[3:52] board on a topic that's not on the agenda seeing none we'll go on to

[3:59] community Community announcements commissioner Community announcements um

[4:05] commissioner P thank you Mr chair uh just a couple

[4:09] items the Historical Society if you've been

[4:15] looking for a new reason to stop by the Cara County Historical Society here's

[4:20] one they are hosting the Minnesota home front World War II exhibit which is on

[4:27] load from the Minnesota Historical Society

[4:31] come on in and take a look at what the home front here in Minnesota was like

[4:37] while the country was at war in 19 in the

[4:42] 1940s the Museum's located at 555 West First Street in wakona

[4:49] and the hours are 9 to 4:30 Monday through Friday and 9 to2 on

[4:56] Saturdays also the car County Library uh they're jumping right into

[5:03] 2024 with something for our teens they're offering a scholarship essay

[5:09] workshop on Saturday January 6 this will be an online class from 10:30 to noon

[5:16] and will be taught by The Loft students will prepare to write their college

[5:21] scholarship application essays by exploring their personal narrative and

[5:26] how to tell their story in a compelling way additional details can be found at

[5:33] www.car caror live.org and um want to wish all the staff and

[5:41] everyone at Carver County happy New Year any other public announcements commun

[5:45] announcements Mr chair commissioner I myself on uh given my reasons for my

[5:50] vote so I use a few minutes to talk about that now uh on the nomination

[5:54] process the last three years and you'll see it also in the um packet for today

[5:58] for proposed agenda an announcements you're see an increased movement of

[6:01] other County boards um other City councils other townships to move towards

[6:05] a rotation process to take the politics out of who's going to hold the Gabel to

[6:09] create Clarity for staff so you can anticipate the future so in the course

[6:14] of the last 20 two years now um one commissioner district has been notably

[6:20] uh uh absent from holding the gavel I think everybody who dly elected should

[6:24] have the same burden and benefit of holding that gavel I also think that six

[6:28] out of the last nine years years the vice president has moved to the chair

[6:31] creating again a chance for the staff to know who's going to be the leader and

[6:34] hold that gabble throughout the course of the year so for those reasons I did

[6:38] not vote for the nomination because Tom should have moved into the chair role

[6:42] and then either District Four or District three should have moved in the

[6:44] vice chair role to be here for 2025 other announcements that I had over

[6:49] the course of the holiday I had a chance to be out in about in a number of our

[6:52] buildings and talk to a lot of our staff had a see chance to see the new Paradise

[6:57] Commons building at Lake ponia it looks beautiful signage is up um that's been

[7:01] quite an Endeavor not only for the acquisition of that property over the

[7:05] course of 20 some years but also the development of it and Marty and his team

[7:09] have led that I'm perfect at times but um it's a beautiful building and I hope

[7:13] our community gets great use out of that had a chance to go to the First Street

[7:16] Center that sometimes we forget about it's our mental health facility and I

[7:20] know that that's on the horizon for when it comes to space planning but um that

[7:23] business that building was active out of necessity around the holidays and uh

[7:28] pardon me said say that in this sense that it's a necessity throughout the

[7:32] holidays some of us had the luxury of stepping away from the office taking

[7:35] some time off being with our families um the instances of mental health and

[7:38] mental health challenges um elevates at this time of year so appreciate the

[7:42] staff that were there had a chance to be at the government center and meet with a

[7:45] ton of people the DMVs and the libraries libraries were packed and the DMV was as

[7:49] well and so um Dave and your team thank you for that um scheduling has been a a

[7:55] chance for us to to get more people through that door um in as much as I

[7:58] would have liked that to be an empty room where people in and out there's a

[8:01] high demand because I know that we're delivering good service there so thank

[8:04] you to your teams had a chance to be a lot of gatherings and I think a lot of

[8:07] times we go to a lot of things right we go to the alliance club we go to the

[8:11] legion we go out and about in the community um but it's what we bring back

[8:14] to this boardroom and make an impact of and the two common themes that I heard

[8:17] among all the Gatherings that I was is number one overall affordability

[8:21] including taxes not just um the taxes that we decide the city taxes Township

[8:25] taxes and otherwise and how it's impacting Our Youth and our Next

[8:29] Generation being simply unaffordable for people to live here and the second theme

[8:33] I heard over and over and over and over and over again was mental health in our

[8:37] in our um world um not just from a perspective of HHS but also from law

[8:42] enforcement attorney's office families Etc it's something that's pling us in so

[8:47] many ways our county is the gold standard when it comes to addressing

[8:49] those things um I want to wish Happy New Year to all the staff um and the people

[8:54] that are watching the community and also wanted to underscore the importance and

[8:59] the impact of not for-profit Civic organizations Faith organizations and

[9:03] the Partnerships that we have a number of those were elevated through this

[9:06] holiday um one of that I'll elevate my daughter and I volunteer every couple

[9:10] weeks at the Bountiful Baskets U their demand is up almost two times from last

[9:14] year that doesn't mean that there's two times more people um that are trying to

[9:19] find a a way for free food it means that there's two times more need in our

[9:22] community and so I think it's Our obligation and opportunity as a board um

[9:27] to address those and again in so many ways we done that with a good standard

[9:30] and all those people in the room right now I've done that I'm looking at

[9:33] Heather I'm looking at Sheriff camon I'm looking at Sarah these are not easy

[9:36] things to do and their needs within our community that will get bigger not

[9:39] smaller in the next year so thank you chair thank you commissioner urman any

[9:45] other public announcements this morning um with that we'll continue on with our

[9:50] oh wish everybody a Happy New Year um and hopefully this next year will be

[9:55] even better than the one we've had last year item number two agenda review and

[10:01] adoption chair I move approval with one exception I had asked A2 to hold from

[10:05] consent and move to regular agenda so we can see that

[10:09] presentation we have a motion with the the switching of

[10:14] item what 8.2 to 9.2 any second we have a motion add a

[10:29] amendment change including that and the addition of of a library board applicant

[10:34] CDA applicant and the proposed changes to the operating rules attorney except

