and then the uh sewer pump station is

online as of think what they pull plug
last Thursday.

station's online uh clear well as Jeff

said will be online next week. Um, both
of those are pretty much just waiting on

lot of projects are wrapping up for you

some may not be exactly on time, but
they're on budget.

>> Yes, Mayor Arwin, members of the board,

and the citizens of Decar. Um, tonight I
speak to you not only as an alderman,
[9:17]
but as someone who believes I was denied
fairness, transparency, and due process
[9:22]
by the very people entrusted to uphold
them. The handling of the grievance by
[9:27]
Mayor Irwin fired against me, filed
against me, demonstrates the disturbing
[9:31]
pattern of unequal treatment,
withholding of information, selective
[9:36]
disclosure, and disregard for town
procedures. Mayor Irwin, on Tuesday, May
[9:42]
5th, I directly asked you for a copy of
the griev grievance filed against me.
[9:47]
You refused to provide it. At that time,
you and reporter Smith had already been
[9:52]
in possession of this grievance for 15
days. 15 days. I was forced to submit a
[9:58]
public records request just to see what
the accusations were being made against
[10:02]
me. Even worse, the withdrawal letter
was withheld from me for 31 days. Not
[10:09]
one day, not one week, 31 days. For 31
days, that letter existed while I was
[10:15]
left in the dark. For 31 days, my name
continued to appear on agendas and
[10:21]
meetings and workshops, on Facebook, and
in the local newspaper. For 31 days,
[10:27]
people were allowed to believe this
grievance was still active, still
[10:30]
unresolved, and still legitimate, even
though the document should have ended
[10:35]
with already in your possession. For 31
days, the truth sat hidden while my
[10:40]
reputation was being questioned in
public.
[10:44]
When I submitted a public information
request and contacted reporter Smith,
[10:49]
she told me she did not have the
withdrawal letter, that the mayor had
[10:52]
it, and attorney mains would need to be
asked before it could be released to me.
[10:57]
That means the letter was not misplaced,
it was not forgotten, it was controlled,
[11:01]
and it was withheld. And during that
31-day period, Mayor Irwin, you
[11:06]
instructed attorney Mains to make an
offer to me through my attorney. This
[11:10]
occurred on Monday, May 25th. If I
apologize and agree to attempt to
[11:15]
refrain from the actions complained of,
moving forward with an investigation
[11:21]
would be taken off the table. That was 5
days after the withdrawal letter had
[11:25]
been in your possession. In other words,
the matter was still being used as
[11:29]
leverage against me. But here's the
truth. Mayor Irwin and Attorney Mains
[11:35]
did not follow procedures required by
town ordinance 4-210.
[11:39]
At no point did the mayor ask me to sit
down and resolve the grievance. At no
[11:44]
point did the mayor ask for my version
of the the events. No evidence was
[11:49]
gathered. No interviews were conducted.
I have been judged without due process.
[11:54]
Many of you decided guilt before facts.
You turned procedure into politics.

I needed to hire my own attorney when I
saw how weak the grievance was, how the
[12:04]
mayor had hidden it from me, and how m
how mayor Irwin had conducted himself
[12:09]
towards me. One example of this was at
the April budget workshop. I suggested
[12:15]
cutting expenses, and Alderman Meyers
threw his pencil and name plate off the
[12:19]
table, yelled at me, and I quote, "I
will pay the damn money out of my own
[12:24]
pocket." The mayor didn't address
Alderman Myers's behavior. Instead, he
[12:28]
yelled at me.
This grievance was a witch hunt. It was
[12:33]
never about ethics or conduct. It was
about control, retaliation, and
[12:38]
silencing someone who dared to speak up.
Chief Chief Chris admitted he fired
[12:44]
filed a grievance because he was angry
with my husband, Monty Roland, the
[12:48]
former police chief. The the grievance
contains statements about me being my
[12:52]
husband that are false and damaging to
our reputation.
[12:56]
Rather than addressing a legitimate town
or workplace issue, the mayor and
[13:01]
attorney decide to turn a personal
dispute into an official town matter.
[13:06]
Chief Ratcliff's supplemental grief
grievance doesn't deserve mentioning.
[13:10]
The facts are wrong. It was filed 6
months after the incident. This was
[13:14]
retaliation.
Everyone got to hear the audio of my
[13:18]
rant to Chief Ratcliffe about the way a
member of his department acted towards
[13:22]
me because it was sent to everyone on
the email list and not just the
[13:26]
alderman. I asked for the video of this
email incident to be emailed out to all
[13:30]
the alderman. It wasn't done.
My grievance against Mr. O'Daniel was
[13:36]
never investigated by Mayor Owen or
Attorney Mains. I do not know if either
[13:41]
of them even reviewed the video of his
verbal attack against me. But I know
[13:45]
they never requested
my audio recording of the incident
[13:51]
which was necessary to to be fully
investigate what occurred. My grievance
[13:56]
was never placed on the board agenda,
brought before the board, published in
[14:00]
the newspaper or posted on Facebook. It
also was not handled in accordance with
[14:05]
town ordinance 4-210.
In contrast, the grievance filed against
[14:11]
me was treated as an official town
matter distributed to town officials,
[14:16]
placed on the agenda, and brought before
the board. The facts clearly demonstrate
[14:20]
that these two grievances were handled
unequally by Mayor Irwin and Attorney
[14:24]
Mains. And while all this was happening,
Attorney Mains built the town for
[14:30]
services he provided in connection with
his grievance, a grievance he advised
[14:34]
on, shaped, and profited from. He made
money off a frivolous, baseless
[14:40]
complaint that never should have
existed. Let me be clear.
[14:45]
Mr. Mains was working as the mayor's
attorney, not the towns. His action
[14:49]
served the mayor's personal interest,
his vendetta against me, not the best
[14:54]
interest of the town of Decar. Instead
of dismissing this nonsense, mayor, you
[14:59]
attorney mains twisted into something it
never was. You tried to make it sound
[15:03]
official, legitimate, and disciplinary.
The mayor invited an impass adviser to
[15:08]
the workshop. Alderman Ward and attorney
mains addressed his agreements to him.
[15:13]
Let me remind you the mayor was already
in possession of the withdrawal letter
[15:17]
and it had been voted on passed by the
board to not discuss without my attorney
[15:21]
present.
This letter should have ended this
[15:26]
matter immediately. Instead, it was
buried for 31 days. 31 days of silence,
[15:32]
31 days of public damage, 31 days in
which the mayor had the power to correct
[15:37]
the record and he chose not to. This is
not transparency. This is not due
[15:42]
process. This is not leadership. This is
secrecy.

