[2:46] All right, we'll call meeting to order. >> 701.
[2:51] » Let us first of all, thanks for all coming, but let us start with the pledge
[2:55] of allegiance. [clears throat]
[3:00] I pledge allegiance to the flag of the United States of America and to the
[3:05] republic for which it stands, one nation under God, indivisible, with liberty and
[3:12] justice for all.
[3:23] » So, first of all, in the back row, can you
[3:28] hear Okay, as long as nobody else is talking
[3:31] on the side, we should be okay. Okay, I know you fixed it. I can turn it
[3:38] up, but I prefer that if we all listen, we're doing well.
[3:42] » Could we have a roll call, please? Clerk Per,
[3:45] » certainly. [clears throat] Supervisor Bertrren,
[3:48] » I am present. >> Treasurer
[3:51] » here. >> Clerk Per here. Trusty Monet
[3:55] » here. >> Trusty Demer
[3:57] » here. All present, sir.
[4:00] » Okay. We have a uh interview process today for
[4:06] a zoning administrator. I'd like to make a motion for approval
[4:11] from the board to move right into that interview right off the bat. Uh so that
[4:16] those people are not sitting through the whole rest of the meeting.
[4:20] I will make that motion. Do I have a second?
[4:22] » Second. >> Okay, we have a second. Any further
[4:25] discussion on that?
[4:30] Hearing none. All those in favor of proceeding with the interviews for
[4:34] zoning administrator position signify by saying I.
[4:39] » I. >> I.
[4:40] » I. Oppose. The same. >> Nay.
[4:44] » God. I already wrote the five down. >> Sorry.
[4:47] » Okay. The motion carries at four to one. Uh, Clerk Per, would you like to take
[4:53] the lead as far as uh getting our first candidate up here?
[4:57] » Well, sure. Uh, the first one that applied for the job was Josh Deinsky.
[5:02] So, I'd like to lead off with him and u um Miss Craves. Uh, if she's still in
[5:10] the audience, I'd like her to be removed for the time and then we'll remove Josh
[5:15] when we have your interview. Is that all right with you? Thank you.
[5:23] Okay, >> Josh, you got the floor.
[5:26] » How you guys doing today? Good evening. Copy my resume in front of them.
[5:30] » Yes, >> cuz I have two.
[5:32] » Uh, yes, we received it. The board, I believe, has all looked it over by now.
[5:38] » I left mine out in the car, which I got it.
[5:42] » The reason for bringing an extra. >> Good job. Thank you,
[5:48] » Josh. The process is that we'll give [clears throat] you a couple minutes if
[5:52] you got anything to say about yourself, but then each of us may have some quick
[5:56] questions for you. >> That's absolutely fine. Um,
[5:59] » so you'll have to hit the button on that mic and if it's greened,
[6:06] okay, that that >> you doing something?
[6:08] » You're good. >> Well, your batteries are good if it's
[6:10] looking like that. So, you don't have to get right on it, but fantastic.
[6:14] » That should work. >> Um, a little bit about myself. Uh been
[6:18] in the trade since right out of high school. Um so pretty much on the resume.
[6:23] Started out construction in Gaylord. Um building a lot in 97 2000. Jumped into
[6:31] journeyman iron worker down in Detroit for quite a while. Wife drugged me back
[6:35] cuz she liked it up here. Moved back up here. Got a builder's license. Went into
[6:41] business for myself. Found out that was kind of a pain in the butt. So went to
[6:45] work for company for a while. Um but he started failing me. So said
[6:52] figure put my mind to work instead of my body from there on out.
[6:56] » Uh a lot of experience. Um carried my builder's license since uh right around
[7:01] 2007. Got the opportunity to work here as a
[7:04] building inspector, zoning official or um zoning administrator and uh ordinance
[7:10] officer. Um moved on for a while. Uh, I'm currently
[7:15] at Frederick Township. Um, I'm on a Monday through Thursday schedule. Um,
[7:21] I've got Fridays wide open and my phone's always on.
[7:28] » Okay. Uh, if we'd like to start on the left
[7:32] there, Mr. Hops, if you got any questions, let's [clears throat] that
[7:35] way. >> I just had a couple. You were here.
[7:40] I don't see uh the year you were here. Years you were here.
[7:44] » Um uh let's see. Was it recent or?
[7:49] » Yeah, it was 2021. It was right after uh Dave Doll was starting to retire and he
[7:53] actually passed away as we were transitioning to me.
[7:56] » Um I had the pleasure of working with him for a month or two before things got
[8:01] really bad with him. And and um was there a reason you left or
[8:08] » um and to be perfectly honest um I had uh a contractual issue I wanted to
[8:16] renegotiate nothing to increase pay but to change the way it was distributed.
[8:22] » Okay. >> Um and difference of agreement or
[8:24] difference of opinions at that point and I just said fine you know what Frederick
[8:28] Township's looking if you guys don't want here's my res resignation. Um,
[8:33] Frederick was offering pretty good uh situation, large office, truck, phone.
[8:39] So, [snorts] [clears throat]
[8:40] made sense. >> Okay.
[8:43] » I'm listening. I'm with the >> Do you still have your builder's
[8:45] license? >> I do.
[8:47] » Oh,
[8:52] those are I I've read through the resume, so those are the really annoying
[8:56] questions. >> It's definitely a nice resume. Very nice
[9:00] resume, by the way. >> Uh Joshua, do do we can we set do you
[9:07] think we can work out something where we can set a few hours a week and then
[9:12] still have your availability on call to set an appointment and things like that.