[10:39] from the amendment thanks okay we do have that in front of us um any

[10:45] discussion on that motion all in favor of the motion uh as

[10:50] stated say I I I oppose motion carries item number three 2024 board operating

[10:58] rule rules with that I'll turn it over to administrator hemp thank you Mr chair

[11:03] as we ask you to do every year and you required to by State Statute we have the

[11:10] proposed operating rules in your packet the only changes that I

[11:17] proposed are listed on page five of your packet by the way there are a couple

[11:22] page numbers so I'm referring to your packet page page five of your packet

[11:26] where we're clarifying that outside of the metro area overnight expenses

[11:31] associated with conferences are eligible for reimbursement that's the way we've

[11:35] been handling it we just added that clarification to make sure everybody

[11:40] understands that and then on page 11 of your packet there's a change related to

[11:44] the youth Library board appointment to clarify the timing on the age

[11:51] restriction 18 and under which we bumped into this past year so those are

[11:56] relatively simple changes and then again you should you should have a hand out in

[12:01] front of you and that was distributed proposing other changes that

[12:06] those proposed changes were made by commissioner wman so I'll stand for

[12:11] questions any questions for administrative he on proposed

[12:16] changes if not um is there we can either take it the mo have a motion for the

[12:25] whole uh accepting the whole operating rule or we can um talk about each

[12:31] section by

[12:35] themselves what's the wishes of the board at this

[12:43] point I think there excuse Mr the relatively minor changes I would move

[12:48] approval okay we have a motion by commissioner Lynch is there a

[12:53] second go ahead just for discussion we're well we should have a second

[12:58] before we have

[13:01] discussion I I second including the um proposed changes that were

[13:07] presented okay we have a motion and second to approve the operating rules as

[13:12] for presented by m administrator hamy now discussion commissioner F yeah I I

[13:17] just wanted to make that clarification it's not what's on the agenda propos

[13:23] agenda amendments that are in front of us we talking about what's in our

[13:27] back I believe that's correct because those are coming up at

[13:32] 9.2 my second uh was to include the items that were number three um and pull

[13:38] them in in totality for the board operating if that wasn't your intent Tim

[13:42] then I withdraw so I will second Mr Lynch

[13:49] motion okay we have a motion made and second I there discussion on the

[13:53] proposed operating rules as presented by administrator hem Mr ch just seek a

[14:00] Clarity um if if these were to be passed as proposed and seconded um would these

[14:04] be on the table as well they would not uh Mr chair commissioner they would not

[14:09] if you want them on the table that would be an amendment to the main motion you

[14:13] can do that in a few ways one would be to just propose the whole list of

[14:18] changes or you could propose one at a time or a couple at a

[14:23] time but U the key is that you're amend you're proposing to amend that main

[14:27] motion so I'll use a few minutes to explain

[14:31] these um they shouldn't come as any surprise because them multiple times um

[14:37] in E under officers I'm proposing to take the politics out of the rotation

[14:41] for officers I give the staff ability to plan ahead see a natural rotation that's

[14:46] predictable and and some points that were made in our last board meeting

[14:49] quest for transparency um the full full uh context can be shared there under G

[14:55] monthly expense allowance um again it was brought up in a previous meeting

[15:01] about prudent use of taxpayer dollars and transparency at that time we

[15:05] Revisited a um policy that was established before my agenting the board

[15:09] in 2008 where every commissioner was uh granted $4,000 of expense on a yearly

[15:15] basis and if they put those items on the agenda um in the beginning of the year

[15:19] we didn't have to drag those throughs on an individual basis that also applied to

[15:22] any other elected office U and their ability to put those items down that

[15:26] item passed um but what did not pass and was not accepted um was the transparency

[15:32] of the monthly allowance that we use or each issued a monthly allowance um to be

[15:36] used out of leisure The Proposal says each commissioner shall be allocated an

[15:40] annual conference and training budget with an amount to be determined

[15:43] according to the annual budget process conference and training funds not used

[15:46] by an individual commissioner during each respective budgetary year will be

[15:50] returned to the general fund at current There's an opportunity if for instance I

[15:54] didn't use mine I could offer it to Tim if he was using double the amount and so

[15:58] that's my my proposed amendment another language is uh current um we each get a

[16:03] stien for our cell phone a number of board members utilize uh additional

[16:07] dollars above and beyond our stien for printer cartridges and other expenses my

[16:12] proposal says cell phone expenses printer cartridges along with any

[16:15] expense $50 or less are not eligible for reimbursement and can be paid for out of

[16:19] that monthly allowance next item is broadcasting it's come to my attention

[16:23] that there's a growing number of cities townships and counties that are using a

[16:27] best practice that gives um board work sessions the ability to be observed um

[16:31] from people that don't have an ability to get get to the boardroom um and can

[16:35] be seen and so my language on that one is all regular meetings of the Carver

[16:38] County Board of Commissioners are streamed live and recorded for on demand

[16:42] viewing via YouTube All Work sessions are streamed live with the option to

[16:45] join remotely I'm calling to order to the meeting and to the adjournment of

[16:49] the meeting's regular session again a best practice it's seen by a lot of

[16:52] others next up is preparation and distribution I think we talked about

[16:56] this on a couple of occasion my proposed languages the County Administrator shall

[17:00] include an item on the proposed agenda at least three days prior to the meeting

[17:03] for which the agenda is to be prepared any person for any reason at any time

[17:06] may move any consent item to the agenda and then a duly elected official may add

[17:11] any agenda item that may have material impact or requested by the district or

[17:16] uh County stakeholders at current I believe we're only the only city

[17:19] Township or county that doesn't allow anybody to pull anything off consent and

[17:23] needs a first a second and a majority vote I believe that that flies in the

[17:27] face of a representative democracy um and then finally if we move

[17:31] down uh to the last item which is uh proposed uh to move ahead the board

[17:37] packet you know sometimes we talked about um transparency we also talked

[17:41] about uh being able to have a chance to adequately review couple times during

[17:45] the course of the year that wasn't the case for reasons that were Beyond us um

[17:49] but what I'm proposing is the board agenda packet including meeting agenda

[17:52] and supporting materials shall be received digitally by each member of the

[17:55] board no later than Friday preceding the regular Tuesday meeting I think far too