Mayor John Wayne Irwin and Trooper John
[15:51]
Wayne Irwin have each taken an oath to
uphold the Constitution and the laws of
[15:55]
Tennessee to faithfully perform the
duties of their respective public
[15:59]
offices to carry out those duties with
integrity and truthfulness.
[16:04]
And mayor, those obligations include
following state law,
[16:08]
the town charter, and the town
ordinances based on the actions and
[16:13]
omissions outlined here. I believe these
are serious questions about whether the
[16:16]
oaths and obligations have been honored
in this matter. In closing, this isn't
[16:21]
about me. It's about the integrity of
the office of the mayor. It's about
[16:24]
whether our leaders can be trusted to
act with honesty and fairness.
[16:29]
Mayor Irwin, you failed that test.
Alderman Myers and Alman Ward, you
[16:34]
enabled it. Attorney mains profited from
it. And those on the board who stood
[16:39]
silently or spread rumors, you were
complicit.
[16:42]
Let me make one thing clear. I will not
be silenced. I will not be intimidated
[16:47]
and I will not stop until accountability
is served. I am asking that my
[16:52]
attorney's letter and his attachments
and Chief Chris withdraw the letter be
[16:57]
attached as part of the minutes of this
meeting. Thank you.

So with the ARPA money, uh there's two
pots of the money.

There's the ARPA the money from the
state and you're also just been agreeing
[18:19]
on that contract and then there's a
contract with the with the Hurst
[18:23]
excavator which is contracted for the
rehab budget.

In my attempt to try to [clears throat]
keep you all under budget, um I'll I'll
[18:33]
explain those two. There is a difference
in what we're under. The ARPA contract,
[18:37]
we have about $90,000 left to spend.
I've got about a month to spend that.
[18:43]
Uh, under the Hurst excavating contract,
I got about $400,000.
[18:48]
So, there was an overage discrepancy.
I'm going to be completely honest. U,
[18:54]
every time I talk to someone with the
state, I get a different number. So,
[18:58]
I've spent literally the last month
getting every number that I can from
[19:02]
every contract that we've gotten, and
I'm confident within $90,000.
[19:08]
Um, that would mean no no extra money
comes out of y'all's pocket that was not
[19:13]
intended other than a 10% match. Um, so
with that being said, I'm proceeding as
[19:20]
if we've got $90,000 left to spend in
this contract. um has been brought to my
[19:25]
attention. Uh when I presented this,
Mayor Irwin mentioned Hunterbin Road um
[19:31]
had some problems and then Jeff and I
went down there and took a look at
[19:34]
Hunter Ben Road and I noticed the
multiple layers of patch that have been
[19:38]
put on it. I think in the short time
that uh Jeff has been here, they've
[19:43]
patched it a couple of times. Um, we're
starting to notice um the first time I
[19:48]
went up through there, you can notice
some some decent divots, three 4 in
[19:55]
uh settlement uh in in the pavement. And
then the other day, we went up to look
[19:59]
at two of the worst spots to try to keep
this in that $90,000 range and noticed u
[20:05]
an actual hole.
I do not use the word simple because I
[20:10]
know exactly what that means. But it is
a place where water can actually get
[20:14]
into a trench and once water is in a
trench it can move whatever it wants to
[20:19]
um as we've seen flooding and everything
else. Water has got a a mind of its own
[20:24]
and it's very powerful. Um, so with that
being said, as as Jeff and I drove up
[20:30]
the road and looked at this, um, it is
apparent to me that it is probably
[20:36]
settlement within the the trench. Uh,
seemed like that may have been going on
[20:40]
for a while. There's a creek right next
to it. Uh, water moving in and out.
[20:45]
In lie of putting patch over this again
and watching it settle out in six
[20:50]
months, uh the best effort that I can
put forth is to completely dig that
[20:55]
trench up and back fill that with what
we call foldable fill, which is a a
[21:00]
loose concrete set up over time and is
still excavated. Um that is not a not a
[21:07]
cheap fix. Um, so that's what I've given
uh attached to this and again I am sorry
[21:14]
for the late notice on this. I've been
working getting the numbers straight so
[21:18]
that we can put these in.
Um, option one is keeping us in that
[21:23]
80,000 or $90,000 range. And that is
literally repairing and back filling the
[21:30]
two worst spots up there and patching
the hole. Um, y'all saw what that did on
[21:35]
Main Street. Not always the smoothest it
turns out, but we can we can watch that
[21:41]
process and and try to get that smoother
as smooth as possible. So that fixes two
[21:48]
of the rough leaves, but it fixes about
45 linear feet of of the problem. And as
[21:55]
we've measured out, there was about 135
linear feet. Uh so option two is fixing
[22:02]
all 135 linear feet of trench and back
filling that with just patch or not
[22:09]
patch but just just paving the trench
that he opened up. Um and that is the
[22:15]
$189,000.
Um and then option three is going back
[22:22]
in doing option two and then coming
through and paving the full width of the
[22:26]
road. um which I believe is going to
last for quite a while uh once we get
[22:31]
this uh ditch situated and keep things
from settling.

