Now, I don't know that gentleman, but he
gave us [laughter] the thumbs up, so
[0:03]
okay.
All right.
[0:05]
We'll call the meeting to order.
[0:10]
» All right, roll call. Uh Chairperson
Gambling.
[0:13]
» Present.
>> Ms. Johnson.
[0:14]
» Here.
>> Ms. [clears throat] Warner.
[0:16]
» Here.
>> Ms. Shira.
[0:17]
» Here.
>> Um Ms. Bouncing.
[0:19]
» Here.
>> And Ms. Mizuta.
[0:21]
» Here.
>> Roll call has been called.
[0:23]
» Okay.
The swearing in.
[0:26]
» Yep, swearing in of witnesses. Uh
because this is an adjudicatory hearing
[0:30]
that is based on facts and not on public
opinion. Therefore, everyone that is
[0:34]
going to be testifying today
will need to be sworn in. All witnesses
[0:38]
who plan on testifying must raise your
right hand.
[0:43]
Uh do you swear to tell the truth and
nothing but the truth?
[0:46]
» I do.
>> Yes.
[0:48]
» All right, all witnesses are sworn in.
>> Okay.
[0:53]
Before we get started, we have the
approval of March 31st, 2026 the meeting
[0:58]
minutes. So, did everybody read the
minutes? Is there any corrections or
[1:03]
anything that needs to be deleted or
added?
[1:06]
I'll make a motion that we approve the
March 31st meeting minutes. Second.
[1:12]
» And we done.
>> There we go.
[1:14]
» Okay.
[1:17]
So, it's been moved and second. All in
favor signify by saying I. I. I. No
[1:22]
opposed. Okay.
Um now, the housing I got a message that
[1:28]
we're not going to cover that today.
>> There is no update.
[1:31]
» No update. Okay. All right, so we will
move on to old business. As we stated in
[1:36]
the agenda, there is none. So, we will
start with new business.
[1:41]
» Yes, so new business tonight is case
number 26-0080.
[1:46]
Sharice Clinton for Tavaris Jamal LLC is
appealing the notice of order of
[1:51]
violation for a person living in a
trailer parked in the backyard behind
[1:56]
819 Perry Street Sandusky, Ohio 44870
parcel number 57 - 02349.000
[2:13]
» [clears throat]
[2:17]
» I'm code compliance manager Craig Ward.
I will be doing the presentation
[2:20]
tonight. So up on our slideshow tonight
819 Perry Street. This started with a
[2:26]
complaint that we received on March 27th
of 2026. The original complaint came
[2:31]
into office of code compliance
about a junk trailer parked on an
[2:35]
unapproved surface
behind 819 Perry Street on April 14th,
[2:41]
2026. The following pictures were taken
from a neighboring property.
[2:45]
This was adjacent to the property. The
pictures you're looking at here. I
[2:48]
believe we're looking at an East
Northeast direction.
[2:52]
Here's a couple other pictures just
showing an easterly direction of the
[2:55]
trailer that's parked in the backyard.
For perspective, I just included this
[3:00]
aerial drawing from um
the Erie County Auditor's site showing
[3:03]
819 Perry and the orange arrow indicates
where the trailer is located toward the
[3:08]
rear of the property. This I think from
the Auditor's site was from April of
[3:12]
2026.
Um on April 20th, 2026 an inspection was
[3:18]
performed.
During this inspection John Ferris from
[3:22]
the office of code compliance was there.
City building official Scott Tom,
[3:27]
property owner Sharice Clinton and
myself.
[3:30]
Just I included my inspection notes from
the day of the inspection just saying
[3:34]
that all of us met in the backyard of
the property to view the camping unit.
[3:38]
The owner stated she lives in the camper
which is situated in the north-south
[3:41]
direction along the rear property line.
Owner stated that the original idea was
[3:46]
to take the unit and basically move it
on and off the property like a normal
[3:48]
camper.
Um like you'd do for camping.
[3:52]
Uh, no permanent water sewer connections
were observed. The owner stated that the
[3:56]
unit is winterized during the cold
months, um, and just recently filled the
[4:01]
fresh water tank. She stated that she
can use the house and the local gym for
[4:05]
showering. The owner was informed that
campers, uh, may be stored on properties
[4:09]
if on an approved surface or improved
surface.
[4:13]
Um, but the owner cannot occupy and live
in the camping unit. The owner expressed
[4:18]
no interest in abating the new the
issue, uh,
[4:21]
as she stated at that time.
