[5:06] You're up. Counselor.
[5:11] Oh, you got Michael Jordan. Yeah, I think so.
[5:17] You can pull sher up there. Okay.
[5:36] » Good evening, Mr. Chairman and members of the planning board. Council is
[5:41] Anthony Theorello. my officer at 16 further street total burrow and I'm here
[5:45] on behalf of William Dphano. Mr. Dphano who is standing to my left uh is the
[5:50] contract purchaser of a parcel of property uh here in Little Falls uh
[5:55] known as one Merit Avenue. It's uh further known as block 40 lots one and
[6:01] two and block 63 lots 10 and 12. The premises are presently occupied by a
[6:07] manufacturing company called Alvin Brush Company. uh they receive uh shipments uh
[6:14] large trucks. They manufacture, they ship out uh various types and quantities
[6:19] of brushes. Mr. Dphano has been in business uh and
[6:25] has operated in Little Falls as well as the Toronto community by providing types
[6:29] of amusements uh in connection with fairs, uh municipal events, weddings, uh
[6:36] church events and the like. uh he proposes to purchase the property which
[6:40] consists of 5.7 acres. It's a large practical plant uh which is uh
[6:45] designated as wooded uh I've been to the property about four times and it's more
[6:50] like forested. There are big uh aged trees that grow in there. Uh there's a
[6:56] pond, there's herds of deer and other natural resources have property. There
[7:04] are going to be no changes to those buildings. I'm going to be heightened,
[7:08] heightened, lengthened, uh more doors and more windows, nothing to stay the
[7:13] same. Uh there's going to be no increase in impervious service.
[7:19] So something to consider. Um of the 5.7 acres, there is 6 acres that are
[7:25] impervious. So they're going to be no increase in purpose of service. There
[7:30] are stored on the property as it presently exists uh containers and
[7:34] they're stored in an area between the parking uhized parking area uh and the
[7:41] wooded or forested areas I like. So Mr. going to be sat belts here that tell you
[7:47] a little bit about his business, what he intends to do with the property, his m
[7:50] his mode of operation, the number of employees, the number of cars, uh
[7:54] particularly what what sort of apparatus he has because he's seeking to not only
[7:59] occupy the premise the commission, but also to have outdoor storage in the area
[8:03] where outdoor storage presently exists and expand it a little bit into the uh
[8:10] non-imperous uh area that exists. We also have with
[8:15] us this evening Daniel Lamok of the Apache Associates. He's our engineer and
[8:19] he'll he'll testify concerning uh various aspects of the plans that are
[8:25] submitted. So I'd like to call up uh Mr. Dphano have sworn
[8:32] a question. >> All right, Mr. Stephano, please raise
[8:37] your right hand. Do you swear affirm the testimony that you're about to give
[8:39] before this board is going to be the truth, the whole truth, and nothing but
[8:42] the truth? All right. Please spell your last name for the record.
[8:51] » And your address, sir.
[8:56] » Thank you Stephano. You're the contract
[9:00] purchaser B of the premises that are here before the board this evening. Is
[9:04] that correct? Uh and you presently own an operated business.
[9:10] » And it's the name of the business, please.
[9:15] And how long have you been engaged in this enterprise and business?
[9:22] » And what is it that the business does or what do you do with the business?
[9:30] Well, even
[9:38] John for many many years
[9:48] on my play.
[9:54] I think the reason I was some of the on the property about what
[10:01] it was and basically they're leaving the past. They looked at this
[10:08] do one day you know anywhere safely set up for three four five hour
[10:17] day outside
[10:31] 67 seven goes back
[10:45] to see
[10:58] Sorry to client working
[11:11] fulltime employees and we hire somebody partis
[11:18] I just
[11:23] not
[11:29] anything
[11:47] what is known mini trailers. >> You have some uh small box trucks that
[11:54] use as well. Um, is your business open to the general public?
[12:20] Will you be leasing the will you be using the entire building? Will the
[12:25] brush company still be have a presence or you'll be occupying and all those
[12:30] rides can't fit inside? There's not enough room.
[12:37] » Winter time. Do you cover them? >> No. If kids from the uh there's a lot of
[12:43] houses going going on now and kids access them to their backyard.
[13:09] Thank you.
[13:23] » You cover them. >> Do you cover them? We follow
[13:39] » if you're doing schools and things like that, what are the hours of operation?
[13:44] No, I know. But are you moving all those things at 7 a.m.?
[13:54] » Okay.
[14:00] How many uh employees will be in the building at any given time?
[14:11] » That varies in accordance with the season. Is that correct?
[14:16] » I'm looking at your truck with advertising on it. It says uh you
[14:19] provide uh those type of activities for backyard parties.
[14:27] weddings
[14:31] on the truck. It indicated water slides and mechanical bull
[14:35] have that.
[14:44] It's not something that you see at a corner like a ferris wheel or a whip or
[14:48] that type of material. Is that correct? They're stored on you said these mini uh
[14:54] tractors that drove trailers. Uh you provided some
[15:00] photographs that indicate the type of equipment
[15:04] that's there uh that utilize as well as the drugs sector showing you these are
[15:09] these photos taken some chairman. I'd like to have these as
[15:16] sure.
[15:27] So each package contains >> each package consists of four.
[15:57] Hey, so can you uh >> just
[16:00] » Okay, >> we're going to mark this A1. It's going
[16:02] to be a series of four photographs. Then your client, you can go from each one
[16:08] » and just tell us what it is. Stephan, I'm showing you A1
[16:13] photograph that you take. What does it show?
[16:17] » Sorry, could you wait till the photo? >> Thank you.
[16:56] can you describe to us what we're looking at?
[16:59] » Just just before you do that, um, so Mr. Dphano, did you take these photographs?
[17:06] Okay. And when did you take the photographs?
[17:10] And the and do these photographs fairly and accurately depict the conditions on
[17:16] the photographs at the time you took them?
[17:20] Okay. And where what's the site of where these photographs were taken?
[17:26] » Okay. At your current site. >> Okay. Thank you.
[17:54] Can you describe the picture? They're a little hard to make out. They're very
[17:58] black and white. >> Yeah.