Um I can assure you if you look through
the video that is not the sewer. Um it
[22:41]
is a trench issue. Uh there's no INI in
that system. That system that was
[22:47]
previously rehab. The liners look really
good. Um, so I believe that this will be
[22:54]
the best fix for the project is to get
this trench back filled. Whether you all
[22:59]
want to back fill the whole thing or if
we just want to fix the two major parts,
[23:05]
um, that's completely up to you. Um, I
have been in contact with the contractor
[23:11]
today. Uh, he is contacting the the one
thing [clears throat] that upholds
[23:16]
everything is timeline to get the paying
crew back in.
[23:20]
U as y'all see with Main Street. It took
a little while to get them in here. Um
[23:26]
so he's in contact with them uh this
afternoon and tomorrow to see if we can
[23:31]
line up that that works within the
timing. I've got about 30 days to get
[23:35]
things done by September 30th. Um so
that this can be completed. U so that is
[23:42]
where we're at and I'm open to
questions.

This is a road that we have have got a
lot of complaints on and Jeff like I
[23:50]
said went up there and tried to patch it
several times and it just keeps washing
[23:54]
out um keeping
>> and sinking in as so it's just going to
[23:58]
keep doing over time. This would be the
one time that we could actually spend
[24:03]
quer money on some paving because it's
within this project. So
[24:09]
that would be one of the next road that
we would have to pave in the future
[24:11]
after this is fixed. Anyways,

lot on Main Street. Is that how it be?

before we paved it fully. Option three

start digging and trench falls in

think these are overestimates by a
little bit. I always try to do that. I

don't like to be the surprise.

And uh three is from the city limit line
all the way back down five point.

audits next year. So, I think we're
[27:41]
going to be able to attack um
some of the items that we've been
[27:46]
working on for the last three or four
years. You know, we're
[27:50]
right now at this point correcting with
some of them. There's still some others
[27:55]
that we've got to work on procedure.
We've got to work on segregation of duty
[28:00]
so that it won't come back up again.
But, you know, I can tell you that, you
[28:05]
know, the cash has been accounted for.
So you guys looked at the books last
[28:10]
month. You know, I swallowed really hard
when I thought we wrote about $1.7
[28:15]
million in checks out, but you can
report it back to you and I'm sure Laura
[28:21]
will get the details of what we have. As
Chris mentioned, we're getting
[28:27]
everything set up for the ARPA funding
to fill that back in. So, you know, I
[28:33]
think we're we're well on our way to
have a pretty strong year. It looks like
[28:38]
preliminary that um water and sewer will
still remain pretty healthy through this
[28:45]
year's August coming up. Um, the general
fund is still is tied, but I think once
[28:53]
everything's said and done, I'm a little
concerned with the depreciation of how
[28:58]
we're going to handle the extra
depreciation coming in water and sewer,
[29:03]
but I think we've got enough margin to
cover that. So, cash is balanced. um
[29:13]
everything you know we're working is due
up the payables receivables matches the
[29:18]
general ledger you know we're going
through all that the details of it now
[29:23]
so I feel like we should be in good
shape to submit at the first request
[29:28]
from the auditors so you know my goal is
I can't tell you when the auditors will
[29:35]
proceed with the audit but I can tell
you that we will have the city will have
[29:41]
ourselves turned in um well before we
have in the past this year.
