me
[0:37]
okay i've got at least my one of my
[0:40]
assistant county attorneys on with me
[0:54]
yeah i already went doggy
[1:08]
[Music]
[1:09]
all right um
[1:12]
all right we'll get this meeting started
[1:14]
to the jefferson county board of
[1:15]
supervisors
[1:16]
i'm darren hamilton chairman and uh
[1:20]
we'll uh call this meeting to order
[1:24]
uh let's start by acknowledging the
[1:26]
minutes from the previous meeting
[1:30]
all right i have a motion by uh demit
[1:33]
second by saint quest
[1:35]
uh to approve the minutes from the
[1:37]
previous meeting
[1:38]
all those in favor say i i all those
[1:41]
opposed
[1:42]
same sign motion carries
[1:45]
um the next two
[1:49]
items are
[1:55]
our part of the county engineer's
[1:57]
responsibility and he's not here so
[1:59]
we're gonna
[2:00]
move on up to um
[2:04]
let's see do we have paperwork for
[2:09]
uh discuss and consider board of
[2:11]
supervisors civil service
[2:13]
commission
[2:17]
oh i think you're going to need
[2:18]
assignments well
[2:21]
that involves scott as well i had no
[2:24]
idea on cell service division i assumed
[2:26]
that maybe that was
[2:29]
from chauncey because susie's term
[2:32]
expired
[2:33]
and i think he was wanting to do an
[2:36]
interim
[2:37]
appointment so to speak until after the
[2:39]
election
[2:41]
and i don't know if he was asking it
[2:42]
because susan's his appointment
[2:45]
well we have pat mcmahon on with us pat
[2:48]
maybe you can answer this question about
[2:51]
the uh civil service
[2:53]
uh yeah my understanding is that the
[2:55]
hold on just a second
[2:57]
i gotta get some volume up on you here
[3:01]
okay now go ahead the terms of the folks
[3:04]
who were up this year
[3:05]
uh expired on june 30.
[3:09]
so i think we have one that needs to be
[3:12]
either reappointed or
[3:14]
uh newly appointed and i think that you
[3:16]
folks had one as well but
[3:18]
um i wasn't involved directly in those
[3:20]
conversations that's just my
[3:21]
understanding
[3:23]
okay all right so
[3:26]
um
[3:30]
who's currently on under us
[3:35]
uh pat are you still there no
[3:40]
depends what you ask okay
[3:44]
uh i show um that adam stafford expires
[3:48]
in october of 21.
[3:53]
joe ledger expires in october of 23
[3:56]
and susie's the only one that
[4:00]
is up and is is she october of this year
[4:03]
or was it june october of last year
[4:07]
we don't have anybody expiring until
[4:09]
october of 21.
[4:11]
poor choice of words whose term is is
[4:14]
up until october of 21.
[4:17]
okay uh well if that's the case then it
[4:20]
is just us
[4:21]
and um um we will uh
[4:25]
we'll do what we need to do so uh i
[4:28]
don't know why i was thinking that it
[4:30]
was uh one of those kind of like the
[4:31]
supervisors where there's two at one
[4:33]
time and then one at
[4:34]
two years staggered so uh okay well then
[4:38]
there's nothing for you guys to do there
[4:39]
we'll
[4:40]
send you something eventually okay thank
[4:42]
you thank you pat
[4:45]
all right uh scott kleiner county
[4:48]
engineer has joined us
[4:49]
so we're going to move back to meet with
[4:52]
the county engineer
[5:02]
okay so of course i've done blading
[5:05]
on dirt and gravel roads
[5:11]
did a culvert replacement of 1 10th
[5:16]
and ditching some more on miracle
[5:20]
further to the south and ironwood
[5:25]
and um equipment maintenance
[5:29]
mowing shoulders gravels and tables
[5:35]
we're into yellow now on the basement
[5:38]
striping
[5:39]
very good and uh
[5:42]
got five holes repaired on packwood road
[5:47]
v64 rock hall angle
[5:51]
1 10 between green tree and ivy
[5:55]
and shoulder maintenance on kelp north
[5:59]
of gear
[6:00]
in front of man boxes
[6:04]
i got a couple rooms for you to check
[6:05]
out for somebody
[6:08]
just talked about that
[6:12]
there's uh somebody that liked it
[6:17]
and just north like just down that hill
[6:19]
that first little hill
[6:21]
on the west side there's a big like
[6:23]
tractor tire or something right by the
[6:25]
edge of the road
[6:28]
well these tractors she just wanted to
[6:29]
think about that
[6:31]
but my point is tractors are going to
[6:33]
start moving here pretty quick and
[6:35]
trucks we need to get it fixed because
[6:37]
it just it's the edge of the room and
[6:39]
just at least now it needs a
[6:41]
flag on that but
[6:45]
and the other one is on nutmeg just have
[6:47]
them go out and really look at that i
[6:49]
did that yesterday and there's
[6:50]
a couple of bitcoins on there and that's
[6:53]
going to have traffic here in front of
[6:55]
three weeks or so
[6:57]
more um between there and selena read
[7:02]
[Music]
[7:08]
yeah it's been awfully dry but um
[7:11]
both commercial uh people are hauling
[7:14]
that
[7:27]
yeah well because of all the dryers
[7:43]
that's where okay at with road crews
[7:46]
yeah
[7:47]
all right we'll move on to uh consider a
[7:50]
resolution to accept
[7:51]
proposal by calvin burns and associates
[7:54]
for
[7:55]
bridge inspection and rating program
[7:58]
we have a resolution in front of it that
[8:00]
says be it resolved by the jefferson
[8:02]
county board of supervisors to accept
[8:04]
the proposal by calvin burns and
[8:06]
associates
[8:07]
incorporated for the 2021 bridge
[8:10]
inspection and rating program
[8:12]
to be accepted for jefferson county
[8:15]
by signature of the board of supervisors
[8:17]
chair
[8:21]
correct yes they're going to
[8:24]
reinspect 79 structures in 2021
[8:29]
for a long sum fee of 17 370 dollars
[8:36]
there it's required that load rating
[8:39]
computations
[8:40]
be done including on any new
[8:43]
of the rating trucks i mean meaning
[8:46]
trucks that are
[8:47]
now allowed to be on there that weren't
[8:50]
allowed to be there before
[8:52]
and uh update the scour evaluations
[8:57]
do uh fracture critical inspections
[9:02]
those those are bridges that if one
[9:04]
component goes there's no redundancy and
[9:07]
little things live ago and
[9:10]
track let's see
[9:15]
anyway various items there so for load
[9:18]
reading computations
[9:21]
those are 125 dollars each
[9:25]
and it depends on how many they have to
[9:26]
do and
[9:28]
updated scour evaluations 105
[9:31]
each bridge has that that's done on
[9:34]
fraction critical 400 each and they
[9:37]
estimate that those three things
[9:39]
would cost around six thousand dollars
[9:44]
and if there's anything else that we ask
[9:46]
them to do like
[9:49]
if somebody wants to take a heavy truck
[9:51]
over
[9:52]
for a heavier truck over a bridge
[9:57]
and they give you the how their load is
[10:00]
spread out
[10:01]
they the boards can determine if
[10:05]
we could give a special permit for that
[10:08]
truck to go over
[10:09]
and might be things like don't go more
[10:11]
than 5 miles per hour
[10:13]
and no braking on the
[10:26]
to get that special permit that they
[10:29]
need to pay the cost of the
[10:43]
there is a charge
[10:47]
that's um in the state statutes
[10:51]
but over reducing
[10:54]
some of the numbers of bridges
[11:01]
well if we put a single tank cart on
[11:04]
something that was
[11:06]
a bridge before like 20 feet of greater
[11:11]
then a single tank car is not going to
[11:14]
be
[11:14]
20 feet or greater so that takes one out
[11:16]
but if we
[11:18]
come find an 18 foot long bridge and we put two tanker cars in because
[11:24]
that's what it says it's supposed to
[11:25]
have
[11:26]
then we have a new bridge that goes on
[11:29]
our
[11:29]
inventory
[11:32]
and someday they might rate that a
[11:36]
little bit lower and we get some money
[11:37]
out of
[11:38]
it being a bridge but um
[11:42]
tommy we have eliminated silently
[11:45]
probably eliminated
[11:52]
right you got you don't have any width
[11:55]
restrictions anymore
[11:57]
and no low limits and i'm not liable to
[12:00]
have a name for
[12:02]
40 50 years
[12:07]
right
[12:16]
to approve the resolution all those in
[12:19]
favor say hi all those opposed same sign
[12:23]
motion carries
[12:50]
maybe i can go back
[13:05]
thank you sir
[13:10]
okay we'll move on to consider a
[13:12]
resolution to accept
[13:13]
okay we did that one sorry um
[13:17]
discuss and consider signing group
[13:19]
letter
[13:20]
and that would be the group clutter that
[13:22]
was spoken to us at our last meeting
[13:25]
about uh oversized trucks
[13:29]
and um platoon type trucking
[13:32]
the extra weight vehicles
[13:36]
um yeah that we spoke about so
[13:40]
and there's there's not on a
[13:43]
signing letter really what it means is
[13:46]
that um
[13:55]
[Music]
[14:00]
yeah okay i have the motion from
[14:03]
sandquest a second
[14:04]
from dim it to go ahead and
[14:08]
add our names to the letter that's being
[14:11]
submitted for
[14:12]
um reconsideration of increasing weights
[14:15]
on trucking across the united states as
[14:19]
well as
[14:19]
through our county and the state body
[14:22]
all those in favor say i all those opposed same sign
[14:27]
motion carries
[14:33]
it is to try and stop
[14:36]
increased weights on on highways
[14:45]
this doesn't change their dynamic at all
[14:48]
it doesn't affect their ability to uh
[14:51]
haul their their product to
[14:55]
wherever right is that suggested by the
[14:59]
government
[15:00]
here
[15:03]
okay um we're going to discuss stop sign
[15:06]
on 110th
[15:07]
in pleasant plain
[15:12]
we've asked the mayor of pleasant plain
[15:14]
to come and be with us today
[15:16]
okay um thank you so much
[15:37]
all right um a little bit of history on
[15:40]
this
[15:41]
uh previous county engineer had
[15:44]
authorized a stop sign to be placed at
[15:47]
west street and 110th
[15:50]
street in pleasant plain which is on the
[15:54]
west side of town
[15:57]
[Music]
[15:59]
the history on it was is that uh it was
[16:02]
felt that people were speeding through
[16:04]
pleasant plain
[16:05]
and they were wanting to use it as a
[16:07]
traffic control device
[16:09]
there were not warrants which are
[16:13]
designations given as to whether traffic
[16:16]
control devices are needed at a
[16:18]
particular
[16:18]
