[0:29] good evening welcome calling order the
[0:32] City Council regular meeting Wednesday
[0:34] November 6 6 p.m. roll call all counsel
[0:38] are present and if you would please
[0:41] stand and join me in the pledge
[1:23] okay moving on item number four city employee recognitions and a
[1:28] miss Kane for a
[1:33] certificate of appreciation was
[1:36] presented to the Garden Ridge Police
[1:37] Department and grateful recognition for
[1:40] their efforts to support homes for our
[1:42] troops
[1:44] my my hero award was presented to
[1:48] officer Richard McMann in appreciation
[1:51] for serving the community in the Garden
[1:53] Ridge Police Department
[1:57] Jeremiah McKinney sent - thank you -
[2:00] City Council the wildlife commissioners
[2:03] Marisa Spencer cap Balby and myself for
[2:07] his enjoyable experience while being on
[2:09] the wildlife management Advisory
[2:12] Commission
[2:16] [Music]
[2:18] water manager Jacob Parsons completed
[2:21] his 180 day probation on October 18th
[2:27] 2019 congratulations Jacob and
[2:31] we have two employees that we want to
[2:34] recognize their tenure
[2:37] service years with the city of Garden
[2:40] Ridge and those employees are
[2:44] [Music]
[2:51] Steinmetz for 19 years of service
[2:54] 19 years
[2:56] [Applause]
[3:00] thank you both for the five and nineteen
[3:05] years of service we really appreciate
[3:07] all you do for our city moving on item
[3:09] number five citizen comment period the
[3:12] rules when you signed up they were on
[3:15] there on a sign-up sheet and I believe I
[3:18] don't see a lot of new faces in here but
[3:20] just a reminder that it's not an
[3:22] exchange you're you're speaking to the
[3:24] council to be on the record and the council will not be responding
[3:30] we'll be taking notes and just listening
[3:32] to what you have to say you have three
[3:33] minutes come up here name and address
[3:36] does not count for your three minutes
[3:37] the clock will start then all right
[3:40] first up and you have to sign up for
[3:42] this one now there is a
[3:45] citizen common period at the end that
[3:47] you do not have to have signed up for so
[3:49] if you hear something during during this
[3:50] meeting and you want to you want to a
[3:53] comment on it you'll still have an
[3:54] opportunity at the end of the the
[3:56] council meeting as well so first up is
[3:58] number one Toni Fratto
[4:15] thank you I'd like to thank all the
[4:17] veterans
[4:18] throughout the country and garden Ridge
[4:22] for other service and keeping America and thank you
[4:29] all right I name an ant rise sir oh I'm
[4:32] sorry
[4:33] Tony fresco
[4:35] 8802 wildwind Park I
[4:42] would like there's an ordinance to 10-0
[4:46] two two zero one eight which is the
[4:49] rules and regulations for the council
[4:52] Section G I wish the some of the council
[4:56] would read this because then that's a
[4:59] big supposed to be on social media
[5:01] speaking about anything going on in the
[5:04] town
[5:05] and
[5:07] there's another section five
[5:11] fair and impartial review that's not
[5:14] just for the Commission staff plus the
[5:17] audience because I've heard some snide
[5:19] remarks which I don't really appreciate
[5:22] now as far as it goes you're going to
[5:25] put drinking fountains in and I'm all
[5:27] for it to have the kids have water and
[5:29] everything but you cannot take that I
[5:32] was drinking fountains off that existing
[5:35] line that was just put in in Paul Davis
[5:38] Park that's considered a contaminated
[5:40] line there could be poisons there could
[5:44] be
[5:46] animal waste there could be a variety of
[5:49] things there so there's a chance that
[5:52] the drinking fountains will distribute
[5:55] contaminated water this is state code so
[5:59] you have to pull the water off prior to
[6:03] that backflow device
[6:05] so just to make it known we have to
[6:09] protect the kids and everybody using
[6:11] those fountains so please do it right
[6:16] also and I can't figure this out for the
[6:22] transparency
[6:24] there was a House bill passed two eight
[6:27] four zero
[6:29] which means the public can speak by
[6:32] raising their hands now you as a council
[6:36] and mayor have to put down what limits
[6:39] and what restrictions there are I don't
[6:42] believe that you can use the same
[6:44] restrictions you using now
[6:46] for that you have to come up with new
[6:49] restrictions so please tell me why what
[6:54] get to me what get to the people why
[6:57] since September 1st
[7:00] 2019
[7:02] we've only been allowed to
[7:05] get 3 minutes in and whatever 2 minutes
[7:10] at the end but if there's something
[7:12] coming up on the table according to this
[7:16] legislation we have a right to speak so
[7:20] I would like to be addressed why for two
[7:24] months that we were not able to do this is not transparency and I looked
[7:32] over this bill and I can't find anything
[7:34] other than this thank you very much
[7:38] next up we have Tristan Arvidsson
[7:46] [Music]
[7:49] I
[7:51] came here tonight to do a check up on my
[7:54] youth Scout project I built a pocket
[7:56] park on Fairview Circle it's mostly done
[7:59] we're waiting on some boulders for a
[8:01] border they should come in soon
[8:04] I'd like to request with your permission
[8:07] that this park be named the Eagle Scout
[8:09] park because if we had a vote at
[8:11] true beating last Monday and that was
[8:14] the the highest voted for name so
[8:17] I'm sure this will come up when the
[8:20] wallet or what is it the Parks
[8:22] Commission has their time so as long as
[8:24] you just keep that thought in your head
[8:26] and see what you think thank you
[8:31] next up we have Dave LaForge 2 1 9 1 9 castaño Cove my
[8:43] comments are related to water rates I
[8:46] wrote the mayor in September that
[8:48] details of the metrics methodology data
[8:52] that's just flying the specific rates
[8:54] ought to be presented or at least
[8:56] provided to the public before any rate
[8:58] changes are voted on
[9:00] Garden Ridge residents are pretty smart
[9:02] people they know the details that are
[9:05] important to understanding these votes
[9:07] and if they understand them they can do
[9:09] better with that information the mayor
[9:12] stated during the September 10th council
[9:14] meeting that he didn't pick up on the
[9:16] fact that the rates had gone up as much
[9:18] as they had and that the rates were
[9:20] simply voted on based on an experts
[9:22] advise that means to me that the metrics
[9:25] the methodology and the data justifying
[9:28] the rate changes either weren't
[9:29] presented to the council or or weren't
[9:31] understood by the council I'd like to
[9:34] see those metrics I'd like to see what's
[9:36] driving the rates
[9:38] likewise managing personal water
[9:40] consumption is my family's
[9:42] responsibility not the government don't
[9:44] directly link water rates with usage
[9:46] rates support for water conservation
[9:49] isn't solved or improved by increasing
[9:50] the water rates I'm capable to decide
[9:54] who win and how to conserve
[9:56] besides Garden Ridge has methodology in
[9:59] place and it's a really good one to
[10:00] encourage conservation through the
[10:02] drought management plan point is that
[10:05] are more effective and more receptive
[10:07] ways to encourage rather than force
[10:09] conservation as they said Garden Ridge
[10:13] residents are smart people yeah a lot of
[10:16] them are removed from the details to
[10:18] manage and lead the city they don't
[10:21] necessarily come here for the meetings
[10:23] but don't take them for granted if the
[10:26] city can't provide the details behind
[10:28] any rate changes and I recommend no vote
[10:32] until they daughter thank you
[10:36] next up we have Ken conniver
[10:59] ken Taniya 88-91 Shane tal Road and I
[11:02] tempt you now tonight is a board member
[11:05] of the gorge ranch property owners
[11:07] association board of directors on your
[11:10] agenda for tonight you're gonna hear
[11:13] there is gonna be discussion about
[11:15] trapping the feral hogs using the
[11:16] current trapper that we are using for
[11:18] the deer I highly recommend it I would
[11:22] because there is a place to put it right
[11:24] where the pen is that now we have found
[11:27] looking at game cameras that those
[11:30] hogs have been trapped before at least
[11:32] two of the older ones so they know what
[11:35] to do they keep the younger ones away
[11:37] but they will not know what to do at
[11:39] this one because it be camera controlled
[11:41] and they'll be up and it'll drop on them
[11:43] and then the DPD you'll be notified
[11:46] right away to come and take care of the
[11:47] hogs so you don't destroy their pens
[11:50] because does hogs are strong and they're
[11:54] destructible
[11:55] so they are very big and if they can
[11:58] pull up a fence and pick it up unless
[12:01] you bury a three foot down trust me they
[12:03] can do a lot of damage to any pen I've
[12:06] seen what they've done to big Corral
[12:08] pens at Sarah Santoni River Authority
[12:12] when I went to a Saturday conference
[12:14] with them or a seminar so then these
[12:17] house they're smart
[12:19] trust me I know pigs are not the dumbest
[12:23] animals in the world the dumbest ones
[12:24] are the deer because they will go right
[12:26] to feed
[12:28] these hogs are staying away from the
[12:30] feed their stand away from the feeders
[12:32] they're not going into pens
[12:35] and if they're smart enough they can
[12:37] push the pin in and then go eat what's
[12:40] that there they will do that and then
[12:42] release it and they go a little bit
[12:43] further they keep pushing the pin in if
[12:45] they can so these hogs are very
[12:48] intelligent animals and they are very
[12:50] smart so please allow whatever period of
[12:53] time you think is reasonable in the last
[12:56] three weeks since we've gotten rain and
[12:58] the weather's gotten cooler the hog
[13:00] attacks in yard attacks I should say bye
[13:04] the hogs and George ranch have gone down
[13:06] to none we've not had any reports and
[13:10] the only reason I know that is I get I
[13:11] was getting a lot of emails daily when
[13:14] they were active because I'm the point
[13:16] of contact that with the city to deal
[13:18] with with them both with animal control
[13:21] and now with mr. Steinmetz and with the
[13:24] support we have gotten from the city has
[13:27] been outstanding and I would like to
[13:29] thank then those two gentlemen very much
[13:31] and everybody with the city who has
[13:33] helped us with this problem so please if
[13:35] it comes up and is you gonna vote for it
[13:38] please vote in favor of it because I
[13:39] think it'll help control the
[13:42] feral hog problem we've got we need to
[13:45] get rid of the lease as small groups and
[13:46] there's maybe one or two small batches
[13:48] in there get rid of those in there the
[13:51] others will not come back they'll stay
[13:53] away thank you very much
[14:01] okay moving on item number six consent
[14:03] agenda council remind you that in the
[14:07] interest of trying to
[14:08] keep these meetings from going until
[14:10] midnight a few more things are being put
[14:12] in and consent agenda but you'll be
[14:14] getting these things well ahead of time
[14:17] and it's always public the packages of
[14:21] public the decisions are public so it's
[14:23] not like we're trying to to not talk
[14:26] about things and in public and you
[14:28] always have the trump card to say we're
[14:31] literally weeks prior that you want
[14:32] something not in the consent agenda but
[14:34] in a business item but if they're
[14:36] relatively mundane or routine things
[14:40] I'm going to continue to try to put them
[14:43] in the consent agenda to to move the
[14:45] meeting along so that said there are a
[14:48] number of things in consent agenda like
[14:50] to see if anybody needs any of them
[14:52] pulled or if I can get a motion to
[14:54] approve the consent agenda I
[14:57] move to approve the items on the current
[15:00] consent agenda I have a motion to
[15:03] approve
[15:04] the items on the consent agenda from
[15:06] place five can I get a second second
[15:08] from place three any further discussion
[15:11] or questions
[15:13] absent that all in favor of the consent
[15:16] agenda as published being approved say I
[15:18] any opposed it is unanimous thank you
[15:22] moving on the staff reports item number
[15:23] seven city administrator good for me
[15:25] [Music]
[15:26] the only thing that I would like to add
[15:30] to my report to City Council is that we
[15:34] are trying to promote electronic water
[15:36] billing out of approximately 1700 water
[15:40] bill accounts we've had a hundred and
[15:42] thirty residents sign up for the
[15:45] electronic billing
[15:47] there we encourage
[15:50] people to sign up on the registration
[15:55] form provide the information necessary
[15:57] to get the electronic water bills to
[16:00] them and I believe that the ladies have
[16:04] placed some forms on the table over here
[16:06] to the side where they have the agendas
[16:09] so that they're available and
[16:13] that's all I had to add to my report
[16:15] Thank You Miam and before I before I go
[16:18] through council just want to add to that
[16:22] please if you haven't done it do it and
[16:25] talk it up it's not only a better a
[16:30] better system for the city and to save
[16:33] on some labor as well as postage but
[16:36] it's actually better for the individual
[16:37] it's more secure you don't have your
[16:39] personal information sitting in
[16:40] mailboxes and sitting in envelopes
[16:42] instead it's just sent directly to you
[16:44] it and and you get it you get it right
[16:47] away and you have plenty of time to
[16:50] act on a bill that you that you have a
[16:53] problem with or something like that it
[16:54] actually is quicker than if you get it
[16:56] in a envelope and we I'll tell you that
[17:01] as we as we implement this will be
[17:04] adding links to grapevine and and
[17:08] schedules
[17:09] you know the
[17:11] calendar to make sure that people still
[17:13] are getting the kind of information that
[17:14] they get as they receive this in the
[17:17] mail so questions comments on city
[17:21] administrators monthly activity reports
[17:23] starting in right side
[17:28] okay thank you miss Kane next up is a
[17:32] police department chief thank you I do
[17:35] have a couple of things I'd like to add
[17:36] bulk of the information is up there
[17:38] however there are three other items
[17:41] additional items I'd like to speak a
[17:42] little bit more on if we could put the
[17:45] first one up we were invited to attend
[17:47] and assist the bracken United Methodist
[17:50] Church recently they had their community
[17:53] helped week and they wanted officers
[17:55] from us to come out and talk to the
[17:57] children about community helping and so
[18:00] forth so over a two-day period four
[18:02] officers went out there and spoke and
[18:04] worked with about 350 children and so
[18:08] that was they have a very large daycare
[18:11] out there and children so they were
[18:13] appreciative and took this picture and
[18:15] framed it and sent it back to us so I
[18:16] thought that was a very interesting
[18:18] although they technically are not in our
[18:20] city we do consider them part of our
[18:21] community as they many of the members of
[18:23] that church live here in guard Ridge so
[18:25] I wanted that brought up also you heard
[18:29] just a minute ago from from our Scout we
[18:31] have completed the Fairview Park to the
[18:33] point where it can be considered a park
[18:35] I've had the city engineers draw up a
[18:38] new map with the thousand foot rule on
[18:40] that so we have an additional park now
[18:43] covering another additional area and I
[18:45] wanted to bring that up and show you
[18:46] that we do have everything up to date on
[18:48] the on the webpage and available since
[18:51] it was an Eagle Scout project we wanted
[18:53] to bring that up to y'all here in a
[18:54] public meeting and
[18:56] last but not least you'll see some of us
[18:59] are looking a little scruffy right now
[19:01] we have decided to participate in the No
[19:04] Shave November to bring awareness to
[19:06] cancer mainly prostate colon cancer this
[19:09] month so officers will be wearing a
[19:12] little blue lapel pin over their name
[19:14] tag and indicates that they are
[19:16] participating and have contributed at
[19:18] least $50 to a Cancer Research or cancer
[19:22] giving organization here locally and
[19:26] that is all I have at this point sir
[19:30] thanks sir
[19:32] did you want to talk about the
[19:34] retirement oh I'm sorry I did forget one
[19:37] other thing it was just announced today
[19:39] actually officially that Detective
[19:41] Spiller has announced his retirement so
[19:43] he will be retiring first week of
[19:45] January so we wish him the best and I
[19:48] wanted y'all to be first to get that
[19:49] news so he will be leaving us shortly
[19:54] Thank You chief and questions or
[19:57] comments on the police police reports
[20:00] running left side
[20:02] Mike
[20:04] I look forward to the party thank you
[20:06] very much and I'm sorry I did have
[20:10] something else and went out my my brain
[20:12] so sorry sir
[20:15] there's some kind of cleanly shaven face
[20:18] is sitting up front here at the Dyess as
[20:20] well some of us are maybe a little
[20:22] furrier than others but
[20:24] I'd be willing to join in on no-shave
[20:26] November your any don't kick makes it
[20:30] easy for me doesn't it
[20:32] that's all I got
[20:35] over on his side
[20:39] Thank You chief next up is Public Works
[20:41] mr. diamonds
[20:52] we recently received our new crack seal
[20:56] machine trailer mounted and Bobcat
[20:58] Miller attachment for being able to
[21:01] quickly do road repairs more efficiently
[21:04] we provided
[21:08] playgrounds material and
[21:11] other types of a border for the new
[21:16] Baraboo Park set up
[21:19] and
[21:20] [Music]
[21:23] we have currently we have not caught any
[21:25] hogs as today last we've seen any come
[21:29] to the traps were the 27th of October
[21:36] on the right side questions for mr.
[21:39] Steinmetz public works
[21:42] am good yes please under future projects
[21:46] are needs sir I know we have two items
[21:48] there I know in the past six or so
[21:50] months ago I believe we discussed
[21:51] potentially creating a roof for our
[21:54] vehicles we have I don't see that on
[21:57] here
[21:59] well that's kind of part of it we're
[22:02] considering all options when we're
[22:04] looking we're likely looking at putting
[22:06] more office space up there so we're
[22:08] actually milling that around also we're
[22:10] going to put that into the cost okay
[22:13] we're possible okay so it's really part
[22:18] of that maybe it's maybe you could state
[22:20] that next time as a consideration that's
[22:23] all
[22:24] thank you
[22:28] all right sir thank you very much
[22:33] next up is water department
[22:35] mr. Parsons
[23:12] good evening
[23:14] all right
[23:17] [Music]
[23:20] okay so as you notice in your packet we
[23:24] have used a lot of Edward's water we're
[23:26] actually getting down to where we've
[23:28] shut off the Edwards the 22:52 wells so
[23:31] we're not using pulling any more water
[23:33] from that aquifer we're actually using
[23:35] Trinity and we're just on Trinity so I
[23:38] wanted to point that out
[23:42] secondly
[23:43] we had some leaks that we had the big
[23:47] one was a fire hydrant on goldenrod
[23:50] circle and I just wanted to make you
[23:52] guys aware that it was a leak that we
[23:56] estimated about a forty-eight thousand
[23:57] gallons that when it broke it was leaked
[24:02] down it was contained rather quickly and
[24:04] we got it back and it's actually back in
[24:07] the ground working and operating
[24:10] also we've had a lot as as you know
[24:15] we've had a lot of water leak
[24:16] adjustments we're water leak adjustment
[24:18] requests and we have gone through a lot
[24:21] of them it's taking a long time it takes
[24:24] at a minimum about two hours to go from
[24:28] start to finish for elite water leak
[24:30] adjustment
[24:31] so far we've gone through 38 of them
[24:34] we're waiting for some information on
[24:36] some of them six of them have been
[24:38] approved
[24:41] seven of them have been sent to the
[24:43] Water Commission so and that's where we
[24:45] are standing right now when I put this
[24:48] form in we we've actually been doing a
[24:49] lot of work and every week we do more
[24:51] and more so
[24:53] we've also had a meter flow test these
[24:57] are filled meter tests where we go to
[24:59] the house someone complains our is
[25:02] questioning the meter the accuracy of
[25:04] the meter we go ahead and put a
[25:05] different style and type of meter and we
[25:09] run a ten gallon water test through it
[25:11] and we are finding that the accuracy we
[25:13] have not found any thus far that have
[25:15] been inaccurate or that would need to be
[25:17] subject or sent to a third party we have
[25:21] had a few that have requested to be sent
[25:23] to a third party this week so we'll be
[25:25] doing that
[25:27] other than that we have laptop readings
[25:29] so these are requests from our customers
[25:31] that say hey something's going on I
[25:33] don't know what's going on with my water
[25:34] can you come out and look at that so
[25:36] we'll go out and take a laptop reading
[25:37] which gives us an hour an hour hour by
[25:39] hour to look of what's going on and I'm
[25:43] sure some of you are aware of these some
[25:45] of you may not be but but what we're
[25:47] finding is irrigation used potential
[25:50] irrigation use potential leaks and in
[25:53] different things it's pretty evident
[25:56] the water leak adjustment based on this
[25:59] and this was all from the Water
[26:00] Commission when they sent it to us that
[26:03] being said we have done this month 89
[26:06] last month we did 122 so there's a lot
[26:09] of work going into finding out what's
[26:12] going on with the meters and leaks and
[26:13] leak adjustments so I just wanted to
[26:15] make you guys aware of that
[26:17] without you
[26:20] thank you mr. Parsons I want to go back
[26:22] to something you talked about and to be
[26:25] clear it wasn't a leak from from a
[26:28] hydrant it was a hit-and-run with a car
[26:31] that took out the hydrant and then they
[26:34] decided to leave and I'd like to turn it
[26:36] over to the chief because we're we're
[26:38] still investigating this clay chief we
[26:41] are sir we don't want to release a lot
[26:43] of information on that however if
[26:45] anybody has any we what we had was at
[26:48] the end of the cul-de-sac there it just
[26:49] so happened it worked out that both of
[26:51] those residents were out of town and the
[26:54] house was being looked upon looked after
[26:56] by relatives and friends we had two of
[27:00] those individuals contact us and say
[27:02] they heard something and didn't report
[27:04] anything until they were leaving and saw
[27:06] the water
[27:07] flowing down the street and through the
[27:09] yard so if anybody has any information
[27:12] on that we're asking them to come
[27:13] forward we've posted it but at this
[27:15] point that is still under investigation
[27:17] so we are still working that case thank
[27:20] you chief anything else I just want to
[27:23] mention that Brad Oliver II he's the
[27:26] water deputy he actually obtained his
[27:28] backflow assembly license and which were
[27:30] really proud of him for doing so if you
[27:33] see him tell congratulations please
[27:34] great thank you thank you starting over
[27:36] on the left side questions for water
[27:37] manager no thanks
[27:40] how about compliments I got a phone call
[27:43] yesterday from a good friend of mine I
[27:45] won't use his name because he didn't
[27:46] want me to their arm but he complimented
[27:48] you on your professionalism and handling
[27:50] this water rate issue and the meters and
[27:52] everything else and he's not somebody
[27:54] that would typically call up and
[27:55] compliment so you can get it in in time
[27:57] to get it into Nancy but I can do it
[27:58] right here now and right in front you so
[28:00] thanks thank you
[28:04] ma'am sir thank you very much
[28:10] [Music]
[28:11] next up librarian
[28:13] miss Crossland
[28:19] good evening a very quick report on our
[28:23] first ever trunk-or-treat I put down in
[28:27] the report we had 400 people that was a
[28:30] very conservative estimate because we
[28:33] didn't start counting until about 5:20
[28:37] our counter didn't count all the people
[28:39] who had trunks and they didn't count the
[28:42] police are quite a few people so it was
[28:45] well over 400 and it was cold but we had
[28:48] a great time thank you police for
[28:51] helping park and helping get voters to
[28:55] come and vote I encouraged people to
[28:58] come thank you Public Works for helping
[29:00] us get set up I am wearing my red white
[29:04] and blue flag scarf as a reminder that
[29:07] this Friday after tomorrow at 10:30 a.m.
