» Thank you. Uh we had some recent staff
changes which opened a super supervisory
[10:01]
position for night shift. After a small
in-house
[10:06]
application process, we have appointed
John Hartley as a sergeant for B nights,
[10:12]
not to be confused with Landon Harley,
who is already a sergeant on Bdays. So,
[10:18]
we're excited for him and he's getting
started with some of that supervisory
[10:21]
training. Now,
some of our officers participated in the
[10:25]
street racers detail with IP and state
police back on August 21st.
[10:30]
Uh that's through grant money through
the state. Those kind of spinners, those
[10:34]
vehicles that take over the
intersections. During that, our one of
[10:37]
our officers spotted a reckless vehicle,
stopped him. We were able to get a
[10:42]
serious violent felon in possession of a
firearm off the street as well as a
[10:46]
driving arrest that was actually very
close to town.
[10:51]
We've had a couple of recent breakins
and thefts around Arthur overton that
[10:54]
area. We have a couple leads that we're
following up on trying to see if we can
[10:59]
gather out of that. We did have a
firearm that stolen out of that. So,
[11:03]
obviously that's kind of important for
us to try to get back. We picked up our
[11:07]
Polaris Ranger today. Um it was outside
if anybody wants to do that. We have to
[11:12]
get decals down still and then we're
going to incorporate that into our
[11:16]
driving training that will be coming up.
Speaking of that, we have driving
[11:20]
training later this month at the Marian
County Fairgrounds. We've started a
[11:23]
partnership with them and using some of
their grounds they have when it's
[11:28]
nobody's there. So that's very helpful
that it's a nice large space. There's
[11:30]
several different structures that we can
use kind of elevate our training a
[11:34]
little bit. We did stops which is
traffic stops training there a couple
[11:38]
weeks ago. Um got a lot of positive
feedback from that. use our simulation
[11:42]
firearms and Sergeant Landon Hartley
conducted that training for us and again
[11:49]
we got a lot of good feedback from our
officers saying they liked it. So
[11:53]
trailer retreat coming up on October
17th 3 to 5
[11:58]
and chief wanted to mention that we are
coming up on the 25th anniversary of the
[12:02]
terrorist attacks on September 11.

We uh been digging into insurance both
on the benefits and liability side quite

a quite a bit. Um we get benefits
meeting earlier with a somewhat quite

trivial things. We're
have a little bit of a tough year but we

help that out for next year. On the
[12:33]
liability side since we changed
brokerage we've probably been meeting
[12:36]
with Epic
talking or meeting about times a week.

We found a lot there to make changes on
pretty significant got feedback. Not the
[12:46]
worst I've seen. So that's that's a good
good bar. But we are going to try to
[12:52]
rewrite go to 111 with our liability
insurance the same way we do with our
[12:57]
health insurance on the same term. So
everything was up beginning of the year.

Um separately uh from that uh the
Indiana School Management Association
[13:10]
uh is awarding the town an award at the
leadership lunchon they have for
[13:18]
professional management leadership
community partner award. I am the
[13:20]
president of that board. I want to be on
record that I did not nominate
[13:25]
that
look questionable and the president
[13:29]
boards getting award.
So they they select Cumberland for
[13:35]
promoting professional management of
government in the state of Indiana.

Then also December chamber chooses four
communities from the nine county region
[13:46]
to highlight and spotlight every year.
So beginning of December, they are going
[13:52]
to do spotlight on County Cumberland for
their fourth quarter event here at town
[13:57]
hall, but it's a ticketed event that the
chamber puts on. So they're going to
[14:03]
probably bring in some extra chairs and
things for that. We are allowed to
[14:08]
reserve x amount of tickets for those
that want to attend from our
[14:12]
organization.
That will be right before as well as
[14:17]
couple days before that.

pretty pretty excited about that. We're
getting somewhat of a regional
[14:25]
recognition on the current initiatives
right now. Then Christine and her staff
[14:30]
been working with the businesses. They
had the sunflower festival over the
[14:33]
weekend. We got really good feedback on