The owner was informed that a violation
[4:25]
notice, uh, would be issued. Uh, Scott
Thom did also address some things, uh,
[4:30]
concerning the deck in the back being in
violation.
[4:33]
So, the same day, April 20th of 2026, a
notice of violation was issued and sent
[4:38]
certified mail and certificate of
mailing to the owner,
[4:41]
um, with a compliance and reinspection
date of May 1st, 2026.
[4:46]
The violation that was documented is,
uh, Sandusky City Ordinance 1341.10.
[4:51]
Um, and I'm not going to read the whole
thing to you, but I know it's in your
[4:54]
packet, it's up on the board. But,
basically it's just saying that
[4:57]
basically you cannot occupy any dwelling
that's not in compliance.
[5:01]
By definition, a camping unit is not
even a dwelling. It's classified as a
[5:06]
temporary housing structure, and that's
why [snorts] I included these
[5:09]
definitions in the presentation.
Um,
[5:13]
uh, when we before a reinspection could
even be performed on May 1st, 2026, the
[5:18]
property owner filed an appeal to
Housing Appeals Board on April 29th,
[5:22]
2026, which has kind of brought us here
tonight. And that's all I really have
[5:26]
for my presentation.
If anybody has any questions for me,
[5:35]
And that this would be your opportunity
if you'd like to come up and address,
[5:38]
um,
the Housing Appeals Board.
[5:41]
» Okay. Where do I go?
>> Uh, right up here to the podium.
[5:43]
» Okay.
[5:47]
» [clears throat]
>> Hi, Andrew. Hi, how are you? So, we're
[5:50]
going to ask you to state your name and
address for the record.
[5:53]
» Sherice Clinton, 819 Perry Street.
>> Okay.
[5:56]
» Okay. So, as he said, when I originally
got this trailer, it was not meant to
[6:02]
stay back there. That wasn't the purpose
of it. But, because of, you know, um my
[6:07]
neighbor
passing away, things changed. Um
[6:13]
so, it was stuck back there. So, I said,
"Well,
[6:17]
it's back there." I mean,
what could I do about it? I didn't worry
[6:20]
about it. It was already back there. So,
I said I might as well stay in it. You
[6:25]
know what I mean? But, I travel around
so much. When John originally called me,
[6:31]
told me about the complaint, I've known
him a very long time. He know what I do.
[6:37]
He know that I travel around a lot. I
even explained that to Craig when he
[6:41]
came over there, cuz they were saying
that this was a temporary housing.
[6:45]
This whole year, it's June now, I
probably stayed in there a month, maybe.
[6:51]
Cuz I'm just I travel around. But, I
guess, um
[6:56]
for me, it kind of makes me feel like
I'm being targeted or discriminated
[7:01]
against, honestly, because I don't
bother
[7:05]
anybody, and I own that piece of
property. Um so, I don't understand why
[7:11]
my trailer can't sit back [cough] there.
It's on blocks. It's it's in compliance
[7:16]
because it's on blocks.
I don't understand what
[7:21]
the issue is. You know? I just I don't I
don't understand the issue.
[7:26]
» So, question. So, do you own the trailer
or who is this to What's his name?
[7:30]
Tavaris?
>> Tavaris Jamel.
[7:33]
» Okay, so who is that?
>> That's my business.
[7:35]
» That's your business.
>> Mhm.
[7:36]
» Okay, so
not getting personal, but what type of
[7:41]
business is it?
>> Um well, I had a beauty supply store and
[7:45]
I'm a stylist.
Um it's just my business name and I put
[7:50]
the trailer in my home [clears throat]
in my business name.
[7:53]
» All right.
>> May I ask a question?
[7:55]
» Yeah.
>> How did it get back there if you can't
[7:57]
get it out?
>> Well, I got it delivered. So, what
[8:00]
happened was like in the front of my
house, you really can't tell it's this
[8:04]
big old long fence. So, probably about
midway through, a piece of it got stuck
[8:10]
on the fence because up at the top it
got like those little hook things, but
[8:14]
it got stuck. So, the neighbors let me
remove like a little piece of their
[8:19]
fence to so it'll finish going in there
and then he told me when I got ready to
[8:24]
move it out, he would let me do the same
thing. But then he since passed away,
[8:28]
you know? So,
it was it's just stuck.
