[0:26]
All right.
[0:29]
I'd like to ask everybody to
[0:32]
rise for a moment of silence,
[0:38]
please
[0:40]
.
[0:41]
MR. Mayor, would you sign the
[0:42]
pledge of allegiance, please?
[0:47]
I pledge allegiance to the flag
[0:49]
of the united states of america
[0:50]
for which it stands one nation
[0:54]
under GOD, indivisible, with
[0:54]
liberty and justice for all.
[1:01]
For all
[1:04]
.
[1:04]
All right.
[1:08]
Deputy chief.
[1:08]
How are you tonight?
[1:12]
I'm great.
[1:12]
>> how are you guys?
[1:13]
Wonderful.
[1:14]
Do we have any changes to the
[1:16]
agenda?
[1:16]
Yes.
[1:17]
I'm happy to report that we
[1:18]
will remove five of one as it
[1:19]
came into compliance late this
[1:22]
afternoon.
[1:22]
>> wonderful.
[1:23]
And I would also like to make a
[1:27]
recommendation if the board so
[1:30]
desires to move 5o2 in front of
[1:31]
500 as we don't have anybody
[1:33]
from 500 here at this time and
[1:36]
several people for 5o2.
[1:36]
No objection.
[1:40]
All in favor?
[1:40]
Right.
[1:47]
Yeah, no problem.
[1:47]
Okay.
[1:51]
MAY I ask that all code
[1:51]
enforcement officers and other
[1:54]
individuals giving testimony
[1:55]
this evening please come up to
[1:58]
the podium on you're going to
[1:58]
give testimony and announce
[2:02]
your name, position or your
[2:02]
name and address.
[2:06]
And before speaking.
[2:07]
And at this time, if you plan
[2:08]
to come up, if you would stand
[2:15]
and be sworn in, no.
[2:16]
Can I have you raise your right
[2:19]
hand and then do you swear and
[2:20]
affirm to tell the truth the
[2:22]
whole truth and nothing but the
[2:22]
truth?
[2:23]
>> awesome.
[2:26]
Can I also just make a note of
[2:27]
anybody in the audience?
[2:27]
If you're going to speak, could
[2:30]
you just write your name down
[2:30]
on this little border here just
[2:31]
to make sure I have it spelled
[2:34]
correct in the minutes for me?
[2:34]
Yes, ma'am.
[2:41]
Thank you.
[2:42]
>> you guys are humming along.
[2:45]
No typos and everything look
[2:45]
good.
[2:46]
Okay.
[2:46]
Good job.
[2:46]
Thank you.
[2:49]
Triple j.
[2:49]
All right.
[2:52]
Did any one else read the
[2:55]
minutes from tuesday, JULY
[2:55]
28th, 2026.
[2:56]
>> sorry to your person.
[2:57]
We actually have to elect a
[2:59]
vice chairperson for the
[3:00]
remainder of this year.
[3:03]
Since miguel was our vice chair
[3:04]
we do have to just select
[3:06]
someone else just in case.
[3:06]
>> okay.
[3:11]
What happens if we don't select
[3:13]
someone?
[3:14]
Can we postpone it to the next
[3:17]
meeting?
[3:17]
Potentially.
[3:18]
It's really just the vice
[3:19]
chairperson there in case the
[3:21]
chairperson can't be here for
[3:22]
whatever reason the vice
[3:22]
chairperson can then run the
[3:23]
meeting.
[3:25]
It's just one of those
[3:26]
safeguards that we have in
[3:28]
place for that in case
[3:28]
something happens.
[3:32]
>> yeah, our main reasoning,
[3:33]
our hesitancy is miguel really
[3:35]
good.
[3:36]
He's very thorough and every
[3:40]
time we always learn something
[3:40]
from coaches.
[3:44]
>> what can we can we point to
[3:47]
interim for him?
[3:48]
I mean I mean, if he comes back
[3:51]
then he would take it now or do
[3:52]
we have to redo it for an issue
[3:54]
with that?
[3:55]
>> how does that work?
[3:56]
I think that would be fine.
[3:59]
Do we know if he's thinking of
[4:01]
coming back or we have an
[4:02]
application of file?
[4:02]
He has shown interest.
[4:03]
It's just in regards to the
[4:05]
commission has not reappointed
[4:06]
him yet.
[4:06]
>> sure.
[4:07]
And I got a response there on
[4:07]
it.
[4:10]
Yes, got that.
[4:10]
I'll be back.
[4:10]
Gotcha.
[4:14]
Yeah, we can table it for next
[4:14]
time or postpone it next time
[4:14]
if you would like.
[4:18]
Or we can appoint an interim
[4:18]
like we wouldn't for good for
[4:19]
the evening.
[4:21]
>> let's postpone until next
[4:22]
time.
[4:22]
Okay?
[4:22]
Okay.
[4:22]
Yeah.
[4:25]
Do we ever have an excuse me?
[4:26]
Do we ever have an opportunity
[4:27]
where this board would have to
[4:29]
meet prior to the next meeting?
[4:29]
>> not from my understand less.
[4:32]
It's a complete emergency, you
[4:33]
know, in regards to safety and
[4:33]
hazards and things.
[4:36]
But like I don't I've never had
[4:36]
that happen.
[4:39]
>> yeah that's that's correct.
[4:40]
If there was an emergency and
[4:41]
we needed to get the board
[4:45]
together, we could do so.
[4:46]
>> that's why I was asking
[4:48]
about a typical term.
[4:49]
But just at that point we could
[4:52]
look at that point if there's
[4:52]
an emergency, those of us who
[4:55]
come to that meeting would be
[4:56]
able to elect somebody at that
[4:56]
point.
[5:00]
>> I mean, again, it's only if
[5:00]
the chair person can't make it.
[5:01]
Yeah, that would be that would
[5:03]
be could we do that if the
[5:04]
chair couldn't make it, we
[5:05]
could all show up and then
[5:07]
elect somebody that night.
[5:07]
Sure.
[5:07]
Okay.
[5:07]
Yeah.
[5:08]
Then I'm good with it.
[5:11]
So then I would formally move
[5:14]
to table the yeah for me move
[5:18]
to the table the election of to
[5:18]
the next meeting.
[5:20]
Second.
[5:20]
Second.
[5:20]
All in favor?
[5:22]
I.
[5:27]
All right.
[5:27]
>> now back to where I was
[5:28]
thinking.
[5:31]
Sorry.
[5:31]
>> okay.
[5:31]
Just kidding.
[5:34]
Just on your job has anybody
[5:37]
reviewed the minutes from the
[5:38]
the JULY meeting?
[5:41]
JULY 28th, 2026?
[5:41]
Yes.
[5:42]
No, they were painful.
[5:44]
Sorry.
[5:45]
Do you and do you have any
[5:48]
changes, any issues or do you
[5:49]
have a motion to approve?
[5:52]
I didn't see anything that I
[5:57]
noted was incorrect.
[5:57]
Okay.
[5:57]
Okay.
[5:58]
So I would make a motion to
[6:03]
approve the minutes from JULY
[6:06]
2026 second nothing.
[6:09]
We have a second roll call.
[6:09]
Chairperson gilday.
[6:13]
Yeah.
[6:13]
Board member keppra board
[6:14]
member obama.
[6:16]
All right.
[6:17]
Board member cripps like board
[6:17]
member gallo.
[6:23]
All right.
[6:27]
I know continued cases, no
[6:31]
repeat cases 500.
[6:37]
We are going to move five out.
[6:41]
One is in compliance.
[6:44]
That brings us to five vote to
[6:47]
item five or to please.
[6:47]
>> good evening.
[6:48]
For the record, my name is
[6:48]

[7:41]

[7:50]
>> case summary JUNE 3rd, 2026
[7:50]
code compliance division
[7:53]
received a citizen complaint
[7:54]
regarding multiple code
[7:54]
violations at the reference
[7:56]
property on JUNE ninth a follow
[7:57]
up inspection was performed
[7:57]
observed building materials
[8:01]
overgrowth, yard debris damage
[8:04]
or dead trees, waste within the
[8:05]
front area of the property.
[8:06]
The screening as a site barrier
[8:08]
is in disarray and address
[8:09]
numbers on the property
[8:10]

[8:17]
violation was mailed to the
[8:19]
registered property owner by
[8:20]
usps certified mail with return
[8:22]
receipt requested posted at the
[8:23]
property where the alleged
[8:24]
violation existed and posted at
[8:28]
city hall exhibit 13 exhibit
[8:32]
one.
[8:34]
Exhibit two.
[8:39]
Exhibit three.
[8:43]
Exhibit four.
[8:50]
Exhibit five six.
[8:54]
Exhibit seven.
[8:57]
Exhibit eight.
[9:00]
Exhibit nine.
[9:04]
Exhibit ten.
[9:08]
Exhibit 11 and exhibit 12.
[9:08]
>> probably can't see too well,
[9:12]
but there is a medium sized
[9:15]
tree that has broken in half.
