[4:09] if you could raise your hand, we would
[4:11] love to hear your comments.
[4:22] » I am Sheldon Birch. I am
[4:25] not here to complain about anything.
[4:27] >> Good. We love that.
[4:28] >> [laughter]
[4:30] >> I'm as you know, I'm probably know I'm
[4:32] on the Erda City Council and as I look
[4:33] at your agenda, I'm glad to know that
[4:35] Erda is not the only one with difficult
[4:36] things on on their agenda. And I'm
[4:40] I also assume you know that I'm running
[4:42] for a House District 29 and I am here
[4:44] and listening and trying to pay
[4:46] attention, doing my best. So, thank you.
[4:49] >> Thank you. Thanks for your concern for
[4:50] our community. Appreciate it.
[4:54] And thanks for not complaining. We

[5:06] » Anybody online, Alicia?
[5:09] All right, we're going to close the
[5:10] public comment portion of our
[5:13] agenda tonight.
[5:15] Um the next item of business is the
[5:17] summary action items.
[5:19] Uh the approval of minutes from the June
[5:21] 3rd, 2026 City Council regular meeting.
[5:24] Do any of the council members have any
[5:26] corrections to the minutes?
[5:28] And if not, can I get a motion?
[5:33] » Mayor, I'll make a motion. We move to
[5:35] approve minutes of June 3rd, 2026 City
[5:38] Council regular meeting.
[5:40] >> We have a motion by Council Member
[5:41] Thomas. Is there a second?
[5:43] >> I'll second the motion.

[5:46] in favor?
[5:46] >> Aye.
[5:47] >> I.
[5:48] >> Okay.
[5:49] And
[5:51] item B,
[5:53] um approval of the bills. Does anybody
[5:55] have any concerns with the bills as
[5:57] they've been presented?
[6:05] And if not, can I get a motion?
[6:10] » Mayor, I make a motion that we approve
[6:11] the bills as presented.
[6:14] >> We have a motion by Council member
[6:15] Williams for the approval of the bills.
[6:17] Can I get a second?
[6:19] >> I second.
[6:20] >> Second by Council member Thomas. All in
[6:22] favor?
[6:23] >> Aye.
[6:25] >> Thank you.
[6:27] The next item tonight, um is exciting.
[6:30] It's the recognition of the rodeo
[6:32] committee.
[6:33] Uh we would like to take a moment to
[6:35] recognize the many individuals who
[6:37] helped make the return of the
[6:38] Grantsville Rodeo possible.
[6:40] As many of you know, this year's rodeo
[6:43] marked the return of a community
[6:45] tradition that has been absent for
[6:46] several years. As a child, I remember
[6:49] the rodeo vividly. I remember working in
[6:51] the concession stand. Um it was just a
[6:53] great time of year. It was exciting. And
[6:56] it has been missed from our community
[6:57] for several years.
[6:59] While residents and visitors enjoyed the
[7:01] rodeo events and festivities, what often
[7:03] goes unseen are the countless hours of
[7:06] planning, preparation, coordination, and
[7:09] physical labor required behind the
[7:11] scenes to make an event of this size
[7:13] successful.
[7:14] The success of this year's rodeo was
[7:16] truly a community effort. We are
[7:18] grateful for the members of the rodeo
[7:20] committee, the city staff from multiple
[7:23] departments, sponsors, volunteers, and
[7:26] community members who generously gave
[7:28] their time, talents, and resources to
[7:30] support this event.
[7:32] I would like to especially recognize the
[7:34] extraordinary efforts of our parks
[7:36] department and roads department. These
[7:39] employees dedicated countless hours
[7:41] preparing the grounds,
[7:45] um
[7:47] maintaining facilities, coordinating
[7:49] logistics, setting up and taking down
[7:51] equipment, and ensuring the event was
[7:53] ready for participants and spectators.
[7:56] Their hard work was instrumental to the
[7:58] success of the rodeo and often took
[8:00] place behind the scenes without
[8:02] recognition.
[8:03] I would also like to recognize the
[8:05] members of the rodeo committee whose
[8:08] vision, leadership, and commitment
[8:10] helped bring the Grantsville back to our
[8:12] community after years of absence.
[8:15] Their willingness to invest their time
[8:17] and energy into reviving this cherished
[8:19] tradition made this event possible.
[8:22] And I would like to just add um one of
[8:25] the greatest things for me for the rodeo
[8:26] was I feel like I I just have new
[8:29] friends. I got to know some of the
[8:31] people on the rodeo committee that I
[8:33] didn't know prior, and they are amazing
[8:35] people with
[8:36] a great work ethic and just a
[8:40] It was just fantastic. So, what I gained
[8:42] from the rodeo was friends. So, thank
[8:44] you. I appreciate it was just a a
[8:46] pleasure to work side by side with you
[8:48] in the many hours and time and several
[8:50] of the council members as well.
[8:52] Um on behalf of Grantsville City
[8:54] Council, city staff, and the residents
[8:56] of Grantsville, we extend our sincere
[8:58] appreciation to everyone who contributed
[9:01] to the successful return of the
[9:02] Grantsville Rodeo. Tonight, we are
[9:05] honored to present the mayor's award of
[9:07] appreciation to the Grantsville Rodeo
[9:09] Committee, the Public Works Parks
[9:11] Department, and the Public Works Road
[9:13] Department in recognition of their
[9:15] exceptional service and dedication.
[9:18] And I would like to read the names um of
[9:22] those departments and those individuals
[9:24] from the committee to um be recognized
[9:27] and um if they would please come
[9:30] forward.
[9:32] Yeah, our Shelly's right there. She
[9:34] wants to, but maybe
[9:35] she could probably use some help. Yeah.
[9:38] >> I'll be August 5th.
[9:39] >> Yeah.
[9:42] And if these individuals are are here,
[9:45] if they would please stand and we will
[9:47] probably not sort the certificates out
[9:50] as quickly as
[9:51] we'd like to, but if you would just
[9:53] stand, we would love to recognize you.
[9:55] Shane Johnson
[9:58] Christine Parker
[10:02] Larry Peterson
[10:06] Aaron Stevanus
[10:09] Aspen Clegg
[10:12] Michelle Barney
[10:16] Mitchell I'm sorry. I read that wrong.
[10:18] Mitchell Barney, Shelby Moore
[10:22] Trent Riddle
[10:25] Anthony Butler
[10:29] Ryan Durfee
[10:32] Steve Barney
[10:35] Ben Henderson
[10:38] Colton Newsome
[10:41] Canyon Williams
[10:43] Race Wheeler
[10:46] Andrew Mascaro, I hope I pronounced that
[10:48] right.
[10:49] Hunter Haymore
[10:51] Bryce Eakins
[10:53] Kevin England
[10:55] Ali Baird
[10:57] Audrey Critchlow
[11:00] and Canyon Tynan
[11:02] And also thank you to our public works
[11:04] director for allowing them the time to
[11:06] escape other projects. So thank you
[11:08] Christie. I'm sure she was Stand on up,
[11:11] Christie.
[11:13] All right, so to these individuals we
[11:15] sincerely offer our gratitude. I know
[11:18] how many hours you all spent and I
[11:20] appreciate it and because of that it was
[11:23] a fabulous success and I can't wait for
[11:26] next year. So
[11:37] » Thank you all very much. And then we
[11:39] have
[11:40] Do you have those?
[11:42] Go ahead and grab them. Okay, we have
[11:44] these little uh
[11:45] cowboys also to give to each of the
[11:47] different groups that that made this a
[11:49] success.
[11:50] And I think that Shelby Moore deserves a
[11:53] huge round of applause all on her own.
[12:01] Thank you, Shelby.
[12:02] >> Thank you.
[12:02] >> It was phenomenal. You did a great job.
[12:05] >> She has a little presentation.
[12:06] >> Okay, and now she is going Item number
[12:08] four is a discussion and council
[12:11] direction on the Battle of the Bronx
[12:13] during the Honey Harvest Festival
[12:14] presented by Shelby Moore, but I think
[12:16] Are you presenting something from the
[12:18] rodeo?
[12:18] >> It was just for the rodeo committee.
[12:19] >> Okay.
[12:19] >> I think it would be great just to kind
[12:21] of go through this and look at the
[12:22] wonderful pictures that were taken.
[12:25] Um
[12:25] so you can see
[12:27] you know, our sponsors were tremendous.
[12:29] Um these pictures were taken by um
[12:32] Lauren, Shane's daughter. Uh she donated
[12:35] her time um and the pictures to the
[12:37] city. If you just go through those.
[12:40] So you can see
[12:41] um
[12:43] uh it was a fantastic rodeo and it was
[12:46] emotional Saturday, especially when we
[12:47] had the flag fly in and
[12:49] um so as you can see, this is Friday and
[12:51] the huge crowd and
[12:53] so it was great.
[12:55] Um just some pictures of the rodeo
[12:56] committee hanging out.
[12:58] Um helping with the the sheep and other
[13:01] livestock. The bottom picture is kind of
[13:03] my favorite.
[13:04] >> [laughter]
[13:05] >> Um
[13:07] yeah, if you just want to keep going.
[13:08] Um this is just a little video kind of
[13:10] what the grounds look like before and
[13:11] after.
[13:13] >> [snorts]
[13:13] >> So, you know, Ben and Colton and their
[13:15] team did a phenomenal job.
[13:20] And then if you want to go to the next
[13:21] slide.
[13:26] Just hit escape and then the next slide.
[13:28] >> Oh.
[13:29] It just this
[13:31] Keep going?
[13:31] >> No, hit escape.
[13:39] » That was good.
[13:40] And you've got the
[13:40] >> Anyways,
[13:41] um it was fantastic. I do have
[13:44] a video that I would like to play for
[13:46] the
[13:48] um bronc riding. It's called Battle of
[13:50] the Broncos.
[13:52] It's a
[13:54] event that I think would be fantastic to
[13:57] run in lieu of the Honey Harvest
[13:59] Festival.
[14:15] Make sure we have good audio this time.
[14:17] Last time it didn't go well.
[14:20] >> [clears throat]
[14:32] » So, I think it'd be fun to to have that
[14:34] event. Um
[14:35] I have reached out to sponsors, and I
[14:37] have had
[14:39] um almost $30,000 worth of sponsorship
[14:41] um guaranteed and interested in
[14:44] sponsoring not only the Battle of the
[14:45] Broncos, but the next year's Memorial
[14:47] Day Rodeo.
[14:49] And so, I think this would be
[14:51] um a great opportunity to bring our
[14:52] community together again. Um
[14:56] So, yeah. We're just looking for
[14:57] direction from council to see if that's
[14:59] something we want to do.
[15:02] » I think yes.
[15:04] I was like I was amazed at the rodeo. I
[15:06] just I I went both nights, and I thought
[15:08] it was so many people that said such
[15:09] positive things. It was great. It was
[15:11] good to see, I mean, meet people, like
[15:13] you said. And so, I think this is
[15:14] something I mean, I've been to Honey
[15:16] Har- Harvest Festival, too, obviously,
[15:17] but the um
[15:18] I think this So, this would go on at the
[15:20] rodeo grounds the same weekend we're
[15:21] doing the honey harvest festival.
[15:23] >> Correct. Yep, October 10th. So, that's a
[15:25] Saturday. The Honey Harvest Festival
[15:27] gets over about 5:30, 6:00. That's when
[15:29] we're wanting to bring the crowd over to
[15:30] the rodeo, you know, so they can go get
[15:32] their honey and we can get some of those
[15:34] vendors to, you know, transition over
[15:35] and and bring that crowd.
[15:38] >> Yeah, that is fine [snorts] with me.
[15:39] >> I think it's a good idea. I missed the
[15:41] rodeo, unfortunately, as I was on a
[15:43] vacation that was booked well in
[15:44] advance. So, I'm sorry I couldn't
[15:45] cancel, but
[15:47] I love to go to something else and I
[15:48] don't have any vacations planned for us
[15:50] over the 10th.
[15:51] >> [laughter and clears throat]
[15:51] >> Perfect. We'll put you to work there.
[15:54] Good to know your schedule's open.
[15:56] >> [laughter]
[15:58] >> Now we got more than a month to plan, so we're ready.
[16:03] We'll just hang [clears throat] out
[16:03] until September.
[16:04] >> That's right.
[16:05] >> [laughter]
[16:06] >> Well, we did all the hard work, so we're
[16:07] good now.
[16:08] >> it's great. Honey Harvest Harvest
[16:09] Festival brings in a ton of people
[16:11] >> Mhm.
[16:11] >> and I think it'd be nice segue into
[16:14] that. Long day for some people, but it'd
[16:15] be fun.
[16:16] >> Yeah, it's a good complimentary
[16:18] activity, I think, with the Honey
[16:20] Harvest Festival, so.
[16:21] Jeff or Jake, do you have any input?
[16:23] >> No, I I I feel the same. [clears throat]
[16:25] I I think uh we talk about, you know,
[16:27] his you know, traditions that we have
[16:29] and some of these it's sad that they've
[16:31] kind of gone by the wayside and
[16:33] we're able to
[16:35] rejuvenate it and I'm hoping that, yeah, that it
[16:38] continues to be something that, you
[16:40] know, memories can be made and
[16:42] you know, Mayor mentioned some memories
[16:44] that she has and
[16:45] be able to have that happen for future
[16:47] generations in Grantsville. Um we have
[16:50] some really awesome traditions that, you
[16:52] know, the 4th of July we got that coming
[16:53] up here.
[16:54] It's a week-long
[16:56] awesome week and
[16:58] we we grow as a city during that time
[17:00] from from where all everyone comes to
[17:02] visit and so having some of these things
[17:04] that
[17:05] can help benefit our community and bring
[17:07] us together, I think, are very
[17:09] beneficial. I I fully support it, so.
[17:12] >> Be great. Let's do it.
[17:14] >> Let's do it. There's the word. Let's do
[17:16] it. All right. Rodeo committee, get back
[17:19] to work. You [laughter] can't stay here
[17:20] any longer. Head back out there.
[17:24] All right. Thank you very much. Thank
[17:25] you to Shelby. Thank you to the Roads
[17:27] Department, the Parks Department, and
[17:29] the and the Rodeo Committee especially.
[17:32] Thank you so much for all your work. So,
[17:34] thank you.
[17:36] Moving on to agenda item number five, a
[17:39] presentation from the Division of Water
[17:41] Resources regarding a water-wise
[17:43] landscape incentive program and council
[17:46] directions. And also to all those who
[17:48] are here with the Rodeo Committee, this
[17:50] is fascinating stuff. You're welcome to
[17:52] sit around and listen. If you do not
[17:55] want to, please feel free to be excused.
[17:58] You do not need to feel obligated to sit
[18:00] here all night.
[18:00] >> [laughter]
[18:02] >> Yeah.
[18:02] >> Thanks.
[18:03] >> I might have to
[18:05] >> Hold on one second.
[18:06] >> Something with my computer glitches.
[18:07] >> [laughter]
[18:11] » Thank you.
[18:19] » Okay. So, are your name is Heidi as well
[18:22] as mine? Okay, we have two Heidis.
[18:24] >> Can you hear this? There we go. Okay,
[18:26] yes. Two Heidis. It's not very often I
[18:28] get to meet another Heidi.
[18:29] >> Yeah, it's great. The Conservation
[18:31] Coordinator with the Utah Department of
[18:32] Natural Resources Division of Water
[18:34] Resources.
[18:35] >> Yes, that's a very long
[18:37] >> very long title. Okay.
[18:38] >> very long. Usually we just say with
[18:39] Water Resources and people can remember
[18:41] that.
[18:42] >> Heidi King King from King from Water
[18:44] Resources. There you go.
[18:46] >> Yes. Um I'm here to speak on the
[18:48] statewide landscape incentive program
[18:50] and I greatly appreciate the council's
[18:52] time to be able to present on this and
[18:54] answer any questions that you may have.
[18:58] So, I will briefly discuss what the
[19:00] landscape program is and who is
[19:03] eligible, why we incentivize lawn
[19:05] removal, and what we do not incentivize,
[19:08] as well as those conservation benefits
[19:11] associated with it, additional resources
[19:13] that are available to participants, and
[19:15] then I'll take any questions at the end.
[19:19] So, the landscape incentive program
[19:21] began in 2023. It is a statewide
[19:24] program, and it is available to
[19:27] residents and any properties uh that are
[19:31] residing in municipalities that have
[19:33] adopted water-efficient landscape
[19:34] ordinances for new construction. This
[19:37] rebate is delivered by the Division of
[19:40] Water Resources in partnership with the
[19:43] largest water districts in the state.
[19:45] So, the large water districts, they
[19:47] cover the population centers, so along
[19:49] the Wasatch Front and Washington County.
[19:51] And then Water Resources, we deliver the
[19:54] program to the more rural areas of the
[19:56] state, including Tooele County.
[19:58] Um
[20:00] and we promote switching from the
[20:02] traditional Kentucky bluegrass to
[20:04] water-wise landscaping. And this is some
[20:06] good before-and-after photos. The most
[20:09] common projects that we see are in the
[20:11] park strip, because that's where the
[20:12] biggest water savings can happen.
[20:15] It's uh water
[20:17] sprinklers really struggle, the
[20:19] technology of it, to water anything
[20:21] that's less than 8 ft wide efficiently.
[20:24] So, anything that's smaller than that 8
[20:26] ft wide is going to experience overspray
[20:28] and dry spots, which is why park strips
[20:31] tend to struggle the most. And then
[20:33] people see dry spots, so then they water
[20:34] it even more. Uh and that's why park
[20:38] strips are very popular for this
[20:40] conversion, because it's so much easier
[20:42] to take care of, as well as reduce that
[20:44] water use.
[20:46] Go ahead to the next one.
[20:49] So, this is what we do rebate. Um
[20:53] the There's a photo behind, but and you
[20:55] can't see it, and I apologize for that,
[20:57] but that's okay. Um the photo behind has
[20:59] grass in it. We do incentivize the
[21:02] removal of grass, but we don't
[21:04] incentivize removing everything. So,
[21:07] it's okay if you can't see. We'll be
[21:09] okay.
[21:10] Uh so,
[21:12] the photo on the right is not something
[21:13] that we incentivize. We don't
[21:15] incentivize full hardscaping because it
[21:18] has some ecological uh detriments to it
[21:22] and we don't want to incentivize that.
[21:24] That's not something that we encourage
[21:25] either. Uh the photos on the left are
[21:27] what we do incentivize. So, you can
[21:29] remove all of your grass and replace it
[21:31] with water-wise plants. We do require
[21:33] that at least 50% of the project area
[21:36] have plants and water-wise plants are
[21:37] really anything that is uh longer lived
[21:41] than 1 year typically. So, perennial
[21:43] shrubs, trees, bulbs, anything except
[21:46] for the grass and the annuals. Um and
[21:49] you can keep grass. Uh
[21:52] we often see people remove grass in the
[21:54] hardest areas to maintain that's not
[21:57] really being used. So, typically against
[21:59] the fence or structures, buildings, and
[22:01] whatnot that takes a lot of equipment to
[22:03] maintain and reduce the amount of grass
[22:06] that they have so it's just a usable
[22:07] area. It's bigger than 8 ft wide so it's
[22:10] easy to maintain as well as using less
[22:13] water.
[22:14] Go ahead to the next one. So, this is
[22:16] just a quick snapshot of the cities that
[22:19] are eligible for this program. Um we did
[22:22] just get Layton City is on there now so
[22:25] we have 73 eligible cities
[22:27] um or municipalities
[22:29] and it's continually growing especially
[22:32] in the more rural areas. Go ahead to the
[22:35] next one. I mentioned our partnerships.
[22:38] This is just a a brief visual map of
[22:40] what that looks like. So, the blue areas
[22:43] are covered by water districts and then
[22:45] the rest of the state is what we uh
[22:48] deliver this program to.
[22:53] So, how do people become eligible for
[22:55] this? So, the
[22:56] uh the incentive is $2 per square foot
[22:59] of lawn that's removed and water-wise
[23:01] plantings are replaced with that. So,
[23:04] that is the plants, drip irrigation, and
[23:07] a mulch. That's the program.
[23:10] And a city has to adopt a
[23:13] water-efficient landscaping standards
[23:15] for new development only. This is not a
[23:17] retroactive program. It does not apply
[23:19] to properties that already exist. It is
[23:21] for new developments only. And I'll go
[23:24] over what those
[23:25] standards are in just a moment. So,
[23:28] eligible projects are really any
[23:31] property type. So, it's not just
[23:32] homeowners, but commercials and
[23:34] commercial properties and businesses, as
[23:36] well as government properties such as
[23:39] government buildings, libraries,
[23:42] public works buildings. The only
[23:44] exceptions would be golf courses,
[23:46] agricultural property, sod farms, and
[23:49] parks.
[23:51] And then application is pretty simple.
[23:53] It's through Utah Water Savers right
[23:56] now. We're transitioning to
[23:57] slowtheflow.org.