[18:00] First picture looks probably
[18:13] up. We usually Christmas time they go in
[18:17] there Christmas action Halloween
[18:26] man trailer
[18:30] this and it gets pulled from pickup truck and
[18:38] » okay let's take a look at the exhibit A2 you tell the board what that
[18:55] It's on a trailer and
[19:01] how do you how do you access that trailer to to move with a pickup truck
[19:04] or a how long is that apparatus?
[19:18] and take a look at A3. Tell the board what what that represents.
[19:36] Where are those tables and chairs stored? And you intend to store them
[19:40] with
[19:47] take a look at the exhibit A3. What that is
[19:58] chairs you like and that's on a mini trailer as as well like that's hooked up
[20:03] to a truck and take a look at a forward but that is
[20:20] » and How is that transported?
[20:24] » I'm sorry. What's the height of that rock?
[20:27] » 24.
[20:39] » Now, as the site presently exists, there are shown on the plans uh certain
[20:46] containers that are on site. Is that true? And that's in an area where you
[20:52] propose to store some of the equipment was tested by
[21:00] you intend to store them any other place
[21:11] are
[21:14] here
[21:17] maybe on
[21:20] Are the containers leaving?
[21:34] » We want them all. >> Yeah. Unless you can store rides in
[21:38] them. >> Unless you can store rides in them.
[21:50] Mhm.
[21:58] » What kind of condition are these trailers on the slot? Are they rusty or
[22:04] trailers? Are they rusty or >> trailers?
[22:11] Trailers. >> No. No. I'm talking about the prayers
[22:14] that are on the >> saint.
[22:27] » Okay.
[22:32] » We go back to A5 for a moment. >> Say it again, sir.
[22:35] » A5. The picture.
[22:41] Yeah. Okay. Is that the rock wall?
[22:46] » This a train. >> That's a rock wall.
[22:51] » Okay. Okay. So, you describe that very well.
[22:56] » Looks like fun. Is Is this however this looks like it's just classic tarp
[23:00] draped? >> Yeah.
[23:02] That's not >> Well, you mentioned shrink wrap, but
[23:05] that's not an example. Uh that's
[23:10] » okay. Any questions? >> Going back to the trailers, if if you
[23:15] decide to take the trailers from the current owner, would you need all four
[23:20] of them?
[23:24] » Yeah.
[23:31] » Okay. They uh from my my observation is they certainly need a paint job if
[23:38] nothing else and they're rusting away.
[23:44] » Thank you. >> At your current location, um you occupy
[23:48] part of the building space there as well in addition to the drivers.
[23:52] the drive. So again, you have you have your here in the drive. You can also
[23:57] see
[24:06] » continue. >> I have no further questions with Mr. D.
[24:10] I would like to call our engineer for test.
[24:14] » I have several questions. The containers on your current site are
[24:20] call them unsightly, especially in the sense that there's stuff piled all over
[24:24] the tops of them that uh as the height starts to increase obviously the
[24:29] visibility would also increase. Would you agree that if there's any containers
[24:34] on the site that nothing would be stored on top of them?
[24:38] And I know I've been to the Merida property
[24:42] in the past. I think there's about five or six containers there now. Is that
[24:45] Right.
[24:54] So, would you agree to limit the total number of containers to three, which
[24:57] would be a reduction of the total number of containers on the site?
[25:06] » There's five there now, right? Is that my recollection? Is that correct?
[25:09] » Land show five.
[25:16] I was there today and I counted four. >> Four.
[25:19] » I Yeah. >> Okay. I know the numbers fluctuated over
[25:21] the years. So would you agree to limit the number of containers to the current
[25:25] number that is there rather than expanding the number of containers in
[25:28] total?
[25:32] And as far as the six to seven mechanical rods, would you
[25:38] agree to box them in with a a fence so that there's no real visibility of them?
[25:45] Because the majority of them look like they're under about 6 feet tall. Would
[25:48] you put a vinyl fence around them so there's no visibility to those rides?
[25:57] I don't
[26:01] do that again any
[26:19] » Okay. Tree trees may work for that purpose. The the problem with the
[26:23] fencing is that we have to pull these trailers indie trailers in and out. Um
[26:28] there's no way to do that fence that that
[26:33] » what the fencing would do would be block the view from all those condos and
[26:37] apartments that are behind you that are five six stories high. So we kind of
[26:44] like to block that. I know it's high. We kind of like to block that if possible.
[26:50] Say, you know, thinking about it.
[27:08] » If you just go up to the height of the trailer tops, probably be enough.
[27:16] » Yeah. the would you restore the trailers on the most I guess southern part of the
[27:22] property which is where the containers currently are. If you'd continue with
[27:26] the rides so that they're not visible from the dewy side of the the project
[27:30] that would hide all of those six to seven mechanical rides they have.
[27:36] I'm just trying to figure out a way to make it less of an attractive nuisance
[27:40] where kids are going to come and potentially see them or jump on them or
[27:43] do anything like that from that angle. If they're behind the containers, I
[27:47] don't think they'd be visible. None of them are higher than the containers
[27:50] themselves, right? When stored. >> None of the rides are higher than the
[27:54] containers when they're stored and broken down.
[28:02] » There's proposed gates on Merit Avenue, so there' be no access there. Uh there's
[28:10] my eye there's six foot fences along the property line apple property and the
[28:17] residential neighbors. So no way to do that unless you know age somebody else
[28:22] probably >> I don't think they're saying the whole
[28:24] thing >> the back
[28:25] » not all not all those neighbors have secret fences.
[28:30] Well, the ones that are approximate to the building
[28:34] uh in lot one two and three one in lot it's 11.01 They don't want to have sick.
[28:40] » I I believe kids are notorious. They'll crawl under, they crawl through, they
[28:45] climb over. >> Kids can
[28:48] in a heartbeat. Uh, as far as hours of operation, would
[28:52] you agree to not do any work outside of the building prior to 7 a.m.?
[29:07] » I mean, work inside the building obviously not an issue, but you know,
[29:10] outside neighbors cannot have to deal with noise of loading things prior to 7
[29:16] a.m., which are noisy ordinance in town.
[29:23] I think that's all we have. >> Mr. Chairman, Mr. Chairman, if I may,
[29:27] one or one or one or two quick questions.
