February meeting. If you would please
[0:01]
stand, we'll do the pledge to the
[0:03]
>> flag
[0:06]
to the flag of the United States of
[0:09]
America and to the republic for which it
[0:12]
stands. One nation under God,
[0:15]
indivisible, with liberty and justice
[0:18]
for all.
[0:21]
>> Thank you.
[0:23]
Roll call, please.
[0:24]
>> Mr. Whitehead,
[0:25]
>> here.
[0:28]
>> Present.
[0:28]
>> Mr. Mr.
[0:29]
present.
[0:30]
>> Mr.
[0:31]
>> Here,
[0:32]
>> Mr. R
[0:32]
>> here.
[0:33]
>> Mr.
[0:34]
>> Here,
[0:34]
>> Mr. Burg
[0:35]
>> here.
[0:38]
>> Approval of the January 14th minutes.
[0:41]
Any additions or corrections, please?
[0:43]
>> Uh, yes. I'd like to correct the uh
[0:47]
approval of minutes. That's should have
[0:50]
been December the 10th,
[0:52]
2025.
[1:01]
And another correction um that was
[1:03]
requested by Scrubal was to remove
[1:06]
February 11th, 2026 from the top with
[1:09]
January minutes and title the document
[1:11]
January 14th, 2026
[1:14]
just to clarify what the document is.
[1:33]
Correct. But here,
[1:37]
so at the January 14th meeting, we had a
[1:42]
motion to September 10th, 2025.
[1:47]
Okay.
[1:52]
It's because of the way that the
[1:54]
document is. I think that so when we
[1:56]
switch it to the new way, I think it'll
[1:58]
be a lot easier to
[2:00]
>> Well,
[2:04]
with those two corrections, I'd like to
[2:05]
make a motion to approve the minutes.
[2:09]
>> Second. Have a motion to force properly.
[2:11]
Second. Roll call, please.
[2:14]
>> Mr.
[2:15]
>> Yes.
[2:15]
>> Mr. Hamilton.
[2:16]
>> Yes.
[2:17]
>> Mr.
[2:17]
>> Yes.
[2:18]
>> Mr. Christie. Yes, Mr.
[2:20]
>> Yes.
[2:22]
>> The tableabling of the Hog Creek
[2:24]
reconstruction. Mr. Surveyor.
[2:27]
>> Yeah, we tabled the task one order from
[2:31]
uh Lockam Group on the Pog Creek
[2:34]
Reconstruction
[2:35]
last week. I think uh Mr. Christie made
[2:39]
that motion. So, this is where we're at
[2:42]
now. I don't know if he's got more
[2:44]
questions or if they've been answered
[2:45]
and we can go from there.
[2:50]
And Lock Mueller is here. If you'd like
[2:51]
to have them make an update
[2:54]
address,
[2:55]
>> please.
[2:56]
>> I think might be most appropriate to
[2:58]
just I'm going to make a motion to
[3:00]
approve the task for.
[3:02]
>> Do you want to have L Miller make their
[3:04]
um
[3:05]
>> I think I'm Don't we want to approve the
[3:06]
task order first?
[3:08]
>> Sure.
[3:10]
>> Okay. I second that motion to approve
[3:13]
the task
[3:14]
first. First, before you get ahead of
[3:16]
yourself, it's on the table, right?
[3:19]
>> You have to remove it from the table.
[3:21]
>> I make a motion to remove the item from
[3:23]
the table.
[3:24]
>> Second.
[3:25]
>> Have a motion before properly second.
[3:28]
Roll call, please.
[3:30]
>> Yes.
[3:31]
>> Mr.
[3:32]
>> Yes.
[3:32]
>> Mr.
[3:33]
>> Yes. Mr. Christie.
[3:34]
>> Yes.
[3:36]
>> Thank you, Mr.
[3:38]
>> Now, Mr. Christie, would you like to
[3:40]
make your motion to approve the task
[3:41]
order?
[3:43]
That sounds like you just did. So, I'll
[3:44]
second it.
[3:45]
>> Okay. Thank you.
[3:46]
>> I have a motion before properly. Second.
[3:48]
Roll call.
[3:50]
>> Mr.
[3:50]
>> Yes.
[3:51]
>> Mr. Hson.
[3:52]
>> Yes.
[3:52]
>> Commissioner.
[3:53]
>> Yes.
[3:53]
>> Mr.
[3:54]
>> Yes.
[3:58]
>> You proceed, please.
[3:59]
>> Good morning, everyone. I'm Angie Moyer.
[4:01]
I'm a project manager with Lock Miller
[4:03]
Group. I also have my senior engineer
[4:05]
here with me, Erin Winger, and my area
[4:07]
manager, Anthony Goodnight, back here. I
[4:09]
think you've all met him. Um, I thought
[4:11]
I'd just summarize our task order and
[4:13]
then um, answer any questions you may
[4:16]
have. Um, so this is an hourly task
[4:19]
order not to exceed 49,200.
[4:22]
And the scope of services that will be
[4:24]
included are a kickoff meeting including
[4:27]
a site visit,
[4:29]
reviewing existing data, delineate
[4:32]
drainage areas, estimate potential flow
[4:35]
for the area, prepare hydraulic
[4:37]
modeling, develop two alternatives,
[4:40]
including exhibits, preliminary
[4:42]
estimates, hydraulic modeling for
[4:45]
alternatives. Identify potential utility
[4:48]
conflicts, prepare drainage
[4:50]
reconstruction report, identify
[4:53]
potential environmental impacts, and
[4:55]
summarize permitting requirements. And
[4:57]
this will also include a topographical
[4:59]
survey.