[23:59] So, either one of those websites will
[24:00] get you the incentive program.
[24:05] So, these are the ordinance
[24:06] requirements. This is only for new
[24:08] development. It does not apply to
[24:10] existing properties. And it's as simple
[24:14] as this. And I will preface this with we
[24:16] work with all of the cities to adopt
[24:19] these ordinances because we recognize
[24:21] that it's not a one-size-fits-all.
[24:23] And there's a lot of flexibility with
[24:25] it. And one of my colleagues is the
[24:27] person who works closely with the cities
[24:29] to help them figure out what ordinances
[24:33] exactly, how to word it, will fit for
[24:36] the municipality. So, these are the bare
[24:38] minimum. Is no lawn in park strips. And
[24:41] I noticed Grantsville doesn't have a ton
[24:43] of park strips, so that shouldn't be too
[24:45] difficult.
[24:46] No lawn in areas less than 8 ft wide.
[24:49] And then lawn limitations for the front
[24:51] yards. So,
[24:52] half of the front yard and side yard
[24:54] landscaped areas
[24:56] uh be more than half of it being grass.
[25:00] Uh and then there's some exceptions for
[25:02] those really small lots, especially for
[25:04] multi-family housing. And then some lawn
[25:07] limitations for the commercial,
[25:09] industrial, and institutional properties
[25:11] that have large properties. We don't
[25:13] want it all grass. Uh that takes a lot
[25:15] of water. We want to be intentional
[25:17] about how we're landscaping because uh
[25:20] it uses
[25:22] uh usually up to like 75 70% more water
[25:25] than the water-wise landscaping.
[25:27] Go ahead to the next.
[25:29] >> [snorts]
[25:29] >> And this is what it looks like in
[25:30] practice. A lot of people get really
[25:32] nervous about these ordinances and what
[25:34] it will look like, and they don't want
[25:36] all rock, they don't want all
[25:37] desert-looking stuff, they want grass to
[25:39] be able to play on. And again, this only
[25:41] applies to the front yard. So, you'll
[25:43] see on the left-hand side there's still
[25:44] grass. There's just not grass going up
[25:47] to the fence or the house. That's
[25:49] landscaped with water-wise landscaping,
[25:51] and then the park strip is just plants.
[25:53] And we see a lot of water-wise plants as
[25:56] well as trees in the landscape.
[26:00] The ordinance is is the first step to
[26:04] letting residents become eligible for
[26:06] this program. So, you adopt those
[26:08] ordinances, and you send that to us for
[26:10] review. And we work with you. It doesn't
[26:13] cost the city anything to do this. Uh
[26:15] and then we add you to our eligibility
[26:17] list.
[26:18] The role that you have is just upholding
[26:20] those ordinances.
[26:22] And how you enforce those is up to you.
[26:25] And let's see. And program promotion,
[26:28] you don't have to do that, but you're
[26:30] welcome to if you want to promote the
[26:31] program to your residents. Uh we
[26:34] appreciate it. We think it's great. It's
[26:35] a great water conservation tool. Uh and
[26:38] then we are the ones that are running
[26:39] this program. You don't have to do
[26:41] anything. If people ask you questions,
[26:43] you can direct them to us. Uh but
[26:45] really, we're the ones that answer the
[26:46] phone calls, we schedule appointments,
[26:48] we process the applications, and we run
[26:51] this entire program, and it's there's no
[26:53] cost associated to the city itself.
[26:59] These are some of our resources that we
[27:00] have available for the participants. You
[27:02] don't have to participate in the program
[27:04] to be able to access these. These are
[27:06] readily available on our website.
[27:08] However, we do send uh customized emails
[27:11] to participants, especially along the
[27:13] way while they're doing their project,
[27:15] to really support them throughout this
[27:17] project as well as aftercare and the
[27:19] maintenance of it because we don't want
[27:21] people to go through the program and
[27:23] then get frustrated when they are not
[27:24] sure what to do once everything's
[27:26] installed. So, we do have a landscape
[27:29] guide
[27:30] as well as a monthly webinar series. Uh
[27:34] all of these are free. We do include a
[27:36] landscape incentive program checklist of
[27:38] what they need to do.
[27:40] And we do have a statewide water wise
[27:42] plant list available.
[27:44] We are a Localscapes partner.
[27:47] Localscapes is a partner education
[27:49] program that provides It's the education
[27:51] component to the landscape incentive
[27:52] program.
[27:53] Uh provides education for
[27:56] water wise landscaping, and those
[27:59] classes can be found either online, or
[28:01] we will even work with you to provide it
[28:04] to your community. So, we'll come to you
[28:06] and teach a class completely free. Uh
[28:09] and it's tailored to your region. So,
[28:12] it's not Wasatch Front, it's for
[28:15] Grantsville specifically.
[28:17] And then we are a WaterSense EPA
[28:20] WaterSense partner, and they do have a
[28:23] fantastic certified irrigators list for
[28:26] qualified water efficient landscapers
[28:29] available.
[28:32] This is all of our contact information.
[28:34] If you have questions, specific
[28:36] questions, we're happy to answer them.
[28:37] Candace is the colleague I mentioned
[28:39] that helps review these ordinances and
[28:41] works side by side with the cities to be
[28:43] able to get those in place. Madison is
[28:46] our uh program coordinator over the
[28:49] landscape incentive program.
[28:51] >> [snorts]
[28:51] >> Uh I help coordinate and teach our local
[28:54] scape classes and develop those
[28:56] landscape resources. And then our two
[28:58] technicians help deliver the program and
[29:00] process those applications. And our
[29:02] contact information can be found there.
[29:04] Are there any questions that I can
[29:07] answer?
[29:09] >> I have one little question. You You
[29:11] mentioned no annuals.
[29:13] So, if somebody has mostly perennials,
[29:17] but they include some annuals, they're
[29:18] out like you're out.
[29:20] >> No, that. So, we just encourage
[29:23] that annuals be planted either in their
[29:25] own bed or in pots, not mixed in with
[29:29] the perennials, but that won't
[29:30] disqualify them from the program. Okay.
[29:32] No, good question.
[29:34] >> And does the ordinance just allow us to
[29:35] participate in this if people want to?
[29:37] It just says the ordinance would be
[29:38] structured to say, if a citizen wanted
[29:40] to, then our city would qualify and that
[29:42] puts us the best It wouldn't be
[29:43] mandatory for anybody to do this. It
[29:45] would just be if they
[29:45] >> No, the landscape incentive program is
[29:47] the incentive piece. It's meant to
[29:50] incentivize
[29:52] properties that already exist, that
[29:54] already have those landscapes. They are
[29:55] not required to do this. It is not a
[29:59] mandatory program by any means.
[30:02] >> So, the ordinance would just be allowing
[30:03] us then to participate.
[30:04] >> Yeah, so the ordinances are for the new
[30:06] construction only. We're trying not to
[30:09] waste tax dollars as well as um
[30:13] it's kind of like chasing our tail.
[30:15] We're trying to fix a problem, but not
[30:17] preventing the problem from happening
[30:18] anymore. And so, we're trying to
[30:22] uh reduce that uh inefficiency. So,
[30:25] we're not creating new problems. Those
[30:27] landscapes look great, they're
[30:28] efficient, and then uh incentivizing the
[30:32] existing landscapes to be more
[30:33] efficient.
[30:35] >> So, the incentive is just to for
[30:37] clarification, the incentive is just for
[30:40] existing landscapes, correct?
[30:41] >> Yes, it only it is only for existing
[30:44] landscapes. It is not for new
[30:46] construction.
[30:46] >> Okay.
[30:47] >> Yeah, great question.
[30:51] Any other questions or concerns that I
[30:53] can address?
[30:58] » No Heidi, thank you for being here. Um,
[31:01] I we've had some residents express
[31:02] interest in this and because we're not
[31:05] on a on that, you know, we don't qualify
[31:07] in that incentive.
[31:10] They don't have the option to be able to
[31:11] do this and so
[31:13] the I mean obviously it it ought to be
[31:16] the division of limited water quality,
[31:18] you know, limited water because we live
[31:20] in the fifth driest state in the nation.
[31:21] So, but it
[31:23] um, finding ways uh
[31:26] to allow our residents to convert some
[31:28] of that the some of those areas into an
[31:31] and take it opportunity for this program
[31:33] was the reason why
[31:35] I wanted to when we wanted to see if the council would have interest in
[31:39] doing that. What that means is, you
[31:41] know, ensuring that
[31:43] you know, the the we we align with those other four items that were listed
[31:47] there if there was any concerns on
[31:49] those. So
[31:50] >> need to change our code
[31:52] to align with that.
[31:54] Uniquely Alexis had been working on
[31:57] getting a draft that prepared for
[31:59] council. So
[32:00] Uh, Jay brought this up and our council
[32:02] member
[32:03] almost brought this up and so we thought
[32:05] it would be a good idea before Alexis
[32:07] got all the way through that process to gauge the interest was what council
[32:11] wanted to do and take that direction.
[32:16] » I think that's a good idea.
[32:17] I think I like the education portion
[32:18] too. I'm not a gardener at all. So like
[32:20] when you say water wise, I don't even
[32:21] know what that means. So I'm like so
[32:23] having somebody to go like what would be
[32:24] good here, what what what qualifies? I
[32:26] think that's super helpful for people.
[32:28] And yeah, I mean water's a big issue. So
[32:31] >> is.
[32:32] >> Do you go out to [clears throat]
[32:32] different cities and do classes or all
[32:34] webinar? city.
[32:35] >> Um, we do an annual webinar, but we do
[32:38] individual classes as needed. So, if you
[32:42] would like one, I'm more than happy to
[32:44] coordinate with you on one. Um, for
[32:46] example, we're teaching one in Tooele on
[32:48] Monday. You're welcome to come if you'd
[32:50] like, see what it's about. Um,
[32:52] and we're focusing on they wanted to
[32:55] focus on native plants for Tooele County
[32:58] specifically, so that's what we're
[32:59] doing. Uh, so we're happy to curate or
[33:03] uh
[33:04] specialize the class to fit whatever
[33:06] your residents and your community needs
[33:09] are. We want to make sure that it's
[33:11] impactful and a good use of everyone's
[33:13] time.
[33:14] >> Okay, right. The the city can with their
[33:17] properties can participate in the
[33:18] program.
[33:19] >> Yes. Um, the parks cannot, the golf
[33:21] courses cannot, but like this building
[33:23] here, you could easily participate in
[33:25] this program. Yes.
[33:28] >> And there's other incentive programs as
[33:29] well, like for I think they're I think I
[33:32] did one
[33:33] um, that was for uh electronic like a
[33:38] smart
[33:39] >> Yeah, the smart controllers.
[33:40] >> controller
[33:40] >> Those are available to anyone anytime.
[33:42] You don't have to live in a specific
[33:44] city to be able to do those. But yes, we
[33:46] do offer a rebate of up to $125 for a
[33:50] smart irrigation controller.
[33:52] So, if you want a new irrigation
[33:54] controller for your home, I highly
[33:55] recommend it.
[33:59] » What's that like council wanting to see
[34:01] a draft and go forward on? So, I'll have
[34:03] that.
[34:04] >> I think so.
[34:05] >> that application that change.
[34:07] >> Okay.
[34:09] Thank you.
[34:09] >> Sounds great. Thank you so much for your
[34:10] time.
[34:11] >> Thank you. And thanks Jake for reaching
[34:13] out to the Division of Water Resources and
[34:16] getting this information for us.
[34:21] All right.
[34:22] Item number six is a council appeal
[34:25] decision, consideration of resolution
[34:27] 2026-38
[34:30] approving a driveway deviation for the
[34:32] property located at 48 McMichael Avenue.
[34:38] » Um, so this is a secondary access
[34:42] property. So, McMichael is just kind of
[34:45] it's east of Sinclair.
[34:47] For those of you that don't know exactly
[34:49] where that's at.
[34:50] Um, [clears throat]
[34:51] >> [sighs]
[34:52] >> we received a application on March 20th
[34:54] after the staff
[34:56] reviewed it and we became aware of what
[34:58] the original driveway used to look like.
[35:00] And it was expanded without
[35:03] um, city authorization,
[35:06] um,
[35:06] you know, then we just began to work
[35:08] with the applicant. There was a
[35:09] violation for the meter box. The
[35:11] applicant
[35:12] did a cut after we brought that to their
[35:15] attention. They did cut the driveway um,
[35:18] the two feet around two or three feet
[35:20] around the meter that is required. Um,
[35:23] so they have done that. We're just here
[35:25] for city council to determine if they're
[35:28] going to allow the driveway to stay
[35:29] built how it is
[35:31] or if they are going to require it to be
[35:34] brought to city standards. So, a few
[35:36] issues that we need to address. And if
[35:38] you'll scroll down to the pictures.
[35:41] There is a
[35:43] pipe that runs underneath the driveway
[35:45] cuz the driveway actually comes out
[35:47] further than what the gutter is.
[35:51] And um,
[35:53] and so it is sized on the smaller side
[35:55] of things and that was a concern of the
[35:57] engineer and then there is a concern how
[35:59] the driveway comes out um,
[36:03] past the curb and gutter and it actually
[36:05] comes out into the roadway.
[36:07] A a maybe a few inches.
[36:10] >> Sorry, it's
[36:11] glitching.
[36:13] >> You're fine. So, I did the same thing
[36:15] yesterday.
[36:22] So, keep going.
[36:25] » This one?
[36:26] >> Um, that's a good picture to of show the
[36:28] overall view in the front edge, um, and
[36:30] then just kind of how wide the driveway
[36:32] is.
[36:33] If you would keep scrolling.
[36:35] Right there in those pictures.
[36:37] So, you can see that's initially what
[36:39] the, uh, water meter looked like. Again,
[36:41] the applicant did cut that and and
[36:43] address that situation and then scroll
[36:44] down just to that bottom picture.
[36:47] Yep. So, you can see how it comes past,
[36:50] um,
[36:51] the curb pan or the gutter pan.
[36:54] I don't know if it's 4 to 6 in
[36:56] and then you can see
[36:58] >> slightly
[37:01] Here, there's a water bottle blocking
[37:03] it, but here is
[37:04] that pipe.
[37:06] And so, you can see what we're losing as
[37:08] far as the capacity of that
[37:10] curb cutter.
[37:20] » [clears throat and cough]
[37:22] >> And so, you can see what the driveway
[37:23] originally looked like.
[37:25] Um, and then it's expanded from the
[37:27] walkway, uh, over to the property line
[37:30] to the north.
[37:38] » So, just
[37:40] making sure I have it straight. They
[37:41] sent in an application to the city
[37:44] for this project, but we didn't realize
[37:46] that
[37:47] >> [clears throat]
[37:47] >> it was going to be this large or it
[37:49] didn't say on the application.
[37:50] >> No, so, um, there was a violation
[37:53] uh, with the water meter and then we've
[37:56] asked to correct the water meter, then
[37:58] there was a driveway issue and then the
[38:00] applicant has been working with staff
[38:02] with an application, but the issues are
[38:04] that the driveway is expanding past the
[38:06] curb the gutter pan, um, it has the the
[38:10] smaller diameter pipe and then it
[38:11] extends all the way to the north
[38:14] along the property line.
[38:19] So, if you scroll up, um, in the staff
[38:21] report, we actually give the
[38:23] [clears throat] timeline.
[38:24] Keep going. Now, that's the violation.
[38:27] Keep going.
[38:30] One more, I believe.
[38:34] Nope, keep going. Past the picture.
[38:38] That one.
[38:39] Nope, keep going. Sorry.
[38:41] Keep going.
[38:44] Right here. So, August 25th, 2025,
[38:48] initial violation. November 13th, the
[38:51] second violation. January 23rd, a
[38:53] certified letter. March 3rd, a site
[38:56] visit was conducted with the code
[38:58] enforcement officer,
[38:59] um,
[39:00] and the property owner, and attempt to
[39:01] contact the property owner.
[39:03] Then, scroll down.
[39:06] March 13th, the code enforcement officer
[39:08] made contact with the property owner.
[39:10] March 20th, the meter box was corrected
[39:13] and the applicant submitted, um, for the
[39:16] secondary driveway.
[39:18] Um,
[39:19] April 26th, the application was reviewed
[39:22] by the department heads, and May 5th,
[39:24] the applicant was notified that the
[39:25] driveway secondary access did not meet
[39:28] the requirements of the land use
[39:29] ordinance, and needed to seek a
[39:31] deviation through city council.
[39:36] » So, Shabley, on this timeline in Michael
[39:38] such an old road, how long has it been
[39:40] like this?
[39:42] When was the cement or the addition?
[39:45] >> Um, the applicant is here and might be
[39:47] able to answer that. I could look at
[39:49] Google Earth and kind of give you a
[39:50] timeline.
[39:57] » Uh, I've noticed I've noticed these on
[39:59] that street. There's actually more than
[40:01] one, um,
[40:03] that have this.
[40:05] And Tooele has areas, older parts of
[40:07] Tooele has this
[40:11] >> [clears throat and cough]
[40:11] >> where they have a really aggressive
[40:13] gutter system near some
[40:15] residential homes, and so they create a
[40:19] um, um
[40:20] a bridge essentially over that over that
[40:23] gutter system.
[40:24] The gutter system on McMichael is not
[40:26] that deep. So, I
[40:29] I'm not sure
[40:30] what the purpose of those would be and
[40:33] there are some concerns when you place
[40:35] them in in that setting. I don't want to
[40:37] get totally off topic here, but
[40:39] um if if the water's not allowed to pass
[40:42] there and it gets clogged up and it ends
[40:44] up building in that area and then pushes
[40:46] onto the roadway and it will ruin the asphalt in those areas
[40:52] um
[40:53] because the water's not, you know,
[40:55] guttering as it should be. But is this
[40:57] is an old this is an old street, so
[41:00] um one of the
[41:03] maybe the initial curb and gutters and
[41:04] then we went away from it and then we've
[41:06] gotten back to it, which was you know, I
[41:08] don't know why we ever went away from
[41:09] it. It's it's the best way to go if you can do
[41:13] it. So, but this isn't the only home
[41:15] that has that issue in that street. So,
[41:19] I guess what we're looking at
[41:20] specifically tonight is just the secondary access, correct?
[41:27] >> Um
[41:28] you're not [clears throat] looking at
[41:30] >> the deviation of the driveway.
[41:31] >> You're looking at he's expanded or they
[41:33] have expanded the driveway
[41:35] wider than what is allowed per our code.
[41:38] So, you're looking at that seeing if
[41:39] you're going to allow that deviation.
[41:41] They are
[41:43] right up against the property line and
[41:45] so they have um expanded expanded that,
[41:49] which is against the code.
[41:51] Then the pipe sizing wasn't um you know,
[41:53] engineered or looked at to determine if
[41:55] that was the correct pipe size.
[41:58] And so it just doesn't meet
[42:02] city standards.
[42:04] >> I mean, if you look at the original
[42:05] photo
[42:06] it has the bridge out to the road too
[42:07] and it doesn't even look like there's
[42:09] >> Yeah, it looks better in the ground too
[42:10] than it does
[42:12] >> original.
[42:14] >> [clears throat]
[42:14] >> The problem is is that that will divert
[42:17] the water into the road. And when the
[42:19] water goes into the road, it'll start
[42:20] tearing the earth.
[42:22] Getting into the asphalt and it cause
[42:24] more repair damage.
[42:26] >> Yeah, I mean I get that, but I'm looking
[42:27] at like the original and it looks like
[42:29] it's
[42:30] built.
[42:31] Yeah, you can see that on that top
[42:32] photo.
[42:34] >> to me it probably I mean I I think it
[42:37] was done this way not not because of the
[42:39] depth of the gutter. It was probably
[42:40] done this way cuz it was like
[42:42] I've got a curb there and rather than
[42:43] just cut the curb
[42:46] rather than just cut the curbs on these
[42:48] is like we built a ramp over the curb,
[42:50] which
[42:51] um
[42:55] » Yeah.
[42:56] >> what should be done.
[42:59] » And I mean elevations and you know, it
[43:01] may have been too steep. It's a pretty
[43:02] steep
[43:04] uh driveway.
[43:05] Um
[43:07] you know, elevations may have been
[43:08] difficult to kind of get that that
[43:10] transition.
[43:13] » So when they remodeled this a a permit
[43:15] should have been pulled.
[43:16] >> Correct.
[43:18] >> So what's that permit process? Is there
[43:20] a concept presented to you guys? Is
[43:22] there how how does that work? Cuz I see
[43:24] this is coming to us more often in
[43:26] planning commission, too. These second
[43:28] driveways I don't know if it's just cuz
[43:29] we have the code enforcement officer
[43:30] now, but we're seeing more and more of
[43:32] these.
[43:33] So
[43:35] kind of tell me what that process is and
[43:36] then too, what can we do to prevent
[43:40] >> Education.
[43:41] >> these yeah, it will to keep from coming
[43:43] to us every week every two weeks.
