[4:32] new buyer is going to be the pro purchasing the

[4:35] property as is with all the

[4:39] pending violations issued by the building department

[4:43] and intends to address those on on his own behalf

[4:50] i don't know if any communication was had with the local building department

[4:54] and to convey any of this information

[4:58] but what i'm asking for is a short adjournment again um

[5:02] perhaps the 26th or even

[5:05] a date out further the next time after that that the council is going to be

[5:09] convening for the simple reason to make sure and

[5:12] ensure that it is sold and as we all know sometimes with with

[5:17] with real estate transactions they could be delayed for

[5:20] any number of reasons so i don't want to

[5:22] my my request for the adjournment maybe post the 26th is that i don't want to

[5:27] come back and have nothing more to to report

[5:30] if there was a delay on the buyer's end so again i'm asking for a brief

[6:23] owner knows or doesn't i mean i'm not questioning you mr longabuco in terms of

[6:28] the fact that your client may very well have uh properly advised the purchaser

[6:34] of what the issues are in terms of the as-is purchase i would indicate to the

[6:38] board that if in fact it's an as-is purchase with this violation pending

[6:42] would have to be a cash deal because no title insurance company

[6:47] would provide title insurance uh that was going to be my next question the

[6:51] building department then have they researched it for title insurance

[6:55] we have not uh received any information at all from

[6:59] them other than it was a call on friday to

[7:03] the secretary they left a number which i called three

[7:07] times today to mark mira security solutions

[7:13] who had through his conversation with the

[7:17] secretary said indicated that he was tearing it down

[7:21] for the bank so obviously that wasn't was miscommunicated so

[7:26] you know based upon mr lombuco's you know narrative uh what what i was

[7:33] suggest especially based on what our attorney

[7:37] said is that you know we've done everything by the book at this point

[7:41] uh i would i would say that the demolition order should stand you can

[7:46] extend it if you wish you know but

[7:51] keep the demolition order and possibly say that within 30 days

[7:56] from today that the

[7:59] you know the owners need to comply with taking out a building permit and it must

[8:04] be demolished within 60 days and

[8:09] you know let it ride through that and if there is a sale and they do plan

[8:14] on doing something they contact us they have an engineer with plans drawn up

[8:20] and submit them back to the account board and the building

[8:25] you know or you can you know adjourn it but again then we have to go through the

[8:28] entire procedure again with different so we would have the possibility of

[8:35] going out 30 days with offering them another 30 days at at the point if there

[8:41] is a sale so that would give them 60 days even if

[8:44] we followed al's plan when well if you were to close the public hearing

[8:50] tonight and make the determination that it's a dangerous building the the

[8:54] hearing notice says i believe that they have to secure a demolition permit

[9:00] within 30 days and actually complete the demolition within 60 days

[9:05] so that would put this out roughly 45 days

[9:09] beyond the closing date identified by council

[9:14] for whoever to come in and get the permit submit plans if they

[9:20] don't intend to demolish it they can submit plans for the rehabilitation and

[9:24] certainly at that point if the if it's progressing

[9:29] there'd be no requirement for the building department to actually

[9:33] go forward and do the demolition or arrange for the demolition

[9:37] what that would do is it would protect the town because you wouldn't have to

[9:41] recreate the will you wouldn't have to serve anybody you've done your due

[9:44] diligence if there's a problem at least you're in a position to have it

[9:48] demolished and if in fact there is a sale and the the the new owners want to

[9:53] re rehab it well they've they've got a short window within which to make

[9:59] arrangements and request additional time but it's not with any um negative impact

[10:05] on on the town board [Music]

[10:17] would say we should follow that plan that does give them

[11:37] a third party third party

[11:39] lender that's coming in i don't know and i apologize for not knowing that

[11:43] information certainly have no problem

[11:46] of making a request to have the contract conveyed over to

[11:50] town attorney so that he can see that you know there is somebody on the other

[11:54] end in there ready willing and able to buy the

[11:56] property um

[12:00] my only request would be for one more week of germany

[12:05] it doesn't matter to me at least it doesn't matter whether

[12:09] there's somebody on the other end and really what they know or don't know

