Let's bring the meeting to order. Let's
[0:10]
do the pledge of

[0:19]
to the flag of the United States of
America and to the republic for it
[0:24]
stands one nation under God indivisible

[0:38]

[0:48]
» Everybody a motion to approve June
meeting minutes.
[0:54]
» July
>> July
[0:56]
» or July, I'm sorry. July.
[clears throat] I make a motion to
[1:00]
approve them.
>> I'll second it.
[1:03]
» All in favor?
>> Yes.
[1:06]
» Yes. It's approved unanimously.
[1:12]
» A motion to approve any and all invoices
received by township treasur for the
[1:17]
month of July
2026.
[1:23]
» Is there a motion for that?
>> I'll make a motion.
[1:25]
» Is there a second?
>> I'll second it.
[1:28]
» All in favor?
>> Yes. Yes.
[1:34]
» I'm not going to agree. something I
can't see.
[1:38]
» Okay. Well, it's approved.
[1:48]
» Old business grant update. Say it pen
and harshman.
[1:54]
» You want us
speaking on that?
[1:58]
» I've been working on grants again.
And this is the young lady from
[2:04]
Hartsman's group.
and she's been trying pretty hard. We
[2:08]
got a grant going in for My Fire's
Bridge. Uh there was a fire back here
[2:14]
over the winter time, I believe it was.
And the fire department said that they
[2:20]
didn't trust the bridge with their fire
trucks going across it. So, we have
[2:25]
looking at it. We're applying for a
grant to get that bridge replaced or
[2:31]
repaired or whatever it may need.
I also been talking to Fate Pen, which
[2:36]
is another grant writer, because I feel
as many grants as I can get for our
[2:41]
township is what my job was to do when I
come here. So, I'm talking to them. I'm
[2:47]
going to continue pushing over here. We
are trying to find some money to build a
[2:52]
salt shed. We really need to get the
salt out of our building. We got some
[2:56]
roofs that need worked on,
but grants only go so fast. So,
[3:03]
That's about the best I got on that.
>> I think we ought to hire an inspector to
[3:09]
inspect that bridge down there before
there's any money spent for a bridge.
[3:20]
» Yeah, it's off the dark road.
>> We like to call in on the grant
[3:25]
situation. We got to wait till the end.
>> No, you can you can call
[3:29]
[clears throat] back in November when I
was up here and talked to you. After the
[3:33]
first year, you're going to work on
grants for Tailoo. What's up with that?
[3:37]
» I've had the people all over every road
and they tell me the only project that
[3:43]
they got right now that they can help me
with is Myers Bridge.
[3:48]
» And why is that?
>> Because the other one, Taylor Road, is
[3:52]
supposed to be maintenance. They said,
>> "Well, how did they fix all the other
[3:57]
grants for
>> I didn't know they got grants for all?"
[4:01]
» Well, they spent
ungodly weeks and months down there at
[4:08]
Ramat a couple years ago.
>> Oh, yeah. They got that and that put a
[4:13]
big sore thumb in with the conservity.
We were very lucky to get them to come
[4:17]
back and help us with the Beaver Creek
project because they that
[4:23]
» went terribly wrong down there. They
misspent the money. They misdone the
[4:27]
work. They ended up we ended up getting
$110,000 fine on our liquid fuels from
[4:32]
the way they misspent the money. So, the
conservity did not want to come back in
[4:36]
and help us with any roads. This Beaver
Creek project is going to be an
[4:40]
important project. If it goes smoothly,
I think we can get the conservity to
[4:45]
work with us again. If it doesn't go
smoothly and we get people in there
[4:49]
that's trying to tell the conservity
what to do, we're going to be in
[4:53]
trouble. The conservity is the one that
has the money. They're the ones paying
[4:57]
for it. We got to do what they tell us
to do.
[5:01]
I mean, if anybody knows anything about
Ramat and Fire Tower Bridge, they know
[5:08]
for years that that bridge was default.
It's still in default. They're still
[5:12]
being bought for.
[5:16]
» So, in other words, there's no chance of
that.
[5:19]
» I'm not saying there's no chance. I work
every month chasing grants. So, I'm not
[5:25]
saying there's no chance. I I'm on the
road a lot in a month's time for the
[5:30]
township trying to find money for the
township.