[43:45] >> No, absolutely. So um if someone wants
[43:47] to widen their driveway or or expand it
[43:49] or have a secondary access, they can
[43:51] either call in um or they can apply
[43:54] online and they'll submit it can be a
[43:56] hand drawn um site plan. Typically
[43:59] Nicole or I will jump on um you know,
[44:01] Google Earth screenshot and put it into
[44:03] Bluebeam so that we can um
[44:05] draw out the site plan and and measure
[44:07] it and scale it. Um after we've done
[44:10] that and payment has been received and
[44:12] we review this every Thursday. So, right
[44:15] away permits, secondary accesses, things
[44:16] like that, every Thursday.
[44:18] Um we'll review [clears throat] it.
[44:20] We'll determine if it meets code. If
[44:21] changes need to be made, we'll send
[44:23] those comments back to the applicant and
[44:25] then they determine okay, we will adjust
[44:28] that um portion of the driveway or we
[44:30] want to come to council to ask for a
[44:33] deviation.
[44:34] And a lot of times um
[44:37] they would like to just come to council
[44:39] and ask for the deviation.
[44:45] So, we do have driveway standards. Um
[44:48] you know, with chapter six, I did revise
[44:49] them, so they were
[44:51] a little easier to read and understand
[44:52] and it spelled it out of what we need
[44:54] and um the approval process.
[44:57] Um we are working on um getting
[45:00] community and development a Facebook so
[45:02] that we can post consistently of hey,
[45:05] you know, if you want to expand your
[45:07] driveway or you want a secondary access,
[45:08] you need to follow these steps. Here's
[45:10] the link.
[45:11] Or you know, hey, this is the code
[45:13] enforcement for weeds.
[45:15] Things like that.
[45:19] » We got a comment and a question.
[45:21] >> Is that the applicant?
[45:26] » Hi.
[45:27] state your name, please.
[45:28] >> I'm Antonio Vargas.
[45:30] >> Thank you.
[45:30] >> I'm the resident from 48 Michael.
[45:33] Actually, before I did the driveway
[45:36] I asked
[45:37] uh
[45:39] What's his name? Uh
[45:40] Perkins. The
[45:43] uh
[45:45] >> Lyle.
[45:46] Perkins. The
[45:48] I said, "Did I need a permit to put in
[45:50] my driveway?"
[45:52] You know, he said
[45:54] "No, I don't think you need a permit. Go
[45:56] ahead, do it."
[45:58] I asked for a permit if I needed a
[45:59] permit before I did it.
[46:01] And now I don't see what is wrong with
[46:03] the driveway.
[46:04] She said it was bottle clogging the
[46:07] line.
[46:08] I put a big 4-in pipe. You can see all
[46:11] the neighbors
[46:12] to the south, it's all garbage in it in
[46:15] the gutters.
[46:17] It's that a quarter is going to clock
[46:19] it. I If they don't clean it,
[46:22] walk to the neighborhood and watch how
[46:24] dirty they are.
[46:26] I'm not going to throw the
[46:29] you know, blame on people, but
[46:32] what's wrong with the driveway?
[46:35] I asked the neighbor if I can put the
[46:36] fence
[46:37] over the driveway.
[46:40] I didn't do it just because I want to do
[46:42] it.
[46:46] I said we're going to benefit your
[46:48] property and my property. And I didn't
[46:50] ask him for money or anything. I asked
[46:52] for permission to pick and do it.
[46:58] If you will see
[46:59] when your dad house was built,
[47:02] it was built in 1954.
[47:04] You bring the code from that time to
[47:06] this time.
[47:08] Apply the code. But back in that days,
[47:10] they didn't have any code.
[47:15] » I think the the concern of the issue is
[47:18] obviously when you lengthen the
[47:19] driveway, when you lengthen that
[47:21] driveway, you're creating
[47:23] less distance between drive to drive.
[47:27] And it creates a safety issue. This is a
[47:28] through road. Um
[47:31] >> But I see people that have water meters
[47:33] in their driveways.
[47:36] And then, are you guys going to make
[47:37] everybody do that?
[47:39] >> Yeah, they're not allowed in the
[47:40] right-of-way.
[47:40] >> See, it's the same same thing. They
[47:43] asked They sent me letters to
[47:45] They didn't send it to me.
[47:47] They sent it to the previous owner. They
[47:49] didn't connect the One of the officers
[47:51] went and knocked my door. It was kind of
[47:53] mean, like a why you not answer my my
[47:57] uh
[47:58] that I I send it to you say when you
[48:00] send it. I went to the post office they
[48:02] didn't receive any letters from from me.
[48:07] I'm not doing anything illegal. I try
[48:09] [clears throat] to do everything legal.
[48:12] » No, I think when this happens it it
[48:14] >> What is you know, I am proving the
[48:16] house. The only thing I do anything.
[48:19] I don't know anything wrong with the
[48:20] house.
[48:22] I try to do the best I can have my house
[48:24] looking good the way I want it look. I
[48:27] don't want to have a trash home. I want
[48:28] to clean my clean house.
[48:31] Go drive around the neighborhood check
[48:32] the neighbors.
[48:35] I can show you picture I have a neighbor
[48:37] behind me.
[48:39] I have to weed as best as I all the time
[48:41] because
[48:43] rats
[48:44] everything comes to my property.
[48:49] Are you guys going to do that? Check the
[48:51] neighborhood.
[48:53] And see how that looks like.
[48:56] I don't want to put fingers on anybody.
[49:00] The only thing I do on
[49:02] to have a nice driveway I can park my
[49:04] car because I want to park on the
[49:06] street.
[49:09] » How wide is the drive How wide is How
[49:10] wide is the width of the drive that
[49:12] we're looking at?
[49:13] >> I believe it was 41 ft. There's a
[49:15] picture of measurements.
[49:21] » Even I ask Lyle if I can pull them a
[49:23] little come over to the side so you can
[49:26] pass a little ramp with a small car so
[49:28] probably hit in the front.
[49:32] » You can go to another second picture.
[49:34] Approximately 41 ft has expanded.
[49:50] » Did you say the pipe wasn't the
[49:51] appropriate size?
[49:52] >> It's the proper size. I see pipes as
[49:54] more than my pipe is a 4-in pipe.
[49:55] >> Well, what I'm saying per city code, is
[49:57] it big enough?
[49:58] >> It would need to be engineered to
[50:00] determine how big it needs to be.
[50:01] >> I I put a different size in the other ones that
[50:05] along the the road. I see the other ones
[50:08] are little pipes. And then the the funny
[50:10] part, every time it rains, I have to be
[50:12] cleaning all the debris that comes from
[50:14] the other neighbors cuz they clocks the
[50:16] lines.
[50:17] >> Okay,
[50:18] yeah, to that one. Uh
[50:20] yeah, and then scroll down to the back
[50:21] of the back of the house.
[50:21] >> I think honestly, our biggest concern
[50:24] really
[50:24] >> Is that last piece.
[50:26] >> It is this
[50:27] section here.
[50:28] >> Yeah.
[50:29] >> Really, it sticks out for the potential
[50:30] to catch that.
[50:31] >> Well, you can Yeah, you can see what
[50:33] it's doing to the asphalt, right? I
[50:35] mean, that's exactly what I was just
[50:36] explaining. It's that that area you can
[50:39] see
[50:40] >> The original the other the other section
[50:41] on the other side, they used to be that
[50:43] over there. I didn't if they was already
[50:45] that way.
[50:46] So, the only thing I did is add into the
[50:50] to it.
[50:51] was already there, the other side.
[50:53] You can see the the partial part over
[50:55] there in the other side.
[50:58] See, the the reason I put it that way
[50:59] because there was the rocks.
[51:01] You step on the rocks, you twist your
[51:03] ankles.
[51:05] Just the Just look at pictures before
[51:08] and and after.
[51:15] » [clears throat and cough]
[51:17] >> I asked the neighbor if I can put in my driveway
[51:22] along the property line and I can put a
[51:25] fence on top because my I had to put it
[51:30] you know, get cars in the back.
[51:42] It is you will see at the other section
[51:44] will be the same thing but it's on this
[51:46] side, they had the same size pipe. I
[51:48] have a 4-in pipe.
[51:50] The only thing that the thing is like
[51:51] all the stuff right there because it
[51:53] comes when it rains, there comes this
[51:55] way and everything all that I have to go
[51:57] and then start cleaning all the debris
[51:58] because you can see bushes all over
[52:00] along the side. Just from my property to
[52:02] the south, check every neighbor and see
[52:04] if they Oh, how all those weeds growing
[52:07] in the in the in the gutters.
[52:12] Because all the rocks and everything
[52:14] from the neighbors come through and it
[52:15] clogs the lines.
[52:18] » Shelby, what would what would need to be
[52:19] done to make it to code? Like what would have to rip it out completely
[52:23] or what would be a remedy?
[52:24] >> No, I mean a a remedy would be to um
[52:29] you know
[52:30] to to make it to meet code, yeah, he
[52:32] would have to rip out 6 ft uh
[52:36] >> On your side?
[52:41] » Oh, go back to
[52:44] You have to rip out like 6 ft here just
[52:47] on this panel
[52:48] uh to meet the code. So, 6 ft away and
[52:52] then just
[52:53] to fix it. He'd probably have to in
[52:56] order to
[52:56] >> They have a bigger driveway over where
[52:58] they have the dog take care over there
[52:59] in the corner.
[53:01] What's what's the difference?
[53:02] >> He had probably pull out this panel and
[53:04] then
[53:05] shorten it to get the whole
[53:07] to meet this.
[53:10] Or what you would have to do instead of
[53:13] cutting this and then patching this but
[53:14] that you wouldn't want just like a
[53:16] little patch here. You would
[53:18] typically bring that asphalt patch all
[53:20] the way out. If you just patch that, 4
[53:22] to 6 in is going to blow out.
[53:24] >> I can put it something over there and if
[53:26] they want it
[53:28] I's not they want to do it.
[53:37] I do want to see more sessions in this
[53:40] to the other side. The same thing is the
[53:42] pipe is smaller than my pipe.
[53:45] It's not the point that you know the
[53:46] water doesn't have any way to go. The
[53:49] thing is all the debris from the that
[53:51] comes from
[53:53] the neighbors they start coming this way
[53:55] and then clog the lines.
[53:58] It's not because that's the guy all the leaves and everything that clogs
[54:01] because they don't pick the leaves.
[54:04] I've been cleaning all the time. Go wash
[54:06] right now. I tried [clears throat] every
[54:08] week to clean it.
[54:11] I tried cleaning it but the others don't
[54:13] clean it. It's going to It's going to
[54:14] do.
[54:19] » Yeah, it is a very narrow gutter system
[54:21] on that street anyway, that's for sure.
[54:24] And having the extra driveway I realize
[54:27] it's 6 ft too long but I travel this
[54:29] road often and
[54:32] all the cars on the road are very
[54:35] It's hard to navigate down McMichael
[54:37] when
[54:38] there's cars parked on both sides of the
[54:40] street. So having an extra place for
[54:43] vehicles to be off the street is
[54:47] very advantageous on that narrow road.
[54:49] >> on the street because you know they have
[54:51] the snow plow trucks and mail
[54:54] and on the [clears throat] street I
[54:56] don't want to be you know mail guy get
[54:58] pissed off because they
[55:00] blocking the mailbox.
[55:03] >> Could you scroll down the page 18?
[55:09] » [clears throat]
[55:11] » Just go
[55:13] opposite view you can see the
[55:15] pipe in there. It's looks bigger on this
[55:16] end than it does that other end but
[55:21] » As soon as it comes out we'll see.
[55:23] >> [laughter]
[55:24] >> I'm sorry.
[55:34] Waste of time.
[55:36] Yeah.
[55:37] >> yeah.
[55:41] » This whole thing is going to blow.
[55:45] We definitely built him.
[55:48] Thank you.
[56:09] » [clears throat]
[56:12] » And we have a legal driveways all over
[56:13] town.
[56:15] >> Yeah, well, there's
[56:17] the house above that one has the same
[56:19] issue.
[56:20] Um
[56:21] so I that's the frustrating part is it's
[56:24] like almost like this street just
[56:26] decided to kind of just roll however we
[56:28] wanted to roll. And I know it's they're much older homes.
[56:32] But
[56:33] like the home above also has [snorts] their drive and then they
[56:39] have like a spot where they park a truck
[56:41] that's
[56:44] » Correct.
[56:44] >> also
[56:46] >> Yeah, no, you you are correct. And
[56:47] that's the hard part is
[56:49] >> So
[56:50] >> is in 2015 that was already established
[56:53] versus in 2004, 2005-ish when this was
[56:57] when that driveway was expanded, that's
[56:59] when our code was into effect. So yeah,
[57:01] you're going to see driveways that are
[57:03] legal non-conforming
[57:05] versus driveways newer driveways that
[57:07] now we're catching going, "Hey, we need
[57:09] to follow the process." And it is it is
[57:11] hard.
[57:12] >> I didn't I didn't know the driveway guys
[57:14] to do it.
[57:15] I asked Leo if I need a permit.
[57:18] >> No, I I
[57:19] >> And he say, "You don't need a permit." I
[57:21] was so happy. I say, "Okay, I can throw
[57:23] it in and no problem." I It's not because I don't
[57:26] want to pay for the permit.
[57:29] You know, I'm more than willing to pay
[57:31] for the permit, but you know, after work
[57:33] they come and say, "No, you can't have
[57:35] your
[57:39] You know, this patch of the you know
[57:41] >> If it's placed how it should be placed,
[57:43] you know, in a in a new build, they
[57:45] don't need a permit. They just have to
[57:46] follow the format that it needs to be built within.
[57:52] And this is this is kind of a different
[57:54] situation. So, I can see kind of how
[57:56] that communication work can take place.
[57:59] The issue here is and I guess the
[58:00] question I have for you Antonio is more
[58:04] Um we need to you know, come
[58:07] obviously it looks like you're using all
[58:09] of those um
[58:10] spaces and coming straight out. How that
[58:13] should have been designed or developed
[58:15] is narrowed and then opening that up to
[58:18] allow you to to pull in and I can tell you tried to make it
[58:23] better and
[58:25] >> I don't What you say it's wrong with the
[58:26] driveway is you know
[58:29] I don't have no
[58:30] more no rocks.
[58:32] No weeds, nothing, you know.
[58:34] >> Yeah, the the concern that I'll and I
[58:36] kind of mentioned at the start the
[58:37] concern I have is that when we do that
[58:39] like it just
[58:41] it creates areas. There's there's
[58:44] designations for where, you know, if someone driving down that street
[58:48] they're having to constantly
[58:51] you know
[58:53] you could have multiple vehicles pulling out in the same area
[58:56] and that's why there's you know, that's
[58:58] why planning designates those driveways
[59:01] and there's separations and separation
[59:03] factors in those driveways. It's for
[59:05] it's a safety
[59:06] >> Yeah, they tell it like when you have a
[59:07] separation of the driveways with a heavy
[59:10] vehicle it's possible that the
[59:13] concrete can
[59:14] crack and falls down because the water
[59:16] can go underneath.
[59:18] So, that one over there the water don't
[59:20] go to the neighbor, it comes all the way
[59:22] to the street. I have like a little
[59:24] uh
[59:25] curb right there so the water comes all
[59:28] the way to the street. That's it goes to
[59:29] the neighbor.
[59:31] I put in that purpose. I don't want to
[59:32] throw water to the to the neighbors.
[59:35] Come into this still my property.
[59:37] Every time the rain is comes all the way
[59:40] down to the street. Doesn't go to the
[59:42] neighbor.
[59:43] It's not affecting anything to the
[59:45] neighbor. I know people likes to do that
[59:47] to the neighbors. Throw the water to the
[59:48] neighbor, but I try to prevent from
[59:51] having issues with the neighbor.
[59:55] So, this put is strong. This is a lot of
[59:58] money invested in that driveway. It's
[1:00:01] not one penny.
[1:00:06] And then you can see it's occupied. It's
[1:00:09] not empty.
[1:00:14] » Do you have something you'd like to say,
[1:00:16] Ben?
[1:00:21] » Ben Henderson, Evansville Street
[1:00:23] Department super- uh supervisor.
[1:00:26] I see a lot of potential for number one,
[1:00:29] when we're doing pushback with snow
[1:00:30] plows,
[1:00:32] that's going to chip. It's That driveway
[1:00:34] is not going to stay in that condition.
[1:00:36] Our plows are going to get damaged when
[1:00:37] we do pushback into the curb.
[1:00:39] And if there's 3 ft of snow and you
[1:00:41] don't see that, you're going to eat a
[1:00:42] windshield, I promise you. And if you've
[1:00:44] ever been plowing and you hit something
[1:00:46] that hard and that abrupt,
[1:00:49] it's it
[1:00:50] lodges you from your seat
[1:00:52] and it will chip the driveway. So,
[1:00:55] um if in a in a sense
[1:00:59] on a legal side, which I don't I'm not
[1:01:02] an attorney, but he's accepting the
[1:01:04] right
[1:01:05] to any liability
[1:01:08] in the in our right-of-way
[1:01:10] by doing extending his driveway into our
[1:01:12] right-of-way.
[1:01:14] That's my
[1:01:15] >> Thank you.
[1:01:18] » This might be a really dumb question,
[1:01:20] but is there some type of code,
[1:01:22] ordinance, law, something that says
[1:01:24] they're grandfathered in?
[1:01:26] Like
[1:01:28] >> So, yes.
[1:01:28] >> protects the the property owner?
[1:01:31] >> Legal non-conforming use. So, if if that
[1:01:33] driveway was in existence
[1:01:35] in the 1950s, for example, like
[1:01:38] I think that's what was mentioned. Um
[1:01:40] that [clears throat] use or that that
[1:01:41] non-conforming uh building um style, the
[1:01:47] engineering of that curve that was
[1:01:48] allowed in the '50s could remain. The only condition there though is that
[1:01:54] you you cannot expand that use. You can
[1:01:56] maintain it, um but to to expand that
[1:02:00] use would would uh
[1:02:02] would
[1:02:03] remove the the grandfathered status, if
[1:02:06] that's the word. So, it no longer be a
[1:02:08] legal non-conforming use. It'd just be
[1:02:09] non-conforming.
[1:02:11] >> Okay.
[1:02:17] » Yeah, I understand it's difficult to try
[1:02:18] and have to remove something after
[1:02:19] you've already done it, but I was just
[1:02:21] >> a It was an existing situation already
[1:02:22] like that,
[1:02:24] you know. So, it'll be it will create a
[1:02:26] issue with a snow plow. It should have
[1:02:28] been issued a long time ago, not
[1:02:30] recently.
[1:02:32] And it's And it's it's a more neighbor
[1:02:34] to have the same thing.
[1:02:34] >> I'm sorry.
[1:02:35] >> Is it a 6-in highback curb? It's not
[1:02:37] taller than It's It's not an atypical
[1:02:40] curb, is it?
[1:02:40] >> No.
[1:02:41] >> It's an old facing.
[1:02:42] >> Yeah, it's something that's probably a
[1:02:43] 6-in back curb. I might be a four
[1:02:46] by the looks of it. It's an older style.
[1:02:50] It was a highback with a short pan.
[1:02:53] >> I don't see any reason to cut to carry over the gutter. I like
[1:02:59] to I there's other areas in which it's happened on that street,
[1:03:03] and I'm not sure
[1:03:05] why because it's it's a typical curb.
[1:03:08] You could just cut the curb down
[1:03:10] and pour your drive approach into the
[1:03:12] back of the curb like you would
[1:03:13] typically do.
[1:03:15] And I appreciate Ben bringing up the
[1:03:17] that that point specifically.
[1:03:19] You'll have a snow plow catch the edge
[1:03:21] of that and that guy will be in his
[1:03:22] front yard. So, um
[1:03:26] you know, there's a reason why
[1:03:29] drives end at the back of the curb and
[1:03:31] not carry into the street. So
[1:03:33] >> I I how that one I hit it when this they
[1:03:35] have cars parked on the street. If
[1:03:37] somebody come and park on the street,
[1:03:39] the cars will be in the middle of the
[1:03:40] street.
[1:03:42] Cuz they
[1:03:42] >> a different issue though. I mean, cars
[1:03:44] parked on the
[1:03:45] >> Because if they have car car both sizes,
[1:03:48] this snow plow has going to hit that
[1:03:49] one.
[1:03:55] » But we're not I I might be off on this,
[1:03:58] but we're not saying
[1:04:00] that we can make him redo the whole
[1:04:02] frontage.
[1:04:04] It's only the new part. It's only the
[1:04:08] >> Yeah. So, there's still going to be a
[1:04:10] bridge there.
[1:04:13] So, so we're going to hit it with the
[1:04:15] plow
[1:04:17] with 6 ft later.
[1:04:21] » Correct.
[1:04:23] >> Yeah.
[1:04:24] >> I haven't seen one year one of the snow
[1:04:26] plow.
