power, and glory forever. Amen.
[0:35]
» Pledge allegiance to the flag of the
United States of America and to the
[0:40]
republic for which it stands, one nation

[0:47]
justice for all.
[0:51]
» Roll call, please.
>> Peterson,
[0:54]
» present.
>> Michael Sullivan,
[0:55]
» here.
>> Stanley Zack,
[0:57]
» here. Darren Biggs
>> here.
[0:59]
» Slarski present. Chris Gilnik and Matt
Reese
[1:03]
» here. I'll make a motion we excuse Chris
Gnick.
[1:07]
» Okay.
>> All in favor?
[1:10]
» I opposed. Motion passed. Approval and
correction of the minutes. Uh did
[1:15]
everybody get a chance to review the
minutes for June 16th?
[1:18]
» I'll make a motion to approve.
>> Second.
[1:20]
» All in favor? I opposed. Motion passed.
I'll make a motion we accept the meds
[1:26]
for July 7th. Second. All in favor? I
>> opposed. Motion pass. Cindy, do we have
[1:32]
any correspondence?
>> No. Okay. Any public comments?
[1:36]
[clears throat]
[1:38]
Any public comments? Okay. Seeing none,
on to new business. The first item is a
[1:44]
master service agreement for
professional services by Bernandez for a
[1:47]
water rate study update for the BPA.
Well, these since we just got these, I
[1:54]
think we should hold them at least.
>> Yeah. Till I the first I saw this. So,
[2:00]
okay. If we can move actually the uh
[2:06]
actually at least the first four then
the tank resolution. I still have to
[2:11]
talk about that some. So,
>> okay. You okay with that?
[2:15]
» Okay. We'll just make a motion to
>> We have to make a motion to table this
[2:19]
table. Um, it's on the agenda, so you
can make a motion to table it. Okay,
[2:25]
I'll make a motion we table item 1
through 4. Is that okay with you guys?
[2:30]
» Yes, I'll second that.
>> Second. All in favor?
[2:32]
» I posted. Motion passed.
Okay. Item number five, a resolution
[2:39]
recommending the village council
authorize the village of Lordstown to
[2:42]
execute an agreement with utility
service co. industry for maintenance and
[2:47]
tank asset management for the village of
Lordstown own water storage tank
[2:55]
to approve it.
>> Do you think you want to move ahead with
[3:01]
this?
>> Yeah.
[3:03]
I don't think we got a choice.
>> Yeah. This is the gentleman that came in
[3:07]
and gave the presentation.
>> Yeah. Was it June 16th Aaron?
[3:11]
I think that the resolution or his
agreement said January 1st.
[3:17]
» Did I miss Am I wrong?
>> It's effective January 1st.
[3:22]
» I I Yeah, let me check the contract. I
think she's right though. I'm pretty
[3:27]
sure it said cuz I remember I do
remember him saying like this has to be
[3:30]
done in August, but yet the contract
date is January 1st is the way that it's
[3:34]
drafted. Mhm.
And I don't I don't know who requested
[3:40]
it, but number four under new business
was for them to review.
[3:44]
» Yeah.
>> For Dantis to review that. So, whoever
[3:46]
requested that,
that review has not been done or
[3:51]
authorized yet.
>> Okay.
[3:54]
» Do we need for Dantis to review it?
[3:59]
» I I don't see why you wouldn't.
>> Okay.
[4:03]
Where are you? Where where are we
referring to?
[4:06]
Number four.
>> Number four.
[4:09]
» Oh, okay.
[4:15]
I see. Yeah.
I mean, I could tell you this is
[4:20]
basically the same scope of work that
was previously approved by the BPA with
[4:25]
with some additional changes under the
master services agreement. But
[4:32]
yeah, Darren, if you're comfortable with
it, Matt, if you're comfortable with it.
[4:35]
I don't think you need Bernandez to
>> Yeah, I don't see it. It m It's the same
[4:40]
agreement. We're just switching it from
the 500,000 gallon to the 3 million
[4:44]
million.
>> Yeah, we canled the 500,000 one because
[4:47]
it was surface. So, we saved ourselves
some money until we got this up and
[4:52]
going. Warranties are all running out.
We need to get a agreement for the
[4:57]
maintenance, the wash outs, any anything
that needs it needs done with our new
[5:01]
tank now.
>> Okay.
[5:04]
» But do we need to uh instead of putting
number four on hold, should we just uh
[5:10]
remove it?
>> I would say I don't see a reason for
[5:14]
them to redo it. I mean, Darren and Matt
are okay with it.
[5:21]
» You want a motion on that?
>> Yeah. Originally when this was done
[5:25]
before I was solicitor, I know my the
former solicitor recommended doing a
[5:30]
request for proposal and having and and
having Verdantis review this
[5:36]
[clears throat] before we entered into
the initial master services agreement.
[5:40]
There are statutory exceptions that we
don't need to do that. We don't need to
[5:43]
bid. We don't need to go to request for
proposal. So it was kind of um
[5:47]
» So maybe they thought they had to review
it.
[5:50]
» That's how it was done last time. It's
it's an either or under the Ohio Revised
[5:54]
Code. We could do a request for proposal
or we could negotiate directly for these
[5:58]
services like we did here. And in fact,
even the first time I think in 2017,
[6:03]
there was a little bit of push back
within the village. Why do a request for
[6:06]
proposals? Pretty much the only company
that's going to really do this type of
[6:10]
work anyway. It's going to waste
everyone's time. So, the thought was
[6:14]
based on some of my emails to you last
month or and Darren as well, let's just
[6:18]
move forward. We don't have to by law do
a request for proposal. So without the
[6:22]
request for proposal process, I don't
know what Verdantis would be reviewing.
[6:26]
» Okay.
>> So we need to go back and review number
[6:31]
four completely.
>> Yeah.
[6:33]
» So I'll make a motion.
>> Yeah, that makes sense to me. So I guess
[6:38]
I'll make a motion not to do the master
service agreement.
[6:42]
» I'll second that.
>> Second. All in favor?
[6:45]
» I
>> I don't quite understand.
[6:48]
We're not going to have a master
agreement on the
[6:54]
» No, all this was is redandis was going
to review the contract. That's Yeah,
[7:01]
unless Darren unless there's something
else that they would need to review like
[7:04]
their this company's services or
anything for maintaining the tanks. My
[7:08]
understanding is the originally when
this was done they were just reviewing
[7:12]
the request for proposals and I think
there was only one response anyway and
[7:15]
making recommendations which we're not
doing this. There's nothing I could
[7:18]
think of that that would that we would
need them to review or uh any
[7:22]
maintenance problems or anything I have.
I I don't go through our engineers
[7:25]
anyway with that. So I I I I can't think
of anything where our engineers would be
[7:30]
needed.
>> Okay.
[7:32]
» So
>> it sounds like just a continuation of
[7:34]
the
>> contract. Yes.
[7:37]
» They haven't really there's been a few
other
[7:39]
» Yeah. We're just adjusting the contract
to a new tank.
[7:41]
» Exactly.
>> So Okay.
[7:44]
» So motion second. All in favor? All
right.
[7:47]
» I
>> I opposed. Motion passed. Okay.
[7:53]
So, number five. Are you okay with
moving forward with that? Send that to
[7:57]
council.
Yes. I'll make a motion we move the
[8:01]
resolution for the u
utility service company for the asset
[8:06]
management of the 3 million gallon water
tank. Okay. I'll second it.