[29:31] » The um you mentioned that you get occasionally a delivery of new rides,
[29:36] new equipment, whatever. Could you put a ballpark on the frequency of that? Is
[29:41] that a seasonal thing right at the beginning of the year?
[29:44] » Yeah.
[29:49] things very
[29:53] » okay. >> So it's not a weekly monthly occurrence.
[29:57] It's just rare as needed. Okay. And those vehicles that come will be
[30:03] whatever the delivery company's using. It's okay. The um just getting back to
[30:09] what the mayor and some others were talking about with kind of fencing and
[30:12] we'll discuss this with with your engineer as well. I think part of what
[30:17] I'm looking at as the planner on behalf of the board in the township is to
[30:21] basically define the area that you're going to use and whether that's a fence
[30:26] that's giving us a boundary, whether that's edge of pavement giving us a
[30:30] boundary, landscaping giving us a boundary, just defining that area so
[30:34] that today it's this and then next week it's this times two doesn't become an
[30:40] issue. So just keep that in mind and we'll have testimony from your
[30:44] professional and kind of revisit some of the technicalities of that.
[30:52] » We'll come back. Go ahead. >> Well, our engineer then
[31:02] » Daniel, you swear from the testimony that you're
[31:05] about to give before this board is going to be the truth, the whole truth, and
[31:07] nothing but the truth. Please tell us your name last name. Mr. Business.
[31:21] Can you give the board the benefit of your educational background experience?
[31:39] your lensure still
[31:45] in this matter submitted behalf of Mr. Dano
[31:51] the board please through the plans >> accepted
[31:55] » he's accepted >> okay
[31:59] Mr. Or you me
[32:31] 45
[32:59] And then you
[33:08] show them
[33:20] to
[33:25] everything.
[33:48] Sir, in terms of the uh the area where the trailers or the outdoor storage
[33:51] would be, could you estimate and provide a uh a figure as to how wide that would
[33:56] be? I see some containers uh located there around but to me and to my eye
[34:00] looks about 100 feet be wrong. >> Yeah. So
[34:23] it follows the uh the tree line. He's
[34:28] kind of very
[34:32] sty And
[34:34] fairly long
[34:57] back road kind
[35:12] The loading area presently exists. >> Yes.
[35:18] » And a existing uh refuge facility is also approved.
[35:23] » Yeah.
[35:39] that there's a 40 foot uh residential setback along the properties that are on
[35:45] DY Avenue. Is that correct? >> Yes.
[36:16] Are you saying you might store things on the side of the building?
[36:24] Yes. Yes.
[36:43] dumpster going where those containers are.
[36:49] » Is it designated on your
[37:04] probably >> that's a little more specific.
[37:09] » It already exists there and that's where we intend to keep it.
[37:11] » Okay. >> But it's movable so you know all over
[37:14] but that that's the logical place to put it furthest away from
[37:19] residential properties. uh part of the building uh is already existing within
[37:24] that 40 foot set. Is that correct?
[37:34] » Is that clouded area fully hard surface or a combination?
[37:42] » Is is it shown on this plan where the hard surface is and where it's not?
[37:50] So most of the storage area will be on the grass.
[37:56] » We review the engineer. Can we review the engineer report?
[38:03] Can we review the engineer report? >> Sure. So Lamont, you you received a copy
[38:10] of the Kalar's uh report. Have you reviewed it?
[38:19] to review it with you and
[38:24] Right. We're just going to do do the technical comments
[38:28] starting D
[38:35] 11. There are 11 technical comments.
[38:47] Yes.
[39:22] equipment that that reference in there is that's owned by a third party
[39:28] landscape. So for you don't own it, then that's going to be revoked by that
[39:35] that person.
[39:40] Number
[39:50] two, we've addressed by testimony from Mr.
[40:18] heard testimony regarding the number of employees that would vary according to
[40:22] season. I seasonality because uh those parking spaces enough to accommodate the
[40:27] employees 27 onsite
[40:36] A comment with respect to the condition of the parking lot itself repairs.
[41:17] But he stays.
[41:23] Did you mention the height I missed
[41:35] » item number seven last week?
[41:45] » Yes. Now there's a problem. I know
[41:52] appears to be a large deer population in the wooded area.
[41:59] » Will that limit the type of escape view that will
[42:15] » on the topic of events? The uh we have two departments that need access.
[42:21] DPW there's a stream behind you the site that they clean out. So they will need
[42:27] to access. Fire department will need to have access. Will you be ready to supply
[42:33] them with codes, keys, whatever you use? >> Sure.
[42:41] So the most item uh with respect to uh I think we were on finish seven we're on
[42:48] eight.
[42:52] You indicated that there going to be an area for the dumpster that uh will
[42:57] provide a throwing.
[43:06] He didn't have testimony to affect the lighting, but there's no additional
[43:10] lighting on your plan that
[43:32] there's no uh new signage proposed. All that's going to happen
[43:38] that often end brush company will just be rewarded to reflect the step company
[43:46] name
[43:49] is going to be diminishing just there's a lot of information we don't
[43:56] have very well
[44:01] » signature blond without saying that'll that'll
[44:04] » I don't have any place to sign. You don't get signed.
[44:06] » No, >> we're going to make going to make some.
[44:10] » Okay. Mr. Kobalar, do you have any comments?
[44:13] » A couple questions of regards to the Belster location. I did see a couple
[44:20] within the site itself. One location
[44:25] you describe here. >> Yeah. that um a refuge truck pick up
[44:36] building only to that point
[44:45] between the building and res
[44:53] that back.
[45:07] want to point out that
[45:22] » I would assume it's a a municipal roadway and that the
[45:28] municipality would like >> the municipality is not coming down as
[45:31] far a driveway spread a roadway.
[45:38] » Yeah, they would have to uh
[45:45] » we got the equip. >> Who?
[45:49] » You got we got to swear you in. >> All right. Well, he's already sworn in,
[45:53] but we need to have you identified on the record. We just hear a voice in the
[45:57] audience. >> All right, Mr. Dphano. Now you can put
[46:00] on the record what you were saying from the seats.
[46:03] » What the request is that the allow the entire roadway
[46:12] was having public work.