[8:33]
» Ma'am, can you speak into the
microphone? Bend that to you.
[8:36]
» Okay, microphone.
>> [cough]
[8:39]
[clears throat]
>> So, we can hear you. Thank you.
[8:41]
» Okay.
>> So, do you live in the trailer?
[8:44]
» Um when I'm here, yes, I do.
>> But you own the property, so there's a
[8:48]
house on it, correct?
>> It is.
[8:50]
» So, you don't live in the house?
>> No, it's occupied by five women.
[8:55]
» I mean, are you renting it to them?
>> I'm not.
[9:05]
» I
>> Oh, go ahead. Go ahead.
[9:07]
» You You mentioned that the previous
owner passed away the owner of the
[9:10]
fence. Have you contacted the new owners
>> Well, it's still
[9:15]
» about the dilemma you're facing here?
>> It's still the same people. It's just
[9:20]
the husband passed away and then the son
is in control of everything now and he's
[9:27]
just like, "No, it's not going down."
>> [clears throat]
[9:31]
» So, I don't I don't know.
[9:37]
» Well, per the statutes, you can't live
in that.
[9:42]
And that's why we're here today
primarily. I mean, even though you are
[9:47]
um
on rocks and based on what, you know,
[9:52]
the city is saying,
um
[9:55]
it may be
fit at this point because it is on the
[9:59]
rocks, but the other part of that is it
can't be considered a standard dwelling
[10:05]
because you have no electricity.
>> I have electricity.
[10:08]
» So, how do you have the electricity
running?
[10:10]
» I had electric ran
from the house.
[10:15]
» Now, that's
I'm not going to say it's illegal. I'm
[10:20]
going to say that that can be a fire
hazard. So, that's something that needs
[10:25]
to be considered in this. Do you have
running water? Now, the understanding I
[10:29]
have based on this is saying that you um
shower
[10:35]
All right, see, you go to the gym and
shower.
[10:37]
» Mhm. Or to my mom's. My mom is the one
that live in the house in front. I want
[10:42]
to be close to my mom, but now I can't
stay with my mom. I'm 49 years old, but
[10:47]
that means she's 20-something years
older than me. So, I want to be close to
[10:50]
her without being there. You know,
women have all different types of
[10:55]
attitudes and it's like a five women in
that house. I need my own space.
[11:00]
So, when I'm around, I go in the
trailer.
[11:04]
» [clears throat]
[11:07]
» Go ahead.
>> I have a few questions.
[11:11]
How many times a month do you live in
that trailer?
[11:14]
» Um this month I've stayed in there
around eight days.
[11:18]
» Eight days?
Eight straight days or different days?
[11:22]
» No, chopped up. I did a few weeks in
Miami, and I just got back from Africa.
[11:27]
So, when I come back, I'll stay, and
then I leave again.
[11:33]
» Okay. Um you say you you're under an
LLC. What kind of business is that?
[11:39]
» Uh it was a beauty supply store.
>> Beauty supply store? Okay.
[11:44]
» [clears throat]
>> Where's your store at?
[11:47]
» Um I actually just sold it in March.
>> Was it in Sandusky?
[11:51]
» Mhm.
>> Where at?
[11:53]
» It was sorry. It was on
Washington Street right down the right
[11:57]
down the street next to Circle K.
>> Okay. And you say there's five women
[12:04]
living in your 819 Perry rental. You
rent that out to five women?
[12:09]
» No, I don't rent it out. I just let my
mom stay there.
[12:13]
It's basically her house.
>> Oh, it's your mom's house. Okay.
[12:19]
Um
Okay, just a second here.
[12:23]
Um so your mom lives there with four
other women.
[12:26]
» Yes.
>> And you have to live in the trailer when
[12:30]
you come up?
>> I just need my own space. When I come
[12:34]
around, I go sleep in the trailer.
>> Does she not have room at in at the 819
[12:41]
Perry Street for you?
>> No, and I don't want to stay there.
[12:45]
» You don't. Okay, so I'm confused. Where
is your Where are you living? What
[12:50]
Where's your residence at? You here in
Sandusky or someplace else?
[12:54]
» Well, I really don't have a residence.
[12:59]
I don't have a permanent place.
>> Well, technically you have a residence
[13:03]
because remember in the beginning I
asked you you have to state your name
[13:06]
and your address. So under what they
consider the mail law, if you're
[13:11]
receiving mail at a particular
residence, that is considered your home.
