[1:16:19] suggest
[1:16:21] a an amendment to our zoning
[1:16:25] resolution uh we the full the okay and
[1:16:30] this how this process works if we amend
[1:16:33] the zoning resolution and when I say
[1:16:36] that I'm I'm thinking uh
[1:16:40] this six members we actually have six
[1:16:43] people on the
[1:16:46] bza and if we have fiveyear terms and
[1:16:51] one comes off every year that don't work
[1:16:54] we could uh suggest
[1:16:59] a one uh six-year term you could do that
[1:17:03] got six members one has to come off one
[1:17:06] term has to expire every year we could
[1:17:11] suggest to the uh we this ad hoc
[1:17:16] committee would have to first suggest an
[1:17:19] amendment to the zoning resolution to
[1:17:22] the planning committee
[1:17:24] the Planning Commission has to make a
[1:17:27] recommendation to the full legislative
[1:17:29] body for any text whatsoever to be
[1:17:34] changed in our zoning
[1:17:37] resolution so approve a legislative
[1:17:39] committee then the full legislative body
[1:17:42] takes the recommendation of the Planning
[1:17:45] Commission and either approves or
[1:17:48] rejects and if we approve it then the
[1:17:51] language in zoning resolution would wind
[1:17:53] up being what this ad hoc committee
[1:17:55] decided fixes the problem if you guys
[1:18:00] think we need to do that my I like that
[1:18:03] but what I'm thinking if we're trying to
[1:18:07] keep it neutral and objective and not
[1:18:10] any political uh overtones to it why
[1:18:14] don't you make it every three
[1:18:16] years then you're rotating uh
[1:18:19] Commissioners and things like that uh
[1:18:21] well then but it it keeps from that it
[1:18:23] keeps from having five or six members
[1:18:25] and and having to carry over and make up
[1:18:27] and if you had them every three years
[1:18:30] that rollover would take care of that
[1:18:32] problem it would be a solution in itself
[1:18:34] but you have six members and terms
[1:18:37] expire in three years because you you've
[1:18:40] got two people at least two people
[1:18:42] rolling off every time we saw this you
[1:18:44] had two people rolling off or being
[1:18:45] reapproved oh so you're saying two
[1:18:47] should come off every year every three
[1:18:50] years yeah you you you put everybody on
[1:18:52] there for three years years and every and every year two would roll
[1:18:56] off oh every year two that's not going
[1:18:58] to work okay TCA see that goes contrary
[1:19:02] to TCA TCA plainly says one member's
[1:19:07] term shall expire each year okay so we
[1:19:11] would have to keep it at five address
[1:19:14] the floating associate member address it
[1:19:18] separately or go to six-year terms and
[1:19:22] count the associate just like we would a
[1:19:24] full member that's what I cuz we set the
[1:19:27] terms TCA says one member comes off or
[1:19:32] expires right everybody we
[1:19:36] atast every year yeah one Member One
[1:19:41] member's term shall expire each year and
[1:19:44] six years would would take care of the
[1:19:46] associate also if we wanted to do that
[1:19:51] yeah
[1:19:54] I wish this ad hoc committee had had
[1:19:57] been assigned to to figure out
[1:20:02] the terms of our Planning Commission
[1:20:05] members but we were not so I'm not going
[1:20:07] to say we need to address that this is problem at this point now that

[1:20:13] this information in front of us because
[1:20:17] uh I don't see it in print
[1:20:20] anywhere in our zoning res solution I
[1:20:23] could not find it and others have not
[1:20:25] either what the term length and TCA
[1:20:28] doesn't full legislative body controls
[1:20:31] term
[1:20:33] length if we keep the present members
[1:20:36] that are on there and just reassign the
[1:20:39] term ending would seem to be the most
[1:20:42] simple thing to do that's kind of what I
[1:20:45] had wrote down right here if we could
[1:20:46] keep the current members and then
[1:20:48] reassign years that they need to come
[1:20:51] off correct and then from there
[1:20:54] forward well then next January we would
[1:20:56] reappoint the person rolling off right
[1:20:59] so 2024 even though I know January has
[1:21:02] passed but somebody needs to come off
[1:21:04] this year and be reappointed this year I
[1:21:06] think correct it has to 24 so and I had
[1:21:10] put LOL just as a name because he was
[1:21:12] been the longest running uh but so his
[1:21:15] site so I put him as 25 and Sammy is 26