[46:23] My understanding the role itself is own
[46:33] I was focused on Dewey. That's why I said
[46:37] right
[46:40] and he'll take care of them.
[46:45] » Anything else?
[46:50] » Any questions of the board? engineer. >> Mr. Chairman, I not for the engineer,
[46:54] but I have a question. Mr. Stephano, if a organization, a church was to hire
[46:58] your company and they wanted most of your the activities you would supply the
[47:03] games, how many vehicles would be pulling out of the establishment?
[47:11] » So, at that moment, it would be six, I'm sorry, six box trucks, you said.
[47:16] And then so that would six about 14 vehicles. Am I correct? Nine vehicles.
[47:25] So nine vehicles would be pulling out at a given time for that event.
[47:28] » Nice.
[47:42] » I'm sorry, Mr. Dick. You said six 16 ft box trucks in three three picks.
[48:02] » Any more questions from the board? Continue.
[48:11] » That is our presentation. Okay, you haven't addressed the
[48:16] variances,
[48:19] » two
[48:28] this was addressed to the engineer. >> Do you need the planners report?
[48:36] » Mr. Fero, on page three of the planners report, there were three variances
[48:40] identified. So let me just review them.
[49:14] Why are you
[50:11] We haven't addressed the prohibited outdoor storage location.
[50:22] Uh, is he going is the engineer going to make the case for the positive and
[50:26] negative criteria? Are you
[50:36] foresee any
[50:41] potential detriment to the Liverpool's zoning plan or zoning ordinances with
[50:46] respect to this application?
[51:12] enhance the purposes of zoning.
[51:18] There's a better plan than that on the purposes at this time.
[51:34] » That's uh does our planner have any comments?
[51:39] » Sure. I actually have a a question before we get to comments. Um, the plans
[51:44] seem to show encroachment onto the railroad rightway to the the northeast
[51:50] uh drive aisle that loops around a building within the railroad property.
[51:53] Is that accurate?
[51:59] Okay.
[52:03] So, getting back to our previous discussion about defining the limits of
[52:08] storage. Um, if you're out there on the site, you look at the pavement and you
[52:14] say, "Well, that's that's my property. I drive around my building." Well, it's
[52:17] the railroad's property. So, I think we would want to avoid storing things
[52:22] within the railroad right away for a lot of different reasons.
[52:26] Um, what what mechanism do you propose to prevent that from happening?
[52:59] Five.
[53:19] » Okay. I think that's >> So somebody mentioned name there today.
[53:28] solid
[53:33] cover from the barrier that in most of that in
[53:43] that has overgrown trees that have been there for very very long.
[53:56] So, I guess it'll be a matter of because part of this is ensuring that we have an
[54:01] accurate record should there be any need for enforcement field verification in
[54:05] the future. Not that you're going to do anything wrong, but um the the plan
[54:09] right now shows the wood line a bit further out and you can drive around the
[54:14] building and you've got some lawn area next to the pavement. So, I think Mr.
[54:20] Lamoth's recommendation or something similar is a good one again
[54:25] to keep your activity on your property, keep it defined. If somebody from the
[54:31] township needs to go out and and verify that you're working where you're
[54:34] supposed to be working, then we all know what space that is.
[54:39] » Um,
[54:42] right here.
[54:57] Yeah. No, I'm not I'm not asking you to define the edge of the existing woods.
[55:00] I'm talking about the top and the bottom basically.
[55:05] » Yeah. Um
[55:09] » now, um one more followup for whoever would like to answer. We've talked about
[55:14] how there's a pond and the undeveloped part of the property is is wet. Do you
[55:19] have any concerns about storing what I assume is fairly heavy equipment on a
[55:24] unstabilized grass area when you have some rain or snow over the winter and
[55:29] the ground gets saturated? Um, is that going to be an issue for your business
[55:34] for the site? It would be if I I I've been at this
[55:40] building three or four times a week for the last six months since this was start
[55:47] um I don't so where I would go I mean there's there's a point where you know
[55:53] unless something I don't see
[55:58] you know would have to be something like I we had a ton of the past month I've
[56:02] gone during the come back to or however it works stays
[56:07] in that pond there. I'm sure it grows out a little bit more but doesn't come
[56:10] anywhere near the area and obviously that's my
[56:16] the risk I would have if I we're very even where I am right now familiar with
[56:22] every time there's the last 12 can't be best there
[56:28] » and we have to work we have to go we're so weather dependent because this is
[56:32] that we're always in there we're always looking to see what's going on and
[56:36] there's threat of flash flooding have the grave. We bring energy to what we
[56:40] feel is the same thing as we go. So got something we always
[56:47] ready to make, you know, whatever change.
[56:50] » Okay. Um and then keep thinking of additional questions. So the um proposed
[56:58] outdoor storage, we've got containers that are on site, we've got amusements
[57:02] on trailers. Would you be willing to limit it to things that are either
[57:07] containerized or fixed on trailers? No pallets, no loose chairs, tents,
[57:13] equipment that are just kind of scattered around.
[57:18] » Okay. So, the outdoor storage would be strictly
[57:22] fixed trails. We have three dumps that have slow.
[57:34] » Okay. But I think you know defining the area, keeping things orderly, keeping
[57:40] things, you know, so that they don't don't sprawl out and cause any issue
[57:45] with the neighbors. So, um, you know, Mr. Sharon, with with the testimony that
[57:51] we've heard, I think that um you know, there are some improvements that are
[57:55] being proposed here compared to the existing site certainly with enhancing
[57:58] the buffer to the neighbors. You know, the zone permits a variety of uses that
[58:04] may be more intense than what's happening here. You could have a factory
[58:07] operating 247 here as a permitted use with a daily truck traffic coming to and
[58:14] from. Um so you know I think on the on the balance the uh proposal with some of
[58:21] the things we've discussed to limit storage limit the scale and location and
[58:26] enhance the buffering in particular um do advance several purposes of zoning
[58:31] and we'll improve the visual environment on the property. So um you know I think
[58:37] on in in those ways I think um we've worked towards some some improvements.