[17:59] often we receive some items on Monday or Tuesday that could have been received on

[18:02] Friday with adequate time to digest so I will ask that a friendly Amendment be

[18:08] inclusive of these things that were uh put the taxpayer first Le transparency

[18:12] they're predictable give us a chance to plan ahead and give some certainty for

[18:16] our

[18:19] staff is there a motion that is a motion um to accept all those after a unit

[18:28] excuse me we have a motion and a second to accept those as a unit any more

[18:35] discussion on the now discussion on the amendment yeah I guess I'm confused

[18:41] because there was a motion second on the floor then there's another motion second

[18:45] do we have two on the floor I thought a Bard Opera rules am if I understand

[18:50] commissioner urman is amending the original motion oh okay I do not wish to

[18:54] accept the amendment you wish to come in this

[18:59] no I at this point uh we have a second to the amendment so now we're having

[19:06] discussion on the amendment the amended motion and your point is you

[19:14] would uh commissioner uh Lynch what are you saying on original motion maker I do

[19:20] not accept the amendment I believe these are unnecessary we've operated without

[19:25] these uh rules yeah but at this point commissioner Lynch uh you don't have to

[19:29] accept oh okay yeah it's we're going to vote on the proposed

[19:34] amendment and it's any other discussion on the

[19:39] proposed amendment all I can say is there's a lot

[19:44] of these items that are listed there some that have um more in my mind

[19:51] legitimacy than others but as a whole unit um I can't support the whole unit

[19:58] being passed at that point any other discussion on the proposed amendment

[20:04] seeing then all in favor of the proposed amendment say I I I oppose I I motion

[20:11] fails the amendment fails uh on a two to three vote now we're back to discussion

[20:18] on the original amend the original proposed

[20:24] um moot main motion thank you motion any more discussion on the propos

[20:32] uh the main motion seeing none all in favor of the M

[20:37] motion say I I I oppose I I motion carries 3 to two with that we have the

[20:46] operating rules in order item number four then moving on

[20:51] the agenda is the adopt the schedule of the regular meetings for

[21:28] again Following last year's pattern is basically what we have in front of you

[21:38] November last year do we need to move that this year to the 12th or should we

[23:38] Mr Hemy Lyndon rajant and Heather Goodwin AMC Metropolitan governance tax

[23:46] Force kitchen cabinet I'm unable to attend that meeting okay is there an

[23:52] alternate that or somebody else would like to take commissioner Workman spot

[23:56] on that kitchen cabinet do you commissioner Workman can you tell

[24:00] us when those meetings probably would be meeting right now about every week at 3

[24:09] o' what day any other day of the week uh let me check Mr chair I'm I I've

[24:16] been participating in those by the way and I will continue to do that and they

[24:20] will be wrapping up once the task for I think once the task for once the main I

[24:27] what the call the the main panel makes our recommendations to the

[24:33] legislature double checks if I have remind everybody M commissioner

[24:39] Workman what the the kitchen cabinet what their main goal

[24:45] was uh this this was an expanded group uh to create input into the legislative

[24:53] request to review the Metropolitan governance uh

[24:59] they I think AMC appointed Bingham from Washington County if I'm correct so this

[25:05] so this group the intent of this group was to have a voice by the remaining

[25:10] Metropolitan counties to in particular bangham as she is it bigam as she uh

[25:16] provides direct input into the into the main group making recommendations to the

[25:22] legislature so I think it is important to have uh for me to have some

[25:26] assistance from a board although you don't need to participate in every one

[25:30] of these but other Commissioners are attending anybody showing interest uh Mr

[25:37] chair I do see at least one meeting January

[25:41] 22nd it's a Monday at two o'clock I think they time had

[25:49] mentioned weekly there's yeah there's one on J

[25:53] Monday January 8th at 2 o'cl so it looks like Monday's at two weekly at least for

[25:57] the next month or

[26:01] two to get ready for the legislative session to provide input uh into the the

[26:06] main individual from Washington count anybody have an interested joining

[26:14] that group at Mondays sounds like 2

[26:19] o'clock these are remote meetings

[26:23] also if not we'll leave that one open for now

[26:29] yeah Mr chair what I would do then is I prer back to who's ever on the

[26:33] legislative committee or for guidance if needed we'll see where that that group

[26:37] ends up they're getting into some pretty uh they're getting the weeds some the

[26:42] issu so I I feel like I'm venturing a little far sometimes so I'll I'll Circle

[26:46] back to the legislative committee if we don't have an appointment there sounds

[26:49] good um that board of directors I'll stay on that commissioner udman you want

[26:56] to be alterate that's fine um Arts committee order R and Workman that's

[27:02] fine okay uh CDA Fe you know before we do that one yes Mr chair um this is such

[27:11] an important board and and I know that we're in a state of flux for a lot of

[27:14] reasons and it's probably the most dynamic decade if CDA is not only

[27:18] because of the dollars and the things that have been approved um but also the

[27:22] the future need that's here and I just did a quick look um our lays on in the

[27:27] last half of the year um did not attend half of the meetings for that CDA I

[27:31] think we deserve better there so I'd be happy to step up and be that role for

[27:34] the CDA this

[27:38] year Well commissioner F you were on there um you want to give that up or you

[27:43] want to stay on the CDA at this point I would like to stay on it um Mr chair and

[27:51] yeah just unfortunate with the schedule and other meetings that took place

[27:59] definitely do enjoy the the CDA

[28:05] and um with your long history on the CDA and you're right uh CDA is going through

[28:11] some obviously uh important times in the for

[28:16] the county uh we'll point point we'll keep

[28:21] um we'll point fahe to that and keep udman commissioner udman as alternate at

[28:28] this point Mr chair I just ask I think it's just inferred and assumed but

[28:33] professional courtesy to let me know if you're aable to attend JP thank you that

[28:36] is correct if if the man person man commissioner is unable to for whatever

[28:42] reason uh that's why we do have alternates and uh we should utilize them

[28:49] that's for sure and also Mr chair if there is any other board member that's

[28:54] interested in being the alternate for the seat da if uh I would be open

[29:00] for any individuals that would like to do that okay thank you I will keep that

