but I just wanted to thank John again

for coming back and doing another six

months with us and uh closing out this

term. I want to thank uh Patty for her

continued service to the city of
[2:04]
Haywarden and uh the community. Uh she
[2:06]
has done many many things for the
[2:08]
community and this is just one of the
[2:10]
last things that she's done as being a
[2:12]
council member from January of 2022.
[2:14]
just wanted to thank her for all that
[2:16]
time and everything that she's done. I
[2:18]
wanted to welcome the incoming uh board
[2:20]
members uh Ben and Trevor. Uh I am
[2:22]
excited to work with you guys as well.
[2:25]
Also wanted to welcome Misty to the
[2:27]
city. You guys got to see her a little
[2:29]
bit earlier today. Uh Misty is coming to
[2:32]
us from Sous City. Uh she graduated with
[2:34]
a bachelor of science in public
[2:36]
accounting and uh we have been working
[2:38]
together a little over a week now and I
[2:40]
am excited to have her on board. It's
[2:42]
going to be a great addition to the
[2:43]
team. And I also wanted to thank our
[2:46]
staff that have been putting in very
[2:48]
long days and lots of hours to make sure
[2:51]
that our roads are clear with these uh
[2:53]
many snow days that we've been having.
[2:56]
So, and that is all.

everything, get it to be a go. Um I did

pass out the design. We have an

opportunity uh on the flooring, the

concrete. We're going to stain it. Uh
[3:30]
then they put down a polyurethane and
[3:32]
then they'll put this stencil out and
[3:34]
then another layer gets put over top of
[3:36]
that. So I think this will be a a nice
[3:38]
addition. And then also the name um was
[3:42]
uh Veterans Memorial Park or Veterans
[3:45]
Memorial Shelter um is what the um
[3:50]
winner the winning name was. Um so
[3:53]
that's all
[3:55]
we're going with that. And then
[3:57]
substation transformers, the old
[3:59]
substation. Um I've put it out there for
[4:02]
quotes to get that scrapped out and then
[4:05]
sent off. So, um hopefully um in the
[4:09]
next few months we'll get those taken
[4:10]
out and so we can get that area cleaned
[4:12]
up.

public hearing on proposal to dispose of

something. They show them this property,

but then there's a lot of unknown stuff
[12:33]
kind of going on. They have to build up
[12:35]
and they don't want to um they want to
[12:37]
just kind of know what the price is. So,
[12:38]
a lot of people have been backing off
[12:40]
after they show them that and they show
[12:41]
that this going on. So, the chamber got
[12:43]
together and came up with this idea to
[12:46]
just get this
[12:48]
uh uh spend what it needs to get it up
[12:51]
uh to where it's supposed to be. Uh so
[12:54]
that somebody can build on it and then
[12:56]
somebody will have just that that's the
[12:58]
price that they will pay and make it
[13:00]
more enticing for them to uh come in and
[13:03]
get it. Uh and they are not looking to
[13:07]
uh make any profit off of it. They're
[13:09]
going to do it the same as if we were to
[13:10]
sell it. They're just doing the work to
[13:12]
build it up and spending that money to
[13:14]
make it more enticing for somebody to
[13:16]

setting a public hearing to consider
[13:45]
proposed changes to the Haywarden code
[13:47]
of ordinance by amending cable
[13:49]
television utility rates and fees. It is
[13:53]
my um goal to have more public hearings
[13:56]
for these ordinances that uh change
[13:58]
monetary um stuff for citizens. So uh
[14:02]
this will just be the setting a public
[14:04]
hearing for our final reading for the
[14:05]
ordinance for cable rates. Um, I want to
[14:07]
make sure that I read clearly tonight,
[14:11]
especially uh the rates and what they
[14:13]
were and what they're going to and why
[14:16]
so that uh anybody watching uh later on
[14:20]
or listening in later on can have
[14:23]
something to kind of reference and know
[14:25]
what's going on. So, uh but just uh

Uh number six is uh the second reading
[15:07]
of ordinance 761 which is an ordinance
[15:10]
amending cable rates and fees of the
[15:13]
city of Haywarden by amending sections
[15:16]
113.09,

the rates. Um last meeting I I spoke
[15:30]
about it uh but I know I kind of
[15:31]
stumbled over a couple things. So, I

