Our first item on the agenda is a
continued public hearing for the
[2:05]
Bellefield Phase 4 FDP condos. Come on

back tonight. Larry Budro with Belf,
Jared Okconor to my left and uh we're
[2:38]
back to give the board an update. Um

» So, we were uh you know, working pretty
hard to get through all the comments and
[3:00]
then the board issued some preliminary
conditions to approval and I believe,
[3:06]
you know, there was a significant amount
of them and we plowed through all those.
[3:09]
Of course, one of them was getting the
approval from the Roosevelt Fire
[3:14]
Department and we did get some lastm
minute um comments that we wanted to,
[3:20]
you know, uh, you know, get addressed
right away. We were fortunate to meet
[3:25]
with Dan Nichols this morning uh at at
11:30 and thank you Don, you know, for
[3:31]
helping with that and of course an um
thank you for being there and Tom Harvey
[3:36]
was there. Uh Dan Nichols and Ryan were
both there and of course our team, you
[3:42]
know, Tom Malroy was there. Um
he was uh glad to meet us and we had the
[3:49]
architects LMV there, Tom and um and
Mike McCormack.
[3:55]
Their uh issue was the egress out of the
buildings and as we showed it in the
[4:01]
plans we submitted on August 18th show
the egress going into the courtyard.
[4:05]
They didn't like that. Uh so uh it was a
really not hard to do. We just needed to
[4:11]
understand that. Uh so now we
[clears throat] put the egress out
[4:16]
towards the parking lot side of the
building. So we changed that. We um uh
[4:22]
updated the plans and resubmitted it
back to him so he would be in a pos
[4:26]
position to write an approval letter
back back and forth. Um uh the other
[4:33]
thing we did for him is we removed the
retaining. Oh Jared, you probably show
[4:37]
it.

So we do have it here. We did uh include
it in the PowerPoint.

But as as that comes up, the other thing
we did was you might remember there was
[4:54]
a retaining wall uh on the on the east
and the north end of the courtyard and
[5:02]
that was an accessibility issue for
them. So we took that out and we graded
[5:06]
it down at 3:1. Uh the garage the wall
is already there with the parking
[5:12]
garage. So we just sloped it right down.

I think the other thing we did memory

» and Dan had a concern with was the uh
pool house amenity was a little close to
[5:56]
the actual residential building condo.
So um the architect said well we'll

rotate it 90 and so he was happy with
that. Uh and then he wanted a note on
[6:09]
the plan specifically referring to uh
NFPA13
[6:15]
as a code requirement. We did look up
the code and it is required for the
[6:20]
height of this building. So that we will
be sprinklering the buildings at NFPA
[6:25]
NFPA13. So that note was added to the
cover sheet as note number 10. Uh, so I
[6:31]
forward him an email with uh with uh a
note explaining all of that with the
[6:37]
three attachments, the cover sheet,
grading, and layout plan. So I'll show
[6:41]
you what we did here.

So stair egress here. We added this this

right here. So now you can come out the
stair tower and out to the parking area,

and uh you'll see in the grading plan we
[7:26]
added the stairs
to get out. This uh we rotated it 90°
[7:34]
and we had to go from 40 to 35 ft in
order to work with the grade. So this is

a lot more room in between the buildings
now.

Same thing here. This wall was taken
out. Stair access down. And this was
[7:56]
rotated 90 to give more room between the
buildings. And we added egress here,

there, and there. and Jared will get us

to the grading plan, but um uh we had to
make sure all the grades work. So, we
[8:13]
went to the grading plan, put the spot
grades on, made sure everything worked.

a handicap get into there without
accessing those stairs on the

floor plan of that um layout. But the

access to it and you go up to whatever

floor you want and

this. You can see the grade difference.

That was one of the concerns
uh Dan had was uh you know how does he
[9:17]
get you know to this courtyard you know
uh up this stair tower coming up some 12
[9:24]
feet up here with all their equipment
that kind of stuff. So, this this was a
[9:30]
a valid concern. We had to know what it
was and we addressed it. So, here's the
[9:35]
grading plan. We had to work with the
grades a little bit. We had to pull this
[9:39]
back a little bit to get that guy in.
Um, same thing here.

