[1:06] advance two items items 15 and 16 these both deal with our trash

[1:14] service which is very very important and affects every single person in the

[1:20] Heights and before this I start I just want to um say that Brian Bergman and

[1:27] Dennis lar spent a great deal of time on on this and uh we're residents we're

[1:33] trying to do a good job they have really uh worked on this and so we'll go first

[1:40] with item 15

[1:43] Mr thank you FD thank you mayor I just want to introduce um our special City

[1:50] Attorney Patrick Munos this grace is working thank you uh

[2:29] can you hear that better there we can hear a little better now that's a little

[2:32] better now all right thank you mayor and council members um we have been uh going

[2:36] through a couple of items here related to the hauling of refuges um in the city

[2:42] uh we have been working with our city attorney's office ran and Tucker um

[2:45] we're very fortunate through their offices to have uh Patrick Munos with us

[2:50] um who is an expert in the field and he'll be talking a little bit about the

[2:53] items tonight thank you uh good evening Miss

[2:57] mayor and members of the council uh the the first item on your uh uh Advanced

[3:02] agenda item number 15 deals with um the balance of your uh Solid Waste agreement

[3:09] with Republic Services uh the as set forth in the

[3:13] staff report the uh agreement with Republic expired in May of

[3:19] 2022 uh we've been uh operating on a uh extension since that time the extensions

[3:26] expired and we went to a month-to-month uh service with them

[3:30] uh they have agreed to continue to provide services until October 1st uh

[3:36] one of the conditions of their agreeing to do so was to have um what we refer to

[3:41] as an extraordinary cost adjustment this year instead of the standard uh CPI

[3:46] increase they asked for a 10% increase to cover uh some of the costs that

[3:51] they're incurring that were not uh covered under the terms of the agreement

[3:55] so in essence what we're asking for on item 15 is a motion to ratify by uh a

[4:01] 10% uh increase to the rates that Republic uh would be otherwise charging

[4:08] between July 1 and October

[4:14] 1st are there any questions of Mr

[4:20] Munoz is there any public

[4:25] comment I return it to the council may I have a motion I'll make a motion to move

[4:30] approval on item 15 for the 10% rate increase it'll just take them through

[4:36] October 1st of this year second Mr Zula yes Mr PPA yes Mr lar yes

[4:45] Mr Bergman yes and I'm a yes item

[4:51] 16 going forward thank you mayor and Council U

[4:56] this item is dealing with moving forward with Trash Services uh in the har

[5:00] Heights um we have been gone through an extensive process um with a subcommittee

[5:05] from City Council made up of council members um larity and Bergman who worked

[5:10] with staff and Mr Munoz to go through a very ex extensive and exhaustive process

[5:16] related to um a new agreement with a new trash hauler that will come in and

[5:21] provide Refuge services for the city and then I'll hand it over to Mr Munos and

[5:24] he can give you kind of a quick summary as to where where we were and where

[5:29] we've made it to thank you again

[5:33] um uh as um Mr uh wridge indicated the uh Council subcommittee along with staff

[5:40] and our office went through a process where we started Cons with consideration

[5:44] of six companies narrowed that down to three companies that we received

[5:48] proposals from um of the um three proposals uh where

[5:55] disposal Incorporated uh ultimately was determined to to have not only

[6:00] objectively the most competitive price uh proposal but the committee felt as

[6:05] though it provided the best value uh an overall uh service propos that was being

[6:11] proposed um the staff report provides a high level summary and I I won't just

[6:16] repeat what's in there but I think it's important to bear in mind that the staff

[6:20] report is just a summary and that we'll be bringing back a uh an extensive

[6:25] franchise agreement um that will have all of the deal points uh spelled out

[6:30] and nailed down I think residents should uh know that um this might be um a gross

[6:37] generalization but if it's if there's a service that's currently being provided

[6:41] by Republic it will also be provided um in the new franchise with wear disposal

[6:48] so things like um Christmas tree recycling quarterly cleanups uh bulky

[6:52] item service things along those lines that were not touched upon in the staff

[6:57] report that currently exist will continue to exist the difference uh in

[7:02] my view is going to be a much more um economical uh Service uh that's being

[7:08] provided um there for instance will no longer be charges for burough Services

[7:14] uh for streets that are difficult for standard-sized trash trucks to navigate

[7:20] um uh there are some residents that are the top of steep driveways that need

[7:25] what's referred to in the industry as Scout Service uh we're going to Pro

[7:29] provide a provision that will allow for sharing of the cost for scout Services

[7:34] uh for um residents that are clustered at the top of a of a steep driveway uh

[7:40] as I was describing um there's a provision that was proposed that after

[7:44] the first 90 days where we'll uh come back with a proposal to figure out how

[7:50] to save residents more money if there are Services being provided that aren't

[7:55] as efficient as they could be if there's other services that could be provided

[7:58] that would result in cost savings that's something that we'll be re-evaluating

[8:02] after the first 90 days um where we'll be providing uh all of the services that

[8:09] the city needs under a new state law known as s SP 1383 it's a very

[8:14] significant uh um benefit that the city will be receiving there are very um

[8:21] specific and detailed reporting requirements um requirements for

[8:26] monitoring uh waste that's disposed of in the very ious containers that will be

[8:31] uh placed out for residents to use uh route auditing requirements a lot of

[8:35] expense involved in all that that where will be taking on for the city and while

[8:40] the city does have a waiver for SP sp1 1383 for the next couple of years that

[8:44] waiver will expire and so we'll be well positioned to be in compliance with the

[8:48] law at that time and understand that there's a $10,000 a day potential

[8:52] penalty if the city's not in compliance so um I think the proposal you have uh

[8:57] will have a a very significant benefit uh from from a legal compliance

[9:01] standpoint um those are the highlights of the contract I'm and the proposal I'm

[9:05] very happy to answer questions if anybody has

[9:08] any are there any questions of Mr

[9:14] Munoz I have a couple of questions sure all right so um I know this is in the

[9:19] staff report but for the people so what will be the base cost for the typical

[9:26] residents if the base cost will be $32 .98 a month um and as I mentioned in my

[9:34] opening comments uh there's a lot of uh residents who receive something called

[9:38] burrow service right now uh the burough service will be eliminated so anybody

[9:42] that's paying both the base cost for Republic plus a burough service charge

[9:46] going forward will only pay the base uh service charge which is the 32.98

[9:52] correct and then if you have a long driveway or uh the trash is picked up at

[9:59] at your house instead of at the street right how

[10:04] is that so that's referred to as carry out service or sometimes as Scout

[10:08] Service uh the charge for that is an additional $54 in change I apologize I

[10:13] don't remember the exact number 5444 if I remember correctly um and as I

[10:17] mentioned if there are a number of Neighbors at the end of that same

[10:20] driveway they'll be able to share that $54 um on a prata

[10:26] basis and the um where will be providing the same 96

[10:33] gallon three containers that we have now that's

[10:37] correct you'll have one container for refuse one for recyclables and one for

[10:42] um organic waste or green waste the one exception is that wear has offered a 10%

[10:48] discount uh to seniors or disabled customers uh who aren't generating as

[10:54] much waste and can use smaller size containers and then you you did indicate

[10:59] that you reached out several different haulers were contacted by I guess you or

[11:06] the committee and one of those was Republic

[11:10] and for the longtime residence one was hallay hallay and Republic both

[11:14] indicated that they were not interested in um participating in this process and

[11:20] then the ones you did speak with um they submitted competitive sealed bids or

[11:27] whatever however that worked it it wasn't a super formal process um with

[11:32] sealed bids and that sort of thing although we tried to keep them

[11:35] confidential just to keep the process Fair um so we we received three

[11:39] different proposals one from Edco disposal one from Valley Vista services

[11:44] and one from we disposal Inc um they all had um strengths uh that we had to

[11:52] compare with each other or against each other I should say to determine what

[11:56] what the committee felt was the best value from a price standpoint as I

[12:00] mentioned the wear proposal was clearly you know the the lower number and then

[12:04] as we went through and talked about the type of equipment that would be used um

[12:09] the customer service Provisions the transition services that would have to

[12:13] occur the committee felt comfortable that we provided both the the lowest

[12:17] price and the best

[12:24] value that's all the questions I have at this point

[12:31] I do have a card from Mr we so I guess I'll open it to public comment unless oh

[12:37] does anybody else in the council have questions Mr P I'm sorry Mr where Mr

