do the invocation tonight. So, if you'll
please stand.

Lord, we come to you for guidance,
wisdom, and grace in the oath we take to
[11:31]
serve the citizens of this city. We ask
that you give us that understanding to
[11:35]
listen better and speak with our hearts
that look to serve.
[11:40]
We come wanting understanding, Lord, as
we have all seen the tragedy that took
[11:43]
place and touched our nation. The loss
of Charlie Kirk should be the reminder
[11:47]
that we should live Christlike. While
the battle cry may say live like Charlie
[11:52]
or I am Charlie, it is simply a way of
the reminder that we can all love like
[11:56]
Jesus.
We can find forgiveness in those that
[11:59]
trespass against us because that is what
our savior did for us when he laid down
[12:03]
his life. So if you will all join me.
Our father who art in heaven, hallowed
[12:10]
be thy name, thy kingdom come, thy will
be done on earth as it is in heaven.

one is John McDonald. And so we will

honor him tonight in our meeting. And
with that, we will uh treat each other
[13:43]
with kindness.
So that's going to bring us up to our

What does one say about a person who has

shown courage to stand up and serve? Who
has shown compassion when working with
[14:02]
people? Who has shown understanding when
listening to the people whom she comes
[14:06]
into contact with? How do you say thank
you, honor, and make sure they know they
[14:10]
are valued and appreciated for all they
do and have done? And I have no doubt
[14:14]
will continue to do even after she steps
away from this seat. Maybe the best way
[14:19]
to do it is serve as Bev has, but just
make sure to hold a better poker face
[14:23]
when the topics are not so fun.
Here's the thing. I firmly feel and
[14:29]
believe that this city is better because
of Bev. It is said, it was said by Teddy
[14:33]
Roosevelt, "Walk softly and carry a big
stick." And honestly, if you go with the
[14:37]
meaning behind it, it means to approach
situations with a gentle demeanor and be
[14:41]
prepared to use strong measures when
necessary. A lesson we should all
[14:45]
remember not only in saying but doing.
Bev has taught me a lot and in many
[14:49]
cases how to have a better tamed tongue
and sit back and take deep breaths and
[14:54]
focus on moving forward and doing good
things. It isn't about getting in the
[14:58]
mud and rolling around and getting
dirty. It's about the windshield. It is
[15:02]
much larger than the rearview mirror.
Unfortunately, it took me a bit of time
[15:07]
to concede this
as I am a stubborn Taurus and I do not
[15:13]
like to sit quiet sometimes. Bev will be
missed and I will continue to lean on
[15:17]
her for her mentorship even though she
will be absent from the office of city
[15:21]
manager going forward.
Bev, you are truly a good person. You
[15:25]
took things on the chin even in our
disagreements on many matters. You
[15:28]
always remain professional, kind, and
more so my friend. I love you. You are a
[15:33]
rock and you will always be the first
city manager of Mlennon Chisum and we
[15:36]
thank you for your service.

this. So I apologize if y'all notice

this proclamation and then staff will
present her her road sign and a couple
[16:46]
other little things and then we'll get

proclamation whereas Bev Stevens a 1973
graduate of Pana noise married her
[16:57]
husband Neil who she met on a blind date
in 1976
[17:02]
and married in 1977 and moved with him
to Mlendon Chisum in 1980.

Whereas before acting as our intern city
administrator, Bev has been part of our
[17:13]
part of several nonprofit organizations
such as American Heart Association,
[17:17]
Dallas Area Habitat for Humanity, and
Volunteer Center of North America.
[17:22]
Whereas Bev has many talents, including
being a trained florist with a true
[17:27]
green thumb, she also enjoys travel,
traveling with the world with her
[17:32]
husband and loves cruising.
Whereas between cruises, Bev has had a
[17:38]
firm belief in serving and being a part
of her community. Over the years, she is
[17:42]
involved in all parts of her community,
including helping hands, Rockwell open
[17:46]
space alliance, women in need, and the
chocolate indulgence committee.

