[0:00] city council is too.
[0:03] >> Didn't even know we're getting paid till
[0:04] like a year ago. [laughter]
[0:07] >> Wait, what?
[0:09] >> You think he still doesn't know? It's
[0:10] still a secret.
[0:19] » Okay, thank you.
[0:26] with some creative
[0:56] That's the
[0:56] >> skinny.
[1:21] » Okay. Wonderful.
[1:23] >> All right.
[1:27] » [laughter]
[1:28] >> Hey, here's guy.
[1:31] >> I'll sit by the mayor.
[1:32] >> Yes.
[1:35] >> All right. Well, welcome everybody. We
[1:36] want to kind of kick this off on time.
[1:38] Um, we have a lot to discuss and we are
[1:42] so grateful that you all took the time
[1:44] to come be here. We know that your time
[1:45] has been enormously
[1:48] involved. Um, and so meeting with our
[1:51] city really means a lot. Um, we are, so
[1:55] I'm just going to officially announce
[1:57] this is for the record. Um, we're
[1:59] opening the meeting here at the
[2:00] Tibonogus School District Board here at
[2:02] 5:15 p.m. on Monday, May 4th here in the
[2:05] Lynen City Chambers. And I'll be
[2:08] conducting Mayor Carolyn Lumbard here
[2:10] for this work session. Um, so welcome.
[2:13] We wanted this to be down here and kind
[2:17] of like a council circle versus you
[2:18] looking up at us on the DAS. [laughter]
[2:21] So,
[2:23] comfortable and we can just speak freely
[2:24] and and uh yeah, we're excited about
[2:27] what's going to be happening in the
[2:28] future with you all. So, we listed here
[2:32] um a number of discussion items that we
[2:34] had thought of and certainly uh anything
[2:37] that you want to discuss with us in ways
[2:39] that we can help as a city we certainly
[2:42] welcome and this is going to be a true
[2:45] partnership in our minds as a council
[2:48] staff. So, um hopefully you had a kind
[2:52] of look over this list and um
[2:56] >> yes so first of all who who is kind of
[2:59] our
[3:01] >> great so first of all we want to excuse
[3:04] Sterling Hilton and Grace Rex they were
[3:06] unable to make it other Sterling may
[3:09] come but he did know he could reorganize
[3:11] his schedule at times so um want to
[3:14] excuse them and we are also excited to
[3:16] be here to to get this this partnership
[3:20] kind of continue to like strengthen. Um
[3:23] we want to talk about our
[3:24] accomplishments first. So since we met
[3:27] last as the interlocal with the pass off
[3:30] meeting with the interlocal and passing
[3:33] things off to us to start getting to
[3:34] work, we did we were able to hire a
[3:38] superintendent. We want to thank the the
[3:40] city of Lynon for utilizing this space
[3:42] to do our interviews. It worked so well
[3:44] and and we are a little we were a little
[3:48] homeless at that point. We didn't have a
[3:50] So, it was nice to be able to come here
[3:52] and and have the help your your staff
[3:55] was so helpful with that. We're
[3:56] appreciative of that. Um, so we've hired
[3:58] Joe Dr. Joe Jensen as our superintendent
[4:00] and then shortly after that we hired
[4:02] Jason Sunberg as our business
[4:03] administrator and then they hired Karen
[4:06] Carter who is our executive assistant
[4:08] and we're so I'm so grateful for her.
[4:10] She's taken
[4:12] >> taken a lot of things off of my plate
[4:13] that have been um yeah, just she's just
[4:17] been very helpful. So, we've also then
[4:20] Joe started organizing. It was quick. We
[4:22] wanted to get things going as far as
[4:24] hiring employees and getting things
[4:26] started. So, they have done a great job
[4:28] doing that. Um, we were able to have our
[4:30] kickoff in March. I don't know who was
[4:32] able to attend um that. It was a great
[4:36] start. We have a lot of momentum. We
[4:38] have a lot of excitement from a lot of
[4:40] our administrators, teachers
[4:46] with what we've been able to accomplish
[4:48] in these what five six months that we've
[4:52] been that we've been working.
[4:55] Um so next discussion item is our is
[4:58] there any questions about that about the
[5:01] progress? No, we're we're thrilled. I
[5:04] mean that was one of the reasons why the
[5:05] interlocal wanted the legislature to
[5:07] change that you could be sworn in
[5:09] immediately not wait till January one
[5:10] because I think you know they're doing
[5:12] tremendous job very
[5:16] » yeah can you talk to about our school we
[5:19] opened up because that will affect some
[5:21] women students
[5:23] >> yeah so um we worked uh withd
[5:27] and identified the fact that our Dan
[5:30] Pearson school was going to be
[5:42] short-term solution for those students
[5:45] to have a place to receive some
[5:48] >> special needs like profoundly disabled
[5:51] students.
[5:51] >> So, it'll help students that will be
[5:53] coming from the Dan Peterson School in
[5:55] American Fork. Um, they will be educated
[5:59] hopefully. Our hope is that that will
[6:01] start in August of this year. So any
[6:04] students that are in London that will be
[6:07] I mean for Lynon I think it's pretty
[6:09] probably equidistant between Peterson
[6:12] and the Sharon school but it will be
[6:13] more a better location for some of our
[6:18] >> also opened up another school in the
[6:20] same facility for the 18 to 22 year olds
[6:24] >> who post high school transition. So if
[6:26] you think kids who are in the Pleasant
[6:29] Ohio that have special needs that are
[6:32] served at the local schools, they would
[6:34] come and be served at the uh TEK or
[6:39] whatever we end up naming.
[6:40] >> Typogus, what does it stand for?
[6:42] >> Transition education center.
[6:44] >> Yeah.
[6:45] >> So, it's been a tech if you've heard of
[6:47] that at all.
[6:52] just down just down the hill and then
[6:54] they moved it for
[6:59] » so yeah we're excited about that. Um
[7:03] yeah, any other questions or comments
[7:09] » I'm just having experience on both
[7:10] sides.
[7:12] I don't think this district could have
[7:14] been served better by the board that was
[7:16] elected and people chose to leave.
[7:33] We're not sure about you.
[7:35] [laughter]
[7:44] » Sterling's joined us. Let's do really
[7:46] fast just a quick introduction.
[7:48] >> So I already introduced myself here and
[7:51] start
[7:56] the business administrator.
[7:58] David Smith and I represent west of the
[8:00] freeway in all of vineyard and pieces of
[8:03] >> for
[8:05] Carter executive assistant.
[8:07] >> Joe Jensen superintendent
[8:10] I represent
[8:32] graduate of Aspen Oak Canyon and PG
[8:36] >> and student when we were
[8:38] >> Exactly.
[8:40] He was also a student
[8:43] at 8 back in the day.
[8:45] >> Oh my god.
[8:45] >> When Steve was our assistant principal.
[8:48] >> Well, Westmore, Lincoln or High
[8:51] [clears throat and laughter]
[8:52] >> Lincoln. Stinking Lincoln. Oh,
[8:54] >> no. Westmore Lakeidge Orum.
[8:58] Anyway, uh Sterling Hilton, I represent
[9:00] Southwest
[9:02] >> and Jen Lman, I represent uh Lynon and
[9:05] South Park. All right, let's have our
[9:07] staff because they'll probably be
[9:08] helping the discussion as well.
[9:10] >> Adam Cowi, the city administrator.
[9:12] >> Keith Baitman, I'm the parks recreation
[9:14] director. Mike Florence, community
[9:16] development director.
[9:17] >> Brian Haw, city attorney. Mike
[9:25] Jamie Jensen. I'm a mom. [laughter]
[9:27] >> She's also communicated.
[9:30] >> Yeah. And I work for Linen City as well,
[9:32] but I'm here as a mom.
[9:35] >> Dave Mau, assistant superintendent of
[9:36] operations, secretary for the facilities
[9:39] director.
[9:43] [laughter]
[9:44] >> We don't
[9:47] listen.
[9:48] >> Okay. Wonderful. Anything else on the uh
[9:50] accomplishments or overview of your
[9:52] first five months?
[9:54] I think that's a very short overview,
[9:57] but with the five minutes that's Yeah.
[9:59] >> Okay. Fantastic.
[10:01] >> Um, boundary study status update. Yeah,
[10:03] we are starting our boundary study. So,
[10:05] this is going to be comprehensive
[10:06] boundary study. We call it the MOABs,
[10:07] the mother of all boundary studies. And
[10:09] we're [laughter] looking from the north
[10:11] end of the district all the way to the
[10:12] south because we recognize that things
[10:14] have been kind of um yeah, just as
[10:18] development has happened, it hasn't been
[10:21] cohesive a lot of times. And so, we're
[10:22] looking trying to
[10:25] look at all of that, but also our main
[10:27] objective is to create robust and
[10:30] thriving schools from kindergarten up to
[10:32] 12th grade. We want our schools to have
[10:35] um the amount of students that will will
[10:39] help facilitate good collaboration
[10:42] between teachers and be able to have
[10:44] enough specialties. We're also looking
[10:47] to our principles and some staff and our
[10:52] parents to get our criteria. So, we know
[10:55] as a board, we recognize that we're
[10:57] seven people and we have an idea of what a robust elementary and secondary
[11:02] schools look like. But we also recognize
[11:04] as I think we've learned in all this
[11:06] process that the more information we
[11:08] gather from constituents just learning
[11:11] going to other schools, I mean other
[11:12] districts and collaborating with them,
[11:14] we're finding we don't know everything.
[11:16] And so, it's very helpful. So, we are
[11:18] crafting actually a process for our
[11:20] boundary study that will allow us to set
[11:22] a criteria for what we want our schools
[11:25] to kind of have a a framework, right?
[11:27] You would say framework for um as we're
[11:30] doing this boundary study, how we're
[11:31] going to do that. So, so is there going
[11:33] to be a public official public input
[11:35] process?
[11:36] >> Yeah, we're but we're in early stages.
[11:38] So, that's
[11:40] >> we're gonna have we're going to start
[11:41] with some focus groups. Um we're going
[11:43] to have some we just talked about this
[11:45] in leadership, so I'm saying maybe some
[11:47] of the board doesn't even know yet, but
[11:50] >> boundary studies. [laughter]
[11:56] » Um, we're creating committees that will
[11:58] have board members and principles and
[12:00] staff on them. And then we also want to help just set the criteria. That's
[12:05] going to be our first step. We want to
[12:06] know, okay, what are we looking at when
[12:08] we're looking at this boundary study and
[12:09] trying to make all these changes and use
[12:12] this wonderful tool that actually Alpine
[12:13] School District has created that we can
[12:16] see, we can plug in addresses, right? Or
[12:19] create a Jason's going to be doing that
[12:21] part. That's why I keep looking at him.
[12:24] >> Yeah. That we can we can put a boundary
[12:26] and say, "Okay, what's this going to
[12:27] look like? What's how's this going to
[12:29] work?" And we can keep playing with it.
[12:31] But until we have that criteria of what
[12:33] we're looking to create a thriving
[12:36] school. Um then we don't have a lot of
[12:39] information.
[12:40] >> Our agenda this this uh Wednesday will
[12:43] include a study session wherein we'll
[12:46] talk about what a healthy school looks
[12:47] like
[12:48] >> at the elementary level and then we're
[12:52] also officially launching the boundary
[12:55] study which is has a timeline that's
[12:58] regulated by law.
[12:59] >> Yeah. So it's there are certain things
[13:01] and we don't want to just hit those required by law. Our goal is to go
[13:06] above and beyond to make sure our
[13:08] constituents feel heard and that we are
[13:12] fully informed as to to what we want to
[13:15] do. And we're looking our goal is to
[13:17] look very far ahead like 20 or 30 years
[13:21] down the road. We don't want to be
[13:22] making decisions that are just good for
[13:24] the
[13:25] >> people feel disrupted.
[13:26] >> Yeah, some years down the road that
[13:29] sounds great.
[13:30] >> That will also include a study of
[13:32] programs.
[13:44] I've been impressed just how transparent
[13:46] this board is about
[13:52] to be completely open.
[13:58] I would simply add again to your point
[13:59] about public input. I think it's we want to provide mult points for that.
[14:05] Not just
[14:10] when we're establishing the criteria.
[14:31] The main focus I think of the
[14:33] staff through the summer. So, we plan to
[14:37] >> and I know that our staff communicates
[14:39] well, particularly with your city
[14:41] planner.
[14:44] I think we need to to be talking with
[14:46] each other.
[14:54] » Okay. The tsd projected financial over
[15:01] » [laughter]
[15:02] >> I think we're down to two.
[15:05] >> Yeah, just kind of a high level summary
[15:08] here. So what for many years we've
[15:11] looked at Alpine looked at okay if this
[15:14] configuration was in district split or
[15:16] this one what would it look like once we
[15:18] have the full data so the last year we
[15:20] were able to do that where we have
[15:21] actuals is for fiscal year 25 which
[15:24] ended last June June of 25 and so in
[15:28] looking at that the schools that are in
[15:30] the Tempoga school district and the
[15:32] estimated revenue that would come just
[15:35] when we're looking at operations
[15:37] estimated about an 18 to20 million
[15:40] annual deficit
[15:44] how the schools with the expenses that
[15:46] are at the schools actual expenses and
[15:48] then looking at okay there was this many
[15:50] students and this is an estimated
[15:53] overhead cost per student at the
[15:55] district level we estimated that so
[15:59] something we're we're looking at. Um and
[16:01] that's that 20 million or 18 to 20
[16:04] million is about um 8 to 10.
[16:10] So looking at ways I did a presentation
[16:14] to the school board back in December
[16:17] just looking how can we make that how
[16:19] can we correct that deficit. So there's
[16:22] really three ways to do that. Just keep
[16:24] expenses where they are and raise
[16:25] revenue which would be through property
[16:26] taxes or be able to lower the expenses
[16:30] um in the the schools and keep revenue
[16:33] where it is or some combination of both.
[16:36] So, as we're looking at things, we're
[16:37] thinking that option three is going to
[16:39] be the most likely as we're looking at
[16:41] different things to be able to make that
[16:43] work. Um the nice thing right now Alpine
[16:47] School District could set up a building
[16:48] fund in the capital fund that generates
[16:51] for Tempog would generate about $20
[16:54] million per year. So, if there's
[16:58] the combination there. We won't have to
[16:59] necessarily do it all through raising
[17:02] taxes. There's some movement that can
[17:03] happen between taxes
[17:06] that we close as Alpine closes this
[17:10] fiscal year that'll end in a month or
[17:11] so. We'll do another
[17:26] starting December
[17:31] first
[17:37] is that what's been helpful. We've been
[17:39] working with ASD and as we hire from
[17:42] employees that are current ASD
[17:44] employees. Uh ASD is continuing to pay
[17:47] their salaries because we don't our $60
[17:50] a student that we're getting would not
[17:52] cover the staff that we've hired to this
[17:54] point. So that is being covered by ASD
[17:56] because they so they will continue to
[17:58] work for ASD like Dave and Zach are
[18:01] still working for ASD and are
[18:03] technically ASD employees through July
[18:05] of 2027. But is going to allow them to
[18:10] be our
[18:12] um work for us maybe one day a week
[18:14] starting in July and they can have time
[18:18] that they can help us right now too. But
[18:19] so it's kind of this graduated um
[18:23] step by step transition to come in and
[18:26] work for us. So we're not paying
[18:31] » and and Joe work Joe is working he um
[18:33] with Joel Perkins who is the Aston Peak
[18:36] superintendent and Vicky Carter who is
[18:38] the Lake Mountain superintendent. So
[18:40] they coordinate that so and they try to
[18:42] keep it even and fair as far as as
[18:45] hiring you say they're working well
[18:47] together. We are yeah I think a couple
[18:50] things that people have brought up is
[18:52] are there well you know interlocal
[18:54] agreement opportunities to
[18:57] you know.
[18:57] >> Yeah. And we're working on that
[18:59] >> versus reinventing the wheel for all
[19:00] three.
[19:01] >> Yeah, we're working on that with
[19:02] negotiations. So, Sterling and I and Joe
[19:04] are on the committee that is negotiating
[19:06] with Lake Mountain and Aspen piece. And
[19:08] so, yeah, we are like people we have
[19:13] various things that we're like we're
[19:14] working on. Intellectual property, how
[19:16] are we going to handle stuff that was
[19:18] created
[19:20] >> IP? So, intellectual property, how are
[19:22] we going to handle that?
[19:24] services, transportation, there's a
[19:26] whole host of things that we are it's in flow. So, it's not that we can
[19:32] say or report anything, but it is in
[19:35] discussion.
[19:36] >> Are there any uh bonds that are falling
[19:39] off in the near future where you know
[19:41] you could have a new bond that just
[19:43] replaces an old bond so for the general
[19:45] public taxes just stay?
[19:48] >> Yeah, it's a great question. So, there
[19:50] the last few years there's been
[19:53] debt a big drop off now it's kind of
[19:55] stable but the next 8 to 10 years the
[19:57] geo bond debt will go away the least
[19:59] revenue bond goes out to about 15 or 16
[20:06] that's something we'll Look at
[20:30] » the LB is kind of an internally
[20:33] funded based revenue is not require
[20:39] But we are limited as to how much we
[20:46] » three years and the the payment for
[20:47] those can't come from the debt service
[20:50] levy that the geo bond generates. So
[20:53] with the general obligation bond the
[20:56] voters have approved that. So whatever
[20:58] interests
[21:16] me an understanding potentially save the
[21:18] cost of standing up from scratch
[21:22] maybe on a smaller scale initially
[21:25] >> most of them
[21:27] Peak and
[21:29] just because
[21:31] >> there's more there's more between as
[21:34] peaks and typographically
[21:37] >> but there are a handful that include all
[21:39] three
[21:44] » and nothing has been signed. Those will
[21:46] be coming you know as they're created.
[21:49] You know how it works with you have
[21:51] three different entities and something
[21:52] comes it's like oh I don't like the way
[21:54] this we need to change this a little bit
[21:56] then it goes back to the drawing board
[21:57] and so it's just it's just a process
[22:07] » um moving on the uh drop off and pickup
[22:10] traffic and parking congestion safety at
[22:12] some of our schools. Yeah. So this was
[22:15] um I talked I Just in the first
[22:19] iteration of this, it mentioned Oak
[22:20] Canyon. And so I went and met with Oak
[22:23] Canyon about their issues and they
[22:27] recognized that there is a lot of
[22:32] uh but they have also
[22:35] done they've worked with they've hired a
[22:37] traffic engineer to come and work and
[22:39] they have closed some entrance and exits
[22:42] to try to make the flow be more just one
[22:45] way. Um options that they suggested but
[22:48] would be on on your end as far as the
[22:52] city would be um to the west and being
[22:56] able to create a turn lane on Canal or
[22:58] Eagles whatever canal drive right there
[23:02] and then the other would be making
[23:06] and so people could only come in from the south and then exit out through
[23:12] canal drive some of the flow our
[23:15] engineers haveordinated some improvement
[23:17] on flow. Parking is still and I know
[23:21] maybe um our city administrator Adam
[23:23] Cowi could kind of share on the map,
[23:32] » you know, and for time here tonight,
[23:35] maybe it's just it's we'll we'll look at
[23:38] this really fast, but maybe just point
[23:39] us
[23:40] >> point us in the right direction for who
[23:42] we can talk with in the future. So,
[23:47] This was never a problem when Steve and
[23:48] I were the assistant and just to make it
[23:51] clear we figured that out.
[23:55] >> All right.
[23:56] >> So, so right now we've and you're
[23:58] probably most of you are familiar with
[23:59] this is where we've got parents that
[24:01] stack all the way down this side of the
[24:04] roadway and there's really not enough
[24:05] room for them to park. Um, and then we
[24:09] have a huge amount of kids that I think
[24:11] their parents are just saying go over to
[24:13] the church. And so this this becomes a
[24:15] drop off and pickup area and a lot of
[24:16] congestion with kids on this
[24:18] intersection. And
[24:20] >> over 100 cars to park there within a
[24:22] 15inute period of time.
[24:26] >> So I think for the purposes of tonight
[24:30] uh we we can introduce ourselves to your
[24:32] facilities
[24:34] >> uh director there and and talk more
[24:36] about this. We know this is still Alpine
[24:38] School District, but just wanted to give
[24:40] you a heads up and and and to kind of
[24:42] lead into the SRO conversation on that
[24:44] next bullet point, a similar issue. We
[24:47] know that's currently Alpine, but um
[24:49] Jason and I have had a few conversations
[24:51] and we'd love to talk more about that in
[24:53] the future. So,
[24:54] >> Adam, would you just share the quick
[24:55] couple of ideas like to to use that back
[24:58] area a little bit more and utilize that
[25:00] for parking?
[25:01] >> Yeah, our city engineer actually met
[25:02] with um some of the people here at
[25:04] Alpine. It's probably been a year and a
[25:07] half or two years ago. Um, this this
[25:09] space back here, you can see actually
[25:10] it's underutilized with parking and
[25:13] there is a little access road that goes
[25:15] around the back of the school. And so
[25:16] we've we've been curious if there's
[25:19] ability to put more teacher parking back
[25:22] here perhaps where it frees up some
[25:23] space out front. Just
[25:25] >> throwing that out.
[25:31] a lot of students and where that's
[25:33] almost kind of a blind corner. They're
[25:35] concerned about they talked about also
[25:37] putting having buses do that and then
[25:39] they could capture that that north
[25:43] parking lot a little bit better and
[25:44] utilize that for drop off. But that turn
[25:48] a school bus just can't do it. It can't
[25:51] turn that 90
[25:54] additional parking back.
[25:56] >> They do use that green space. So they
[25:58] have a nine square permanent nine square
[26:00] now um back in that green space and they
[26:02] are encouraging students to use the
[26:05] green space between the buildings
[26:08] >> a little bit more with the new cell
[26:09] phone policy up [clears throat]
[26:14] » this is part of the concern right now is
[26:16] we have a lot of parents that line the
[26:17] street and we've got kids jumping across
[26:19] the road way while there's also traffic
[26:21] going through it and so we'll we'll just
[26:24] wanted to introduce the issue to you
[26:26] tonight and then we'll keep talking
[26:27] about though they know they have that
[26:30] entrance. There's no exit there anymore.
[26:32] So that that traffic flow should not be
[26:34] coming in and out right there. It should
[26:36] just be going in. And then you should
[26:38] just have it. And they've encouraged
[26:40] parents to just drop off actually up at
[26:43] that that more northern where it's just
[26:46] grass and not do it in the parking lot
[26:48] area. So there should be a a cue, but
[26:52] >> you know do what you tell them to do.
[26:57] sometimes doesn't work very well. Also,
[26:59] that back area. So, we have the the
[27:00] trailers back there. There is a little
[27:02] bit of parking back in in that on that
[27:05] northeast corner, but that is also the
[27:08] that's where students go. So, they come
[27:09] out that very north end and then they
[27:11] walk over to the trailers. So, we would
[27:13] want it makes sense that they keep that
[27:16] traffic minimized just because there is
[27:20] >> the road there has had no parking signs
[27:22] all along that west boundary because the
[27:24] road isn't wide enough. Yeah. So, I was
[27:27] talking with Ben about that and it is
[27:29] it's the the canal is open to about
[27:31] halfway through where those trees are.
[27:33] Um, is it possible to pave because I did
[27:36] I searched the plat map and it's owned
[27:37] by Ali School District, but is there can
[27:41] we pave over that area?
[27:45] >> Could we widen the road a little bit so
[27:46] there's actual proper parking? You can
[27:48] see in that photoally parking
[27:50] >> when you say parking mean standing like
[27:53] >> they're not parking and going into the
[27:55] school. Some of them are in the evening,
[27:57] especially for evening activities. That
[27:58] whole road says no parking, but it's
[28:00] filled with people parking and like Adam
[28:02] said, kids are running across the road
[28:04] because parents are waiting over there,
[28:05] but it's a it's an unsized road profile
[28:08] already.
[28:09] >> Yeah. So,
[28:10] >> what because I had been told as just as
[28:12] a parent that um you oh, we can't pave
[28:15] over canal, but then we followed that
[28:17] canal as it goes all the way through
[28:19] Orum and Pleasant Grove and there's
[28:22] plenty of places where it's paved over.
[28:24] It's built over. So I I don't know.
[28:27] >> Can it be done? Yes, it would be very
[28:29] expensive because we would have to make
[28:30] sure that that canal pipe that's
[28:32] underneath it either supports that
[28:34] traffic load or is removed.
[28:36] >> And so there's some footage though like
[28:39] the grass there was a distance before
[28:41] the pipe.
[28:42] >> Not to belabor this, but you're asking
[28:43] to park vehicles here and then have kids
[28:46] cross the street. Oh, I my ask would be
[28:49] to keep it that way and we enforce that
[28:51] there's no parking there, but to give a
[28:53] third lane, have a turn lane.
[28:56] >> We'll have to keep talking about this.
[28:57] So, I'd love to get our city engineer
[28:59] involved. So,
[29:01] >> and the traffic's just going to get
[29:03] worse with the temple traffic because of
[29:05] the
[29:06] >> Exactly.
[29:06] >> There's going to be a lot of people
[29:07] accessing the temple through this.
[29:11] >> So, that leads us into our uh our
[29:14] resource officer coordination. So,
[29:18] >> you know, on this item right now, we
[29:20] just we just wanted to bring it to your
[29:22] attention that there's some disparity
[29:24] between what what some of the SRO's are being paid as far as the parent
[29:28] entity that that hires those SRO's. And
[29:31] so, it was just bringing that to your
[29:33] attention. And then our our chief had brought up some additional things
[29:36] with the agreement that we'd like to see
[29:39] um addressed or looked at in the future.
[29:41] And so we can again I think tonight was
[29:44] just point us in the right direction and
[29:45] we can start with with your
[29:47] administrators and superintendent and
[29:50] >> follow
[29:54] » uh school resource officer
[29:57] >> so that's officer
[30:00] >> but I think you're talking about
[30:01] comparison of other cities right
[30:05] >> isn't that is it I was my understanding
[30:07] it was standard through the district
[30:11] Just this current fiscal year we're in
[30:14] there was budget approved to bring all
[30:16] the cities
[30:30] but I did check with provo and they're
[30:33] in the same
[30:36] but my understanding that's not what the
[30:38] officers are making that's
[30:40] from the district.
[30:43] >> We do appreciate the at all the schools,
[30:46] but I wor
[30:52] for a bit then we switched over to
[31:05] » um All right. So, our parks and rec
[31:07] director maybe Keith could share about
[31:09] how love to have a little bit more
[31:10] collaboration with.
[31:12] >> Thank you, mayor. Um, you know, Neibo,
[31:15] speaking of Neibo District, they have
[31:16] Anita's thing. My colleagues in Nebo
[31:18] District have keys to the schools
[31:21] and they the schools have keys and a
[31:24] usage [clears throat] to the pools for
[31:26] their swim teams
[31:27] >> and for those situations. I would hope
[31:30] I'm sure that or if you just bump them
[31:33] pleasant and vineyard all of us would be
[31:35] in the same they don't even really keep
[31:38] track of what you rented what we rented
[31:40] they just kind of get together and sum
[31:42] it up well you used a lot more than us
[31:43] and maybe we ought to have a little
[31:45] money but if that's working in neibo uh
[31:49] we would love and we've been to ASD
[31:51] several times as parks directors in the
[31:54] last five or seven years and met with
[31:56] their assigned person for that they
[31:58] didn't interested in it. We actually
[32:00] brought someone from MEO to help explain
[32:02] it and there wasn't much interest there
[32:04] from the current folks, but if we could
[32:07] just look at that and see if we could
[32:09] just be a real good partner and we take
[32:13] care of the janitor service and city,
[32:15] you know, we just be a really good
[32:17] partner. We clean up. We take care of
[32:19] the buildings as if they were ours and
[32:21] the school district would do the same
[32:22] for facilities that they need from us.
[32:25] In Limon, it'll be a little different.
[32:26] We don't have a lot that the school
[32:27] district wants, but we also don't have a
[32:29] high school. So, we've got a junior high
[32:31] gym and and a couple elementary gyms.
[32:33] So, we wouldn't have a big ask either,
[32:36] but uh maybe
[32:38] >> what is currently utilized between with
[32:41] Lynon Parks and Wreck and
[32:43] >> we use Oak Canyon quite a bit and then
[32:46] we use
[32:46] >> you use just the gym space or do you use
[32:48] any field space?
[32:49] >> We do use we don't use any field space.
[32:51] >> Okay. We'd love to but we haven't used
[32:53] that in big field but also the
[32:55] auditorium we've used.
[32:57] >> Okay.
[32:58] >> Um and then the elementary mostly Lynon
[33:01] Elementary it's close by us and we've
[33:03] been able to drop over there and have a
[33:05] basketball league over there. Principles
[33:06] have been great. Kate Ross is
[33:08] outstanding.
[33:10] >> She's been really helpful to us. But uh
[33:13] it could be a little easier and smoother
[33:15] for both I think if we could just figure
[33:18] and then years ago if I just One more
[33:21] thing. Years ago, the school district, I
[33:23] don't know if they did it inadvertently
[33:25] or not, but it seemed that they put like
[33:27] the uh AAOU basketball as a priority
[33:30] ahead of the city rec programs. So,
[33:33] those those groups were getting priority
[33:35] gym time because of the revenue, I'm
[33:37] sure, but that really hurts us for
[33:41] charging $30 a kid for recreation
[33:44] basketball.
