[2:21] all too often council members are using the platform

[2:25] to use their authority to project things other than what's on the agenda

[2:31] and during this item at the last council meeting

[2:35] during announcements section

[2:38] the residents were subjected to a pathetic narrative by councilman grant

[2:44] what sounded to me like a cry for sympathy as he feels he has been

[2:49] inappropriately attacked by some individuals

[2:53] i took offense that he specifically called me out by name in this matter

[2:59] i took offense because while i was on council

[3:04] with mr grant myself my family

[3:08] including minor children were wrongly subjected to a character

[3:12] assassination campaign in an attempt to delegitimize me as a

[3:17] council person in this community actions

[3:22] at the last meeting that were characterized by you mr grant

[3:26] as lowest of the low yet at a council meeting

[3:31] while miss pierce was mayor i addressed this matter and i was told

[3:36] by mayor pierce that there would be no apology

[3:39] and in the announcement portion when you spoke mr grant you condoned

[3:45] that which you called lowest of the low behavior

[3:48] by stating directly to me that i deserved everything that i got

[3:55] madame mayor if you want to move this city forward in a positive direction

[4:00] you will need to improve the character and culture that has pervaded this body

[4:05] for far too long thank you very much have a good evening thank you mr romans

[4:47] they're law enforcement they don't have the authority to kick me out of this

[5:53] have a right to ask those questions

[5:58] michael can't talk so i have questions like for instance

[6:02] why did the police call dr kaufman a primary care physician

[6:06] who quote was ready to sign a death certificate without hesitation

[6:10] when michael was not on hospice at seven in the morning dr kaufman is my

[6:15] doctor one of the dirtiest doctors around

[6:20] why did the police call the me's office and tell them we got a death certificate

[6:24] that's going to be signed

[6:27] that resulted in the emmy not coming out and i don't know if you know this but

[6:32] texas law requires on a death

[6:36] that is not hospice for a medical examiner inquisition or

[6:41] inquest to be made an autopsy to be performed

[6:47] he was found according to the police report with a lamp cord wrapped around

[6:50] his arm that's according to the police

[10:42] on what was said and the lies that were made

[10:46] you know you can't just accuse people of doing something without them saying

[10:52] they're going to do it so if the council member who said that a

[10:58] situation would correct himself um as far as the agendas goes i wish it

[11:05] would be uh spoken first then have a discussion

[11:59] good afternoon council tonight i would like to bring to your attention to city

[12:03] staff mistakes and issues that have been arisen due to our city staff at city

[12:08] hall accountability needs to start with our

[12:11] city staff who are the purveyors of information

[12:14] and make decisions that affect council and residents our city secretary has

[12:19] been dodging questions i have been asking by stating that she will answer

[12:23] them without a timeline or without ever reaching out to answer them

[12:28] she has also been writing minutes in such a manner that they don't seem to

[12:32] explain the actuality of what's occurring at the meeting

[12:36] and in certain times left whole things out altogether of which you guys are

[12:41] aware of because mr roman stated as such and no one would vote on those minutes

[12:47] and the capacity as our election official we have seen a huge misuse of

[12:52] power which was aided by a council majority

[12:57] but what needs to talked about and brought up is how our election

[13:02] officials was persuaded to place documentation in the election packet as

[13:07] well as send me a letter stating that i could not be on the ballot which were

[13:12] both wrongfully done i have begun the process of writing the

[13:16] ag's office and secretary of state about these matters and have shown evidence

[13:21] that some senior counsel and senior staff have essentially colluded against

[13:26] our charter to fulfill their own agendas my request tonight is simply a way to

[13:31] notify you as counsel that the process has begun to gather evidence to prove

[13:37] that due to a council majority that nothing will be done to hold

[13:41] accountable those who are doing your your bidding

[13:45] no matter how bad their wrongdoing i tell you that there is a part of the

[13:51] charter article 2 at section 2.16 that allows for you to create an

[13:57] investigative body to inquire into the conduct

[14:01] of any employee and therefore a chance to question the bad conduct and

[14:07] mistakes and act accordingly i have no expectations that this council majority

[14:13] will actually follow through with the this request

[14:18] but by not doing anything it will further my evidence that there are

[14:22] people on this majority who have better access to city services

[14:27] as our city attorney and the employees in city hall including our city managers

[14:32] the secretary and election official all do the bidding of a senior council

[14:38] majority and as a favor never get held accountable to their misdeeds i would

[14:43] like for you to place on the next agenda to discuss having an investigative body

[14:48] as per our charter to look into the misdeeds and mistakes of our city

[14:52] secretary and our election official and hold them accountable to

[15:00] thank you patty you're welcome

[15:04] moving on to 6a fair county appraisal district and property tax system

[15:18] good evening uh my name is michael lamesky i'm the

[15:21] chief appraiser for the bear appraisal district

[15:24] um i believe they sent some handouts for

[15:27] you yes um just wanted to go real quickly over the first pages just some

[15:31] bear county statistics uh for this year uh this reappraisal

[15:36] year values countywide are up roughly 22

[15:43] for total market value that's not including any exemptions or anything of

[15:47] that sort that's just a market value increase

[15:50] if we look at the calendar year from 2020 to 2021

[15:54] according to the real estate center at texas a m university the average selling

[15:58] price of a home went from 273 to 312 000.

[16:03] our average price now is somewhere around 309 bear county

[16:07] throughout the entire county one of the most incredible things about

[16:12] this year i think that when the pandemic first started everybody expected

[16:16] everything to pull back just like business had to

[16:20] that nothing could be further from the truth with respect to real estate values

[16:24] and the availability of supplies to build new improvements commercially or

[16:29] residentially and so

[16:31] i think that a lot of these things plus the influx of people moving into texas

[16:35] something like a thousand every day uh has caused there to be an extreme

[16:39] housing shortage i think anybody would recognize that that's the case

[16:44] um our commercial values are up roughly 18

[16:48] these are county-wide numbers and so um

[16:52] being somewhat familiar with kirby you actually won't see those kinds of

[16:55] increases commercially but i know that residentially the average value of a

[17:00] homestead in kirby is projected to be about 175 000 this year

[17:06] there's just not a whole lot listed for sale

[17:08] in that price range

[17:12] there is one correction on that front page you may or may not have heard but