[12:43] PPA so um on I was reading through staff notes and also the agreement

[12:51] um and you mentioned the the Scout service which is kind of the service

[12:55] where um if you want our I think you call maybe valet service which is where

[13:00] if you don't want to bring your trash cans out they'll come up and get them

[13:04] um we in here notice there's a senior disabled option for that so there's um

[13:11] two different things we're talking about here valet service refers to if you keep

[13:15] your trash cans in your backyard behind a gate right um then the huler will go

[13:21] behind the gate get the trash cans and bring them out to the place where

[13:24] they're disposed of and that would apply whether uh your residence is structured

[13:28] or or situated to where you could put your your uh carts out on the curb or if

[13:33] you're at the end of one of those long driveways so for those um residents in

[13:37] need where has offered to provide that valet service at no charge Scout service

[13:42] is unique to very very long driveways steep driveways unusual circumstances

[13:48] where the curb is not being used as the as the I just want to confirm the valet

[13:52] service will be at no charge that's correct and where will determine whether

[13:56] or not I mean it'll an objective standard

[14:00] got it people who

[14:05] qualify thank you are there any other questions did the two members of the

[14:11] committee wish to say anything at this point or we'll

[14:15] invite Mr wear to come up I just I'll comment a little bit uh I

[14:21] thought the process went extremely well and it was uh you know we worked as a

[14:28] team and inter interviewed as a team and asked a lot of questions and it uh it

[14:33] was uh really good to get all the information from the

[14:37] haulers and I thought it worked uh very well we got a very good process with the

[14:43] whole thing and we were able to uh really crunch the numbers and look at uh

[14:47] what worked and what didn't work in the past and we're doing whatever we can to

[14:54] make this transition this fall as seamless as Pro possible

[15:00] Mr wear is here from the company and uh he he understands that uh we had some

[15:07] issues with the transition in the past and that uh we're going to work real

[15:12] hard to make this happen and so it's eliminate any pain supposedly for all

[15:18] the residents uh when that occurs but Mr wear can speak to that when he comes up

[15:23] but I thought it went very well and want to thank all the team members

[15:29] yeah I understand that this was the first uh process of looking at trash

[15:34] haulers with the assistance of uh an attorney who specializes in

[15:40] trash this this aspect of trash and uh it really to me added an important

[15:49] Dimension that uh would have been missing otherwise uh especially in

[15:54] regards to customer service I think there was uh considerable time spent on

[15:58] customer service uh not as an afterthought but as the

[16:02] discussions went on with all three haulers uh really focusing on customer

[16:08] service and the responses uh from where people uh really spoke to that in a very

[16:15] favorable way in a way that uh it seemed that there was considerable sensitivity

[16:21] to the needs of our community uh but also uh knowing that Mr Munoz is

[16:27] available uh down the road uh to uh take any comments that we might have as a

[16:34] council or needs in the community to uh speak to customer service if there's any

[16:41] complications any difficulties uh that uh he he's there and uh available to us

[16:47] and I I just think that that to me firms up any agreement uh firms up the offer

[16:53] of customer service uh that it it certainly will come through and I guess

[16:59] I certainly don't have any question about that happening on the basis of the

[17:03] discussion on the basis of Mr munoz's involvement and just uh where we are

[17:09] today with with where and I think it's a great

[17:15] decision okay Mr

[17:19] wear perhaps you could give us just a tiny bit of the background of your

[17:23] company and then whatever you'd like to present

[17:29] absolutely absolutely uh Madame mayor council

[17:32] members my name is Jay wear I'm the general manager of we disposal I uh

[17:36] stand in Fr you tonight thanking you for your consideration uh and thanking the

[17:41] committee for its recommendation uh my company is uh

[17:45] started by my parents in 1968 uh we are a full Solid Waste

[17:50] Service Company we have uh over 250 trucks operating in the Southern

[17:56] California area um across San Diego Los Angeles and Orange County um we are

[18:02] looking forward to providing uh the services uh to the city and as you've

[18:08] heard tonight the committee was very much focused on uh community service and

[18:12] customer service and those are my biggest um uh focuses for your city one

[18:19] transitioning out the city in a smooth and effortless uh and seamless

[18:24] transition and secondly to make sure that your city is serviced my customer

[18:29] service team along with my operations team who I have here tonight actually I

[18:34] have Mr Manny Gonzalez and I have also miss Leah Ding and ranr all very much uh

[18:39] prepared to uh involve and invest theirselves um fully to customer

[18:44] services within this city um and with that said uh I believe that I can answer

[18:51] any of your questions if you have any I guess it's a little unusual but

[18:56] are there any questions Mr we by any of the council

[19:38] franchise agreement for collection and processing a solid waste including

[19:41] compliance with the state mandated organic Recycling and related

[19:45] services and direct the City attorney to prepare a franchise agreement for a

[19:49] 10-year period beginning October 1st 2024 with the option of two one-year

[19:54] extensions and return to the council for its uh approval of such

[20:00] franchise a second is there any

[20:06] discussion um just briefly I just want to basically thank uh the uh uh Dennis

[20:13] and Brian for their hard work on this they address a number of my concerns I

[20:17] had with the uh current uh uh waste huler and I appreciate it especially

[20:23] your concentration on the fact that we have responsibility to to do our best

[20:29] for the for the uh residents not simply for the city as a whole but for the

[20:33] residents individually thank you very

[21:19] evening Brooks Skyline Drive um I want to start by thanking the volunteers that

[21:26] came out a couple of weeks ago and helped pick up trash I really appreciate

[21:31] that there are other people in the community that actually care about what

[21:34] our city looks like I also want to thank Rafferty and Josh and Al and Grace uh

[21:40] for doing traffic control and making it safe um it was pretty Harry up at the

[21:45] top of skyline and they did a good job making it

[21:49] safe um I was a little concerned because I someone said that they heard a comment

[21:55] from mayor Englehart that said if we do this again we don't need City staff we

[21:59] can just put out signs and that should be good enough unfortunately that just

[22:03] kind of shows me how out of touch you are and you know when it comes to

[22:08] employees safety should always come first and volunteers should be treated

[22:11] like employees um Mr City attorney I think

[22:15] you need to explain to the city council and to Mayor Englehart that she's not

[22:19] the CEO of the city and that she can't just go into City Hall and bark orders

[22:24] the chain of command is and should be that city council makes decisions that

[22:29] Council decision gives direction to city manager and the staff works for city

[22:35] manager not for any particular city council member and you know we're going

[22:40] to end up having staff quit or file more lawsuits against the city because you

[22:45] know the chain of command is broken it's been a year at least since

[22:51] the last city manager left and I've seen the intern sign inim sign for Rafferty

[22:57] that's just absolutely Ely horrible Management on the part of the city

[23:01] council either hire a city manager or make him the city manager but to string

[23:07] the poor guy out for a year really I mean he's afraid to make a decision

[23:12] because maybe he won't get the promotion Step Up do your job okay it

[23:19] it's just it's just so disturbing that takes a year and I don't want to hear

[23:24] excuses oh we can't afford a city manager um

[23:29] rapidy I you know would like you to please contact 672 Greenview and tell

[23:35] them their time is up um that property has been on the hit list for code

[23:41] enforcement for going on 15 years and the pre or the owners now have owned it

[23:45] for 14 years and they're doing nothing with it that property is going nowhere

[23:50] it's an isore and Mr ster is running for city council now so that he could get

[23:56] rid of that iord living next to him because he couldn't do it for eight

[23:59] years while he was on the Planning Commission so I think their time is up

[24:03] they're behind on their taxes they're not going to do anything let's just move

[24:07] on the city has two lawsuits that I know of because of mismanagement by city

[24:13] council and the city previous city manager having a relationship with an

[24:18] employee well I find the same thing disturbing that Brian you know Bergman

[24:23] and Carol Englehart have this relationship and they've been dating for

[24:26] a long time and I just think it's really bad for our city because we need five

[24:31] independent thinking people and not somebody who's afraid to make a decision

[24:36] because their girlfriend's going to get mad at them so I think one of you should

[24:40] resign anyone watching this if people actually watch these meetings please

[24:45] drive by Henda in West Road it's horrific that lot is a city-owned lot

[24:51] and it's absolutely horrific I'm embarrassed weeds are 6 feet high and I

[24:57] know the excuses about the dirt pil there but plant a row of Hedges FAS

[25:01] nitas or something and hide the thing but no other property in the city could