[29:10] in this room we will be celebrating our
[29:14] Veterans Day tribute
[29:17] this is just a wonderful thing I hope
[29:20] all veterans can come and let us just
[29:22] say thank you in the back there's a
[29:26] little flower pot and it I have a list
[29:30] there of everyone we put up a big
[29:32] display over here with people's names
[29:34] and their names on a star it's our wall
[29:39] of
[29:40] and so back there I have people listed
[29:43] if I already have your name on a star if
[29:45] your name is not there please
[29:48] write your name down and also anyone who
[29:52] can send a picture of photo of yourself
[29:55] in uniform to the library it will be on
[30:00] a slideshow that will be going when
[30:02] people come in any questions
[30:05] on the right side any questions from
[30:08] miss cross them
[30:12] yeah a trunk a tree great and I'll just
[30:15] echo please please please don't assume
[30:18] that the folks that you know know about
[30:21] the Veterans Day tribute that we do in
[30:24] here
[30:25] make sure they know don't tell everybody
[30:28] that you know about this and by the way
[30:30] it's not just for veterans it's for
[30:33] people to come in to celebrate that so
[30:36] you don't have to be a veteran to be in
[30:38] here for that and spouses we want to
[30:40] honor spouses but and then people who
[30:44] just want to say thank you yes thank you
[30:47] very much Linda
[30:49] next up is item number 8 City Engineer
[31:05] good evening mayor council
[31:08] we've got our report weekly run through
[31:11] it one of the introduce to Colin Brewer
[31:13] one of our young engineers here with me
[31:16] tonight there's a lot of work with the
[31:18] city on various projects
[31:21] 22:52 again no action this month but we
[31:25] anticipate a January meeting with tech
[31:27] stock where they're supposed to have 50%
[31:29] design plans we anticipate some possible
[31:33] utility conflicts and we're eager to get
[31:36] those plans as we understand it right
[31:38] now the
[31:41] any conflicts that we've may run into
[31:44] because they're in easements where we
[31:46] anticipate those would be covered by
[31:48] tech stop and they're not wouldn't be a
[31:50] city expense
[31:53] 22:52 water wastewater we're continuing
[31:57] to talk to landowners in the area and
[32:00] look at possible
[32:03] development and utility needs planning
[32:06] those projects woods the Garden Ridge
[32:10] benzel Road the revegetation is still
[32:14] pending the recent rains have been quite
[32:16] helpful but we're still waiting on final
[32:18] growth the recent rains eliminated some
[32:22] of the past
[32:24] residential flooding issues we've had
[32:26] downstream so I think that was
[32:28] successful
[32:30] Plaza oaks water line work continues on
[32:34] that they have passed a pressure tests
[32:37] and bhakti tests but there's quite a bit
[32:39] of cleanup and quite a bit of work that
[32:41] needs to be done to complete that
[32:43] project so we're continuing to monitor
[32:45] that
[32:46] city transportation master plan that
[32:49] it's been completed and it's under
[32:51] review by city staff
[32:54] Blackwell office building we've been
[32:56] exchanging comments with their architect
[32:59] and engineer
[33:01] we've got reply comments
[33:03] we've address we're addressing those
[33:05] reviewing those and continuing to work
[33:07] on that project to move it forward
[33:09] northeast Bible Church we've got plans
[33:12] on that and we're reviewing that
[33:15] particular attention to the drainage
[33:18] for that site and we'll be getting them
[33:21] comments back and expect there'll be
[33:23] some recent Middle required to address
[33:26] those issues
[33:28] 2019 the GIS and water model study we're
[33:32] finishing up that and hope to have a
[33:34] meeting with city staff here in the next
[33:36] couple weeks to address that and
[33:40] bring that up and up to date and
[33:44] continuing preparing the master plan for
[33:47] that project
[33:49] zoning map just to update to the zoning
[33:52] maps to reflect current zoning
[33:55] throughout the city and as aid for city
[33:57] staff to refer to for planning we saw
[34:01] the city park sakes known child zone
[34:04] as well I'm happy to answer any
[34:07] questions
[34:08] providing additional information thank
[34:11] you sir starting left-side questions for
[34:12] city engineer
[34:17] can you give us more of an exact status
[34:21] on the blackwell office building
[34:24] what the slow up is and how long do you
[34:26] think it'll be before it can it gets
[34:28] rectified
[34:31] we receive plans in
[34:35] late February we responded on the 7th of
[34:39] October to those plans there are a
[34:42] number of deficiencies
[34:43] additional information that was
[34:45] necessary
[34:47] they responded with
[34:49] additional documentation
[34:52] on the 24th
[34:54] the main issues were lack of
[34:58] engineering
[35:00] calculations and other information to be
[35:02] provided so we can evaluate it's not the
[35:05] city engineers job to design the project
[35:08] we received that information on the 24th
[35:11] and we're repairing a response letter a
[35:16] lot of the information is still not
[35:18] fully adequate we're a
[35:23] response that it's done this way in
[35:25] another city it's not doesn't apply to
[35:27] Garden Ridge and specific requirements
[35:29] and and how things are done so we're
[35:31] trying to make it as complete as
[35:32] possible to get a complete response and
[35:34] get back to them and
[35:36] have not heard from the project manager
[35:40] or the owner but be happy to meet with
[35:42] them and address those issues it's good
[35:45] thank you sir
[35:47] one other thing the zoning are we gonna
[35:49] have any residential zoning
[35:51] classification in the city or are you
[35:53] just dealing with a zoning along we got
[35:56] 3 mm 2252 now this is more of a historic
[35:59] zoning cities had zoning maps in the
[36:02] past but with changes in parcels and
[36:04] plats just an update to make sure that's
[36:07] properly reflected it's not we're not
[36:10] changing city city zoning requirements
[36:12] we don't have any zoning in in the city
[36:13] right now so other
[36:15] main highway so it's I it was it struck
[36:19] me when I first moved this area because
[36:21] that's what I you know I that's part of
[36:23] the research I do it by business and we
[36:25] don't have a zoning code in in Garden
[36:28] Ridge for residential I just wondered if
[36:29] that was ever going to take place not
[36:31] that it makes a darn bit of difference
[36:32] okay
[36:41] thank you mr. Lang
[36:45] number nine City Commission committee
[36:47] reports recommendations possible actions
[36:49] item a is planning zoning did not have a
[36:52] meeting since the last time we met but
[36:54] I'll turn it to dr. Miller if he's got
[36:56] something
[36:57] I had nothing to add to what you just
[37:01] said we we cancel both meetings in
[37:03] October we're looking forward to a
[37:05] meeting on the 12th of November at which
[37:08] time we're expecting a representative of
[37:12] freeze nichols chase parks to come and
[37:16] update us on
[37:18] three main areas that we had trouble
[37:21] with and they may in the other ordinance
[37:23] I think with short-term rentals
[37:25] accessory buildings and accessory
[37:27] structures that it miss canes those
[37:29] three things in particular but we plan
[37:32] to ask some other questions about where
[37:33] we are as a
[37:36] workaround for the legislative changes
[37:38] that kind of drove us to a school ground
[37:42] us to a halt
[37:43] that's all I had for planning of Zoning
[37:47] Thanks
[37:49] and any questions from Council for
[37:53] linings own chair start with the right
[37:54] side
[38:02] the purpose of this next meeting Tuesday
[38:05] evening with six o'clock here is again
[38:08] for mr. sparks chance sparks to address
[38:13] specifically the three key issues that
[38:15] have been the most significant issues
[38:16] for planning and zoning commission and I
[38:18] think it'd be a super idea if all of us
[38:21] who could attend could attend it would
[38:24] not be a special council meeting it
[38:25] would not be a forum for planning and
[38:28] zoning I'm sorry for planning and zoning
[38:29] and council interact just be a set more
[38:33] sets of ears so that when the whole
[38:35] project comes before us especially those
[38:38] of us who are sort of on the second tier
[38:40] of the project I just think it would be
[38:43] very helpful again it would not be a
[38:44] question and answer they'd be more or
[38:47] less silent in the back but I think
[38:48] could really give you a better feel for
[38:49] what the commissioners
[38:52] they're their primary concern so this is
[38:54] going on as you know long time thank you councilman Bower
[39:05] moving on to Cory Cory did not have a
[39:07] meeting and I don't know if anybody from
[39:09] Cory is here
[39:12] water Commission's possible action turn
[39:16] it over to chairman abouthere sure Thank
[39:20] You mayor
[39:21] first time I'm on the agenda is
[39:25] filling the position of Water Commission
[39:28] in place to what a commission actually
[39:30] received forward and self nominations
[39:32] which were very happy that we received
[39:34] that many
[39:36] unfortunately two were as will make it
[39:39] challenging with for anyway one County
[39:40] that pulled his name right prior to the
[39:41] meeting for personal reasons same thing
[39:44] with the second cannon was not able to
[39:45] attend the meeting we didn't interview
[39:48] two candidates both offered unique
[39:50] experiences and did a great job in
[39:52] answering our questions at this point
[39:54] the Commission recommends that of dr.
[39:56] Richard Carmichael who stood in back
[39:58] here you stand up or you can see who he
[40:02] is
[40:02] thank you
[40:07] we recommend pointing dr. Richard
[40:09] Carmichael to the Water Commission place
[40:11] to term expiring September 30th 2021 dr.
[40:16] Carmichael has a PhD in civil
[40:18] engineering in his restaurant and
[40:20] licensed professional engineer in Texas
[40:22] he has served in the US Air Force and
[40:24] has various work experience including
[40:27] work with the Texas Commission on
[40:29] Environmental Quality tcq so we're we're
[40:33] also asking he's only lived in the city
[40:36] five months we're asking for a waiver to
[40:39] the residency requirement under Rose
[40:41] Orange 210
[40:43] so I like to counsel at consider maybe
[40:46] delaying his appointment of December to
[40:48] avoid having that waiver so I turn it
[40:51] over back to you counsel mr. mayor
[40:57] we are very fortunate to have dr.
[41:01] Carmichael I haven't applied and agreed
[41:04] to serve with the PE
[41:10] breadth and depth of experience what I'm
[41:13] gonna and and what you got was our chair
[41:17] bringing to you what the what the
[41:19] Commission recommended I'm gonna I'm
[41:21] gonna recommend to you to also consider
[41:24] that you approve it as of December 6th is when dr. Carmichael will
[41:31] have been here for six months and I you
[41:35] know when we when we consider variances
[41:38] and when we consider waivers and things
[41:41] like that we have to consider that
[41:43] they're supposed to be cases that it
[41:45] really needs to happen and in this case
[41:48] what will happen is if you improve it by
[41:50] for the December 6th he can attend the
[41:54] next month meeting
[41:56] the next meeting they have in the
[41:59] audience and start to see what's going
[42:01] on and be be get up to speed but that
[42:04] way we don't have to we don't have to
[42:05] engage in waivers and you can just
[42:07] approve them as of the six that's
[42:09] something to consider it you're sure
[42:10] decisions your call but I just wanted to
[42:12] explain a little bit of what chair
[42:14] Valdes was just talking about so that
[42:16] said looking for a motion to act on dr.
[42:20] Carmichael's or a commission place - I'm
[42:23] going to approve dr. Carmichael's the
[42:26] recommendation of the Commission to
[42:28] approve dr. Carmichael beginning
[42:30] December 6 and I welcome him and and
[42:32] hope that he will be able to attend the
[42:33] November meeting and then be sworn in or
[42:37] whatever
[42:38] yeah thank you from place five I have a
[42:41] motion to approve as of December sixth
[42:44] for dr. Carmichael into place - can I
[42:47] get a second second
[42:50] you think
[42:53] [Laughter]
[42:58] all right so place one had his why
[43:00] Connells well say place one as the
[43:03] second any further discussion or
[43:04] questions
[43:05] all in favor any opposed unanimous again
[43:09] dr. Carmichael thank you very much for
[43:12] getting involved and we look forward to
[43:14] you being on the Water Commission and
[43:16] bringing your experience to an expertise
[43:20] to the Commission Thanks welcome
[43:23] then I'll turn it back over you
[43:27] going to the next item I wanted to thank
[43:30] mr. Frank mr. beard and mr. Diaz for
[43:33] also showing interest in serving the
[43:34] Commission and encourage them to
[43:36] continue to support the city so maybe
[43:39] they can be available for some other
[43:40] Commission's as well okay moving on to
[43:42] the next item which is the water rate
[43:44] structure so
[43:49] okay as you know we've been talking
[43:52] about water rates for a while now it
[43:55] needs to happen we have a dire need to be sure we made
[44:02] our requirements you have a packet and
[44:05] we'll cover some background this one
[44:07] information will cover background I'm
[44:09] going to cover the data we actually use
[44:10] assumptions made in the data
[44:13] the water rate options that the
[44:15] Commission can look with and look at the
[44:18] way we make our decisions based on
[44:20] alternate alternatives and in criteria
[44:23] around run precedence decisions and then
[44:25] I present the Water Commission
[44:26] recommendations as well
[44:30] so again the Water Commission had a
[44:33] subcommittee of two people our co-chair
[44:36] our Harshberger myself met with city
[44:39] staff to review and understand the water
[44:41] markets model something we really didn't
[44:44] do the first time and really go through
[44:45] look at what was in the in the day in
[44:48] the format and so we spent a lot of time
[44:51] and we thank a city administrator Nancy
[44:53] came for Hearst Hearst work and her
[44:55] staff as well Kath Denis Jacob as and
[45:00] especially I have to Karen Ford she read
[45:03] it was very helpful in providing the
[45:04] financial information couldn't Devens
[45:06] without her
[45:07] sorry Marissa we left you out
[45:11] I said in your packet you received the
[45:14] detail report that we have developed for
[45:16] you
[45:18] everything I'm gonna cover is more on
[45:20] the data based on a question I received
[45:22] from Councilwoman sweat about really
[45:26] where the data came from so that's why I
[45:28] changed the presentation here to really
[45:29] everything's didn't your report I'm just
[45:31] gonna show in a different format okay so
[45:34] again so again this district this
[45:36] presentation has just come reading the
[45:37] data
[45:39] here's the inputs that look going to the
[45:43] model our monthly consumption water
[45:46] consumption for the fiscal year 2019
[45:49] look at the number of accounts what the
[45:52] percent growth
[45:55] assumptions look at our depth or water
[45:59] fund expenses what we need to have in
[46:02] our reserves and then the rate structure
[46:07] okay so here this is a copy from
[46:10] directly from the the sheet and I want
[46:14] to show in the first column fiscal year
[46:17] 2018 these are the numbers for inside
[46:21] city limits and else I see limits so
[46:24] it's the middle column that water
[46:26] markets used
[46:28] the the column on the right is fiscal
[46:32] year 2019 this new data that we obtained
[46:35] knows that the consumption went down
[46:38] this is per month so in
[46:41] inside the city limits when 2 million
[46:43] gallons
[46:44] per month so so we had less consumption
[46:49] this past year 28 million gallons of the
[46:51] whole year versus 2018 so again that's
[46:53] data but that affects the calculations
[46:57] number of accounts
[47:00] we've had
[47:03] 23 meters inside the city were added in
[47:06] 2019 we went down 1 meter outside the
[47:11] city limits in in this last year water
[47:15] markets use a 2% growth number
[47:19] but so we were feel like the model was
[47:22] over predicting the growth since we're
[47:25] almost have built out conditions we only
[47:27] have the woods that has current you know
[47:30] permits to build houses at this point
[47:32] after that it's gonna slow down so we
[47:35] changed that growth rate to half a
[47:36] percent so growth rate outside we went
[47:40] from 2 percent down to 0 again
[47:42] we don't see much growth going out past
[47:45] that
[47:46] and then we have we don't know the
[47:48] non-residential growth on 22 V 2 is
[47:51] uncertain at this time so we took we
[47:53] didn't take that into a factor for this
[47:55] coming year
[47:57] as far as our debt
[48:00] so Karen provided this information so
[48:02] this is the amount of funds that we owe
[48:05] per year the middle column is what
[48:08] actually we as current depth it's around
[48:11] 600,000 plus per year
[48:16] we have projects that been approved for
[48:19] CIP but have not been funded yet so we
[48:22] don't include anything for 2020 we did
[48:25] add some funds looking ahead and we just
[48:29] a basic 30-year equally you know a
[48:33] memorization table we came added two
[48:36] hundred thirty thousand dollars per year
[48:37] for debt to look ahead after 2021
[48:41] but for this coming year we didn't we
[48:43] don't have any additional debt
[48:45] because we don't have anything funded at
[48:47] this time
[48:50] so this has come directly from our
[48:52] budget the the water fund expenses from
[48:56] approved in our budget these are the 11
[48:58] categories we have you'll have a fiscal
[49:01] year 2020 budget those numbers that
[49:03] total is 1 million 76 thousand we
[49:07] estimate our instant growth is estimated
[49:10] to 4 2021
[49:12] which is almost three point two seven
[49:14] percent increase for that so we use
[49:17] those numbers to look at the next two
[49:19] years based on that
[49:22] the model actually requires us to enter
[49:25] 2019 data so it throws us off so we
[49:29] actually had to make the model work so
[49:31] that the 2020 2020 budget numbers and
[49:35] 2021 come out the way we won them here
[49:37] and they did once we saw where they went
[49:40] as far as the reserve our reserve fund
[49:45] balance was that just to launder 1.5
[49:48] million as of August 31st this year now
[49:52] reserve funds are used to manage
[49:53] fluctuations in revenue you know to
[49:57] sustain the water fund during low cash
[49:59] flow periods and for any unforeseen
[50:01] expenses so the first eight or nine
[50:04] months of the fiscal year we're actually
[50:06] using borrowing money from that fund to
[50:08] pay our expenses you know it's later in
[50:11] the year that we actually have a peak
[50:13] income to balance out the year so we
[50:15] were we're borrowing from that money
[50:17] will you eat them away of what to use
[50:19] the reserve fund covers a 12 month depth
[50:23] so be sure we can pay that in the next
[50:25] 12 months and we're only using nine
[50:27] months operating expenses at this time
[50:29] we set our minimum reserve in the in the spreadsheet at 1.5 million for
[50:35] 2020 and we have a goal to bring that
[50:39] operating expense up to 12 months
[50:40] increase the reserve fund up to 2
[50:43] million so how we did that we used over
[50:46] a 10-year period increased at 25,000 per
[50:49] year over a 10-year period in the
[50:51] calculations
[50:53] okay so like well
[50:57] thrown button
[51:00] this is all the data that we put in any
[51:03] questions at this point and continue you
[51:05] know
[51:11] okay like I said everything's in the
[51:13] packet you had already this is just in a
[51:14] different format to show you the actual
[51:16] numbers that thought it'd be easier to
[51:17] explain
[51:19] so the the Commission looked at four
[51:22] options and we call them the first one
[51:24] in the City Council on out of the way we
[51:25] were charged at the September 10th
[51:27] meeting to look at and I'll cover more
[51:29] detail what that meant option two was a
[51:32] uniform percent increase percent you
[51:35] know across all tiers
[51:37] number three was at a commercial rates
[51:40] we have potential commercial growth come
[51:43] both coming in 20 in off twenty to fifty
[51:46] two per our master land plan use so
[51:49] that's a little bit longer term to look
[51:51] out there and option four was doing
[51:53] another option which was just
[51:55] implementing what water markets proposal
[51:58] year one in year two recommendations and
[52:00] I'll show you explain a little more
[52:01] about those
[52:03] we used them we have to find a way to
[52:06] score how each one of these came out and
[52:10] so we looked at six different criteria
[52:13] and rated at one to five looked at the
[52:16] impact on low volume users
[52:20] delay the increase the middle volume
[52:22] users
[52:23] minimize the financial risk to the water
[52:27] company
[52:28] revenue stability
[52:30] look at equality you know share increase
[52:33] across all all the residents all users
[52:38] how does it have with respect to
[52:40] conservation incentives and then an
[52:44] economic efficiency as the Water
[52:47] Commission was going through the
[52:48] alternatives in our meeting
[52:51] the commissioners really looked at
[52:53] financial risk and the inequality as
[52:55] needing
[52:57] to look a little bit closer so we added
[52:59] we actually multiply that value by two
[53:01] so we have a base score and then we have
[53:04] a weighted score for each one
[53:08] okay so the wonderful city council
[53:12] option is retaining the $2 increase on
[53:15] the base rate
[53:17] leave so look at the water market your
[53:20] won in year two rates we would leave
[53:22] your tears 1 2 3 & 8 and above unchanged
[53:27] from water markets we would increase
[53:30] tears 4 through 7 but at a lower
[53:33] graduated rate and then we looked at
[53:36] looking at 3 percent increase from 22
[53:39] from F fiscal year 2022 and Beyond
[53:43] okay
[53:45] and here's the way we scored it so in
[53:47] your packet you have the detailed charts
[53:49] between here and there you know you see
[53:51] the detailed charts what that actual
[53:52] numbers was I just want to get to the
[53:53] show the options here and and this how
[53:56] we scored it
[53:58] and say wait you know this has
[54:01] read a 5-4 impact on the low volume
[54:05] users a 5 for again low impact of tears
[54:09] 4 through 7
[54:10] the financial risk it did have a greater
[54:14] risk so we put a three at this one
[54:16] because it is demand since it's
[54:18] insensitive
[54:20] for
[54:24] conservation incentive we put as a four
[54:26] just because it does decrease
[54:28] it decreases the mid volume users
[54:30] lowered but that provides the incentive
[54:33] for the higher rate users and then the
[54:36] economic efficiency it's based on the
[54:38] lower tiers
[54:40] pay a a lower amount of the of the peak
[54:44] cost so a three there so again so we had
[54:48] the original score of 21 the latest
[54:50] score 25 as we doubled the the financial
[54:53] risk inequality there
[54:57] moving on to
[54:59] the option number two this is a uniform
[55:02] st. percent increase across all tiers
[55:07] this one did so for the year 2020 we
[55:11] left the 25 for the base rate it were
[55:13] required to go to 26 in 2021 again
[55:17] justice looking ahead estimating it's
[55:19] just an estimate
[55:21] our calculation showed that we needed a
[55:23] 14th sent across the board for 2020 and
[55:26] look possibly based on what we estimate
[55:31] for the budget for 2021 that we need to
[55:33] increase that in those 16 percent 2021
[55:39] okay and here's a skort again this one
[55:43] has on
[55:45] impact of low volume users rate is a 1
[55:48] if it does impact
[55:50] the lower tier users
[55:53] again it does impact the middle tier
[55:55] users a little bit more so it's a 3
[55:58] it's a 5 for financial risks in that
[56:02] it's not demand since that the like the
[56:04] rest of them are so I got a score of 10
[56:06] when you weighted it for equality we
[56:09] treated by the same so again a 5
[56:14] it currently maintains the same instance
[56:16] we have now so so 3 first conservation
[56:19] incentives sensitivity I mean and a 2
[56:24] for economic efficiency low base and
[56:27] lower tiers pay the and they increase
[56:29] their share peak loads
[56:31] so the base score is 19 the weighted
[56:35] score is 29
[56:39] option 3 was to look we looked at
[56:41] commercial rates
[56:44] to be like that and all we did was take
[56:47] non-residential
[56:49] non-government users and we moved them
[56:52] over a simple way moving over to the
[56:54] outside see limit rates
[56:57] [Applause]
[56:59] you know in in you can actually get away
[57:02] with just reducing the
[57:04] Residential's to 9 percent in 2020 the
[57:07] problem is we don't we don't have enough
[57:09] data at this point to move on we don't
[57:11] know what it's going to be so at this
[57:13] point the Water Commission is proposing
[57:14] we delay this option as we get more
[57:17] information as we forgive it'll predict
[57:19] a study comparing how other cities treat
[57:22] commercial rates so we're not ready to
[57:24] move on to this one but I want to show
[57:25] that this is an option that we want to
[57:26] consider later on
[57:29] and here's a score here I'm not gonna go
[57:31] through the details of it but since we
[57:33] were doing that one
[57:36] the stick with the water markets your
[57:38] one in year two
[57:41] so everything's the same the third
[57:43] burger got someone I want to point out
[57:44] it is this is not revenue neutral in
[57:47] that once we change all the data to
[57:50] update to
[57:52] 2019
[57:54] usage and although in the budget for
[57:57] next year
[57:58] we actually exceed our expenses by
[58:00] 64,000 we actually have a net gain of
[58:02] 64,000 so it's now revenue
[58:05] neutral to make the revenue neutral
[58:08] which is to go back to option one okay
[58:11] so I just want to show you how what you
[58:12] have to do this one what we have now to