[1:04:27] >> I I know.
[1:04:28] >> Yeah, we haven't used those.
[1:04:30] We don't use those anymore.
[1:04:33] >> I just think my concern is that it sets
[1:04:35] precedent. If everybody is just like
[1:04:36] we're going to do a deviation, you know,
[1:04:37] they do something and then we're
[1:04:38] granting deviations, it sets precedent
[1:04:40] for and and I I know that's it's hard
[1:04:42] when somebody already does it to say fix
[1:04:44] it.
[1:04:45] >> I I think the biggest point is the
[1:04:47] education. Um like we need to have a way
[1:04:51] to educate people to understand the
[1:04:53] process and the reasons for the the
[1:04:56] regulations, but I
[1:04:57] >> I I asked for the permit.
[1:04:58] >> I I know you did.
[1:04:59] >> Okay, they will say don't do it this
[1:05:01] way, don't I will not do it.
[1:05:02] >> Yeah.
[1:05:03] >> Honestly, but they told me
[1:05:05] >> They told you no.
[1:05:06] >> you don't need it. So, you know, it's
[1:05:08] not like I did it something that
[1:05:10] breaking the law or anything.
[1:05:11] >> No, we understand that.
[1:05:13] >> that.
[1:05:14] >> Yeah.
[1:05:15] >> I I
[1:05:16] My thought is I I'm going to recommend
[1:05:18] to possible table this because I think
[1:05:20] we have a more complicated issue on that
[1:05:22] roadway. I think it probably leads to
[1:05:25] maybe I would like [snorts] to
[1:05:27] investigate it a little bit more.
[1:05:29] I noticed this
[1:05:31] actually for the first time this year,
[1:05:33] but not when it was brought up on this issue
[1:05:36] specifically when I drove up the street
[1:05:38] and I was like that that is weird that
[1:05:39] you have
[1:05:41] if concrete coming into our roadways and
[1:05:44] I noticed and I actually didn't notice
[1:05:46] yours, but I noticed the home up where
[1:05:48] the where it does have smaller pipes.
[1:05:50] They're like 1-in maybe diameter inch
[1:05:52] and a quarter diameter. They looked that. They may have been
[1:05:55] bigger. I don't know, but
[1:05:58] >> Now, when they they sent me uh like
[1:06:00] three letters to
[1:06:02] cut like 2-ft diameter around my meter
[1:06:06] box.
[1:06:07] And I see like three or four down the
[1:06:10] road in the same situation.
[1:06:13] >> But you don't see any new homes with
[1:06:16] that same problem.
[1:06:17] >> I They do, but they have to put metal
[1:06:20] >> Correct, or they have to remove them.
[1:06:22] >> Right. Uh-huh.
[1:06:23] >> Or they have to
[1:06:23] >> But I most of the they I'm doing town
[1:06:25] homes over in 12th Ave. They meters
[1:06:29] right in the driveway.
[1:06:31] But they put in metal collar in it. So
[1:06:33] it make it strong so that it'll
[1:06:35] expand.
[1:06:36] >> But I do think we need a solution for
[1:06:38] the whole street. Um
[1:06:40] >> I think this one's a little more
[1:06:41] >> This yeah, this is not just one house. I remember it was probably gone, but I
[1:06:47] need to There used to be one
[1:06:50] There was a big speed bump.
[1:06:54] >> Yeah.
[1:06:55] there is one that's um that's
[1:06:57] metal. There's a great There's a one
[1:06:59] that's a
[1:07:00] like a cast aluminum or a cast
[1:07:04] Yeah, you know, that's a metal ramp. Um
[1:07:08] But I Yeah, I mean my This is That's
[1:07:10] where I feel. I feel like there's more to this one that probably
[1:07:14] needs additional discussion. But that's
[1:07:16] my thought.
[1:07:25] » You want to make a motion for that,
[1:07:27] Chase?
[1:07:27] >> Yeah, Mayor, I make a motion we move to
[1:07:29] table
[1:07:32] uh resolution 2026-38
[1:07:35] approving a driveway deviation for the
[1:07:37] property located on 48 MacMichael Avenue
[1:07:40] until Council has an opportunity to
[1:07:42] thoroughly review that street.
[1:07:44] >> We have a motion to table item number
[1:07:47] six. Is there a second?
[1:07:48] >> I'll second.
[1:07:49] >> A second by Council member Dalton. All
[1:07:51] in favor.
[1:07:52] >> Aye.
[1:07:54] >> Do you have any direction for staff to
[1:07:56] on this far as what you're wanting to us
[1:07:58] to investigate or you're wanting to do
[1:08:00] your own investigations?
[1:08:02] >> And I was going to ask you I mean I'm
[1:08:04] sure you guys have talked about the
[1:08:05] whole street.
[1:08:07] I mean is it only
[1:08:10] Never mind. I'll shut up. What are your
[1:08:12] visions for the whole street?
[1:08:14] >> Yeah, I mean there's the it needs to be
[1:08:16] built out. You can see that we're
[1:08:17] missing the sidewalk on that side and
[1:08:19] things like that. So,
[1:08:22] I mean we can go back we can hopefully
[1:08:24] find the construction plans from this
[1:08:26] older um
[1:08:27] development and and see what we can find
[1:08:29] and
[1:08:30] why
[1:08:31] a lot of them have these overhead
[1:08:33] driveways and
[1:08:36] Yeah.
[1:08:40] » So,
[1:08:40] >> Mr. Mayor,
[1:08:41] >> I just wanted to say for the record we
[1:08:42] don't typically require building permits
[1:08:44] for flat work on property. So, if this
[1:08:47] had been compliant with the rest of the
[1:08:50] curb cut requirements and other things,
[1:08:52] there would have been no problem. Um you
[1:08:54] can pave your entire
[1:08:56] your lot if you want to
[1:08:58] and no permit is required. The The
[1:09:01] problem is the stuff between the top
[1:09:04] back of curb and the road and how he's
[1:09:06] cut into the road and that's where we
[1:09:08] get into a problem. The flat work that
[1:09:10] and Lyle, if you approach Lyle and said,
[1:09:12] "Do I need a permit for a driveway?" The
[1:09:14] answer is no. That's flat work. We don't
[1:09:16] require a permit for that. But where we
[1:09:18] do is the curb cut and the work in our
[1:09:20] right-of-way. So, I just wanted to
[1:09:22] clarify that.
[1:09:23] >> Yeah, and that's where the confusion
[1:09:24] came in, it sounds like.
[1:09:26] >> I asked Lyle for I said, "Do I need a
[1:09:28] pool pipe for the water to go out?" Of
[1:09:30] course I said, "Just put a 1-in
[1:09:32] big pipe to work."
[1:09:34] It's not like
[1:09:35] you know, I didn't put anything. Yeah. I
[1:09:37] asked him if I could put a pipe in and
[1:09:39] said, "Yes, I put a pipe."
[1:09:41] So, I put a big pipe in and I said, "My
[1:09:44] My pipe is bigger than the old pipes I
[1:09:46] have."
[1:09:49] Kettle, the only thing you know, it's
[1:09:50] going to clog because of all the debris
[1:09:52] that comes in and it's not cleaning the gutters.
[1:09:55] >> Yeah.
[1:09:55] >> No, I mean
[1:09:57] the reason for the gutter is not to have
[1:09:59] a pipe
[1:10:01] so it doesn't clog at all.
[1:10:03] That's the reason for the gutter.
[1:10:04] >> But there's all kinds of problems.
[1:10:05] >> running water system
[1:10:07] >> on McMichael.
[1:10:08] >> But there there are. So, I Yeah, I think
[1:10:10] Okay. Thank you.
[1:10:11] >> So, we will take a look at that
[1:10:13] situation on on your street and see the
[1:10:15] best way to address it and then we'll
[1:10:17] move forward.
[1:10:18] Thank you.
[1:10:22] Okay, item number seven
[1:10:24] is a consideration of resolution 2026-39
[1:10:27] approving a proposed amendment to the
[1:10:30] Kenneth Fosson subdivision and approving
[1:10:33] the commercial final plat application
[1:10:35] for Holiday Oil located at approximately
[1:10:38] 794 East Main Street in the CG zoning
[1:10:41] district.
[1:10:42] >> Hey, how are you guys?
[1:10:43] >> Great.
[1:10:45] >> [laughter]
[1:10:46] >> Um this one is exciting. So, we're we're
[1:10:49] doing two things here. We're amending
[1:10:50] the Kenneth Fosson subdivision and we're
[1:10:52] approving
[1:10:54] the commercial plat for Holiday Oil. Um
[1:10:56] if you'll scroll um, we we can kind of
[1:11:00] go here. So, this is in the CG
[1:11:02] uh zoning uh for Holiday Oil. It's right
[1:11:04] there on the corner adjacent to Maverick
[1:11:06] on 794 East Main Street. Um, if you want
[1:11:10] to scroll down. So, we we're taking this
[1:11:12] from, if I recall, four three or four
[1:11:14] parcels and we are turning it into um
[1:11:18] two parcels.
[1:11:20] So, three parcels here and then if you
[1:11:22] scroll down one more.
[1:11:25] Maybe go up one.
[1:11:28] I- into two parcels. So, the they will
[1:11:30] stay there. Have access.
[1:11:32] >> [laughter]
[1:11:34] >> They'll have There'll be a easement
[1:11:36] access here
[1:11:38] um and then access here as well. And so,
[1:11:41] you'll see these uh easements in favor
[1:11:43] of lot one and two and then easement in
[1:11:46] favor of lot one and two as well.
[1:11:48] >> Yep.
[1:11:52] » Um, and then if you want to scroll down
[1:11:55] one more, please. So, you can see oh, go
[1:11:57] up one.
[1:11:59] You can see they've done the truck route
[1:12:00] to show um how traffic would flow. You
[1:12:03] have Holiday Oil. You have the underground fuel tanks. You
[1:12:10] have Holiday the the um fuel pumps. You
[1:12:14] have the
[1:12:15] RV dump.
[1:12:17] The store uh with a drive-thru and then
[1:12:19] you have the car wash here. And then
[1:12:21] here's the two accesses.
[1:12:23] And then if you want to scroll down
[1:12:24] again.
[1:12:26] And so, this is just kind of a cleaner
[1:12:27] overall um landscape picture. So, we got
[1:12:30] trees. Um, it is xeriscaped and then we
[1:12:35] have asked um the applicant to dedicate
[1:12:37] their half width of Highway 112 and 138.
[1:12:42] Um, UDOT has asked for 117
[1:12:45] ft right-of-way. So, they've dedicated
[1:12:46] their half which was significant.
[1:12:49] Um, and caused them to have to redo a
[1:12:51] big portion of their plans, and but
[1:12:53] that's why you'll see these parts strips
[1:12:54] are so wide as well that when that road
[1:12:57] widens
[1:12:58] >> It will be ready to widen.
[1:13:04] » [laughter]
[1:13:06] >> This one a big stick. Someone give me a
[1:13:07] big stick.
[1:13:08] >> You do need a big stick.
[1:13:09] >> I'm going to get you a laser pointer.
[1:13:11] >> At least.
[1:13:13] This one might work.
[1:13:16] Yeah, it don't work.
[1:13:18] But yeah, any questions?
[1:13:21] >> [clears throat]
[1:13:27] » The dry or the
[1:13:31] drive-thru that you mentioned, is that
[1:13:34] just something that you can purchase
[1:13:36] things from the gas station there or is
[1:13:39] it a separate business that will have
[1:13:41] like a
[1:13:42] another restaurant that you would pull
[1:13:44] through there?
[1:13:44] >> No, so it's you know, if you want a
[1:13:46] drink or a the snack or or not, so.
[1:13:49] >> And then we do have Brent here as well.
[1:13:51] >> Okay.
[1:13:53] come on up, Brent.
[1:13:54] >> You're going to come
[1:13:54] >> up.
[1:13:55] I was looking for him and then I text
[1:13:56] him, I'm like, are you here? And he's
[1:13:57] like, I'm right here.
[1:13:58] >> [laughter]
[1:14:00] >> Um my name's Brent Neil with Holiday
[1:14:02] Oil. Yeah, thank you. Um so touching on
[1:14:04] the drive-thru, so if you go to our Lake
[1:14:06] Point location, that's the same kind of
[1:14:08] concept we're going to be doing here. So
[1:14:09] it's more of a sweet shop, so you can't
[1:14:11] get you can't buy like gas through it,
[1:14:13] tobacco, beer, anything like that. It's
[1:14:15] specialty drinks, the dirty sodas,
[1:14:18] um cookies, stuff like that. So it's
[1:14:19] more of a sweet shop.
[1:14:20] >> I'm hungry right now, so let's not talk
[1:14:22] about that.
[1:14:23] >> I was wondering [laughter] why he
[1:14:24] pointed at me when we were talking about
[1:14:25] cookies.
[1:14:29] » [laughter]
[1:14:30] >> Well, you provide a good product. Uh
[1:14:32] excited to see it it take place on this
[1:14:34] corner. I I And Shelley, I appreciate
[1:14:36] you
[1:14:38] hitting on
[1:14:40] how we envision this area. I know last
[1:14:42] night P&Z this area further to the north of this
[1:14:47] was discussed and the extension of
[1:14:50] or possible extension of 112 and and
[1:14:52] that going further to the north. Um
[1:14:56] I guess that the the question I had is I
[1:14:59] mean all of this obviously has gone
[1:15:01] through UDOT as far as the entrance
[1:15:02] locations. So, we will have an entrance
[1:15:04] off of
[1:15:07] Main Street and an entrance off of 112,
[1:15:09] correct?
[1:15:10] >> are right in right out only.
[1:15:12] >> Okay.
[1:15:14] >> Uh 112 should be a full motion.
[1:15:17] >> Yeah,
[1:15:18] sorry. It's It's a left right right in
[1:15:20] right out.
[1:15:21] >> Okay.
[1:15:21] >> Uh
[1:15:22] and we did ask them to put a 6-ft fence
[1:15:25] along the
[1:15:26] west side.
[1:15:28] >> At the west side.
[1:15:30] Against the
[1:15:32] next piece. Yeah.
[1:15:34] Okay.
[1:15:36] >> I see the turn lane on 112 going in. Are
[1:15:38] we going to do anything with Main Street
[1:15:40] to get the right in? Is that going to be
[1:15:42] >> Yeah, they'll have to I don't know. It's
[1:15:44] kind of like
[1:15:45] >> At the entrance up to the Is that the
[1:15:47] west?
[1:15:49] >> [laughter]
[1:15:50] >> Um but it's it's hatched here. You can
[1:15:52] see these hatches. So, they'll have to
[1:15:53] do a merge lane in
[1:15:55] and get that in there. So, with UDOT on
[1:15:57] both 138 and 112.
[1:15:59] >> Similar to what's been done on Matthews
[1:16:01] Lane, where
[1:16:02] >> Correct.
[1:16:03] >> a lane has been created for a a right
[1:16:05] turn in. Okay.
[1:16:10] » And this will eventually allow us to
[1:16:13] continue the the two lanes.
[1:16:26] » I was maybe just going to ask the
[1:16:28] question regarding P&Z, like is there
[1:16:30] any feedback
[1:16:33] that came through that we need to
[1:16:35] >> Um I I mean they're concerned, you know,
[1:16:38] with with the turning and and then the
[1:16:40] wall, but
[1:16:41] they were pretty excited
[1:16:43] >> Straightforward. Okay.
[1:16:46] » I want to say Derek was there for that.
[1:16:50] >> [laughter]
[1:16:51] >> Back in the day. I can't remember it.
[1:16:53] >> You were there for all of it.
[1:16:55] >> I was there from the beginning when
[1:16:57] we changed the
[1:16:59] >> What we did was zoning, I think, or
[1:17:01] something. Or but
[1:17:04] >> Um
[1:17:05] >> Yeah, I remember passing with zoning.
[1:17:07] >> Yeah, I don't know if I have either.
[1:17:10] Questions?
[1:17:11] >> Not to get into the weeds, but like the trees in the landscaping along 112
[1:17:17] and and
[1:17:19] I mean, this will be a new addition to
[1:17:22] our main and as we have new additions to
[1:17:24] the main, obviously trying to coordinate
[1:17:28] you have different components.
[1:17:30] Um I don't know. Do we go Do we get into
[1:17:33] what types of trees, how those Okay. So,
[1:17:36] we are looking
[1:17:37] into the future there.
[1:17:38] >> What about lighting?
[1:17:40] >> So, we do have area lights. Um there is
[1:17:43] a photometric plan
[1:17:45] that shows Oh, not in this one? Okay.
[1:17:47] >> Okay.
[1:17:47] >> That's in the separate plan that they
[1:17:48] have to submit
[1:17:50] their We've met with uh
[1:17:52] with them to talk about like signage and
[1:17:54] things like that.
[1:17:54] >> I think she was also needing street
[1:17:56] lights.
[1:17:57] >> Yeah.
[1:17:59] No.
[1:17:59] >> That would be U dot's decision.
[1:18:01] >> Okay.
[1:18:04] » Yeah, so we'll we'll continue to
[1:18:05] coordinate with U dot as far as if they
[1:18:06] do require any kind of signal or street
[1:18:08] lights. We do have area lights around
[1:18:10] the property and that's what we the
[1:18:12] photometric plan will show that we keep
[1:18:14] the candle with on our property and it's
[1:18:15] not just glaring all over the field and
[1:18:17] everything to the east of us as well. So
[1:18:19] >> Okay.
[1:18:29] What is your anticipated time frame?
[1:18:32] >> So, we're hoping to open December.
[1:18:35] Um depending We still have to go and
[1:18:36] respond to the city with some staff
[1:18:38] approval and also with UDOT. So, we're
[1:18:39] hoping to push dirt and start moving
[1:18:41] dirt in mid-July.
[1:18:43] So, about a month out
[1:18:45] is what we're pushing for.
[1:18:49] » Gas for Christmas.
[1:18:50] >> Yeah.
[1:18:51] >> [laughter]
[1:18:53] >> Is that also your property to the south
[1:18:56] where it's kind of cut out, or is that a
[1:18:58] separate property?
[1:18:59] >> No, we we own that as well. So, that's
[1:19:00] not part of this project. Um, we are
[1:19:02] currently under contract with a
[1:19:04] potential user there, but it's we're
[1:19:06] actively trying to sell it. That last
[1:19:08] that back acre piece.
[1:19:15] » Is that piece on
[1:19:17] >> 112?
[1:19:18] >> Mhm.
[1:19:19] >> Okay.
[1:19:20] That's further south.
[1:19:22] >> Okay.
[1:19:24] >> And that's where the plat shows the
[1:19:25] cross access as well. So, we can UDOT
[1:19:27] made us put our access 500 ft down. So,
[1:19:29] that's why it's further down on Highway
[1:19:31] 112 to allow us to get back on our
[1:19:33] property.
[1:19:34] For the gas station property.
[1:19:36] >> Okay.
[1:19:50] » I don't have anything else.
[1:19:51] >> I don't have anything.
[1:19:53] >> All right, just need a motion then.
[1:19:54] >> I'll make a motion then.
[1:19:56] >> Thank you. Appreciate it.
[1:19:57] >> I'll make a motion we approve resolution
[1:20:00] 2026-39
[1:20:01] approving the proposed amendment to the
[1:20:03] Kenneth Folsom subdivision
[1:20:05] and approving the commercial final plat
[1:20:06] application for Holiday Oil located at
[1:20:08] approximately 794 East Main Street in
[1:20:10] the CG zoning district.
[1:20:12] >> All right, we have a a motion by Council
[1:20:14] Member Dalton. Is there a second?
[1:20:16] >> I'll second it.
[1:20:17] >> Second by Council Member Williams and a
[1:20:19] third by Council Member Skinner. All in
[1:20:22] favor?
[1:20:22] >> Aye.
[1:20:24] >> All right, thank you and welcome to
[1:20:25] Grantsville. We're excited to have you.
[1:20:29] » I'm coming for my cookies.
[1:20:31] >> That's right.
[1:20:31] >> [laughter]
[1:20:32] >> They're desperate.
[1:20:33] >> [sighs and gasps]
[1:20:34] >> All right, item number eight.
[1:20:39] Is a consideration of resolution 2026-44
[1:20:43] approving the master development
[1:20:44] agreement for the Willow Field
[1:20:46] subdivision located approximately at Old
[1:20:49] Lincoln Highway and Champion Drive.
[1:20:52] >> This one was
[1:20:54] later.
[1:20:54] No, actually you're we're going to
[1:20:55] switch them.
[1:20:56] >> And we are keeping Shelby busy tonight.
[1:20:58] >> Yes. [laughter]
[1:21:00] Um so this is um an amendment and a
[1:21:03] reinstatement of the development
[1:21:04] agreement. This project is in the
[1:21:07] uh rural residential one.