[25:06] look like that without getting code enforcements and it just you know the

[25:10] city manager and you know can only do what city counil directs him so you know

[25:17] take care of that and if you think that lot looks bad

[25:21] why don't you drive by Mr zula's house and I'm just absolutely appalled that Mr

[25:27] zoula sitting council member is now wasting City staff time and we finally

[25:32] hire a code enforcement man and we're wasting city code enforcement because

[25:37] you failed to live by the codes six years ago Norm I stood up here

[25:43] and I asked you a question and I said do you live by the general plan and the

[25:47] codes or are you just a hypocrite politician that wants to tell other

[25:51] people how to live well actions speak louder than words so I'm done with you

[25:56] I'm tired of being nice I'm going give you three weeks to hire a contractor and

[26:02] pull a permit and replace that roof and clean up your your hedges in your front

[26:06] yard after three weeks I'm going to sue you and I'm going to sue the city for

[26:11] Selective enforcement and I'm going to go after damages for my avocado Crest

[26:16] property that was undervalued because of lack of code enforcement for this city

[26:21] I'm putting you on notice I've tried to be nice to all of you and I'm done I'm

[26:35] 98% of the city I worked hard I saved my money I've

[26:50] it shows by the respect you have for the city and by the respect that you give to

[26:55] our codes so I wish City Council would start actually doing some things and so

[27:01] that I don't have to play hard ball but one way or another I really like this

[27:05] city there's some wonderful people here and I'm tired of things not getting done

[27:49] patience hey I want to thank you for the time it's been I know

[28:01] how how's that better okay good evening mayor anglehart

[28:07] members of the council staff and citizens of La Harbor Heights well thank

[28:12] you very much for the time to be able to talk about these two things but I'm

[28:17] Kathy Howen a resident of La Harbor Heights who is appointed by the city

[28:20] council along with Roy Francis and Adam nazarov to sit on this the uh habitat

[28:27] count Authority citizen tactical advisory committee and I'm here to

[28:31] update you on what's going on in July the habitat Authority board

[28:37] unanimously voted to form a legal entity called the community facilities district

[28:42] and I put a map in front of all of you there or the cfd which allowed the

[28:47] habitat authority to place measure pH on the November 2024 general election

[28:53] ballot within the district's boundaries measure pH is a special tax

[28:59] of 1 cent per building square foot and that's building not your whole property

[29:04] so if you have let's say an 800 square foot 1,800 square foot house that would

[29:10] be $118 a year that they're asking for from you the equivalence of maybe two to

[29:15] three Starbucks right the key projects funded by this

[29:20] special tax would include the first would be the preserved security and

[29:24] maintenance of the natural habitats including powder Canyon Canda Hills

[29:29] turble Canyon Sycamore Canyon Helman Park and Aurora pescadera for security

[29:35] which includes law enforcement and Fire Prevention we have the Rangers from the

[29:39] mrca and we do contract with the various agencies to do repairs like failing

[29:45] Trails due to heavy rains the second would be preventing

[29:50] wildfires our R our Rangers are extensively trained Wildland

[29:55] firefighters they maintain Parkers Ranger patrols for fire safety and

[30:00] emergency response for example on July the 4th weekend the park rangers along

[30:06] with many volunteers patrolled the trail heads and some of the trails of the

[30:11] habitat and the third would be clearing brush from homes and emergency access

[30:16] road and the habitat Authority has finished its annual clearance of brush

[30:21] and tree review a removal from homes and emergency access roads in La Harbor

[30:25] Heights we actually had goats clear 11 acres of powder Canyon this year as

[30:32] well and also the fourth would be protecting the

[30:36] natural lands from threats like homeless encampments vandalism and illegal

[30:41] dumping all the funds from measure PH will be locally controlled they will not

[30:48] be taken away by the state or used for any other purpose so why is the habitat

[30:54] Authority doing this the habitat Authority faces an on goinging

[30:58] structural deficit and without an additional stable funding source they

[31:02] will be forced to make additional cuts which could and right now it's quite a

[31:09] um shoestring type of um amount of money that they have you know it's really the

[31:16] funds are really limited and this what this could do is eliminate Rangers Park

[31:22] man maintenance staff and limit access for individuals and families to the

[31:27] trail and the the open

[31:30] spaces so this is why they're wanting to do

[31:34] this now if you want to get out and exercise and enjoy nature we have many

[31:38] public hikes available led by our volunteer doents in powder Canyon we

[31:43] have two hikes at 5:00 sharp on Sundays and Thursdays during and this is

[31:49] starting at the black walnut Trail off of Fullerton Road so please visit our

[32:57] is in LA County so one animal on this earth that could affect your health for

[33:01] the rest of your life or cause death is a

[33:05] mosquito if you're being bothered by mosquitoes you need to find out why they

[33:08] are around so this month there were 22 nonhuman cases of West Nile Virus versus

[33:16] 36 cases last year in California five of those were in Fresno and the rest are

[33:22] scattered around the San Fernando Valley so it's not in this area and so far

[33:27] we've had two human cases of westnile virus in California this year and in La

[33:33] Harbor Heights vector control had four service requests for mosquito activity

[33:38] and all were negative and treated our technician found mosquito activity in

[33:43] areas of La Harbor Heights six in pools four in USD Lids one in gutter spots and

[33:49] 20 in other non-p poool locations mosquitoes don't fly far from

[33:54] their water sources so if you don't have any standing water anywhere and have a

[33:59] lot of mosquitoes maybe your F your neighbors do to help control the

[34:04] mosquito population just do the simple Act of dumping out the water in the

[34:08] various receptacles in your property at least once a week keep an eye on what

[34:13] could be potential sources of mosquito growth our technician would be happy to

[34:18] come out and show you what could be potential sources that you

[34:22] have and here's something interesting the greater La vector control district

[34:26] along with Orange County County are looking for ways to reduce the mosquito

[34:31] population one stud one study that we are doing is called the sterile insect

[34:35] technique or sit what we're doing is sterilizing male

[34:40] aides egypti mosquitoes and releasing them weekly into a specific area to see

[34:46] if the numbers of of the mosquito population drop and this is a pilot

[34:51] study so far in the initial studies they are seeing some decrease in mosquito

[34:55] population so it's very promising Ing and I hope the future shows even more

[35:00] promise and the reason why we're picking the 80s egypti mosquito is because they

[35:05] carry the zika virus dangi fever yellow fever and CH Ching Kong

[35:12] Chung uh virus I can't say that right and in the meantime while we're

[35:18] working on this we're looking for ways to control the is the a city's egyp ey

[35:23] populations that are plaguing our residents and pose a risk for local

[35:27] transmission of tropical diseases that are being brought into LA with

[35:33] Travelers and there has been an unprecedented onslaught of imported

[35:37] cases of dangi fever as a disease is going rampid throughout the world and

[35:41] residents are returning with infections from travels near and far for each case

[35:48] report that results in an extensive door-to-door inspection and treatment

[35:53] campaign so if anyone ever has it in La Harbor Heights you may find vector

[35:58] control knocking on your door please let them in and do the appropriate

[36:04] treatments and uh La greater La um Vector District also bought a new

[36:11] facility in pacomia and at this time they're setting up a lab for the

[36:16] mosquito rearing for the sit program and so for more information go to the

[36:27] programs and a lot of information to help you out and that's

[36:56] laab heights uh Improvement Association uh they just W wrapped up this year's

[37:01] music in the park uh I know I saw many of you there from many of the events um

[37:06] it's always sad when the last one ends because it's kind of the end of summer

[37:09] and we're moving into moving into fall but I think they did a pretty amazing

[37:14] job of putting that together and you know if you're a resident of the city

[37:17] you should really look into you're not a member of the Improvement

[37:22] Association I would highly recommend um joining I think everyone gets their

[37:27] monthly news uh monthly uh little magazine in

[37:32] the mail regardless of whether you're a member uh but they produced that um also

[37:37] on October 5th I believe it is is the uh Community uh yard sale uh uh they uh

[37:45] Susan Brooks uh kind of did it herself last year and um this year here I think

[37:50] the Improvement Association is taking it on I look forward to that I think that's

[37:53] going to be a a wonderful Community event um I also o want to thank uh all

[37:58] the volunteers that came out uh and also thank Susan and John Susan Brooks and