[58:14] make it
[58:15] revenue neutral
[58:21] okay so here the scores a 19-4 now wait
[58:26] at 22 for weighted and here has a
[58:29] summary
[58:31] up to one retire we don't weigh it
[58:34] option two which
[58:36] rates comes out higher when you do do
[58:40] the way to score ratio we feel the
[58:42] Commission felt like options one and two
[58:43] or the most viable solutions at this
[58:45] point like I said we want option three
[58:48] the commercial rates is something that
[58:50] we need to consider was gonna take some
[58:52] more work for more study
[58:54] and option four is not
[58:57] maybe neutral so that was rejected
[58:59] alternative the following charts is only
[59:02] going to look at options one and two to
[59:03] give you more a comparison to help you
[59:06] decide we'll give you our recommendation
[59:08] but again it's sure you can pick either
[59:10] one
[59:13] the first chart here just shows the
[59:15] rates for
[59:18] that's all for current option one and
[59:21] option two and this just gives you a
[59:23] percent increase in there in the red
[59:25] column
[59:28] okay just study those again the option
[59:31] two is the straight 14 percent across
[59:33] each tier
[59:35] option one it's zero percent increase
[59:38] for the first three tiers and he goes up
[59:40] gradually but you're a ninety seven
[59:42] percent increase
[59:42] when you go to
[59:44] above ninety five thousand gallons
[59:50] this actually would be the bill so what
[59:55] does actually consumer you see on his
[59:58] monthly bills so get the current every
[1:00:01] 5,000 gallons got the option one and
[1:00:04] every 5,000 option two later on I'll
[1:00:08] show you what the Delta is between each
[1:00:11] between the difference are so it's in
[1:00:13] the last slide she'll put it right next
[1:00:15] but I wanted to do a graph
[1:00:17] here to show how the to go up with time
[1:00:22] so you get the on the X x axis is the
[1:00:26] number of gallons
[1:00:28] actual consumed versus the dollars that
[1:00:32] actually build
[1:00:35] if you notice that 7,000 gallons roughly
[1:00:39] below that option one is below option
[1:00:43] two so I want to highlight that little
[1:00:44] bit more you expand that to show you a
[1:00:46] little bit different just to visually
[1:00:48] show you how that is even the option two
[1:00:51] is a little bit higher it's significant
[1:00:53] not significant
[1:00:54] what we stick to the same point and then
[1:00:57] the last chart here is what
[1:01:00] again in the red I add I put in there
[1:01:03] what they increase from current is and
[1:01:05] then the difference between option one
[1:01:07] and two is the last column
[1:01:11] I'm not going with that pretty quick
[1:01:15] [Applause]
[1:01:23] a lot of commission voted on this and
[1:01:26] Water Commission recommends option to
[1:01:28] just a straight 14% increase this year
[1:01:31] but also recommends a second
[1:01:33] recommendation is to adopt an annual
[1:01:34] review process now that we have the
[1:01:36] model we know how to use it we can take
[1:01:40] the usage data for this next year we'll
[1:01:42] take the budget for 2020 and relook at
[1:01:44] all the numbers again it's not like
[1:01:46] we're gonna raise the rates X numbers
[1:01:49] every year we're gonna look at it every
[1:01:50] years with our proposal that way we stay
[1:01:52] on top of it we don't want to wait five
[1:01:53] years like you know was done passed
[1:01:56] so at this point I guess I can General
[1:01:57] referring questions
[1:01:58] [Music]
[1:02:01] thank you thank you very much like to
[1:02:05] turn it over to Council for any
[1:02:06] questions and again the option to is
[1:02:10] what they're recommending 14% across now
[1:02:12] I want to tell you that there's two
[1:02:14] recommendations and they're separate
[1:02:16] there's 70 I motion separate votes you
[1:02:19] see on your agenda that's we split them
[1:02:21] out so just we'll talk about
[1:02:23] recommendation number one first which is
[1:02:25] what you as a council believe the rates
[1:02:28] should be based on the data I'll also
[1:02:30] tell you that
[1:02:32] consider that the comment of now we have
[1:02:35] the model we had the model
[1:02:37] when we when we
[1:02:40] engaged with water markets we had the
[1:02:42] model but we weren't very smart about
[1:02:45] how to use it and now we get to people
[1:02:47] sitting there that are very smart about
[1:02:49] how to use it and that's what you see
[1:02:51] the product here so water markets you
[1:02:53] know it's it's whatever data they have
[1:02:55] whatever data we gave them but a year
[1:02:57] later we have more data and we have so
[1:03:00] the the Water Commission and
[1:03:03] particularly this subcommittee had more
[1:03:05] fidelity and more data to be able to to
[1:03:09] make this an out to do this analysis so
[1:03:12] that said start over on
[1:03:15] the left side
[1:03:17] comments and questions to the Water
[1:03:20] Commission on their recommendations and
[1:03:23] their analyses
[1:03:25] Jesse I think you're in your element
[1:03:27] this is wonderful presentation
[1:03:33] if I may
[1:03:35] understand option two the recommendation
[1:03:37] and so on did you discuss I know in the
[1:03:40] past we've discussed essentially despite
[1:03:43] what's been said by citizens tonight in
[1:03:44] previous meetings that you know we all
[1:03:47] want to hope that we know how to
[1:03:49] conserve and we all tempt a concern but
[1:03:51] there are people who don't choose to
[1:03:52] conserve and did you consider that 14
[1:03:56] percent across the board
[1:03:58] you know is I mean the people that just
[1:04:02] say I don't care and I'm gonna use
[1:04:03] 200,000 gallons a month I mean should
[1:04:05] they be essentially paying they're gonna
[1:04:07] pay more money but should they be paying
[1:04:08] at the same rate
[1:04:11] well I mean we're adding the 14 percent
[1:04:13] but that 14 percent is a higher dollar
[1:04:15] value like I showed you on the other
[1:04:17] previous one here you know
[1:04:20] even the 14 percent at
[1:04:23] 100,000 gallons is additional $200
[1:04:26] you know per the monthly bill it's not
[1:04:29] the 500 or 600 that they would have been
[1:04:32] in the other one or whether it have been
[1:04:33] 340 for the other way
[1:04:36] so we are still name being increase now
[1:04:40] we the reaction that we felt that
[1:04:42] happened in September was people
[1:04:44] starting to come back cutting back on
[1:04:46] their usage we really saw in to 2019
[1:04:48] they cut back and fing they're going to
[1:04:50] create will the Commission is planning
[1:04:52] on doing some discussion about
[1:04:55] conservation classes or educational
[1:04:57] sessions that will plan on doing for
[1:04:59] that to help them out as well so it
[1:05:01] could have been me impact on this in the
[1:05:03] future as far as but they
[1:05:07] spend the money
[1:05:34] to go down but yeah
[1:05:39] we're gonna stand the question can you
[1:05:42] rephrase I'm not sure I understood
[1:05:44] question in the past and maybe I missed
[1:05:46] something here in the past week you know
[1:05:48] if you went into drought stage exit was
[1:05:49] a surcharge on top when you used over X
[1:05:51] amount of gallons of water was that
[1:05:53] discussed oh no at all here we're just
[1:05:55] gonna we don't we're not changing that
[1:05:57] okay that's all okay we did that's a
[1:05:59] different ordinance I believe okay so
[1:06:00] we're not looking at that one Jim but at
[1:06:02] first blush blush I went 14% seems like
[1:06:05] kind of high we're sort of punishing the
[1:06:06] low end users and then my brain went you
[1:06:08] know we haven't had a rate increase in
[1:06:10] how many years five years okay what's
[1:06:13] been the inflation rate over those five
[1:06:15] years a couple of percent per year if
[1:06:17] you looked at a 3% over year over year
[1:06:19] we'd be at 16% - sure so then it makes
[1:06:23] sense if you look at it from that
[1:06:24] perspective it my first blush was 14%
[1:06:26] that's too much well except we haven't
[1:06:29] changed it for five years as which is
[1:06:30] why we risk running into a revenue hole
[1:06:33] and if you don't increase it so okay I
[1:06:37] like it
[1:06:42] mr. Valdez very well explained I don't
[1:06:45] know where you got all these graphics
[1:06:46] and all that but it there's a lot of
[1:06:47] work to get that together
[1:06:50] what is the fear or the concern y'all is
[1:06:54] concerned about the being revenue
[1:06:56] neutral
[1:06:59] so yeah the way the the way the model is
[1:07:03] set up you put in all those expenses and
[1:07:05] debt and everything is in there to start
[1:07:08] with and so the goal since the the city
[1:07:12] water company is trying to provide the
[1:07:14] service and cover cost is not to profit
[1:07:18] from it it's just to make sure we cover
[1:07:19] expenses to include those future capital
[1:07:21] outlays that are necessary for the
[1:07:23] system so we felt given the charge that
[1:07:26] the council gave us that are going in
[1:07:29] target should be to make sure the model
[1:07:31] comes out as close to revenue neutral as
[1:07:34] possible
[1:07:35] meaning that our expenses are going to
[1:07:37] be covered by our revenues we did define
[1:07:39] revenue neutral though as being within
[1:07:41] 2% of the estimate because there's a lot
[1:07:43] of fluctuation in there from year to
[1:07:46] year so we wanted to have a projection
[1:07:49] that was no less than zero break-even
[1:07:50] but no more than a 2% above estimates so
[1:07:55] there there is about $20,000 Delta in
[1:07:58] there so there's a little bit of wiggle
[1:08:00] room but we felt that we needed to try
[1:08:05] rebuild a little bit of confidence in
[1:08:07] the process as well so we just wanted to
[1:08:10] emphasize that our whole going in was
[1:08:13] revenue neutral but that doesn't mean
[1:08:15] we're not covering it our expenses
[1:08:17] alright we're just not targeting
[1:08:19] additional income we we do have a twenty
[1:08:23] five thousand per year increase to you
[1:08:26] know increase our reserves though so
[1:08:28] we're still adding twenty five thousand
[1:08:30] to the reserve every year that's in
[1:08:32] there already well personally I don't
[1:08:35] have any any problems with money
[1:08:39] let's take this and it was already
[1:08:41] mentioned take this to the extreme
[1:08:44] let's say the weed winter a severe
[1:08:46] drought a 5-10 year drought we have the
[1:08:50] Trinity Walker aquifers playing out we
[1:08:53] have to buy massive amount of water for
[1:08:55] the med ed works having a good good size
[1:08:58] cushion in there would be I think very
[1:09:00] helpful and I don't see I don't think
[1:09:03] see a thing wrong with you know increase
[1:09:06] in or or taking that money and setting
[1:09:08] aside for for something we don't foresee
[1:09:11] well we don't either I don't want to
[1:09:13] imply that but the Edwards and Trinity
[1:09:16] fees are essentially past throughs so we
[1:09:18] pulled those out of the model so they're
[1:09:20] not counted twice so there is still the
[1:09:22] ability through that that particular
[1:09:24] part of the of the bill to cover those
[1:09:27] additional costs if they arise but
[1:09:29] secondly we also wanted to focus only on
[1:09:32] this year so the problem we were trying
[1:09:34] to solve is what do we need for the
[1:09:35] rates now all that can be adjusted in an
[1:09:38] annual review process
[1:09:41] and that that's really the bottom line
[1:09:44] we don't have a problem with it either
[1:09:45] we just didn't know how to quantify that
[1:09:47] you know what it was a reasonable amount
[1:09:49] so the model that we're showing was
[1:09:50] based upon the assumption of let's keep
[1:09:52] everything neutral
[1:09:55] doesn't mean it can't be you know
[1:09:57] adjusted but for right now that those
[1:09:59] two options provide you the same income
[1:10:02] now we did have a lot of discussion and
[1:10:04] concern
[1:10:07] one of the charges was to you know just
[1:10:09] the mid-tier but not affect the lower
[1:10:11] tiers option two does affect the lower
[1:10:14] tiers far more substantially there's a
[1:10:18] lot of reasons not to do that but if you
[1:10:21] look back at the volume consumption data
[1:10:23] you'll find that yes we we consume two
[1:10:25] million gallons less a month but if you
[1:10:27] look at the higher volume tiers they
[1:10:29] went up so that reflects the lack of
[1:10:33] restrictions right we removed the the
[1:10:36] restrictions and said you know if you
[1:10:37] pay for your water you can use your
[1:10:39] water so those upper tiers are kind of
[1:10:42] our highly demand sensitive when people
[1:10:46] when the price goes up they can cut down
[1:10:49] how much they use or vice versa so since
[1:10:53] the goal was to make sure the water
[1:10:54] company was funded and we were focused
[1:10:55] only on next year we did not emphasize
[1:10:58] that
[1:10:59] because we didn't want the since there's
[1:11:02] already been a two million gallon of
[1:11:04] decrease we didn't want to take a chance
[1:11:05] on being below targets for next year so
[1:11:09] I do want to I guess we won't emphasize
[1:11:10] our recommendation is this is a one-year
[1:11:12] recommendation the model provides those
[1:11:14] out your projections but it's gonna have
[1:11:17] to be relooked at with more data as time
[1:11:19] goes forward I think I want to add is
[1:11:21] that the water markets with their rates
[1:11:24] were based on the data they had when we
[1:11:27] say you know
[1:11:29] revenue neutral there were eleven
[1:11:31] thousand dollars and we're in the same
[1:11:33] range with our numbers based on the new
[1:11:35] data that we input it this year so we're
[1:11:37] still following the same process that
[1:11:39] what our markets did the difference in
[1:11:41] that option for using the water market
[1:11:44] rates is that our new data gives us that
[1:11:47] increases that by fifty thousand dollars
[1:11:49] revenue increase the difference as well
[1:11:52] is the explanation there so our new data
[1:11:54] is what makes a difference
[1:11:57] okay so council is gonna be taking a
[1:11:59] look at this and y'all every year
[1:12:03] the Water Commission Marchena our
[1:12:05] changes in our options here we can we
[1:12:08] can do different ways you know and all
[1:12:10] that'll be modified it's like living
[1:12:12] document it can be a living yes sir we
[1:12:13] may have a lot from five next year could
[1:12:16] be or three only three okay I really
[1:12:19] won't look at very very well done that
[1:12:20] commercial part is really you know
[1:12:24] how so much money just a big thank you I
[1:12:27] watched the Water Commission meeting and
[1:12:29] you guys are very thorough and I
[1:12:31] appreciate all the work you put into it
[1:12:33] I probably picked Jessie's brain
[1:12:37] so I I certainly don't have any
[1:12:39] questions I've I've looked at all of
[1:12:41] this and this is a great work thank you
[1:12:45] sir
[1:12:49] ditto Lisa on thanks this is quite a
[1:12:54] project matter of fact it was a whole
[1:12:55] lot of fun reading it over a few dozen
[1:12:58] times trying to figure out what was
[1:13:00] going on nobody guy seriously the I had
[1:13:05] one of my reservations was the 14%
[1:13:09] increase at the low level and
[1:13:13] because one thing that we didn't want to
[1:13:16] do was increase
[1:13:18] those that did conserve and and wanted
[1:13:22] you know didn't didn't want to do he's a
[1:13:25] whole lot of water thing bad is after
[1:13:28] you run a few numbers like at the 30,000
[1:13:31] level
[1:13:33] it's next to $15 yeah that's why 50,000
[1:13:37] level it's like $36 I don't like to
[1:13:43] minimize that but it's not like the huge amounts that we
[1:13:51] had earlier and I and I was hoping that
[1:13:56] we could go a little bit higher at the
[1:13:59] high end
[1:14:00] because that's where
[1:14:03] you know I couldn't believe we had
[1:14:06] people at 200,000 gallons I'm just glad
[1:14:09] that the press wasn't here because
[1:14:11] that's a lot of water and however
[1:14:15] in reviewing what you did the 14%
[1:14:19] increase
[1:14:21] hey that's just for the first year and B
[1:14:25] we do need to increase our rates to
[1:14:29] cover our costs
[1:14:31] as the mayor said last month in the
[1:14:34] month before in the month before that
[1:14:36] we're trying to let the administrative
[1:14:40] budget and the water budget stand on
[1:14:43] their own and so we have to look at this
[1:14:48] very critically the one thing that
[1:14:52] iced option - for me was that
[1:14:57] the annual review if next year we decide
[1:15:02] well we only want to increase at ten
[1:15:04] percent or three percent or none at the
[1:15:07] lower levels we don't increase it if we
[1:15:10] want to increase it more diaper levels
[1:15:12] and we do it so it's nice to have that
[1:15:16] well not only is it nice to have that
[1:15:21] your your model it's nice to understand
[1:15:24] it so
[1:15:26] thank you very much appreciate your work
[1:15:31] Thanks
[1:15:35] chairman and vice-chairman yeah thank
[1:15:39] you you know a lot you took what water
[1:15:42] markets gave us and then tailored it to
[1:15:45] a year's more of data and and then gave
[1:15:49] us some more options and a superb job of internalizing this and as
[1:15:55] well as trying to give us options to
[1:15:58] stick with some of the things that we
[1:15:59] had talked about with trying to take
[1:16:03] somebody that was in the lower end and
[1:16:07] not having them affected but we found
[1:16:09] that that that was an unpopular way because the people in this
[1:16:15] city say no everybody should everybody
[1:16:17] should pay more the the thing that's
[1:16:20] interesting that really shaped a lot of
[1:16:23] this
[1:16:23] discussion was one of the things that I
[1:16:26] said that that I missed and that was
[1:16:29] that it happened in Sept
[1:16:33] and for the record everybody talks about
[1:16:36] well the 80,000 80,000 gallon user and a
[1:16:39] hundred thousand gallon user the
[1:16:42] perspective on this is it was the second
[1:16:46] hottest August on record in this area
[1:16:49] during a severe drought and to keep in
[1:16:52] mind council
[1:16:55] 95 behind 95 people in the city used
[1:16:59] more than the city used of February
[1:17:02] prior the entire city an entire month of
[1:17:05] February so you know everybody was using
[1:17:08] their bill that they got in September
[1:17:11] and we had Realtors coming up here and
[1:17:13] telling us that there's no way we could sell a house of it was going to
[1:17:17] be a $2,000 bill every month well I
[1:17:20] can't imagine that somebody
[1:17:21] thinks it's realistic that they're gonna water 150,000 gallons in
[1:17:26] February you know December January
[1:17:29] February March timeframe and so that and
[1:17:32] that was that was just my mind not
[1:17:35] realizing that that the timing was was
[1:17:38] pretty bad so that and I mentioned that
[1:17:41] not just to look back but to also talk
[1:17:43] about as we look at this chart the
[1:17:45] reality of this is even the people that
[1:17:47] were using 150,000 gallons they're gonna
[1:17:50] be hard-pressed to use 150,000 gallons
[1:17:52] this month the next month and so the
[1:17:55] average that they're going to be using
[1:17:57] over the year is far different than the
[1:18:00] outcry of the
[1:18:02] 150,000 gallons and the and the two
[1:18:05] thousand dollar bill that they had as I
[1:18:07] said to keep their grass green during a
[1:18:10] severe drought in the second hottest
[1:18:12] August on record and that is not in a
[1:18:14] vacuum because anybody paying attention
[1:18:17] to the news both print and and
[1:18:20] TV pretty much every city around here
[1:18:24] went through the same thing and New
[1:18:27] Braunfels was smart enough to wait to
[1:18:29] raise their rates till after the after we got through the heat but
[1:18:33] they're they're they're raising their
[1:18:35] rates off
[1:18:36] Cibolo everybody was raising their rates
[1:18:38] and you saw in the news of people were
[1:18:40] we're all screaming there's no way I
[1:18:41] could have used this much water so it
[1:18:44] it's just bad timing
[1:18:45] but and also for the record there wasn't
[1:18:48] I never
[1:18:50] to my knowledge said that I didn't know
[1:18:52] how much the rates were gonna go up what
[1:18:54] I said was I didn't realize
[1:18:56] what was gonna happen in August and I
[1:18:59] didn't present it as such so you really
[1:19:03] did a great job of showing that we still
[1:19:06] need to do this and what was lost on a
[1:19:10] lot of people is that we didn't just sit
[1:19:11] and do nothing for five years it was
[1:19:13] because we needed to have better data
[1:19:15] going in before we decided what to do
[1:19:18] when we thought it was disingenuous that
[1:19:19] just raised the rates blindly without
[1:19:22] knowing what we needed to do the users
[1:19:25] they don't believe this but they were
[1:19:27] beneficiaries of that five-year pause
[1:19:29] because as we were determining what the
[1:19:32] real cost of the of the water company
[1:19:34] was and as we we fully loaded the water
[1:19:37] company did all the things we did over
[1:19:38] the last few years the rates stayed the
[1:19:41] same and also for the record we're
[1:19:44] surrounded by cities that have baked in
[1:19:48] water increases every year so it's not
[1:19:51] very controversial because it's just
[1:19:52] there already and everybody everybody
[1:19:54] knows that next year's bill is going to
[1:19:56] be higher I think and we're going to
[1:19:58] talk about that in a separate motion but
[1:20:00] I appreciate that you said no what we'll
[1:20:02] do is we'll just look at it every year
[1:20:04] and because we have smart people like
[1:20:06] you that know how to use this model
[1:20:08] really well we can take another years
[1:20:11] worth of data plug it back in and see
[1:20:14] where we are
[1:20:15] you know the this this these two options
[1:20:19] that you have that we have presented
[1:20:21] right here are both strong viable
[1:20:24] options to maintain the the
[1:20:26] fiscal solvency of the company and and
[1:20:30] be able to then kind of do a what I
[1:20:33] would call shoot look and see see what's
[1:20:35] going on so so yeah echoing everybody's
[1:20:39] comments up here thank you for all the
[1:20:40] they the extraordinary amount of time
[1:20:43] and effort that you put into doing this
[1:20:45] so that said all of us have had an
[1:20:47] opportunity to speak and now it's a
[1:20:49] question of what's the council's will
[1:20:51] and what you want to do and what I'd say
[1:20:53] is what option
[1:20:56] and also when you want this to take
[1:20:59] effect
[1:21:02] anyone a
[1:21:04] movie except option 2
[1:21:07] okay I have from place three that will
[1:21:12] go with option number two
[1:21:13] second and second from place one any
[1:21:18] further discussion or questions
[1:21:22] absolutely okay we've proposed I think
[1:21:25] last month or two months ago or so we
[1:21:27] not start until December yes I'm sorry
[1:21:30] January is what's December for january
[1:21:32] bill is what you yes yes so your
[1:21:35] Christmas bills you get your new water
[1:21:36] bill yeah so no change in that is what
[1:21:38] we had is what this this body of the
[1:21:40] side of the December that's number for
[1:21:42] January is that that part of company
[1:21:46] that do it doable yeah okay yeah so an
[1:21:49] amplification
[1:21:50] anything else ma'am
[1:21:54] okay so from place three the motion for
[1:21:58] option number two and place one with the
[1:22:01] second all in favor
[1:22:04] any opposed it is unanimous
[1:22:08] again fantastic job and now moving to
[1:22:11] the annual part I'll just Mennella say
[1:22:16] about that I think you've pretty much
[1:22:17] covered it we separated it out but again
[1:22:20] a lot of cities around here just say
[1:22:22] that it's going to be an X percent in
[1:22:24] every every year period nobody even it's
[1:22:26] not even a further discussion but in
[1:22:28] this case what what we're recommending
[1:22:29] particularly since this is our first
[1:22:32] time in in nearly five years
[1:22:34] adjusting the rates it really makes a
[1:22:36] lot of sense to do what they're asking
[1:22:38] so looking for a motion to review the
[1:22:42] water each annually and what I will say
[1:22:43] is I didn't pick up on this until today
[1:22:46] but we should have been specific about
[1:22:47] when we say annually do we mean like
[1:22:50] twelve months from now or so do you have
[1:22:53] an amplification of that recommend yes
[1:22:55] sir it'd be October of next year just I
[1:22:59] mean it'd be after we get the budget to
[1:23:02] prove for the fiscal year 2019 and we
[1:23:04] get the annual usage for the fiscal year
[1:23:07] 2020 which is September 30th or
[1:23:10] / first so we will start the process in
[1:23:12] October
[1:23:14] and and then and bring to Council in
[1:23:18] November in November yes sir okay that's
[1:23:21] great thanks we have to find that same
[1:23:24] time the same time for 12 months council
[1:23:26] any questions or comments on on what
[1:23:28] that recommendation is starting to write
[1:23:30] sign
[1:23:33] yes I would like
[1:23:35] adopting an annual at his timetable at
[1:23:39] the recommendation but I also would like
[1:23:41] to seriously I just want on the record
[1:23:43] to review the high end users because if
[1:23:47] there's somebody thinks they're green
[1:23:48] grass is more important than somebody
[1:23:49] having drinking water I'd like to really
[1:23:51] reconsider that it's a higher tier or
[1:23:55] penalized if you will Tommy them thank
[1:23:57] you understand okay so that said can I
[1:24:00] get a motion on this recommendation
[1:24:06] I'm overview the water rates annually I
[1:24:09] have a motion from place three to reboot
[1:24:12] review the water h annually to bring and
[1:24:15] the analysis be done to bring to council
[1:24:17] in November of e of following year can I
[1:24:21] get a second second second from place to
[1:24:24] any further discussion or questions all
[1:24:26] in favor aye
[1:24:28] any opposed it is unanimous
[1:24:32] anything else yes just want to cover our
[1:24:36] next Water Commission meeting has has
[1:24:38] been moved up to the third Tuesday
[1:24:39] because of Thanksgiving week so our next
[1:24:42] menial being November 19th at 6 p.m.