[1:21:09] It has a PUD overlay on it. Um so the
[1:21:12] applicant stayed with the one-acre lots
[1:21:15] with two of the lots facing Old Lincoln
[1:21:17] Highway. Um it's a half-acre lot just
[1:21:19] cuz um the two lots are half-acre just
[1:21:22] cuz [clears throat] it would have been
[1:21:22] kind of an
[1:21:23] odd-shaped one-acre lot.
[1:21:26] Um it consisted of approximately 29
[1:21:29] acres. It was approved in 2022 um
[1:21:32] through resolution 2022-40 and 2022-41
[1:21:36] and 2022-81
[1:21:39] um with the prior development agreement.
[1:21:41] We are um the applicant is wanting to
[1:21:45] build one additional lot for I believe
[1:21:48] his nephew.
[1:21:49] Um and that's what we're calling phase
[1:21:51] two. Um and then the remainder will stay
[1:21:54] open. We have um and I did correct that
[1:21:57] Tyson. We did um update it in the
[1:21:59] development agreement. I believe it's
[1:22:01] 2035 that he has um until he can build
[1:22:05] out. Um anything past 2035 reverts to
[1:22:08] the um RR1 zoning which they were
[1:22:11] following.
[1:22:12] Only deviations that they had asked for
[1:22:14] and were vested with in the prior PUD um
[1:22:17] was just the road cross-section.
[1:22:20] Um on that. So um
[1:22:22] we are asking for fee in lieu the
[1:22:26] um making sure that we have the
[1:22:28] easements for the sewer line
[1:22:30] construction um as well as the
[1:22:32] dedication of the road in front of this
[1:22:34] one additional lot.
[1:22:39] Tony, if you want to
[1:22:41] Oh, you'll probably scroll for a while.
[1:22:45] Yeah, probably towards the end of the
[1:22:47] NDA. There's a
[1:22:49] that layout 23.
[1:22:52] Go down two more.
[1:22:55] So, that's what it um currently looks
[1:22:57] like.
[1:22:59] They actually stopped
[1:23:01] building approximately here and then
[1:23:04] there's that one additional
[1:23:06] lot.
[1:23:09] » So, they were already approved for this?
[1:23:10] >> Yes.
[1:23:31] » You hit on the questions I had regarding
[1:23:33] sewer easement access.
[1:23:35] >> I knew I was psychic.
[1:23:37] >> So,
[1:23:39] » Oh, thank you, Jake.
[1:23:41] >> Yeah, thanks for digging into it, but 30 35
[1:23:45] that you were going to give them to
[1:23:48] get everything [laughter] done, right?
[1:23:49] Good thing, Tyson.
[1:23:50] >> 30 35
[1:23:52] Hey, yeah.
[1:23:53] >> Forever.
[1:23:54] >> [laughter]
[1:23:56] >> Infinity years.
[1:23:58] >> Sometimes how my projects seem like
[1:24:00] >> [laughter]
[1:24:09] » I think it looks good. I mean, it's
[1:24:11] We're saying they can do what we've
[1:24:12] already said they could do, right?
[1:24:13] >> That's what it sounds like.
[1:24:14] >> Pretty much.
[1:24:16] According to what they had for the
[1:24:17] beauty.
[1:24:18] >> Yeah.
[1:24:20] » Mayor, I'll make a motion we approve
[1:24:22] resolution 2026-44
[1:24:25] approving the master development
[1:24:26] agreement for the Willow Field
[1:24:27] subdivision located at approximately Old
[1:24:29] Lincoln Highway and Champion Drive.
[1:24:32] >> We have a motion by council member
[1:24:33] Dalton. Is there a second?
[1:24:35] >> I second.
[1:24:35] >> Second by council member Thomas. All in
[1:24:37] favor?
[1:24:38] >> I.
[1:24:40] >> Great.
[1:24:44] Okay, item number nine is a public
[1:24:47] hearing item. It is the consideration of
[1:24:49] resolution 2026-45
[1:24:52] approving the fiscal year 2026 year-end
[1:24:55] budget amendments and adopting the
[1:24:56] fiscal year 2026 year-end budget.
[1:25:00] This will be presented by Aspen Clegg,
[1:25:02] our finance director, and after her
[1:25:04] presentation, if there's any members
[1:25:06] from the community who have additional
[1:25:09] concerns or comments that they would
[1:25:11] like to bring to the council,
[1:25:14] we will invite you to to to speak on
[1:25:17] that um
[1:25:19] at that time. Right now, we'll let Aspen
[1:25:21] speak and present on this item.
[1:25:24] >> Okay, council, this is the year-end
[1:25:27] budget amendments for fiscal year 2026.
[1:25:31] And so, fiscal year 2026 ends June 30th
[1:25:33] of this
[1:25:35] upcoming month, and then fiscal year 27
[1:25:37] begins on July 1st. So,
[1:25:39] after this meeting, we can no longer
[1:25:41] make
[1:25:42] budget changes to fiscal year 2026
[1:25:44] because you guys will no longer be
[1:25:46] operating in it, and you guys can't vote
[1:25:47] on it. And so, this is just the last
[1:25:50] changes to the fiscal year 2026.
[1:25:54] you'll note that a lot of like and some
[1:25:56] of them are substantial. So, if you have
[1:25:58] like specific questions about some of
[1:25:59] them, we can talk about them, but
[1:26:03] it's I do feel like it's a little
[1:26:05] misleading because we are adjusting
[1:26:07] expenses, but we don't adjust like I
[1:26:10] don't come before you and say, "Hey, can
[1:26:11] you approve us to receive more grant
[1:26:14] money?" Or like the revenues that are
[1:26:18] reflected aren't necessarily in here
[1:26:20] because the we
[1:26:23] are worried about overspending in our
[1:26:24] expenditure accounts, but we don't get
[1:26:26] approval to like bring in more revenues.
[1:26:28] And so some of these line items are
[1:26:30] specifically in relation to receiving
[1:26:33] more grant funding, but we need to
[1:26:36] increase the budget in their grant
[1:26:38] expense line, so that way they are
[1:26:40] actually approved to have spent that
[1:26:41] grant money. So like that 106,000 for
[1:26:44] instance in community development
[1:26:46] that you see there at 175264,
[1:26:49] that is in relation with the grant. And
[1:26:51] so it's kind of misleading that it seems
[1:26:53] like a huge additional expense, but we
[1:26:55] do have the revenue that offsets it. You
[1:26:57] just don't see it in these amendments.
[1:27:01] if you have any specific questions, I'm
[1:27:03] happy to address them. Otherwise, that's
[1:27:06] pretty much where we are as okay.
[1:27:11] Anybody have any questions or should we
[1:27:12] move to the public hearing at this
[1:27:14] point?
[1:27:15] Let's do the public hearing then. Okay.
[1:27:17] Thanks, Aspen.
[1:27:19] If there's any members of the public who
[1:27:22] would like to
[1:27:23] um comment on this item, number nine,
[1:27:26] this is your time to do so. If you're
[1:27:28] online,
[1:27:30] you could please raise your hand. Um
[1:27:32] we will let you speak there as well. Is
[1:27:34] there anybody here in the audience that
[1:27:36] would like to speak on this item?
[1:27:41] Anyone online?
[1:27:46] Okay.
[1:27:48] All right, we will close the public
[1:27:49] hearing for item number nine.
[1:27:51] And
[1:27:52] we will now move to a discussion with
[1:27:54] the council regarding regarding item
[1:27:56] number nine and look for a motion.
[1:28:21] » I guess this is just making it more in
[1:28:23] line with what we're actually spending
[1:28:24] through the end of the year. Is that
[1:28:25] what we're like
[1:28:26] >> Yeah, so um like by state statute
[1:28:29] departments can't go over budget like
[1:28:31] overspending from what was approved and
[1:28:33] so this would just bring into
[1:28:37] it would make sense so that everything
[1:28:38] that was spent is within that
[1:28:40] department's approved budget. Um
[1:28:42] >> And it's not because they overspent,
[1:28:44] it's because they received more revenue
[1:28:46] >> Sometimes.
[1:28:47] >> Okay.
[1:28:48] >> I mean legal uh we did have a large
[1:28:50] increase in legal expenses, but we had a
[1:28:53] lot of
[1:28:54] legal expenses this year that weren't I
[1:28:56] mean there was a legal budget presented
[1:28:59] and was approved by council back when
[1:29:02] fiscal year 26 budget was approved, but
[1:29:05] just we had a lot more legal fees than
[1:29:08] were anticipated this last year. So like
[1:29:10] that line is I mean we don't have a
[1:29:12] grant for legal fees. We just have to
[1:29:15] pay them.
[1:29:16] So like that one
[1:29:18] is just true expense just because we
[1:29:20] have
[1:29:21] had a lot of legal fees. Um
[1:29:23] >> It's a large transfer and am I right
[1:29:24] about that?
[1:29:25] >> Yeah.
[1:29:25] >> Transfer from different different
[1:29:27] expense accounts into legal.
[1:29:30] Traditionally those
[1:29:31] legal expenses had not been put into the
[1:29:34] legal fund. So
[1:29:37] we're capturing legal expenses that were
[1:29:40] attributed to different departments, now
[1:29:42] placing them all into the legal budget.
[1:29:45] And so there's a large transfer that
[1:29:46] occurred. Um this is the first time that
[1:29:48] transfer has ever happened.
[1:29:50] >> So they were split apart and we pulled
[1:29:52] them together.
[1:29:52] >> This way it's more transparent on what
[1:29:54] we do for our legal fees.
[1:29:56] >> Yeah.
[1:29:59] but yeah you know our like elections we
[1:30:01] spent $75
[1:30:03] more dollars than was originally
[1:30:04] budgeted for that. So we have to
[1:30:06] increase that collections budget for
[1:30:08] $75. So, that way that cuz that budget
[1:30:10] is just so small. It's just the one
[1:30:11] line. There's not another line item to
[1:30:13] cover that expense. And so, we just have
[1:30:17] show it. So.
[1:30:18] >> But, there's other lines, but we're not
[1:30:20] showing that they're going to be lower
[1:30:22] in the budget and things like that. So,
[1:30:23] we'll have a final
[1:30:25] trueing up of the budget later
[1:30:28] but in August, I'd say.
[1:30:29] >> No. Well, I mean, we can do line item
[1:30:31] adjustments at any time. So, like if
[1:30:33] there's a
[1:30:34] if there's one line item that had
[1:30:36] excess budget in it, we could transfer
[1:30:39] it to that line item to help cover that.
[1:30:41] And that I did address already. They've
[1:30:44] been sent to Marie to do internal
[1:30:46] entries. So, that's kind of separate,
[1:30:48] but um
[1:30:50] yeah, then as a second part of this
[1:30:53] item is just the approval of the
[1:30:55] year-end budget, which has like those
[1:30:57] adjustments in it in the actual fiscal
[1:30:59] year 2026 budget, which is like all of
[1:31:01] this. But,
[1:31:25] » Anybody like to make a motion on this
[1:31:27] item?
[1:31:42] » I guess are we expanding the budget or
[1:31:44] like is this increasing the budget?
[1:31:45] >> Yeah. So, all of those amendments would
[1:31:47] be increasing the fiscal year 2026
[1:31:49] budget. Unfortunately, at this point,
[1:31:51] all of those expenses have already been
[1:31:52] incurred. So,
[1:31:54] I mean, we can discuss them and look
[1:31:56] into them as much as you'd like, but
[1:31:58] ultimately, we're going to have to have
[1:31:59] an approval of it because they've
[1:32:00] already been expensed. So.
[1:32:03] >> I'm paid.
[1:32:03] >> Um
[1:32:05] there's not a lot
[1:32:06] >> [laughter]
[1:32:06] >> like a lot to do there unfortunately. Um
[1:32:11] I came in at the
[1:32:13] partway through this fiscal year. So,
[1:32:15] going forward in fiscal year 27, I would
[1:32:17] like to come more often with budget
[1:32:19] amendments as they come as they arise
[1:32:22] with different things that want to be
[1:32:23] expensed. Um
[1:32:26] but
[1:32:27] yeah, unfortunately I just wasn't here.
[1:32:29] So, a lot of this just got we've we're
[1:32:32] just running on what was done before.
[1:32:34] So. But
[1:32:35] >> But moving forward for 2027, have we
[1:32:37] looked at this and said, "Okay, then,
[1:32:38] you know, for going forward making sure
[1:32:40] >> Yeah. We have what we need in these
[1:32:41] departments." Yeah, and we're actually
[1:32:42] in the process of changing our accounts
[1:32:44] payable right now. Um we're piloting it
[1:32:47] currently with the police department and
[1:32:49] hopefully it'll be ready to go at the
[1:32:51] beginning of fiscal year 27, but it will
[1:32:53] require departments to get approval
[1:32:55] prior to purchases being made rather
[1:32:58] than
[1:33:00] they kind of do a process right now, but
[1:33:01] it's once they have an invoice, which is
[1:33:03] again
[1:33:04] it's too late. Like they've already
[1:33:06] ordered it and received the product by
[1:33:08] the time that they've received an
[1:33:09] invoice. And so,
[1:33:11] um they'll be
[1:33:12] a learning curve and some growing pains
[1:33:14] for sure, but I think ultimately in the
[1:33:16] long run it'll end up proving to be
[1:33:18] beneficial for Grantsville City to have
[1:33:21] it required to get approval prior to
[1:33:23] purchases being made. And then that will
[1:33:24] keep them within their budgetary
[1:33:26] restrictions because they won't be able
[1:33:28] [clears throat] to request a a PO that
[1:33:30] would exceed the budget within that
[1:33:32] line. So.
[1:33:36] Yeah.
[1:33:37] >> I'll take that. It will definitely help.
[1:33:38] I mean
[1:33:39] we increased our budget 2.8 million from
[1:33:41] the original
[1:33:43] approved budget last year to today. So.
[1:33:47] I don't like the
[1:33:49] buy and ask for for permission
[1:33:52] after the fact.
[1:33:54] >> Yeah, I mean
[1:33:55] >> I think where we get an extra 2.8. I
[1:33:57] know things come up.
[1:33:59] Uh you know, that's unexpected, but
[1:34:01] you know,
[1:34:03] it's
[1:34:03] >> But some of those funds of the 2.8 were
[1:34:06] because grants were received. So yeah,
[1:34:09] it was spent, but yet it wasn't because
[1:34:11] we went over necessarily. It was just
[1:34:14] how it has to look on paper.
[1:34:15] >> Yeah, and so like I mean, we're
[1:34:18] Yeah, there are grants to offset some of
[1:34:20] these expenses for sure, but that's just
[1:34:22] not shown because we don't increase the
[1:34:24] revenue line
[1:34:25] it with a budget amendment. There
[1:34:28] the state is worried about budget
[1:34:29] amendments for expenditures, not so much
[1:34:31] getting approval to receive more
[1:34:33] revenue. Um
[1:34:34] so that's why it comes before you like
[1:34:36] this. But there are like specifically um
[1:34:40] >> The revenue
[1:34:42] >> Yeah.
[1:34:44] >> stops would be in that scenario.
[1:34:46] >> Yeah.
[1:34:47] so like we did receive
[1:34:49] >> dollars for the grants included in that
[1:34:51] number.
[1:34:52] >> Mhm.
[1:34:52] >> But you won't see that.
[1:34:53] >> But you That's how you'll see the
[1:34:55] expenditure of that and then it just
[1:34:56] shows that we have inflated our budget
[1:34:58] and then like this is the true amount,
[1:35:00] but so that she said is not a fair
[1:35:02] representation.
[1:35:03] >> Yeah, ultimately you'll see like the
[1:35:04] revenues versus expenditures after they
[1:35:06] do like our fiscal year 26 audit, but
[1:35:09] again, that's not
[1:35:10] com- done until like December of this
[1:35:12] year. And so
[1:35:14] But this is the last time we have the
[1:35:16] opportunity to make the amendments for
[1:35:18] the expenditures.
[1:35:28] » Mayor, I make a motion that we approve
[1:35:30] resolution 2026-46 approving and
[1:35:33] adopting the fiscal year
[1:35:35] Sorry, uh 2026 year end budget
[1:35:37] amendments and adopting the fiscal year
[1:35:39] 2026 year end budget.
[1:35:41] >> Would Would you restate the resolution
[1:35:42] number?
[1:35:43] >> Yeah, sorry. That was the last it was on
[1:35:44] the wrong one. 2026-45.
[1:35:46] >> Thank you.
[1:35:47] We have a motion by Council member
[1:35:48] Skinner. Is there a second?
[1:35:52] >> I second.
[1:35:53] >> A second by council member Thomas. All
[1:35:55] in favor?
[1:35:56] >> I.
[1:35:58] >> All right.
[1:36:05] this is me again.
[1:36:07] So, our
[1:36:07] >> just a second.
[1:36:08] >> Sorry.
[1:36:09] >> Um agenda item You're fine. Agenda item
[1:36:11] number 10, also a public hearing item.
[1:36:14] Uh it's a consideration of a resolution
[1:36:15] 2026-46
[1:36:17] approving and adopting the fiscal year
[1:36:19] 2027 compensation compensation schedule
[1:36:23] for Grantsville City department heads
[1:36:25] and elected officials. It'll be
[1:36:27] presented by Aspen Clegg, the finance
[1:36:29] director. And after her presentation, uh
[1:36:32] members of the public are welcome to
[1:36:33] make comments on this agenda item.
[1:36:37] >> Thank you. So, for fiscal year 2027, it
[1:36:39] does include a 3% COLA increase for all
[1:36:42] staff. That does include department
[1:36:44] heads
[1:36:45] um as well as elected officials. And so,
[1:36:48] per state statute, we're required to
[1:36:49] disclose what the department heads will
[1:36:52] receiving at that point in time. So,
[1:36:53] this is just a disclosure of the salary
[1:36:57] rates for the department heads and
[1:36:59] elected officials for Grantsville City
[1:37:01] that would go into effect in fiscal year
[1:37:03] 2027
[1:37:05] for that in budget year. So.
[1:37:10] That's what that is. I'll let the public
[1:37:12] hearing happen, and then I'll be back.
[1:37:13] >> Thank you.
[1:37:16] Are there any public comments on this
[1:37:19] item?
[1:37:23] Anyone online?
[1:37:29] >> No?
[1:37:31] All right. We're seeing no comments.
[1:37:33] So, we will continue back to the
[1:37:35] discussion with the council
[1:37:38] um for item number 10.
[1:37:42] » We've already approved this, right? This
[1:37:43] is just numbers. This is just showing
[1:37:45] what the actual numbers are that we're
[1:37:46] going to
[1:37:47] >> Okay.
[1:37:47] >> And this is cost of living. This is not
[1:37:49] This is what we approved last as a merit
[1:37:50] increase. This is just a cost of living.
[1:37:52] >> Correct.
[1:37:53] >> Yes.
[1:37:53] >> This is just the 3%
[1:37:57] Yeah, this is just a cost of living.
[1:37:58] >> Correct.
[1:38:02] » I do [clears throat] understand the
[1:38:03] difference between the two.
[1:38:05] >> [laughter]
[1:38:06] >> Yeah, there has been a There's been a
[1:38:07] lot of sem- semantics. It is an
[1:38:09] increase. It is an increase. Um but
[1:38:12] there's also been inflation from last
[1:38:13] year to this year as well. So,
[1:38:17] you know, I I I deal with this in my
[1:38:21] what I, you know, current company that I
[1:38:23] work with and we we separate the two.
[1:38:29] and yeah, it's an im- it's an impact in
[1:38:31] one form or fashion. So,
[1:38:33] anyway, yeah. I I don't need to say any
[1:38:35] more on that.
[1:38:42] » Like I said last meeting, I'm
[1:38:44] fine with the I kind of got some of the
[1:38:46] stuff I wanted, but
[1:38:48] I just have to say that I don't think
[1:38:49] that the elected officials should
[1:38:52] receive anything. I think we just keep
[1:38:53] ours as is.
[1:38:56] But that's my my two cents on it.
[1:39:00] >> And to be sure, not I mean, this is like
[1:39:02] the approved rate, but even not all of
[1:39:05] the elected officials receive that. Some
[1:39:07] have opted to like
[1:39:11] forgo or forfeit, I guess, yeah, theirs
[1:39:15] and so they don't actually receive it.
[1:39:35] » So, I did the math. It's just the 3%
[1:39:37] COLA. That's all this is showing.
[1:39:40] Correct.