[33:44] >> And is it safe to say that you guys are
[33:46] increasing your more of your fields? It
[33:50] seems like like
[33:50] >> Yeah, we we're always building.
[33:52] >> Yeah, we had about 600 700 kids in
[33:56] basketball. Maybe not quite seven, but
[33:58] 650 in basketball, but our soccer is 12
[34:01] or 1100 right around there kids. So,
[34:04] we're we're we're growing. We service a
[34:06] lot of South Orum and and some of
[34:09] Pleasant Grove.
[34:10] >> So many of our kids aren't so many of
[34:12] our kids bleed over into schools in
[34:14] other cities that these aren't.
[34:17] >> So, I don't think this is a Lyndon ask.
[34:18] I think if you ask the other cities,
[34:21] yeah, the the other directors, well,
[34:24] we're all on the same page. It would
[34:25] just be like maybe Neibo handles that. I
[34:27] don't know the exact details, but it's
[34:29] more of a partnership than you rent from
[34:31] me and I'll rent from you and then my
[34:34] rates go up and your rates go down and
[34:37] so we could just maybe look into that in
[34:38] the future.
[34:39] >> And we have collaborated with Nebo. I
[34:42] have anyway with their president down
[34:43] there. So I will who is it that we would
[34:46] talk to if we vote you know
[34:47] >> you know I have to admit I think I would
[34:49] pass this off well I have a couple
[34:52] colleagues in Springville in the city of
[34:54] Springville and I don't because we don't
[34:56] have a big ask for schools I don't know
[34:58] the contact person right now
[35:00] >> but the
[35:03] >> yeah and there's this just been when my
[35:06] colleague jingles the keys to the
[35:08] schools and says well we don't have to
[35:10] have that much that we do as a city that
[35:14] I mean maybe we can all mention a couple
[35:16] things that we contribute to the schools
[35:18] is you know elementary this just a few
[35:21] months ago we had they had an emergency
[35:23] drill and acting like a if there was you
[35:27] know an active shooter and they used our
[35:30] community center as the place for
[35:31] parents to pick up and kind of have the
[35:34] operations there. So you [clears throat]
[35:36] know our community center is very
[35:38] interchangeable.
[35:40] We also do many grants to all the
[35:42] teachers out of our budget every year.
[35:45] We I think how many how many grants did
[35:48] we get? 22
[35:51] teachers that they can apply for Aspen
[35:54] Oak Canyon all thearies. So, um,
[35:58] >> Jen, I'm happy to to find out from my
[36:00] colleagues who
[36:01] >> that
[36:03] Yeah, I'm happy to find that out. And
[36:05] when Kate was at this school here, Kate
[36:07] Ross was here at this school, she'd call
[36:10] me up and she'd say, "Proble with my
[36:12] gym. I got to send come on over." And
[36:14] that was a really great partnership. And
[36:17] she we just it was so slick, so nice.
[36:20] instead of worrying about too much of
[36:21] the fee schedule to be honest with you.
[36:23] >> And a lot of the kids at the last week
[36:25] of school, they call up heat and they
[36:26] come have a swim day.
[36:32] » If it's snowing the last
[36:36] we've tried to do parties sometimes
[36:38] like, oh, it's 53 degrees. We're not
[36:40] gonna go [laughter] to
[36:42] >> Okay. All right. So, update on the
[36:44] potential tsd admin office. We've heard
[36:46] some
[36:49] So, um, as it sits right now, we are
[36:52] looking to utilize our current campus
[36:54] there in that we have in Lynon. So,
[36:57] we're looking at different storage
[36:59] facility.
[37:00] >> Well, yeah. Yeah. So, that we're just
[37:02] calling that our Lynon. So, it houses
[37:04] physical facilities now and um
[37:07] technology and purchasing. So, that's
[37:09] where Joe and Karen and Jason have their
[37:12] offices is in in that building right
[37:14] there. Uh, 490 North State. And there's
[37:17] a good piece of land in front to build
[37:20] and expand.
[37:21] >> Yeah. So, so that's that's our our
[37:24] thinking right now. So, and there's a
[37:27] lot of space behind. Um
[37:30] Yeah, that's actually being used a lot.
[37:32] They that's where the main facilities
[37:35] for Alpine School District is housed.
[37:37] They have their they have a whole almost
[37:41] business thing happening back there with
[37:43] electrician, HVAC, plumbing.
[37:47] carpeting carpentry.
[37:50] >> Um yeah, so um really great asset that
[37:54] we're we're taking
[37:58] and we we were we have ideas on how to
[38:02] make
[38:05] » we love that it's we love that it's
[38:07] centrally located. It's on State Street.
[38:10] So I mean there's it's we just think
[38:13] that's that's a good location. Is there
[38:16] you need from the city in regards to
[38:18] this.
[38:19] >> Is there a height regulation?
[38:21] >> Yeah, zoning as far as
[38:26] » stories.
[38:30] Is that including any steeples we put on
[38:32] it? [laughter]
[38:34] >> We have to have two steeples.
[38:37] >> Now, if you do have any site planning
[38:39] issues or questions on utilities, Mike
[38:42] Lawrence with our community development
[38:43] office
[38:45] to Enter through the lower side of our
[38:47] building just down here on the lower
[38:48] parking lot.
[38:53] » Do you have a city plan as far as
[38:58] planning for the future plan?
[39:01] >> I mean, I think that road was originally
[39:03] planned to connect all the way through.
[39:05] I don't
[39:20] property there is for sale.
[39:24] adjacent to that
[39:27] >> loc.
[39:42] » It's a It's a residential. The res the
[39:44] resto right hand corner.
[39:46] >> Stray Sandra.
[39:47] >> It's the Sandra.
[39:48] >> Okay.
[39:50] >> Bottom right. the bottom.
[39:52] >> Yeah. And then the uh along State
[39:54] Street, so the southwest
[39:57] end
[39:59] >> there. I've I've heard that some the
[40:02] owner of that is planning to develop or
[40:05] do something there. I don't know if you
[40:07] want
[40:09] something.
[40:11] >> Do you have any updates on that? Our
[40:16] goal is to put something that's gonna
[40:20] be attractive and would be an asset to
[40:23] the city of London. So
[40:27] » we're going to call our home.
[40:30] >> That's right.
[40:31] >> District seat, right? [laughter]
[40:34] >> We're hoping that you put in a Maverick
[40:36] close to that.
[40:42] » [laughter]
[40:43] >> That's a very temp that's an example of
[40:46] a very temporary need. We're thinking
[40:48] long term. [laughter]
[40:51] >> There is a swig and a fizz
[40:55] >> block south.
[40:58] >> They're on 400 North.
[41:00] >> Yes.
[41:00] >> Yeah. They talked about putting a gas
[41:02] station there early, but the wife of the
[41:04] person who owns it said he would need to
[41:06] find a new wife. So, it's possible.
[41:08] [laughter]
[41:10] >> I don't that they still own it. I I've
[41:12] heard that the ownership may have
[41:13] switched hands now. Are they
[41:15] >> It was It was the same people that
[41:20] >> was
[41:25] not
[41:29] pizza factory.
[41:34] have that little rodeo ranch.
[41:41] » We will need to have it completed by the
[41:44] time we have employees. We need to have
[41:46] a place to put our employees. So,
[41:48] >> so we're hoping within our plan is
[41:50] within a year
[41:52] >> year plus.
[42:05] Um, okay. So, hey, we are getting
[42:07] through this.
[42:11] » I looked at this and I was like, there's
[42:12] no way.
[42:14] >> Like, there's no way.
[42:15] >> There's a way.
[42:16] >> Okay. So, future meeting schedule, we
[42:19] would love to, you know, coordinate,
[42:22] collaborate.
[42:23] I know you mentioned in the past um in
[42:26] the beginning sometimes
[42:30] quarterly by annually what yeah whatever the council would like we are
[42:34] meeting with ORM so we did a couple
[42:36] weeks ago tax day and they we came to an
[42:41] agreement that we would do it three
[42:42] times a year so every four months but we
[42:46] are
[42:50] it might be more appropriate for us to
[42:52] do it more often there
[42:55] >> [laughter]
[43:00] >> that goes along with it.
[43:05] [laughter]
[43:06] >> Now, you do know that London is the um
[43:10] the high elves of it is the capital of
[43:14] the higher. [laughter]
[43:19] » Okay. [laughter]
[43:25] » [laughter]
[43:34] » All right. Anyway,
[43:36] >> so yeah,
[43:38] I mean
[43:41] >> I mean we can play by ear or we can just
[43:44] council staff.
[43:47] >> I think what we think
[43:51] suggested since there were four cities
[43:52] that we were coordinating with that we
[43:56] could do one a month and hit everyone
[43:59] throughout the year.
[44:01] My thought was to get like
[44:05] in my brain I was thinking okay each
[44:07] quarter there's three months so we'd hit
[44:09] each city and then double up one of the
[44:12] months but then so when they wanted to
[44:14] do it three times a year I was like okay
[44:16] that's fine I didn't push the issue
[44:18] >> totally
[44:19] >> three times a year would be once with
[44:21] every four cities per month just
[44:24] >> well we just have a meeting month but it
[44:26] hasn't h
[44:28] hasn't really happened that way because
[44:29] we're going to double up in Okay. And so
[44:32] >> I imagine that there's going to be
[44:35] >> I know you're still figuring out the
[44:37] boundary study thing, but I would highly
[44:39] encourage that there's lots of meetings
[44:42] >> and when we can come here. I don't know
[44:44] if you plan to do it in the different
[44:45] cities.
[44:46] >> We really want to make sure people feel
[44:48] like, and I liked your comment, early,
[44:50] not towards the end, that they're
[44:52] involved all the way. the transparency
[44:55] comment that that's going to be critical
[44:58] >> and and from the budget type of a thing.
[44:59] Everything we're doing to save money is
[45:03] be the things I think to focus on as
[45:04] well to make sure people know those I
[45:06] know they are but it's helpful when
[45:08] people hear
[45:09] >> and I'm going to push back on you Van
[45:11] because we're going to focus on the best
[45:14] teaching and learning experiences for
[45:15] our teachers for our kids and any
[45:18] budgetary savings is going to be a side
[45:22] effect. that's not going to be our our
[45:24] main focus. Our main focus of this board
[45:26] and I think of our staff is going to be
[45:28] providing the best education. We have
[45:30] three new districts that are going to be
[45:33] in close geographical proximity. So, and
[45:36] one of and I've talked with Carolyn
[45:38] about this before. We want to attract
[45:41] our students back and so we're focused
[45:45] on on doing
[45:47] >> on doing that the best way solve the
[45:49] revenue issue is attracting back people
[45:51] who have chosen other education
[45:53] platforms
[45:54] >> and Lindon that's there's a big example
[45:56] of that.
[45:57] >> So um
[45:59] >> so that's what you're going to hear our
[46:00] focus is going to be a lot on what is
[46:03] creating the best schools what is that
[46:06] going to look like and I agree that
[46:09] there's going to be some cost savings
[46:10] that will come along with that, but
[46:11] that's not going to be our why. Our why
[46:14] is what is going to be best for teaching
[46:17] our students.
[46:18] >> To to Van's point though about the
[46:21] meetings and possibly even having a
[46:23] meeting here, one of the things I
[46:25] appreciated about our visit with Orum is
[46:27] they talked about
[46:29] using ORM's communications platforms to
[46:32] help get our message out. And so those types of things would be really
[46:36] helpful as well. Um I think anytime we
[46:40] can get as many stakeholders and you
[46:42] guys are obviously very influential
[46:44] stakeholders,
[46:46] you know, helping promote a message of
[46:49] this is about robust schools and
[46:50] >> positive,
[46:52] >> right? And and that's going to help
[46:54] because it's no matter what we do with
[46:58] any kind of consolidation, it's going to
[47:00] be high emotion.
[47:01] >> Yes, it will be. It's challenging.
[47:03] >> So how we do it matters and we the
[47:06] messaging getting everyone on board,
[47:08] feeling heard and on board. And I just
[47:10] have to to to give Van some kudos. I
[47:13] think to what Van is speaking to and
[47:15] what this council demonstrates, what
[47:16] this staff demonstrates is in Lynon, we
[47:19] are small town, big amenities, but we
[47:22] often find out of the box solutions to
[47:25] minimize raising taxes and fees, but not
[47:29] compromise service and quality of life
[47:31] in our community. So, I think that's I
[47:34] think that's the spirit of the message.
[47:36] >> Absolutely. the student experience.
[47:38] That's why we do this.
[47:40] >> It's it's really easy to raise a tax and
[47:42] a fee versus just dig deep and find ways
[47:45] to justize and still get a great
[47:47] >> Well, that's what I'm excited about with
[47:49] um you know, the way Joe has set up his structure is it's hyper it's super
[47:55] focused on that teaching and learning.
[47:57] And what that actually does is there
[48:00] could be some savings costwise as far as
[48:02] having a smaller district
[48:06] some smaller district staff and just
[48:07] replicating everything that we need and
[48:10] you know replicating what ASD has done
[48:12] and so his his attention at having these
[48:15] this we call him the super six so it was
[48:17] the first six hires that he did um they
[48:20] also are going to be supervising schools
[48:21] so that takes out a layer of supervisors
[48:24] that ASD currently has just because of
[48:26] their size that they have the cabinet
[48:28] level then they have supervisors then
[48:30] you have the schools
[48:31] >> that's a great
[48:32] >> so so we are we're trying to think
[48:34] outside the box and it also puts district very close to
[48:40] schools which sometimes that distance
[48:43] creates some issues. Something that I
[48:45] think I've heard and I'm sure you're
[48:47] hearing and will hear is um when it
[48:50] became a east versus west kind of tribal
[48:53] situation before the split, you know, um
[48:56] a lot of people here are saying we still
[48:58] want to have we don't want these big
[49:01] giant magnet schools that everyone's
[49:03] commuting to and driving to and then
[49:05] they're huge. We still want to have that
[49:07] balance of the walkable bikable for the
[49:11] children neighborhood schools. They
[49:12] really are an asset in the what they do
[49:16] for quality of life and economic
[49:18] prosperity and just the kids having that
[49:21] maker. So we hope that the mindset for
[49:24] this district will be not gigantic super
[49:27] schools that are everyone has a drive to
[49:28] but
[49:30] we understand there's going to
[49:32] potentially be some property boundary
[49:35] shuffling the deck whatever but
[49:38] >> I've understood when you talk about
[49:41] schools that the concept I've understood
[49:44] it.
[49:45] >> Yeah. Is being able to provide
[49:46] >> robust schools. You got everything in
[49:49] that area.
[49:51] >> Being able to provide like we're looking
[49:53] at specialty and programs and
[49:59] bulk of our payments or our costs as a
[50:02] district are going to be people, right?
[50:09] And we want to maximize that. Not don't
[50:13] maximize that we're going to make huge
[50:15] schools, but it's just maximizing each
[50:17] property to be able to impact each
[50:20] student's learning at the highest level.
[50:23] So, we want our students to have choice.
[50:26] And sometimes when our schools get so
[50:28] small, they don't have choices.
[50:36] » You get a small school,
[50:38] >> you can't have art and music and PE as a
[50:40] specialty. And so, impacts the whole
[50:43] school, all the kids and the teachers.
[50:45] >> And sometimes principles are forced to
[50:47] make those hard decisions whether he
[50:49] combines he or she combines grades which
[50:51] is the worst
[50:54] math this year next year is going to
[50:56] have a first second grade split. So you
[50:59] will have a class that has half first
[51:01] graders and half graders [clears throat]
[51:03] and that teacher has to try to manage
[51:06] that and that is a function of it's a
[51:08] small school and they don't have as much
[51:21] population.
[51:23] >> These are all things that we want to
[51:24] discuss in public.
[51:26] >> Part of the criteria,
[51:28] >> it's going to be part of the criteria
[51:29] that we're looking at as we're crafting
[51:30] this whole
[51:32] framework on how we're going to be
[51:34] looking through the lens through which
[51:35] we're
[51:35] >> kind of what what student populations
[51:38] and I I love that you said too, you
[51:40] won't necessarily be like what's the
[51:42] population these schools will have in
[51:44] 2027 or 2028. Yeah.
[51:46] >> But what's a starting point that we can
[51:48] at least make sense financially, but I'm
[51:52] assuming we're going to grow because
[51:53] we're going to win back some of the
[51:55] families that have left
[51:57] >> public ed and then right
[52:02] and um so I didn't mention it in our
[52:03] accomplishments, but I'm very proud of
[52:06] us for having done this. So I want to
[52:08] mention it maybe we can end with it.
[52:12] But um we visited as a board holy um we noticed our field trips and we
[52:18] visited every physical facility in our
[52:21] area plus a couple in Aspen Peaks area.
[52:24] Um we made the decision early on that we
[52:27] can't make decisions about properties
[52:29] we've never seen.
[52:31] Informed our understanding in so many
[52:33] ways to actually have boots on the
[52:35] ground at all. Now currently we're in
[52:37] the middle of doing our vision tour.
[52:40] call it. Um Joe is presenting our vision
[52:42] for the district at each school to a
[52:44] group of administrators, the teachers or
[52:48] staff, uh students, which has been so
[52:50] fun. And um parents,
[52:54] they're involved there in the school as
[52:55] we've been trying to craft our vision.
[52:57] So that's something that we're almost
[52:59] done with. I think we're we did finished
[53:02] 19
[53:03] >> 18 today 18 of 29. So
[53:08] >> I don't know.
[53:10] We're not we're not visiting the special
[53:13] school right now.
[53:15] >> David,
[53:15] >> can I just mention Carolyn? I I would
[53:18] really be interested in the future in in
[53:20] your city and your goals, your
[53:22] priorities
[53:23] >> and how we might be able to support each
[53:25] other.
[53:25] >> Oh, that would be wonderful.
[53:26] >> In that way, just a little more about
[53:30] >> Let's get together again soon. It sounds
[53:32] like there's, you know, we're excited
[53:35] that this will be the admin home and uh
[53:40] obviously as you're getting information,
[53:42] let's let's keep meeting frequently at
[53:44] least in
[53:46] >> three times a year. Does that sound
[53:47] good?
[53:48] >> Fantastic.
[53:49] >> Who is your communication?
[53:54] » Okay.
[53:58] » And Cole's our leazison from a city
[54:00] council standpoint with
[54:03] >> I'm sure you have contactary
[54:08] Adam, you know you have Karen's info,
[54:09] right? That's how we organize this.
[54:14] » Pretty much dissolved.
[54:18] » Awesome.
[54:21] [laughter]
[54:22] >> I'm creating new position.
[54:25] >> If I could
[54:25] >> add it to your council responsibility
[54:27] school, you add it to the list.
[54:28] >> Mayor, if I could for the um for the
[54:31] board, uh Lynon Elementary is is right
[54:34] next to our campus, right? We have this
[54:36] Lyndon campus here and so we're we're
[54:39] very interested in the future of Lynen
[54:41] Elementary. A lot of our uh residents go
[54:44] there.
[54:46] Want to just invite you to open that
[54:48] conversation um with us early and often.
[54:52] You know what your thoughts are there
[54:54] and love that you're on the tour. Love
[54:55] that you're looking at it and just keep
[54:57] us informed and we'll keep you informed
[54:59] as well.
[54:59] >> I've I've been to Lynon Elementaryund
[55:02] times in my career when I worked for
[55:04] Alpine and this board tour. I never knew
[55:07] until we did this,
[55:09] >> the amphitheater.
[55:10] That's awesome.
[55:12] >> That's from the old school,
[55:14] >> the old London Elementary.
[55:17] >> Okay.
[55:18] >> And then we drove by it. I don't know
[55:20] who I was with a couple days ago. We
[55:21] drove by it. Maybe we ran by it and saw
[55:23] it from the back end. Like it's like,
[55:25] "Oh, it's right there." Was that you and
[55:27] I or Yeah.
[55:29] >> It's a huge field.
[55:30] >> Yeah. An asset maybe.
[55:33] But
[55:34] >> you guys want to buy it?
[55:36] >> Well, that's where I I feel like we need
[55:38] to really coordinate closely.
[55:40] >> Yes. And because that school is part of
[55:42] our campus, we've actually held off on
[55:44] either rebuilding or upgrading our
[55:47] community center, which has seismic
[55:48] issues. Um we're kind of saving a
[55:51] contingency fund, just kind of waiting
[55:53] to determine what's happening with that
[55:56] property across the street. Originally
[55:59] when there was word maybe ASD would
[56:01] rebuild again. We were waiting to see
[56:03] how to coordinate best
[56:05] >> or if it's a disposed. I think the city
[56:08] would be interested in
[56:10] that looks like for the city to acquire
[56:12] it. But obviously I think a lot of
[56:14] families are hoping.
[56:16] We'll see as you do that public input
[56:18] and you do your Moab, right? Um where
[56:22] that goes. Keep We'd love to keep in
[56:24] close contact for sure. So you guys will
[56:26] figure out what we need to do
[56:27] >> on my speed. I got on my speed. Well,
[56:29] and I I I really in relation to the
[56:32] boundary study because that's what's
[56:33] going to be generating a lot of interest
[56:35] and understandably and necessarily. So,
[56:38] it's really important that we
[56:40] communicate and I hope that you will
[56:41] communicate as well that we everything
[56:44] is on the table and no decisions have
[56:46] been made.
[56:47] >> Yeah.
[56:47] >> So, we we aren't approaching this with
[56:50] oh I I I we really know we're going to
[56:52] do this this this and this but we have
[56:54] to go through this like nope.
[56:56] >> Everything is being considered
[56:58] >> and we have not
[56:59] So we we want to hear what people are
[57:03] thinking, how they're feeling, and we
[57:05] would appreciate that if if you could
[57:07] communicate that as well in the
[57:08] opportunities that that is genuine on
[57:11] all of our parts.
[57:12] >> And and it's exactly that that why it's
[57:14] so important we have that criteria up
[57:16] front because we're going to make better
[57:18] decisions if we have a criteria to
[57:20] follow rather than we're just saying
[57:22] schools that are this size
[57:24] >> because there may be a school that
[57:28] context, it's perfect at 500, but it's
[57:31] better for this school to be 754.
[57:35] >> If your city's going to grow, you
[57:37] mentioned students coming back, but do
[57:40] you have growth areas that you know we
[57:42] need to know about?
[57:44] >> People make decisions about where
[57:45] they're going to build, where they're
[57:46] going to live on schools.
[57:49] >> So, purchase some property on the west
[57:52] side of London for a future.
[57:55] So, as you're touring,
[57:57] >> we've already been there.
[57:58] >> We've been there.
[58:00] >> That was that was early days. In fact, I
[58:02] don't think we hadn't even hired Joe and
[58:04] Jason when we went that
[58:08] >> So, they need to do that.
[58:11] >> Are you going to add it to the district?
[58:15] » There's some parents who have said to me
[58:17] if Lyn has to for whatever reason be
[58:20] disposed of, they would love to see that
[58:22] West school stood up. So there's a clean
[58:25] transition to progress over there.
[58:28] >> Say that again.
[58:29] >> If in the past I'm just saying some
[58:31] opinion was and I I don't want to speak
[58:33] out of term but when elementary has been
[58:36] on the closure list for a number of
[58:38] years. So there's a lot of families that
[58:39] are very the alll program is doing
[58:42] amazing there. But that's caused some
[58:44] families to not enroll in Lynon
[58:47] Elementary because they think it's been
[58:49] on this closure discussion for six
[58:51] years. Um but who are very invested in
[58:54] Lynon Elementary were very happy to hear
[58:57] that maybe there would be a school in
[58:59] Anderson Farms that could transition to
[59:02] all you know whatever happens there
[59:06] kind of made um a commitment that we're
[59:09] going to our decisions the major
[59:11] decisions will be made by December I
[59:13] think that's something that we talked
[59:14] about that unknown for teachers and
[59:23] for for teachers and for students and
[59:24] families. It's that
[59:27] >> and we're we're trying to come in and do
[59:29] this the right way and do but do it
[59:31] quickly and be able to let people know
[59:32] so that as they're making decisions
[59:35] >> they have
[59:37] they know the road. Yeah. They have
[59:38] their options laid out.
[59:43] » Comments from my board.
[59:47] >> Oh my gosh, we finished a minute early.
[59:50] [laughter]
[59:52] Is your council meeting at 6:30?
[59:54] >> We start at 5:15 normally, but we're
[59:56] going to go into our regular council
[59:57] session now.
[59:58] >> Thank you so very
[1:00:35] I'm ready for
[1:00:41] » start.
[1:00:50] Sorry, sorry, sorry.
[1:01:01] Awesome.
[1:01:24] I'm gonna cry.
[1:01:31] » Let's just do it right now. Let's do it.
[1:01:35] >> So nice just collaborating and
[1:01:36] connecting.
[1:01:51] Welcome back.
[1:01:52] >> How was Macedonia?
[1:02:06] » It'll be
[1:02:08] sitting there with three of us.
[1:02:20] happen
[1:02:31] down there.
[1:02:31] >> Thank you.
[1:02:58] want to go first or you want
[1:02:59] >> No, I want
[1:03:03] first.
[1:03:14] Can I stand up?
[1:03:28] » I said
[1:03:34] It's
[1:03:45] » all AI, man.
[1:03:48] >> Crazy.
[1:04:09] You have any questions?
[1:04:15] » Somebody walked off.
[1:04:45] All right. Thanks, buddy.
[1:04:58] What was mentioned there?
[1:05:22] No jerky today.
[1:05:35] » I don't know.
[1:05:49] Sorry.
[1:05:58] » Yeah.
[1:06:03] We'll
[1:06:12] transfer transfer.
[1:06:26] » And then everybody's going, "Well, I
[1:06:28] can't I can't open word perfect. I can
[1:06:30] only use Word." So, I had to convert to
[1:06:31] Word. I hate it.
[1:06:35] >> And now we're just
[1:06:42] so good.
[1:07:00] reason
[1:07:05] what's another
[1:07:07] which Phil was really good at but it
[1:07:10] took him a while to get
[1:07:11] >> yeah I agree
[1:07:16] this is lots of money
[1:07:20] and easier
[1:07:22] I'm willing to do it right and I want to
[1:07:24] do it right
[1:07:26] >> and and it's hard because I'm getting
[1:07:27] one side of the story you I mean,
[1:07:30] >> but I know that he kind of has a
[1:07:31] reputation
[1:07:35] » you heard me make my comments when he
[1:07:37] was here.
[1:07:39] >> And I didn't know about your text, you
[1:07:41] know, but that was going to come, but
[1:07:43] that was kind of we're still moving.
[1:07:45] >> It was interesting because you said that
[1:07:50] just a bunch
[1:07:53] because of that comment. I had that same
[1:08:07] I'll say hi to
[1:08:18] you guys.
[1:08:30] temple tomorrow morning.
[1:08:36] » She's going to be here.
[1:08:39] >> All right, welcome everybody. Uh we just
[1:08:43] con concluded a work session with our
[1:08:45] new Typanoga school district board and
[1:08:47] staff and um a lot of exciting things
[1:08:50] coming on. Um it looks like Lynen City
[1:08:53] will be the home of the new uh school
[1:08:56] district headquarters ad admin location.
[1:08:59] And so that work session was a public
[1:09:02] meeting and um if you're interested in
[1:09:04] some of the topics that were discussed
[1:09:06] uh but we will now commence we had a
[1:09:09] short recess as they were exiting and we
[1:09:11] will now commence with our regular the
[1:09:13] rest of our city council meeting here
[1:09:15] for May 4th. May the fourth be with you
[1:09:19] [laughter] here in the Lynen City
[1:09:20] Council chambers. And I've we have some
[1:09:23] fun visuals here that I'm going to ask
[1:09:26] our admin to put up after the prayer.
[1:09:29] [laughter] So anyway,
[1:09:31] >> should be more.
[1:09:33] >> We might need help. [laughter]
[1:09:36] Um anyway, we're going to go ahead and
[1:09:38] begin. My name is uh Mayor Carolyn
[1:09:39] Lindberg and I'll be conducting this
[1:09:41] evening. I'm grateful for a full quorum
[1:09:43] here of our council here in the Lynen
[1:09:46] city chambers. And uh we will first
[1:09:48] begin with an invocation by council
[1:09:51] member Van Brick and that will be
[1:09:52] followed by a pledge of allegiance led
[1:09:54] by Steve Kaposi.
[1:09:58] » Our heavenly father, we're grateful for
[1:10:00] the many blessings that was given us.
[1:10:02] We're grateful for this great country
[1:10:05] that we live in and for our community
[1:10:07] here in Lynon. grateful for each of the
[1:10:10] residents that live here and for their
[1:10:11] contributions to making this such a
[1:10:14] great place to live. We are grateful for
[1:10:17] our our staff uh our first responders
[1:10:21] and those who work so hard to serve the
[1:10:23] citizens of Lyndon and our community.
[1:10:26] Please bless and be with them and keep
[1:10:28] them safe and in their responsibilities.