intersection because of traffic volume
[16:22]
turning movements or accident history
[16:25]
which this location had met none of
[16:28]
those requirements
[16:31]
and it's the county's position that
[16:34]
the stop sign should not be there um
[16:38]
it is the county highway 110th street is
[16:41]
the county highway that goes to the
[16:43]
west out of pleasant plain and
[16:47]
uh there are some things that can be
[16:49]
changed
[16:50]
to lessen the speed
[16:54]
coming into town by moving to signs
[16:58]
locations we have proposals for that
[17:02]
extending uh extending the 55 mile an
[17:06]
hour speed limit
[17:08]
farther to the west as you're going on
[17:10]
in town
[17:11]
uh changing the 55
[17:15]
mile an hour speed limit that's
[17:17]
currently going west
[17:19]
to a 45 mile an hour speed limit at that
[17:22]
location where the
[17:23]
speed limit is reduced all the way to 25
[17:26]
mile an hour coming in
[17:29]
we lengthen the distance of the speed
[17:32]
zone
[17:33]
ahead area we currently have a
[17:37]
sign out there that that says that
[17:40]
but it's it's much closer than what it
[17:43]
is
[17:45]
that would make um the speed limit start reducing
[17:52]
at uh which is quince
[17:56]
avenue to the west
[18:00]
[Music]
[18:09]
additional speed zone head sign
[18:13]
to the west of the city london line so
[18:15]
that right people are where they need to
[18:17]
be
[18:17]
going 45 and say london
[18:21]
what input is the community
[18:31]
in the letter that i sent you it was
[18:33]
outlined by the
[18:34]
county attorney that since it is pretty well known that the sign
[18:41]
isn't enforced
[18:43]
out there that it presents a hazard or a
[18:46]
problem to the county in that if there
[18:48]
is an accident that happens
[18:50]
because someone doesn't obey the stop
[18:53]
sign that's currently there
[18:55]
then the sound the county can be held
[18:56]
liable for what happens with that
[18:59]
accident
[19:00]
and with no um no
[19:03]
history of that intersection or no
[19:06]
turning movements
[19:07]
to warrant a sign being there in the
[19:10]
first place it should not have been
[19:12]
erected uh is what the county's position
[19:16]
is
[19:16]
so that it should come down even though
[19:19]
a previous county engineer
[19:21]
had uh designated to put up a sign out
[19:24]
there
[19:25]
it was not because there was anything
[19:28]
that
[19:28]
actually warranted and i'm not sure
[19:37]
well obviously it isn't it is
[19:40]
i've seen people i pulled in there just
[19:43]
to
[19:44]
turn around while documenting where
[19:46]
signs were
[19:47]
i saw two people go through the stop
[19:49]
sign
[19:50]
without stopping i mean they may have
[19:52]
slowed down a little bit
[19:55]
um that was all it did to slow down
[20:01]
and uh stop signs there's you're
[20:03]
supposed to stop that there's supposed
[20:05]
to be
[20:06]
enforced that you come to a full stop
[20:09]
there should be a stop sign coming from
[20:11]
the other
[20:11]
way if if it's warranted that a stop
[20:14]
sign before that that low case should be
[20:17]
through three will stop
[20:33]
west
[20:36]
and then put one up going east now
[20:39]
there's both of them on both sides
[20:41]
i'm going out of town from the inventory
[20:45]
but out of town they can run faster
[20:49]
there's nothing there they've passed the
[20:50]
church already to pass
[20:52]
uh west street they have to
[20:55]
come back down so there's no need for
[20:57]
adoption
[20:59]
well if they're going into
[21:08]
there's supposed to be a resolution
[21:12]
or an ordinance that says that they're
[21:15]
supposed to be
[21:16]
they would have to say there's two stops
[21:18]
on there and they
[21:19]
have to be predicated on that there
[21:22]
being warrants to have one there
[21:24]
if people slow down to the speed limits
[21:27]
that are posted
[21:28]
then they shouldn't have to stop there
[21:31]
let me ask a question and this is
[21:34]
that's impact in here so
[21:38]
first question do you know when that had
[21:42]
both stop signs was that originally
[21:44]
pleasant planes idea or was it just
[21:46]
there
[21:48]
yeah okay and that that answers that
[21:51]
question
[21:51]
the second part of the question then is
[21:54]
if an
[21:54]
ordinance is required who's required to
[21:56]
pass that ordinance the city of pleasant
[21:58]
plain or the county board of supervisors
[22:00]
and the third part of that then is is
[22:02]
that if it's the city of pleasant plain
[22:05]
they pass an ordinance is it not their
[22:07]
responsibility to enforce that
[22:08]
organization
[22:10]
oh populations below 500.
[22:14]
so i mean i'll let that
[22:17]
yeah did you hear the questions that lee
[22:21]
had
[22:22]
yes i did uh so this is a county roadway um
[22:29]
and so it's um
[22:32]
as such the county has jurisdiction over that roadway
[22:36]
uh kind of like highway one running
[22:38]
through the city of fairfield right
[22:41]
so it would be the county's
[22:45]
uh responsibility to do that and it
[22:48]
would be
[22:50]
whether it's the county's responsibility
[22:51]
or the city's responsibility to enforce
[22:53]
uh the sheriff provides
[22:55]
uh uh you know
[22:58]
law enforcement coverage for pleasant
[23:00]
planes so we're really talking about the
[23:02]
same entity
[23:04]
so let me go back to you said about
[23:08]
highway one but there are stop lights
[23:09]
along highway one now i'm not advocating
[23:11]
i'll keep the stop sign i just want to
[23:13]
be clear
[23:14]
there's stop lights along highway one
[23:16]
that a local
[23:17]
law enforcement can write me a ticket
[23:19]
for running that stoplight
[23:22]
any law enforcement can write a write a
[23:24]
ticket for violation of a traffic
[23:26]
ordinance but you said whose authority
[23:28]
or whose responsibility is it uh you
[23:30]
know each municipality has
[23:32]
a law enforcement um
[23:36]
provides law enforcement for their
[23:37]
community pleasant plane does that by
[23:40]
contracting with our sheriff's office
[23:41]
so our sheriff's office can do it but
[23:43]
the state patrol could do it
[23:44]
anybody that saw it could do it right
[23:47]
but who established the stoplight is
[23:48]
what i'm saying to the city of fairfield
[23:51]
or did the state of iowa uh i'm guessing
[23:54]
it was a joint
[23:55]
thing because you can't we can't the
[23:57]
city can't put anything
[23:59]
uh on highway one without approval from
[24:02]
the state
[24:02]
okay that answer that's what i wanted to
[24:05]
know is it's so this is
[24:06]
we're actually almost comparing apples
[24:08]
to apples here
[24:10]
well except that we have jurisdiction on
[24:12]
wasn't playing right
[24:13]
that's what i'm saying so if we were in
[24:16]
agreement with pleasant plane we could
[24:18]
establish that stop sign
[24:20]
uh sort of sort of okay
[24:24]
uh i'm looking at the the statute that
[24:27]
is
[24:27]
of concern for um our office chelsea
[24:30]
talk to me a little bit about this this
[24:32]
morning before he left but um
[24:35]
it's in the code state code that talks
[24:38]
about traffic enforcement it says that
[24:41]
um you know drivers have to follow uh
[24:43]
traffic control devices
[24:46]
placed in accordance with the provisions
[24:47]
this chapter and the provisions of the
[24:49]
chapter say that local authorities
[24:51]
in their respective jurisdictions shall
[24:54]
place and maintain
[24:55]
traffic control devices upon highways in
[24:57]
their jurisdiction
[24:58]
as they deem necessary and as
[25:02]
uh as indicated uh
[25:05]
by the state manual and specifications
[25:09]
so when scott's talking about whether
[25:11]
it's warranted or not and whether it
[25:12]
meets the criteria
[25:15]
those are things that need to be
[25:19]
taken care of in order for the sign to
[25:21]
be properly placed and if the sign is
[25:23]
not properly placed
[25:25]
and we actually catch somebody run that
[25:27]
stop sign and they come in and they
[25:29]
say look this this sign is not warranted
[25:31]
or it's not properly placed
[25:33]
then we can't prosecute it okay
[25:36]
so it's not just a matter of counting
[25:38]
degrees city agrees we're just going to
[25:39]
put it up
[25:40]
um there's more to it than that and so
[25:42]
that's what scott's talking about in
[25:43]
terms of whether it's warranted or not
[25:45]
warranted and what the studies show
[25:47]
and the appropriate way under the manual
[25:50]
to
[25:51]
regulate traffic uh given the data
[25:54]
and if if those things don't um
[25:58]
aren't all in line um then
[26:01]
uh enforcement on the legal side can be
[26:04]
very difficult
[26:05]
if not uh you know prohibited
[26:08]
so it's um those are the things that
[26:10]
concern us
[26:12]
so by definition scott it's not
[26:14]
warranted
[26:15]
okay
[26:18]
how much traffic goes through there in a
[26:20]
day
[26:22]
there's a hundred 180 vehicle count i
[26:25]
believe it is
[26:26]
coming through there um on the east west
[26:29]
road
[26:30]
right and we don't have a count
[26:33]
on west street
[26:42]
yeah that's the 180 vehicles per day
[26:50]
on both ways yeah that would be going
[26:52]
both directions
[27:01]
yes they call that an average count
[27:08]
so
[27:14]
we can't take no action
[27:17]
on it we can't authorize him to remove
[27:21]
it but i don't think we need to he has
[27:22]
the authority to do that because it
[27:24]
doesn't mean
[27:25]
i understand that right now doesn't meet
[27:26]
the requirements and i don't believe
[27:28]
there was a resolution by the county to
[27:30]
ever put it out there in the first place
[27:32]
that the board would have approved
[27:37]
i don't remember tom ever coming before
[27:44]
but again
[27:50]
we don't have the authority to take any
[27:52]
action but i don't think we need to have
[27:54]
the authority because i think it falls
[27:55]
under the engineer
[27:56]
adam
[28:00]
i i think that um i think that you're
[28:03]
right
[28:04]
uh one okay
[28:10]
there we go oh my god
[28:16]
no i think i think you're right i mean i
[28:18]
you know unless there was
[28:19]