[17:17] we had a ransomware attack at our office this week

[17:20] and so we push back the date to mail notices from april 1st to april the 8th

[17:26] taxpayers will still have about five weeks to file their protest the protest

[17:31] deadline is may 15th by law

[17:35] the protests will actually be extended to the 16th since the 15th falls on a

[17:39] weekend the next several pages just show

[17:43] multiple years of how the red line would be according to the real estate center

[17:48] at texas a m university this chart will show

[17:51] values doing this basically since 2011. our values would be the values in green

[17:58] and you'll see that we've been tracking that value very closely

[18:02] uh never any closer than this year as i say the average selling price of a

[18:06] residence homestead was three hundred and twelve thousand five fifty five the

[18:10] average value on the roll is 309 118. if you look at the next page

[18:17] talks about the average residential sales price by year by county

[18:21] and essentially you can see at the very top of the page is travis county that's

[18:26] austin texas and williamson county with the highest prices it almost well

[18:31] more than double the average selling price here in bexar county while bear

[18:34] county remains affordable the majority of our major

[18:38] taxing jurisdictions don't offer a additional

[18:44] local option homestead exemption if you will

[18:47] in austin dallas houston most of their cities the counties offer a 20 percent

[18:53] even in comal county in new braunfels they offer a 20

[18:57] local option homestead exemption for the city as well as a county

[19:01] now in bear county one of the things that we do have going for us that is

[19:04] atypical of large metros in texas is is that the big four taxing jurisdiction is

[19:10] what i call them which is the city the county the school and the community

[19:13] college district they all freeze currently

[19:16] so if you're an over 65 senior your taxes

[19:20] are frozen for those four jurisdictions irrespective of what happens to the

[19:23] value or the tax rates

[19:29] the last page just shows again the

[19:32] median residential sales price by all counties and again bear county is

[19:37] the most affordable of all of them but that median has crept up to two

[19:43] and so if you'll just look in 2005 value

[19:48] in your city was 188 million 733 000 about 2014 it had climbed more than

[19:55] double well almost doubled uh to 223 900 000.

[20:01] if you look at uh the projection for 2022

[20:05] it's 618 million 454 617 or roughly

[20:13] 26.75 over last year

[20:16] the very last column shows that your city has done a pretty good job in terms

[20:19] of adjusting the tax rate as it needs to when values are high tax rates are

[20:24] supposed to come down y'all have been pretty true to that

[20:29] if you look at the the last column

[20:32] the estimated change in levy is projected to go up by more than 20

[20:38] if that tax rate remains the same as it was last year and that's just for your

[20:42] information the value history the estimated tax levy

[20:47] is all there at the bottom of the page one of the things that i wanted to

[20:51] mention to you is oftentimes get asked what are we

[20:55] supposed to do with these increasing property values

[21:00] and that was a really interesting article written by ross ramsey in the

[21:03] texas tribune and the crux of it was

[21:07] elected officials who get elected every two years to the state legislature and

[21:11] say they're going to fight to lower your property taxes i've been in this

[21:14] business for 40 years i'm about a year and a half away from retiring i'll be

[21:19] 62. i can tell you right now

[21:23] every year since i've been in this business and i've done everything you

[21:26] can from moppa floor to be the chief appraiser at my office i can tell you

[21:30] that i've never seen the legislature do anything below the property taxes

[21:35] you have to understand the relationship of property taxes school funding and how

[21:41] it impacts local homeowners it makes for a really good bumper sticker

[21:46] but it does not help any homeowners the bottom line is every time the values

[21:52] go up and the tax rates don't come down that's more money to the state

[21:57] in this year's state budget they are projected to take in

[22:01] 6.75 billion dollars more than they did in the last biennium

[22:09] the more money they take in the less money they put into local schools the

[22:13] more local tax rates have to come up that's probably a conversation for

[22:19] another meeting and i will say before i leave i've given you all my cards

[22:24] on the back of that card is jennifer she's my executive assistant if you need

[22:28] a town hall if your residents feel like they want to talk to us here

[22:33] we'll come back we'll do that and we'll talk specifically about how to file a

[22:38] protest there is some protest information in

[22:40] there that i do want to share with you because she was kind enough to print it

[22:43] out and that would be this document this is

[22:47] just the basic protest form and most importantly

[22:51] she highlighted for you with red arrows the most important

[22:55] things that taxpayers need to remember to do and that is to check off what

[22:58] reason you're protesting every time you're going to check off it's over

[23:02] market it's too high and it's not equally appraised just do it

[23:06] the next thing you're going to want to do is to make sure and

[23:10] uh let us know how you want to handle this meeting do you want it in english

[23:13] do you want it in spanish do you want to do it in person do you want to do it via

[23:17] zoom or webex or by telephone either way we'll accommodate anything we are going

[23:22] to be working remotely at the beginning to try to get the vast

[23:26] majority of these things done i think last year we only had 600 live persons

[23:30] come through out of 141 000 appeals but we saw

[23:36] this will be pushed off until the end of the season

[23:39] the last thing you're going to want to do is to check off the box that says

[23:42] evidence that's my evidence and i'll tell you

[23:45] very succinctly that the reason you want to do that as a taxpayer homeowner small

[23:49] business owner city council member not elected official

[23:52] doesn't matter you have the same rights afforded to you under the law

[23:56] if you check that box i have to give you every ounce of information that i have

[24:00] and i can't give it to you by law until you file a

[24:02] protest i'm talking about sales prices i have sales prices texas is a

[24:08] non-disclosure state so every time a piece of property sells we don't know

[24:12] about it we will mail buyers and sellers

[24:15] questionnaires nobody's under any requirement of while it even says so for

[24:19] them to respond to it but we generally get about 30 35 percent back county-wide

[24:24] we get enough to do our job and basically

[24:28] what makes that really tough is i can't you know madam mayor if you

[24:33] called me 10 years ago and said mike i'd like all the sales in my community i'd

[24:37] send them to you if any taxpayer asked for him i'd send

[24:40] it to him now

[24:43] the legislature has seen fit to make it a requirement of law that you have to

[24:47] have a property currently under protest for the year in question for the year

[24:51] that you're making your open records request

[24:53] that doesn't really sound like open government to me but that's the law

[24:58] if a taxpayer wants that information the number one thing you need to do

[25:02] whether you agree with the value whether you disagree with the value just to