[9:16]
Top section has fallen over but
[9:19]
the other section remains
[9:20]
planted into the ground.
[9:24]
>> there is another tree in the
[9:24]
back you'll see in a different
[9:25]
exhibit.
[9:27]
Notice of violation posting
[9:32]
case summary JUNE 29, 2026
[9:32]
property ownership was updated
[9:34]
on seminole county appraiser as
[9:35]
of JUNE 15th 2026 followup
[9:39]
inspection was performed to
[9:40]
verify the violations remain on
[9:42]
the property JULY 14 to 2026
[9:43]
and also violation was mailed
[9:46]
to the register property owner
[9:46]
by usps certified mail return
[9:50]
receipt requested JULY 17, 2026
[9:50]
and notice of violation was
[9:51]
posted at the property and
[9:53]
posted at city hall exhibits 14
[9:59]
through 21
[10:09]
exhibit 1415 1617.
[10:10]
There's a you might not be able
[10:10]
to pick it up but there's
[10:12]
another large tree on the left
[10:12]
side behind the green tree.
[10:16]
There's a brown dead tree and I
[10:17]
think it's pine if I'm not
[10:20]
mistaken.
[10:25]
Exhibit 18, exhibit 19.
[10:35]
So at 2021 case summary JULY
[10:35]
24th 2026, a follow up
[10:36]
inspection was performed served
[10:37]
that the property remain in
[10:39]
violation.
[10:40]
Notice of colbourne hearing was
[10:43]
sent by us usps certified mail
[10:43]
return receipt requested posted
[10:44]
at the reference property and
[10:46]
at city hall exhibits 22
[10:52]
through 29
[11:04]
23 24, 25, 26
[11:11]
supposed to be 26 27, 28.
[11:12]
That's the other large tree I
[11:12]
was talking about on the rear
[11:15]
side of the property stop
[11:18]
recommendation stop recommends
[11:19]
the code enforcement board find
[11:20]
the property in violation of
[11:21]
one spring city ordinance 13
[11:24]
dash two be 13 dash two c 13
[11:28]
dash two d and city ordinance
[11:28]
9-374 to be corrected and the
[11:31]
property barn to compliance on
[11:34]
or before SEPTEMBER 24th 2026
[11:37]
30 days and consider imposition
[11:38]
of a daily fine up to 250 per
[11:38]
violation per day in the event
[11:40]
the requirements of the order
[11:41]
have not been met by the date
[11:42]
set forth for compliance by a
[11:44]
code enforcement board.
[11:45]
Can you pull up the day of
[11:51]
photos
[11:59]
?
[12:00]
>> oh, there should be a set of
[12:08]
I think 13 or 14 photos
[12:09]
.
[12:13]
>> so the front area the right
[12:14]
away has grown significantly
[12:17]
since the last inspection site
[12:21]
barrier still in disarray and
[12:22]
in fact even worse condition.
[12:23]
And it was before tree remains
[12:25]
in the front yard and that's
[12:31]
starting to grow.
[12:34]
>> building materials of the
[12:38]
various debris still remains
[12:46]
siberian still falling apart,
[12:46]
pallet still remains leaning on
[12:47]
the structure and other yard
[12:51]
debris.
[12:58]
That tree still remains
[12:58]
some
[13:02]
overgrowth to the rear side of
[13:06]
the property yard to bring in
[13:08]
the front area of the property
[13:09]
.
[13:09]
I think that was it.
[13:13]
Okay, that concludes our
[13:13]
presentation.
[13:14]
>> does the board have any
[13:14]
questions?
[13:16]
What type of dialog have you
[13:17]
had the owners?
[13:21]
>> none.
[13:22]
>> I actually received a return
[13:25]
mail not that long ago but I
[13:26]
have no communication, email or
[13:29]
phone by the new owners.
[13:31]
>> no new owners.
[13:32]
>> did they buy this as is or
[13:35]
was this under under
[13:36]
construction?
[13:40]
>> so I would presume as is
[13:40]
since the permit can't be
[13:41]
transferred over to the new
[13:41]
owner unless they go through
[13:44]
the same steps.
[13:51]
So as of JULY I mean JUNE 15th
[13:52]
,I have to go back to that.
[13:55]
As of that date when the
[13:55]
ownership changed, I didn't
[13:56]
cite the property right away
[13:59]
just to give some time to see
[14:00]
maybe the jump on something but
[14:03]
nothing was moving so the new
[14:03]
owners were cited
[14:03]
appropriately.
[14:07]
Okay.
[14:10]
Was this a foreclosure?
[14:10]
>> not to my understanding at
[14:11]
the time.
[14:14]
The original notice was given
[14:15]
the owner was in process of
[14:17]
still trying to get the permits
[14:18]
in place for the as he were
[14:21]
doing the first notice of
[14:22]
violation he received as a
[14:22]
separate matter.
[14:25]
But it was for a expired permit
[14:26]
which he ended up getting it
[14:29]
issued back to him again.
[14:30]
>> but then shortly after he
[14:33]
sold the property.
[14:36]
Is anyone living in this house?
[14:36]
>> oh, no.
[14:37]
Okay.
[14:37]
Not that I can see.
[14:40]
No.
[14:40]
Okay.
[14:41]
So it's not a rental?
[14:44]
No, it's pretty much a
[14:45]
construction site right now.
[14:49]
>> it's nothing going in and
[14:50]
out of that property, I
[14:50]
believe.
[14:52]
Anybody who wants to testify
[14:52]
here would probably say the
[14:53]
same.
[14:56]
>> okay.
[14:57]
Thank you.
[15:00]
And here is there a respondent
[15:09]
here for the the owner now the
[15:09]
owner's not here?
[15:13]
No.
[15:14]
and the owner has not responded
[15:17]
or accepted any of the service
[15:18]
on mail?
[15:21]
>> yeah, there was a return and
[15:22]
I have to look for it, but
[15:22]
nothing was claimed.
[15:26]
>> so you haven't got any phone
[15:26]
calls from the owner?
[15:29]
>> no.
[15:30]
The owner is g investments.
[15:30]
Okay.
[15:32]
Because the owner is g
[15:33]
investments and we've had
[15:38]
multiple cases like this in the
[15:40]
past where some bank or
[15:40]
investment company owns a
[15:41]
property and they just don't
[15:45]
respond to the bank pay for it.
[15:45]
>> yeah.
[15:49]
So the latest from postal
[15:52]
services AUGUST 17th of 2026
[15:55]
return notice it never was
[15:56]
signed for it was returned back
[15:56]
to sender.
[15:59]
Okay.
[16:00]
And we have folks that are
[16:03]
willing to give testimony on
[16:03]
this to the internal revenue
[16:06]
service property.
[16:07]
You could come up and state
[16:13]
your name and address.
[16:17]
What are you?
[16:20]
So ellen paul I live at 1201
[16:21]
street.
[16:24]
I one second will help you out
[16:24]
there.
[16:29]
It was on this.
[16:30]
Sorry about that.
[16:36]
Thank you
[16:36]
.
[16:37]
You can fill that out after.
[16:40]
Yeah.
[16:43]
This has been going on for four
[16:44]
years.
[16:44]
Okay.
[16:47]
We're going on the fifth year
[16:50]
the people decided to rather
[16:55]
than tear it down and build a
[16:56]
new house, they decided to
[16:58]
renovate.
[16:59]
apparently the contractor my
[17:03]
understanding was from
[17:05]
clearwater they had no more
[17:06]
than two people working on this
[17:09]
house for two years or four
[17:09]
years.
[17:13]
Then it went down to one person
[17:13]
and they would bring in stuff
[17:16]
and they the yard was just
[17:19]
piled with a dumpster and stuff
[17:20]
everywhere.
[17:23]
That was finally removed.
[17:27]
>> as you can see, the yard is
[17:28]
very unsafe.
[17:28]
It's a health hazard there.
[17:32]
Children in the neighborhood
[17:32]
that ride their bicycles by
[17:35]
going to school.
[17:35]
There are rats running out of
[17:39]
the house to the neighbors that
[17:39]
are on that side of the street.
[17:43]
They're dealing with rats.
[17:43]
I'm sure the raccoon family is
[17:46]
living in their maybe the
[17:46]
coyotes.
[17:46]
I don't know.
[17:50]
But there's all kind of there
[17:54]
was a dead rabbit that had been
[17:54]
I think the coyote got it in
[17:55]
the driveway.
[18:00]
So anyway, the back of the
[18:03]
house is completely open and
[18:04]
it's been open for four years.
[18:07]
So anything can run in and out
[18:07]
of there.
[18:11]
It's I'm sure people mold it
[18:11]
this property.
[18:15]
It just needs to be demolished
[18:15]
.
[18:16]
I don't know if the city can
[18:18]
demolish it.
[18:22]
It's awful.
[18:23]
You know, I think four years is
[18:23]
long enough for the neighbors
[18:26]
to have to suffer looking at
[18:26]
it.