[58:42] » Thank you. Um, I'm I'm a little concerned we don't have a plan on uh
[58:47] lighting, landscaping, signage, things like that. But let's see. Uh, I know the
[58:53] answer is what's how does it work when that doesn't happen? So, should the
[58:58] board choose to approve? How do we get these plans and who has
[59:04] the authorities at the engineer to uh approve of the fence and what have you?
[59:10] We can make it a condition of approval that they provide a lighting plan
[59:14] subject to Mr. Kovar's review of approval. Uh if they needed a
[59:21] landscaping plan again that could be subject to approval of our board planner
[59:25] or engineer. So there could be conditions of
[59:29] » very good. So what is the process then? Jeremy, the only thing I would um
[59:36] in terms of putting language in the resolution that defines the area where
[59:42] the storage area, the outdoor storage area, I just like to me a little.
[59:47] » Okay. >> Because I' I've heard different numbers
[59:49] and >> are you talking about a measurement or
[59:53] what will be stored there? >> No, no. The the area in which those the
[59:58] containers and the trains and where everything is going to be stored. Can
[1:00:02] you address that at all? >> Yeah, you could do that. I mean, I think
[1:00:06] the area that we're talking about between the buttons is the area that I
[1:00:10] would primarily using to put my trucks and monkeys
[1:00:17] um on property. The problem is it isn't a uh forsighted square area. It's an
[1:00:25] area that suits. other than say as part
[1:00:32] that's the best way find otherwise you you'll have a snake like
[1:00:37] and bounds So
[1:00:40] » sir,
[1:01:19] I think
[1:01:30] be nice to have a plan. Um, counselor, are you satisfied with
[1:01:36] that? later. Sure.
[1:01:40] » May I add one comment for the board's consideration? So, we we talked briefly
[1:01:44] about deer resistant shrubs and whether or not they are truly deer resistant and
[1:01:50] so forth. Um, and I leave it to Mr. Priodoro about the right way to craft a
[1:01:57] potential condition, but I think there should be some obligation to maintain
[1:02:01] those buffer areas. If shrubs get eaten, they get replaced with something else.
[1:02:08] Or if the shrubs prove that they just can't be sustained, then maybe that's
[1:02:12] when a fence becomes required. Something to, you know, we plant shrubs today,
[1:02:17] deer eat them tomorrow and just throw up our hands and say, "Oh no." Um, but I
[1:02:21] think some condition to maintain that long term one way or another.
[1:02:25] » Okay. I do believe counselor draining as you speak.
[1:02:32] many uh counselor, are you okay with uh the
[1:02:37] explanation or you want something more detailed?
[1:02:40] » We'll go with that. >> Okay.
[1:02:44] Any questions of the board?
[1:02:54] » I believe no, we didn't we didn't limit. We
[1:03:00] suggested Well, that the per hour be higher than
[1:03:05] the block.
[1:03:11] That was pretty much what we agreed to.
[1:03:25] » This will also apply to future, right? >> Sure.
[1:03:29] Echoing there. climbing rock walls and other
[1:03:34] things.
[1:03:39] Shane
[1:03:50] plans
[1:04:04] What are the water weapons?
[1:04:18] » Well, I think it it was addressed. It's in a flood zone K or something.
[1:04:24] 0.0. Can you explain that?
[1:04:30] standgo.
[1:04:35] » I think we put on our
[1:04:41] » I think it was K. I think it was 0.03 and I said what the heck is that
[1:04:49] even was 3%. What is that? >> Your application says zone X
[1:04:56] file.
[1:05:00] English somebody >> English
[1:05:05] » uh frequency of
[1:05:12] event could happen but it's not
[1:05:23] has the present owner discussed that with you at all as being an issue.
[1:05:27] said the building. >> Very good.
[1:05:31] » All I can do is like
[1:05:39] nothing seems to make but there is still standing order that seems to be
[1:05:49] that much. >> Any additional questions or comments?
[1:05:54] » Mr. Chair, if I may, just getting back to the variances. So, in our board
[1:05:59] planners report, the first variance that's been identified is a minimum 40ft
[1:06:04] buffer with landscape screening is required adjacent to a residential use.
[1:06:08] The current storage is located plus or minus 20 ft from the neighboring
[1:06:12] residential property without any landscape screening. So, you've
[1:06:16] addressed that, right? Yeah. storage is going to be relocated
[1:06:22] so it doesn't encroach into the 40ft buffer.
[1:06:24] » Right. >> So that variance is being eliminated.
[1:06:28] » Yeah. >> Any existing conditions will remain as
[1:06:32] they are but for purposes of our outdoor storage they will not require that
[1:06:36] variance. >> The only other varian is in regard to
[1:06:39] the number of on-site parking spaces and I think Mr. We've represented that it
[1:06:46] would be somewhere between 20 and 25.
[1:07:05] » You're you're including the pickup trucks and what have you.
[1:07:18] I'm just saying we have to pick a number. So if it's So if you want if
[1:07:22] it's 20 then the board should be prepared.
[1:07:28] » Right. So if if it is >> I believe we I believe you uh submitted
[1:07:33] the 27th >> 27.
[1:07:36] » Where do we go with that? >> Right. But in testimony, you may not
[1:07:41] have 27 spaces, right? Isn't that what it has to do?
[1:08:05] All right. So, that's for the board. You want
[1:08:08] » 27? >> You want to go with 27?
[1:08:12] » That's That's the That's
[1:08:16] » Let's go with 27. >> 27.
[1:08:23] » All right. Any other comments before we open up the meeting to the public?
[1:08:27] » Um, this is a this is a comment and a point of information. Um, I'm not sure
[1:08:33] if the current owner informed you, but there is a cat colony on the property
[1:08:38] now. And there's a local um, organization called the Save the Animal
[1:08:44] Rescue team that uh, visits that site, I think, on a weekly basis. Uh don't be
[1:08:50] surprised if they come and ask you for access to the property once a week or so
[1:08:55] to feed those cats.
[1:09:02] » All right. >> Uh
[1:09:07] » I don't know what the counselor rules are.
[1:09:10] » Anyway, I won't even go there. Um all right, we're going to open the meetings
[1:09:15] to the public. If you wish to address your board, you'll come up to the
[1:09:19] podium. Not yet. Not yet. Um counselor, our attorney will ask you
[1:09:25] for your name. He will square you in because it's just not comments.