[38:03] John Dominguez for organizing our quarterly cleanup um I remember when I

[38:08] moved into the city back in 1998 that uh we used to do that and it

[38:12] was always kind of neat to you know get out meet meet the uh meet your neighbors

[38:17] that you normally don't get to see and uh and then go have a nice cup of coffee

[38:20] afterwards uh which I know several several of the folks did so uh also want

[38:25] to thank the staff for for keeping us safe I know um uh there were some not so

[38:30] nice things said by people driving by in cars as we tried to to pick up the trash

[38:34] on the side of the road and then lastly um just the shout out to the

[38:39] EPC uh I think everyone kind of felt it today the the Pasadena earthquake um it

[38:45] was a small one uh but we've had a couple now that have shook the

[38:50] heights uh you know the EPC is producing a bunch of preparedness materials both

[38:56] for Wildfire fire but also for earthquake preparedness I know firewatch

[39:01] um which is our local um Community uh firewatch group has put out some

[39:06] material Kathy soel has put it out uh around uh preparedness so not only do

[39:12] you need to be prepared for your family up here but make sure that you're

[39:15] thinking about your pets especially if you have large animals that have water

[39:19] needs uh one of you know we're seeing this in palace veres with the land

[39:23] movement issue is that water is usually the first thing to get impacted

[39:26] especially during land movement events up in Pasadena the city hall even had an

[39:30] issue even in a small earthquake with some water pipes breaking so make sure

[39:35] you have sufficient water for your large animals and animals um you know to get

[39:39] you through at least 72 hours I think is the

[39:41] recommendation uh make sure you have sufficient food for your animals to get

[39:45] through 72 hours and that you kind of keep that separate so you don't lose

[39:49] track of what you're doing anyone

[39:54] else I too would like to um thank John Dominguez who's here tonight is there a

[40:00] way to train the camera on him if he doesn't speak or and and also Susan

[40:05] Brooks they revived the trash pickup along Henda and it was well attended and

[40:11] the street always looks so nice oh thank you for for a short period of time okay

[40:19] administrative reports thank you mayor and Council

[40:23] couple items for you tonight uh over the weekend there was a birthday party for

[40:29] one of our longest term fire department volunteers Joan clenin Stein she was a

[40:35] uh part of the dispatch component of our fire department all the way back in the

[40:39] day when it was purely volunteers and residents that pitched in and helped out

[40:44] um she recently turned 99 so they had a nice big celebration for her over the

[40:47] weekend um and we were able to bring out engine 772 to wish her a happy birthday

[40:53] so the the Chiefs uh Chief briser and chief Martin along with Captain Harris

[40:58] and another another retired captain that happened to be here um in town for

[41:02] another event that doesn't even live in in the area anymore was here and he

[41:05] wanted to go over and wish Joan a happy birthday so it was a very nice event we

[41:10] were able to go over and wish Joan a happy 99th and and many more um she's

[41:14] always been an integral part of the volunteer part of the fire department

[41:19] it's we dealing with dispatch and all the way in from when they used to be

[41:22] everybody at home that would pick up the phone and answer the phone calls all the

[41:26] way into our now professional um dispatch that goes through the county

[41:30] system so she was an integral part of that fire department for a very long

[41:33] time so we just wanted to thank her and it was a great event to to go out and

[41:37] wish her a happy birthday for that one and also as mayor Pro pespisa touched on

[41:43] the there is going to be a yard sale coming up October 5th um the price is

[41:48] $15 and the spaces will be a little larger this time so it'll be 20 by 20 um

[41:53] last time they were 10 by 10 um so this go around the the spaces will be bigger

[41:59] um they're looking at having a little more spaces so it won't be as restricted

[42:32] event so we're looking forward to another one um we do have two pretty

[42:36] significant um traffic control things that'll be

[42:40] going on tomorrow um along Henda Road there has been some copper theft from

[42:44] the Telecommunications lines um so Frontier is going to be doing some

[42:49] single lane closures along Hender road tomorrow um to replace a

[42:55] large section of lines that was stolen off that was stolen um so they'll be out

[43:00] doing single lane closures and things as they work to replace those lines along

[43:04] Henda Road um and at the same time Southern California gadison will be

[43:07] doing some road work on um Harbor um so you've seen if you've gone up and down

[43:12] Harbor recently you see message boards there that say road closed um for the

[43:16] most part it will be single Lane on both directions of Harbor there will be a

[43:21] short period where they will fully close Harbor as they string a cable across the

[43:25] roadway and make a replacement of a line so for a short period of time um Harbor

[43:29] will be closed on August 13th otherwise it will just be single lane closures on

[43:33] Harbor Boulevard that'll be tomorrow same thing on Hos andas Frontier Works

[43:37] to make those repairs of um the lines from the copper theft that's happening

[43:42] ever more often to it and also too I'd like to thank uh Mr Dominguez and Mrs

[43:47] Brooks for the working to coordinate that cleanup of fana Road it was a it

[43:53] was a great event we had a good time out there I me we kind of split into two

[43:56] groups there was a group that worked here from City Hall all the way up to

[43:59] East Road and a group that went from Skyline down to the north city limit I

[44:03] was working with that group there we actually made it through that part

[44:06] pretty quick so we said hey let's go from Skyline all the way down to canat

[44:10] sombre then we cleaned down to to canat sombre so it was it was a nice event

[44:14] very well attended it was great to see the the group of people out from that

[44:19] have did it when we used to do it back in the day as as AER Pro was talking

[44:23] about to new residents that are just doing it for the first time this around

[44:27] so it was a very nice event it was a a great thing to do that's all I have

[44:31] tonight thank you city attorney's report nothing other than we met on the items

[44:36] listed in closed session and there's no reportable action that is all Community

[44:42] Development report Mr wridge thank you mayor um so the

[44:47] Community Development report for this month uh building department issued 15

[44:50] building permits um and collected permit fees of a little bit over

[44:54] $166,000 we took in two code enforcement complaints um we have 25 Active cases

[44:59] and closed seven cases during the month of sorry it's July June it's July um we

[45:05] issued four stop work orders during July um and closed six of those ille

[45:10] unpermitted construction cases I'm bringing that to 65 we also took in

[45:15] seven development applications and planning and approved nine projects if

[45:19] you have any questions I'm happy to answer them for

[45:21] you any questions fire chief's report

[45:27] well good evening Fire Chiefs report we can go over that real quick um we had 60

[45:32] calls this month which is seems to be pretty average it seems like we're

[45:36] running about 58 to 62 calls monthly we did have one significant fire call it

[45:42] was small but it was a brush fire on July 21st 20 24 about 2m we had a brush

[45:49] fire breakout um in chaperel and uh and grass on Walnut

[45:56] Street um we were able to respond quickly the volunteer fire department

[45:59] got in there quickly a good size up report was made and uh resources from uh

[46:06] the County of Los Angeles and the laab Heights Fire department were able to

[46:10] subdue that fire keep it from getting any bigger but that's like our first

[46:14] brush fire that we've had we're fortunate that there wasn't any wind

[46:17] blowing um I was asked to U mention after hearing some of the talk tonight

[46:24] about things that are somewhat negative let's talk a little bit about some

[46:27] wonderful people in laaber Heights so uh I wanted to bring up the uh W the um

[46:35] party that we had this weekend this recognition of uh the wings uh family

[46:40] and our and our interaction as a fire department with that family Caitlyn and

[46:44] Martin W Wings whose grandmother lives here in the Heights was having a party

[46:50] for a birthday party on July 12th 20124 for uh Laura Li she was a 2y year

[46:57] old and uh Charlotte her sister was three years old at the time Charlotte

[47:01] drowned uh had a near drowning in the pool theab Heights Fire department

[47:05] volunteers responded and they took over the

[47:09] scene uh Charlotte was pulled out of the water she was uh she was unconscious not

[47:14] breathing CPR was started uh the laab heights volunteers showed up applied

[47:18] supplemental OT started an IV went code 3 to Whittier Presbyterian hospital and

[47:24] she survived Charlotte was here this weekend with her parents and the

[47:28] original crew that was on that incident we all had a celebration here in at the

[47:33] in the council chambers uh to acknowledge those uh that event and

[47:38] Charlotte was here she was 13 now she's uh she was at the the the uh party and

[47:44] so were the old crew it was a very positive thing to happen also I wanted

[47:48] to just mention uh Joan kapenstein um her 99th birthday uh for those of you