[18:27]
And I'm sure if it was across
[18:29]
from your property you would be
[18:30]
as frustrated as we are.
[18:33]
So I appreciate you listening
[18:36]
to my rambling, but we're just
[18:36]
over this.
[18:40]
Anything you can do to speed up
[18:41]
the process would be greatly
[18:44]
appreciated.
[18:45]
Mean I'm sorry I didn't hear
[18:47]
where you're dressed.
[18:48]
>> are you a neighbor, I'm
[18:48]
assuming.
[18:51]
Yes.
[18:52]
I live across the street.
[18:52]
Three doors down.
[18:52]
Okay.
[18:53]
Thank you.
[18:55]
And I'm go by it every day.
[18:59]
In fact, I even walk on the
[19:00]
other side of the street
[19:00]
because I don't know what's
[19:02]
going to come out and bite you.
[19:02]
Okay.
[19:06]
Thank you.
[19:06]
Appreciate it.
[19:09]
Is there anyone else?
[19:14]
Hi, I'm paula jobe and I live
[19:16]
right next door at 1217 swan.
[19:23]
In their 30 years seen for
[19:24]
owners come and go.
[19:24]
>> now we're on the fifth.
[19:26]
I understand as a builder that
[19:30]
lives down the road on northern
[19:30]
.
[19:33]
My husband and I are very, very
[19:34]
high and taking pride on
[19:34]
ownership of our house and we
[19:38]
try very hard to have our lawn
[19:41]
and our house just so.
[19:42]
>> luckily I live on the side
[19:43]
where there's a hedge and a
[19:45]
fence, whereas we have
[19:45]
neighbors that live red cross
[19:46]
straight that have to see it
[19:48]
every single day.
[19:53]
>> the issue is I worked or I
[19:53]
know the owners of the past
[19:54]
owners and I know what happened
[19:56]
and I know why they sold the
[19:56]
house.
[19:57]
I also know that they told that
[19:58]
whoever is going to buy the
[20:01]
house has to demolish the
[20:01]
house.
[20:01]
There was extensive mold
[20:05]
because for four years nobody
[20:08]
lived in there and was open and
[20:09]
they were sorely disappointed.
[20:10]
But they certainly found the
[20:13]
house quick enough to purchase
[20:14]
and live away from from swan
[20:18]
street.
[20:19]
>> we've never my husband I've
[20:22]
never had rats until recently
[20:23]
and we've never had raccoons
[20:26]
until recently.
[20:26]
Our bird feeders are completely
[20:27]
gone because of all the rats
[20:27]
that come.
[20:30]
We had rats nesting in our
[20:34]
patio this past spring.
[20:34]
>> it's just been very hard.
[20:37]
Now our front lawn, which I
[20:41]
think I would love to say that
[20:41]
we probably have won the best
[20:42]
lawns, you know, in the
[20:42]
neighborhood just because my
[20:45]
husband put so much time in it.
[20:46]
The weeds, the seeds, the
[20:49]
branches those trees have
[20:49]
fallen on the fences.
[20:53]
The trees have fallen from the
[20:53]
front.
[20:54]
And as was seen in the
[20:57]
pictures, there is a actually a
[20:57]
large oak tree that broke and
[20:57]
fell.
[21:00]
Well, there's one that's fell
[21:01]
into our yard too that we had
[21:01]
to take care of.
[21:04]
>> so the thing is, is that
[21:05]
with this new builder I was so
[21:07]
happy to see that a new owner
[21:11]
had come in to the scene
[21:11]
because for four years we had
[21:15]
to deal with the past owner and
[21:15]
getting permits after permits
[21:19]
after permits to extend four
[21:19]
years of construction.
[21:20]
That never worked out for them.
[21:22]
So with the new owner back in
[21:23]
JUNE that bought the house, I
[21:26]
was like, oh please just mow
[21:26]
the lawn.
[21:27]
>> at least the old owner had a
[21:29]
service that came every week to
[21:29]
mow.
[21:30]
>> there's nothing been done.
[21:33]
And I just walked the sidewalk
[21:36]
this morning and the grass is
[21:37]
actually attaching itself from
[21:40]
side to side over the sidewalks
[21:40]
.
[21:40]
And in our block right now
[21:41]
they're putting a new
[21:41]
sidewalks.
[21:44]
They're digging out the old
[21:45]
ones and putting in new ones.
[21:45]
The cracked and broken.
[21:48]
And I can't wait until they get
[21:49]
on this side because of the
[21:49]
fact that they're going to fix
[21:52]
what's been broken and all the
[21:53]
hopefully all the weeds and the
[21:56]
bushes and the shrubs and it's
[21:56]
just it's just an ongoing
[21:57]
thing.
[21:59]
So with a new owner, my husband
[22:00]
was like, okay, great.
[22:01]
>> somebody is going to do
[22:03]
something.
[22:04]
And it's just gotten worse.
[22:07]
And with the heat and the rain
[22:08]
,it's just as you have seen in
[22:08]
the pictures just so overgrown,
[22:12]
so as alan said to, you know,
[22:13]
if we can get this move in,
[22:16]
something happening, we would
[22:16]
surely appreciate it.
[22:17]
Thank you for your time.
[22:17]
Thank you.
[22:18]
Mm hmm.
[22:32]
Thank you, everybody for your
[22:36]
time just to hear our concerns
[22:36]
on the neighborhood.
[22:37]
>> I'm delia pigott.
[22:40]
I live at 1220 swan street.
[22:43]
I'm directly in front of 1219.
[22:44]
So I get to see this every
[22:47]
single day.
[22:50]
I have been in winter springs
[22:50]
for five years.
[22:51]
One of the things that
[22:51]
attracted me to that
[22:54]
neighborhood specific actually
[22:55]
was just how the prior to
[22:56]
ownership that we have in our
[22:59]
neighborhood there was a lot of
[22:59]
students, a lot of kids that
[23:00]
ride their bikes.
[23:03]
That was one of the things and
[23:03]
of course all the trees and the
[23:06]
nature around us.
[23:07]
>> that's what attracted me to
[23:10]
winter springs currently been
[23:11]
four years going on.
[23:14]
All of us have pride in our
[23:14]
neighborhood.
[23:15]
We all kind of compete nicely
[23:17]
just to keep our best yards.
[23:21]
>> we have respect for the
[23:22]
trash that goes out there at
[23:25]
night and for the last four
[23:25]
years we have not seen any
[23:29]
effort from whether it's the
[23:29]
owners or the new owners to
[23:32]
even match or have the minimum
[23:33]
standards of the community.
[23:36]
>> the other thing too is that
[23:37]
it causes concerns because as
[23:40]
ellen said, there's a lot of
[23:43]
open places and spaces in that
[23:44]
in that in that housing.
[23:47]
Previously while they were
[23:48]
working on it, there were a lot
[23:49]
of people that were staying
[23:52]
there overnight at two weeks at
[23:52]
a time, three weeks and there
[23:54]
were different faces coming and
[23:55]
going from time to time.
[23:59]
No one drove, no one had a
[23:59]
license.
[24:01]
They just kind of sat there for
[24:02]
2 or 3 weeks and then they
[24:02]
left.
[24:03]
So we have been dealing with
[24:06]
this for over four years and
[24:07]
we're just here in solidarity
[24:10]
trying to see if we can get
[24:10]
this some support done.
[24:11]
Even the owners, they're not
[24:14]
even here.
[24:14]
We live there in the
[24:15]
neighborhood and we have to
[24:15]
deal with it everyday.
[24:17]
So we're asking for some sort
[24:20]
of resolution to get this going
[24:21]
.
[24:21]
Thank you for your time.
[24:24]
Thank you.
[24:29]
Is there anyone else wishing to
[24:31]
speak?
[24:35]
Okay.
[24:39]
Can you confirm from carlos the
[24:40]
one one did this owner take
[24:43]
ownership?
[24:44]
>> I think you said you think
[24:47]
it was JUNE.
[24:47]
JUNE 15th.
[24:54]
I believe you two can
[24:59]
because
[25:00]
does the board have any other
[25:00]
questions?
[25:00]
Yes.
[25:08]
Carlos carlos, what addressed
[25:08]
did we send these notices to
[25:09]
the new owner?
[25:12]
>> I sort of registered owners
[25:18]
are listed gbg investments llc
[25:18]
1215 northern way.
[25:24]
Okay
[25:29]
.
[25:29]
Let's see.
[25:33]
Inspector the photo the
[25:36]
residence or at least one that
[25:36]
I remember mentioned the safety
[25:39]
potential safety issues.
[25:40]
Is this something the city's
[25:43]
got to worry about?
[25:47]
>> I, I can't fathom on you
[25:47]
know what ifs but I mean there
[25:50]
is substantial business
[25:50]
building materials out there
[25:54]
lumber, metal, metals and
[25:54]
everything.