[25:05] protect your right to appeal it's called a protest it's really a conversation

[25:10] we'll sit down and talk to anybody last year out of 141 000 taxpayer appeals we

[25:15] had almost a 94 settlement rate nobody had to go to a hearing nobody had to go

[25:20] before a tribunal nobody had to do anything to have a conversation with me

[25:23] or my staff that's what it involved

[25:27] our job is to give them as much information as we can to help them

[25:30] understand how we arrived at that value and if we miss something having to do

[25:35] with their home the next page talks about the kinds of

[25:38] things that are important to your appeal and these are the most commonly used

[25:43] things um

[25:45] in terms of key protest information

[25:49] uh how you want to appeal and the things that you want to appeal if your home

[25:53] isn't up to par if you have foundation issues there are a lot of them out in

[25:57] this part of the county if you have foundation issues roofing

[26:01] issues if your house is 25 years old and has never been remodeled and you think

[26:05] we're comparing you to remodel properties that's a reason to appeal

[26:10] in the inner city of san antonio we have homes that are saha homes that are brand

[26:14] new and rented to low-income people i have

[26:17] brand new uh i call them flipper houses if you

[26:20] will they've been completely gutted some have been demolished and rebuilt so i've

[26:24] got four or five different markets in almost every neighborhood inside of 410

[26:30] and it extends beyond that some too so we're very well acquainted and

[26:34] accustomed to dealing with those issues we just want to make sure that every

[26:38] taxpayer that that wants to file an appeal has a right to file an appeal

[26:43] and if anybody on this commission wants to talk to me about how i know

[26:48] about what the state of texas is doing it's not just my 40 years experience i

[26:52] currently am serving on the property tax administration

[26:55] advisory board with for comptroller hager we just had a

[26:59] meeting yesterday and

[27:02] it was a zoom meeting that's all we've had for two years nice seeing all of

[27:06] y'all even though i don't know most of you

[27:10] the fact of the matter is the comptroller's office the state of texas

[27:14] gets to stand behind the law and say we don't have a state property tax

[27:19] we typically rank about six in the nation and the highest property tax in

[27:23] the country and about 45th in the nation in terms of overall taxation because we

[27:28] don't have an income tax not an advocate for anything i'm not

[27:32] advocating for this tax or that tax i'm just telling you why is what it is

[27:37] the legislature in fact does not have constitutional authority to impose

[27:43] a property tax but they control all the purse strings

[27:48] they make sure that the appraisal district in every county and every part

[27:51] of the state of texas is studied every two years biannually if you will this is

[27:56] a study year for us in bexar county to make sure that we have appropriately

[28:01] appraised property in a market like this that means that it's high enough

[28:05] has to be somewhere between 95 and 105 percent of market value not less than 95

[28:11] not more than 105. that's the state's standard for testing

[28:15] us i'm giving you the really cheap and

[28:18] dirty version of this but the fact of the matter is

[28:22] if a school district does not tax at their maximum tax rate and the appraisal

[28:26] district doesn't pass the property value study then that school district and

[28:31] those taxpayers aren't entitled to the full amount of state aid afforded under

[28:36] law that's generally referred to as hb3 in the last funding session i will tell

[28:42] you that there's absolutely nothing that gives me more angst than having to

[28:47] raise value because there actually are two ways for taxpayers to appeal

[28:52] market and equity those are the two boxes i

[28:55] tell you to check off i can tell you that while we're not supposed to treat

[28:59] taxpayers differently it's my opinion as a taxpayer that our tax code in this

[29:05] state has since 1997 done just that

[29:12] if a homeowner in kirby on bauman street wants to compare himself to a homeowner

[29:17] on seguin street there's probably going to be some pretty good units of

[29:21] comparison that same equity provision that makes

[29:25] sure that we treat homeowners equally in this community and in every community in

[29:30] bexar county relative to their neighbors is very different when you start looking

[29:35] at the jw marriott the best most

[29:39] revenue generating hotel in the history of bexar county when they can compare

[29:43] themselves to lesser properties literally the equity statute requires

[29:48] that the very best property

[29:52] actually doesn't say that it says that no property including the very best

[29:56] property in any category can be appraised above its median level of

[30:00] value well you know what i bet the median

[30:03] level of value for a homeowner in any community or any subdivision and san

[30:08] antonio texas is going to be pretty darn close to their neighbors

[30:13] but when you compare the j.w marriott to the two other

[30:17] resort hotels in bexar county there is no comparability

[30:23] the westin has one golf course now they just sold the other one

[30:28] they also lost the valero texas open to the jw marriott i'm not picking on the

[30:33] jw marriott i love it i love the golf course i love their food i don't love

[30:36] their food they're okay

[30:38] but i will tell you that as a taxpayer

[30:43] it's it's not well i'll just let me just close with

[30:47] this i tell my staff we have a range of value we have to deal

[30:51] with i need to pass that study looking as poor as i possibly can

[30:56] 95.0123

[30:59] somewhere in there because i can't give away enough

[31:03] homeowner value to make up for how much we lose in litigation

[31:07] and appeals on commercial property because of the equity statute

[31:11] last year i had almost 20 no year before last i had almost 27 billion dollars in

[31:16] litigation you know how much of it was commercial

[31:20] 99.999 percent of it you know how many of them contended that they were over

[31:24] appraised damn year not one

[31:29] they all claimed equity so the shops at la candera could compare themselves to

[31:33] the forum you familiar with the forum are you

[31:36] familiar with the shops at lochunder maybe it's comparable to

[31:41] the quarry market but they don't compare themselves to each other they compare

[31:45] themselves to lesser properties to get that median level of value dropped down

[31:50] in my opinion equity has allowed the best commercial property not just in our

[31:54] community but in every community in the state of texas to pay taxes on about 50

[31:58] percent of their actual value that's what we see

[32:02] if there's any homeowners in here that want to be heard at a town hall in this

[32:06] community i'm happy to come back and do that for you

[32:09] if we can you know make sure we get them signed up

[32:11] for a protest we'll bring ipads we'll bring appraisers we'll bring

[32:16] to have that conversation and get them armed to be able to handle the appeal

