[0:13]
I'd like to call our work meeting to
[0:14]
order for the Upper City
[0:16]
Planning Commission and
[0:18]
meeting of May 14th, 2026.
[0:22]
So, first couple items, could I get a
[0:25]
volunteer for
[0:27]
the pledge also to pray? I'll do it.
[0:35]
And then as just for you guys know,
[0:37]
those two conditional use permits, they
[0:39]
fall under the new ordinance and they
[0:42]
both elected to withdraw and just go
[0:44]
through that
[0:46]
allowed use process. So,
[0:49]
it's functioning as
[0:51]
designed.
[0:53]
So, we won't do anything with that.
[0:56]
And then
[0:59]
I read through the minutes. I did not
[1:00]
see anything that needed to be
[1:03]
discussed. Anybody else? They looked
[1:05]
fine to me.
[1:12]
And then any questions about the hobby
[1:16]
kennel as you looked over the new
[1:19]
application with the site plan and the
[1:22]
additionals of where the kennels are
[1:24]
going to be placed?
[1:35]
I listened to the City Council and they
[1:37]
did reference the
[1:39]
state code of 18
[1:42]
2101-1
[1:44]
of saying you can't discriminate based
[1:46]
off of
[1:48]
breed of dog. So, I
[1:51]
the condition, I know that was a concern
[1:54]
of a lot of the people that we had. So,
[1:57]
we can just maybe communicate that
[2:00]
to them as they
[2:02]
so they know what basis why why we're making that
[2:06]
decision and considering that if we
[2:11]
So so with conditional use permits, can
[2:13]
you if something were crazy to happen,
[2:15]
can you revoke the conditional use
[2:17]
permit whenever you want?
[2:19]
Um it would have to be a condition. So I
[2:21]
was kind of looking at that.
[2:24]
You'd have to put that as a condition
[2:25]
and say
[2:27]
they get out all the time or something
[2:29]
if
[2:30]
I don't know three
[2:32]
verified call-ins for noise for
[2:35]
regarding the dogs happen
[2:37]
then that's it can be brought back to
[2:40]
the planning commission to review the
[2:42]
conditional use to add
[2:44]
additional additional conditions.
[2:48]
So that could potentially be a
[2:50]
Yeah.
[2:52]
So the
[2:53]
main concerns from the meeting last time
[2:56]
were noise, odor and waste,
[3:00]
dogs escaping and safety,
[3:03]
potential breeding, and then the lack of
[3:06]
site plan,
[3:08]
which they provided in this one. Yeah.
[3:11]
And then
[3:12]
there was concern about the breed, but
[3:14]
that one's kind of null to me because
[3:16]
the the code or whatever.
[3:19]
Um
[3:20]
But yeah, sorry, I want to answer your
[3:21]
question. You can revoke. Okay.
[3:24]
But you have to But that's one of our
[3:25]
conditions up front. We need to set the
[3:27]
commission the conditions now. Yeah, so
[3:29]
if they're not following the conditions,
[3:31]
it can be revoked.
[3:33]
So I have a question as far as since we
[3:34]
can't [clears throat] discriminate
[3:35]
against the breed, is that something we
[3:36]
want to take off that application?
[3:39]
So it's not even a
[3:40]
question in the
[3:41]
Yeah, it's on that application.
[3:44]
Mhm.
[3:45]
Yeah, probably be good practice. I don't
[3:47]
know why it would be relevant.
[3:50]
But, know. What Darren, any comment on
[3:51]
that?
[3:53]
No, we I mean just
[3:55]
Yeah, we just can't discriminate when it
[3:57]
comes to granting a I guess it can be on
[3:59]
the
[4:00]
But, does it say it on the application
[4:01]
specifically ask for breed? Yeah, it
[4:03]
says how many dogs and types of dogs
[4:05]
that will be housed on the property.
[4:08]
Yeah.
[4:11]
Remind me, does anyone What When does it
[4:13]
turn into a non-hobby? Is it at the
[4:15]
amount of dogs or if they have a
[4:16]
business license that acts as a
[4:17]
business? Amount of dogs. Amount. Amount
[4:20]
of dogs and then also with hobby you
[4:21]
can't you can't you can't be breeding
[4:24]
stuff like that, right? So, kind of
[4:25]
both, but
[4:26]
There was a
[4:28]
email that was sent in that
[4:29]
>> [clears throat]
[4:30]
>> discussed
[4:32]
the potential of the potential of
[4:33]
business type activities.
[4:38]
Also, during the
[4:39]
city council work meeting
[4:42]
um David
[4:44]
brought up a I thought brought up a fair
[4:46]
point to be discussed here is
[4:49]
where do you like we allow farmers to
[4:51]
have hobby calves and we don't
[4:55]
doesn't kick over into the
[4:57]
commercialized Yeah. So, where where are we drawing the line?
[5:01]
>> wouldn't that fall under agriculture?
[5:03]
It's only domestic animals.
[5:08]
I think that goes into the
[5:09]
reasonableness of the conditions.
[5:12]
So,
[5:14]
just the worry is that we put our city
[5:15]
at
[5:17]
we got some liability if they're
[5:18]
unreasonable.
[5:20]
And we have to take into account where
[5:21]
we
[5:22]
what kind of city we have and like
[5:25]
how far away they are from the school
[5:27]
and those kind of things.
[5:32]
Yeah, so when it talks about that
[5:34]
reasonable conditions
[5:36]
I mean like having two fences or three
[5:39]
fences like that's unreasonable in my
[5:41]
mind, right?
[5:43]
As far as not letting escape.
[5:46]
I would I would worry about that being
[5:48]
unreasonable. Well, if I allow
[5:50]
Right now, the fence is 6 ft. What if
[5:52]
it's has to be 8?
[5:55]
I think that would be reasonable
[5:58]
or unreasonable? I think it would be
[5:59]
unreasonable. Because they already have
[6:01]
a fence? Well, cuz 6 ft, that would be
[6:03]
pretty
[6:04]
That's like a typical standard.
[6:05]
>> That's a typical standard.
[6:08]
Also, are you discriminating based on
[6:09]
the breed of the dog? If someone wanted
[6:11]
12 Yeah. French bulldogs, are you going
[6:13]
to make them jump to an 8-ft fence
[6:15]
because of the red line?
[6:16]
Or is it because of the discrimination
[6:17]
because of the breed, which we're not
[6:19]
allowed to do? I think we would be
[6:20]
tipping into that area of unreasonable.
[6:22]
I mean, it's arguable.
[6:25]
But I just didn't say anything.
[6:28]
Potentially.
[6:29]
>> Yeah. In my mind, I think conditions you
[6:30]
place are
[6:32]
Yeah, if you like if they get out
[6:33]
repeatedly, if they're the noise or the
[6:35]
stench and
[6:37]
stuff like that. But also, if they if
[6:38]
there is evidence of it this is now
[6:40]
business, they're breeding, they're
[6:41]
boarding.
[6:43]
Stuff like that. Those are kind of my
[6:44]
mind.
[6:45]
The conditions you place on them. They
[6:47]
talked about
[6:48]
the first time how they're going to put
[6:51]
them outside every once in a while. Mhm.
[6:53]
So, is it unreasonable to say they have
[6:55]
to be leashed from the house to the
[6:58]
kennel?
[7:01]
I feel like if their backyard was
[7:03]
fenced, I feel like that would be an
[7:05]
unreasonable ask. Okay. All right. That
[7:08]
That's just So, what I was thinking cuz
[7:11]
I was thinking a lot about this. I
[7:14]
And how close is the
[7:16]
>> How close is the I mean, I'm maybe a
[7:18]
little too much is what I'm saying.
[7:21]
How close is the next building? Is the
[7:23]
next residence? It's an acre lot, and so
[7:25]
there's a They They have neighbors next
[7:28]
door. But how far are we from We're
[7:29]
probably 50 ft tops. 50 ft? Yeah,
[7:32]
they're 100 It looks like they're 100-ft
[7:33]
frontages down there at Well, on the
[7:35]
farm If you look at the house to the
[7:37]
west,
[7:39]
they're not that far apart.
[7:43]
I think those lots are a little deeper
[7:45]
>> [snorts]
[7:45]
>> and a little less wide. Were they Did
[7:48]
they come in with concerns, the
[7:49]
neighbors?