[1:24:44] here at the next meeting will will Masek
[1:24:47] adjust focus on the water leak
[1:24:49] adjustments that
[1:24:51] Jacob Parsons is pushing up to us and
[1:24:54] then for future topics starting in the
[1:24:57] spring we'll be looking at educational
[1:24:59] sessions on water conservation so that's
[1:25:02] all I have to add
[1:25:03] great job and thank you so much and
[1:25:07] you're about to also have another PE and
[1:25:09] I have some engineer Wars going
[1:25:12] but that's fantastic and and
[1:25:15] really taken on the charge we talked
[1:25:18] about
[1:25:19] gosh now a year and a half ago with with
[1:25:22] all of the different different projects
[1:25:24] and really encouraging that that this commission is really moving moving
[1:25:30] out pretty pretty handily thank you very
[1:25:32] much well anything else for the Water
[1:25:35] Commission starting right side left side
[1:25:40] okay item number
[1:25:42] 9d wildlife management
[1:25:46] had one meeting in
[1:25:50] skis kind of represent for sure sir
[1:25:54] thank you
[1:25:56] on our last meeting we had a
[1:26:00] resignation of Jeremiah McKinney place
[1:26:02] for we accepted his resignation and
[1:26:07] interview 2 replacement candidates we
[1:26:11] decided on dr. Denise miner Williams for
[1:26:15] that place Fork Commission I guess that
[1:26:18] place for seat
[1:26:21] and we are recommending her for for that
[1:26:27] yeah that's what I got okay I'll take
[1:26:30] pretty song I split these outlets first
[1:26:35] request the motion to accept the
[1:26:37] resignation of Jeremiah McKinney from place for and a wildlife-management
[1:26:41] Advisory Commission I move to accept the
[1:26:44] resignation of Jeremiah McKinney from
[1:26:46] the wildlife management Advisory
[1:26:48] Commission I get a motion from place to
[1:26:50] could I get a second Sagat place for
[1:26:53] would the second any further discussions
[1:26:55] questions starting left side with
[1:26:57] regrets thank you
[1:27:00] yeah I'm gonna say it with regrets and
[1:27:02] we're losing a guy that's a wildlife
[1:27:04] biologist by profession so that's a big
[1:27:07] loss to the the Wildlife Commission and
[1:27:09] I'll reserve my other comments when we
[1:27:11] bring the new person on
[1:27:13] sir anything ma'am I
[1:27:17] agree with Todd hate to see him go
[1:27:22] so yeah we are we are losing somebody
[1:27:27] that is really an expert and has done a
[1:27:29] lot of great work I will tell you in his
[1:27:32] resignation
[1:27:33] he actually
[1:27:35] volunteered to continue helping with the plan and anything else so he's
[1:27:42] stepping away from it but not entirely
[1:27:45] and we really appreciate that so gonna
[1:27:46] Motion place to a second for place for
[1:27:49] all in favor accepting the resignation
[1:27:51] say aye any opposed it is unanimous and
[1:27:55] then the second part which is we are
[1:27:58] very fortunate to have dr. miner
[1:28:00] Williams she's not here tonight she told
[1:28:02] us she couldn't be here but she's she
[1:28:05] actually was here at the last council
[1:28:07] meeting if you recall representing with
[1:28:09] the Bat Conservation folks but she is
[1:28:12] she she is very well versed in the
[1:28:16] doings of wildlife management and we're
[1:28:19] very fortunate that she she stepped up
[1:28:21] to volunteer so it's a recommendation of
[1:28:24] the wildlife management visor Commission
[1:28:25] to accept her on its place for can I get
[1:28:28] in a motion move to approve place one
[1:28:31] with a motion to approve dr. Denise
[1:28:33] miner Williams I sent the motion I get a
[1:28:35] second from place five any further
[1:28:37] discussion of questions all in favor aye
[1:28:41] can you post it is unanimous please pass
[1:28:44] on to her when you when you see her that
[1:28:46] we're excited to have her on there as
[1:28:47] well as we've all told Jeremiah
[1:28:49] individually how much we we appreciate
[1:28:51] what he did we'll do anything else for
[1:28:54] monthly activity so we had a couple of
[1:28:56] we had a presentation on bees that
[1:28:58] believe it's on YouTube I felt it I felt
[1:29:01] like it was very informative so if
[1:29:03] you're interested in learning a little
[1:29:05] bit more about bees and
[1:29:08] pollinate and pollination there's a good
[1:29:11] I believe it's on YouTube you can go
[1:29:13] watch it it's pretty good we did talk
[1:29:16] about the Hogs I know that's the next
[1:29:18] item we did not come to a council with a
[1:29:21] recommendation for that
[1:29:23] we as a commission decided that the city
[1:29:27] was doing everything that they could to
[1:29:30] address that at this time
[1:29:32] along with I think George rage had some
[1:29:35] initiatives they were working on as well
[1:29:37] so and I think there were some
[1:29:38] discussions around the school assisting
[1:29:41] potentially as well so with all that
[1:29:43] said we didn't come with a
[1:29:45] recommendation to do or spend any money
[1:29:48] from our budget and the wildlife budget
[1:29:51] to addressing the hog situation and
[1:29:54] other than that I don't think we had
[1:29:56] anything else thank you then what I'll
[1:29:59] add is later on in the agenda we are
[1:30:01] going to talk about hogs and some other
[1:30:03] actions but it's not because the
[1:30:06] wildlife management Advisory Commission
[1:30:08] didn't didn't have the ideas or anything
[1:30:10] but frankly more things there's been
[1:30:12] more developments since their meeting so
[1:30:14] it's it's just additional information
[1:30:17] additional additional courses are
[1:30:19] potential courses of action so that's
[1:30:21] the reason why it's on there
[1:30:23] any questions or comments for a wildlife
[1:30:25] management starting right side
[1:30:28] did we ever take the time to the the
[1:30:31] biologist that stepped away from helping
[1:30:33] Garden Ridge with Texas Parks and
[1:30:35] Wildlife did we ever take the
[1:30:37] opportunity to write him a letter or a
[1:30:39] supervisor letter telling how much we
[1:30:40] appreciated what he did for the city I
[1:30:43] know that our thank yous been passed
[1:30:45] along I know that Cindy reached out
[1:30:47] who's the the chair of the Wildlife
[1:30:50] Commission reached out to him and
[1:30:51] thanked him in person and that will not
[1:30:56] in person but be a phone call or an
[1:30:57] email I'm not sure if the city broadly
[1:31:00] did that or not but I know that she
[1:31:02] reached out individually did that could
[1:31:04] we do that yeah it's something
[1:31:08] okay and just say first of all I could
[1:31:12] just look for consensus from the council
[1:31:15] would you be would you be amenable to us
[1:31:17] sending to a copy to him but to his
[1:31:20] supervision to say how much we
[1:31:22] appreciate what he did for the city okay
[1:31:24] and what I would say is if you would
[1:31:27] take this back to your Commission see if
[1:31:29] they are - and just write it right have
[1:31:32] somebody write a quick note and and what
[1:31:35] would be really pretty pretty stylish is
[1:31:38] if they all signed it and then bring it
[1:31:40] to will bring it will give it to council
[1:31:42] and they can all sign it and the
[1:31:43] supervision will see that whole bunch of
[1:31:45] people really appreciate all he did for
[1:31:46] our city for sure this time do that
[1:31:48] great great idea he walked away from a
[1:31:51] very difficult situation and and is his
[1:31:54] contribution when he was here with it
[1:31:56] was incredible yeah he went a Bundy
[1:31:58] needs to have something in his work
[1:32:00] flounces yeah that's how much we
[1:32:02] appreciated it and he'd trained he'd
[1:32:03] already transitioned out of the out of
[1:32:05] what was the biologists position into
[1:32:07] another position and still helped us out
[1:32:10] so that was a little extra for be of
[1:32:12] above and beyond what was normally asked
[1:32:14] of him so yeah great idea thank you very much we appreciate all
[1:32:25] that they're doing
[1:32:27] next up is 90 parks committee
[1:32:30] to be succinct
[1:32:33] we're well into
[1:32:36] planning for the tree lighting ceremony
[1:32:38] we had a meeting today we have another
[1:32:41] meeting this month we have a
[1:32:44] extensive task list and
[1:32:46] we're right on right on point in terms
[1:32:49] of getting things done
[1:32:51] the tree lighting ceremony is December
[1:32:55] the 5th
[1:32:56] we start staging
[1:32:59] our
[1:33:02] equipment if you will on December of the
[1:33:06] second or that Monday and the only
[1:33:09] problem we foresee is take down has to
[1:33:12] be on in one day on December the 6th
[1:33:15] it's a Friday but we're gonna work
[1:33:18] around that get as many people and
[1:33:19] volunteers as possible to help us take
[1:33:22] the stuff down and get it packed up and
[1:33:23] out of there in one day but we're real
[1:33:26] excited how things are coming I
[1:33:29] think it'll be as good is not if not
[1:33:33] better than it was last year I'll
[1:33:36] entertain questions
[1:33:38] later Ron thank you and we're all
[1:33:41] excited about it and before I hand it
[1:33:42] over I want to add
[1:33:44] thanks to working with the scouts and
[1:33:48] Public Works
[1:33:49] in Fairview Park and making that part
[1:33:52] happen as well and it is an official
[1:33:54] city park and all the all that goes with
[1:33:57] it and we really appreciate that that
[1:33:59] y'all had a big hand in that as well so
[1:34:01] starting left-side questions comments
[1:34:04] for Parks yes this is not as premature
[1:34:07] as it may seem but we have run into this
[1:34:09] situation several years where we don't
[1:34:12] know a lot of effort as we know to
[1:34:15] create this wonderful spectacle and then
[1:34:18] weren't asked to take it down in six
[1:34:19] hours one morning and I would like to
[1:34:22] suggest as I've done in the past not in
[1:34:23] this forum but with miss Kane and and
[1:34:26] other officials in previous years
[1:34:28] community center is a community center I
[1:34:31] think it's for the citizens and I see no
[1:34:33] harm in
[1:34:34] potentially reserving one
[1:34:37] weekend a year for our citizens not
[1:34:40] worried about reading it and we move our
[1:34:42] parks tree-lighting to our Friday or
[1:34:44] Saturday night we've got the whole darn
[1:34:45] weekend I think I think just think it
[1:34:47] would help all the intend ease I think
[1:34:49] it would help we could even maybe expand
[1:34:51] it to you know 9 o'clock if it's not not
[1:34:53] on a school night I just think it would
[1:34:55] help everybody around and I think it
[1:34:57] would help with take down and so on not
[1:34:59] unlike we deal with Paul Davis Park
[1:35:01] where we reserved the whole park for
[1:35:03] fourth of July and actually preceding
[1:35:05] days or so for set up I think it's time
[1:35:07] we consider that we know that it's a
[1:35:09] successful event and as far as I know
[1:35:11] it's gonna continue way into the future
[1:35:14] and we also know that if we continue to
[1:35:17] have it on Thursdays this is going to
[1:35:20] conflict throughout 2020 we know that
[1:35:22] the judges already Municipal Court will
[1:35:25] conflict again next year as it will this
[1:35:27] year so I would really like to get it on
[1:35:29] the table now that we consider in the
[1:35:33] near future and we just reserve that
[1:35:35] weekend for our citizens thank you okay
[1:35:40] and I'll answer that that we'll look at
[1:35:41] that we need to make sure that before we
[1:35:43] say oh yeah that's a great idea for next
[1:35:44] year it isn't already reserved for next
[1:35:46] year sometimes people will reserve a
[1:35:49] year out for weddings or you know things
[1:35:52] kind of things so we need to make sure
[1:35:53] that it's it's not an issue so we will
[1:35:56] look at it and we will come back and
[1:35:57] report but you for the record you could
[1:36:01] have said something we could have looked
[1:36:02] at it before we walked in here so for
[1:36:05] the record I just thought about it
[1:36:06] because I found out just today I just
[1:36:09] found out today that for third-year
[1:36:19] okay well we will we will run this the
[1:36:22] ground will talk will put on any Jenna
[1:36:23] will talk about next time and I would
[1:36:27] venture a guess that whoever's given the
[1:36:29] information doesn't know that it's
[1:36:30] quote-unquote false information so we'll
[1:36:33] take a look at it okay
[1:36:34] good okay
[1:36:40] thank you and volunteer garden ridge
[1:36:44] again to be succinct
[1:36:47] the
[1:36:49] outreach efforts that we've made
[1:36:52] last month and over the last two months
[1:36:55] haven't been as successful as I would
[1:36:59] hope but we really haven't put a whole
[1:37:00] lot of time into it because there's a
[1:37:01] lot of conflicting pains going on in the
[1:37:05] city and amongst amongst the people
[1:37:08] running volunteer garden Ridge
[1:37:10] we've had several nibbles if you will
[1:37:13] and we need to follow up a little bit
[1:37:15] and set the hook so to speak on the
[1:37:18] other several nibbles that we had but
[1:37:21] we've also had some ideas about how to
[1:37:24] make it better and we'll try them
[1:37:27] the problems we have with volunteer and
[1:37:30] volunteerism are not unique to garden
[1:37:34] rich I'm finding out it's hard to get
[1:37:36] volunteers for everything
[1:37:39] we'll keep trying
[1:37:40] we appreciate that thank you and after
[1:37:44] the dust settles out
[1:37:50] [Music]
[1:37:55] yeah
[1:37:57] questions comments for volunteer guards
[1:37:59] starting right beside
[1:38:03] thank you sir moving on to propose
[1:38:05] authorizations item number 10 a its
[1:38:09] feral hogs the item is to review and
[1:38:11] discuss proposal so first of all city
[1:38:14] actions are our Animal Services and
[1:38:17] Public Works and frankly everybody that
[1:38:19] can help has been helping putting out
[1:38:22] traps and pens and consulting with
[1:38:25] trappers our our Public Works folks and particularly our Animal Services but
[1:38:33] also our our Public Works Director have
[1:38:36] talked to at least three trappers that I
[1:38:39] know of asking them what are we doing
[1:38:41] right what are we doing wrong what can
[1:38:43] we do and the consensus of the trappers
[1:38:45] is they would be doing the same thing
[1:38:47] and they gave us some some tips on what
[1:38:50] to do with the bait and how to make it
[1:38:52] so it's not so attractive to deer and
[1:38:54] one of them said that acorns which was
[1:38:57] scoffed at on public in social media was
[1:39:00] is actually kind of like cracked to a to
[1:39:03] a hog apparently and that's why that
[1:39:05] went out and some people have been
[1:39:07] collecting that but nevertheless you
[1:39:09] heard something that is is a common
[1:39:12] comment with with trappers is they know
[1:39:17] that when there's particularly a mom hog
[1:39:21] in the group that's trap smart they'll
[1:39:25] actually nudge away and push the other
[1:39:26] hogs away from the trap it's it's crazy
[1:39:29] to watch it on film and they really do
[1:39:31] that they're that smart so that's one of
[1:39:33] the things that we're up against but we
[1:39:36] have we also have had some people
[1:39:39] petitioned the city to authorize and I
[1:39:42] won't do air quotes but I'll say quote
[1:39:45] professionals to hunt in the in city
[1:39:48] limits and
[1:39:49] there's a couple of problems with that
[1:39:51] one is there's no it's pretty loose
[1:39:53] definition of what a professional is to
[1:39:55] begin with but
[1:39:57] moreover it's not just an issue of the
[1:40:01] city ordinance saying that it's a
[1:40:03] problem with hunting in the city but
[1:40:05] it's a problem with the state saying
[1:40:07] it's a problem with hunting in the city
[1:40:08] and we've engaged with our attorney and
[1:40:11] asked our attorney to analyze this you
[1:40:13] were sent a letter on this so you would
[1:40:18] be armed with the information understand
[1:40:19] why it's it's a bridge that's
[1:40:23] extraordinarily too far to allow
[1:40:25] somebody to be hunting and in in our
[1:40:29] neighborhoods but I'm gonna turn this
[1:40:31] over to our attorney to ask her to
[1:40:33] explain a little bit of that
[1:40:36] so one of the things that we considered
[1:40:38] was is there a possibility of just
[1:40:40] rescinding the ordinance and then would
[1:40:44] that give you know someone the right to
[1:40:45] do this as we documented for you in the
[1:40:49] memo it is a there is a penal code
[1:40:51] violation under 4201
[1:40:54] to allow that that type of discharge of
[1:40:57] firearms within the city limits because
[1:41:00] of the definitions the particular
[1:41:01] definitions that apply to you the penal
[1:41:03] code
[1:41:05] there's a little bit of additional
[1:41:07] research and I confirmed with Chief
[1:41:08] shortly before the meeting and what we
[1:41:11] can also confirm is not only is that
[1:41:13] there that Penal Code definition in that
[1:41:15] penal code violation which is a Class B
[1:41:18] misdemeanor offense it is also a
[1:41:21] violation of a separate chapter of the
[1:41:23] penal code which is a felony offense and
[1:41:26] so whatever the city does because there
[1:41:29] is also the felony offense at play and
[1:41:31] the potential for a felony offense at
[1:41:33] play for discharge of a firearm within
[1:41:36] city limits and the city has no
[1:41:38] authority to to authorize that
[1:41:43] kind of and they're going to I'll skip
[1:41:45] the air quotes but no authority to
[1:41:47] authorize that type of discharge within
[1:41:50] the city limits
[1:41:52] and and let me add she said discharge
[1:41:55] firearm a couple of times but in the
[1:41:57] note that you have you see that it
[1:41:59] actually says or other weapon shotgun
[1:42:01] air rifle pistol BB gun bow and arrow so
[1:42:04] it it's all of that although the people
[1:42:07] that don't Lee don't use these things
[1:42:10] very much consider it all and they just
[1:42:12] say discharge firearm but they're really
[1:42:13] talking about all that stuff so that
[1:42:16] said while our attorney has the floor to
[1:42:19] offer if anybody has any questions about
[1:42:22] this particular topic not about the hog
[1:42:25] trapping or anything in general but just
[1:42:27] about the memo you got and the idea of
[1:42:30] allowing people to hunt in our city
[1:42:32] starting the right side any comments or
[1:42:34] questions
[1:42:36] don't think hunting our city has any
[1:42:39] place there's way to strap these hogs if
[1:42:41] we get experienced people we can we
[1:42:43] could do that successfully it's been
[1:42:45] done I've done it myself before
[1:42:49] ma'am no way
[1:42:52] so then
[1:42:54] taking this a step further as I said
[1:42:57] we've been we've bought extra traps
[1:42:59] we've been trying lots of different
[1:43:01] things we're up against having some hogs
[1:43:05] that are trap smart and
[1:43:07] you know we're still trying to help then
[1:43:10] so the next step is we we went to some
[1:43:14] trappers and said what can you do if we
[1:43:17] engaged your services to trap and I'd
[1:43:20] like to turn this over to our city
[1:43:21] administrator so she can explain some
[1:43:23] discussions that she's had good I
[1:43:27] spoke with
[1:43:29] Ryan Murphy with RMH ranch or RMH
[1:43:33] services they've done our did our deer
[1:43:36] trapping this past year or past season
[1:43:41] he has submitted a quote or an estimate
[1:43:46] that would be initial trap setup and
[1:43:48] takedown of $2,500 and then a weekly
[1:43:52] trap capture capture fee with a two week
[1:43:55] minimum of $500 per week what he would
[1:43:59] be using is a trap that is similar to
[1:44:04] what he used when he was trapping deer
[1:44:07] but it would be smaller
[1:44:09] if you remember the the sides are open
[1:44:12] and it is electronically controlled when
[1:44:15] he would see hogs in the trap then the
[1:44:19] sides would go down and the pin would be
[1:44:22] locked up upon
[1:44:25] knowing that he had hogs in the trap he
[1:44:29] would respond immediately he would load
[1:44:31] the Hogs up and remove him out of the
[1:44:34] city there would not be any shooting of
[1:44:37] any hogs
[1:44:38] in the city limits he would take him to
[1:44:42] either a ranch who wants hogs or
[1:44:46] donate them to someone who would process
[1:44:48] the meat to feed the needy
[1:44:53] so what we have is somebody that has an
[1:44:58] alternative to the traps that hogs are
[1:45:01] obviously trap smart to and
[1:45:05] he we know him obviously he has a track
[1:45:08] record with us and he this is his offer
[1:45:12] to go ahead and do two weeks worth so
[1:45:14] we're talking $3500 in a couple of weeks
[1:45:17] to see if he can and and and what we've
[1:45:19] been told by other trappers is if he
[1:45:21] manages to get the those the mama hogs
[1:45:25] at her trap smart all of a sudden we're
[1:45:28] going to start catching other hogs and
[1:45:29] our traps as well
[1:45:30] no promises of course but that's that's
[1:45:32] the way the conventional wisdom in hog
[1:45:35] trapping so
[1:45:37] what what we are proposing to do and for
[1:45:42] your action tonight your your
[1:45:44] consideration in action tonight is to
[1:45:47] engage with with
[1:45:49] RMH
[1:45:51] exotics LLC LMNOP and
[1:45:56] to go ahead and do this in gorge ranch
[1:45:59] first now that said if this works and
[1:46:03] works out well that also consider going
[1:46:07] over to trophy oaks I don't want to
[1:46:08] forget trophy Oaks you know you rewind a
[1:46:10] couple of years and I stood in front of
[1:46:12] our wildlife management committee and
[1:46:14] said hey I know everybody's putting a
[1:46:16] spotlight on deer but they're having a
[1:46:18] problem in that neighborhood with hogs
[1:46:20] and it's gonna get worse everywhere and
[1:46:23] so this is something that I don't want
[1:46:26] to forget about trophy Oaks as well but
[1:46:27] I don't think it's I personally and
[1:46:29] recommending to you that we don't go
[1:46:31] whole hog on this and
[1:46:35] do both neighborhoods all at once until
[1:46:37] we see how this is working out and if
[1:46:39] it's if it's effective so that said the action says take action proposed and
[1:46:46] authorized city minutes to execute
[1:46:48] documents so Swee the services so I'll emphasize that what I'm asking you
[1:46:52] to do is to consider authorizing our
[1:46:54] city administrator to to
[1:46:57] contract on behalf of the city with Ryan
[1:47:01] Murphy for what you see here for two
[1:47:03] weeks see how it's going and see if we
[1:47:05] need to do it any further but also if
[1:47:07] it's working out there to also bring it
[1:47:10] over to the trophy oaks and try to get
[1:47:12] some of the Hogs that are over there and
[1:47:13] to put a bound on it I'd say that the
[1:47:17] you know we we have the wildlife
[1:47:20] management Advisory Commission money and
[1:47:23] it's for the deer we never use all of
[1:47:26] that what we put it in there but I think
[1:47:28] it would be prudent for us to say not to
[1:47:30] exceed ten thousand dollars of that of
[1:47:32] the money that's in there and I will
[1:47:36] tell you that we probably will most
[1:47:38] likely will not use all that money on
[1:47:40] the deer anyway so my recommendation for
[1:47:43] you to consider is to give her a give
[1:47:46] our city administrator the authorisation
[1:47:48] to execute these contracts to first
[1:47:51] start with with George ranch if it's
[1:47:53] working out well go to trophy oaks and
[1:47:55] to not exceed ten thousand dollars
[1:47:57] without coming back to you
[1:47:58] comments questions starting on the left
[1:48:01] side yes does he have to get a permit
[1:48:05] for this no no they're not there they're
[1:48:07] not game animals there you're not
[1:48:10] they're not game animal so okay Texas
[1:48:12] Parks and Wildlife okay
[1:48:14] I don't know if it's relevant to anyone
[1:48:17] else or whatever but I personally I'm in
[1:48:18] favor of it actually been favorite
[1:48:21] instead of the deer but
[1:48:23] would he be willing to provide the
[1:48:27] ultimate destination what do you share
[1:48:29] that with us just so we know if we're
[1:48:32] feeding or we're stocking somebody's
[1:48:34] game ranch
[1:48:35] can we ask him to provide that I don't
[1:48:38] see why not I don't think it's not make
[1:48:40] it part of the discussion because nobody
[1:48:42] really cared but yeah if you care we'll
[1:48:44] see what we do so we'll ask yes I think
[1:48:47] anything else nope
[1:48:48] [Music]
[1:48:51] yeah we got to get it figured out by the
[1:48:54] way this is a lot bigger deal than just
[1:48:57] the city of garden Ridge
[1:48:58] people want to blame the high school
[1:49:00] they want to blame the Vista Bridgewater
[1:49:02] pipeline the fact of the matter is it's
[1:49:03] a statewide problem
[1:49:06] and I think some of the people that are
[1:49:08] really concerned about it myself
[1:49:09] included need to start to engage with
[1:49:11] tpw about how we're gonna deal with it I
[1:49:14] have an access I have access to a
[1:49:16] hunting lease that's quite close to the
[1:49:18] city Garden Ridge with outside the city
[1:49:19] limits and I saw a sounder of hogs last
[1:49:22] weekend that was over 70
[1:49:25] and I couldn't get a clear shot out of
[1:49:27] and I'll admit it because they were in
[1:49:29] the brush
[1:49:30] so that's giving you an idea something
[1:49:32] of what's going on out there and I've
[1:49:33] never seen that before so this is
[1:49:35] absolutely insane
[1:49:40] that said this trying to figure this out
[1:49:43] has got to be our priority of if it
[1:49:45] means cutting back on deer trapping all
[1:49:47] those kind of things it they are far
[1:49:50] more destructive and far more dangerous
[1:49:51] and that needs to be our priority so I'd
[1:49:54] love to see this work and maybe it's
[1:49:57] something we can get to the state of
[1:49:58] Texas to help out I don't know just
[1:50:00] musing out loud here
[1:50:02] comments questions
[1:50:05] councilmen Bauer there is no ranch in
[1:50:07] the state of Texas gonna set hogs that's
[1:50:11] they've got enough of their own I'm only
[1:50:13] doing they will they will shoot them
[1:50:15] just like we should be shooting them as
[1:50:17] soon as they leave the city limits so
[1:50:18] only asking
[1:50:20] that's
[1:50:23] now my biggest concern right now is
[1:50:26] the Hogs have moved on we cannot attract
[1:50:31] those hogs back here it sits there
[1:50:32] that's their pattern that will bring
[1:50:35] them back so do we set up these pens
[1:50:37] right now and hope for the best
[1:50:39] or do we pay $500 a week and not catch
[1:50:42] anything for the next month or two until
[1:50:44] their pattern comes back this way again
[1:50:46] they're gone from here right now they're
[1:50:49] not going to come back because we start
[1:50:50] feeding they're off doing something else
[1:50:53] so we have to concern ourselves with in
[1:50:55] it and if they're gonna charge us 500
[1:50:58] dollars a week does that
[1:51:01] include a guarantee that they're gonna
[1:51:03] catch leaves catch some hog
[1:51:06] no there was no guarantee em okay well
[1:51:09] then uh we are did I take a real hard
[1:51:10] look at what no they're good I mean
[1:51:12] they'll be able to do it a pen like they
[1:51:15] have that's actually a short one so the
[1:51:16] deer can jump out is is probably the
[1:51:19] best way to to get a number of hogs at
[1:51:22] one time but I think we're a little bit
[1:51:26] premature if the dogs are not here now
[1:51:29] that's my thought yeah the the they're
[1:51:33] obviously the reason why they're that
[1:51:35] we're not seeing as many is because now
[1:51:37] there's water that's been rainin there's
[1:51:40] water there's greenery there's there's
[1:51:42] something for them to eat and drink
[1:51:44] that's not in the lush green yard so
[1:51:47] yeah we're not seeing as many of them we
[1:51:50] can research that and see if they if
[1:51:52] we're not seeing any at all then maybe
[1:51:53] we shouldn't be doing this I don't know
[1:51:55] I first a trophy Oaks we have not seen a
[1:51:57] hog in that neighborhood for about two
[1:51:59] years that's not know I do know that my
[1:52:02] friend Dale and everybody knows him has
[1:52:04] had his mulch fluffed up but I don't
[1:52:07] think there's been any damages well
[1:52:09] we've caught hogs out right outside and
[1:52:12] the entrance and I mean that's what that
[1:52:14] pen is is to try to prevent him from
[1:52:16] getting into the neighborhood so and we
[1:52:18] have caught hogs there yes yes mr.