[25:58]
>> like she said before, the
[25:59]
back is pretty much open, is
[25:59]
not secured.
[26:01]
Anything that was supposed to
[26:02]
be there as a site barriers and
[26:02]
just disarray.
[26:05]
Nothing's really preventing
[26:05]
anybody from going on to that
[26:06]
property and venturing into it.
[26:09]
>> there's no swimming pool
[26:09]
though, right?
[26:10]
>> nope.
[26:13]
An open lot that I can no, no.
[26:14]
The fact that they can go into
[26:17]
that house, a child or any body
[26:20]
that's to me is the safety
[26:20]
issue right there.
[26:25]
>> so the rear gate is ajar is
[26:27]
open.
[26:28]
Sometimes I see it more is open
[26:28]
more than other days.
[26:30]
But it's never been secured for
[26:35]
a while I guess for our or our
[26:39]
lawyer, our league, our legal,
[26:42]
legal, legal.
[26:46]
>> if this was an empty pool,
[26:47]
you know, a swimming pool
[26:49]
situation, we could request as
[26:50]
a board to do something.
[26:53]
It is.
[26:54]
Does this safety thing apply in
[26:57]
this case that we can do
[26:57]
something?
[27:01]
>> yeah, it's kind of a I would
[27:02]
say kind of an edge case
[27:05]
typically to have the city to
[27:06]
go in and abate the property,
[27:09]
it has to be pretty significant
[27:10]
to find it to be like a health
[27:12]
hazard.
[27:13]
It usually has to be quite
[27:16]
significant like a pool that is
[27:17]
open that the child or someone
[27:20]
could walk into and drown or
[27:21]
some sort of body of water that
[27:23]
is like breathing of
[27:24]
mosquitoes.
[27:28]
Definitely the rats and other
[27:28]
vermin are, you know, an issue
[27:32]
and might be a safety concern I
[27:35]
suppose whether it would rise
[27:36]
to that level is up to the
[27:39]
board and then I'll just know
[27:39]
that the city has requested to
[27:40]
go in and do the abatement at
[27:43]
this time if that's something
[27:43]
they're looking to explore.
[27:46]
>> I'll defer to them.
[27:47]
okay.
[27:47]
Thank you.
[27:47]
Of course.
[27:53]
Is that something that thanks
[27:57]
to deputy chief pressley for
[27:58]
the record, it's not out of the
[28:00]
question.
[28:01]
What we're asking for tonight
[28:02]
is a finding of fact that
[28:04]
they're in violation.
[28:05]
There are some steps that we've
[28:06]
discussed internally that we
[28:08]
can take.
[28:09]
But for this evening, you know,
[28:10]
we're obviously requesting that
[28:13]
finding of fact that some
[28:16]
violation there are some things
[28:16]
that takes a little more
[28:17]
investigate of work to
[28:17]
determine the rodents and
[28:17]
things like that.
[28:21]
We haven't seen any of those
[28:21]
personally.
[28:25]
So you know, if we can show the
[28:28]
health hazard safety hazard, we
[28:28]
can definitely go that route.
[28:32]
But we don't feel that we have
[28:33]
the evidence to support that in
[28:36]
our case this evening.
[28:36]
Excuse me.
[28:36]
Okay.
[28:39]
Excuse me.
[28:39]
MAY I?
[28:39]
Please.
[28:43]
If we were to have a finding of
[28:47]
fact, can the city go?
[28:48]
Can we have the city go in and
[28:51]
at least clean up?
[28:52]
>> no.
[28:52]
With mowing or any.
[28:52]
No.
[28:54]
The finding of fact is to incur
[28:55]
the daily fines if they don't
[28:58]
come into compliance after our
[28:58]
recommended 30 days that we
[29:02]
give them.
[29:03]
If that's what the board does,
[29:06]
this evening, we have another
[29:10]
tool that you'll never see as
[29:10]
an intent to remedy.
[29:14]
so if we still continue to get
[29:15]
no response from the property
[29:17]
owner, there's a 15 day notice.
[29:21]
For example, if the city's
[29:22]
going to go in and mow the
[29:22]
grass and clean up some of the
[29:25]
junk, the construction debris,
[29:26]
we can issue a 15 day notice
[29:29]
post that if it's not cleaned
[29:30]
up then we can go in and do
[29:33]
that without any board action.
[29:37]
>> if council if we have the
[29:40]
pool situation and they come in
[29:44]
and we're looking to to resolve
[29:48]
a safety issue on such a case,
[29:48]
it's in the past.
[29:52]
To my recollection we've done
[29:54]
that and it's that time shorter
[29:54]
than that 30 days recommended.
[29:55]
Hmm.
[29:58]
The fact that we're speaking
[29:59]
the safety concerns here, can
[30:05]
we can we alter that in this
[30:06]
case and be on on good footing
[30:09]
to do it with a time frame less
[30:09]
than 30 days?
[30:10]
>> yeah, absolutely.
[30:13]
You all are provided with a
[30:14]
fair amount of discretion about
[30:16]
the time frames and the fines.
[30:17]
The time frame just has to be
[30:20]
reasonable and the fine just
[30:21]
can't be more than $250 per
[30:24]
violation.
[30:25]
But within that you have a lot
[30:25]
of wiggle room.
[30:28]
So if you think that less than
[30:29]
30 days is appropriate in this
[30:31]
case, then then that would
[30:32]
we're talking about the safety
[30:35]
issues we have for violations.
[30:39]
>> you can split them up if you
[30:39]
want.
[30:40]
It doesn't have to be the same
[30:43]
time or fine for each violation
[30:43]
.
[30:44]
>> if you want to be more
[30:45]
inclined to consider that if
[30:46]
there was representation here
[30:47]
for the other side on the fact
[30:48]
that there's been no
[30:50]
interaction.
[30:51]
All right.
[30:54]
That's my feeling.
[30:58]
And but I personally I've heard
[30:59]
enough that they're consider a
[31:03]
motion of someone like the
[31:03]
present one if there's no more
[31:03]
questions.
[31:04]
I will I do have another
[31:07]
question or discussion if we
[31:07]
could.
[31:08]
So what would the board be
[31:11]
thinking would be the time
[31:11]
frame?
[31:13]
I mean I'm I think just to give
[31:14]
them 30 days is ridiculous when
[31:17]
they have not even responded or
[31:21]
actually turn their nose up at
[31:22]
any violation letters that were
[31:22]
sent to them.
[31:23]
They're just showing that
[31:25]
they're not they're not
[31:28]
interested and for those
[31:29]
reasons, why give them more
[31:32]
time just to sit there and do
[31:33]
nothing?
[31:33]
I completely concur.
[31:40]
Chief, how much time I how much
[31:40]
time do you think it will
[31:43]
actually take for somebody to
[31:44]
come in to clear out those
[31:45]
safety violations if if they
[31:48]
were to start tomorrow, how
[31:48]
much time will it take?
[31:50]
>> I mean, I guess be
[31:51]
determined by the size of the
[31:54]
crew.
[31:58]
I mean, if we take into
[32:01]
consideration a cleanup crew of
[32:02]
4 or 5 people, I mean I would
[32:06]
imagine you get a majority of
[32:06]
it done in a day.
[32:06]
>> okay.
[32:10]
So then you.
[32:10]
Yeah, that's what I wanted.
[32:12]
That's what I needed to know.
[32:13]
I needed to know from your
[32:16]
perspective what a reasonable
[32:21]
timeframe would be to to clean
[32:21]
it up.
[32:21]
Right.
[32:24]
A tree crew can cut down a tree
[32:24]
in a day.
[32:28]
Right?
[32:32]
Yeah, it would.
[32:32]
Would the department be averse
[32:35]
to less than 30 days?
[32:36]
No, not at all.
[32:39]
Okay.
[32:43]
In that case, chair, I would
[32:47]
move to find that based on the
[32:47]
testimony, the photographs and
[32:53]
the evidence that was presented
[32:53]
by the officer show that there
[32:58]
are in fact violations of water
[33:02]
springs city ordinance 13 tach
[33:06]
to subparagraph for winter
[33:09]
springs city ordinance 13 tac
[33:10]
to subparagraph see where
[33:13]
springs city ordinance 13 tac
[33:17]
two subparagraph the and what
[33:23]
is spring city ordinance 9-374
[33:27]
and that those sections of the
[33:28]
code have been violated.
[33:31]
I move that respondents be
[33:34]
given until to today.
[33:35]
Today is AUGUST 25th.
[33:45]
Until SEPTEMBER seven.
[33:45]
About that reasonable.
[33:49]
Well I think that's more than
[33:49]
reasonable.
[33:50]
Two weeks is it two weeks.
[33:52]
Yeah that's two weeks.
[33:53]
Yeah.
[33:53]
Yeah.
[33:55]
I thought SEPTEMBER 7th, 2002
[33:59]
six to comply to comply if the
[34:03]
fair in the event that the
[34:03]
respondent does not correct the
[34:06]
violations in the event the
[34:07]
respondent fails to comply by
[34:07]
that date.