[7:50]
Yes.
[7:51]
>> the neighbors concerned Well, one of the
[7:52]
neighbors is scared of dogs and she
[7:56]
made sure that everybody knew she didn't
[7:58]
want her calves or baby calves near her.
[8:00]
>> Yeah, I heard.
[8:02]
Well, the the other lady that emailed
[8:04]
me, I talked to her on the phone.
[8:06]
She lives right next door.
[8:09]
Her mom
[8:10]
>> does.
[8:11]
And her house is like two or three down.
[8:14]
They're on 46, right? Yeah. Yeah. Pretty
[8:17]
far west, 60
[8:18]
>> 65 59
[8:20]
So, they're
[8:22]
60
[8:25]
65 59
[8:28]
So, that They're right there. Yeah,
[8:29]
they're right there.
[8:32]
So, they're they're one acre lots.
[8:34]
They're lots. But, they're deep, they're
[8:35]
deep and wide. Okay. It's actually 1.7,
[8:38]
but they're deep and they're wide. So,
[8:40]
they're all wide. I got
[8:41]
So,
[8:42]
concerned about noise, I think would be
[8:45]
That's it. But, I do like on their site
[8:47]
plan it shows that they didn't put it,
[8:48]
you know, on the fence next to the
[8:49]
neighbor's house. They put it more in
[8:50]
the middle. Yeah. On the back. Okay. And
[8:54]
also, don't they have to get it approved
[8:56]
through the neighbor county? At the 65
[8:59]
59 So, we could do that as a condition
[9:01]
that
[9:03]
as long as it's approved through them,
[9:04]
too. So, they Well, so So, They're the
[9:07]
yard's fenced in the back pasture.
[9:09]
>> to find that. I didn't find it anywhere
[9:11]
where they I couldn't find it.
[9:12]
>> Well, I I just
[9:14]
I typed in Hooper Animal Control.
[9:15]
>> So, they said that the back pasture
[9:17]
animal control and under their hobby
[9:19]
kennel it's like be inspected annually,
[9:21]
but nobody at Weber County knows
[9:23]
anything about that. So, there's
[9:24]
nothing's going to happen through the
[9:25]
county.
[9:27]
And being a commission They what? They
[9:29]
just had a nasty turnover. I know that's
[9:31]
weird. I know. I know.
[9:35]
What were you saying, Chase?
[9:37]
The animal shelter had a pretty large
[9:40]
turnover
[9:42]
listening to one of the debates.
[9:44]
Oh, really? Yeah.
[9:52]
Anyways, so I noise obviously these dogs
[9:58]
can be loud, but I feel like bark
[10:00]
collars are sufficient.
[10:03]
Well, that was what they were going to
[10:04]
do bark collars. They said they were
[10:06]
going to do bark collars on them. So, I
[10:08]
felt like that mitigated that one
[10:11]
noise. They volunteered to do that?
[10:14]
>> Yeah. Yeah. Yeah. And as a condition. I
[10:17]
think they already are doing it anyway.
[10:18]
Yeah, they in their application. And when they we
[10:21]
asked them questions, they like, oh,
[10:23]
they have bark bark bark collars and
[10:24]
they have
[10:26]
So, then that would probably be a
[10:27]
condition that we they're going to
[10:29]
volunteer that. Yeah. Yeah, there is a
[10:30]
line on the application that says how
[10:32]
will noise / barking be kept under
[10:34]
control when they say bark collars and
[10:36]
training. Yeah, we'll have to put it on
[10:38]
the record that that is the condition.
[10:42]
The odor and waste they proposed a plan
[10:44]
to sanitize Every day, wasn't it? They
[10:47]
were going to spray
[10:48]
>> Yeah.
[10:49]
>> every day with some
[10:51]
I can't remember if it how frequently
[10:53]
they stated, but it was I know that
[10:57]
the permit for a hobby kennel says 4 to
[10:59]
10, but can we mitigate what 4 to 10
[11:02]
means? Can we say five?
[11:04]
Or Is that just open? The code is 10 is
[11:08]
4 to 10.
[11:08]
>> 10. So.
[11:10]
they can have up to 10. They can
[11:12]
have up to 10. Yeah, how will noise It
[11:14]
says right here, bark collars and
[11:15]
training. Potty area will be regularly
[11:17]
cleaned and sprayed down with cleaner.
[11:19]
So, do we Yeah, so you probably want to
[11:20]
define regularly
[11:22]
in the in the record.
[11:24]
Now, she says five German Shepherds and
[11:27]
Malinois.
[11:30]
So, one that I've seen with these types
[11:32]
of things is a curfew.
[11:35]
The dogs are in by 10, which is normal
[11:38]
curfew hours.
[11:40]
But,
[11:40]
it seems like they're taking care of the
[11:43]
they're volunteering to do the dog the
[11:44]
bark collar, then that's Yes, I I mean,
[11:46]
I give them credit for applying. And the
[11:49]
fact that you can legally have three
[11:50]
now. So, like when we're talking noise,
[11:52]
what's the difference between three and
[11:53]
five? I mean, three and 10 obviously a
[11:55]
big difference, but
[11:58]
the fact that they're applying tells me
[12:00]
that they're serious about what they do, for a website, what they
[12:03]
train. My concern is, okay, is this a
[12:06]
raw is this going to
[12:09]
And you can't hold somebody accountable
[12:10]
for something that may happen in the
[12:12]
future, but is this going to be a
[12:13]
revolving door of dogs? Are we going to
[12:15]
have five here at a time, but
[12:17]
do we necessarily own these dogs? Are
[12:18]
these dogs we're working with and we're
[12:20]
just going to keep rotating dogs
[12:21]
through? They're all the training ones
[12:23]
that are in training.
[12:24]
>> Yeah.
[12:26]
So, how do you differentiate that
[12:27]
between the horse trainer that rotates
[12:29]
through?
[12:30]
Six horses at his property and they're
[12:32]
not all his, but he's training them to
[12:34]
rope cuz that happens Oh, yeah, all the
[12:36]
time.
[12:38]
Yeah, I don't think they if it's a
[12:39]
requirement
[12:41]
What's that?
[12:41]
>> need to be owned by the owner. As long
[12:43]
as they're not doing it as a business,
[12:45]
cuz a hobby kennel can't be run running
[12:47]
it like a training business out of the
[12:48]
home. Correct.
[12:53]
I mean, we could we could require
[12:54]
they're licensed to correct.
[12:56]
So, they're not getting any sort of
[12:58]
business license with this. No, they
[12:59]
didn't.
[13:00]
Quote unquote, I think that they said
[13:02]
that they were personal dogs.
[13:04]
>> Yeah, for that they use for sport.
[13:06]
They're sport dogs. Yeah.
[13:09]
You see it?
[13:12]
Sammy and Katie.
[13:14]
He's too fast and furious.
[13:18]
So, he can't have a hobby
[13:20]
>> [laughter]
[13:21]
>> Okay.
[13:23]
Four to 10. Got him. Four to 10 of them
[13:24]
are not in training for what was the
[13:26]
breeding and training and
[13:28]
Personal enjoyment. Okay.
[13:30]
Then there it is.
[13:31]
Can't be for business.
[13:33]
So, that would I think mitigate that a
[13:34]
little bit cuz if you're doing a
[13:36]
training, it's probably for business.
[13:38]
Well, and that's the I I think down the
[13:39]
road if they ever violated then you can
[13:41]
revoke the conditional use permit.
[13:43]
>> Well, if they're doing business without
[13:44]
a license, we can charge criminal and all sorts of civil. What if
[13:49]
they have a business license and then
[13:51]
does that disqualify them for the
[13:53]
conditional use of the farming and hobby
[13:54]
farm? I don't know if they need to have
[13:56]
different. They would have to be
[13:57]
differentiated.
[13:58]
So, the business would be for
[14:02]
So, they would have to apply for a
[14:03]
commercial kennel. Yeah. Which is still
[14:06]
an R1 allowed
[14:07]
>> well, that's one of the one of the
[14:09]
residents that reached out to us, that
[14:12]
was her concern is she was talking to them after the
[14:15]
meeting and they're looking at the
[14:17]
ground behind them that's like 3 acres
[14:19]
and that would
[14:21]
make it so they can apply for a
[14:22]
commercial license.