[29:05] on the list uh CDA has always been obviously an

[29:10] important issue for the county Mr shair just a point of clarification this is a

[29:17] required vote for these appointments and you typically do that as a

[29:21] slate if there is disagreement I would suggest removing any any individual

[29:28] items and that would require a motion second and and majority vote okay let's

[29:34] vote as a slate but at this point I'll make a motion that we appoint

[29:38] commissioner fahe as our representative and commissioner udman as our alternate

[29:44] and uh myself as an alternate uh second alternate a second

[29:49] alternate at this point is there a second to that

[29:53] motion second uh motion made second any any more discussion on

[29:59] that if not all in favor of appointing commissioner fahe as the uh designated

[30:06] and Alternate would be commissioner udman and I'll be a second Al alternate

[39:59] seems like 60% of the time we're missing our meetings are we really at service of

[40:03] the people I just have to ask that I I don't know that I could support um I

[40:08] don't know if I could support the current

[40:11] appointment and since I'm excuse me Mr chair since I'm the chair or the liais

[40:17] on to that committee and there again with various conflicts with the

[40:21] scheduling just with the knowledge base and I bring to that board and just to be

[40:28] able to work with the staff in a very positive way and I I don't think it

[40:34] would be very helpful with uh the disrup disruption that take would take place

[40:42] if okay at this point the appointment is commissioner FEI and alternative

[40:48] commissioner Lynch Mr chair it's not just a lay on it's the only um sizable

[40:53] board that it's a voting member so it really puts our our staff at a

[40:57] disadvantage when we're looking for a quorum or a number of votes so um I I'd

[41:02] like to take that one to a vote if you don't mind okay

[42:34] is very correct on pointing out many times uh Carver County in a lot of

[42:41] meetings I'm ask the same thing hey where is your other appointees to not

[42:48] only the committee that I have to be sitting on but at some of these other uh

[42:52] board meetings and uh it is important uh we were um and we should be continuing

[43:01] to go uh our work isn't just today it's our work is um out of these committee

[43:08] meetings that we attend um with that Mr

[43:12] chair agree it's important but uh you do have an

[43:18] agenda the format listed in your operating roles so if you go back to

[43:22] page 10 of your

[43:25] packet item Item B the board wants to formally change

[43:30] that that was formally changed well it's been quite a while I don't remember 10

[43:35] plus you see the the format okay so my suggestion of putting reports at the end

[43:42] of the meeting um since we already approved the order we don't have to

[59:17] the uh the board action narrative that's in your packet sufficiently outlines

[59:23] what uh what I intend to do and and uh the rationale for it um but I I do want

[59:31] to provide just a little bit of added context and and a little bit of backdrop

[59:36] frame it up for you the decision making process yeah explain to the public who's

[59:42] listening that have doesn't have the background information that you provided

[59:46] to us uh what you try to do so there are in in the law enforcement World there

[59:53] are typically as a Rel to Firearms programs there are agency issued

[59:59] Firearms it's really common and employee owned Firearms is also really comp and

[1:00:07] so there's really not a right or wrong way to do it it's just agencies make

[1:00:14] decisions based on what seems to work for them larger agencies typically have

[1:00:20] agency issued Firearms smaller agencies typically are

[1:00:26] employee so looking at Carver County going back to the 90s you might remember

[1:00:31] in the 80s and earlier cops all carried revolvers around the late 80s early 90s

[1:00:38] then semi-automatic kind of became the norm and and in caror County we had

[1:00:44] employee owned revolver semi owns I can only go back to 1990 because that's when

[1:00:49] I started I I remember this um and so we went went with that and we had employees

[1:00:55] who carried revolvers all through the 90s and Bud Olson was elected sheriff in

[1:01:00] 98 began his term in 1999 and and somewhere around the

[1:01:07] 2000s uh he drove the agency to get out of the revolvers entirely and every

[1:01:15] employee uh or deputy sheriff would carry a sem my auto we did some work

[1:01:20] internally and decided would be two models

[1:01:25] from each of two manufacturers for a total of four right Sheriff I hate to

[1:01:30] interrupt but some people don't know what's the difference between a revolver

[1:01:34] and a semi-automatic yeah well I I appreciate that uh you know um I'm not

[1:01:40] really sure how to explain it other than one is a firearm that has a cylinder

[1:01:47] with bullets in it and as you pull the trigger the cylinder rotates and

[1:01:52] presents the next like you movies like you would see in the in the Spaghetti

[1:01:57] Westerns right and a semi-auto it feeds the bullets from the bottom typically

[1:02:03] and as the slide comes back it ejects the spent cartridge it loads a new

[1:02:07] cartridge and and you fire it it that way um both basically have the same

[1:02:14] function though in so far as uh you know there's the there's the grip end of it

[1:02:20] and there's the dangerous end of it and pull the trigger bullets come out the

[1:02:23] dangerous that's that's a gross simplification but to just help with

[1:02:28] that so so anyways going back um Sheriff Olson drove bu Olson that is drove the

[1:02:35] policy to two manufacturers two calibers of ammunition

[1:02:43] and um so that that narrowed it down quite a bit for us and everybody was

[1:02:48] carrying semi-auto it was also Deputy owned and well if you for those who work

[1:02:54] with bu and he really liked a freezed in approach to things so he would set

[1:02:58] things out and it would take a couple of years to get to the end game of

[1:03:02] everybody there but that was Bud's methodology and it worked and and

[1:03:08] uh and so that's how we got to where we are today with employee owned semi AAS

[1:03:14] now what happened over the years is technology Chang manufacturers came out

[1:03:19] with different products uh employees started to you know they like this

[1:03:24] firearm over that and and frankly they're all pretty good Firearms it's a

[1:03:30] Chevy Ford Dodge pickup argument if you ask me they're they're all pretty good

[1:03:35] today and um

[1:03:40] we so because that happened and this was over B Olson and Jim Sheriff Jim wison

[1:03:45] we started to add more firearms and add more and more and more and the deputies

[1:03:49] were coming every year with oh we want this and we want and so I made a a

