[0:24]
of Zoning Appeals meeting to order.
[0:27]
Um
[0:28]
Meg, can you call the roll?
[0:31]
>> Sure.
[0:33]
Uh
[0:35]
Seth McCormick?
[0:36]
>> Here.
[0:37]
>> Charlie Goodall?
[0:38]
John Mingle?
[0:39]
>> Here.
[0:41]
>> Fred Woods is absent and Bob LaMee is
[0:43]
absent. Or is anybody on Zoom?
[0:47]
And then Attorney Willoughby is here.
[0:49]
And that concludes roll.
[0:52]
>> Okay.
[0:52]
Can we all stand for the Pledge of
[0:54]
Allegiance?
[0:58]
» Okay.
[0:59]
>> I pledge allegiance
[1:00]
>> to the flag of the United States of
[1:02]
America, and to the republic for which
[1:05]
it stands, one nation under God,
[1:08]
indivisible, with liberty and justice
[1:11]
for all.
[1:19]
» Okay, for for old business,
[1:22]
um
[1:23]
we have uh consideration of the written
[1:26]
findings and facts for the public
[1:28]
hearing on the William and Mary Buckley
[1:30]
2011 Juneway
[1:32]
uh drive petition that was granted last
[1:36]
meeting.
[1:38]
Um I'll open the floor to discussion
[1:40]
about uh
[1:41]
>> Do you want to approve minutes real
[1:42]
quick?
[1:44]
>> Did I skip that?
[1:45]
>> Yeah.
[1:45]
>> I think
[1:47]
>> Sorry to interrupt.
[1:48]
>> read my own agenda.
[1:50]
>> I move to approve minutes of last month.
[1:52]
>> I second it.
[1:54]
>> All in favor say I. I.
[1:57]
>> So it passes.
[2:00]
Now on to old business.
[2:02]
So again, um I'll open the floor to
[2:04]
discussion regarding
[2:06]
um the findings and facts as proposed.
[2:09]
Um and if anybody have has any changes
[2:11]
or or wants to make a motion to approve,
[2:13]
we can we can go from there.
[2:16]
Did Did every Does everybody have a copy
[2:18]
of
[2:21]
» I I can go print them if you need them.
[2:23]
>> Here. You guys have them in like
[2:25]
>> I
[2:25]
>> They were circu- They were circulated by
[2:27]
email, I think earlier today.
[2:30]
>> Would you like the hard copy? Does
[2:32]
anybody need it?
[2:33]
>> Yeah. Here. Well
[2:34]
>> You were able to look at it?
[2:35]
>> Yeah, you can read this one. I've read
[2:37]
it.
[2:37]
>> Oh.
[2:38]
>> And Charlie can read that one.
[2:39]
>> Okay.
[2:40]
>> So we'll take a second.
[3:45]
Okay.
[3:46]
>> Pretty much as we discussed last
[3:47]
>> I agree.
[3:48]
>> last month, right?
[3:49]
>> Okay.
[3:50]
So I'll I'll uh entertain a motion to
[3:52]
approve um um
[3:55]
these findings and decisions.
[3:57]
>> Second.
[3:59]
>> All in favor say aye.
[4:00]
>> Aye.
[4:01]
>> Okay, so we'll need to sign that
[4:02]
original copy
[4:04]
um
[4:05]
before you leave. And so, that we can
[4:07]
get it to uh
[4:09]
the petitioners and so they can take it
[4:11]
to the building commission.
[4:14]
All right.
[4:21]
So, now moving on, we have um
[4:25]
the preliminary hearing um for John
[4:28]
Smith at 1701 Story Avenue.
[4:31]
Um Meg, would you like to read the um
[4:34]
the summary of the of the of the of the
[4:36]
petition into the record.
[4:41]
» John Smith, 1701 Story use and
[4:43]
development standard variance petition
[4:45]
requesting variance from the
[4:47]
requirements of section 154.052,
[4:50]
construction and location standards for
[4:51]
accessory uses and structures, and
[4:54]
section 154.057,
[4:57]
schedule of district regulations
[4:59]
for setback height, zoning lot size, and
[5:01]
coverage. Petitioners seeking to replace
[5:04]
an existing shed and lean-to.
[5:06]
And the preliminary hearing is set to
[5:08]
open this evening.
[5:09]
>> Sorry.
[5:12]
>> For the record, Fred Woods is now in
[5:14]
attendance, and I didn't include a
[5:16]
building representative, Joyce Schmidt,
[5:18]
in the original roll call either, who is
[5:20]
also present in the audience.
[5:25]
So, I'll hand it back to you, Seth.
[5:27]
>> Okay.
[5:28]
So, how this works is it's a little
[5:30]
weird of setup. You have to go up to the
[5:31]
podium. Um you have to and you're you're
[5:34]
the builder, right?
[5:35]
>> Yes.
[5:35]
>> Okay. So, just state your name. Um are
[5:38]
you the are you the one presenting?
[5:40]
Are you the one going to give kind of
[5:42]
like Okay. Uh
[5:48]
Mhm. Okay.