[8:14]
Roll call.
do roll call since the resolution?
[8:19]
» No.
>> Okay. All in favor?
[8:21]
» I I posted motion passed.
>> Okay. Any other new business?
[8:29]
Seeing none.
Old business, utility department
[8:33]
building.
>> Very old business.
[8:35]
» Mark, I'm sure you have good news for
us, right?
[8:38]
» No.
>> Okay. [laughter]
[8:42]
Um
the mayor in part of her report last
[8:48]
night mentioned
that issue and essentially
[8:56]
it started with
this building over here and the move
[9:01]
over there and then um
the conungle building um
[9:09]
» tore
Yeah, but Matt uh told us some
[9:13]
information which she was going to put
that on hold. And then the third thing
[9:16]
she brought up is and it was actually
was in response to a residents what was
[9:22]
going on with the facilities
and with regard to
[9:30]
the BTA water department.
Um, see, and don't quote me, but it was
[9:36]
somewhere along the line that the the
water department could eventually move
[9:41]
into
>> fire department.
[9:43]
» The fire department and she and and the
fire chief are working on finding a
[9:51]
place for the new safety service
building. I don't know. I haven't had a
[9:56]
chance to speak with her anymore. Wasn't
wasn't there something about they were
[10:01]
going to hire a person to come in to
look at all the buildings and no the
[10:11]
only only person that that they've hired
so they me
[10:16]
um have done so far is the architects
for the library. Um, there has been a
[10:22]
suggestion that council do that, do a
comprehensive, but that hasn't been
[10:28]
decided. Um,
that I know. I don't know if you've
[10:32]
heard it, Matt.
>> Yeah, it's kind of goofy.
[10:35]
They're taking care of that and talking
about
[10:39]
looking for property for the fire
station.
[10:43]
» Fire and police station, right?
uh and then
[10:49]
Darren moving into the fire station, but
no
[10:55]
uh mention about what would happen with
this building. Now, there was no
[11:00]
discussion about that at all. And um
[11:07]
I can't [laughter]
I don't know what to say on that issue.
[11:10]
I I was under the impression that we
were going to come back cuz we had a
[11:13]
work session. I was under the
impression, which could be mistaken, you
[11:18]
know, that we were going to come back
and and uh do that again and see where,
[11:24]
you know, where we were at this point.
I don't know that that's going to occur.
[11:30]
But at this point, to answer your
question,
[11:34]
um
>> there is no answer. It sounds like to me
[11:38]
» the answer only answer I heard is when
the fire department moves
[11:43]
» uh the water department could move into
possibly
[11:49]
the old fire station.
>> But that would be I would think years
[11:54]
away.
>> I would think um just from and again
[11:59]
this is just from what I
>> don't even know where they're going to
[12:02]
put it.
>> No. Um, but uh I I would think that that
[12:06]
building that move for the fire
department is going to take several
[12:11]
years.
>> That's been my experience with fire
[12:15]
departments.
>> So then the water department would
[12:17]
probably stay here
>> on this building.
[12:21]
» Um, and I I'm not sure about that. But
again,
[12:27]
everybody's moving over there. There
will still be that office in the back.
[12:34]
uh for the water department.
[12:39]
Okay.
>> And honestly,
[12:42]
as I said, I was under the impression
that we would do another work session or
[12:47]
something along or maybe one of the
committees would handle uh the
[12:52]
discussion of the facilities, but I
haven't heard again. So,
[13:01]
any more questions on that?
Seeing none,
[13:05]
um item number two, Imperial Water and
Sewer Agreements. I know
[13:10]
» we're going to have a meeting down.
>> We're going to have a meeting down
[13:13]
another couple months, right, where we
talk about we talked about
[13:16]
» sometime in the fall. Yeah.
Okay.
[13:21]
Uh item number three, new 24 in water
line.
[13:26]
Darren, do you have any updates from
Chris?
[13:28]
» Not not major updates. I have seen some
emails where they're reaching out to
[13:33]
Ohio Edison checking on the easements.
Um but I think that's that's where
[13:39]
they're at trying to get on property and
see how they can make that whole thing
[13:44]
work.
>> Okay.
[13:45]
» Coming coming down that way other than
that.
[13:48]
» Okay.
So there if you're seeing emails that
[13:51]
means there's work being done behind the
scenes.
[13:55]
» I do have a question about
>> Matt
[14:00]
the right away on the um
uh MBSD property.
[14:08]
Uh because I'm doing some of the I'm
contracting land owners, but I don't
[14:12]
have to go see them, do I?
>> No. So, what we'll do is um and I I was
[14:16]
talking to MVSD's attorney, Tom Wilson,
about this. Um they've already consented
[14:21]
to this. What'll happen is once we
determine exactly where that line's
[14:26]
going to go, um uh Verdantis will need
to prepare the legal descriptions. Then
[14:33]
I'll incorporate those into formal
easements, and then those will have to
[14:36]
be approved by uh basically a vote of
the board at MBSD that'll be attached to
[14:42]
it. But they've been very MVSC has been
very clear. We're not going to share any
[14:46]
any of the expense of this or prepare
any of this stuff. You guys get it done,
[14:50]
send it to us, and we'll approve it is
basically what their representations
[14:53]
have been to us. But they're not going
out of pocket for anything. So once
[14:56]
Chris has that information as to where
exactly the line's going to be, I can
[15:00]
prepare the easement and then they'll
approve it by resolution for MVSD.
[15:09]
» Any more questions on that?
Item number four, clean energy future
[15:14]
Trumbo LLC sanitary sewer in Northtown
Ohio EPA PTI. I'm assuming probably no
[15:20]
updates.
>> Yeah, I mean there's no updates. We have
[15:22]
a scheduling order. Um hearing is not
until next May. So it's we're basically
[15:29]
with the appeal right now on that. So
>> Okay. Any questions from Matt on that?
[15:34]
» Uh rules and regulations governing water
use and service.
[15:39]
I didn't hear any updates from the
person on that. Okay.
[15:42]
» Um that was under new business number
three. That was one.
[15:45]
» Yeah, that's more the one that we held
up on. Uh item number six, Nile's bulk
[15:51]
water agreement. I don't have any
updates on that. The last time I talked
[15:54]
to Niles about anything was just
consenting to the 24in line and they
[15:58]
gave their consent um which didn't
require an amendment of the agreement.
[16:02]
So, I mean, if there's if you guys want
me to continue to push that issue about
[16:09]
getting clear language with Niles, I
mean, problem is this. We have we
[16:13]
already have a contract that's been
approved by our council and their
[16:16]
council. Every time I reach out to them,
there's no motivation from the law
[16:21]
director to really advance this at all
because they don't think that council
[16:24]
will approve an amendment or change to
the bulk agreement. So there there's not
[16:30]
much more I can do uh other than just
say here here's the changes that we want
[16:34]
but I've already revised the language in
the agreement and sent it to them and I
[16:37]
followed up with them and I just you
know
[16:40]
» I don't understand [clears throat] why
their council if they're interpreting it
[16:43]
for the largest portions of water we buy
at a cheaper rate
[16:50]
if if we go into this new line with
their beliefs that it's you you know,
[16:57]
MBSD rate plus 10% or whatever. They're
selling it to us cheaper. So,
[17:05]
I don't want to be negative, but we
could argue, well, no, we thought we
[17:07]
were going to get it for a lot less.