[12:13] in fact it's worse if there's somebody on the other end because it's the whole

[12:18] transfer of title that causes the problem for the board if they extend it

[12:23] so effective and they and they don't have a meeting next week

[12:27] to or or another meeting between now and

[12:29] the 19th nor

[12:33] do i think that my advice would be that they delay the process because it would

[12:37] necessarily require additional notice publication

[12:41] delay and

[12:44] the either your client or the third party purchaser if there is uh such an

[12:49] entity they have the ability to do what they

[12:52] need to do without having the building raised by the building department

[12:55] believe me the building department does not want to go through the hassle of

[12:58] coordinating a demolition and then having to have it assessed against the

[13:02] tax rolls that's not our interest but at this point without

[13:08] really concrete information as to what the intentions are or who it might

[13:13] affect um

[13:15] yet you had your two to four weeks since the last meeting and i know that you've

[13:20] gotten certain information but at this point

[13:24] it's really potentially negatively impacting the board if they if they

[13:28] extend this any further so i don't know what the week buys you

[13:31] frankly this has been post or held open since june july 22nd right that's

[13:37] correct that's three weeks has anything been done three weeks up there

[13:44] is it is that building

[13:46] like open windows and open doors and you guys have not made any effort to secure

[13:50] that building after all this because we did that you said you were going to do

[13:53] that i did and i and i did reach out to my client i advise them that they should

[13:57] have the property manager that is assigned to

[13:59] that property to get there and secure it and they don't care um well i wouldn't

[14:04] say they didn't care i just i mean it didn't get done so

[14:07] according to according to the bill department didn't get known i did

[14:10] explain to them the concern and

[14:13] well that's i mean that's i guess what i would say is is against your thoughts is

[14:17] that they're they're not acting in [Music]

[14:20] good faith good faith right right now they they should have acted in

[14:23] good faces hey look you gave us another time period we'll go make sure that the

[14:27] windows reported the door so no kids get in there and somebody gets hurt right

[14:31] but you know they didn't even make the effort to do that

[14:34] and now to come back and you know delay this thing but we don't want personally

[14:38] i don't want to see a building ripped down because that just lessens the tax

[14:41] base absolutely that's not my choice to see this thing happen but

[14:45] when we're doing things like this there should be good faith on both sides of

[14:49] people moving forward and it doesn't seem like they've done anything to do

[14:53] that understood i have a problem no and i

[14:57] mean that's my position as well i mean i wanted to move forward with this weeks

[15:01] ago and i know that you know just talking with the neighbors

[15:04] that call my office almost every day you know they're complaining about rats

[15:09] and garbage and just the sight of it right they're worried about their

[15:13] property values decreasing because of it so i mean

[15:17] i don't know you know i'm kind of left in a situation where you know i

[15:22] have to move forward with this still gonna have

[15:25] 45 or 60 days even if we go forward absolutely if they want to get it done

[15:29] they'll get it yeah absolutely there's a new owner and that want to rehab the

[15:33] property and they have a plan then you know we definitely at our next

[15:37] meeting take a look at it and reconsider you know right that would have been my

[15:40] next question in terms of um

[15:44] so in the event that the obviously if the board is going to take action um as

[15:48] recommended by the town and the building department so where does that leave

[15:52] these this third this purchaser that's coming into play that's going to

[15:55] potentially buy this property um next week

[15:58] um what what is it exactly that they're going to be facing or encountering

[16:02] because they're going to have like a standing order at this point for the

[16:05] demo so it puts sort of the onus now on them

[16:10] it goes away we've suggested it'll be a standing demolition order they have 30

[16:15] days to take out a permit in 60 days to complete the demolition if it's not

[16:20] completed in that time period we'll get prices and we'll do the

[16:24] demolition and charging against the property

[16:27] that's that's the how this will work now practically

[16:31] speaking if they are looking for a piece of vacant land

[16:35] and that's that's ideal for them they can proceed with the demolition if

[16:41] they are going to try to re habilitate the property then

[16:46] we need stamp sealed drawings from the new york state engineer or structure and