[1:10:31] We'd invite thy spirit to be with us now
[1:10:33] as we discuss the items on the agenda
[1:10:36] that we can make good informed decisions
[1:10:38] and be uh have mutual respect and
[1:10:42] dignified dialogue one with another. And
[1:10:44] we say this in the name of Jesus Christ.
[1:10:46] Amen.
[1:10:46] >> Amen.
[1:10:55] To the flag of the United States of
[1:10:58] America and to the republic for which it
[1:11:01] stands. One nation under God,
[1:11:04] indivisible, with liberty and justice
[1:11:06] for all.
[1:11:15] » Okay, guys. Where's your lightsabers?
[1:11:18] [laughter]
[1:11:20] I love it.
[1:11:20] >> Wow. I love it.
[1:11:23] >> Actually, are we doing this?
[1:11:24] >> This was my father-in-law's. He He
[1:11:27] served a mission in Japan back in the
[1:11:29] 1940s. This is actually a genuine I
[1:11:32] >> kimono
[1:11:33] >> for the men for a man.
[1:11:35] >> So anyway,
[1:11:36] >> but it fits your costume.
[1:11:37] >> Look, look, look, look, look. [laughter]
[1:11:39] >> That's uh
[1:11:40] >> I don't have a a don't have that
[1:11:43] costume.
[1:11:44] >> Am I the only one from the dark side?
[1:11:45] [laughter] a little
[1:11:47] >> I'm worried about me on the dark side. I
[1:11:49] had to put the lightsaber [laughter] in
[1:11:50] there cuz I
[1:11:51] >> change it to blue just for you.
[1:11:54] >> But you got to show some of the other
[1:11:56] pictures in the staff report.
[1:11:58] >> So, Adam did this. It's so clever.
[1:12:00] >> There unless you really want to show
[1:12:01] them off. It's
[1:12:03] >> show the header. Show the header though.
[1:12:05] You skipped that.
[1:12:06] >> The very first.
[1:12:07] >> We have a new logo here.
[1:12:08] >> That's our new city logo.
[1:12:09] >> There we go.
[1:12:12] >> Far far away. [laughter]
[1:12:13] >> Okay.
[1:12:15] bit here.
[1:12:16] >> Okay. All right. So, uh we will now
[1:12:19] start with our agenda. These can be
[1:12:21] found at the entrance there if you'd
[1:12:23] like to follow along. I'd like to
[1:12:25] welcome those that are online as well as
[1:12:26] those that are present here today. And
[1:12:28] we'll start with our roll call. So, I'll
[1:12:30] start here on my right. [clears throat]
[1:12:32] >> Steve Stewart present.
[1:12:33] >> JY present.
[1:12:34] >> Le present.
[1:12:35] >> Cole Hulie present.
[1:12:37] >> Lincoln Jacobs present.
[1:12:38] >> Van Brick present.
[1:12:40] >> Okay. Wonderful. And then if if there
[1:12:42] are any presentations and announcements
[1:12:45] from council. I don't know if we have
[1:12:47] any from staff this evening.
[1:12:49] >> Nothing tonight.
[1:12:51] >> Wonderful. This takes us to item number
[1:12:53] three on the agenda, which is our open
[1:12:55] session for public comment on anything
[1:12:58] that is not on tonight's agenda. So, I
[1:13:01] know we have some guests in the room and
[1:13:02] I feel like Mayor Kussi, former Mayor
[1:13:06] Kussi here and former council member
[1:13:10] friends. Who wants to go first? David
[1:13:13] Spencer. Okay, ladies first. [laughter]
[1:13:16] >> And Mayor Kafusser.
[1:13:21] » Mayor Kussy nodding her head as I I feel
[1:13:23] like I'm a little bit, you know, I have
[1:13:25] to be watch my P's and Q's. You are
[1:13:28] perfect, madame mayor
[1:13:30] [laughter and clears throat]
[1:13:32] and honorable council members. My name
[1:13:34] is Michelle Kafussi and I did have the
[1:13:36] honor and privilege of working with a
[1:13:38] lot of you. I mean, from the league and
[1:13:40] all the other opportunities we've had to
[1:13:42] collaborate together and we just love
[1:13:44] London. I love your chief of police. I
[1:13:46] mean, just so many great relationships
[1:13:49] with you. And as uh Mayor Lumbberg
[1:13:52] stated, I am here because there is an
[1:13:54] election coming up on June 23rd, the
[1:13:57] primary for the county commission.
[1:13:59] There's two seats. We only have three
[1:14:01] county commissioners and seat A and seat
[1:14:03] B are up right now. And I am running for
[1:14:06] seat A. And I know I Mayor Lumbberg
[1:14:10] needs to just walk me up center street
[1:14:11] in Provo and drop me off because
[1:14:14] [laughter] why do I keep doing this? And
[1:14:15] I I was just sharing with your chief, my
[1:14:18] boys were helping me load the truck to
[1:14:19] go to an event and one of them stopped
[1:14:21] and said, "Mom, do you just love public
[1:14:24] ridicule? What is [laughter] wrong with
[1:14:26] you?" I said, "I don't know." I tried to
[1:14:28] sit still and calm the world inside me.
[1:14:31] >> All of us have the same trauma bond.
[1:14:34] What is wrong? [laughter]
[1:14:36] >> But I really do. I love people problems
[1:14:39] and I love people and I love helping
[1:14:41] them solve their problems. and I feel
[1:14:43] like I've got the energy and the desire
[1:14:46] to keep giving back. So, I am just here
[1:14:49] to introduce myself and ask you to look
[1:14:51] for my name on the ballot. It will come
[1:14:53] out on June 4th in your mailbox. So,
[1:14:55] here we go again. [laughter]
[1:14:57] >> Awesome.
[1:14:57] >> Thank you.
[1:14:58] so much. Glad you're here for
[1:15:00] >> all your work on the Provo airport. We
[1:15:02] flew out of there two weeks ago. My
[1:15:03] whole family, it is phen. We flew all
[1:15:06] the way to Europe. From Provo to Europe.
[1:15:08] It's incredible. Great work.
[1:15:10] >> Look at me. I'm getting goosebumps.
[1:15:12] This is what is what is wrong with me
[1:15:14] guys. Respects over infrastructure
[1:15:16] [laughter]
[1:15:18] nerd out over that [clears throat] kind
[1:15:19] of stuff.
[1:15:21] >> All right. Thank you. And Mayor Kussi in
[1:15:23] her time as mayor. She served on over 16
[1:15:26] different boards throughout the state.
[1:15:27] She wasn't just mayoring Provo. She was
[1:15:30] advocating in really an incredible
[1:15:34] servant statewide, nationwide. I would
[1:15:37] say even globally potentially some of
[1:15:39] the things that she touched. So huge
[1:15:42] talent there. All right, welcome.
[1:15:45] >> So I I'm David Spencer, uh, mayor and
[1:15:47] council. Um, I was on the city or city
[1:15:50] council for 12 years and I didn't get
[1:15:52] elected in December, so lost by 200
[1:15:55] votes. So I decided to throw my hat in
[1:15:56] the ring for Utah County Commissioner
[1:15:58] seat B. And uh the concern I have with
[1:16:01] the county is
[1:16:03] in the [snorts] 12 years I was on the
[1:16:05] council, I didn't have one commissioner
[1:16:07] come to ORM and ask what our needs were.
[1:16:10] And I think that's a that's a a misstep
[1:16:12] on their part where they represent the
[1:16:14] citizens plus they represent the cities
[1:16:16] in Utah County. So I feel that my plan
[1:16:20] is I want to go to every city, look at
[1:16:22] your master plan, your transportation
[1:16:23] plan, see what your needs are, and then
[1:16:25] be able to because I believe that uh
[1:16:27] Utah County were fragmented.
[1:16:30] everybody's doing their own thing. So,
[1:16:31] if we can get on the same page, then we
[1:16:33] can go to the legislature and really
[1:16:34] fight for dollars for Utah County. And I
[1:16:37] believe that the legislature, the uh the
[1:16:40] leadership is pretty much in in Davis
[1:16:43] County, so they get a lot of the money,
[1:16:45] right? So,
[1:16:47] Utah County is the fastest growing
[1:16:49] county, right? So, we need to make sure
[1:16:50] that we get the dollars for our cities
[1:16:53] in Utah County. Um, I have a lot of good
[1:16:55] ideas. There's a transparency port I
[1:16:57] want to bring to the county because
[1:16:59] >> [clears throat]
[1:16:59] >> county commissioners now you don't even
[1:17:00] know if they go to their meetings how do
[1:17:02] they vote you know are they traveling
[1:17:05] foolishly when if you're a Utah county
[1:17:07] commissioner
[1:17:09] you should stay in Utah county or go to
[1:17:11] let's say legisl you need to go to back
[1:17:13] to Washington because that's why you
[1:17:14] have congressmen and senators so I'm
[1:17:18] here to represent the cities you know I
[1:17:20] love warm I love Lynon I remember I
[1:17:22] spoke at your Lynon city council way
[1:17:24] back in the day with the utopia but I'm
[1:17:26] here to serve the people and uh make
[1:17:28] sure that we come together as cities.
[1:17:30] But hopefully you'll see my name on the
[1:17:32] ballot June 23rd and I'm David Spencer.
[1:17:34] Hope I can get your vote. Thank you.
[1:17:36] >> Welcome.
[1:17:36] >> Thank you so much.
[1:17:37] >> David, what if each of you who's
[1:17:39] currently filling each seat you're
[1:17:41] running for if you don't mind?
[1:17:42] >> So a million powers I think is seat A
[1:17:46] >> and then Brandon Gordon is se they're
[1:17:48] not running
[1:17:48] >> and neither are running.
[1:17:49] >> The incumbents are retiring.
[1:17:50] >> No incumbents. So we have three people
[1:17:54] running for CB. I won the convention at
[1:17:57] 52% but didn't get 60. So we have a
[1:18:00] writing candidate which they'll be on
[1:18:02] the ballot. So there
[1:18:04] >> so yeah it's fun.
[1:18:06] I was on for 12 years so campaigning was
[1:18:09] a little different animal in the city
[1:18:10] compared to the county.
[1:18:12] >> And maybe you could talk a little bit. I
[1:18:14] know you're been a huge partner
[1:18:16] proponent with the first responders and
[1:18:18] ORM and we have this interlocal
[1:18:20] agreement with ORM Lindon Vineyard and
[1:18:22] you are kind of the the main liaison guy
[1:18:25] for OMC on all that.
[1:18:26] >> I support the first responders 100%
[1:18:28] because they keep us safe and we have to
[1:18:32] make sure that our citizens are safe
[1:18:34] because that's your police, fire, water,
[1:18:36] roads and sewer. That's the city's
[1:18:37] responsibility for the citizens and that
[1:18:40] that's the top of the list. So I think
[1:18:42] as ORM we have a great police department
[1:18:44] and a fire department and you use Orm's
[1:18:46] fire department and they're the best and
[1:18:48] um we're glad that we can keep you know
[1:18:51] Lyndon citizens safe but I am a I'm pro
[1:18:54] first responders because they put their
[1:18:56] life on the line every day and they
[1:18:57] might not come home to their families
[1:19:01] because they they gave their life. So
[1:19:03] very important that we have to make sure
[1:19:04] we we keep them safe and we give them
[1:19:06] money they need to help us be safe. So
[1:19:10] thank you.
[1:19:10] >> All right. Thank you for coming, both of
[1:19:12] you.
[1:19:13] >> Um, we know it's a lot of work away from
[1:19:17] your families right now to try to step
[1:19:19] up and serve. So, thank you so much for
[1:19:21] coming and and being willing to come to
[1:19:24] the small town of London.
[1:19:26] >> I'm glad we didn't have a clock because
[1:19:27] normally there's a clock. [laughter]
[1:19:29] >> Oh, no pressure. We're We're not high
[1:19:31] pressure like that.
[1:19:33] >> There's just a door underneath. You're
[1:19:35] good. [laughter]
[1:19:36] You were right on time.
[1:19:38] >> See you. Thank you.
[1:19:39] >> Thanks. All right. I think if you could
[1:19:41] call if there's any other public
[1:19:43] comment. There might be
[1:19:44] >> I'm going to invite that right now. If
[1:19:46] there's any other public comment, please
[1:19:48] come forward and state your name and
[1:19:50] make sure you sign in there on the
[1:19:52] table. Thank you.
[1:19:58] » Thank you, Mayor. Um, my name is Brian
[1:20:02] Lozo and I live in Oram, Utah. And I'm
[1:20:06] actually I'm glad to be speaking today
[1:20:08] because I lived in Provo at the time.
[1:20:11] Michelle Kussi was mayor and my parents
[1:20:13] who live um by one of the temples could
[1:20:17] kept talking about her and Dave Spencer
[1:20:20] actually assisted in my current
[1:20:22] apartment in Oram, the driveway being
[1:20:25] fixed. Um so I really appreciate and I
[1:20:27] do think he is someone who um stands by
[1:20:31] his word and the citizens of Utah
[1:20:33] County. And I would I I can't say enough
[1:20:37] how good of a job you're all doing in
[1:20:39] Lynen and and I love the model that
[1:20:43] you've held in Utah County for getting
[1:20:46] results for citizens and that's what I
[1:20:49] want to talk about today. I spoke
[1:20:51] earlier the previous month because I
[1:20:54] felt like the voice of the youth needs
[1:20:56] to be heard and instead of division we
[1:20:59] need to be collaborating together. And
[1:21:01] with the recent events of the Trump
[1:21:04] assassination and the gas prices being
[1:21:07] increased, espec including here due to
[1:21:10] the Iran war, I feel like my voice does
[1:21:13] need to be heard again. And I wanted to
[1:21:16] make three points today. Um the first
[1:21:18] one was a culture of safety. And I feel
[1:21:23] like at this time it's important for us
[1:21:25] to come together and to bond on our
[1:21:29] shared goals and to and to really look
[1:21:33] out for each other's security and safety
[1:21:36] and and maintain a culture of safety,
[1:21:39] meaning we all get together and care
[1:21:41] about each other and each other's shared
[1:21:44] issues. And
[1:21:46] the second point is what I feel the
[1:21:49] city's already doing the energy and
[1:21:51] resource issue. We condemn international
[1:21:54] violence but not because we want to get
[1:21:57] into fights with the entire world but
[1:21:59] because we want to focus on local issues
[1:22:04] and not allow distant conflicts to bring
[1:22:06] us down the drain. every dollar of the
[1:22:10] and of every gallon of gas counts during
[1:22:14] these troubling times. And the last
[1:22:18] point I wanted to make is about refusing
[1:22:22] to allow the outside world to consume
[1:22:24] our sovereignty. Um, Lyndon is a great
[1:22:28] place and I I love driving here, going
[1:22:32] to shop here and
[1:22:36] it these outside conflicts can really
[1:22:41] allow us to stop thinking about local
[1:22:43] issues and our own local freedoms. And I
[1:22:47] feel like we've all seen those things
[1:22:49] before. and the future of a city will
[1:22:53] not be a side effect of global markets
[1:22:56] if we dictate our own destiny. Um, I
[1:22:59] feel like this is a moment where we need
[1:23:01] to remember um our local communities and
[1:23:05] to for the city to continue getting the
[1:23:08] results they've been getting and talking
[1:23:10] to my local officials to maybe get give
[1:23:14] them those ideas
[1:23:16] um and to not let um outside results take
[1:23:22] away the progress that we've been
[1:23:24] making. Thank you.
[1:23:26] >> All right. Thank you so much. Any other
[1:23:29] public comment tonight?
[1:23:32] All right, seeing none, we will move on
[1:23:34] to our council reports and
[1:23:38] which end wants to arm wrestle to start
[1:23:40] us off here.
[1:23:42] >> I will start.
[1:23:43] >> Thank you.
[1:23:43] >> Uh the the league meetings in St.
[1:23:45] George, we're great and wonderful,
[1:23:47] always helpful, things that we learn and
[1:23:49] help us to become uh
[1:23:53] better at our jobs and the trust that's
[1:23:55] been afforded to us by being members of
[1:23:57] the city council and mayor. Love those
[1:23:59] relationships that we are able to
[1:24:01] continue and develop and always find
[1:24:03] ideas for good practices and so fun to
[1:24:06] have everybody go that went. Uh, also
[1:24:09] hopefully this week at the cemetery
[1:24:12] there'll be some sod going in and some
[1:24:15] trees going in. If the weather holds
[1:24:17] good and the schedule goes right, we'll
[1:24:20] maybe see that this week. So, I'm
[1:24:22] keeping an eye on that and we'll see how
[1:24:24] it goes. But, I think it was supposed to
[1:24:25] start Tuesday or Wednesday this week.
[1:24:28] [clears throat] That's it.
[1:24:29] >> Great. All right, Lincoln.
[1:24:31] >> We always have so much going on with our
[1:24:34] parks and wrecks. Uh, our watering will
[1:24:37] begin in our parks. Um, but keep in mind
[1:24:40] we are at a questionable water year. So
[1:24:42] there might be some yellowing. Please
[1:24:44] let your residents know that we're
[1:24:46] trying to conserve water and so some of
[1:24:48] the grass might not be getting quite as
[1:24:50] much as as uh it has in the past. Um,
[1:24:54] some people criticize our our um our own
[1:24:58] parks watering that it doesn't fit the
[1:25:01] schedules that they've indicated to the
[1:25:03] residents. Some of our parks have so
[1:25:06] much watering to do that sometimes it
[1:25:07] goes a little bit longer, but but that's
[1:25:09] the reason why there's only so much that
[1:25:10] we can physically do at a time.
[1:25:13] >> Have we put smart clocks on all of our
[1:25:15] parks yet?
[1:25:16] >> About 80%.
[1:25:18] About 85% now this year. The other
[1:25:20] percent I don't think we can. They're just little spots in little
[1:25:25] obscure places.
[1:25:28] >> Okay. I hope I represented that first
[1:25:30] paragraph well.
[1:25:31] >> [clears throat]
[1:25:32] >> Sports programs are going strong with
[1:25:33] baseball getting ready to start our
[1:25:35] T-ball, coach pitch, machine pitch, and
[1:25:37] kid pitch league. Say that really fast.
[1:25:40] We'll be at the City Center Park this
[1:25:42] year instead of Fezenbrook Park. Uh the
[1:25:45] next special event for the city is June
[1:25:47] 3rd, our summer kickoff. So, more more
[1:25:50] details coming soon on that.
[1:25:53] >> Um CTC, Historic Commission, Treeboard
[1:25:56] are all doing great. The Arbor Day
[1:25:58] celebration was awesome. really good
[1:26:00] time. And um for the arts committee,
[1:26:04] just to give you all an update, we
[1:26:05] several weeks ago, a handful of us met
[1:26:08] to discuss next steps. And the next step
[1:26:10] was to pull in a few residents just to
[1:26:13] get some ideas of what the arts
[1:26:16] committee could do or look like. And so
[1:26:19] it's still early formation discussions.
[1:26:24] » Thank you. All right, Jake.
[1:26:27] >> Uh a couple quick updates.
[1:26:29] um from the PD. Uh our God, let me get
[1:26:34] right back to that. Our uh
[1:26:38] our our K9 officer went through uh
[1:26:42] completed patrol dog school with Officer
[1:26:44] Harmon and they uh graduated top of
[1:26:47] their class. So, we're always proud of
[1:26:48] Officer Harmon and our uh K9 officer. Um
[1:26:52] and then and then just an announcement
[1:26:53] for this group of our um May 11th awards
[1:26:57] banquet for our PD. Please RSVP if you
[1:27:00] haven't already.
[1:27:02] >> What was that, Chief?
[1:27:04] >> Let me check. It might be the 13th. Hang
[1:27:06] on.
[1:27:06] >> Sorry. Wednesday.
[1:27:09] >> 13th.
[1:27:11] >> Le astray. No worries.
[1:27:13] >> Are you wanting an RSVP then?
[1:27:17] >> Yeah.
[1:27:18] >> Okay.
[1:27:19] >> We're coming.
[1:27:20] Um, awesome. And and then two weeks ago,
[1:27:24] I I brought up uh sponsorships for Lynen
[1:27:26] Days. Uh Heath and I this week secured
[1:27:29] one, we think, for the fireworks. We're
[1:27:31] excited about that. Um certainly within
[1:27:34] the council's realm to be out there
[1:27:36] asking businesses to help the city. So
[1:27:37] that's all I have.
[1:27:40] >> Okay. I think I reported last time about
[1:27:42] our youth council that we had 22 members
[1:27:45] now, up from 18 this year, and we
[1:27:47] started at 13 a few years ago. So, it's
[1:27:49] definitely a growing and and I'll call
[1:27:52] it robust since that's the word of the
[1:27:53] day today [laughter]
[1:27:54] program. And we have a solid group of
[1:27:56] young people that are going to be
[1:27:57] helping us. On the 18th, our next
[1:27:59] council meeting will be introducing the
[1:28:02] new council to this council. They're
[1:28:05] looking forward to that. Um, and then
[1:28:07] they will uh be going out and planting
[1:28:10] flowers in the city cemetery in
[1:28:11] preparation for the Memorial Day program
[1:28:13] which will be on May 25th at 9:00 a.m.
[1:28:16] at the city cemetery. and we're looking
[1:28:17] forward to participating in that with
[1:28:20] our youth council and with everyone
[1:28:22] else. We love that program and everybody
[1:28:24] involved. And I'd just like to make a
[1:28:25] note that really enjoyed our our Utah
[1:28:28] League of Cities and Towns midyear
[1:28:29] conference in St. George with most of
[1:28:31] you. I think almost all of us are there
[1:28:33] and really enjoyed that time of learning
[1:28:35] and and camaraderie.
[1:28:38] >> Thank you so much. You all do so great
[1:28:41] with your liaison assignments and
[1:28:42] reports.
[1:28:44] Uh we had um NextGen Motors did their
[1:28:48] ribbon cutting. Thank you for those who
[1:28:50] were able to come. I know it was it was
[1:28:52] on a a busy night. Um but they're doing fantastic um and doing
[1:28:58] great sales already. Um something
[1:29:01] communitywide of note is the uh Lynen
[1:29:03] City Temple dedication this Sunday that
[1:29:06] incorporated um residents in part of PG
[1:29:10] Pleasant Grove as well as ORM. So, that
[1:29:12] was a pretty significant event. Um,
[1:29:14] thank you again to Chief and all the
[1:29:17] staff that um that was a a lot of um
[1:29:21] service and coordination and um a lot of
[1:29:25] hard work to just pull off having nearly
[1:29:28] 300,000 visitors come for that. Um
[1:29:33] we also had uh
[1:29:36] interestingly Pleasant Grove City had a
[1:29:38] special uh presentation of um a
[1:29:43] photography collection that was really
[1:29:45] quite fascinating. I should have made a
[1:29:47] note of the there was a gentleman a
[1:29:50] hundred years ago who just bought this
[1:29:52] amazing camera and he just had an
[1:29:54] artistic eye and he took a lot of
[1:29:57] historical photos and I went because I
[1:29:58] wanted to see what did he catch about
[1:30:00] Lyndon and there was potentially and our
[1:30:04] um historian Brett Swberg was there so I
[1:30:06] was like okay we're good Brett's on it.
[1:30:08] So, um, anyways, pretty interesting
[1:30:10] collection. The family had donated to
[1:30:12] BYU and then a a a lady just out of her
[1:30:16] own passion went and just has digit is
[1:30:19] going to digitize the whole thing and
[1:30:21] published a book about it. And so, it's
[1:30:23] really fascinating to see our
[1:30:25] community's um images that don't exist,
[1:30:30] many buildings anymore, and just what
[1:30:32] life was like back in the day. So, um,
[1:30:36] looking forward and our museum just
[1:30:38] continues to have incredible, um,
[1:30:40] displays and donations that our historic
[1:30:43] committee is working on. So, lots of
[1:30:46] thanks to them. There's also,
[1:30:49] um, a Lynden Yard of the summer um,
[1:30:53] nomination process that's going to be
[1:30:55] happening. Um, so we'd love to encourage
[1:30:59] just people wanting to beautify their
[1:31:02] properties and their homes and get some
[1:31:04] recognition going for that. So there's a
[1:31:07] wonderful newsletter that comes out
[1:31:09] every month. Um, it doesn't mail to each
[1:31:12] home. Um, can people still pick up a
[1:31:14] hard copy here at the city center if
[1:31:16] they want a hard copy or you can opt in
[1:31:18] to get it by email. So that just has all
[1:31:22] we just have constant amazing activities
[1:31:24] and initiatives that are going on that
[1:31:26] and education um for the community. So
[1:31:30] encourage them to do that.
[1:31:32] All right, we will now turn the time
[1:31:34] over to our administrators report.
[1:31:37] >> Thanks for being good sports on uh Star
[1:31:39] Wars Day, May 4th [laughter] here. So um
[1:31:42] we need Eagle Mountain posted a picture
[1:31:44] very similar to this with their council,
[1:31:46] but you guys do it much better.
[1:31:48] [laughter]
[1:31:49] who are at best.
[1:31:51] >> You're better at AI.
[1:31:53] >> Yeah, all AI. So, uh we're continuing on
[1:31:56] here and making sure we all get equally
[1:31:58] embarrassed. So, [laughter]
[1:32:00] um just an FYI, we've got our live
[1:32:03] streaming fixed on these meetings. So,
[1:32:04] this meeting's back on YouTube. We
[1:32:06] missed about a month and a half there,
[1:32:08] but uh that got fixed today. So, it
[1:32:10] looks like it's working again for us.
[1:32:12] So, um, on the sewer treatment fee
[1:32:15] update, we met with ORUM and their their
[1:32:19] staff and, you know, we had that
[1:32:21] discussion partner versus customer. Uh,
[1:32:24] I very much felt that they were partners
[1:32:27] in this meeting. It was refreshing and I
[1:32:31] think they've they've made an effort uh
[1:32:34] to try to make sure that we feel that
[1:32:35] way. uh even so much that things such as
[1:32:39] hey if we have to we have a large amount
[1:32:42] of money that we'll be needing to pay
[1:32:44] back uh where they're using cash that
[1:32:47] they've saved um and they're willing to
[1:32:50] just match or it's the public
[1:32:52] treasurer's investment fund PTI where
[1:32:55] we're able to put money into a state
[1:32:57] fund that earns an interest rate it's
[1:33:00] actually what the state dictates we all
[1:33:03] of our general fund our savings and
[1:33:04] everything is in this PTI fund and they
[1:33:07] even went so far as to say we'll just
[1:33:10] charge that. So, they aren't trying to
[1:33:12] mark up an interest rate to be repaid
[1:33:15] which was again very refreshing. So, um
[1:33:18] some positive moves there. We'll keep uh
[1:33:21] you informed as Noah is looking at some
[1:33:23] options to try to lessen the burden on
[1:33:27] residential uh fee increases and see how
[1:33:30] we can make sure that all different uses
[1:33:33] and different zoning uh in the city are
[1:33:35] equally uh treated as far as the sewer
[1:33:39] processing and treatment that we have to
[1:33:41] perform. So um May newsletter, we've got
[1:33:45] you down there, Steve. And then June is
[1:33:47] Heath. So, thanks. And then, uh, just
[1:33:51] some dates there for Memorial Day and a
[1:33:53] meeting coming up in June. And then we
[1:33:54] mentioned this, uh, Wednesday, May 13th,
[1:33:57] meeting with Chief Brower and his
[1:33:59] department. So,
[1:34:02] any questions on any of that?
[1:34:06] If not, that's all I have. Mayor,
[1:34:08] thanks.
[1:34:08] >> Thank you. Right. Item number six is the
[1:34:11] approval of the minutes from our council
[1:34:12] meeting dated April 20th, 2026.
[1:34:16] So, if you've had a moment,
[1:34:19] >> I've reviewed them. And if the council
[1:34:20] doesn't have any changes, I'd like to
[1:34:22] make a motion that we approve the city
[1:34:24] council minutes from April 20th, 2026.
[1:34:27] >> Second.
[1:34:27] >> Have a motion by council member Hoy,
[1:34:29] seconded by council member Jacobs. All
[1:34:31] in favor?
[1:34:32] >> I.
[1:34:33] >> Okay. Minutes are approved. Thank you.
[1:34:35] Uh just really quick before you move on,
[1:34:37] just an FYI, um just wanted to make you
[1:34:40] aware that we do use um some AI software
[1:34:44] to help produce the minutes. Britney has
[1:34:46] fully embraced that and has greatly
[1:34:49] increased efficiency. Um but just an FYI
[1:34:53] that uh that helps produce a large
[1:34:55] amount of what we do now. So trying to
[1:34:57] embrace that new technology to be more
[1:34:59] efficient.
[1:35:01] >> Close sessions as well.
[1:35:03] >> Okay.
[1:35:05] Smart.
[1:35:07] >> All right. Very good.
[1:35:09] >> Thank you.
[1:35:10] >> There are no consent agenda items this
[1:35:13] time. So, we'll move on to item number
[1:35:14] eight. And this is a review and action
[1:35:16] of a general plan amendment. And uh this
[1:35:20] was continued from March 2nd. And we'll
[1:35:23] go ahead and have our
[1:35:26] economic development director here,
[1:35:28] Michael Florence, present
[1:35:31] and get us up to speed.
[1:35:33] I'm gonna step out.