Now, he also had some comment, wasn't
it, about the stair tower it from the
[9:52]
from the garage level and reworking that
ramp or
[9:56]
» Well, his his concern was if there was a
fire in the garage, he didn't want the
[10:01]
smoke going up the stair to
the stair tower that goes out has no
[10:07]
access to the garage.

So, uh we made progress on that and uh

he was very helpful in saying, you know,
what do I need to do um you know to help

Couple other things to give the board an
update. We did receive REIA comments. Uh
[10:40]
we're working through them. comments
seven and nine. You know, of the 20
[10:46]
three uh 23 original comments, um we're
we've addressed
[10:53]
most of them. I've seen personally seven
and nine are addressed. Uh we have 13,
[11:01]
16, 17, and 21 to complete. I just got a
text message that they're, you know,
[11:07]
they're basically done. Um the last
comment 23
[11:14]
uh and I'll just read it here uh remains
Bellefield it said the uh in uh building
[11:20]
inspector zoning administrator town
engineer should agree on the
[11:24]
requirements for the building permit and
CO occupancy. So this refers to the CO
[11:30]
occupancy phasing plan and for each of
those phasing plans we're saying what
[11:35]
has to be in place
>> in order you know to get the CO and the
[11:40]
comment says that the zoning
administrator town engineer should agree
[11:45]
on it. So um
you know that we would need a response
[11:51]
from from them
[11:55]
and we can follow up.

like to go over. Um

the interpretive plan we presented it to
um the intent was it to establish the
[12:44]
design intent of the interpretive you
know features. So you can go to that

So, the idea is that we're presenting to
the board. Um, you know, our intent, uh,

I think there's like almost 20 different
different design elements. Um some are

but um the uh we met with Dylan
[13:22]
yesterday and the idea was you know how
does this work at at you know final
[13:28]
approval and so we were working through
that today and we have some thoughts and
[13:33]
we'll go through them. I'll go through
the big picture. Jared can go through
[13:37]
some of the details, but the idea is
that you know the plan being presented
[13:43]
is um
is our design intent for what we want to
[13:48]
do. Uh the final design elements would
the idea we're thinking the final design
[13:54]
elements would be approved by staff and
installed prior to the co. So what we
[14:00]
would do is uh tie a certain number of
elements. We say in the note on the
[14:05]
upper left that three or four of the
interpretive elements would be required
[14:10]
to be in per CO and you take three * 4
and that's 12 of course or four * 4 is
[14:17]
16. So we'll capture all the the uh
design elements within the there's
[14:24]
there's four cos right one no two three
four five six six six cos right so 6 * 3
[14:31]
is 18 6 * 4 is 24 so it's three to four
elements per co
[14:36]
» then we so because we're not going to
build the whole thing at once right
[14:40]
» and only have 30 people there right so
the idea is to sequence it with the co
[14:48]
beef it up as you go.
>> Yeah. And and then we have some thoughts
[14:52]
on on sequencing it and we can share
that. But the idea would be obviously
[14:57]
for building 30,000
we the pond would be in the trail around
[15:02]
the pond would be done. The stone tower
park would be done. So all those
[15:07]
elements would be done and then in the
next co we'll come up with another list
[15:11]
and that kind of thing.
So I think we can confidently provide
[15:18]
the list of what would be done on the
first CO. Now
[15:20]

provide a list that confidently says
what we can deliver uh for the first CO
[15:29]
» because a lot of the earth work has to
happen for the pond. Makes sense to put

in the trails.

back and try to do that when the other
buildings are being done. So, but then
[15:41]
once we move beyond that, um, we've got
some thoughts on trying to give us some
[15:44]
flexibility to deliver certain elements
that meet the intent of what we're
[15:48]
showing here. So,