[1:03:55] policy decision shortly after being elected that I really just want to

[1:04:00] regulate the ammunition because the that's the part that is the most

[1:04:07] concerning on the if there's a youth is the ammunition that actually does the

[1:04:14] creates the wound cavity and and um whatnot and it also then ended the

[1:04:21] argument of should I have a Chevy or afford or you know pick your brand right

[1:04:28] and um it also as we were recruiting one of

[1:04:34] the things that we hear when we hire new employees is yeah great come work for us

[1:04:39] now you got to go buy this firearm that they may not already own and so their

[1:04:44] startup cost to be a new employee is over

[1:04:49] ,000 give or take depending upon which make and model they choose

[1:04:54] and so that's a that's a little bit of a a hit when when you're hiring um and so

[1:05:00] by allowing them to bring in a firearm they Pro they may very well have already

[1:05:04] owned um and it opened up options on the price scale too by adopting that policy

[1:05:11] U that seemed to be an okay solution at the time so fast forward so 2022 is uh

[1:05:21] 2023 there there's the one of the more common popular law enforcement

[1:05:28] firearms um is currently in litigation over the firearm

[1:05:33] discharging um without operator input and generally speaking when we H when we

[1:05:40] see an unintentional discharge we almost always assume it's operator air and you

[1:05:47] know the gun doesn't go off unless your unless your finger or something else

[1:05:51] pops the trigger right I mean that's just the general mechanics of and

[1:05:58] um and so we left it at them said okay they'll sort it out if it's a design

[1:06:02] flaw whatever it'll get sorted up and then we started seeing videos on

[1:06:09] YouTube uh where it's this is actually a pretty good video where a young woman

[1:06:13] it's a cop in somewhere in the south is carrying her firearm she asserts

[1:06:20] bolstered in her Duty bag she's walking through the the uh police parking lot

[1:06:26] and the firearm goes off in the back shoots her in the

[1:06:29] pelvis um and it's the security camera from the police parking lot is how we

[1:06:35] captured this or how they captured that well she asserts it's in the holster

[1:06:42] everybody else says it couldn't have been it wouldn't have happened I don't

[1:06:45] know it's under litigation there's 100 PL DS against the manufacturer so but it

[1:06:51] but because I saw this video of clearly I mean you can see she's just carrying a

[1:06:54] bag and it goes off so that prompted me to go all right well now what because I

[1:06:59] know more than half of our deputies carry that particular

[1:07:04] model so I talked to a risk management who consulted with

[1:07:09] mcit and mcit being risk averse says well The Prudent action is to not

[1:07:17] allow fire okay fair enough now would so I went to the um

[1:07:24] employee relations Mr Hemy and uh we contacted the union because they're

[1:07:30] employee owned we went and said look we we have

[1:07:35] this problem we're not interested in any uh unintentional negligent discharges of

[1:07:40] these Firearms more than half of you carry them uh and we made an offer to

[1:07:47] either provide uh early uniform allowance because uniform allowance is

[1:07:52] paid in July we said we would pay in January and you

[1:07:57] could use that money to purchase a new firearm the idea is to get these out of

[1:08:01] our inventory and sooner than later or alternatively we offered to provide an

[1:08:09] interest free loan where you will give you the money go buy the firearm will

[1:08:14] withhold whatever the amount is out of your check to get it paid off in 18

[1:08:18] months or whatever you agree to uh and the

[1:08:22] union um

[1:08:27] declined I guess is how to say you know there's uh in in their estimation there

[1:08:32] is no problem so big that it cannot be resolved with giving their members more

[1:08:38] money and I didn't want to just hand over money to the Union to the

[1:08:43] membership uh without getting even a a if you're going to own it we're going to

[1:08:48] do it that was going to be a quick easy S no added cost to the taxpayers

[1:08:55] and I I looked when they declined that that prompted me to before I made that

[1:09:01] decision really look into it and decide and and figure out where we were

[1:09:08] at so what I learned is uh and you probably won't hear many

[1:09:13] elected officials uh make this admission but the policy decision that I made to

[1:09:19] regulate ammunition and not makes in models of

[1:09:22] firearms got away from me was probably not the best decision I ever made and we

[1:09:28] looked at the numbers of firearms and what they're carrying and the calibers

[1:09:32] and what that means for training uh because now if if uh if I'm the Firearms

[1:09:39] instructor and and commissioner Workman is having problems shooting or has a

[1:09:44] problem with the firearm now I kind of have to learn how his firearm functions

[1:09:49] to help him get through this training glitch or or whatever and so there's

[1:09:54] just some inefficiencies in there that that I failed to anticipate but

[1:10:01] um still had the same issue with new employees uh walking at the startup cost

[1:10:07] um because whether it's a, firearm or $500 firearm still come work for us go

[1:10:15] spend your own money first um also I have some employees who are proficient

[1:10:20] Shooters but they're swapping they're in and out carrying this gun that gun

[1:10:24] uh periodically throughout the year and I find that to be a problem

[1:10:31] so having that's what brings us here today recognizing that we have an

[1:10:37] obligation to provide our deputies a safe reliable firearm program looking to

[1:10:44] move to agency issued Firearms um I think what it does is it

[1:10:49] standardizes the uniform equipment uh issue sort of thing it standardizes the

[1:10:55] ammo purchase we currently buy three different types of ammunition calibers

[1:11:01] that is 94045 or the three that we carry we'll limit that to just one which

[1:11:08] creates some efficiencies and savings because we're buy we always buy in bulk

[1:11:14] but when you buy more of one in the bigger bulk it's gets a little bit

[1:11:17] cheaper um standardizes the maintenance I you know I don't have uh a number that

[1:11:25] I can put on it but when if we all have the same

[1:11:30] firearm I can have one or two employees who are armors who are able to

[1:11:36] disassemble repair replace the the typical parts that break I can do all

[1:11:41] that really easily inh housee when I have eight 10 12 different manufacturers

[1:11:48] having people who are trained and certified for all of those different

[1:11:52] manufacturers gets to be a little bit of a glitch and um I don't really have an

[1:11:58] appetite to send them all out for third party repairs uh Min uh minimize the