[34:13]
Finally, amount of 250 hours
[34:17]
per day per violation shall be
[34:20]
imposed shall be imposed until
[34:21]
the compliance is reported and
[34:24]
verified by the city's code
[34:25]
enforcement to the city's code
[34:25]
enforcement.
[34:29]
may I ask you to make one
[34:29]
liner?
[34:29]
Yes.
[34:32]
Can you include with that that
[34:36]
in addition to the the evidence
[34:40]
that there's potential safety
[34:43]
issues as well, you do that?
[34:44]
Yeah.
[34:45]
Then let me amend that to say
[34:47]
that the violations constitute
[34:51]
a serious threat to the public
[34:52]
health, safety and welfare.
[34:52]
And in the event respondent
[34:55]
does not correct the violations
[34:56]
by the date of this order, code
[34:58]
enforcement board MAY ask the
[34:59]
city commission and the city
[35:02]
commission MAY authorize the
[35:03]
city to make reasonable repairs
[35:06]
which are required to bring the
[35:07]
company property into
[35:07]
compliance and charge the
[35:10]
violator with a reasonable cost
[35:11]
of those repairs along with the
[35:14]
fines imposed pursuant to
[35:18]
chapter 162 for factors or
[35:19]
whether the fine he recommended
[35:21]
to be 150 gallons per day per
[35:21]
violation violation.
[35:24]
So that's four.
[35:25]
Okay.
[35:28]
All right.
[35:29]
>> and I just want to point out
[35:33]
for some discussion on this
[35:35]
that I, I think I counted 13
[35:36]
days to the monday.
[35:39]
Yeah.
[35:39]
Okay.
[35:43]
You want to make it SEPTEMBER
[35:44]
8th and make a temporary that's
[35:44]
two weeks.
[35:47]
Yeah, that's two weeks.
[35:47]
I think that's fair.
[35:50]
That would be my suggestion.
[35:50]
Okay.
[35:54]
Now the only thing that I'm
[35:58]
thinking about is modifying the
[35:58]
motion.
[36:02]
I don't know that the the three
[36:02]
prohibitions are certainly
[36:06]
worth the mailbox numbers.
[36:10]
I don't think so much so I
[36:10]
would modify it to say for that
[36:14]
for that last violation for
[36:17]
nine that cash dash 374 that
[36:19]
that fine be $50 a day.
[36:23]
I don't think we could justify
[36:24]
$250 a day for somebody not
[36:25]
putting numbers up.
[36:29]
Mm hmm.
[36:30]
I mean, do we need that second?
[36:33]
We do.
[36:34]
I just wanted to let any any
[36:37]
discussion happen before we.
[36:38]
>> well, I'll second it.
[36:40]
I'll second it and then you can
[36:41]
have a discussion.
[36:41]
Okay.
[36:41]
Yeah.
[36:44]
If you want.
[36:44]
Okay.
[36:44]
That's that's there.
[36:45]
I think.
[36:47]
I think we're good.
[36:51]
No further discussion.
[36:51]
Tristan brockwell, please.
[36:54]
We have a motion in a second.
[36:55]
>> I just want to actually
[36:57]
double verify the motion.
[36:58]
>> so we're doing a $250 a day
[37:05]
for the 313 dash two b, c and d
[37:09]
and then 54 ordinance 9-374.
[37:09]
Correct.
[37:09]
Okay.
[37:09]
Beautiful.
[37:12]
And giving them until SEPTEMBER
[37:12]
8th.
[37:12]
14.
[37:13]
Beautiful.
[37:13]
All right.
[37:16]
That totals to about $800 a
[37:17]
day, if I'm not mistaken.
[37:20]
>> I just wanted to make sure I
[37:21]
had that all down because I was
[37:21]
trying to get it while you were
[37:21]
saying.
[37:22]
>> yes, ma'am.
[37:22]
All righty.
[37:23]
Roll is chairperson gallo.
[37:27]
>> I sorry.
[37:27]
>> apologize, chairperson
[37:28]
gilday.
[37:28]
It's because I have you both
[37:31]
together.
[37:31]
>> I apologize.
[37:32]
Hear my name?
[37:34]
Chairperson gilday.
[37:34]
>> all right.
[37:35]
Board member gallo.
[37:39]
Hi.
[37:39]
Four member capra board member
[37:40]
ober board member kreps.
[37:44]
>> hi.
[37:44]
Okay.
[37:45]
That that does it mean that
[37:48]
it's going to happen overnight?
[37:49]
Just so you know and we don't
[37:52]
know what that person is going
[37:53]
to do and so it could linger
[37:56]
some more but at least the ball
[37:56]
is rolling.
[37:57]
Hopefully that'll open some
[38:03]
eyes and get things moving and
[38:03]
some things will happen in your
[38:04]
favor hopefully sooner than
[38:04]
later.
[38:06]
So all right.
[38:07]
Thank you.
[38:07]
Thank you for coming.
[38:07]
Sorry.
[38:10]
What you're going through there
[38:14]
right now?
[38:16]
We'll move backwards to item
[38:20]
500.
[38:20]
>> good evening.
[38:21]
For the record, my name is
[38:24]
carlos defalco.
[38:25]
Compliance with city want to

this presentation into evidence

[38:35]
Address is 530 south mass road

ordinance 20 dash four three
[38:41]
for a six authorized commercial
[38:45]
vehicles and residential area
[38:46]
or areas sorry one two springs
[38:48]
ordinance 13 dash two
[38:51]
subsection b prohibitions.
[38:52]
definition as presented
[38:58]
definition as presented case
[38:58]
summary MARCH 17th while
[38:59]
investigating an inoperable
[39:03]
commercial vehicle on the right
[39:03]
of way of south mass road, the
[39:04]
vehicle registration was
[39:06]
verified to the reference
[39:06]
property.
[39:07]
>> I arrived at the residence
[39:08]
to contact the owner but the
[39:09]
property was gated from my
[39:10]
position I observed another
[39:10]
commercial vehicle in the
[39:16]
property rear yard exhibits one
[39:17]
through two MAY 5th 2026.
[39:18]
A formal follow up inspection
[39:20]
was performed to observe
[39:21]
additional commercial vehicles
[39:21]
on the property with
[39:24]
accumulation of outdoor storage
[39:24]
and debris.
[39:27]
Courtesy notice was sent by
[39:28]
usps regular first class
[39:28]
mailing.
[39:29]
Exhibits three through four MAY
[39:30]
11th, 2026 a courtesy notice
[39:34]
was posted at the reference
[39:37]
property violations remain on
[39:40]
the property exhibit five I
[39:43]
exhibit one at this time this
[39:44]
was one vehicle and the rear
[39:50]
side that vehicle to this day
[39:51]
has remained in that position
[39:57]
in that condition exhibit
[39:58]
three.
[40:02]
MAY 5th we see three commercial
[40:02]
vehicles one obviously the
[40:05]
drive the driveway is being
[40:08]
utilized on the rear has a
[40:09]
second vehicle which has been
[40:13]
there since the time of this
[40:13]
photo.
[40:14]
So now we have two remaining
[40:17]
commercial vehicles on the
[40:17]
property at all times minus the
[40:20]
one in the driveway.
[40:23]
There's some accumulation
[40:24]
beyond the carport area.
[40:28]
There is some mangled metals,
[40:30]
cinderblocks, tires just stays
[40:36]
underneath the tree under
[40:37]
exhibit five, not really good
[40:41]
shot, but you still see the two
[40:41]
vehicles there just pan off to
[40:44]
the right side of the first
[40:44]
vehicle.
[40:45]
You'll see the the box of the
[40:47]
other vehicle on JUNE 9th,
[40:47]
2026.
[40:48]
>> a follow up inspection was
[40:51]
performed verified violations
[40:51]
remain on the property and also
[40:52]
violation was sent by usps
[40:55]
certified mailing with return
[40:55]
receipt requested posted at the
[40:59]
property in a city hall
[41:02]
exhibits 6 to 7 JUNE 30th,
[41:02]
2026.
[41:03]
A follow up inspection was
[41:03]
performed to verify the
[41:05]
violations remain on the
[41:08]
property exhibits eight JULY
[41:09]
24th 2026 a notice of hearing
[41:12]
was sent by usps certified
[41:12]
malware return receipt
[41:13]
requested posted at the
[41:14]
property near city hall
[41:15]
violation remains on the
[41:18]
property exhibits nine through
[41:28]
13 exhibit six exhibit seven
[41:28]
exhibit eight.
[41:31]
Now we have a third vehicle
[41:32]
panned off to the left hand
[41:36]
side I believe I can't see from
[41:38]
here but I believe this slide
[41:39]
is from JUNE 3rd and this one
[41:42]
is from JULY 24th.
[41:46]
So that vehicle still remains
[41:49]
it appears the debris have been
[41:49]
either removed or relocated.