[9:18] That That's what we're hoping for. >> Quarter mile away.
[9:21] » Oh my gosh. What if you have to walk? I mean, you might ride the bike.
[9:25] » Okay. >> That would take some effort, but
[9:28] » Well, this is uh this is a pretty lucky thing for us that you have experience
[9:34] with the with the township. That's a good thing. But so we we can set
[9:40] something up by appointment only. We can have you available by cell phone and we
[9:44] can set a certain number of hours per week that you'll be available. All
[9:49] right. Thank you.
[9:52] Um,
[9:56] I got a couple questions just in general there. We got two strong resumes here.
[10:01] I'm interested in some other things. Um, you did tell us a little bit about
[10:06] yourself. Tell me about your personal preferences, things that you're into,
[10:10] not into. >> Um, I'm pretty simple. I like working on
[10:15] stuff. [clears throat and cough] My hands dirty.
[10:18] I like taking the side by side out if I get a chance. And I like fishing.
[10:22] » Okay. >> Simple. Got a family. Keep them separate
[10:26] from uh anything going on in the township. That's the only thing I
[10:30] [clears throat]
[10:33] » Okay. Uh what do you think your biggest weakness is?
[10:37] » Um
[10:41] got a big heart. That's probably the biggest weakness in a lot of areas
[10:44] because I believe people for the best, you know, I I give them the benefit of
[10:49] the doubt. more often than >> Okay.
[10:54] Why should we hire you? >> Um, well, I'm close. I've been here. I
[11:02] know the ordinances and the zoning pretty well.
[11:07] I know a lot of people in the community.
[11:14] » Okay.
[11:19] And uh it may have covered this already, maybe not. Why did you leave your last
[11:24] job? So that would be previous to Frederick
[11:27] » that was here. Um and we did cover that. That was um I had a contractual I wanted
[11:32] to renegotiate contract and they pretty much said well it all renews. I said
[11:37] that's not the point. I want to change the way a was. [clears throat]
[11:43] » They were not didn't How often were you supposed to reup the contract? Um, it
[11:48] was every three years and I was back for three years.
[11:50] » And they wouldn't negotiate with you? >> Uh, the way it sounded? No. And I didn't
[11:54] want to push the issue. And there was an offer that had a lot of good stuff going
[11:58] on. I mean, like I said, truck, phone, huge office.
[12:02] » Okay, that's all I got.
[12:09] That's it >> for me. All right. Sure.
[12:11] » Good evening. Hey, Josh. Thanks for coming. Um, I just have um
[12:17] one question. What exactly is the H Hotton Lake Building Agency? Does that
[12:22] work just like a zoning agency? It What do you know what that is? And do you
[12:29] have any affiliation whatsoever with that agency?
[12:32] » I have no affiliation with that agency. I was actually quite close with previous
[12:35] building inspector because [clears throat]
[12:37] we bump things off of each other. Come up to something that's kind of goofy on
[12:40] a job, you send me pictures. what would you do in this situation? And I'd do the
[12:43] same for him. >> Yeah.
[12:44] » Um he's retired from that position now. Homeland building agency covers uh
[12:48] multiple townships. >> Um okay. I really have no affiliation
[12:52] there at all. Um I mean I think I pulled a permit there once. So and that was
[12:59] years ago. >> And do they have any jurisdictional
[13:03] uh authority over our township or is it just Okay. just it's just a conglomerate
[13:09] of >> right. I do believe that there was talk
[13:12] when I left um >> that they were going to try to get um
[13:18] brought in under the lake building authority but it never came to fruition.
[13:21] » Okay. Thank you. That's all I have.
[13:27] » If somebody filed a complaint, gave you a written complaint, would you just
[13:31] automatically assume that person was guilty or would you listen to both sides
[13:34] of the story? Um, always listen to both sides.
[13:39] » Always. >> Always.
[13:42] » There's no reason to not. That's the job is to find out what's going on. And
[13:47] sometimes a written complaint can open up the complainting to issues also when
[13:52] you go out there to investigate.
[13:56] So, it's it's a tough call.
[14:08] If there's no further questions, if you got anything else you want to say, then
[14:12] we'll move on. >> Uh, no, I'm fine. I think we've covered
[14:15] the bases. You know, I'm, like I said, always have my phone on
[14:20] my side. I've got split line, so I can give the phone number, my split phone
[14:25] number, the township. No issues. >> Okay. All right.
[14:29] » All right. Well, we would ask if you leave
[14:34] Um, well, it's nice outside.
[14:39] » Somebody will holler at you, >> right? Um,
[14:42] » I appreciate your time. Thank you. >> Thanks, Josh.
[14:51] » Clerk Per, who is next?
[14:54] » We'll call Miss Tineas Craves uh to the the floor.
[15:03] I don't know if she's >> Is she here or?
[15:06] » Yeah. Well, she went out while he was uh parachute.
[15:09] » Oh, okay. >> Come on in.
[15:12] » Come on in, Tina.
[15:15] » You can sit right up here. Uh,
[15:20] if you push the button on that microphone, it should be green. If he
[15:25] happened to turn it off. >> Uhhuh.
[15:27] » No, should be working. >> Good.
[15:32] Well, I'm glad to see that you're here. You put in an application. The board has
[15:36] looked at the applications from both candidates.