[1:21:20] example but give everybody a roll off

[1:24:23] established in accordance with
[1:24:26] 13-7 d106 through 13-7
[1:24:30] 109 of the Tennessee code annotated the
[1:24:33] board of zoning appeal shall consist of
[1:24:36] five members appointed by the Coffee
[1:24:40] County Commission period the board
[1:24:43] members shall be appointed to fiveyear
[1:24:46] terms however the initial appointment
[1:24:49] shall be arranged so that the term of
[1:24:51] one member will expire each year period
[1:24:55] And I will say what we had just
[1:24:57] discussed and suggested does exactly
[1:25:00] that okay okay now the last the next
[1:25:04] sentence in that paragraph one member of
[1:25:07] this board shall be a CO County
[1:25:11] Commissioner another a member of the
[1:25:14] Planning Commission period one member of
[1:25:18] the board should be a full-time farmer
[1:25:21] should sort of is like a wiggle word but
[1:25:24] it is derived from sh so we do your best
[1:25:28] to do that but if you can't then yeah I
[1:25:30] think I think I think that signifies
[1:25:35] shall so and we have we have that
[1:25:38] established we have uh kept it that way
[1:25:42] and
[1:25:45] so that way when I'm at the Planning
[1:25:48] Commission like when I go to a board of
[1:25:50] zoning appeals uh
[1:25:53] meeting sometimes we're asked to change
[1:25:57] a uh a decision that are uh direct let
[1:26:03] me let me just powers of the
[1:26:06] board three there's three powers pretty
[1:26:11] explicit doesn't give us a lot of
[1:26:13] latitude that's why I've seen some
[1:26:15] people walk out of this room crying you
[1:26:18] know U because we can't do what they
[1:26:21] want us to do do the board of zoning
[1:26:24] appeal shall have the following powers
[1:26:27] administrative review to hear and decide
[1:26:31] appeals where it is alleged by the
[1:26:33] appellant that there is error in any
[1:26:37] order requirement permit decision
[1:26:40] determination or refusal made by the
[1:26:44] zoning administrator or other
[1:26:46] administrative official in the carrying
[1:26:49] out of enforcement of any provision of
[1:26:53] this resolution that means if somebody
[1:26:55] just doesn't agree with what Curt or
[1:26:59] zoning administrator his decision if
[1:27:03] they don't like it they think he's made
[1:27:05] a mistake they have uh evidence that
[1:27:09] he's messed up we can overturn his
[1:27:12] decision all right that's the first
[1:27:14] Power special exception to hear and
[1:27:17] decide applications for special
[1:27:19] exceptions as specified in this resol
[1:27:22] olution which there's a lot of special
[1:27:24] exceptions listed in the text of the
[1:27:28] zoning resolution and for decisions on
[1:27:31] any special questions upon which the
[1:27:33] board of zoning appeals is authorized to
[1:27:35] pass you know that's pretty widespread
[1:27:38] but in matters of direct
[1:27:41] airs the board shall refer to Tennessee
[1:27:45] code annotated section 13-3 d48 to
[1:27:48] determine the proper division of
[1:27:50] property and that that's somebody's
[1:27:53] handing down a farm people get to
[1:27:55] arguing about it I guess we can help
[1:27:57] them decide who gets what I guess then
[1:28:01] the variance to that's number three the
[1:28:04] third power to hear and decide
[1:28:06] applications for variances from the
[1:28:09] terms of this resolution and we do that
[1:28:12] quite often just the other day in uh out
[1:28:15] at Lakewood Park a guy wanted to build
[1:28:17] his house we have a 25 foot sidey yard
[1:28:21] setback we gave him a variance of I
[1:28:26] think it was 5T so he had room to build
[1:28:30] the house he wanted to build with a 20
[1:28:32] foot sidey yard so that's that's one of
[1:28:36] the things we do and if his neighbor
[1:28:38] course and every time something like a
[1:28:40] variance or rezoning or something like
[1:28:42] that comes up the
[1:28:45] U get a letter they have to send a
[1:28:47] letter to the neighbors neighbors yeah
[1:28:50] and like if we decided that guy deserve
[1:28:52] this five foot and neighbor argued well
[1:28:54] the neighbor has to go to court to