[1:39:40] >> So, the first
[1:39:42] number you'll see is like the current
[1:39:44] compensation so these are the rates that
[1:39:45] they're currently paid at and then
[1:39:48] the second column would be what their
[1:39:51] new rate would be with that 3% Cola
[1:39:53] which is again cost of living adjustment
[1:39:56] only which is the 3% that's been
[1:39:57] approved for
[1:40:00] citywide staff to receive so
[1:40:10] » I've I've
[1:40:12] spent [clears throat] the last couple
[1:40:13] weeks having conversations with
[1:40:19] most of the individuals on this on this
[1:40:21] list I I know
[1:40:29] I I I just want to say I appreciate our our staff and especially those that
[1:40:35] direct um
[1:40:39] direct the the city um
[1:40:42] and
[1:40:44] the the dealings that we deal with a lot
[1:40:46] of those individuals you know have a
[1:40:48] holiday supposed to be on a holiday and
[1:40:51] on a holiday they are
[1:40:55] at their desk so um
[1:40:58] uh I it's it's
[1:41:00] >> or out in the field
[1:41:03] um and so I anyway I did
[1:41:07] I think this at a minimum is is
[1:41:11] uh an appreciation factor
[1:41:14] we're dealing with you know
[1:41:16] costs of livings and other things that
[1:41:18] you know come into play this is
[1:41:19] appreciation I I I feel like this is
[1:41:22] something we needed to do just to even
[1:41:24] in that setting to to show that so anyway
[1:41:29] that's all I have to say on it
[1:41:32] >> staff appreciate all of that
[1:41:47] » Appreciate all the extra effort, too, in
[1:41:49] going through the budgets to try to
[1:41:50] figure out how we can
[1:41:53] >> Where we can make the cuts. Yep.
[1:41:55] >> So
[1:41:59] All right. Now, I'm finished, Jeff.
[1:42:02] >> [laughter]
[1:42:04] » So, is the public comment done? We just
[1:42:07] need a motion.
[1:42:10] » [clears throat and cough]
[1:42:17] » So, Mayor, I make a motion that we
[1:42:19] approve Resolution 26-46
[1:42:23] approving and adopting the fiscal year
[1:42:25] 2027 compensation schedule for the
[1:42:28] Grantsville City department heads and
[1:42:30] elected officials.
[1:42:32] >> We have a motion by Councilmember
[1:42:34] Williams. Is there a second?
[1:42:36] >> I'll second the motion.
[1:42:37] >> A second by Councilmember Skinner. All
[1:42:40] in favor.
[1:42:41] >> Aye.
[1:42:42] >> All opposed.
[1:42:43] >> Nay.
[1:42:48] » Roll call. Councilmember Williams.
[1:42:50] >> In favor.
[1:42:51] >> Skinner.
[1:42:52] >> In favor.
[1:42:53] >> Dalton.
[1:42:54] >> Nay.
[1:42:55] >> Um Thomas.
[1:42:57] >> In favor.
[1:43:04] » Okay. Item number 11, a presentation of
[1:43:07] property tax impact schedule.
[1:43:12] » All right. So,
[1:43:14] it's our favorite little property tax
[1:43:16] impact schedule document you guys have
[1:43:18] seen.
[1:43:22] So, Grantsville City is considering an
[1:43:24] increase to its property tax rate from
[1:43:27] 0.001417
[1:43:29] to 0.001488,
[1:43:32] which exceeds the estimated certified
[1:43:33] tax rate and is estimated to generate an
[1:43:36] additional $110,598,
[1:43:39] dollars, sorry, and 32 cents in property
[1:43:41] tax revenue.
[1:43:43] Um, so it just kind of goes through what
[1:43:46] our current property tax rate is, um, at
[1:43:48] the certified tax rate, um, what how
[1:43:51] much property tax revenue that would
[1:43:53] generate, which is 2.2 million.
[1:43:55] The proposed revenue with the tax change
[1:43:57] would be 2.3 million, which is that
[1:44:00] increase of 110,000. So, it's a 5%
[1:44:04] property tax
[1:44:05] increase rate, and it equates to
[1:44:08] approximately a dollar 83 per month for
[1:44:10] residential, for the average home.
[1:44:13] Um, and that again would be going to
[1:44:14] fund a parks and recreation employee to
[1:44:18] accommodate for our scenic slopes coming
[1:44:19] online.
[1:44:21] >> And Desert Edge.
[1:44:22] yes.
[1:44:23] >> Yes.
[1:44:24] >> And the Veterans Park.
[1:44:27] >> So, anyway, so we just have to read that
[1:44:29] and disclose it and announce it and
[1:44:31] present it. So,
[1:44:32] nothing really to do that one.
[1:44:34] >> Just a presentation.
[1:44:35] >> Yep.
[1:44:36] >> Okay.
[1:44:39] All right.
[1:44:40] Um,
[1:44:41] item number 12,
[1:44:44] um, is also a public hearing
[1:44:48] item. It is the consideration of
[1:44:50] resolution 2026-49
[1:44:53] approving the 2026 update to the
[1:44:55] Grantsville City Transportation Master
[1:44:57] Plan.
[1:44:59] >> Oh, wait, we have two different ones.
[1:45:00] Oh.
[1:45:03] >> Sorry.
[1:45:04] >> So, mine's I got two papers and I have a
[1:45:06] different item. Sorry.
[1:45:08] Um, 2020 Item number 12, consideration
[1:45:11] of resolution 2026-48
[1:45:14] approving and adopting the fiscal year
[1:45:16] 2027 interim budget and acknowledging
[1:45:19] the fiscal year 2027 property tax impact
[1:45:21] schedule.
[1:45:23] >> So, this is just would be the interim
[1:45:25] budget for fiscal year 2027 for us to
[1:45:28] operate on
[1:45:30] beginning July 1st. Um the truth in
[1:45:32] taxation will go through
[1:45:35] citizens will receive the notice of it
[1:45:36] when they get their tax valuation notice
[1:45:38] in July from Tooele County.
[1:45:41] And then we'll do our truth in taxation
[1:45:43] hearing in August. And then at that
[1:45:44] point, depending on you guys' decision
[1:45:46] to adopt a new property tax rate of the
[1:45:49] 5% or lower, um at that point we would
[1:45:52] adjust. So, this interim budget does
[1:45:54] have the property tax, the additional
[1:45:56] revenue proposed with the rate, as well
[1:45:59] as the expenses separated out into
[1:46:02] separate line items, so that that way it
[1:46:04] does not perceived
[1:46:06] in our operating budget that that
[1:46:08] funding is available yet. So, depending
[1:46:11] on what happens in August at that and
[1:46:13] your decision at that point, we would
[1:46:15] either do a line item adjustment to move
[1:46:17] that budget into a usable line, or it
[1:46:21] would just sit there untouched until
[1:46:24] the year end, being as how we didn't
[1:46:26] receive any additional revenue if you
[1:46:27] guys opted for no increase in August.
[1:46:29] So, this one just has it
[1:46:32] explicitly separated out, so that way it
[1:46:35] is not confused for any staff that they
[1:46:37] think that that budget is available for
[1:46:39] use.
[1:46:40] So.
[1:46:41] >> Is that the difference on what we were
[1:46:42] voting cuz we we voted to approve it
[1:46:44] last time, the interim budget, right?
[1:46:45] >> So, that the tentative.
[1:46:47] >> The tentative.
[1:46:48] >> Yeah.
[1:46:49] >> So, does it feel like this is like
[1:46:51] Groundhog Day?
[1:46:52] >> The tentative budget that we adopted the
[1:46:54] tentative budget at the very beginning
[1:46:55] of the presentation cuz that would just
[1:46:56] be tentative till now that we have to
[1:46:58] adopt the interim budget.
[1:46:59] >> Okay.
[1:47:00] >> Yeah, so the interim budget, and this is
[1:47:02] new this year as well from the state of
[1:47:05] Utah from the tax commission. And so, we
[1:47:08] in years past they have adopt if they go
[1:47:11] through a truth in taxation, they would
[1:47:12] adopt a tentative budget, but there's
[1:47:15] been a lot of changes for transparency
[1:47:18] and truth in taxation processes that
[1:47:20] have gone into effect this year. And so,
[1:47:22] we have to be very clear
[1:47:24] and use the new terminology that it's an
[1:47:26] interim budget, not attentive. So, this
[1:47:29] is the interim budget that we will be
[1:47:30] operating on until we would adopt a
[1:47:33] final budget in August after the truth
[1:47:36] and taxation.
[1:47:37] >> But nothing in this budget has changed
[1:47:39] other than we're calling it the word
[1:47:40] interim.
[1:47:40] >> Yes, it's the word interim, and then it
[1:47:42] does have the potential additional
[1:47:44] revenue and that corresponding expense
[1:47:47] in separate line items. Yeah.
[1:47:49] >> Separated based on whatever decision is
[1:47:51] made on that.
[1:47:51] >> Correct. And so like I went into our
[1:47:53] chart of accounts, created new general
[1:47:55] ledger accounts, and so all of it's like
[1:47:57] official now, and it does have it
[1:47:59] separated out in this budget. But that's
[1:48:00] the only change that has occurred since
[1:48:04] the last one you saw.
[1:48:05] >> Unless there's some increase you want to
[1:48:06] put on there right now for some other
[1:48:08] project that you thought of.
[1:48:12] » Or we can do an amendment
[1:48:14] after July.
[1:48:15] >> [laughter]
[1:48:17] >> So.
[1:48:19] >> Yeah. Okay. Thank you, Aspen. We'll go
[1:48:21] to our um
[1:48:22] the public comment section of item
[1:48:25] number 12. So, if you have any comments
[1:48:28] and you would like to bring those to the
[1:48:30] council's attention, please come forward
[1:48:31] at this time, or if you're online,
[1:48:33] please raise your hand.
[1:48:42] Anything online, Alicia?
[1:48:45] Okay. All right, we'll close the public
[1:48:47] comment for item number 12 and continue
[1:48:49] with the discussion with the council
[1:48:53] on this resolution.
[1:48:56] » I don't have more questions. That was my
[1:48:57] all my questions.
[1:48:58] >> All right.
[1:48:58] >> I don't either.
[1:48:59] >> Okay.
[1:49:01] All right, we just need a motion.
[1:49:04] >> Mayor, I make a motion we move to
[1:49:05] approve resolution 2026-48 adopting
[1:49:09] approving and adopting the fiscal year
[1:49:11] 2027 interim budget and acknowledging
[1:49:14] the fiscal year 2027 property tax impact
[1:49:17] schedule.
[1:49:17] >> All right, we have a motion by council
[1:49:19] member Thomas. Is there a second?
[1:49:21] >> I second motion.
[1:49:21] >> Second by council member Skinner. All in
[1:49:23] favor?
[1:49:24] >> I.
[1:49:26] >> Great.
[1:49:29] Um item number 13, a consideration of
[1:49:31] resolution 2026
[1:49:34] -49 approving the 2026 update to the
[1:49:36] Grantsville City Transportation Master
[1:49:38] Plan.
[1:49:41] And I'm not even sure who's presenting
[1:49:42] this.
[1:49:44] That would be Bill.
[1:49:46] >> [laughter]
[1:49:47] >> We were meant to have someone online. Is
[1:49:48] there someone from
[1:49:51] Jones and Demille?
[1:49:52] >> Um what would their name be?
[1:49:55] I can tell you. I have it here.
[1:49:57] >> McLean probably. Is
[1:49:58] >> Matthew Lindford?
[1:50:00] >> Yeah. Yeah, Matthew maybe.
[1:50:02] >> Matthew McLean.
[1:50:04] >> Hey, can you hear me?
[1:50:06] >> Yes.
[1:50:08] >> Okay, that would be Matthew. Hey
[1:50:09] Matthew, how's it going?
[1:50:10] >> Good. How are you doing?
[1:50:12] >> I'm fabulous. You're on now with the
[1:50:14] council meeting and I'll hear you, so
[1:50:16] >> Okay.
[1:50:16] >> I just wanted to give a quick little
[1:50:18] introduction. Um the planning commission
[1:50:20] heard this last month and um
[1:50:23] voted to uh recommend approval by the
[1:50:25] city council. So, that's in your staff
[1:50:27] report.
[1:50:28] Uh one of the nice things about having
[1:50:29] this done now is that this helps to
[1:50:32] inform questions about and decisions
[1:50:35] made for and by our general plan update,
[1:50:37] which is
[1:50:38] imminent. So, um this would be an
[1:50:41] element of that general plan update and
[1:50:44] the the the coincidence of these two
[1:50:47] things is actually very very fortuitous.
[1:50:50] So, um
[1:50:52] we're grateful for their efforts and uh
[1:50:55] I hope you will enjoy their
[1:50:57] presentation. If you have any questions
[1:50:58] for me, I'm here and then uh otherwise
[1:51:00] we'll turn that over to you, Matthew.
[1:51:02] >> Okay, perfect. Thank you.
[1:51:04] Um thanks for [clears throat] letting me
[1:51:06] join remotely. I was unable to make it
[1:51:08] to Grantsville this evening, so thank
[1:51:10] you for this opportunity.
[1:51:14] Am I able Oh, it looks like I am able to
[1:51:16] share my screen. Perfect.
[1:51:20] Okay, can everyone see my screen?
[1:51:27] » Yes, hold on. We'll start.
[1:51:47] Let's see.
[1:51:49] We can see it. It's just
[1:51:51] kind of a funny view.
[1:51:53] >> Okay. Am I Am I good to
[1:51:56] >> Yeah.
[1:51:56] >> start presenting? Okay.
[1:51:59] Um So, we've been working with the
[1:52:02] mostly city staff for about a year now
[1:52:05] to get this updated.
[1:52:07] As was mentioned, this will be a part of
[1:52:09] the general plan.
[1:52:11] Um So, this website here will be put on
[1:52:14] the city's website. Um
[1:52:16] and this has all of the data from the
[1:52:18] plan. So, it has a report. It has all of
[1:52:21] the maps that we created with the plan
[1:52:23] as well as some other information.
[1:52:25] Um I believe [clears throat] McLean has
[1:52:28] already presented to the council. That
[1:52:30] was
[1:52:31] I believe that was in April or May.
[1:52:36] And so, I'll keep this fairly brief
[1:52:38] unless there are questions, but Um if
[1:52:40] you go to this website, um you can click
[1:52:42] on this button to get to the master plan
[1:52:44] report. This is the actual document
[1:52:46] that's being adopted as part of the
[1:52:48] general plan. Um currently on the
[1:52:50] website, um it is in a draft format just
[1:52:53] because it hasn't been adopted. Once it
[1:52:56] gets adopted, we will um finalize that.
[1:52:59] It'll have all of the same information,
[1:53:01] all the same wording. It'll just
[1:53:02] be finalized rather than in a draft
[1:53:04] format.
[1:53:07] And then on this website as well, um
[1:53:10] there's these different tabs at the top.
[1:53:11] I'll just briefly go through them. Um
[1:53:14] this tab just gives some information
[1:53:15] about Grantsville and some information
[1:53:17] about why this study was done, why this
[1:53:22] amendment and update to the
[1:53:23] transportation master plan was
[1:53:25] completed.
[1:53:26] Um this tab has socio-economic
[1:53:30] information on Grantsville from the
[1:53:31] census. This is information that we used
[1:53:34] um to determine future growth rates um
[1:53:37] and future planning.
[1:53:39] Um so you can have that for reference
[1:53:41] there.
[1:53:43] Uh and then I'm going to skip the maps
[1:53:44] for a second. Um if you go to this
[1:53:46] documents tab, it has links to the city
[1:53:49] code, city land use ordinances, the
[1:53:51] general plan for the city,
[1:53:54] um and then also the master plan report.
[1:53:57] And then this master plan appendix
[1:53:59] button, that will have uh PDF copies of
[1:54:01] all of the maps in this online website.
[1:54:05] Uh and then this last tab is just a
[1:54:06] definitions page uh that gives some
[1:54:09] definitions for words that are used
[1:54:11] throughout the plan.
[1:54:13] Um okay.
[1:54:16] Any questions before I hop into the
[1:54:17] maps?
[1:54:21] Okay, perfect.
[1:54:23] Um so a lot of these maps are looking at
[1:54:26] the existing road network and then a lot
[1:54:28] of the other maps are looking at the
[1:54:29] future build-out road network. So if you
[1:54:32] look on the
[1:54:34] um left side of the screen, this is
[1:54:36] UDOT's classification of roadways
[1:54:39] um in Grantsville. I'll zoom in.
[1:54:42] Um and it's classified by arterial,
[1:54:44] collector, and local roads.
[1:54:48] Um arterial being the highest priority,
[1:54:51] so the UDOT roads mostly right now, and
[1:54:54] then collector roads are medium priority
[1:54:56] roads, and then local roads are lower
[1:54:58] priority roads, meaning um they have
[1:55:01] lower volumes, they have lower speeds.
[1:55:04] They're more for slower local traffic.
[1:55:08] Um, on the right,
[1:55:10] you can see the
[1:55:13] future
[1:55:14] functional classification network. So,
[1:55:17] this is all of the
[1:55:19] proposed locations of future collector
[1:55:22] and arterial roads.
[1:55:24] Um, this was a critical aspect of the
[1:55:27] plan in determining where
[1:55:29] um, those collector roads are going to
[1:55:31] be to ensure that in the future we have
[1:55:35] um, good movement of traffic.
[1:55:37] There's not a lot of congestion.
[1:55:39] Um, the road stay safe, and that
[1:55:41] development occurs in the plan um,
[1:55:45] as the as the city would like
[1:55:47] development to occur.
[1:55:49] Um, any questions on this map?
[1:55:57] Okay.
[1:55:58] And the different roads have
[1:55:59] >> I have one quick question. The extension
[1:56:01] of 112 to the Burmester exit.
[1:56:04] >> Yes.
[1:56:05] >> It's a big swoop in that. Is that
[1:56:06] because of um, flood wetlands?
[1:56:10] >> Yes. So, we
[1:56:11] >> I can see that better now that it's
[1:56:13] zoomed in. Thank you.
[1:56:13] >> Yeah, we initially had that connecting
[1:56:15] straight, but felt that it would be
[1:56:17] better
[1:56:18] to go around that.
[1:56:21] Um,
[1:56:23] okay, any [clears throat] other
[1:56:23] questions?
[1:56:26] Okay.
[1:56:28] Um, this next map is the
[1:56:33] uh, this is a map of all of the roads
[1:56:35] maintained by Grantsville City. So, it
[1:56:37] doesn't have any U dot roads or any
[1:56:39] county roads.
[1:56:40] Um, it's just the roads maintained by
[1:56:42] the city. And this map is used by U dot
[1:56:45] to determine the class B and C road
[1:56:48] funds that the city gets allocated each
[1:56:50] year.
[1:56:51] Uh, so we updated this map as part of
[1:56:54] the plan.
[1:56:55] So, now U dot is um funding
[1:56:59] the city based off of an accurate road
[1:57:01] mileage.
[1:57:03] And we would recommend continuing to
[1:57:04] update this um map every every year.
[1:57:13] This next map is traffic counts that we
[1:57:16] performed. So, you can see the roads
[1:57:17] that we performed the traffic counts on.
[1:57:19] We use this to determine where those
[1:57:22] critical future corridors are going to
[1:57:23] be.
[1:57:26] you can click on these blue squares and
[1:57:28] it'll show you the average daily traffic
[1:57:31] on the road. So, here on uh Mormon Trail
[1:57:35] Road or West Street, um you can see the
[1:57:37] average daily traffic's just over 2,000
[1:57:39] vehicles. You can also see the speeds
[1:57:41] that we collected as well.
[1:57:44] Um right here, the average speeds.
[1:57:46] And then heavy truck traffic percentages
[1:57:49] as well.
[1:57:52] >> I just want to point out to uh Chief
[1:57:54] Zager that we're 1 mile below the or the
[1:57:57] speed limit is the average. So,
[1:58:00] we're all following the law here. So,
[1:58:02] >> [clears throat and laughter]
[1:58:03] >> And that is one one note I will make on
[1:58:06] the speed limit data or the speed data.
[1:58:08] If the count was taken closer to a block
[1:58:13] um or an intersection, the speed data
[1:58:15] might be a little lower than if it were
[1:58:17] taken kind of in the open. That one was
[1:58:19] taken pretty in the open though. So,
[1:58:21] that is good.
[1:58:24] » That's surprising. [laughter]
[1:58:28] » Um okay, this next map is
[1:58:33] uh crash history map. So, you can see in
[1:58:36] the table the crashes per year
[1:58:39] um in Grantsville
[1:58:41] uh by crashes without injuries, crashes
[1:58:44] with injuries, and fatalities. And then
[1:58:46] there's a heat map that shows kind of
[1:58:48] those hot spots where
[1:58:50] uh more crashes have occurred. You can
[1:58:52] see it's on the Udot highway, that makes
[1:58:54] sense because that's where you have your
[1:58:56] higher speeds, that's where you have
[1:58:57] most of your traffic. But, you can also
[1:58:59] use it to see, okay, there may be
[1:59:01] another intersection where there's some
[1:59:03] higher crashes
[1:59:05] that that might need to be looked at.
[1:59:08] Um, we didn't do an intense safety
[1:59:10] analysis as part of this plan update,
[1:59:13] um, but that is something that could be
[1:59:14] looked at in the future and this data
[1:59:16] would be helpful for that.
[1:59:24] Um, this active transportation plan,
[1:59:26] this just shows existing multi-use bike
[1:59:29] and pedestrian trails and planned future
[1:59:32] um, multi-use trails.