[1:12:06] startup cost for new employees I think that's a pretty big deal uh retention

[1:12:10] for evident evidentiary purposes uh this sounds silly and hopefully we don't ever

[1:12:15] have to do this but when an officer involved is involved in a shooting and

[1:12:22] this person dies it's ruled a homicide as a matter of

[1:12:28] routine we retain all evidence of homicides

[1:12:33] forever we don't dispose of it what I learned in a in a different

[1:12:39] officer involved shooting was we don't have the lawful authority to do that

[1:12:45] with other people's property so the if the employee

[1:12:51] says I want my firearm back we have to give that to them I mean we could

[1:12:57] litigate it but we're going to lose is I think is the direction the county if if

[1:13:01] the last case is an indicator uh perhaps in a change in the

[1:13:06] law we're going to lose that and um I think it's important to keep to retain

[1:13:13] that evidence for

[1:13:18] uh you know for trials for defending ourselves civil action but also you know

[1:13:25] save it forever in criminal cases because of the appeals processes and uh

[1:13:30] you know the any allegations wrong F Brit any of those sorts of things so

[1:13:37] um if we own the Firearms it's ours we can take and put it on a

[1:13:43] shelf and so anyways um it eliminates Arguments for increasing allowances uh

[1:13:51] in for uniform allowances to maintain equipment one of the things we do is as

[1:13:55] we ask employees to add components like this we there's a as technology improves

[1:14:03] there's a sighting system so we call it a red dot sighting system basically it's

[1:14:07] a head up heads up display you look through a loop and it there's a Red Dot

[1:14:12] in that Loop and once it's cited in wherever that red dot is is where the

[1:14:16] bullet is going to go um pretty accurate it's really fast it improves the

[1:14:21] shooting accuracy speed in proficiency so we asked our employees to put that on

[1:14:27] well we're 500 bucks 300 bucks whatever they are and of course the employees

[1:14:32] walk at having to add that even though they have a generous uniform allowance

[1:14:38] they even done as argum to increase that so um and it's a fair argument because

[1:14:43] it is an expensive thing so

[1:14:49] anyways all of that combined um I just think that it it agency you know has to

[1:14:56] weigh these decisions personal Firearms agency owned I think the there's no

[1:15:01] right answer um but it's a judgment call and in my judgment I think we are best

[1:15:08] served through agency Firearms now that was a long way to get to I'm asking for

[1:15:15] in the board in the the RBA $992,000 to uh from and it's there's a

[1:15:21] typo in here it's actually 20 22 year end savings we don't know what 2023 is

[1:15:26] yet because we're only the second day into this year it hasn't been

[1:15:32] calculated um but I'm asking for the board to approve the funding from that

[1:15:37] piece which gives me some budgetary flexibility in

[1:15:41] 2024 and with that stand for S questions for the sheriff Mr CH a couple question

[1:15:49] CH I learned a lot I guess I'm guessing the audience did as well I didn't I

[1:15:52] didn't know a lot of that so thanks for the history thanks also as a leader that

[1:15:55] says I might not got it right and now you're getting it right that's rare

[1:16:00] three questions one what happens the old guns um two um the replacement cost is

[1:16:05] that something we should budget and plan for and three if this is typically a

[1:16:09] bucket that comes out of the uniform are we able to pull back dollars associated

[1:16:13] with that because we'll now be Furnishing the firearm uh three

[1:16:17] different questions no excellent question so uh the Firearms currently in

[1:16:22] play are employee owned and so they would continue to own them and and they

[1:16:28] can do whatever they choose with with those Firearms

[1:16:33] um this there was one about the pulling back I I think that you know that's a

[1:16:39] the the uniform allowance is a collective bargaining issue um and I

[1:16:45] think that would be something we would have to have that that the negotiating T

[1:16:49] how that's going to shake out uh you know I don't I don't believe

[1:16:53] then the plan for replacement costs and then the the plan for replacement costs

[1:16:58] um you know yes we will have to have uh some of that built in I would anticipate

[1:17:04] we would work with uh Mr Hemy and Mr frisman to build a plan not unlike we do

[1:17:11] for radios where we look at what the what we expect the life expectancy to be

[1:17:16] and then we just uh squirrel away a little bit

[1:17:21] annually to to build that and roll it year over-ear until we are on the

[1:17:25] replacement schedule what is a typical replacement and my understanding is is a

[1:17:29] lot of firearms hold their value at least maybe even increase is there is

[1:17:33] there a notion that this is a break even so the newer models actually cost less

[1:17:37] than their yeah you know they're um they're not uh the price of them is not

[1:17:43] a budget Buster sorts of things they do hold their value it's all it's a common

[1:17:47] practice to upon retirement sell the firearm to the employee who will take it

[1:17:53] with them um like badges are another one that's kind of a common

[1:17:59] practice um I don't know what the retention or what the the longevity is I

[1:18:05] mean they last a long time uh I mean you know my my dad has all of my

[1:18:12] granddad's firearms and it's you know from years and years ago uh I think

[1:18:18] what's more likely to happen in this circumstance is um

[1:18:24] technology um is going to drive that and so they will likely be cycled out more

[1:18:29] so because of

[1:18:33] changes because of the AG is wearing Care thank you other questions for the

[1:18:42] thorough and the information is there um are the deputies on board with this

[1:18:48] change you know that's that's hit or miss and that's a great question Mr Hemy

[1:18:52] and I have talked about that quite a bit because we've worked very hard to uh

[1:18:56] keep the the work group happy and um you know we're going to have some employees

[1:19:03] who are uh just married to that whatever they

[1:19:11] have it's they bought it because they like it probably and um but I also have

[1:19:17] some employees who have just flat out said if I wasn't a cop I wouldn't own a

[1:19:22] hand income and the only and so they would be happy to receive it um you know

[1:19:30] that the policy has not been finalized yet I think that uh as I look I there's

[1:19:40] a while there is agency issued and employee issued there's always the the

[1:19:44] hybrid model there are some agencies who here's the here's the firearm that we

[1:19:49] issue if you want your own under policy here are the approved models

[1:19:58] and it would be but then through policy it's up to you to own it maintain it we