[1:52:22] Simonds how how recent do you happen to
[1:52:24] know if top of your head
[1:52:28] he's off mic but he said September yeah
[1:52:32] I know that we've caught we've got some
[1:52:34] just recently yeah
[1:52:35] and and that's the the pen that's kind
[1:52:38] of the
[1:52:39] mitigation pen to try to keep him from
[1:52:42] going into that neighborhood from from
[1:52:44] the quarry area
[1:52:46] so what no you bring up a good point and
[1:52:48] I and I I don't know I don't know if
[1:52:50] they're gone for good
[1:52:53] well I don't mean gone for good for the
[1:52:55] I mean gone for good for wow it's
[1:52:56] raining and Wow you know our green yards
[1:52:59] are not much is it attractant to him but
[1:53:04] we can find out
[1:53:09] all I was going to add is when I spoke
[1:53:13] with mr. Murphy he asked when the last
[1:53:15] time we saw the Hogs I let him know
[1:53:17] he said they will be back once it gets
[1:53:20] cold and the the vegetation starts dying
[1:53:25] off they're going to probably come back
[1:53:28] in where there's still some vegetation
[1:53:31] within the city I
[1:53:34] had the same concerns as Brian on timing
[1:53:38] and guarantee I mean I'd hate first to
[1:53:40] put it out you know spend $3,500 and our
[1:53:45] timing be all off and not catch any the
[1:53:47] Hogs so I mean I thought that's part of
[1:53:49] my concern and I guess longer-term
[1:53:53] do we just keep catching honks I mean
[1:53:56] catching more honks I mean how do we
[1:53:57] prevent the Hogs I mean I know there's
[1:53:59] been some talk about fencing and George
[1:54:02] ranch I mean not that's not a city issue
[1:54:04] per se but
[1:54:07] where does it end
[1:54:12] like Todd said he saw 75 in one group
[1:54:15] and they multiplied every female
[1:54:18] multiplies it at least twice a year if
[1:54:21] not three and they'll have between 8 and
[1:54:23] 10 babies and it takes them about those
[1:54:25] babies about 9 months before they could
[1:54:27] start having their own so the numbers I
[1:54:29] mean you can
[1:54:31] amazing what you can come up with so you
[1:54:34] talk to a rancher or you talk to a
[1:54:36] farmer that has this problem and they
[1:54:37] don't go well I'm not going to kill them
[1:54:38] because where does it end they kill them
[1:54:41] it's just
[1:54:45] maybe the long term as we keep killing
[1:54:47] them
[1:54:48] I did a little research on it TPWD right
[1:54:53] now is saying that if you bring ten hogs
[1:54:54] into the room right now to keep the
[1:54:56] population where it's at currently you
[1:54:59] got to take out seven over yeah a 70%
[1:55:01] rate that's ridiculous now I had a
[1:55:04] question I'm sorry I'm going on a turn
[1:55:06] here a little yeah so we'll come back to
[1:55:07] you okay
[1:55:10] as far as the timing of it I think we
[1:55:14] can leave it to Ryan Murphy to put him
[1:55:17] out when he thinks the best time one
[1:55:20] thing that did I was thinking about
[1:55:24] I've got a lease and every once in a
[1:55:26] while you know I meet this guy it's got
[1:55:29] corn and but it's out in the country and
[1:55:33] I'll throw vegetables
[1:55:36] apples whatever to vary the the diet and
[1:55:42] it they
[1:55:43] they're I guess it's like trick or treat
[1:55:46] they come back to see what they can find
[1:55:48] because I've had pretty good success
[1:55:51] freshly with the Hogs but
[1:55:53] you know one citizen mentioned acorns
[1:55:58] and we got some acorns over there and
[1:56:00] we've got a whole lot of pumpkins we
[1:56:02] could use and I've got some leftover
[1:56:04] Snickers that we could use I know
[1:56:05] they'll love those
[1:56:07] but I think I
[1:56:10] would be really interested in working
[1:56:13] with him and just let him use his
[1:56:14] judgment because it's obviously better
[1:56:17] than most of ours
[1:56:19] [Music]
[1:56:21] okay so reattached starting left side
[1:56:23] anybody good
[1:56:26] I'm kind of with what John was asking
[1:56:28] I'm wondering how responsive can he be
[1:56:30] did we wait till the next time we see
[1:56:32] hogs in the city and he comes out the
[1:56:33] next day and pops traps up I don't know
[1:56:35] if he's that responsive that's really my
[1:56:37] question I
[1:56:40] would ask that question yeah clearly
[1:56:43] she's not representing him she doesn't
[1:56:45] know
[1:56:46] anything else sir yeah okay so what
[1:56:52] going to item number two what does
[1:56:55] council want to do
[1:57:02] like I
[1:57:04] think we ought to probably go ahead and
[1:57:07] ask him to put up these pens
[1:57:10] he can keep them with corn in them again
[1:57:13] if they're low Pence one hog panel high
[1:57:17] then the deer can jump out and when he
[1:57:19] sees them starting to accumulate hogs in
[1:57:23] them and started back up again but and
[1:57:26] just leave them open leave they leave
[1:57:27] the door open
[1:57:28] until we started having hogs come in
[1:57:32] okay so but no motion don't kick in the
[1:57:37] $500 a week until we know we have the
[1:57:39] hog sure back
[1:57:41] okay so what's your motion
[1:57:45] does anybody have emotional where am I
[1:57:48] going to move on to item number 10 be go
[1:57:50] ahead then list him to set up the pins
[1:57:52] at this point and then ask him what he
[1:57:54] thinks about
[1:57:56] when he's gonna start charges and we
[1:57:58] know not gonna pay until we start seeing
[1:58:00] hallelujah
[1:58:02] okay so really or is it you're not
[1:58:04] really emotion it's not and also you're
[1:58:06] making an assumption that he's willing
[1:58:08] to set up the pens and then not start
[1:58:10] the $500 a week
[1:58:12] and that's a pretty substantial fee for
[1:58:15] setting up a pen I agree but
[1:58:18] he didn't split it out and say then he
[1:58:20] wasn't gonna do anything so he said he
[1:58:23] wanted a two-week minimum once he put
[1:58:25] the pens up is what it is
[1:58:28] so again what do y'all want to do wasn't
[1:58:32] the issue to authorize Nancy to
[1:58:34] negotiate with him yes okay the correct
[1:58:36] that we authorized the city
[1:58:38] administrator Nancy came to negotiate
[1:58:44] putting up hog traps
[1:58:46] okay does that cover it it sort of but I
[1:58:50] also want to talk about because you've
[1:58:52] got the authority on the money as well
[1:58:54] so what I suggested was putting a cap
[1:58:57] and saying it was coming from the
[1:58:58] wildlife management Advisory Commission
[1:59:00] budget
[1:59:01] okay I have no fat I have no problem
[1:59:04] doing that but I think we ought to table
[1:59:06] this until Nancy gets taku okay so we're
[1:59:08] gonna wait another month yes
[1:59:14] okay that's what one council person says
[1:59:17] so what does council want I
[1:59:21] think we need to talk authorised Nancy
[1:59:25] to do it with limit of let's say no more
[1:59:28] than ten thousand dollars but it doesn't
[1:59:30] have to be done tomorrow or next week
[1:59:35] she's done a lot of negotiating some
[1:59:39] sure she's tough but what I'd like to do
[1:59:42] is leave it
[1:59:43] with her and Ryan to set them up when
[1:59:48] they think is the best time to do it we
[1:59:51] can go more than a ten thousand dollar
[1:59:54] maximum so is what is your motion to
[1:59:57] allow her to negotiate yes to use ten
[1:59:59] thousand dollars out of the wildlife
[2:00:00] management advisory commission budget
[2:00:02] something like that yes yes okay good so
[2:00:07] that's what I have promotion authorized
[2:00:08] City Administrator to work with RMH
[2:00:11] exotics to
[2:00:13] determine when the best time is to put
[2:00:17] these traps up and put some traps up and
[2:00:19] to not exceed ten thousand dollars using
[2:00:22] it out of the wild night budget can I
[2:00:24] get a second place to the second now um
[2:00:29] further discussion one thing I want to
[2:00:31] say is thank you for the vote of
[2:00:33] confidence to our city administrator
[2:00:35] about the negotiation and fact is this
[2:00:39] is not his regular price she's already
[2:00:41] negotiated it down to this
[2:00:43] because we already do business with him
[2:00:45] etc etc so yeah he normally charges
[2:00:49] considerably more to do this yes astute
[2:00:52] observation she is she is skilled at
[2:00:56] negotiating and she did exactly that on
[2:00:58] behalf of the city so I have a motion
[2:01:00] place four and a second from place two
[2:01:03] any further discussion starting left
[2:01:05] side
[2:01:09] [Music]
[2:01:12] okay all in favor of authorizing city
[2:01:16] administrator to to work this and to
[2:01:19] execute this with our mhm exotics not to
[2:01:22] exceed $10,000 how I might buzz it say
[2:01:25] aye
[2:01:27] and any opposed it was unanimous thank
[2:01:31] you very much and we'll keep you posted
[2:01:33] okay moving on to item 10
[2:01:36] b1 its discussion take action and
[2:01:40] possible retention of a public
[2:01:41] information officer okay so bringing you
[2:01:45] this not necessarily for action right
[2:01:48] now but more of a discussion and to see
[2:01:50] if you want us to continue in this
[2:01:52] direction we are having lots of issues
[2:01:55] with with
[2:01:58] stuff going out on social media people
[2:02:02] engaging the the print and news
[2:02:04] different news media that we have to
[2:02:06] answer questions that that are based on
[2:02:10] a whole lot of misinformation
[2:02:13] you know we have we if we had a public
[2:02:16] information person whether it was
[2:02:19] part-time or contractor part-time you
[2:02:21] know like a half time kind of person we
[2:02:23] don't have to do we it would we could
[2:02:25] afford something like that in the budget
[2:02:26] a full-time person is another story but
[2:02:28] or even a contractor that we could do
[2:02:32] things like when when you I don't know
[2:02:35] if you're aware of this but you all got
[2:02:37] beat up because you didn't want to hear
[2:02:38] from your constituents in the city
[2:02:41] because people were writing to you based
[2:02:44] on what somebody put on social media
[2:02:46] there's your email address and it was
[2:02:47] wrong email address and finally somebody
[2:02:50] realized it was the wrong email address
[2:02:51] but if we had a Pio so that person could
[2:02:54] intervene right then and say hey
[2:02:55] everybody that's the wrong email address
[2:02:56] don't be don't be saying that they don't
[2:02:58] want to hear from you they just using
[2:03:00] the wrong email address so there's lots
[2:03:02] of situations incidents that I could
[2:03:05] bring up anecdotally but the fact of the
[2:03:07] matter is is it's maybe time for us to
[2:03:10] consider having somebody help us with
[2:03:12] the message as well as the delivery as
[2:03:14] well as addressing social media and
[2:03:16] social media
[2:03:17] I want to call it fake news but
[2:03:20] inaccuracies and all of those kind of things so again
[2:03:26] this is not to necessarily do any
[2:03:29] contracting or hiring or anything but I
[2:03:32] just wanted to get that bring this out
[2:03:34] for a discussion because we can't talk
[2:03:37] about this any other time than in the
[2:03:38] meeting so I wanted to kind of throw
[2:03:41] that that Chum out and then see what you
[2:03:43] all think about what we could do and
[2:03:46] then we will move if you want us to and
[2:03:49] it doesn't have to be a vote it can be a
[2:03:50] consensus we can move excuse-me forward
[2:03:53] with some more information options bring
[2:03:56] back to you next month so starting over
[2:03:58] on the right side thoughts on this
[2:04:03] well I've got mixed feelings on it
[2:04:06] theoretically we shouldn't need it but
[2:04:09] the frustration is that
[2:04:12] there is so much misinformation and
[2:04:17] one you know they're there all kinds of
[2:04:21] examples so I won't go into them because
[2:04:23] I think most of you have heard them but
[2:04:26] I'm I'm not opposed I just don't like us
[2:04:31] having to do it
[2:04:35] any and and while you're and I'm really
[2:04:38] very interested in what all of you think
[2:04:40] about the approach on whether you know
[2:04:43] we try to do contractor or we do a
[2:04:46] part-time person again we won't be able
[2:04:49] to not in the budget right now to be
[2:04:51] able to hire a full-time person to do it
[2:04:52] but but we could you know remember a
[2:04:54] part-time person
[2:04:56] is no benefits and that kind of thing
[2:04:59] and it helps helps the help some budget
[2:05:02] quite a bit so any thoughts on any of
[2:05:04] that
[2:05:05] councilman will call I
[2:05:08] would hope we wouldn't need more than a
[2:05:11] part-time person and I think it's a good
[2:05:14] idea either contract or well
[2:05:18] contract or if we have some an employee
[2:05:22] that could do other things also
[2:05:26] an employee I mean hiring another
[2:05:28] employee well because well with the
[2:05:32] employees we have don't have the
[2:05:34] bandwidth to be doing this - I
[2:05:35] understand that's why I'm saying it
[2:05:38] would be like if we need an assistance
[2:05:40] somewhere they could possibly
[2:05:43] do two jobs at once not you I don't want
[2:05:47] to take have some of our people
[2:05:50] currently adding this because it could
[2:05:54] turn out to be substantial
[2:05:56] but and remember I would look part time
[2:06:00] yes sir and and to make sure that I I
[2:06:03] hope I didn't mislead you I'm not saying
[2:06:05] this is just not watching social media
[2:06:07] and answering it's a message it's it's all of the things that are about
[2:06:14] our message and about our outreach it's
[2:06:17] you know
[2:06:18] the messaging and the message on our
[2:06:21] website and all of that stuff so it's not just sitting there and
[2:06:26] monitoring Facebook and and next door
[2:06:29] and answering it that's not what I'm
[2:06:30] suggesting
[2:06:31] anything else
[2:06:36] I'm this is something I'm definitely for
[2:06:39] and I think it's you know again beyond
[2:06:42] just kind of addressing misinformation
[2:06:44] it's also getting out
[2:06:46] positive information about the city it's
[2:06:48] about publicizing city events is about
[2:06:50] working with Commission's something that
[2:06:53] Jesse and I've talked a lot about is
[2:06:54] educating the citizens about the water
[2:06:57] rates you know how do we present that to
[2:06:58] the public how do we put it on the
[2:07:00] website are there's brochures that we
[2:07:02] can put together that would help our
[2:07:03] citizens understand those kinds of
[2:07:05] things a gonna be issue with how do we
[2:07:07] educate the people about why we make the
[2:07:09] decisions about the deer you know how do
[2:07:12] we help the citizens get to know who our
[2:07:14] volunteers are or what our Commission's
[2:07:16] actually do so they may want to attend
[2:07:19] so there's this whole positive spin to
[2:07:21] things too and you know the
[2:07:23] misinformation part for me is mostly
[2:07:26] about not taking up everybody else's
[2:07:28] time all the city staff having to answer
[2:07:30] the phone or you know having to I just
[2:07:34] get so bogged down and all that you know
[2:07:37] the negative misinformation then the you
[2:07:39] know the the false information so I mean
[2:07:41] I think there's two sides of this and I
[2:07:43] think that positive side is there would
[2:07:45] be a real benefit to the city
[2:07:49] great thank you anything else sir I
[2:07:54] can need I can see the need with I just
[2:07:58] have to wonder if a public relations
[2:08:02] individual
[2:08:04] have we grown that much so we actually
[2:08:06] need one I don't know what the answer is
[2:08:09] it's that's that's another employee we
[2:08:12] still have to staff the police
[2:08:13] department fully
[2:08:14] which I think it should be a priority
[2:08:16] over a public relations officer or
[2:08:19] individual
[2:08:20] it is that what you're talking about
[2:08:23] leasing is necessity it really is those
[2:08:27] are my thoughts yes sir and and that's
[2:08:30] why I'm also throwing out the option of
[2:08:33] having it be a contractor or a part-time
[2:08:36] person something that it keeps to write
[2:08:38] the cost down considerably
[2:08:40] sir
[2:08:42] okay and I love the discussion that's
[2:08:46] going on up here because this is in my
[2:08:48] mind supposed to be a positive event we
[2:08:51] have things happen in the city we have
[2:08:53] things going on
[2:08:55] we have city council meetings every
[2:08:58] month oftentimes it's five or six people
[2:09:00] come to the city council meetings
[2:09:01] something then comes up and everybody
[2:09:03] screams well I didn't know and it's been
[2:09:05] on our Facebook page it's on the city
[2:09:07] council meeting minutes it's now going
[2:09:08] out on YouTube people can review that
[2:09:10] and they still don't know so I view a
[2:09:12] public information officer as another
[2:09:15] venue to communicate through a way to
[2:09:17] expand our communications
[2:09:19] the communication cycle now in the world
[2:09:22] is very very fast as we all know and
[2:09:24] like like councilman Councilwoman swin
[2:09:27] said some of our city employees are
[2:09:29] getting beat up by folks it may be beat
[2:09:32] ups not the right question right term
[2:09:34] but they're getting bogged down in
[2:09:36] people calling up coming in doing
[2:09:37] Freedom of Information Act requests
[2:09:39] demanding information about something
[2:09:41] that somebody posted online that's
[2:09:42] outright false or misleading or
[2:09:45] incomplete datasets or cherry pick data
[2:09:47] sets or quite frankly just a false
[2:09:49] personal attack that's been made up and
[2:09:51] with the intent of harming somebody
[2:09:53] that's the kind of thing I'd like to
[2:09:55] address with this
[2:09:56] is to be able to just not go after the
[2:10:01] person who's doing it but here's the
[2:10:02] actual facts folks so before you pick up
[2:10:04] the phone and call the city who I can
[2:10:06] look at the next-door thread and go oh
[2:10:07] they're not actually currently doing X Y
[2:10:09] or Z and put out fat base straight-up
[2:10:12] information and that's it
[2:10:15] [Music]
[2:10:16] I think either a contractor or a
[2:10:19] part-time employee whichever is the most
[2:10:21] reasonable price for the performance
[2:10:23] would be the way to go with it and it's
[2:10:26] like I said when I started talking here
[2:10:28] it's another way to communicate with
[2:10:30] people a lot of folks are getting a lot
[2:10:31] of their information off of these
[2:10:33] different online media and I think we
[2:10:36] need to we're gonna have to engage on it
[2:10:37] it's we get behind the information cycle
[2:10:39] and also that you're you're battling
[2:10:41] uphill
[2:10:43] Pam I
[2:10:45] totally support the idea I think our
[2:10:48] staff is is overwhelmed not nothing
[2:10:51] today or discredit it's just an awful
[2:10:53] lot has asked to them I think the idea
[2:10:55] of a Pio would be that person would be
[2:10:59] not only proactive in being positive for
[2:11:03] the city but also reactive when when
[2:11:06] negative is out there or just to clarify
[2:11:07] I mean people can legitimately
[2:11:10] misunderstand an issue it doesn't mean
[2:11:12] there's a problem I also see this as
[2:11:14] potential for marketing the future
[2:11:17] development and that person could be in
[2:11:19] place to bring them along to know okay
[2:11:23] this it's much like what mr. Lancia I
[2:11:25] discussed last year you know creating a
[2:11:28] marketing plan if you will and I think
[2:11:30] the i/o officer would be key to that and
[2:11:32] I think it should be a contract person
[2:11:35] who has a capacity to grow with the city
[2:11:42] okay that's all great and I appreciate
[2:11:45] all those thoughts but as you heard
[2:11:47] other people speak maybe something else
[2:11:49] came to mind so I actually want to go
[2:11:51] back to the right and see if there's
[2:11:52] anything else you want to add before I
[2:11:54] before we move forward
[2:11:57] no the only thing that I would add is
[2:11:59] but
[2:12:01] was added to what I said so I'm fine I
[2:12:06] totally agree
[2:12:07] [Music]
[2:12:08] ma'am sir let's keep it to a part time
[2:12:12] and I'm agreeable to it
[2:12:17] okay so again we don't have to have a
[2:12:20] vote on this but I did want to get a
[2:12:21] consensus that we will move forward with
[2:12:26] exploring the options of either finding
[2:12:28] somebody that can do this as a with the
[2:12:29] contract or as a part-time person and it
[2:12:33] will we'll get closer to this and over
[2:12:36] and I don't know if we can get it done
[2:12:38] in the next 30 days to bring you some concrete options but at least we'll
[2:12:45] get closer to it now that we know that