[32:20] because my staff is going to listen to whatever you say

[32:24] we're going to do our best to get the closure on this

[32:27] and with that unless you have any questions or to discuss tonight

[32:41] to homes that have uh like 100 percent tax exempt

[32:48] how often do you check on that because in certain instances there's

[32:52] people die and it gets moved and nothing ever gets

[32:56] reported and yes sir so whether it's 100 percent or

[33:00] an over 65 or a surviving spouse of 100 or a surviving spouse of an over 65 or

[33:06] disabled persons those things are checked we send out and i'm sure people

[33:10] in your community have gotten them because every year we send out about 10

[33:14] 000 reapplication requests the legislature and i don't mind saying

[33:19] this to homeowners the legislature does not give me the authority to be a police

[33:23] force i don't get to go and investigate if the

[33:26] person who's claiming that over 65 or that 100 percent is actually the person

[33:30] who lives there in fact if you tell my staff to get off

[33:33] your property you know what we're going to do we're going to get off your

[33:36] property because i don't have a right to be there unless you allow it

[33:40] once texas thought it was a good idea for everybody to carry guns i don't

[33:45] the law are just going to continue to get away with nothing absolutely

[33:49] and committing forgery on the back of that document when i make them reapply

[33:53] they're absolutely entitled to it there's no way to follow up at all

[33:59] there's nothing under the law that allows me to follow up beyond and let me

[34:02] tell you something one of the best ways of finding out about those situations is

[34:07] when the guy that lives behind him knows damn goodwill it's a rent house

[34:12] and that that owner is in a nursing home or that that owner doesn't live there he

[34:16] or he lives there but he rents out to four or five rooms to different people

[34:21] and so we go and we ask and they go no that's not true

[34:26] well i don't have a court of law i can take that person too

[34:30] but they don't send you a death certificate or nothing when pro i do

[34:33] purchase all the bureau of vital statistics information

[34:37] we also get all the dmv information of course i have to pay for it

[34:41] but we run those reports against our qualification sheets every year

[34:47] so yeah i mean and and the bad thing is i'm glad you brought that up if you're

[34:52] an over 65 person or even 100 disabled person

[34:56] and you're concerned about your estate and what you're going to leave to your

[35:00] family it's really critical that you not just

[35:05] talk to an attorney but you talk to some of our exemption people in our office

[35:08] because we have undone so many things that attorneys have done that cause

[35:12] people's taxes to go from three thousand dollars a year

[35:49] the penal section dealing with fraud and defrauding a government office

[35:55] it's up to the county attorney or the district attorney to file that if they

[35:58] choose i have yet to see one in any county i've

[36:02] worked in and this is my third county how extremely rare

[36:08] how can you bring that i mean so your office can your office report it

[36:14] if we report it i have to have proof

[36:18] that that person that claimed qualification no longer has eligibility

[36:22] i don't have any investigation authority once i ask you and you sign your name on

[36:31] well but when you go back and you say the neighbor behind or whatever

[36:37] and they know he's deceased and he's still getting 100 disability if we know

[36:42] he's deceased we will go back and we can go back five years on that

[36:58] one of the most important things you need for your homeowners to know is even

[37:02] if the value goes up 20 it's kind of hard to argue when you look

[37:06] at the sales data if they have a residence homestead

[37:10] exemption that puts a 10 percent limitation on it for this year

[37:15] and it may go up 10 percent the next year if the market continues its

[37:19] trajectory which it's projected to do so the homestead exemption is literally the

[37:23] protection that a property owner can afford themselves

[37:27] if they qualified up to two years ago and don't apply until this year i can

[37:32] give it to them this year and go back to and dear god don't ever pay anybody to

[37:37] file that document for you there are companies that used to charge 50 dollars

[37:41] to do this now they want 15 of the tax savings

[37:45] well the tax savings isn't by the way there's an election in may to increase

[37:49] your homestead exemption from twenty five thousand to forty thousand you need

[37:53] to make sure and vote if you don't vote for anything else vote for that

[37:58] i option all the way back to two years ago

[38:02] so if you two for this year i can give it to you

[38:06] for 21 and i give it to you for 20. but you have to protest first pardon but you

[38:11] have to protest first right you have to file your homestead exemption first

[38:15] separate issue but here's the thing that 50

[38:19] company that's out there they're out of plano texas and i did point this out to

[38:23] the lieutenant governor the speaker and the governor's office and one of the

[38:27] things that we got told is they're not about to file

[38:30] a law that gets in the way of business doing their business

[38:39] that 10 percent cap imagine a 10 cap back in 2020

[38:45] going to 2021 your value probably went up eight or ten percent and another

[38:58] at whatever your tax rates were for that year for those jurisdictions you're

[39:02] going to owe at least a thousand fifteen hundred

[39:05] dollars that company and here's the rub with those guys they actually want you

[39:09] to sign a fiduciary agreement so that the tax office which i am not the tax

[39:14] office i just do values and exemptions will require you to sign a document that

[39:20] that forces the tax office to send your refund to them and then they'll send you

[39:24] their half right when they're good and ready too

[39:29] after they've collected interest for about a year

[39:31] well we'll do that for them for free we'll we'll we i have a dozen notaries

[39:36] in my office we'll notarize their documents i don't care if it's va social

[39:40] security or just their homestead we'll take care of any of it any any exemption

[41:01] he basically analyzes our our numbers in reference to our traffic stops

[41:06] and we get this report that basically say we are in compliance with the sandra

[41:11] bland act i'm going to read some numbers to you

[41:14] kind of go through this briefly each of you should have gotten a copy and there

[41:17] will be a copy placed

[41:19] out in the lobby the police department also out in the lobby of city hall after

[41:22] today last year we this kirby police

[41:26] department conducted at least 2093

[41:29] traffic stops 2084 of those traffic stops

[41:35] race or ethnicity was not known prior to stop nine of them were

[41:39] um we had

[41:42] nine of those being alaska native american indian 28 asian pacific

[41:47] islander 587 african-american or black white 349

[41:52] and hispanic latino 1 120. the gender of female

[41:58] total 791 the males were 1 302. the reason for the stops the violation

[42:05] of law for a violation of law was 13 pre-existing knowledge was 55

[42:10] moving traffic violation total was 1 627.

[42:16] the vehicle traffic violation total was 398.