[47:54] who don't know Joan she's kind of a legend around here here I didn't know

[47:57] Joan it was the first time that I've I've heard of her heard heard rumor of

[48:01] her heard that she was like one of our first dispatchers when the department

[48:04] was volunteer but uh Janes spent 43 years as a volunteer dispatcher for the

[48:09] laaber heights both as when it was the all Vol back in the all volunteer days

[48:13] that some of you might remember and then during the transition to the more modern

[48:17] Department that we know today Joan in 1968 Joan's oldest son Paul volunteered

[48:22] to train as a firefighter with the laab heights volunteer fire department and he

[48:25] persuaded his mother to join the department as a dispatcher so it was a

[48:29] family business Mark and James uh Jon's other two sons also became volunteer

[48:35] firefighters and uh Joan has said that all dispatching was done from their

[48:39] homes there were five dispatchers they all had special phones installed and

[48:43] when A call came in all five dispatchers were notified at one time each one had a

[48:48] radio and a fire telephone for receiving the calls calls first came into an

[48:52] answering service then they were transferred to the dispatchers on the

[48:55] fire on the Fire phones in their homes then they would dispatch from there um

[49:00] Joan thought the dispatchers ought to have volunteer fire department badges

[49:05] but the chief at the time kind of scoffed at that and said where would you

[49:08] wear them on your bathrobes so uh Joan created an

[49:13] official red phone that she that she sewed onto five official bathrobes that

[49:19] she issued to all five of the uh of the dispatchers in the city and I I gave you

[49:24] the handout here that shows that she did that she's quite an an amazing woman um

[49:29] we would uh they she created the official bathrobes for the dispatchers

[49:34] uh when dispatching moved from the resident's homes into the fire stations

[49:37] Joan moved in to become the first fire captain to accommodate and and

[49:41] Communications chief for the Department she trained many fire service graduates

[49:45] and students who worked in the department turning them into in her

[49:48] words fine clear speaking dispatchers and I can't tell you how important it is

[49:52] when you're on the radio and you're managing something to have clear and

[49:56] concise communication I push it very hard with the volunteers that we push to

[50:00] talk we don't push to think over the radio if you can kind of catch that

[50:05] meaning uh anyway it was our 99th birthday uh a huge group of people

[50:10] showed up and celebrated that we all went down there and acknowledged her so

[50:14] there is one of your one of your key residents in laab Heights Joan K Klo

[50:21] kapenstein kste John kapenstein your first dispatcher I'm proud to say um

[50:27] also uh so I mentioned the fire and then um there were three um after July 21st

[50:34] properties located at the high and very high fire SE severity zones requiring

[50:38] documentation of compliant defensible space

[50:41] inspections according to ab38 uh assembly 38 were uh were conducted and

[50:48] to for real estate sales disclosures and documentation only so people that have

[50:52] to go through these they don't need to worry about it we're going to go up

[50:54] there and do a fire inspection but it's just for sales per purposes only um the

[50:59] uh Chief alal they did three inspections in July in accordance to ab38 if there

[51:04] are any other questions I can answer them that's end of

[51:09] report any questions I would like to make a

[51:13] followup comment on the wing matter and thank the chief um Caitlyn Wing kind of

[51:22] decided on her own that she would honor the par Medics and staff that were

[51:28] on duty back in was it 2014 when her her daughter almost

[51:35] drowned and the chief and Don sterk I guess I've um did a wonderful job uh and

[51:43] it was it was really nice seeing some of the guys that had actually been at that

[51:49] event and one of the gentlemen I can't remember his name he had saved the call

[51:55] sheet and actually he was I can't articulate it it

[52:00] it was really down when he read the call sheet but they went out anyway and it

[52:04] all turned out wonderful and I really um think we cannot thank our fire people

[52:09] and our paramedics enough because they actually do save a lot of lives thank

[52:15] you so much um Sheriff's Department report good afternoon we had one uh

[52:23] reported burglary on uh excuse me Elka

[52:28] Hita that took place on the 4th of July we also had one vehicle burglary that

[52:35] occurred that occurred at powder Canyon Trail um the parking

[52:41] area just a reminder that all valuables should be kept at home in the trunk or

[52:48] uh or take them with you because this happens almost every month at uh

[52:54] powdered Canyon Trail we had identity theft one vandalism that took place on

[52:59] Fullerton Road but I drove there this morning and I didn't see any vandalism

[53:02] so it might have been cleaned up and one petty

[53:05] theft for the month of July any

[53:10] questions Mr pispa uh Deputy Beltran um sir I I've

[53:15] become aware of some copper theft along Henda uh I I didn't hear that in your

[53:19] report has there been a the copper theft I reported it was reported today oh was

[53:26] reported yeah it was just reported this morning I took a report okay cuz it it's

[53:30] occurred now in three three separate places along Henda yeah they just told

[53:34] me about it uh I did do one report this morning uh was uh according to the U

[53:40] employees of uh Frontier yeah it was $220,000 worth of copper yeah it's hard

[53:46] to believe that that that much copper is these these these copper wires are not

[53:52] your usual what people imagine it they're pretty it's almost 2 in thick

[53:57] and there's a lot of copper inside of it yeah now

[54:01] I I believe it happened this weekend the time we can't no it's been a couple

[54:06] weeks well there was one this morning yeah I'm I'm yeah I I actually talked to

[54:11] the frontier folks and there was there was one that happened a couple weeks ago

[54:14] it started a couple weeks ago um and and the only reason I bring it up and maybe

[54:18] we can get some you know I I know it's hard at night to get Folks up here from

[54:24] this sheriff's department but maybe you know they can just drive up and down

[54:28] Henda and just look at it cuz while while it impacts Frontier what who it

[54:32] really impacts are residents that for the last two weeks have not had phone or

[54:38] Internet service because of the outage safy issue right so there's a safety

[54:43] issue with it too they can't di on 911 or there's no reception and it comes a

[54:48] serious uh yeah so safety issue I just you know if you have an opportunity to

[54:53] you know at briefing at industry just to ask you know not a lot just if you got 5

[54:59] minutes drive up and down Henda and just make sure there's no one cutting the the

[55:02] phone cables on the poles

[57:23] Henda Road did I do something here so for the record the recusal is because

[57:29] of the location of your property correct yeah

[57:41] wridge thank you mayor and Council um this item before you tonight is to award

[57:46] contract for the fiscal year 2022 203 Street Improvement project uh zone four

[57:52] Hina Road and East Road um this project uh before the

[57:57] council a little while ago um we had opened bids for the project and the bids

[58:01] came in um at about 1.7 million which was way above what the engineer's

[58:08] estimate was and what we expected to to have related to the the project um so

[58:14] staff and city engineer went back and met with the roads advisory committee's

[58:19] design subcommittee they relooked at the projects revised the project the scope

[58:24] of the project um and did a couple of things

[58:27] they reduced the number of streets that we would be worked on and they also

[58:30] created a few additional alternate bid items so typically we'll have one or two

[58:36] alternate bid items one of those alterntive bid items generally is crack

[58:40] seal there's Council usually has a think for us to be able to do $30,000 worth of

[58:45] crack seal as part of the projects um and so that is typically one of the

[58:49] alternate bids and there might be an additional Street or two that we would

[58:52] look at as an alternate bid um but after opening that bid

[58:56] um the design subcommittee did a lot of very good work in looking at the roads

[59:01] um to work on the roads that needed the work the most up front um so the project

[59:07] the base bid of the project was revised to include work on Skyline lucadia and

[59:14] panoy um in those areas up up in that location as the the base bid and the

[59:20] alternate bid item one is for crack sealing so we would crack seal the areas

[59:25] that were as part of the 1718 project um which is a regular cycle and process of

[59:31] of maintenance for that so that crack seal would be on Reposado

[59:36] alocate half of Church Hill and papaya are the streets that we did in the 1718

[59:42] project that would be done for alternate bid one is the crack seal component

[59:46] alternate bid 2 um is a work on um reconstructing deep Canyon so deep

[59:54] Canyon is over off of East Road close close to papaya um that street has had

[59:58] some significant deterioration over the years um so alternate bid two would be

[1:00:05] essentially that area needs to be all RNR so removed and replaced um and

[1:00:09] reconstructed and Alternate bid three would be for repaving of green view the

[1:00:15] public portion of green view about half of green View Road is public and the

[1:00:19] other half is private so alternate B item three would be to do that would be