[1:09:29] Everything spoken here is testimony. This is a quasi legal form.
[1:09:36] » Okay. >> So, Mr. Chairman, the members of the
[1:09:39] public will be able to comment in andor ask question.
[1:09:43] » Yes. Thank you. Not yet.
[1:09:48] You can stand. Don't talk. >> All right. May I have a motion to open
[1:09:51] up the meeting to the public? >> Some move.
[1:09:53] » All those in favor? >> I
[1:09:55] » I >> Thank you.
[1:09:59] » One second. Please raise your right hand. You swear or affirm the testimony
[1:10:03] that you're about to give before this board is going to be the truth, the
[1:10:06] whole truth, and nothing but the truth. Okay. Please tell us your name, spell
[1:10:09] your last name, and then give us your address.
[1:10:11] » Bonnie Nerato. C A N A R I ATL
[1:10:18] » and your address me >> 67 Dewey Avenue
[1:10:24] that's
[1:10:28] » okay. So my concern was I got the letter um of course where I'm upset and nervous
[1:10:33] because where my house is it's directly across from the brush company. I can see
[1:10:39] the whole back of it. And basically since we moved there 23 years ago, it's
[1:10:44] been quiet, very quiet. Does have a travel trailer delivered once in a
[1:10:49] while, but that's it. So now when I heard that this equipment would be
[1:10:54] coming into my residential area where I'm sure you all own homes, understand
[1:11:00] you don't want any of this in your backyard or in your front yard.
[1:11:05] I was concerned about more trap, more noise and also I have to look at that
[1:11:13] every single day. I didn't buy my house with carnival. I bought it with an empty
[1:11:20] spot where we had no problem.
[1:11:25] So, I am very concerned and we're all very upset about that
[1:11:32] we have to deal with and I just hope you guys understand
[1:11:37] whether it's your house we're all having this
[1:11:42] I don't know noise. I don't know how much tra we're traffic constant I'm sure
[1:11:49] on the bus times in and out tractors big trucks um I deal with it once in a
[1:11:55] while with the brush company but it's once a week now it's going to be a lot
[1:12:01] more and um yeah not happy about
[1:12:06] when I tell you if I stand here I can see right the back
[1:12:13] so now every time I make White House state mit I had a deal with
[1:12:18] truck didn't wait and stand
[1:12:23] I reset there I did not by my health that's still a part
[1:12:33] just hope you all understand in my situation if this is your house
[1:12:39] » thank you for your comments >> chairman I have a question currently
[1:12:44] You're saying that a tractor trailer comes by once a week with the current
[1:12:47] establishment. >> They do their little delivery. They drop
[1:12:52] their stuff off and once in a while we do have a problem with them getting back
[1:12:56] out. Not often. Sometimes they're really big
[1:13:00] and they can't get out and they knock on doors
[1:13:05] to move. But it's basically quiet. Very quiet.
[1:13:11] The block's always empty. There's one car parked there. You don't see anything
[1:13:15] in the back to walk back there and be passed into
[1:13:19] the line. I'm not going to lie. And I never had a problem. I never did
[1:13:23] problem. Just I can't imagine looking at this and feeling with some restitude.
[1:13:36] You should welcome yourself by situation.
[1:13:39] Would you be glad to be Joe?
[1:13:44] » Thank you.
[1:13:52] » Please raise your right hand. Do you swear from the testimony you're about to
[1:13:55] give before this board is going to be the truth, the whole truth, and nothing
[1:13:57] but the truth? Please tell us your name, SP, and give us your address. It's
[1:14:01] Fiper. S L I K E R1. I just got a couple of questions.
[1:14:12] Yes, >> you're saying that uh I live on 41. So
[1:14:16] I'm not I'm right across from that first.
[1:14:20] So I'm looking at
[1:14:24] So now my question is are you going to be building
[1:14:28] across the back or in that block window?
[1:14:35] Oh, I mean basically like it's like it's basically like
[1:14:41] that would only look without going where you put
[1:14:46] back go backside you can't see from the street
[1:14:52] that's what I'm saying because I you're saying you really can't put enough on
[1:14:55] track how is he going to put all that stuff on back of the building with the
[1:14:59] track side then you can't get around the property itself.
[1:15:06] » He's not he's not speaking of putting it in the back of the property. It's going
[1:15:11] to be on the side >> back of the property.
[1:15:13] » There's no room. >> It's the tracks,
[1:15:15] » right? >> His front more like his front door,
[1:15:18] their front door is like, you know, like a park there. The
[1:15:23] trucks come in and they go around the tracks, then they back in slowly. That's
[1:15:28] what I was saying. He got he's got he says like 16 of Where's he going to be?
[1:15:33] He can't fit all that stuff in front of his book.
[1:15:38] » That's what I'm saying. Am I going to be seeing that out my my front window
[1:15:40] looking across the street like >> chairman? I think his testimony was he
[1:15:44] was going to store it next the current storage containers.
[1:15:48] » Yeah. >> Which is further south than even merit a
[1:15:53] entrance is itself. >> Right.
[1:15:55] » But you guys are talking brides now. He's got 14 trucks instead. nine trucks
[1:16:02] or six box trucks and three big nine vehicles
[1:16:06] box trucks 16 foot box trucks a straight shot and uh wel
[1:16:12] think if he hit anything you know where you can't see and you said you're going
[1:16:17] to put gates right are you going to put gates up on that side what about the
[1:16:20] other side
[1:16:23] putting dates on one side
[1:16:28] Right. I >> think the intention of the gates is to
[1:16:31] hide the aesthetics more than it is to not allow access.
[1:16:39] » That's we we tried to do something with that street years ago. So you couldn't
[1:16:43] do nothing that far get around you wanted
[1:16:50] that
[1:16:59] » Miles Avenue is down to the left as I'm looking at the property.
[1:17:05] He says, "What does Miles Avenue actually look like visually?"
[1:17:09] » He said, "The dirt dry place." I said, "No one no one moves." The guy
[1:17:16] that's there now and used to plow, but he used to plow out out to the street
[1:17:21] out next sto.
[1:17:27] » Okay. >> That was that was an
[1:17:30] » Yeah. >> I just wanted to let you know that
[1:17:33] that's all. Thank you for your comments. Anyone else wish to address the board?