[14:25]
Can you scroll up a little bit,
[14:27]
so we can see the commercial
[14:38]
So, commercial has to be
[14:39]
>> So, if located 3 acres, so it's located
[14:42]
in residential.
[14:44]
So, it sounds like their goal is to
[14:45]
maybe get to a commercial if they end up
[14:47]
buying that land. Which our code Yeah.
[14:49]
allows it our code allows it in some
[14:50]
Yeah.
[14:52]
But until then So, do
[14:54]
putting something do we need to put
[14:56]
something in the motion as the business license as
[15:03]
commercial activity as a condition or is
[15:05]
that already spelled out in the charter
[15:07]
there? Okay.
[15:09]
We just got to make sure that
[15:12]
the Coys don't sell them any more
[15:14]
ground.
[15:17]
So, that's where they get their fence
[15:18]
>> Can we can we ask
[15:21]
Yeah. So, it where that property's fully
[15:23]
fenced and and gated like,
[15:25]
you know, and I know we don't
[15:26]
discriminate against breeds, but there
[15:27]
is a difference between these dogs.
[15:29]
They're They're for what they're
[15:30]
sporting. Yeah. Can Can we ask that the
[15:33]
gates be locked?
[15:35]
The The gates leading from the yard to
[15:38]
the front yard.
[15:39]
Cuz I I can't imagine a little kid wanting to
[15:42]
pet the doggies
[15:44]
and going through one of those gates.
[15:47]
Wait.
[15:48]
I think Is that a reasonable I think
[15:49]
that's reasonable.
[15:50]
>> It's not because you could be You could
[15:51]
have that same worry for any dog.
[15:53]
>> Yeah. Yeah.
[15:54]
Don't they have Yeah, do we We require
[15:56]
that for a swimming pool, don't we?
[15:59]
Yeah, they have those self-locking
[16:00]
gates, or at least, you know, the ones
[16:01]
that latch
[16:02]
>> latch or yourself latching gate on
[16:04]
swimming pools.
[16:06]
They don't open by accident. They can't
[16:09]
They don't necessarily have to be
[16:09]
locked, so. But we don't need to specify
[16:11]
on the record that it's because of the
[16:13]
type of dog.
[16:13]
>> No, we just we just want the gates
[16:15]
locked if we're going to have that many
[16:17]
animals on the property.
[16:18]
>> Dude, well, and and
[16:20]
with the
[16:21]
caveat that
[16:23]
we just don't want
[16:25]
kids or somebody else trying to come
[16:27]
into your yard. We're trying to protect
[16:29]
you
[16:30]
as well as everybody else.
[16:32]
Yeah.
[16:42]
I don't know if I'm the only one that's
[16:43]
lost sleep over this one. This is
[16:45]
different.
[16:46]
Yeah.
[16:49]
I'm not sure. They're with the
[16:51]
drug and alcohol treatment center.
[16:59]
So, I think all of those Those are the
[17:02]
main concerns.
[17:04]
So, I don't see how any of those aren't
[17:09]
mitigated with a motion that includes
[17:11]
[clears throat] what either they already
[17:13]
offered to do with the bark bark
[17:14]
collars, and then the
[17:17]
just needed to define what they view as
[17:19]
regularly on the odor and waste. But we
[17:21]
can reiterate that in our motion for
[17:24]
collars. Yeah.
[17:25]
The cleanliness. Lock gates. Lock gates.
[17:28]
And I think the lock gates kind of dogs
[17:31]
escaping safety issue, that's a
[17:33]
condition I think that's reasonable
[17:35]
there. And then
[17:38]
I think mentioning to them that
[17:40]
commercial activity would fall under a
[17:41]
different use, so they're aware of that.
[17:44]
Yep.
[17:45]
And just have a code slate and then
[17:46]
other than that the site plan to me
[17:48]
looked
[17:50]
if they follow that, I think it's
[17:52]
Is that Is that an in-ground pool? It
[17:55]
is, isn't it? Yeah.
[17:57]
I believe so.
[17:58]
That's interesting. I looked it up on
[17:59]
there.
[18:02]
On the on the Google. On Google.
[18:06]
I don't think this yet. That's pretty
[18:08]
good.
[18:09]
There it is. There it is. It's closed.
[18:13]
Whoever does the motion
[18:15]
can you just
[18:17]
reiterate that they have voluntarily
[18:19]
agreed to use bark collars. Yeah.
[18:22]
Make it as a condition that you have
[18:25]
voluntarily
[18:27]
they volunteered to have that be a
[18:29]
condition. Yeah.
[18:32]
I don't want some someone from PETA
[18:34]
coming to us and saying Oh, yeah.
[18:36]
You guys are requiring requiring bark
[18:38]
collars that kind That's true.
[18:41]
If that's If that's [laughter] If that's
[18:42]
the part of this PETA has a problem with
[18:45]
that's
[18:47]
Let them chain up. Enjoy the mosquitoes.
[18:52]
Any other Does anybody else have any How
[18:55]
do you want to define regular cleaning?
[19:01]
I'd say with that many dogs doesn't need
[19:03]
to be every day. I thought she made the
[19:06]
comment that we're going to go out there
[19:08]
and spray it every day, but I I they did
[19:10]
because then somebody brought up, "Well,
[19:11]
that's a lot of water.
[19:13]
And she said no, one to two gallons.
[19:15]
Yeah. And they've got a chemical that
[19:17]
they use.
[19:18]
She'll She'll biodegradeable chemical.
[19:20]
And light her up and ask her again,
[19:22]
right? Yeah. Yeah. Yeah, we can
[19:25]
Kind of let her self-define it almost
[19:26]
and then if she doesn't, then we offer
[19:28]
our
[19:29]
stipulation. But if she'll define it as
[19:31]
one every day, then that's an easy
[19:32]
answer for us to say okay, every day it
[19:34]
is.
[19:39]
Do you want to put anything in there
[19:40]
about X amount of complaints or
[19:44]
Do we Do we need to Do we need to define
[19:47]
that like the number of complaints?
[19:49]
>> [clears throat]
[19:49]
>> Nuisance complaints. We could You could
[19:51]
say
[19:53]
it's if three verified
[19:56]
noise complaints with animal control
[19:58]
would get made, then it they come back
[20:02]
to the planning commission so we can add
[20:04]
additional
[20:05]
conditions.
[20:10]
We could do
[20:12]
I
[20:13]
If they ever get out, I think that's
[20:15]
like a
[20:17]
that would be
[20:20]
reason for them to come back in. I don't
[20:21]
know. I Like do you want to put
[20:23]
something around if they ever I think
[20:26]
the barking is defined under nuisance,
[20:29]
which I think there are a whole lot of
[20:31]
things that fall under that, so Three
[20:33]
nuisance complaints.
[20:35]
But then we've also got to remember
[20:37]
somebody doesn't like those dogs, they
[20:38]
could just be calling.
[20:40]
Nuisance complaints. You could do even a
[20:42]
single I could have verified.
[20:44]
It would have to be a verified
[20:45]
complaint. True. Yeah, through law
[20:47]
enforcement. Yeah.
[20:49]
Through law enforcement or animal
[20:50]
control, right? It probably go through
[20:52]
our county ordinance. Law enforcement.
[20:55]
>> [clears throat]
[20:55]
>> Officer Allen is the one who fields
[20:58]
those, investigates them, and then
[21:00]
brings back the findings what he sees
[21:02]
does. Is he the same one that is scared
[21:05]
of dogs and so you have to go catch him
[21:07]
for him and put him in the
[21:09]
Not that I've had any experience with
[21:11]
that, but Don't tell us how you really
[21:13]
feel. I don't know.
[21:14]
>> [laughter]
[21:15]
>> Hobbling down the road chasing dogs.
[21:17]
The gal would come out was 10 times the
[21:20]
She was tough.
[21:21]
but he was like
[21:26]
You want me to go catch it?
[21:29]
Anyway, we digress.
[21:33]
So, we're going to throw it in there?