after we met yesterday, um, and I I
wonder if you could say a little more
[15:56]
like I'm it surprises me as I think
about it, how much uncertainty you have
[16:02]
about like what space you're going to
have or what things are going to look
[16:05]
like when you're done. Can you talk a
little like I'm accustomed to seeing in
[16:09]
the plan that you've you know what's
going to happen in enough detail that
[16:12]
you're able to site a playground piece
of playground equipment, right? So why
[16:15]
isn't that the the case with with this
particular piece of property in this
[16:19]
project?
Well, the uh you know the whole thing
[16:23]
with Bellefield is you know when we were
doing this trail by the by the uh uh
[16:29]
hotel, right? We show it on plan, but
when we actually were doing it out in
[16:34]
the field, you know, we were working
more with the contours, with the rocks
[16:38]
that are there, with the trees that are
there. So, uh, we need that flexibility
[16:44]
to I mean, we could show the trail, we
could show the playground feature, but
[16:49]
we I I believe we need the flexibility
to work with what's actually out there.
[16:55]
Uh, the trees, the rock outcrops, or
whatever else we may find. Um, that was
[17:00]

a concept plan or when looking at the
whole property, but when we get into
[17:06]
this scale and this level of detail for
a site plan, uh, you know,
[17:13]
shouldn't we have a sense of where the
trees are and actually have it kind of

mapped out a little more clearly,
cleanly?

» Well, well, when I say trees, I'm
saying, you know, uh,
[17:25]
» a bunch of trees. Well, u you know, a
nice sycamore that doesn't show up on an
[17:29]
aerial, you know, that you want to pop
around, you know, that kind of thing.

» A rockout crop that doesn't show up on
the on the topo. Uh and that's what we
[17:39]
did with that trail. We worked around
some rockout crops and stuff like that.

your things might not be what you
expect.

» That's the idea. Um but this will be um
as we were speaking yesterday the final
[17:59]
design element the idea I mean like a
bench you know how

you know we'll show the detail what
we're going to do and we'll show where
[18:09]
» after the pond is is built we'll have a
really good idea where that thing would
[18:14]
fit and so then we can site it you know
specifically like that. So, we're
[18:19]
committing to however many bench benches
we have in there, you know, we'll we'll
[18:24]
show up. Um,
I I really like having uh I used to do a
[18:31]
lot of golf courses, right? So, when you
do a golf course, you lay it out on
[18:35]
plan, but it's all done in the field.
You know, you're working with the
[18:39]
contours, you're moving things around,
and that's kind of what, you know, what
[18:44]
I see here. But we're identifying
specifically, you know, ideas that that
[18:51]
we're going going to put out there. Um,
you know, so it's not, you know, I mean,
[18:57]
like that bench there, we want to have a
natural,
[19:00]
you know, kind of wood type bench. So,
[cough] will be there. It will be,
[19:05]
it'll be in the area of the location
that we identify. Uh, but it might be a
[19:10]
little left or right of it or
>> So, Larry, if I'm understanding
[19:14]
correctly, you're you since you've done
golf courses and all, you're saying that
[19:19]
you're gonna you're going to it's it's
fine on paper, but as you get out into
[19:24]
the field, you might come across
something naturally beautiful that you
[19:28]
don't want to the bench is going to sit
right there and you're going to have to
[19:31]
take it out and remove it. You you could
just shift it over 5T and have the best
[19:36]
of both worlds. That's your intention is
to make it better than actually what
[19:41]
you're presenting.

» Well, the the other issue I think you
have on the site is the understory is
[19:49]

» from the topo maps, you're not seeing a
lot of the elements that are within the

site. So, as you start uh grubbing the
understory and cleaning that all out,
[20:03]
you're talking about large scale
landscaping, not building structures.

So, as you build that landscape, you'll
see and landscape architects and
[20:12]
designers will look at it and go, "It
was supposed to go here, but it looks
[20:16]
better here."
>> And as you build the pond,
[20:18]

>> everything's going to mirror off of that
[20:21]
pond.
>> Yeah, that's that's the idea. I mean,
[20:24]
these things here, um, the gazebo, the
Jarro and I were talking about this
[20:30]
today, but, uh, where is the best spot
for the dock? You know, that's going to
[20:35]
go out in the water. We show it there to
the right. Yeah, right there. We show it
[20:40]
there, but actually when we get the pond
in, you know, we might want to move it a
[20:45]
little bit. So,
>> or angle it or something.

areas, you know, right here in this bend
[20:52]
is very steep on the slope. And so when
we get in there and find a way like what
[20:57]
is the trail actually going to look like
for that section, that might spark more
[21:00]
ideas on what else might make sense to
put here given the topography of it if
[21:04]
there's other elements we want to put
there. So that's those are like the
[21:07]
level of details that we don't have now,
but we're committing to, you know, go
[21:12]
through and do that work.

themselves to that flexibility, you
[21:19]
know. So that's why it

here, I think the the only concern would
be that by staging it um we won't see
[21:30]
some of these elements. So as long as
there is a list to have flexibility to
[21:35]
be able to work them into the landscape
in the proper way sounds fantastic. as
[21:41]
long as we still retain all of the
elements throughout the project.

