[0:14]
Yeah, I'm getting requests.
>> All right. I would like to call to order
[0:18]
the town of East Joy Planning Commission
for the month of um August, September,
[0:25]
sorry. Um
[0:30]
August 2nd, I'm sorry, September 2nd.
>> Let's do that
[0:34]
» for the month of September. Mhm.
>> Um,
[0:40]
everyone is uh
[0:44]
is uh sorry.
>> You all right?
[0:51]
» Everyone is
is present except for um
[0:59]
Jerry. Jerry
>> and Smith
[1:03]
» and Ben Smith.
[1:08]
All right. Sorry.
[clears throat]
[1:15]
So we we operate on a uh
uh
[1:24]
single
[1:27]
sorry
>> can we pause for a second?
[1:31]
» Yeah. Can we just please record
>> I can't stop the stream.
[1:37]
» Are you okay? Want me to take over?
>> No, I'm good.
[1:40]
» Okay.
haven't felt great. Anyway, all right.
[1:45]
Um
so we we operate on a single meeting
[1:50]
format and what we'll do is we'll have
the
[1:56]
applicant come up tell us what they're
you know what they're looking for and
[2:02]
then we will
um
[2:09]
you know we'll
>> talk amongst commissioners
[2:13]
» we'll deliberate amongst ourselves
Y
[2:16]
» my apologies.
>> No, you're you're good. So, we'll we'll
[2:18]
deliberate amongst ourselves. So, you
the applicant will come up,
[2:23]
» plead what you wish to have the variance
for, and then we will deliberate amongst
[2:29]
ourselves, ask some questions to the
participants. And at that point in time,
[2:34]
we'll ask for we'll have some
conversations amongst ourselves as a
[2:38]
board. And then we'll ask for anybody
that is in favor of the proposal to
[2:42]
speak. and then we'll ask for anybody
that is opposed of the proposal to
[2:46]
speak. And at that point in time, you'll
have an opportunity to have a rebuttal
[2:51]
before we have our final discussions and
discussion. Uh typically what happens in
[2:57]
these meetings is if we don't have
anything of concern, we could possibly
[3:02]
move to a vote at this meeting. But we
do have the right to move forward to the
[3:09]
next meeting if there are some concerns
um presented tonight that we need to
[3:13]
address. Okay. So, I'd like to have the
spokesperson please come up and uh
[3:21]
» Well, hold on. The first first item on
the agenda is to review the um minutes
[3:30]
from last month.
Anybody have any issues with the
[3:36]
minutes from last month?
>> I'll make a motion to approve and I'll
[3:39]
second that.
>> Motion to approve. Second. All those in
[3:43]
favor?
>> I
[3:44]
» I
>> opposed.
[3:46]
Motion carries.
Next item on the agenda is a variance.

[4:08]
got one
>> you please.
[4:11]
» Yes, please.
>> Hello guys. Um
[4:17]
my name is Lance Johnson. Uh my company
is 9 Square Design and I'm representing
[4:21]
Kyle Worm tonight on his project out at
uh W1785 Lake Road. Um Kyle sends his
[4:28]
apologies. He wishes he could be here.
He is on business in Nevada, so I'm
[4:32]
representing him by myself. Um so I
guess I'll explain how this kind of
[4:36]
started. I don't want to get too
longwinded, but we went into the zoning
[4:40]
um office for the county and um I had
kind of a discovery meeting with Darren
[4:45]
and um we realized pretty quickly that
we were within the deck is within the 75
[4:49]
ft of the back um the the lake line or
the shoreline. So, um I had to come up
[4:55]
with a solution that where we could
possibly keep building and move on on
[5:00]
the project and treat the deck. Um I
guess we decided to treat it as a
[5:04]
separate project so we could start
building. So, I separated the two
[5:08]
projects. We got the permit on the house
and we are underway for the construction
[5:11]
for the um the renovation of the main
home right now. And we're just um kind
[5:15]
of hoping and waiting on the variance.
What we're asking for is about two more
[5:19]
feet of deck toward the lake in the
back. Right now, it's about a 5ft 10
[5:24]
cantalvered deck that's in disrepair. Um
doesn't meet code. I mean, the can lever
[5:31]
alone wouldn't meet modern codes, but
the deck the railing is too uh short and
[5:35]
uh it's just in this repair. So, it
would be we'd be replacing it either
[5:38]
way. Um and in this process, when I
talked to Kyle, he was he wanted to do
[5:44]
uh the neighbor to the east, I don't
know if we have that picture I sent, but
[5:47]
they have a twotory deck with a full
covered roof that goes at the back.