want to see if I can do it a little bit

more clear for people. Um, currently
[15:37]
right now, we have two primary packages
[15:40]
for cable. We have a basic and we have
[15:42]
an expanded. Uh, the basic right now
[15:44]
without taxes is 37.93 a month and
[15:47]
expanded is 9227 a month. Now, our
[15:51]
actual cost to the city to transmit
[15:54]
those packages to the customer is
[15:56]
actually $42 a month and $112 a month to
[16:01]
transmit that to them. So, we have been
[16:03]
losing money every single month, every
[16:05]
single customer for everybody that has
[16:08]
uh cable and uh we can't sustain that if
[16:11]
we're going to continue to have
[16:13]
high-tech be a competitive and good um
[16:16]
utility. So, we are just going to try
[16:18]
and raise it to a rate that just kind of
[16:21]
breaks us even so that it's not um
[16:23]
eating away at some profits. So, uh what
[16:26]
we have in this ordinance is to raise it
[16:28]
up to $43 for the basic a month and $113
[16:33]
for the expanded. Um, and then I also
[16:37]
just kind of wanted to highlight that in
[16:39]
this ordinance it also removes the
[16:41]
digital packages because we are not
[16:44]
being able to do digital going forward
[16:46]
as uh beginning in early January. But I
[16:49]
am told that only affects about 15
[16:52]
customers. So, and they have been sent
[16:55]
letters to inform them of the services
[16:59]
that are going to be changing. Um,
[17:02]
I think I've covered that pretty well.
[17:05]
So that is uh what this ordinance is
[17:07]
doing.

every single month. So on average, I
[18:04]
mean we have over 1,200 items that go
[18:06]
through this machine a month. Um
[18:10]
it looks like the monthly increase right
[18:13]
now if we sign uh this which is actually
[18:16]
a the lease comes up in April but they
[18:21]
have a program that we can sign a new
[18:24]
contract with this year's rate increase
[18:27]
if we sign it now ahead of time. Um but
[18:31]
they anticipate that the rate's going to
[18:32]
go up. So if we wait till April, it'll
[18:34]
be a little bit higher. And this is just
[18:36]
a way that they can try and give back to
[18:38]
the people that have their current
[18:40]
contracts is to sign one slightly early
[18:43]
at the year before's rates. So um we
[18:47]
don't have to sign it now. That's going
[18:48]
to be up to you guys, but then come
[18:50]
April, we would have probably a slightly
[18:53]
higher contract that we would be
[18:54]
approving for it. So,

[19:18]
vendors.

Okay. So last meeting uh we had talked
[19:24]
about doing the schedule of fees uh
[19:26]
which we tabled which we'll have to
[19:28]
figure out the proper process to on
[19:30]
table. I think one of you guys will
[19:31]
motion it to bring it off the table
[19:33]
before we can actually vote on it next
[19:35]
item. Um but we wanted to uh take some
[19:40]
time to uh talk about the mobile vendors
[19:44]
and maybe the definition behind it and
[19:47]
what all is included in a mobile vendor.
[19:49]
Uh specifically, there are a couple
[19:51]
different things that uh were brought to
[19:53]
our attention that we wanted to look at
[19:55]
that were, you know, not included in a a
[19:57]
mobile food truck. Um so they have the
[20:00]
uh the coffee that has uh delivered to
[20:03]
the hospital that they serve out of
[20:05]
there. I think it's once a month. Um
[20:07]
another one is the flower shop that is
[20:09]
uh set up like across the street from
[20:11]
Casey's in the springtime. Used to be uh
[20:14]
on Sunshine. Um and then some other just
[20:19]
uh vendors that sell things. Uh they uh
[20:22]
we just wanted to bring it up for
[20:25]
discussion what you guys think, what
[20:26]
should be included, what shouldn't be
[20:28]
included, why. And uh the city is
[20:32]
wanting to hear from you guys on what
[20:34]
direction you want to go for that so
[20:37]
that we can
[20:39]
put your vision on paper
[20:42]
because the way that it's written right
[20:43]
now it would stay the same with that
[20:47]
being just mobile food trucks. So
[20:52]
as I mentioned last time and I'll speak
[20:54]
about it again that I uh would prefer
[20:57]
the language to include
[21:00]
So it so it's not so just specific to
[21:03]
food trucks. So I want it to encompass
[21:07]
any um entity that comes to our city
[21:10]
that it's not brick and mortar. They
[21:12]
come in, they sell their items, and then
[21:16]
they're out. So anything like that that
[21:18]
we can think of. And Jenny, if you have
[21:20]
any guidance on this as far as wordage,
[21:23]
verbiage, however you want to say it, um
[21:25]
I'll gladly listen to what you have to
[21:28]
say. I think in crafting this ordinance,
[21:31]
it's going to be important to define or
[21:34]
identify a purpose of the ordinance. So,
[21:37]
typically they're they're crafted
[21:39]
towards food vendors for the purpose of
[21:42]
ensuring safety, sanitary conditions,
[21:45]
regulations. So, if we're going to
[21:48]
expand it, I think we have to be um
[21:51]
intentional about why we're expanding it
[21:54]
and what public purpose we are
[21:57]
essentially protecting. So, uh I think
[22:01]
that would be my take on it is if it's
[22:03]
expanded, we need to identify and define
[22:07]
why and what public purpose it is
[22:09]
serving.