[1:35:34] >> Okay.
[1:35:34] >> Recuse myself.
[1:35:36] >> All right. Council member Hoy is
[1:35:38] recusing himself.
[1:35:42] >> Uh just as a reminder from the last
[1:35:44] meeting in March, the proposal from MS
[1:35:47] Properties was to amend the street
[1:35:50] master's plan map to remove both of
[1:35:52] these streets. Uh 1,200 West in the in
[1:35:56] this section and 200 north um
[1:35:59] highlighted in green there. Uh at the
[1:36:02] last meeting uh one of the
[1:36:04] representatives for Schaefer Industries
[1:36:07] was not able to make it. He asked that
[1:36:09] the meeting be continued and so the the
[1:36:11] commit the council continued that
[1:36:13] meeting and to give the property owners
[1:36:15] the three prop main property owners MS
[1:36:17] Properties um Pacific Bridge and Steel
[1:36:20] and Schaefer Industries time to talk and re uh review the proposal. Um, in
[1:36:27] your packet, one of the items we
[1:36:30] discussed last time as well was could
[1:36:33] the property be have a culde-sac coming
[1:36:35] from State Street or sorry, Center
[1:36:37] Street North. Uh, these are the two UD
[1:36:40] do detention basins. They um receive
[1:36:43] water uh that Lynden helps maintain in
[1:36:46] those storm water basins. But, you know,
[1:36:48] this this is what the culde-sac could
[1:36:51] potentially look like as an option. um
[1:36:56] uh is an as an alternative as well. So,
[1:36:59] um,
[1:37:01] as of late today, the the property
[1:37:04] owners,
[1:37:06] um,
[1:37:08] had also reached out to me about with
[1:37:10] the potential of maybe just, um, having
[1:37:15] the discussion about,
[1:37:17] uh, removing this section from the map,
[1:37:21] uh, transportation map highlighted in
[1:37:23] green, and and leaving the rest of the
[1:37:26] map uh, the way it is um I know there's
[1:37:30] the property owners can discuss this.
[1:37:32] there's some, you know, preferences and
[1:37:35] things um for 200 north here. The, you
[1:37:39] know, Martin Snow would would prefer not
[1:37:41] to have this bisect his two properties
[1:37:43] here. Um and so that this may need an
[1:37:46] alternative route, but um so there's
[1:37:49] been some different discussions whether
[1:37:51] to do a culde-sac, whether to remove
[1:37:53] both roads segments, whether just to
[1:37:56] remove a portion of 1200 West. And so
[1:37:59] the council's got a number of items to
[1:38:01] consider with this. Um we've prepared it
[1:38:06] as the application has was originally
[1:38:09] submitted with both roads being removed.
[1:38:11] Um but I think there's a number of
[1:38:13] alternatives you you should evaluate.
[1:38:20] » Right. Council, do you have any
[1:38:23] questions for Mr. Florence?
[1:38:27] >> So in that last image that you had up.
[1:38:32] So, there is there will be a way to
[1:38:34] connect to Center Street and it's
[1:38:36] through that Anderson Lane
[1:38:39] >> down where it kind of
[1:38:40] >> I apologize I cut that off.
[1:38:41] >> It's okay. But I wondered I couldn't see
[1:38:43] but there would be another way not just
[1:38:45] 1200 West.
[1:38:47] >> Yes. Anderson Lane
[1:38:48] >> Geneva and Anderson Lane.
[1:38:52] >> Yeah, that's good. Let's see. Let's go
[1:38:54] to this one.
[1:38:56] >> So, yeah. Anderson Lane will be
[1:38:58] constructed. I think Schaefer Industries
[1:39:00] will be constructing that this summer.
[1:39:02] >> Okay, great.
[1:39:07] » All right. Any further questions?
[1:39:10] >> All right.
[1:39:11] >> Can we just go to the view you were
[1:39:13] showing before? [clears throat]
[1:39:16] >> This one here,
[1:39:16] >> the small section right there at the
[1:39:18] end. Is that a culde-sac?
[1:39:22] >> Um,
[1:39:23] >> we're we're talking about just remot.
[1:39:26] >> Yeah. Yeah,
[1:39:27] >> I don't think it needs necessarily a
[1:39:28] culde-sac there cuz it's it's not a
[1:39:30] road. It's still private property.
[1:39:32] >> This is just general plan. So, we could
[1:39:34] remove that section and the rest of the
[1:39:36] general plan would just stay the same.
[1:39:38] >> Is that right?
[1:39:39] >> That that would. Now,
[1:39:40] >> that's one of the options.
[1:39:41] >> Now,
[1:39:43] um again, a lot of this depends on
[1:39:45] property owner property owners working
[1:39:48] together whether or not the roads will
[1:39:49] go in at all.
[1:39:50] >> Sure. Um, you know, for example, this road 200 north is it's on the
[1:39:56] property boundary between MS Properties
[1:39:58] and Schaefer Industries. Um, the
[1:40:02] remaining of this uh north south road on
[1:40:05] 1200 West that's split between uh UD do
[1:40:10] um Schaefer Industries and Pacific
[1:40:14] Bridge and Steel. Um and so all of those
[1:40:17] them would have to work together for
[1:40:19] those roads to go through. We're not
[1:40:21] adjusting any zoning uh with this
[1:40:23] application. The heavy industrial zoning
[1:40:26] or whatever zoning is currently in place
[1:40:28] is not affected by these applications.
[1:40:31] This is only whether to amend the street
[1:40:33] master plan map.
[1:40:38] » All right. Okay. I think that covers it.
[1:40:39] So we have applicants in the room. Um, I
[1:40:44] don't know if we need to cover the
[1:40:45] letter that you have from from some of
[1:40:49] the parties or that that came in
[1:40:53] recently or
[1:40:55] >> there was a letter for the last one.
[1:40:58] >> Is that for in March? Is that
[1:41:03] » today?
[1:41:07] Oh,
[1:41:08] >> yeah. I think this one in green explains
[1:41:11] that. All right. There were some other
[1:41:13] Okay. And then you mentioned
[1:41:14] [clears throat]
[1:41:15] Okay. That leg around there.
[1:41:17] >> Yeah.
[1:41:17] >> Um so
[1:41:20] in the
[1:41:21] >> Yes. Let's um the applicant we'll have
[1:41:25] him come forward Mr. Snow. So he's the
[1:41:27] one that originally applied for the
[1:41:30] removal of all these roads. And
[1:41:33] obviously we want to understand the
[1:41:35] perspectives of all the property owners
[1:41:37] that are impacted by this application.
[1:41:41] Um, all right.
[1:41:43] >> All right. Well, I think there's a few
[1:41:45] new people here today than there was a
[1:41:48] couple weeks ago. So, basically, if we
[1:41:52] go to,400
[1:41:53] [clears throat]
[1:41:54] where it goes past Ivory, if you guys
[1:41:57] can follow me on that map or Yeah. where
[1:42:01] Mike's got his pointer going. We have
[1:42:04] between MS Properties and the city, we
[1:42:07] have a little property dispute there.
[1:42:10] And when we were working to res Oh, that
[1:42:12] was very
[1:42:14] I can figure out how to use that.
[1:42:16] [laughter]
[1:42:18] >> Just don't put it point it in your eyes.
[1:42:24] » Oh, I got to hold it down. Yeah. All
[1:42:26] right. So this section of road right
[1:42:29] through here is where we've been working
[1:42:32] for year and a half, two years, maybe
[1:42:35] more with the city people over a little
[1:42:39] property dispute here. And it came up in
[1:42:42] the meeting that if we would
[1:42:45] to settle this, we were gonna
[1:42:49] take this proposed road, remove it off
[1:42:51] the master plan, take the bond money
[1:42:54] that we have here, and then we're going
[1:42:56] to go develop it and finish this road
[1:43:00] through here and give the property to
[1:43:02] the city for the rightway and the needs
[1:43:04] to get that road in place. And then I
[1:43:08] think this summer sheer shadow mountain
[1:43:12] is supposed to be developing this road
[1:43:14] through here. And I think they only go
[1:43:18] up to here. So that and we'll go to this
[1:43:21] intersection right there. There'll be a
[1:43:24] little piece here that we call the group
[1:43:26] home property that still needs to be
[1:43:30] figured out to get past it, but
[1:43:33] basically that's going to open up that
[1:43:36] 1400 or Anderson Lane. I think we we
[1:43:40] call it 1400. The old map was 14. But
[1:43:43] then it's going to allow access to come
[1:43:45] from Center Street up through here. And
[1:43:48] now you can work your way out this way
[1:43:50] or you can go out that way. So I think
[1:43:53] in the discussions with the city they
[1:43:56] said well
[1:43:58] we don't really need this road through
[1:44:00] here and it's a definite safety hazard
[1:44:03] going between our buildings and then in
[1:44:06] the the other point came up was a safety
[1:44:10] fac or hazard going through here because
[1:44:13] of all the Utah Pacific's big steel
[1:44:18] ridge beams and girders and overhead
[1:44:20] cranes and so you guys went through that
[1:44:24] last time. So, I think when we left off
[1:44:26] at the last meeting, we were discussing
[1:44:28] a culde-sac
[1:44:31] up in here to come here. Uh, Shadow
[1:44:34] Mountain has concerns because they have
[1:44:37] 27 acres over here that they haven't
[1:44:40] really decided what they're going to do
[1:44:43] in there yet. uh the city. I think what
[1:44:47] Adam and and and Mike Florence are
[1:44:50] saying is uh we can put these roads back
[1:44:54] in. We can move these roads.
[1:44:58] One of my thoughts I brought up last
[1:45:00] time was maybe this road should be
[1:45:03] straight. It comes off of here. you
[1:45:05] know, maybe it could. There's a lot of
[1:45:08] options, but I think the property owners
[1:45:11] need to decide where they want the road
[1:45:13] through there because they're serving
[1:45:15] their development, whereas we're already
[1:45:18] developed and we know the road doesn't
[1:45:20] work in Utah Pacific, it's pretty much
[1:45:23] developed in here. And that's just is
[1:45:27] kind of where we let off or at the at
[1:45:31] the last meeting. So, I think the
[1:45:34] decision was let everybody voice their
[1:45:36] opinions and and we'll see what happens.
[1:45:40] This road here doesn't doesn't really
[1:45:43] it's kind of an issue here because it
[1:45:45] goes through my property there and then
[1:45:48] it splits right through Utah Pacific and
[1:45:51] gives them it basically gives them two
[1:45:54] little parcels right here and this one
[1:45:57] bisects Utah Pacific again. So that's
[1:46:02] and I don't see the use changing in the
[1:46:04] future for either us or Utah Pacific and
[1:46:09] uh because we're both established and
[1:46:12] been there 40 plus years. So I don't I
[1:46:16] don't think anything's going to change
[1:46:18] for that and I guess that's uh that's the reason for the proposal and
[1:46:25] that's how it's sitting.
[1:46:28] So, I'm a little bit unclear. Um, Mr.
[1:46:32] Snow, are you wanting as you applied
[1:46:37] to is that what you want the council to
[1:46:38] still consider or have you changed your
[1:46:40] mind? I think I think the city I haven't
[1:46:45] I proposed what was suggested by the
[1:46:47] city uh because it was the most
[1:46:51] practical idea was to take it all out
[1:46:54] because I think the city said well we're
[1:46:57] never going to be able to put that road
[1:46:59] through here and it doesn't look like
[1:47:03] it's going to be a benefit down here for
[1:47:05] the existing use. So that was my
[1:47:08] application and then there were you know
[1:47:12] the city's opinion at that time was we
[1:47:15] can put these roads in wherever we need
[1:47:17] to when this development comes up. So I
[1:47:21] mean
[1:47:23] for my personal benefit it really
[1:47:26] doesn't matter. I mean, I'd need to get
[1:47:28] the road out on the top. And that was my
[1:47:31] agreement with the city was you get rid
[1:47:34] of this, I'll settle with you over
[1:47:37] there, you know. So,
[1:47:39] >> and then I believe that's probably your
[1:47:43] legal or Mr. pause, but I think he made
[1:47:46] the comment in the last meeting that
[1:47:48] it's up to the council or that the
[1:47:50] council has the authority to approve all
[1:47:53] of it, part of it or right
[1:47:55] >> or some alternates. So,
[1:47:58] >> okay,
[1:47:59] >> I'm just going to leave it at that and
[1:48:00] I'll let the rest of them give you their
[1:48:03] opinion of what they need and
[1:48:05] >> all right,
[1:48:06] >> we'll hope we get a good decision from
[1:48:08] everybody.
[1:48:09] >> Right. So, as Mr. Florence mentioned
[1:48:12] this has completely unrelated to zoning
[1:48:15] and and uses that are allowed here. This
[1:48:17] is just and maybe you could speak to
[1:48:20] everyone in the room a little bit about
[1:48:22] when we have a street master plan. It's
[1:48:24] kind of calling out future places to
[1:48:27] have that connectivity and the proper
[1:48:29] flow um and and not strand any property
[1:48:33] owners for example if they need it. Um
[1:48:36] but at the same time
[1:48:39] these lines that are future roads are
[1:48:42] somewhat flexible because as you
[1:48:45] mentioned the individual property owners
[1:48:47] certainly a 27 acre piece may need a
[1:48:51] particular configuration when the time
[1:48:53] comes that they have actual development
[1:48:55] or whatever may happen if what you do
[1:48:58] with your business um expands or has
[1:49:02] additional buildings or uses. So maybe
[1:49:05] you could speak to just
[1:49:08] the roads themselves and permanence or
[1:49:11] not permanence and what they're calling
[1:49:12] out.
[1:49:14] >> Yeah. I mean if this green road if it it
[1:49:17] needed to shift slightly like it came to
[1:49:20] here and needed to come down. I mean the
[1:49:23] purpose is that the road goes through
[1:49:26] according to the master plan. If it had
[1:49:28] to make some minor tweaks that that's
[1:49:30] okay um in the in the future. Um but But
[1:49:34] you're you're correct that it's it's a plan for the future for
[1:49:38] circulation and and uh you know trying
[1:49:41] to help help all the property owners and
[1:49:44] not segment anything that won't be
[1:49:46] unbuildable.
[1:49:49] >> And and I think it's important to mayor
[1:49:50] to to realize that these maps were
[1:49:53] originally adopted if I'm remembering
[1:49:55] right this was originally adopted either
[1:49:57] 69 or 89.
[1:50:00] >> Um and we we last time we had our
[1:50:03] They're not here tonight, but our
[1:50:05] engineers have gone through and looked
[1:50:06] at traffic and with traffic and
[1:50:09] development that has changed, these
[1:50:11] roads don't necessarily need to be
[1:50:13] exactly in this spot. There's a lot of
[1:50:15] room for us to be able to work. So, our
[1:50:17] engineers have looked at this and and
[1:50:19] they're they feel comfortable with these
[1:50:20] changes as well. So, that's important.
[1:50:22] >> Are you saying in removing both of
[1:50:24] those, the blue and the green, they're
[1:50:26] comfortable?
[1:50:27] >> The engineers were okay with that
[1:50:28] because again, when those developments
[1:50:30] come in, they are going to have to roads
[1:50:33] and they they can configure that, but
[1:50:36] because of the heavy industry that's
[1:50:39] going through that main road going north
[1:50:41] and south, we're not going to have a lot
[1:50:43] of traffic flowing through there. And so
[1:50:45] there will have to be some
[1:50:46] configurations for the green line. And
[1:50:48] as a development comes in, we'll have an
[1:50:50] opportunity to to get a alignment that
[1:50:53] works best.
[1:50:53] >> Okay. So you're saying if we eliminated
[1:50:55] now the blue and the green later on,
[1:50:57] somebody come and say, "Hey, we want to
[1:50:58] develop this in this way. We'd like a
[1:51:00] road cut in here." And then we're
[1:51:02] addressing that as the issue.
[1:51:03] >> That's why our engineers felt fine
[1:51:05] taking them all off.
[1:51:06] >> Although my question would be is if a
[1:51:08] road is eliminated and let's say one
[1:51:11] property says I want that road but their
[1:51:14] neighbor says I don't want the road. And
[1:51:16] if the road is not on the map master
[1:51:18] plan does that create
[1:51:20] >> what that how that works right now is is
[1:51:22] both property owners still have a right
[1:51:24] to say I don't want that road there
[1:51:26] right now. But what can happen is one
[1:51:29] property owner can say, "Well, that's
[1:51:31] fine. I'll put the whole cost of the
[1:51:32] road in now." But I'll ask for what's
[1:51:35] called a reimbursement agreement that if
[1:51:37] the other property develops within a
[1:51:39] certain amount of time, typically those
[1:51:40] are 10-year period. If you develop
[1:51:42] within 10 years, um, and you get the
[1:51:46] benefit of that road for that
[1:51:47] developing, you have to reimburse that
[1:51:49] first property owner for that. And so so
[1:51:53] that would go that that ability to to do
[1:51:56] a road and and to get the council to do
[1:51:59] a reimbursement agreement that works
[1:52:01] when two properties above each other.
[1:52:03] And so if we move this road off, we
[1:52:05] probably wouldn't be able to do a
[1:52:07] reimbursement agreement or you know in
[1:52:09] that circumstance. So that is one thing
[1:52:12] that probably changes
[1:52:13] >> mayor.
[1:52:15] Well, we do have a representative from
[1:52:19] Bridge Pacific Bridge and Bridge and
[1:52:21] Schaefer Industries as well. Um there's
[1:52:25] it's a little bit complex on the the
[1:52:27] possibilities here and I I think it's
[1:52:30] important to understand the perspective
[1:52:33] of the other property owners that are
[1:52:34] potentially impacted here. Um, I'd like
[1:52:38] to invite you to come forward
[1:52:43] and maybe
[1:52:44] >> so some of you weren't here last two
[1:52:46] months ago. I'm Clark Olsen, uh, with
[1:52:48] Utah Pacific Bridge, one of the founders
[1:52:50] and president. [clears throat]
[1:52:54] Uh, the way we left it last or two
[1:52:56] months ago was because of safety issues.
[1:52:58] I'm I'm very similar to Martin Snow. You
[1:53:02] know, we've got 200 foot girders, 150
[1:53:05] tons sitting there uh with five 150 ton
[1:53:10] mobile cranes passing back and forth
[1:53:13] with that property line. Uh so it's a
[1:53:16] safety issue. I you know I just don't
[1:53:17] want a road there. However, uh we
[1:53:22] >> and road there, let's be specific. That
[1:53:24] would be in the blue. Well, really
[1:53:26] neither one. Number one, the north south
[1:53:30] because it uh it it uh adjoins our
[1:53:34] property and the east west the green
[1:53:37] road uh you know would collect
[1:53:42] from that subdivision area cars to go
[1:53:46] from there to the east and then south on uh 200 north so that you know that's
[1:53:53] our concern is just generating traffic
[1:53:56] there now two months ago
[1:53:59] uh Schaefer indust industries couldn't
[1:54:02] be here, but they did propose a letter,
[1:54:05] a culde-sac that was that was presented
[1:54:08] at least
[1:54:09] um and Clark Taylor with Schaefer uh
[1:54:15] called me shortly after, wanted to meet.
[1:54:17] I' I've been gone for about a month, but
[1:54:19] anyway, we did meet last Wednesday and
[1:54:22] uh Mr. Taylor presented that same
[1:54:25] shortened culde-sac running north south
[1:54:27] from Center Street of which uh I could
[1:54:32] do. I mean I I don't want a road at all,
[1:54:34] but I I told him that we would agree to
[1:54:37] that. It's shortened. It doesn't get
[1:54:39] north uh uh so far as to uh to bisect,
[1:54:46] you know, my two pieces to the north.
[1:54:49] And also more importantly, it doesn't
[1:54:51] have an east west road, 1,200 west or a
[1:54:55] 200 north road to collect traffic. So I
[1:55:00] thought we I thought we were good. Um
[1:55:03] but he but Clark called me at noon today
[1:55:05] and said they don't want to do that.
[1:55:07] They want all all the roads for I don't
[1:55:09] know why because he's the one that rep
[1:55:11] proposed it in the first place. But so
[1:55:13] that's where I am. So to be to to
[1:55:15] summarize I I would do the the
[1:55:18] originally proposed as of two months ago
[1:55:21] culde-sac Jordan culac but
[1:55:25] >> okay
[1:55:26] >> doesn't want to at least he didn't
[1:55:27] >> we'll give him an opportunity to
[1:55:29] >> okay great
[1:55:30] >> share thank you
[1:55:31] >> okay so that's where we're at
[1:55:32] >> okay anything else Mr. Olsson
[1:55:33] >> uh no thank you okay thank you very much
[1:55:36] all right Mr. Taylor.
[1:55:47] » Is this an exhibit that we need to share
[1:55:49] with the council?
[1:56:13] All right. Thank you. Please state your
[1:56:15] full name for the record.
[1:56:17] >> My name is Clark Taylor
[1:56:21] and I'm executive vice president,
[1:56:23] general counsel for Schaefer and its
[1:56:25] affiliate
[1:56:27] Shadow Mountains.
[1:56:30] and appreciate uh you continuing this to
[1:56:34] today.
[1:56:35] I had a family medical emergency and I
[1:56:39] appreciate the opportunity to appear and
[1:56:41] get to present our position
[1:56:44] and I should uh state greetings to the
[1:56:48] mayor,
[1:56:49] uh the council members,
[1:56:52] uh madame reporter and the city planner
[1:56:56] and attorney and
[1:56:59] administrator. You've I've worked with
[1:57:01] the city for many years. I remember
[1:57:04] going back through the old building,
[1:57:06] the the little building we've had. We
[1:57:08] work
[1:57:09] >> we've worked together. We've really
[1:57:11] tried to be good corporate citizens.
[1:57:14] Schaefer Industries
[1:57:16] um manufactures
[1:57:18] structural pipe and tube.
[1:57:21] Uh so structural pipe and tube basically
[1:57:25] there are two things that hold up
[1:57:26] America.
[1:57:28] One is concrete and two with steel. And
[1:57:31] we're a leading manufacturer in the
[1:57:32] western United States with our
[1:57:34] geographic area being from
[1:57:37] we do have some clients back east, our
[1:57:39] customers, but generally from Colorado
[1:57:42] to Hawaii and generally border to
[1:57:44] border, but in the western United
[1:57:46] States, we're a leading manufacturer.
[1:57:49] For example, if you pull this drywall
[1:57:51] down, you'd see our our steel here. It
[1:57:55] holds up billboards. that holds up
[1:57:57] gates, fences, bullards. If you just
[1:58:00] walk outside, you could name 30 uses of
[1:58:03] our steel just from your front porch
[1:58:06] here. Uh we've been and we have 27 acres
[1:58:09] there with four large facilities. I
[1:58:12] think some of you are familiar. If not dropped by anytime, I'll give you a
[1:58:16] tour. Uh we in addition and we came in 1988.
[1:58:22] Um,
[1:58:24] and we built we started our campus the
[1:58:26] 27 acres that just is off the screen
[1:58:28] there.
[1:58:33] » Uh,
[1:58:34] and then then the northern 27 acres is
[1:58:37] depicted on the the uh map and I've
[1:58:42] highlighted that in blue in the first
[1:58:45] handout
[1:58:46] >> and that currently is undeveloped land.
[1:58:49] >> That's undeveloped land. I will note
[1:58:51] that uh a couple of years ago the city
[1:58:54] and we've really tried to be good
[1:58:56] corporate citizens and I want to commend
[1:58:58] the city staff. We've we've worked well
[1:59:01] together for decades.
[1:59:04] >> Um
[1:59:05] >> thank you.
[1:59:10] So, we've worked we've worked uh
[1:59:12] tremendously together and the city
[1:59:14] wanted to place see the fill on the
[1:59:18] south part of the 27 acres. Uh we had
[1:59:21] that in green belt and the city came to
[1:59:23] us and and said we need to dispose of
[1:59:27] our dirt and like like we always get
[1:59:30] along. So, we said no problem. None of
[1:59:32] us anticipated that the county wasn't
[1:59:34] going to cooperate.
[1:59:36] >> And so now this we got a almost $350,000
[1:59:40] bill from the county because they've
[1:59:43] changed the zoning. And that will be a
[1:59:45] huge bill that will go on into the
[1:59:46] future.
[1:59:48] But the the property other than the
[1:59:51] accommodating the city is undeveloped.
[1:59:54] Uh except for on the west corridor. Uh
[2:00:00] Mr.
[2:00:00] highlighters right there if you need.
[2:00:02] >> Oh, I you know, I don't know if I'm
[2:00:03] steady enough to to do that, but maybe
[2:00:06] I'll be
[2:00:08] [clears throat] the when Ivory Homes
[2:00:10] went in,
[2:00:11] the city needed to connect here
[2:00:16] um so that they could have the water uh
[2:00:19] sewer, both pressure and normal flow.
[2:00:22] So, four lines in through there. And the
[2:00:26] ultimate resolution was we let the lines
[2:00:29] go in and the city engineered the road
[2:00:30] and we anticipate we've already had our
[2:00:32] pre-construction meeting building that
[2:00:34] this summer. And of course this is a a
[2:00:38] road that is a a residential
[2:00:41] uh road on the the master plan. You
[2:00:44] you've seen the master plan. Um
[2:00:47] so it's it's undeveloped. However, we
[2:00:51] have relied on the master plan for
[2:00:54] years.
[2:00:56] Um, so if you go to the the handout,
[2:00:59] skip the second page and and go to the
[2:01:03] third page. Um, I've tracked it back,
[2:01:06] council said it goes back further, but
[2:01:08] I've tracked tracked back as far as I
[2:01:10] can. This is 1995 a master plan to 2000.
[2:01:16] And you can see that the 1200 west is on
[2:01:19] there. And then you can see the next one
[2:01:22] is 2000 to 2005.
[2:01:25] There we have the east west 1200 on
[2:01:28] there as well.
[2:01:31] Uh and the next uh is 2006.
[2:01:35] You'll see both roads are are on there.
[2:01:39] And
[2:01:41] then we see the same in 2011.
[2:01:44] And that brings us to 2013. So, so
[2:01:48] Schaefer Industries Shadow Mountain,
[2:01:50] we've relied on the master plan for
[2:01:54] decades, literally decades, with respect
[2:01:57] to the development. Now, we recognize
[2:02:00] that the city came in and put Ivory
[2:02:02] Homes in, which may impact us with
[2:02:05] respect to development plans, but that's
[2:02:07] for something down the road.
[2:02:11] One thing I want you to note while
[2:02:13] you're looking at
[2:02:15] the if you go to the U first page of the
[2:02:19] handout,
[2:02:22] and I'm going to use Schaefer for short
[2:02:25] for the full designation.
[2:02:30] We are the land owners that are most
[2:02:32] impacted by this. And I did a real rough
[2:02:35] calculation off of Google Earth. We have
[2:02:38] some 1,400 ft approximately at issue. Uh
[2:02:43] Mr. Snow has roughly 950,
[2:02:46] Mr. Olson about 750.
[2:02:49] But again, you have to understand we
[2:02:51] have been relying on these and to adopt
[2:02:54] the proposal as made
[2:02:58] landlocks our property
[2:03:01] from the current zoning and from the
[2:03:04] master plan which is light industrial.
[2:03:06] landlockwalks this completely because
[2:03:08] people say, "Well, you've got the road
[2:03:10] on the that you're putting in and then
[2:03:12] it continues up the east side of Ivory.
[2:03:14] That's a residential road that is not
[2:03:16] going to handle the traffic.
[2:03:19] It's not going to if we put a
[2:03:20] distribution center in there, it's not
[2:03:22] going to handle the traffic. If we go
[2:03:24] with heavy industrial, it won't handle
[2:03:25] the traffic. if if virtually you're
[2:03:28] going to landlock the property that
[2:03:30] we've relied on for decades. And so I
[2:03:32] thought, well, there must be some big
[2:03:35] public interest at issue
[2:03:38] for for this issue to bubble up to the
[2:03:41] surface at this point in time. So I
[2:03:43] thought, well, let me refresh my memory
[2:03:45] on master plans. So I went to the
[2:03:48] statute and I thought, well, let's start
[2:03:50] with our state law. And our state law
[2:03:54] requires a master plan. And under state
[2:03:58] law that it the master plan has to have
[2:04:00] two items.
[2:04:02] It must have it must address the future
[2:04:05] and present needs of the municipality
[2:04:08] and I would suggest that means the
[2:04:10] public at large not a single property
[2:04:13] owner
[2:04:14] and it has to address the growth and
[2:04:17] development
[2:04:18] of any or part of the land within the
[2:04:22] city within the municipality. So that's
[2:04:25] state law and the focus is on future.
[2:04:30] So then I thought well let's let's see
[2:04:32] what the state has said what how do how
[2:04:35] do we teach the cities this? So I went
[2:04:37] to the general planning guide that the
[2:04:39] state puts out and it says on its face
[2:04:42] in the introduction
[2:04:44] this guide will help you understand the
[2:04:46] role that the general plan should play
[2:04:49] in your community.
[2:04:52] And let me tell you in in that uh first
[2:04:55] few pages it says planning and we're
[2:04:57] talking about planning
[2:04:59] also allows stakeholders Schaefer for
[2:05:02] decades
[2:05:04] to know what to expect from your city.
