Thank you, Chair Stern Good evening, commissioners. Tonight the consideration of a
[6:42]
request for a closed hearing appeal of a agrees it grievance decision is before the
[6:48]
commission to decide At the commission will one hear the matter to adjudicate the matter
[6:56]
without a hearing or three refer the matter out to a hearing Officer?
[6:59]
The Commission's decision is pursuant to civil service rules 12 point 5B4 Little I Number
[7:09]
three So I or 12.12 before I continue with the brief staff report tonight going forward in
[7:18]
this item the grievant or the employee will be referred to as Grievant and has requested a
[7:25]
closed hearing. With that being said, staff is emphasizing that the
[7:29]
commissioners and all parties present refer to the Grievant by Grievant and not their name
[7:36]
In order to maintain their privacy we ask that all commissioners and parties use
[7:43]
the term grievant in place of the employee's name. Thank you.

Tonight the Commission and its legal counsel Ms. Monica Khalifa will receive the full
[7:55]
grievance hearing along with the staff providing copies to the parties that are present in
[7:59]
accordance with civil service rule 12.5 B for Little three Eyes This portion of the
[8:10]
grievance rule requires that the Commission receives the full grievance record to review
[8:14]
prior to deciding one Will they hear the matter to will they adjudicate the matter without a
[8:22]
hearing Or three will they refer the matter out to a hearing officer as part of the
[8:28]
grievance for record there's a series of short videos for the Commission to review due to the
[8:35]
limitations of viewing these documents or these videos from the Dyess there is a closed
[8:43]
session item on the agenda tonight that closed session item will be used to view those
[8:48]
videos only staff will provide further information and instruction to the Commission
[8:54]

just want to state that there's a concern about the record. It is missing the risk
[56:50]
management report and the sound quality report. And so I just want to go on
[56:59]
record stating that there are some things missing from the complete record.

or not you're going to hear the grievance appeal, whether you're going to adjudicate the
[1:00:12]
matter without a hearing or if you're going to send the grievance appeal to a hearing
[1:00:17]
officer. Just keep in mind that a couple of those options either hearing
[1:00:23]
the appeal or adjudicating the matter without a hearing would be something that we would want
[1:00:27]
to discuss Potential hearing dates or a deliberation date depending on which choice you
[1:00:35]
choose of those two of the three. Just so that we can move
[1:00:39]
forward with the matter but know that staff and Ms. Khalifa are also here to answer
[1:00:43]

think this is worth us hearing. I think the record is green. I think we could make a
[1:01:20]
decision based on this record especially if it were supplemented.

But I feel like there are more questions to be answered by both parties So I think we
[1:01:30]
would benefit from having a hearing and I think it's something we should do in-house
[1:01:34]

I also agree it would be my preference to adjudicate immediately but I have a whole

series of questions for both sides and I believe that there is much that isn't mentioned in
[1:01:49]
the record that I would want to touch base on and I do think it's appropriate that we hear

it since we heard the matter previously that led to this. So thank you.

So yeah I am in consideration of adjudicating it. I am not opposed to hearing it

based on the record would be a viable option. Of course I'd not be opposed to

two versions and I think that the witnesses would fill in a lot of gaps.

I assume to give more context and answer maybe some of the questions that we have.

I mean we could do it but I think it would be much more fair to both parties to have
[1:02:52]
more evidence before us. Yeah, I agree. I have I guess I would call
[1:02:59]
reservations. I'm not sure I I'm in favor of adjudicate but I have some
[1:03:04]
reservations about some of the questions about some of the matter is that either in the
[1:03:08]
record or items that I feel ought to be in the record that I have questions about.

and I'm not sure about anyone else on the commission but I'm already looking at dates in
[1:07:02]
January February. I will agree with me. I feel the same thing in

November or December. I we may need to leave November open if we have to put some of
[1:07:21]
October into November. You know we still have an open matter that we haven't
[1:07:25]
initiated yet So I have a question for staff if I may on the on the upcoming hearing or
[1:07:36]
the October dates back in play, do we know

commission it's still tentative pending trial. So I don't think there's been a

particular hearing. So that's why I'm a little worried that we may need

if I may just from the staff perspective and logistics perspective perhaps it may suit

the commission to potentially consider putting the calendaring of this grievance

request actually on their October agenda. Once you have a clear picture
[1:09:00]
as to what's happening with your hearing that begins the middle of September so you have
[1:09:05]
a better idea. It's an option to consider I'm saying one way or the other But
[1:09:09]
if you want to look at dates tonight that's fine as well. But I just want to know let you
[1:09:13]
know that that could be an option available. Okay.

more than one hearing day still to be safe. That's I think at least two,

Just you know, for us to deliberate and discuss. So I'm actually determined make
[1:10:27]
a determination So I mean November may be viable but rather than push it into
[1:10:36]
January well my pro is I'm going to be away from Thanksgiving through about the
[1:10:42]
middle of December at least one way to. So that's why I was thinking
[1:10:49]
January might be looking at that at all. Yeah I'm looking more toward
[1:10:53]
the end of September here October we have three weeks there of freedom.