[1:20:03] assume no responsibility for fixing it we a spring breaks or the extractor

[1:20:08] breaks or any of those sorts of things that's on you and uh you know I haven't

[1:20:12] ruled that out yet as a as a policy decision so we're going to approve the

[1:20:19] agency issued handguns and and the polic is going to come after well you're

[1:20:25] approving the money uh you you might recall sir that the the setting

[1:20:30] Sheriff's Office policy is the sheriff's responsibility your responsibility

[1:20:34] relates to the budgeting and so I I'm looking and what this does is it gives

[1:20:41] me the flexibility I'm going to do this um in 2024 what I would like to be able

[1:20:49] to do is use money from 2022 year and to do

[1:20:54] that thank you any other questions commissioner Lynch um great

[1:21:01] great thorough um my my first I think he answered it already but normally when

[1:21:07] someone leaves employment you usually sell it to the individual or or you just

[1:21:11] turned it in what what is it uh agencies we haven't decided what we're going to

[1:21:17] do yet because we don't do this um some agencies upon retirement will allow the

[1:21:23] person to purchase the firearm and take it with him a three-year employee um

[1:21:29] would be expected to return the firearm okay and then to Gail's question about a

[1:21:34] revolver or semi-automatic and the sheriff was very accurate it's a

[1:21:38] cylinder that spins around but there was a shootout in

[1:21:42] Florida an FBI shootout and that's why the revolver is very difficult to reload

[1:21:48] whereas a semi-automatic uh you slap a new magazine into it it could SP quick

[1:21:53] that's why they switched over to that um I think JP had a great question but

[1:22:00] um my only question is do you really want to go there because you're going to

[1:22:03] have some push back because when you get a a cops coming all different sizes

[1:22:09] people shoot 9 millimeters and 45 and just get used to what you have um you're

[1:22:14] not going to be have a happy person who's a Avid 45 shooter who's going to

[1:22:19] have to shoot a 9 millimeter now but it's it's a your decision sir I would uh

[1:22:24] I can see the advantages of having everything all the

[1:22:28] same yeah I and I appreciate that and those arguments are not lost on me what

[1:22:34] uh what I have found is that those who are average 45 Shooters and are good at

[1:22:39] it they're pretty good with 9 millimeters and 40s and 357 and they

[1:22:44] figure it out right and uh um I look at you know agency issued firearms are the

[1:22:53] norm um with you know let's use the military they got people all different

[1:22:58] shapes and sizes and uh and they pull it off and but you know and that is uh part

[1:23:04] of the reason I'm looking at the Hybrid model of policy is because there there

[1:23:11] will be people who have uh you know perhaps smaller than you know the

[1:23:16] Firearms are generally manufactured for averages right and you might have people

[1:23:20] smaller than average hands it just doesn't fit for them so I have

[1:23:24] to have a workable program for them but I'm trying to get back get it contained

[1:23:31] because as I pointed out earlier it it just it just got away from

[1:23:37] me when Sheriff uh couple anybody else have a question if not I'll wrap it up

[1:23:43] here um when is this policy going to take effect if we approve this to you

[1:23:50] yeah well um would you get these well it's a you know Supply Chain's an issue

[1:23:55] right so we'll have to see to get all of the components um we would have to buy

[1:24:01] the the firearms and and all the components that go along with it um and

[1:24:07] then we have to have a training program for that so that we can get people

[1:24:14] trained up to this firearm um you know it'll it'll take the

[1:24:19] better part of this year to do that okay management and is this just the

[1:24:24] beginning you're talking fire handguns now uh how about rifles and whatever are

[1:24:30] their agency issued rifles and stuff shotguns excellent question and uh we do

[1:24:36] have um the fire the handgun is the

[1:24:43] only defensive weapon that we do not provide the employee we provide them

[1:24:49] with their chemicals their batons the taser the the rifle uh we just

[1:24:58] we we provide every other weapon and the holsters and all that stuff that goes

[1:25:04] along with it um just not the handgun and

[1:25:11] uh you know I can't speak to to how or why that is I I do want to make one

[1:25:16] point of clarification though to make sure that people understand that the

[1:25:21] policy to open up the the Firearms was uh is not what is totally

[1:25:28] driving this and was not at an added cost to any it's just when I looked at

[1:25:34] this whole thing in the totality you just learned some things

[1:25:41] that how it how the policy impacts hiring how the the numbers got a little

[1:25:46] bit out of control I'm trying to shrink that back down a little bit and so

[1:25:50] there's it's the totality of the circumstances not just one issue and

[1:25:55] this is all public knowledge but I don't think you actually mentioned what

[1:26:00] revolver are we looking at um is this something that you want the public to

[1:26:05] know what our Deputy of the carrying around or not sure the intention is to

[1:26:10] go with with a a Glock 459 millimeter I know that sounds weird because 45 also

[1:26:17] happens to be a caliber but it's the Glock model 45 in

[1:26:23] 9mm and uh little bit of trivia for you Glock when they make a new

[1:26:31] firearm apply calls the model sequentially with their patent numbers

[1:26:37] so this is the 45th Glock patent if anybody

[1:26:41] cares and just a little have for Trivial Pursuit somay is Glock an American uh

[1:26:48] product it's an Austrian made firearm that is is uh very common in law

[1:26:54] enforcement and military service globally commission Workman well Mr

[1:26:59] chairman I think more importantly what is the firearm that didn't want to

[1:27:05] behave and kind of caused this I think important to the public is that readily

[1:27:11] available uh it is it it is a uh 6our P320 is the the firearm and the model

[1:27:20] and I want to be very clear on this point that it is it's an allegation it's

[1:27:25] in litigation sigar is saying there is no problem with the firearm the 100 uh

[1:27:32] plaintiffs are asserting that there is I don't know there's a question mark next

[1:27:38] to it there is not a question mark adjacent to any of the designs

[1:27:43] of the other models that are currently in use in

[1:27:48] in I think we all learned more way more about revolvers and Firearms than I ever

[1:27:54] anticipated but I appreciate you all reminding me that I am for

[1:31:01] to talk about the creation of a Communications Department within our

[1:31:06] Public Services Division this has been a little while in the coming uh I've been