>> I mean, I' I've even pointed out to them
[17:11]
that not only is their interpretation
wrong, but they would we would have a
[17:15]
huge credit under their interpretation.
And I just I don't know if anyone's even
[17:19]
really like I don't even know if they're
really looking into this that much or if
[17:22]
it just goes in one ear, not the other.
>> Yeah. And that that's my uncertainty on
[17:26]
it is like as we build the sign and
prepare to build the sign that should be
[17:31]
set in stone. We should know
>> exactly where we're at.
[17:34]
» Yeah. Cuz you know, I hate to say this,
but right down the road is the city of
[17:38]
War. What would they sell us water for?
We don't want them to want to open that
[17:43]
agreement after the fact and then say,
"Well, we want to increase that water
[17:47]
rate." We know MBSD might be increasing
that rate. That's that's known. But
[17:53]
I think
>> yeah, I agree. I I'll push back and I'll
[17:57]
but I I will push back and I'll say, you
know, given this 24inch redundant line,
[18:00]
we need to make sure we get the language
cleared up in the agreement. But at the
[18:04]
end of the day, if they just keep
ignoring me, the only thing the only
[18:08]
real legal remedy would be to file an
action in court for a declaratory
[18:12]
judgment to have the court interpret the
contract for us. And I mean, that'd be a
[18:15]
lawsuit. Basically, it's it's where you
have two people that don't agree on an
[18:19]
interpretation of a contract say,
"Judge, we need you to decide what this
[18:23]
contract means." But if they keep
ignoring me, that's that's the only
[18:26]
legal remedy we have.
>> Yeah. And I can't,
[18:29]
» you know, force council to do on Nile
city council to do anything or force the
[18:33]
law director to present it to, you know,
the city.
[18:36]
» You guys want me to keep pushing and try
and see if you can get clarification?
[18:41]
» I would think so.
>> Yeah.
[18:44]
As it stands, it's in our favor.
>> Yeah. Yeah. I mean,
[18:47]
» if if we met with Nile, if their council
was giving them push back, our
[18:52]
interpretation is at a higher rate.
>> Yeah.
[18:56]
» I don't I don't see the resistance. I
mean, that it's a little bit backwards,
[19:01]
but I mean, it is how we interpret it,
the examples in the document, and you
[19:07]
know, like Matt said, it it is the way
>> Yeah. Yeah, it's written
[19:13]
» and and I provided them that breakdown
showing that we have a credit under
[19:16]
their interpretation. And I said, you
know, I know this is going to this is
[19:20]
difficult, I guess, maybe to convey to
council to approve. But me, if you show
[19:23]
them these numbers, they'll realize, you
know, that this is not somebody arguing,
[19:28]
well, we want to pay less or we want
more money back. We just want to be on
[19:31]
the same page with everybody, make sure
we have clarity.
[19:34]
» Um,
>> so I I will reach out to them again.
[19:37]
Okay.
>> Any more questions on that?
[19:42]
Seeing none, item number seven, Trumbo
Energy Center, Warren Waterline. And we
[19:46]
have an action item record drawings.
I do not think Chris has received the
[19:52]
drawings yet, I'm guessing.
Um I don't know if
[19:58]
Are we to the point that we need to have
Matt reach out to him to get the
[20:00]
drawings?
>> I think they said they were working on
[20:04]
them. It's just a matter of the time
that it takes to complete. I don't And
[20:08]
they were doing the rest. He said like
some of the restoration and
[20:12]
» I I would I'm not real sure. I don't
want to answer for Chris probably before
[20:15]
we ask Matt to do anything.
>> Yeah. I'd rather Chris say, "Hey, I'm to
[20:19]
the point that I need
>> Correct.
[20:21]
» Yeah.
>> You guys okay with that?"
[20:23]
» Yeah. But the part I don't understand is
you installed a water line.
[20:27]
» Yeah. They have drawings.
>> You have drawings. You have to have
[20:29]
drawings.
>> Yes, they have drawings.
[20:31]
» They just Well, put it over there. I
guess a little bit over there. I mean,
[20:34]
it's
>> Yeah.
[20:35]
» What's the You know, what's the problem?
I don't understand.
[20:40]
They correct any as built and then
>> that should update
[20:44]
» that should have been done long time
ago.
[20:45]
» Yeah, the water line's been in since
what? October, November.
[20:49]
So, yeah.
Okay, we'll hold off on that till we
[20:54]
talk to Chris. Uh, Trumbo Energy Center
sanitary sewer that's [clears throat]
[21:00]
» Yeah, that's that's same thing under the
EPA fuel.
[21:04]
» We could probably combine them too,
couldn't we? Yeah, I mean it's it's the
[21:07]
same thing. One plays into the other. I
mean, if we you know, we're saying they
[21:11]
shouldn't be able to discharge into Mud
Creek and that they should have to
[21:14]
follow our local or our rules and
regulations and discharge into our sewer
[21:19]
rather than in Trumble County. So,
>> okay.
[21:23]
» Okay. Any questions for Matt on that?
Item number
[21:28]
» just for clarification, you want me to
remove number eight and all you guys
[21:33]
okay?
>> Yeah, I'd say combine them. Yeah,
[21:35]
combined. [clears throat]
>> Uh, item number nine, proposed Hikon
[21:40]
Road waterline improvements.
[21:45]
So,
I've circulated you guys this master
[21:49]
funding agreement and I actually I spoke
to their uh attorney today uh as
[21:54]
recently as today.
There there's two main issues. Um,
[22:00]
so under this master funding agreement,
it's for the it's for the water line
[22:04]
that they're going to fund as well as
traffic control lights um that they're
[22:10]
going to fund.
The main issue is this 200,000 gall per
[22:15]
day. They're telling me, "Well, if you
guys can only commit to 200,000 gallons
[22:20]
per day, that's fine, but we don't want
there to be an exclusivity provision
[22:24]
where we exclusively have to buy from
the village because if we have other
[22:28]
tenants here on this in this facility
that have more water usage needs that we
[22:33]
can't provide to them under this
contract, we need to be able to go to
[22:36]
another source or remove the exclusivity
provision
[22:40]
and we don't we don't put a cap in there
on how much you guys are going to
[22:44]
provide, which nobody wants to do
because we don't know what their future
[22:46]
water needs are. We can't overcommit to
something. So, what we were proposing
[22:51]
when I was talking to her and I talked
to the mayor about this a little bit, we
[22:54]
were thinking maybe some middle of the
road language where we will get we will
[23:00]
provide exclusively up to 200,000
gallons per day. In the event that they
[23:05]
need more and we refuse to provide it
with provide them with additional water,
[23:10]
then
the exclusivity provision is removed for
[23:14]
any excess amount above the 200,000.
However, in the event that down the road
[23:19]
we're able to provide them more than
that 200,000, if there's a change in
[23:23]
course, change in decision,
then we have the right basically the
[23:28]
first option to to sell them the water
to sort of, you know,
[23:33]
» regardless even if they were buying off
of Warren, it still has to go through a
[23:39]
» right. Yeah. And and I've already
explained to them there's there's no
[23:42]
contractually there's no right. I mean,
the city of Warren and the village would
[23:45]
have to agree. correct
>> by you know the legislative authority
[23:48]
would have to approve another contract
and everybody's on the same page with
[23:52]
that at least the city of Warren and
Lordstown are based on the document
[23:55]
trail and I've explained that to them
and I don't think that they were aware
[23:58]
of that until a couple of months ago
because their lawyers are reaching out
[24:01]
to me saying is this true can you give
me yeah here's a letter from the city of
[24:04]
Warren acknowledging that the agreement
is terminated here's the contract
[24:08]
showing it terminated when GM ceased
operations any water supplies on an
[24:12]
informal basis that's not you know
there's no legal support for so they
[24:16]
understand that.