[42:20] out of all those was a search conducted 263 of them were yes and 1830 1830 were

[42:27] no um the reason for those searches were 42

[42:31] of them were consent to search uh contraband in plain or in plain view

[42:36] would been nine probable cause was 155. um inventory total was 50 and incidental

[42:43] arrest was seven was contraband discovered a total was

[42:48] 151 for yes and 112 for no

[42:54] did the res finding results in arrest 22 were yes and 129 were no

[43:00] the description of contraband the drugs total found was 126.

[43:06] zero currency weapon money

[43:10] stolen property was two and other was 19. the result of the stop was 16

[43:17] verbal warnings 1166 written warnings

[43:22] 841 citations total written warning and arrest totaled to 47. citation and

[43:28] arrest was 17 and the arrest total was six on the

[43:33] bottom arrest based on

[43:36] the penal code was 34 violation of traffic law was one city ordinance was

[43:41] zero and outstanding warrant was 35. was there any physical

[43:46] force used resulting in bodily injury during the stop now keep in mind there

[43:50] are some things that have changed this year you're going to get a little bit

[43:52] more data they've gotten a little bit more complex this is one of them

[43:56] we have had zero physical force used that resulted in bodily injury in any of

[44:00] our traffic stops or our encounters in those traffic stops so the no would been

[44:05] total the traffic stop which is 2093. and that is it

[51:11] your audit for the 2021 fiscal year um you should have an audit report um up

[51:17] in front of you i'm just going to go over a few

[51:20] highlights of the audit not try to take up too much time

[51:28] so basically what's in a annual financial report there's the

[51:32] introduction the independent audit report the

[51:35] management discussion and analysis

[51:40] the fund financial statements

[51:44] and those just provide a greater detail for what's contained in

[51:48] themselves required supplementary information

[51:53] supplemental individual financial statements and those just provide

[51:57] comparative financial statements for the individual

[52:00] funds statistical section and this provides

[52:05] different types of statistical data for informational purposes and then finally

[52:10] you'll have the compliance section and that's your single audit

[52:17] all right for your independent audit auditor's report it's on page one

[52:23] the operators that we follow generally accepted auditing standards

[52:28] and government government auditing standards for the single audit portion

[52:33] the purpose is to form an independent opinion on whether the financial

[52:36] statements are presented in accordance with generally

[52:40] accepted accounting principles

[52:47] uh this year the opinion that we had overall was an adverse opinion

[52:51] um and that's basically saying that we didn't have

[52:54] everything for the scope and that's just because we didn't have the kirby senior

[52:58] center included in your financial statements

[53:01] as far as the city we did give you an unmodified opinion and that's the best

[53:05] opinion that you can get basically saying that the financial

[53:08] statements are materially correct as they're stated

[53:12] as far as the schedule of expenditures for federal awards we also gave you an

[53:16] unmodified opinion stating that you are in compliance with the requirements

[53:21] that the government requires for using federal funds

[53:28] um in the md a section there's a few uh parts of that there's financial

[53:33] highlights overview financial statements uh a touch on government-wide financial

[53:38] analysis uh financial analysis of the city's funds

[53:42] budgetary highlights capital assets and debt and then requests for information

[53:48] uh so just one portion that i was going to go over

[53:52] in the mdna on page seven and eight or the government-wide financial

[53:58] statements for governmental activities the assets of the city exceeded its

[54:02] liabilities by 11.5 million at september 30th 2021

[54:09] and then your net position actually increased by 1.5 million from the prior

[54:13] year primarily due to revenues and expenses remaining similar to the prior

[54:17] year which had the similar outcome in the previous year

[54:21] for business type activities which is your water and sewer fund

[54:25] your assets exceeded its liabilities by 6 million at

[54:29] september 30th 2021 and the unrestricted net position

[54:33] decreased by 29 000 to 2.4 million at september 30th 2021.

[54:43] and then on page 14

[54:47] um the highlight here is on your government-wide financial statements

[54:51] is your your net position your net position for governmental

[54:56] activities was 11.5 million of that 1.7 was unrestricted

[55:02] for business type activities your net position was 6 million and the

[55:07] unrestricted portion was 2.3 million the total being 17.5 net position with

[55:14] 4.1 being unrestricted

[55:22] all right then your fun statements on page 17

[55:26] the general fund balance at herein of

[55:29] 2021 was 2.7 million and the combined fund balance of all funds was 9.4

[55:35] million your unassigned fund balance for the

[55:38] general fund was 2.4 million or approximately

[55:42] 6.8 months of the average operating expenditures

[55:46] the government finance officers association recommends that there be at

[55:51] least three months to cover three so how many months do we have now you're six

[55:55] point eight six months yes six point eight

[55:59] thank you um and then 85 000

[56:05] and the combined fund balance decreased by

[56:08] 728 000 mainly due to

[56:12] that should say increase mainly due to the decreased capital

[56:16] outlay in the general fund in the current year

[56:24] for your page 17 your major fund general fund

[56:30] balance the fund balance there was 2.7 million

[56:34] again of that the unassigned was 2.4 million

[56:38] your debt service fund balance was 189 uh capital projects fund that fund

[56:46] balance was 6.4 million crime control was 109 000 and again your

[56:51] total was 9.4 million

[56:59] for your business type activities your waterworks your fund net position

[57:03] decreased by thirty four thousand um this includes the expenses include

[57:08] transfers to the funds and the amount of six hundred thousand dollars and that

[57:12] was the transfer in lieu of taxes to the general fund

[57:18] right for the required supplement supplementary information um i wanted to

[57:22] touch on the general fund budget and actual analysis

[57:27] so the main keys here i was going to go over revenue expenses and then the the

[57:31] net increase decreased so your actual revenue was 5.4 million

[57:36] and y'all budgeted 5.3 so y'all actually

[57:41] did better than you expected by thirty eight thousand dollars in for the year

[57:52] as far as total expenses y'all had actual total expenses of 5.2 million

[57:58] um and you budgeted 5.5 so you actually spent

[58:03] about 292 000 less than you were expected to

[58:07] spend

[58:11] um so this brings your net change in fund balance

[58:16] you had an actual of 584 000 and y'all were expecting to generate 421

[58:23] so y'all actually generated 163 000 more than you are expecting to this year