[1:17:52] » Hey, raise your right hand. Do you swear affirm the testimony you're about to
[1:17:55] give before this board is going to be the truth, the whole truth, and nothing
[1:17:58] but the truth? >> Okay. Please tell us your name, spell
[1:18:01] your last name, and give us your address and then we'll go to the next person.
[1:18:04] » My name is 75.
[1:18:08] » I'm sorry. How do you spell your last name?
[1:18:09] » G L O R I A uh D U Q U Q U Q U Q U Q U Q U Q U Q U Q
[1:18:15] U Q U Q U Q U Q U Q U Q U Q U Q U Q U Q U Q U P.
[1:18:19] » And your address? >> 75.
[1:18:21] » 75. Okay, >> I bring my daughter.
[1:18:26] » Okay. I try to speak English, but I better
[1:18:30] speak English. Thank you. >> Welcome.
[1:18:32] » All right, let's let's swear you. You swear from the testimony you're about to
[1:18:36] give before this sport. It's going to be the truth, the whole truth, and nothing
[1:18:38] but the truth. Please tell us your name. Tell your Well, obviously you have the
[1:18:43] same last name. Oh, okay.
[1:18:50] And your address? Okay.
[1:18:58] Uh I have a different question. The first one is that uh the the streets uh
[1:19:05] they say in the future the traffic is heavy and I think in the streets is for
[1:19:11] residents only for traffic and in the future.
[1:19:19] The old roads they come to pay for that district. We pay for the same streets.
[1:19:25] That is my first question. And in my second question is then
[1:19:32] the noise I have at 76 years old leaving my house my mom and the noise is
[1:19:39] different with uh 7 in the morning 7 at night different hours the drugs going on
[1:19:46] back and the other question is the traffic is starting at 7 in the morning
[1:19:51] and some say busy times or season sometimes in
[1:19:56] March April and June that is the time that the
[1:20:00] kids going to the school my daughter going to the school she walk
[1:20:05] to the school at that time and the traffic in that area for now it's
[1:20:10] difficult for now the people is scary all the time and that time with the the
[1:20:15] drugs what happened with the the kids and the dogs I have actually I have
[1:20:20] three dogs what happened with that with the all dogs that we have in the island
[1:20:25] we can't around in the morning if it's all the
[1:20:29] drugs. That is my question and my daughter
[1:20:55] not much love.
[1:21:01] » You welcome to school three.
[1:21:10] » Thank you.
[1:21:21] You swear affirm the testimony that you're about to give before this report
[1:21:24] is going to be the truth, the whole truth, and nothing truth.
[1:21:26] » Please tell us your name, spell your last name, and give us your address.
[1:21:29] » My name is Max Markour, M A R Q A R. I live at 92 Bergen Drive.
[1:21:37] Uh, so I'm I border a lot too. I don't have the same concerns the immediate
[1:21:42] neighbors. Um, also I've been a customer public business that's proposing good
[1:21:47] business there. So no issues there. Um, my issue is the fact that the heavy
[1:21:53] heavily forested area that we talked about that we said it's unusable. Uh,
[1:21:59] it's pretty easy to when you buy five acres I own property outside of Little
[1:22:04] Falls as well. Uh, you buy five acres, it's incredibly rare that anyone's
[1:22:09] buying five acres. not used for anything. Uh obviously I'm
[1:22:16] a little bit spoiled. We we borrowed trees. It's great. Aesthetic is fine. Uh
[1:22:20] it's obviously wetland. Most of my questions were answered
[1:22:24] quick. Uh my statement really just kind of dives into the fact that to appease
[1:22:30] the other immediate neighbors, myself and my immediate neighbors want to make
[1:22:34] sure that the town and it seems like everybody's on the same page, but we
[1:22:37] want to make sure the town looks out for the fact that no part of this five acres
[1:22:41] becomes any kind of storage or junkyard. As far as so one set of neighbors, we're
[1:22:47] not now going to store this in the back where I look out my back window and I'm
[1:22:51] looking at broken down rides or any of that. As long as this doesn't become a
[1:22:54] junkyard, we're not talking about tapping into sewage. Um, future
[1:22:58] development obviously at a later point be a major concern for us because there
[1:23:02] is water table there. Uh, when we have bad storms, I'm outside. I'm in the I
[1:23:07] think I'm in the 500 yard link. So, if we click there's one 500 year chance,
[1:23:12] whatever. Sometimes that could happen more frequency during some of the bad
[1:23:15] storms we've had in the nine years that I've been there. My water in the
[1:23:18] backyard doesn't drain already. So any development of that property could be
[1:23:22] major problem later on. Uh but myself and our neighbors on the other side of
[1:23:27] that we have over on the Bergen side. We want to make sure that this doesn't
[1:23:31] become well okay it's just woods. We can store anything we want there. We can put
[1:23:35] the containers there. It's out of sight for the immediate neighbor that look at
[1:23:38] the property. Uh that's really our only concern. We don't want to be looking at
[1:23:42] all the rides. Sure nobody does obviously. Uh
[1:23:46] but from what it sounds like it doesn't sound like immediate plan to expect that
[1:23:49] it's just that we want to make sure that everybody here's our concern of 5 acres
[1:23:54] is a lot of area 5 acres is a lot of area specific to live right and every
[1:23:59] town in New Jersey builds we all build we build up I don't know how many 5acre
[1:24:03] lots even exist in this township and probably no is my guess I could be wrong
[1:24:09] uh so my our concerns are you know obviously in the future we address what
[1:24:13] may need to be addressed But we also want to just make sure we don't start
[1:24:16] cutting trees down. Make it a space where now we can store to appease ex
[1:24:21] neighbors and now why neighbors get forgotten about. We're staring at a
[1:24:24] storage junkyard even though it's marsh and a lot of it is wetland. Doesn't seem
[1:24:29] like any of us know why the water is there but the pond is there, the
[1:24:32] standing water's there. Uh so as long as that's understood, you know, that's
[1:24:39] pretty much the statement that I have to make is that we don't want to have
[1:24:41] storage junkyard broken down rides or all of the containers now being pushed
[1:24:45] off into what's being called unusable or forest there. You know, you buy five
[1:24:50] acres, you want to use part of that five acres, there's zero way that I think
[1:24:54] that we're just going to buy five acres not. Uh so as long as that's taken into
[1:24:58] consideration, you know, myself and many neighbors, we discussed it. you know, we
[1:25:02] don't have other objections. If it's going to status quo stay the same, you
[1:25:06] know, for our end, we get it. But as long as it's the same page as us as far
[1:25:11] as we don't want to just start taking part of this land and using it for
[1:25:15] storage just because it's out of sight, out of office, but then it's an arsenal.