[1:28:57] reverse our our the grant the granting
[1:29:00] of that variance so it's it's pretty
[1:29:04] powerful uh board and uh that's why I
[1:29:08] think it needs to be populated with
[1:29:12] people that understand what's going on
[1:29:14] and need to have a little compassion
[1:29:16] when you're dealing with people yeah
[1:29:20] so using that pattern that
[1:29:25] solves the problem it it establishes I
[1:29:28] gave you my um my list of
[1:29:30] members and it establishes it
[1:29:33] reestablishes the proper order right and
[1:29:36] then it puts us back on track right that
[1:29:39] next January whichever one's rolling off
[1:29:42] we understand what their position is
[1:29:44] whether they're commission Planning
[1:29:46] Commission meeting a member farmer or a
[1:29:48] farmer or whatever and that helps us to
[1:29:50] decide then right from the full
[1:29:52] commission during that meeting it can
[1:29:54] the nominations can come from the
[1:29:57] floor so we've accomplished that so do
[1:30:00] we add our so do we so our
[1:30:03] recommendation does that still have to
[1:30:05] go our recommendation to go to the
[1:30:08] planning uh well I haven't heard a
[1:30:10] motion putting all this together yet but
[1:30:13] are you leaning towards making the bza
[1:30:17] members sixe
[1:30:20] terms
[1:30:24] if we left it at five one of two things
[1:30:27] you can one of two things I think would
[1:30:29] be a appropriate either way if you make
[1:30:33] it a six-year term for that
[1:30:37] membership that has to be uh an
[1:30:40] amendment to the zoning resolution and
[1:30:44] or you could say that leave it five year
[1:30:47] for the full membership and the
[1:30:50] associate member is floating and could
[1:30:54] change annually or every five or you
[1:30:58] could you could word it to where the the
[1:31:01] five-year term does not apply to the
[1:31:04] associate member you could do you could
[1:31:06] do many things but that would also
[1:31:08] require amending the zoning resolution
[1:31:11] to state that can the can the associate
[1:31:15] member if she come off in 2028 at her
[1:31:18] regular time she would just come off
[1:31:19] with one regular member is that a
[1:31:21] problem having an associate come off
[1:31:23] with one regular
[1:31:25] member it it says that just as long as
[1:31:27] one I think we would be complying with
[1:31:31] TCA
[1:31:33] because it TCA says member right the
[1:31:39] associate member uh is not a member
[1:31:45] right just kind of like a a sub or feel
[1:31:47] in for an
[1:31:49] absent U member
[1:31:57] vacancies shall be filled I'm reading
[1:31:59] TCA now not our zoning resolution
[1:32:03] vacancies shall be filled for unexpired
[1:32:06] terms in the same manner is in the case
[1:32:08] of original ones meaning it would be uh
[1:32:12] nominations and approval by the full
[1:32:14] legislative body that's the way I take
[1:32:16] that sentence the county legislative
[1:32:20] body May appoint
[1:32:22] associate members of the board and in
[1:32:26] the event I want to back up may doesn't
[1:32:29] say shall we have because we've got
[1:32:32] associate members but it's the TCA says
[1:32:35] may appoint associate members of the
[1:32:38] board and in the event that any regular
[1:32:41] member see so they they differentiate
[1:32:44] they use the word regular
[1:32:47] member and in the event that any regular
[1:32:50] member be temp temporarily unable to act
[1:32:54] owing to absence from the county
[1:32:58] illness interest in a case before the
[1:33:01] board or other cause such associate
[1:33:05] members Place may be taken during such
[1:33:08] temporary disability by an associate
[1:33:11] member designated for the purpose by the
[1:33:15] county legislative
[1:33:17] body so it still doesn't address the ter
[1:33:22] well but it it gives us the
[1:33:25] opportunity to let like you said Float
[1:33:28] let the associate
[1:33:29] float and we
[1:33:31] could regular members are coming off
[1:33:35] term expires year yeah and then we could
[1:33:39] look at the associate every year I yeah
[1:33:41] to to approve or to roll off or whatever
[1:33:44] the commission whatever the commission