[21:34]
Somebody say Well, three three nuisance
[21:36]
complaints and
[21:38]
verifiable verifiable verifiable through
[21:40]
Weaver County
[21:42]
Three nuisance complaints from separate
[21:44]
neighbors? One neighbor? Just complaints
[21:46]
today. If they're verifiable, it's a
[21:48]
complaint.
[21:48]
>> Okay.
[21:51]
Yeah, it wouldn't be any good if they
[21:52]
weren't
[21:52]
>> there? Does that mean it has to be filed
[21:54]
with Weaver County comes out and finds
[21:56]
they were at fault with that? Yeah, I
[21:57]
guess he's going to do something like
[21:59]
that. So, it's not just like
[22:01]
Which is the same as our ordinance for
[22:04]
like We've had him come out for
[22:06]
different
[22:07]
homes that are
[22:09]
bad, right? And he can't verify it. And
[22:13]
they'll go out and then inspect and
[22:15]
yeah, not a Do they give you guys city
[22:17]
staff the report?
[22:20]
They do give you the report. So, you
[22:22]
would be able to tell, hey, this
[22:24]
third time we've
[22:26]
Okay. And if our three complaints like
[22:29]
if three different neighbors complain
[22:31]
about one night of barking, is that
[22:33]
three events or three or one complaint?
[22:35]
That'd be one. I think I'd say verified
[22:38]
events events, yeah. That's what I
[22:40]
think, too.
[22:42]
That's what I'm just making sure I
[22:43]
understand it. It shouldn't be a
[22:44]
problem, but three
[22:46]
separate
[22:47]
>> separate instances
[22:48]
>> [clears throat]
[22:49]
>> or events that occurred. Okay.
[22:57]
If you're going to contemplate that, do
[22:59]
you want to also
[23:02]
Yeah, and then
[23:02]
maybe request for Dan, do you know one
[23:04]
of the corners of What if it's a pretty
[23:05]
severe complaint or
[23:08]
issue? Like if someone got bit, for
[23:11]
instance, something like that.
[23:14]
You want to have to be able to address
[23:15]
>> just have the condition be that if
[23:17]
there's complaints
[23:19]
and they're verified.
[23:21]
Just any complaints
[23:22]
verified to
[23:25]
how this is being ran
[23:27]
that it gets brought back to the
[23:29]
planning commission to review.
[23:31]
That seems fair. I like that. That's
[23:32]
good wording. It's not like they're
[23:34]
going to revoke it inherently, but it at
[23:36]
least just let us eyes on it. Yeah.
[23:39]
Or there could we could set a yearly
[23:40]
review. That's another thing we could do
[23:42]
as well.
[23:47]
Is there a way to distinguish between a
[23:50]
nuisance complaint versus
[23:52]
something safety? Safety.
[23:57]
I think we can
[23:58]
I think complaints
[24:01]
in regards to how this kennel is being
[24:04]
ran,
[24:05]
I think
[24:06]
that would just give us the ability to
[24:08]
bring them in for review either way.
[24:09]
Right.
[24:11]
How would you word
[24:13]
Um it'll be
[24:15]
one of the conditions is a yearly
[24:17]
review.
[24:19]
Of your operating not like your
[24:20]
operation, but your permit. The condition of this
[24:24]
permit.
[24:25]
I mean, we make the
[24:27]
people with the ADUs come in every year
[24:29]
and verify that they're
[24:31]
one of the primary
[24:35]
Yeah, I I I think I think I think that's
[24:37]
pretty reasonable to ask that that we
[24:38]
want to review this yearly.
[24:40]
So, next May.
[24:43]
Well, and it could be very simple.
[24:45]
>> [cough]
[24:46]
[clears throat]
[24:46]
>> It'd be very chopped. Next May, it's
[24:48]
like, you know what? You guys have lived
[24:50]
up to your end of the bargain.
[24:52]
Appreciate it.
[24:53]
>> Has there been any complaints already?
[24:56]
No. Like nobody's sent in the house. I
[24:58]
think they're in They're They're
[24:59]
remodeling
[25:00]
that house.
[25:01]
Oh, they're They're remodeling that
[25:02]
house.
[25:06]
They're migrating from Salt Lake.
[25:13]
I'm wondering if it would be better to
[25:14]
have some sort of trigger with the
[25:16]
annual review.
[25:18]
Some sort of trigger.
[25:20]
There would have to be a reason why we'd
[25:21]
have them come in for a review
[25:23]
instead of just an automatic. Yeah, I
[25:26]
feel like that's kind of
[25:28]
Yeah, I feel like get out of my
[25:29]
business. Yeah.
[25:30]
>> [laughter]
[25:31]
>> Well, that's That's my thing. But if
[25:32]
there's a complaint, like if I if I'm
[25:34]
not running it right, my neighbors
[25:35]
[clears throat] are going to complain.
[25:36]
And then we And then we That's when the
[25:38]
review happens. Yeah,
[25:39]
that makes sense.
[25:43]
Yeah, this This might be one of those
[25:45]
things that it goes in and it just goes
[25:46]
away quietly cuz everything's fine.
[25:50]
Well, I think that's what we're hoping
[25:51]
for.
[25:53]
Seems like a verifiable complaint. Since
[25:55]
we do pay the county to do that for us,
[25:57]
it has a slight vetting process. I think
[25:59]
it could protect on both sides if
[26:01]
Allen says this is the same complaint
[26:03]
we've received every time and nothing's
[26:05]
changed. We've already seen it once.
[26:06]
That probably wouldn't be verifiable,
[26:08]
right? It'd be probably a burden already
[26:11]
not happening if it's not really
[26:13]
legitimate. And then
[26:14]
if it's new, we'd be able to see it. So,
[26:16]
the complaint would trigger it. It seems
[26:18]
like that's enforceable
[26:20]
and doable.
[26:21]
Not too burdensome. Annually could be a
[26:23]
little burdensome, especially if we get
[26:25]
any more received in the next year.
[26:27]
Yeah, we don't do the annual based on
[26:29]
complaint.
[26:31]
Verifiable complaint.
[26:34]
And we don't want to go off the number
[26:36]
of instances in case it's uh severe.
[26:39]
Yeah. Yeah.
[26:40]
I mean, that makes it a little
[26:42]
half-hazard to do that.
[26:46]
Yeah.
[26:47]
Well, they've only bitten somebody
[26:48]
twice. I get one more.
[26:49]
>> I got one more.
[26:50]
That's two free doggie jail free cards.
[26:54]
Okay.
[26:58]
All right. Do you actually have
[26:59]
everything written down on the tackle
[27:00]
list? No.
[27:03]
Yeah, he has So, Oh, yeah.
[27:05]
Our callers voluntarily.
[27:08]
Gates locked.
[27:09]
Uh
[27:10]
nuisance verifiable nuisance complaints,
[27:12]
it'll come back before Columnist.
[27:15]
Planning commission. Did you need any
[27:17]
more time for this or are we good? We
[27:20]
can just invite her up to answer some of
[27:21]
ours.
[27:22]
Yeah, I don't have any any I don't I'll
[27:24]
make sure you have the plan. You want to
[27:25]
go over the site plan just so that
[27:27]
everybody
[27:28]
>> Depending on who's here, you
[27:30]
flash [clears throat] that up to say no.
[27:31]
>> Yeah, I'll make sure you have the plan.
[27:33]
Right in the middle. [snorts] I'll just
[27:34]
make sure they know that they're what
[27:35]
they're applying for and but I don't
[27:37]
have much to add, no.
[27:39]
Just relax. Yeah, cuz this isn't a
[27:40]
public hearing. No, but we we did
[27:43]
request him last time to bring a site
[27:45]
plan.
[27:46]
>> [clears throat]
[27:47]
>> Yeah,
[27:47]
just saying that we we appreciate they
[27:49]
put it in. Yeah.
[27:52]
Yep.
[27:53]
So, that was the only four conditions we
[27:55]
had.
[27:59]
Ask about the planning and get that in
[28:00]
writing.
[28:02]
Define regular, yeah.
[28:05]
Okay.
[28:08]
Sounds like you've got it handled. Good
[28:10]
job.
[28:11]
It always works out that way. Pays to be the last one here. Pays to be
[28:14]
the first.
[28:16]
I don't know what we're all celebrating.
[28:18]
First time First time I beat you to the
[28:19]
beer.