[5:04]
» Other questions?
[5:15]
No, I don't think
[5:16]
>> Hey, Angie, when you when you delineate
[5:19]
the area of the waterhed or of the small
[5:25]
ditch as it is now, that can potentially
[5:28]
be a larger area than like what we have
[5:31]
right here on this map that you gave us.
[5:33]
Is that correct?
[5:33]
>> I'm going to let you technical person on
[5:36]
this. So,
[5:36]
>> yeah, that's absolutely going to be a
[5:38]
bigger area than Well, I know it's going
[5:40]
to be bigger than the red area. I was
[5:41]
just wondering
[5:41]
>> Yeah. Yeah. Yeah. It'll be a lot larger
[5:43]
than
[5:43]
>> it could potentially even go like a mile
[5:46]
or
[5:47]
>> Yeah, it's going to be a couple square
[5:48]
miles of area.
[5:50]
>> That's perfectly That's what I was thinking. I appreciate
[5:52]
it. Thank you.
[5:53]
>> That's the survey limits that you're
[5:55]
>> Yeah.
[5:55]
This I I know it wasn't this red
[5:57]
area. I know this is where we're
[5:58]
starting at, but when we delineate that
[6:00]
watershed or what goes into that
[6:03]
>> side ditch, if you will, uh I was just
[6:06]
making sure that we're going to
[6:08]
>> expand it out. Thank you. I actually do
[6:11]
have a couple questions. Um, what's lock
[6:14]
Mueller's role during construction?
[6:19]
» Yeah. So, this task order doesn't
[6:21]
include um any services, but we can
[6:24]
provide whatever services you want at
[6:26]
that time.
[6:34]
How many days, months you think it might
[6:36]
take?
[6:39]
Well, depending on weather, you know, so
[6:43]
we can get a good survey for you and um
[6:47]
capture, you know, all the different
[6:49]
features in the area. Our goal is to
[6:50]
provide you a draft in 45 days from
[6:53]
notice to
[6:58]
you have a section
[7:00]
um
[7:02]
about services that are not provided.
[7:05]
There's 15 items on that list. Um, can
[7:09]
you elaborate on why that list was
[7:12]
included and are there things within
[7:15]
that list that we would need to get
[7:18]
someone else to do?
[7:22]
Um, so everything that's included in
[7:24]
that list we could potentially uh
[7:26]
provide for you if needed, but they're
[7:28]
not necessarily all needed at this time.
[7:31]
Um this first task order uh covers up to
[7:36]
you know providing that reconstruction
[7:38]
report doing all the hydraologic and
[7:39]
hydraulic calculations
[7:41]
um to come up with two alternatives and
[7:44]
this includes uh a potential evaluation
[7:47]
of extending that ditch further to the
[7:50]
south um as Rose requested. So at this
[7:53]
point we don't know like if you need to
[7:56]
replace culverts or if it's just going
[7:57]
to be ditch work. So, we don't want to
[8:01]
um have a scope of services and and be
[8:04]
charging you a fee for work that maybe
[8:06]
you don't need um or that we don't know
[8:08]
the full scope of yet. So, that we can,
[8:11]
you know, kind of rightsize that
[8:12]
proposal at the time.
[8:20]
» Any other questions?
[8:23]
>> The only other question I have, and I
[8:25]
think this is what Mr. Chrissy is trying
[8:27]
to get to. But if we get to the point
[8:30]
where we have a construction plan,
[8:33]
you offer a service to come back in
[8:35]
after construction to evaluate the
[8:37]
process, make sure that it was done
[8:38]
properly. I think what we've
[8:40]
>> Yeah. So we we can provide like um
[8:42]
during construction inspection. Okay. Um
[8:45]
shop drilling review if that's needed.
[8:47]
Construction administration. Okay.
[8:49]
>> Um asbuilt survey if you need that. Um
[8:53]
>> yeah, we can do all of that.
[8:55]
>> That's what I was wondering. We ran into
[8:57]
in the past where it's the we've got all
[8:59]
the way up to the construction point and
[9:01]
then
[9:01]
>> they're just hands off.
[9:02]
>> Hands off and
[9:03]
>> No, I appreciate people that can do
[9:06]
that.
[9:10]
» Any other concerns, questions?
[9:17]
» Thank you. It's our next move there for
[9:20]
sure.
[9:21]
>> We've already approved the task order.
[9:24]
I don't think there's any other on this
[9:27]
reconstruction. But we move on the Thank
[9:30]
you ladies.
[9:31]
>> Thank you for
[9:33]
>> this is the time we have set for public
[9:35]
comment. Anyone wishing to address the
[9:38]
drainage board, please state your come
[9:40]
to the microphone, state your name,
[9:44]
address, and your concerns.
