Adjustment meeting for Monday, August
[1:19]
24th. Please bear with me while I meet
read the meeting procedure.

All persons in attendance at the
Planning Commission Board of Adjustment,
[1:28]
the PCBOA meetings are expected to
comply with the following meeting
[1:32]
procedure. Thank you in advance for
helping make this a manageable meeting.
[1:36]
Copies of agenda item materials are
available for public viewing on the
[1:40]
table located at the back of the meeting
room. These materials are not to leave
[1:43]
the table so that others in attendance
may also view them.
[1:48]
Please turn phones to vibrate or off
during the meeting and conduct any
[1:51]
sidebar conversations outside of the
meeting room.
[1:55]
Interruption or other interference with
the orderly conduct of the PCBOA meeting
[1:59]
will not be allowed. Defamatory or
abusive remarks are always out of order.

Disruptive persons will be removed from
the meeting and the chair may terminate
[2:07]
its speaker's privilege of address if
after being called to order the speaker
[2:11]
persists in improper conducts or
remarks.
[2:15]
Written material concerning agenda items
must be submitted to the environmental
[2:18]
services department by 3:30 p.m. on the
Wednesday immediately prior to the
[2:23]
meeting date. Written materials will not
be accepted after this deadline or at
[2:27]
the meeting because the PCBOA will not
have sufficient time to review them
[2:30]
prior to the meeting. Such materials
must state the agenda item for which it
[2:35]
is being submitted and the name and
address of the submitting party. The
[2:39]
planning commission business is
conducted first, followed by the board
[2:42]
of adjustment business. The chair will
call the meeting to order and explain
[2:46]
the meeting procedure.
The chair will read each item agenda
[2:50]
into the record and ask the applicant to
come forward to the presenter's table,
[2:54]
state his her, or their names and
address for the record and explain his
[2:58]
her or their request. The PCBOA will
then discuss the agenda item with the
[3:02]
applicant. The chair will then ask for
public comment on the agenda item. And
[3:06]
to facilitate an orderly, efficient
meeting, there is a threeminut speaking
[3:10]
time limit per speaker per agenda item
unless the chair allows a speaker
[3:14]
additional time. The chair may terminate
the speaker's privilege of address if
[3:18]
after being called to order, the speaker
persists an improper conduct or remarks.
[3:22]
When the chair recognizes a speaker, he
or she may approach the audience podium
[3:26]
and microphone, state his or her full
name and address for the record, and
[3:30]
write such on the speaker log, and then
share his or her comments. The audience
[3:36]
podium microphone must be used by the
recognized speaker because the meeting
[3:39]
is recorded. A member of the public may
not donate his or her speaking time to
[3:44]
another speaker.
A speaker should state his or her
[3:48]
comments and address the issue, not the
applicants. All comments are to be
[3:52]
directed towards the PCBOA. Please do
not repeat comments already made by
[3:56]
previous speakers. The chair reserves
the right to ask a group of with similar
[4:01]
comments to appoint a spokesperson. If
written comments have been submitted to
[4:05]
the PCBOA, please do not read them aloud
during the meetings as they are already
[4:09]
a part of the record and copies thereof
have been given to the PCBOA.
[4:13]
After everyone wanting to speak on an
agenda item has done so, the chair will
[4:16]
close public comment period on the
agenda item and no further public
[4:20]
comment will be taken after this point.
The chair will give the applicant an
[4:24]
opportunity to address issues raised
during public comment.
[4:28]
The PCBOA will then continue its
discussion on the agenda item and the
[4:32]
chair will entertain a motion on it. The
PCBOA will make a motion to pass, deny
[4:36]
or table the item. Once a motion is made
and seconded, the PCBOa will develop
[4:40]
findings of facts for conditional use
permit and variance applications and
[4:44]
then vote on the motion. Once the vote
is taken on the agenda item, the PCBOA
[4:49]
will move on to the next agenda item.
Meetings commence at 6 p.m. and will
[4:53]
continue until all agenda items have
been heard or until 10 p.m. No new
[4:57]
agenda items shall be considered after
9:45 p.m. The PCBOA may at its
[5:01]
discretion continue an item that is on
the floor at 10 p.m. Any remaining
[5:06]
agenda items shall be continued to
another date or time, preferably the
[5:09]
immediately following Tuesday at 6 p.m.
and no further public notice will be
[5:13]
provided for such a meeting
continuation. The PCBOA will then
[5:17]
through the chair may modify these
procedures prior to a meeting or an
[5:20]
agenda item.