[15:40] Give you a couple minutes. If you want to say anything about yourself that you
[15:44] believe is uh worth noting, go ahead. And then we'll have some questions for
[15:49] you after that. >> Okay. [clears throat] Well, um currently
[15:54] I'm on the board for Denton Township. um on I was on the board for the zoning
[16:00] and planning and now I'm just on the appeals. I was also on the board with
[16:06] Bakas Township on the planning and zoning as well.
[16:11] Um so I've been on that for approximately
[16:16] at least six or seven years. So, I'm very familiar with the process and what
[16:21] I need to do before I make a decision on the with the board and so forth. Prior
[16:28] to that, I've worked at the uh state of Michigan. I worked with them for over 30
[16:34] years. and I was in the uh secretary of state
[16:40] section where uh I basically handled lots of complaints,
[16:46] uh problems with uh driving records, uh
[16:53] car dealerships, anything under the secretary of state.
[16:58] I was a senior technician there. Um I have a extensive legal experience
[17:06] I've also um I was also a landlord and I managed up
[17:12] to about I'd say about 10 units
[17:17] at one time and during that time I did the interviewing for credit check
[17:25] eviction process my own paperwork in court
[17:31] um and now I'm here I work at the homeless agencies.
[17:37] I work there part time.
[17:47] » Okay. Uh if you'd like to start there,
[17:51] Treasurer Hops. >> Sure. I will say it's pretty impressive
[17:55] to have a you have a endorsement from Ruth
[18:02] Johnson, Secretary of State. Very nice.
[18:06] » Thank you. Actually, I have several letters, but I didn't want to scream all
[18:11] » Yeah. And I know we had we had a we had talked earlier. Um
[18:18] [clears throat] I I actually I don't have any questions.
[18:23] We had we had talked earlier, so I'm on time for questions. [clears throat]
[18:29] Well, again, a very impressive resume and uh some mighty fancy recommendations
[18:37] from the people that have written and I know you had more, but we only had so
[18:42] much room. The staples only go this far, you know.
[18:46] » No. And uh I think I think I uh asked enough questions from you before and I
[18:52] know one of the main reasons that you were applying is your hours have been
[18:57] cut at the other place. >> Yeah, drastically.
[18:59] » Yeah, by by about 20% or something a little more than that. So
[19:04] » yeah, it's quite severe. Nobody's building anymore. [clears throat] Not
[19:07] like they used to. The prices of the supplies and so forth have gone up so
[19:12] much >> just can't afford it anymore. So,
[19:16] » right.
[19:22] » All right. >> Okay. Hang on. I just Your batteries are
[19:25] dead, I believe. >> My battery.
[19:29] » Well, let me fix that. >> Let me borrow this one.
[19:33] » Yeah. I'm tired of hearing you anyway.
[19:39] » I wish I'm loud enough without that. Okay.
[19:43] » Well, you might want to reanswer that question because they were saying they
[19:48] really couldn't hear you. >> As far as I think you were talking about
[19:54] your hours being cut. >> Yes. Yes, the hours are uh cut. It was a
[19:59] part-time job in the beginning. It was kind of like 32 hours a week and now
[20:04] it's down barely to 20 hours a week. Barely.
[20:09] So that's changed drastically.
[20:15] » Okay. Do you have any other questions, Clerk Per?
[20:17] » No, I'm done. I I'll change those where you at.
[20:20] » Okay. >> Got some there.
[20:23] » I should.
[20:28] So besides all of what you already said, tell uh tell us some more about
[20:32] yourself. Well, um what
[20:36] » I can go back a little bit further about my experience. Um give
[20:40] » me two more for Kevin. >> My uh my son was in the military. He's a
[20:47] veteran now. He was uh stationed in Afghanistan and I was part of the Blue
[20:53] Mothers uh the Blue Star Mothers. I actually
[20:57] edited their newspaper for their uh chapter. was chapter 99 and
[21:04] I did that for about a year. Um, and then I was a chief editor for the
[21:09] newsletter. Um, I was also a director
[21:15] of uh, White Deer Village condominiums. That's further down, but that was many,
[21:20] many [clears throat] years ago. So, I first saw that uh, complex.
[21:26] Um, aside from that, I mean, I don't know how far back you want me to go.
[21:33] » It's just a matter of what you'd like us to know. You don't have to dig any
[21:37] farther than you want to. >> Okay. I've also worked for the sheriff's
[21:41] when I was younger. I I was I was a dispatcher at Ingam County for the
[21:48] sheriff's. Um, so I, you know, I've been here and there. Uh, I worked for
[21:54] Michigan Bell and AT&T, the phone company. And funny thing about that, I
[22:00] probably I was planning on retiring, but um, back then uh, I was pregnant with my
[22:07] son and they were very, very strict and I could only have three absences a year.
[22:15] Well, I tried to hide my pregnancy and that didn't work out. So, [laughter] I
[22:19] got fired. So I got fired. That was the only place
[22:23] where I was let go. >> Yeah. Thank you for your honesty.
[22:27] » But now, you know, you you can't do that now. So, you know, uh I worked in at
[22:33] Morgan Guaranteed Trust Company processing stock certificates.
[22:38] Um I worked at various insurance companies, Employers Mutual, USFG.
[22:44] I was a workman's compens workman's compensation adjuster where I issued out
[22:50] checks for people that were injured. >> Okay, that's okay. You unless you
[22:55] absolutely want to tell us. >> No, I don't want to bore you anymore.