[5:57]
So, what you'll have to do is
[5:59]
you'll have to go up to the podium and
[6:01]
then you'll just state your name and
[6:02]
your address
[6:03]
and then the floor is yours in terms of
[6:05]
the presentation and then after he's
[6:07]
finished you can go up there and just
[6:08]
state your name
[6:10]
and we'll go from there. Okay? And you
[6:12]
have to push
[6:14]
there's a little button at the base here
[6:15]
that says push and a little green light
[6:17]
should come on
[6:19]
to make sure your microphone's on that
[6:21]
way that record is
[6:27]
the bar
[6:27]
>> It's the long bottom.
[6:29]
>> It's a bar that goes across the bottom.
[6:32]
Oh, I got it. Okay. There you go.
[6:35]
Am I live?
[6:37]
We don't know.
[6:39]
But but I the Zoom people may know.
[6:42]
Okay, green light?
[6:43]
That's green light. Then you're then
[6:45]
it's on.
[6:46]
>> And you're Okay, great. There you go.
[6:47]
>> Thanks. Yeah, no, I appreciate you all
[6:49]
coming to the tonight.
[6:51]
I hope you had power and
[6:53]
didn't have big trees down like a lot of
[6:56]
people in our neighborhood.
[6:57]
And I want to thank Larry Wall in
[7:00]
particular for
[7:02]
his guidance early on in this petition
[7:05]
or
[7:06]
what do I call it a
[7:08]
request.
[7:09]
>> Mhm.
[7:10]
>> Uh
[7:12]
He came to the house and gave a lot of
[7:13]
good advice and Meg was really helpful
[7:16]
in digging out papers for us and
[7:18]
appreciate all of them.
[7:20]
Um
[7:22]
So, I'll give you some background
[7:24]
information
[7:26]
and then
[7:27]
uh
[7:28]
I'll show how our topography
[7:32]
lot topography dictates where the garage
[7:34]
must be placed.
[7:37]
And
[7:39]
finally I'll explain why the garage is
[7:41]
necessary. Then Bob
[7:43]
Bartel will get up and show you the
[7:45]
drawings and whatever
[7:47]
of the plans.
[7:50]
So, we're at 1701 Story Avenue in Long
[7:53]
Beach.
[7:54]
Uh Story Avenue, even though it's an
[7:56]
avenue, only has four homes.
[7:59]
And ours is one of them. Our house was
[8:02]
built in 1941.
[8:05]
It's a split log
[8:07]
uh cabin that we just love.
[8:10]
And and uh
[8:16]
So, I just want You guys may have
[8:18]
already a copy of this survey.
[8:21]
I see some of you have them.
[8:24]
But
[8:25]
Did everybody get one?
[8:27]
Okay, so you can see that
[8:29]
uh
[8:33]
I don't know if
[8:34]
Okay, so you can see our house.
[8:37]
It's in
[8:39]
This guy here is the current shed.
[8:42]
But
[8:43]
And it's all in the back.
[8:46]
Like I told you guys earlier.
[8:49]
Uh are the um
[8:53]
dunes that's behind us. I mean, it's
[8:56]
pretty, but it's quite fast rising.
[8:58]
And even though we have We have
[9:00]
basically two lots.
[9:02]
There's a lot of width here,
[9:04]
but not depth.
[9:06]
So, that's why we're limited to
[9:09]
basically where the shed is
[9:12]
uh to to put a garage.
[9:14]
And
[9:16]
uh our plan is to replace the shed with
[9:19]
the garage.
[9:21]
The shed's been there for a number of
[9:23]
years.
[9:26]
Okay, so you guys have all that stuff.
[9:37]
I got some notes here. Sorry.
[9:41]
Okay. Now, as to why we need the garage.
[9:43]
Over the years,
[9:45]
we've weathered seemingly
[9:47]
annual
[9:49]
uh
[9:50]
dents from the uh limbs of the oak
[9:53]
trees. So, you guys all know that
[9:55]
they're very heavy
[9:56]
uh falling on our cars. And we just kind
[9:59]
of
[10:00]
suffer through that. But, 2 or 3 years
[10:02]
ago, we had
[10:04]
a hail storm.
[10:06]
I don't know if you remember it or not.
[10:07]
Big hail.
[10:08]
We had over $3,000 of the damage in our
[10:10]
cars. And that was the kind of the last
[10:12]
straw.
[10:13]
We realized we needed a garage.
[10:16]
That's why we're we're respectfully
[10:18]
requesting a garage building permit
[10:21]
to protect our vehicles from future
[10:22]
damage.
[10:25]
And as I said, it would be built in the
[10:26]
place of the existing sheds.
[10:30]
And the setback
[10:32]
You see the
[10:34]
setback of the house
[10:36]
is here.
[10:38]
And actually, the house is pretty close
[10:40]
to the road as it is. And we made sure
[10:42]
that the shed setback was the same as
[10:45]
the house setback.
[10:47]
And we would do that for the garage as
[10:48]
well. So, it wouldn't be any closer to the
[10:51]
road than the existing shed.
[10:58]
And uh let's see.
[11:02]
We're going to make sure the
[11:03]
architecture of the uh garage
[11:07]
matches that of the house. So, it's
[11:09]
going to be brown split log.
[11:11]
Uh and
[11:13]
as such, we think it will increase the
[11:15]
value of our
[11:16]
property and also our neighbors'
[11:18]
property.