Um but yeah, their concern is committing
[24:22]
to ex, you know, agreeing that we're the
exclusive provider and at the same time
[24:26]
agreeing to a cap. They're worried that
they could hamstring themselves. I mean,
[24:30]
they have another tenant looking at the
facility and they don't even really know
[24:33]
much about that tenant when I talk to
them, let alone what their water needs
[24:36]
are or anything else. So, um,
>> with that being said, do they understand
[24:42]
that Warren supplied General Motors
water prior to Lordstown Energy C
[24:48]
Center's construction and then providing
2 and a half million gallons a day to
[24:53]
Lordtown Energy Center. I don't know the
capacity of the Warren line, but General
[24:59]
Motors left LAC come in. That line is
what feeds Lordtown Energy Center. The
[25:04]
longer they delay the construction of
the line around the plant, the longer
[25:08]
they may not have the water they need
for that future tenant. I just don't
[25:13]
want them to be like unclear. LEC pulls
a triple or quadruple the amount of
[25:20]
water that General Motors ever did at
its maximum.
[25:23]
» Yeah.
>> So, they may not have the ability to get
[25:28]
much more water regardless.
>> Yeah. Warren may not have the capacity
[25:32]
either. And that is exactly why they
acknowledge that the General Motors
[25:36]
contract and their commitment to that
site ended with when General Motors
[25:42]
left.
>> Yeah.
[25:43]
» So I don't I just want to be forthright
with Fox Con what whoever's over there,
[25:51]
you know, this has went on for months
and if they need that water soon they
[25:56]
held it up. I mean it's we're talking
about what we can provide. D can move
[26:01]
water different directions, but
>> yeah, I see they're ready to go there
[26:04]
because they got all the pipes on the
ground over there. All their water lines
[26:09]
are all sitting there staged that
they're uh they're redoing the fire loop
[26:13]
over there.
>> Yeah. Is that what they want?
[26:15]
» I believe so. Yeah.
>> I I have told them that you try to
[26:19]
explain with that loop going around. We
can supply from different both sides.
[26:25]
anywhere coming down Todd Avenue if they
got a break from Warline they're done
[26:29]
until
>> they're done. Yeah,
[26:30]
» they're done. I have told them that.
>> But I stockp doesn't know that. Fox
[26:37]
» I I can't answer that. I I was talking
to Foxcon. Correct. Where it went from
[26:42]
there. I don't you said Sony was coming
in the next council meeting.
[26:47]
» Next council meeting they said that what
is the name of it? suffering.
[26:53]
» Yeah, they're coming. Sean
council,
[26:58]
» I believe so. He's out of DC, right? I
believe it's Sean.
[27:01]
» Yeah.
>> Yeah. The mayor and I spoke. So, this is
[27:04]
the second component. So, there's
getting this paragraph rewarded is the
[27:08]
only thing holding up at least, you
know, massaging the language of this
[27:11]
agreement. But the other concern is that
just all of these data center rumors
[27:17]
that we've been hearing and we've been
contacted by a company called DSG Group
[27:21]
says we're hiring employees for the
Foxcon facility to build a data center.
[27:25]
Um there was an article in the business
journal about a modular data center
[27:29]
going in there last week. So there's
just everybody's telling us it's not a
[27:33]
data center uh or everyone telling us it
is a data center except for Foxcon and
[27:38]
SoftBank. And I talked to them again
today and I said listen I said I I told
[27:42]
them about all the different rumors you
know everything that we were hearing
[27:47]
they once again reiterated this is not
[clears throat]
[27:50]
a full-scale data center this is a proof
of concept you know showroom to
[27:55]
manufacture data center components and I
said you're not putting a full-scale
[27:59]
data center they said no we are not we
we are sorry that this is you know
[28:02]
getting so out of control with the
rumors um but I it's at the point where
[28:09]
I talked to the mayor said somebody from
Soft Bank because we've only been
[28:11]
talking to Foxcon. Soft Bank ultimately
[clears throat] funds the owner of the
[28:15]
property and SoftBank and Foxcon is one
partner/tenant
[28:19]
and um I said somebody from SoftBank
needs to come here and talk to council
[28:24]
as a whole and talk to the public before
anybody makes a decision on the master
[28:28]
funding agreement. And and I think
that's kind of the bigger break that
[28:31]
we're hitting right now because we we
can't keep going off of well the
[28:35]
engineer or the mayor or the solicitor
talked to this one person and this is
[28:38]
what they said. I mean I think council
needs to hear as a whole. Um and so is
[28:44]
the public so they can ask questions and
make a decision if if they really want
[28:47]
to move forward with the agreement. So
um that's that's the bigger issue.
[28:52]
Getting this, you know, this exclusivity
provision and everything reworked is the
[28:57]
other issue. um you know but will that
help if we have a conversation with him
[29:04]
or no because you're done lawyers?
>> I mean it it can't hurt but I from the
[29:09]
lawyer's perspective they don't want to
say all right we'll agree to 200,000
[29:13]
gallons per day and you guys are
exclusive provider because now they
[29:17]
won't be able because now if they have a
tenant that that they have a ten that
[29:20]
wants more I I get it. They just want to
be able to say, "I just don't want to
[29:25]
create a back door down the road that
>> Warren could run."
[29:30]
» Yeah. Without anybody saying it's okay.
>> I guess that would be my fear.
[29:35]
» It would have to be based upon our
refusal to provide them anything more
[29:39]
than 200,000. And then there would still
have to be approval and everything to
[29:43]
run the to run the water line, but it
would it would have to be because we're
[29:46]
telling them we're not going to provide
you guys with any with 200 thou more
[29:50]
than 200,000 gallons per day. Okay.
Um, the other concern they had is they
[29:56]
said, "Well, what if what if you guys
just start increasing the water rates?"
[30:00]
And I explained, I said, "No." I said,
"The water rates are set by our rules
[30:02]
and regulations, but the BPA approves it
across the board. They're not we don't
[30:06]
charge, you know, higher rates based on
the type of business." I said, "Now,
[30:09]
there are water service agreements,
which are an option, which would be, you
[30:13]
know, a lower rate depending on volume,
but there's no requirement right now
[30:16]
that we enter into that with them." But
they had concerns that we would just
[30:19]
unilaterally jack up their rates too for
some reason.
[30:22]
» We have one rate throughout the village
residential.
[30:25]
We did have a decreasing tier, but no
matter where the source is, whether it's
[30:30]
Niles Water or Warren Water, the
customer's rate is the same. We pay the
[30:36]
the difference, you know,
>> and I I explain the rate's not going to
[30:40]
be different for you just because of the
type of business. said the only way it
[30:44]
would be different is if we had some
type of specific agreement with you
[30:46]
guys, which would be subsequent to this
master funding agreement. But so I'm
[30:51]
trying to work on language and
ultimately I mean you guys are going to
[30:54]
have to decide what you want to
recommend for council and council's
[30:56]
going to have to approve it. if you're
okay with this 200,000 cap and giving it
[31:01]
as exclusivity and only in the event
that we refuse to provide them with any
[31:05]
more water um can they go look for other
sources and then if we subsequently
[31:10]
decide we are going to provide you with
more water that they would have to you
[31:13]
know discontinue service from the city
of Warren but as of right now that's the
[31:18]
language that we're looking at
>> I think that would be fine long as they
[31:23]
don't get locked
>> they should you can't really stop them
[31:26]
from doing business and we don't want to
say, "Well, you got to shut off because
[31:31]
we can't give you the water." But you
have to go to the other source. I'm
[31:34]
fine. But soon as we're able to, no
choice. You got to come back.