[22:58] » Well, it's not boring. I I certainly a varied background. Uh what do you think
[23:03] your biggest weakness is? >> My biggest weakness? Um
[23:10] I would probably have to say persistence. I it's a weakness and a
[23:15] blessing at the same time because sometimes I
[23:20] you know I I have something that is just isn't right or you know it can't
[23:25] be fixed and I try to kill myself trying to fix it or
[23:31] or make it right and I sometimes have a hard time accepting that you just can't
[23:37] fix everything. >> Okay. Uh why should we hire you?
[23:42] Well,
[23:47] I have lots of reasons actually. I just don't know how how to start. First of
[23:51] all, I have the experience I think as far as zoning
[23:57] and I also have uh a lot of uh legal experience that I think that would be
[24:04] very helpful to you. Um I I work um with the building agency
[24:10] so I'm very familiar with the permits and so forth and you know how to uh
[24:18] get into BSNA which is a program that we all use as far as the townships. I have
[24:24] excellent references and
[24:28] to be honest with you I think I'm the best person.
[24:31] » Okay. Uh, I don't have any other questions.
[24:35] The other one you already covered, so with that, I'm good.
[24:42] » Good evening. Thanks for being here. Um, yeah, you pretty much just answered uh
[24:45] my question. In all fairness, it was going to be the same question as for Mr.
[24:49] Stinsky. Is that um what exactly to you is the Hot Lake Building Agency because
[24:53] I did not know how vast it was and what is your affiliation and job duties
[24:58] basically with them because you do work for them, but you've kind of already
[25:01] covered that. So you don't have to expand upon it if you don't want.
[25:05] » Unless you want me to. I can go into detail.
[25:07] » That's fine. No, I I have it right here and you pretty much answered it. So,
[25:10] thank you.
[25:14] » I guess you've covered pretty much all my questions and I'm really impressed
[25:18] with your uh legal experience, your experience with the permits, your
[25:23] references, and your all the experience that you have and I look forward to
[25:28] working with you. >> Thank you so much.
[25:31] I'd be honored.
[25:36] » Okay.
[25:40] Clerk Per, have we had discussions um to where we're talking about what a pay
[25:47] rate might be here and hours? >> Starting pay is going to be 8,000.
[25:52] » Okay. I did get an answer from the attorney that we do not necessarily have
[25:57] to set any hours unless we want to. Mhm. Um,
[26:03] okay. >> Well, the same thing I was saying to
[26:07] Josh, uh, I I'd like him to have some hours that are available here at the
[26:13] township someday per week and and be available by phone and by appointment
[26:21] anytime. And he agreed to that. I'm sure Tina will be the same way.
[26:31] Okay. Um, thanks for coming. Is Josh still
[26:36] outside? >> He probably is.
[26:41] » Um, should probably have somebody ask him to
[26:45] come back in. We need to make a decision.
[27:16] Thank you, Patty.
[27:20] » Okay. Uh, thank uh Josh and Tina. Thank you both for coming in and interviewing.
[27:26] The board did have a chance to review your applications and questions,
[27:30] which is uh our due diligence. It's now uh decision time between two
[27:36] solid candidates. [snorts] At this point, I'm going to make motions
[27:40] as needed for [snorts] a fail or pass vote from each board member.
[27:46] First, I'll make a motion that the board approve hiring Tina as the new zoning
[27:51] administrator for Lion Township effective 82426
[27:56] or sooner. Do I have a second?
[28:01] » Second. >> Okay.
[28:02] » Okay. Is there any further discussion from the board?
[28:10] Okay. Hearing none on that motion. Could we have a roll call, please? Clerk
[28:17] P. >> Sure.
[28:19] » Treasure Hubs, >> yes. [clears throat]
[28:24] » Trusty Monet, >> no.
[28:27] » Trusty Dmer, >> yes.
[28:30] » Supervisor Bertrren, >> yes. [clears throat]
[28:34] » And clerk burn, no.
[28:39] » Okay, then that motion carries at 3 to two. There's no reason for a further
[28:45] one. So, congratulations. >> Thank you, sir.
[28:48] » You are now the new zoning administrator for Lion Township.
[28:52] » Thank you. I'm very honored. Thank you. >> And any details you can work out with
[28:57] Clerk Burn >> going forward.
[29:00] » Okay. >> Appreciate you coming in. Appreciate you
[29:03] both. These are tough decisions, but we got to make them. That's why we're here.
[29:07] » Thank you. I appreciate it. >> Thank you. Okay.
[29:10] » Thank you.
[29:14] Okay, that moves us to >> Thank you, Josh.
[29:19] Thank you. >> The board reports.
[29:25] » Let me make sure I don't lose track of where I'm at.
[29:32] moves us to the uh board and department reports
[29:40] and any questions from the public. Uh first is supervisor
[29:45] very similar to last month.
[29:51] Uh, my statutory duties include managing public improvements,
[29:57] overseeing township employees, acting as a legal agent for the
[30:02] township, and being responsible for efficient administration.
[30:07] I took an oath to do that and that's I'm ultimately responsible.
[30:12] It's public job as supervisor. I recently made motions at board meetings,
[30:16] some more than once, to implement business practices
[30:20] and support grant applications and awards usage that I believe are best
[30:24] practices and in the best interest of the majority of the township residents.
[30:29] On some occasions, there were no board members willing to second the motions or
[30:33] not all the board members were present, so no discussion or vote could be
[30:38] recorded for public record. Tonight with all of us here, I intend to make some of
[30:42] those motions again and clearly state why I believe they're important. Uh hope
[30:47] that there's a second so we can have discussion and then get a roll call vote
[30:50] for the record. Uh and then be done with that.