some official action that needs to be
[28:21]
undone uh
[28:23]
then i don't think you need to take any
[28:25]
official action
[28:26]
here uh i think it's part of the county
[28:28]
engineer's responsibility to
[28:30]
you know maintain signage along our
[28:32]
roadways just as i read
[28:34]
and that includes uh removing
[28:38]
of signs that are not appropriate we've
[28:39]
done that in other instances where
[28:41]
things have been posted by
[28:42]
you know adjoining landowners or
[28:45]
whatever
[28:46]
and so that would be similar the thing
[28:47]
is that this has been at that location
[28:49]
for a while so
[28:50]
you probably you know it is appropriate
[28:52]
to sort of publicize it
[28:54]
and make sure that people are aware that
[28:56]
you know that uh that intersection
[28:58]
um is changing um and uh you know do our
[29:02]
best to get our information out there
[29:04]
well we would need to go ahead people if
[29:07]
we're going to do the
[29:08]
speed limit and pass
[29:12]
resolution regarding that i don't have
[29:14]
anything ready on that i've
[29:16]
been wanting to see what the board and
[29:20]
pat and the mayor might all have to say
[29:23]
about it today
[29:27]
well i mean obviously uh
[29:30]
according to the county attorney's
[29:32]
office falls into your jurisdiction and
[29:35]
if you want to change the signs
[29:36]
your resolution to do something but
[29:45]
[Music]
[29:53]
i mean you can check it out and uh pick
[29:56]
up
[29:56]
90 percent of the people that go through
[29:58]
there well i
[29:59]
think to play devil's advocate if they
[30:02]
don't look at the speed limit signs they
[30:03]
don't look at the stop sign either
[30:05]
which well i know the stop sign slows
[30:07]
them down
[30:10]
well that's the only thing
[30:14]
and that's an excellent point you
[30:15]
brought up an excellent point and that's
[30:17]
exactly goes back to the point that that
[30:19]
was making
[30:20]
that because they blow through it
[30:23]
even though they're they're slowing down
[30:25]
in their 170 they're going through the
[30:27]
45 they're going through it
[30:29]
which proves the county at risk
[30:32]
if an accident occurs there because a
[30:49]
in your argument you actually
[30:52]
um make the point uh like
[30:55]
against keeping this behind there okay
[30:59]
if anything why not
[31:44]
or
[31:49]
because nothing's right nothing's ever
[31:51]
happened to put it up there in the first
[31:53]
place
[31:54]
and it's not been warranted there's not
[31:56]
been a resolution
[31:57]
it's just simply a unenforceable
[32:01]
uh sound it's not unlike a situation
[32:05]
it's it's not exactly apples to apples
[32:07]
but it's not unlike the situation we had
[32:09]
out at osage
[32:12]
we had two deaths on osage since they
[32:14]
put in the bypass
[32:16]
and we as the board of supervisors felt
[32:19]
that was an unsafe um intersection
[32:23]
and it needed to be changed and we asked
[32:26]
the dod for safety monitoring and they
[32:28]
would give me the determination that it
[32:29]
was not
[32:30]
a safety issue what criteria they used i
[32:34]
don't know
[32:35]
but my point simply is is that
[32:38]
in this particular instance beauty is
[32:40]
not in the eyes of the beholder wrapped
[32:42]
forward
[32:43]
business safety ain't you coming into
[32:47]
town
[32:47]
because you get overtime over with
[32:50]
vehicles
[32:52]
they don't pay attention to the stop
[32:54]
sign
[32:57]
and boys shouldn't be stopping down
[33:00]
why can't the stop sign be there when
[33:02]
literally was there 13 years
[33:04]
ago how are you becoming illegal now
[33:07]
i don't have an answer for
[33:20]
and maybe it wasn't legal 13 years ago
[33:23]
but it was put in 13 years ago illegally
[33:26]
how do you know it wasn't an ordinance
[33:28]
did you like that
[33:29]
yes we did there is an ordinance
[33:38]
well there's definitely no possibility
[33:41]
of it being awarded to one stop sign
[33:43]
from one direction
[33:45]
um if it was warranted to put it in
[33:49]
going um from the west to the east that
[33:53]
it should have been warranted to go in
[33:54]
there from the east to the west
[33:56]
uh it would but wow
[34:01]
it wasn't necessarily warranted it was
[34:03]
just
[34:05]
would have been there if there were two
[34:07]
stops on it but you still have to
[34:11]
have a warranted stop signs needed there
[34:14]
and
[34:14]
you have to get a resolution or an
[34:18]
ordinance that
[34:20]
says that there's going to be a stop
[34:22]
sign and that makes it enforceable
[34:25]
and we don't have any of that there and
[34:28]
don't it's not really worth it to put a
[34:30]
stop sign there
[34:32]
okay if people are going the speed
[34:33]
limits that
[34:35]
are posted there then they're then
[34:37]
they're not going to have an accident at
[34:39]
that
[34:40]
intersection because of somebody coming
[34:42]
from the west
[34:43]
i mean coming from west avenue west
[34:45]
street whether it
[34:58]
are the conflict vehicles and uh
[35:02]
there's no church there's not that many
[35:06]
so i mean you're supposed to warn it as
[35:08]
to whether it's going to be a crash
[35:10]
there
[35:10]
because of somebody a lot of
[35:14]
vehicles coming out of west street not
[35:16]
turning them inside
[35:21]
and if people are going to speeds that
[35:23]
are posted there then that's not going to happen people
[35:27]
are going to stop at west street to let
[35:29]
the vehicle go by let's go in the speed
[35:31]
limit
[35:33]
there's no one's creeping in my way yeah
[35:35]
we're not dropping
[35:36]
that's what you own for us is the speed
[35:38]
limit okay but we ain't got no way
[35:41]
it's impossible to put up a pre-sign
[35:44]
that says
[35:45]
fashion slow ahead or you know how you
[35:47]
see these
[35:48]
well my idea is to put up the signs that
[35:52]
have the arrow ahead with the seat there
[35:55]
and that tends to so people found more
[36:09]
right well out on um
[36:13]
gear yeah gear and we looked at an
[36:17]
intersection there
[36:19]
and we didn't choose to put a four-way
[36:21]
stop there we
[36:22]
put uh revise the speed limit head signs
[36:26]
and
[36:27]
different different things so that when
[36:29]
you got
[36:30]
not necessarily at that intersection
[36:32]
with the kelp then
[36:33]
once you got into town with uh gear at
[36:36]
12
[36:38]
it's a lot more noticeable now that it's
[36:41]
25 miles per hour
[36:42]
on the west side of that intersection
[36:45]
than it was when the side was in the
[36:47]
shade on the
[36:48]
east side of that intersection
[36:53]
but oh there's there's countless
[36:55]
examples but one thing
[36:57]
is you're never supposed to use the stop
[37:00]
sign
[37:00]
just simply for speed control it's not
[37:04]
warranted
[37:05]
for that it's rewarded by
[37:08]
your conflicts that you have at an
[37:10]
intersection
[37:12]
and with people going through not not
[37:15]
paying attention or
[37:16]
obeying that stop sign that's there now
[37:19]
you're not getting
[37:21]
it's not uh effective the way it is
[37:25]
there's a lot of obey and then who's
[37:28]
going to be your
[37:28]
uncle who wants to get killed and they
[37:30]
can't find out
[37:33]
but there's no indication whatsoever
[37:36]
that taking the stock sign out
[37:37]
is going to increase or decrease
[37:40]
accidents now are you taking the b3
[37:44]
would you close the door the feed limit
[37:46]
fine i'm going to slow traffic
[37:51]
[Music]
[38:02]
guess when it gets a ticket you're gonna
[38:05]
get them there
[38:06]
i guess it would be the sheriff's
[38:08]
department yeah but they just had to
[38:10]
re-talk on their own
[38:16]
they sit and talk on their phones at the
[38:18]
north in the town not the south end of
[38:20]
town
[38:23]
not the north end of the town where they
[38:25]
could be
[38:28]
but i've never seen anybody here
[38:51]
but then they'd have to come and ask
[38:52]
permission from the county to be able to
[38:54]
put it up on that location
[38:55]
right i think well the sheriff has
[39:00]
sheriff's office can put out a uh sign
[39:03]
that
[39:04]
indicates how fast people are coming in
[39:06]
yeah right
[39:07]
and they've they've just did that
[39:09]
recently
[39:11]
out here on grimes and it seems
[39:14]
but i've noticed it seems to slow people
[39:16]
down
[39:18]
and i probably want to when we put up
[39:21]
those signs you probably
[39:22]
want the sheriff's office to put their
[39:26]
radar detection with the speed
[39:29]
indication sign out there for a while
[39:31]
and make people more aware of the fact
[39:33]
that
[39:34]
they need to slow down
[39:42]
oh you had another there was another
[39:45]
stop sign and another
[39:46]
small community that they put up just
[39:50]
from one direction
[39:52]
with the thought of speed control but
[39:54]
that has since been
[39:56]
removed by everybody's agreement so
[40:04]
well this ain't getting no place um well
[40:07]
can we have this term can i have to turn
[40:13]
sure that's that's perfectly fine we
[40:16]
don't have a meeting
[40:18]
about the third monday of each month so
[40:20]
it'll be
[40:24]
third monday in september which is
[40:27]
uh
[40:30]
24th of september okay
[40:34]
now before it ever
[40:38]
go ahead with the resolutions about
[40:40]
speed limits because
[40:42]
those are reasonable anyway and uh
[40:46]
go ahead and do that i mean well yeah
[40:48]
you can have everything all
[40:50]
put in place ready to go but we can wait
[40:53]
until the 21st of september
[40:55]
uh after their counter of your city
[40:58]
attorney has had
[40:58]
a chance to look at everything that the
[41:00]
county attorney has looked at
[41:02]
when it comes to this so that uh
[41:08]
just for a matter of uh
[41:11]
i don't know but reach out to your city
[41:14]
attorney and have them
[41:16]
contact county attorney's office and
[41:33]
harvest season and
[41:36]
do you have any objections about what
[41:39]
putting on the speed limit
[41:42]
out there at the city limit line and
[41:46]
then
[41:46]
you might
[41:55]
it is the county accounting jurisdiction