[58:32] all right and the last section that i wanted to touch on was the compliance

[58:35] section of page 104 this is your single audit

[58:39] a single audit gets put in place to determine if an entity is in compliance

[58:43] with specified requirements when expending federal funds and to determine

[58:47] if there are deficiencies in internal controls

[58:51] during our procedures in the current year the single audit resulted in an

[58:55] unmodified opinion in relation to the financial statements

[58:59] basically saying that city was in compliance with the specified

[59:02] requirements and there were no deficiencies noted in internal controls

[1:34:12] time a pump is going to run you about 50 000 that's not in this quote but we have

[1:34:18] a pump until the realignment and the

[1:34:22] casing is done then you know what size it could be smaller

[1:34:26] it could be larger than you order your pump

[1:34:29] so at that time when we're working on budget we approved we rounded it up to

[1:34:33] 130 000 for the last fiscal year so they can get started on the project

[1:34:38] our polaris director's goal was to get it finished by the industry that's where

[1:34:42] the gym came from they said that was kind of aggressive considering you have

[1:34:45] to order parts and materials that you don't know how long it will take

[1:34:50] that time we were under the impression that we approve it

[1:34:55] and the city could do all the paperwork we then learned it required a tceq

[1:35:00] permit and a paa from it and you had to have registered professional engineering

[1:35:05] plans in order to submit those apartments

[1:35:09] so we did not have enough money to start the project last year so we didn't even

[1:35:13] start we came back during a new fiscal year

[1:35:16] budget that you all approved for october 1 and we requested 200 000 in the budget

[1:35:22] that 200 000 included engineering fees and permitting fees so we could get all

[1:35:28] the paperwork submitted just to get the project started so the

[1:35:32] project technically didn't start prior to

[1:35:35] around january this year

[1:35:40] so that's where that lagging time came from

[1:35:43] when they got into the casing and they they didn't come back and say there was

[1:35:47] an issue with the cementing and so forth it was going to cost some additional

[1:35:50] money um to get more materials to try to fill that in the city assumes the

[1:35:56] responsibility for that any additional costs because

[1:36:00] they said they can't guarantee what's going to happen once they get in there

[1:36:04] um so they did notify me of that and i authorize them to continue to work

[1:36:09] because at that point it's open run in the city of one well

[1:36:14] tower the smaller one drinking water is you know our

[1:36:18] priorities so they did go ahead and finish that work

[1:36:21] that work is done and those two invoices have been paid

[1:36:24] but i paid them within the 200 000 budget so i um at this point

[1:36:30] we need to order the pump and they've already informed us that

[1:36:34] you're looking at 8 to ten weeks to get a pump which

[1:36:40] expedite the process so this cost estimate that you have at forty nine

[1:36:44] thousand i believe includes expediting it

[1:36:48] um so that we could try to get physical i understand that

[1:36:53] but the only two things that are different from the original

[1:36:57] proposal that they gave us back in april and

[1:37:02] these invoices are that

[1:37:07] uh number 10 the sub contracting for

[1:37:12] which is a difference of 3 000 or yeah 3 000 is 12 increase and

[1:37:17] then this 90 000 that's different from the 63 000. those are the only two

[1:37:21] things that are not identical prices didn't go up on anything else

[1:37:34] so what was so different about this piece

[1:37:37] that is not the additional four things

[1:41:26] as to the specifications that are now in there with the liner in place

[1:47:15] about mid sometime mid next week let me give it an official date i guess

[1:47:21] so by next wednesday um i'll have the information where you can go up to the

[1:47:25] vfw and pick your slot out if you want to pre-pay if you don't

[1:47:29] prepay you're just going to get what's left on the day of the sale so hopefully

[1:47:33] everybody participates comes out and i encourage all um

[1:47:37] actually the beautification and recycle committee encourages all um other boards

[1:47:40] and commissions to come out too to participate they were saying like for

[1:47:43] instance crime control if you want to set up a booth you could there also just

[1:47:47] so when the current the citizens come out they can meet everybody and that's

[1:47:52] on there uh may 14th

[1:47:58] uh next up is building and standards commission councilmember martin

[1:48:02] mayor i have nothing to report we haven't had a meeting in probably

[1:48:05] four or five months and i don't think we have one coming up doing money

[1:48:10] that's it that's all i got thank you sir next is crime control and prevention

[1:48:14] district council member salazar not here next in line is economic development

[1:48:20] committees council member apodaca we have not met so nothing to report

[1:48:25] okay next in line is planning and zoning

[1:48:28] commission that is myself we have not had a meeting and number seven senior

[1:48:33] center corporation board council member street

[1:48:36] okay they had a board meeting on march 14th

[1:48:40] uh sid sanders senior has resigned as the board president

[1:48:45] they are also planning on having their 30th anniversary

[1:48:48] celebration in april of 2023 the date set right now is for april 22nd

[1:48:57] the center will be having an indoor easter egg hunt for our seniors on

[1:49:01] wednesday april 13th and if you have any questions please

[1:49:13] events and items of community interest from our city manager

[1:49:24] a forum will be going out

[1:49:40] the engine's impact the list will remain confidential and

[1:49:44] it's only used in the event of a city-wide emergency so the purpose of

[1:49:48] that is like when we have the freeze or we have a power outage you know you have

[1:49:52] oxygen that needs to run or have some other

[1:50:01] secondly city hall is going to close at 3 p.m on friday april 1st we do our

[1:50:07] annual department cleaning and shredding of

[1:50:10] city documents for our retention date so

[1:50:15] that is the friday of the week so everybody to know in advance

[1:50:21] you need to pay your water bill because you've been turned off you will really

[1:50:24] have a cell phone that day in person but you will still have the online and the

[1:50:28] options and lastly we are still asking for

[1:50:32] volunteers to meet us here at city hall on wednesday after six

[1:50:39] easter eggs candy donations are also made accepted

[1:50:42] here at city hall easter egg lunch is going to take place

[1:50:46] on sunday april 10th in friendship park from 2 to 4 p.m

[1:50:50] we will proceed because we did get um the prime control board volunteered to

[1:50:55] help us find eggs that day and then i had about four emails from residents who

[1:50:59] were ready to help so we appreciate

[1:51:04] that moving on to 11a requests by mayor and council members

[1:51:10] for items to be placed on future city agendas and announcements on city events