[30:56] on the majority of the comments. On the plus side, I've gotten many compliments
[31:01] on parks, grant awards, grant related presentations, quality of the concerts,
[31:07] Facebook page, fire department recruiting,
[31:10] housekeeping progress, recycling availability, cemetery, phone calls
[31:14] being answered, emails being answered, polite staff, and more.
[31:20] Recently, I've had many discussions concerning public and private road end
[31:24] issues. Those will continue and I will update the board as needed.
[31:30] Has anybody got any questions for me?
[31:37] Seeing none or seeing no hands, we will move on to the treasure.
[31:44] » [clears throat] >> Um, mine's pretty straightforward. That
[31:48] actually that 750 should be a,000 number of tax payments so far, which is which
[31:54] is actually pretty good. All of our millages are up to date being paid. Uh,
[32:00] clerk Pern and I are going to meet with Huntington Bank September 8th
[32:05] to discuss uh a it's called a seedar's program to invest
[32:11] some of the township money to get a better return than just a simple bank
[32:15] rate. So, that would be more to come on that.
[32:19] And uh this was this was all but clerk per and I both interviewed these the two
[32:27] um candidates that were here earlier. I think that both of them were great. And
[32:32] for maintenance uh we actually next the end of next week we should have our that
[32:37] pot that compost finally completed of turning the whole entire lot. So that's
[32:44] quite an accomplishment I think. Um, we finished painting all the playground
[32:48] equipment and pavilions. Every single one of them are done.
[32:53] Uh, we're still doing inspections once a week. Um, replacing the material and
[32:59] doing our inspection sheets, replacing the fall material.
[33:05] Um, [clears throat] and we decided to to look into the two septic tanks uh at
[33:12] Park 27 and the compost just out of curiosity. And the last time they were
[33:17] pumped was 2019, so I figured it was probably due to have them done.
[33:25] Um, and right now we're going to we're in the process. We're going to start
[33:28] cleaning up the parking lot at Phoenix Park because I I think that park's been
[33:35] neglected. Um, just my opinion, of course, but
[33:39] I would like it more where you can see it from the road. Just clean up that
[33:44] whole parking lot area. So, our guys are going to be doing that and we should
[33:49] have our compost gate um the all the electrical done and we should have it
[33:54] installed hopefully by uh the end of next week for our automatic gate system
[33:59] which probably I don't know if it'll go in effect this year.
[34:05] I mean, I don't see why not, but I want to give people at least a couple months
[34:10] notice on the transition on on how it's going to happen. So, it might happen
[34:16] this year, if not for sure, the first of uh first of next year when we open back
[34:20] up. >> Any questions?
[34:24] » I have a question. Are we talking about open it up so we can see it from uh the
[34:29] road? >> Yeah, the west thing. So, taking down
[34:32] some trees probably and get rid of some of the
[34:34] » really just brush. I don't know. Yeah, trees. Just the overgrown.
[34:38] » Yeah, I see. >> Weeds and little small little little
[34:43] trees. Yeah, I think it should be opened up. So,
[34:45] » Mhm. >> you can see the park from the road.
[34:49] [clears throat] >> Any questions from the public for
[34:53] Treasurer Hops? >> Kevin, what was the Has the fee been
[34:58] established for the automatic aid yet? >> I think we came uh with a onetime $20
[35:06] fee. >> Okay. Is that a combination or a FOB?
[35:08] » It will be a combination, a fourdigit. So everybody will get it holds it stores
[35:13] up to 500 uh different codes. So So what'll happen is you'll come in and
[35:20] fill out an application, pay your $20 and we need like license
[35:26] plate numbers because um and it's going to be it's going to be
[35:31] I will say this, it will be very strict. If anybody's caught giving their theirs
[35:35] out to people who didn't want to pay the $20,
[35:40] one time, you're out. Um because this is, you know, I don't I think $20 is
[35:46] reasonable for a onetime fee. And you can you can come and go Monday through
[35:51] Saturday. It'll be open 8 to 5, I believe, the hours will be
[35:55] » and close Sunday. But instead of being Wednesdays and Saturdays, you get you
[36:00] have access, you know, all week long, six days a week. So
[36:04] » we'll know when they become available. >> Yeah, I'm going to for sure give at
[36:08] least a couple months notice. You know, I can't do it overnight.
[36:14] » Thank you. >> But it's coming.
[36:18] » Yes. >> Is the gate for
[36:21] » Lion Township residents? Yes. And the and the um contractors will
[36:27] still [clears throat] they still will pay their $800 fee.
[36:32] » Um that won't change. Um they come and go now as they as they want anyways. So
[36:40] this doesn't really affect them all that much. Um because they had keys by paying
[36:46] that $800. So theirs will theirs will stay the same.
[36:55] Oh,
[36:59] » yeah. We approved this back in >> Jeez, I can't tell you the date, but I
[37:06] know we approved the uh cost for the gate and proved that we wanted to put it
[37:11] in >> and the $20 fee.
[37:17] » That would should be in the minutes. >> No, I'm sure it's in the minutes.
[37:20] » Oh, yeah. It was months and months ago. I don't remember off hand.
[37:33] » Yeah, we voted on it. >> It wasn't.
[37:36] » No, I I think it might have even been May. I mean, I could look it look it up
[37:41] for you. It's not a problem.
[37:49] » [clears throat]
[37:51] » Yeah, I can look it up for you. >> How about in the back?