[9:52]
Good morning board. Steven Brand, Del
[9:54]
County Commissioner's Office. I'm also
[9:55]
the president of storm water board and I
[9:57]
wanted to ask the drainage board if they
[9:59]
would be interested in having a joint
[10:01]
meeting between the storm water board
[10:03]
and the drainage board. I don't know
[10:05]
what that would look like statutoily. I
[10:07]
think legal counsel represents both
[10:09]
drainage and storm water board. So they
[10:11]
would have to weigh in on this. Also,
[10:13]
Mr. Borcher is associated with both
[10:15]
boards and I think it would be uh
[10:17]
valuable for both boards to uh have a
[10:20]
joint meeting.
[10:23]
>> I support that. Sounds like a great
[10:25]
idea.
[10:27]
>> Any concerns from our legal counsel?
[10:29]
>> No, we can do the notice. You would do a
[10:31]
notice for each board that you would be
[10:33]
at the same time in the same place. And
[10:36]
um the boards could
[10:39]
we can figure out the logistics on where
[10:41]
who's going to sit where, that kind of
[10:42]
thing. So, we can do the notices for
[10:44]
that. That's not a problem.
[10:46]
>> And I suggest we use the D doodle tool
[10:48]
to find the best date for many busy
[10:52]
people. Well, do you want to do it on a
[10:55]
the storm water meets the first Monday
[10:59]
every month?
[11:01]
And the drainage board meets the second
[11:04]
>> Wednesday of every month. So, do you
[11:06]
want to do it on one of those dates?
[11:08]
That may be the easiest. I think we've
[11:10]
already sent out the notices for the
[11:12]
storm water for the year
[11:13]
>> like before.
[11:15]
>> I would recommend tagging it onto this
[11:16]
meeting here.
[11:18]
>> Commissioner Rian and I are already
[11:20]
here. We would just need to bring in
[11:22]
Commissioner Henry and Mr. Borches is
[11:24]
already here.
[11:25]
>> Yeah,
[11:25]
>> sounds best for me since we're already
[11:27]
going to be here.
[11:28]
>> Yeah, that's easy to do. We could do a
[11:30]
You've already published all your
[11:31]
notices for your meetings. So, the storm
[11:34]
water will just make a change of its
[11:36]
meeting to the this time. And you want
[11:39]
to do it in March. You want to do it in
[11:40]
April or
[11:41]
>> March. March 11th would be our next
[11:43]
meeting.
[11:43]
>> Okay.
[11:44]
>> Yep. That's fine.
[11:45]
>> As well do it in March.
[11:46]
>> Be here before we know it.
[11:48]
>> And Mr. Whitehead, I will work with you
[11:49]
and legal to put together an agenda.
[11:51]
>> All right. Now, this is not a public
[11:54]
>> period. Public meeting.
[11:56]
>> It would be open to the public. Okay.
[11:57]
>> Be a public meeting for both of them.
[11:59]
We'll just we'll change the storm water
[12:01]
meeting from the second to the 11th.
[12:04]
>> Correct.
[12:05]
>> Okay.
[12:06]
>> Mr. Brand, if there's anything that you
[12:08]
want me to prepare for that meeting,
[12:09]
just send it to an email.
[12:10]
>> Absolutely. Yep. For sure.
[12:12]
>> Y Commissioner Brand, do you have
[12:14]
specific items in mind? I think that
[12:16]
it'd be good to talk about uh
[12:18]
jurisdiction and overlapping priorities.
[12:20]
You know, we talk about similar topics
[12:22]
on both boards and I just think it would
[12:24]
be healthy to have an open conversation
[12:26]
to make sure that we're using the
[12:28]
taxpayers's dollars as effectively as we
[12:30]
can.
[12:32]
>> Could we have the verbiage of which one
[12:35]
and who has those jurisdictions?
[12:37]
>> Sure, we'll be happy to provide that.
[12:39]
There is a lot of overlap. The storm
[12:41]
water covers a lot of the same stuff you
[12:43]
guys cover and there's money in the
[12:45]
storm water because there's separate
[12:47]
storm water fee on top of a drainage
[12:49]
assessment fee. So since we have to
[12:52]
abide by verbiage, it's nice to see it
[12:56]
in front of us. I don't like it.
[13:00]
>> I'd be happy to provide what the storm
[13:02]
water does.
[13:03]
>> Thank you.
[13:04]
>> Yeah. Thank you.
[13:05]
>> Thank you.
[13:07]
Anyone else wishing to address the
[13:10]
drainage board, please come forth.
[13:14]
>> New business, Mr. Surveyor.
[13:18]
>> Yeah. Uh,
[13:20]
believe in James.
[13:25]
» No, that's Do you want to talk to
[13:29]
Banning Engineering about the A
[13:32]
McConnell report? Well, no. At some
[13:35]
point,
[13:36]
>> it's up.
[13:37]
>> I don't step on you. I just
[13:38]
>> No, you're fine. We're going to open
[13:39]
bids. And like I said, we got a lot of
[13:41]
bids to open, so it's up to you guys.
[13:46]
» Well, as I said in the January meeting,
[13:48]
the drainage board had me put together a
[13:50]
list of debrushing projects,
[13:53]
and so I put together there's 14 of them
[13:55]
on there. Uh,
[13:58]
two of them are ones that we do annually
[14:01]
just because of the water in the area
[14:04]
and the
[14:06]
high population density in that area.
[14:08]
And then the other ones are just ones
[14:10]
that have needed to be done for years.