[1:00:23] to pay from Reposado um all all the way to where it it changes to the private

[1:00:28] side of Green view um if you we we rebid the project um and open those bids a

[1:00:35] couple of weeks ago um we received uh five people pulled bid packets um we

[1:00:42] received four bids from Onyx Paving Company RJ Noble Hardy and Harper Inc

[1:00:47] and All-American asphalt um where the four companies that submitted bids uh

[1:00:51] for that included the base and the alternate bids um if you include the

[1:00:56] base and all the alternate bids together um the lowest responsive bidder would be

[1:01:01] Onyx Paving for a total of 1, 369,000 um so that would be the option

[1:01:09] to award the base plus the three alternates ultimately the way it was

[1:01:13] broken up Council can award their contract based off any combination of

[1:01:17] the base bid or base bid plus alternate or alternates um the only thing is that

[1:01:24] has to be from one contractor so depending on if you look at wanting

[1:01:28] to approve a base plus a certain alternate the contractor that is the

[1:01:33] lowest bidder may change based on which bid item you're looking at um staff is

[1:01:39] making the recommendation that we award based on the base bid and the three

[1:01:44] alternates um so that would be awarding the contract to Onyx Paving Company in

[1:01:48] the amount of 1 M 369,000 um as the second component of

[1:01:54] these Street Improvement projects is the construction management and the

[1:01:57] inspection portion of it and for that we reached out to our engineering firm nv5

[1:02:02] to receive a proposal for doing the inspection Management Services

[1:02:07] construction management services and the inspection of it including materials

[1:02:11] testing and labor compliance component of it um so their their proposal for the

[1:02:16] that component of it is

[1:02:20] $2,364 um so cmn inspection is done as like time and material so they look at

[1:02:27] the whole project to look at the amount of working days that are in there so

[1:02:33] inspection is scheduled for they gave a bid for 80 working days as part of the

[1:02:39] inspection the reality is generally our projects don't do 80 days worth of

[1:02:43] inspections so they would only bill for the time that they're actually doing

[1:02:46] inspections so for like the inspector it would be at the time for meetings that

[1:02:51] we have and progressor meetings pre-construction meetings and their time

[1:02:54] in the field doing in inspection um they would bill us for those hours that they

[1:02:58] work same thing with the construction manager it would be the the time that

[1:03:03] leads up going through the material submittals and preconstruction progress

[1:03:09] through it and close out um so it's not that we would award an agreement to nv5

[1:03:14] and they would collect $192,000 it's based on what they built

[1:03:18] so typically our cmn inspection usually comes in less than that because they

[1:03:23] don't typically work the entire time as far as like days of inspection in the

[1:03:27] field which is the most costly component of it um theirs also includes labor

[1:03:33] compliance since this is a prevailing wage there are certain requirements that

[1:03:36] have to be done as part of the construction so there's interviews with

[1:03:40] the workers from the construction companies we have to review their

[1:03:43] payroll the s a certified payroll we have to do all of those and report all

[1:03:47] of that to the state and also includes materials testing and and inspections um

[1:03:52] as needed for the project so staff is recommending that

[1:03:56] the city council W the fiscal year 2022 23 Street Improvement project um

[1:04:02] Construction contract to onx Paving Company in the amount of

[1:04:06] $1,369 th000 authorize a contingency for this project in the amount of 15% award

[1:04:12] the construction management and inspection contract to nv5 in the amount

[1:04:16] of $192,300 and authorize the finance

[1:04:22] manager to amend the F the fiscal year 2024 25 bu budget to increase count

[1:04:27] number 10450 PWD 6830 by7

[1:04:52] 725,000 is in addition to the 1.36 9 million correct how does this fit with

[1:04:59] the original expectations of uh the assessment as we've gone along our costs

[1:05:07] have definitely increased especially over the last few years um so our costs

[1:05:11] have continue to increase for the projects as we've gone on from when that

[1:05:15] the assessment was originally put in place so where would the

[1:05:20] excess dollars come from it comes from the general fund from the which general

[1:05:31] fund is that 192,000 do you feel that's realistic for what they're

[1:05:37] doing I I would say it's going to be less than that on average construction

[1:05:42] time for the street projects we usually don't see a go past 60 days um just on

[1:05:48] average it's generally less than that we're usually in the 45 to to 50 60 at

[1:05:53] the long end of a project um so you know they they write those proposals to

[1:05:58] include sort of the worst case scenario of time so like 80 Days of construction

[1:06:04] so inspector is generally not going to be out here for 80 days which would

[1:06:08] represent a significant Savings in that amount of money okay thank

[1:06:16] you Mr Bergman um this one if I look at nv5 you know the proposal this time

[1:06:23] versus what they've done in the past this is considerably

[1:06:27] more it's like almost double so the um I mean do you have to have somebody

[1:06:36] on out here every single day during that uh when they start the

[1:06:42] paving project yes well that that is the best recommendation to have our

[1:06:46] inspector here while they're doing the

[1:06:53] work and their proposal they you know they give the who's going to be doing

[1:06:58] the work you know their their primary inspector would be Mike Elma he's done a

[1:07:02] project here in the heights for us he did a project the one we did with RJ

[1:07:05] Noble um which included like Cypress and nbal and dorothia and and those areas

[1:07:11] over there so he's very familiar with the community and the train and and

[1:07:15] getting people in and out so he's he's well experienced with the the heights

[1:07:26] I guess I'm sort of based on they've almost doubled their price I have a real

[1:07:29] concern with the um pricing struction

[1:07:35] and I mean maybe we need to go out for a bid on this thing I'll

[1:07:41] say Peter Sago who is the construction manager for it does an amazing job he is

[1:07:48] I think you worked with him in other communities he does a lot of other work

[1:07:51] for other communities even in their city that that City he represents he's very

[1:07:56] thorough he tracks things well he keeps everybody on their toes he makes sure

[1:08:00] all the submittals are in and reproved um their inspectors do an amazing job as

[1:08:06] part of it they they do good work in this aspect of

[1:08:11] it I guess if uh myself personally if I approve this tonight I want you to go

[1:08:17] back to nv5 and they need to sharpen their pencil on this thing because it's

[1:08:22] it's you look at what they charged is in the past and what it is now it's U it's

[1:08:27] a huge increase on this prior Street

[1:08:33] project it's I know we have a working relationship obviously with that guy

[1:08:39] we've also split this Pro we've split this up in the past and that project

[1:08:44] didn't go so well I understand that I understand that

[1:08:49] that's they can also sharpen their pencil and then believe me like Peter

[1:08:54] tracks his hours they track their hours very carefully to know that to watch

[1:08:59] exactly where they are and let us know where they are in

[1:09:03] their in their hour range of what they put it in the proposal I mean if they

[1:09:08] have to be out here they have to be out here I understand that

[1:09:13] but I don't want them out here if they don't have to necessarily be here type

[1:09:17] thing and I guess that puts work on you to manage that

[1:09:20] situation yeah definitely they are not any more than they need to be I mean if

[1:09:25] if the contractor isn't working or doing something that needs to be inspected

[1:09:30] generally aren't here in a situation like this as a city

[1:09:34] ever hired a civil engineer with some background in working with streets and

[1:09:39] Roads hire them

[1:09:43] independently we have not done that aspect of it

[1:10:03] if you had to use somebody else who would you reach out to we would have to

[1:10:07] put it out to

[1:10:16] bid mean I'm just concerned that there's such a vast increase on this thing over

[1:10:20] the last one sure you notice that too

[1:10:27] and I don't know if the Project's that much different or what they've done on

[1:10:31] the whole thing but

[1:10:51] uh I guess it's just my feelings I'd like to hear from the rest of the

[1:10:57] Council I had a you said um the bid the whole package of the of the paving not

[1:11:04] the engineering um was

[1:11:07] restructured and what was it the alternates that were taken out of the

[1:11:13] bid or was were there other streets that aren't on this proposal that were

[1:11:18] deleted there were other streets that were deleted from the base bid aspect of

[1:11:23] it so the Bas bid also you can look at alternate two and three were included in

[1:11:28] that base bid previously um so and there were other streets that after the

[1:11:33] subcommittee looked at they said okay these streets can wait the their PCI

[1:11:38] their conditioned they went out they walked the areas again to look at what

[1:11:41] could wait and what needed to move forward um for us to figure out what