[5:36]
I don't know what anybody else is doing,
but I know I do it and I personally do
[5:40]
it. I personally pay for the gas. I
personally pay for the car. I personally
[5:44]
pay for everything. I take nothing to
try to get to the township.
[5:50]
That's all I do.
>> You're still looking for that money
[5:53]
tree,
>> huh?
[5:54]
» You're still looking for that money
tree.
[5:56]
» I'm looking for the money tree.
>> No, it's not out. Well, I guess it could
[6:01]
be out there, but it's not my backyard.
>> Don't mud pipe. [laughter]
[6:07]
» But I am after grants. I do take them up
there because Taylor Hill, there's three
[6:13]
or four hills in my opinion that need
addressed and needs fixed somehow.
[6:17]
» Well, right now our road fixer is
Robson. He bought a piece of equipment.
[6:23]
He runs up and down that hill.
>> It's like, you know,
[6:29]
» like a super highway.
>> Yeah.
[6:32]
» Not so much.
>> He does a good job.
[6:35]
» He's a fanatical.
>> You do a good job, too.
[6:39]
Thank you.
>> You walk the walk. Any other questions
[6:43]
on the grants?
[6:47]
» Beaver Creek project.
It was delayed from Monday to
[6:55]
I think Thursday.
>> Was it
[6:59]
» the 6th or 7th?
>> They didn't know. The bridge crew still
[7:02]
had to get their machines up. So that's
what it was between the bridge crew and
[7:07]
conservity when they were having it
delivered and last time I count.
[7:12]
» Yeah. Bridge. So on the
>> So the county's doing the bridge for
[7:15]
free. They're doing the labor for free.
>> So we've talked the bridge crew in to do
[7:21]
the labor for free. The conservatives
giving us the money. So hopefully this
[7:25]
project goes real smooth. So next time
we need money maybe for Taylor Road or
[7:30]
another road, the conservity will look
at us again and take us seriously.
[7:35]
» So on that project I timed it. I went 35
miles an hour. It takes you an extra
[7:40]
minute and a half to go 30 35 miles an
hour down there. I hope that we tell the
[7:45]
trucks as much as possible, stay in the
middle of that road because we're going
[7:49]
to destroy. There's no burns at all.
There's 6 in of drop off. If my car goes
[7:55]
off and I ruin the hole underneath,
that's how bad that road is right now.
[7:59]
So if these trucks hold out of weights
running the side of the road, you're
[8:04]
going to have another problem fixing the
road. So if we can talk to the trucking
[8:09]
companies to try and go slow, it only
takes an extra couple minutes
[8:14]
and run the middle of the road.
I don't know how many trucks will be
[8:18]
coming in and out right now. I mean, the
bridge is going to be delivered and it
[8:22]
has to be put together.
Then I'm sure after that there'll be
[8:26]
trucks either of stone or concrete or
something, but I don't know.
[8:30]
» Well, what's a triacial haul? 30 ton.
>> That's a lot of weight. When you got a 6
[8:36]
in drop off and you're right along the
edge of the road,
[8:41]
the road's still in decent shape. I hate
to see it.
[8:47]
» I will try to voice an opinion to the
truck driver.
[8:52]
Any other questions on the Beaver Creek
project
[8:57]
torn chipping of roads?
>> Got delayed too.
[9:02]
» That was supposed to start Monday, but
it was supposed to rain all this week. I
[9:05]
think they delayed it also.
>> They got tied up. I like to tell you
[9:11]
county somewhere up there. So, they're
tied up today because of the weather.
[9:18]
Now they're talking possibly Wednesday
or Thursday. I don't It rained again
[9:23]
yesterday and today so
back up any further
[9:31]
» purchaser from Cory Kquet.
>> That was during your special meeting for
[9:37]
the opening of that.
>> Yes.
[9:40]
» Was that last week?
>> Friday.
[9:45]
» It's about time. It's only years later.
[9:56]
» Uh, Bradic, Flat Rock, Clover Top, and
uh,
[10:08]
» you if you want to.
[10:12]
» We can put you on.
[10:17]
New business
>> resolution for Mars
[10:22]
Road bridge. I think we went over that.
>> Is there a motion to approve the
[10:27]
resolution?
[10:34]
» Make a motion.
>> I'll make a motion to approve.
[10:37]
» Is there a second?