[14:13]
So, I asked I sent out uh quotes to uh
[14:18]
respects to
[14:20]
uh some contractors and they got me
[14:22]
quotes. So, I guess we'll open them up.
[14:25]
Anybody have any questions before we
[14:27]
start?
[14:28]
>> And Mr. Borchers is going to open these
[14:29]
in the order of priority. So the
[14:31]
priority that um we feel um they need to
[14:34]
be completed to sustain drainage in
[14:35]
Delaware County. Um I would suggest that
[14:38]
we wait until we have opened all of the
[14:39]
quotes before we make any decisions on
[14:41]
awarding any of the quotes to make sure
[14:43]
that we have enough funds to cover the
[14:45]
codes the quotes of highest priority.
[14:48]
>> Making sure we have funds is necessary.
[14:54]
Uh the the first one is on your sheet is
[14:56]
no name creek. This is the area that a
[14:58]
McConnell drains in that Banning
[15:01]
Engineering is working on a
[15:02]
reconstruction with. So I thought
[15:04]
there's no sense of reconstruction that
[15:06]
tile if the open ditch that drains that
[15:08]
tile is not
[15:10]
clear of debris and brush. So the first
[15:14]
quote was from Butler Masonry.
[15:21]
I think I got a thingy.
[15:24]
I do a thingy.
[15:43]
Butler masonry quote was for $78,190.20.
[16:04]
The next one is from Coupe Salon and
[16:06]
Landscape.
[16:18]
And this was for 45,413.
[16:31]
And the last quote that we receive from
[16:34]
this is from JJC Excavating.
[16:48]
And it's for 47,388.
[17:10]
The next ditch is the Hyatt. This is the
[17:13]
one that runs by the old school in
[17:15]
Tiltson. It's a summer job mowing. It's
[17:19]
not really de brushing.
[17:27]
Number 13. First one is from Butler
[17:29]
Masonry.
[17:41]
It's for $25,410.
[17:53]
The next quote is from Coup's Lawn and
[17:54]
Landscape.
[18:05]
It's for 20,000 even.
[18:15]
The next bid is from JJC Escavating
[18:27]
for $13,860.
[18:42]
The next one is uh job number 14. It's a
[18:46]
shramm ditch. This is the one that runs
[18:48]
through country village. It's also
[18:49]
another annual mowing job.
[18:54]
The first bid quote is from uh
[18:58]
Scram or from Butler, excuse me.
[19:13]
It's for $30,019.
[19:27]
Second quote is from Coup's Lawn
[19:29]
Landscape.
[19:34]
Yeah, that's a good one
[19:44]
for 17,000. Even
[19:51]
the third quote for number 14th, the hot
[19:55]
the shra is from JJC.
[20:05]
for 32,748.
[20:14]
And the last one is from Schneider
[20:16]
Excavating
[20:25]
and it's for 10,8684.
[20:44]
This next quote is
[20:47]
job number one, the Isaac Linux. And
[20:49]
this first one is from Butler Masonry
[21:02]
for a total of $68,837.
[21:15]
Second quote is from Coup's Lawnscape
[21:18]
or land in law landscape.
[21:24]
It's for $57,968.90.
[21:29]
» That was 57,000.
[21:31]
>> 57,968.90.
[21:40]
The last quote for this job is from JJC
[21:42]
Excavating.
[21:56]
» It's for $54,345.
[22:04]
Before we go on, Tom, on this Isaac
[22:06]
Linux, there was a question about some
[22:08]
signs that were posted um not to remove
[22:10]
vegetation. Was that clarified with all
[22:12]
three of these contractors?
[22:14]
>> Yes, I've talked to all three of them
[22:15]
about them. They they are actually
[22:18]
all of them contacted my office or
[22:20]
someone else about them and I've talked
[22:22]
to them all about it. So, yeah, they
[22:24]
understand.
[22:24]
>> The the background for the board was
[22:26]
during the original construction or
[22:27]
reconstruction of this ditch, it was
[22:29]
relocated to a new um location. And at
[22:32]
that time the contractor placed signs um
[22:34]
permanent signs on the ditch bank that
[22:36]
said do not mow or debrush, do not
[22:38]
remove any vegetation. Those signs were
[22:41]
never removed. So there was a question
[22:42]
with some of the contractors on do I
[22:44]
have to mow the whole thing or do I stop
[22:46]
at the signs? So that was clarified. I
[22:48]
just wanted to make sure that was done
[22:49]
before.
[22:50]
>> So they do the whole thing.
[22:51]
>> They do the whole thing. And for
[22:53]
everybody's information, this was the ditch that Walmart South Walmart
[22:58]
paid for, put in, and I don't think
[23:00]
anything's been done to it really since
[23:02]
on that one section.
[23:05]
>> Thank you, Tom.
[23:06]
>> Yep. Next, we're going to go to number
[23:09]
two, the Dora Wilhelm
[23:13]
versus Butler Masonry.
[23:30]
Uh $19,019019.
[23:41]
Second quote is from Coup's
[23:43]
lawn and landscape.
[23:56]
It's for $19,019019.
[24:10]
The third quote is from JJC Excavating.
[24:23]
So for $24,453.
[24:33]
And the fourth quote is from Schneider
[24:35]
Escavating. Nope. Yep. Schneider
[24:38]
Escavating.
[24:50]
It's for $8,341.19.
[25:11]
Next is three, the Donovan.
