I pledge allegiance to the flag of the
United States of America,
[0:09]
and to the Republic for which it stands,
one nation
[0:13]
under God, indivisible, with liberty and
justice for all.
[0:26]
» Mr. Paul,
are you up?
[0:31]
I want a second.
[0:35]
It's
a meeting.
[0:37]
Remove.
Oh, you haven't got the remote though.
[0:41]
» I
>> It's all new to me, sir.
[0:44]
» Can we start over?
>> Mhm.
[0:48]
One second, I'll take a look.
[1:02]
Okay.
Okay.
[1:05]
Commissioner Gigli?
>> Here.
[1:07]
» Commissioner Clark?
>> Here.
[1:09]
» Commissioner Askew?
>> Present.
[1:11]
» Commissioner Solomon?
>> Here.
[1:13]
» You said that Commissioner Porter is
absent. He called in, you know, he was
[1:17]
going to be absent.
[1:21]
» Any other update on zoning activity?
>> Well, one update is uh that we the the
[1:26]
Board of Supervisors met about uh
remote access to the meetings. And as
[1:31]
you can see on the agenda, we included
language for remote access. And there's
[1:36]
a link up in the agenda on our website,
so people can click on it and go to the
[1:40]
remote access.
There's also language that if
[1:44]
uh you want to submit comments, it has
to be in person or written comments in
[1:48]
advance of the meeting. There's no
mechanism for the public to be able to
[1:51]
talk through the remote access. And
there's a disclaimer that if broadcast
[1:56]
is interrupted for any reason, the
meeting will proceed in person.
[2:00]
If there are any new
items on the agenda, I also want to let
[2:03]
you know that we
went to on Skyline Road to the Board of
[2:07]
Supervisors last week,
and the board approved it unanimously.
[2:11]
So, it's approved with conditions.
[2:20]
I think that's all the update.
[2:24]
Are there any other issues raised by
commissioners?
[2:29]
» Yes, it's a matter of our June meeting
when the recycling
[2:33]
the new recycling center was
created. So, then I did not vote for it
[2:38]
anyway.
My husband and I were driving down
[2:40]
Johnstonville Road,
and I noticed that the recycling center
[2:44]
on Johnstonville Road
is for sale.
[2:48]
And I said to him, "Well, wouldn't that
wouldn't that have been a way that they
[2:51]
bought right there? That would have been
an improvement for that."
[2:55]
The neighbors would have all been upset.
And I thought, "Well, too bad."
[3:00]
And um
then a couple weeks later somebody
[3:03]
approached me and said
the Ingram's
[3:06]
grant
for that recycling center
[3:09]
was written for the Johnstonville Road
property. In fact, they had it in
[3:14]
escrow.
And then at some point changed gears and
[3:17]
moved out to the property
beyond the CHP. Anyway,
[3:21]
I think that's information we could have
used.
[3:25]
I know that your interest was to table
it
[3:29]
and to
learn a bit more. And I don't
[3:33]
we can only make decisions on the
information that we get. And I certainly
[3:37]
didn't know that, and I asked one of the
supervisors, they didn't know anything
[3:40]
about it.
We've got a group of poor people who are
[3:45]
on their bikes and walk out to that
recycling center, and I don't think
[3:49]
they're going to make it out to the
highway
[3:51]
by the CHP.
I think that's sad.
[3:54]
And um
[4:00]
it's sad.
Um
[4:05]
Anyway,
just wanted y'all to know that. Could
[4:08]
have gone a different route, but Oh,
that's what I wanted to say is that when
[4:12]
the new one opens,
when the new one opens, is that one
[4:16]
going to survive? I would
I would recommend it doesn't.
[4:22]
» I think they will be owned by the same
person or someone else could come in
[4:26]
there too.
[4:30]
It was Johnson Road.
Johnson Road is what it
[4:35]
» It was Johnson Road.
>> Something like that. My arrogance is
[4:38]
that
right there.
[4:40]
Yeah, yeah. Yeah, my arrogance is where
where Stein is. Stein is It's Stein is
[4:44]
there.
>> But anyway, um
[4:47]
» I mean, we could have had a nice
improvement update on something that
[4:50]
would not upset anybody.
>> I don't think it's up to the planning
[4:55]
department to explore things like that.
That is
[4:58]
» Well, we didn't have any information on
the the the building application that we
[5:03]
get is the one we have to process. So,
when we get an application, it's brought
[5:08]
to the to the planning commission.