>> I'll second.
[10:40]
» All in favor?
>> Yes.
[10:43]
» Yes. It's a grant. I mean, how can you
go wrong?
[10:48]
» It carries.
[10:51]
» Letter from health department violation
smoking
[10:56]
must been made.
[11:04]
2026 FC
ATS Conservation September 10th and 11th
[11:11]
Faget County Fairgrounds.
That's the convention that they have
[11:16]
every year.
[11:26]
A motion to approve
to pay bills and payroll checks as
[11:32]
electronic format versus paper.
>> I'll second.
[11:39]
» Oh, Rob, did you make the motion?
>> Make a motion.
[11:41]
» Okay. Seconded by Larry. All in favor?
>> Yes.
[11:47]
» All that does is just
move this up in the modern times.
[11:52]
Instead of sending out checks by mail,
if we can pay it AC or whatever, we do
[11:58]
it that way. You save whatever a stamp
cost now. Stamp and envel each adds up.
[12:06]
Make a motion to approve
building permit administration fees.
[12:13]
» Yeah. So the the purpose of that is we
already have a building permit fee that
[12:18]
it already exists on the books and um
sometimes there are legal fees questions
[12:24]
about the property building code um or
something that involves my time or Sue's
[12:33]
time um and that's all administrative
work. And so what this would be would be
[12:39]
um uh since we're since Harshman's
already collecting um that permit fee,
[12:46]
we would be collecting a very small um
10%age of that fee. It would come to us
[12:52]
directly. That's it%
>> of the original fee.
[12:55]
» Uhhuh. That's it.
>> So we're not raising this and
[13:02]
at this point we got so many people out
of violation. How do we
[13:06]
tell anybody they have to buy a building
>> because we have a building permit
[13:11]
ordinance already,
>> right? But what do we do with the people
[13:13]
in violation?
>> That's up to the building code inspector
[13:18]
to go out and say you're not in
violation or you are or you're not in
[13:22]
violation.
All this does is help pay for Sue's time
[13:26]
and because the full fee would go to
Harshman. We would we're not collecting
[13:32]
anything from that right now. So they're
only collecting a small portion of that
[13:37]
» and it does not raise any fees to
anybody
[13:41]
» and Harshman's willing to release 10% to
us
[13:48]
» for no for so they're going to take 10%
off what they make
[13:55]
» done with that.
>> Yep. Is there a motion for that?
[14:00]
» I made a motion to approve it. Is there
a second?
[14:05]
» Agree.
>> So Steve seconds it all in favor.
[14:09]
» Yes.
>> Yes.
[14:12]
» It passes.
[14:17]
» Make a motion to approve amendments to
trash ordinance.
[14:23]
» So um I I know we were talking about and
and we're not ready to readvertise this
[14:28]
yet, but I know we were talking about a
couple of different things that we
[14:32]
wouldn't include in it. And I know Rob,
you had a question about um to be able
[14:38]
to
essentially charge some sort of a late
[14:41]
fee and then be able to take them to the
map. And I think looking at other
[14:47]
municipalities that have a trash
ordinance that they actually collect on,
[14:52]
it would be something like if you're
late, it would be $20 for that month
[14:58]
plus an extra 2% on that invoice going
forward. So that's that's pretty
[15:04]
customary because then you actually have
some way of, you know, saying, "Hey,
[15:08]
look, you're you're in acrewing a
penalty here if you're not going to be
[15:12]
paying on time." So that's a pretty
standard rate. And I wanted to see if
[15:15]
that's something that the majority of
the supervisors would would approve for
[15:20]
me to put in there. And then I know that
there were some questions about whether
[15:25]
an apartment building has um multiple
tenants. if a dumpster was sufficient
[15:32]
for the whole building or whether each
individual needed to be paying.
[15:37]
» Each individual needs to be paying.
>> Yes, they do.
[15:40]
» So, I'm I need to get
>> So, each business and resident. So,
[15:44]
you're going to you got to pay for your
business and your residential state.
[15:48]
» Buy,
>> huh? No, you're not combined. Oh, yeah.
[15:50]
» Because an apartment building wouldn't
be on.
[15:53]
» I'm not going to argue with you.