[1:51:15] and community interests council member street

[1:51:19] i just wanted to say that for those of you who don't understand

[1:51:24] why i ask so many questions is because when i was sitting out there

[1:51:28] i always had questions and it was hard for me to get answers so

[1:51:32] now when i'm up here and i go through these documents

[1:51:37] everything doesn't make sense to me so i ask the questions and then sometimes i

[1:51:41] repeat those questions so you know the answers to them too just in case

[1:51:46] you're also wondering it's not because i don't know everything or because i i

[1:51:53] i was accused of you know not asking the questions beforehand and getting the

[1:51:57] answers and just moving on well i think you sometimes want to know

[1:52:01] so that's the point of why i ask questions up here

[1:52:05] if sometimes i don't already know because sometimes we don't get the

[1:52:09] information fast enough and it's just impossible when you get the information

[1:52:13] from the city manager on monday to get everything

[1:52:16] done by thursday it's just impossible sometimes

[1:53:00] come out on the 19th so thank you to them also um the outside clubs and

[1:53:04] organization i want to give thanks to is black girls do bikes san antonio major

[1:53:08] taylor cycling club san antonio 210 cycle riders and i wish y'all had the

[1:53:13] the military fraternity actually came out too so appreciate them thank you

[1:53:17] um thanks to the assistant my assistant angela for keeping me on track as always

[1:53:20] lunch is provided by myself but um thanks for the added food items like

[1:53:24] bj's famous crackers and england um for donating cinnamon rolls and banana nut

[1:53:29] bread from her business it's good though it's

[1:53:33] good dough make sure i say that right it's good though

[1:53:36] um so thank you thank you that was a nice

[1:53:39] surprise um to my mother gloria grider for organizing set up the food um

[1:53:44] making everybody laugh having a good time um

[1:53:48] and uh obviously my father were helping them doing some hard labor out there

[1:53:51] thank you to everyone who came out especially our youth it was very

[1:53:54] refreshing to see our youth participate a lot of them brought their forums for

[1:53:57] their community service hours they need it for school

[1:54:00] thank you councilmember street and martin for coming out again thank you to

[1:54:04] everyone who participated and helped it was a great success we did a lot of

[1:54:09] work out there um it was no plan around it was work

[1:54:14] i mean i know i went home i was exhausted so so thank you everybody who

[1:54:18] participated that was great

[1:54:32] um i would like is it possible that i know

[1:54:35] last council meeting i asked for you to if you could see some dates in april

[1:54:41] um this for a special meeting about the crime in kirby do we have any available

[1:54:45] dates open or is it going to have to be in may

[1:54:51] so i did go back and look but we actually have um

[1:54:55] the first saturday in june which i think is before it was already scheduled as

[1:54:58] our next quarterly forum if you want to move it up we can look at

[1:55:03] a saturday in may but we've got activities already in april

[1:55:08] okay maybe we can look at some dates in may just in um because some of the i

[1:55:12] mean well a lot of the residents are really concerned so maybe just possibly

[1:55:16] throw out some dates um

[1:55:18] also when um just want to check the status of the computer the little nook

[1:55:22] in the back for the council members when will that be ready and available to use

[1:55:33] okay so okay okay

[1:55:36] um and also um i would like to put on the

[1:55:39] agenda uh in a future agenda item we need to discuss putting money aside for

[1:55:44] our boards and committees for training and when i say training i mean official

[1:55:48] training um economic development committee um

[1:55:53] uh what was the uh what's from last week planning and zone yes planning and

[1:55:58] zoning they need official training i don't think that it's right for anybody

[1:56:04] no matter what position you're in just to throw somebody in there they need to

[1:56:07] know they need to be trained basically

[1:56:11] um and we need to really look into that uh to see if there's some training out i

[1:56:15] know there has to be some training out there possibly

[1:56:17] uh because

[1:56:20] right yeah maybe tml um just so to get them more informed

[1:56:24] and also it's good just to touch up on your skills every now and then you know

[1:56:27] you can't know everything right okay

[1:56:30] so the kirby youth community outreach event we invite kirby residents and

[1:56:34] surrounding communities to bring your children to the free event this event

[1:56:37] will take place on april 30th may 28th and june 25th

[1:56:41] 12 to 1 p.m all ages welcome hosted by semper fortis jiu jitsu

[1:56:47] at our very own vfw post 2059 3202 ackermann road here in kirby jiu-jitsu

[1:56:54] is proven to provide discipline improve focus and attention i hope you bring

[1:56:57] your kids out to this event um we have those three dates

[1:57:01] it's a free event um also i want to say i had the honor of going to india

[1:57:07] association of san antonio event and a learning

[1:57:10] experience um uh

[1:57:14] my friends culture um holy is a celebration of the beginning

[1:57:18] of spring and triumph of good over evil holy is a hindu

[1:57:22] festival also known as the festival of colors

[1:57:25] so this holy may evil leave your home in may prosperity and joy walk in

[1:57:30] happy holi um thanks denali for that i found it very interesting i think it's

[1:57:34] always good to learn other people's cultures you know um because you gotta

[1:57:37] remember our community is made of all types right it's a community okay so the

[1:57:42] last thing that i have

[1:57:46] is women's history month so

[1:57:50] obviously it's coming to an end and i'm honored to be blessed to be raised by my

[1:57:53] parents and especially my wonderful mother gloria grider and have strong

[1:57:56] women role models in my family and in my life

[1:58:00] in our city of kirby there are strong women and i am honored to know you and

[1:58:03] to sit up here and represent you this month as many have seen stories

[1:58:07] reflecting on courage of women in past generations and celebrate their

[1:58:11] contributions but let us continue to honor respect support and empower women

[1:58:16] of all ages all races and all backgrounds i have seen so many women in

[1:58:21] our community in our city step up for example england sanchez who owns is good

[1:58:26] though coordinated and raised money for supplies for kirby kirby animal services

[1:58:30] she just did that out of the kindness of her heart bj voigt offering to lend her

[1:58:34] truck to pick up items or offering to cook and provide a meal to anyone yvonne

[1:58:38] rodriguez donating thanksgiving meals to kirby residents her compassion and