[28:20]
>> [laughter]
[28:21]
>> Had a hectic day, man.
[28:22]
>> I thought really long and hard about
[28:24]
staying in the place all night.
[28:26]
But you did.
[28:28]
Yeah.
[28:28]
Um
[28:29]
I don't know if this
[28:32]
blurs [snorts] too much from what the
[28:33]
agenda item is, but
[28:35]
in council, did we discuss briefly and I
[28:38]
can't remember what their determination
[28:39]
was, but they wanted to review the
[28:41]
overall ordinance for hobby kennels, is
[28:43]
that right? At some point, the number
[28:45]
of dogs.
[28:47]
I don't know if that's something they
[28:48]
can discuss further now or we need to
[28:51]
notice it differently.
[28:53]
That wouldn't apply to this at all cuz
[28:54]
these guys would have applied first.
[28:56]
Yeah.
[29:00]
We'll get it on the next. We'll get it
[29:03]
on the next agenda.
[29:05]
They kind of review the ordinances as
[29:07]
they relate to these.
[29:10]
So with that, Travis, I don't know if
[29:12]
you heard, but those two conditional use
[29:13]
permits fall under the
[29:15]
new ordinance and they
[29:18]
don't have a hardship, so they're not
[29:19]
going to there's
[29:20]
Yeah, so they're off the I wondered
[29:22]
about that. Yeah, yeah, they do. We
[29:25]
thought it was and they have
[29:27]
>> [clears throat and cough]
[29:27]
>> noticing we thought it was just take it
[29:29]
here, but it is it does feel a lot if
[29:31]
even if we place conditions or anything
[29:33]
occurred, they could just apply tomorrow
[29:35]
and be principally permitted, so there
[29:37]
was just no sense.
[29:38]
Do you guys remember when I know there
[29:41]
was a ton of conversation about sizing
[29:43]
everything. Something they talked about
[29:44]
at council meeting that I don't remember
[29:46]
us ever discussing. We talked about the
[29:49]
amount of parking, but did we ever talk
[29:51]
about it being paved or concrete?
[29:53]
>> I read I listened to the meeting
[29:55]
yesterday and I thought
[29:57]
Well, we did we did specify like
[30:00]
parkable surface. Yeah. Yeah, not on
[30:02]
grass. Not on grass, but Yeah, we didn't
[30:04]
say it had to be concrete or asphalt.
[30:05]
Well,
[30:06]
that's that's that's how they have
[30:08]
brought it up and they put they pulled
[30:09]
that part out.
[30:11]
So it still has to be a parkable
[30:12]
surface, but Because we're going to get [clears throat] them
[30:15]
for impervious service surface anyway,
[30:18]
so
[30:19]
I didn't Yeah, when I when I listened to
[30:22]
that I was like we never said they
[30:23]
pavement.
[30:25]
Because half the driveways out here are
[30:27]
unpaved.
[30:30]
>> [laughter]
[30:37]
>> A parkable surface.
[30:39]
What's that?
[30:40]
Yeah, how is that defined?
[30:42]
According to one of my neighbors, you
[30:43]
say we don't want it grass, but we want
[30:45]
the discussion, but I'm assuming I agree
[30:47]
with what they're saying. [laughter]
[30:47]
They said something about we want
[30:48]
surface
[30:49]
park but we don't want it just to be
[30:50]
grass.
[30:51]
I took a liberty and said well, most
[30:54]
codes want asphalt or concrete.
[31:02]
For new development What does our code
[31:04]
require for a new development? home
[31:07]
residential I'd have to look. I actually
[31:09]
know I'd actually don't know if it does
[31:10]
require concrete. I thought I thought it
[31:12]
should
[31:14]
Not even a little apron, no?
[31:16]
I'll look. I'm not sure. Good. You're
[31:17]
covered.
[31:19]
You're not. Maybe not.
[31:21]
I think the ordinance doesn't actually
[31:22]
call anything out.
[31:25]
I mean they did
[31:25]
>> We could the That's probably pretty sure
[31:27]
the city's going to want to address as
[31:29]
[clears throat] it gets more dense.
[31:30]
Okay. Got to put that on your list of
[31:31]
holes. list of things, holes, missing
[31:35]
because
[31:36]
All those will be grandfathered in, so
[31:38]
all the homes now that are allowed to
[31:40]
have dirt
[31:41]
will be allowed
[31:43]
to have dirt. Yeah. I can tell you if I
[31:45]
could afford it, I'd have asphalt. It's
[31:47]
true. I'm not going to go. You're you're farther than me. I'm 200 ft.
[31:51]
You're about 350. 350 I would have got
[31:53]
slag from Nucor and built my driveway
[31:55]
out of slag.
[31:58]
But we can
[31:59]
If nobody has any other comments, we can
[32:01]
close the meeting and
[32:04]
adjourn until our Go play soccer. at
[32:06]
11:30. Go play soccer. Have fun.
[32:08]
We'll We'll see you back here. We had
[32:11]
Well, there was 12,000 sq. ft. We had
[32:13]
about close to five. And then they're
[32:18]
Gary, peace out.
[32:20]
So, we received like five or six So,
[32:22]
recently, not with the last one, but
[32:24]
with this one.
[32:25]
To be fair, I would say.
[32:28]
Making sure the sprinklers and
[32:30]
everything is
[32:35]
» Making
[32:36]
sure the sprinklers work and
[32:38]
everything's safe.
[33:03]
Welcome.
[33:04]
I'd like to welcome you all to our
[33:07]
May 14th, 2026 Planning Commission
[33:10]
meeting. I am Commissioner McCormack and
[33:12]
I'll be conducting the meeting.
[33:14]
To begin our meeting, we'll have a
[33:16]
Pledge of Allegiance led by Commissioner
[33:18]
Weight and
[33:19]
a prayer given by myself.
[33:24]
Please stand and pledge allegiance with
[33:25]
me.
[33:27]
I pledge allegiance to the flag
[33:30]
of the United States of America
[33:33]
and to the republic for which it stands,
[33:36]
one nation under God, indivisible, with
[33:40]
liberty and justice for all.
[33:52]
Our Father in heaven, we're very
[33:53]
grateful for the opportunity we have to
[33:54]
gather together here as residents of
[33:56]
Hooper. We're grateful for the freedom
[33:58]
that we enjoy.
[33:59]
We're grateful for the soldiers who
[34:01]
fight for us. We ask that you please
[34:02]
bless them and their families that they
[34:04]
may be comforted and protected by their
[34:06]
way.
[34:07]
We're grateful for
[34:10]
the blessings that we have here and we
[34:12]
ask that the spirit be with us to guide
[34:14]
us in truth that we may
[34:17]
discuss the needs of the city here and
[34:19]
come to
[34:21]
conclusions that will be acceptable to
[34:24]
all. We're grateful for
[34:30]
the knowledge that we have of thee and
[34:31]
we say these things in the name of Jesus
[34:32]
Christ. Amen. Amen.
[34:39]
All right. First
[34:40]
um are the consent items. We have the
[34:44]
meetings from dated April 9th, 2026.
[34:49]
Um did anybody have any corrections or
[34:51]
I'll entertain a motion to approve those
[34:53]
minutes.
[34:55]
Uh I didn't see any uh
[34:57]
waiting for any corrections, so I'll
[34:58]
make a motion to approve the
[35:00]
minutes dated April 9th, 2026.
[35:04]
I'll second it. We have a motion from
[35:06]
Commissioner White and a second from
[35:08]
Commissioner Sebring. All in favor? Aye.
[35:12]
Motion passes.
[35:14]
Now on to I guess some agenda items on
[35:17]
uh I guess some cleanup items on our
[35:19]
agenda. Since the City Council last week
[35:22]
passed the uh new kind of increased size
[35:27]
on the condition the oversized
[35:30]
structures, both of those are oversized
[35:32]
structures that are on the
[35:35]
agenda are no longer on the agenda as
[35:38]
they will just pass under the new
[35:41]
ordinance. So, those will not be
[35:42]
discussed tonight or there will not be a
[35:45]
public hearing on those. So, if you're
[35:47]
here for those, just letting you know.
[35:50]
And just to specify, though, they
[35:51]
withdrew their applications. Oh, sorry.