[2:05:07] What are we going to expect? We're going
[2:05:09] to expect that we can develop that
[2:05:11] property in 1988. We could literally see
[2:05:13] from here to to the point of the
[2:05:15] mountains before all the growth came in.
[2:05:18] The general plan outlines your city's
[2:05:20] vision. We're talking about vision for
[2:05:23] the future and describes how that vision
[2:05:25] will be achieved. Residents, developers,
[2:05:27] business, state government, and others
[2:05:29] interested parties should be able to see
[2:05:31] how your city will change by reviewing
[2:05:34] the general plan. So, the general plan
[2:05:36] is very, very important. And that gets
[2:05:38] to the heart of your question. It really
[2:05:41] matters if we're on the general plan. It
[2:05:43] does. And in fact, if the proposal is is
[2:05:47] adopted as is, it will have a draconian
[2:05:51] effect on our property, including the
[2:05:52] value and landlocking is not fun. Well,
[2:05:56] I went on to the next step trying to
[2:05:58] track this through. What does what does
[2:06:00] the state say about drafting? Not only
[2:06:02] the policy, but what does it say about
[2:06:04] drafting?
[2:06:07] And it says the same thing. general
[2:06:09] plans, also called master plans or com
[2:06:14] comprehensive plans, guide. So guide,
[2:06:16] we're talking about the future, your
[2:06:19] community in its decision making by
[2:06:21] describing its current and future needs
[2:06:23] and then it goes on. But that's that's
[2:06:25] how this is what we're supposed to
[2:06:28] follow in drafting these. So then I
[2:06:30] thought, well, what did we draft?
[2:06:33] So I looked at our master plan and our
[2:06:38] master plan says right at the beginning
[2:06:40] what is a general plan. The general plan
[2:06:43] serves as an advisory document
[2:06:46] that helps guide the future growth.
[2:06:48] We're talking about the future growth.
[2:06:50] We're not talking about landlocking
[2:06:52] people who've relied for decades who are
[2:06:54] the most impacted owners and land use
[2:06:58] decisions. It indicates the location and
[2:07:00] type of land uses and it goes on
[2:07:05] » u skipping down the general plan not
[2:07:08] only helps guide future development. So
[2:07:11] future development and it it goes on
[2:07:14] after that. So that's what we've we've
[2:07:17] addressed and so again I'm thinking
[2:07:20] there must be some big public interest
[2:07:22] that's come up for this about phase of
[2:07:25] this issue that's been resolved for
[2:07:27] decades.
[2:07:28] And you know, I started digging into it
[2:07:30] and let me tell you what I found. I
[2:07:34] found out and I and I'm gonna tip my
[2:07:36] hand up front because I want I'm gonna
[2:07:38] bore you a little bit, but I'm going to
[2:07:39] tell you what this is all about is to
[2:07:42] resolve private litigation with the
[2:07:44] contract. That's not what master
[2:07:46] planning is for. It's not to resolve
[2:07:48] litigation. That's nowhere in the
[2:07:50] statute. It's nowhere in the in the the
[2:07:54] guide. It's nowhere in the the
[2:07:56] discussion about how we draft these.
[2:07:58] It's nowhere in our master plan
[2:08:01] resolving private disputes because Ivory
[2:08:04] and the city have an issue with Mr.
[2:08:09] Martin and we love Mr. Martin and
[2:08:11] respect him. That shouldn't dictate what
[2:08:14] we've relied on for years. Litigation
[2:08:17] resolution is not an appropriate
[2:08:19] consideration for for planning. So um
[2:08:24] Mr. Taylor, thank you. I just in the
[2:08:26] interest of time. Um I think we hear you
[2:08:30] and uh so I have I have kind of some
[2:08:33] general questions. Um I think in this
[2:08:36] instance everything that you stated
[2:08:38] there in those documents is true. They
[2:08:40] are advisory. They are vision and it is
[2:08:44] we this body has had numerous times
[2:08:47] where you know like we said this vision
[2:08:50] this advisory flow has been created many sometimes decades ago. We do
[2:08:57] revisit with the realities of today of
[2:09:00] how maybe things have changed and the
[2:09:02] way the direction development has gone.
[2:09:04] Um it is appropriate for bodies to
[2:09:07] sometimes review the practicality
[2:09:10] of those road plans and we do make
[2:09:13] adjustments and tweaks and that's um
[2:09:16] again we we we want to make a good
[2:09:18] decision that is practical and balances
[2:09:21] the interests of everyone that's
[2:09:22] impacted and also what's really
[2:09:25] happening with the growth because like
[2:09:27] you said when you were there and you
[2:09:29] could see the point of the mountain who
[2:09:30] we didn't know what was coming but there
[2:09:33] so sometimes change. We can tweak things
[2:09:35] and that's appropriate legally. Um so my
[2:09:39] question for you is um obviously you do
[2:09:44] you imagine with this 27 acres do you
[2:09:46] have a plan of what you plan to do with
[2:09:49] that? Are you going to sell it? Are you
[2:09:51] going to do you have imminent you said
[2:09:53] you were kind of relying on these roads
[2:09:56] as you've seen them for this amount of
[2:09:58] time. Do you anticipate you are going to
[2:10:01] determine what comes here or are you
[2:10:03] going to sell the property and have a
[2:10:05] another entity come and say you know
[2:10:07] what actually we want maybe the
[2:10:09] circulation to be different. I mean I'm
[2:10:11] sure you would want that flexibility
[2:10:13] within your 27 acres as well but when
[2:10:17] you say you've relied on it do you have
[2:10:20] a plan currently in mind of what's
[2:10:22] happening there?
[2:10:24] >> I'll answer the question by saying very
[2:10:26] short no. However,
[2:10:29] we had a plan and we bought the property
[2:10:32] for an expansion site.
[2:10:33] >> Okay,
[2:10:34] >> that's why we bought it and that's why
[2:10:36] we've held on to it. It's in heavy
[2:10:38] industrial. However, the city came in
[2:10:41] however many handful of years ago and
[2:10:44] put a residential area right next to us
[2:10:47] and that's caused us to rethink things.
[2:10:50] But let me tell you, with respect to the
[2:10:52] affected roads, with respect to Mr.
[2:10:54] Rollson. Nothing's changed there. And
[2:10:57] the and eliminating the these roads, I
[2:11:00] mean, he's been swinging these beams and by the way, if he's swinging these
[2:11:04] beams and and it's dangerous, he
[2:11:06] shouldn't be allowed to do it in the
[2:11:07] public road. That should be barred. And also, Mr. Martin's use hasn't
[2:11:12] changed. There's been no change in our
[2:11:15] area other than the city zoning
[2:11:18] residential, which is on the other side.
[2:11:20] And so, no, we don't have a current
[2:11:22] plan. We're going to have a plan, but we
[2:11:24] don't want to to be frozen out by a
[2:11:26] change in a master plan that we've
[2:11:29] relied on for decades.
[2:11:30] >> But you might want flexibility to
[2:11:32] potentially determine how things are
[2:11:35] developed out as well. I would imagine
[2:11:38] you're not saying do these roads and
[2:11:39] never change them.
[2:11:41] >> We are not saying that. And in fact, we
[2:11:43] considered the culde-sac, but we want to
[2:11:45] be good neighbors and I have done that.
[2:11:48] I've done my level best to get this
[2:11:49] resolved. Unfortunately, and and I think
[2:11:52] the other the opposing sides, we're all
[2:11:54] friends, and I think they'll they will
[2:11:57] recognize I've been the one running
[2:11:58] around trying to get this resolved. And
[2:12:01] we hoped a culde-sac would work, but it
[2:12:03] doesn't work because of the city
[2:12:04] ordinances. We studied it. The city
[2:12:06] engineers drafted a couple of proposals,
[2:12:09] but it doesn't get us far enough into
[2:12:11] our property so that we can do
[2:12:13] something. So, we and we don't want to
[2:12:15] be disadvantaged by having these roads
[2:12:17] stripped off of our property. the
[2:12:19] developers won't want it. They're going
[2:12:21] to say, "What's the city going to do?"
[2:12:23] So, we need certainty. [clears throat]
[2:12:24] We need to have the roads there. And the
[2:12:27] there is a quotation I have down here
[2:12:30] from I think the planning department
[2:12:31] where they say the reason we're doing
[2:12:33] this is so that the roads can be
[2:12:35] developed in accordance or put in in
[2:12:38] accordance with the development. That is
[2:12:40] completely backwards planning. You you
[2:12:43] don't do it that way. It flies in the
[2:12:45] face of what we've done. And that is
[2:12:46] under the purpose section.
[2:12:50] of the the planning report. I wish I
[2:12:55] could put my hands right on it
[2:12:58] because it just it says right on its
[2:13:00] face. Let me see if I can turn to it.
[2:13:04] >> So, you did at one point think the
[2:13:06] culde-sac might be an option that
[2:13:08] >> we did that and and what specifically?
[2:13:11] So, now you're concerned it doesn't
[2:13:13] >> it won't work. It won't work. We we have looked at we've looked at a
[2:13:17] couple of auctions. I've looked at the
[2:13:19] code the everybody can back me up. It
[2:13:22] just won't work. If you look at it, it
[2:13:25] just tips into our It won't work. If we
[2:13:28] could take that and extend it a couple
[2:13:30] of hundred feet. Well, maybe that would
[2:13:32] work. But the problem is is where it
[2:13:35] sits so far. We can't do what we need to
[2:13:38] do. I mean, it would be another problem
[2:13:40] with access.
[2:13:41] >> Okay. So actually maybe culstack is
[2:13:44] still on the table if it just had a you
[2:13:47] said a few hundred feet further in to
[2:13:51] your joining properties.
[2:13:52] >> It is an option. It's not a desirable
[2:13:54] option and not by far what we want but
[2:13:57] trying to be good neighbors. We tried to
[2:14:00] brainstorm what we've looked at every
[2:14:02] possible angle. Every possible angle.
[2:14:05] And I want to read you that quote. The
[2:14:07] purpose of the request is to allow
[2:14:11] street alignments to be determined at
[2:14:14] the time property is developed. That is
[2:14:16] backwards planning. You put the roads
[2:14:18] in. It's the future. It's the vision on
[2:14:20] the master plan so that people know
[2:14:22] what's coming. So we we've really really
[2:14:26] tried to resolve this. Now, all of that
[2:14:28] said, I I have to tell you,
[2:14:34] somebody's going to be unhappy with the
[2:14:36] result tonight.
[2:14:38] What we are, if you'll go to the second
[2:14:41] handout, we are okay
[2:14:45] as an alternative
[2:14:48] to deleting the road.
[2:14:52] You can see it on there
[2:14:54] >> that is between Mr. snows buildings from
[2:14:58] the master plan. He gets his bond. The
[2:15:00] city gets the money to rectify the
[2:15:02] litigation over at Ivy, which is what
[2:15:04] this is all about, which is improper
[2:15:06] legally.
[2:15:08] We're okay with the as long as we get to
[2:15:10] keep what we've had on the master plan
[2:15:13] for decades. So, we're not landlocked.
[2:15:16] Again, we can't access it for what the
[2:15:18] current or proposed use is
[2:15:21] >> from the the west, but we've got to
[2:15:23] access it from the east. So, if I
[2:15:26] understand clearly, it sounds like all
[2:15:28] three party business owners are in
[2:15:32] agreement that area that you have
[2:15:35] crossed out that that's not an issue for
[2:15:37] any of the parties to to for that.
[2:15:39] >> It's not an issue for us. We then we
[2:15:41] support that.
[2:15:42] >> Okay. Well, we're on the same page with
[2:15:43] that one issue. That's that's good news.
[2:15:45] I would like to allow my council to
[2:15:48] maybe ask questions um as well on what
[2:15:54] is in front of us here to any of the
[2:15:56] parties.
[2:15:58] >> So um apologize. Last time I was in the
[2:16:02] cloud, but I was here, right? And and I
[2:16:04] was the one that was kind of leaning
[2:16:06] towards continuing it to make sure we
[2:16:08] could get everybody's needs addressed.
[2:16:12] Um I'm I'm a huge advocate
[2:16:16] of the general plan. It It's important
[2:16:19] for cities to plan a city council. Yes,
[2:16:23] we need to deal with what's going on
[2:16:24] today, but we've got to look 50 and 100
[2:16:27] years. And all of us are gone and your
[2:16:29] property belongs to someone else. Even
[2:16:30] your right, your your business that's
[2:16:33] there, your businesses that are there.
[2:16:35] So, what I'd like to see is something
[2:16:37] that works today for you today, but
[2:16:41] still helps in this future. And this is
[2:16:43] not swayed by what Mr. Taylor has said,
[2:16:46] although it aligns a lot with what he
[2:16:48] has said, that's been I will I want to
[2:16:51] protect master plans as much as
[2:16:54] possible. Um, so I think it's great to
[2:16:59] remove that that one slide that Mike
[2:17:01] showed with the green road. I'm
[2:17:04] completely in favor in facilitating some
[2:17:06] of the needs that that provides
[2:17:08] >> the entire green road.
[2:17:10] >> No, his short segment.
[2:17:12] >> Yes. on snow properties.
[2:17:14] >> So, I'm I'm I think that makes
[2:17:16] everyone's happy. I think the mayor just
[2:17:17] pointed that out. I think that works for
[2:17:19] everyone. The other roads that are there
[2:17:22] on the general plan,
[2:17:26] they're there, but you keep doing your
[2:17:28] stuff, right? You keep running your
[2:17:30] business. You keep running your
[2:17:32] business. Mr. Snow, we can meet those
[2:17:35] needs. Um I'm one that would be happy to
[2:17:38] make a motion for that. But I don't need
[2:17:40] to make it right now because I don't
[2:17:41] want to cut Steve off for others.
[2:17:42] >> Yeah. I just want some clarification
[2:17:44] too, kind of going beyond where you are
[2:17:46] because I was going to mention that, but
[2:17:49] with the two roads that are in place
[2:17:51] beyond just the one you're talking about
[2:17:53] eliminating in the future, if those were
[2:17:56] to be developed, that would be some
[2:17:59] agreement between two property owners
[2:18:01] that and and what does that look like
[2:18:03] and how does that what's that process?
[2:18:06] So, typically you'll you'd have a
[2:18:08] subdivision plat dedicating right of way
[2:18:11] and so they will have to sign a
[2:18:13] subdivision plat or one person would
[2:18:16] need to buy one property owner would
[2:18:17] need to buy right ofway width from them.
[2:18:20] So, a couple different options. Um, but
[2:18:24] >> so even if those stayed on the plan, uh,
[2:18:26] it still requires all the parties to be
[2:18:28] involved in how that will end up being
[2:18:31] developed. Correct. So, everybody still
[2:18:32] has a voice in what happens.
[2:18:34] >> Yes. Okay,
[2:18:35] >> if I may, that's there's one additional
[2:18:38] option is condemnation.
[2:18:40] For example, when Ivory put in uh its
[2:18:43] development, we had no interest in
[2:18:46] utilities going across our property. And
[2:18:48] so, what did the city say? He cooperated
[2:18:50] or we're going to condemn it.
[2:18:52] >> And if you read our development
[2:18:54] agreement, it says right on his face, we
[2:18:56] are entering its agreement under the
[2:18:57] threat of condemnation. So if the city
[2:19:00] wants to do something for the which it
[2:19:02] should for the betterment of the city,
[2:19:05] the future of the city, and the land
[2:19:06] owners can't work it out, there's always
[2:19:08] combination.
[2:19:09] >> Okay.
[2:19:10] >> And I do just need to clarify and and
[2:19:12] Clark is right. It says that and Clark
[2:19:15] knows that we added that on there for
[2:19:17] tax purposes to help him. Now, there is
[2:19:19] a right of private condemnation that was
[2:19:21] raised by Ivory, but the city was never
[2:19:23] going to condemn your property. You
[2:19:25] remember that, right, Mark?
[2:19:27] >> It's not my memory.
[2:19:29] >> [laughter]
[2:19:30] >> there were utility benefits as well that
[2:19:32] we'll put in there that will help
[2:19:34] >> but but there but he's right
[2:19:36] condemnation is an option that's right
[2:19:40] >> so again I don't want to close anyone
[2:19:41] off I want to protect the general plan
[2:19:43] as a general plan it's just it's there
[2:19:46] guideline it doesn't no roads going in
[2:19:48] today we're not forcing anything we're
[2:19:51] not they would stay on the general plan
[2:19:53] everybody continue doing their business
[2:19:55] the way they're doing their business um
[2:19:58] we would just remove that section. I'm
[2:20:01] prepared to make that motion this time.
[2:20:03] Um if if but but keep talking others
[2:20:07] that are interested in asking questions.
[2:20:10] >> May I?
[2:20:11] >> Yes. Go ahead.
[2:20:13] >> Uh the thing that's changed in the last
[2:20:16] 10 years is now we have a residential
[2:20:19] subdivision to the west
[2:20:22] uh that really surrounds now heavy
[2:20:25] industrial. And again, Our concern is
[2:20:28] the traffic that that residential uh
[2:20:32] development could generate going from
[2:20:35] west to east and then going south and up
[2:20:39] then and of course then east on center
[2:20:42] street. And you know we uh you know
[2:20:46] Clark Taylor says we shouldn't be
[2:20:47] swinging over roads girders. We don't.
[2:20:50] My concern is these are so unusual.
[2:20:53] They're so large. some of the largest
[2:20:55] girders made in the western United
[2:20:57] States or the United States period. I'm
[2:21:00] concerned about just traffic stopping
[2:21:03] and watching because they will. We're
[2:21:07] also painting there. We're allowed to
[2:21:09] paint. I'm concerned about that. Um
[2:21:12] >> that's if that road goes in from west to
[2:21:15] east or east to west. Yeah, I think it's
[2:21:18] important to note that that's the road
[2:21:19] that will generate the traffic. Now, you
[2:21:22] know, the culdesac would not generate
[2:21:23] the traffic. If if Schaefer wanted to
[2:21:26] come west to east and and terminate in a
[2:21:29] culde-sac on his property to gain
[2:21:32] access, I wouldn't be opposed to that
[2:21:35] either, but I am opposed to a full east
[2:21:38] west north south corridor generating
[2:21:42] traffic right in the middle of heavy
[2:21:44] industrial.
[2:21:47] >> But we're not choosing, we're not
[2:21:49] deciding today to put a road in. We're
[2:21:50] just saying leave it there for 50 years
[2:21:53] or 100 years down the road.
[2:21:54] >> Let's decide not to put a road in
[2:21:56] because the general plan should be
[2:21:58] changed because the conditions have
[2:22:00] changed.
[2:22:01] >> But they've changed because Martin has
[2:22:04] built on [clears throat] both sides of
[2:22:05] that road. I could build heavy
[2:22:08] industrial on both sides of that road on
[2:22:10] the north my my north end that adjoins
[2:22:13] Martin Snows. Those two pieces, you
[2:22:16] know, we talk about being landlocked. If
[2:22:19] that goes in, I I've isolated two pieces
[2:22:22] that I can't do anything with.
[2:22:24] >> They're very small. I can't do anything.
[2:22:28] >> But again,
[2:22:29] >> you know, we talk about, you know,
[2:22:31] keeping the general plan with, but if
[2:22:32] the general plan because of the current
[2:22:35] conditions are are different today than
[2:22:38] they were in in 1990,
[2:22:41] change it. So, if someone were
[2:22:44] proposing, let's put a road in today,
[2:22:45] then you've got good arguments, and I
[2:22:47] would say, no, I don't think this is the
[2:22:49] right thing to do. The vote today is a
[2:22:51] general plan looking 50 to 100 years
[2:22:54] down the road. I'm fine with leaving it
[2:22:56] there. I think it's good to leave it
[2:22:57] there. We're not putting anything in
[2:22:59] today. Definitely not.
[2:23:01] >> I agree with that. But that that states
[2:23:05] that that is the possibility. That's the city sees as that as the
[2:23:09] future. And the fact And now we have
[2:23:12] residential.
[2:23:15] You know what? What if Schaefer wants to
[2:23:16] sell that as residential?
[2:23:19] What if he wants to sell it as
[2:23:20] commercial or or or uh office space?
[2:23:24] That all of those are going to generate
[2:23:26] uh traffic. And none of those are good
[2:23:29] neighbors to heavy industrial. None of
[2:23:32] them. And so if if if Schaefer wants an
[2:23:35] east west access, having put it in, it
[2:23:39] doesn't need to go all the way to the
[2:23:41] east of my property. It doesn't need to
[2:23:43] connect on the center street. If we put
[2:23:45] that culde-sac in which Schaefer
[2:23:47] recommended and we could have we could
[2:23:49] have passed this, if I would have agreed
[2:23:52] to it, it would have been changed two
[2:23:54] months ago because Schaeer requested the
[2:23:58] culde-sac,
[2:23:59] >> but I didn't want anything,
[2:24:01] >> right?
[2:24:03] And so that you know there there we are.
[2:24:05] I mean I don't know why if it just won't
[2:24:08] work now why why I mean it worked two
[2:24:11] months ago but now it won't because that
[2:24:14] was the solution
[2:24:16] >> right
[2:24:16] >> but I didn't want anything and it was
[2:24:18] new to me. Well you know because I don't
[2:24:21] want new additional traffic generated
[2:24:24] that culde-sac accomplishes that. It
[2:24:27] accomplishes it for Martin. Martin
[2:24:29] doesn't want that that east west
[2:24:31] corridor road running um against his
[2:24:36] southern property either.
[2:24:37] >> So quick question. So Mr. Taylor
[2:24:41] said culde-sac is not his first choice,
[2:24:44] but in another alternate if there was a
[2:24:47] culde-sac, if there is a culde-sac, he
[2:24:50] needs it to go a little bit deeper to
[2:24:53] the north.
[2:24:54] >> In our in our current in our ordinance,
[2:24:56] our subdivision ordinance says you can't
[2:24:58] have a culde-sac
[2:24:59] >> deeper thanund or 650 ft. So that's
[2:25:02] measured from the intersection of the
[2:25:04] street to the middle of the culde-sac.
[2:25:06] And so that's why, you know, we did that
[2:25:09] diagram and it shows, you know, what
[2:25:10] where it hits on the property
[2:25:12] >> and that's been something that we Go
[2:25:14] ahead.
[2:25:14] >> Excuse me. Is that the 650 ft you're
[2:25:16] talking about? In other words, did we
[2:25:18] take it as far north as we could?
[2:25:20] >> We did
[2:25:20] >> from Center Street under our current
[2:25:23] regulations. Well, that's something
[2:25:24] we've talked about reviewing because
[2:25:26] there's some examples in the city where
[2:25:29] sometimes there's just been things have
[2:25:31] been not developed,
[2:25:34] you know, with adjacent areas. And so
[2:25:36] maybe we need to review that. Um, but as
[2:25:39] of today, correct, that is what it is.
[2:25:40] >> Yeah. And also clarify this the homes
[2:25:44] that back on to Anderson Lane, they they
[2:25:47] do not have access to Anderson Lane.
[2:25:49] There's a big
[2:25:50] >> six or seven foot masonry wall along
[2:25:52] that street. [clears throat]
[2:25:56] » Mr. Taylor or whoever you you said that
[2:25:59] Anderson Lane couldn't be used for some
[2:26:03] of the purposes that you had hoped for.
[2:26:07] I don't I guess I is it because the
[2:26:09] trucks are too big or
[2:26:12] >> That's exactly right. You as a practical
[2:26:16] matter, you don't run semis in a
[2:26:17] neighborhood. Sure.
[2:26:19] >> And so the the the road to say we have
[2:26:22] access for the current zoning it does
[2:26:24] we're having industrial even the master
[2:26:26] plan
[2:26:28] as light industrial doesn't work too.
[2:26:30] You have semis going up and down there.
[2:26:32] >> What is the road profile width that's
[2:26:34] called out for there. It's not really
[2:26:36] technically a neighborhood because a
[2:26:38] neighborhood is is is completely cut off
[2:26:40] with that masonry wall. So the residents
[2:26:42] don't have access vehicularly or
[2:26:45] pedestrian or bicycle anything. It's
[2:26:48] segmented there. But maybe we should
[2:26:51] look what's the road profile
[2:26:53] >> closer to 700
[2:26:55] >> part of our development agreement with Shell Mountain. We actually worked
[2:26:59] with them and came to an agreement on
[2:27:01] the width and the profile of it.
[2:27:09] Again, we're all friends here, but I
[2:27:10] disagree that that wasn't considered
[2:27:13] because we do have that
[2:27:17] There's more to the story than that. We
[2:27:20] we're aware of the master plan and we're
[2:27:24] aware of current zoning and the master
[2:27:26] plan zoning. We know that a residential
[2:27:29] road won't work won't work. So, we had
[2:27:32] the option at our cost using more than
[2:27:36] half of the road with our neighbor on
[2:27:37] our property of expanding the road on
[2:27:40] that segment. And we elected we made
[2:27:43] that election timely and writing. But
[2:27:46] that was our idea because we know that road as currently
[2:27:51] drafted on the master plan won't work
[2:27:54] for the development of this property. So
[2:27:56] that's why we're landlocked.
[2:27:59] Now you're right. Can things change in
[2:28:01] the future? Maybe. But right now it's
[2:28:04] 650 ft. I'm very concerned about the
[2:28:07] fire department not allowing that even
[2:28:09] if the city council and the planning
[2:28:10] commission would allow it. So there are
[2:28:12] a lot of ifs. And so what we need to in
[2:28:14] my judgment is stick to what the policy
[2:28:17] is plan for the future like we've been
[2:28:20] relying for 30 years and our the
[2:28:23] proposal that Mr. Jacobs has made not
[2:28:27] formally lets matters go forward now and
[2:28:31] tables matter for the future when we
[2:28:33] address them everybody you guys can all
[2:28:36] move forward with your deal. So, if
[2:28:38] Anderson Lane you feel is not wide
[2:28:40] enough
[2:28:41] um and then your segment that connects
[2:28:44] to Anderson Lane
[2:28:48] has that same profile adoption which was
[2:28:51] skinny up the road a little bit. Um
[2:28:54] would you ever want to expand it that
[2:28:57] profile for your industrial portion down
[2:29:00] there of Anderson Lane?
[2:29:05] We are we're going to build for what
[2:29:08] we're currently master zone for our
[2:29:10] master plan for
[2:29:11] >> and what we're currently zoned for.
[2:29:13] We're going to build as though we're
[2:29:14] relying on what's there. And so we are
[2:29:17] building at our cost using our extra
[2:29:21] land, not going right down the middle.
[2:29:22] We're using we're paying for the extra
[2:29:25] improvements and using our land to make
[2:29:27] it wider than what the city
[2:29:30] than the the north south straight north
[2:29:33] south part of
[2:29:33] >> Anderson
[2:29:35] because we think master plan should
[2:29:37] carry weight.
[2:29:40] » All right.
[2:29:45] » Yes.
[2:29:46] >> When Ivory came in, I was just looking
[2:29:49] at the 2006 master plan.
[2:29:52] The
[2:29:54] east west roadway
[2:30:02] off 700 and then
[2:30:06] went back and then the city put in the
[2:30:08] road to get down to the lift station. So
[2:30:12] the east west used to continue right on
[2:30:16] straight through and now that part of
[2:30:18] the road isn't there anymore. So I mean
[2:30:22] that's why I was saying is that in the
[2:30:24] right place
[2:30:27] for that I would think looking at the
[2:30:29] map we already took part of it out and
[2:30:31] the other issue that you were talking
[2:30:34] about the street with that road that
[2:30:36] went through Anderson what I call 1400
[2:30:39] was in the previous
[2:30:42] years that was 66 foot wide road and
[2:30:45] then when Ivory came in we developed our
[2:30:48] side build This is a 66 foot road. Then
[2:30:53] Ivory shrunk it down to 15 foot so they
[2:30:56] could build a little closer. We run a
[2:30:59] lot of trucks through there every day.
[2:31:01] Probably 10 or 15 trucks because they
[2:31:04] come straight down Anderson Lane. They
[2:31:06] come around, go through our shipping
[2:31:07] yard. It is a lot tighter than it would
[2:31:11] be if it was 66 feet wide, but the
[2:31:13] trucks are still going through there and
[2:31:16] but there's not much traffic now.
[2:31:20] because
[2:31:21] >> the residential are cut off.
[2:31:23] >> The residential people don't
[2:31:25] >> have an access point.
[2:31:26] >> They have no access. So, it's really
[2:31:28] just our trucks going through. But, I
[2:31:31] mean, it it will get busier when it's a
[2:31:33] through street. It'll definitely get
[2:31:35] busier.
[2:31:36] >> And there's I think what Mr. Taylor
[2:31:39] saying is what they did there. They
[2:31:42] planned it for the 50 foot profile road,
[2:31:46] but they added it's 10 or 15 feet on
[2:31:49] their side, which allows for more
[2:31:52] parking and think that's probably what
[2:31:55] needs to be done as a minimum. So really
[2:31:57] what happened
[2:32:07] » I would like to One more if I could.
[2:32:10] This is an important decision because
[2:32:11] there aren't many 27 acre left. This is
[2:32:15] not a an easy or decision. We all have
[2:32:20] to put a lot of time and effort into.