[41:53]
There are some missing at the
[41:54]
time from the first initial
[41:54]
inspection, but the rest
[41:57]
remains.
[42:01]
I did notice some multiple or
[42:02]
canisters or propane tanks.
[42:02]
I can't tell exactly what they
[42:04]
MAY be.
[42:05]
They're off by the carport
[42:05]
area.
[42:08]
There's additional two right
[42:09]
there, including that red one.
[42:12]
The fence was observed after
[42:13]
the fact so I did not cite them
[42:16]
for that.
[42:17]
But in the near future of that
[42:18]
still remains that it's a whole
[42:20]
different case right there.
[42:23]
Notice of hearing and staff
[42:27]
recommendation and staff
[42:27]
recommends the code enforcement
[42:28]
board find the property in
[42:31]
violation of city ordinance 20
[42:33]
dash 434 and city ordinance 13
[42:34]
dash two b to be corrected in a
[42:35]
property brought to compliance
[42:38]
on or before SEPTEMBER 24th
[42:38]
2026 30 days and consider
[42:41]
imposition of a daily fine of
[42:42]
250 per violation per day and
[42:45]
then event the requirements of
[42:46]
the order to have not been met
[42:47]
by the date set for compliance
[42:50]
by the code enforcement board.
[42:51]
>> can you pull up the data for
[42:56]
photos please?
[43:00]
>> so this was taken this
[43:00]
morning.
[43:07]
The vehicle has to right there
[43:08]
and those canisters or tanks
[43:14]
are still there.
[43:20]
So there
[43:21]
they appear as they
[43:25]
try to organize that space with
[43:25]
the accumulation.
[43:27]
But we still got car parts and
[43:32]
other stuff there.
[43:35]
Yard debris was noticed after
[43:35]
the initial inspection, but
[43:37]
that has been there for about I
[43:40]
think 2 or 3 weeks now.
[43:41]
>> now it's very hard to see
[43:44]
what in between the building
[43:45]
and the tree.
[43:46]
I can't tell if that's a
[43:46]
commercial vehicle or an
[43:49]
enclosed trailer, but at the
[43:50]
height of it I'm going to
[43:52]
assume as a commercial vehicle
[43:53]
it's right in that area where
[43:54]
she's circling at.
[43:59]
But again, I can only speculate
[44:04]
and that's it.
[44:04]
>> that concludes our
[44:05]
presentation.
[44:05]
Do you have any questions?
[44:08]
What kind of dialog?
[44:09]
>> I had one and it was a
[44:12]
relative of the owner.
[44:13]
>> it was a son who advised
[44:15]
that they were away I believe
[44:16]
was vacation.
[44:19]
I'm not too sure they needed
[44:20]
some time so they was given an
[44:23]
extension and they said he was
[44:24]
going to clear everything up.
[44:25]
I did notify them about the
[44:27]
commercial vehicles being a
[44:27]
violation.
[44:28]
I guess it was some sort of
[44:31]
business that they had at one
[44:32]
time or another.
[44:33]
I'm not too sure they said he
[44:35]
was taking they will take care
[44:35]
of it.
[44:36]
But obviously as of today is
[44:38]
still has not been moved.
[44:39]
So and that's the only
[44:42]
communication I've had since
[44:43]
because is that the property is
[44:46]
occupied.
[44:47]
Yeah.
[44:47]
All right.
[44:47]
Looks like it's occupied
[44:49]
residentially not it's not a
[44:50]
business they're running out of
[44:50]
there.
[44:51]
>> I have not seen any
[44:53]
advertising as a business.
[44:57]
I can only assume maybe
[44:57]
delivery services or something.
[44:58]
But that is being as a
[45:01]
residential property for a
[45:02]
living.
[45:04]
>> okay.
[45:05]
>> when did you talk with that
[45:05]
relative?
[45:08]
What?
[45:09]
>> that was back in JUNE, if
[45:09]
i'm not mistaken.
[45:12]
I will have to look at my notes
[45:12]
.
[45:13]
>> okay.
[45:14]
I think it was the beginning of
[45:16]
the beginning or mid-JUNE and I
[45:17]
think an extra 2 or 3 weeks was
[45:20]
given to them.
[45:20]
Okay.
[45:21]
And that has not been no
[45:23]
changes whatsoever from there.
[45:26]
>> okay.
[45:30]
Questions.
[45:34]
No respondents here.
[45:35]
Anything down from you folks as
[45:38]
you guys can expect?
[45:39]
Who's asking for respect?
[45:41]
Is there a respondent present?
[45:48]
>> not that I can tell from
[45:50]
what I know.
[45:53]
Question no questions.
[45:54]
>> if somebody wants to present
[45:57]
a motion I do have a question.
[45:57]
I'm sorry.
[45:57]
Go ahead.
[46:00]
You said there were checks.
[46:01]
>> I guess they are propane
[46:01]
tanks.
[46:02]
Okay.
[46:05]
Yeah, I was so even know that
[46:06]
right now I don't know exactly
[46:07]
the use of I'm allowed to have
[46:08]
them so that's consider outdoor
[46:09]
storage is no different from a
[46:11]
previous case we have one over
[46:12]
now they're storing multiple.
[46:15]
I don't know if that's
[46:16]
pertaining to their business if
[46:19]
they have a business but the
[46:20]
first time I made observation
[46:22]
on it I did not see one and
[46:23]
then a second inspection I saw
[46:24]
multiple so I don't exactly
[46:27]
know the use for them.
[46:27]
I don't know if it's personal.
[46:28]
I don't know if it's commercial
[46:29]
for the business.
[46:33]
I don't know.
[46:34]
Just out of curiosity, can you
[46:38]
look up to see if there's a
[46:38]
business permit for 530
[46:44]
southwest road
[46:45]
?
[46:45]
Unfortunately cannot because I
[46:46]
don't have access to our
[46:46]
business license.
[46:49]
I don't have it off the civic
[46:49]
portal.
[46:50]
>> not on this computer,
[46:50]
unfortunately.
[46:51]
Okay.
[46:56]
>> maybe your deputy chief
[46:56]
presley might have that
[46:56]
information if needed.
[47:03]
>> he's about to walk in.
[47:06]
And welcome to our city clerk.
[47:11]
>> I'm sorry I did not hear the
[47:11]
question.
[47:12]
>> so the question was do you
[47:15]
is there any way we know if
[47:16]
there is a business permit are
[47:19]
licensed at 530 south mass road
[47:23]
so he's want to know if you
[47:23]
have the ability go in and go
[47:24]
can you go with this that
[47:29]
donation in a btr yeah your
[47:32]
yeah I apologize for the
[47:33]
residential one that you can
[47:34]
look up from this computer I
[47:36]
only see permit so I apologize
[47:37]
on that.
[47:37]
>> apologize no.
[47:40]
Where is to get you some kind
[47:41]
of we need to get you
[47:41]
connectivity to the city.
[47:48]
>> yeah if you
[48:00]
if the court
[48:00]
doesn't mind.
[48:01]
>> can I also ask a question of
[48:04]
the city?
[48:05]
>> so I just wanted to clarify
[48:08]
about the commercial vehicles
[48:08]
is the main issue that there's
[48:12]
multiple on the property or are
[48:13]
they do they fall into what are
[48:13]
the categories that are like
[48:14]
too large to be at a
[48:16]
residential property?
[48:16]
Both I think they're just
[48:17]
storing multiple even having
[48:20]
just one I think exceeds the
[48:20]
size.
[48:21]
>> gotcha.
[48:21]
Okay.
[48:27]
Thanks
[48:31]
.
[48:35]
In answer to for you, you did
[48:38]
stated just that you you only
[48:38]
had one conversation and that
[48:42]
was not with the owner but with
[48:43]
the owner's son.
[48:43]
Correct.
[48:46]
Okay.
[48:46]
Okay.
[48:48]
So okay.
[48:54]
Thank you
[49:14]
.
[49:15]
>> any attempts to contact you
[49:19]
the to clarify any of this if
[49:22]
they have tried to reach out to
[49:22]
me and leave a voicemail, then
[49:25]
I would assume not only one
[49:26]
time I had a conversation with
[49:26]
them.
[49:27]
Okay.
[49:29]
Thank you.
[49:30]
I do not see a vtr for that.
[49:31]
Thank you.
[49:32]
Thank you.
[49:39]
Anything else
[49:41]
you can keep it?
[49:41]
Yeah.
[49:45]
I'm trying to think of a time
[49:51]
frame
[49:53]
.
[49:54]
There wasn't much
[49:54]
communication.
[49:57]
It's been since mid-JUNE and
[50:05]
this is a new case
[50:07]
.
[50:08]
Correct.
[50:08]
Off the couch?
[50:10]
Yeah.
[50:11]
I would still be in 30 days.
[50:14]
Yeah, I would do.
[50:15]
This is not a big deal.
[50:16]
Yeah.
[50:16]
All right.