>> Yeah. Because you go to a restaurant or
[15:56]
any kind of food place or any kind of
gas station has dumpsters. So they would
[16:01]
pay for a dumpster fee. You're just
trying to make somebody pay for a
[16:05]
dumpster fee that has an apartment.
>> And you won't want to pay residential
[16:09]
and your business.
>> I don't bring any trash here from my
[16:12]
business. It's it's from my house.
Period.
[16:14]
» You got to have trash from your business
here.
[16:19]
» I I don't agree with that.
>> So I'm I'm trying to get I'm just trying
[16:23]
to consensus on what you guys want to do
about that. I know that has been talked
[16:28]
about previously
um as to what we were doing with it.
[16:32]
Municipalities do it differently. So,
you guys tell me.
[16:35]
» I thought the biggest concern was
somebody I think it was the couple the
[16:40]
supervisor before read in there or
something and everybody was all upset
[16:45]
about that.
>> Well, that's true. That's true. But I
[16:48]
wanted it was it was actually unclear in
the ordinance as to whether a if you
[16:54]
owned an apartment building or you owned
something that was multiple like if you
[16:59]
had some sort of a business that also
had tenants upstairs or something who
[17:03]
had to pay whether it was one account or
was it multiple accounts?
[17:07]
» Multiple accounts. All tenants need to
pay.
[17:10]
» It'd be the same thing with the business
and their
[17:12]
» whatever. But we ain't going to like
your apartment buildings. You're not
[17:16]
going to set a dumpster there and you
collect all the tendants money and you
[17:20]
pay for a dumpster.
>> Same way that like Greg Upole down
[17:23]
there, he can't do it with his apartment
buildings. The same [clears throat]
[17:26]
thing with his plaza. He would have to
pay separately.
[17:28]
» Everybody needs to pay a garbage bill.
>> So, that's what you're saying then,
[17:31]
right?
>> Yep. Every time.
[17:34]
» All right. So, I'm going to present
those changes to you guys for the next
[17:39]
» I don't know if I agree with those
changes. I think the public needs to see
[17:43]
those changes because
like I said, now you're talking you got
[17:47]
all these places that has dumpsters that
can't have dumpsters anymore.
[17:52]
» Okay. [snorts] Well, I got to take
guidance from you guys. So, you tell me
[17:55]
what you want to do.
>> I think the public should have an
[17:59]
opinion on that.
>> What do you people think? All tenants
[18:03]
ought to pay or just one
>> I think everybody should pay.
[18:07]
» Everybody has garbage. Let's face it. Is
this going to make a difference as far
[18:10]
as the dump uh the garbage part of the
business making some money where we can
[18:15]
just hire a crew for garbage and and now
because you guys only work four days.
[18:20]
You got two days in garbage. That's two
days on the roads. And I think our roads
[18:24]
need more than just two days. I mean,
don't you guys agree?
[18:28]
» You're wasting two days on you also got
to put on there, David, if you're doing
[18:32]
that changing the rules, they have to
buy the contracts out of the people's
[18:36]
contracted out.
I have a contract on my dumpster and I
[18:40]
was told to do that by the previous
supervisors.
[18:43]
» Okay.
>> So, I I followed the rules. If we want
[18:46]
to change the rules, the township should
be responsible for buying out the
[18:50]
contract.
>> But you could have a dumpster there and
[18:51]
steal all tendants paying.
>> They just put a garbage in the dumpster,
[18:55]
right?
>> That's what Danny Bird does. Danny Bird
[19:00]
Danny Bird here today.
>> Danny, your tenants pay to put their
[19:04]
garbage in your dumpster, right?
>> Yes, he do.
[19:07]
» Okay. Each account pays the township or
they pay
[19:11]
» each account pays.
>> So do you pay for a dumpster or each
[19:14]
account?
>> I pay for each account.
[19:17]
» I pay for each account.
>> Go ahead, Michelle.
[19:21]
» I just have a question. How do you even
begin to track tenants of apartment
[19:29]
complexes to be able to charge them? And
I'm just thinking like even when you're
[19:34]
thinking per capita tax tenant who lives
in an apartment should pay a per capita
[19:41]
tax, they should pay it. It's for the
privilege of living in Fyet County or in
[19:47]
Uniontown school district. We don't have
one. It's a township. But how do you
[19:51]
even begin to know who all resides where
is the
[19:56]
property owner to furnish the names of
the tenants or the property owner
[20:01]
collecting that? Like Dan just said, I I
was just trying to understand it.