[1:44:58] city limits of Manchester what TCA uh
[1:45:02] States is that a majority of the body
[1:45:07] must reside in the territory in which
[1:45:10] they oversight or oversee so the county
[1:45:14] they have to most of them the majority
[1:45:15] have to be from the county so five three
[1:45:18] of them have to be rural residents but
[1:45:20] we're in good shape there all five are
[1:45:23] rural residents and Helen is an
[1:45:25] associate member we're nowhere near
[1:45:28] getting in uh okay we're we're compliant
[1:45:31] with that when we print
[1:45:34] this in the future it need those
[1:45:38] guidelines need to just like these
[1:45:39] guidelines are stipulated here those
[1:45:41] guidelines need to be stipulated and
[1:45:43] those indications of what position they
[1:45:46] feel needs to be there too just like
[1:45:47] Helen's the associate uh then we go back
[1:45:50] now and and and you'd be Planning
[1:45:53] Commission and Tim Morris would be
[1:45:55] commissioner they need to be signified
[1:45:57] by their name somehow so that we know
[1:45:59] when they're rolling off who we need to
[1:46:00] replace there just to help the people in
[1:46:02] the future right

[1:46:38] make binding decisions but they
[1:46:41] confirm binding language that's in our
[1:46:45] zoning resolution they don't really make
[1:46:47] a decision on it they're just saying
[1:46:49] yeah this is what it's says and yes um
[1:46:52] ma'am sir you will have to do it this
[1:46:55] way you must do that you know we vote on
[1:46:57] it that's the way they do it and if it's
[1:47:00] uh amending the zoning
[1:47:03] resolution which if you have a piece
[1:47:06] property that fronts Highway 55 out
[1:47:09] there and it's R1 for housing but you
[1:47:11] want to put a little car lot it needs to
[1:47:14] C1 that you come to the Planning
[1:47:16] Commission and asks for your property to
[1:47:18] be rezoned well that is amending the
[1:47:21] zoning resolution because the map our
[1:47:24] zoning map is is part of our zoning
[1:47:29] resolution and then we would vote on
[1:47:32] resoning your property and if it if we
[1:47:36] get a positive vote out of the Planning
[1:47:39] Commission that's not binding you go to
[1:47:41] the full legislative body then we vote
[1:47:44] as the Commissioners to change your
[1:47:47] zoning
[1:47:48] designation and
[1:47:51] I don't know that I've ever seen it fail
[1:47:54] generally I mean if the Planning
[1:47:55] Commission gives it a positive
[1:47:57] recommendation that means it's pretty
[1:47:59] much been run through the meal but uh
[1:48:02] anyway it's intriguing but the effort of
[1:48:05] this Administration this election cycle
[1:48:08] has been to clarify and to
[1:48:11] reestablish what should have been going
[1:48:13] on in order and I think that's what
[1:48:15] we're doing here I think that's another
[1:48:17] step in what we're doing is trying to
[1:48:19] make things clear
[1:48:20] uh make it objective uh and and that
[1:48:23] type of thing so I I think we've
[1:48:24] accomplished that maybe today unless
[1:48:26] somebody there's something that I
[1:48:28] compliance is the catch word compliance
[1:48:31] yeah I'm all for that so this will uh
[1:48:35] just need to be brought up at our next
[1:48:37] full commission meeting then yeah we
[1:48:39] will um just get a copy of this and send
[1:48:42] it to the legislative committee because
[1:48:45] we're supposedly the Clearing House so
[1:48:47] just get this and get it to me so I can
[1:48:49] get it on our agenda so we're ready to
[1:48:51] go to the full commission with it I
[1:48:53] don't think that's necessary but if
[1:48:56] y'all want to look at it you can because
[1:48:59] it's the the full legislative body is
[1:49:02] the one that uh we're responsible for
[1:49:06] the bza like I said I was just looking

[1:49:12] again trying to decide on that and it
[1:49:14] said the legislative Committee of Coffee
[1:49:17] County Tennessee commission is the
[1:49:18] Clearing House for either new County
[1:49:20] resolutions or proposed amendments to
[1:49:22] existing resolutions M and we're not
[1:49:25] amending all all legislation proposed by
[1:49:27] the county mayor's office or the County
[1:49:29] Commission normally makes a stop in the
[1:49:31] legislative committee before proceeding
[1:49:33] to a full vote of the County Commission
[1:49:35] so it's just an extra set of eyes yeah I

[1:49:42] sure this has to be a
[1:49:46] resolution uh it's we're just making a
[1:49:49] clarification and a reestablishment