[35:54]
Yes. So, they withdrew their
[35:55]
applications and are just going to go
[35:58]
through the new ordinance
[36:00]
process.
[36:02]
And then
[36:04]
we do have [clears throat] one item of business here for a hobby kennel for
[36:10]
Grace Richards and Nick Brown. And kind
[36:12]
of
[36:13]
one one thing I wanted to say before we
[36:16]
get into discussing this as a council as
[36:18]
a planning commission, we are
[36:20]
administrators of the ordinances that
[36:23]
are already set in place, meaning we
[36:25]
cannot change what is
[36:28]
already written in city code in that
[36:30]
instance, but we can
[36:33]
apply conditions where those things can
[36:36]
be met that don't
[36:38]
do unreasonable ask on those residents
[36:42]
applying for that as the use is written
[36:44]
out in our in our code. So, we don't
[36:47]
have
[36:49]
the authority or the power to change any
[36:51]
city ordinances per se or to deny things
[36:55]
just that because
[36:56]
we don't like things. Just so kind of to
[36:59]
clarify what our role is here is when
[37:02]
applicants come before us, we just have
[37:04]
to look at what the city code is is
[37:06]
written as and apply that code to the
[37:09]
conditional the use that has been
[37:12]
requested. So,
[37:14]
kind of just clarify that
[37:16]
um point right there. And then so, our
[37:20]
now on to this item of business for the
[37:22]
hobby kennel, Mr. Chairman.
[37:25]
Sorry to interrupt, but I I do want to
[37:26]
ask
[37:28]
and see if we can make a motion cuz
[37:29]
there's obviously a lot of citizens that
[37:31]
have a lot of interest in this.
[37:33]
I would like to ask if you guys think it
[37:35]
would be appropriate to move citizen
[37:37]
comment
[37:38]
before this action item
[37:41]
understanding of course that
[37:44]
no action be taken based on their
[37:46]
comments, but would that be appropriate
[37:48]
to
[37:49]
possibly move citizen comment to that
[37:53]
people comment prior to moving on to
[37:55]
action items?
[37:57]
It It would be up to you guys to vote
[37:59]
for it. Okay. Then, if you're okay with
[38:01]
that, I would like to make a motion that
[38:02]
we move agenda item five for citizen
[38:05]
comment um allowing our
[38:08]
citizens 3 minutes
[38:10]
uh understanding we cannot take action
[38:12]
on any items presented, but I'd like to
[38:15]
move that up before
[38:18]
um action item 4A.
[38:23]
Okay, we have a motion from Commissioner
[38:24]
Bates to move citizen comment
[38:27]
to the first item.
[38:29]
Do we have a second?
[38:33]
I'll second it.
[38:34]
Second from Commissioner Woodison. All
[38:35]
in favor?
[38:36]
Aye. Aye.
[38:38]
All right, motion passes. Okay, so now
[38:40]
we'll
[38:42]
with that motion, we'll move citizen
[38:44]
comment up. So, just on citizen comment,
[38:48]
you'll have
[38:49]
Please
[38:50]
step forward to the microphone, state
[38:52]
your name. You don't need to and if that
[38:54]
you're a resident of Upper City, you
[38:55]
don't need to give your address, and
[38:57]
then you'll have 3 minutes.
[38:59]
Um watch Morgan for your time to state
[39:02]
your
[39:03]
concern. And just so you know, like
[39:06]
Commissioner Bates mentioned, we can't
[39:07]
take actions on these comments, but um
[39:10]
we can
[39:12]
listen to your concerns.
[39:14]
At this time, we'll open that up to
[39:17]
citizen comment.
[39:20]
Good evening. My name is Shay Wardleigh,
[39:22]
and I
[39:22]
am a Hooper resident.
[39:24]
I um
[39:26]
live back-to-back adjacent to uh the
[39:29]
Browns, however, my mother is their next
[39:31]
immediate next-door neighbor, and I
[39:33]
spend a lot of time at my mother's house
[39:35]
helping her. We have host family dinners
[39:38]
where there are children present, and I
[39:41]
have concerns about um the hobby kennel
[39:46]
license that they've applied for.
[39:48]
My understanding under a hobby kennel
[39:50]
license is that it is not for commercial
[39:53]
use, it's for private residence. In the
[39:56]
April meeting, the Browns stated that
[39:58]
their dogs are not pets, and that they
[40:00]
are
[40:01]
uh trained in what's called PSA, which
[40:04]
is protection services. Um
[40:06]
it's basically attack protocols. These
[40:09]
dogs are specially trained to
[40:12]
um
[40:13]
protect their owners, and so I think
[40:16]
that that's an inherent danger for the
[40:19]
community and for uh their neighbors
[40:22]
that increase in volume of this type of
[40:25]
non-pet
[40:26]
um in inherently increases the dangers.
[40:29]
Furthermore, they've requested a hobby
[40:32]
kennel license. However, they own a
[40:34]
commercial business. They have a
[40:36]
training business. And they
[40:40]
my understanding is they don't meet the
[40:42]
qualifications for a commercial license.
[40:46]
And I don't think that they should be
[40:47]
granted a hobby license just because
[40:49]
they, you know, don't meet the the
[40:52]
qualifications for a commercial license.
[40:54]
Um their business includes services of
[40:57]
training and boarding other people's
[41:00]
aggressive dogs. So, again, that's an
[41:01]
increase in quantity and so inherently
[41:05]
an increase in potential dangers to
[41:07]
their neighbors, the community,
[41:09]
livestock, and so on.
[41:11]
Um the In the April 9th meeting, they
[41:13]
also stated uh again that their dogs are
[41:16]
not pets, but they are canneled 100% of
[41:18]
the time. They disclosed that their dog
[41:21]
the dog breeds were Malinois, um
[41:23]
which have a a little uh
[41:27]
They're often called Maligators for and
[41:31]
um German Shepherds. And these are very
[41:34]
um high energy breed dogs. I'm concerned
[41:37]
that if they, you know, one I want them
[41:39]
to be canneled all the time, but that
[41:41]
also leads to barrier frustration and
[41:44]
Malinois in particular are known to be
[41:47]
able to climb fences with ease. So, I'm
[41:50]
asking the commissioners to deny the
[41:53]
basic the uh hobby license based on the
[41:55]
fact that they own a business and this
[41:57]
is doesn't qualify for a hobby kennel,
[42:00]
in
[42:00]
uh is my understanding. And in spite of
[42:03]
all of these considerations, if the
[42:05]
commissioners do um
[42:07]
approve to approve the hobby kennel
[42:10]
license, I would like the structure to
[42:13]
be a solid wall so little kids can't put
[42:15]
their arms through the fence, extend 2
[42:18]
ft below the ground so the dog can't dig
[42:21]
through, and have a cantilevered um top
[42:25]
so they can't escape over the top. Thank
[42:27]
you.
[42:33]
Any other citizen comment at this time?
[42:38]
Yeah, Brian Easterday, resident. I live
[42:40]
to the west of the grounds.
[42:42]
Uh the conditional use has always
[42:44]
confused me cuz what conditions are we
[42:46]
supposed to put on there? And I have
[42:48]
never seen any and and I would hope that
[42:50]
there would be some that before this is
[42:52]
granted or before the animals are put in
[42:54]
that place
[42:55]
>> [clears throat]
[42:55]
>> there would be a fence, there would be a
[42:56]
check to make sure that fence is secure
[42:58]
much like she just said. So, as far as
[43:01]
that conditional use, I'd like to know
[43:03]
what some of the conditions of that are
[43:05]
if that's possible,
[43:07]
uh some of the restrictions, and and
[43:08]
then who's going to monitor that
[43:10]
and and make sure I know
[43:12]
that barking and things like that might
[43:14]
be or may not be a part of so I'd just
[43:16]
like to know more information
[43:17]
clarification on that. What What really
[43:19]
qualifies as conditional use in this
[43:20]
case?
[43:24]
Thank you.
[43:27]
Any other citizen comment?
[43:33]
Uh Cheryl Hermes.
[43:35]
Excuse [clears throat] me. I live next
[43:36]
door to the uh to the grounds.