[41:59]
on that
[42:00]
because of the i mean even through town
[42:03]
because they have less than 500
[42:06]
population
[42:08]
which is not like fairfield
[42:12]
where fairfield would really have to say
[42:15]
um
[42:16]
roads going through therapy
[42:22]
okay all right
[42:26]
we'll look to talk to you on the 21st
[42:29]
what time is your meetings
[42:31]
seven o'clock and where the uh community
[42:39]
yep okay thank you
[42:51]
all right
[43:03]
so next we're going to move on to
[43:05]
discuss and consider board of
[43:07]
supervisors civil service commission we
[43:09]
already did that
[43:17]
now we're going to discuss and consider
[43:19]
weed commissioner change
[43:23]
okay we each received um
[43:26]
letters on this
[43:30]
um i gotta send your phone like a
[43:33]
comment before we start
[43:35]
it would have been helpful to do this at
[43:37]
the start of the budget here this
[43:39]
is coming because florida health got
[43:43]
this piece
[43:43]
back to them within budget year
[43:47]
and all this kind of stuff should not be
[43:49]
p small that should go as a package
[43:52]
just my personal opinion
[43:56]
well i i yeah
[44:08]
and uh
[44:11]
so i reached out to brent to scott
[44:15]
and i also called mark and i talked to
[44:17]
melissa
[44:19]
and while certainly what what dan
[44:23]
is is recommending is
[44:26]
can be done um
[44:30]
it does increase
[44:36]
does require reporting changes in terms
[44:38]
of
[44:39]
salaries
[44:49]
and if um we control this work
[44:53]
then it has to be designated on this
[44:57]
time sheet for lack of a better word
[44:59]
which would
[45:00]
fall to the responsibility of both the
[45:02]
individual trying to keep track
[45:04]
of time which agreement for
[45:07]
real that it would be minimal but
[45:09]
nonetheless keep track of the time
[45:11]
then report that time to mark who then
[45:14]
adjusts
[45:16]
their time sheet to reflect what portion
[45:19]
comes out of their own department what
[45:20]
portion comes out of the recommendation
[45:23]
uh our road crew generally speaking i
[45:25]
think scott and i are in agreement with
[45:27]
this they're paying attention to the
[45:28]
road as well they should be
[45:33]
and we never have had somebody go out
[45:36]
and just
[45:37]
you know cruise down the road and look
[45:38]
to see if d you've got
[45:40]
noxious weeds we recognize that
[45:46]
we state that the property owner is
[45:50]
responsible for the noxious means of the
[45:52]
nation
[45:53]
not the county so it's their
[45:55]
responsibility to mitigate those
[45:58]
whatever they happen to be um
[46:02]
i think correctly from wrongdoing we
[46:04]
pretty well handle it by complaint
[46:05]
or if you happen to be out there in the
[46:07]
second video
[46:09]
right
[46:12]
so it goes back to what i said you know
[46:14]
our road crew guys are out doing
[46:16]
something they're not specific unless
[46:18]
you know unless you get a complaint then
[46:21]
brent must have to go out respond would
[46:23]
have to go out or you
[46:24]
send billy out or whatever my point is that
[46:28]
um
[46:32]
we have budgeted three thousand dollars
[46:35]
to recommission wheat commission is
[46:36]
under the board of supervisors
[46:38]
and correctly points that out uh i did
[46:41]
talk to those hudson they're willing to
[46:42]
take it on and do it while they're doing
[46:44]
their nuisance work
[46:46]
and you know when they're going out and
[46:48]
in fact in a lot of instances it might
[46:50]
aid in a better nuisance a little bit
[46:51]
because a lot of the weeds and stuff
[46:53]
that we run into on property are
[46:55]
not just wheat
[46:58]
and so it would be
[47:01]
i don't know if we i don't know that i
[47:03]
would say that it would be
[47:06]
um don't misunderstand how this sounds
[47:09]
any greater coverage or any i mean okay
[47:12]
what we're just simply saying is is that
[47:14]
in the process
[47:15]
and again if there's a complaint as does
[47:18]
damn
[47:19]
they would review it but there would be
[47:22]
they would do it for the three thousand
[47:24]
dollars
[47:26]
how much time do you spend in the air
[47:28]
again
[47:30]
average the average over the past nine
[47:33]
years was 49
[47:35]
hours a year this past fiscal year was
[47:38]
61 hours
[47:41]
what was the uh increase due to
[47:44]
well that was averaged over nine years
[47:48]
right but this last year you said there
[47:51]
was 61.
[47:52]
so it's gradually gone up as people you
[47:55]
know now
[47:56]
they've called me to complain about
[47:57]
leading up the website on the
[48:01]
third week county website
[48:06]
okay and i do of the three thousand
[48:08]
dollars that
[48:09]
uh is allowed to you what portion of
[48:12]
that goes to your recertification
[48:14]
and um schooling that's required
[48:18]
of the weed commissioner there's
[48:20]
publication
[48:22]
so that's part of the budget every every
[48:25]
april
[48:25]
put out a public legal code and then
[48:29]
uh education um
[48:34]
i usually go to the aims to the
[48:37]
wheat commissioner's conference right so
[48:39]
there's cross
[48:40]
there it's about 300 right
[48:43]
here um and then the rest
[48:47]
is for actually the
[48:50]
rest of it is really for if you need to
[48:52]
hire somebody
[48:53]
go out and do spraying or mowing
[48:57]
like a third party to go on some of your
[49:00]
property and do that work
[49:02]
which i've never had to do that i've had
[49:05]
to write letters and then have the
[49:06]
attorney
[49:07]
i'll write legal letters to people
[49:10]
and usually they'll respond
[49:13]
so i haven't had that but the total of that three thousand dollars all
[49:19]
of those things that you just spoke
[49:21]
about
[49:21]
come out of that three thousand dollars
[49:23]
minus what you
[49:25]
your hourly rate is when you're out
[49:27]
there with it
[49:29]
so we're not talking about just three
[49:32]
thousand dollars here we're talking
[49:34]
probably in the vicinity of it
[49:38]
okay just a second ago you said it
[49:40]
didn't so that was why i was asking
[49:42]
again publication
[49:46]
education and then if we did need to
[49:49]
hire someone
[49:50]
which i've never had to so that money's
[49:52]
been spent on that
[49:54]
so and then about nine years ago
[49:58]
the board of supervisors said the
[50:01]
recommissioner's budget
[50:02]
can
[50:07]
basically pay the environmental health
[50:10]
department
[50:10]
for the time that the sanitarians spent
[50:12]
on weekends so
[50:14]
the beginning when i first took it on
[50:16]
which was
[50:17]
supervisor said oh by the way the
[50:19]
sanitarian usually does the wheat
[50:20]
pressure
[50:22]
so there's no there's no um
[50:25]
[Music]
[50:26]
compensation for the time that the
[50:28]
sanitarium
[50:29]
spent on means the first like six years
[50:35]
and then board decided to do that
[50:37]
compensation
[50:38]
so that's
[50:52]
yes
[50:59]
as far as russ goes we don't
[51:01]
particularly have a dog behind it's just
[51:02]
simply
[51:03]
i didn't get the impression from scott
[51:04]
that he was particularly enamored with
[51:06]
the idea um
[51:08]
but as i look at it with the 61 hours
[51:11]
we're talking about an hour a week i
[51:12]
mean how can that be
[51:15]
um no i'm not i'm not
[51:18]
completely oblivious to the fact that
[51:20]
you may have six hours this week
[51:22]
and no hours for the next six weeks i
[51:24]
understand
[51:26]
what my my point simply is is that
[51:29]
if all we're required to do is have a
[51:32]
wheat commissioner
[51:34]
and put out public notice
[51:38]
uh and respond to complaints i don't
[51:40]
think
[51:41]
um if the situation
[51:45]
needed to be that we needed to go out
[51:47]
and spray something we have people that
[51:48]
can do that without hiring it
[51:51]
to the outsider
[51:55]
but we wouldn't be doing it on private
[51:56]
land anyway it would be the
[51:57]
responsibility of the proper home to do
[51:59]
it on private land
[52:00]
they've been noticed that they're being
[52:03]
uh or there's
[52:04]
they've been certain notice that they
[52:05]
need to eradicate the weeds now unless
[52:07]
what you're saying is that they don't
[52:09]
you do
[52:10]
right if they don't then then is that
[52:12]
where we've already got the legal
[52:14]
requirement to actually
[52:15]
then is that charged back to the
[52:17]
property owner yeah
[52:21]
and i'm not what i'm saying is is that
[52:24]
um
[52:26]
it if we'd act strictly on complaint
[52:31]
um then i see
[52:35]
i don't see the need to budget three
[52:36]
thousand dollars a year
[52:38]
number one number two uh if we act
[52:41]
strictly on complaint then i suppose
[52:45]
you know branch or somebody from the
[52:47]
engineer's office could run out and see whether or not then you've got
[52:50]
to write the laws i guess the question
[52:52]
amen
[52:56]
and so what i'm saying is that
[52:59]
without increasing the budget we have an
[53:01]
entity that can do
[53:02]
all of that right okay
[53:05]
however into darren's thought process i
[53:08]
think
[53:08]
is and to dance we don't generally spend
[53:11]
the entire enchilada
[53:13]
during the course of the year correct
[53:15]
but in this case if we uh gave it to
[53:22]
for us it would be the entire enchilada
[53:25]
they would make sure that they had a
[53:26]
certification they could do this
[53:28]
i mean they you know as far as that
[53:30]
aspect of it goes
[53:32]
but why can't they just absorb this and
[53:35]
what they're doing already
[53:38]
i'm not saying that they can't i'm
[53:40]
saying that
[53:41]
um
[53:45]
taking i mean i mean i could certainly
[53:47]
ask that question
[53:49]
for that
[54:05]
it's like what's next you know there's
[54:07]
public health
[54:08]
board gets
[54:16]
i asked dan that question are we talking
[54:18]
immediately are we talking about
[54:20]
the fiscal year his comment was
[54:23]
immediately
[54:24]
or you know he wanted to write the
[54:25]
letter to bring everybody up to speed
[54:28]
and so that's the reason that we're
[54:31]
discussing it now
[54:32]