[16:51] or architect for the design for a set of plans to say we're taking out this two

[16:57] by four we're adding a two by six and we're putting in the

[17:01] insulation accordance with new york state building code full set of plans

[17:05] submitted [Music]

[17:08] for rebuilding instead of demolition we

[17:11] would then consider that but it has to be within that time frame

[17:16] understood which is not out of the ordinary i mean you know a set of plans

[17:21] like that you know get the right guy during the week

[21:49] celebrating this year uh i did um

[21:53] the gemara cemetery group

[21:56] approached me about a historic marker for the cemetery to be assigned to be

[22:01] placed at geimord turnpike and i did get notification from

[22:06] the william pomeroy foundation that they give them away if you put in a

[22:12] grant application which i did uh the group um

[22:17] it's uh judy gamartesta and uh grace woodard they did all the paperwork uh

[22:23] however since they're not a 501 3c i did it through the town

[22:28] because a municipal can

[22:32] municipal entity can put in for that and

[22:37] but they are going to install it but it'll then be also a town

[22:42] a responsibility will be one of our signs along with all the others

[22:47] i've had helped a number of people i did a lot of research lately

[22:51] including something for the orange county land

[22:54] trust project and the new york

[22:57] genealogical and biographical society which is

[23:01] currently putting in a new gazetteer in 21st century gazetteer

[23:06] and they're making a lot of corrections uh to the old ones

[23:11] which included deer park uh deer park's parent uh town was

[23:16] mamikating which wasn't correct it's actually mammocating and menacing

[23:21] because we were half holster county and half orange county

[23:25] the historic marker project is done uh except that i just found out that

[23:31] there is another one assigned down on the neversync drive but i did go over to

[23:35] the highway department and we're going to work on getting that back up together

[23:39] again i did get a grant for six hundred

[23:42] dollars last year you requested that i put together a booklet for the historic

[23:48] markers and the stories behind them which i have done

[23:52] and i asked the orange county historian's

[23:56] office for a grant for the publishing of the

[24:00] booklet so

[24:02] i've got the pictures the caption done i just have to format the whole thing

[24:07] and also um carl just gave me the letter of permission

[24:11] the william pomeroy foundation is also giving

[24:15] to all the towns uh and not for profits bronze plaques to put on

[24:21] any building that's on the national register of historic places and they're

[24:25] very very nice i think there was a picture of one of the the papers that i

[24:30] gave you and they can either be put on the

[24:33] building or they can be free standing

[24:38] and i would say that that would be up to you if we get one whether you want it

[24:43] free standing or whether you want it to be put on the building

[24:46] and i've got all the paperwork now

[24:51] the large 8x4 sign that's in front of the schoolhouse was run over

[24:57] i don't know how it happened somebody must have pulled into the

[25:02] the driveway backed up right into it so anyway it was lying there in pieces

[25:08] i've cleaned it up as best i could i purchased new tracks for the letters and

[25:13] ed houston i spoke with with ed and the highway department they're going to help

[25:17] me put it back into place the damage wasn't that bad and it wasn't

[25:22] worth going to through insurance it cost 42 dollars so far to get it fixed i had

[25:28] lumber at home that i used and the other thing we have to do is get the

[25:33] the uprights and i don't know how much they're going to be

[25:37] i'd like to publicly thank lynn burns for all the plantings around the

[25:41] schoolhouse if you take it right up there it looks very nice this summer

[25:44] she's watered them maintain them weed whacked

[25:47] and it's looked really nice and al shaq gave us a

[25:51] planter which is sitting on the stone steps which is very nice so that has

[25:56] been really lovely all all summer for the town museum

[26:01] the july 21st bus tour was very successful we had excellent feedback

[26:07] uh we're working on august 24th bus tour they're all sold out

[26:12] and that's without a whole lot of advertising i am really amazed at this

[26:16] whole thing um that

[26:19] it's just so successful

[26:22] and it's really once we got it all together

[26:25] it isn't that much work uh we are planning an open house in

[26:29] september to celebrate the 150th birthday of the school

[26:35] uh uh september 21st from 12 to 5 and on the 20 sunday the 22nd from one to five