[1:11:45] would put us more into where we would need to be budget

[1:11:49] wise okay could we could

[1:11:53] we adop adopt the bid by Onyx Paving that hold off on the payment to nv5

[1:12:01] until we've talked to them more about

[1:12:06] that we could certainly now how whether how many um administrative hurdles that

[1:12:13] creates I don't know but legally you certainly

[1:12:17] can administratively it's just going to put

[1:12:20] the project behind as we're going to have to wait to move forward with any

[1:12:24] sort of submittal so typically out of the gate the first thing we do is we

[1:12:28] work through agreements getting so basically kind of that first month is

[1:12:32] going to be that it's agreements it's bonds insurance is put in place so we

[1:12:36] look we review all those City attorney reviews those construction manager

[1:12:39] reviews those and then it's the submittal from the contractor so their

[1:12:43] AC mix designs and all of their their tack coats and slurry seals uh crack

[1:12:49] seal all of those are submitted for review and approval um through that that

[1:12:54] process of it so that part of it would probably be delayed if we if we go out

[1:12:58] and circulate a bid to find another

[1:13:05] option I've I've heard comments and well since I've been on the council which

[1:13:11] isn't that long we saw that nv5 made a very high bid to design the

[1:13:19] paving at the Helo hydrant and then there was

[1:13:23] another I'm forgetting it now there was another project where where there oh it

[1:13:28] was the park it was the diagonal ramp at the park and they submitted an extremely

[1:13:35] high bid and when I got first on the council uh one of the members of the

[1:13:40] roads committee pointed out that there was a

[1:13:44] project I'm not sure which year it was but the cost of the paving increased

[1:13:52] which was everybody understood that and then nv5

[1:13:57] just upped their cost to 10 or 15% of whatever the increase was even though

[1:14:03] the amount of streets that was covered

[1:14:08] um hadn't changed so the little experience I have with this it it just

[1:14:14] seems nv5 is is uh has not got a TR good track

[1:14:20] record from what I've observed the other thing is if we could save any money I

[1:14:24] mean at this point we're being asked to increase this project by 725,000 and

[1:14:31] that that comes out of the general fund and as I recall our 25 2425 budget was

[1:14:39] like $100,000 from balancing or over is very short so I I would think it would

[1:14:47] be worth looking looking at someone else or

[1:14:52] having them come back with a a more

[1:14:56] accurate a lower

[1:15:01] price I if you want us to not have the inspector out there every day we can we

[1:15:06] can work that through and look at reduce the hours that they have in for

[1:15:13] inspection I just want to work really smart on

[1:15:16] this and um I think what we need to do tonight this might just one councilman

[1:15:23] speaking is to approved the project with the the total aggregate cost on the

[1:15:30] 1369 and give you directions that you have to

[1:15:34] go back to nv5 and really really tighten up these numbers and see where they can

[1:15:40] pull things out and if uh if they can have the inspect I don't want any

[1:15:44] inspector out here if they don't have to be out here type thing if it's on a need

[1:15:48] type basis and they have to we're pulling all this money out of the

[1:15:52] general fund to make this thing happen and

[1:15:55] I understand if you need the inspector out here and you need the management

[1:15:59] from that team out here fine but we need to really tighten this up because I look

[1:16:06] back on the last proposal from nv5 and this is this is like almost double and

[1:16:12] it's um maybe they have more work in it but they need to go back and relook at

[1:16:17] the whole thing and that's where I'm coming from that if

[1:16:21] you're going to use them you got to really tell them that you've got to

[1:16:25] sharpen your pencil and not have any person out here when they don't need to

[1:16:28] be type thing and reduce that cost at that

[1:16:34] 192 that's just one council

[1:16:43] member Mr Zula I'm in substantial agreement with Brian if You' like to

[1:16:48] make an motion I'd second it okay well I'm ready to make a motion

[1:16:53] then I'll make a motion to award the fiscal year 20 2223 Street Improvement

[1:16:59] project to onx Paving Company in the amount of 1,

[1:17:02] 369,000 authorize a contingency fee for the project of 50

[1:17:08] 15% and go back to nv5 for um to sharpen their pencil on their whole entire

[1:17:15] contract amount and minimize any labor at all

[1:17:20] that has to come out here and just use them uh only the

[1:17:25] absolute absolute minimum amount and if uh if

[1:17:31] they they can't do that or they can't reduce their costs in this thing we're

[1:17:35] going to have to go out to bid on it I know that'll slow things down so I don't

[1:17:39] really want to do that either and then authorize the finance manager to amend

[1:17:43] fiscal year 2024 budget to increase the amount uh of the 725,000

[1:17:55] city manager execute the contracts in a form approved by the City

[1:18:00] attorney one second oh oh bar okay well do you have to author

[1:18:07] authorize the budget amendment for that full amount if you're hoping well I did

[1:18:12] because I I don't know what it's going to be or anything else so at least we

[1:18:16] have some latitude in there I think we given clear instruction that this number

[1:18:20] has to come

[1:18:23] down was is that a second Mr zoua or I think Dennis beat me to it but oh fair

[1:19:17] okay number 18 financial assistance and recovery from the winter

[1:19:23] storms thank you May and Council um this is continuing some of the information

[1:19:29] that related to our storms from February um as we move for further through the

[1:19:34] process um We are continuing through the process with um FEMA we have a dedicated

[1:19:40] representative that we work with at FEMA um that we work to put all of our costs

[1:19:46] that we've incurred so far in any future future work that may need to be done in

[1:19:50] mitigation that we work with that um that individual to help us through that

[1:19:54] process um have been working very very well with that aspect of it as moving

[1:19:59] forward um so we we meet with them on a pretty much weekly basis from there we

[1:20:04] last meeting we worked with um a member of their mitigation staff to look at

[1:20:09] some of the areas that we may need to do future mitigation work um so that's

[1:20:13] areas of Henda where we saw some failures area of East Road where we saw

[1:20:17] some failures also some of the drainage areas that um we saw overrun with debris

[1:20:23] from the debris flows that are coming off the Hillside and speaking with the

[1:20:27] mitigation expert from FEMA they will come out um and actually walk us through

[1:20:32] that and that proposal as well so we're finalizing that damage assessment form

[1:20:38] with our representative and are working to schedule a time for the U mitigation

[1:20:44] representative to come out um a couple of things that go along with mitigation

[1:20:48] aspect of it is um we could you we receive about 100% of what we have in

[1:20:53] costs that go out the door as far as emergency work that we have done that we

[1:20:58] receive reimbursement for which right now is just a little under half a

[1:21:02] million dollar and we receive that in there if we need to go above and beyond

[1:21:06] that aspect of it if there is some damage that needs attention and

[1:21:10] mitigation work to prevent this in the future um if it's above that half

[1:21:14] million dollar Mark and we would have to go through a cost benefit analysis to

[1:21:18] see if there is a benefit of doing that work to be able to get there um as part

[1:21:22] of it so um we're in that phase with Fem right now um recently you've seen there

[1:21:27] some work has happened out on uh some of the roads we made some repairs to East

[1:21:32] Road where there was some SL failure in that area um so that stretch at 400

[1:21:36] block of East Road was repaired and so at city engineer worked with um put

[1:21:43] together a little bit of bid documents we put that project out to bid um so

[1:21:46] that stretch of East Road was actually elevated on one side to help keep the

[1:21:51] water to flow pitch to the other side of the road um some burm will be coming in

[1:21:55] from there similar on LEF Flo where there was a section where that road

[1:22:00] roadside had washed away and we did some repair work along lafl section of

[1:22:05] Fullerton Road and East Road as well um with the company CTI um so that Paving

[1:22:10] work was recently done the burm work should be happening very very soon um as

[1:22:14] part of that so it's all reimbursable costs that go into um

[1:22:19] our claim but our paperwork with FEMA as well so all of those things are are

[1:22:24] moving through the process um as we speak we're actually meeting with our

[1:22:28] representative tomorrow um we have a scheduled meeting with him from there

[1:22:32] Tom is there anything else you wanted to add that I might have

[1:22:37] missed I don't think he

[1:22:42] heard Council has any options we're any questions we're happy to answer Mr bisa

[1:22:47] so a couple things um I mayor Englehart and I have met with some of the

[1:22:53] residents along hosand that were impacted by the debris flows um are we

[1:22:58] going to be able to have some mitigations in place before next

[1:23:03] winter we're working on larger mitigation with FEMA um at the same time