is because yeah
[54:46]
i don't know that's just my initial
[54:48]
feeling i don't think
[54:49]
the hours that you're putting in and i
[54:51]
don't mean this this recently i just
[54:53]
don't think it's an inordinate amount of
[54:54]
time
[54:55]
that you produced your hours at uh
[54:58]
you know to the board of health but you
[55:00]
also knew what you were getting into
[55:02]
when you asked to do that
[55:04]
you've
[55:20]
[Music]
[55:32]
so they're paying no to do it no
[55:35]
that was he talking now you just told
[55:37]
him you just told him
[55:39]
up until this year up until
[55:42]
fiscal year 21 there's no reimbursement
[55:47]
from the commissioner's budget to the
[55:49]
environmental health
[55:52]
i must have misunderstood i thought it
[55:54]
used to be yes
[55:55]
i misunderstood as well i think what dan
[55:58]
is saying
[55:59]
if chris was here i think she would say
[56:01]
correct because i know i've had
[56:02]
conversations
[56:03]
with her in past years where they do
[56:06]
track
[56:07]
how much of his time is spent
[56:10]
right so i don't think
[56:13]
it has been now we should check with
[56:15]
chris before we
[56:17]
verify that here's the reason we
[56:20]
checked with chris and and my assumption
[56:23]
was the same as darren's
[56:24]
mine was two based on
[56:28]
years that three thousand dollars it was
[56:31]
for the cost
[56:32]
of the week commission now
[56:35]
if if you know if nobody's invoiced or
[56:39]
has been reimbursed or
[56:40]
he didn't he didn't what do you want to
[56:43]
call it
[56:44]
uh provide a claim whatever the case may
[56:46]
be the money was there for that purpose
[56:48]
that's the reason the board put that
[56:50]
look if we're not going to do
[56:53]
if all the dan's done up to this point
[56:56]
and i'm not saying this is small i'm
[56:57]
just saying all that's been done up to
[56:58]
this point is
[56:59]
the public notice the writing of the
[57:02]
letters
[57:03]
uh and you know potentially all we ever
[57:06]
have the hiring
[57:07]
of somebody to go out and spray
[57:10]
but we've never paid for it there was no
[57:12]
point to have three thousand dollars set
[57:14]
aside in that bucket and there still
[57:15]
isn't
[57:17]
you know now this year uh
[57:21]
i don't know what made this year
[57:22]
different other than you've reduced your
[57:24]
hours so is the board of health getting
[57:26]
reimbursed or are you getting paid
[57:29]
so part of the negotiation to lower my
[57:33]
hours
[57:33]
lower my cost was because russ said
[57:37]
they would do the week commissioner part
[57:40]
of it
[57:40]
for nothing that's right
[57:44]
okay and i said okay i will do it
[57:48]
environmental health will do it for zero
[57:51]
and that's for this fiscal year
[57:52]
prior to this fiscal year yeah i would
[57:55]
turn in a claim at the end of the year
[57:57]
for the time that i spent doing
[58:00]
commissioner
[58:00]
things and therefore i would get
[58:03]
reimbursed from the lead commissioner
[58:06]
environmental health would get
[58:08]
reimbursed from the weak commissioner's
[58:10]
budget
[58:11]
for that time that i spent okay so
[58:13]
that's not going to happen this year all
[58:15]
right
[58:16]
is that am i making myself clear yeah
[58:18]
okay so
[58:19]
it has been in the past you've changed
[58:21]
it to this year that's right
[58:22]
okay i misunderstood but i go back to my
[58:26]
point
[58:26]
it's it's not under the jurisdiction for
[58:28]
the board of health
[58:30]
we could still not pay you correct
[58:34]
or to reimburse them for the time that
[58:36]
you spend on that as part of the
[58:37]
partnership
[58:38]
so i guess the question then that needs
[58:40]
to be answered from your
[58:42]
perspective because you're the one
[58:43]
that's out there in the weeds
[58:48]
is our construction business in the
[58:53]
unincorporated areas of the county
[58:55]
so good uh
[58:58]
or in those communities that aren't
[59:02]
seward as we don't have it in account
[59:06]
um are we so busy that
[59:09]
uh it takes all your time now to do that
[59:11]
as opposed to one hour a week well it's not what i wanted to
[59:16]
point out so
[59:21]
and i'm doing state mosquito
[59:23]
surveillance
[59:24]
right now so that's three three times a
[59:26]
week i have to collect these fields
[59:28]
that brings in more revenue in the whole
[59:31]
commissioner budget
[59:32]
okay and then i have the pool
[59:35]
inspections painting inspections tattoo
[59:37]
inspections
[59:38]
i do i usually do the state well survey
[59:40]
too
[59:41]
this time here they decided not to do it
[59:44]
this year but they usually do it this
[59:45]
time
[59:46]
um it's just and of course
[59:50]
septic systems climate transfers
[59:53]
how many steps
[59:57]
uh it was probably around 65 or so
[1:00:03]
and what time did they putting in
[1:00:06]
yeah mostly standard brokers
[1:00:14]
and then and then there's time and
[1:00:16]
transfer instructions
[1:00:17]
that which brought in last let's go here
[1:00:23]
so i'm going to go back to you um
[1:00:27]
if i am stating this incorrectly please
[1:00:30]
say so but i
[1:00:31]
felt like that you would prefer not
[1:00:33]
being
[1:00:34]
or in the engineering department or in
[1:00:36]
the room commissioner
[1:00:40]
um
[1:00:44]
i can reach out to see
[1:00:48]
what arrangements can be made
[1:00:53]
do you want to wait
[1:00:56]
i want to be here do you want to wait
[1:00:58]
till budget time before you make the
[1:01:00]
change and let this fiscal year
[1:01:01]
close i mean that's insane this will
[1:01:04]
kind of depend on what russ
[1:01:05]
says partially but that's my preference
[1:01:16]
well things can be overlooked when it
[1:01:18]
comes to budget time
[1:01:20]
that this was changed in september
[1:01:23]
and now we're in march and it's like
[1:01:26]
well what did we do then as soon as you
[1:01:29]
remember oh yeah that was only part of
[1:01:31]
the year
[1:01:32]
right right when you look back
[1:01:36]
guys the opportunity into the budget
[1:01:39]
year
[1:01:40]
to uh just say russ says no
[1:01:43]
we're not going to do it that way it
[1:01:44]
gives you the opportunity to explore
[1:01:46]
other options before you make a decision
[1:01:48]
right now it's kind of rushed
[1:01:50]
right
[1:01:55]
actually it's a good time to bring it so
[1:01:57]
this is time to
[1:01:59]
look at options right
[1:02:02]
i think if there's some
[1:02:06]
kind of engineering departments out
[1:02:09]
there to
[1:02:11]
take care of the wheat conditioning i
[1:02:13]
mean they must have
[1:02:14]
i mean there's some people that have
[1:02:16]
somebody that takes care of all the
[1:02:18]
planting
[1:02:20]
and doesn't does a lot of things
[1:02:23]
with um with those kinds of related
[1:02:27]
issues
[1:02:28]
but it's still all in the right way i
[1:02:30]
mean i don't know how you have
[1:02:33]
i guess we should actually speak to
[1:02:37]
one of these counties that are listed
[1:02:38]
here johnson musk
[1:02:40]
team scott benton iowa dallas
[1:02:43]
des moines henry and wapelo counties
[1:02:46]
have their wheat commissioners
[1:02:48]
on their county roadways so
[1:02:51]
henry and wappalow are smaller than
[1:02:55]
i think the rest of those
[1:02:58]
like scott county they they've got
[1:03:00]
probably three times as many staffers
[1:03:03]
well that's the thing that's the thing
[1:03:05]
if if
[1:03:07]
you reach out to these counties um
[1:03:11]
and i can call their county supervisors
[1:03:13]
and i can talk to mark at the next
[1:03:15]
school meeting okay the reason i say
[1:03:16]
that is is because i would like to know
[1:03:18]
whether or not they have somebody on
[1:03:20]
staff
[1:03:20]
time that does that what their policies
[1:03:24]
are before it's not going to be a
[1:03:27]
decision that i make but i think it's
[1:03:29]
information about me
[1:03:31]
because if we're talking if we're
[1:03:32]
talking about what we're doing with dan
[1:03:35]
and maybe we've taken advantage of dan
[1:03:37]
over the years but if we're talking
[1:03:38]
about what we're doing with dan as
[1:03:39]
opposed to
[1:03:40]
bringing a body on you know even
[1:03:43]
part-time
[1:03:44]
with benefits i in other words paying
[1:03:46]
the ideas paying me
[1:03:47]
um and maybe we've had the best of both
[1:03:50]
worlds here
[1:03:51]
i'm not saying that we haven't but um
[1:03:54]
here's an opportunity to get all your
[1:03:56]
ducks involved before you make a
[1:03:57]
decision
[1:03:58]
right and i know maybe that's not what
[1:04:01]
you want at this point but we're
[1:04:03]
you know we're about three and
[1:04:07]
we're starting we're not even through
[1:04:09]
the first
[1:04:10]
quarter of this fiscal year
[1:04:13]
so yeah no i didn't that might be one of
[1:04:17]
the decisions and that's fine i just
[1:04:19]
felt content
[1:04:20]
because i put environmental health first
[1:04:24]
and then
[1:04:26]
[Music]
[1:04:38]
and go ahead and talk to bruce let's see
[1:04:39]
what he says
[1:04:41]
so like you say now is a good time to
[1:04:42]
have a discussion so we can get some
[1:04:44]
information
[1:04:47]
so i will i'll do that what scott's
[1:04:50]
preference is
[1:04:52]
um
[1:05:07]
if you could just look those up and then
[1:05:09]
email me
[1:05:10]
well especially henry because that's one
[1:05:12]
yeah but i can call i can call
[1:05:14]
greg muller and i can call jerry parker
[1:05:17]
and get those answers
[1:05:18]
it's just you know or jim carrey for des
[1:05:21]
moines county in fact i have a meeting
[1:05:23]
with well not with jerry with reagan and
[1:05:27]
jim um about two weeks so i can bring that up you know as far as
[1:05:33]
that part goes
[1:05:34]
um
[1:05:40]
so we're going to reach out to those
[1:05:42]
folks
[1:05:44]
but it may be appropriate to to
[1:05:47]
reach out to the engineer's office
[1:06:03]
if they're reimbursed that way or if
[1:06:05]
that's just
[1:06:06]
a duty that's covered by the road
[1:06:08]
department
[1:06:09]
they may have an assistant a county
[1:06:12]
engineer to the assistant county
[1:06:13]
engineer i don't know