[43:39]
When um
[43:41]
I measured from their house to the
[43:42]
property line, it's 27 ft. That's pretty
[43:46]
close. They have 10 big dogs. My concern
[43:50]
is the barking, the disturbances.
[43:52]
Um
[43:53]
I wrote a letter to the commission. I I
[43:56]
hope you all received it, you all
[43:58]
reviewed it.
[43:59]
Uh
[44:00]
mitigating nuisance
[44:03]
is threefold.
[44:04]
Uh mitigating nuisance noise, which is
[44:06]
barking, ensuring that the dog enclosure
[44:08]
and the kennel are closed to prevent
[44:10]
commercial kennel activities from
[44:12]
occurring under a hobby dog conditional
[44:14]
use permit in an R1 zone,
[44:17]
and to provide safe
[44:19]
safety and potentially dangerous animal
[44:21]
safety from potentially dangerous
[44:23]
animals.
[44:24]
>> [clears throat]
[44:24]
>> Um
[44:26]
We were counting animal code 6-4-13
[44:29]
of
[44:30]
Weber County Code
[44:32]
uh deeming animals as nuisances if
[44:34]
animals cause unreasonable barking,
[44:36]
whining,
[44:38]
howling,
[44:39]
or disturbing noises. Ordinance number
[44:41]
2024-01,
[44:43]
the single largest dog's bark
[44:45]
uh
[44:46]
single large dog's bark averages 80 to
[44:49]
100 decibels, which is equivalent to a
[44:52]
car horn.
[44:53]
Exceptional loud barks reach 113 to 116
[44:57]
decibels. The hobby dog kennel permits
[45:00]
applicants seeking potential multiplying
[45:02]
that noise by 10 times in their
[45:04]
respective zone area.
[45:06]
So,
[45:07]
I don't know what
[45:09]
I guess we're proposing that
[45:11]
um
[45:11]
maybe kind of dish it to be that the
[45:13]
dogs to be housed indoor at night time.
[45:16]
Uh
[45:17]
they won't be allowed to bark
[45:18]
continuously more than 5 minutes or
[45:20]
intermittently from 5 minutes to 60
[45:23]
minutes.
[45:24]
Outdoor kennels shall not be located
[45:26]
closer than 50 ft from any side or rear
[45:28]
property line. And if we were zoned in
[45:31]
um agricultural,
[45:33]
that neighbors would be 50 ft, not 27.
[45:37]
And sound walls are solid fencing with
[45:39]
blocks or muffles the noise from
[45:42]
noises or used outdoors. The other
[45:44]
thing that uh we're asking is that the
[45:48]
conditions for the property owners
[45:50]
agreeing not to engage in any activities
[45:53]
that fall under commercial not kennel
[45:55]
noises, including but not limited to
[45:57]
receiving compensation for any services
[46:00]
or products, boarding or training and
[46:02]
also they don't allow
[46:03]
disallowing temporary ownership of dogs
[46:06]
other than
[46:07]
um
[46:08]
disallowing temporary ownership of dogs
[46:11]
and other pets to circumvent the
[46:13]
restriction of the public animal
[46:15]
licenses.
[46:16]
And I, too, am
[46:17]
opposed to having a kennel license,
[46:19]
opposed to having one.
[46:23]
Thank you.
[46:26]
Any other citizen comment at this time?
[46:29]
Yes.
[46:34]
Hi, my name is Grace Brown, or Grace
[46:36]
Ritchey, as it used to be. Um
[46:38]
I'm the one applying for this permit. I
[46:40]
think there's a little bit of confusion
[46:41]
about what this permit means. What this
[46:44]
permit means is we're asking for five
[46:46]
dogs instead of our legally allowed
[46:49]
three. Regardless of if this permit gets
[46:51]
passed or not, there will be three dogs
[46:53]
on our property of a breed of our
[46:55]
choice, as we're legally allowed.
[46:58]
Um we do hear all of your concerns.
[47:01]
Um PSA does not stand for protection
[47:03]
services, it's actually a protection
[47:05]
sport. Um what a hobby kennel does is it
[47:08]
allows you to keep sporting dogs for
[47:10]
your own not commercial
[47:12]
personal use.
[47:14]
Um and that's what we do. We have five
[47:16]
of those. We'd like to be able to keep
[47:18]
all five of those on our property.
[47:20]
So, that's why we're applying for this.
[47:22]
These dogs also will be kept inside,
[47:25]
they will not be kept outside. So, to
[47:27]
your concerns of will they be able to
[47:28]
dig out, will they be able to jump out,
[47:31]
if they can dig out of concrete
[47:33]
flooring, we have some mutants on our
[47:35]
hands.
[47:36]
>> [snorts]
[47:37]
>> But, I promise you they are kept safely
[47:39]
inside. They are not kept in their
[47:41]
kennel 24/7, but they are kept
[47:43]
supervised 24/7. And if they are not
[47:46]
supervised, they are in their kennels.
[47:48]
Does that make sense?
[47:50]
Um
[47:51]
regarding the barking, that is very
[47:54]
managed. You would not know we have dogs
[47:56]
if you walked by our house. Our
[47:57]
neighbors currently do not know we have
[47:59]
dogs at our current house.
[48:00]
Um so, that's pretty well managed.
[48:05]
The backyard's fenced where they will be
[48:06]
out and they will be supervised in that
[48:08]
area if they are in the backyard. Um
[48:11]
I think that's covers everything.
[48:13]
Thank you. Thank you.
[48:17]
Any other citizen comment?
[48:23]
All right, I'll entertain a motion to
[48:25]
close citizen comment.
[48:30]
Make a motion to close citizen comment.
[48:32]
Motion from Commissioner Widdison. I'll
[48:34]
second. Second. Second from Commissioner
[48:36]
Bates. All in favor? Aye.
[48:38]
>> Aye.
[48:39]
All right, so now we can move on to the
[48:43]
conditional use permit for Grace
[48:45]
Richards Brown and Grace [clears throat]
[48:47]
Richards Brown and Nick Brown for a
[48:49]
hobby kennel located license located at
[48:51]
6559
[48:53]
West 4600 South. And we'll
[48:56]
give you the time here for some
[49:00]
uh discussion with the commission. I I
[49:02]
guess I'll I'll begin that with just we
[49:04]
have
[49:06]
heard your from your emails and the
[49:10]
concerns you expressed here and we feel
[49:13]
like the applicant is being
[49:16]
in good faith coming before us trying to
[49:18]
do these things the right way. And so,
[49:21]
what we do want to kind of discuss
[49:25]
kind of some of those conditions where
[49:26]
we feel like this would fit and kind of
[49:28]
can be a win-win for everybody involved
[49:31]
here. So,
[49:33]
um
[49:34]
any questions or anything? I guess
[49:38]
first
[49:39]
Malcolm
[49:40]
maybe turn some time over to staff to
[49:42]
kind of show the they did submit um if
[49:45]
you want to go through the
[49:47]
we asked for a site plan so they can see
[49:49]
kind of where
[49:52]
they
[49:52]
Yeah, we have a site plan that's been
[49:54]
submitted along with an application. Um
[49:56]
I think you guys have done a good job
[49:57]
explaining that they're seeking a
[49:59]
conditional use permit in an R1 zone. Um
[50:02]
This is the process that we follow. Part
[50:04]
of our application requirement is a site
[50:06]
plan. So, this site plan here just calls
[50:07]
out the fencing, gives an idea of
[50:10]
you know, where the gates are and the
[50:12]
overall layout of the lot. So,
[50:14]
if you have any questions
[50:16]
that relates to ordinances, let us know
[50:17]
and I'll try and help, but
[50:19]
this is what we've been provided with.
[50:23]
Thank you. Can you Can you scroll
[50:25]
through the other picture of the
[50:26]
building?
[50:27]
The next thing they sent in was the back
[50:29]
end.
[50:29]
Sure.
[50:32]
And then the one showing the kennel
[50:34]
itself and
[50:38]
All right.
[50:39]
thanks.
[50:44]
So, that's a picture of the kennel with
[50:47]
a roof, right? And then the
[50:49]
chain link fence.
[50:52]
And then the
[50:53]
indoor dog kennel where the
[50:56]
transport Okay.
[50:59]
Was that all open on there?
[51:01]
They didn't specify if someone is
[51:03]
staying there.