[1:58:42] generosity is amazing gisele sanford who owns creme de la hemp and also had a

[1:58:47] jewelry business and gave women and kirby free jewelry just because jessica

[1:58:51] zapata who has a wealth of knowledge with bear county records and is willing

[1:58:54] to help anyone anytime jacqueline malter donated her chair to the park cleanup

[1:58:59] when i asked she said without any hesitation said anytime you ever need

[1:59:03] them again i'm here for you um mayor lisa pierce was the first to

[1:59:08] let me know when i was appointed uh

[1:59:11] if i had any questions um that i wanted to know

[1:59:15] she was gonna she was willing to answer for me answer for me and she was here

[1:59:18] for me until this day if i have any questions she provides me vital

[1:59:21] information um there's plenty business owners here

[1:59:25] women business women owners here in kirby sell me a low casina um actually i

[1:59:30] don't know if you guys want to yummy yummy italian ice cream um that's a

[1:59:33] family of women who own that business um maria's restaurant el ricon de maria and

[1:59:40] many other businesses in kirby owned by women

[1:59:45] glenda curtis quick to support our community and our city any way we uh any

[1:59:49] way she can offers genuine encouragement and kindness um alice pat there are so

[1:59:53] many women that i can just i can't even mention in our community

[1:59:59] that makes this a community and that helps each other help each

[2:00:02] other out um i will close with some of my favorite

[2:00:06] quotes by women women belong in all places where the

[2:00:10] decisions are being made it shouldn't be that women are the

[2:00:14] exception that's by the late supreme court justice ruth bader ginsburg

[2:00:19] each time a woman stands up for herself without knowing it possibly without

[2:00:24] claiming it she stands up for all women maya angelou

[2:00:52] i have been looking at uh different things especially the salaries

[2:00:57] of our employees

[2:01:00] and uh you know of course we've been famous since i've lived here and since

[2:01:05] his department started on being one of the biggest training

[2:01:08] centers for police officers in this county

[2:01:12] so this upcoming budget year

[2:01:18] we really really need to look very hard at

[2:01:22] our employees and the minimum wage a starting officer in windcrest makes

[2:01:28] more than our detectives why he stays just amazes out of me

[2:01:34] loyalty i guess because he likes the city

[2:01:38] and i keep hearing about you know why don't we fill this and why don't we fill

[2:01:43] that it's real simple they come in because i've checked

[2:01:47] they fill out the application they do the interview they get offered

[2:01:51] the job they see the salary they don't show up

[2:01:56] because we are dramatically below anybody else

[2:02:01] we're not even close to we should be a minimum of the starting

[2:02:05] pay for every job in this city should be a minimum of fifteen dollars an hour

[2:02:09] we're not close yet we want to spend two hundred

[2:02:12] thousand dollars on a machine that digs up the street

[2:02:15] another hundred thousand on the equipment to support it and we got

[2:02:18] nobody to work it so let's go ahead and buy it let us sit out there and gather

[2:02:21] dust because we have nobody to run it and

[2:02:26] while i'm on that subject yes it takes two men to run that machine what does it

[2:02:32] do it digs up the pavement

[2:02:36] that's all it does then you buy another machine called a

[2:02:42] lay down paver which you have to train people to run

[2:02:48] and again we talk about seguin

[2:02:52] good conversation there their crew for that machine is five

[2:02:57] people minimal five people period

[2:03:03] and it's a dedicated crew basically now they do work other jobs

[2:03:07] but when they start a job they get to finish it

[2:03:10] our problem is like asphalt for instance is like concrete

[2:03:14] you order so much concrete if you don't use it it sits sets it hardens you can't

[2:03:20] save concrete guess what you can't save asphalt

[2:03:25] once you've ordered asphalt for a job you got so much time to use it if you

[2:03:30] don't use it in that amount of time it sits sets excuse me

[2:03:36] it's called attention to a street where a patch was put in and it's not

[2:03:42] completely full why they ran out

[2:03:48] so what i'm saying to you folks is you want to spend a whole bunch of money

[2:03:52] on something that we can't use it doesn't make a lot of sense until we

[2:03:56] fill and have every position filled

[2:04:01] right now i think we're short two and what uh

[2:04:04] maintenance for the city start two positions or three three

[2:04:08] okay and we're start two officers i know for a fact

[2:04:13] uh oh i caught it the other day for code

[2:04:16] compliance well guess what

[2:04:19] the co-compliance officer has been one dispatching

[2:04:23] to on patrol so again

[2:04:28] you know it's easy to complain it's easy to sit

[2:04:31] up here and ask for all of these things to be

[2:04:34] done we don't have the people to do them

[2:04:38] second of all we don't pay them to do that

[2:04:42] so until we whether i'm sitting here again or not and personally i'm getting

[2:04:46] the point i don't care honestly but the point of it is that i'm making

[2:04:51] to you folks if you don't put the money out to put

[2:04:54] the people in the positions then you can buy all the stuff you want

[2:05:00] and it you don't you can't use it so

[2:05:04] please this next budget look at the people here take your time

[2:05:09] if you're going to do some research every city's budget is published

[2:05:15] look it up see what a street worker makes in

[2:05:18] congress see what a street worker makes in windcrest

[2:05:22] see what one makes in shirts see what one makes in live oak you should be

[2:05:26] embarrassed how low we pay

[2:05:30] mike that runs and does our animal control

[2:05:35] 9 15 bucks an hour and he runs a department

[2:05:38] this is embarrassing so complain all you want about the

[2:05:42] potholes i feel sorry for them i drive them every

[2:05:45] day myself just like everybody else does but if you don't have the people trained

[2:05:51] to fix them if you don't have the people to run the machines that you want to buy

[2:05:57] nothing's going to get fixed so think about that and think about

[2:06:01] where your tax money wants to go come up here and talk to us

[2:06:08] check and see yourselves there's there's everybody out there

[2:06:12] everything is available online to check and see who makes what

[2:06:17] okay it's an embarrassment to put your pl

[2:06:20] your life on the line with your police officers

[2:06:23] for what we pay them okay

[2:06:27] it's ridiculous actually and i'm embarrassed because i can say i

[2:06:31] started 175 when it was 7.25 cents an hour

[2:06:35] and we're just barely past that barely past that

[2:06:42] so anyway folks