» I I think we're gonna be a little
careful with the wording here, too. This
[21:50]
this has the potential to be kind of
subjective, what's acceptable and what's
[21:53]
not. And that's our job, not staff's
job. um when it comes to those sorts of
[21:59]
subjective
>> well I think the board has also been
[22:02]
very clear on some of the items that
they want to see like they want to see a
[22:06]
grouping of some of these recreational
equipments together rather than all all
[22:11]
spread out oneonone. So if we can get
the wording in there that says that
[22:16]
there is at least one place where
there's multiple recreation structures
[22:23]
then that carries through what the board
has been asking for. Yeah, I I agree
[22:28]
» without you actually having to say,
"Well, it's going to go exactly here."
[22:31]
» Yeah. And and I do agree, you know, with
with that. Um
[22:35]
» so So there is um a condition that
discusses
[22:42]
looking at interpretive trails and and
adding additional um equipment, it said
[22:49]
to the satisfaction of the planner. But
I really think that should all be
[22:54]
revised and it really should be. I think
to your point this is conceptual and
[22:59]
just maybe at another date you can come
back with you know ha have the list as
[23:06]
you say but then once you're really out
there and you've started construction
[23:11]
I'm sure a good chunk of what's showing
is park is going to be graded so you'll
[23:17]
have I think you know a little bit
better of a canvas to figure out where
[23:22]
you're going to put things you know so
for example there was there there was a
[23:26]
swing set and I think the group had said
we want more equipment. So I saw one
[23:32]
additional swing set but I don't know
that that's I don't think I'm the one
[23:36]
that would say that's adequate. I think
you all have to say this is appropriate
[23:41]
for a park that's serving this area.
>> Right. Well, and I think we've been
[23:45]
specific in asking for an actual
>> playground area.

» Yeah. where you have multiple options,
right,
[23:52]
» for multiple ages to play fairly close
by to each other so that
[23:57]
» mom's not chasing after

something that's going to work itself

you show conceptually,

then just come back um once you've

in the construction phase? you you
pretty clearly need it or want certainly

plan. Correct. You need the site plan
[25:32]
approved forward. So that's just what
we're talking

» but just as we're talking about the
phasing so that you can finish one
[25:38]
element of the site plan and get a co so
you don't have to have everything in
[25:43]
place. This would work its way into
that. I think once those building
[25:47]
locations are tagged and set where they
are and then the trail the pond goes in
[25:52]
and the trail goes around it, you're
it's going to answer its own questions.

It's going to fall
once those buildings are staked and
[26:01]
pinned and cleared and then the pond is
in.
[26:04]
» We want to get the pond done by the end
of the year so that baby's, you know,
[26:08]
up.
>> Just what what what sort of technical
[26:10]
mechanism are we talking about here? It
would be nice if it's not like a full
[26:14]
amended site plan, right? If it's
>> now we phase 4 a

of what you're going to put there and at

least maybe yeah some preliminary
quantities lists. So you've you've
[27:03]
already expanded it immensely since we
first talked to you by talking about the
[27:07]
number of elements and you know instead
of just saying yeah exactly. So now
[27:12]
you're talking about 18 different
>> we can detail this a little bit more by
[27:16]
uh at least identifying for the first co
what to do then the others we can put a
[27:22]
number on it.

that approach.

getting your first CEO, things are
grubbed and cleared and things and you

to the CEO, but it'll be approved.

And and of course there's certain items

in landscaping and probably recreation
that are movable,

she may deem some of these things as

dimminimous.

would move it over 5T. I think RZA would

say something like that is dimminimous

drew a big circle and said this is where
we're going to put a huge group of of

oh no now we got to shift it over you

know 250 ft. That starts changing the
whole lay of the land.

so the question I have to the board is

the fire chief. So we have those we

addressed and

» that he has no other concerns.