[37:56] » You said there was going to be 500 codes. That would that like the limit? I
[38:01] don't I don't know how many people or household
[38:03] » Yeah, right now we're we're I think at maybe 400.
[38:08] » Okay. >> That currently have the the badge. So,
[38:12] it'll hold 500, but if if we needed to up it, it can be upped.
[38:16] » [snorts] >> And that's not for recycle, correct?
[38:20] » No, that's for the compost. >> Okay. Make sure
[38:23] » Sam
[38:31] » I think we're going to cross that bridge when we get there
[38:34] » for for Yeah, for now. I guess for time being I'm not going to say they're going
[38:42] to stay there or they're going to go behind the gate. I don't know. That's
[38:48] » I want to make a suggestion because some of us said the last couple years
[38:55] that the recycling brack
[39:11] » I agree >> there's no where
[39:16] » I absolutely
[39:19] or whatever you call it would be that the recycling has to be inside.
[39:22] » That certainly is a possibility. >> Yes, it is.
[39:26] » Consider it. >> It will be definitely considered.
[39:29] » Yeah. I don't want this to turn into comments as much as just questions about
[39:33] what he said, but I Yeah, definitely considered.
[39:37] » What else you got? >> That's it. Is it going to be
[39:44] like punch in certain numbers or you get like a card and hold a card up to it?
[39:50] » You'll have a fourdigit code. So, it's a keypad.
[39:53] » Got it. >> Okay, [clears throat] we'll try and keep
[39:56] moving. Who is next on the seat here? The clerk.
[40:04] » Okay. U Well, we're undergoing a bit of a slowdown after the election of August
[40:10] 4th. That was pretty hectic uh in a couple weeks couple weeks before that.
[40:15] Now we've begun to gear up already for the November 3rd election. A bit of a
[40:20] note, the absentee ballots will be sent out on September 25th. September 25th.
[40:26] That's only a little over a month from now. Please notify the clerk's office of
[40:31] any change of address. Call the office to verify the address you have on file
[40:36] and your alternate address should you want the ballot to be sent there. We
[40:42] still have a big percentage of ballots returned for incorrect address. This
[40:47] figure should be very low and it's not. Remember the post office does not
[40:52] forward election material. All notifications and postings from the
[40:58] clerk's office are being done in a timely manner. Approved minutes, past
[41:02] resolutions, and all communications are on file. I had three visits in the last
[41:08] six working days from interim chief fe Chief Fay.
[41:13] Each time he has brought in a name and information on new recruits for both
[41:18] fire and EMS. I'm very impressed with that. We also had countless calls about
[41:24] the fire department doors being open, sightings at the concerts of the fire
[41:29] truck and the fire dog Ember and the open house, etc., etc. I'd like to
[41:36] acknowledge the marriage of my deputy deputy clerk uh Courtney. The wedding
[41:40] took place this last week in uh Beloxy, Mississippi. I'm very happy to have her
[41:47] back. That's all I have.
[41:51] Okay. Any questions? You know, short of the We will have a comment period if you
[41:56] got any questions pertinent to this. Yes, Phil.
[41:59] » Yes. Mr. Turner, are you um confident with the election that there was no
[42:05] fraudulent ballots? >> Do I have the number with me tonight?
[42:10] » I said, are you confident that no fraudulent ballots were cast at the
[42:15] election? >> Well, we're we're pretty pretty
[42:18] confident. Yes. and the the uh county clerk has let us know that she's pleased
[42:23] with our number. Uh we still have another week to go before everything is
[42:28] absolutely official and final, but um yes, I am so far.
[42:33] » Can you assure us that the ability ballots are going to be properly
[42:37] received and handled? >> Well, they they have been so far. The
[42:42] the things that I'm upset about is that the people would call later and say,
[42:47] "Well, listen, it went to this other address." I said, "This is the address
[42:51] we have on file and it's on the qualified voter list, and if it's not
[42:56] changed on there, it won't be changed." As far as you're concerned, the way the
[43:01] system is set up and there's no nothing to be alarmed about or concerned about
[43:07] as far as the security of the past election in the one county.
[43:11] » No, I don't think so. We keep our stuff under lock and key most of the time. Uh
[43:18] at least one of us are there. And if it's not, if neither one of the drawers
[43:22] locked and all these things are uh secure. So we do we do the best we can.
[43:29] Phil, >> any other questions for clerk burn?
[43:34] » May I address the real quick? >> Sure.
[43:37] » Is it Greg's here?
[43:41] » No, not >> okay. I was supposed to address or go
[43:44] over the road and issue, but due to a situation I'm being activated over.
[43:54] So if we can address this at a later date,
[43:57] » I suspect it's going to be addressed at every meeting we have.
[44:00] » But I have to leave. So I apologize for >> No, that's fine. Go take care of
[44:04] business. >> Emergency [clears throat] call that I
[44:08] » by all means. >> Thanks for letting us know.
[44:11] [clears throat] >> Absolutely.
[44:14] » Okay. So, next
[44:21] uh we have Trusty Demer [clears throat] I don't have much of a
[44:27] report to do. Just uh I'm happy to see that uh Central Park Boulevard, the big
[44:32] hole that's in the middle of the road, it's been patched up. Uh I went to the
[44:37] uh open house fire station and was impressed by the things that they have
[44:41] there. And uh as usual, I I walk the neighborhood with
[44:47] my dog Izzy and talk to different people and uh about things that are going on.
[44:52] And things are going well from the people that I talk to.
[44:57] That's it.