Whereas in 2003, she was citizen of the
year of Mlennon Chisum and Rockwell I
[17:58]
will mess this word up.

pleasure and a humbled honor to be able

to recognize her for her outstanding
service to the city of Mlennon, Chisum,

Rockwalk County, and the impact she has

we only have platting authority, um, for
this case. So, the that being said, the

applicant is here if you do have
development questions, um, questions
[22:49]
about his development as a whole, but as
far as the city is concerned, I only
[22:53]
have, um, subdivision ordinance
authority, platting authority.

with me on the final plat? And the

reason it's on consent agenda is because
when it's a final plat,

unless there is some crazy legal reason,

this item before you this evening is
[26:30]
regarding uh donating a 1995 Pierce Fire
Engine to the North Texas Fire Academy
[26:37]
for uh purposes of training in exchange
for $10,000 equivalent in uh training uh
[26:46]
credit. And as I understand it, that
would be in addition to the already
[26:50]
granted uh $10,000 worth of training
credits. Yes. Uh, with that said, staff
[26:58]
does recommend approval of this item. We
have in the audience with us, Mr.
[27:03]
Michael Simmons that is here available
for any questions if you should you have
[27:08]

sure why uh we are having to come here

with the exception of the fact that we
have a site plan um that was submitted
[30:55]
for approval on uh a 7 acre track that
we have on the east side of uh State
[31:04]
Highway 205 at the intersection of 205
and 550.

Um there's a couple of things that I
think point out um that kind of tie and
[31:15]
coincide together here tonight that I
think that um ultimately we need to look
[31:21]
at ultimately in your packet what you
have in front of you and the request of
[31:27]
sames suggests that the council is to
interpret whether or not our plan
[31:31]
development is in conformance.
Um there's certainly developers that
[31:36]
have done this a lot longer than I have,
but this is a first for me. And so, um,
[31:41]
it seems as though we're going a little
bit out of order, but, um, your city
[31:46]
planner has suggested that the site plan
application that we had by 7-Eleven, um,
[31:52]
as the enduser through a developer by
the name of Verd,
[31:57]
um, who is a buyer from one of our
holdings, uh, submitted a site plan
[32:02]
approval that was ultimately rejected by
the city planner. Uh, when
[32:10]
here tonight. Uh, and I do apologize
that you have 80 plus pages in your
[32:15]
packet tonight. There's two things if
you were to go break out and I'm happy
[32:19]
to talk at length in whatever capacity
you'd like to. There's two things that I
[32:23]
think that we need to look at tonight.
One is ultimately the rejection which
[32:28]
suggests that we are not in conformance.
And I trust that you uh received in your
[32:33]
packet and saw in exhibit I on page 209
and 210 a two-page letter that I
[32:41]
concluded by providing five or six
reasons very specifically stating as to
[32:46]
why I believe this is more in
conformance than than not.
[32:51]
And the second thing that we have to
talk about tonight is an already
[32:55]
approved plat that uh took place at the
December 10th
[33:01]
uh conclude who our ultimate enduser was
going to be and that the mayor and the
[33:06]
city manager had the authority to make
interior lot line changes.
[33:11]
And so as part of our site plan
approval, we sent the uh plat reflecting
[33:20]
a
uh 2025 date in the signature blocks in
[33:25]
lie of the 2024.
and we adjusted the interior lot lines
[33:30]
in two different places and uh would
just point out for the record that none
[33:35]
of the exterior perimeters have changed.
So, um you received in your packet um
[33:44]
80 plus pages and um beginning on page
132
[33:51]
through 134 in your packet, there was
ultimately five different sections of
[33:57]
reasoning as to why that this was
rejected
[34:01]
uh by nonconformance.
And so if now is the time, I would be
[34:06]
happy to go through those, but I want to
respect the process and um go through
[34:12]
that. I would ask when it comes to the
plat that you get the official word from
[34:18]
your city attorney from a vested rights
perspective. It's my firm belief that we
[34:23]
established that back on December 10th
of 2024
[34:28]
and uh feel with certainty that he will
agree with the same. But I would ask
[34:33]
that you not ask me my opinion because
I'm clearly trying to move forward with
[34:36]
a development and a disposition of an
asset and would like for you to get that
[34:41]
blessing from him. But I can't move
forward with the development of 711
[34:48]
without going through a site plan
approval of which I feel that we're in
[34:51]
full conformance with from what I now
understand that we have to add a layer
[34:56]
of government to the process by getting
your blessing of conformity. So, I guess
[35:02]
my first question, Mr. Mayor, is is
do we want to go through this in in
[35:08]
great detail now? Would you like an
opportunity to meet with the council?
[35:11]
How would you like for me to proceed
with my my questions? I would actually
[35:16]
be okay with hearing your input. Um, and
I and I would think the council would
[35:22]
agree to hear it all now, if you're okay
with it. And and
[35:27]
time. I'm okay with the time because one
thing that I want to make very clear is
[35:32]
as a city, whether it's an elected or a
staff, we have to be better and we have
[35:37]
to make sure that we're here to serve
you. Whether you're a developer or a
[35:41]
citizen, you're coming to our city and
that's that's our role is to serve. So,
[35:47]
I respect your time. If you're willing
to share your input, I'm taking notes
[35:51]
because I think it's prudent to do so if
everyone's in agreement.

um I'm dealing with a city planner
that's stated no less than four times
[36:07]
that they don't support our use nor our
user. And um
[36:12]
he's told me that uh he's told that to
my partners. He's told that to myself.