And and and we have most of the rena

Services. Uh here representing uh the
Goran Trust uh for Timber Harvest at uh
[37:26]
959 Violet Avenue. Um parcel is uh
6164-01-458755.
[37:38]
Um totals 175.76 acres uh of which we're
proposing uh commercial timber harvest
[37:45]
on 90 of those acres. Um property has
been managed uh under DC approved um 48A
[37:53]
forest management plan since 1982.
um has been harvested uh numerous times
[37:59]
over the years um and we are just
continuing with the um management plan
[38:06]
that was approved um back in 2023.
Um trees to be harvested uh mix of
[38:13]
hardwood and softwood all marked by a
certified forester with blue paint. Uh
[38:18]
there's 1438 trees uh across the 90
acres to be harvested. It averages about
[38:24]
16 trees per acre. Um the plan is to um
lop all the tops uh down to 3 ft high or
[38:34]
lower. Uh helps with the uh breakdown um
and deterioration of the uh the slash
[38:39]
that's left behind.
um erosion control plan is uh will be
[38:44]
following the state's best management
practices for timber harvesting. Most of
[38:49]
the topography is very flat rolling. Um
so slopes are not really a concern. Um
[38:56]
but anywhere there are trails and
there's numerous old trails left from
[39:01]
the previous harvests. um they will be
smoothed um free of debris and uh any
[39:08]
erosion control devices will be
installed as necessary. Uh there is a
[39:12]
DEC classified stream and wetlands um in
the application packet. We've gotten the
[39:19]
approval for a DEC um stream crossing
and wetland um crossing permit. Uh we'll
[39:28]
be crossing with um wooden crane mats.
uh approximately 100 foot uh section of
[39:34]
the the wetland and the stream. Um that
crossing will then be removed at the
[39:40]
completion of the uh uh the process and
[clears throat] um it will be restored
[39:45]
back to what it is currently. Um there's
also uh DC um rare threatened endangered
[39:52]
species, the uh Blandings turtle. So,
uh, there's a letter in the application
[39:58]
that, uh, the DEC's provided for, um,
seasonal restrictions. They'll
[40:03]
basically, uh, only allow us to harvest
between October 16th and April 14th. Um,
[40:10]
there is also a letter from the New York
State Parks, Recreation, Historical
[40:14]
Preservation. Um, the property did get a
hit on the, uh, EF mapper for being in a
[40:21]
potential historic or archaeological
sensitive site. Um the letter states
[40:26]
that this project won't have any u uh
bearing on anything that they have
[40:31]
found. Um access to the property is
going to be off of State Route 9G.
[40:36]
There's a pre-existing old abandoned
orchard that's there. Um there's two old
[40:41]
breaks in the stone wall that were used
for access to the orchard. Um what we
[40:46]
plan on doing is um putting in a
tracking pad um to prevent mud and
[40:52]
debris from entering onto the highway.
Um, I did speak with the DOT, uh, Tina
[40:57]
Riley. She sent me an email that I can
present. Um, but basically, um,
[41:05]
since we don't have a contractor yet, I
can't apply for a DOT temporary access
[41:11]
permit because of the bonds and
insurance. But, um, I can give you this.
[41:17]
Basically, it says that, uh, let the
planning board know that we don't have
[41:20]
any objections to this type of work. uh
and you know an application can be put
[41:25]
in once a contractor is found. Um
so um I know that visuals was a big um
[41:33]
item because this is a special use
permit. Um the harvest is actually um a
[41:40]
long ways from the the state highway. Um
you know 800 feet is as close as it
[41:46]
comes. um more of the property is over
1,000 ft past um the the the Route 9J.
[41:54]
So, um aesthetically, no one's really
going to notice that it's what's going
[41:59]
on back there. Um there's a few houses
um that the harvest will be near, but um
[42:06]
I visually I don't think that will
impact them at all. Um the hope is that
[42:12]
you know with weather um cooperating
that it would take approximately three
[42:17]
three and a half months to complete the
the process. Um you know if we couldn't
[42:22]
finish before the April 14th deadline
then um obviously we would have to come
[42:26]
back the following year. Um I think
that's all I have.