[20:07]
Trash is leanable to the property owner.
Trash is never leanable to the landlord
[20:13]
or
>> to the tenant.
[20:14]
» To the tenant.
>> It's always leanable to the landlord.
[20:18]
Water is always leanable to the property
owner.
[20:22]
Trash, water, and if you got public
sewage, public sewage.
[20:29]
Electric and cable, that's the tenants
problem.
[20:40]
Basically
[20:43]
back out
[20:49]
of the city
[20:55]
wants the
property wants to be responsible for
[21:00]
attendance water bill or sewer bill.
[21:18]
We're going on to the next one.
[21:24]
» Motion to approve to give Keith Myra an
old girl that is in the woods.
[21:30]
[laughter]
[21:34]
The one guy who works here wants an old
barrel that's in the roads. So
[21:39]
we we had problems with stuff coming up
missing. Scrap being taken, this being
[21:44]
taken. Nothing should be taken out of
this township unless all three
[21:48]
supervisors know and on it or anything.
No scrap, no tires, no no nothing.
[21:54]
Nothing should go out of here. If he
wants an old blue barrel that's probably
[21:58]
going to cost us money to get rid of, I
don't have any problems with that. that
[22:01]
I think all three of us should know.
>> I say give it to
[22:08]
» Okay. So, is there a motion to give this
barrel to
[22:12]
» Is it just a 55gallon barrel or what is
it?
[22:16]
» Do you have any idea?
>> It's just a blue plastic
[22:20]
» junk.
I make a motion to give it to I'll
[22:25]
second it.
>> All in favor?
[22:27]
» Yes.
>> Yes.
[22:29]
» No, carries.
Miss Engineer, you get to talk.
[22:33]
» Oh, no.
>> Here's the problem. I'm not an engineer.
[22:38]
[laughter]
>> It's okay then. You're you're redundant,
[22:40]
right?
>> Um I brought this engineers report on
[22:44]
behalf of Jamie. He's on vacation this
week. Much deserved.
[22:48]
» Um
>> I can't truly speak to many of these
[22:52]
items, but um I know like the Beaver
Creek um project was on there and we
[22:56]
received that email update which you all
were aware of. um code enforcement
[23:00]
zoning. Brandy sent an individual update
as well for you all to go through if you
[23:05]
want me to read it aloud. I'm okay.
[laughter]
[23:09]
» Um the multimodal grant which um we are
working on was already you approved the
[23:14]
resolution tonight. That's the grant for
MyersBridge. Um engineer Rich Rick Rich
[23:20]
Rush came out and looked at it and
recommended that was a project that was
[23:24]
most likely to be funded through this
program. Um, so that's the one that we
[23:28]
recommended you go for. Um, I did want
to speak of as the grant writer planner
[23:32]
at Harshman. Um, I know that you all
were uh interested in looking at your
[23:36]
salo and zoning and kind of
comprehensive plan update.
[23:41]
» I didn't
um I did want to bring you all to your
[23:44]
attention. So, I've been talking with
Stephanie at DCED who's in charge of the
[23:48]
MAP program. Um, apparently you have an
outstanding grant for um a MAP program
[23:54]
grant. So, this would be to help with
your zoning and code. Um,
[23:57]
» we've been trying for a couple years to
get that.
[24:00]
» We have an outstanding like we actually
received money.
[24:02]
» No, no, no. The grant is pending. We're
waiting to
[24:05]
» So, we have to wait and see.
>> Yes.
[24:07]
» Okay. The in talking with Stephanie, we
have a pretty good relationship. Um,
[24:11]
unfortunately, because no match was um
provided, she's not very optimistic that
[24:16]
it'll get approved this round, but does
think that it's a very good project that
[24:20]
we should continue pursuing. um
September 1st is the next deadline for
[24:24]
this program and she says that with um
you know with a match commitment that
[24:30]
would be very competitive. The other
option to pursue um funding or in this
[24:36]
case it's technical assistance through
the state to get some of your zoning and
[24:40]
comprehensive plan or uh zoning and
sawdo stuff updated would be through a
[24:44]
technical assistance program where they
actually give you something like 500
[24:49]
free hours to help you work through that
process. It does take some buyin
[24:53]
obviously from the municipality and
ultimately will need um help enlisted
[24:58]
from the solicitor or from your code and
zoning officer to get that over the
[25:01]
finish line. They won't actually write
the code for you. But those are two
[25:05]
really valid programs that the state is
really interested in seeing you put in
[25:09]
an application for or another
application for and kind of pursuing. Um
[25:13]
I have Stephanie at the uh state ready
to talk with you guys if you're
[25:17]
interested in sitting down and kind of
learning about the difference between
[25:19]
the two um and figing out which is the
best option for you guys to um move
[25:25]
forward. There's multiple opportunities
every year for both of these programs.