[1:59:38] Uh,
[1:59:40] this map shows where the city would like
[1:59:42] truck trucks to be routed. Um,
[1:59:47] so, it shows some existing and some
[1:59:49] future roads, like this road down here
[1:59:51] does not exist yet, but once it's built,
[1:59:54] that will be built as a truck route.
[2:00:02] Uh, as part of the plan, we did a
[2:00:05] an assessment of the existing pavement
[2:00:07] condition for every road in the city.
[2:00:10] Um, so you can see here there's a grade
[2:00:12] on a scale of 0 to 100. It's kind of
[2:00:15] like school, if you're
[2:00:17] the higher you are, the better your
[2:00:19] grade is. Um,
[2:00:20] and so the greener the road, the better
[2:00:22] condition it is, the redder it is, the
[2:00:24] worst condition it is.
[2:00:26] And so, we have
[2:00:27] um,
[2:00:28] each road, we completed that assessment.
[2:00:31] You can click on the specific road and
[2:00:33] see the specific detailed grade.
[2:00:36] Um, and then we used that information to
[2:00:39] create this next map
[2:00:42] which
[2:00:44] um,
[2:00:46] created a phasing plan for
[2:00:50] providing treatment to each road in the
[2:00:52] city.
[2:00:53] And you can look at each specific phase
[2:00:57] um and see which projects are included
[2:00:59] in that phase, which type of project, um
[2:01:02] the estimated cost of the project, and
[2:01:05] the estimated scope of the project.
[2:01:11] Any Any questions on this roadway
[2:01:14] treatment plan?
[2:01:21] Okay.
[2:01:22] It's a really good tool for
[2:01:25] transparency um to help inform the
[2:01:28] public of the to make them know that the
[2:01:30] city is aware of certain concerns with
[2:01:33] existing pavement condition and that
[2:01:35] there is a plan in place.
[2:01:40] Okay, this last
[2:01:43] Well, so this This is the transportation
[2:01:45] improvement plan. So, this just shows
[2:01:47] the critical corridors to be built in
[2:01:50] the future. So, we did a traffic model
[2:01:54] that went out to 2050.
[2:01:56] And we determined which roads are
[2:01:58] critical to be built by 2050, and you
[2:02:01] can see we've divided it into three
[2:02:02] phases.
[2:02:05] >> [clears throat]
[2:02:05] >> And so, by phase three, all of these
[2:02:07] roads you see,
[2:02:08] we determined these are critical
[2:02:10] corridors that need to be built
[2:02:12] uh in order to
[2:02:15] uh have a free-flowing traffic network
[2:02:18] without a lot of congestion that's safe
[2:02:21] and reliable.
[2:02:24] And you can click on each road here in
[2:02:26] the map to see
[2:02:28] how many lanes we anticipate it will
[2:02:29] need to have,
[2:02:31] and then
[2:02:32] who would be responsible for building
[2:02:35] that road when it comes down to it.
[2:02:41] Um then these last maps are level of
[2:02:44] service maps. So, this just shows with
[2:02:47] the traffic modeling how well the roads
[2:02:48] are functioning. So, this is the
[2:02:50] existing map.
[2:02:51] Um, 2025, you can see there's
[2:02:55] just like with the pavement condition,
[2:02:56] red is worse, green is better.
[2:02:58] Um, you can see the highways are a
[2:03:00] little congested on the east side of the
[2:03:02] city.
[2:03:04] And so, we with those planned corridors,
[2:03:06] if you go to 2050,
[2:03:09] if you look [clears throat] at this left
[2:03:10] side,
[2:03:11] you can see,
[2:03:14] you know, we've been able to improve a
[2:03:15] lot of that just by adding in more
[2:03:17] corridors, widening certain roads. Um,
[2:03:21] like the highway, we recommend that that
[2:03:22] should be widened.
[2:03:24] And then,
[2:03:25] you can see [clears throat] on the left,
[2:03:26] this is if it's improved, and on the
[2:03:29] right if it's not improved, what it will
[2:03:31] look like.
[2:03:34] Um, so this just creates a tool for the
[2:03:36] city moving forward to know
[2:03:38] where what are the critical corridors.
[2:03:40] Um, so for development, uh, you can
[2:03:44] ensure that when developers come in and
[2:03:46] develop that those critical corridors
[2:03:48] are maintained, so that you have um, a
[2:03:51] healthy traffic network in the future.
[2:03:56] So, that's the that's the bulk of the
[2:03:58] plan. Those are the maps, um, that we
[2:04:00] created as a result of all of the data.
[2:04:03] If you look in the report, that mostly
[2:04:05] just has all of the raw data from the
[2:04:07] plan. Uh, it's about I don't know, 70
[2:04:10] pages, I think. So,
[2:04:13] oh, it's only 50 pages, nice. So, but if
[2:04:16] you want to read through the raw data
[2:04:17] report, you can look at that as well,
[2:04:19] but
[2:04:20] um, any questions for me?
[2:04:27] » Any questions?
[2:04:30] Thank you for your presentation.
[2:04:32] >> Yeah, thanks for the opportunity to work
[2:04:34] on this project. It's been a good
[2:04:35] project.
[2:04:44] » Anybody have any concerns with the transportation master plan?
[2:04:51] » Oh, you can spend a lot of time getting
[2:04:53] all
[2:04:54] getting it out on roads in there. I I I
[2:04:56] thought they did a great job showing
[2:05:00] There there's some interesting things as
[2:05:02] you look at this, you know, specifically
[2:05:04] I-80.
[2:05:06] How it how it maintains yellow and red
[2:05:08] even with the build out. So, you know,
[2:05:10] as we look within our our district and
[2:05:15] really as we look within
[2:05:17] you know, inner connectivity to the
[2:05:19] other valley, there's going to need to
[2:05:21] either a major expansion of I-80 or
[2:05:25] high rail or other other factors coming
[2:05:27] to this valley to make it
[2:05:31] you know, functional for us. But
[2:05:32] >> Yeah. All of the above.
[2:05:35] >> So.
[2:05:37] Anyway, yeah, I thought they did did a
[2:05:39] good job.
[2:05:42] And this syncs in with the data from
[2:05:44] UDOT cuz we got separate data from them,
[2:05:46] too. Were those Did those two studies
[2:05:49] connect? Maybe that's a question.
[2:05:53] We lose
[2:05:53] >> Um
[2:05:54] there was a bit [clears throat] of
[2:05:55] overlap. Uh we had for all of our
[2:05:58] coordination meetings with the city,
[2:06:00] there were representatives of UDOT there
[2:06:02] to ensure that
[2:06:04] um for the UDOT corridors, those were
[2:06:06] planned out in the right location and
[2:06:08] that we were consistent with their
[2:06:09] planning.
[2:06:12] >> Perfect.
[2:06:18] » Yes, Matthew, two things I've noticed
[2:06:20] that we probably need to have you update
[2:06:22] is on this map the level of service, the
[2:06:25] one well going north need to be
[2:06:28] readjusted
[2:06:30] to the right location like you had on
[2:06:31] the original, the first one.
[2:06:34] And then probably in the truck route,
[2:06:38] since you had the the deep North Temple
[2:06:40] Road added there, you probably would
[2:06:42] want the 112 going north to go straight
[2:06:45] that same route, add it to the truck
[2:06:48] route.
[2:06:50] Okay.
[2:06:51] Yeah, that's that's something those are
[2:06:53] some updates we can make.
[2:07:22] » Mayor, I'll make [clears throat] a
[2:07:22] motion we approve resolution 2026-49
[2:07:26] approving the 2026 update to the
[2:07:29] Grantsville City transportation master
[2:07:31] plan with the updates that our city
[2:07:33] manager
[2:07:35] just ex- just suggested.
[2:07:37] >> Okay, we have a motion by Council member
[2:07:39] Dalton. Is there a second?
[2:07:40] >> I second it.
[2:07:41] >> A second by Council member Williams. All
[2:07:43] in favor.
[2:07:44] >> Aye.
[2:07:46] >> All right.
[2:07:49] Item number 14, a consideration of
[2:07:51] resolution 2026-50
[2:07:53] approving the pickup of member
[2:07:55] contributions for Tier 2 public safety
[2:07:57] and firefighter
[2:07:59] contributory retirement system and
[2:08:01] authorizing the related employer
[2:08:03] election form.
[2:08:06] » I should be online.
[2:08:07] >> Mhm.
[2:08:22] » Are you there, Heidi?
[2:08:22] >> Mayor.
[2:08:23] >> I am. Good evening, Mayor and Council.
[2:08:28] Can you guys hear me okay?
[2:08:30] >> We can, yes.
[2:08:31] >> Perfect. So, historically, the city has
[2:08:35] picked up the public safety tier two
[2:08:39] contribution employee contribution. It's
[2:08:42] been at 4.73%.
[2:08:44] It is increasing to 5.98%.
[2:08:49] The city can opt to continue picking
[2:08:51] that up for our officers or pass that on
[2:08:54] to the officers.
[2:08:55] I would recommend, obviously, to pick
[2:08:57] that up.
[2:08:59] To continue what we've done
[2:09:00] historically. This will allow our
[2:09:02] officers to keep more of their take-home
[2:09:05] pay.
[2:09:07] Keeps us competitive with other agencies
[2:09:09] as well.
[2:09:15] » Can you go over the the cost, I think by
[2:09:17] the Heidi?
[2:09:18] >> Yeah, of course. So, if we do opt to
[2:09:20] pick up the the additional cost, it
[2:09:24] would cost the city of Pop approximately
[2:09:26] $13,395
[2:09:30] annually.
[2:09:32] That is if we keep the same exact number
[2:09:35] of officers we have
[2:09:37] that are in
[2:09:39] the tier two
[2:09:42] system.
[2:09:48] I did look at what other cities are
[2:09:50] doing. Um, there was 82
[2:09:53] different um, responses that were in
[2:09:56] there. 30 said that they were picking
[2:09:59] that up.
[2:10:01] 12 said they were not picking it up, and
[2:10:04] eight of them
[2:10:06] were pending pick up.
[2:10:10] To be determined, some were unknown, and
[2:10:12] then there was some no responses in
[2:10:14] there as well.
[2:10:25] » And just so you guys are aware, this
[2:10:27] isn't this isn't an additional benefit
[2:10:30] or a new benefit.
[2:10:33] it is that the city has been doing since
[2:10:38] well
[2:10:39] 2020 was when I went back to. We were at
[2:10:42] 2.27%.
[2:10:50] » Uh question Heidi, so you're saying if
[2:10:52] we don't pick this up the officers are
[2:10:53] going to be mandatory required then to
[2:10:55] they would have to contribute then to
[2:10:57] the URS. They would be required.
[2:10:58] >> Yes, that is correct.
[2:11:01] >> And
[2:11:02] from what
[2:11:02] >> And they cannot opt out.
[2:11:05] >> Yes, okay.
[2:11:07] This is the
[2:11:08] other states do this where they you
[2:11:09] force the officers to contribute to the URS system and it does it's
[2:11:13] mandatory. They don't have a choice. It
[2:11:15] takes it out of their pay.
[2:11:17] >> That is correct.
[2:11:18] >> It would be a pay cut for our officers
[2:11:19] if we if we didn't pick this up.
[2:11:23] I mean it
[2:11:24] because they would it would it would be
[2:11:25] going to their retirement but it would
[2:11:27] be mandatory. They wouldn't have the option to not
[2:11:31] contribute to that.
[2:11:35] » That is correct. This isn't an optional
[2:11:39] benefit for them. It's something that
[2:11:42] they have to pay into and it's part of
[2:11:44] their pension. So the money doesn't go
[2:11:46] directly into their pocket. It goes into
[2:11:48] their pension. So once they retire
[2:11:51] that's part of their the pension
[2:11:53] benefit.
[2:11:59] » So I assume we don't have this increase
[2:12:01] in our new budget that we've worked on,
[2:12:04] correct?
[2:12:05] Cuz we didn't
[2:12:07] did we know it was going to 5.98%?
[2:12:11] >> Mm, sorry. Uh Heidi can talk in a
[2:12:13] second. [clears throat] But no, so it's
[2:12:15] not in the current um
[2:12:17] interim budget that you guys approved
[2:12:19] earlier. I mean, we have
[2:12:21] budget for police officers for their
[2:12:23] benefits and stuff. So, we'll be able to
[2:12:24] pick it up immediately, but I actually
[2:12:26] have an email drafted to Heidi right now
[2:12:29] to just get together with her to get if
[2:12:31] it's approved to get the official amount
[2:12:33] and then I would come to you at our
[2:12:34] first meeting in July with that budget
[2:12:36] amendment. So, it'd be like the July
[2:12:38] 15th meeting, but
[2:12:40] >> And Heidi said it'd be around $13,000.
[2:12:42] >> Yeah. Yeah.
[2:12:43] >> She said if we don't pick up any more
[2:12:45] officers, but we haven't approved any
[2:12:47] more officers this year, so
[2:12:48] >> Correct. So, we would we would only be
[2:12:50] budgeting for the current staffed
[2:12:51] officers at this time um because there
[2:12:53] wasn't any approved increases for
[2:12:56] additional staffing. So,
[2:12:57] >> sent us this number so it's not very
[2:12:59] significant earlier. Otherwise, we would
[2:13:01] have picked that
[2:13:02] in the budget.
[2:13:02] >> Yeah.
[2:13:05] » Is this a typical increase year-to-year
[2:13:07] type thing? Is this uh
[2:13:10] >> Are you going to give the background on
[2:13:12] how URS comes up with that?
[2:13:14] >> Yeah, give us a little retirement
[2:13:15] history on that program.
[2:13:16] >> Yeah, it Of course. Yeah, so in 2020
[2:13:22] 2021 it was 2.7%,
[2:13:24] 2022 was 2.59,
[2:13:28] 2023 was also 2.59,
[2:13:31] 2024 it jumped to 4.73,
[2:13:35] 2025 4.73,
[2:13:37] and then it jumped up again to 5.98.
[2:13:42] » So, we're looking at like a 1.2
[2:13:45] >> 1.2 1.25
[2:13:47] >> percent increase.
[2:13:48] yeah. Yes.
[2:14:15] » So, another dumb question. Do we have
[2:14:16] the option to
[2:14:18] say we'll pay the 4.73%
[2:14:21] we budgeted
[2:14:23] and make them pay the 1.98%
[2:14:26] that we haven't considered?
[2:14:27] >> Absolutely.
[2:14:28] >> Yes.
[2:14:30] you can.
[2:14:32] >> But, again, that's going to put
[2:14:34] cuz they have to like mandatory, so
[2:14:36] that'll just come out of their portion
[2:14:38] of their paycheck they're taking off.
[2:14:47] » This is something that's straight across
[2:14:49] the board, whether it be to public
[2:14:51] safety or tier two or
[2:14:54] public employees tier two as well. They
[2:14:56] have a They have an increase also that
[2:14:59] the employees are picking up. The only
[2:15:02] difference is this The city's not
[2:15:03] allowed to pick up the public employee,
[2:15:05] but they can pick up public safety.
[2:15:10] » Is there not an increase for tier one?
[2:15:12] >> No, there is not.
[2:15:18] » But, we we do pick up tier one.
[2:15:21] >> There is not a Tier one and tier two are
[2:15:23] a different They're a different entity.
[2:15:26] They They work a little bit different,
[2:15:28] and no, they don't have an employee
[2:15:30] portion.
[2:15:33] » Oh, I because they have the benefit of
[2:15:34] already
[2:15:35] >> They were in there before they
[2:15:36] >> in there Yeah.
[2:15:37] >> Correct.
[2:15:39] Yeah, their benefit fits are a little
[2:15:40] bit different.
[2:15:54] » I think it's probably a good thing. I
[2:15:55] think the timing's crappy
[2:15:57] >> Yeah.
[2:15:57] >> cuz we spent
[2:16:00] 3 months hashing out a budget, and then
[2:16:02] the night of approval.
[2:16:05] So,
[2:16:07] Yeah.
[2:16:08] That's just my feelings.
[2:16:10] >> Well, and I mean everybody knows mine is
[2:16:12] transparency. Obviously, my husband's in
[2:16:14] law enforcement, so I mean he's ran for
[2:16:16] public safety, so
[2:16:18] But I know these guys work hard and I
[2:16:19] can I I always support fire and law
[2:16:22] enforcement. Um and this would be a huge
[2:16:24] change for them. This is not something
[2:16:26] that And it wouldn't they wouldn't see
[2:16:27] it in their if if we said it if we if we
[2:16:29] said we're going to pick this up, they
[2:16:30] don't see any difference in their
[2:16:31] paychecks. We're not giving them a
[2:16:32] raise. We're we're doing what we have to
[2:16:35] do to match what URS is giving them. Um
[2:16:37] so they can keep that pension and not
[2:16:39] have it come out of their pocket. But
[2:16:41] that's always
[2:16:42] most of the cities I've seen have been
[2:16:43] doing that. Most departments.
[2:16:45] I guess. I shouldn't say all because
[2:16:46] obviously Heidi said there's some that
[2:16:48] haven't, but um it's a benefit in Utah.
[2:16:50] Like, you know, I know Arizona doesn't
[2:16:52] and that was a pay cut for us when we
[2:16:53] moved to Arizona because the state does
[2:16:55] require you to do that. And it's hard
[2:16:57] for some of these younger guys who, you
[2:16:59] know, of course they're probably not
[2:17:00] thinking about retirement and they
[2:17:01] shouldn't, but if you're suddenly saying
[2:17:02] now you must contribute and it's $13,000
[2:17:05] a year.
[2:17:06] It's unfortunate that they increase this
[2:17:08] and we don't have a
[2:17:10] say in that, but
[2:17:12] that's my
[2:17:23] » Yeah, I mean if you look at the numbers
[2:17:25] what other people are doing, you've got
[2:17:26] the you've got 30 that are saying yes,
[2:17:29] we're picking it up and you have eight
[2:17:31] who are pending
[2:17:33] and 12 who say no, we're not picking
[2:17:35] that additional up.
[2:17:38] >> So for of the 12, are you saying they're
[2:17:40] just keeping the 4.73 and they're making
[2:17:41] the officers pay the difference?
[2:17:44] >> Correct. But they also
[2:17:46] if you if I was to look at those cities,
[2:17:49] they could be paying more than a 3%
[2:17:52] cola. They could also be paying a merit
[2:17:54] as well.
[2:17:56] So it's hard to compare kind of apples
[2:17:58] to apples on this.
[2:18:00] >> [clears throat]
[2:18:07] » Jack, did you have something you wanted
[2:18:08] to say?
[2:18:08] >> No, I was just saying I'm kind of in
[2:18:09] line with Jeff's thoughts. So, you know,
[2:18:12] it it's timing timing, but
[2:18:15] >> [clears throat]
[2:18:17] » Derek?
[2:18:18] >> I don't like to put the pressure back
[2:18:20] there.
[2:18:20] >> I'm just torn.
[2:18:22] >> So.
[2:18:23] >> I don't know.
[2:18:25] I mean
[2:18:26] they do great. They're all amazing, but
[2:18:30] just
[2:18:31] the timing is what is
[2:18:42] » Yeah, timing, but I yeah, I I also feel
[2:18:44] it should be put on their shoulders, in
[2:18:47] my opinion. So.
[2:18:51] I think we can find a way to do it.
[2:19:07] » Mayor, I move that we approve resolution
[2:19:09] 2026-50 approving the pick-up of member
[2:19:12] contributions for tier two public safety
[2:19:13] and firefighter contributory retirement
[2:19:15] system and authorizing the related
[2:19:17] employer election form.
[2:19:21] >> We have a motion by Council member
[2:19:22] Skinner. Is there a second?
[2:19:26] » I second.
[2:19:27] >> We have a second by Council member
[2:19:28] Thomas. All in favor?
[2:19:31] >> I.
[2:19:34] >> All opposed?
[2:19:36] >> Nay.
[2:19:38] >> Okay, we'll do a roll call. Council
[2:19:39] member Thomas.
[2:19:40] >> I.
[2:19:41] >> Dalton.
[2:19:42] >> I.
[2:19:43] >> Skinner.
[2:19:43] >> I.
[2:19:44] >> Uh Williams.
[2:19:45] >> Nay.
[2:19:47] >> All right.
[2:19:49] Moving on to item
[2:19:51] >> say nay because of I would agree to the
[2:19:53] 4.73 that we budgeted. It's just the
[2:19:56] additional. So.
[2:19:58] just wanted to state that.
[2:19:59] >> Okay. Thank you.
[2:20:01] Item number 15, consideration of an
[2:20:03] authorization to execute a memorandum of
[2:20:06] understanding with the Tooele Technical
[2:20:07] College.
[2:20:11] » Um
[2:20:12] I'll speak a little bit. We have the um
[2:20:15] Jess affiliated with the Technical
[2:20:16] College here.
[2:20:17] >> Thanks, Jess, for sticking with us this
[2:20:19] whole time.