[13:17]
So
technically you do have a residence,
[13:21]
which is the Perry Street address.
>> Right.
[13:23]
» Now the things that you are allowed to
do at your home, as long as you're not
[13:28]
in violation, there's nothing that we
can do. But there is a violation here.
[13:32]
So, that's what we're going to have to
work out today on what is going to be
[13:37]
the best solution
at this point.
[13:39]
» Okay.
>> You You can't live in there.
[13:43]
» Okay, I still have some more questions.
Questions.
[13:46]
» Okay. [clears throat]
>> Okay.
[13:48]
Um how long has the trailer been on the
back lot?
[13:51]
» Since 2024.
>> 2024, okay. Is there an alleyway back
[13:57]
there?
>> No.
[13:58]
» No?
Okay. So, in order to get that trailer
[14:03]
out of there, you have to ask the
neighbor to take down his fence.
[14:07]
» Correct.
>> Okay.
[14:09]
Do you think he would be agreeable to
that?
[14:12]
» Well, I've already tried.
That's I've already tried.
[14:16]
» And he says no?
>> He says no.
[14:19]
» Okay.
>> be back there, to be honest with you.
[14:22]
» Okay, so what kind of shape is your
trailer in?
[14:25]
» It's a brand new trailer. It's a 2025,
and I purchased it in 2024.
[14:32]
» Okay.
Um
[14:36]
» [snorts]
[sighs and gasps]
[14:38]
» There's There's a question here about
404 Reese.
[14:42]
» Mhm.
>> Uh where does that come in at?
[14:46]
» Well, that was my mother's home, and
it's since been sold.
[14:50]
» Okay, she sold that, and she's now
living at Perry.
[14:53]
» Correct.
>> Okay.
[14:56]
All right.
Okay, I guess that's all I have.
[15:01]
» Hold up. Um Mindy, what?
>> Has the trailer ever been moved out of
[15:05]
the backyard?
>> No.
[15:07]
» So, you put it in in 2024,
and you said your intent was to take it
[15:11]
places. When did the person next door
pass?
[15:14]
» He passed away last year. He passed away
in 2025.
[15:17]
» So,
why was it never moved? You said you got
[15:21]
it cuz you wanted to take it places and
>> [clears throat]
[15:24]
» places, but you've never in the time
where you still had the permission to
[15:28]
move the fence,
you never moved it. You never
[15:32]
[clears throat] took it.
>> Mhm. Because I still had my store. So, I
[15:36]
tried to remove it once I sold my store.
That's when I found out that it wasn't
[15:40]
happening.
>> So, it just so happens when you sold the
[15:43]
stores when all this came to fruition
that someone said there was a trailer in
[15:47]
your backyard.
>> That's what I'm saying. Ain't that
[15:50]
weird? Now, I sold the store in March.
And then when it started getting when
[15:56]
the weather started changing, that's
when I wanted to take it out. And that's
[16:00]
when I was told I wasn't able to take it
out.
[16:03]
And then they get a complaint, which I
don't understand.
[16:06]
» So, it sounds like I mean, since you
bought it in 2024 and it never went out,
[16:11]
you bought that to live I mean,
to have in the backyard.
[16:15]
» Well, no because
>> took it out.
[16:17]
» Well, no because when I purchased it, I
was at the 404 Reese house rehabbing it.
[16:25]
» So, it was still in the backyard though.
>> It It was still in the backyard, but I
[16:29]
was at 404 Reese Street and my mother
was at 819 Perry Street. I only went
[16:34]
there once the 404 Reese Street house
sold.
[16:38]
» When was that?
>> About 5 6 months ago.
[16:44]
It was around
October, November maybe
[16:48]
of last year.
>> So, like 8 months?
[16:51]
» Somewhere up in there, yeah.
>> So, you were living on Reese Street, mom
[16:56]
was on Perry Street, trailer's never
been moved.
[16:59]
» No.
>> Okay.
[17:01]
» And the only reason cuz it was it was
sideways. Like soon as you pull it in,
[17:05]
so it's facing like this. So, it was
facing to be able to just pull back out.
[17:10]
When the neighbors told me I wasn't able
to move it, I moved it to the back of
[17:15]
the yard because it wasn't originally
there.
[17:19]
» Do you have a vehicle big enough to tow
the trailer?
[17:22]
» I don't.
>> So, how were you ever going to get the
[17:24]
trailer out?