Yeah, it for me uh you know if it's at a
[22:19]
private business and they bring a a
[22:22]
coffee company in there, that's a little
[22:24]
different than on the corner of the
[22:26]
street or wherever. So that's one thing
[22:28]
I see is different. And then the other
[22:30]
thing is like spillet soil, sweet corn,
[22:34]
pumpkins, different things like that
[22:36]
outside of the farmers market where we
[22:38]
start and stop. And
[22:39]

that in revenue over expenses. These

will all be have to be amended because

they weren't built into the expenses,

I had uh

in your packet you've got some
[33:37]
proposals. I visited with uh Jacob and
[33:41]
Brian about these. Um,
[33:45]
I've got some proposals which um provide
[33:50]
some critical modifications in addition
[33:52]
to the existing city ordinance
[33:55]
concerning electric scooters,
[33:57]
including the recent additions by the
[34:00]
city council. These recommend
[34:03]
recommendations stem from a shared
[34:04]
desire to make our community safer for
[34:07]
all residents, particularly our youth.
[34:10]
The time for action is now. We must
[34:13]
proactively prevent a potential tragedy
[34:16]
rather than react to one after it
[34:18]
occurred.
[34:21]
These recommendations are designed to
[34:23]
mitigate risk, encourage parental
[34:26]
involvement, and ensure that individuals
[34:30]
possess the necessary skills and
[34:32]
knowledge and judgment to safely operate
[34:35]
motorized scooters.
[34:38]
My first proposal is to require a
[34:42]
minimum age of 10 years old to operate
[34:46]
in in the city. Operating a motorized
[34:49]
scooter safely
[34:51]
requires a specific level of strength,
[34:54]
coordination, motor skills, judgment,
[34:57]
and a basic understanding of traffic
[34:59]
laws and city ordinances.
[35:02]
I believe um that our children that are
[35:07]
under 10 uh do not have all of those
[35:10]
skills that they need to travel safely
[35:14]
on city streets and sidewalks. The
[35:17]
proposal specifically is to enforce a
[35:20]
minimum age requirement of 10 years old
[35:22]
to operate a motorized scooter on public
[35:25]
streets, sidewalks, or parks within
[35:28]

uh, reactions to that

is mandatory helmet use for riders aged

14 and under.

The most serious injuries involving
[36:21]
motorized scooters are predominantly
[36:22]
head related. Protecting our children
[36:25]
must be our top priority.
[36:27]
The proposal is to require all motorized
[36:30]
scooter operators aged 14 and under to
[36:33]
wear a properly fitted safety helmet at
[36:35]
all times while riding on public
[36:37]
property, including streets and
[36:39]
sidewalks.
[36:45]

It's about protecting the kids. Really?

motorized scooters. The higher speeds

drastically reduce the time available

for both scooter operators and vehicle
[38:32]
drivers to avoid collisions leading to
[38:34]
more serious incidents. Uh, I know I
[38:38]
have witnessed um riders on motorized
[38:42]
scooters um going faster than 15 miles
[38:46]
per hour. And it's to me it's scary to
[38:49]
see that. Um the proposal would be to
[38:53]
implement a speed limit of 15 mph for
[38:56]
all motorized scooters operating within
[38:58]
the city limits regardless of location,
[39:01]
street, sidewalk, or bike path.
[39:04]
I have a question about can we can we
[39:06]
actually enforce this one because not
[39:08]
all scooters have speedometers.
[39:10]
>> So the kids don't know how fast they're
[39:11]
going,
[39:13]

>> Can we can this one actually be enforced

because they don't know?

beyond the the situation the road

be um against the rules anyway. I don't

know going 16 miles per hour or 17 miles

per hour, but sometimes sometimes we
[41:28]
need a little

it's nice to give Brian some leeway so

recklessness. But,

let's move on. We we'll have a chance to

amend these uh at another time. Um,

number four is consequences and parental
[46:33]
involvement. To be truly effective,
[46:36]
safety regulations require the active
[46:38]
participation of parents. Finding
[46:40]
children is often inappropriate. The
[46:43]
primary consequence for a minor's
[46:45]
infraction should involve the parents
[46:48]
managing the privilege of riding the
[46:50]
scooter.
[46:52]
the um
[46:56]
and so the the proposal that I have
[46:58]
which
[47:01]
is just uh can can be uh changed but uh
[47:05]
to establish a range of enforcement
[47:07]
actions dependent upon the severity of
[47:10]
the infraction and the number of
[47:12]
previous infractions starting with a
[47:14]
verbal warning of reports to the parents
[47:19]
uh a ticket issued to the parents with
[47:22]
escalating fines of $25 for the first
[47:25]
event, first offense, 50 for the second,
[47:28]
and 100 for the third and subsequent
[47:30]
offenses, leading to a temporary ban on
[47:34]
riding electric scooters of up to 30
[47:36]
days within the city limits. And the
[47:38]
consequences can be appealed to the city
[47:41]
council within 30 days of the
[47:43]
infraction.
[47:46]
Um,
[47:48]
right now I think we have
[47:52]
the ability of the police department to
[47:55]
uh take the scooter.
[47:58]

that we have is to take the scooter.

some options prior to that. And

I I'm I don't really care for the uh the

if if it becomes necessary to
[48:30]
incentivize parents to take away the
[48:35]
right of uh riding the electric scooters
[48:37]
from their um minor children.