[1:06:16]
just they may have multiple duties of
[1:06:18]
course now aaron has mentioned that he's
[1:06:20]
got a couple hours a week that he's
[1:06:22]
trying to fill
[1:06:23]
so anyway one other thing
[1:06:28]
[Music]
[1:06:51]
they need to be certified because
[1:06:53]
they're actually uh
[1:06:55]
they're doing they're not they're not
[1:07:11]
so to operate the boomer you have to be
[1:07:15]
certified
[1:07:16]
uh because it it has some
[1:07:19]
amount of uh herbicide in the blades protecting the ground
[1:07:39]
looking for
[1:07:45]
there's certain properties where where
[1:07:48]
the county owns the land
[1:07:50]
next to the road so we take care of
[1:07:53]
those
[1:07:53]
but it would be an expansion of duties
[1:07:57]
to be
[1:07:58]
having to deal with private property
[1:08:00]
owners
[1:08:03]
and and nobody in the office was
[1:08:08]
certified
[1:08:10]
okay all right we'll bring this up later
[1:08:14]
and uh we'll have more discussion on it
[1:08:17]
before the
[1:08:18]
uh budget time starts thank you yep
[1:08:21]
thank you all right let's uh move on
[1:08:24]
to discuss and consider property tax
[1:08:27]
suspensions
[1:08:31]
um yeah that would be good
[1:09:13]
appears we have four of these
[1:09:16]
that we're looking at while we're still
[1:09:19]
waiting for mark
[1:09:21]
and this is the annual
[1:09:25]
oh and that yes sorry i
[1:09:28]
missed that one laying in my pile thank
[1:09:30]
you abby
[1:09:32]
i appreciate that so we have five
[1:09:35]
actually that we're looking at
[1:09:45]
all uh right talking about the
[1:09:49]
property tax suspensions
[1:09:52]
um we have four of them
[1:09:56]
laid out here that your office and one
[1:09:59]
that's a
[1:10:00]
written request um
[1:10:03]
[Music]
[1:10:04]
is there any comments or anything that
[1:10:07]
we need to know about this
[1:10:08]
and how this is going to reflect most of
[1:10:11]
it
[1:10:14]
um
[1:10:18]
but the ones from dhs are basically
[1:10:23]
right which are the four that we have
[1:10:26]
printed
[1:10:27]
from your offices okay so i would make a
[1:10:31]
motion
[1:10:31]
to approve those property tax
[1:10:33]
suspensions
[1:10:35]
uh that were eligible through dhs
[1:10:40]
okay we have four of them that were
[1:10:43]
approved through
[1:10:44]
dhs we have emotions from endemic and a
[1:10:47]
second from sandquist
[1:10:49]
to approve those all those in favor say
[1:10:52]
aye
[1:10:54]
all those opposed same sign motion
[1:10:56]
carries
[1:10:58]
all right now uh this one concerning the
[1:11:01]
johnsons
[1:11:06]
is there anything specific that we need
[1:11:09]
to know about this mark
[1:11:10]
that is coming through your office
[1:11:22]
no this was a written request
[1:11:26]
coming through this is the one that has
[1:11:28]
gone
[1:11:29]
through the usda it was best road
[1:11:32]
from a mortgage way back in the early
[1:11:34]
90s
[1:11:35]
and somehow we
[1:11:38]
were doing suspensions
[1:11:41]
as though they weren't through dhs after
[1:11:46]
quite a bit of looking into it
[1:11:50]
on our part we found that that is
[1:11:53]
supposed to be escrow
[1:11:54]
the usda is supposed to be taking care
[1:11:56]
of it so in that sense
[1:11:58]
mr johnson is correct the part that mr
[1:12:01]
johnson didn't understand was
[1:12:02]
he still opposed that but that's between
[1:12:05]
him and the usda
[1:12:06]
so these taxes should not be suspended
[1:12:09]
because the usda should be paying them
[1:12:12]
as they are
[1:12:13]
okay and the fact is is that he was
[1:12:16]
paying his monthly well
[1:12:18]
for state of uh
[1:12:22]
and they were supposed to be setting
[1:12:24]
aside x amount of dollars out of that
[1:12:26]
taxes they failed to do so it's his
[1:12:29]
property
[1:12:30]
so to speak and he's responsible for it
[1:12:34]
but he gave them the money this is
[1:12:37]
sorry i don't know no no that's fine
[1:12:39]
this wasn't the
[1:12:41]
same there was that guy that was in here
[1:12:46]
not long ago
[1:13:01]
no this is the one that comes every year
[1:13:06]
so it's good information to know that
[1:13:09]
yeah there was quite a bit of
[1:13:13]
a past new balance right that usda
[1:13:16]
has taken
[1:13:26]
so there's there's really no action that
[1:13:29]
the board can take when it comes to this
[1:13:31]
application
[1:13:32]
then that's what we're hearing doesn't
[1:13:34]
it
[1:13:35]
okay are you still on if we don't act on
[1:13:38]
it
[1:13:39]
yes pat is still with us yes make sure
[1:13:42]
do we just just simply by motion deny
[1:13:45]
the application or is there some warning that we need to include in
[1:13:48]
that or do we just not ask on that
[1:13:51]
right you can you cannot act on it you
[1:13:53]
can deny it you can do
[1:13:55]
either of those things
[1:14:08]
to deny the property tax expansion
[1:14:13]
for james and joanne johnson
[1:14:18]
based on the information that's part of
[1:14:21]
their escrow with investigating
[1:14:25]
all right i have a motion from dimmett a
[1:14:27]
second from sandquist
[1:14:28]
to deny this application from property
[1:14:31]
tax suspension
[1:14:32]
for james and jolene johnson
[1:14:36]
all those in favor say hi hi
[1:14:40]
all those opposed same sign motion
[1:14:43]
carries
[1:14:45]
so thank you very much mark i appreciate
[1:14:48]
the information that you gave us
[1:14:53]
okay now we'll move on to make committee
[1:14:58]
reports
[1:15:03]
they're working on establishing
[1:15:06]
community
[1:15:09]
in a indicators survey which they
[1:15:11]
typically do
[1:15:13]
some examples are for some of the
[1:15:14]
children of poland organizations and out
[1:15:17]
of three counties support jefferson
[1:15:18]
county's
[1:15:19]
lowest lifers grandmother received
[1:15:24]
during first trimester children are in
[1:15:27]
kindergarten with preschool experience
[1:15:30]
and there's several of these but um this
[1:15:32]
is the kind of thing that they
[1:15:35]
look at with their indicators of success
[1:15:39]
basically
[1:15:40]
so i thought that might be of interest
[1:15:43]
um
[1:15:43]
[Music]
[1:15:44]
then i also had brilliant
[1:15:48]
summit which was through the iowa rural
[1:15:52]
development commission
[1:15:53]
with um joshua
[1:15:58]
and that was virtual this year normally
[1:16:01]
it would be somewhere
[1:16:02]
up north but it turned it was thursday
[1:16:05]
and friday so it was
[1:16:06]
informative to learn what other
[1:16:08]
communities are doing and
[1:16:10]
some of the innovative things going on
[1:16:13]
um
[1:16:14]
met with
[1:16:15]
[Music]
[1:16:17]
a citizen and a person is the marketing
[1:16:20]
director for the well who's coming
[1:16:22]
um to fairfield and of course code has
[1:16:25]
slowed them down they kind of
[1:16:27]
we're going to announce right around
[1:16:28]
koga then they have announced now but
[1:16:30]
they're coming and so
[1:16:31]
they wanted to meet with me about
[1:16:34]
poverty and resources and things like
[1:16:36]
that in careful so i spent some time
[1:16:38]
with them the other day
[1:16:40]
and gave them information about that
[1:16:45]
food insecurity um
[1:16:49]
and workforce development they're down
[1:16:51]
to
[1:16:53]
we need and workforce development local
[1:16:55]
board which is
[1:16:56]
like 14 counties so it's not local as in
[1:16:59]
jefferson county
[1:17:01]
but the way it's being redundant which
[1:17:04]
is good 51
[1:17:05]
of the members need to be businesses
[1:17:07]
which is great that's the way it should
[1:17:09]
be
[1:17:10]
and they need two more businesses i
[1:17:12]
asked one in town and they weren't able
[1:17:14]
to
[1:17:15]
right now put their time commitments
[1:17:20]
that they need females because with any
[1:17:23]
of these boards like this you need to
[1:17:24]
have a gender balance and other
[1:17:26]
requirements of the state
[1:17:28]
so if there's any businesses out there
[1:17:30]
that are interested in this most of it's
[1:17:32]
virtual right now
[1:17:34]
um please let me know
[1:17:37]
lee um i think
[1:17:41]
nothing you're sharing met with the
[1:17:43]
steve at the radio station last week and
[1:17:45]
i think
[1:17:47]
if my calculations are correct you will
[1:17:49]
meet next month
[1:17:51]
i'll meet in october because you still
[1:17:53]
won't be eligible so
[1:17:55]
um that will be my small song okay
[1:17:58]
all right thank you for doing that lee
[1:18:01]
i've been on the month before so i
[1:18:03]
thought it would be good if we had
[1:18:05]
making parents up there uh i had a
[1:18:08]
meeting with
[1:18:09]
uh semco this week
[1:18:12]
we had a public hearing off of
[1:18:16]
through an environmental engineering
[1:18:18]
firm that
[1:18:19]
tracks movement of
[1:18:22]
ground gas through monitoring wells
[1:18:26]
and we have found that
[1:18:29]
we only have one monitoring well out
[1:18:31]
there that has
[1:18:33]
a hazard of methane gas
[1:18:36]
leaching through it we have put into
[1:18:40]
place mitigation
[1:18:41]
strategy so that we can uh
[1:18:44]
monitor the wealth more closely and find
[1:18:47]
out how far
[1:18:48]
that contamination spreads
[1:18:52]
it's in keokuk county that's that's
[1:18:55]
where the landfill is
[1:18:56]
at uh sits right it's
[1:19:00]
well on the site uh the wells are are
[1:19:02]
placed on the perimeter of the site
[1:19:04]
so that they can monitor what is running
[1:19:07]
out from
[1:19:08]
the landfill there are some cells that
[1:19:10]
aren't lined
[1:19:12]
out there and those are the ones that
[1:19:13]
are being monitored more closely than
[1:19:15]
the ones that are lined uh they also look for leakage
[1:19:20]
which is
[1:19:22]
biomaterial that that flows through the
[1:19:24]
ground along with it
[1:19:26]
we do a real good job of collecting that
[1:19:29]
putting it into
[1:19:30]
a retaining pond and then pumping that
[1:19:33]
pond and taking it to
[1:19:35]
different sewage treatment facilities in
[1:19:37]
order to be able to have that
[1:19:38]
process to go back out into the
[1:19:40]
environment at that point in time
[1:19:42]
so where's nothing coming from do i know
[1:19:44]
