Anthony Theorello. my officer at 16
further street total burrow and I'm here

on behalf of William Dphano. Mr. Dphano
who is standing to my left uh is the
[5:50]
contract purchaser of a parcel of
property uh here in Little Falls uh
[5:55]
known as one Merit Avenue. It's uh
further known as block 40 lots one and
[6:01]
two and block 63 lots 10 and 12. The
premises are presently occupied by a
[6:07]
manufacturing company called Alvin Brush
Company. uh they receive uh shipments uh
[6:14]
large trucks. They manufacture, they
ship out uh various types and quantities
[6:19]
of brushes.
Mr. Dphano has been in business uh and
[6:25]
has operated in Little Falls as well as
the Toronto community by providing types
[6:29]
of amusements uh in connection with
fairs, uh municipal events, weddings, uh
[6:36]
church events and the like. uh he
proposes to purchase the property which
[6:40]
consists of 5.7 acres. It's a large
practical plant uh which is uh
[6:45]
designated as wooded uh I've been to the
property about four times and it's more
[6:50]
like forested. There are big uh aged
trees that grow in there. Uh there's a
[6:56]
pond, there's herds of deer and other
natural resources have property. There
[7:04]
are going to be no changes to those
buildings. I'm going to be heightened,
[7:08]
heightened, lengthened, uh more doors
and more windows, nothing to stay the
[7:13]
same. Uh there's going to be no increase
in impervious service.
[7:19]
So something to consider. Um of the 5.7
acres, there is 6 acres that are
[7:25]
impervious. So they're going to be no
increase in purpose of service. There
[7:30]
are stored on the property as it
presently exists uh containers and
[7:34]
they're stored in an area between the
parking uhized parking area uh and the
[7:41]
wooded or forested areas I like. So Mr.
going to be sat belts here that tell you
[7:47]
a little bit about his business, what he
intends to do with the property, his m
[7:50]
his mode of operation, the number of
employees, the number of cars, uh
[7:54]
particularly what what sort of apparatus
he has because he's seeking to not only
[7:59]
occupy the premise the commission, but
also to have outdoor storage in the area
[8:03]
where outdoor storage presently exists
and expand it a little bit into the uh
[8:10]
non-imperous
uh area that exists. We also have with

various aspects of the plans that are

do advance several purposes of zoning

and we'll improve the visual environment

on in in those ways I think um we've
worked towards some some improvements.

acres I own property outside of Little

become well okay it's just woods. We can
store anything we want there. We can put

the containers there. It's out of sight
for the immediate neighbor that look at
[1:23:38]
the property. Uh that's really our only
concern. We don't want to be looking at
[1:23:42]
all the rides. Sure nobody does
obviously. Uh
[1:23:46]
but from what it sounds like it doesn't
sound like immediate plan to expect that
[1:23:49]
it's just that we want to make sure that
everybody here's our concern of 5 acres
[1:23:54]
is a lot of area 5 acres is a lot of
area specific to live right and every
[1:23:59]
town in New Jersey builds we all build
we build up I don't know how many 5acre
[1:24:03]
lots even exist in this township and
probably no is my guess I could be wrong
[1:24:09]
uh so my our concerns are you know
obviously in the future we address what
[1:24:13]
may need to be addressed But we also
want to just make sure we don't start
[1:24:16]
cutting trees down. Make it a space
where now we can store to appease ex
[1:24:21]
neighbors and now why neighbors get
forgotten about. We're staring at a
[1:24:24]
storage junkyard even though it's marsh
and a lot of it is wetland. Doesn't seem
[1:24:29]
like any of us know why the water is
there but the pond is there, the
[1:24:32]
standing water's there. Uh so as long as
that's understood, you know, that's
[1:24:39]
pretty much the statement that I have to
make is that we don't want to have
[1:24:41]
storage junkyard broken down rides or
all of the containers now being pushed
[1:24:45]
off into what's being called unusable or
forest there. You know, you buy five
[1:24:50]
acres, you want to use part of that five
acres, there's zero way that I think
[1:24:54]
that we're just going to buy five acres
not. Uh so as long as that's taken into
[1:24:58]
consideration, you know, myself and many
neighbors, we discussed it. you know, we
[1:25:02]
don't have other objections. If it's
going to status quo stay the same, you
[1:25:06]
know, for our end, we get it. But as
long as it's the same page as us as far
[1:25:11]
as we don't want to just start taking
part of this land and using it for
[1:25:15]
storage just because it's out of sight,
out of office, but then it's an arsenal.

approve it and naturally the board has
[1:25:47]
not rendered its decision yet. If that
were to take place, um we've heard and
[1:25:53]
the applicant stipulated into the
limited area in which there would be
[1:25:56]
outdoor storage. In terms of any future
development
[1:26:01]
right now, uh nothing is proposed, but
in the event there would be the
[1:26:05]
applicant seeks to develop further on
the property, they would have to come
[1:26:09]

considering this application.
Lord needs to consider that this is an
[1:26:37]
industrial zone and that the industrial
zone in Little Falls has a pretty
[1:26:41]
expansive list of what would be
permitted on site. And we need to
[1:26:48]
consider what this use is compared to
what uses that would otherwise be
[1:26:52]
permitted are on the site and determine
if this is a use that is better than
[1:26:57]
what many others could be or if this is
worse. And in again just encourage the
[1:27:02]
board to consider that you know in an
industrial zone there's a pretty
[1:27:05]
expansive list of things that would be
permitted and Mr. Maria, do you know the
[1:27:09]
hours of operation in industrial zones
in Little Falls?
[1:27:13]
There is none. Right. So theoretically,
use of this property at any time is
[1:27:20]
permitted in the industrial zone because
there is no restriction on the times of
[1:27:25]
operation. And if a factory wanted to
open here with 53 ft tractor trailers
[1:27:33]
coming in on the property regularly and
if they wanted to operate round the
[1:27:37]
clock, we would have very little ability
to prohibit that type of use. And we
[1:27:44]
have an applicant here who has made some
concessions this evening.

» There are two variances required in
connection with this. Uh that's for the

outdoor storage and also the number of
on-site parking spaces where 41 are
[1:28:24]
required and 27 spaces would be
proposed.

I'm going to quickly run through some of
the conditions that
[1:28:34]
that I have based on uh comments and
stipulations on behalf of the applicant.
[1:28:41]
One would be the containers would be uh
painted or cleaned and refurbished to
[1:28:47]
improve their appearance.
There would be nothing stored on top of
[1:28:51]
the containers. There'll be a limit of
uh the limit of four containers which
[1:28:56]
currently exist on the site.
They're going to add additional
[1:29:01]
landscaping or planting arbor vidy
trees. the nature and sufficiency of
[1:29:05]
which would be subject to review and
approval of our board planner. There'll
[1:29:10]
be no work outside of the building
before 7 a.m.
[1:29:14]
They're going to add landscaping to the
northerly side of the property, provide
[1:29:18]
a visual buffer.
Uh they're going to move the storage
[1:29:23]
containers outside of the 40ft buffer
area with plan arboriting.
[1:29:29]
Also, they provided uh we went through
the technical process of our board
[1:29:34]
engineer and they're going to comply
with these with the technical comments
[1:29:39]
contained in the board engineers review
report.
[1:29:44]
Um I believe they stipulated there would
be no kind of pallets or anything else
[1:29:48]
stored outside other than what they
represented to be stored on on the
[1:29:51]
record tonight and they will maintain
buffer areas on a long-term basis.

» There were three variances originally.
One was eliminated because they are
[1:30:12]
relocating the containers out of the
buffer.