[1:25:19] So, I appreciate the due diligence.
[1:25:24] » Thank you very much. >> Yeah, Mr. If I if I just may quickly so
[1:25:28] uh in regard to those last few comments that's why we worked very hard to define
[1:25:33] the area of outdoor storage. So Mr. Markbart in regard to your questions
[1:25:38] about uh storing it during that in the area of that forested area or expanding
[1:25:43] it back there. Um if the board were to approve it and naturally the board has
[1:25:47] not rendered its decision yet. If that were to take place, um we've heard and
[1:25:53] the applicant stipulated into the limited area in which there would be
[1:25:56] outdoor storage. In terms of any future development
[1:26:01] right now, uh nothing is proposed, but in the event there would be the
[1:26:05] applicant seeks to develop further on the property, they would have to come
[1:26:09] back before this board. So, thank you. >> Anyone else?
[1:26:17] No one else coming forward. I close the meeting to the public.
[1:26:22] Any questions or comments from the board?
[1:26:26] » Yeah, chairman. I'd like to make a brief comment. My comment is thinking
[1:26:31] considering this application. Lord needs to consider that this is an
[1:26:37] industrial zone and that the industrial zone in Little Falls has a pretty
[1:26:41] expansive list of what would be permitted on site. And we need to
[1:26:48] consider what this use is compared to what uses that would otherwise be
[1:26:52] permitted are on the site and determine if this is a use that is better than
[1:26:57] what many others could be or if this is worse. And in again just encourage the
[1:27:02] board to consider that you know in an industrial zone there's a pretty
[1:27:05] expansive list of things that would be permitted and Mr. Maria, do you know the
[1:27:09] hours of operation in industrial zones in Little Falls?
[1:27:13] There is none. Right. So theoretically, use of this property at any time is
[1:27:20] permitted in the industrial zone because there is no restriction on the times of
[1:27:25] operation. And if a factory wanted to open here with 53 ft tractor trailers
[1:27:33] coming in on the property regularly and if they wanted to operate round the
[1:27:37] clock, we would have very little ability to prohibit that type of use. And we
[1:27:44] have an applicant here who has made some concessions this evening.
[1:27:50] » Thank you. Any additional comments?
[1:27:54] Any comments from our professionals? >> Nothing.
[1:28:00] » Engineer. No. Trainer. >> Nothing further. Mr. Chairman,
[1:28:05] » Mr. Brigley Duro, you have any uh comments? You've already covered a lot,
[1:28:10] » right? I just um the applicant is seeking site plan approval.
[1:28:14] » There are two variances required in connection with this. Uh that's for the
[1:28:18] outdoor storage and also the number of on-site parking spaces where 41 are
[1:28:24] required and 27 spaces would be proposed.
[1:28:30] I'm going to quickly run through some of the conditions that
[1:28:34] that I have based on uh comments and stipulations on behalf of the applicant.
[1:28:41] One would be the containers would be uh painted or cleaned and refurbished to
[1:28:47] improve their appearance. There would be nothing stored on top of
[1:28:51] the containers. There'll be a limit of uh the limit of four containers which
[1:28:56] currently exist on the site. They're going to add additional
[1:29:01] landscaping or planting arbor vidy trees. the nature and sufficiency of
[1:29:05] which would be subject to review and approval of our board planner. There'll
[1:29:10] be no work outside of the building before 7 a.m.
[1:29:14] They're going to add landscaping to the northerly side of the property, provide
[1:29:18] a visual buffer. Uh they're going to move the storage
[1:29:23] containers outside of the 40ft buffer area with plan arboriting.
[1:29:29] Also, they provided uh we went through the technical process of our board
[1:29:34] engineer and they're going to comply with these with the technical comments
[1:29:39] contained in the board engineers review report.
[1:29:44] Um I believe they stipulated there would be no kind of pallets or anything else
[1:29:48] stored outside other than what they represented to be stored on on the
[1:29:51] record tonight and they will maintain buffer areas on a long-term basis.
[1:30:02] Um, did you refer to two variances or three?
[1:30:06] » There were three variances originally. One was eliminated because they are
[1:30:12] relocating the containers out of the buffer.
[1:30:16] » Thank you. >> So, there's two two for outdoor storage
[1:30:20] and for the north side parking spaces. >> Very good. Any discussion among the
[1:30:24] board members? May I have a motion?
[1:30:30] » Chairman, I'll make a motion that we approve this application based on the uh
[1:30:35] points and facts articulated by our board attorney.
[1:30:39] » Thank you. May I have a second?
[1:30:47] » Please pull the board. >> Mr. Barry,
[1:30:51] » yes. >> Mr. Kash,
[1:30:52] » no. >> Mr. Luke Damiano.
[1:30:55] » Yes. Miss Pataldo, >> yes.
[1:30:58] » Mr. Posus, >> no.
[1:31:00] » Mayor Damiano, >> yes.
[1:31:02] » Councilman Spila, >> no.
[1:31:04] » Mr. Dolan, >> yes.
[1:31:07] » Chairman Kilpatrick. I'm
[1:31:10] » not counting.
[1:31:13] I lost track. Interesting. Chairman votes. Yes. Is the motion approved,
[1:31:18] Valerie? >> Six. Yes.
[1:31:22] Three. No. Oops. >> Thank you.
[1:31:27] Thank you. >> Welcome to the call.
[1:31:38] » Uh let's finish up our business. Is there any old business before the board?
[1:31:44] Any new business? I have a motion for adjournment.
[1:31:48] » So move. >> Second.
[1:31:50] » Second. >> All in favor?
[1:31:52] » I. We are turn work.