[1:23:09] city engineer and myself are looking at some more specific things that we could

[1:23:13] do now um that may not necessarily be as part of that mitigation work that FEMA

[1:23:19] does but things that we can do to some of those drainage facilities at s

[1:23:22] impacts um to help prevent this from the next rainy season which is coming up can

[1:23:27] we is there a possibility of understanding what those might look like

[1:23:31] by October yes okay because i' I'd like to

[1:23:35] make sure that they have an opport you know if we can agendize it for October

[1:23:39] that would be great and I'd like to invite them to come down to the October

[1:23:42] meeting to voice their concerns because they have some pretty specific concerns

[1:23:46] about you know what happened and I know the mayor and I have been um trying to

[1:23:52] help them understand the process we go through to make changes to both drainage

[1:23:56] and possibly even the road so i' like to agendize that if possible uh number

[1:24:05] two is Mr Brooks brought up and I'll agree with him on this one thing Weston

[1:24:11] Hender really is an isore um I I hope that part

[1:24:16] of the the recovery plan is to remove the tons and tons and tons of storm

[1:24:23] debris that have been dumped there and it's now I mean we're several months

[1:24:27] from the event is there a plan to remove and and restore that lot back to the

[1:24:32] condition it was in before the storm there is um as part of the fuma process

[1:24:37] we have to remove those debris in a very specific fashion um we also have to bid

[1:24:42] that process out so Grace has been in the process of bidding it we were just

[1:24:46] waiting for the last bid to come in we need the three we need at least three

[1:24:50] bids as part of our purchasing policy to be able to do that um and we're just the

[1:24:55] last bid is coming in right now so once we have that then we can move forward

[1:24:59] with it it's not going to be inexpensive to remove that from the property um but

[1:25:04] it would remove all of that material that was staged or deposited on West

[1:25:09] Nanda and we'll get recovery for those costs we have it already we already have

[1:25:14] it as a line item in our recovery cost once we have the hard cost we'll be able

[1:25:17] to add that dollar figure to it okay I had a question about Western Henda the

[1:25:24] the the burms they're there to keep people off the property I mean it's not

[1:25:30] like it's going to end up being a flat piece of land no I was talking about no

[1:25:34] I agree the BMS need to stay it was specific to the the debris that was

[1:25:39] placed there I BMS were there before the storm so yeah I don't know if it was Mr

[1:25:44] Brooks or Mr Fernandez were complaining about I think it was Mr Fernandez was

[1:25:48] complaining about the BMS but yeah well we can I mean as a council we can talk

[1:25:55] about what we want to do with that piece of property I guess I mean I think

[1:25:58] there's some ideas maybe we need to resurrect those in the near future about

[1:26:03] what we should do with that property so maybe that's another thing

[1:26:07] we agendize for later in the year thank you anyone else okay number

[1:26:20] we're still in the window for October for delivery the new type 1 engine um so

[1:26:27] hopefully we should be getting that soon it's going through the production

[1:26:29] process right now as we see we made some pretty significant uh progress on the

[1:26:33] solid waste agreement tonight we'll continue to work city attorney's office

[1:26:37] to finalize the agreement with we and bring that back to the council for you

[1:26:41] to ratify um and put that into place as we roll that out to the October

[1:26:46] changeover from Republic to now wear Disposal Services as part of that so

[1:26:51] that's a very good thing there I assess accessibility improvements at the park

[1:26:57] uh we are meeting this week with our representative from cdbg related to the

[1:27:01] funding that we can utilize for the ramp to clarify and finalize if we can do a

[1:27:07] design build aspect of it or if they need plans to be reviewed and approved

[1:27:11] as part of their project before they can authorize us to spend money on it um so

[1:27:17] uh this this coming Wednesday our representative from cdbg our community

[1:27:21] development block block block grant program um will be coming out and

[1:27:25] meeting with us in Walking the site of the park so we can finalize that so if

[1:27:29] we can do a design build aspect of it we can move forward with design build um

[1:27:33] instead of preparing plans and then going out to bid for for construction um

[1:27:38] she she was looking at there is the potential for it um to go through that

[1:27:42] design build process she just needed to finalize or gather some more information

[1:27:46] from her side from her her uh fellow colleagues and then we'll meet and

[1:27:51] discuss that on Wednesday we'll meet with her as that part of it

[1:27:54] um h Road saf safety Improvement plan so avocado Crest signal um contractor has

[1:28:01] the big things in as far as the polls traffic cabinets and the um controller

[1:28:08] for the signal are in and ordered the roads committee reviewed the signage

[1:28:13] that will go on the polls um as part of their their packet that they looked at

[1:28:17] last month they made a recommendation to have those signs that hang that on the

[1:28:22] pole let's say h Road and avocado Crest um to match our regular street signs

[1:28:26] that we have so we'll include City seal and have a bit of orange around the

[1:28:31] border of it so what our regular street signs look like our illuminated signs on

[1:28:36] the signal will look similar and we'll use that as we move replace the other

[1:28:41] signage along henda's Road at the other signals West Henda East in Henda there

[1:28:46] isn't any signal any signage like that at uh Skyline so as we replace those in

[1:28:51] the future we can make that all consistent and keep that moving forward

[1:28:54] they have a tentative turn on date of March 2025 for the signal that will be

[1:29:01] the completion of having the signal in tested and all of the striping and

[1:29:05] signage being replaced on Henda by March of 2025 is is the

[1:29:11] contractor's best schedule at the moment so for that one the measure W monies um

[1:29:19] we've received monies related to that and we're in the process of scheduling

[1:29:23] those Works to be done um we have been working with uh the contractor or the

[1:29:29] company that had the project at the park for the regional component um Tom had

[1:29:33] just met with him last week to review and discuss some some options related to

[1:29:37] that um so we should hopefully be able to bring that back to the council here

[1:29:41] relatively soon with some good explanations as to the cost for the

[1:29:46] system ongoing maintenance and looking at transfer agreement and documentation

[1:29:51] that we need to execute with the county as well so hopefully should have that

[1:29:54] here for you um at our next meeting um and Gerald's in the process of revising

[1:29:59] the guard rail RFP we worked with the rad advisory committee to look at he

[1:30:04] went out and did an assessment of all the areas in town that have guard rail

[1:30:07] some areas that need guard rail put that into a priority list we worked with the

[1:30:11] roads advisory committee to look at that priority list to see if that was the

[1:30:14] areas they felt we should focus on first um they they agreed um so that is being

[1:30:19] revised so we can get it released here hopefully by the end of the month it's

[1:30:23] kind of where we're at right now if you have any questions I'm happy to

[1:30:26] answer Mr P pleas so two things um what's going on with our since you

[1:30:32] brought up signage our city limit signs the one on the north end of town at

[1:30:38] Henda has been gone for eight months now yes uh we were in the process of trying

[1:30:44] to get those put into order I believe right when all our storm happened I mean

[1:30:50] grace got tied up with everything so she's in the process of completing that

[1:30:54] order now so we can order those signs and get them installed okay and then are

[1:30:59] we not repairing guardrail in the city now because of the replacement

[1:31:04] project we have I noticed that there's been quite a bit of damage to guardrail

[1:31:09] that has not been repaired for many months yeah we need to move forward on

[1:31:13] some Replacements of guard rails a couple of those are Insurance related so

[1:31:18] we have to work with assessments from crashes that have happened and we

[1:31:22] actually get claims from insurance to be able to go through the insurance process

[1:31:26] and replace that c rail there is there is at least one stretch that we don't

[1:31:31] have any identifiable claim or crash data to to go back to that we can look

[1:31:37] at

[1:31:41] okay when do you think the work on the avocado Crest T signal will start it's

[1:31:47] still late October um they recently did some pot

[1:31:51] holing out there so they looked at the locations where the polls would be going

[1:31:55] to make sure there's no utility lines that would be in the area they didn't

[1:31:58] find anything which is good so no changes needed to be done to Foundation

[1:32:03] or pole design they are anticipated like late October to start doing some work um

[1:32:09] out at those sites is kind of where we're at today with them um but that

[1:32:13] might stretch into early November just depending on when they start receiving

[1:32:19] equipment thank you anybody else

[1:33:37] equipment in several occasion she is just a kick to be around arry so and so

[1:33:45] you get her mad there's nobody like her but she's about as sweet as they come

[1:33:51] just for the sake of anybody that wants to know about the heights give her a