[2:32:25] >> Yes. And it is you can't really get
[2:32:27] access from the west because you have
[2:32:29] I-15.
[2:32:31] Um the north access is is a little bit
[2:32:36] limited.
[2:32:38] um as well like you're saying. Um
[2:32:42] anyway, council, any other questions?
[2:32:52] Both sides have presented their points
[2:32:53] of view very very well.
[2:33:05] Have we exhausted every possibility of
[2:33:08] making it work for all three? Is there
[2:33:11] something we're missing that hasn't been
[2:33:14] reviewed or proposed or thought about?
[2:33:18] Good question.
[2:33:21] >> I can tell you I have done my level
[2:33:23] best. I've met with the parties. I've
[2:33:25] met with
[2:33:26] Adam. I met with Noah.
[2:33:30] Travis Travis
[2:33:32] >> Trent
[2:33:35] >> Michael number I've I've done everything
[2:33:37] to exhaust every opportunity to present
[2:33:41] something that has worked for everybody
[2:33:43] and unfortunately we are where we are.
[2:33:57] Could
[2:34:05] you please show us again? Um, Mr. Snow,
[2:34:10] I see two parcels there. Are do
[2:34:13] [clears throat] you own one or both?
[2:34:15] There below the green line
[2:34:17] >> in that down in that corner. I own one
[2:34:20] and the group home owns the other.
[2:34:22] >> Okay, that's the group home there.
[2:34:24] >> Yeah,
[2:34:26] >> the group home. There's a boy group home
[2:34:28] there.
[2:34:29] >> So the green dash line goes between it
[2:34:33] splits my parson there and it splits up.
[2:34:37] >> Is there any conceivable idea that there
[2:34:40] could be eliminate this and then
[2:34:44] have this and then go across there.
[2:34:48] That was what I brought up in the last
[2:34:51] meeting is saying then it lines up but
[2:34:55] >> then we don't bict Pacific Bridge.
[2:34:59] Don't bisect your piece here. You still
[2:35:02] have full circular access
[2:35:06] here.
[2:35:07] >> I think I don't really want to make the
[2:35:10] decision on what's affecting Clark's
[2:35:13] property because he's the one that needs
[2:35:15] to develop it. That's where
[2:35:17] >> is that something that is untenable to
[2:35:19] you?
[2:35:20] >> It is. We don't we don't know what we're
[2:35:21] going to put there and it may be a large
[2:35:23] distribution center which would prevent
[2:35:25] the development. We've explored that
[2:35:28] option is to answer your question and I
[2:35:31] might note that uh I mean we could
[2:35:34] really drill down on this but Mr. Snow's
[2:35:38] building was was approved and the
[2:35:40] development agreement approved on the
[2:35:43] condition that road's going through and
[2:35:45] I think if I this to even a elementary
[2:35:48] sixth grader said where should this road
[2:35:50] go? It should go north and south. And
[2:35:53] we're not here jumping up and down
[2:35:54] saying don't do that. But we're saying
[2:35:56] don't please don't landlock us. Leave
[2:36:01] what we've relied on for decades and go
[2:36:04] ahead and accommodate Mark at this
[2:36:05] point.
[2:36:09] » All right. So you would like to keep
[2:36:11] options open for what you don't know yet
[2:36:14] is coming. Um and I think our attorney
[2:36:18] clearly explained
[2:36:20] um for the road to go in there has to be
[2:36:23] you know agreement on on cooperation.
[2:36:25] Right now no road is happening at this
[2:36:29] point in time. Um
[2:36:34] >> no council any other
[2:36:42] it's been discussed just a little bit
[2:36:44] that culde-sac
[2:36:46] and the 650 ft and the idea that it
[2:36:50] could be reviewed and possibly go
[2:36:52] longer. Uh you brought up the points of
[2:36:56] fire and those types of things. Uh is
[2:37:00] that even feasible for reasonably
[2:37:03] feasible?
[2:37:05] >> Yeah.
[2:37:06] >> Is it as simple as a legislative
[2:37:07] decision or how many departments get
[2:37:10] involved with?
[2:37:10] >> One of the things I've talked with Mr.
[2:37:12] Florence is to review that ordinance
[2:37:15] right now in the city because we have
[2:37:17] we've run across you know situations
[2:37:20] with that in the past as you may recall
[2:37:22] Van and just to maybe explore
[2:37:26] you know what do other cities do in that
[2:37:28] regard and and what are different
[2:37:30] situations we've come across with it.
[2:37:33] Yeah, I mean we we would review it with
[2:37:35] in conjunction with our engineering and
[2:37:37] fire departments because you're dealing
[2:37:39] with water and sewer lines as well and
[2:37:42] pressure and we already have issues with
[2:37:45] deadend culde-sacs and pressure and
[2:37:47] stagnant water and things and so we'd
[2:37:49] work with so be planning engineering and
[2:37:52] fire would all need to evaluate those
[2:37:54] and and it's it is all over the board.
[2:37:56] Cities have some have 650, some have
[2:37:59] a,000 ft. It it it changes per city as
[2:38:02] well. So
[2:38:25] Yes,
[2:38:26] >> Mr. Taylor. I really don't understand
[2:38:29] why what difference it makes to you if
[2:38:30] that east west road is on the the north
[2:38:33] side of your property, the very north
[2:38:34] side or the very south side. What
[2:38:37] difference does it make?
[2:38:41] » You've got to go in. one or the other.
[2:38:44] You've got same if that road cut across
[2:38:47] east to west a lot further south than
[2:38:49] what we're showing. In other words,
[2:38:51] further south than than our property, my
[2:38:54] property. Um uh what's what difference
[2:38:58] does that make?
[2:39:00] >> It limits our development of the
[2:39:01] property.
[2:39:02] >> Why?
[2:39:03] >> You're talking about the east west road.
[2:39:06] >> Yeah. Just move on.
[2:39:07] >> If you drop that road south, then we
[2:39:09] can't put a large distribution center in
[2:39:11] there. I think he's experiencing the
[2:39:13] same problem you have of getting
[2:39:15] biseected that as was brought up by some
[2:39:18] of the other parties. It's not
[2:39:19] preferable to be by
[2:39:21] >> Well, I'm not see I'm not saying because
[2:39:22] we we get into the ponds there, don't
[2:39:24] we?
[2:39:26] the the Utah state owned property
[2:39:32] » close the two detention bas
[2:39:44] » yeah I was I was saying to move that
[2:39:46] further south and so clerk what you're
[2:39:48] saying is you can't you can't move it
[2:39:51] south far enough right
[2:39:54] >> we can't we can't limit the devel
[2:39:56] velment of our property which we've
[2:39:58] again it's been through multiple master
[2:40:01] plans for decades where it is and we
[2:40:03] think it should stay where it is as
[2:40:05] we've relied on it. We might have made
[2:40:08] different decisions along the way if if
[2:40:10] you know the plans were going to be
[2:40:12] changed. Well, I I I don't know how big
[2:40:14] a piece is my AR my my that I own north
[2:40:18] and south of that green line uh as it
[2:40:21] adjoins to uh 1200 west.
[2:40:25] But
[2:40:27] I certainly can't use those as heavy
[2:40:29] industrial. They're they're just not big
[2:40:31] enough. That that presents the same
[2:40:33] problem with me. I can't take my uh my
[2:40:37] uh storage area to the west uh at all.
[2:40:42] But If you come full circle, we're we're
[2:40:44] really not here because of that road.
[2:40:47] We're here because of a dispute with the
[2:40:50] city and Mr. Martin.
[2:40:52] That's why we're here. We wouldn't be
[2:40:54] here discussing that road, nor the north
[2:40:56] south segment at all. It's this the city
[2:41:00] and Lyndon have a problem with respect
[2:41:01] to an encroachment that was allowed. And
[2:41:05] so the idea to do all of this didn't
[2:41:08] come from some grandios planning. It
[2:41:11] came from Mr. Cowi in trying to resolve
[2:41:13] litigation. That's not why we do master
[2:41:16] planning
[2:41:18] and that's been through. We've had the
[2:41:19] same plan for decades. We don't solve it
[2:41:22] based on a litigation.
[2:41:24] >> And and and like we mentioned earlier,
[2:41:27] nothing is set in stone, immovable,
[2:41:29] inflexible. If there are reasonable
[2:41:33] uh adjustments to be made, that's why
[2:41:35] we're here to consider them. and and we
[2:41:37] want to hear each of the parties and and
[2:41:41] sometimes, you know, it's it's complex
[2:41:44] like you say and so
[2:41:46] council this is uh
[2:41:50] an action item for you.
[2:41:57] what are your thoughts on this here?
[2:42:00] We've been deliberating on it for some
[2:42:01] time and I think we've heard all the
[2:42:04] parties
[2:42:06] different interests and concerns.
[2:42:10] >> Uh this is an unfair question because
[2:42:12] when I got moved into our mo our current
[2:42:15] house, I didn't look at any master plans
[2:42:17] or roads or anything. I had no clue. So
[2:42:19] maybe it sounds like you all have been
[2:42:22] considering this for a long time. And so
[2:42:25] Mr. Snow, Mr. Olsen, have your
[2:42:28] organizations
[2:42:30] If we were to rewind the clock and there
[2:42:33] wasn't a discussion about removing it,
[2:42:36] what was your plan
[2:42:38] with the way things are now? I mean,
[2:42:41] there's some safety issues you've
[2:42:42] brought up. So, I mean, I guess nothing
[2:42:45] would trigger these roads, so maybe you
[2:42:47] didn't have to think very much about
[2:42:49] what would what you would do with
[2:42:51] divided land and small, but did you look
[2:42:54] at all what you might do? um or is this
[2:42:59] you know it's peace of mind to have a
[2:43:02] dotted line off a map you know
[2:43:05] >> so definitely peace of mind but when we
[2:43:08] did put those two buildings in across
[2:43:12] the road there was a lot of discussion
[2:43:14] at that time about developing 1400
[2:43:18] and not worrying so much about this road
[2:43:21] because 1400 was supposed to be the main
[2:43:24] artery supposed to
[2:43:26] sack at one corner straight out. So, you
[2:43:30] know, we weren't really 100% concerned
[2:43:34] that that road was ever going to go
[2:43:36] through. So, that was our hope was
[2:43:39] always, you know, in our mind on paper
[2:43:43] this was the master plan, but also 1400
[2:43:47] went straight through
[2:43:51] and there's some issues down the
[2:43:55] power.
[2:44:05] I think one of the holes right in the
[2:44:07] middle.
[2:44:08] >> Where's the utility?
[2:44:11] >> Okay.
[2:44:13] [laughter]
[2:44:14] >> The further you get away, the harder it
[2:44:16] is.
[2:44:16] >> I know. Yes, it's true. It's true.
[2:44:19] >> So,
[2:44:20] that's that's our, you know, my input on
[2:44:24] that.
[2:44:31] All right, councel.
[2:44:34] >> I don't want to cut anyone off. I'm
[2:44:36] prepared to make a motion.
[2:44:39] [clears throat]
[2:44:40] I move to approve ordinance
[2:44:43] and and help me if I'm saying this wrong
[2:44:44] or if I'm missing something, please. I
[2:44:46] move to approve ordinance 2026-1-
[2:44:52] with the amendment that 1200 West be
[2:44:54] removed up to 200 north.
[2:44:59] » Is that this?
[2:45:03] » It matches. Yep. Kind of
[2:45:06] >> Yes, it does match that. And it also
[2:45:08] matches one that Mike showed earlier.
[2:45:12] Although Mike's was a little short and
[2:45:13] I'm saying go ahead and remove it all
[2:45:16] the way up to 200 north.
[2:45:21] » So matches that one.
[2:45:22] >> So that extra
[2:45:23] >> 200 north.
[2:45:24] >> Yes.
[2:45:29] » All right. We have a motion.
[2:45:30] >> I second.
[2:45:31] >> We have a motion by council member
[2:45:33] Jacobs, seconded by council member
[2:45:35] Stewart. Any further discussion on the
[2:45:37] motion?
[2:45:39] >> All right.
[2:45:40] >> So with what you proposed
[2:45:45] there. Um
[2:45:49] I'm just
[2:45:50] >> I still leave it open for a culde-sac.
[2:45:52] That could still happen if everybody got
[2:45:53] together and said, "Let's make this." We
[2:45:56] have that option there.
[2:45:57] >> All the other options are there. We're
[2:45:58] not planning. I shouldn't say.
[2:46:01] >> No one's proposing to put a road in
[2:46:02] today.
[2:46:03] >> That's a decision down the road. This is
[2:46:05] just saying remove that 1,200
[2:46:09] west section up to where 200 north goes.
[2:46:13] Everybody conduct business as they have
[2:46:14] in the past.
[2:46:19] » Okay.
[2:46:20] Any further discussion on the
[2:46:22] motion? Understood what the motion
[2:46:24] entails. All right. I'll call the vote.
[2:46:27] All in favor?
[2:46:29] >> I.
[2:46:30] >> Any opposed?
[2:46:31] >> Name.
[2:46:32] >> Okay. That's three eyes. One may the
[2:46:36] motion carries.
[2:46:45] » Thank you all for coming here and being
[2:46:46] here tonight.
[2:46:54] All right. Item number nine has been um
[2:46:57] they've moved to a future date. So we
[2:47:01] will move on to item number 10 which is
[2:47:03] the recess to the Lynen City
[2:47:04] Redevelopment Agency.
[2:47:08] So we just
[2:47:09] >> recess the Lynen City Council meeting
[2:47:11] and convene as the Lynen City RDA.
[2:47:14] >> Second.
[2:47:15] >> Okay.
[2:47:15] >> So moved by Councilman Stewart, seconded
[2:47:17] by Councilman Broadick. All in favor?
[2:47:19] >> I.
[2:47:20] >> All right. We are now in the uh RDA
[2:47:24] uh here um on May 4th, 2026. And we'll
[2:47:28] have a roll call. I'll start here on my
[2:47:30] right.
[2:47:31] >> Steve Stewart I
[2:47:32] >> J I
[2:47:34] >> Lunberg I
[2:47:35] >> Cole Hulie I
[2:47:37] >> Lincoln Jacobs I
[2:47:38] >> Van Brick I.
[2:47:40] >> All right, there are some approval of
[2:47:41] minutes from the March 16th RDA meeting
[2:47:47] and adoption.
[2:47:51] » I'll make a motion that we approve the
[2:47:53] March 16th uh 2026 RDA minutes. Second
[2:47:58] >> motion by council member Hoy, seconded
[2:47:59] by council member Stewart. All in favor
[2:48:02] of passing the approval of the minutes.
[2:48:04] >> I
[2:48:06] >> Okay, that is unanimous. Thank you. All
[2:48:08] right, we'll go on to item number three.
[2:48:10] This is a public hearing budget
[2:48:11] amendment. So, we need to open a public
[2:48:13] hearing.
[2:48:14] >> I make a motion to open a public
[2:48:15] hearing.
[2:48:17] >> Second.
[2:48:17] >> Okay. So, moved by Councilman Broadick,
[2:48:19] seconded by Council Member Point. All in
[2:48:21] favor?
[2:48:22] >> I.
[2:48:23] >> All right.
[2:48:26] Chase, you you rock that look.
[2:48:31] » Chase Adams are the hair. The hair makes
[2:48:34] the [laughter]
[2:48:36] >> Yeah. Sorry. Um
[2:48:37] >> I I had the AI ask him to make you have
[2:48:39] long hair. So that's from like the the
[2:48:42] uh directory photos.
[2:48:44] >> Yes.
[2:48:45] >> So
[2:48:46] >> it's not quite long enough though.
[2:48:48] >> It's got some more curl through it
[2:48:50] though.
[2:48:51] >> I think I'm getting close to uh to
[2:48:53] chopping it. So [laughter]
[2:48:54] Um,
[2:48:56] okay. Um,
[2:48:58] we're
[2:49:00] u mostly here to just kind of close
[2:49:02] three of our um RDAs. Um, the State
[2:49:07] Street District, the Westside District,
[2:49:08] and the district number three. Um,
[2:49:12] that's kind of largely what the the
[2:49:14] amendment does. Um, so essentially we're
[2:49:17] going to get rid of not get rid of uh
[2:49:19] close out, I should say. Sorry. um those
[2:49:22] three
[2:49:24] um and uh largely by transferring uh the
[2:49:30] remaining funds to the affordable
[2:49:32] housing fund um which is I don't
[2:49:36] uh which is kind of just a a fund that
[2:49:39] um we're using for like kind of
[2:49:41] accounting transfers in and out and like
[2:49:44] interest and stuff. So for um the
[2:49:46] affordable housing funds um
[2:49:50] uh other than that there's uh a couple of uh I I don't know tons not tons of
[2:50:00] changes to the 700 North CDA and the uh
[2:50:04] and sorry I call them RDA RDA not CDA
[2:50:07] >> over the uh over the years I guess the
[2:50:09] acronym has changed for uh redevelopment
[2:50:12] area. So, uh, but also the Lynen Park
[2:50:16] CRA,
[2:50:17] >> right?
[2:50:18] >> Um,
[2:50:19] >> and, um, there's, uh,
[2:50:23] let me, let me just check my notes, make
[2:50:25] sure I'm not leading anyone astray here.
[2:50:27] I think um my the big thing I was supposed to
[2:50:35] note was that uh we're um allocating 5%
[2:50:40] uh of the tax increment towards um
[2:50:45] affordable housing for the 700 North RDA
[2:50:48] and for the Lynen Park RDA or rather
[2:50:52] CRA, sorry, whatever it's called. Um is
[2:50:56] uh We're allocating 10% of the tax
[2:50:58] increment towards affordable housing
[2:51:00] from from that uh that district. Um
[2:51:06] and I
[2:51:08] Kristen told me to note that um
[2:51:10] currently in the affordable housing uh
[2:51:12] we have 50,000 $57,581
[2:51:18] and we'll be moving uh by the end of the
[2:51:20] year. We anticipate having a by the end
[2:51:22] of the fiscal year um we anticipate
[2:51:26] having uh 189,693
[2:51:31] u in that account.
[2:51:34] Um and that was essentially the notes
[2:51:38] that I uh that I have. If there's uh
[2:51:40] specific questions I'll probably have to
[2:51:43] get back to you on, but [laughter] I'm
[2:51:44] happy to happy to field what I can.
[2:51:47] >> I I can add a few items to that. Um, so
[2:51:51] like we have two RDA areas, the 700
[2:51:54] North RDA and the Lynen Park CRA. We
[2:51:57] we've got a withhold uh 10% and 5% of
[2:52:01] the property tax increment for housing.
[2:52:04] So that that that that's has to be
[2:52:07] ongoing. The current state law says that
[2:52:11] after uh RDA expires, you've you've got
[2:52:15] to move that housing into or you've got
[2:52:18] to move those any remaining funds into
[2:52:20] housing. Now, that changes on Wednesday
[2:52:24] and it says on Wednesday, it says you've
[2:52:27] got to go back and find out who all the
[2:52:29] texting entities are and if there's any
[2:52:32] additional funds, you have to reimburse
[2:52:34] all those taxing entities with that
[2:52:36] remaining budget. And so, that kind of
[2:52:39] partic uh kind of helped move this
[2:52:42] forward that [laughter]
[2:52:44] um as we're reading the new state code
[2:52:45] last week, uh we said, "Well, let's not
[2:52:49] give all this money back. Let's move it
[2:52:51] under the current law to affordable
[2:52:54] housing and then we'll figure out how to
[2:52:57] apply that in the future.
[2:53:01] » Good to know.
[2:53:04] >> And then the three districts that are no
[2:53:06] longer collecting tax increment and have
[2:53:08] this leftover fund balance. Um just for
[2:53:11] the record, for those that are
[2:53:12] listening, could we let's state what
[2:53:14] those are?
[2:53:15] >> Uh yes, sure. Um the
[2:53:19] uh the State Street District. Um
[2:53:22] [clears throat] we have we've used like
[2:53:25] 325,000
[2:53:27] uh for
[2:53:29] um to help pay for uh
[2:53:36] >> purchase.
[2:53:37] >> Yes, a property purchase. Sorry. Thank
[2:53:38] you. Um Mr. Florence.
[2:53:41] And um
[2:53:44] uh so the remaining balance there would
[2:53:47] be 21,936
[2:53:50] uh that we would be transferring to
[2:53:54] uh in that case the uh the recreation
[2:53:56] front fund. Um
[2:53:59] >> and that's an eligible RDA. So that one,
[2:54:02] you know, doesn't necessarily need to go
[2:54:03] to housing. That that's an eligible
[2:54:05] fund,
[2:54:07] >> right?
[2:54:09] Thank you.
[2:54:10] And um in the west side uh district
[2:54:15] there's uh 21,744.
[2:54:18] Um all of that would be going to the um
[2:54:20] the housing affordable housing fund. Um
[2:54:23] in district 3 there's uh
[2:54:30] 7,477
[2:54:33] uh in total revenues. Um, of that, uh,
[2:54:36] 97,200 would be going to the housing
[2:54:38] fund. Uh, we're taking, uh, like a hair
[2:54:43] under 6,5,995,
[2:54:45] uh, to pay for, uh, landscaping services
[2:54:48] uh, for the remainder of the year and,
[2:54:51] um,
[2:54:53] that were trans rather transferring,
[2:54:54] sorry, to the general fund because it
[2:54:56] was uh, kind of prepaid out of that
[2:54:57] fund. Um
[2:55:00] and
[2:55:04] those are the three.
[2:55:09] All right, council. Any questions?
[2:55:14] Okay, this is a public hearing, so I'd
[2:55:16] like to open it for any public comment.
[2:55:22] » All right, seeing none, I'd
[2:55:24] >> like a motion to close the public
[2:55:25] hearing.
[2:55:26] >> Second.
[2:55:26] >> Okay. A motion by council member
[2:55:27] Broadick, seconded by council member Hoy
[2:55:29] to close a public hearing. All in favor?
[2:55:31] >> I.
[2:55:32] >> Okay.
[2:55:33] >> Be interesting to see with our new
[2:55:35] school district
[2:55:37] if there's opportunities with them down
[2:55:39] the road. Um they seem so much more
[2:55:43] friendly and amanable now. Um
[2:55:46] [clears throat] but I almost see them
[2:55:47] going away from participating. I I I
[2:55:50] don't I I guess I'm not close enough to
[2:55:51] it. Have we seen since Oram's University
[2:55:55] Place any participation from a school
[2:55:57] district?
[2:56:03] » Yeah. Okay.
[2:56:06] Just a thought. I I I mean I thought the
[2:56:08] meeting went really well today. I think
[2:56:10] there's just a lot of synergy there, a
[2:56:12] lot of friendship between the groups.
[2:56:17] maybe down the road
[2:56:23] This is the budget item.
[2:56:25] >> Okay.
[2:56:27] With the public hearing closed, is
[2:56:30] there any other comments? Any other
[2:56:31] concerns?
[2:56:33] I'd be glad to make a motion.
[2:56:36] >> Uh, I move to approve resolution
[2:56:38] 2026-2-RDA.
[2:56:41] » Second.
[2:56:42] >> Oops. Second
[2:56:43] >> as presented. Yes.
[2:56:44] >> Sorry. Who? We have Councilman Hoy.
[2:56:47] Motion. Who is the second? Roderick. All
[2:56:50] right. Thank you. All in favor?
[2:56:52] >> I
[2:56:54] >> All right. So, that's a budget
[2:56:56] amendment. So, now we'll move on to item
[2:56:58] number four of the RDA agenda and that
[2:57:02] is to now have a review and action to
[2:57:04] dissolve these expired RDAs that were
[2:57:07] presented.
[2:57:08] >> Yeah. And so these RDAs, they were
[2:57:10] created in the 80s um between 82 and 89.
[2:57:14] Um we haven't collected any uh you know
[2:57:18] increment taxes off those since you know
[2:57:21] between tw 2009 and 2019. Um they've all
[2:57:25] been successful. They've they've met
[2:57:26] their purpose especially where Home
[2:57:28] Depot and Murdoch Hyundai I mean that has created some of our top sales
[2:57:33] tax producers. So those are great to set up. Uh the west side was set up to
[2:57:39] basically help where Schaefer Industries
[2:57:41] is and and those industrial properties
[2:57:44] to help improve our industrial sector
[2:57:47] and um the State Street sounded like
[2:57:50] there was some issues of blight they
[2:57:52] were dealing with in the 80s and I think
[2:57:54] State Street looks a lot better in those
[2:57:56] areas that were redeveloped. So, but
[2:57:58] they've outlived their their time and um
[2:58:01] it's now we're bringing forward a
[2:58:03] process to dissolve those three areas.
[2:58:05] We've created the processes. We have to
[2:58:08] um approve those by the dissolution by
[2:58:11] resolution and then the city council has
[2:58:14] to approve it by an ordinance.
[2:58:19] » When you say they're expired, what does
[2:58:21] that mean? When they're first created,
[2:58:23] they were created for certain period of
[2:58:24] time
[2:58:25] >> typically. Yeah. like this 700 North
[2:58:27] RDA. It it it was only created to last
[2:58:30] till 20 or 2037 and then during COVID
[2:58:34] state law allowed us to expand it give
[2:58:36] an additional two years. So it'll expire
[2:58:39] in 2039. So yeah, they all have a
[2:58:41] project area plan and budget that
[2:58:43] expires you typically 20 to 25 years.
[2:58:47] >> Those time limits were imposed by the
[2:58:49] state.
[2:58:49] >> Yep.
[2:58:50] >> Yeah.
[2:58:51] >> And in order to I mean they expire when
[2:58:53] they expired by date.
[2:58:55] >> [clears throat]
[2:58:55] >> But in order to close them, all the
[2:58:57] debts and everything has to be paid off.
[2:59:00] >> And then once that's done,
[2:59:03] >> you close them.
[2:59:03] >> Just approved was cashing it all out.
[2:59:06] And so we had even though the time had
[2:59:08] expired on these three RDAs, we still
[2:59:10] had some remaining money in there that
[2:59:12] we were using for some things. And so
[2:59:14] you've just approved. They're all now a
[2:59:16] zero balance. Am I remembering correctly
[2:59:20] that we used some funds
[2:59:22] with the Kia um dealership?
[2:59:25] >> Did we do it with Hyundai as well or was
[2:59:27] it just Kia?
[2:59:28] >> I think we did.
[2:59:29] >> Hyundai um
[2:59:32] >> could have used RDA funds, but we did
[2:59:34] have an incentive package with Hyundai
[2:59:36] and we exchanged some property. we used
[2:59:38] to have where part of their parking lot
[2:59:41] uh is currently it used to be just an
[2:59:43] open detention basin and so we
[2:59:45] transferred that property to them and
[2:59:47] allowed them to bury that detention
[2:59:49] system and so they have a subsurface
[2:59:52] detention basin under their parking lot
[2:59:54] so we we traded some land as part of the
[2:59:57] incentive to get them here
[2:59:59] >> and that was I don't know I don't
[3:00:02] believe there was any direct RDA
[3:00:04] reimbursement but they did have a sales
[3:00:06] tax performanc
[3:00:08] plan [clears throat] similar to what KIA
[3:00:09] is doing. So if they hit certain
[3:00:11] benchmarks, we would pay them back a
[3:00:13] certain amount.
[3:00:15] >> And KIA is knocking it out of the park.
[3:00:16] They that was set up as a five-year RDA
[3:00:20] and they're going to we're going to be
[3:00:22] closing that out in three and a half or
[3:00:24] within
[3:00:27] ahead of schedule.
[3:00:28] >> Yes. Three and a half years instead of
[3:00:30] five.
[3:00:30] >> And the KIA plan is is that owned
[3:00:34] property. That is the only property. So
[3:00:36] it's just their land and that was the CR
[3:00:41] >> under the umbrella of the RDA. Okay. So
[3:00:46] >> which has nothing to do with the PTA
[3:00:48] does not. [laughter] But you have some
[3:00:50] PTA stuff in front of you here tonight.
[3:00:52] >> Yeah. About about 10 years ago they came
[3:00:54] out every few years like last this last
[3:00:57] legislative session they changed it
[3:00:58] again you know and 10 years ago they
[3:01:01] created EDAs, CDAs and CRAAS and you
[3:01:04] know it was
[3:01:05] >> crazy. Yeah.
[3:01:07] >> Well, needless to say, great decision-
[3:01:09] making by our forefathers
[3:01:11] here in the city. It's been great. You
[3:01:14] know what I mean? They served their
[3:01:15] purpose and and here we are. And, you
[3:01:18] know, would be remiss not to recognize
[3:01:21] those who put them into place back in
[3:01:22] the 80s or so. I'm I'm ready to make a
[3:01:25] motion. Um, I move to approve resolution
[3:01:28] 2026-3-
[3:01:30] RDA. Um, also 2026-4- RDA and 2026-5-
[3:01:36] RDA as presented.
[3:01:38] >> Second.
[3:01:39] >> You have a motion by Councilman Hoy,
[3:01:40] second by Councilman Jacobs. All in
[3:01:44] favor?
[3:01:45] >> I.
[3:01:47] >> Any opposed? All right, that is
[3:01:48] unanimous.
[3:01:50] >> Easier to approve this when you look at
[3:01:52] the figures of Mike and Brian there.