[11:19]
Certainly the neighbors on Story Avenue
[11:21]
and probably others nearby.
[11:25]
It'll It'll It'll just look good.
[11:28]
And I am done.
[11:31]
Uh
[11:32]
unless you have a question of me, I'm
[11:33]
going to turn it over to Bob.
[11:37]
I think we're good.
[11:38]
>> Anyone have a question?
[11:41]
>> I just want to make sure that
[11:43]
the current setback is 15
[11:46]
on the plan.
[11:48]
>> The from what I'm reading on the plot of
[11:49]
the current setback of the shed is 15 ft
[11:53]
and the front and it sort of I walk by
[11:55]
it there's the entrance to the shed is
[11:57]
all So, if you're looking straight onto
[11:58]
it, it's over sort of the right.
[12:00]
>> Yes. Right. That would be that was me.
[12:08]
» Um, yeah, but but so the the front of
[12:12]
the garage the garage door will be 15 ft
[12:15]
and be directly towards Story Ave,
[12:18]
right? That's what I read read this.
[12:20]
Okay.
[12:21]
So, no different in setback, but your
[12:24]
entrance will change from the right as
[12:26]
you're looking at it.
[12:27]
>> Yes.
[12:27]
>> To the front.
[12:28]
>> Exactly.
[12:29]
>> Got it. Okay.
[12:31]
Thank you.
[12:32]
>> You bet. Anything else?
[12:35]
Okay, Bob.
[12:37]
>> Uh, what one more thing. Which line on
[12:40]
this
[12:41]
on the topographical portion uh, most
[12:45]
similarly represents the uh,
[12:48]
landscaping stones that are
[12:51]
>> Oh, the landscaping
[12:52]
>> Would that be this line right here?
[12:56]
No, no, no, the ones that go around
[12:58]
right now they wrap around the back of
[13:00]
the uh,
[13:01]
>> Could be about right, Bob. More like
[13:03]
right here.
[13:03]
>> So, so it's in here?
[13:05]
>> Yeah.
[13:06]
>> Okay.
[13:07]
>> We'll have to dig out a little bit of
[13:08]
the dome
[13:09]
and we'll have a concrete wall in the
[13:11]
back so it acts as a retention wall.
[13:14]
You know, it's dressed and everything,
[13:16]
but it it it it will sit back in the
[13:18]
village.
[13:19]
>> So, those those stones you would
[13:21]
you'd lift those out of there?
[13:26]
Oh, I'm sorry. Go ahead. Go up there.
[13:29]
>> Yeah, I'm sorry.
[13:30]
Uh
[13:31]
yes, uh it'd be
[13:33]
the elevation of the new
[13:35]
>> state your name for the record?
[13:36]
>> Oh, my name is Robert Barfell with uh
[13:38]
Chicago Renovators.
[13:39]
>> Okay.
[13:40]
>> And uh the new elevation of concrete
[13:43]
floor would be about the same elevation
[13:45]
as the existing shed.
[13:48]
Pretty much. So, it won't be up higher.
[13:51]
It's just that we're seeking uh
[13:54]
a variance for the setback cuz if we
[13:57]
were stuck with a 30-ft setback, it'd be
[14:00]
buried in the dune, you know, and we
[14:02]
just, you know, that's why we're asking
[14:04]
for a variance.
[14:05]
>> Imagine.
[14:07]
>> And then instead of it being a shed,
[14:09]
it's it would be a garage.
[14:11]
And stuff, so that's why we're asking
[14:14]
for this variance.
[14:17]
But it the architecture will be
[14:20]
uh matching the existing house. We'll
[14:22]
keep that continuous and everything. And
[14:26]
uh we will have We're We're not tucking
[14:27]
up uh
[14:29]
we're not past the limit of the
[14:32]
lot coverage.
[14:34]
There, I think we're at 30%
[14:36]
per that drawing that uh
[14:38]
that you that you
[14:39]
>> Is the lot coverage analysis on this
[14:41]
drawing?
[14:43]
>> Yeah.
[14:44]
It's on the
[14:48]
» 26.76%
[14:53]
You know, with with proposed patio
[14:54]
extension.
[14:55]
>> It's that
[14:57]
little square at the top of the drawing
[14:59]
of the site plan.
[15:14]
» Right.
[15:15]
>> Yeah.
[15:17]
yeah. No, I'm I got it. Yeah.
[15:19]
>> Yeah, so so we're at 30% of the of lot
[15:22]
coverage.
[15:23]
Not 35.
[15:24]
>> And and what does that include?
[15:26]
>> That includes our our new driveway.
[15:29]
It includes the existing residence.
[15:32]
And the garage itself.
[15:34]
>> Okay. And all the patios and walkways
[15:37]
and all the landscaping
[15:39]
stones and
[15:40]
>> Right.
[15:41]
>> Yeah, cuz I mean the the lot coverage
[15:44]
calculation has to include like where
[15:46]
you have the flagstone walk
[15:49]
over here and over here. And then it
[15:50]
sounds like you're trying to I mean
[15:51]
you're not here for the new kitchen, but
[15:53]
the new kitchen has to be added into
[15:54]
that. A deck has to be added to that.