uh the this the natural contours of the
lot seem to support um a walkout uh
[8:46]
basement very nicely. um sands the the
requirement or the restriction on how
[8:53]
much volume of soil we can move. So um
we're also proposing a excuse me a
[9:00]
threeseason porch on one end and a and a
small small grill deck on the lakeside.

that you're going to remove the shed and

the gazebo, but the lake um the 10x10
shed and the gazebo must be removed from
[12:42]
the property prior to your land use
permit being obtained.

If you're going to remove those items
anyway, I don't foresee that to be a

problem unless you do.

the property and not created by the

required for any construction. Um uh and

it is mostly in a steep slope area.

practical difficulty involve more than

[24:10]
the end part, the furthest part, one of
the five people that live there. Um, I
[24:15]
did give a written um, letter to the
county, but that was under the
[24:20]
understanding that the driveway was
being adjusted and moved per the
[24:24]
application. Um, even now though with
maintaining the original driveway, I
[24:29]
still do have the concern about the
structural integrity, the risk to that
[24:33]
with the additional um, approach.

Um, I'm there all year round. My husband
and my family and I, we are there all
[24:40]
year round. We maintain the road in the
winter with the snow plowing. We hire it
[24:43]
out. I don't do it myself. Um but in the
summertime whenever we've got a rain,
[24:48]
myself and our neighbors, our other four
neighbors um also go and maintain the
[24:52]
road with bringing in class 5 as needed,
whatever. There are significant areas of
[24:57]
ruting after the rain and we are
concerned about the structural integrity
[25:00]
that it might introduce additional
rudding for the new driveway. Okay.

it's a steep access if it is put in that
way and the onto 104 becomes a problem
[26:11]
and other neighbors are concerned about
it. And on weekends when there's a lot
[26:15]
of traffic through there, there's a
blind corner when you come over the
[26:18]
hill, you can't see it. And um I'm
concerned about that. And then there
[26:23]
were the 911 address changes. What
do we change our address if that
[26:29]
happens?
Um those are the questions I have.

I Juliet drive. I do not live on Juniper
[27:10]
Pine Drive, but I go by this area
anywhere from probably 4 to six times a
[27:16]
day. So, I go around the Islands Corner,
which is about 150 ft from where the
[27:21]
driveway is proposed,
which doesn't give you much time coming
[27:25]
around that corner to see somebody
coming out. It's an extremely steep
[27:31]
elevation to put a driveway in. Coming
from the south, coming like from town,
[27:38]
when you come to the hilltop, it is
probably 100 ft from there, which is
[27:43]
another
not so good idea because you can't
[27:49]
really see very well. There's a lot of
trees around. Um,
[27:54]
the driveway has been there for many
years.
[27:58]
And um I'm wondering
what's the purpose in changing it.

I guess to know
I mean there's a driveway there now that
[28:12]
serves a purpose.
So that's just my concern and I also
[28:17]
sent a letter

inspection hit the nail on the head when

they said, "I'm going to grass in where
the current driveway access is," which

is part of the plan, and then plant
trees uh along our the

west side of the easement between the
easement and the house to make the
[31:59]
appearance of the house better. That's
been the goal from the beginning. I have

a small logistic issue, which is getting
my
[32:06]
23 foot boat trailer and my
uh long box
[32:13]
uh crew cab truck to make that turn
easily. This would make that easier, but
[32:17]
that's secondary to the landscaping
plan.