[3:01:54] [laughter]
[3:01:54] It just gives you confidence.
[3:01:57] All right, I take a motion to adjurnn
[3:01:59] and reconvene. [laughter]
[3:02:02] >> like that we blew up the RDAs in the
[3:02:04] that picture there.
[3:02:06] >> I think
[3:02:08] move to adjourn the RDA meeting and
[3:02:10] reconvene the city council meeting.
[3:02:13] >> Second.
[3:02:14] >> Okay. Motion by Councilman Broadick,
[3:02:15] second by Cal Councilman Jacobs. All in
[3:02:18] favor? I
[3:02:20] >> I'd like to take just a five minute
[3:02:22] break here so we can all stand up for a
[3:02:25] minute. It's been
[3:02:27] three hours.
[3:02:29] >> Okay.
[3:02:31] [clears throat]
[3:02:32] >> And those pictures just made all of us
[3:02:35] smile. You guys all have a good sense of
[3:02:37] humor. So
[3:02:47] » I think the key word
[3:02:55] » lawyer
[3:03:07] Sorry to abandon it.
[3:03:18] » Mountain.
[3:03:19] >> Did you see theirs?
[3:03:20] >> Yeah, I did. They got it on their face.
[3:03:22] >> It's like a cartoon. So,
[3:03:24] >> yeah. Totally made you look like a city
[3:03:26] planner, man. Check that out.
[3:03:36] » Ashley, sorry you got to be here so
[3:03:38] late.
[3:03:38] >> I you know, it was fun listening to it.
[3:03:44] » We got a couple more things to do here
[3:03:46] before we get to you. So,
[3:03:48] >> I will silently work.
[3:03:49] >> All right.
[3:04:00] » [laughter]
[3:04:04] » Either way,
[3:04:07] » I think I think
[3:04:18] Mr.
[3:04:34] We never we were like not on the
[3:04:37] doorstep.
[3:04:39] >> That is a very common thing because you
[3:04:41] get tax break if you if your property is sold or donated under threat of
[3:04:47] domain. You get the a huge tax break.
[3:04:50] And so we do that all the time. When we
[3:04:52] purchase property, we send out a letter
[3:04:54] that says, "Hey, this is taken under the
[3:04:56] threat of imminent domain to help those
[3:04:58] property owners."
[3:04:59] >> That wasn't sales tax.
[3:05:02] And a lot of those we haven't
[3:05:08] So, it's something we could just
[3:05:30] Sorry.
[3:05:44] » Is YouTube still running? I haven't
[3:05:49] >> says it is. Am
[3:05:52] I in the Am I in the Empire or am I
[3:05:56] good?
[3:05:56] >> No, you're a good guy. That's a That's
[3:05:58] the
[3:05:59] >> This is the rebels. The rebels need
[3:06:02] >> Yeah.
[3:06:05] » I thought I died.
[3:06:09] [laughter]
[3:06:22] going down into
[3:06:31] Almost there. Almost there.
[3:06:39] [snorts]
[3:06:47] » Maybe that.
[3:06:49] >> Is that something you think I ought to
[3:06:51] see?
[3:06:53] >> That was nice.
[3:06:55] >> Able to grab some dinner and still
[3:06:57] listen.
[3:07:21] star.
[3:07:22] >> Now we have to pass this ordinance.
[3:07:23] >> We are the death star.
[3:07:24] >> So violent because this was not
[3:07:26] >> violent.
[3:07:34] That makes us Darth Vader and all that.
[3:07:36] >> Yeah, we're
[3:07:40] » a large in stature guy that looks
[3:07:46] » Let's get back
[3:07:48] >> reconvene our meeting here. So we are
[3:07:52] >> back to
[3:07:57] » item 12.
[3:07:57] >> Item number 11.
[3:07:59] >> I do think we need to do 11 still.
[3:08:01] >> Oh yeah, that's right.
[3:08:02] >> Okay.
[3:08:02] >> Which is just the final
[3:08:03] >> the ordinance part. Yeah.
[3:08:05] >> Okay. So this is just a followup to what
[3:08:08] we were discussing in the RDA.
[3:08:10] >> The RDA within the CDA within the PTSA.
[3:08:14] [laughter]
[3:08:16] >> Go. Mayor go.
[3:08:17] >> All right. Whatever order that is. All
[3:08:18] right. Thank you. We'll let Mr. Cowey
[3:08:22] on this.
[3:08:23] >> Mike mentioned earlier, so as part of
[3:08:26] dissolving the RDA, those three that
[3:08:28] have expired, um those areas, uh you've
[3:08:32] adopted as the RDA the resolutions to
[3:08:35] dissolve those. And now, as part of the
[3:08:37] statute, it requires that the city has
[3:08:39] to then also pass an ordinance that
[3:08:42] dissolves the expired RDAs. So, this
[3:08:44] officially uh ends all of our contracts
[3:08:47] between the city and the RDA for
[3:08:49] services uh that it they were those
[3:08:52] entities were using um on their behalf.
[3:08:56] So,
[3:08:59] any questions on that?
[3:09:01] >> The next page is the ordinance.
[3:09:03] >> I'm going to push the death star button.
[3:09:06] [laughter]
[3:09:08] » So, I move to approve ordinance 2026-6-
[3:09:12] presented. I second.
[3:09:15] >> All right. Motion by Councilman Stewart,
[3:09:17] second by Councilman Jacobs. All in
[3:09:20] favor?
[3:09:21] >> I.
[3:09:22] >> Okay. Eyes have it. That is passed. Item
[3:09:26] number 12. This is a review and action.
[3:09:28] I like to invite our parks and
[3:09:31] recreation director,
[3:09:34] Mr. Heath Baitman.
[3:09:36] He's going to present to us all of our
[3:09:39] mini grant
[3:09:41] applications. and we will decide the
[3:09:43] awards.
[3:09:44] >> Yeah. What a great year. We had a lot of
[3:09:46] people apply. I think except for the
[3:09:49] last year, maybe have we done it for
[3:09:52] two, you allowed more than the $15,000
[3:09:55] in award because we had people, but at
[3:09:57] that time we were able to award
[3:09:59] everybody everything at the 17 or
[3:10:02] $18,000 where we were, but we had some new groups come out of the
[3:10:06] woodwork. Uh remember I I included this
[3:10:10] in that box in your in your report. The
[3:10:12] qualifying organizations requesting
[3:10:13] funds must be a nonprofit with their
[3:10:16] 5013C status. They must uh have or
[3:10:20] commit to have a significant presence in
[3:10:22] Lynden and they must have performances,
[3:10:24] events, and activities inside of Lynen
[3:10:26] City for the benefit of Lind City
[3:10:27] residents. So what I did, just so you
[3:10:31] know, I took these
[3:10:33] applications and I reviewed them. I
[3:10:36] think they all pretty much because of
[3:10:38] their plan of what they'd like to do,
[3:10:39] they fit that category of doing
[3:10:41] something in Lynen for Lynen. Uh some of
[3:10:44] the asks were were quite big. Um and
[3:10:48] then we've got a situation like Lynen
[3:10:51] Elementary who has been awarded year
[3:10:54] after year after year after year. So
[3:10:56] they have their arts program is is
[3:10:58] really amazing. So, um, from those seven
[3:11:01] applications, are there any questions
[3:11:03] about any of them that you might have?
[3:11:07] So, when they request, for example,
[3:11:09] Lyndon requested 8856
[3:11:12] >> and they specified three specific areas.
[3:11:16] Um, if we were to pass it at the
[3:11:18] recommended amount, 5256, are they
[3:11:21] required to put it in those three areas?
[3:11:24] Are they required anywhere specific or
[3:11:26] we're just saying here you go?
[3:11:27] >> No. do what you want.
[3:11:29] >> They will be required to turn in their
[3:11:31] after season summary report on those
[3:11:34] events that you guys decided that y'all
[3:11:37] decided was was where they're they want
[3:11:39] to focus this this donation to. So, and
[3:11:42] I checked with those ones um except for
[3:11:47] the Nashville lady. Uh she didn't call
[3:11:50] me back, but the I checked with the
[3:11:52] others. What do you want most and what
[3:11:54] would fit for you best? Like Lynon
[3:11:55] Elementary is a good example. They would love to have a mic set but would much rather have the scripts.
[3:12:02] So this their ask is for really we
[3:12:04] decided that if I made a recommendation
[3:12:06] it would be for the kiln and for the
[3:12:08] scripts and not the mic set but I put in
[3:12:10] there what they actually did request. So
[3:12:12] you know
[3:12:13] >> one of the things too for council um
[3:12:16] Steve and I have reviewed these over the
[3:12:17] years and in the application it says if
[3:12:20] you are not awarded the full amount can
[3:12:22] you still carry off um what you're
[3:12:25] trying to do? And so some of them say if
[3:12:27] I don't get the full amount, no, I don't
[3:12:30] have additional means or funds to do
[3:12:32] this. So that's something that
[3:12:34] >> and all all those mayors, all all the
[3:12:36] ones that we talked to this time agreed
[3:12:37] that they would make it work with a
[3:12:39] parter portion that we recommended. Six
[3:12:41] and seven were both ones that looked
[3:12:43] that they significantly less than what
[3:12:46] they were requesting
[3:12:47] >> and five five requested 8,000 although
[3:12:51] last year uh it was a little bit less
[3:12:53] than that. But they're going to have to
[3:12:55] come up with money now just for the
[3:12:56] building rental because remember that
[3:12:59] garden pipe band. It really was about
[3:13:02] the $6,000 level [clears throat] that
[3:13:04] paid for all of their reservation fees
[3:13:06] which all they do is I award them the
[3:13:08] check and they pay it back to the city.
[3:13:10] >> Yeah, that's
[3:13:12] >> and it's been nice for them and they
[3:13:13] have been great tenants and have done
[3:13:16] some amazing things. So I I some of the
[3:13:20] smaller grant requests um like the
[3:13:23] United Angels Foundation, they do those
[3:13:25] special needs classes in our building.
[3:13:27] That's another one that building is a a
[3:13:29] great portion of the amount that that
[3:13:31] we're allowing them for the rental. Uh
[3:13:34] the Shantanet Lady Choir really uh would
[3:13:38] really like to use the Vets Hall for
[3:13:40] their opening and closing social, but
[3:13:42] they sing in the spring
[3:13:46] >> gardens And they they they make
[3:13:48] available their free concerts to anybody
[3:13:52] at any time. And they've got a lot of
[3:13:54] Lynden ladies that participate in that
[3:13:55] large group as well. And I think one of
[3:13:58] the things that's important to note is
[3:13:59] um some of these like Heath is
[3:14:01] mentioning, it's not really outofpocket
[3:14:04] cash for the city. Sometimes these turn
[3:14:06] into pretty significant partnerships in
[3:14:09] a way because they're providing
[3:14:12] activities or classes or different
[3:14:15] things for people in the community to
[3:14:17] enjoy. It's almost like an extension of
[3:14:19] our recreation programs. Is that fair to
[3:14:22] say? So I think it fits
[3:14:24] >> the money is kind of a wash because it's
[3:14:26] in kind for use of
[3:14:29] >> and often when the building is empty,
[3:14:31] not necessarily on Thursday nights when
[3:14:33] the garden, but I get requests for
[3:14:35] Thursday nights. Uh and it's they're
[3:14:38] kind of in there, but we're not losing
[3:14:40] any revenue because other times are
[3:14:41] available. If if maybe I could ask maybe
[3:14:44] we could just look at number six,
[3:14:46] Nashville and the Rockies. um they want
[3:14:49] to have a large concert in this area in
[3:14:52] this venue and uh I had a hard time uh
[3:14:57] figuring with the other asks that we
[3:14:59] would pay for travel uh you know and pay
[3:15:02] for uh hotels for Nashville artists when
[3:15:06] there's some pretty good talent around
[3:15:08] here and and I understand that they want
[3:15:09] to make it uh big but that's that's why
[3:15:12] that one was was cut down to just maybe
[3:15:14] a venue rental for them if they wanted
[3:15:17] Yeah.
[3:15:17] >> Is that in Lynen?
[3:15:18] >> They wanted to do it in Lynon.
[3:15:20] >> What venue?
[3:15:22] >> They had didn't specify really.
[3:15:24] >> Is there a way for us to make sure we
[3:15:26] don't give them $2,000 and they go play
[3:15:28] in Oram or
[3:15:30] >> Yeah, that'll be specified that it has
[3:15:32] to be here and then they're not eligible
[3:15:34] again if they don't turn in their
[3:15:35] year-end report.
[3:15:37] >> Okay.
[3:15:37] >> They aren't eligible for the next year.
[3:15:40] >> Sorry. Go ahead.
[3:15:41] >> No.
[3:15:42] >> Are you finished on that?
[3:15:43] >> I was just going to move on to number
[3:15:44] seven.
[3:15:45] >> That was what I wanted to ask. Go ahead.
[3:15:46] Tell us about that.
[3:15:47] >> The Unity Unity Gospel Choir uh
[3:15:50] approached the mayor and I just recently
[3:15:52] and just barely got their application in
[3:15:54] on time because they they'd heard about
[3:15:56] this and I'm not so sure
[3:15:58] >> I can kind of share.
[3:15:59] >> Yeah. Yeah. Go ahead.
[3:16:01] >> Bonner, the the really well-known Bonner
[3:16:04] family. So, Yahoo sang at one of our
[3:16:07] Christmas events a couple years ago. And
[3:16:10] you know, the Bonner family um
[3:16:11] African-American family, super talented
[3:16:14] musically. He and his brother are on
[3:16:16] stage in once on [clears throat] this
[3:16:17] island at the Hail or at the
[3:16:19] >> Yeah.
[3:16:19] >> roof. So they perform professionally.
[3:16:22] They do a lot of videos. They're pretty
[3:16:24] high-profile. But Deborah is the mother
[3:16:26] of the clan and she has an really
[3:16:29] amazing program of gospel choir music.
[3:16:33] It's it's not just religious, but it's
[3:16:35] just all uplifting music. So they've
[3:16:37] been rehearsing in Trordia here in
[3:16:39] London. They've been like a corporate
[3:16:42] sponsor just allowing them to use their
[3:16:44] space and uh they recently had a
[3:16:47] performance. Um it's a free choir for
[3:16:51] people to join and they had a gayla
[3:16:54] fundraiser they invited me to and the
[3:16:57] stories of how they really do transform
[3:17:00] lives. It's it's really quite remarkable
[3:17:03] um people getting involved in this and
[3:17:06] um they said we want to partner with
[3:17:09] Lynen City. are already in Lynden. We
[3:17:11] want to now start a children's
[3:17:14] um choir initiative. This other one has
[3:17:17] been adult. So they would want we want
[3:17:20] they said that we want to be an arm of
[3:17:23] Lynen City Recreation
[3:17:25] um where we provide this children's
[3:17:27] choir. Um and so again I think a lot of
[3:17:31] the funding here is for use of space. So
[3:17:35] they came and met with Heath and I. We
[3:17:38] showed them the vet hall and they have
[3:17:40] big plans like if it could start out
[3:17:42] once a week. Kids could come to the
[3:17:44] choir and then they would have um
[3:17:46] profession they have a professional
[3:17:48] pianist, jazz pianist. He's pretty
[3:17:50] amazing. He lives in Vegas. They fly him
[3:17:53] up or he travels up every Thursday for
[3:17:57] their things they're doing with the
[3:18:00] adult groups. And so they would have him
[3:18:03] also stick around to work with the
[3:18:05] youth. and he can take I mean he's just
[3:18:08] incredible. And then they talked about
[3:18:09] they have other professional people who
[3:18:11] had potentially they could start um
[3:18:14] professional uh acting drama. They had a
[3:18:18] whole bunch of ideas of how it could
[3:18:20] potentially expand. So
[3:18:22] >> this uh mayor, as I recall going over
[3:18:24] their grant, this grant request is not
[3:18:26] for that children's choir. It's for
[3:18:29] their choir. And so because we were so
[3:18:31] jammed with time, they didn't know what
[3:18:34] they should ask for and it wasn't put
[3:18:36] together yet. So that might need to be
[3:18:38] clarified if because they want to start
[3:18:41] the children's choir as a partnership.
[3:18:43] But this request was for their regular
[3:18:45] choir.
[3:18:45] >> Okay.
[3:18:46] >> To fly their their people in and and
[3:18:49] hire their professional.
[3:18:51] >> But I think the goal was that they would
[3:18:54] do the adult and children's in
[3:18:56] conjunction.
[3:18:58] they've pretty much announced
[3:19:00] publicly
[3:19:02] starting the youth
[3:19:05] um version of of what their initiative
[3:19:08] their mission.
[3:19:10] >> Yeah. So, as the grant was written,
[3:19:11] we'll have to split hairs if we want to
[3:19:13] on that because they just wanted it for
[3:19:14] their regular choir, not the children's
[3:19:17] choir. But, and they're pretty specific.
[3:19:19] You can look, you can prove that if you
[3:19:20] want and see what you think.
[3:19:23] Uh so that fits pretty well. So what I
[3:19:27] did at the end, you can see that I took
[3:19:29] that those tables and just kind of
[3:19:31] looked at it a couple of different ways.
[3:19:34] Uh way number one is if we go with at
[3:19:38] all organizers benefit, all
[3:19:39] organizations benefit a little and
[3:19:42] everybody gets a chunk of the pie. uh
[3:19:44] you have the ability of course to to
[3:19:46] decide that those that are for the best
[3:19:51] interests of the Lynon to fund
[3:19:52] completely which would be kind of the
[3:19:54] table number two uh and and that's not
[3:19:57] the order that they were received that
[3:19:59] was the order in which I could foresee
[3:20:02] that being a immediate benefit to the
[3:20:06] schools and to the art programs. This is
[3:20:08] the first time in a long time Rocky
[3:20:09] Mountain El Elementary Elementary has
[3:20:11] applied and they want to do a show and
[3:20:14] they wanted mic packs and a and a script
[3:20:18] set as well. Uh or u you could do it. I
[3:20:22] just I just figured that we could do it
[3:20:26] those couple ways or we can award
[3:20:28] whatever we want. But there was a
[3:20:29] $38,000 $686 ask this year.
[3:20:34] So, whatever you'd like to do there, if
[3:20:36] there's questions,
[3:20:38] >> the total amount available,
[3:20:40] >> it's 15,000 budgeted. So, they're over
[3:20:43] >> So, all of this is over budget. Okay.
[3:20:46] >> But I took that because of the last two
[3:20:48] years in in option number one. I took
[3:20:50] that and got it close to what you've
[3:20:51] approved in the last year or two, which
[3:20:54] is 18. No, that's going to be 19. I
[3:20:57] think it was 18,000 last year that you
[3:21:00] approved and everybody got what they
[3:21:02] wanted,
[3:21:03] >> right? Um,
[3:21:04] >> with the [clears throat]
[3:21:07] band, the pipe band, they've itemized
[3:21:10] the space rental, but with the unity
[3:21:15] gospel choir and the angels, it's just
[3:21:20] in kind.
[3:21:23] » Um, so I I don't know if it makes sense
[3:21:26] to take off the 7,000 ask or if it makes
[3:21:31] sense to add in
[3:21:33] the actual amount they would need to
[3:21:35] rent our facilities. I know it's just
[3:21:37] changing purses,
[3:21:39] >> right?
[3:21:39] >> But that so anyway,
[3:21:43] >> I'm fine with either of those solutions
[3:21:47] because I'm guessing the band the pipe
[3:21:50] band if that if we told them we'll we'll
[3:21:53] just
[3:21:54] >> anyway
[3:21:55] >> make you a partner rather than exchange.
[3:21:57] >> Yeah. Yeah.
[3:21:58] >> Similar to the other
[3:21:59] >> it looks it looks easy. It looks good
[3:22:01] this way on on paper when I have them
[3:22:03] apply cuz then we know exactly.
[3:22:04] >> But is it determined that they are going
[3:22:06] to use our I don't know it's determined
[3:22:08] that they're going to use our space
[3:22:09] though.
[3:22:10] >> The pipe band does.
[3:22:11] >> The pipe band is but the other two
[3:22:13] aren't.
[3:22:14] >> Yeah, when it says in kind
[3:22:17] >> is that is that the the choir
[3:22:18] >> space provided in kind?
[3:22:20] >> This this
[3:22:21] >> Wait, that's a good point. Maybe we're
[3:22:22] not the ones who are the inind.
[3:22:25] >> Yeah, like on seven space provided in
[3:22:27] kind. What what does that mean
[3:22:29] >> for the unity choir? They want to they
[3:22:31] want to use our space. But I I I tell
[3:22:34] you, [clears throat] I don't know. This
[3:22:35] was like within a week before the
[3:22:36] deadline that we made our first contact.
[3:22:38] So, I think they just jammed something
[3:22:40] together to get in the conversation. I
[3:22:42] don't even I'm not even sure they
[3:22:44] realize what it costs to rent a full
[3:22:46] rental. So, that in kind, they just want
[3:22:48] to take the portion that they didn't
[3:22:51] specify and they really didn't do a very
[3:22:54] good job specifying.
[3:22:55] >> Yeah.
[3:22:56] um that they would just make it work at
[3:22:59] their ask. Their biggest desire is to
[3:23:02] bring in this jazz musician and anybody
[3:23:05] else they contract and hire to bring in
[3:23:07] to help this help the choir and the kids
[3:23:10] choir.
[3:23:11] >> The choir would be weekly. This
[3:23:14] Nashville thing is kind of a one-off
[3:23:15] event.
[3:23:16] >> Deborah asked for it. She'd take it
[3:23:19] daily. I mean, she was
[3:23:20] >> Deborah said she would expand daily if
[3:23:22] she could
[3:23:23] >> if she could if she could do it. Um,
[3:23:25] >> that's what I'm just I mean in my mind
[3:23:27] kind of the oneoff event is a less
[3:23:30] impactful I
[3:23:31] >> agree
[3:23:31] >> than a program that is ongoing
[3:23:35] >> and local.
[3:23:38] >> Yeah, the Nashville one didn't really
[3:23:40] speak to me for those reasons.
[3:23:42] >> Yeah, I would.
[3:23:43] >> And our our concert series
[3:23:46] >> also provides that
[3:23:54] If you take out Nashville and go with
[3:23:57] the recommendation
[3:23:59] amounts [clears throat] that you put,
[3:24:00] it's 16921.
[3:24:02] >> And is that with the 7,000 bag pipe?
[3:24:08] >> Not not really. I think just looking at
[3:24:10] the numbers even though it's in the same
[3:24:11] purse.
[3:24:12] >> Yeah. Yeah. Because then it's even
[3:24:15] less in that way. So, the bag of pipers
[3:24:18] perform at our memorial program and
[3:24:20] they're in our parade. [clears throat]
[3:24:22] Um,
[3:24:24] and if they don't get the full eight,
[3:24:26] they have to now somehow pay a lease.
[3:24:31] >> Yeah, I did their math. Uh, I did their
[3:24:33] math and I'm sorry I didn't write it
[3:24:34] down, but I think for all the building
[3:24:37] dates they wanted, it would just be over
[3:24:39] 6,000. I think that's what they had last
[3:24:41] year. So I called them and talked to
[3:24:43] Clary who's who turned in the
[3:24:45] application and she said, "Boy, this is
[3:24:47] so nice. We'll do whatever we have to
[3:24:49] do. You know, if it's a little bit less,
[3:24:50] then then we'll make it work." I don't
[3:24:52] know if they offer dues. I do know that
[3:24:54] they offer lessons to Lynon residents at
[3:24:58] no cost and that's also not bag pipes,
[3:25:01] that's drums. They do a big drumming
[3:25:03] section. So I I like what they offer.
[3:25:06] >> Yeah, we have a good track record with
[3:25:08] them.
[3:25:13] I would be inclined. Yeah, I think five
[3:25:15] might be too low. I think it might be
[3:25:18] nice to continue to at least give them a
[3:25:20] wash on their cost to use the space and
[3:25:23] open it up for everyone to attend for
[3:25:26] free. Continue that.
[3:25:29] [snorts]
[3:25:32] » I better get some notes up here.
[3:25:39] Yeah, I I love this program. I'm very
[3:25:41] comfortable with your recommendations
[3:25:42] and and you administering this program.
[3:25:45] You know, I'll bring up that we're able
[3:25:48] to do this cool program because of the
[3:25:50] park tax. And I don't think there's
[3:25:53] anyone who markets the park tax better
[3:25:57] than Lynen Elementary.
[3:25:59] >> I'm serious. I mean, there are signs
[3:26:01] everywhere. They announce it over the
[3:26:03] microphones. Hey, your children are
[3:26:05] about to perform and it's because of the
[3:26:07] park tax that we have these instruments
[3:26:09] and and so I'm biased towards Lyndon
[3:26:12] Elementary, but I appreciate the
[3:26:14] partnership that they're,
[3:26:16] you know, and so I I'm comfortable. I'm
[3:26:21] >> Well, Lynon Elementary, I mean, the
[3:26:23] request is 8856.
[3:26:26] Um, so did they indicate?
[3:26:30] >> Yeah, he just took out the microphone
[3:26:31] packs and sound equipment.
[3:26:33] >> Okay. So the pottery kiln is more of a
[3:26:36] priority to them.
[3:26:37] >> It is at this point.
[3:26:38] >> Yeah.
[3:26:39] >> And the script because they can rent
[3:26:41] mics. Although
[3:26:43] >> what she what she'd like to do is start
[3:26:45] that that whole another section of arts
[3:26:48] over there. And like you were saying,
[3:26:50] Jake, they they always ask me for
[3:26:52] stickers. Every one of those ukuleles
[3:26:54] has a sticker on it that says park tax.
[3:26:56] And the banners, they ask me for banners
[3:26:58] every year. So um yeah, they said we can
[3:27:01] do without the mics. We'd love to have
[3:27:02] them. We know it's a big ask, but we'd
[3:27:05] really like to do a musical and and get
[3:27:07] a and they've got district approval for
[3:27:09] electrical where they're going to put
[3:27:10] the kiln and things like that. At least
[3:27:14] for this year.
[3:27:16] >> Well, and I I like that you're taking a
[3:27:18] good look at this. When people hear free
[3:27:19] money, they Well, I'll ask for 8,000.
[3:27:22] You know what I mean? And and so I think
[3:27:23] you're handling this the right way.
[3:27:25] However you want to split it, I'm I'm
[3:27:28] comfortable where anyone wants to end up
[3:27:30] here. [laughter]
[3:27:32] budgeted 15,000 and this is all the way
[3:27:36] down to 18. Does that [clears throat]
[3:27:39] >> I think I'm comfortable with that. I I
[3:27:40] you look at the park tax and what it's
[3:27:42] produced in years past. We've never once
[3:27:45] under estimated what it will produce. It
[3:27:48] always produces more um than our
[3:27:51] projections uh 12 years running. And so
[3:27:54] I'm
[3:27:56] confident we will do that again this
[3:27:57] year. And there'll be an additional
[3:28:00] 3,000 to use specifically to parks and wreck
[3:28:05] and and I just think this is such a
[3:28:08] great program. I think of all the other
[3:28:10] things we could use it on and and this
[3:28:13] unique partnership with community
[3:28:15] members is
[3:28:17] good as anything.
[3:28:20] >> And I appreciated the comments mayor you
[3:28:22] made in our meeting with the Tempanoga
[3:28:24] School District to bring this up and
[3:28:26] make sure that they understood that I
[3:28:28] don't think they were aware that this
[3:28:29] was occurring. Agreed.
[3:28:37] » Were you suggesting option one, Jake?
[3:28:39] >> Yeah, I'm comfortable with option one. I
[3:28:41] don't want to step on anyone's toes.
[3:28:43] >> One is giving the Nashville Rockies
[3:28:46] 2000.
[3:28:48] I I'm a little more skeptical about
[3:28:50] >> I I would Yeah, I'd approve that with
[3:28:53] the deletion of the Nashville
[3:28:55] >> and I would pro if
[3:28:57] >> getting that 2,000 toward Lynon
[3:28:59] Elementary.
[3:29:01] >> What if we split it with Valley Pipe
[3:29:03] Band needs a little bit more to cover
[3:29:05] their rental?
[3:29:06] >> I forgot that that was
[3:29:17] So, Garden Valley said they're to just
[3:29:20] have a wash on the space usage. They
[3:29:23] need about six.
[3:29:24] >> I think it's pretty close to that. Yeah.
[3:29:29] Of course, they would adjust their
[3:29:30] practices to whatever they get. You
[3:29:32] know, they just cut it off in summer
[3:29:34] early or a little bit later. They're they're great to work with. They
[3:29:38] take care of the building. They're just
[3:29:39] a good
[3:29:40] >> partner.
[3:29:43] What's the What's the balance on the
[3:29:45] park tax fund?
[3:29:48] >> So, we have a I mean, you have a
[3:29:50] significant fund balance, but we're earmarking it for things
[3:29:55] potentially in the future. And so,
[3:29:56] checking with Kristen, she felt like in
[3:29:58] that 19,000 range is is totally doable.