[31:39]
» Yeah, I'm fine with that.
>> I'm okay with that. As as long as it's
[31:43]
ironclad and we're protected, I'm I'm
good with
[31:46]
» Yeah, me too.
>> Okay.
[31:48]
» So, that's that and that's what they're
going to present to council. And could
[31:52]
it be addressed by no matter what they
are our customer where we choose to pull
[31:57]
their water supply from is our
discretion if we if we allowed a
[32:04]
secondary connection until
>> correct. Yeah. They can't just go to war
[32:07]
and say hey we want more water.
>> It's up Yeah. They just need to inform
[32:10]
us of anticipated increased needs and as
the water line's being built if we do
[32:17]
get that higher volume. It it's a mute
point. Okay.
[32:20]
» With what we can supply, correct?
>> Well, there there there's a lot of
[32:24]
things with that. One, you know, we got
to keep up with how both places are
[32:28]
treating two. You can't turn one off and
turn the other one back on. That that
[32:32]
that cannot happen. Okay? So, it's not
going to be that simple. Now, Foxcon
[32:37]
came to us and said, "Hey, 142,000
right before. Can we do better?" Which I
[32:45]
ran the numbers and did a lot better and
they're still not happy. So, I don't
[32:48]
know. I I think they're not looking for
a number. They're looking for don't
[32:52]
restrain us at all.
>> That they're looking for flexibility and
[32:55]
options. Yeah.
>> I We can't do that right now till we get
[32:58]
this other 24 in and make sure
everything's going fine. You know, we
[33:01]
needed that 24. We need another tank. We
didn't get it. This is the situation
[33:05]
we're in now. Just here recently, there
was another company that came to zoning
[33:10]
and was asking about, "Hey, how about
over 200,000 more a day? Can we get
[33:15]
that?"
So, we're still got new businesses plus
[33:18]
businesses that are here. So, as far as
unlimited
[33:23]
water for somebody, we we're not at
that. I I cannot let
[33:28]
» Yeah. You can't promise it.
>> Can't get it.
[33:31]
» You know, I mean, we we got other things
that we could run out real quick. I gave
[33:36]
the example. Did you see the email,
Chris? Okay. The example was I got 45 ft
[33:41]
in that tank right now. 2 and 1/2 hours
we lo we lose 5T. That's how fast. And
[33:46]
it was taking over 15 hours to get that
5 ft back in. That's how much water we
[33:50]
go through. According to AWWA, we should
have one day supply left over.
[33:57]
We won't make that. We got a lot of
improvements to do. So, we need to be
[34:01]
careful with these numbers. That's why I
couldn't go really any higher. I can't
[34:06]
any emergency, any fire event or
whatever else. Now I I you know we're
[34:11]
not going to make it
with normal day-to-day operations if we
[34:15]
need to. We're we're we're getting that
close now.
[34:20]
» Okay. Does that help?
>> It does. I So what I'll do is I'll
[34:24]
finesse this language. Um I'm going to
circulate it back to the group.
[34:30]
I'm sure they're going to have
additional changes, but I I don't think
[34:33]
that anything's going in front nothing
should go in front of anyone until we
[34:36]
have we've heard from um Soft Bank.
>> Yeah.
[34:39]
» Because I I think that's important for
the BPA and council to be able to ask
[34:43]
questions and the public um before we
move forward with this agreement.
[34:48]
» Okay.
>> Can you guys be at the C next council
[34:50]
meeting?
>> Stanley,
[34:53]
» uh what date is that?
>> Uh be the first Monday in September.
[34:57]
Correct.
Yeah, but that's Labor Day.
[35:01]
» Labor Day
be the 8th. So it's the same day as ours
[35:05]
actually, isn't it?
[35:10]
» Yes.
>> Yeah, it's the same day as ours then.
[35:14]
» So they just moved it Tuesday.
>> Wait a minute. No,
[35:17]
» we we had talked about moving
>> September. No, you're right.
[35:21]
» Yeah, Tuesday is the first
Tuesday.
[35:24]
» Labor Day is the next week.
>> Yeah.
[35:26]
» Yeah. I don't have I'll be around.
[35:30]
Okay.
To a council meeting on the first.
[35:35]
» No, council meetings on the 8th. Our
meeting next meeting is on the first.
[35:41]
» Yeah, either date.
>> Okay.
[35:43]
» Okay. Any more questions on that? Seeing
none, South Springs Road Booster Station
[35:49]
relocation. there. Do you have any
updates on
[35:53]
how that's going or
[35:59]
» no? No real updates? No.
>> Okay.
[36:05]
» Item number 11. I I do know Chris was
working on some stuff because I talked
[36:11]
to him. I don't know if he talked to
you, Darren.
[36:13]
» I have not talked to him. I I still need
to talk to to Cindy about that. We did
[36:18]
find um three more grinders that when we
did have a lot of water, we're we're
[36:24]
getting some in two or three. So, I
ordered more risers. Hopefully, that'll
[36:29]
help. We're still waiting on that.
That's that's where I am. Like I say, he
[36:34]
said he was going to send you some
stuff. I don't know if he did or not.
[36:38]
» We did talk um before I was before I was
up on vacation. Um, and I don't believe
[36:45]
he forwarded what we were talking about
at that time. Um, I went through my
[36:52]
emails yesterday real quick, but I could
have missed it. I don't I don't I don't
[36:57]
believe
>> he said he was going to send you an
[36:58]
[clears throat] email and I didn't know
if he got to it or not.
[37:00]
» Yeah, we talked um before I went on
vacation about the INI. Um,
[37:12]
any questions?
[37:15]
Any additional public comments?
[37:20]
Okay, seeing none solicitors report. The
only thing I have is TC's attorney
[37:25]
reached out to me about this um you know
their claim that they've been
[37:29]
overcharged between the bulk rate and
the contract rate after they declared
[37:33]
full commercial operation. Uh which was
like April 15th or April the middle of
[37:37]
April. And so there's that 2 to 3 week
period between April and May that
[37:42]
they're claiming they were overcharged.
They're claiming they were overcharged
[37:44]
242,000.
Um,
[37:49]
I just I I guess I just more more or
less had questions as in terms of are we
[37:57]
and I emailed Cindy about this too and I
So Cindy, are we
[38:02]
are they were they being build at the
Warren contractual rate I guess during
[38:06]
that last part of April? Do we know? And
here here's the breakdown. It says here
[38:11]
that they think that the service water
agreement rate for us should be 440.
[38:15]
Now, we have a 49% adder in our
contract, right?
[38:20]
» We had a 49% adder when we entered into
the contract. Um, the contract states
[38:27]
that if Warren increases their rate that
our adder or I don't think they call it
[38:34]
an adder in this contract will also be
increased by the same number. Um, I
[38:39]
spoke directly to uh Ted Harvey and I
showed him how to calculate that rate.