[25:28]
So, it's not like one and done. Um
there's another opportunity in April if
[25:32]
you want to work with her through the
process a little more in depth.
[25:37]
Um all the inactive and pending projects
I think are pretty much the same. I know
[25:41]
Rich came out and looked at some other
road projects that we're going to
[25:44]
recommend you probably submit to DGBR um
once the Beaver Creek project is over.
[25:50]
And so, um, we kind of have a bunch of
projects on your wish list from, um,
[25:54]
Rich being able to get out here and see.
And, um, we're going to recommend the
[25:59]
best funding source that we believe for
each of those projects as they keep
[26:02]
coming up. And,
>> and the DGL program is one of the
[26:06]
programs for Taylor Road possible if we
can get it to go through. But,
[26:11]
» I was just wondering because it's been
like eight or nine months, I've heard
[26:13]
nothing.
>> Well, we got to make sure that Beaver
[26:17]
Creek goes smooth.
and we can't we can't submit another one
[26:22]
until we've completed this program and
it's just taking quite some time to get
[26:28]
done just is
>> and the DJVR program through the um
[26:34]
county conservation district is a
rolling application. So, um as soon as
[26:38]
Beaver Creek is wrapped up, we can go
ahead and submit the next round. But um
[26:44]
obviously they want to see that we
treated their money well the first time.
[26:50]
So what's important?
>> You already got [clears throat]
[26:54]
all I needed from you.
>> That's it.
[26:57]
» I like to speak out.
>> I have a question.
[27:02]
» Watching the video of the meeting last
week because I couldn't get up there and
[27:06]
there was a I think you said that with
these lawsuits or something going on
[27:10]
that the township is going to have to
start paying for these suits. Is there
[27:14]
going to be any recourse for us to
counter suit if these people lose these
[27:19]
uh lawsuits? I mean, can anybody just
sue the township and then if they lose
[27:22]
say, "Oh, okay. My bad."
>> Well, right now there's only one pending
[27:26]
lawsuit
against the township and it's Steven
[27:30]
Humber versus Henry Township and all the
other cost 30 $50,000. This is still
[27:37]
lawsuit.
>> Where's our reports to go to recoup the
[27:40]
money? If we got to keep spending 50,000
or paying insurance, rates go up to
[27:44]
defend lawsuits.
>> So if if the court believes that the
[27:48]
lawsuit was defeatious or was out lacks
any merit, they could award attorneys
[27:55]
in our favor if we want.
>> But that still doesn't answer my
[28:02]
question. If the township themselves
want to go after
[28:05]
» they're with what a judge says.
>> Okay. So if the judge said no, this is
[28:11]
the way it works in the United States.
Anybody can sue any anything any entity
[28:17]
or whatever at any time. And there is no
unless you have some sort of a contract
[28:22]
or by statute said you can recover
attorney's fees, you can't recover
[28:26]
attorneys.
So all of the money that has been spent
[28:31]
would not be recovered
by law.
[28:35]
» So you can just have are taking it to
>> I I am simply just acting in the role of
[28:43]
a solicitor. The We have an insurance
company that has hired insurance defense
[28:49]
council to defend us, but they have
already spent over $50,000 defending
[28:55]
this suit. And now because of our
policy, that limit has expired. We've
[29:01]
hit the cap. So now the taxpayers will
have to pick up the dime.
[29:06]
Anybody
[29:13]
else to speak out?
>> Yeah, I want to say thanks to J for what
[29:18]
putting the culpr down there going to do
hopefully a good job and really
[29:23]
fantastic.
[29:32]
» That's it.
>> That's it.
[29:34]
» M to adjourn. Motion to
[29:40]
» make
[29:46]
all in favor.