[50:19]
And his place, it's thought
[50:20]
that would be something.
[50:20]
yeah.
[50:26]
Um, okay, so I move to find
[50:29]
that the photographs and
[50:30]
testimony from officer dafoe
[50:34]
show there are in fact findings
[50:37]
that the respondent at 530
[50:41]
south morse road is in
[50:41]
violation of winter springs
[50:45]
city ordinance 20 dash four
[50:47]
three subsection a six and
[50:51]
winter springs city ordinance
[50:57]
13 dash two subsection be of
[50:58]
the city code I move can you
[51:01]
just restate the ordinance
[51:02]
number for that first one the
[51:02]
commercial vehicles.
[51:04]
Yeah.
[51:04]
Ordinance resetting winter
[51:08]
springs city ordinance 20 dash
[51:11]
434 subsection a six.
[51:11]
Correct.
[51:12]
Yeah that's good.
[51:12]
Okay.
[51:12]
Yeah.
[51:15]
Thank you.
[51:16]
I move to order that the
[51:27]
respondent be given until the
[51:28]
SEPTEMBER 24th 2026 to correct
[51:32]
the violation in the event that
[51:33]
respondent fails to comply by
[51:36]
this date a fine in the amount
[51:42]
of $100 per day shall be
[51:46]
imposed per violation until
[51:49]
compliance is reported to and
[51:50]
verified by city code
[51:57]
enforcement 100 I would second
[51:57]
that motion.
[51:58]
Okay.
[52:01]
Any discussion?
[52:01]
Okay.
[52:04]
Roll call.
[52:05]
Chairperson gilday all right.
[52:09]
Or member gallo I form keppra I
[52:09]
for member of bear.
[52:09]
All right.
[52:14]
Board member krebbs okay.
[52:18]
All right.
[52:22]
Come.
[52:23]
That brings us to the end of
[52:26]
hearing some cases where there
[52:30]
is there any other information
[52:30]
detail questions, comments,
[52:31]
concerns.
[52:31]
Yes, sir.
[52:33]
Go ahead.
[52:37]
At the last two commission
[52:38]
meetings there has been
[52:41]
discussion about the
[52:42]
appointment of a special
[52:45]
magistrate to replace the code
[52:49]
enforcement board at a cost to
[52:51]
the city of approximately
[52:52]
$10,000 per year.
[52:52]
That was the amount that they
[52:55]
claim to.
[52:59]
We've been through this before
[53:02]
during my tenure and personally
[53:06]
and I'm not saying this because
[53:07]
I'm a member of this code board
[53:10]
and have been for a number of
[53:10]
years.
[53:11]
But I'm saying it because there
[53:14]
is a tremendous difference
[53:16]
between a special magistrate
[53:20]
and a code board.
[53:21]
This code board serves
[53:24]
voluntarily and we've volunteer
[53:25]
because we take pride in this
[53:28]
community and we have a love
[53:29]
for this city and we're not out
[53:32]
to punish people.
[53:33]
We're out to educate people and
[53:35]
to help bring people back into
[53:36]
compliance.
[53:36]
There have been many, many
[53:40]
times when people have come
[53:43]
before this board with
[53:44]
difficulties and we've given
[53:48]
them extended opportunities to
[53:51]
correct violations and we've
[53:52]
bent over backwards and gone
[53:55]
out of our way to help people
[53:59]
at times there MAY seem to be
[54:02]
disparities in how we assess
[54:07]
fines and how we do things, but
[54:10]
there is always thought and
[54:11]
fortitude in our decision
[54:13]
making.
[54:14]
We take many, many we take
[54:17]
multiple factors into
[54:20]
consideration including
[54:21]
cooperation with the code
[54:25]
enforcement debater, including
[54:28]
how people present themselves,
[54:29]
including the attitude that
[54:32]
they come to or that they don't
[54:32]
even show up to the board.
[54:33]
Correct.
[54:36]
So all of these factors become
[54:41]
part of how we assess fines.
[54:44]
I don't know that any special
[54:44]
magistrate would have the
[54:48]
compassion that we do towards
[54:48]
our fellow citizens.
[54:52]
I don't know that they come to
[54:53]
this with the same concern
[54:56]
caring that we do.
[54:57]
We come here as volunteers
[54:59]
because we love the community.
[54:59]
Special magistrate is getting
[55:03]
paid to do a job and I know
[55:06]
that there have been concerns
[55:10]
that for for our personal
[55:14]
safety that perhaps a
[55:14]
respondent would try to
[55:18]
retaliate and take action
[55:20]
against us in the many, many
[55:21]
years and I've been sitting on
[55:25]
this board, I completed nine
[55:25]
full years.
[55:29]
I was off for a year and now
[55:29]
I'm back on again.
[55:32]
So in the 11 years that I've
[55:33]
been sitting on this board, I
[55:35]
have never once been threatened
[55:38]
or felt intimidated by any
[55:39]
respondent.
[55:43]
So I think I, I really believe
[55:46]
that this board should take a
[55:50]
vote should take a vote and to
[55:51]
stay in a stance to encourage
[55:54]
the city to maintain the code
[55:57]
enforcement board in lieu of a
[55:57]
special magistrate.
[56:01]
And I would make that a motion.
[56:05]
It is if this board so desires
[56:05]
.
[56:06]
Let's do it as a motion and
[56:06]
make it official.
[56:08]
Yeah, but before we do that,
[56:12]
before we do that, I would ask
[56:12]
chief pressley what the
[56:19]
department's viewpoint is.
[56:20]
>> that's hard for them because
[56:23]
it's going yeah, yeah, I have
[56:24]
no I mean I obviously have an
[56:25]
opinion but it's not my
[56:27]
decision.
[56:28]
This topic has come up in the
[56:31]
past with most of the members
[56:32]
on this board.
[56:34]
You know when there were rumors
[56:35]
or discussions about going to a
[56:38]
special magistrate.
[56:39]
Safety is a concern.
[56:43]
I mean, I'm a police officer
[56:43]
and a police officer for almost
[56:43]
31 years.
[56:46]
There's cases around the
[56:47]
country where, you know, board
[56:50]
members of all different types
[56:51]
of boards have been hurt and
[56:54]
and you know, I don't think me
[56:57]
personally it's not an issue of
[56:57]
any unfairness.
[57:01]
There's some potential
[57:02]
efficiency things that might
[57:05]
make it a little more efficient
[57:06]
if it's during business hours
[57:08]
for city staff.
[57:09]
You know, that's kind of my
[57:09]
take on it.
[57:12]
But ultimately at the end of
[57:13]
the day it's not my decision.
[57:14]
You know, it's the
[57:16]
commissioner's decision.
[57:17]
So we we we and I appreciate
[57:18]
your opinion.
[57:21]
I mean, I, I really do and I
[57:21]
thank you for it.
[57:25]
I thank you also for all the
[57:25]
hard work that you do on your
[57:26]
behalf.
[57:26]
>> sure.
[57:28]
And we'll continue to do that
[57:31]
regardless of, you know and you
[57:32]
know, you talk about being
[57:35]
compassionate and I mean, I
[57:40]
can't express enough of what my
[57:44]
staff does before it even gets
[57:44]
here today.
[57:47]
I mean, there's so many chances
[57:47]
.
[57:48]
We're so accommodating and
[57:52]
obviously regardless of the
[57:52]
outcome, we'll continue to do
[57:56]
that for sure.
[57:56]
>> absolutely.
[57:57]
We we know we know that even in
[58:00]
law enforcement, the chief's
[58:02]
position has always been I'm
[58:03]
not here to punish.
[58:03]
I'm here to educate.
[58:04]
Sure, it's the same thing with
[58:07]
the traffic stop.
[58:07]
Somebody gets stopped.
[58:08]
It's not to punish them.
[58:11]
It's to educate them as to what
[58:11]
goes on.
[58:12]
Sometimes if fine is necessary,
[58:15]
sure.
[58:15]
But I don't know that the
[58:19]
special magistrate would would
[58:19]
come with the same kinds of
[58:20]
concerns.
[58:22]
So you know, if I would make a
[58:23]
motion that this board
[58:26]
officially request from the
[58:29]
city commission that we
[58:30]
continue as a board and that
[58:34]
any ideas of a special
[58:34]
magistrate be dropped.
[58:36]
I was second that.
[58:36]
All right.
[58:40]
A discussion discussion,
[58:40]
please.
[58:44]
I, I, I totally agree with you.
[58:45]
But I think when you send that
[58:45]
to a commission, you need to
[58:48]
send the reasons why we believe
[58:48]
that.
[58:51]
I mean, you know, you can sit
[58:52]
up here with a robot and say I
[58:55]
and that's what you're going to
[58:55]
get.
[58:56]
You know, here you get people
[58:59]
who listen to whatever is
[58:59]
happening even in someone's
[59:02]
life.