And I would respectfully tell you that
you're out of bounds and you don't have
[36:21]
that authority. We're inside a plan
development district and we're in
[36:25]
conformance. And with that, I would
proceed forward. The first thing that we
[36:30]
want to talk about is uh conformity.
If I could get you to direct your
[36:35]
attention to page 185 inside your
packet, um you will find my letter and
[36:42]
on the I apologize. Uh,
page 132 of your packet.

the way that

our site plan. The concept plan shows a
fire lane generally from each of the
[38:06]
respective entrances.
So does our site plan. Generally, the
[38:10]
concept plan shows two buildings north
of the proposed entrance on state
[38:14]
highway 205.
So does our site plan.

Ordinance number 2022-11
PD permitted uses states, and I quote,
[38:25]
"The uses allowed or prohibited in this
plan development district are as
[38:29]
follows. Those uses allowed in the city
of Mlin and Chisum GB general business
[38:35]
district namely convenience store with
or without fuel sales is a permitted use
[38:41]
that does not require an SUP.
We have a plan development district that
[38:47]
was approved back in 2022
[38:52]
and we are not asking for any variances
and our initial site plan approval
[38:58]
request is for a use that's permitted by
right that doesn't even require an SUP.

Second thing that I want to point out
tonight that I would respectfully ask
[39:09]
that you consult with your city attorney
on is an already approved
[39:16]
final plaque that was blessed by
unanimously by the council on at the
[39:21]
December 10th, 2024 meeting.
And I would ask that you ask your city
[39:27]
attorney about our vested rights. And
specifically, I would ask that you ask
[39:33]
for clarity in the direction that I was
given by your city staff at that time to
[39:38]
hold off on your signature, Mr. Mayor,
as well as the city manager or the city
[39:42]
administrator, I believe, at that time
because we were working with two
[39:47]
different applicants at the time as who
was going to be purchasing purchasing
[39:52]
the hard corner. and we were told that
it was proper
[39:58]
for us to wait until that was
identified, which is what we've done.

And so alongside our site plan
application here, we submitted
[40:10]
the revised and current site plan that
showed those modifications and addressed
[40:15]
the respective comments with Mr. Sherman
in person to where
[40:21]
at the time we had a full understanding
and what I understood to be complete
[40:28]
support same. Those are the two matters
um on pages um
[40:37]
132 through 135 in your 134 in your
packet. You have five items noted by
[40:45]
staff, namely Mr. Sherman.
One being the comprehensive plan.
[40:52]