[38:44]
um he
understood it and
[38:49]
accepted that. Um as far as the credit,
I I told you the contract states that
[38:56]
they they qualify, in my opinion, they
qualify for that rate once they reach
[39:04]
full commercial operation, but they
failed to create a contact contract or
[39:10]
permit
to complete the permit. they didn't come
[39:14]
in. Then when they did come in, they
didn't come in with the deposit. So when
[39:18]
as soon as they
started the permit process,
[39:25]
we got a final uh a meter reading um
which Warren didn't allow us access to
[39:30]
the day. It took one day more and then
but still before we received the deposit
[39:36]
which should have been submitted with
the permit application,
[39:39]
we transferred that account before we
had the deposit. Um I feel that we build
[39:44]
it accordingly to the contract and they
want to dispute it. It says in there
[39:49]
that they have to comply with the rules
and regulations
[39:53]
and permit application with the deposit
is in the rules and regulations.
[39:57]
» Yeah.
>> Yeah. Did Warren um that's I'm trying to
[40:02]
Did Warren start charging us under the
contract rate in
[40:05]
» Warren
>> cuz I know Warren I believe Warren's
[40:08]
position [clears throat] is they
recognize you know commercial completion
[40:12]
of commercial or or beginning of
commercial operations uh on the April as
[40:17]
of April 15th. So, did they charge us
under the contract or they charge us?
[40:21]
» If if Warren told you that, that is
contrary to what Warren I I met with
[40:27]
Franco and
[40:32]
um the billing clerk and Darren, what's
the other gentleman's name?
[40:36]
» Dr. DJ
Ross. No,
[40:39]
» Tom Ross. The three of us met in his
office and they said they cannot go back
[40:45]
and
find that reading after the fact. They
[40:48]
failed to notify them as well. Um we the
warrants rate for Lordstown Energy
[40:58]
Center at the beginning I think it was
two
[41:03]
51. There's a two cent or a few cent
difference. Warren build us through that
[41:09]
period at the higher rate, the other
rate in the contract, not the PEC rate.
[41:15]
» Okay.
>> And I do I unless they go back and give
[41:18]
me a credit, they build me at the other
rate for the May bill as well, the May
[41:24]
usage.
>> Oh, really?
[41:27]
I think it was 271 for others and 267
for
[41:31]
» correct
>> TEC. That sounds
[41:33]
» but based on a thousand galler
measurement. Yes.
[41:37]
And so that few cent difference when we
received the bill and what we paid was
[41:42]
based on that other customer rate, not
the TEC rate.
[41:49]
» Okay. Did Warren ever start billing us
at the TEC rate?
[41:52]
» I I do believe so.
>> Okay.
[41:54]
» I could check that because maybe we
would have got in June, [clears throat]
[41:58]
so that bill would come in in July. But
I do think
[42:03]
» so. They never changed their billing to
the TEC contract rate until May.
[42:09]
» Till June.
>> June.
[42:10]
» Or June. Okay. All right. All right.
>> Okay.
[42:15]
» And when I met with them, I believe I
could go back and look and see when I
[42:19]
did meet with them, but I think I met
with them in May or at the beginning of
[42:24]
June, and
the director very clearly stated that
[42:30]
they didn't inform them either. And the
rate don't change until
[42:36]
they
[42:39]
we determined at that time of the
meeting that they were just starting to
[42:44]
pull that 4 million gallons or to get up
to that full commercial operation.
[42:50]
» Okay.
>> And that was another thing. Um
[42:56]
» All right. Well, I just want to let you
guys know they're, you know, they're
[42:58]
saying that we should have been build at
the the contract rate, not the bulk rate
[43:02]
for those two weeks at the end of April,
asking for a $242,000 credit. I'll I'll
[43:08]
just tell them, you know, that the rules
and regulations apply under our contract
[43:12]
and the BPA, you know, isn't willing to
reconsider this, I guess. Does that
[43:16]
work?
>> Yeah. Yeah. The ball's in their court
[43:20]
cuz we followed our
>> Yeah, we follow we follow what we have
[43:23]
in our rules.
All right.
[43:29]
Anything else?
>> That's all I have. Any questions for
[43:32]
Matt?
>> Uh, engineers report. I don't have
[43:35]
anything ready to give you anything to
add. Okay. Uh, [clears throat] utility
[43:40]
committee report.
[43:46]
» I only have a few things. Um, in regards
I I mentioned it briefly upstairs is you
[43:52]
have the
before you the Verdantis um
[44:00]
professional service quote to update the
sore rate study. The sore rate study is
[44:07]
up to date with the financial figures.
What is missing or I what I would like
[44:12]
to have um checked on that is if our
funds that we're setting aside for the
[44:24]
lift stations is appropriate for
the replacement.
[44:30]
When we first started this I said, "Oh,
in 15 years they're going to start
[44:33]
wiring down and and and Baron is seeing
that." But where are we at? You know, I
[44:40]
want them to like kind of like analyze
those figures verse versus versus the
[44:45]
potential cost. I don't think I did not
read their um scope of work. Like I
[44:52]
said, I was off last week, so I got it.
Haven't read it thoroughly through
[44:56]
there. But that is all I would request
for the sore rate study and to
[45:02]
incorporate, you know, th those figures
in there. The water rate is a huge mess
[45:08]
because of all the different contracts,
all the different purchase price rates.
[45:12]
And was there TEC? Was there not going
to be TEC? Well, we do have TEC, but not
[45:18]
on our water. So, so many things have
changed.
[45:21]
» So many things have changed.
>> It's hard to go back and plug in the
[45:25]
figure. And then the maintenance
building, you know, are we budgeting for
[45:29]
a maintenance building? Are we not
budgeting for a maintenance building?
[45:31]
And we still really don't have the
answer. Are we paying for a helic
[45:34]
waterline expansion around
the General Motors complex? So, I do
[45:40]
want it. I do think it's very important
that we move forward with that. I just
[45:44]
think it maybe we could ask for them to
do that on an hourly um structure for
[45:50]
what it actually takes to work. But, um
those those two items, like I said,
[45:57]
sword needs a little bit of attention.
Water's going to need more, but I don't
[46:03]
think we need lump sum work.
>> You guys okay with having city email
[46:07]
back and say, "We'd like this to be on
an hourly basis, and please give us a
[46:12]
dollar figure per hour."
>> Yes.
[46:16]
» Okay.
>> Yeah, if you don't mind doing that,
[46:18]
please.
>> Yeah, not a problem. The next thing I
[46:20]
have is um we have a trash contract with
Republic Services and
[46:27]
we are in year three or starting year
four the [clears throat] contract and
[46:32]
there was a the first year after we
entered into the contract the wages
[46:37]
should have been adjusted about 1%. And
they missed it and didn't increase it.
[46:42]
So they wrote that off. it's in the past
and then last year was zero and now this
[46:49]
year um because of the fuel prices
that's our variable in our contract our
[46:56]
trash rate is going up um the new basic
service at the road will be $1970 a
[47:02]
month um or 5911 a quarter if you rent
the cart it'll be 2220 a month or 6161 a
[47:11]
quarter they do have a at the door
service for seniors or handicap or
[47:16]
whatever people um that'll go to 2822 a
month. But the bag service where the
[47:23]
customers can come in and purchase the
bags here and just put it out as needed
[47:28]
will remain at $25 for 10 bags
and that is effective July 1. So some
[47:36]
people have already been build for the
that period. Um but there's three
[47:40]
different billing periods in our
community. So, they'll be prrated or
[47:45]
maybe back build from July one. Um, for
that I met with curb before I went on
[47:51]
vacation.