>> Well, because I was supposed to buy a
[17:27]
truck, but I just bought a Lincoln and I
bought it maybe four or five months ago
[17:33]
and I only bought it because they told
me I couldn't move the fence to pull the
[17:37]
trailer. So, I felt like this is it.
What am I get a truck for?
[17:42]
That's why I bought a car, but I was
buying a truck to pull it.
[17:47]
» Lisa, you got a question, huh? Go ahead.
>> Um
[17:52]
my question is more along the lines of
our code. Do we have any part of the
[17:58]
code that would
make it an accessory dwelling? What
[18:01]
would she have to do to be in compliance
to have that trailer there? Do we have
[18:07]
anything in code that allows that?
>> I think I'd defer to Adam probably on
[18:11]
the accessory structure.
>> Hi, I'm Adam. I'm assistant city
[18:14]
planner. Craig asked me to be here for
some support. Um yes, I can answer the
[18:18]
question. It's no. The short answer is
no. We don't currently have any
[18:22]
provisions in our planning and zoning
code
[18:25]
or any other [clears throat] code that
I'm aware of that would permit an
[18:29]
accessory dwelling unit or if I might
add um
[18:35]
or I guess
I'll answer that question for now, but I
[18:37]
can take any other related ones.
>> Um I just had like a follow-up, but it's
[18:41]
not it's
What can she do to remove it based upon
[18:46]
What are the Does she have If there's a
If she needs to remove her property,
[18:52]
what can be done because it has to
traverse over somebody else's property?
[18:56]
Is there anything that can be done
to remove it?
[19:01]
» Um as far as I'm aware, I mean
>> Legally, does she have any right to
[19:05]
remove that from her?
>> I mean, it got there one one way.
[19:11]
» Right.
>> So, in my opinion, there's there is a
[19:13]
viable route. It's just what route will
the city allow
[19:17]
» Yeah.
>> the appellant to take.
[19:19]
» Does she have to go to court to try to
remove it? Does she have to get an
[19:22]
order?
>> I'm not exactly certain. The law
[19:25]
director can feel free to step in, but I
I've seen things like temporary work
[19:31]
easements. It's like the most formalized
way you can do it, but
[19:35]
I I would expect neighbors to behave
that as neighbors and you know, allow
[19:41]
» She's got a brand new trailer. I see why
she wants to use it.
[19:43]
» Alternatively, the the appellant could
rent a crane. That would be the most you
[19:47]
know, you know, severe option, but I
think it would exist since you're asking
[19:52]
the question.
>> All right.
[19:58]
I have another question if everybody's
done.
[20:00]
» I'll go ahead.
>> Um you said that
[20:03]
is this classified as a trailer home or
an RV?
[20:08]
» It's a trailer. It's a one-bedroom
trailer.
[20:11]
» One of those trailers that you would put
in a home trailer park?
[20:14]
» Um no, it's one of the pool travel
trailers.
[20:19]
It would attach to the back of like your
car.
[20:21]
» Yeah. Truck.
>> Oh, okay.
[20:23]
» Type of trailer.
>> Okay. That you haul around.
[20:25]
» Go camping.
>> How many How many feet is long is that
[20:29]
trailer?
>> 27.
[20:30]
» 27-ft? Okay.
Um you said that you travel around on
[20:35]
business a lot and when you come into
town eight days out of the month, you
[20:40]
you live in the trailer. Where do you
live when you're traveling around?
[20:45]
» Hotels, Airbnbs, hostels.
>> You live at in Airbnbs?
[20:54]
Okay.
And And where where else do you do you
[20:58]
go to hotels or what?
>> Uh yeah.
[21:02]
» Okay.
>> When I'm traveling, yeah, cuz I fly.
[21:06]
» You fly?
>> Mhm.
[21:08]
» Okay.
Okay.
[21:12]
That's all I have.
>> If I may?
[21:15]
» Go ahead.
>> You mentioned that the trailer was
[21:18]
repositioned from where you originally
had it located. I guess
[21:22]
uh parallel to the fence and then it
relocated perpendicular.
[21:25]
» Mhm.
>> How was it moved?
[21:27]
» One of those dingos.
>> I'm sorry, but I don't know what a dingo
[21:30]
is.
>> One of those
[21:32]
little small dingos that you get on it
it had the the hitch and it hitched to
[21:37]
the top of it and then it just move it.
>> So it's motorized type of thing?
[21:42]
» Yeah. Hitch it to a truck.