House Bill 101, the housing audit

presentation.
>> Yes. Um so I'll be brief.
[19:09]
Um you have a copy of report as well as
the presentation that was provided to
[19:15]
commission in the council chair. I also
added a copy of the draft minutes from
[19:19]
commission the other night. No one
attended the public hearing. I do know
[19:24]
watched since then.
I'm just going to highlight a couple of
[19:29]
things that are in the in the
PowerPoint. Um so one is the findings.
[19:35]
There are five kind of key findings that
staff found as we analyzed um the
[19:40]
ordinances as it relates to the house
101 those nine factors they have asked
[19:46]
us to look at. So over the last five
years [clears throat] all of our res
[19:53]
that does tend to indicate to us that
our ordinances are likely updated for
[19:56]
what is being constructed.
Number two,
[20:01]
um none of the projects that were
approved over the last five years would
[20:05]
actually get permitted in our R1 or R4
districts, which are single family
[20:10]
districts.
They some of the standards would fit in
[20:14]
our R5 or R six, but those are multif
family districts or single companies not
[20:18]
allowed. So, we do have some
inconsistencies there. Um we do not
[20:23]
permit residential in any of our
commercial districts. So when you're
[20:26]
talking about mixed use and some of
those things, we are starting to see
[20:30]
more communities include residential in
some of their lower impact districts,
[20:35]
but we do not allow that. Our middle
housing districts are where we allow the
[20:40]
most flexibility right now. Um, and
lastly, the the typologies we have our
[20:46]
comprehensive plan don't line up with
our zoning district. So again just
[20:50]
another inconsistency indicating that
it's time for school amendments which as
[20:56]
you'll recall we have contracted with
HWC to do an update to our unified
[21:00]
development ordinances
control ordinance that's something that
[21:05]
has started and will be completed by the
end of next year. So a lot of the nine
[21:10]
uh the items in that n those nine
categories that we've been asked to look
[21:15]
at will really get analyzed deeper as
part of that process and looked at. But
[21:20]
there are some recommendations that I
just want to highlight that we'll be
[21:24]
looking at this year and then some of
the things that we'll analyze next year.
[21:28]
So one is some process changes. Um the
plane commission um would like to look
[21:35]
at establishing a plaque committee. This
is a smaller board. It takes the
[21:40]
subdivision plat out of the plan
commission to the smaller committee. Um
[21:44]
it allows us to be a little bit more
efficient, put some timing off on there
[21:50]
and it does require us to have a minimum
of one commission member there and the
[21:54]
plan commission makes the appointment to
that committee. Um it does require
[21:59]
amendments to the ordinance. So we're in
the process of drafting those. Those
[22:03]
would be to go to P commission and then
they would make recommendation to
[22:06]
council ultimately council will make a
determination of whether or not that is
[22:10]
something um that you guys want to do.
We're also recommending some things to
[22:16]
expedite your development plan process.
Um right now we require public hearing
[22:21]
for that. However, under state code,
we're not required to do that. So one
[22:25]
that
requirement we think needs to be
[22:28]
modified. And then also um under Indiana
code, the legislative body can designate
[22:34]
that to the commission staff. A hearing
be committee or commission. So we're
[22:40]
recommending that that be a staff
approval and that in fact we use our T
[22:45]
committee which is our technical
advisory committee with our engineers
[22:48]
and department heads on it to um review
those development plans. So those two
[22:54]
changes will allow us um to save um a
couple of on each of those processes. So
[23:01]
ultimately we could be saving developers
potentially a month if they're required
[23:05]
of those.
Um for the zoning recommendations, one
[23:10]
of the things that we'll be recommending
this year as part of our transition um
[23:16]
we'll be bringing development changes so
that we have zoning districts for our
[23:21]
Marian County properties um that we
don't a lot of legal non-conforming
[23:26]
uses. And what we found is instead of a
bunch of new districts. We believe we
[23:30]
can make some modifications to our R5
and R six zoning districts that will
[23:36]
solve a lot of those issues. Um that
also lines up with some of those
[23:41]
inconsistencies I identified in our
findings. So we'll be looking at
[23:46]
allowing single family in our five and
our six and then also um modifying some
[23:52]
of the speakers in there. That's
something that will be coming back to PL
[23:57]
council um late fall and that this year
for consideration and that will put us
[24:04]
in a good position um as we become an
excluded town January one to be able to
[24:10]
administer those comprehensive
control ordinances um consistently on
[24:16]
both sides post on the entire town
regardless of what county
[24:21]
and then um There's many items that we
are asked to look at. Architectural
[24:26]
standards, parking, um a lot of our
development standards,
[24:32]
um allowing different residential
typologies.
[24:38]
Those items really deserve adequate
study with our comprehensive plan
[24:43]
nearing completion. It's going to go
through the approvals process this fall.
[24:48]
We're preparing for this Uno transition.
We have HWC under contract to update our
[24:54]
unified development ordinances. We think
if we would be if we asked you to make
[24:58]
changes now, we would be reacting um to
kind of a suggestion versus doing a
[25:05]
really good study to make sure we're
being consistent with what our community
[25:08]
is asking us to look at and give
thoughtful study of these of what the
[25:16]
standards should be in these districts.
So, we're recommending that the
[25:20]
remaining items be analyzed and
considered as part of our uh update to
[25:27]
the development board.
That is a quick version of highlights of
[25:34]
what is in um our audit on housing. Um
ultimately, I think we have some good
[25:40]
things in there with our housing, but we
also do have some things that we know we
[25:43]
need to address and there are some
opportunities for efficiency. So, um,
[25:48]
you're required under this new act to
hold a public hearing on this, which we
[25:53]
did at commission reporting back to the
council and then we'll report to the
[25:57]
state that we have this hearing and our
findings.