legalities and allow him to explain uh

So, let me start off by saying the
council is really excited
[1:26:58]
about the particular uh developer and
what they brought to the city. Um, they
[1:27:04]
actually wanted to do a lot of things
tonight. So, it is my fault that they
[1:27:10]
are hopefully not going to do anything
uh tonight. And and I'll explain the
[1:27:15]
reason why about that. Uh because like I
said, council is they want to make sure
[1:27:20]
that they're treating everybody fairly,
that everybody gets what the due process
[1:27:26]
allows them to get under the ordinances
uh under a code of ordinances. They're
[1:27:30]
very adamant about that. They're very
appreciative of you actually
[1:27:34]
specifically uh Mr. Barry. The mayor
didn't want me to say that, but I
[1:27:37]
thought I would, you know, let you know
they specifically appreciate it. um the
[1:27:42]
where it looks like there was maybe a
mislication of our ordinances because if
[1:27:47]
you look at five this language is taken
almost directly from 5-1 I think it's
[1:27:51]
subsection uh D of our code of
ordinances zoning ordinance and in
[1:27:57]
five-1 it starts off with in the
establishment of a plan development
[1:28:02]
district and then it's got ABC and D
well that is that whole procedure is
[1:28:08]
when you're actually in the process of
establish establishing a plan
[1:28:11]
development. That's not what's going on
out here. One of the council members you
[1:28:16]
So, you're basically saying that the
horse is out of the barn, it's gone,
[1:28:19]
it's had ponies, and now it's in the
glue factory. I said, exactly. This was
[1:28:23]
done. I thought it was pretty clever
myself. That was three years ago. It's
[1:28:27]
over. It's done. So, there there there
is no authority for the council to take
[1:28:32]
action at this point. So um what now
different things can happen at at this
[1:28:39]
point you know where we are we can you
can leave it where it is um you know you
[1:28:44]
can you can continue to try to work with
staff see what we can work out there's
[1:28:48]
also an option if you want to amend uh
see to amend the PD to conform with
[1:28:53]
whatever the the consent plan you had
and I understand there may be some
[1:28:56]
disagreement between staff and developer
but here's the thing if the developer
[1:29:00]
says look I'm willing to do I don't know
say A B and
[1:29:04]
But the staff wants me to also do deenf.
I don't think I need to or I don't want
[1:29:09]
to or both. That doesn't mean council's
going to make the the or even P&Z is
[1:29:15]
going to recommend that the developer do
def. That is totally within the purview
[1:29:20]
of the council. So it can go through P&Z
and they can come to council and council
[1:29:24]
can say hey you know what uh developer I
agree with you. I think only AB and C
[1:29:29]
are necessary. So we're going to approve
the amendment to the PD with just ABC
[1:29:34]
and not DEF. So council that is
perfectly within their perview,
[1:29:37]
perfectly within their authority to do
that. So those are just a couple of
[1:29:41]
options. Uh you know that they are. But
as far as tonight, as much as council
[1:29:46]
would gen genuinely like to do something
because what I've appreciated about this
[1:29:51]
council is they're willing to not not
concede to developers, but they
[1:29:55]
understand that that the best option is
to work with developers because that's
[1:29:58]
going to benefit the community and
everybody as a whole. at this point, the
[1:30:03]
way the ordinance is and and we kind of
apologize and and maybe I should have
[1:30:07]
caught it too that the way it's worded
and taking from the section of our
[1:30:11]
ordinance that it was in, it should have
really been on the agenda even for
[1:30:14]
tonight. So, and I don't want them to to
ask questions. So, please blame me. It
[1:30:21]
is not their fault. They are genuinely
excited about y'all, but I have asked
[1:30:26]
them not to have their questions
answered because in the future, for an
[1:30:31]
example, if there is an attempted minute
in the PD, I don't want them to have all
[1:30:35]
their questions answered and they made a
decision tonight when it's not even in
[1:30:38]
front of them. So, that's kind of just
generally where they are.

that this is not a zoning case.
uh we were here or required to be here

conformity so that we can move forward
with the site plan approval process. And
[1:31:26]
so the only action that I would
interpret, as much as I would love to
[1:31:30]
ask for you to uh to to take this under
advisement for a site plan approval, I

clarification that's being required or

zoning commission docket was because his
[1:33:46]
interpretation was is that our site plan
uh suggested a use and or what have you
[1:33:53]
that's not in conformance with my plan
development district. And you're telling
[1:33:57]
me in section 5-1D to the best of your
memory, we're not writing that down. uh
[1:34:02]
to the best of your knowledge that 51D
states that that's only applicable at
[1:34:07]
the time we're establishing a plan
development district that's already been
[1:34:11]
created and established,

does the new concept plan conform with
that concept plan then? And if not, what
[1:35:37]
has changed? Because there are avenues
and you know this as well as I do. There
[1:35:41]
are avenues where there and and there
there may be a difference of opinion on
[1:35:45]
what a minor deviation from the concept
plan is. I don't really have a problem
[1:35:50]
if there's uh minor deviations saying
yeah this concept plan we're not going
[1:35:55]
to have an issue with that. If they're
major then maybe we need to do an
[1:35:59]
amendment to the PD. So and I think
that's something that the city can fast
[1:36:04]
track. I think we can get that done
inside of a month. uh depending on if
[1:36:09]
that's the the route that we want to go.

misunderstanding of the way our
ordinance was written and so it never

through5 but they wanted us to have a

document in place that stated PID money
did not pay for water infrastructure.

weekends, and how you totally took
advantage of the fact I love you would

never build a city for that and the
thousands of dollars you saved them. So,

you showed me you were smart. You know,
even when you would call just to

complain about how you to talk slowly,
connect the dots for Council Member
[2:28:03]
Goodwin. He wasn't. I I never I never
mind it. And actually, as soon as you
[2:28:09]
said that, I whispered, "But Bev, I got
I said, I got one." But in all
[2:28:13]
seriousness, I I worked with you early
on. We kept in touch during the times
[2:28:18]
that I wasn't a part of the city, so I
always knew what was going on in the
[2:28:22]
city. And I remember thinking, "Oh,
okay. You know, Bev's got a lot a lot of
[2:28:27]
that she can offer as a city
administrator." I said, I I there's a
[2:28:30]
lot there that she can do. My only
concern is she hasn't actually done the
[2:28:34]
job. So, it was there were times that I
literally forgot that you hadn't been a
[2:28:39]
city administrator her whole life. And I
I've told you more than once and and I
[2:28:42]
mean it that it you missed your call. I
think you are you you just jumped into
[2:28:50]
the job. You had natural instincts a
ppeaciousness about the the job and how
[2:28:55]
to do the job and and what how to react
and what to say and what to do that you
[2:29:00]
you can't always teach somebody. Sure,
people can learn it, but you didn't
[2:29:05]
necessarily need, you know, to learn
that. You just the actual, you know,
[2:29:09]
training, seminars, whatever, whatever.
Um, you you didn't have that, but you
[2:29:15]
just had a natural ability to do it. And
it just really over time it really
[2:29:20]
amazed me and I appreciated that about
you and I appreciated the fact that you
[2:29:24]
know all seriousness is you don't really
give filtered opinions. I mean, you you