>> Okay.
[21:44]
» What's the complaint?
>> Okay.
[21:46]
I I If I may, I have one other question.
>> Mhm.
[21:48]
» How How did you ask the neighbor? Was it
verbally? Was it written? How How did
[21:53]
you make contact with neighbor to ask
him about to take the fence down
[21:56]
temporarily so you could
>> Well, I talked to them all the time, you
[22:00]
know, like I've known their family my
whole life, you know. This is why the
[22:06]
husband allowed me to do it. So things
didn't change until he passed away and
[22:10]
the son got involved. So I don't know um
the son just
[22:18]
uh
he just won't allow it to happen.
[22:24]
I don't know.
>> If If it did happen, whose cost would
[22:27]
that be? On on you or would it be on him
or
[22:30]
» No, it would be on me. Uh when I remove
like the little piece putting it in
[22:35]
there, I fixed it right back.
I thought it it just wasn't going to be
[22:41]
an issue.
>> Okay.
[22:43]
» [clears throat]
>> And then I I do have one question then
[22:46]
for the the city representatives. As we
see trailers temporary when people come
[22:51]
in for a weekend and so on
park in a driveway. How is that
[22:56]
different than what we're seeing here?
>> Sure. So
[23:00]
» Like a weekend type of thing it's not a
dwelling.
[23:02]
» Parking your own personal recreational
vehicle is very different than using
[23:07]
that as a dwelling.
From the perspective of the planning and
[23:10]
zoning code,
this camper, however it may be
[23:13]
classified, however long it is, it has
wheels on it. Anything with wheels on it
[23:18]
per my code
is mobile and therefore does not fit the
[23:22]
definition of a permanent structure.
To be a dwelling of any kind,
[23:29]
it needs to fit that definition. It
needs to be a permanent structure. It
[23:33]
has wheels, it can't be a dwelling. So,
her property is zoned R140 single family
[23:39]
residential district, which permits
exactly one dwelling and any customary
[23:44]
accessory buildings, sheds, garage,
detached garages, what have you. But
[23:49]
again, those even those customary
accessory buildings or structures
[23:54]
are permanent. This has wheels, it's
it's not a permanent structure. So, that
[23:59]
that would be really the difference.
>> Okay.
[24:03]
» So, do you think your neighbor
just say maybe you got a letter from the
[24:09]
city that said that you have to move it
and that you'd be willing to pay for it,
[24:13]
would they be willing to work with you?
>> Um maybe.
[24:17]
I can't I don't It's not even the mom.
It's not Miss Ernestine. It's her son.
[24:22]
» No, well
>> Because
[24:23]
» I'm just saying. I mean, the son
And again, I don't know the situation.
[24:27]
» Mhm.
>> So, and I don't know
[24:30]
who has the legal standing on that,
whether it's in her name or in his name.
[24:36]
But I'm just saying from the standpoint
here that
[24:41]
you know, okay, he's being difficult.
So, maybe to get around that, if you had
[24:46]
a letter from the city that states that
you need to move this. Because if they
[24:51]
know you, they don't want to see you go
to jail. They don't want to see you in
[24:54]
court. I wouldn't. So, and if you had a
letter from the city that says I need to
[24:59]
move this or this is what's going to
happen to me, but I'm willing to pay to
[25:04]
have this done, would you be willing to
work with me? So, that's what I'm I'm
[25:08]
just asking if you think that they would
be accommodating in that sense.
[25:12]
» I would [clears throat] hope so
because I don't have a problem moving
[25:15]
about it moving it moving it.
It wasn't supposed to stay there
[25:19]
permanently anyway.
>> So, then to the city I ask
[25:24]
I mean, are we in
reason or within guidelines to give her
[25:29]
something to state to them that she has
to have this moved and then she can
[25:35]
offer to pay whatever. We wouldn't be
taking care of that, but if we gave her
[25:39]
some type of legal letter of some sort
that we she needs to move it, can we do
[25:46]
that?
>> Uh the answer is yes, we could.
[25:49]
» Okay.
So.
[25:53]
» One more question.
>> Okay.
[25:55]
» When you first put that trailer on there
like a year or so ago,
[26:00]
um
who
[26:02]
did you have somebody who owned a truck
to put that in there or
[26:07]
» No, the place where I bought it from,
they delivered it.