[25:21]
First one is from Butler Masonry.
[25:33]
That's for $30,15.
[25:42]
Second one is from Coops Lawn and
[25:44]
Landscape.
[26:01]
It's for $27,49857.
[26:11]
The third and final quote for the
[26:14]
Donovan number three is from JJC
[26:16]
Excavating
[26:27]
is for $19,66.50.
[26:47]
Next up is the thimple number four.
[27:02]
$6,260.
[27:04]
That was from Butler Masonry.
[27:06]
6260.
[27:11]
Next is Coup's Lawn and Landscape.
[27:25]
$15,12.60.
[27:35]
Next is from JJC Escavating,
[27:50]
$3,756.
[27:55]
And the fourth and final one for number
[27:58]
four fimple is from Schneider
[28:01]
excavating
[28:03]
general contractor on this one.
[28:12]
$10,16.
[28:30]
Got number five, Campbell Creek.
[28:33]
First one was from Butler Masonry.
[28:44]
54,915.
[28:55]
Next is Coup's Lawn and Landscape.
[29:10]
$32,522.87.
[29:19]
Third is from JJC Excavating.
[29:41]
$ 28,372.75.
[29:50]
We got one from Full and Camp E
[29:51]
excavating.
[30:09]
It's for $36,610.
[30:33]
Number six is Lwood Reese. First one is
[30:36]
from Butler Excavating or Butler
[30:38]
Masonry,
[30:47]
$34,665.
[30:53]
Second one is from Coup's Lawn and
[30:55]
Landscape
[31:05]
26,576.
[31:13]
Third and final one for the number six
[31:16]
Reese is JJC Esavating.
[31:30]
$35,820.50.
[31:47]
Number seven is for the Ham Miller. This
[31:50]
is the ditch that runs through uh McCall
[31:52]
Park
[31:54]
versus Butler Masonry.
[32:09]
99,123
[32:16]
Second is Coup's Lawn and Landscape
[32:29]
29,526.
[32:36]
» Tom, can we back up a second?
[32:37]
>> Yeah. Butler was 99,123.
[32:44]
» Yes.
[32:44]
>> And coupe is how much?
[32:46]
>> 29,526.
[32:49]
>> Thank you.
[32:50]
And the third and final is JJC
[32:52]
Excavating
[33:06]
$59,52
[33:09]
59052
[33:28]
McLean ditch number eight
[33:40]
Butler Masonry.
[33:48]
27,888
[33:51]
30 $27,888.30
[34:01]
JJC escavating
[34:18]
$25,353.
[34:22]
That's all for
[34:25]
ML.
[34:32]
Number nine, the ShraMM.
[34:44]
Tom, just to clarify, there is a
[34:45]
difference between number 14, the
[34:47]
ShraMM, and number nine, the ShraMM.
[34:49]
>> Yeah, correct. The number 14, the ShraMM
[34:51]
is what goes through Country Village
[34:53]
that we know every year. And then uh
[34:59]
number nine that we're going through
[35:01]
would continue from the end of country
[35:03]
village around through LL LJ Stone I
[35:06]
believe it is and up to 28 and it would
[35:09]
clear that next section of the ditch cuz
[35:12]
there's so much water that goes in there
[35:13]
from Country Village and the surrounding
[35:15]
houses. This would continue it on to 28
[35:19]
and then from there it goes up north and
[35:21]
it's that's been cleaned before but that
[35:24]
section
[35:25]
from Country Village basically to 28.
[35:27]
Hasn't been cleaned in a long time. Got
[35:29]
it. Thank you.
[35:32]
This would be uh Butler Masonry.
[35:36]
$47,11410.
[35:46]
Coup's lawn and landscape.
[36:00]
$42,831.
[36:12]
JJC
[36:14]
escavating
[36:22]
$40,00045150
[36:26]
40
[36:28]
45150.
[36:35]
This next quote is from Brian Jackson.
[36:49]
for 16,500.
[36:56]
The last quote is from Schneider
[37:08]
11,7714.
[37:23]
from second to last one. Here we go.
[37:25]
Morrison Ditch
[37:27]
number 10.
[37:29]
First quote is from Butler Masonry.
[37:42]
$41,15.70.
[37:51]
Next one is from JJC Excavating
[38:03]
$31,72.50.
[38:06]
50 cents.
[38:20]
The last bid for this quote is
[38:24]
Schneider
[38:27]
$8,23.14.
[38:43]
The last of the
[38:46]
is for the Ferguson number 11.
[38:51]
First one is from Butler Masonry.
[39:05]
$52,852.50.
[39:13]
Next one is from JJC Excavating
[39:29]
for a total of $39,72.50.
[39:38]
The next one is from Fold and Camp
[39:40]
Excavating. This ditch is a partial
[39:43]
debrush of it and then
[39:45]
the to dip the whole thing. Uh I believe
[39:48]
they're going to be putting in some tile
[39:50]
out there. So they requested the ditch
[39:52]
be dipped. So Fen Camp appears to have
[39:57]
put it for debrushing and dipping. So
[39:59]
they we'll have to add these up.
[40:04]
Someone's got a calculator
[40:09]
for the debrushing part of it.
[40:12]
He has $22,987.
[40:29]
And for the dipping section, he has
[40:31]
$11,627.
[40:35]
» 54614
[40:38]
quicker next time.