to know there's so much to what we do

appreciated knowing you and you know me
meant a lot to me personally and how

you've been there for me when I've
needed things and how our friendship,

you know, has grown over this and I know
you're going to be around but it's going
[2:29:51]
to be, you know, it's going to be, you
know, different. I mean, you're you call
[2:29:56]
and and you know, honestly, half the
time that I never put anything on the
[2:29:59]
bill was was, you know, there may be 15
minutes, 20 minutes of city business and
[2:30:03]
then 15 or 20 minutes of us just, you
know, talking and so I I know you're
[2:30:08]
going to still be around. I am excited
about Breeze. I mean, I genuinely am.
[2:30:11]
I've known him for a while and I'm being
dead serious. I am very excited about
[2:30:15]
Freeze. He was the guy who was hoping it
was all I could do. I had to sit on my
[2:30:18]
hands and sit on my lips to not say
anything, you know, about Freeze. I'm
[2:30:22]
excited, but I'm I'm generally in and
with all my heart going to miss having
[2:30:27]
you around and and you'll always be my
friend. And if you ever need anything,
[2:30:31]
you can always just let me know that.

too much to recognize just the wealth of

information, the wealth of knowledge
that she carries with her, the
[2:30:59]
commitment and dedication that she has
for the city of Mland and Chisum. Uh
[2:31:03]
I've been extremely lucky. Not most new
city managers don't have somebody to
[2:31:08]
hold their hands during the transition
process and she's been that for me.
[2:31:12]
She's graciously been willing to do that
for me and I really appreciate it. Um
[2:31:17]
and and that's part of the reason why
we've decided to keep her on an as
[2:31:22]
needed basis.
It's because she has such a she's such a
[2:31:26]
resource. Uh so thank you. Thank you on
a personal level. I really appreciate
[2:31:30]
it. Uh it's a pleasure. I'm I'm excited
to be able to join the city and I'm
[2:31:35]
looking forward to everything that we'll
be able to accomplish. I'm looking
[2:31:37]
forward to working with the team and
with you serving under your leadership,
[2:31:41]
mayor and council members. Um, and
secondly, I do want to remind you that
[2:31:46]
we have a joint training session
tomorrow evening at 6:30 p.m. that will
[2:31:51]
be provided by Mr. Holla and that would
be between uh with city council and PNZ.

hat, and probably a few others. And I
jokingly say that because I don't know

if I would be the mayor I am today if it
wouldn't have been for your guidance.

And I know we joke a lot that I didn't
take your advice. Uh I know that so I'm
[2:33:16]
basically blaming her for all the
videos. I'm basically blaming her for
[2:33:20]
all the posts. Basically every speech
written uh is Beth Dibbons. Uh I will be

happy to give her personal email out. On
a serious note, you have been a solid
[2:33:34]
person in my corner and I appreciate
that very much. Um, also with that said,

my next ask is our next council meeting

is October 14th. Okay. Um that's Charlie
Kirk's birthday and I would ask us to

all be in red.
So, if we can all wear red on October

14th, I would appreciate that, council.
Uh, I'll leave that up to you. If you

want to wear a red freedom shirt or
however you want to do that, uh, staff,

And also, there is a meeting scheduled
for council on in November that is going
[2:34:37]
to be November 11th. That is Veterans
Day. I will be cancelling that and I
[2:34:41]
will be calling a special meeting for
November 18th. Uh I will not hold a
[2:34:46]
council meeting on Veterans Day
um because we will be honoring veterans
[2:34:50]
that evening uh with a sunset um event
and I will not dishonor uh veterans by
[2:34:58]
holding a council meeting when we need
to be honoring them. So please know that
[2:35:01]
I will cancel November 11th and I will
move us to November 18th. So council, if
[2:35:08]
y'all can make yourselves aware, staff
Angela, you need to know that for
[2:35:11]
posting purposes with the new law