[5:50]
That's what he originally had wanted,
and that's the plan we brought down to
[5:53]
Darren to submit. And um we've had to uh
ditch that plan. But when I t when I sat
[5:59]
Kyle down, we had a meeting. I got the
heart of what he really wanted. I mean,
[6:04]
he wanted the big large decks, but
really what he wanted was a nice a
[6:08]
bigger space to walk out onto. Um,
a better deck, you know, better
[6:15]
condition and a cover. Um, a little more
space and some cover. The sun, I guess,
[6:21]
just drenches them back there and it's
almost unusable in some times of the
[6:24]
year, the summer months, obviously, when
you want to use it the most. So, his
[6:28]
real concerns were um I forget um a
place to go out from his master bedroom
[6:32]
to have a coffee in the morning or
something small. So, the second story
[6:35]
deck that was proposed to be 8x 28 on
the second story was way too big. So, we
[6:41]
essentially brought that into the master
bedroom as a covered porch under the
[6:44]
main um you can see uh just behind and
above the right there that's a small
[6:50]
5x12 kind of a breakfast nook uh deck
area, coffee area that satisfied that
[6:55]
requirement. So, we've essentially
reduced it to one story with a cover and
[6:59]
hopefully we can gain that 2'2 in toward
the lake. I think we're with we're at 65
[7:04]
63 ft right now. Um, and I guess if we
don't get the variance, what we would
[7:10]
we'd be able to rebuild the deck as it
is in the exact configuration with no
[7:13]
improvements, no cover, no larger size.
Um, and I'd have to post it because we
[7:18]
can't can we cannot leave it can levered
the way it is. So, something has to be
[7:21]
done. So, it's going to be tore off
either way. Um, so that's kind of the
[7:24]
history and um, this is my first meeting
for variance, so I apologize. So I
[7:29]
appreciate your guidance and um,
guidance with me on this, but um, I
[7:33]
guess that's the long and short of what
we're trying to trying to achieve.
[7:38]
And the lot itself is very I don't know
if you've seen the plot. It's very one
[7:42]
at one spot he's 175 ft from the lake
and then it hooks in and he's within
[7:48]
that's where he's 65 63 feet away. So,
you know, 75 65 to 75% of the back lot
[7:55]
almost shoots straight out. It's just
that weird shoreline that kind of makes
[7:58]
it difficult and um to achieve what
we're trying to achieve. It's that short
[8:02]
distance that that curve. And as far as
the neighbors, um the one to the east
[8:07]
has that twotory deck. They're out front
of us by 16 ft. So, that's not going to
[8:11]
their views, nothing's going to hurt
them. the the neighbors to the west who
[8:15]
have been more in communication with
theirs around Elmore. They um verbally I
[8:19]
don't believe have had any issues with
the deck that we're proposing and
[8:23]
they're they're the they're the
opposite. They're further back. They're
[8:26]
quite a ways to the north. So, it isn't
going to change much for them either.
[8:30]
And there's a large tree uh and that
will be there forever. But, um I think
[8:33]
overall for the neighbors,
it's not going to have too much of a
[8:37]
negative effect at all. and then
watershed and items like that. We're
[8:41]
within all other um code compliance with
the deck. It's just simply this one ask
[8:46]
of the the waterfront issue.
[8:51]
» I'm going to see how that scoop happens.
>> And just to clarify right now with the
[8:57]
canal lever and everything, you're
within that 75 ft setback.
[9:01]
» We are 63 feet right now to the corner
of the deck. We are yes within. Yes.
[9:05]
» So you're non-conforming as
>> correct. probably grandfather in
[9:07]
whatever you would
>> asking to rebuild it slightly bigger by
[9:11]
two feet
>> correct
[9:13]
» and no longer can lever you're going to
have post
[9:15]
» yep posted three posts yep beam and then
um hopefully like I say the cover um
[9:20]
just for for shade probably with a steel
roof I believe is what we're going to do
[9:24]
there
>> and so the existing condition now just
[9:28]
so we can clarify the picture is
the deck comes off call it the first
[9:35]
floor, but it's can levered and you're
looking for a roof structure. Even
[9:41]
though you're adding a little breakfast
nook off the top,
[9:44]
» you're looking you're not going to have
a walk out to the second story. This is
[9:48]
just going to be a canlevered covered
porch.
[9:51]
» And essentially this existing can
levered deck, you're going to add two
[9:56]
more feet,
>> correct
[9:57]
» to that. And the existing should be in
the packet somewhere, I believe, if you
[10:00]
want to see what the the drawing of the
existing is. I thought it was in there,
[10:03]
but if not, I can bring it up on my
phone.
[10:05]
» Oh, more more of the civils is what I'm
kind of I'm looking at. I'm a I'm a
[10:10]
civil guy, so I I like to take a
>> maybe and maybe the existing deck is
[10:16]
actually lined right here. So, I can see
that. Okay.