>> What was what was the curb service?
[47:54]
» The curb the the door service or the
curb regular regular curb service
[48:00]
without a container is $1970 a month.
[48:07]
It's a total of 5911 a quarter. So, if
you have a container,
[48:15]
that's the blue
>> the Yeah, the the cart, the 96gallon
[48:19]
cart.
>> Yeah.
[48:20]
» Like with one cart, I previously was
paying $63 a quarter and it's now
[48:27]
66.661. So, it went up $361
for 3 months, $120 a month.
[48:38]
That's with the card.
>> With the [clears throat] card. Yeah.
[48:43]
» So, I just wanted to let you know
sometimes we get questions. They'll
[48:46]
primarily come through the office, but
if if you have any questions, I do have
[48:51]
um that posted upstairs and I will get
it on um take it down to and through and
[48:59]
have him put it on the website.
>> When's our contract up?
[49:04]
» 2028. Anything
[49:09]
[clears throat]
[49:14]
else?
>> All these things going up because of
[49:17]
gas.
>> When it comes back down,
[49:21]
» Mhm.
>> is the rate going to come back down.
[49:23]
» Yeah, it it gets it it would it
[clears throat]
[49:27]
index every year. So, if it drops down
1% or even falls lower, it would be
[49:32]
[clears throat] adjusted by that
percentage.
[49:35]
Um, I don't think I have anything else.
I did want to clarify when you approved
[49:41]
the meeting minutes, um, Darren had
asked for corrections. I forwarded the
[49:46]
corrections to you, but only his
corrections, correct me if I'm wrong,
[49:51]
were made in in the the new set of
minutes. So, you were approving the
[49:57]
revised
>> revised Yes. minutes.
[50:00]
» Correct. Okay. Yes.
Darren, you were happy with the
[50:05]
the corrections.
>> I don't remember seeing them.
[50:11]
» Okay,
[50:15]
» we'll get them to you.
>> Yep.
[50:17]
» Okay.
>> Email. You should have received them in
[50:20]
your email.
[50:23]
» I have them.
>> I can't answer that.
[50:28]
» Just let us know. I just wanted to know
if they were approving the original set
[50:31]
or
>> Yeah, I'm sorry. Yeah, we were
[50:32]
approving.
>> It's okay.
[50:35]
» Y any questions for Cindy?
>> Okay. Superintendent report
[50:43]
the um call outs in the in the evenings.
Got a
[50:49]
lot of emergency markings or power
outages or whatever else. A lot of times
[50:54]
I I go see assess the situation or just
take care of it. But I take my own
[51:00]
vehicle and it's it's happening quite a
bit. There's no lights. There's nothing
[51:04]
on there. I'm wondering if I could take
the pickup home with me so that when I
[51:09]
do have those calls, at least I have
lights and some tools with me and
[51:15]
whatever I might need.
>> I don't have a problem.
[51:18]
» Yeah, I don't have a problem.
>> I'm fine with that.
[51:20]
» Yeah. Thank you.
Um, we talked about
[51:26]
cleaning lift station one and two. We
had number three done already and that
[51:30]
was with the warrant contract. Just an
update on that. Uh, they're still not
[51:35]
sure. They're going to another boss and
then their law.
[51:40]
So, just wanted to update you. We're
still waiting on on an answer if they
[51:44]
could help us out with that or not.
uh a class for the for Ed and Mark
[51:51]
Gorman Ruff. That's who has our lift
stations. They offer every year a
[51:56]
pumping
class and electrical class. It's $120
[52:00]
per person per class. I'd like to send
both of them to both those classes
[52:06]
totaling $480.
>> I'll make a motion we approve the $480.
[52:12]
Sir, all in
>> favor? I post motion pass.
[52:17]
» Darren, you said Ed and who?
>> Edmark.
[52:24]
» Uh, I I got I wasn't in this loop, but
the shore boxes that were talked about
[52:30]
prior
a while ago. Okay.
[52:35]
Uh, apparently Martin was supposed to
get some estimates, get it to you. You
[52:41]
were supposed to have an answer. I don't
know. I was out of this loop.
[52:44]
» Unless I I don't know if he ever gave me
the estimate.
[52:49]
» I'd have to go back.
>> I don't know where it's at. I'm I'm
[52:51]
being asked about it now and I I don't
I'm not sure either. So that's why I'm
[52:54]
asking.
>> Can we approve the go and buy?
[52:56]
» I thought we approved that.
>> You did.
[52:58]
» Okay.
>> I'm almost positive he did.
[53:03]
» Say that. I think we did. Yeah.
>> Were they not purchased?
[53:06]
» I believe not. I I'm just finding out
about all this. Is it something maybe we
[53:10]
approved and just it never got to was
Martin buying them? Maybe
[53:14]
» I thought that that was a plan, but I
>> maybe Martin just didn't know.
[53:17]
» I don't I don't know. When this whole
thing was being discussed, I I was off
[53:20]
and then that move got started and it
was gone. So I
[53:24]
» How did you say we did approve it? I
remember approving it now.
[53:27]
» So yeah.
>> So So what's next? It's approved. Let
[53:31]
» it was approved.
>> I think we had I a special meeting.
[53:34]
» Yeah. for that or or meeting and we just
put that on there. Yeah,
[53:40]
» absolutely.
>> I will I will check that out.
[53:42]
» Yeah, I don't like I don't think you
were here for that.
[53:45]
» Oh,
>> yeah. I think it was just shooting me.
[53:48]
» Okay.
[53:52]
Um we're draining the uh Bailey tank
right now. We started this afternoon.
[53:56]
We're going to have a wash out on
Thursday. Uh everything went smooth so
[54:02]
far with with draining it. Um, Stan,
especially you, if you notice anything
[54:06]
different, you're getting that water,
give me a call,
[54:09]
» okay?
>> Let me know. I think everything's going
[54:11]
good. We'll have a wash out on Thursday.
So, late Thursday, we'll start refilling
[54:15]
it. Friday, we'll be refilling it. But,
we're we're running on a pump right now.
[54:20]
And I got to keep an eye on it. So, if
you guys hear anything, let me know.
[54:26]
Okay.
[54:29]
Uh, classes for the guys. I do know that
I've seen emails going out that they're
[54:36]
posting classes, but they haven't posted
them yet. I I know they have more than
[54:41]
just you guys in a class in this area. I
just have not seen the dates yet. And I
[54:46]
told them, "Send me the dates so I can
let you guys know if we have to adjust
[54:50]
that." They said, "Once they post the
dates, we can idea when that might be."
[54:54]
» I'm hoping very soon, but they haven't
given up on it.
[54:56]
» I don't want to start
>> Yeah. I don't want to start checking
[54:59]
dates because they have so long to get
it done and we've been waiting a lot
[55:02]
more.
>> Yeah, they bring
[55:05]
» Yeah, the hold up was they were updating
some course material.
[55:08]
» So that that's what the hold up was cuz
the EPA changed a couple of things. So
[55:11]
that that's what the hold up was.
>> Okay.
[55:16]
Uh MBSD had a notice of violation from
the EPA.
[55:21]
They had a chemical feeder chlorine I
guess that was that malfunctioned. So
[55:27]
for 15 minutes before they can get it
fixed again, it didn't feed correctly.