[15:56]
>> I I did that the first time.
[15:58]
>> Okay.
[15:59]
>> We made a presentation.
[16:11]
» Okay.
[16:17]
I just want to add one other thing. Uh
[16:19]
around the existing shed we've got a big
[16:22]
platform of stone.
[16:24]
That's all going to be gone.
[16:25]
>> Okay.
[16:26]
Well, and I mean we're we're asking this
[16:28]
question cuz I I I don't know um when
[16:30]
the last time someone from the building
[16:32]
commission was out there, but there was
[16:33]
some concern that there would be a lot
[16:35]
coverage issue. And so, um if you're
[16:38]
here with us now
[16:40]
>> Yes.
[16:40]
>> you should be asking for I mean if
[16:41]
there's going to be a lot coverage
[16:42]
issue, you should be asking for that
[16:44]
variance now.
[16:45]
Um because if there is a lot coverage
[16:47]
issue, let's assume we grant your
[16:49]
petition, right?
[16:50]
>> Yes.
[16:50]
>> And we only grant what you asked for.
[16:52]
Um so, if there is a lot coverage
[16:55]
issue, you're going to have to come back
[16:56]
to us for that variance as well. So,
[16:59]
that's why I'm asking the question and I
[17:00]
just want to make sure that you guys are
[17:02]
you know
[17:03]
>> Lot coverage is not the our problem.
[17:05]
>> Okay.
[17:05]
>> The problem is the 30-ft setback.
[17:07]
>> Okay.
[17:07]
>> Yeah.
[17:10]
» And what's the distance from the back of
[17:12]
the garage to the lot line?
[17:16]
» Uh
[17:25]
The front of the garage is going to be
[17:26]
at 15 ft from the road.
[17:29]
>> Yeah, I got that.
[17:30]
>> the the depth of the garage is 26 ft.
[17:33]
>> Okay.
[17:34]
>> by 26.
[17:35]
>> And then from the back of the garage to
[17:37]
the
[17:39]
rear lot line is what?
[17:41]
>> Oh.
[17:43]
Uh
[17:44]
you know Oh.
[17:51]
» You know the number now, but it's a long
[17:52]
ways.
[17:53]
>> At least 20 ft, but
[17:55]
>> Oh. Oh, yeah.
[17:55]
>> More than 20 ft.
[17:57]
>> Yeah.
[18:00]
I believe it's 40 ft.
[18:02]
>> Well, I mean if this is 48.4, then
[18:05]
that's only going to be at most 22,
[18:06]
right?
[18:07]
>> Yeah, this is 26.
[18:10]
>> Yeah, that's going to be So, it'd be
[18:11]
less than 22, right?
[18:12]
>> Yeah, I'm thinking it's more like
[18:15]
18 or
[18:16]
>> Yeah.
[18:16]
>> Something like that.
[18:17]
>> Yeah, you're But that's nearly straight
[18:18]
up, right?
[18:19]
>> Almost.
[18:21]
>> Yeah.
[18:25]
so uh
[18:27]
And the issue here is that that distance
[18:30]
is
[18:32]
also an issue, too.
[18:33]
>> Right.
[18:34]
>> Uh for the rear setback.
[18:36]
Um beyond that is um there's a house up
[18:39]
there.
[18:39]
>> Right.
[18:40]
>> And that house
[18:43]
also needs to
[18:45]
not have issues over uh
[18:48]
this activity.
[18:49]
>> Right.
[18:50]
>> And it could. So, how do What's the uh
[18:53]
notion as to how you protect that house
[18:55]
while this is going on? And what will
[18:58]
you do to um actually secure the dune?
[19:01]
Are you going to Are you going to drive
[19:03]
piling?
[19:04]
>> No, we don't need to drive piling in at
[19:06]
all.
[19:06]
>> Okay.
[19:06]
>> We're we're just simply going to
[19:08]
excavate. I'm trying to keep the the
[19:10]
elevation floor
[19:12]
as high as we can we don't have to dig
[19:14]
out that much but we will be putting a
[19:16]
concrete wall on the on the back wall
[19:19]
and then backfilling against that so we
[19:21]
won't have erosion
[19:23]
and we'll probably end up taking taking
[19:26]
out a couple small trees
[19:29]
>> It looks like two trees got to go.
[19:30]
>> Right, in front and on the side.
[19:33]
>> Um
[19:35]
so that con rear concrete wall will that
[19:38]
be full height?
[19:39]
>> Yes.
[19:40]
Yeah, that'll be
[19:43]
about an 8-ft wall
[19:44]
>> minimum.
[19:54]
Will that be taller than the garage? In
[19:56]
other words, will that go up into the
[19:59]
gable end or
[20:00]
>> No, but I don't see that we need need to
[20:02]
do that.
[20:19]
» Have you talked [clears throat] to your
[20:20]
neighbor has have there's been
[20:22]
discussions with the neighbor above
[20:23]
about the plans?
[20:26]
>> No, we haven't made that presentation
[20:28]
yet.
[20:28]
>> Okay.
[20:29]
>> I thought that was what we did at the
[20:31]
next meeting.
[20:37]
» Will the garage have a second floor and
[20:38]
is that a living area?
[20:40]
>> Storage area.