[51:04]
No.
[51:06]
The lobby house, that's right.
[51:14]
Any other points of discussion that the
[51:17]
commission wants to make?
[51:20]
Ms. Brown, can you come back up? Please.
[51:24]
Um
[51:26]
in your the original Thank you for
[51:28]
coming back, by the way. Yeah, I'm so
[51:29]
sorry.
[51:30]
And thank you for providing the
[51:32]
documents we asked for. So,
[51:34]
um
[51:35]
in your original application
[51:37]
um
[51:38]
you were talking about noise and
[51:40]
barking, and you listed down that you're
[51:42]
going to use bark collars, correct?
[51:45]
For the dogs who tend to whine
[51:48]
or bark at dinner time, it's easier to
[51:50]
have bark collars on them than to manage
[51:52]
them. Okay.
[51:54]
Um
[51:57]
Another question that I've got is when
[51:59]
you look at the site plan, you've got
[52:02]
6-ft fence all around the property.
[52:05]
There's two gates that lead to the
[52:06]
front.
[52:07]
>> Correct. How How do you plan to secure
[52:10]
those two? For For honestly, for other
[52:13]
people's safety and for your dogs so
[52:15]
that they can't get Yeah. So, those
[52:18]
gates are also 6-ft, same height as the
[52:20]
fence.
[52:21]
Um we just have like bicycle chain locks
[52:23]
that wrap around so you can't get
[52:25]
through it. So, they are locked? Yeah. I
[52:27]
don't know if they're locked right now
[52:28]
cuz we've been having some people coming
[52:30]
in and out to paint and do some drywall
[52:32]
stuff.
[52:32]
So,
[52:34]
I don't know if they're currently
[52:35]
locked, but they will be when we move
[52:36]
onto the property.
[52:38]
Okay.
[52:43]
You also
[52:45]
last month talked about
[52:49]
taking care of odors and smells. Can you
[52:51]
expand on that a little more? Yeah. So,
[52:54]
if you look um next to the pasture,
[52:56]
there's that
[52:57]
nice rectangle that's gray, dark gray.
[53:00]
Um that's the portable potty run. So,
[53:02]
what we do is if we can't attend to the
[53:04]
dogs going to the bathroom, meaning be
[53:07]
right there with them, we put them in
[53:09]
that portable potty run. Some are a
[53:10]
little shy going to the bathroom, so we
[53:13]
give them their own little space. Okay.
[53:14]
How do you rest meaning [clears throat]
[53:15]
it's it's fenced like a kennel? Yes.
[53:18]
sir. Um so, once they
[53:21]
um go to the bathroom in there, we scoop
[53:23]
it out, put that in a little receptacle
[53:26]
um that we have for the dog poop.
[53:28]
And we spray it out and move it around
[53:30]
to make sure it's not like one area is
[53:32]
getting too stinky. And by moving it
[53:34]
around, I mean move it 10 ft over, move
[53:36]
it 10 ft over, give the grass a little
[53:38]
bit time to grow back, too. Make sure
[53:40]
everything's sanitary.
[53:49]
Any other Any other questions for this
[53:51]
property?
[53:52]
Yeah, I guess
[53:53]
on this property case you mentioned
[53:55]
regular. So, obviously if they're using
[53:56]
the the kennel to do their business, otherwise they're
[54:00]
out and they might and go anywhere,
[54:02]
right? So, you you mentioned regular
[54:04]
cleanings. That mean
[54:06]
every day, every week, or what?
[54:08]
>> around behind my dog with a dog poop Oh,
[54:10]
that makes
[54:10]
>> [laughter]
[54:11]
>> sense.
[54:12]
Yes.
[54:13]
Okay, I'll just leave it at that.
[54:20]
I guess one one more thing too is I
[54:22]
guess I mean the code mentions pretty
[54:24]
clearly this is a hobby kennel, not a
[54:25]
commercial kennel. So, we have an
[54:26]
agreement you should not be doing
[54:28]
anything as far as commercial wise in
[54:30]
this property. So, I want to make that
[54:31]
clear for you.
[54:32]
Thank you.
[54:40]
Any other questions? Thank you. Thank
[54:42]
you, guys.
[54:45]
Bring back to commission for
[54:48]
further discussion or a motion.
[54:58]
Um
[55:00]
I I know we've had a lot of citizens who
[55:03]
reached out and I want to tell everybody
[55:04]
thank you for that. That's some really
[55:06]
good conversations the last week or two
[55:08]
over this.
[55:09]
Um
[55:10]
and we've had a lot of discussion in our
[55:12]
work meeting about this as well.
[55:14]
Um
[55:15]
we want to make sure that we're
[55:16]
protecting everybody's property rights.
[55:19]
So, at this time
[55:21]
um I would like to make a motion
[55:24]
that we approve the conditional use
[55:25]
permit for um
[55:28]
Nick and uh Grace Brown
[55:31]
uh
[55:32]
for the hobby kennel at 6559 West
[55:36]
Excuse me, 4600 South at Hooper Um with
[55:40]
the following conditions.
[55:44]
Ms. Brown already alluded to bark
[55:46]
collars, so we would like that
[55:48]
in there as a condition.
[55:52]
The gates to the property, as she
[55:53]
discussed, are secured currently with
[55:55]
bike locks. We would like those to
[55:57]
remain secured at all times.
[56:00]
We talked through the cleanliness issue,
[56:03]
making sure that there is regular
[56:04]
cleaning
[56:05]
with the animals.
[56:08]
We also discussed that this is also
[56:09]
covered in the other ordinance about no
[56:11]
commercial use.
[56:14]
Any other and last condition that we
[56:16]
would like to
[56:18]
implement with this is around any
[56:21]
nuisance complaints
[56:24]
that if there are nuisance complaints
[56:26]
that are verifiable through Weber
[56:28]
County, whether it be animal control or
[56:30]
the Sheriff's Department, that we pull
[56:33]
this back before the Planning Commission
[56:35]
to review this item.
[56:38]
For review. For review. Thank you.
[56:42]
I do have an additional one. This was in
[56:45]
the application,
[56:46]
so I would advise the Planning
[56:48]
Commission to
[56:50]
require 6-ft tall fence.
[56:53]
Excellent. Okay, thank you. I'd like
[56:55]
to add that to the motion. Was that That
[56:57]
was in the application. I just want to
[56:58]
verify that these were I don't know if
[57:00]
it was in the application.
[57:02]
When we measured parts of the fence,
[57:04]
they measured 6-ft.
[57:06]
I don't know if 100% of it, with grading
[57:09]
and everything, measured 6-ft. It's
[57:11]
pretty close.
[57:13]
But I don't know if it was in the actual
[57:15]
application. Okay. I'm sorry. I thought
[57:17]
that was in the application, so that
[57:19]
might be You guys might That might add
[57:21]
discussion.
[57:22]
I'm sorry.
[57:38]
» Would that be a reasonable request?
[57:43]
I think so.
[57:45]
Then I'd like to add that to the motion
[57:46]
as well. That
[57:49]
all fencing surrounding where the
[57:51]
animals will be kept is um at a 6-ft
[57:55]
height in all places.
[58:06]
We have a motion from Commissioner Bates
[58:08]
for approval. You don't have to restate
[58:11]
everything that you said. We just need
[58:13]
[laughter] a second.
[58:18]
Before we do that, can I just ask one
[58:20]
more question of the applicant?
[58:22]
The the bark collars, that's a voluntary
[58:24]
condition.
[58:25]
You're okay with that condition? Yep.
[58:27]
Okay. Thank you.
[58:38]
I'll second the
[58:40]
motion.
[58:41]
We have a motion from Commissioner
[58:43]
Bates, second from Commissioner
[58:44]
Watterson. All in favor for the
[58:46]
approval?
[58:48]
I. I. I.
[58:50]
Okay. Motion passes.
[58:55]
All right, since we moved our sense of
[58:56]
community to the beginning of the
[58:57]
meeting, that is
[59:00]
Now we'll allow her to make a motion for
[59:03]
adjournment.
[59:04]
I make a motion to adjourn.
[59:07]
Motion from Commissioner Watterson to
[59:08]
adjourn. Second. Second from
[59:10]
Commissioner Bates. All in favor? I. I.
