uh review and consider approval of

residential plat amendments within
Hidden Oak subdivision. And Mike, you

so this is a uh on for a public hearing.

Um although this is an unusual um
formality, an unusual situation, and
[2:19]
I'll kind of go through uh uh what is
happening here. This is what we call
[2:24]
Hidden Oaks pods 17 and 18. That's I
always think it's interesting to realize
[2:29]
that a pod is just an acronism for phase
of development. This is a development
[2:33]
that we are well familiar with as a
city. Um was approved by the city
[2:38]
council uh in early 2018
>> and uh Ivory and Perry Holmes are both
[2:45]
uh development partners within this
project.

This is just the vicinity map within the
city u where this project is located. It
[3:00]
is a larger master development agreement
um within the city. Next slide.

And just looking a little bit closer.
This was the map that was shown on the
[3:17]
um public hearing notice outlining both
these two pods. Pod 171 18. You can see
[3:22]
it crosses Haramman Main Street, part of
it. Uh, pod 17 is on the north side. Pod
[3:28]
18 is on the south side.

So, here here's the background on this
project. Um, the planning commission had
[3:38]
approved preliminary plat uh for these
pods back in June 2022. That approval
[3:44]
letter was attached in your packet for
reference. Uh the master developer,
[3:50]
which is Ivory Homes, after they
acquired um the the rest of the property
[3:55]
in this in this project, appeared before
the city council and petition the
[3:59]
council for an amendment to the Hidden
Oaks master development agreement. Uh
[4:04]
and Brad Mackey from Ivory can um
discuss that in more detail if if the
[4:09]
commission has any questions or anything
maybe that the members of the audience
[4:14]
might want additional information on. So
that amendment was approved.
[4:20]
Ivory Holmes then uh made adjustments to
those preliminary plans that were
[4:26]
previously approved by the planning
commission. Met with our engineering
[4:30]
department. Engineering approved those
plans and then they proceeded to
[4:36]
construct those plans. Again, all with
city engineering approval uh complying
[4:42]
with the terms of the MDA and our city
standards.
[4:46]
Um, and I just put down Brad as an
estimate. Essentially, Ivory is now
[4:52]
completed with those construction plans.
And in order to start selling uh lots
[4:59]
within these phases, they now need to
record the final plat. Unfortunately,
[5:06]
with all of these changes and the
timeline of doing development, that
[5:11]
planning planning commission preliminary
approval had expired and there wasn't a
[5:17]
an extension requested. Uh, which really
is a formality and we I don't think I
[5:24]
ever recall the city ever denying a
request for an extension. Um, but that
[5:29]
just didn't occur. Now, in discussing
what to do about this situation,
[5:35]
subdivisions built
built with city review and approval, but
[5:40]
the planning commission approval had
expired. Commission is is obligated by
[5:46]
city code to sign the plat. And so, it
was my recommendation that we simply
[5:52]
have the applicant reappear before the
planning commission and and renew
[5:58]
essentially your prior approval. Now,
there have been a few minor changes to
[6:02]
the pods again based on what was
approved by the city council in the MDA.
[6:08]
Um, so as we do require a public hearing
for preliminary plats in the city, uh,
[6:15]
we did send out that notice. I did
receive one public comment um, over the
[6:21]
phone and it is from, uh, Mr. and Mrs.
Doxy who own property adjacent to this
[6:26]
prop um, to this development. And I'll
show you in this um the next slide,
[6:31]
Mitch.
Um they are had negotiated an agreement
[6:37]
with Ivory to secure a private easement
through lot 1719 here in phase se um pod
[6:45]
17 phase one for a sewer um line
easement. Uh I was told that it's along
[6:52]
the east property line of 1719. And I
apologize, this is the exhibit that went
[6:57]
out in your packet, but the city does
currently have in its in its um we have
[7:04]
right now here in city hall the final
plat with the easement. It's a 10 foot
[7:09]
wide easement um in favor of the doxies
uh that runs north and south. Um I'm
[7:16]
I've been told by Ivory that the uh
sewer line stub has been brought to the
[7:21]
property line. There's no um pipe or
anything in that in that uh easement
[7:27]
currently. That'll be the responsibility
of the private party to construct that.
[7:31]
But they have facilitated that that
could be an outfall for sewer uh if and
[7:37]
when the doxies ever choose to pursue
additional development where they would
[7:40]
need a a sewer outfall. Um so that was
the one comment that I had received. Uh
[7:46]
I had contacted Ivory and just verified
that that was still
[7:51]
their intent and again we verified that
that is on the final myar that the city
[7:57]
is holding uh pending the planning
commission review. The next slide is
[8:02]
just pod 18. Again this is u was placed
in your packet. U and then the next
[8:09]
slide is our recommendations.
These recommendations are the same that
[8:14]
were published in the report except for
number three. This is kind of belt and
[8:18]
suspenders. Again, this has been
verified by the applicant. Um, and we we
[8:23]
verified again on the on the myar, but
uh just just to put it on the record
[8:28]
that as a condition of approval that the
final plat um includes a 10- foot wide
[8:33]
private easement along the east property
line of lot 1719 in pod 17 phase one for
[8:39]
that future sewer connection.

weird one because we went through so
many hearings and meetings and

everything along the way and I guess um
this was just missed along the way. So,

um, unfortunate, but it's built and and
it's good. And Adam was asking me
[9:16]
earlier if we were doing any halfacre
lots, and I forgot both of these phases
[9:22]
have halfacre lots. So, um, pod 18 is
all halfacre lots. It's probably the
[9:30]
coolest piece of property, um, that we
have in the south south end of the
[9:38]
valley. I think it's pretty cool. If you
drive up there, the views are
[9:42]
unbelievable. Um, and then Pod 17 also
um has some halfacre lots as well. And
[9:49]
and the views down that little valley
are unbelievable. So, it's a great it's
[9:55]
a great project. Beautiful piece of
land, and we're excited to start
[9:59]
selling. So, if there's any questions