[20:42]
>> Yeah, unfinished.
[20:43]
Storage area.
[20:51]
» And the gable runs which way?
[20:54]
>> Uh
[20:55]
according to the plan it's going to run
[20:57]
north and south.
[20:59]
>> So parallel to the story.
[21:01]
>> Yes.
[21:02]
>> So the ridge board will go this way.
[21:05]
>> Yeah.
[21:06]
So sorry, believe you you got some
[21:08]
drawings in front of you right there Mr.
[21:10]
Woods.
[21:11]
You can see the elevation
[21:13]
there.
[21:16]
>> We haven't seen those.
[21:17]
>> Oh.
[21:49]
The back of the garage is elevation
[21:54]
for the contour
[21:56]
is at 640.
[21:58]
And so we are going to be
[22:02]
>> [clears throat]
[22:02]
>> excuse me
[22:04]
at the elevation of
[22:08]
638
[22:10]
for the floor.
[22:24]
So we should have about 2 ft of concrete
[22:27]
sticking up out of that that doing it on
[22:29]
the back wall.
[22:32]
And that'll be of course reinforced
[22:34]
concrete.
[22:36]
10 in wide, 8 in wide.
[22:40]
» Does this elevation just a mirror image
[22:42]
of this or
[22:43]
>> Oh, you got it.
[22:49]
I touched the east
[22:51]
at road.
[22:52]
>> I got tricked there as to what the
[22:54]
directions were.
[23:56]
» Now, this is very very likely 16 ft.
[24:02]
Right there.
[24:03]
>> Yeah.
[24:05]
>> It's almost exactly the same as this
[24:08]
measurement.
[24:09]
>> Okay.
[24:21]
I guess we're asking for front yard and
[24:23]
back yard
[24:25]
variants.
[24:28]
Is there a minimum for a back yard?
[24:31]
>> Um I'd I'd I'd have to look at the code.
[24:34]
Um I mean the the the 30
[24:37]
ft front setback is in 154.
[24:42]
052. Um
[24:46]
and then the the rear setbacks are in a
[24:48]
different part of the code. They're in
[24:49]
the appendix and I don't have a printout
[24:51]
with that with me.
[24:54]
Do what?
[24:56]
>> 20 ft?
[24:59]
» From
[25:00]
>> the zoning district
[25:02]
residential
[25:03]
>> Okay.
[25:04]
So, yeah, one we'll need to see
[25:07]
the length from the back of the garage
[25:11]
to the rear property line.
[25:13]
Um
[25:14]
and you'll you know, you'll need to ask
[25:16]
for a variance for the benefits under 20
[25:18]
ft.
[25:18]
>> Okay.
[25:19]
>> Sure. Yeah.
[25:20]
>> Um
[25:28]
» Well, if you
[25:30]
Yeah, if you scale the drawing, it's we're probably going to be a little
[25:33]
less than 20 ft.
[25:34]
>> Okay.
[25:36]
So, just I mean, and you know, we would permit you to like ask for that
[25:41]
variance as well.
[25:42]
>> Okay.
[25:42]
>> Um you'd have to you'd have to
[25:43]
essentially amend your petition.
[25:46]
Um but there as long as you meet the
[25:47]
notice requirements, then that's
[25:50]
allowed.
[25:51]
Um so, do that work pretty quickly. Um
[25:54]
and and and then you don't you don't
[25:55]
need to submit anything. You can submit
[25:57]
an amended application, but like by the
[25:59]
public hearing, we'd want to be able to
[26:00]
see that.
[26:01]
>> Would you like to see a section with
[26:03]
doing coming down and the elevations of
[26:06]
the grades there as I have?
[26:09]
>> Yeah, that that would have that would be
[26:10]
helpful.
[26:10]
>> Yeah, we can do that. Sure.
[26:12]
>> Okay.
[26:13]
>> Seth, it needs to be prior to the public
[26:15]
hearing, 2 weeks by the deadline.
[26:18]
>> Right. The amended application would
[26:19]
need to be right. But I mean, like yeah,
[26:21]
okay. So, let's get this straight cuz I
[26:24]
may have just misspoke and I want to
[26:25]
make sure it's clear. You'd have to
[26:27]
submit the amended application at least
[26:29]
2 weeks before the public hearing. That
[26:31]
would need to contain all of the
[26:32]
documents that we're asking for.
[26:34]
>> Sure.
[26:34]
>> Um
[26:35]
you know, our you know, the evidence of
[26:38]
how far it is from the rear to the the
[26:41]
rear of the garage the proposed garage
[26:43]
to the rear of the lot line.
[26:44]
>> Okay.
[26:45]
Um and then that way we could have time
[26:47]
to review it so we could ask you again
[26:49]
questions about it if we had questions
[26:50]
at the public.
[26:51]
>> Okay.
[26:52]
>> Sure.
[26:57]
» Yeah, well
[26:58]
we'll determine that when we go out
[27:00]
there and actually measure it.
[27:03]
>> Well, I I guess I would have
[27:06]
I'm basing my comment on uh
[27:09]
Mr. Tate's drawing.
[27:12]
Tate.
[27:14]
So, uh
[27:16]
Tate. Yeah.