[2:12:46] we're not moving towards something that
[2:12:48] you don't want us to do so this is this
[2:12:50] was been great thank you for for those
[2:12:53] ideas and for those thoughts
[2:12:57] it's gain anything to add to this
[2:13:00] okay great
[2:13:02] anybody have anything else on this all
[2:13:04] right moving on to item number 10 C
[2:13:07] garners market days discuss status and
[2:13:10] monthly activity and I want to first
[2:13:14] offer up to Councilwoman sweat she's
[2:13:16] been
[2:13:18] heading this thing up so she's got some things she wants to to talk about
[2:13:23] actually we have on our market manager
[2:13:26] Kim wood here today to give the update
[2:13:29] on the market we've sort of taken the
[2:13:31] approach that this is kind of like like
[2:13:33] a startup business so we had did a
[2:13:35] little SWOT analysis that she's gonna
[2:13:37] present so we can kind of get a baseline
[2:13:39] for where we're at now that we've got a
[2:13:41] professional on board
[2:13:47] for some button
[2:13:49] no you need to turn the mic on turn the
[2:13:51] mic on
[2:13:53] sorry new at this very Amer hi
[2:13:57] so yes thank you for that introduction
[2:14:00] Lisa I'm Kim wood and do have some
[2:14:04] experience with this stuff I ran a
[2:14:06] marketing company and events company for
[2:14:09] over eight years and have my degree in
[2:14:12] marketing and public relations so it's a
[2:14:14] pleasure to be here you're in good hands
[2:14:16] and I'm very excited to be here and
[2:14:18] represent the Garden Ridge Market days
[2:14:20] so and like Lisa said we pulled together
[2:14:24] a SWOT analysis so that you all would
[2:14:26] have a better idea of what's going on
[2:14:27] with the market right now and the
[2:14:30] present strengths and weaknesses of the
[2:14:32] market so that we can make decisions
[2:14:33] moving forward with that
[2:14:37] so I will just get right into that the
[2:14:40] strengths that we have going on with
[2:14:42] market days right now we have a very
[2:14:44] loyal customer base with visitor counts
[2:14:47] from around 2000 around 2000 since we
[2:14:50] started the market back in May there's a
[2:14:53] high level of interest from vendors and
[2:14:55] a variety of products that they're
[2:14:56] offering and they're from all over San
[2:14:58] Antonio and the surrounding cities we
[2:15:01] have 50 vendors this month which is
[2:15:03] almost double the size of previous
[2:15:05] months so we're doing quite well growing
[2:15:08] the market
[2:15:09] and it's we're steadily increasing the
[2:15:12] earning earning income every month with
[2:15:14] the market as well we're expanding the
[2:15:16] vendor pool and we're projecting close
[2:15:19] to 1500 dollars in vendor fees for this
[2:15:22] month alone
[2:15:23] some of the weaknesses going into that
[2:15:26] there is limited space in the city hall
[2:15:29] parking lot
[2:15:30] so that is where we obviously host the
[2:15:33] market but because we are growing in
[2:15:35] vendors we actually have to cap the
[2:15:37] number of what we're currently at which
[2:15:39] is the 50 so we cannot at this point
[2:15:42] accommodate a growing vendor waitlist
[2:15:45] that we do have a little bit of a lack of
[2:15:49] capital here at the start
[2:15:51] there is no real money to invest in
[2:15:54] extensive marketing at this time or
[2:15:57] other activities that we could add to
[2:15:59] the market things to generate people
[2:16:01] coming in and interest in the event is
[2:16:04] very important obviously to keeping
[2:16:06] something like this going so
[2:16:09] and
[2:16:11] the other thing is we don't have a lot
[2:16:13] of volunteers at this time we're
[2:16:15] obviously working on that and like we
[2:16:16] mentioned earlier that is a over what an
[2:16:19] overall city you know issue that we have
[2:16:21] so it's not just us obviously
[2:16:23] the opportunities that we have the
[2:16:25] demographics of the guard of Garden
[2:16:27] Ridge itself are changing and the
[2:16:29] majority have expressed an interest in
[2:16:31] retail offerings so we're providing that
[2:16:33] and able to act on that as a stopgap
[2:16:37] measure through the market the city is
[2:16:39] able to serve as an incubator for small
[2:16:41] local businesses ma'am ma'am I don't
[2:16:44] mean to interrupt you
[2:16:46] we are off the agenda
[2:16:49] for what we should be talking about I
[2:16:52] believe
[2:16:57] what is we are serving the purpose of
[2:17:01] this right now is to get a status of it
[2:17:02] and because
[2:17:08] so to get it to get a status and to
[2:17:13] discuss some of the things that
[2:17:14] councilman Swint thinks that that y'all
[2:17:17] need to make some decisions on having a
[2:17:19] guest speaker and having our
[2:17:22] [Music]
[2:17:23] contracted manager speaking right now
[2:17:25] was not on the agenda yeah I was not
[2:17:27] told that you were gonna have this
[2:17:29] presentation and
[2:17:32] so but I've been I've been sitting here
[2:17:35] letting it go so you need to wrap this
[2:17:38] okay
[2:17:41] the market in my opinion is very
[2:17:44] it's growing rapidly and it is a big
[2:17:47] deal it is a big issue discuss we have
[2:17:48] over seventy thousand people on
[2:17:52] social media that have already
[2:17:53] recognized just the one November market
[2:17:56] coming up right now we have over 3,000
[2:18:00] RSVPs to that market and that is more
[2:18:03] than we've had for the last markets all
[2:18:04] combined since May so I do think it's an
[2:18:07] important issue to address
[2:18:09] the threats that you were mentioning
[2:18:11] that we do need to discuss I'm sure that
[2:18:14] was the next thing at least I can
[2:18:15] address those so that I can wrap it up
[2:18:17] it's councilman's went by the way
[2:18:19] excuse me no no Kim I apologize for the
[2:18:23] mayor he's treated you completely rudely
[2:18:26] up here if there was somebody who's at
[2:18:28] fault it's me apparently
[2:18:31] Kat knew there there are plenty of
[2:18:33] people that knew up here that she was
[2:18:35] going to be presenting
[2:18:37] so let's review
[2:18:41] who's meeting is
[2:18:44] yes I know so if you're gonna have
[2:18:46] somebody come in and speak to this body
[2:18:48] you need to let me know it's not on the
[2:18:51] agenda nobody has said anything to me
[2:18:53] about it and you're given and you're
[2:18:56] looking you're looking at one of our
[2:18:57] employees put the agenda together we
[2:19:00] will talk about when I sent the message
[2:19:03] to you and Nancy I said I'd like her to
[2:19:05] speak
[2:19:06] Nancy do you remember me saying that in
[2:19:08] the email so let's move on uh-oh I'm
[2:19:11] cutting my hole cut the whole deal
[2:19:13] let's move on is there anything that you
[2:19:16] want to bring to council on
[2:19:19] gardeners market days so let's for the
[2:19:22] record let's talk about a few things
[2:19:23] because it's very important right
[2:19:28] now on social media the hours have been
[2:19:32] changed for the amount of the market is
[2:19:35] that correct the council did not approve
[2:19:43] there has been an expenditure on the
[2:19:47] market that the council did not approve
[2:19:48] which is that correct ma'am is that
[2:19:51] correct which expenditure the the
[2:19:53] expenditure of hundred and something
[2:19:56] dollars that your market manager
[2:19:58] expanded that now we're talking about
[2:20:00] that we need to we need to reimburse her
[2:20:02] for that was not that is that is money
[2:20:05] that the market does not have its money
[2:20:08] $1,800 than its account but we don't
[2:20:11] have the money to run the market and to
[2:20:12] pay them our managers incorrect no we do
[2:20:15] so then why haven't we paid the market
[2:20:18] manager we can't pay the market manager
[2:20:21] okay the market manager has been paid so
[2:20:24] Andy do you understand what he's saying
[2:20:28] your note to me was that we have a
[2:20:32] market manager that spent money that was
[2:20:35] not an authorized expenditure is that
[2:20:37] correct or incorrect the market manager
[2:20:39] prepaid for some things and on my list
[2:20:43] as you know is a request for some seed
[2:20:46] money or some
[2:20:47] what did I write down or a line of
[2:20:50] credit or something that we can borrow
[2:20:51] against because what we're doing is
[2:20:53] we're spending money and then we are
[2:20:55] waiting for vendor fees to come in and
[2:20:58] going back and paying things
[2:21:01] we're operating in arrears
[2:21:04] so to review we're spending money that
[2:21:08] we don't have that was not authorized by
[2:21:11] the council we're changing the hours
[2:21:13] without being authorized by the council
[2:21:15] we're asking for extra money no special
[2:21:18] said I let me finish and we're asking
[2:21:20] for extra money when the council said
[2:21:23] that they were going to seed this for
[2:21:25] three months and then it needed to be
[2:21:27] the count of the market needed to be
[2:21:30] self-sufficient if you are if if you or
[2:21:34] anybody are authorizing changes to what
[2:21:37] the council has authorized and then
[2:21:40] bringing it the council to ask for the
[2:21:42] approval after if the changes have been
[2:21:44] made I
[2:21:46] have a problem with that well I disagree
[2:21:50] with your representation of things half
[2:21:53] the hours been changed the hours have
[2:21:55] not officially been changed is it on
[2:21:58] social media saying what the hours are
[2:21:59] it is on my list and we do okay am I
[2:22:03] allowed to talk or no go ahead I
[2:22:07] had this discussion with you and I told
[2:22:11] you that we specifically designed the
[2:22:13] banners
[2:22:15] with the times off of them because we
[2:22:18] did not want to commit to the hours I
[2:22:20] did say that Kim put out some time on
[2:22:24] social media and I have caught that it
[2:22:27] is on my list to ask council about that
[2:22:31] it is at the vendors request that we
[2:22:33] extend the market by an hour
[2:22:38] Jim announced on
[2:22:42] it's been announced by our to the
[2:22:46] council approving it that's that's a
[2:22:48] very important thing okay nobody on
[2:22:51] staff nor I will will ever get in front
[2:22:54] of the decisions of Council and then
[2:22:56] hope that when we come in Council will
[2:22:58] say yes that's all right we talked about
[2:22:59] that Oh correct when I told you I made a
[2:23:02] mistake but now you're saying what
[2:23:04] didn't what happen no I didn't say that
[2:23:06] where did I say that I said it went out
[2:23:08] on social media and I said I should have
[2:23:10] caught it all right so so instead of
[2:23:13] arguing and we're gonna just move on and
[2:23:16] what do you need from Council on this
[2:23:20] Garden Ridge market days
[2:23:24] what do you need
[2:23:27] what do I need for
[2:23:30] my list was a request to change ours to
[2:23:36] add an additional hour at the request of
[2:23:38] the vendors
[2:23:42] what else
[2:23:44] mom let me go through the list
[2:23:46] again our budget is three hundred and
[2:23:49] seventy five dollars I was going to a
[2:23:53] request that we take some things off the
[2:23:55] budget including $100 expense that is on
[2:23:58] our budget too slowly by our own set of
[2:24:01] table and chairs from the community
[2:24:03] center it's come to my attention that
[2:24:06] there probably some months that we don't
[2:24:08] even have access to those tables and
[2:24:10] chairs and that we could probably buy
[2:24:12] them cheaper on my own or on our own and
[2:24:15] that would take one hundred dollars out
[2:24:17] of the budget a month it's also come to
[2:24:20] my attention that when the market
[2:24:21] started we also we used to have
[2:24:25] parks and I'm sorry our public worst
[2:24:27] person there for blocka time from 7 to 9
[2:24:30] and then the last hour that would also
[2:24:34] help us cut down on the expenses and
[2:24:38] some more money back into the budget
[2:24:40] that would be a total of 185 dollars
[2:24:42] back into the budget
[2:24:44] so those were two things so wait a
[2:24:48] minute make sure we understand what
[2:24:51] you're asking you're asking for the city labor to work less at the
[2:24:58] market correct that's what we initially
[2:25:00] started in to reduce costs okay so
[2:25:05] specifically how much how many hours are
[2:25:07] they working now and how many hours do
[2:25:08] you want them or they're working
[2:25:10] six hours now we only need them for
[2:25:13] three
[2:25:15] and we know those three hours seven to
[2:25:19] nine and the last hour of the day so you
[2:25:22] want them to come in work for a couple
[2:25:24] hours go home and then come back for an
[2:25:27] hour we initially did
[2:25:29] you didn't have a problem with it then
[2:25:33] that was when that City was paying for
[2:25:36] the whole thing but that's that's a tall
[2:25:39] order to ask somebody anybody to leave
[2:25:42] and come back a couple hours later and
[2:25:44] work for one more hour and working work
[2:25:45] on getting it covered with volunteers
[2:25:48] okay what else
[2:25:54] I'm again if I can reduce some of the
[2:25:57] expenses I won't ask for the seed money
[2:25:59] because obviously that's a sticking
[2:26:01] point what expenses are you gonna reduce
[2:26:04] I just told you if we could take the
[2:26:05] tables and chairs the $100 off of our
[2:26:08] list so how are you gonna get tables and
[2:26:10] chairs we will temporary borrow
[2:26:13] temporarily borrow them from the
[2:26:16] community center or being asked it paid
[2:26:18] to use the tables and chairs from the
[2:26:20] community center and as I recall the
[2:26:23] discussion in here the reason for paying
[2:26:25] for them was because it puts wear and
[2:26:28] tear on the community centers equipment
[2:26:31] that now you're just gonna put wear and
[2:26:34] tear on it and they're not going to have
[2:26:36] the ability to be able to replace those
[2:26:37] chairs tables as to wear and tear so
[2:26:40] you're asking for the city to basically
[2:26:42] donate the tables and chairs no sir
[2:26:44] borrow them temporarily until we can
[2:26:46] afford our own I'm not sure why you're
[2:26:49] making everything so difficult
[2:26:51] okay what else
[2:26:54] that's it
[2:26:57] okay so what you're looking for is a
[2:27:01] change of the hours and you you want to
[2:27:04] ask them to bring somebody in and then
[2:27:06] let them go and come back and you want
[2:27:09] the city to loan the tables and chairs
[2:27:12] for
[2:27:13] how long
[2:27:15] I'll let say three months
[2:27:20] and the other things that you wrote were
[2:27:22] about money getting more money
[2:27:25] is that off the table now
[2:27:30] okay
[2:27:32] and you also wrote about the location is
[2:27:36] that off the table now well I know it's
[2:27:38] something that it's not gonna be
[2:27:40] considered
[2:27:42] okay
[2:27:44] all right Nancy so I'm gonna see has her
[2:27:49] hand up yeah and go ahead which game
[2:27:52] when we bring an employee in it's a
[2:27:55] minimum of two hours at a time
[2:27:57] I'm call that still find you that's
[2:27:59] still less than six hours
[2:28:02] so you're gonna send them away for one
[2:28:04] hour and have them come back for two
[2:28:06] hours
[2:28:07] to save an hour's worth of labor hours
[2:28:11] well depending
[2:28:15] okay and maybe we don't then maybe we
[2:28:18] ask for Steve money I mean I'm not sure
[2:28:22] Lee I'm not sure why I've got to beg
[2:28:24] borrow
[2:28:25] B and you're not begging and borrowing I know I know you that's what you
[2:28:31] think's going on right now but the
[2:28:32] problem is is I'm sitting here
[2:28:35] with in minutes and what council
[2:28:39] approved and watching what's happening
[2:28:41] and they're not the same thing and I I
[2:28:44] told you that's a problem and so you I'm asking you to understand that
[2:28:54] counsel made the decision on this seeded
[2:28:58] this for three months said that it was
[2:28:59] going to be
[2:29:02] self-sufficient and
[2:29:04] now we're moving this target I'm just
[2:29:09] holding the line on what council said
[2:29:10] now councils here and that's why we're
[2:29:12] talking about it here and if they want
[2:29:13] to change change this it's their
[2:29:15] prerogative and I have no vote in this
[2:29:17] but but it's it is a problem to spend
[2:29:22] money that the council has not approved
[2:29:25] it's a problem to advertise a change in
[2:29:30] a in a city activity that the council
[2:29:32] did not approve and that's why you're
[2:29:35] perceiving it as being difficult but I'm
[2:29:38] just telling you that we need to stick
[2:29:39] with with what y'all y'all you're part
[2:29:42] of it decide well our interpretation of
[2:29:45] things are slightly different okay
[2:29:49] ma'am oh and the other thing that I will
[2:29:53] tell you that I don't know if it's been
[2:29:56] brought to your attention but this next
[2:30:00] market is is and this is not my
[2:30:03] declaration but this next market is the
[2:30:06] last time that cats gonna be working
[2:30:08] which is significant because she's she
[2:30:11] is spent a lot of time she's actually
[2:30:14] spent more time on it recently than she
[2:30:16] did when we were the city was running it
[2:30:19] so correct because she's trying to get
[2:30:20] our person that we hired up to speed and
[2:30:24] if I recall
[2:30:26] you and Nancy both have governance over
[2:30:28] the market as well and I seem to be
[2:30:31] doing the majority of the work and
[2:30:33] getting the majority of the
[2:30:37] shall we say
[2:30:40] grief I don't know I mean for the
[2:30:43] hundred things we do right again once
[2:30:45] again
[2:30:46] called me on the carpet for doing two
[2:30:49] things wrong that I told you in advance
[2:30:51] I was gonna dress up here but you
[2:30:54] decided that you needed a public forum
[2:30:56] no it's not about a public forum it's
[2:30:58] about the forum with these
[2:31:01] four piers right okay so what do you
[2:31:06] want council to
[2:31:12] would like Council to take the $100
[2:31:15] expenditure off of the mark for tables
[2:31:17] and chairs off of the market budget
[2:31:20] for the next three months the community
[2:31:24] center will provide tables and chairs is
[2:31:26] that which harassment correct okay
[2:31:28] that's the first thing I would like to
[2:31:30] send the market hours temporarily or at
[2:31:33] least on a trial basis until 2 o'clock
[2:31:37] ok 2:00 p.m. extension okay and anything
[2:31:42] else I'd like to consider some seed
[2:31:44] money for the market so you want the
[2:31:46] council to appropriate more money to
[2:31:48] L'Amour do you need more money more
[2:31:51] money we've spent how many thousands of
[2:31:53] dollars on the market already so it is
[2:31:55] more yes ma'am not since she's been
[2:31:58] running no not since we didn't run it
[2:31:59] not since I've been running it we didn't
[2:32:01] spend that thirty five hundred that was
[2:32:03] allocated the only money that was spent
[2:32:05] out of that was on
[2:32:07] okay so how much money do you want I was
[2:32:11] only the only money that was spinning
[2:32:12] that was labor that $3,500 was just
[2:32:14] spent on labor how much money do you
[2:32:16] want
[2:32:17] $500 okay council there you have it you
[2:32:20] have tables and chairs for three months
[2:32:22] from
[2:32:23] you can say you can say anything you
[2:32:29] want you're the ones that are making a
[2:32:30] decision so okay I move that we approve
[2:32:32] thousand dollars for seed money for the
[2:32:36] market days also that we allow them I
[2:32:40] guess to use a tables and chairs for a
[2:32:43] certain amount of time and that the
[2:32:44] hours be increased by one hour on a
[2:32:47] Saturday
[2:32:49] also okay that's emotionally okay so
[2:32:53] motion tables and chairs for how long
[2:32:57] look this is the I know this seems to be
[2:33:00] trivial but if you're the one that has
[2:33:03] that other part of the city and your
[2:33:06] stuff is being used and torn up and you
[2:33:08] have no recourse because now you just
[2:33:10] got to replace it out of your budget I'm
[2:33:12] in essence I guess what I'm saying is
[2:33:14] I'm trying to do church the Lord's
[2:33:17] Committee for use parks committee buys
[2:33:21] do you use de parts the parts over so
[2:33:24] it's thank you very much so how long do
[2:33:29] you want three months three months three
[2:33:32] months okay and this is a city function
[2:33:34] there this is not some
[2:33:36] community organization that's gonna be
[2:33:39] using these things okay okay so I have a
[2:33:42] motion from place three to use the
[2:33:45] tables and chairs at no cost for three
[2:33:48] months to extend the hours to 2:00 p.m.