[45:08] » Okay, Mr. May, I think we're up to you. All right. Good evening. Um, I don't see
[45:13] a spot on tonight's agenda for um, board comments. So, mine's going to be
[45:18] twofold. I don't have much in um, in the way of a report. As I stated at the work
[45:22] session, I will no longer be pursuing um information on a fertilizer ban at this
[45:28] point in time because just as much as I wanted to make sure that procedures and
[45:33] requirements were handled properly during the quote unquote sewer wars, I
[45:37] want to make sure that any fertilizer ban has the scientific data and research
[45:41] behind it first and foremost. Um, since I'm doing dual here, as far as
[45:46] recycling, as far as I'm concerned, to save mother earth in our lake, we should
[45:50] have more recycling bins and it should be even if we have to have a tax
[45:54] increase because I don't want to see the trash sitting around, I don't want to
[45:56] see it in the lake and I really don't care who uses the bins because they are
[46:00] public. I mean, to say that it's just for us, if I'm driving up here for the
[46:04] first time and I see a recycle bin and I don't feel like throwing out my window,
[46:07] I'm going to the recycle center. I think it's a good thing. Um, that being said,
[46:12] in June, >> there will be it's on here. It's not on
[46:15] the agenda for report for the comments. >> Yeah, that's
[46:18] » Well, >> what were you asking about? Oh, public
[46:20] comment. >> No, there's no there's nothing on here
[46:22] for board comments. So, mine's twofold. >> Okay.
[46:26] » In June, um, at one of our board meetings, I made some comments, um, that
[46:30] I want to clarify for the public. I made it very clear that when we had a
[46:34] discussion that I stated that I do not care what this board thinks of me. And I
[46:38] want to clarify why I said that. In life, we all have one path to follow.
[46:43] My path may not align with these gentlemen, but I am going to stay true
[46:47] to my path. Everyone who knows me knows I'm about the Constitution, the rights
[46:51] of due process, laws, regulations, and procedures, and I will not waver. So if
[46:58] that means that there are people on this board or even in the public do not like
[47:01] that, I don't have a problem with it because
[47:05] I'm under the clear mindset that if you follow the rules, you follow the
[47:09] procedures, you follow the guidelines, the only one you have left to complain
[47:12] to is yourself or go to the state because we've done our job. Um, and
[47:18] here's some few examples why I'm going to stay true to my path. There's been
[47:22] numerous numerous numerous procedural requirements wrong in my time on this
[47:27] board. Um, we have a tax ass trash assessment resolution that's never been
[47:33] addressed that the board states that we will never address it, but yet we
[47:36] address it. Every single committee appointment is not done properly
[47:40] according to state law. Not a one. They are not given term limits. They are not
[47:45] staggered in the one to three and fiveyear increments as required by state
[47:49] law. Um, there are just so many procedural things for me that are wrong
[47:55] that I am once again under the clear mindset. If you can't get the small
[47:59] things right, you can't get the big things right. Thank you.
[48:05] » You are correct that I didn't have it on the agenda, but it is on the process
[48:09] sheet here. But >> well, it's not on.
[48:11] » You get another shot. How's that? >> Okay.
[48:16] » Okay. Uh we already had maintenance uh via treasure hops
[48:23] fire department Chief Fay. >> All right. Good evening everybody.
[48:28] » All right. And the reports are over there if anybody wants a copy of them.
[48:32] Uh so we responded to this is for the month of July. We responded to 10
[48:37] requests for service. We had uh 13 total EMS calls. Nine of them were turned
[48:42] over. Made four. We had eight fire calls. Made six. We unfortunately turned
[48:47] over two of those. Um there's a breakdown of them. Uh training wise, we
[48:52] did our monthly business meeting. Uh went through driving the different
[48:56] apparatus with the new folks. Pumped water with the engine. 623.
[49:01] Went over the power C use with the ambulance. Uh 632.
[49:06] We did water shuttle training. So we pumped water out of the dump tank,
[49:10] pumped it with the engine 623 and 640. And then we went down to Townline Drive
[49:16] and uh pumped water out of the dry hydrant there, did pump training,
[49:20] drafted the water from the hydrant, fed 623.
[49:24] Uh we completed all unit inspections this last month. Um and all of that was
[49:31] done inhouse with with our team. Uh completed the station inspection with
[49:36] Greg Per at the end of the month. community involvement. We took uh 623
[49:41] and Ember down to Park 27 for a couple of concerts and we also had a group. We
[49:46] took the ladder to H Hotton Lake to Walmart for the national night out. So,
[49:51] we were down there for a few hours and got a lot of pictures with the dog.
[49:55] People seem to enjoy that. Couple of things that we had going on down at the
[49:59] station. We had a small propane leak and leak and the repairs were made by West
[50:04] Webster Gardener. There was no charge. There's no issue at this time. It was on
[50:08] our our vapor propane tank. It's a small pigtail that was kind of a littleer one
[50:15] kind of a weaker style. Now it's a hog tail according to them. So that's all
[50:19] taken care of. And then uh we also I got with Google and Google and Apple Maps to
[50:25] correct the location of the fire department. So now it shows actually at
[50:30] the 10 555 North Harrison Road versus it was shown up down at uh Phoenix Avenue
[50:35] Park 27. So, that should be corrected on everybody's maps.