We had
[5:12]
I don't know if that would have made a
difference in the processing of the
[5:14]
application
that was submitted to us cuz that was
[5:18]
what was submitted was brought to
But uh I did not know any have any
[5:22]
information on the recycling center
Johnson Road or whatever that
[5:26]
Yeah.
>> It it could have
[5:30]
Oh, that's terrible.
>> It had a great fit for that location. It
[5:34]
would have just been so much better for
everybody.
[5:37]
Anyway, just wanted to put that out
there.
[5:40]
» Um
I have an item
[5:43]
as far as
uh received a uh
[5:46]
email from Dana Hawkins at the time part
of that concerning
[5:51]
California
associate.
[5:55]
After Joe Clark that's coming up on
October
[5:58]
23rd, 24th.
[6:01]
Is there any provisions for any of us to
>> I thought there was uh four there's
[6:06]
enough budget for one representative to
go. I would propose the chair as the
[6:10]
chair.
Um we have to have funds in our budget
[6:13]
to be able to do that. And
consulted with our fiscal officer and
[6:17]
with the CEO
and there was
[6:20]
sufficient funds where we could do the
travel authorization
[6:25]
if you wanted to attend.
>> Um is there anyone else that would like
[6:30]
to attend?
Council Foster.
[6:34]
» I'm still looking at my calendar.
[6:41]
» Hopefully put these during the holidays.
>> [laughter]
[6:51]
» I probably would.
>> Okay.
[6:54]
» If you do want to let me know and we can
make the do the travel authorizations.
[6:59]
Things we need to put in the budget.
>> Good point.
[7:02]
» Good point.
[7:09]
» Okay, correspondence.
Which one is
[7:13]
I think
Presentation by staff. Any other
[7:16]
presentations?
[7:21]
The minutes that were provided with the
October 4th August minutes.
[7:26]
» August 4th.
>> August 4th minutes.
[7:31]
It says August 4th.
>> Yeah.
[7:37]
» I think we can approve the August 4th
minutes. Do we have a second?
[7:44]
Second.
Mr. Beatty
[7:46]
Looking good.
[7:51]
discussion
All those in favor say aye.
[7:55]
opposed
Motion carried.
[8:04]
This time we will open up to our meeting
to
[8:08]
items of pertaining to discussion
from anyone in our audience. Uh from
[8:14]
here on we will
continue with our meeting.
[8:19]
Seeing none.
Our next resolution in line for adoption
[8:23]
is 19
21 26.
[8:30]
For our first item
public hearing use permit uh 226-004
[8:39]
Albrad.
[8:49]
» Good morning, Mr. Chairman and
Commissioners. My name is Matt Goetz,
[8:52]
and I'm the senior planner with the
Planning Department.
[8:54]
Today I'll be presenting on lease
termination number 2026-004.
[9:02]
The property being Green Valley
Enterprises at all, and it being
[9:06]
Caltrans.
[9:13]
Proposal for a non-public utility line
for transmission of electricity and one
[9:17]
legal parcel parcel multiple APNs
necessitating right of way acquisition.
[9:23]
Project site is zoned UCAP, upland
conservation and agricultural preserve
[9:28]
combining district, and is designated
extensive agricultural in the Lassen
[9:32]
County General Plan.
Is there
[9:37]
Project
site is along Highway 395.
[9:41]
It's approximately 4 miles north of the
city.
[9:45]
This is a minute site
by the county and that's adjacent to the
[9:48]
subject parcel.
[9:52]
August 16th.
[10:00]
Then we have a vicinity map of the area
showing the project site and listing the
[10:05]
hands
as well as
[10:08]
those transmission lines in red.
[10:12]
You see where it's at in relation to the
highway.
[10:22]
The ordinance for application Lassen
County Code Chapter 18.102 use permits,
[10:27]
which states in part under section
18.102.035
[10:32]
that the Planning Commission shall have
the authority to approve condition or
[10:35]
deny the use permit
application.
[10:38]
Lassen County Code Section 18.102.020
B2
[10:43]
allows [clears throat] for public
utility lines for transmission or
[10:46]
distribution of electricity in all
districts within the approved district.
[10:54]
Project is exempt from CEQA under
section 15061 B3 of the CEQA guidelines.
[11:03]
We have a list of some of the conditions
of approval which will also
[11:10]
If anyone has a question regarding the
application.
[11:18]
» So, I I wanted to just point out the
section that Matt cited. Caltrans is not
[11:22]
a public utility, so we have a section
in our zoning code which Matt just cited
[11:26]
that says that non-public utilities when
they have electric distribution lines,
[11:31]
the transmission lines, that it requires
a use permit. So, since they're not a
[11:34]
public utility, often that section is
applicable to Caltrans, and they
[11:39]
indicate such in their packet as in
their letter as well. But, that's why
[11:44]
I'm reviewing it as for that line for
the right-of-way acquisition.