[2:33:50] and to
[2:33:56] put a thousand dollars more thousand
[2:33:59] dollars whether it's more or not
[2:34:00] thousand dollars to the market days
[2:34:03] where would you like that money to come
[2:34:05] from
[2:34:09] we could reduce the cost that trap hogs
[2:34:13] by a thousand dollars and put nine
[2:34:16] thousand dollars on it we could take it
[2:34:17] from there I don't care where it comes
[2:34:19] from we certainly have it somewhere
[2:34:22] okay
[2:34:23] [Music]
[2:34:25] all right motion place three you heard
[2:34:28] it anybody want to do a second
[2:34:30] I'll second place one with a second any
[2:34:33] further discussion or questions yes if I
[2:34:36] may do we I've been there and I
[2:34:39] volunteered as you know on this project
[2:34:42] the staff aside from cat for example but
[2:34:46] the guys the Public Works guys they come
[2:34:48] and they physically bring out the tents
[2:34:50] or that and so that's essentially what
[2:34:52] they're doing and they retreat on that
[2:34:55] at the end of the session is that right
[2:34:57] so they're I guess there's no option for
[2:35:01] volunteers to to disassemble it because
[2:35:05] we wouldn't have access to storage is
[2:35:07] that right probably it's usually
[2:35:10] temporarily stored in that area the
[2:35:13] smoking-room right okay right I mean we
[2:35:15] could have volunteers to sit down if we
[2:35:16] didn't want that somebody back possibly
[2:35:19] a considering right and I'd be happy to
[2:35:20] help with that too degree that I can
[2:35:22] also do you know how I mean I know you
[2:35:25] know how many chairs and tables do you
[2:35:27] use each month so far or have you uh
[2:35:30] it's like four or five tables it depends
[2:35:32] on what we've got going on if we
[2:35:34] face-painting or if we set up the
[2:35:36] information booth it just depends well
[2:35:39] Jim and I could would be willing to
[2:35:41] donate some tables I'd have to figure
[2:35:43] I've got tables that are my table that's
[2:35:45] in use right now as well so thanks for
[2:35:46] that
[2:35:47] if we own our own tables where might we
[2:35:50] store them I mean if in other words if as an entity although it's a city
[2:35:55] entity you know we are able to
[2:35:58] underwrite or ultimately purchase tables
[2:36:01] where would we store those so they don't
[2:36:03] get messed up with community center
[2:36:05] issues
[2:36:08] everything for the farmers market is
[2:36:11] being stored on the back patio behind
[2:36:13] admin okay
[2:36:18] I'm sorry I think that's all I had as
[2:36:21] questions right now
[2:36:22] Thanks any other questions or comments
[2:36:28] ocean place 3 second place one all in
[2:36:32] favor aye
[2:36:33] any opposed there's unanimous moving on
[2:36:36] item 10d I say something about about the
[2:36:41] yes okay my attempt to
[2:36:44] keep the
[2:36:46] discussion a little bit on track with
[2:36:49] the agenda was a complete failure I'm
[2:36:53] sorry about that
[2:36:54] Kim and
[2:36:56] council once went to your efforts last
[2:36:59] month were incredible that was one of
[2:37:01] the best we've ever had and I'm sure
[2:37:03] it'll continue to be like that but we
[2:37:05] did have two items on this agenda that
[2:37:07] we were supposed to be following and one
[2:37:10] of us discussed the status and monthly
[2:37:12] activity the second was to make the
[2:37:15] motion we just made that was it so don't
[2:37:17] please don't take this personally
[2:37:21] moving on item 10d ordinance two to zero
[2:37:25] seven two zero one nine this is this is
[2:37:30] an interesting situation because
[2:37:32] the awesome materials has asked us to
[2:37:36] change our ordinance to allow their
[2:37:39] trucks to drive the that is if you put
[2:37:43] that that part up it's one that yeah
[2:37:46] there you go and just roll it down to
[2:37:48] drive this route you approve tonight in
[2:37:52] the consent agenda the minutes where you
[2:37:56] council stated that you would do this
[2:38:00] but that austin materials would have to
[2:38:03] in writing agree to be responsible for
[2:38:06] the the maintained maintenance and
[2:38:08] upkeep of the road well going back and
[2:38:12] forth to them there now to the point
[2:38:14] where they're saying oh yeah we'll take
[2:38:15] care of it but they're not willing to
[2:38:16] put it in writing so what's coming to
[2:38:19] you is do you want to do you want to
[2:38:22] approve this without it being in writing
[2:38:24] and I know that council councilman Lanza
[2:38:27] has a little bit of background and so
[2:38:28] I'd like to hand this over them
[2:38:30] did as anybody talked to them
[2:38:32] specifically about this I
[2:38:35] was under the impression that you had I
[2:38:38] was watchin with the mayor who may have
[2:38:41] suggested that that they have refused to
[2:38:44] put this in writing or whatever they have done that they would cooperate
[2:38:49] and they've told me this on several
[2:38:51] occasions they would cooperate with the
[2:38:54] surrounding industrial properties to
[2:38:56] maintain that Road if it gets to the
[2:38:59] point where it needs it they absolutely
[2:39:01] will I put it in writing and I I brought
[2:39:03] this up both times I brought this up to
[2:39:05] counsel this is not part of their
[2:39:07] agreement what they want to do is they
[2:39:09] want to use 6/10 of a mile within our
[2:39:13] city limits to allow their trucks to
[2:39:15] come from their plant to the exit of
[2:39:20] Hanson materials take a left and go
[2:39:24] straight to 35 that's all they're asking
[2:39:26] for
[2:39:27] so there's no maintenance agreement here
[2:39:30] the only agreement they have actually
[2:39:32] put it in writing as they put out that
[2:39:34] they will fire anybody that goes
[2:39:37] anywhere else except that route and
[2:39:40] we're only talking about 6 cents of a
[2:39:42] mile through the city limits that's all
[2:39:43] they're asking for once it turns on to
[2:39:46] 2250 later that's a 20 that's a state
[2:39:48] highway
[2:39:49] so also the rewind in the discussion one
[2:39:52] of the things we talked about is that
[2:39:54] they're driving on that road will tear
[2:39:56] up the road more and so they were
[2:40:00] agreeing that they would maintain
[2:40:02] that road and take care of that road
[2:40:04] but the issue is they're not willing to
[2:40:07] put in writing so for council hang on a second so for council it's
[2:40:11] just up to y'all do you want to do you want to take take this just and I modify ordinance 22 and accept
[2:40:21] that without it in writing and move on
[2:40:24] or do you want to insist that they put
[2:40:27] it in writing it's up to y'all go ahead
[2:40:29] sir
[2:40:30] they
[2:40:33] are already authorized by law they go
[2:40:38] from their plant to Hanson to pick up
[2:40:41] material and back to their plant they
[2:40:44] already use this road in fact the road
[2:40:46] that they're going to be using is
[2:40:48] probably going to be about two-tenths of
[2:40:49] a mile that they're not actually using
[2:40:51] at this point so any tearing up of the
[2:40:54] road is already taking place that I mean
[2:40:57] they that they're Hanson trucks going up
[2:40:59] and down that road all the time it's not
[2:41:01] going to accelerate it that much more
[2:41:03] all its going to do is keep them from
[2:41:06] going through the old Comal community
[2:41:09] and on past the the intermediate school
[2:41:12] that's what they're trying to eliminate
[2:41:14] and they will not be signing an
[2:41:17] agreement for maintenance of the road
[2:41:19] okay it will cooperate but they're not
[2:41:21] going to sign it
[2:41:22] I'm not advocating for or against this
[2:41:25] I'm just stating the facts facts are
[2:41:27] that that they're not signed in it in
[2:41:29] the in in the minutes that said that we
[2:41:32] were we were going to them to ask and to
[2:41:34] sign it that's what that was what was
[2:41:36] affirmed by council so signed not signed
[2:41:40] two tenths it doesn't it's all it's all
[2:41:43] on the table right now for you all to
[2:41:45] make a decision them so
[2:41:47] again this is unchanged ordinance to to
[2:41:51] and
[2:41:53] what's the will of the council
[2:41:58] ma'am can we ask for what it's worth a
[2:42:02] legal opinion is to you know if there's
[2:42:05] an incident I mean I don't understand
[2:42:07] why they won't put it in writing it
[2:42:09] makes me a little nervous
[2:42:13] Councilwoman of our this thing on a
[2:42:15] second anything
[2:42:18] legal do you have anything to say about
[2:42:20] this
[2:42:23] so I can't answer councilman barish
[2:42:27] question as to why they wouldn't want to
[2:42:28] put that in writing but what I can say
[2:42:30] is that there are legal mechanisms is if
[2:42:32] they do agree with which you know we can
[2:42:36] legitimately create an agreement for
[2:42:40] maintenance of that road so there are
[2:42:42] some options there of course an
[2:42:44] agreement and implies that the other
[2:42:46] person on the other side is an agreement to that and what I'm
[2:42:50] hearing though is that they're not
[2:42:51] willing to do so so
[2:42:55] councilman Lanza go ahead there's other
[2:42:58] industrial properties using that Road at
[2:43:01] six tenths of a mile the brick plant
[2:43:04] uses it Hanson uses it are we going to
[2:43:07] get an agreement from everybody
[2:43:09] legal
[2:43:11] so the answer is that is normally how
[2:43:14] it's done is that whoever the users of
[2:43:16] the road are are working to a sort of an
[2:43:19] assessment type of agreement so that
[2:43:20] they pair pay a share of the upkeep and
[2:43:23] maintenance
[2:43:24] well then we might as well table this
[2:43:27] for another six months fill we get that
[2:43:29] agreement going I don't know what else
[2:43:30] to do
[2:43:34] sir i I am NOT trying to quarrel I'm
[2:43:38] merely asking this is this is an
[2:43:40] isolated segment and to be honest I
[2:43:42] don't remember where it came from in
[2:43:44] terms of I mean I know it's been on the
[2:43:46] agenda okay but why are we singling them
[2:43:49] out if everyone is using it so I is it
[2:43:51] sort of a moot point I'm perhaps I'm
[2:43:53] lost go ahead and explain okay I I have
[2:43:56] no loyalty to these people whatsoever
[2:43:58] the plant manager called me up we said
[2:44:01] Brian he said our current route that we
[2:44:03] take those through Old Town Co Mel goes
[2:44:06] either past the new intermediate school
[2:44:08] or it goes back
[2:44:11] and we have we have that that picture I
[2:44:14] had before it's a large triangle that
[2:44:17] goes right back to 2250 to right before
[2:44:19] I 35 he said can you see if we can
[2:44:23] actually go legally from our plant to
[2:44:27] 22:52 and take a left and go to 35
[2:44:30] instead of this this other route and I
[2:44:33] said I'll try I don't care if we drop
[2:44:35] this right now and I never talked the
[2:44:37] man again it makes no difference to me
[2:44:39] I'm just trying to protect the school
[2:44:41] I'm trying to protect local count of the
[2:44:43] old town area and Comal and then it only
[2:44:46] makes sense that they are allowed to
[2:44:48] drive an additional six tenths or a
[2:44:51] toothed chance through the city limits
[2:44:53] that's in an industrial area anyhow to
[2:44:56] get to 22 52 inch straight 235 that's right that's where I'm at it
[2:45:01] makes no difference to me okay so it's
[2:45:03] essentially the lesser of however many
[2:45:05] evils and do we have any input from PD
[2:45:08] yes no
[2:45:14] good I was originally the one that
[2:45:17] suggested that we try to get Tim to
[2:45:19] maintain it that is a world travel
[2:45:21] industrial road
[2:45:24] it's up to the council on what's
[2:45:26] accountable what the council wants to do
[2:45:28] that road is is getting torn up but as
[2:45:31] councilman Lancie said they can already
[2:45:34] use it to go in and out of the plant and
[2:45:36] go back and forth all in aggregate back
[2:45:38] and forth so I don't know what the
[2:45:40] increase truck traffic would be that
[2:45:44] would not be going into Hanson don't
[2:45:46] know if it's if it's worth it or not
[2:45:47] don't know if it's worth talking to
[2:45:51] Hanson and them trying to get something
[2:45:53] I was just making a recommendation
[2:45:56] trying to look out for the city's best
[2:45:58] interest on a road that's gonna cost a
[2:46:00] considerable amount of money to fix
[2:46:05] go ahead
[2:46:08] they're already using it I'll put my dad
[2:46:12] hat on and go the truck traffic that
[2:46:13] goes in front of Danville middle school
[2:46:16] driving that triangle that councilman
[2:46:18] Delancey mentioned is hideous and causes
[2:46:21] traffic problems because they're trying
[2:46:22] to turn left
[2:46:23] off of 42 or whatever that road is it
[2:46:26] goes by in front of middles the
[2:46:27] internment the middle school with all
[2:46:30] the truck traffic already coming out
[2:46:31] 2252 i think it would greatly benefit
[2:46:35] the parents that are driving their kids
[2:46:37] to and from the middle school to allow
[2:46:39] this
[2:46:40] the one of the questions I've got is how
[2:46:43] many Garden Road citizens live on that
[2:46:44] 6/10 stretch of road
[2:46:47] none there's no impact on any residents
[2:46:50] so if that road got toward a crap by all
[2:46:53] these heavy trucks going on it and we
[2:46:54] didn't fix it what happens to us
[2:46:57] it doesn't impact our citizens the only
[2:47:00] people that get impacted are the
[2:47:01] businesses that are there and it's in
[2:47:02] their vested interest to fix it
[2:47:04] if we're not obligated to fix it when
[2:47:07] they tear it up I'm not really worried
[2:47:09] about a written agreement on their part
[2:47:11] to fix it it'll become self critiquing
[2:47:13] if they don't want to fix it in their
[2:47:15] tear and axles out of their trucks
[2:47:16] because the roads bed and we don't have
[2:47:17] to fix it
[2:47:20] cutting down on the truck traffic that
[2:47:22] goes into the old Kamel settlement it
[2:47:24] also goes in front of I believe the what
[2:47:27] was Kemal elementary school now is Pope
[2:47:29] John Paul or something the the Catholic
[2:47:31] school that's there so you're having
[2:47:33] truck traffic going through another
[2:47:34] school zone versus you'd cut that out by
[2:47:36] having it go this way I guess I'm trying
[2:47:38] to give reasons in my mind why this is a
[2:47:40] good idea and I can't come up with a
[2:47:42] reason why it's a bad idea if it doesn't
[2:47:43] impact any citizens so there's there's
[2:47:46] my thoughts that's what I thought
[2:47:49] councilman and it just it was common
[2:47:51] sense
[2:47:52] they're not gonna do us any harm
[2:47:54] whatsoever and they're already used in
[2:47:57] that he wouldn't go to 20 to 50 to the
[2:47:59] day this plant manager called me I drove
[2:48:01] towards a plant I counted six trucks
[2:48:04] coming out of there their site went
[2:48:07] straight to 2252 they just don't want to
[2:48:10] be taking it from now on but they use it
[2:48:12] all the time
[2:48:17] know
[2:48:21] okay so what do you wanna do I say for
[2:48:25] the welfare of the children and the
[2:48:27] parents and so on
[2:48:29] we give it a try and
[2:48:32] possibly consider down the line if if
[2:48:35] there is an issue the fact that they
[2:48:36] reached out I know it's to their benefit
[2:48:38] but it sounds to me like with input from
[2:48:41] parents and so on that possibly it's
[2:48:44] safer
[2:48:44] saver to allow it
[2:48:47] so to be clear what is your motion
[2:48:50] you're you're looking to accept give
[2:48:53] them exception to ordinance 22 what
[2:48:57] you're asking is the same as an
[2:48:59] exception I wouldn't we don't is it
[2:49:00] necessary to rewrite the ordinance well
[2:49:03] we we have to revise the ordinance to
[2:49:05] amend it to allow right to allow
[2:49:07] specific cover that's right because we
[2:49:11] have to rescind the change that put this
[2:49:13] into place
[2:49:20] right
[2:49:22] so only an ordinance can change an
[2:49:24] ordinance so if we're going to do
[2:49:25] anything to allow them to drive that we
[2:49:27] either need to rescind the the previous
[2:49:29] amendment or right in some other change
[2:49:32] within the ordinance to make that happen
[2:49:37] right so not to specify
[2:49:39] companies per se but to allow commercial
[2:49:43] tractor trailer traffic that would be my
[2:49:47] motion
[2:49:49] say it again I
[2:49:54] recommend we amend the ordinance to
[2:49:56] include to allow
[2:49:59] commercial
[2:50:02] class whatever it is
[2:50:05] tractor trailer
[2:50:07] travel and it's not necessarily tractor
[2:50:10] trailer for me okay commercial truck
[2:50:15] traffic on that specific route
[2:50:20] okay thank you mm-hmm I have a motion
[2:50:23] please five can I get a second
[2:50:25] Zagat second place for any further
[2:50:28] discussion of questions all in favor
[2:50:31] any opposed there's unanimous thank you
[2:50:35] and number ten e
[2:50:38] coordinates 2 & 7 0 1 2 0 1 9 this is
[2:50:42] the sex offender ordinance and we
[2:50:46] received a petition that
[2:50:49] somebody says that they they believe
[2:50:52] they're
[2:50:53] there an exception to the ordinance and
[2:50:56] they want to be able to be accepted you
[2:50:59] received a discussion and you received a
[2:51:02] note from the petitioner and you just
[2:51:04] received a legal opinion a discussion
[2:51:06] from our attorney so I'd like to hand it
[2:51:11] over to
[2:51:12] mr. Trevino to explain
[2:51:17] in analyzing the ordinance and based on
[2:51:21] the information contained within the
[2:51:22] petition we find that the petitioner
[2:51:25] does not meet any of the written
[2:51:28] exemptions that are contained within the
[2:51:29] ordinance there is one provision within
[2:51:32] the ordinance section mind that allows
[2:51:34] counsel
[2:51:35] to grant an ordinance or an exception to
[2:51:39] the ordinance if it so chooses to
[2:51:41] however that granting is limited it is
[2:51:45] limited by the fact that the council can
[2:51:48] either do it on their own authority but
[2:51:50] based on an independent
[2:51:53] analysis or an independent risk analysis
[2:51:56] done for that particular offender and to
[2:51:59] my knowledge the city hasn't the
[2:52:01] petition was not accompanied with any
[2:52:03] type of independent analysis of risk for
[2:52:05] this particular offender so based on
[2:52:08] that the council doesn't meet the
[2:52:11] threshold to grant an exception under
[2:52:13] its own authority without meeting those
[2:52:15] particular parameters of the ordinance
[2:52:18] so put in plain English this petitioner
[2:52:22] is saying that there you have an
[2:52:23] exception and legally that exception
[2:52:26] does not is not met flatout that's
[2:52:29] basically what it comes down to
[2:52:32] questions comments and questions for our
[2:52:36] attorney start on the right side I
[2:52:40] I'm inclined just to do nothing because
[2:52:45] don't want to change it
[2:52:48] if I will the way that the ordinance is
[2:52:52] written counsel is required to take and
[2:52:54] document an action in the in the minutes
[2:52:56] so you it can be as simple as the motion
[2:52:59] to say you find no exception and tonight
[2:53:06] we do exceptions and variances on a
[2:53:09] regular basis we shouldn't be doing
[2:53:11] those what we do this is one line that
[2:53:15] we're going to draw I'm going to draw
[2:53:16] and say absolutely not
[2:53:20] Pam you're like in motion
[2:53:23] your thoughts and the motion yes my
[2:53:26] thoughts are
[2:53:27] based on legal advice we do not accept
[2:53:32] the request okay can I get a motion
[2:53:34] please
[2:53:35] move to deny the request for exemption
[2:53:39] from our ordinance 22 - oh seven 201
[2:53:43] nine based on legal advice I think
[2:53:47] there's no justification
[2:53:49] thank you have a motion to deny this
[2:53:50] petition can I get a second well
[2:54:01] did she read the wrong ordinance I mean
[2:54:03] oh that's the street that's regulating
[2:54:05] the traffic I'm sorry I didn't even
[2:54:07] catch them thank you for catching us so
[2:54:10] it's ordinance 2-1
[2:54:12] 70s I'd like to amend my amendment to
[2:54:16] state ordinance I don't care about the
[2:54:18] traffic ordinance two one seven zero one
[2:54:21] two oh one nine please okay so place
[2:54:25] five as has made a motion to deny the
[2:54:29] petition for the exception of ordinance
[2:54:32] two one seven can I get a second please
[2:54:37] have place for with a second any further
[2:54:39] discussion or questions yes I'd like to
[2:54:41] thank the chief for appearing the rocks
[2:54:43] in his head go back and forth
[2:54:45] all in favor
[2:54:47] any opposed is unanimous thank you thank
[2:54:51] you mr. bean you okay moving on in item
[2:54:54] 11 an update city administrator reports
[2:54:56] update on CIP
[2:54:57] we have completed all
[2:55:01] renovations in the park community center
[2:55:04] municipal Parkway
[2:55:07] restriping the only thing we have
[2:55:09] outstanding is payment of the drainage
[2:55:12] property project associated with vines
[2:55:14] Elaine and
[2:55:17] some outstanding engineering fees that
[2:55:19] would be associated with that project as
[2:55:21] well so we are almost completed all of
[2:55:25] our projects and as we heard from our
[2:55:28] engineer
[2:55:29] we're getting close to having that
[2:55:33] the conditions the vegetation all
[2:55:37] satisfied and that was kind of we're
[2:55:39] holding back the money for the
[2:55:40] vegetation so as soon as that's done and
[2:55:43] possibly a little bit of outstanding
[2:55:45] engineering fees will finally be able to
[2:55:46] put that CIP down for good
[2:55:49] an update on city use of password
[2:55:52] management city secretary
[2:55:57] so I know I had originally said we were
[2:55:59] going to try to do implementation and
[2:56:01] training sessions at the last week of
[2:56:03] October but early voting kind of sprung
[2:56:06] upon us that we had not thought about so
[2:56:09] we were not able to use this room so
[2:56:11] we're still looking at dates but I don't
[2:56:13] have anybody on council that has created
[2:56:17] their account yet so make sure that you
[2:56:20] are receives the email I need to make
[2:56:22] sure that everybody got the email I know
[2:56:24] I've talked to a couple of y'all and
[2:56:26] that has had questions so I know those
[2:56:28] have got the email but if you haven't
[2:56:30] received the email at the invitation
[2:56:31] please let me know so I can resend it
[2:56:33] and then when you you need to create an
[2:56:36] account it's pretty easy but if you have
[2:56:38] questions feel free to ask myself or Kat
[2:56:41] she knows how to do it as well
[2:56:44] any questions
[2:56:46] for our city secretary comments okay
[2:56:50] thank you very much
[2:56:52] item 11 be the communication report if
[2:56:56] your if you happen to notice the
[2:56:58] electronic sign is
[2:57:00] has been removed the electronic sign
[2:57:03] that hasn't worked for a while that
[2:57:04] would have cost us a fortune to fix
[2:57:07] we've finally removed it also another
[2:57:10] communication thing is the consent
[2:57:12] agenda and I just want to I want to pull
[2:57:17] counsel and make sure that everybody is an agreement with the intention to
[2:57:22] put non-controversial things out there
[2:57:24] give you lots of time to look at it ask
[2:57:26] questions of staff but then to make
[2:57:30] these meetings try to make these
[2:57:31] meetings shorter by DL until do that
[2:57:33] again I'm well aware that it may be made
[2:57:37] somebody may think oh you're know want
[2:57:38] to talk about it in public but we still
[2:57:41] people will be able to read these
[2:57:43] packages well ahead of time they'll
[2:57:45] always be able to poll you or myself
[2:57:47] what's going on what are we doing about
[2:57:48] this that or the other even before the
[2:57:50] decisions are made and in any time
[2:57:52] anything becomes controversial in your
[2:57:54] mind you can let staff know ahead of
[2:57:56] time and we'll pull it off the consent
[2:57:58] agenda and of course you can always do
[2:58:00] it in the meeting too
[2:58:01] so any questions or comments on that
[2:58:04] action because it is or moving forward
[2:58:07] with that so no I'm very much in favor
[2:58:09] of it and just like you said after
[2:58:12] reading them
[2:58:14] there was nothing I really wanted to go
[2:58:16] over