being the owner of a boat trailer about

the same size,

the slice you're going to make is going
to make improve your ability to u get

that we have before you is uh related to

the disconnect of a mobile home and a
new mobile home being brought in. Uh we

have 52 uh mobile home units that are in
Sunny Shores and have been in there um
[51:28]
since it was started in 1990 and
periodically some of the mobile homes
[51:34]
need to be replaced. Um it just so
happened that last year one of our units
[51:39]
u we had a death of that member. they
sold it. The person that sold it to came
[51:44]
in to get the uh permit for the mobile
home and was notified about this clause
[51:51]
that we hadn't previously dealt with of
having to upgrade the septic system uh
[51:56]
to current standards. Our septic system
is in compliance right now. And so our
[52:01]
request right now is simply that we have
the ability and flexibility to replace a
[52:07]
mobile home as long as we don't increase
the number of bedrooms in that unit.
[52:15]

unit?

» Two.

But again, I want to make emphasize that

put it in? And in this case, there's a
60 ft trailer there. And we had based on

room had said we could go up to 70 ft.
Typically, a 70ft unit is two bedrooms,
[55:01]
two bath. Um his request was for a
three-bedroom, two bath and a full 70
[55:07]
foot end to end. We came back and said,
"No, we understand the issue. we now are
[55:15]
dealing with with the ordinance and with
the potential for a septic system. And
[55:19]
we said, "No, we're only going to accept
two bedrooms." The plan currently has
[55:23]
put in front of us is two bedrooms with
a den space in there.

will keep it that way. I am the
applicant for Sunny Shores. I'm also the

president of Sunny Shores. I'm not the
owner of lot 29, but I mean just in to
[58:14]
show our good faith in this, they came
forward with the three-bedroom and we
[58:18]
made the difficult decision to say no,
>> we're instead willing to self-p police
[58:24]
ourselves because we have 52 owners that
we represent and as a board I have a
[58:29]
responsibility to all 52 of those. So,
while what
[58:35]
um you have said is they could turn it
into whatever they like,
[58:41]
we know when construction is going on
out there. It's not like you can hide
[58:45]
somebody's got 2x4s out there. Um to be
able to turn it into a room. I mean, I
[58:49]
think we feel like we do a very good job
of of self-p policing. We have a seven
[58:54]
member board uh that oversees that. I
have three of my other board members
[58:59]
with me today and you know things come
up and you know as an example and I was

go up for sale and that unit likely is

not in terrific shape and may need to be

that puts a lot of burden on us as Sunny
Shores to have to come forward with a

variance when it's really lot X's issue

there's ways every unit has to come in
to get a permit. Every permit is going

to have a plan is going to show the
number of bedrooms that are out there.

So there is a way already set up to be
able to do that. everyone needs a new,

you know, foundation footings for their
trailer. That is a permitting process.

So, we feel like the processes are
already in place to do it. The the key
[59:57]
piece of this is to make sure that we as
a um Sunny Shores stay in septic
[1:00:04]
compliance. We have a lot writing on
that. So, we sure don't want to put
[1:00:09]
ourselves in a position that somebody
decides that they want to add change
[1:00:14]
their den into a bedroom simply to fake
you out. They're faking us out as well
[1:00:19]
and they're going to pay the price for
that because they're 152nd owner of the
[1:00:24]
park as well. So, correct.

rules, I guess, is my point.

negative. we have to watch out for

and and I've been down that road more
times than I can count. And so, with
[1:05:07]
this particular meter that's in there
right now, it hooks up to my laptop.
[1:05:12]
It'll give me, I believe, 410 days of
accuracy. And so, there's no adjustments
[1:05:20]
there. It just is what it is. And so
that that information is and will
[1:05:26]
continue to be available. So it is the
most accurate thing I've ever seen. So
[1:05:30]

backed up. So anytime I I think that for
[1:05:35]
environmental services, um they would
probably just like to see that at the
[1:05:39]
end of each season, you know, just
submit that to the environmental
[1:05:43]
services and just have it in your file.
That would just be handy. I would just

put that on your checklist to do at the
end of the season and that way it's
[1:05:50]
always in the file and they can always
review it. That would just be one less
[1:05:54]
thing, you know, one more thing to mark

the rest of the

saw that they had mowed that. Um, but

you know, we get the runoff
which is has been forever and I showed

you guys that video um of all the water
coming down in a big rain event

» and it it's always come down the hill
and so they're trying to diffuse it.