[40:46]
» And for the last quote, Schneider for
[40:48]
the Ferguson dippity brush.
[41:07]
$17,194.68
[41:09]
68 cents.
[41:23]
» And we are done.
[41:27]
If we were to pick the the lowest bid of
[41:29]
all of these, I think it comes out to
[41:30]
just over $32,000
[41:34]
for the total of um all of these jobs.
[41:36]
Um Mr. surveyor, do you have any um
[41:40]
technical
[41:43]
concerns of awarding these jobs to the
[41:46]
lowest responsive and responsible bidder
[41:50]
pending legal review?
[41:52]
>> I do not, like I said, I've I've seen
[41:55]
work that Coup's Lawn and Landscape has
[41:58]
done, but they've never actually worked
[42:00]
for the county. I believe he's one of
[42:02]
the lower ones.
[42:05]
Um, but all the other contractors
[42:09]
that had a low bid, they've worked for
[42:11]
the county and I support anything they
[42:13]
do. That makes sense.
[42:16]
The lowest bidder on six of these jobs
[42:18]
was JJC Excavating. Jiren Crabtree, who
[42:21]
owns JJC Excavating, is in the audience
[42:24]
today. Do any board members have
[42:26]
questions or concerns with awarding six
[42:28]
of these jobs to Jiren Crabtree?
[42:36]
No.
[42:38]
Okay.
[42:40]
>> Tom, do we need to award that we need to
[42:42]
finish this up today?
[42:45]
>> No, just there's a couple of them with
[42:46]
deadlines.
[42:48]
Uh there's believe there's two that you
[42:51]
can't get to from a road on our rideway.
[42:54]
So, you have to go through a field. So,
[42:56]
I believe I have a one of them has like
[42:58]
an April 15th deadline and the other
[43:00]
ones have May 1 deadlines. because you
[43:02]
can't access them without going through
[43:05]
a crop field.
[43:07]
So, uh those would probably be on the uh
[43:15]
more immediate side. And then there's
[43:17]
other ones like the annual mow jobs that
[43:20]
we do. We we won't do those till the end
[43:22]
of June into July. So, I mean, it's all
[43:24]
about access and what the actual mowing
[43:27]
or debrushing is, if that makes sense.
[43:30]
I I think I summarized it on a sheet
[43:32]
with the the deadlines on there and you
[43:36]
know I don't know legalize if you guys
[43:38]
want to talk about it and award them at
[43:40]
a different date. Do we have to have a
[43:42]
special meeting? I don't know that.
[43:45]
Mr. Craftree, do you believe that you
[43:46]
would be able to complete all of this
[43:48]
work as established on the ref request
[43:51]
for quotes? Please go to the mic so we
[43:54]
can get it on the minutes
[43:58]
and and for the board's uh
[44:02]
I went to the the racer ditch last week.
[44:06]
He's completed it. Looks nice. I talked
[44:08]
to the farmer. He's happy. Everything's
[44:10]
cleaned up. The farmer said he would
[44:12]
plow some of the rideway.
[44:15]
Just kind of mudded in a little bit, but
[44:16]
the farmer was so happy with the ditch
[44:18]
that he said he would plow that and
[44:20]
everything looked nice. So, that was
[44:22]
just for the board's information on that
[44:24]
racer ditch that we had some trouble
[44:26]
with last year.
[44:28]
>> Please state your name and address.
[44:29]
>> Yeah, it's Jiren Crabree. My address is
[44:32]
8800 South County Road, 300 West. Um, I
[44:36]
do not see an issue in finishing these
[44:38]
ditches for a time frame given.
[44:42]
>> Thank you.
[44:44]
>> I guess is there any other questions to
[44:46]
Mr. Crafter from the board?
[44:49]
Okay. Thank you.
[44:54]
Tom, you've done a great job putting all
[44:57]
this together and this is
[45:01]
pretty ambitious and um I like the looks
[45:05]
of it and thank you and
[45:09]
once again I think you've done a great
[45:11]
job on this.
[45:12]
>> Thank you. The value of this quoting
[45:14]
process should be apparent to all the
[45:16]
taxpayers in Delaware County in the
[45:17]
money that was saved from the highest
[45:19]
quote to the lowest quote on all these
[45:21]
jobs. With that, I would like to make a
[45:24]
motion to accept the lowest responsible
[45:25]
and responsive bidder pending legal
[45:27]
review for compliance on all of these
[45:29]
jobs.
[45:31]
>> I'll second.
[45:34]
>> Have a motion before properly second.
[45:36]
Roll call, please.
[45:38]
>> Yes.
[45:39]
>> Mr.
[45:41]
Yes.
[45:42]
>> No,
[45:44]
>> Mr. B.
[45:44]
>> Yes.
[45:48]
» Pass. Any other new business? Mr.
[45:51]
Surveyor.
[45:54]
No new business. So, just so that for
[45:55]
the board's information,
[45:58]
Jennifer will compile the a list of all
[46:00]
these quotes and send out to all
[46:03]
participating
[46:05]
uh contractors that put in quotes with a
[46:08]
summaration and who was awarded the
[46:10]
quotes just so everybody knows. Then
[46:13]
they'll have that for next year and so
[46:16]
on. But besides that, I have no new
[46:19]
business. Great,
[46:22]
>> Mr. Miller. That was I'm sorry. Go
[46:25]
ahead,
[46:25]
>> Mr. Miller. Well, can I bring up a piece
[46:28]
of new business just for the Sure.