for sure um the methane comes
[1:19:46]
from the decomposition of material out
[1:19:49]
there
[1:19:50]
in the fill and what i'm doing that is
[1:19:53]
in my
[1:19:53]
work with food waste we send so much
[1:19:56]
food waste
[1:19:58]
to the landfill that that's
[1:20:01]
can be a cause
[1:20:10]
[Music]
[1:20:11]
a root cause of what causes that
[1:20:14]
what brings that methane out but um
[1:20:18]
it is something that can be recommended
[1:20:20]
to the public that if they've got
[1:20:22]
food waste such as potato peelings or
[1:20:25]
cucumber peelings or whatever try to
[1:20:28]
compost that yourself
[1:20:30]
on site rather than running it down a
[1:20:32]
garbage disposer
[1:20:34]
or putting it into the trash to be taken
[1:20:36]
away by the
[1:20:39]
trash outlet that we have here in the
[1:20:42]
community and other communities around
[1:20:44]
um the the one key
[1:20:48]
thing that that the environmental
[1:20:50]
engineer
[1:20:51]
said and he works for a large number
[1:20:55]
of landfills across the state of iowa
[1:21:00]
we are the only landfill that over the
[1:21:02]
last five-year time period have been
[1:21:05]
able to lower
[1:21:06]
our tipping fees because of how the
[1:21:08]
waste is handled
[1:21:10]
out at our landfill and he says that screams volumes about the people
[1:21:16]
that
[1:21:17]
we have in place out there to not only
[1:21:19]
be the contractor for the site
[1:21:21]
to compact all the trash and to monitor
[1:21:24]
the cells and the life of the cells
[1:21:27]
as well as the director that we have on
[1:21:29]
site out there
[1:21:31]
we do very well we're pretty much a
[1:21:34]
zero gain when it comes to
[1:21:37]
money that's taken into the landfill we
[1:21:39]
have to put money aside for
[1:21:42]
future cells that may be put online or
[1:21:45]
have to be constructed
[1:21:47]
and purchase surrounding
[1:21:51]
land to the landfill in order to do that
[1:21:54]
right now the neighbors were all
[1:21:56]
notified um
[1:21:58]
within what was it uh anybody that's
[1:22:01]
within
[1:22:04]
250 or 300 feet of the landfill itself
[1:22:08]
as a neighboring property owner who was
[1:22:09]
notified of this public
[1:22:11]
meeting we only had one person that was
[1:22:13]
there and that's
[1:22:14]
uh mike hadley who is also on the board
[1:22:17]
he's the supervisor in keokuk county
[1:22:20]
um he has property that sits right next
[1:22:23]
to the landfill itself and
[1:22:25]
he says he's had no no problems with
[1:22:28]
what's been going on
[1:22:29]
over the years out there and uh we have
[1:22:32]
been doing
[1:22:33]
really well and we
[1:22:36]
are already discussing whether we want
[1:22:38]
to change our meetings from
[1:22:40]
monthly to quarterly because
[1:22:44]
uh at one time a monthly meeting was
[1:22:47]
necessary because
[1:22:49]
things were kind of in a disarray out
[1:22:51]
there
[1:22:52]
and now with the leadership that we have
[1:22:54]
we feel more comfortable
[1:22:55]
that if we don't necessarily have any
[1:22:58]
item that truly needs to be
[1:23:00]
on discussion at that meeting that we
[1:23:03]
not have a meeting that month
[1:23:05]
we also found that through this coded
[1:23:07]
time period
[1:23:08]
that a quarterly meeting was more
[1:23:11]
effective
[1:23:12]
for us so i think we're we're
[1:23:15]
trying to at least think about moving
[1:23:17]
that direction
[1:23:19]
so the landfill has been doing good you
[1:23:22]
can still
[1:23:24]
as a private individual you can still
[1:23:26]
take your garbage out
[1:23:28]
the landfill if you clean out your house
[1:23:30]
you want to get rid of it all
[1:23:31]
take it out there you can um it's good
[1:23:34]
if you call
[1:23:35]
ahead of time they will accommodate you
[1:23:38]
if you show up
[1:23:39]
gate now previously they weren't doing
[1:23:41]
that because
[1:23:42]
of coven restrictions and
[1:23:45]
the staff out there is
[1:23:49]
five total people so
[1:23:53]
if someone was having to come down with
[1:23:55]
something then the whole staff would be
[1:23:57]
quarantined which means the whole
[1:23:59]
landfill would be quarantined which
[1:24:00]
means
[1:24:01]
nothing would come in even from
[1:24:03]
commercial haulers
[1:24:04]
in that case so we found that there's
[1:24:08]
a lot of a lot of electronic means that
[1:24:13]
we've utilized during this covid time
[1:24:15]
period that allows
[1:24:16]
truck drivers to stay in their trucks
[1:24:18]
people that bring
[1:24:19]
trash out to stay in their vehicles
[1:24:22]
while it's being taken off
[1:24:24]
by the workers there at the plant
[1:24:28]
you don't have to hand them a ticket any
[1:24:31]
longer they can get the tickets
[1:24:32]
electronically for what they brought out
[1:24:35]
for weight and cost and all of that you
[1:24:38]
can also pay
[1:24:39]
either there or you can pay
[1:24:41]
electronically now
[1:24:43]
for that so we will continue those types of
[1:24:50]
activities
[1:24:51]
and move more towards a quote hands-free
[1:24:56]
situation when it comes to people
[1:24:58]
bringing in waste and leaving the site so uh
[1:25:03]
those those are some real positives that
[1:25:05]
we came from
[1:25:07]
not only the review that we do uh with
[1:25:10]
our
[1:25:10]
environmental engineer for the site but
[1:25:12]
as well as
[1:25:13]
site management and bill slu
[1:25:16]
so i think we we do extremely well out
[1:25:20]
there
[1:25:21]
all right um we'll move on to any public
[1:25:24]
comments that we might have here
[1:25:28]
anything you'd like to comment on i
[1:25:30]
guess
[1:25:31]
sure um
[1:25:50]
and i'm used to
[1:26:01]
and and you know listed out some things
[1:26:05]
may be true
[1:26:10]
[Music]
[1:26:20]
i thought that i was always free to be
[1:26:22]
able to
[1:26:23]
do whatever i wanted to in the country
[1:26:26]
um
[1:26:27]
and so not only does it come as a shock
[1:26:30]
but
[1:26:31]
you know it's it's being it's i feel
[1:26:33]
like it's being forced on me
[1:26:36]
you know that's being posed on me and if
[1:26:39]
i don't do it
[1:26:40]
i'm threatened with a fight
[1:26:43]
or a video so i'm trying to adjust to that
[1:27:02]
um
[1:27:06]
start cleaning it up but at the same
[1:27:09]
time i'm wondering
[1:27:10]
and why why is there this ordinance is it
[1:27:26]
necessary
[1:27:28]
can people who live in their country
[1:27:33]
remotely i'm at the end of the ground
[1:27:36]
road there might be one or two cars that
[1:27:39]
come down that road each day
[1:27:43]
and i have one neighbor
[1:27:53]
and i don't expect
[1:27:56]
to talk with lee on that with
[1:28:00]
i don't expect any special treatment you
[1:28:02]
know because of my situation or whatever
[1:28:04]
i know you have to handle it equally for
[1:28:08]
everybody
[1:28:09]
if you're going to have an ordinance it
[1:28:10]
has to be across the line
[1:28:13]
so um so i'm wondering is it possible
[1:28:16]
that you guys can consider
[1:28:19]
this ordinance is it totally necessary
[1:28:23]
is it cost worthy
[1:28:25]
or is it something that needs to be
[1:28:27]
there
[1:28:29]
so that's that's my question
[1:28:33]
is it something that should be willing
[1:28:34]
to consider
[1:28:37]
is it productive you know is it
[1:28:40]
that's a great question yeah i mean
[1:28:43]
there's a lot of people who won't live
[1:28:45]
in the country
[1:28:46]
and not be bothered by anybody you know
[1:28:51]
that's the 64-hour question um when you
[1:28:55]
weigh that against the cost
[1:28:57]
um that's something you know it's an
[1:28:59]
actual question one that we've arm
[1:29:01]
wrestled with not just this
[1:29:04]
makeup on previous boards um as
[1:29:07]
i indicated to you during our
[1:29:09]
conversation uh my problem has always
[1:29:12]
been and
[1:29:13]
i'm sure pat's still listening he gets
[1:29:15]
tired of listening to me but nonetheless
[1:29:18]
i've always been
[1:29:22]
i've never had a dog in the hunt if you
[1:29:24]
want to repeal it or if we don't want to
[1:29:26]
enforce it then let's repeat it it's
[1:29:27]
always been my mantra but if we're not going to
[1:29:31]
repeat it then it has to be enforced
[1:29:34]
equally equal application and
[1:29:37]
we can't in my estimation i may be wrong
[1:29:40]
but in my estimation if it's in the
[1:29:43]
unincorporated areas of the county which
[1:29:45]
is where the ordinance applies
[1:29:47]
i can't make the distinction of whether
[1:29:49]
or not you're on the end of a gravel
[1:29:50]
road or you have a neighbor
[1:29:53]
and by definition that definition is
[1:29:56]
what's outlined in the nuisance
[1:29:58]
so if i have a neighbor on the one hand
[1:30:01]
whose property is is not congested with vehicles with
[1:30:06]
weeds with dilapidated buildings
[1:30:09]
it directly affects the value of their
[1:30:11]
property i can verify that through the
[1:30:13]
county assessor's office it has an
[1:30:14]
impact
[1:30:16]
plus you know it also
[1:30:20]
we had one down here in the southwest
[1:30:21]
corner of
[1:30:24]
town actually it's actually surrounded
[1:30:25]
by town but it's one of those
[1:30:27]
islands that we talk about
[1:30:31]
the property was absolutely at one point
[1:30:33]
was a gorgeous property but
[1:30:35]
this this individual had a passion for
[1:30:37]
bringing things in
[1:30:38]
we drove it wrong i mean it was and yet
[1:30:42]
there was a three four hundred thousand
[1:30:44]
dollar home next to it
[1:30:45]
that was being impacted
[1:30:49]
by it but if i tell this individual that
[1:30:52]
you have to remove the cars you have to
[1:30:54]
do this
[1:30:55]
in terms of equal application i don't
[1:30:57]
see how i can make a distinction
[1:30:59]
based on definition as to where
[1:31:03]
that nuisance is located if it's defined
[1:31:06]
as a nuisance in the ordinance it's a
[1:31:08]
nuisance whether it's at the end of the
[1:31:09]
road
[1:31:10]
or whether you have a neighbor and
[1:31:12]
conversely
[1:31:15]
i have a property down in what i call
[1:31:18]
the darkest parts of the continent just
[1:31:20]
north of the mountaineer county line
[1:31:22]
there's no neighbor down there