[59:02]
I mean, you know, there's a lot
[59:06]
of different things and
[59:06]
sometimes and we've even had
[59:07]
people who are in the process
[59:10]
of of reaching compliance but
[59:11]
they're not there yet when they
[59:13]
come here.
[59:14]
I mean, what do you do?
[59:17]
You say, well, you know, so I
[59:21]
yeah, I think we should have a
[59:21]
explanation and there yeah as
[59:25]
well I, I agree with
[59:25]
commissioner krebs.
[59:29]
I and I, I think I'm speaking
[59:29]
for myself.
[59:33]
I would be very comfortable
[59:34]
with rabbi caprio speaking to
[59:37]
the commission and giving them
[59:38]
the results of our vote because
[59:40]
everything you said I totally
[59:41]
agree with and I couldn't say
[59:44]
it any better than what you
[59:44]
just said yourself.
[59:45]
That's true.
[59:48]
So that would that would be my
[59:48]
request.
[59:51]
I agree and I will happily do
[59:51]
that.
[59:55]
In fact, public performances
[59:55]
for public disclosure.
[59:56]
I have a meeting with the city
[59:59]
manager tomorrow morning and
[59:59]
discuss this very topic.
[1:00:00]
Okay, good.
[1:00:03]
Thank I am this issue reared
[1:00:07]
its head a few times and I know
[1:00:10]
the last time it was driven
[1:00:11]
specifically by one of the
[1:00:13]
commissioners I don't know if
[1:00:14]
more have gotten hold or
[1:00:17]
whatnot, but um, I, I concur
[1:00:20]
with the reasons that you have
[1:00:21]
stated here and that that's I
[1:00:25]
think the crux of why I feel I
[1:00:28]
mean the way I do it's quite
[1:00:32]
frankly if we're going to have
[1:00:33]
the cases that people are just
[1:00:37]
going to blow it off and
[1:00:37]
totally get a wake up call, you
[1:00:40]
know what?
[1:00:41]
Maybe maybe it's your team or
[1:00:43]
you talking to them and
[1:00:44]
sometimes they end up here
[1:00:45]
because they want to listen to
[1:00:48]
that and just get in here is
[1:00:48]
like I MISS A lot of money.
[1:00:51]
Maybe I better get going.
[1:00:52]
Sometimes the ones that don't
[1:00:54]
show up, it's going to take
[1:00:55]
take the fine to get going.
[1:00:59]
Yeah, but there's an awful lot
[1:01:00]
of folks that do come here that
[1:01:03]
yes, that I think it's not that
[1:01:04]
they're trying to get away with
[1:01:06]
something.
[1:01:07]
I'm trying to blow both of you
[1:01:07]
guys off.
[1:01:10]
How many how many cases just on
[1:01:10]
insurance alone have we heard
[1:01:11]
over the years?
[1:01:13]
Sure.
[1:01:17]
I mean you pick a reason we we
[1:01:18]
we we seem to have heard it and
[1:01:21]
I think you're going to MISS A
[1:01:22]
lot of that where compassion
[1:01:24]
does have a role that's going
[1:01:25]
to be out the window with the
[1:01:25]
magistrate.
[1:01:29]
But I remember the one lady
[1:01:33]
that we had the elderly woman
[1:01:33]
that I mean, she ran out of
[1:01:33]
money.
[1:01:36]
Yes.
[1:01:37]
Probably living off the social
[1:01:39]
security and she just asked can
[1:01:40]
I just, you know, wait till I
[1:01:43]
get my money here to finish
[1:01:44]
what she had?
[1:01:44]
I mean, what how would a
[1:01:45]
magistrate treat that?
[1:01:48]
I don't know.
[1:01:51]
>> we do have a motion in a
[1:01:51]
second on the facts, right?
[1:01:52]
Yeah.
[1:01:53]
If didn't mean to do an
[1:01:54]
official vote and my
[1:01:55]
understanding is that the
[1:01:55]
motion is to request the
[1:01:59]
commission to consider keeping
[1:01:59]
the board as a code board and
[1:02:00]
not a special magistrate.
[1:02:03]
>> correct?
[1:02:03]
>> correct.
[1:02:03]
Okay.
[1:02:04]
So okay with me doing a vote
[1:02:06]
now, are you with one more
[1:02:07]
thing is that the we the motion
[1:02:10]
is to have rabbi capra take
[1:02:14]
that personally to the
[1:02:14]
commission.
[1:02:14]
Okay.
[1:02:15]
And then the city manager.
[1:02:18]
Yeah.
[1:02:18]
>> representing our the board
[1:02:18]
here.
[1:02:19]
Okay.
[1:02:22]
So you want me to include as
[1:02:23]
for morris carper to be
[1:02:25]
representative of the boards
[1:02:25]
voice sort of situation.
[1:02:26]
>> okay.
[1:02:29]
If I can add that onto that.
[1:02:30]
>> well yeah, that would be my
[1:02:30]
I guess my additions to my
[1:02:33]
amendment here.
[1:02:33]
>> that's what I'll do as an
[1:02:37]
official role call for the
[1:02:37]
record, please.
[1:02:37]
Please.
[1:02:41]
Chairperson gill do I or I
[1:02:41]
gallo I remember keppra a board
[1:02:44]
member ober all right.
[1:02:45]
>> more member reps by
[1:02:47]
unanimous.
[1:02:48]
Okay.
[1:02:48]
Okay.
[1:02:50]
One more piece of business.
[1:02:54]
Go ahead, please.
[1:02:54]
>> she personally while you're
[1:02:57]
there, I understand you might
[1:03:01]
be getting close to retirement
[1:03:05]
and I just wanted to personally
[1:03:08]
say thank you for your 30 plus
[1:03:08]
years of service to the
[1:03:09]
community.
[1:03:12]
Every time I see you or hear
[1:03:13]
you, I learn something new.
[1:03:16]
You're you're fair.
[1:03:20]
You are everything I would want
[1:03:20]
a law enforcement officer to
[1:03:20]
be.
[1:03:24]
so I just want to say thank you
[1:03:24]
and thank you to your wonderful
[1:03:25]
staff.
[1:03:28]
There are some and you will be
[1:03:28]
truly missed.
[1:03:31]
Thank you, art.
[1:03:31]
Not yet.
[1:03:35]
It's not a rumor.
[1:03:36]
I will be retiring mid OCTOBER
[1:03:39]
after almost 31 years with the
[1:03:39]
winter springs police
[1:03:40]
department.
[1:03:43]
My wife and I are very excited
[1:03:44]
about that and thank you very
[1:03:46]
much for those very kind words
[1:03:46]
and I really appreciate it and
[1:03:47]
I appreciate all the support
[1:03:50]
not just to you but all the
[1:03:51]
members through the years that
[1:03:54]
are on this board that have
[1:03:54]
supported the police
[1:03:55]
department.
[1:03:55]
Can't do it without you guys.
[1:03:58]
Well, mid-OCTOBER 3032 that
[1:03:58]
I'll be here.
[1:04:04]
>> yeah, you sound like my boss
[1:04:06]
Okay.
[1:04:10]
Thank you.
[1:04:11]
We don't need a roll call.
[1:04:11]
Your your awesome.
[1:04:12]
Yeah.
[1:04:14]
So okay, so anything else?
[1:04:15]
I'm sorry.
[1:04:18]
Yeah.
[1:04:18]
Okay.
[1:04:21]
And I will say that to our new
[1:04:21]
city clerk.
[1:04:26]
I we had to send the people
[1:04:26]
home tonight.
[1:04:29]
So aaron, I had several dancers
[1:04:32]
and people come in and get
[1:04:33]
ready, so we'll try to see if
[1:04:34]
we can get them back next time.
[1:04:36]
But but welcome aboard.
[1:04:39]
And we're happy to be working
[1:04:39]
with you.
[1:04:40]
>> I do have one more thing to
[1:04:43]
go ahead, please.
[1:04:44]
For those of you who are not
[1:04:47]
aware a icon in the city has
[1:04:50]
passed and that would be susie
[1:04:50]
coffman.
[1:04:51]
>> can I can I ask you to
[1:04:52]
repeat that?
[1:04:55]
I didn't hear you and I said an
[1:04:55]
icon of the city past.
[1:04:58]
Okay.
[1:04:58]
Susie coffman.
[1:04:59]
Okay.
[1:05:05]
And she actually began the the
[1:05:06]
the senior center that building
[1:05:09]
was just last year named after
[1:05:10]
her.
[1:05:13]
There's a room in there.
[1:05:16]
Her husband was very active
[1:05:16]
also.
[1:05:21]
And so we we really lost a
[1:05:21]
legend in a place.
[1:05:22]
And for those who don't know
[1:05:24]
dolly parton died.
[1:05:29]
Yeah she did and anything else
[1:05:33]
now that's okay note to end on
[1:05:35]
an all right this regular code
[1:05:36]
enforcement meeting board
[1:05:39]
meeting is now adjourned.
[1:05:40]
Thank you.
[1:05:46]