[2:58:18] so we still have that opportunity if
[2:58:21] necessary great thank you
[2:58:24] I love the idea because it's three
[2:58:28] minutes to 9:00 and we've still got a
[2:58:29] bunch of work left to do yes we do I
[2:58:32] like it and I think this time it seemed
[2:58:35] that we had
[2:58:36] more supportive backup or more
[2:58:39] clarification maybe in our backup yes
[2:58:41] that helped yes and and and thank staff
[2:58:43] for that you know some of the stuff in
[2:58:45] there I'll say like from the PD great
[2:58:48] background great explanation but again
[2:58:51] if you look at it and you're not getting
[2:58:53] what you need we're gonna send this to
[2:58:55] you early enough that you have enough
[2:58:56] time to come back to staff and and get
[2:58:58] questions answered and we can republish
[2:59:00] to all of you more of the information or
[2:59:02] anything you need so we'll make sure it
[2:59:04] happens okay good thank you
[2:59:13] citizen contact report we get a couple
[2:59:16] things want to let you know about
[2:59:18] you know we've done a lot of the work on
[2:59:20] sumac circle with drainage and we had a
[2:59:24] neighbor of the lot that we did all the
[2:59:29] work on saying okay you've done all this
[2:59:31] work and how how is this not gonna
[2:59:32] affect me which is logical and a very
[2:59:35] good question so our are at our city
[2:59:40] administrator spent considerable time
[2:59:42] explaining to these folks what was done
[2:59:44] and that we would we would keep a close
[2:59:48] eye on it and connected these folks also
[2:59:51] with Public Works and mr. Steinmetz so
[2:59:53] they are satisfied that that we've done
[2:59:56] what we could do as well as we're going
[2:59:58] to keep track of it and keep watch of it
[2:59:59] to make sure that that would they
[3:00:01] haven't forgotten them so that's a
[3:00:02] that's great work on both Public Works
[3:00:04] and admin
[3:00:06] city administrators thing and I think we have them to thank for that
[3:00:12] we had some issues with some pothole and then also was kind of the
[3:00:17] side of the road that was eroding Vincey
[3:00:20] land also
[3:00:21] bad cave for those of you keeping track
[3:00:23] back Haven isn't even our road but
[3:00:25] because we're always trying to help our
[3:00:27] public works even repaired a piece of
[3:00:30] bat cave and let let our County folks
[3:00:33] know that we did that because it was a
[3:00:35] hazard to our our citizens but also
[3:00:38] repaired pothole on Ben seal and that
[3:00:41] came from a coffee coffee with the mayor
[3:00:46] discussion where somebody brought that
[3:00:48] in and said hey we got some problems
[3:00:49] with this and then another one that was
[3:00:52] a coffee with the mayor thing was the
[3:00:54] drainage ditch at some 2252 which is
[3:00:55] actually text dots
[3:00:57] area but it has an effect on RMS for you
[3:01:01] know
[3:01:01] mr. Steinmetz spent considerable time
[3:01:04] putting together the answers and the
[3:01:06] report to satisfy the federal and state
[3:01:10] requirements for ms4 and we are that's
[3:01:14] why we you see more things on the sign
[3:01:16] about about about ms four types of
[3:01:19] issues but also he is working with text
[3:01:23] out to to clean that out because it does
[3:01:26] have a direct effect on on the flow and
[3:01:28] into our area so something that Public
[3:01:31] Works kind of over over and above again
[3:01:33] so to to over and above with Public
[3:01:36] Works some contact with citizens so
[3:01:39] thank you very much anybody have any
[3:01:41] questions or comments on any of those
[3:01:44] City facility update the audiovisual
[3:01:46] upgrades and streaming handed over to
[3:01:49] city secretary worsen so we are now
[3:01:52] streaming all of the Commission meetings
[3:01:54] that started in October they are all
[3:01:56] going to the YouTube channel for the
[3:01:58] city's YouTube channel and
[3:02:00] for civic Clerk which is the software
[3:02:03] portal where you can see the indexing of
[3:02:06] the agenda to the video they are working
[3:02:09] on integrating all of what we currently
[3:02:11] have on our agenda Center on the website
[3:02:14] into their portal which they should have
[3:02:17] done I probably next week when we meet
[3:02:20] with them again so our meeting was a
[3:02:22] little later we would have it in
[3:02:23] November but we will definitely have
[3:02:26] that available to the public at our
[3:02:27] December meeting they'll be able to view
[3:02:30] the meeting live from the city's website
[3:02:33] council me and then after the fact they
[3:02:37] will be able to see the bookmarks
[3:02:38] obviously the bookmarks aren't available
[3:02:40] if you're watching the live video
[3:02:41] they're not available until after the
[3:02:44] meeting but that will for sure be done
[3:02:46] the December council meeting they'll be
[3:02:49] able to watch that and that that's a
[3:02:51] that's great progress thank you so much
[3:02:53] anybody have any comments or questions
[3:02:55] former sana okay
[3:02:58] ordinance revision process were working
[3:03:01] zoning buildings and
[3:03:03] water as you know and then parks as soon
[3:03:07] as we finish the work around the the new
[3:03:11] pavilion will then work that pavilion
[3:03:14] into the parks coordinates as well
[3:03:15] textile coordination if you recall text
[3:03:19] dot told me that the speed limit on 20
[3:03:24] and 3.9 would be changed in October and
[3:03:27] if you've driven on three double O nine
[3:03:30] you see that it has not changed a lot of
[3:03:32] people were telling me that they kept
[3:03:34] asking me throughout October why it
[3:03:35] hasn't happened and I figured if the
[3:03:37] minimum wasn't good enough it wouldn't
[3:03:38] be the minimum so I waited until
[3:03:39] November 1st and called and I have no
[3:03:42] answer yet they haven't answered me they
[3:03:44] don't know they don't know what's going
[3:03:45] on so I'll keep you posted on that but
[3:03:48] as it stands right now I'm waiting for a
[3:03:51] call back from from the point of contact
[3:03:54] on that so no change in the speed limit
[3:03:57] yet
[3:03:58] number six Garden Ridge elementary
[3:04:00] school traffic flow and three double O
[3:04:02] nine safety the traffic flow with three
[3:04:03] double or not or excuse me with Garden
[3:04:06] Ridge elementary school as obviously
[3:04:08] improved tremendously with of them
[3:04:10] allowing two lanes going in there the
[3:04:12] issue though is we now have just traffic
[3:04:16] during that time increased traffic on
[3:04:18] three double O nine makes it really
[3:04:19] difficult for somebody that lives in
[3:04:20] trophy Oaks to get out of their
[3:04:22] neighborhood and and it cues back quite
[3:04:26] a ways and when I get the answer from
[3:04:29] text dot the next our next thing is
[3:04:30] we're gonna ask him if there's any way
[3:04:32] they can look at making more of a turn
[3:04:34] lane going into municipal Parkway some people are
[3:04:40] creating a turn lane I was educated that
[3:04:42] as long as they stay on blacktop they're
[3:04:44] not breaking the law if they go into the
[3:04:46] dirt to to create a turn lane there now
[3:04:49] breaking a law but so we've got a mixed
[3:04:52] bag of some people that are doing both
[3:04:53] but it's still not it's not an ideal
[3:04:55] situation we're addressing we're
[3:04:57] addressing that with them so we'll see
[3:04:59] but three double nine continues to be an
[3:05:02] issue with with traffic particularly at
[3:05:04] those those peak hours anybody have any
[3:05:07] questions or comments on that
[3:05:09] they're going out of their way to
[3:05:11] increase the size of the road in front
[3:05:13] of the new high school yeah they're
[3:05:16] making every effort to do that but
[3:05:17] they're not gonna help us a bit
[3:05:20] anything else
[3:05:21] okay City Council projects new resident
[3:05:25] package got the council woman's went and
[3:05:28] Bower on that any updates on that well
[3:05:31] we were slowly but surely but maybe not
[3:05:34] surely moving along i we did ask for
[3:05:38] input from staff as to ideas that they
[3:05:41] might have to expand it the
[3:05:44] documentation that you gave me earlier
[3:05:46] and we all feel like they've all
[3:05:49] expressed the thought that they actually
[3:05:51] like the interaction with citizens
[3:05:53] whether they be new citizens or current
[3:05:55] citizens and so on so they they actually
[3:05:57] like the face to face so it would
[3:05:59] suggest that possibly we create a PDF
[3:06:01] file with a link to our city website but
[3:06:05] also the availability of texting or
[3:06:07] emailing new residents as as well for
[3:06:10] information so it's not to exclude the
[3:06:12] paper the paper version for those who
[3:06:14] aren't electronically you know inclined
[3:06:18] but it's its remains sort of a work in
[3:06:21] progress and I don't know that we're
[3:06:22] gonna get anything done in December or
[3:06:24] November for that matter
[3:06:27] thanks for the work you've done on it
[3:06:29] you want it to stay on here do you want
[3:06:31] to come off and come back on when you
[3:06:33] want it to come back on what's your
[3:06:34] choice
[3:06:37] sorry my mic on take it off for December
[3:06:40] and will redress in January okay thanks
[3:06:43] links with city council meetings number two on here in it's councilman
[3:06:46] Lansing comments if it is agreeable the
[3:06:49] councilman Bauer it is agreeable to
[3:06:51] councilman Swint and myself to take 11c
[3:06:54] and move the entire thing to next month
[3:06:56] we have a lot to cover before the end of
[3:06:59] this evening
[3:07:01] okay well it's just two items left so so
[3:07:05] you so you want to move this you want to
[3:07:08] defer till next month yes okay
[3:07:14] well I don't understand number two is
[3:07:16] just doors
[3:07:19] mayor we've already done number one got
[3:07:22] three okay I want mine to move to that next
[3:07:25] one thing how's it that sounds great
[3:07:27] thank you and number three is councilman
[3:07:30] Bower mine is very brief I have no
[3:07:32] answers to the
[3:07:34] comments I made last month up regarding
[3:07:36] pets one little anecdotal thing again I
[3:07:39] address cats I'm not an anti cat person
[3:07:42] please understand but since that meeting
[3:07:45] I was alerted by a neighbor that that
[3:07:48] black cat that we have seen in our
[3:07:49] neighborhood that continues to enter my
[3:07:51] yard and her yard attacked her cat her
[3:07:54] cat became sick and died we cannot catch
[3:07:56] that cat and that's an example of
[3:07:58] somebody being irresponsible whether
[3:08:00] they let that cat go or whatever I've
[3:08:02] tried everything my power and it came
[3:08:04] very close to one of my dogs catching
[3:08:06] that cat and if that cat is sick and
[3:08:07] makes my dog sick
[3:08:19] front yard and it's not for my dogs that
[3:08:22] tells me there's a dog running loose now
[3:08:24] - but please just let's everybody try
[3:08:27] because now if it's becoming an issue
[3:08:29] with
[3:08:30] contaminated animals contaminating other
[3:08:32] people and other people's yards I came
[3:08:36] that cat came very close to losing its
[3:08:38] life if I had not intervened at this at
[3:08:41] the very last minute with one of my dogs
[3:08:43] and it would not be my dog's fault so I
[3:08:45] just beg you please people let's really
[3:08:48] try thank you that's it and all I'd all
[3:08:52] I'd add is have you called Animal
[3:08:54] Control on it
[3:08:56] you know I did not because mr. Loman was
[3:08:59] out of commission I didn't feel like it
[3:09:01] was in I haven't seen the cat
[3:09:03] please consider call because it'll also
[3:09:06] be a record of this being a continual
[3:09:08] occurrence I will okay thank you
[3:09:11] item number 12 discussion for future
[3:09:14] generations Genda items I'll start on
[3:09:16] the left side do you have anything for
[3:09:17] future Jedi
[3:09:26] okay none for anyone okay item number 13
[3:09:30] citizen comments I
[3:09:32] got a hand up but
[3:09:35] hang on a second so I want to address
[3:09:40] citizens comments because apparently
[3:09:42] there's there's a
[3:09:44] rumor going around that people can speak
[3:09:47] in the council meeting anytime they want
[3:09:49] that's not what the law says it's never
[3:09:51] said that and it doesn't say that now
[3:09:52] what it says is that
[3:09:56] citizens will be given in fact I have it
[3:09:59] here but
[3:10:01] city's governmental bodies may adopt
[3:10:03] reasonable rules regarding public right
[3:10:05] to excess address the body under this
[3:10:07] section and it
[3:10:11] we can limit the amount of time which we
[3:10:13] do which apparently some people don't agree with but it's pretty
[3:10:16] standard practice in the state of Texas
[3:10:18] and
[3:10:25] it says to address body regarding the
[3:10:28] item at the meeting before or during the
[3:10:31] body's consideration that's why we have
[3:10:34] a comp uh blaa comment period counsel
[3:10:37] before we start all this so and are in
[3:10:41] our intent has always been that you look
[3:10:44] at the agenda you know you want to talk
[3:10:46] about something on the agenda you get
[3:10:48] your three minutes before the meeting to
[3:10:49] talk before we talk to discuss it for
[3:10:52] you to discuss it but then we also for
[3:10:55] those that may not know they wanted to
[3:10:57] talk about something until they heard
[3:10:59] the proceedings during the council
[3:11:01] meeting we have this citizen comment
[3:11:03] period at the end so I can assure you
[3:11:05] that we not only comply with the law but
[3:11:08] we exceed the requirements of the law by
[3:11:10] having this second citizen comment
[3:11:12] period at the end we have we have
[3:11:14] consulted with our attorney who also
[3:11:17] represents a lot of other cities around
[3:11:19] here and we are absolutely in line with
[3:11:22] the law and with other cities nobody has ever read this that people
[3:11:28] can in the middle of of y'all talk and
[3:11:30] can raise their hand and say I want to
[3:11:32] speak on this and there was also a
[3:11:34] question of why we did not bring up
[3:11:37] House bill 2840 and it was merely
[3:11:39] because it not applicable
[3:11:41] we already comply with with section 1
[3:11:47] subchapter a55 one of the government
[3:11:50] code and so there was no reason to ever
[3:11:52] talk about it but apparently there was
[3:11:55] because it's there's been lots of lots
[3:11:59] of discussion including in here about us not allowing people to speak so
[3:12:06] that said this is the one you don't have
[3:12:08] to sign up for you get two minutes when
[3:12:10] you come up to speak name and address
[3:12:13] doesn't count to you two minutes and
[3:12:15] when you're done would you please go
[3:12:16] over to our City Secretary to sign in
[3:12:18] and come on up anyone
[3:12:30] mr. barish City Council thank you for
[3:12:33] allowing me to speak my name is Kirk
[3:12:35] Carter I'm a gardener at resident for
[3:12:37] the last 13 years and I live at two one
[3:12:40] nine eleven Paseo quarto I just wanted
[3:12:42] to say first thank you for addressing or
[3:12:45] at least in my opinion beginning to
[3:12:47] address the feral Hawk problem I would
[3:12:49] like to put a face on that if you don't
[3:12:52] know anybody that has had their property
[3:12:54] damaged by a feral hog you're looking at
[3:12:56] one and at this point time I'd just like
[3:12:58] to start these sir let me let me let me
[3:13:01] say you actually you got to give it to
[3:13:03] our city secretary and then she'll make
[3:13:05] sure that everybody gets to
[3:13:10] say thanks for I think the trapping is
[3:13:13] good we our board of directors at George
[3:13:16] Ranch provided us an opportunity to hear
[3:13:18] from a Texas wildlife expert earlier in
[3:13:22] this week and there's many obviously
[3:13:24] avenues for
[3:13:26] fighting the feral hog problem or
[3:13:28] addressing the feral hog problem I would
[3:13:31] just like for you to consider that
[3:13:33] you know you kind of scoffed at the
[3:13:35] hunting aspect of the feral hog problem
[3:13:37] in the city limits and I know there are
[3:13:38] some legal issues there but it is not
[3:13:40] without precedent in the state of Texas
[3:13:42] for urban hunting to be allowed the city
[3:13:45] of Longview has done that Longview is a
[3:13:47] much larger city than the city of Garden
[3:13:49] Ridge I
[3:13:51] just say that's you know laws are passed
[3:13:54] by men and men can change those laws or
[3:13:57] amend them for the refere for the for
[3:13:59] the good of the
[3:14:01] subdivision I just think you know we we
[3:14:05] are at a point where this is going to
[3:14:07] become a larger problem if we don't be
[3:14:10] proactive about it and you know we have
[3:14:13] nice welcomed packets that we want to
[3:14:15] give to our new residents but it will be
[3:14:17] hard to find new residents to purchase
[3:14:19] homes that are for sale in the in garden
[3:14:21] Ridge if they drive through our
[3:14:23] communities and see the kind of damage
[3:14:24] that was done to my yard and my yard is
[3:14:28] by no means the worst yard that was been
[3:14:31] damaged in Georgia ranch and my damage
[3:14:33] was 3,200 dollars worth for that just
[3:14:36] the pictures that you see there so we
[3:14:39] are not talking inconsequential dollars
[3:14:42] thank you sir and and for the record if
[3:14:44] anybody was watching the clock and it
[3:14:46] went to zero and I didn't stop him the
[3:14:48] reason why is because when he was given
[3:14:51] his name and address for some reason we
[3:14:52] started the clock so I I counted the ten
[3:14:55] seconds that we took from him and put it
[3:14:57] at the end so that's why in case you're
[3:14:59] wondering
[3:15:00] [Music]
[3:15:01] anyone else on
[3:15:11] the mic
[3:15:15] yes ma'am great the time hasn't started
[3:15:18] Traci Blackwell 97 and 45 trophy oaks I
[3:15:21] wanted to address the city engineer as
[3:15:23] he said that he's been working with T
[3:15:25] Blackwell insurance since February I
[3:15:27] didn't purchase the property until May
[3:15:29] 15th that was my closing date if you
[3:15:31] recall I did have another lot that I was
[3:15:33] looking at that I had to walk away from
[3:15:35] because the City Planning and Zoning
[3:15:36] I've been very patient and I've been
[3:15:38] working but with everybody trying to get
[3:15:41] this done and I haven't even spoke last
[3:15:43] time whoever represented the city
[3:15:45] engineer they said that they were
[3:15:46] working with T Blackwell because they
[3:15:48] had all these variance request when I
[3:15:51] asked him in the hallway exactly how
[3:15:53] many variants requests I had he said I
[3:15:55] don't know they just had me come talk
[3:15:57] and I don't know I said well you
[3:15:59] misspoke because I didn't ask for a ton
[3:16:01] of variance request but my
[3:16:04] architect is used to be on Planning and
[3:16:06] Zoning in city of Gardiner Shawn Willis
[3:16:08] and he actually was on planning zoning
[3:16:10] for four years I specifically picked him
[3:16:13] Clyde marbot Friesen hyung to do the
[3:16:16] building because they have built in
[3:16:17] garden ridge they know the laws they
[3:16:19] know what have you and recently and this
[3:16:21] is from Shawn our civil engineer me back
[3:16:25] up I have to say I'm very frustrated the
[3:16:27] process and concern of our future
[3:16:29] development of city of Garden Ridge this
[3:16:31] process has been dragged out due to the
[3:16:33] fact that this city engineer is not able
[3:16:35] to perform that work and timely or
[3:16:37] competent manner we have recently
[3:16:39] discovered that reviewing the engineer
[3:16:40] the plans is based out of Arizona
[3:16:44] not new braunfels Arizona and is not
[3:16:47] familiar with the local and area
[3:16:49] standards for designing storm water
[3:16:50] detention and septic our civil engineer
[3:16:53] is very experienced and
[3:16:55] is required and is very thorough to make
[3:16:57] sure the system and designs are in
[3:16:58] compliance with state and local
[3:17:00] standards and not to be detriment to the
[3:17:03] neighboring properties he and I both
[3:17:04] take offense the city engineers comments
[3:17:06] that we consider them to be out of line
[3:17:08] the last review cost me and still is
[3:17:12] costing me money I need to be out of the
[3:17:14] place I'm at I need to move on I need
[3:17:17] the City Engineer to work and explain
[3:17:19] exactly what we need up front and not a
[3:17:21] bunch of rework thank you ma'am
[3:17:26] anyone else
[3:17:36] yeah there you go
[3:17:38] nope yeah when the red lights on it
[3:17:42] are you guys is she ready you are uncle
[3:17:46] rideth Julie Rieger I'm at 90 $0.15 of
[3:17:49] our Court first of all I just want to
[3:17:52] say thank you for what you guys do my
[3:17:54] husband grew up in Garden Ridge when it
[3:17:56] was a small population we've been here
[3:17:58] six years now and it's a great place to
[3:18:01] live we love it and we're so glad to get
[3:18:03] to raise our daughter here and I know
[3:18:05] the time and effort that you put in here
[3:18:07] especially those who are volunteers is a
[3:18:10] sacrifice and being away from your
[3:18:12] family and I appreciate just everything
[3:18:16] you guys do to make this a great place
[3:18:18] to live I want to advocate on behalf of
[3:18:22] residents of George Ranch I we have not
[3:18:25] had any feral hog issues but I just
[3:18:28] wanted to say we appreciate your efforts
[3:18:31] thus far and would ask that you would
[3:18:33] continue to look at a multi-faceted
[3:18:35] approach to treating the feral hogs in a
[3:18:39] proactive manner and the research and
[3:18:42] data does show that there is no one
[3:18:45] absolute best way and only way to treat
[3:18:48] feral hogs but your effectiveness does
[3:18:51] increase if you attack it from a
[3:18:55] multiple venue or in various ways so if
[3:19:01] you would consider
[3:19:02] other ways in addition to trapping and
[3:19:05] then to a comment that was made earlier
[3:19:07] today about
[3:19:10] there's expected growth probably with
[3:19:13] the as as we can tend to have
[3:19:15] development in the area feral hog
[3:19:17] attacks will continue and will only
[3:19:19] increase so I would ask that you guys
[3:19:22] would consider
[3:19:23] making a line item in the budget to
[3:19:26] proactively plan on dealing with the
[3:19:29] feral hog issue rather than and I'm new
[3:19:33] at this so I don't I'm not sure I don't
[3:19:35] know everything about the budget but I
[3:19:37] don't think it's a specific line item
[3:19:39] right now and I believe that the problem
[3:19:41] is only going to increase and for the
[3:19:43] protection of the quality of our life
[3:19:46] and
[3:19:46] residents of Olive Garden roads we'd ask
[3:19:48] that you would look at that in the
[3:19:51] future thank you ma'am anywhere else
[3:20:09] ken Kenai / 88-91 chain tall road oh
[3:20:14] yeah I am astounded by being reminded
[3:20:17] that you all are not giving citizens an
[3:20:20] opportunity to speak I not only attend
[3:20:23] this meeting res religiously but also
[3:20:25] ten school board meetings and the people
[3:20:28] that are in the audience can only speak
[3:20:29] once at the school board and that's
[3:20:32] prior to the meeting and we need to
[3:20:34] dress something on the gun the agenda or
[3:20:37] something we find very near and dear to
[3:20:39] our hearts so you are giving now every
[3:20:42] citizen an opportunity to speak saying
[3:20:45] you don't as totally I don't know where
[3:20:48] they're where they're coming from
[3:20:50] when I was in the military we said they
[3:20:52] listened to a latrine lawyer there are a
[3:20:55] lot of them I think they live in our
[3:20:57] city they think they work for an
[3:20:59] attorney or they think they know the law
[3:21:01] and they don't know the law so they need
[3:21:03] to get an education there before they
[3:21:06] put something out in social media order
[3:21:08] to get their group to start attacking
[3:21:11] and questioning you they really need to
[3:21:14] find out what the law really says and I
[3:21:18] guess I don't have a problem with them
[3:21:21] other than the fact I love to be on
[3:21:24] their into their the loves walk their
[3:21:26] love miss so I'm sure I'll get some
[3:21:28] comments very shortly on next door about