» That was a problem. Beth and the
neighbor tried to
[1:14:04]
» four years ago when you when you did
that addition.

» Well, the neighbors that used to be my
parents' cabin right next to us that the
[1:14:11]
one that was next to that was my parents
cabin for years. So, we have a lot of

pictures, photos, and we we they had it
for I don't know 15 years. When they
[1:14:19]
redid that cabin, they raised the dirt
up a lot, and that's because we had the
[1:14:25]
their little shed there used to be level
with our shed and down further. So, when
[1:14:30]
they came in, they brought a ton of dirt
and brought that and raised it a bunch.
[1:14:34]
And then we had a river like it washed
our grass, it washed everything out.
[1:14:39]
Trees washed out. It was terrible. And
so we put that flower box backs up just
[1:14:44]
because of that. So I don't know when
they raised that then the water ran
[1:14:51]
gushed down ours and then into the, you
know, in front and then down into that
[1:14:56]
slooh area. So that presented a big
problem. It washed out the back of our
[1:15:02]
cabin in the back door. Well, what it's
been replaced now, but before it was
[1:15:06]
replaced, it washed out all underneath
there. And then since then we've had all
[1:15:11]
this settling like our like you said our
floor is like crooked and um we had it
[1:15:17]
was just like bricks or something
underneath there really and so it washed
[1:15:20]
all that out underneath the deck. It
went out and took all that out. We've
[1:15:23]
replaced a bunch of trees and and
whatnot that they you know that washed
[1:15:27]
it ruined them. I mean it ruined our
yard. We had to bring in we had to bring
[1:15:30]
in grass and
>> that's not to point. The point is
[1:15:34]
since we're now doing an additional
construction
[1:15:38]
uh when you're within the shore impact
zone, I'm just trying to explore the
[1:15:44]
fact is could something be done to
increase the buffer
[1:15:49]

wherever beside you from your house or
up the hill.

neighbor to do not mow that and to use

So then we would just build that uh all

the way out to the front of the deck and

water from getting where it's currently
going under. Get it forward out forward

to the deck more. And with the grass
that's on the lawn, most of the in the

the planter that uh Beth and the
neighbor lady had done, that kind of

diffuses some of that water anyway, so
the grass isn't getting all corrupted

and washed out and stuff. So, it's the
grass is holding it. And so, it is
[1:18:30]
holding, but it would be nice to keep it
from getting to the house. And so,

that's why I was suggesting that we
could maybe do that. And I I can redraw

sleeps up there. Well they sleep up he
and his wife sleep up there because of

the time change. So when they come we
use it but otherwise

we we put our kayaks in there and all
that stuff. I know that that's clearly
[1:20:49]
in violation of the or the variance we
gave you four years ago that that was
[1:20:55]
not to be used for any sleeping quarters
at all.

stuff yet. So that all will go in there.

Relative to the ordinance amendments. I
[1:26:24]
brought those to the county board and
they were open to the plat process
[1:26:30]
change, but they changed their mind on
the conditional use process change. So
[1:26:37]
they directed me to bring that back to
you and that'll be on next month's
[1:26:41]
agenda to review the draft which is
basically the same other than having the
[1:26:47]
cup process modifications
and that will need your approval and the
[1:26:54]
draft I'll then bring back to the board
and we'll see where things go. Um
[1:27:01]
so that's one item. The other would be
we've got an ordinance amendment
[1:27:05]
application
uh asking the county to consider
[1:27:10]
commercial business use being allowed on
recreational development lakes.
[1:27:16]
Uh we've got a conditional use permit
application amendment request and then I
[1:27:23]
think three variances so far and the
deadline is next Monday. So we could
[1:27:29]
very well get more between now and then
but that's what we have. Thus far,
[1:27:35]
that's what I've got.