[27:19]
to the extent that
[27:21]
he's not to scale, uh I suppose it could
[27:24]
be anything.
[27:35]
» [clears throat]
[27:37]
» Yeah, I I saw the stakes.
[27:40]
Yeah.
[27:44]
But, you need to know that now. You you
[27:46]
don't need to know that when uh
[27:48]
you start tearing things apart and say,
[27:50]
"Oh, look at this."
[28:01]
» It'll be close, cuz if you're you got 48
[28:04]
and 1/2 over here, I mean
[28:08]
with the drawing, it just it looks
[28:09]
tight.
[28:13]
» I scale.
[28:15]
>> Yeah.
[28:17]
there's Yeah, there's no reason
[28:18]
for us all to debate it. They've got
[28:20]
scientific tools that can show us. So,
[28:23]
um
[28:25]
Okay. Um does anybody have any further
[28:28]
questions?
[28:32]
» I think somebody should review the lot
[28:33]
coverage and make sure that uh all the
[28:36]
pieces have been covered. And
[28:37]
understanding that uh
[28:39]
she made the point that
[28:41]
some of it is going to get gobbled up
[28:43]
with the the garage anyway.
[28:45]
>> Yeah.
[28:45]
>> So, uh the added amount might not be
[28:47]
that big, but
[28:48]
all this stuff in here is pretty well uh
[28:52]
covered even though it's uh
[28:55]
got stuff on it. Yeah.
[28:58]
Okay.
[29:00]
>> And so you want to change the lot
[29:02]
coverage.
[29:03]
>> No, I don't want to change it. I would just want it to be
[29:06]
right.
[29:07]
>> Okay.
[29:07]
>> No, what I what I base my these
[29:09]
calculations on up here is on the
[29:12]
drawing where
[29:13]
you see that there it shows the deck
[29:15]
previously.
[29:16]
We haven't they've built a kitchen on
[29:19]
there and that part of their patios
[29:21]
there, so I based that on Tate's criteria.
[29:26]
>> Yeah, whatever it is, it is. I
[29:28]
>> Right, yeah. And then
[29:30]
I subtracted for the shed, the existing
[29:32]
shed.
[29:33]
>> Yeah, I get it.
[29:34]
>> We just, yeah, added, you know, the
[29:36]
difference.
[29:37]
>> Um if anything's missing, it's right
[29:39]
here, I would assume. Yeah. So that's
[29:42]
that is in the
[29:44]
as part of the ordinance.
[29:53]
When when this
[29:56]
What does the east elevation look like
[30:00]
with uh the backdrop of the property
[30:02]
behind it?
[30:04]
>> I didn't
[30:05]
uh
[30:07]
I don't think I have the elevation
[30:08]
right.
[30:09]
>> Um
[30:10]
it's not
[30:12]
>> Maybe that east elevation somebody could
[30:14]
just take some shots and put some
[30:16]
reference lines on it to say Okay, this
[30:18]
is you know, top of the hill or whatever
[30:21]
it is.
[30:21]
>> Yeah.
[30:22]
>> This is the house behind it or
[30:24]
>> Okay.
[30:24]
>> whatever.
[30:29]
» Okay.
[30:32]
All right, so um
[30:34]
we can move this onto public hearing, so
[30:37]
it can happen next month.
[30:40]
The alternative is
[30:42]
um you know, you could
[30:44]
go do your homework and come back for a
[30:46]
preliminary hearing and then go to, you
[30:48]
know, go to a public hearing the
[30:49]
following month.
[30:51]
Um, because the timetable, the 2-week
[30:53]
timetable is very real. Um, and so it,
[30:56]
you know, I I will vote how we vote,
[30:59]
but, uh,
[31:00]
you know,
[31:01]
um, if you want to make that decision
[31:03]
now, I mean, I mean, if you want us to
[31:04]
start voting on whether it should go to
[31:05]
public hearing, that's fine. If you want
[31:08]
to postpone, you know, continue this
[31:10]
here this preliminary hearing till next
[31:12]
month to see if you need to do at make
[31:15]
any more of requests, that's fine, too.
[31:17]
Um,
[31:18]
so we'll follow your lead on that.
[31:20]
>> No, we should be good. I I produce, uh,
[31:22]
the information 2 weeks prior to the
[31:23]
next meeting.
[31:24]
>> Okay.
[31:30]
Um, the date of the public hearing, do
[31:32]
you have that?
[31:33]
>> I can look it up on my phone.
[31:35]
In a month, I believe.
[31:36]
>> It's a I mean, it's the next
[31:38]
>> It's September 9th.
[31:41]
And And Bob, you can any amended pages
[31:45]
could can be submitted. You do not need
[31:47]
to do the entire, if the drawing is
[31:49]
going to be amended at all, you would
[31:51]
resubmit that.
[31:52]
>> Okay.
[31:52]
>> And any documents, but you don't have to
[31:54]
do all of them.
[31:55]
>> Right.
[31:55]
>> Just any amended ones.
[31:57]
>> Okay.
[31:57]
>> Thanks.
[31:58]
>> Yeah, so it's, you know, 29 days from
[32:00]
now.
[32:01]
>> Okay.
[32:03]
Um, okay.