[55:31]
So the detention time with their their
water disinfection,
[55:36]
it it didn't meet DPA's standards on
there. So they
[55:42]
had to notify us as we're their
customer. I had to notify everybody.
[55:48]
Yesterday we sent out over 1,600
letters. We hand delivered to the
[55:53]
businesses, places that wouldn't get it.
We got it posted here. here. It's on the
[55:57]
website.
Uh, nothing wrong with the water.
[56:01]
Everything's fine.
Um, I don't have a date when this will
[56:06]
go away. We got to have a post, I know,
for 7 days. I don't I think they took
[56:10]
care of everything and it'll probably go
right away. But the letters are going to
[56:14]
start hitting the residents. Have them
call me.
[56:18]
It's not a problem. It's not a big deal.
Water's all good. But want to make you
[56:22]
guys aware cuz you may start getting
phone calls, too. So, what was it? A
[56:25]
chlorination issue that exactly quit
chlorinating or it it quit. The injector
[56:30]
quit on it, right? So, they found out
they got it fixed. It was down for 15
[56:35]
minutes, but
>> that's a lot of water.
[56:38]
» Doesn't matter if you miss contact.
>> Exactly. That's So, that's what
[56:44]
happened. But everything's fine and they
they fixed it, corrected it. I'm just
[56:48]
letting you know that a lot of letters
all the letters went out to all the
[56:50]
residents. So,
>> be be ready for that. Well, you would
[56:54]
notice something in your testing anyhow
when you
[56:57]
» Yes. Yeah. Well, the EPA would have too
cuz they got notified right away. Um,
[57:02]
and they would have done testing
correct there. They wouldn't even gave
[57:07]
us any water if there was a problem.
>> Yeah.
[57:09]
» Yeah. So, it would have been stopped
actually there, but you're correct. I I
[57:13]
probably would have noticed a little bit
difference. We're we're good. According
[57:16]
to EPA, MVSD, and L testings that I'm
doing, there hasn't been an issue. So,
[57:26]
Hopefully next meeting can we do
interviews? Can we just put it on the
[57:30]
agenda in case I get make that happen?
I'm good with it for our opening.
[57:34]
» That's fine. Good.
>> That's all I had.
[57:37]
» Okay. Any questions for Darren?
>> Okay.
[57:42]
Seeing none, any member comments? Yeah.
Uh where are we with the relocation of
[57:48]
the master meter for uh
[57:57]
are they moving forward with anything or
>> master meter for the
[58:00]
» not master meter
>> the booster station?
[58:03]
» Yeah.
>> Um
[58:05]
you said you didn't really have any
updates.
[58:09]
» The only thing I thought was hanging Did
he ever get that? Wasn't there still a
[58:14]
car or something in there?
>> It looks like there's actually an
[58:18]
esavator over there now.
>> Oh yeah. So,
[58:20]
» as I said, the picture
I don't know the the parcel goes back
[58:26]
and then it cuts in and like has so
where it cuts in maybe it's on that cut
[58:33]
in to the property, you know, that
belongs to the property north. But
[58:38]
until, as I said, until they set those
pins in and check that, I don't want it
[58:43]
I didn't want it to be an obstacle when
they went to get over there and start
[58:48]
working because we got to keep things
moving.
[58:51]
» Well, really, my question was was are we
good with the $200,000?
[58:59]
» The $200,000 we already received. I will
have to do a report once we we
[59:06]
[clears throat] have expenses against
the booster pump station already. The
[59:10]
question there is what expenses
qualify
[59:15]
to use that 200,000. I reached out to
Turbo County, but I have not got a
[59:20]
response back. So
my intention is is to reach out to the
[59:27]
loan specialist at Berdantis she that
I'm working with on the that project and
[59:33]
the other project now and maybe she
would be able to answer that cuz I have
[59:38]
the grant, you know, the paperwork. I
just don't know what the sections blah
[59:43]
blah blah. I don't know what those mean.
Um and for me to research it would take
[59:46]
a long time where she just might know,
>> yeah,
[59:49]
» here's my list of what I've spent.
Here's what they say. What can what
[59:54]
would apply to that?
>> And I do know last thing I heard on the
[1:00:00]
project is that they were going to be
coordinating a pre-construction meeting
[1:00:04]
and then the contractor anticipated
starting August 24th.
[1:00:10]
» It it gave us uh I don't I don't
remember the date on there. It wasn't
[1:00:14]
too far off. It was a um we hope to have
this timeline right here. We did have a
[1:00:19]
meeting with him. There's nothing
physically that I know that you can see
[1:00:24]
has been done. I've talked to him. The
Bernanz representative, he's been in
[1:00:28]
here. I've I've met with uh the
generator guy down there. So, things are
[1:00:33]
going on behind the scene, if you will.
You're not going to see anything yet. I
[1:00:37]
don't know about I haven't heard when
the meeting is, but they do attend.
[1:00:41]
» Chris said that they're going to have
surveyors come in and put put uh markers
[1:00:48]
I I I hope they still do that. I I think
there that
[1:00:51]
» Yeah, that's what he said he was going
to do last week.
[1:00:53]
» Yeah, I can ask if he's
>> I I haven't seen Mike if I haven't been
[1:00:57]
on the property. I I I don't know if
that that may have happened. I I'm not
[1:01:00]
sure.
>> I just wonder if you pass it. It looks
[1:01:03]
like they haven't done anything. Like he
said, there's
[1:01:08]
there's a earth mover and a semi way
back. I think it would be off our
[1:01:14]
property. Either way, it wouldn't
interfer what they're going to do. But
[1:01:18]
still needs to go.
>> Yeah.
[1:01:23]
» It shouldn't take long for any funds to
go out cuz once the contract's awarded
[1:01:27]
to whoever's going to do the
construction, there's a big down payment
[1:01:30]
is going to go out with it. So, the
money shouldn't be a problem spending
[1:01:34]
that money.
>> I'm with And I mean, are we checking to
[1:01:38]
see if the funds can be used to
reimburse the village for buying the
[1:01:41]
real estate as well?
>> That's one of our expenses. Okay.
[1:01:45]
» Um, we just don't know if that expense
qualifies for ARPA,
[1:01:49]
» the use of ARPA money.
>> Um, the projects over $600,000. ARPA was
[1:01:55]
200,000. So, but we've also spent
>> really close to $200,000 already.
[1:02:03]
» It's just if it qualifies for I can't
put it on there and then, well, you
[1:02:07]
know, that didn't qualify.
>> Yeah. Wasn't the engineering part of
[1:02:11]
that, too? we were able to use that
[clears throat] 200,000 for the
[1:02:15]
engineering.
>> The catch there with the engineering is
[1:02:20]
they had designed it prior to the award
of receiving that money. Sometimes some
[1:02:30]
things qualify for that, some things do
not. So when we got to ARC money which
[1:02:36]
was a time a while back I I think we
needed to have
[1:02:40]
» but it was already designed. Yeah. Yeah.
They had done all that work before.
[1:02:43]
» That's one of those questions. Can I or
can't I? We spent money and by September
[1:02:50]
you know 30th in two more months we'll
have spent more money. Um
[1:02:55]
but that I just need to push all that we
can against the ARPA paperwork. Um, and
[1:03:05]
like I said, we're I think the last time
I did it was like $180 some thousand
[1:03:10]
that we already spent on that project.
Um,
[1:03:12]
» Wow.