[3:30:02] Um I this would dramatically change
[3:30:05] things, but you have the ability. I
[3:30:07] mean, you could make this a $100,000. I
[3:30:09] mean, and but that's going to change how
[3:30:12] we're paying for some other things in
[3:30:14] the city. And so, but the 19 range, she
[3:30:17] was totally comfortable going more than
[3:30:19] the 15 that's budgeted
[3:30:21] >> because if we did the full ask of
[3:30:25] everyone except well the fir the full
[3:30:29] ask of our previous applicants um and
[3:30:34] then didn't charge the pipe and their
[3:30:37] rent. So they only needed $1,000
[3:30:41] and then gave 2,200 to the gospel choir
[3:30:44] to pay for the professional and not
[3:30:47] include Nashville Rockies. That would
[3:30:49] put us at $18,000.
[3:30:52] >> And that begs the question, I know we
[3:30:53] had the policy of, hey, you got to pay a
[3:30:57] rental fee because we had some groups
[3:30:59] come and say, oh, we're we're going to
[3:31:00] do all this for the city. And then
[3:31:01] sometimes it didn't really materialize.
[3:31:03] So we said, "Okay, we need to have a
[3:31:04] policy. There's a room rental
[3:31:07] >> and it's a washroom.
[3:31:08] >> Sweetheart deals we got rid of."
[3:31:10] >> But but at the same time, the discussion
[3:31:12] you and I had with Unity Gospel Choir,
[3:31:14] and you mentioned, Heath, that maybe
[3:31:16] it's time with the Garden Valley pipe
[3:31:20] band, they've proven their return on
[3:31:23] investment, their value in the
[3:31:24] community, and we do just pull them in
[3:31:27] and say this is an extension almost of
[3:31:30] parks and wreck in a way. I I mean is
[3:31:33] that
[3:31:34] >> it's kind of interesting. We just don't
[3:31:36] charge them a rental. I don't I just
[3:31:37] don't think we can be
[3:31:39] >> subjective. It's really hard for us to
[3:31:41] do that though without a contract or
[3:31:44] something that you guys are approving
[3:31:45] for us to just say we're going to wave
[3:31:46] this group's fee but not that group's
[3:31:48] fee
[3:31:49] >> because then the other two we need well
[3:31:50] they would have to come up with money to
[3:31:52] rent and maybe they can
[3:31:55] >> but there's just two applicants that
[3:31:57] have seemed to suggest that part of
[3:32:00] their grant would be an inind donation
[3:32:02] of building space.
[3:32:04] >> So we would just need to tell them they
[3:32:07] have to price that out.
[3:32:12] And I think
[3:32:13] >> the Shantanets are they're $1,500 if
[3:32:16] that was the Veterans Hall.
[3:32:19] >> Their their actual cost for the Veterans
[3:32:21] Hall is the recommendation that I know.
[3:32:23] >> Okay. So then we only have one that's
[3:32:24] >> Yeah.
[3:32:25] >> But I think what the Unity Gospel Choir
[3:32:27] was saying is
[3:32:28] >> United Angels as well.
[3:32:29] >> They they would like to be just an arm
[3:32:32] of parks and wreck is goal
[3:32:34] >> or an arts council,
[3:32:36] >> right? I mean I I don't know how well
[3:32:38] [clears throat] that fits just in our
[3:32:39] other programs. We
[3:32:41] >> you know the football flag or not flag
[3:32:43] football tackle football is an extension
[3:32:45] of us but we do nothing with that but
[3:32:47] give them ground
[3:32:49] >> because the kids that they play so we
[3:32:50] don't take their funds or do their any
[3:32:54] fundraising for them. It's just that
[3:32:56] that's a part of that we don't offer
[3:32:58] that fits our Lynon kids. So they we
[3:33:00] have a partnership with them
[3:33:01] >> and it's advertised as a Lynen parks and
[3:33:03] wreck
[3:33:04] >> but that's about it on those programs.
[3:33:06] So if we want the unity choir to come in
[3:33:09] you know do we change that to the Lynen
[3:33:12] Unity. How does Deborah feel about that?
[3:33:15] >> I mean she she'll lose some aminity or
[3:33:18] not aminity that's the wrong word some
[3:33:20] recognition on that and some
[3:33:22] independence to be honest with you
[3:33:25] >> because she'll come under our umbrella
[3:33:26] and we'll do as we think we need to do.
[3:33:29] I think her I mean she's wanting this to
[3:33:32] be duplicated in other mark cities
[3:33:34] potentially further away from London
[3:33:37] than just next door. But,
[3:33:38] >> you know, mayor, there was another
[3:33:40] thought, too. A couple of times De
[3:33:42] Deborah said on the phone or the other
[3:33:44] Gholly anyway, she said,
[3:33:46] >> "This fits so well with communities that
[3:33:49] care because the children's choir is
[3:33:51] made to to stop sadness and depression
[3:33:55] and and they they reviewed our stuff we
[3:33:58] have online." She says, "Wow, this fits
[3:34:00] really good." I have not checked with
[3:34:02] Jamie to see if she could put a program
[3:34:05] like this in her grant and extend the
[3:34:07] reach of non-smoking and the non-smoking
[3:34:09] grant and that might be able to fund a
[3:34:11] program in a different way. Uh it is
[3:34:14] certainly park tax eligible with park
[3:34:17] tax money. Um but I and I think they
[3:34:21] would be just excited to have a good
[3:34:23] place to practice.
[3:34:25] Um, but the kids choir becoming a Lynen
[3:34:29] City kids choir, that's what it would
[3:34:30] amount to.
[3:34:33] >> Just as an FYI, um, so two years ago you
[3:34:37] approved 15,000
[3:34:39] a year, sorry, three years ago, 15,000.
[3:34:41] A year ago, two, sorry, three years,
[3:34:45] 15,000. Two years, 6,000. This last
[3:34:48] year, you're at 194. And this year, you
[3:34:51] approved 15.
[3:35:02] All right, council. Let's hammer this
[3:35:03] out and get going. What What are you
[3:35:05] thinking here? We're looking at option
[3:35:08] one, but making a couple tweaks. Is that
[3:35:12] what we're thinking here? Okay. So, are
[3:35:14] we all unanimous that we're not
[3:35:17] particularly interested in the Nashville
[3:35:18] and the Rockies?
[3:35:19] >> Correct. Yes.
[3:35:20] >> Okay. Strike [clears throat] that.
[3:35:23] >> [snorts]
[3:35:23] >> Um
[3:35:25] and then the uh garden val so we're
[3:35:29] saying take that two. So how are we
[3:35:31] right now that total for recommendation
[3:35:34] one option one is 18,921.
[3:35:37] Is that a budget amount you feel good
[3:35:40] about appropriating this time or more or
[3:35:43] less or is that something you're happy
[3:35:45] with?
[3:35:45] >> That's right. I'm good. a couple nods
[3:35:49] >> and I could do
[3:35:50] >> and maybe the 2000 just put directly to
[3:35:52] the pipe band because Lyndon Elementary
[3:35:54] has already said they'd, you know,
[3:35:56] accept the mics instead of the mics.
[3:35:59] >> Another thought about that is Rocky
[3:36:00] Mountain the [clears throat] first time
[3:36:01] a player. I cut $1,100 off of their
[3:36:05] request and it was all show it was
[3:36:07] another set of mic packs. So, I mean
[3:36:10] they've they're not like Rocky Mountain
[3:36:12] where they've had year after year after year.
[3:36:16] you know, if if if there's a little
[3:36:18] extra money, it might be a good thought
[3:36:19] to help Rocky Mountain, but I I'm happy
[3:36:23] to help the pipe band and and Lynen
[3:36:27] Elementary get their stuff.
[3:36:31] It's used so well and so visual.
[3:36:39] So, if we went with number one with
[3:36:43] Lynen Elementary getting 5,256,
[3:36:47] Rocky Mountain getting its full 3150.
[3:36:51] United Angels, they're at 1380, but they
[3:36:54] also have the undis undescribed inind
[3:36:58] facility usage.
[3:37:01] the Shantinets if they got the 1500, the
[3:37:04] 5,000, and the 2500 for the gospel
[3:37:08] choir, that's 18,786.
[3:37:11] So, Lyndon wouldn't get the mics,
[3:37:15] but and then the pipe band would have
[3:37:18] two 3,000 less than their full ask.
[3:37:23] » I second the motion.
[3:37:25] >> That's pretty I mean, it's close, but
[3:37:29] [laughter]
[3:37:31] I like it
[3:37:34] » because the mics is kind of a big deal.
[3:37:36] If you've been gone to these plays,
[3:37:37] which I have, you've been to the plays
[3:37:39] and you can't hear it. It's like
[3:37:41] >> kind of pointless a little bit. Not
[3:37:43] pointless, but it's so disheartening
[3:37:44] when the kids work so hard and they
[3:37:46] can't
[3:37:46] >> They said they would rent rather than
[3:37:48] own. Is that what you understand?
[3:37:49] >> But mics for Rocky Mountain or for
[3:37:50] Lynon?
[3:37:51] >> Well, both. I mean, we've taken out the
[3:37:53] mics from Lyndon,
[3:37:54] >> right? So I I would hesitate to give
[3:37:56] Rocky Mountain first time when Lyndon's
[3:37:58] been going and then they've requested
[3:38:00] mics and not give them to them.
[3:38:02] >> That's a good fair.
[3:38:03] >> Although Lyndon's gotten a lot more
[3:38:05] funding over the years a lot.
[3:38:07] >> Good point.
[3:38:12] » And even this ask is
[3:38:18] » unless you want to bump up the total,
[3:38:20] round it to 20. If you gave well to do
[3:38:22] the mics you'd need to round to 22 well
[3:38:25] 22,386
[3:38:27] if that was the only adjustment
[3:38:28] >> the full
[3:38:29] >> if you gave them the full
[3:38:33] and everyone the full except the gospel
[3:38:37] choir and then
[3:38:38] >> the shaets
[3:38:39] >> the the shaets would get their full ask
[3:38:43] and the because I guess that covers
[3:38:45] their rental so they're paying just like
[3:38:48] the bagpipe people are paying.
[3:38:51] And then the bag pipe theirs has been
[3:38:54] reduced by 3,000,
[3:38:56] but they need 6,000 to pay us.
[3:38:59] >> Yeah. Yeah.
[3:39:02] >> Changing purses like you were saying,
[3:39:04] >> right?
[3:39:08] » That arrangement 6,000 would make it 28
[3:39:13] 3,000
[3:39:14] >> 386.
[3:39:15] >> I mean, if we look at another way to
[3:39:17] look at it financially is which ones
[3:39:20] are onsite and so it's just a wash of
[3:39:23] exchanging
[3:39:24] >> Yeah.
[3:39:24] >> dollars on a page versus those that are
[3:39:27] offsite. It's actual a cash outlay.
[3:39:32] You know, I don't there's a hard cost
[3:39:34] versus a soft cost on some of these. I
[3:39:35] mean,
[3:39:35] >> which is kind of the way I looked at
[3:39:36] option three. If you wanted me to rank
[3:39:40] >> arbitrarily past and good usage,
[3:39:44] >> uh just uh did I say I meant funding for
[3:39:50] organizations closely related to Lynon
[3:39:51] too. Yeah.
[3:39:52] >> Okay.
[3:39:52] >> Where where we ran out of money at the
[3:39:54] $8,000 for that, but
[3:39:57] >> uh some of those others didn't get any
[3:39:59] part. And that was not all Lynon
[3:40:00] Elementary PTA ask. You you tell me
[3:40:04] where to fund them and I'll make sure
[3:40:05] they get them.
[3:40:06] >> You're awesome.
[3:40:13] » Did you feel comfortable with Lynen
[3:40:14] Elementary getting 52 56?
[3:40:21] and Rocky Mountain. They're full ask or
[3:40:23] just the 2,00
[3:40:32] » full ask and challenge them to be as
[3:40:34] communicative about how wonderful the
[3:40:35] park tax is.
[3:40:37] >> Yeah, there you go.
[3:40:37] >> Lynon Elementary
[3:40:39] [clears throat]
[3:40:43] » and the United Angels ask really it's
[3:40:47] most of that is in the building in kind.
[3:40:49] So they're not going to get very much
[3:40:52] out of that. So you okay with 1380
[3:40:55] >> for them.
[3:40:57] >> The Shantinets likewise
[3:41:00] >> 1500
[3:41:02] >> just a wash
[3:41:03] >> comes back to us
[3:41:05] >> and then the Garden Valley wanted to see
[3:41:07] if we can give them their whole ask.
[3:41:09] >> They were putting down that their
[3:41:11] building rental was seven but you on the
[3:41:13] application but you said you think it's
[3:41:15] six closer to Yeah, it's right around
[3:41:18] six. a little over six when I just
[3:41:21] looked up their dates for last year.
[3:41:24] So, unless they've got plans on doing
[3:41:26] more,
[3:41:30] » but they can make 5,000 work, they can
[3:41:32] make 6,000 work, they can make 7,000
[3:41:34] work
[3:41:37] » and they they've been a good
[3:41:40] >> Yeah.
[3:41:43] >> group to have.
[3:41:45] >> All right,
[3:41:45] >> we got to move forward. So, make a
[3:41:47] motion. How much on the pipe band?
[3:41:49] >> So they got 6,000 last year.
[3:41:51] >> So should I just think you should have
[3:41:54] >> maintain it? Yeah.
[3:41:54] >> If we're just getting all the money,
[3:41:56] >> they'll be happy.
[3:41:57] with that. And then we
[3:41:59] struck Nashville and then the United
[3:42:00] Gospel Choir.
[3:42:02] >> You okay with 25 to them?
[3:42:04] >> We could start with that.
[3:42:05] >> What's the new total? Have you
[3:42:07] >> 19,786?
[3:42:10] >> Yeah, that's what I got to.
[3:42:11] >> Okay. So we're just under 20. But hard
[3:42:14] cost is only about hard cost is
[3:42:17] >> a lot less.
[3:42:19] >> Yeah. Because they're paying back.
[3:42:20] >> There'll be a lot of happy organizations
[3:42:22] and very thankful.
[3:42:24] >> So,
[3:42:25] >> okay. I move
[3:42:28] [laughter]
[3:42:29] >> I don't know how to
[3:42:30] >> to approve what we just talked
[3:42:31] >> to approve
[3:42:33] the park tax committee grants as
[3:42:35] outlined.
[3:42:37] >> Maybe that numbered that 19
[3:42:39] >> comes to 19,786.
[3:42:43] distributed as
[3:42:44] >> distributed as instructed
[3:42:46] >> and I will second the motion.
[3:42:47] >> Okay.
[3:42:48] >> Motion by council member Hulie, second
[3:42:49] by council member Hoy. All in favor?
[3:42:51] >> I
[3:42:52] >> All right.
[3:42:53] >> Bye.
[3:42:54] >> Thanks Heath. [laughter]
[3:42:55] >> Thank you Heath.
[3:42:56] >> You bet.
[3:42:59] >> All right. We are now on item number 13.
[3:43:02] This is also review and action of our
[3:43:04] solid waste disposal contract with
[3:43:06] Republic Services.
[3:43:12] So we have Ashley Collie is here with
[3:43:15] us. She is represented from Republic
[3:43:17] Services. So thanks Ashley for coming.
[3:43:20] >> Thanks for hanging in there.
[3:43:22] >> And so [clears throat] let me close this
[3:43:24] here. This is just kind of summarizing
[3:43:27] uh the agreement that you have in place
[3:43:29] uh in front of you in your staff report.
[3:43:31] Um we've been contracted with Republic
[3:43:34] Services for a long time. It's probably
[3:43:37] been uh 20 years and so we had several
[3:43:42] opportunities to renew or extend an an
[3:43:45] existing contract. Uh this is an
[3:43:47] addendum to an existing contract that
[3:43:51] we've had in place. It's a three-year
[3:43:52] extension. And let me just kind of
[3:43:55] outline what's in in this proposal. Uh
[3:43:58] in the first year this coming fiscal
[3:44:00] year, there would be a 6% increase. Uh
[3:44:04] and we've
[3:44:05] uh discussed with you previously in a in
[3:44:08] a prior meeting to be able to handle
[3:44:10] that increase uh collectively with our
[3:44:13] garbage and recycling. We have a fund
[3:44:15] balance as a city. Um and that balance
[3:44:19] kind of es and flows as new accounts
[3:44:22] sign on or as people drop cans or
[3:44:24] things. And so, uh, it's built up a
[3:44:27] little bit and Kristen feels that we can
[3:44:29] absorb for garbage that full 6% increase
[3:44:32] this first fiscal year. For recycling,
[3:44:35] um, we would absorb 1% and then pass on
[3:44:39] a 5% increase to our customers. And so,
[3:44:41] just to the right there would be our
[3:44:44] current rate for garbage then, uh, for
[3:44:46] this proposed fiscal year would not
[3:44:48] change. And then the recycling would go
[3:44:50] up just that that little bit, uh, about
[3:44:52] 30 cents or so.
[3:44:55] um on the contract. Then on year two and
[3:44:58] three, um it creates a floor of a 2 and
[3:45:01] a.5% increase and a ceiling of a 6 and a
[3:45:05] half% increase. And these increases are
[3:45:08] based off of the consumer price index,
[3:45:10] the CPI. There's a specific garbage and
[3:45:13] trash listing out of hundreds of things
[3:45:15] that they index. Um just as a FYI, in
[3:45:19] some prior years, here's some of those
[3:45:21] rates. um January to January of this
[3:45:26] last 25 to 26 was about 5%. Um but
[3:45:31] February to February is what the
[3:45:32] contract says. Um and so you can see in
[3:45:35] one of those years it would have capped
[3:45:38] at that 6 and a half% ceiling. Um but
[3:45:41] traditionally we're hovering around that
[3:45:43] 5% increase every year.
[3:45:47] the floor. I realistically it probably
[3:45:51] won't go below that, but is that
[3:45:53] necessary to have in there?
[3:45:55] >> That was something that I I'll let
[3:45:57] Ashley dis discuss. Um
[3:45:59] >> because I prefer not to be in there
[3:46:01] personally.
[3:46:02] >> We But we tried to negotiate some
[3:46:05] different options there and that's what
[3:46:06] Republic felt I think uh to help keep up
[3:46:08] with inflationary costs, but I'll let
[3:46:10] Ashley speak to that. So,
[3:46:12] >> yes, please come forward.
[3:46:17] So, good evening. Thanks for having me.
[3:46:19] Thanks for being patient with me, uh,
[3:46:21] Madame Mayor and Council. Uh, so, first
[3:46:23] of all, wonderful to be here in London.
[3:46:26] My name's Ashley. Um, I previously
[3:46:28] worked with the city with Reese Deill,
[3:46:30] who was used to be a rep for the city.
[3:46:32] He left. I went to California with
[3:46:34] Republic. Now, I'm back. So, it's a
[3:46:36] pleasure to be here. Uh, so, first of
[3:46:38] all, we have a long-standing
[3:46:39] [clears throat]
[3:46:40] partnership with you. We really
[3:46:42] appreciate it. uh straightforwardly we
[3:46:44] really appreciate too your just uh
[3:46:46] geographical significance with the
[3:46:48] transfer station. It's very helpful to
[3:46:49] us. Um so looking at this contract we
[3:46:53] previously have been capped at a 4% um
[3:46:57] under this previous amendment that
[3:46:59] really hurt us. Um just transparently
[3:47:03] cost of service has gone up so much. Uh
[3:47:05] we've tied your annual price increase to
[3:47:09] the garbage and trash CPI, but again
[3:47:13] just honestly the cost of doing service
[3:47:15] for us is always going to be above 3%.
[3:47:17] So uh I got a hard bargain from Adam. We
[3:47:21] [laughter]
[3:47:22] uh I I'm not going to say on record what
[3:47:25] the official ask was from my higherups
[3:47:27] in area, but it was higher than what uh
[3:47:29] he got out of me. And uh this is what we
[3:47:32] came to. uh I have to get my area
[3:47:36] approval to put these prices together.
[3:47:38] It's a long process. They have a big
[3:47:40] spreadsheet, no formula. So, we put in
[3:47:42] 2.5. That's where we feel like it we're
[3:47:45] always going to be having to pay more
[3:47:47] higher drivers, etc., but we're good
[3:47:49] with that amount. We can take that
[3:47:51] floor. Um ceiling. Hopefully, it doesn't
[3:47:54] get up to that with the economy, but you
[3:47:56] never know. But that's uh Council Member
[3:47:57] Hulie. That's where that came from.
[3:48:00] >> Will that help with service delivery? We
[3:48:03] had, I think, two instances where
[3:48:04] Republic couldn't help us out as
[3:48:07] intended this last year.
[3:48:09] >> So, I wasn't here. I was in California,
[3:48:12] but I came back. Um, I've known about
[3:48:14] that.
[3:48:16] It's an industry-wide challenge, and
[3:48:19] here in Utah County, we have had
[3:48:21] challenges hiring drivers with CDLs. Uh,
[3:48:23] we've raised our rates and our wages,
[3:48:25] hence, you know, that 2.5 floor. We feel
[3:48:28] really good about it right now. Our
[3:48:30] trucks are holding up. We continue to
[3:48:31] hire. We're even offering uh people who
[3:48:34] are interested in getting their CDL to
[3:48:35] go out to Texas and we'll pay for it.
[3:48:37] So, but we're feeling better and good.
[3:48:40] >> So, yes, fingers crossed. I can't
[3:48:42] promise it will always be perfect, but
[3:48:43] that's what we hold ourselves to.
[3:48:50] » Do you share what what does a driver
[3:48:52] make on average?
[3:48:54] >> I don't have that with me right now.
[3:48:55] Yes. But I can bring it back. Yeah.
[3:48:59] All
[3:49:07] right, council. We did have kind of a
[3:49:09] heads up from staff on this, what to
[3:49:11] expect.
[3:49:12] Um, and we did already have that
[3:49:14] discussion about absorbing some of the
[3:49:16] increase for our residents. We had that
[3:49:18] ability to do so. Um my recollection,
[3:49:22] you know, the having been on the council
[3:49:25] all these years is that it has been a
[3:49:28] very good uh relationship and
[3:49:32] partnership and I remember many times
[3:49:35] Ree saying, "Hey, we're increasing this
[3:49:37] city this much, this city that much."
[3:49:38] And he would hold it for us quite often.
[3:49:41] So, um we we appreciate those
[3:49:46] accommodations. Something that's been
[3:49:48] beneficial for us that's remaining in
[3:49:50] the contract is right now Republic
[3:49:51] actually covers the cost of emptying all
[3:49:54] of our city facilities. And so we do not
[3:49:57] pay for garbage services disposal for
[3:50:00] any city facilities. So that was
[3:50:02] something that they we we kicked that
[3:50:05] around as an option, but we we would
[3:50:07] prefer to keep that. So
[3:50:09] >> and you are our only city that has that
[3:50:11] benefit. So [laughter]
[3:50:13] >> don't tell the others yet.
[3:50:16] Oh, we're telling them. Put it on the
[3:50:19] Facebook with the Star Wars stuff.
[3:50:20] Lincoln, you're my garbage guy. You
[3:50:22] feeling okay about this?
[3:50:24] >> You.
[3:50:25] >> Okay. So am I.
[3:50:27] >> Appreciate the conversations at ULCT as
[3:50:29] well. Appreciate you helping us wrap our
[3:50:31] heads around it. I'm I'm comfortable as
[3:50:33] well.
[3:50:35] >> Are you the motion man? Is what he's
[3:50:37] asking. [laughter]
[3:50:38] >> All right. This is yours, Lincoln. I
[3:50:41] move to approve the solid waste contract
[3:50:44] [cough and clears throat] addendum with
[3:50:45] Republic Service as presented.
[3:50:47] >> Second.
[3:50:48] >> Have a motion by council member Jacobs
[3:50:51] our trash ZAR.
[3:50:53] >> I like that.
[3:50:55] >> Council member Stewart,
[3:50:56] >> his assistant Zar.
[3:50:58] >> All right. All in favor?
[3:51:00] >> I.
[3:51:01] >> Thank you. And may the fourth be with
[3:51:03] you. [laughter]
[3:51:04] >> Nice sign on.
[3:51:07] >> All right.
[3:51:08] Okay. That takes us now to item number
[3:51:11] 14. This is a telecommunications
[3:51:14] franchise agreement with First Digital
[3:51:16] review and action.
[3:51:19] So, uh, First Digital actually has some
[3:51:21] infrastructure in our community. They've
[3:51:24] put in some things and then have changed
[3:51:27] from what I can gather they've changed
[3:51:29] some parent company
[3:51:34] sorry ownership issues and they wanted
[3:51:36] to get a separate uh agreement that was
[3:51:39] just first digital um instead of through
[3:51:43] a subsidiary or parent company. And so
[3:51:46] uh we've sent them a sample agreement
[3:51:48] that we've used in the past. They were
[3:51:51] just fine with it. Signed it, sent it
[3:51:52] back, and they've paid their application
[3:51:54] fee. So, this is a draft that we've
[3:51:57] actually prepared as a city. We're
[3:51:58] comfortable with this being approved
[3:52:00] 100%. So,
[3:52:01] >> awesome.
[3:52:01] >> What's the the the piece about the
[3:52:03] automatic renewals is that
[3:52:06] >> to save time? I that was the only thing
[3:52:08] that made me go like do we want to have
[3:52:09] a hard stop so that we can
[3:52:12] >> where they have infrastructure buried in
[3:52:15] our streets to say at some point we're going to term this agreement and
[3:52:20] not allow it to continue. I don't know.
[3:52:22] >> Pretty strange.
[3:52:23] >> Yeah. Why we would do that. They they
[3:52:26] pay a tax that comes through. It's it's
[3:52:29] tax to end users. Uh clearly that's part
[3:52:32] of the tax that we pay for our utilities
[3:52:34] or for these different services. But,
[3:52:37] uh, I'm I'm comfortable with that
[3:52:38] automatic renewal. And so,
[3:52:41] >> um, the other thing, it does provide a
[3:52:43] little bit of a protection for us. We
[3:52:44] did have a similar instance with another
[3:52:46] franchise agreement that it had expired.
[3:52:49] And for us to then enforce something,
[3:52:51] that's problematic for us to say, "Hey,
[3:52:53] we have an agreement that says you'll
[3:52:54] take care of this issue because of your utility caused it." And then if our
[3:52:59] agreement's expired, that can be
[3:53:00] problematic. But,
[3:53:02] >> and then did is have you ever had
[3:53:03] problems with the restoration clause?
[3:53:05] It's like as it was instead of as it
[3:53:08] should be. Like if it was a cracked
[3:53:10] sidewalk and pretty lousy to begin with.
[3:53:14] They're not going to make a cracked
[3:53:15] sidewalk. But I just thought, well, no,
[3:53:16] we would
[3:53:17] >> What section is that? Do you recall?
[3:53:21] >> Restoration.
[3:53:21] >> It was a restoration section.
[3:53:23] >> Yeah, restoration clause. Any concerns?
[3:53:27] >> No, that that is just the standard
[3:53:29] language that they're not going to want
[3:53:31] us to. Again, what that usually applies
[3:53:34] to is if we've got a, you know, three
[3:53:37] foot sidewalk that's there, we can't
[3:53:40] make them come in and put a six foot
[3:53:43] >> that that's that's where it's at. And
[3:53:45] it's very standard that
[3:53:46] >> we repair it to the condition.
[3:53:49] >> That's 4.8 if you're looking for it.
[3:53:51] >> Yeah, that's cool. It's not searchable
[3:53:53] or else I just tell you to
[3:53:55] >> Yeah, sorry about I just put in the
[3:53:56] scanned copy that they sent back.
[3:53:58] >> No, you're good. You're good.
[3:54:01] >> Thanks. Those are my questions.
[3:54:07] » Well, I'll make a motion.
[3:54:09] >> Thank you.
[3:54:09] >> I move to approve the franchise
[3:54:11] agreement with First Digital as
[3:54:12] presented.
[3:54:14] >> Second.
[3:54:15] >> Motion by Councilman Stewart, seconded
[3:54:17] by Council Member Broader. Any further
[3:54:20] discussion?
[3:54:21] All right. Seeing none, I'll call the
[3:54:23] vote. All in favor?
[3:54:24] >> I.
[3:54:27] >> Any opposed? Okay, that's unanimous.
[3:54:31] All right, we'll get that signed away
[3:54:33] tonight. All right, we're now going to
[3:54:36] go into uh our last item on the agenda.
[3:54:39] This is [clears throat] item number 15
[3:54:41] to have a close session.
[3:54:44] >> I move to enter a close session to
[3:54:46] discuss potential purchase or sale of
[3:54:48] real property.
[3:54:50] >> All right, we have a motion by Council
[3:54:51] Member Stewart, seconded by Council
[3:54:53] Member Hoy. All in favor?
[3:54:55] >> I I
[3:54:59] go ahead and
[3:55:01] I or do you want it with
[3:55:02] >> that on the new recording, don't we?
[3:55:04] >> Oh. Oh, yeah.
[3:55:05] >> I was going to say
[3:55:06] >> to go into the close session.
[3:55:07] we need a
[3:55:09] roll call vote.
[3:55:10] >> Van Brick, I Lincoln Jacobs, I
[3:55:13] >> Cole Hulie, I
[3:55:14] >> Carolyn Lunberg, I
[3:55:16] >> Jay Ky, I
[3:55:17] >> Steve Stewart, I