[26:41] there will be flyers coming out for that

[26:45] we're going to have world war ii posters in the history of the artists that

[26:49] produced them at the schoolhouse and a yesteryear display of clothing and

[26:53] household items in the grange building and

[26:58] we're putting together a display of 1863 events

[27:02] and it was really interesting that i found that in 1863 port jervis got gas

[27:07] lights they were installed so

[27:11] i'm learning a lot dave do you remember that

[27:16] very funny and we're going to have some irish music

[27:20] with the parting glass and i didn't put this in because i

[27:24] really didn't think that this would happen as quickly as it did

[27:27] but charlie swore out he's really very good to the school and he sends a

[27:31] donation every year and he wanted he sent another donation

[27:35] and he wanted it used for something special so i ordered a an 1863 flag

[27:41] you can fly an american flag of any year at any time it's it's perfectly legal

[27:46] and it just came in today and here it is as 35 stars

[27:51] and so we're going to dedicate that for the 150th birthday and i did write him a

[27:56] thank you note and told him and i'm going to put his name on the on the

[28:00] flagpole i guess that's about it we have programs

[1:13:02] according to the schedule i did put together they are due

[1:13:07] this friday by 4 p.m department submit estimates to

[1:13:11] the budget officer um from that or from friday until september the 6th i will be

[1:13:17] working on the budget officer's budget and will submit the tentative budget to

[1:13:21] the town clerk on september the sixth or by september the sixth

[1:13:26] uh once that's submitted you will receive at our next board

[1:13:30] meeting on the 9th of september you will receive the tentative budget

[1:13:35] for the town board and this is just where the town clerk will give the

[1:13:40] budget to all the town board members and then you will have time to review that

[1:13:46] that document up until september 23rd at the september 23rd meeting

[1:13:52] we will go over any changes that we want to make to that

[1:13:56] tentative budget and hopefully pass a

[1:14:00] 2014 preliminary budget on that day the preliminary budget the next day will

[1:14:06] be put together given to the town clerk and she will decide whether to accept it

[1:14:13] or not and if it is completely accurate she will accept it

[1:14:19] then from september 24th through november the

[1:14:22] 7th this is the new york state comptroller's

[1:14:26] annual review of our preliminary budget they will give us recommendations for

[1:14:30] any changes editions and deletions november 7th is the thursday after

[1:14:35] election day that will be a special meeting

[1:14:39] that will be our public hearing on the 2014 preliminary budget

[1:14:45] and that revisions are due to the comptroller's office

[1:14:48] and our public recommendations you know can be heard on that day as well

[1:14:53] any time after that public hearing we can vote to adopt a budget but the

[1:14:57] budget has to be adopted by the 20th of november

[1:15:08] quick to set the special meeting for the uh

[1:15:11] public hearing on the preliminary budget for november 7th to put that in stone

[1:16:49] on behalf of the taxpayers to the uh department heads of the town of deer

[1:16:53] park because um they have

[1:16:57] they have done a yeoman's job of controlling spending and uh

[1:17:04] it just it just goes to prove that with some diligence

[1:17:08] um you can reign things in you can you can

[1:17:12] actually be in the black and not increase taxes and drive your

[1:17:19] taxpayers crazy here because it's been done and uh

[1:17:24] i expect that uh for the next few years we're going to

[1:17:27] have a good election here coming up in november and i expect for the next few

[1:17:30] years that we're going to do our best to continue in that vein

[1:17:35] uh to be conservative uh both fiscally and politically and uh

[1:17:40] listen it it works and one of the things that that kind of indicates it also is

[1:17:46] the fact that nobody comes to a meeting anymore so

[1:17:50] uh i encourage people if listen if you want to come to the meeting you have

[1:17:53] something you want to talk about please uh feel free but

[1:17:57] um again my thanks my personal thanks