[2:20:20] >> We do appreciate [laughter]
[2:20:21] that.
[2:20:22] Uh with the budget cuts, we did cut uh
[2:20:25] the Technical College for the small
[2:20:27] business amounts. We were contributing
[2:20:29] $20,000
[2:20:31] to that small business alliance. We cut
[2:20:32] that down to 5,000.
[2:20:34] And so, this is the updated memorandum
[2:20:37] to clarify that and then then put it as
[2:20:40] a yearly um review is what we we've
[2:20:43] agreed to and they they've agreed to
[2:20:46] make that change. And so, they're going
[2:20:47] to come now yearly to us and kind of
[2:20:50] again, depending on how much um
[2:20:53] uh and uh
[2:20:56] growth we see as a city from residential
[2:20:58] to our uh retail type thing and
[2:21:01] industrial, maybe we can up that number
[2:21:03] in the future. Cuz we do want to
[2:21:05] recognize that our that that
[2:21:06] contribution that they have to the small
[2:21:09] businesses and what they bring to
[2:21:10] Grantsville is is uh is is huge and we
[2:21:13] want to keep that program going unless
[2:21:15] the council directs otherwise. But,
[2:21:17] staff felt that that's a very important
[2:21:19] program for our small businesses and
[2:21:21] their contribution to that.
[2:21:23] So, we didn't want to exclude that
[2:21:24] entirely. And so, if you have you have
[2:21:26] any questions about the small business
[2:21:28] alliance, Jess is here to answer those.
[2:21:30] Otherwise, the the memorandum's just
[2:21:32] going to be changing it and reducing it
[2:21:34] from the 20,000 to the 5,000 and then to
[2:21:37] a yearly basis.
[2:21:48] » And I I would also like to echo
[2:21:51] Michael's statement that we we do
[2:21:53] recognize and appreciate the
[2:21:55] contributions of the Tooele Technical
[2:21:57] College and
[2:21:58] all that they do for our county and our
[2:22:00] city.
[2:22:02] >> May I address the council?
[2:22:03] >> You sure may. Yes.
[2:22:08] » I want to thank uh the manager for his uh his handling
[2:22:13] of this and I just want to take a minute
[2:22:15] and thank Grantsville City for the
[2:22:17] support that you give to small
[2:22:19] businesses.
[2:22:21] Um it makes a lot possible.
[2:22:25] at the SBDC and Tooele Technical
[2:22:27] College, we're not unsympathetic to the
[2:22:29] challenges that your city's facing right
[2:22:31] now.
[2:22:32] Uh we know and and we get it and uh and
[2:22:35] we want to be there with you on it.
[2:22:38] So uh we understand this and and and and
[2:22:41] I just want to say that that we're
[2:22:43] nothing but grateful
[2:22:44] uh for your willingness to continue to
[2:22:47] support those small businesses.
[2:22:49] Um I don't know if they were able to get
[2:22:51] the report that I shared with you.
[2:22:54] >> Not yet.
[2:22:54] >> Okay. I I brought copies. I'll leave
[2:22:56] them with uh with the manager um
[2:23:01] to give you an an idea of what the
[2:23:02] impact has been since we started uh in
[2:23:06] 2018 in Grantsville City specifically so
[2:23:09] you can see that.
[2:23:11] Um I don't share that with you as any
[2:23:13] kind of leverage or anything but uh I
[2:23:15] come every year in the fall to to report
[2:23:19] on our impact and I'm looking forward to
[2:23:21] doing that again this year.
[2:23:23] Um but I just want to say thank you
[2:23:26] and I'll leave this information with you
[2:23:29] that uh that might be uh helpful to you
[2:23:32] and wish you well. We want to be a part
[2:23:34] of the solution
[2:23:35] uh in any way that we can uh for the
[2:23:38] challenges that you're facing.
[2:23:41] And we're fully confident that those are
[2:23:43] going to be resolved and look forward to
[2:23:45] uh future partnerships. So uh thank you
[2:23:48] again.
[2:23:49] >> Thank you. Thanks, Jess.
[2:24:09] » We need a motion to pass this uh just an
[2:24:11] authorization to execute. Is that what
[2:24:13] we're doing? Okay.
[2:24:14] >> I make a motion um
[2:24:18] that we authorize the execution of a
[2:24:20] memorandum of understanding with Utah
[2:24:22] Technical College.
[2:24:24] >> Okay, we have a motion. Is there a
[2:24:25] second? A motion by Council member
[2:24:27] Williams. Is there a second?
[2:24:29] >> I'll second.
[2:24:30] >> A second by Council member Dalton. All
[2:24:31] in favor?
[2:24:32] >> I I
[2:24:34] >> All right.
[2:24:37] Item number 16, a consideration of
[2:24:39] resolution 2026-43
[2:24:42] approving the Utah Wildfire Resources
[2:24:44] Memorandum of Understanding between the
[2:24:46] Utah Division of Forestry, Fire, and
[2:24:48] State Lands and the Grantsville
[2:24:50] Volunteer Fire Department.
[2:24:54] » Hello.
[2:24:55] >> Mayor, Council members. Jason Remy, Fire
[2:24:57] Chief, Grantsville Fire. So, this res-
[2:25:00] resolution seeks support of approval for
[2:25:04] MOU between the Grantsville Volunteer
[2:25:06] Fire Department, Grantsville City, and
[2:25:08] the Utah Division of Forestry, Fire, and State Lands.
[2:25:12] The purpose of this MOU is to formalize
[2:25:14] how all all fire resources are
[2:25:16] coordinated and utilized between our
[2:25:19] city and the state.
[2:25:21] So, this should have come in with the
[2:25:24] I just lost my train of thought.
[2:25:27] >> Cooperation
[2:25:27] >> The cooperation agreement that we
[2:25:29] approved
[2:25:30] >> a month ago.
[2:25:31] >> Yeah.
[2:25:31] >> A month ago.
[2:25:32] This should have been with that. So,
[2:25:34] it's just an addition to that. So,
[2:25:36] it's how we work with the state and when
[2:25:38] we go out on a wildland fires, they pay
[2:25:40] us.
[2:25:41] >> That's what I was curious. I was like we
[2:25:43] I think we got how we nailed this one,
[2:25:45] but it's
[2:25:46] >> Yeah, they didn't send this extra
[2:25:47] [clears throat] documents.
[2:25:48] >> Yeah, okay.
[2:25:51] » So, we're just seeking approval for
[2:25:55] the mayor or city manager to sign it and
[2:25:57] send it back to state.
[2:26:01] » They do this every year, right? Same
[2:26:02] thing.
[2:26:03] >> Yeah.
[2:26:08] Any discussion?
[2:26:10] Mayor make a motion motion we move to
[2:26:12] approve resolution 2026-43 approving the
[2:26:15] Utah Wildfire Resources Memorandum of
[2:26:18] Understanding between Utah Division of
[2:26:19] Forestry, Fire, and State Lands and our
[2:26:22] fabulous Grantsville Volunteer Fire
[2:26:24] Department.
[2:26:25] >> We have a motion by Council member
[2:26:27] Thomas. Is there a second?
[2:26:29] >> I'll second that.
[2:26:30] >> Second by Council member Skinner. All in
[2:26:31] favor?
[2:26:32] >> Aye.
[2:26:35] >> All right.
[2:26:38] Uh agenda item number 17 is Council
[2:26:41] reports.
[2:26:43] Um I'll start with
[2:26:45] Jake.
[2:26:47] » Um I I give I'll go quick. Uh
[2:26:51] update on obviously
[2:26:55] the Memorial Park is moving forward um
[2:26:58] in anticipation of trying to get that
[2:26:59] closer to being finished by the 4th of
[2:27:01] July. I don't know if we'll we'll reach
[2:27:02] that or not, but the the name walls have
[2:27:04] been poured. The
[2:27:06] plinth um
[2:27:08] has been
[2:27:10] uh foundation has been poured, and then
[2:27:12] they were in the in the process of
[2:27:14] laying out the Purple Heart.
[2:27:17] Uh and so uh progress moving along well
[2:27:20] in that. It's It's It's looking great.
[2:27:25] I had something that I was going to
[2:27:27] address specifically on that, but now I
[2:27:28] can't remember what it was, but um
[2:27:32] yeah, that first phase is moving is
[2:27:34] moving there. We're going to have some
[2:27:35] challenges after we achieve that first
[2:27:38] phase and and kind of where we go next.
[2:27:42] but yeah, getting those primary
[2:27:44] components in is is
[2:27:47] it's moving forward. I know that
[2:27:48] is exciting for many who have
[2:27:51] a lot of time in.
[2:27:52] Uh they
[2:27:54] uh we've seen some preliminary
[2:27:57] uh they're going to have a miniature
[2:27:59] version of the statue.
[2:28:02] Um and I believe they'll have that for
[2:28:03] the 4th of July, so you can you can see
[2:28:05] that. Uh it was they they started the
[2:28:07] clay process and he brought that to
[2:28:10] uh one of the meetings. Specifically,
[2:28:12] it's it's going to fit in Grantsville.
[2:28:15] Almost it it looks Grantsville. So, um so you'll get to see I know they've
[2:28:20] got renderings of it, but
[2:28:22] [clears throat] it
[2:28:23] it's amazing the uh amount of detail
[2:28:26] that goes into
[2:28:28] creating a statue right down to
[2:28:30] measuring
[2:28:31] the firearm, the length of the firearm,
[2:28:34] how, you know,
[2:28:35] and this is all modeled after um
[2:28:38] individuals, and so
[2:28:40] uh really really going to be a neat
[2:28:42] feature. Uh you'll get to see what the
[2:28:44] statue will look like uh for the 4th of
[2:28:47] July. They'll have that. Um
[2:28:49] in the booth. So, encourage people to
[2:28:51] take a look at that. Um
[2:28:55] We've got uh we've had several discussions with
[2:28:59] regarding the
[2:29:01] uh use of the park and and to report
[2:29:05] uh that is is moving forward. More more
[2:29:09] information to come on that, probably
[2:29:11] following following us another report
[2:29:13] after some internal meetings.
[2:29:18] We started uh
[2:29:20] we had our first economic development uh
[2:29:23] meeting. Thanks to all those who were
[2:29:24] involved in that. Um
[2:29:27] and
[2:29:28] pushing that further forward um and
[2:29:31] growing that to try to ensure we're
[2:29:33] supporting
[2:29:34] that we're we're doing a better up you know, we're
[2:29:38] looking for a better opportunity to
[2:29:41] hopefully lower the tax
[2:29:44] taxes that are issued to individuals and
[2:29:46] try to help
[2:29:47] more businesses [snorts] come in and
[2:29:49] help carry some of that burden for our residents. So,
[2:29:54] uh that's encouraging and moving
[2:29:55] forward. So, lots of good stuff.
[2:29:58] >> All right, thanks Jake Dark.
[2:29:59] >> [clears throat]
[2:30:00] >> I don't know how much. Um I did just
[2:30:02] kind of have a question. Um I was at
[2:30:03] Scenic Slopes and it looks great by the
[2:30:06] way. It's amazing, but it's still an
[2:30:08] active construction zone. And so, my
[2:30:10] just my question was I saw about 10 15
[2:30:12] kids
[2:30:14] using that that pump track. And I didn't
[2:30:16] know if we were trying to
[2:30:18] get them off, avoid it, or what what are we on that? I just feel like
[2:30:23] there might be a liability with
[2:30:25] >> You think? Yeah.
[2:30:26] >> [laughter]
[2:30:27] >> It's real popular already and has been
[2:30:29] discussed
[2:30:30] multiple times in the Scenic Slopes park
[2:30:33] and our meetings. Um
[2:30:36] It's there.
[2:30:38] It yes.
[2:30:40] >> But it it has a fence around it right
[2:30:41] now, but
[2:30:42] the liability is on the
[2:30:46] contractor cuz we have instructed him to
[2:30:49] fence it up or put a barricade or some
[2:30:52] sort of
[2:30:53] blockage there, but he's again hasn't
[2:30:56] done that. We can The council really
[2:30:58] wants us to get him to put in the fence.
[2:31:00] That might cost more money to do it
[2:31:01] around the entire park.
[2:31:03] Or you do enforcement, but then how do
[2:31:05] you enforce that 24/7?
[2:31:09] » I mean it's great it's being used, but I
[2:31:11] saw it and I was just like
[2:31:12] >> I don't disagree. I don't know about
[2:31:14] that.
[2:31:14] >> [laughter]
[2:31:14] >> I've been there twice and the two times
[2:31:16] I've been there
[2:31:17] 20 individuals and I I say guys you're
[2:31:19] not supposed to be out here.
[2:31:21] You know, and it's and they're just
[2:31:24] I mean
[2:31:25] don't go home and look at your tablets,
[2:31:27] right? Like
[2:31:28] >> [laughter]
[2:31:29] >> You're out here You're out here using
[2:31:30] something that we, you know, we're
[2:31:32] building.
[2:31:33] I I appreciate you brought it up. So, I'd
[2:31:36] just say concern.
[2:31:38] >> I can look into it. So, I wasn't super
[2:31:39] good at the contract.
[2:31:40] >> Can we just reiterate it again and get
[2:31:42] it on the record that we have concern there.
[2:31:45] >> I mean, it's it's encouraging to see all
[2:31:47] those kids there. It's going to get
[2:31:48] used. So, it'd be nice if we could just
[2:31:50] get get that area finished and so
[2:31:54] That's all.
[2:31:54] >> It is looking good that way. It's
[2:31:55] looking good. It's amazing.
[2:31:59] » Great.
[2:31:59] >> Not much on my mind. We did Tula County
[2:32:01] Board of Health in there last month and
[2:32:03] went over, which was fun. We all drove
[2:32:04] out there.
[2:32:05] Well, Eric Stromberg flew out there, but
[2:32:08] >> [laughter]
[2:32:08] >> So, it was fun. It was fun to go out to
[2:32:09] Wendover. Um
[2:32:11] and the Tula County Board of Health has
[2:32:13] they I From what I've learned, they have
[2:32:15] a lot of resources. Like, they have a
[2:32:16] dentist office there that I didn't know.
[2:32:18] People so, I don't know if the citizens
[2:32:19] of Grantsville know, you can go get
[2:32:20] low-cost I don't know all what they
[2:32:22] have, but they actually have a dentist
[2:32:23] office at the Board of Health. So,
[2:32:26] that was interesting. They just talked a
[2:32:27] little bit about the measles, how
[2:32:29] they're containing that and things like
[2:32:31] that. Um
[2:32:32] They're getting ready to do their big
[2:32:34] assessment. The the Board of Health is
[2:32:35] now doing their data gathering. We also
[2:32:37] joined a Utah Well-Being Project. They
[2:32:39] were kind of pushing us to do that,
[2:32:40] which sounds like Grantsville did great.
[2:32:42] I haven't got the the data all back on
[2:32:44] that yet, but um
[2:32:46] We put that We put that out very quickly
[2:32:47] cuz they were wanting us to do that, but
[2:32:48] it sounds like overall it was positive.
[2:32:50] We got a good response from the citizens. So,
[2:32:53] I think we'll meet again next month and
[2:32:55] get an update.
[2:32:56] >> Great.
[2:32:57] Jeff.
[2:32:58] >> Um I did I mean, the mosquito abatement
[2:33:01] board is such a small thing, but they
[2:33:03] did spray for our rodeo, I think. And
[2:33:05] for that, they I don't know if you guys
[2:33:08] know, but they do spray our parks
[2:33:11] prior to our fourth activities. So, that
[2:33:14] is um
[2:33:15] they know our dates that we begin
[2:33:17] and they will spray accordingly the
[2:33:19] parks a week before that. So,
[2:33:22] I The football team thanks you, by the
[2:33:24] way.
[2:33:25] >> Yeah.
[2:33:26] >> [laughter]
[2:33:26] >> They're pretty much
[2:33:29] do what we
[2:33:30] I didn't say that right. They're very
[2:33:33] If we ask them to spray an area, they'll
[2:33:35] spray an area. So, if anyone just text
[2:33:37] me, call me if you if there's a
[2:33:40] mosquito or some kind of problem,
[2:33:43] the gnats are gone, obviously.
[2:33:46] But, they do take care of us and they
[2:33:49] know our dates, so
[2:33:51] that's a it is a kind of a small benefit
[2:33:55] to to Grantsville City.
[2:33:57] The irrigation, we need to be there
[2:34:00] on the water.
[2:34:02] I'm aware of a few outstanding problems
[2:34:05] we have there.
[2:34:07] But, we'll address them as we have a
[2:34:11] resolution, so
[2:34:12] I'm happy to be a part of that, too. So,
[2:34:15] they're a humble group of guys. They
[2:34:18] pray for it to rain, so
[2:34:20] >> [laughter]
[2:34:21] >> So, it's good.
[2:34:23] >> All right. Did Brett didn't ever join,
[2:34:25] correct? Okay.
[2:34:26] >> Not that I can tell. I mean, unless he's
[2:34:28] on an iPhone, but
[2:34:30] >> Okay. That's okay.
[2:34:33] I guess the biggest council report is
[2:34:35] gearing up for the 4th of July.
[2:34:37] Um we will send out sign-up sheets in
[2:34:40] the next uh
[2:34:42] hopefully tomorrow. Can we do that
[2:34:44] tomorrow, Alicia? Send out some sign-ups
[2:34:46] for
[2:34:47] um hot dog cooking. So, get ready to eat
[2:34:51] hot dogs for 9 straight days.
[2:34:54] You're
[2:34:55] >> [laughter]
[2:34:56] >> I did verify just so you guys are aware,
[2:34:57] I did verify it is one person has to
[2:35:00] have their food handler's permit per
[2:35:03] station. Per group. Yeah, per group. So,
[2:35:07] Jake
[2:35:08] >> That's all I got of it last [laughter]
[2:35:09] year, but this year I
[2:35:10] know I might as well know what the cool
[2:35:15] food at what temperature and how ice
[2:35:17] baths stuff. It was great.
[2:35:18] >> [laughter]
[2:35:20] >> So, it sounds like it's really
[2:35:21] enjoyable. If you haven't done your food
[2:35:23] handler's permit, um if you could get
[2:35:25] that done, that would be wonderful.
[2:35:27] And
[2:35:28] >> Will you remind us where we go to do
[2:35:29] that?
[2:35:30] >> The food handler's permit? I can resend
[2:35:32] the link to you.
[2:35:32] >> Well, yeah. Thanks. Sorry.
[2:35:33] >> That's okay.
[2:35:38] >> version is
[2:35:40] I don't know if there's a live version,
[2:35:41] but I I can't imagine being any better
[2:35:43] than the online version.
[2:35:44] >> It [laughter] sounds exciting.
[2:35:47] Yes, the the activities that we have
[2:35:51] will be
[2:35:52] um lots of fun.
[2:35:54] Lots of people. I appreciate all the
[2:35:56] people that are willing to make those
[2:35:58] things happen, especially our public
[2:35:59] works department in moving all the
[2:36:02] equipment back and forth all week long.
[2:36:04] It's a big job, and we appreciate that.
[2:36:06] So, um as
[2:36:10] I had some other things, but I'll just
[2:36:12] address those with you later because
[2:36:14] it's getting late.
[2:36:16] Um thank you, everyone, for for your um
[2:36:20] participation. Thank you for being here
[2:36:22] tonight. And just a reminder that there
[2:36:24] will be not be a council meeting on July
[2:36:26] 1st because the council will be cooking
[2:36:29] hot dogs. So,
[2:36:31] um we will meet again on the third
[2:36:34] Wednesday of July.
[2:36:36] And
[2:36:38] I think that's everything.
[2:36:40] Um Michael, do you have anything you
[2:36:42] need to add tonight?
[2:36:43] >> No, thank you, Kelly. Most of the stuff
[2:36:45] I had
[2:36:45] >> Okay. Um Tyson, Alicia, anybody else on
[2:36:48] the city staff? Bill, Aspen, Christie?
[2:36:51] Anything else that needs to be
[2:36:52] addressed? Please. Thank you.
[2:36:54] >> thank you on behalf of the tier two
[2:36:55] employees for that contribution. I think
[2:36:59] we have 11
[2:37:00] um officers, and the Tier two is uh July
[2:37:04] 1st, 2020, 11. After that date is when
[2:37:07] they are certified, and they also have
[2:37:10] to work 25 years instead of
[2:37:13] and less retirement. And some cities are
[2:37:15] like picking up a little bit more 401k
[2:37:17] and stuff to offset it. So, it is like
[2:37:20] apples to apples, it's hard to compare,
[2:37:22] but they will appreciate it, and I do as
[2:37:24] well.
[2:37:24] >> Thank you. Thank you. Thank you for all
[2:37:26] you guys do.
[2:37:27] >> All right, we just need a motion to
[2:37:29] adjourn.
[2:37:31] >> I hear I make a motion we adjourn.
[2:37:33] >> I second the motion.
[2:37:34] >> All in favor?