[46:32]
>> When we um were appointed the attorney
[46:35]
for the drainage board, we appreciate
[46:37]
that opportunity. We noted that when the
[46:40]
budget was adopted for the drainage
[46:42]
board in for 2026 that the um salary for
[46:47]
the attorney was placed in the 100 or
[46:50]
payroll part. uh for our purposes and we
[46:54]
really think it should be moved uh to
[46:56]
the 300 series which is contractual
[46:58]
services under the budget. And so we
[47:00]
would make a request to save the county
[47:02]
some money and not have to pay payroll
[47:04]
taxes and whatnot is to make a request
[47:07]
to council for a transfer of the funds
[47:10]
for the Delaware County Drains Board
[47:12]
attorney from the 100 series to the 300.
[47:15]
You can put it in a 320 or whatever the
[47:16]
number is for contractual service. We
[47:18]
think that's a better place for for this
[47:20]
to be in the first place.
[47:23]
>> Mr. Brooke, do we need a motion to make
[47:24]
that change?
[47:25]
>> Yes.
[47:26]
>> I'd like to make that motion.
[47:28]
>> Have a motion before us properly.
[47:30]
Second. Roll call, please.
[47:32]
>> Mr.
[47:32]
>> Yes.
[47:33]
>> Mr.
[47:33]
>> Yes.
[47:34]
>> Mr. Mr. Christy.
[47:36]
>> Yes.
[47:36]
>> Mr. Buckle.
[47:37]
>> Yes.
[47:38]
>> We'll get that taken for care of for
[47:40]
you.
[47:40]
>> What will happen is you'll need to make
[47:42]
a transfer request to the council for
[47:45]
their next meeting,
[47:45]
>> right? I don't think it since it's not
[47:48]
dealing with new money. It doesn't have
[47:49]
to be advertised. It just is trans.
[47:52]
>> We we also have some perpetuation money
[47:54]
we have to move around. So, we'll put
[47:55]
that right on there with it and go from
[47:57]
there.
[47:57]
>> Okay.
[47:58]
>> Thank you.
[48:10]
» Uh Joe Miller with Banning Engineering
[48:12]
uh Planefield, Indiana. appreciate the
[48:14]
opportunity to uh talk to you guys
[48:16]
today. Uh talk a little bit with uh Tom
[48:18]
and Joe. Um we've got kind of an
[48:22]
existing conditions analysis of the Abe
[48:24]
McConnell uh completed. Uh we've been on
[48:26]
site and walk the whole the whole length
[48:28]
of it and we've got three draft
[48:32]
alternatives right now. We'd like to
[48:33]
meet with staff, go over those, see if
[48:35]
they have any tweaks they'd like to make
[48:37]
to those and modifications. Also would
[48:39]
be a good opportunity to get some kind
[48:41]
of local pricing that you guys have. for
[48:44]
uh some drain tile costs. They vary
[48:47]
pretty significantly. Um when you go to
[48:49]
different counties, so it'd be nice to
[48:50]
have some idea when we're putting
[48:52]
together the uh the estimates. Um so
[48:54]
we've got a ballpark figure for all
[48:56]
those things. Um if you want me to speak
[48:58]
a little bit more about what it's a
[49:00]
challenging site uh and a challenging
[49:03]
issue and it looks like it's tried to
[49:05]
been addressed a couple times already
[49:06]
and um to varying degrees of success. So
[49:10]
um but that's kind of where we're at
[49:12]
right now. need to get something with
[49:13]
Tom uh set something up and
[49:16]
move forward. Hopefully have something
[49:18]
maybe by the next board meeting you guys
[49:20]
can have an a the full report kind of a
[49:22]
recommendation on moving forward and and
[49:24]
what that process looks like.
[49:28]
>> Any questions for Mr. B?
[49:30]
>> I I do have a comment. There are two
[49:32]
claims um on the Ed McConnell ditch by
[49:35]
um Joe Schneider and um those I talked
[49:38]
to Joe about those. Both of those
[49:40]
repairs were for existing clay and
[49:42]
concrete tile that was part of the 1973
[49:46]
and then the 2009 reconstruction. Those
[49:48]
reconstructions were not properly
[49:51]
designed or in installed and this has
[49:53]
resulted in water continuing to flow
[49:55]
through these existing drains and this
[49:58]
is one of many claims that we've had to
[49:59]
fix those by hiring an engineering group
[50:02]
such as lock Mueller or BL or Banning to
[50:04]
do this design work. My hope is that we
[50:06]
avoid further complications created by
[50:10]
um improper design and installation of
[50:12]
new reconstructions.
[50:16]
>> Thank you.
[50:17]
>> Did you say you had an approximate
[50:19]
number for the job?
[50:20]
>> Well, I I want to talk with staff, make
[50:23]
sure we've got it kind of lined out and
[50:25]
make sure we got everything encompassed.
[50:26]
It's a it Mr. Chris, it's a you it's a
[50:29]
challenging area. There's with with
[50:32]
three different regulated drains. I'm
[50:34]
not sure exactly how to address all
[50:36]
those necessarily uh because it's not
[50:38]
something we run it. Normally when you
[50:40]
do a reconstruction, you want to take
[50:41]
out the old pipe and connect in
[50:43]
>> Yes.