[1:31:10] working on many different plans on how to fill a vacancy and looking forward on

[1:31:16] how we can best serve uh Carver County residents really the goals of this uh

[1:31:21] change are three uh one is to enhance overall County

[1:31:26] communications one uh the second is to Foster consistency and communication

[1:31:31] across our organization then the third is to

[1:31:34] leverage a higher level of expertise in communication

[1:31:39] strategy with that uh the main item I'm proposing today is to elevate the

[1:31:45] currently vacing Communications manager position that was held by Eric

[1:31:49] previously to the chief Communications officer to manage this new Department

[1:31:55] within public services division other Staffing would include two new positions

[1:32:00] that were included in the and approved in the 2024 budget that includes the

[1:32:06] part-time communication specialist and then a full-time communication

[1:32:09] specialist within the public uh works department two existing employees would

[1:32:16] also report to this department that would be the Public Works communication

[1:32:20] manager that's Sarah position currently and then the planning and water

[1:32:25] management senior Outreach and engagement specialist That's mine's

[1:32:29] position for reference today's request does not

[1:32:34] increase the total FTE allocation what I'm looking to do is to elevate one of

[1:32:39] the existing positions all the other ones are currently approved in the

[1:32:42] budget it actually slightly decreases because I'm looking to our stock funding

[1:32:50] for this so overall wanted it would slightly decrease that t allocation but

[1:32:55] again within this area of more moving things around an elevating

[1:32:59] position so with that elevating of the position from the communications manager

[1:33:03] to a chief Communications officer that has a fiscal impact of an increase of

[1:33:10] $3,841 79 with that I am providing funding

[1:33:15] options within the Public Services Division this includes $122,000 for my

[1:33:20] Professional Services line the reason for that that I'm

[1:33:25] proposing that is we have not utilized those funds in several years

[1:33:29] historically some of those funds have been used for Architects and space

[1:33:33] planning but since we did a massive space plan my thinking is we won't need

[1:33:37] those funds going forward then also some of those funds include cable casting and

[1:33:42] with our am upgrade we're going to be bringing that cable casting service in

[1:33:47] house once we have that upgrade made so there'll be some cost savings there as

[1:33:51] well in addition I've proposing

[1:33:54] $715 to come from the facility stock stock is seasonal temporary

[1:34:00] onf if you remember earlier last year we did a reor within facilities this $

[1:34:07] 7,155 was the savings for that we put that in stock to hold that for future we

[1:34:14] were thinking maybe getting a seasonal at this time I don't think we'll utilize

[1:34:17] those funds so I propose that we utilize them for this instead

[1:34:22] then the last one is a extension stock with

[1:34:25] $468 79 if you remember several years ago we

[1:34:30] had two admin support staff within uh extension we reduced that down to one as

[1:34:37] part of that budget move we move some funds to the stock budget that way if

[1:34:42] that person's off on vacation or needs extra help we can utilize uh those funds

[1:34:48] for that looking at historic Trends we haven't been using all those funds so my

[1:34:53] propos propos us to take some of those funds and to utilize it to help P this

[1:34:58] position for this change so with that Mr chair my uh

[1:35:04] recommendation is a motion to create a Communications Department of Public

[1:35:08] Services eliminate the vacant 1.0 FTE Communications manager create a new 1.0

[1:35:14] FTE Chief Communications officer and approve the associated budget amendment

[1:35:19] request form any questions for Mr kabi Mr chair

[1:35:25] m i I think this is the right move I think it's an indication of the growth

[1:35:28] of our County and and stepping into the next area I know that you spent a lot of

[1:35:32] time in diligence looking at this one of those being you know is it a competitive

[1:35:36] wage should track the right candidate so I appreciate all the effort on it I know

[1:35:40] that um particularly in lyndon's group there's a lot of money spent to let the

[1:35:43] public know tell our story right what are we doing how are we doing it I know

[1:35:45] chasa just went through a significant amount of that and it's hard to measure

[1:35:49] that savings you know like when when the community is engaged and they're not you

[1:35:54] know pounding your front desk with a bunch of calls because they're proactive

[1:35:57] is there a way that um that we can make this partially unfunded by Levy by way

[1:36:03] of billing it back to a road project or billing it back to a different

[1:36:07] project you know I defer to L I can't remember it's part of the exting sales

[1:36:12] is coming from the sales ta okay s's this but like the can we do

[1:36:17] a part just make sure we get this on uh yeah yeah could you please come up

[1:36:22] explain how the public work some of that is maybe would you practi pay for the

[1:36:27] chief Communications officer I guess is the question oh right yeah I know that

[1:36:32] Mr chair Commissioners that the new position funded in 24

[1:36:36] specialist that one is funded with Road and Bridge CIP funds okay as well as

[1:36:41] cers as you know okay yeah so like net I think the taxpayers are getting a better

[1:36:45] at a benefit and they're not paying the full cost of it I mean directly through

[1:36:48] Levy guess that's the point thank you lynon um the other things I kind of

[1:36:52] wanted to point out when we looked at goals we had talked about it in work

[1:36:55] session um uh in June I think this role is partially to

[1:36:59] help promote a robust Talent pipeline too we Face a lot of headwinds and tell

[1:37:04] our story as a community two years ago um we hosted the first um rural or out

[1:37:10] outstate um cver County Commerce Corridor to where through greater MSP in

[1:37:15] Greater MSP the number one recommendation they said was is tell

[1:37:18] your story because part of our story is we don't tell our story much because

[1:37:22] we're the ASU kind of County folks but I also think that through um our strategy

[1:37:27] documents um we said well it look like for this first thing for this person to

[1:37:31] do is to take a look at telling our story particularly to an audience of

[1:37:35] Juniors that may be considering where they're going to go to work in the

[1:37:37] future and telling the story Cross functionally of collectively what do we

[1:37:41] do as a county um so so promoting a robust Talent pipeline um I I think is

[1:37:47] part of the goals as well so fully support this I think it's a step in the

[1:37:50] right direction other counties and cities are doing the same and they're

[1:37:53] seeing huge benefit from it so thanks for the work on it any other questions