[10:19]
» You can see it's the existing, but it
doesn't show much detail here.
[10:22]
» Sure. Okay.
[10:32]
Great. Any other questions? So, we have
it.
[10:38]
» You know, to me, you're essentially
asking to rebuild what's there. It is
[10:44]
non-conforming. Um, if there was any
opposition from the neighbors, you know,
[10:49]
with a a view obstruction or something,
I could see there being an issue, but,
[10:54]
you know, that's just how I see it.
That's, you know, for discussion. And
[10:59]
I'm looking at the the site plan, the
the civil too here and the adjacent
[11:05]
property to the east is actually set
forward that has the deck that you've
[11:10]
referenced.
>> Um and then again the civil drawing
[11:14]
shows the uh property to the west that
clearly would not have any sighteline
[11:21]
impact especially for an extra 2 feet
from what is existing now. Um, I'm also
[11:26]
noting that there's almost a 30 foot
elevation change between
[11:34]
lake level and
ground level at the walk out basement.
[11:39]
So, there's there's a significant
elevation change there that it can helps
[11:43]
with the sightelines. And if I could add
to that's I'm glad you went up. Usable
[11:47]
space is difficult on this lot for the
back. So, this is part of the usable
[11:50]
space. He's trying to get just a little
bit, you know, cuz that's important.
[11:53]
most of it is is and they're going to do
some retaining wall work next year, I
[11:57]
believe, and and do some changes. But
that is difficult to deal with with just
[12:00]
entertainment and casual space. That's
what he's trying to gain a little bit
[12:04]
more that way. But yeah, and certainly
those conversations, you know, for
[12:08]
another time as far as disturbance
within that 75 ft and structures. But
[12:13]
but yeah, I mean I you know talking
amongst us here I um it's
[12:21]
it seems reasonable for uh what what's
requested here tonight. Um but certainly
[12:28]
just for structural safety purposes of
existing build building codes that you'd
[12:33]
have to go to post construction whether
it's covered or not.
[12:37]
» Yeah. And and I think too he wants to
bring it up kind of with there are
[12:40]
adding on we're tearing out the second
floor and adding a little bit of space
[12:45]
but reconfiguring it and he wants to
kind of bring it up as well with the
[12:48]
kind of the um the overall achieve kind
of the overall essence of the the
[12:53]
improvement. You know what I mean? So
that's one thing we want to do with the
[12:56]
deck is bring it up just a little bit.
We're not asking for a ton I don't think
[12:58]
but um I don't know the variance world
and how it you know it's my first time
[13:03]
in it but um yeah it's just that we're
remodeling it all. um and just wants to
[13:08]
bring it up a little bit to be in
keeping with the remodel that we're
[13:11]
doing.
>> Are you extending the second story
[13:14]
outward toward the lake as well?
>> Nope. It'll be within the foundation.
[13:18]
» So the the existing structure will be
within the foundation of 100%.
[13:22]
» Okay. All right. Julie, you have
anything else?
[13:26]
» No.
>> Okay. Um
[13:30]
amongst us, do we have any
>> no sense?
[13:33]
» Questions to All right. Thank you.
Anybody in the audience like to speak in
[13:40]
favor of proposal?
Anyone like to speak against proposal?
[13:47]
Then I would take a
>> Okay.
[13:52]
» Motion.
>> Um well based on the information
[13:54]
presented tonight,
um I think this is a reasonable
[13:59]
proposal. Um we always have to take into
consideration the setback laws that are
[14:05]
established. Um certainly the residents
that are here and can we have any
[14:12]
hardship presented to them by approving
something tonight. Um but based on
[14:18]
elevation change, based on the adjacent
uh properties and the configuration of
[14:28]
you know the parcel as a whole and and
certainly you can see the the
[14:32]
challenging nature of uh the elevation
drop and the narrow nature of the of the
[14:39]
property itself. Um I think this is a
reasonable request.
[14:45]
Do we have a motion?
>> I will offer the motion tonight that we
[14:50]
approve uh the conditional use our
conditional approval of the building as
[14:56]
presented for parcel number PPT 00003.
[15:04]
» Uh we have a motion. Do we have a
second?
[15:06]
» I'll second.
>> All those in favor?
[15:09]
» I I
opposed.
[15:12]
» Motion carries.
[15:20]
Thank you.
>> Thank you.
[15:22]
» You bet.
>> Thank you.
[15:25]
» Thank you.
>> If there's no other public comment or
[15:31]
other business amongst commissioners, I
would take
[15:35]
» a motion to adjurnn.
>> Second.
[15:37]
» Motion to adjurnn and second. All those
in favor?
[15:40]
» I oppos.
>> We're journ. Thank you.