[50:44]
>> those. I mean, that's a requirement. And
[50:46]
when that doesn't get done at the time
[50:49]
of it, that significantly complicates
[50:52]
matters and you keep fixing stuff long
[50:54]
term that uh really shouldn't be needing
[50:57]
to be fixed. So, uh makes it a lot more
[51:01]
challenging.
[51:04]
But no, but yeah, we'll meet with Tom
[51:06]
and and Joe and uh
[51:10]
probably tweak what we have a little bit
[51:12]
and uh bring us before the board
[51:14]
hopefully next month. So,
[51:15]
>> we'll have a meeting and review
[51:16]
alternatives. Thank you, Joe.
[51:17]
>> Yeah. Thank you. Thank you.
[51:21]
Any other uh old old business?
[51:25]
>> No, sir. Oh, yes. I I said this earlier,
[51:31]
but
[51:33]
Mr. Crabtree put a claim in for the the
[51:35]
rest of the racer ditch. Like I said, I
[51:37]
went out there. Everything's fine. It
[51:39]
looks great. He did a good job out
[51:41]
there. And uh
[51:43]
I would uh give a favor recommendation
[51:47]
to to pay the claim on the racer ditch.
[51:53]
Any comments
[51:57]
>> from our last meeting? I crashed on my
[52:00]
agenda some little note about a vacated
[52:04]
ditch uh 700 West Dennis Nixon and David
[52:08]
How. Mr. Borchers looked into this. Um
[52:11]
it was not indicated on the current map
[52:13]
as a regulated drain, but we did find
[52:15]
Mr. Borchers did find history of that
[52:17]
being a legal and regulated drain with a
[52:20]
history of repairs. Um Mr. Orchard has
[52:22]
looked into replacing approximately
[52:24]
1,600
[52:25]
1600 feet of that tile that is currently
[52:29]
broken down and in poor condition. Um it
[52:31]
would not change the size or depth of
[52:33]
the regulated drain. So it would be a
[52:35]
repair instead of reconstruction. Tom,
[52:38]
do you have any other comments on that?
[52:39]
No, I was I I went to receive quotes to
[52:42]
replace that and I couldn't I wanted to
[52:45]
get a estimate of the pipe along with as
[52:49]
you guys know I buy the pipe and and let
[52:51]
the contractors install it because I've
[52:53]
dug up too much single wall stuff that
[52:56]
is basically junk.
[52:59]
So when we were talking about it then we
[53:02]
had the snow hit and there's no way I
[53:03]
could get out there to see what what
[53:05]
type what size of pipe's even there. I
[53:07]
know what the map says from 1953, but I
[53:10]
don't know what's actually out there
[53:11]
now. So, now that the snow is melted, I
[53:13]
can get out there, find what size that
[53:15]
pipe is, get a quote for the pipe, and
[53:17]
then receive quotes from three or four
[53:20]
contractors to install that pipe, and
[53:22]
that'll take that from uh basically from
[53:26]
the or from the bypass back down to
[53:28]
where we've worked on it before, and we
[53:30]
know it works. So, I I would suggest by
[53:34]
the next meeting that I'll have those
[53:35]
quotes already and we can open those up
[53:37]
and replace that pipe.
[53:40]
I I had two other items um before we go
[53:43]
on. Um one, Purdue University is
[53:45]
offering three hours of on-site drainage
[53:47]
training. Um the deadline is March 15th
[53:50]
for sign up. Um I would encourage anyone
[53:52]
from the surveyor's office that is
[53:53]
interested in that training to sign up
[53:55]
by March 15th. And um the other one is
[53:58]
um Indiana Department of Transportation
[54:01]
is modifying three intersections in
[54:03]
Delaware County. Um one of those is at
[54:06]
300 South and State Road 35. And there's
[54:09]
been a history of the Lwood re Lwood Ree
[54:12]
regulated drain um having problems
[54:15]
draining into the outlet of White River
[54:16]
in that area. And Mr. Borchers is
[54:18]
keeping an eye on that project um to
[54:22]
decide if there are any impacted
[54:23]
drainage concerns.
[54:26]
Sorry.
[54:29]
» Any other old business?
[54:32]
>> I do not have any. If this is the time
[54:35]
set aside for any comments from the
[54:37]
board.
[54:48]
» Thank you.
[54:53]
» Next, approval of maintenance claims.
[54:55]
Any questions, concerns? I I have one
[54:58]
change that I would like to request and
[55:00]
that is on um the DEG work order um
[55:03]
7412. There are actually two different
[55:06]
invoices under 7412 and they listed No
[55:09]
Name Creek as the um wershed and I would
[55:12]
like to have that changed to aid
[55:14]
McConnell um just to keep track of where
[55:16]
the work was performed.
[55:21]
I don't have any other questions or
[55:22]
concerns.
[55:24]
If not would entertain a motion.
[55:27]
>> So moved.
[55:29]
>> Second.
[55:30]
>> Have a motion before us. Properly
[55:32]
second. Roll call, please.
[55:34]
>> Mr. Whitehead.
[55:35]
>> Yes.
[55:35]
>> Mr. Hamilton.
[55:36]
>> Yes.
[55:36]
>> Mr.