[32:05]
All right. Well, then we'll we will
[32:06]
close the preliminary unless you have
[32:08]
more you want to say.
[32:09]
Okay. Does anybody else have any any
[32:11]
comments or questions before we discuss
[32:12]
it?
[32:16]
Okay. So, we'll close the preliminary
[32:17]
hearing and then we can have our
[32:19]
discussion. We can vote to
[32:21]
um, move this on to public hearing or we
[32:23]
can,
[32:25]
um,
[32:26]
you know, request additional
[32:28]
information.
[32:31]
I say that moving on to public hearing.
[32:34]
>> Yeah. It's is a not a not a further
[32:36]
preliminary hearing. I uh
[32:39]
>> I think we actually need a little bit
[32:40]
more information.
[32:42]
>> Okay.
[32:43]
>> That's my opinion.
[32:46]
» And is it Okay. And is it You would
[32:48]
propose then to delay this? Or
[32:51]
>> Yeah, come back with the rest of the information and see
[32:55]
where we're at.
[32:56]
I don't know.
[32:56]
>> Right.
[32:57]
>> Okay.
[32:58]
>> Or I guess we can do it at that time,
[33:00]
too. We can move just move it ahead if
[33:02]
you want.
[33:04]
>> Well, no. I mean, I think I think this
[33:05]
is this is one of those you know,
[33:07]
scenarios where like
[33:09]
uh you know, we we do feel like we need
[33:12]
more information, right?
[33:13]
>> Um that the they have the opportunity to
[33:16]
provide it to us at the before the
[33:17]
public hearing.
[33:19]
Um but then if we don't have it, then
[33:21]
we're either denying the petition
[33:23]
because we don't have the information we
[33:25]
need and it's their burden of proof to
[33:26]
establish it, or we're continuing the
[33:28]
public hearing
[33:30]
so that they can provide the
[33:31]
information. Um
[33:33]
so if you'd rather have you know, this
[33:35]
is really a the preliminary hearing is
[33:37]
really for them to get a preview. In my
[33:39]
view, it's to get a preview of what
[33:40]
we're going to do at the public hearing.
[33:43]
Um
[33:45]
but if if you if you're not comfortable
[33:46]
moving this to public hearing without
[33:48]
the information we have, then that's our
[33:50]
I mean, that's our prerogative and
[33:51]
that's our decision.
[33:52]
>> Would I be supplying that additional
[33:54]
information like 2 weeks before the
[33:56]
public hearing?
[33:57]
>> Well, that's the question, right?
[33:59]
>> right.
[34:00]
>> I got you.
[34:04]
Yeah, I mean, I think we clearly can't
[34:06]
make a
[34:06]
If this was a public hearing, we really
[34:08]
we could not make a decision right now,
[34:10]
right?
[34:11]
So, we'd be faced
[34:11]
>> kind of my thought.
[34:16]
» I I'm clear at the with the information
[34:20]
with the exception of that the back, you
[34:23]
know, setback, which we'll just find
[34:25]
out.
[34:25]
>> Right.
[34:26]
>> You know, what it whether you're going
[34:27]
to need a variance or not, that's that's
[34:28]
pretty binary. You're they're going to
[34:29]
need it or you're not.
[34:30]
>> Sure.
[34:31]
>> Yeah. Um and lot coverage, which it
[34:33]
looks like you're well within limits,
[34:35]
but we we just need a a definitive
[34:37]
number on. So, I'm I'm pretty clear if if but it'll be incumbent upon you to
[34:42]
make sure we get that information.
[34:45]
>> Okay.
[34:46]
>> Yeah, and I mean, my my thought would be
[34:48]
is if you're very confident that you can
[34:50]
get us this information,
[34:52]
um, I would I would
[34:55]
be okay with moving it on to public
[34:56]
hearing, but if you don't get it in on
[34:59]
time or you don't get it to us, then we
[35:01]
shouldn't move you know, we're going to
[35:03]
have to continue it.
[35:04]
>> Right.
[35:05]
To the next month or whatever.
[35:08]
Yeah, well, give just give us a chance
[35:10]
to get it 2 weeks before the public
[35:12]
hearing and
[35:13]
we'll go from there.
[35:16]
That's all right with you guys.
[35:18]
>> Well, if you set it for public hearing,
[35:20]
you have other timeline requirements for
[35:23]
the paper notice, uh, and then the
[35:26]
mailing to neighbors.
[35:28]
>> Right.
[35:29]
>> So, you've got to get all of that going
[35:31]
>> Right.
[35:31]
>> at at kind of the same time.
[35:33]
>> As well.
[35:34]
>> If you feel confident in that.
[35:36]
>> Yeah.
[35:37]
>> So, the 2-week deadline, that is not
[35:39]
your only, uh, deadline that you'll have
[35:41]
for the public hearing.
[35:43]
>> Okay.
[35:43]
>> So, just keep that in mind.
[35:49]
» John and Joan, do you you guys
[35:50]
understand?
[36:09]
» Well,
[36:09]
>> Yeah, it's just an for a variance for
[36:11]
the for the setback for the front.
[36:13]
>> Right.
[36:14]
>> If your building also require and what
[36:16]
you know, that's that's one thing we can
[36:18]
approve, but if you also need a setback
[36:20]
for the back,
[36:21]
>> Right.