[26:11]
» They brought it in for you? Okay. Okay,
now if this guy takes down his fence,
[26:18]
can you scoot it out on his driveway or
are you going to dig up his lawn while
[26:23]
you're bringing that out?
>> No, my mother's driveway go from the
[26:28]
front of the street all the way to where
the backyard begins. So, it's like long,
[26:35]
like maybe 20 or 30 ft worth of
driveway. So, once the little piece of
[26:40]
fence go, then the trailer will just
come out.
[26:45]
» So, it would cross over to his property
and then back around to your mother's
[26:51]
driveway?
>> Um not really cuz it was just like a
[26:55]
like a section of his fence that stuck
on my trailer cuz my trailer just went
[27:01]
all the way in down my driveway.
So I just had to move that little
[27:06]
section right there so I could get in
there.
[27:08]
» May I approach? I'm looking at the
satellite view.
[27:11]
» Yes.
>> It's a better view than the one we have.
[27:14]
» Can we bring that up? Can we bring that
up on this?
[27:17]
» He going to try but if he can't the the
>> [laughter]
[27:20]
» He going to bring it to us and
[clears throat] let us see it.
[27:24]
» Where is where's the trailer now?
>> The trailer is on this property.
[27:28]
» [laughter]
[27:30]
» It's a brand new trailer.
>> That's her mother's driveway. Oh, okay.
[27:36]
» Trailer [clears throat and cough] is
back here.
[27:37]
» Yeah, the trailer is back here. Looks
like there used to be like a shed or
[27:39]
something back here.
>> Okay.
[27:41]
» So once she gets that over and across to
that driveway
[27:44]
» The trailer is just too wide to make it
through there. So the fence is there's a
[27:49]
shadow here.
>> Oh, okay.
[27:51]
» Okay.
>> Can you show the other board members so
[27:54]
they can see?
Thank you.
[27:57]
» This is the driveway that she tried to
get in. This driveway is that like a big
[28:01]
piece of
>> Oh, there it is.
[28:02]
» You see this chain link fence?
>> There's the driveway.
[28:05]
» Yeah.
>> Yeah, I think if we
[28:07]
» We going to give her a letter and she
>> Go all the way to the end of the house.
[28:12]
» This must be the fence.
>> You know.
[28:15]
Know who does what with that.
[28:20]
» 60 days.
>> Yeah.
[28:24]
» All right, is there
>> You have a question?
[28:26]
» Are there any more questions? Um
So
[28:32]
We going to work a plan with you. So
give give me a second here. So Mrs.
[28:35]
Sherrod
>> I'd like to make a motion if I could.
[28:38]
Can I It's a couple of parts. Number one
is I'd like to
[28:42]
request the city to provide the
documentation that we discussed here
[28:47]
briefly to her
uh
[28:50]
and that's uh like get that done here in
the next few weeks if we could.
[28:54]
The second part of the motion would is
we delay a decision on this
[28:58]
uh for approximately 90 I would say 90
days. That gives you uh plenty of time
[29:03]
to go ahead and make contact with your
neighbor and
[29:06]
hopefully it'll get resolved and this
issue will go away. If not, we'll be
[29:10]
back here in uh
90 days.
[29:12]
» Okay. It's a long time.
>> I I think this may take a while.
[29:16]
» It may take a while.
>> Yeah.
[29:18]
» And
as long as she's working at getting it
[29:22]
taken care of, I don't see a problem
with that. Does anyone else see a
[29:25]
problem? But if you have any
stipulations or questions, this is time
[29:29]
to ask.
Okay. [clears throat]
[29:32]
So, there is a motion on the floor for
the city department to give a letter to
[29:40]
her and we're giving her 90 days to work
this out with her
[29:47]
um neighbor.
So, here's a motion. Can I get a second?
[29:56]
» I'll second it since I didn't talk.
>> [laughter]
[30:00]
» So, it's been moved
>> Wait a minute. I'd like to discuss this
[30:03]
also.
>> Well, she was given a sec
[30:04]
» Well, you can't [laughter] I mean I I
left that open for you. So, now it's
[30:08]
been motioned and a second motion. So,
we can't can't can't change it now.
[30:12]
» But you can ask questions.
>> Well, first we have to finish the
[30:17]
motion.
>> Yeah.
[30:18]
» So, it's been moved and second. All in
favor signify by saying I.
[30:22]
» Are there any questions?
>> No. Any opposed?
[30:25]
» Opposed.
>> Okay.