[11:49]
So, that's typically why it's there.
[11:55]
» Another question, um
why are they putting this new electric
[11:59]
uh electric line?
>> It's for
[12:02]
lighting.
Yeah, for the stations.
[12:25]
» So, that part of it on the what they're
displaying, what they're showing,
[12:30]
that's within their jurisdiction. And
within their jurisdiction, it's the
[12:33]
right-of-way acquisition.
[12:37]
» Uh I didn't pick that up in
[12:42]
But, Caltrans is not
Was it which is not so
[12:47]
Uh probably not.
The
[12:51]
The owner had to sign up on the
application.
[12:54]
Uh but, uh they'll have to have an
easement as well, which they'll have to
[12:57]
execute. But, uh
But, I've I've not had any indication
[13:01]
that
[13:04]
They just need to speak.
[13:07]
So,
[13:29]
Okay.
[13:32]
» This time we will open up the public
hearing portion on this item.
[13:36]
If anyone in favor of this document,
please come up to the left turn.
[13:45]
Being no one here, open up the doors of
all.
[13:49]
Close the door.
[13:52]
Please step up to the left turn.
Thank you, Gary.
[13:59]
Being no one coming forward, we will
close the public hearing
[14:03]
on this item.
Back to the board for further
[14:05]
discussion.
[14:13]
No further discussion, we'll entertain a
motion.
[14:25]
I make a motion to uh
[14:29]
» Uh disapprove this preliminary
application 2026.
[14:39]
» Okay, we have a motion to disapprove
the proposal
[14:45]
before us.
Do we have a second?
[14:51]
Second. The motion will
[14:56]
It's not on the meeting. Okay.
Motion to approve or not.
[15:01]
Proposal.
[15:11]
» Motion to approve it. Do you have the
the number here? Which is what? 2026
[15:15]
108.
>> Yes.
[15:19]
It's uh the resolution number 9 201
6.
[15:29]
We have a motion to approve the
proposal. We have a second?
[15:38]
» I got
I got to go to the
[15:40]
the minutes
[15:44]
The issue was given since the district
the district
[15:49]
They actually think that I was in the
district.
[15:52]
So you can divide the money
You know like that.
[15:57]
First of all, I didn't even do the land
acquisition
[16:00]
and there was any issue in the way.
That was one
[16:04]
thing that was clear so
[16:11]
If and granted it was a high
priority job
[16:15]
I'm very familiar with this location.
I'm driven
[16:20]
every time
[16:25]
It can be a you know a little hostile it
is in the winter time.
[16:29]
But
it's good.
[16:32]
My biggest thing is
you know it's over here.
[16:36]
Um
potential for
[16:40]
causing a fire there.
[16:43]
Look up side right here.
So
[16:49]
I'm going to get some down through the
storm.
[16:53]
I would put it in
[16:55]
I would appreciate it.
This is the risk I
[17:00]
it's on.
It's worth it.
[17:03]
It's laid out.
You know if it was something where it
[17:06]
was underground mines and
[17:10]
it would be a place to store but it's
just the way it looks to me right now.
[17:27]
» So you're responding to a motion that's
on the floor.
[17:32]
Sit there for a second.
You have a motion on the floor from the
[17:36]
commissioner of finance.
Proposals.
[17:41]
Second again.
[17:49]
Thank you, Mayor O'Brien.
[18:00]
So.
[18:03]
You have a motion and a second.
Proposals.
[18:13]
Proposals in favor.
[18:19]
Opposed.
[18:23]
Mr. Terry, Terry.
[18:27]
Three to one.
Um
[18:29]
that's the only item on the agenda.
[18:34]
You have a motion on the floor. I would
like to make a comment.
[18:37]
We've been sitting on this board for
over 15 years. Occasionally we will
[18:42]
disagree.
[18:45]
You know, Gerald and I disagree on items
and you know
[18:49]
disagree
We can agree to disagree, so to speak,
[18:54]
but
I'm glad we brought out those
[18:56]
disagreements
of the board.
[18:59]
Hopefully that uh
I don't know if it's going to take or
[19:03]
whatever. Talk to the public.
[19:07]
Something that uh
appreciated by the public. I appreciate
[19:11]
the from the public.
[19:15]
But, uh with that, uh
it's
[19:19]
a day and we'll entertain a motion to
adjourn.
[19:25]
» To clarify, you don't have to.
>> Okay, we don't have to have an emotion.