[1:31:24]
uh as far as living there's there's a
[1:31:27]
property owner to the south there that
[1:31:28]
owns some land
[1:31:31]
um but the property is
[1:31:34]
you know overgrown vehicles some of them
[1:31:36]
were in the in the right of way
[1:31:37]
so on and so forth but that person has
[1:31:41]
exactly the same
[1:31:44]
almost identical set of circumstances
[1:31:46]
that you do
[1:31:47]
it turns up nobody around to complain
[1:31:52]
so for me personally i'm not speaking to
[1:31:55]
the other two for me personally
[1:31:57]
if we're going to have it it has to be
[1:32:00]
applied equally to everybody in the
[1:32:02]
county irrespective of what their
[1:32:05]
location is in terms of absent that
[1:32:10]
if you ask me um
[1:32:13]
am i opposed to repeating it i think it
[1:32:17]
serves a purpose
[1:32:18]
but only if we apply it equally well the
[1:32:20]
other piece of that
[1:32:22]
and pat maybe you can add the detail
[1:32:25]
there is a state
[1:32:26]
law that also has
[1:32:29]
pieces of the ordinance so even if we
[1:32:32]
repealed the ordinance
[1:32:34]
there still are certain i believe it's
[1:32:36]
health and safety
[1:32:38]
requirements that everybody has to have
[1:32:41]
i don't know your specific items if it's
[1:32:44]
a health
[1:32:45]
but um so that that would still be the
[1:32:49]
case
[1:32:52]
and we do have to uh and i mean i've not
[1:32:55]
been out
[1:32:56]
to your place so i don't know if it
[1:32:58]
necessarily applies but there are
[1:32:59]
hazardous substances which actually
[1:33:02]
includes you know combustible items
[1:33:06]
and so um i think that goes
[1:33:10]
into what b said yeah
[1:33:14]
so um
[1:33:19]
again if if you want like like i said to
[1:33:21]
you
[1:33:22]
yes you have the right to appeal um
[1:33:25]
the appeal would be centered around
[1:33:27]
excuse me the items listed
[1:33:29]
in your letter as to whether or not
[1:33:31]
those nuisance exists
[1:33:33]
by definition and that's what we would
[1:33:35]
go by is that nuisance defined and if it is
[1:33:39]
then
[1:33:40]
it's in the stance we
[1:33:44]
as far as as far as timelines go as i
[1:33:47]
indicated to you and i also talked to
[1:33:50]
our compliance officer about this
[1:33:52]
he's an agreement as long as you're
[1:33:55]
showing progress
[1:33:56]
we're not going to put the hand down as
[1:33:58]
far as that partner goes
[1:34:00]
it's when we get ignored or we don't
[1:34:02]
show up in court or
[1:34:03]
whatever those situations are but we
[1:34:05]
have to move to the next step
[1:34:08]
we're asking you to mitigate the
[1:34:09]
nuisance but we're also well aware that
[1:34:11]
sometimes
[1:34:12]
that mitigation process is not something
[1:34:14]
that can be done day after tomorrow
[1:34:27]
this is my first term so we started
[1:34:30]
it was more to only so what happened we
[1:34:33]
got an
[1:34:34]
increased number of complaints so many
[1:34:38]
that the year i was chair i think i had
[1:34:41]
like 23 letters at least now because the
[1:34:43]
board
[1:34:44]
did all these and we thought
[1:34:47]
we need a better system if we're going
[1:34:49]
to get all these complaints so that we're fair and
[1:34:53]
not you know we have somebody that
[1:34:55]
this is what they do so we contracted
[1:34:58]
with russ
[1:34:59]
so we're trying to now that we have a
[1:35:03]
process in place that's more
[1:35:06]
objective and not subjective then
[1:35:09]
there will be a time when you need to
[1:35:11]
evaluate that and say okay
[1:35:13]
is it worth the money we're spending on
[1:35:16]
that
[1:35:16]
and the other side of that is some of
[1:35:19]
the complaints come from this we've
[1:35:21]
already
[1:35:22]
mentioned the neighbors and in your case
[1:35:25]
that's not an issue
[1:35:26]
but someday if you have a different
[1:35:28]
neighbor it could become one
[1:35:30]
so this is probably one of the most
[1:35:32]
challenges that we get because
[1:35:35]
it's difficult you know it really
[1:35:40]
don't live out is
[1:35:45]
we moved into town my wife was dying of
[1:35:48]
cancer in
[1:35:50]
2000. she moved into town for a small
[1:35:53]
period of time
[1:35:54]
she passed away and then my son and i
[1:35:57]
moved
[1:35:57]
back out there and then
[1:36:01]
we were out there for a while and he was young when she died
[1:36:23]
out of the house one thing oh and go
[1:36:25]
back out there
[1:36:26]
so i'm in the process now i'm trying to
[1:36:28]
build something
[1:36:29]
out there
[1:36:33]
so and all my feelings
[1:36:36]
once i'm living out there taking care of
[1:36:39]
stuff
[1:36:41]
but right now it's in transition well
[1:36:44]
for the immediate it sounds like you
[1:36:45]
have a work hard and that's great
[1:36:47]
yeah yeah so that's gonna show
[1:37:02]
one we wanted it to be looked at black
[1:37:04]
and white
[1:37:06]
and the reason for that is is because
[1:37:08]
you and i are
[1:37:09]
long time friends and it's difficult if
[1:37:13]
not
[1:37:13]
impossible to look at you objectively
[1:37:17]
because relationship okay
[1:37:20]
and or if we had just say scott for
[1:37:23]
example
[1:37:24]
okay being a county engineer and then
[1:37:27]
how do i
[1:37:27]
enforce a complaint that i get
[1:37:31]
from this individual then this
[1:37:33]
individual says well wait a minute
[1:37:35]
you didn't do anything about dinner
[1:37:38]
okay and i think that would concur then
[1:37:42]
that
[1:37:43]
really your legal legs don't really
[1:37:45]
exist at that point and it it did as
[1:37:49]
de-indicated took the burden off of us
[1:37:50]
the subjectiveness of it off of us and
[1:37:53]
gave it to an individual who just
[1:37:55]
strictly looks at it in black and white
[1:37:57]
terms
[1:37:58]
and so therefore it's applied equally i
[1:38:00]
go back to my original statement um i
[1:38:05]
do believe that it's necessary it
[1:38:07]
wouldn't break my heart if it was
[1:38:08]
repealed
[1:38:10]
only in the context that if we're not
[1:38:12]
going to apply it equally to everybody
[1:38:14]
we're going to pick and choose then i
[1:38:16]
don't want it but if we're going to have
[1:38:18]
it
[1:38:19]
then we've got to apply it equally
[1:38:20]
across yeah
[1:38:42]
well you're not the lone ranger we've
[1:38:44]
had lots of conversations
[1:38:46]
uh and you know uh
[1:38:50]
if you got a few minutes before you
[1:38:52]
leave i mean before you
[1:38:53]
go to where take a drive out west on old
[1:38:56]
34
[1:38:58]
um on the south side of the road you
[1:39:01]
can't
[1:39:02]
miss it okay so this has been an ongoing
[1:39:06]
problem that we've been trying to
[1:39:07]
correct
[1:39:08]
and it to me epitomizes the issue
[1:39:11]
but for us to have any enforcement
[1:39:13]
leverage
[1:39:14]
on that property we have to be
[1:39:18]
even-handed with everybody else
[1:39:24]
you go it's just beyond where you turned
[1:39:27]
south to go straight
[1:39:28]
south into libertyville um it's it's
[1:39:31]
over the railroad bridge and then off on
[1:39:33]
the left-hand side
[1:39:34]
yeah that's the thrill of
[1:39:38]
[Music]
[1:39:52]
yeah yeah you go underneath the freeway
[1:39:54]
you keep going
[1:39:55]
to the west as 34 used to go to ottumwa
[1:39:59]
uh you go across the burlington northern
[1:40:02]
bridge
[1:40:03]
there the the libertyville corner is
[1:40:05]
just uh before the
[1:40:07]
bridge that goes over the railroad
[1:40:09]
tracks once you're over that bridge
[1:40:11]
it's off on the left-hand side about
[1:40:13]
three houses down
[1:40:16]
and it's like lee said you cannot
[1:40:19]
miss it when you drive
[1:40:31]
it's what we deal with
[1:40:38]
so um yeah you're welcome
[1:40:41]
thanks for coming in and and talking
[1:40:43]
about it
[1:40:44]
well i really enjoyed sitting here
[1:40:48]
watching you guys
[1:40:52]
all right okay um i would accept a
[1:40:55]
motion to allow claims and approve
[1:40:57]
reports
[1:40:59]
okay i have a motion from dimmitt a
[1:41:01]
second from sandquist
[1:41:02]
all those in favor say aye hi all those
[1:41:05]
opposed same sign
[1:41:07]
motion carries uh discuss and consider
[1:41:10]
nuisance properties
[1:41:13]
i mean pat and i have been going back
[1:41:15]
and forth about
[1:41:18]
extracurricular uh enforcement issues
[1:41:23]
he's worked very hard i don't know that
[1:41:26]
we're at a point where we can
[1:41:28]
my overriding concern is that
[1:41:32]
we some power or another put a process
[1:41:35]
in place i mean we've got the oranges i
[1:41:36]
think it spells it out
[1:41:37]
pat like say has been working on it um
[1:41:41]
but i think the board now has to decide
[1:41:44]
how much
[1:41:45]
they're willing to expend on some of
[1:41:48]
these properties
[1:41:49]
that have not come into compliance in
[1:41:52]
some cases
[1:41:53]
for extended periods of time were being
[1:41:55]
ignored
[1:41:56]
even though they've been fined when
[1:41:57]
there's been a judgment issue it's as
[1:42:00]
i'm pat's going to shoot me for this but
[1:42:03]
um the ongoing
[1:42:07]
uh as far as i'm concerned it's an
[1:42:09]
emergency exist by reason of the
[1:42:11]
continuing maintenance of the nuisance
[1:42:13]
as far as i'm certain a perfect example
[1:42:15]
out west of town that's continuing
[1:42:17]
maintenance
[1:42:19]
and um i think that we have
[1:42:22]
we've given them notice to abate uh they
[1:42:25]
were
[1:42:26]
they did
[1:42:41]
we can remove that private property and
[1:42:44]
i don't know the answer to that
[1:42:52]
okay so that concludes
[1:42:57]
the meeting here in the office we are
[1:43:00]
having a road tour this morning
[1:43:02]
with the county engineer to go out and
[1:43:05]
look at some
[1:43:07]
problems or positives that are out there
[1:43:09]
that have been going on with us i'd like
[1:43:11]
to thank everybody for joining us for
[1:43:13]
the meeting today
[1:43:14]
and uh we'll get this posted up thank
[1:43:17]
you
[1:43:22]
i have a motion from dimmitt from
[1:43:24]
sandquist to adjourn
[1:43:26]
all those in favor say aye aye all those
[1:43:29]
opposed same
[1:43:30]
sign motion carries