[30:29]
Um
>> I think 90 days I think
[30:32]
60. I was thinking 30, but I think 60
would be favorable cuz if we do 90 days,
[30:37]
that's putting us into October meeting
before we would see her again.
[30:42]
Cuz we meet at the end of the month.
[30:47]
Cuz it would be
>> I think 90 days is too long. That's too
[30:50]
long.
>> Either the
[30:52]
It's a cut and dried. Either the
neighbor's going to move the fence or he
[30:56]
isn't. It's cut and dried.
>> Well, again, but but you don't have to
[31:00]
deal with the neighbor. She does. So, if
90 days that you guys feel is too long,
[31:05]
the motion has died. We can redo a
different motion if that's what you guys
[31:10]
choose to do.
So, same motion is out there.
[31:15]
» She will get a letter from this Excuse
me.
[31:18]
» I heard two nays. Was there a third?
>> So, I am actually abstaining. So, Lisa,
[31:25]
you would actually be the deciding for
this.
[31:28]
» Oh, I'm in favor of the motion.
>> No, no.
[31:31]
» She can't vote.
>> Who's Yes, she can't vote. There's two
[31:34]
two. That means the motion fails.
>> She can discuss but not vote.
[31:38]
» So, so the motion has died. Is that what
you're saying? That's what I need to
[31:41]
know.
>> Yes. Yes.
[31:42]
» Okay, so
>> I wasn't sure of the final tally.
[31:44]
» Okay, got you. So, we are going to redo
the same motion, which we can do that
[31:49]
with the different changes, correct?
>> Yes.
[31:52]
» Okay, so now
I'm explaining it again for the last
[31:55]
time.
The motion is that the city will provide
[32:00]
Ms. Clinton with a letter.
We are giving her 60 days to address the
[32:07]
letter and everything with her neighbor
in order to have this moved before our
[32:12]
next meeting.
All in favor signify Well, first of all,
[32:17]
can I get a second to the motion?
>> I'll second it.
[32:21]
» Okay.
It's been moved and second. All in favor
[32:26]
signify
>> Wait a minute. What happened to the
[32:27]
discussion?
>> It After you
[32:29]
» Okay, so I'm not understanding this
because we had 90 days. Now we're down
[32:34]
to 60 days.
>> first of all, I just asked you did you
[32:37]
have any questions? So, I'm not going to
keep going back and forth. The substance
[32:41]
of this is at this point 90 days you
guys
[32:46]
voided it cuz you didn't want to go with
that.
[32:49]
» So, now the motion has been put back out
there with 60 days.
[32:52]
» Okay.
>> Are you with it or not?
[32:55]
» No.
>> Okay, so you you stated no, but first of
[32:59]
all, we haven't even had
the whole
[33:02]
meeting done at this point. So, first of
all, all in favor signify by saying I.
[33:08]
» I.
>> Any opposed?
[33:10]
» I oppose.
>> Okay. Can I get a
[33:14]
um a vote count?
And I'm abstaining.
[33:18]
» I'll vote.
>> Katrina.
[33:21]
» Miss Sherrod.
Mr. Sherrod.
[33:24]
» Yeah.
Yay.
[33:29]
» Miss Janice.
>> Yes.
[33:35]
» Miss Johnson.
>> No.
[33:41]
» Miss Mindy.
>> Yes.
[33:44]
» Motion passes.
>> Okay, motion is passed. So,
[33:49]
to clarify so that there is no
misunderstanding on this part. So, we
[33:53]
are going to work with you and you're
going to get a letter from the city that
[33:57]
states what you need to do and what we
expect to get done.
[34:01]
» Okay.
>> You it's up to you to discuss that with
[34:04]
your neighbor and then figure out how
you guys want to do that.
[34:09]
Again,
if you would be so courteous if you get
[34:14]
that figured out to please inform the
Housing Appeals Board. Other than that,
[34:18]
they will will be reviewing this back in
60 days. So, if you want to wait and
[34:23]
come back in 60 days and tell us
something or have it done within 60
[34:27]
days, that is strictly up to you. But in
60 days, something needs to be handled.
[34:32]
» Okay.
>> Okay.
[34:37]
Can I get a motion for adjournment?
>> I'll make that motion.
[34:41]
» I second.
>> It's been moved and second. All in favor
[34:44]
signify by saying I.
>> I.
[34:46]
» I.
>> It's a done.
[34:47]
Okay, I know that we did