[36:22]
>> that that doesn't come included.
[36:24]
You have to ask for both of them.
[36:26]
And if you don't ask for both and you
[36:27]
start building your garage, you're going
[36:28]
to be out of compliance.
[36:30]
>> Well, yeah, well, worse, you're not
[36:32]
going to get a permit, right? You're
[36:33]
going to be back at the building
[36:34]
commission, and they're going to deny
[36:35]
the permit because you don't have a
[36:36]
variance.
[36:38]
This is really more belts and suspenders
[36:40]
than it is anything else.
[36:43]
If it's necessary.
[36:44]
>> We're not sure.
[36:45]
>> Or we already got
[36:46]
>> Wasn't on the
[36:47]
>> It
[36:47]
doesn't show us that, but if you scale
[36:50]
off of that print, it would suggest that
[36:53]
you you need that.
[36:55]
Uh
[36:57]
the print might be not to scale.
[37:00]
In which case, okay.
[37:02]
That's fine.
[37:04]
Yeah.
[37:09]
Sure it does.
[37:14]
But it's got the garage right on it.
[37:15]
It's It's got the garage right on top of
[37:17]
the old shed.
[37:18]
>> He's got the future. Yeah, proposed.
[37:21]
>> It's right.
[37:23]
I just did a rough math on my phone. If I could If you guys don't mind.
[37:29]
Speaking [clears throat] from that that
[37:31]
outline, that's a 48.4
[37:35]
across. I just subtracted the amount of
[37:37]
the 26-ft garage, and what looks to be
[37:40]
about 3 ft of the front driveway,
[37:44]
and we're at 19 and 1/2 ft right now.
[37:47]
>> Yeah.
[37:48]
>> So, if we
[37:49]
need to make the garage 25 ft or whatever, we can do
[37:53]
that, too.
[37:55]
That would be within that 20 ft.
[37:57]
Correct?
[37:58]
>> Well,
[37:59]
whatever, you just want to ask for what you need.
[38:04]
Sure.
[38:05]
So,
[38:07]
>> But if they're saying right now that
[38:09]
they'll adjust the
[38:11]
construction details
[38:13]
based upon the rear setback. I mean, I
[38:15]
That's
[38:15]
>> Then you won't need a variance. Yeah,
[38:16]
then you won't need a Then you won't
[38:18]
need a second variance.
[38:19]
>> Right. So, we
[38:20]
>> But that's your call.
[38:21]
>> We got to be 20 ft from the rear lot
[38:23]
line.
[38:23]
>> Exactly.
[38:24]
>> Yeah. Okay.
[38:26]
Well, you know, I mean it sounds to me
[38:28]
like
[38:29]
that issue's not necessarily before us
[38:31]
right now. The only issue before us is
[38:32]
the front side back. And it sounds like
[38:35]
they either have confidence that they
[38:37]
meet the rear setback requirements or
[38:39]
they'll amend or they'll shorten the
[38:41]
garage. So,
[38:43]
um with those kind of
[38:45]
thoughts in mind, I'm I would be okay
[38:47]
with moving this forward to
[38:49]
um
[38:50]
a public hearing for the sole purpose of
[38:52]
the one variance you're asking for.
[38:56]
>> Well, there was actually two. There was
[38:57]
154 right 107 and
[39:00]
>> But they're both related to the correct,
[39:01]
but they're both related to the front
[39:02]
setback.
[39:03]
>> Right.
[39:03]
>> Yeah.
[39:04]
>> And for use.
[39:06]
>> Correct. Okay. Um
[39:13]
Okay.
[39:15]
I'm not sure.
[39:17]
I'm sorry.
[39:18]
Okay.
[39:23]
All right. So, I'll I'll make a motion
[39:24]
to move this on to public hearing.
[39:27]
>> I'll second it.
[39:28]
>> All in favor say I.
[39:30]
>> I.
[39:32]
>> Okay. So, that's four.
[39:34]
All right. So, we're moving on to public
[39:35]
hearing.
[39:36]
The public hearing will be September 9th
[39:38]
at 7:00 p.m.
[39:39]
Um I think Meg you
[39:42]
there's the posting and advertise and
[39:44]
mailing requirements for
[39:46]
uh noticing the meeting to
[39:48]
the people you know, within the radius.
[39:51]
Um I think Meg has a packet that you can
[39:54]
use.
[39:55]
>> It's just in the information packet.
[39:57]
>> Okay.
[39:57]
>> All the information.
[39:58]
>> Is So, you'll you'll have to, you know,
[40:01]
give the green cards or proof of mailing
[40:02]
for all of that prior to the meeting and
[40:04]
meet all the other requirements
[40:06]
um to to to open the public meeting.
[40:09]
Um you know, and then if you need to
[40:10]
amend your your petition,
[40:13]
you need to do it within 2 weeks of of
[40:15]
that deadline.
[40:16]
>> Okay.
[40:19]
» Can do.
[40:25]
» All right. So, um
[40:30]
Public hearings are none. I'll entertain
[40:32]
a motion to adjourn the meeting.
[40:34]
>> So moved.
[40:35]
>> All in favor say I.
[40:36]
>> I.