When I reviewed the PowerPoint, I did
[26:08]
have some concerns. very first one was
on
[26:14]
lot sizes lot sizes
that causes me concern
[26:20]
and I know it was also house bill
that was addressed as to what type of
[26:28]
house it will bring the second concern
was it is odd it looks like now from R1
[26:34]
to R4 now they're back to pushing double
triplexes
[26:40]
that they were so against that.
And the third thing, yeah,
[26:45]
» the market is the market is cyclical.
So, if you do this long enough, as many
[26:51]
as of us have watched the housing
market,
[26:54]

» And so I I agree. When I first started
out, you know, 25 years ago, R1 was
[27:05]
single family, R2 was single family,
delex, R3 was single family, delex,
[27:09]
triplex, R4, and it went on. We got to a
point where it was like all single
[27:14]
family, everything else is mult.

The other thing I thought was
interesting was on R5, R six
[27:25]
» because now they're looking at rather
than having industrial zone area. Now
[27:31]
we're shifting to able to put
residential in there and doing almost a
[27:37]
fixed use.
I found that very interest.

You know, a lot of the things you
[27:45]
brought up is one of the reasons why a
lot of those development standards we're
[27:49]
recommending we take under consideration
as part of our new process that to come
[27:56]
in and make a quick decision. Now, I
don't feel like we're doing the
[27:59]
community justice. Um, we also haven't
adopted the comprehensive plan yet and
[28:05]
we want to make sure whatever we adopt
with our standards aligns with that
[28:08]
comprehensive plan. And so while these
are things that we're being asked to
[28:13]
analyze, I think that's exactly what we
need to do is analyze them and then
[28:17]
determine based on our community's
guidance what's appropriate for us
[28:22]
» and then ultimately
if this, you know, we're going to do
[28:26]
whatever the state requires of us,
>> we'll probably have a new law by next
[28:29]
July anyways.
>> I know that's I guess that's where I was

I sit on the House Rep's summer housing
committee that is carrying this
[28:41]
legislation now. It's not the same
legislator as last year. The House
[28:46]
leadership, the governor's
administration moved it to the House
[28:49]

And we were having really good
conversations, but then it moved back to
[28:58]
the national agenda after
they their summer national conferences.
[29:05]
So it's like they get in the chamber. So
I came back in really good collaborative
[29:10]
space and then after they went to their
summer conferences they came back to
[29:14]
basically 101
items.

We're trying to work more into talking
about incentives and less about regular
[29:32]

» I do think it's good to take it under
adisement and evaluating

other things come spring.

And when it comes to like a lot size
concern, there's lot size, there's

density, there's also form based code
which gets away from those things, but

it has other standards in place to get
to what you want design. So it's
[30:02]
important that we look at this
comprehensively from all those different
[30:06]
angles to figure out what's best for our
community instead of just automatically
[30:10]
like
check something like let's do. So I'm

not These things are necessary things we
should do. These are things that
[30:28]

a tripping hazard

all through the lens of ADA and then
severity.

probably a trip or hazard

This would add several definitions to

trails, neighborhoods, post calls on
[36:32]
trails, post calls in the neighborhood.
Kind of defines that. It's not uh

procluding like your typical ebikes,
things like that. It's more focused on
[36:42]
some of the emotives and making sure
people that are driving on our roadways,
[36:47]
that are experienced drivers train to
drive
[36:52]
A lot of it doesn't repeal a whole lot
of code other than some of the parks
[36:57]
code would change a little bit through
this, but there's a fine section.

Otherwise, if we move forward with this,
we'll add new trail signage and rule
[37:07]
signage entrances throughout the trail
is kind of on our radar to do anyways.

Um we want to put these new regulations
very clearly have entrances to
[37:17]
our trails.
It does regulate roadways as well

enough to operate on the roadway and
follow all safety regulations. See more

and more kids and I said scooters
particularly ebikes just blowing

intersections and I get hit by cars.
So scary stuff like that.

sidewalks

what can happen where so there's not

debate. It also kind of tries to pull
the supervisors out of it HR. So there's

less of that um just inter department
struggle and face within that looked at
[42:23]
surrounding communities kind of what
their policies are a lotments and basic
[42:42]
reason I like it very close rel
[43:04]
I did like that change the policy I
thought that was more than fair
[43:13]
about how many comments policy.

adopting employee ethics policy.

policies and put it into employee ethics

other issues as we kind of gone through

[43:47]
goal is really just transparent
government and making sure we're
[43:51]
practicing things ethically up and down
clearly defining that to staff conflict
[43:57]
of interest
other areas for
[44:02]
you did nice job on the 16 pages.
I know the first four or five are on the

origins itself. I mean always

documents out

recommendation was going

at the end of that contract term