other matter for October to help. It's been going on for a really

long time and they haven't really committed to date so maybe we should just they have

a it's due to a trial that they weren't aware previously would start in October and it's based

on whether that would continue. Correct? So I mean it would be my strong
[1:11:23]
suggestion to wait until the October seventh meeting because we should have more inquiry on
[1:11:31]
dates during after the other hearing actually begins. The October dates though begin
[1:11:39]
October to one unless I'm incorrect. Chair You are correct in that
[1:11:52]
first date that we had calendar for we have calendars for the other matter and which does
[1:11:57]
then give us beginning September 28th the week of seven September 28th, the week
[1:12:05]
of November 5th, the week of October I'm sorry Tobar five The week of October 12.

So there's there's a three week span in there that potentially as long as parties are prepared
[1:12:24]
and I'm not sure about h.r. Staff i due to the scheduling of the other hearing and me
[1:12:32]
walking out those dates i've had to schedule a ton of other things between you know when we
[1:12:37]
have definite free time and I'm sure H.R. has been doing the same thing as far as scheduling
[1:12:47]
So it's a bit tough. Yeah well now that we're speaking about like potentially
[1:12:51]
three days for this hearing including deliberations, I feel you know, with the uncertainty
[1:12:59]
of these dates I think pushing it into January would be you know, a viable idea And that
[1:13:07]
was my original thinking. So I thought just skip past all this and wait till January.
[1:13:11]
But if it is possible I would rather have it sooner. But if it's not possible I can
[1:13:18]
see where it could be logistically complex to do it now to to try to try this could
[1:13:25]
have it somewhat simultaneous with the other hearing even though this is should be you
[1:13:30]
would think would be rather simple simpler matter but you have the dates are uncertain
[1:13:37]
and no one is given but we're not interfering with the dates that we're interfering with.
[1:13:41]
There is staff availability. I'm still with the Jen Yes So I'm sorry newbie question to
[1:13:53]
the do we have to set the dates at an open meeting as we're doing now or can this be
[1:14:01]
discussed between meetings. No no can't be discussed too well.

Individual commissioners can provide their general availability to staff just it
[1:14:09]
can't be discussed with a quorum outside of the meeting. Okay.
[1:14:16]
And how many commissioners need to attend the meetings? Well, five of us have to be
[1:14:21]
available for the hearing itself. Yes.

No, we need a minimum of three for a quorum So that's for example we don't have all
[1:14:31]
commissioners participating in the upcoming hearings as long as we have a quorum we are
[1:14:39]
fine. Okay. So then at the October meeting
[1:14:46]
I imagine that staff could come up with a list of dates where all the various people outside
[1:14:54]
of commissioners would be available because you can discuss it selves, right?
[1:14:57]
Yes. And Amy, would that be possible to by the October meeting
[1:15:02]
receive availability from the parties, from commissioners and from staff and make suggest
[1:15:09]
suggestions on potential dates ? Yes, I think we could.

I think that information I think this has to be discussed with the commission among the
[1:15:21]
commissioners. It would be discussed I think the idea that Commissioner
[1:15:28]
Craig is bringing up is to essentially postpone actually calendaring the date until the
[1:15:37]
October meeting when staff has more information and not only about the hearing but
[1:15:41]
everybody's availability. Okay. That that then precludes us
[1:15:45]
from doing having any action prior to that meeting So yes but at least for me I'm
[1:15:56]
unavailable the first week of October, the last week of September I'm not sure about
[1:15:59]
each our staff but we do have other options here to to look at two accommodate staff and
[1:16:09]
commissioners Okay so so another new question would it be allowable for commissioners
[1:16:16]
to between now and October seventh and just to reach out to each other a list of dates
[1:16:25]
where we're available so that you have that information so you can make your will
[1:16:31]
discussion. Yes Nothing in the brown I argued that.

Yes So then they have our schedules right and then they can also gather up the parties
[1:16:48]
schedules and staff schedules And then when we reconvene next month we'll have a lot of

information we can hopefully just find some dates that everybody I, I know I'm I, I
[1:17:01]
would entertain the thought of moving this into January. >> We feel that could certainly
[1:17:08]
be on the on the on the table along with some of the other data you could possibly be
[1:17:15]
proposed But I think it's prudent to go ahead and wait until the October meeting until
[1:17:20]
we have more information rather than dinner. It could be an option.

I just think it would be nice to try to do this as soon as reasonably possible because
[1:17:30]
it's an ongoing situation, you know, and I want to resolve it. I agree that we've eaten into
[1:17:38]
her time, you know, at that point So do we need to notice at the the meeting, you know,
[1:17:50]
like a certain amount of time prior to the meeting If if we have the hearing, do we have to
[1:17:58]
notice that hearing for this any specific time prior? Yes, it did.