[50:40] Um, then upcoming events, we've got the basic life support ambulance license
[50:45] renewal that's in process right now. I did this for the month of July, but
[50:49] we've already had our our meet and greet that was on August 15th. That had a nice
[50:53] turnout. Um, upcoming, we have a generator repair, so that's going to be
[50:58] done here in August. They're replacing a a leaking block heater and installing a
[51:03] deicing filter on that. um and then doing the preventive maintenance on both
[51:08] units. So that'll be taken care of and up to date. And then on Monday, Lion
[51:13] Township hosted the uh fire chief association meeting and that went well.
[51:19] So that's all I have. Any questions from anybody?
[51:23] » I have one, sir. Uh there was a lot of disappointed people that the last
[51:29] pancake breakfast got cancelled. Do we have another one on schedule? Yeah,
[51:34] we'll do that on uh uh Memorial Day and 4th of July. That's our intent and
[51:40] enough people have offered to volunteer and help, we can we can make that
[51:44] happen. So, that is definitely our intent.
[51:46] » And unfortunately, we missed the last concert, but the kids bash over in Ross
[51:53] Common, we had been asked to take the dog over there. It got rained out, got
[51:57] rescheduled, so we met that obligation and unfortunately had missed a park.
[52:02] possibility of scheduling another pancake breakfast other than those two
[52:06] or is it too much work? >> We'll see. Let's move into that. I know
[52:11] we also do the pancake breakfast at Winterfest. We help with that.
[52:14] » Yeah. >> So, there'll be one there in the early
[52:16] winter. >> We talked about uh uh Labor Day weekend,
[52:21] but a lot of people are getting packed up ready to get out of here. It's been
[52:24] tried in the past >> and was less successful. So, um
[52:29] » Okay, >> we'll hold. Are you guys going to
[52:32] participate in the firemen's memorial September?
[52:35] » I will be at training. I will bring it up to the guys and if any of them want
[52:39] to go over or take a unit over or >> Yeah, I I think it would be good.
[52:43] » Understood. >> I mean, there's a lot of I don't know,
[52:46] there's 20 departments there or something, so
[52:50] » I I've got instructor training. >> Okay, that's more important, but
[52:54] » unfortunately, >> maybe the assistant chief will uh
[52:57] » Yeah, >> if he's got time to do it.
[52:59] » See who has. Yep. >> I had two quick questions. Uh, Philip
[53:04] Dupri Henry, >> he has not turned in his application
[53:08] yet. So, that's >> Well, I'm I'm My question is And then
[53:12] Brianna Mcill. >> Yes.
[53:15] » These are coming through you, right? >> Yes.
[53:17] » Okay. As long as they're coming through you.
[53:19] » McGillan came through me. Uh, Dri picked up a flyer when he was in paying his
[53:24] taxes. >> That's right. As long as you see him
[53:26] before we do, I'm okay with I've got McGillan's application. You folks have
[53:31] that >> so we can make
[53:32] » I have both of them here. So, are we ready to go on?
[53:34] » I don't know that you have his application unless he dropped it off
[53:38] today. >> We've got his resume. You got his res
[53:42] resume, not his actually filled out application.
[53:44] » It's not an application. >> So, let's wait to approve him until he
[53:49] brings his in. >> Yes.
[53:50] » So, her her application is in she's ready one to go.
[53:55] » All right. Which one's the paramedic again? That's
[53:58] » That was Dupri. >> Dupri. Okay.
[54:02] » Okay. Is there any questions from the public? Um for Chief Fest.
[54:08] How many 911 calls do we receive?
[54:14] » For the month of July, we had 13 EMS calls and eight fire
[54:20] calls. >> And how many did we respond to? We
[54:23] turned over nine EMS calls and we turned over two fire calls.
[54:27] » Turned over meaning >> uh Potton Lake Ambulance Authority ran
[54:31] on the EMS [snorts] calls. We because we didn't have an EMS available.
[54:35] » And so you don't have EMS. So do you have to pass those on?
[54:38] » Correct. We have two EMS on on our books. If they're not available, H
[54:44] Hotton Lake Ambulance Authority runs advanced life support. They're auto
[54:48] [clears throat] dispatched with us. We let them know that we didn't have a crew
[54:50] available. What kind of response time do they have through the community?
[54:55] » I I believe just from cast I would say typically they beat us to it to a a
[55:01] residence because we go from home to the barn to get the ambulance and then to
[55:06] wherever we're going. It also depends on where where they are. So we've had
[55:11] conversation with them. They know that we're short-handed right now. So they've
[55:15] made pretty good response time. If you were if you guys if you were staff at a
[55:19] different level then you'd be responding to one of these calls.
[55:22] » Yes, we would be responding. I don't know if we'll be any faster but we're
[55:26] you know we're definitely going to try. >> How do we keep the public informed about
[55:30] what they can expect? In other words, should they get in their
[55:34] car and drive to Winston or should they wait for somebody coming
[55:39] from another town? I can tell you right now that the Hold Lake Ambulance
[55:42] Authority is 20 minutes or less because they're in the building. So when they
[55:48] get a call, if you don't mind, >> well, I'm going to interject that
[55:51] because I have talked to them about it. >> Okay. Well, that's fine.
[55:54] » Okay. >> I would say it's your individual call.
[55:57] If you'd like to call 911, they're going to be here as quick as they can. They
[56:00] can run lights and sirens and depending on this information that they've
[56:04] received from you or a loved one, they can start care over the phone and
[56:09] they're going to get rolling. Like I would recommend calling the ambulance.
[56:14] » Is part of the goal to reduce that response time or increase the responses
[56:18] that are possible locally here? >> Hopefully we can do both. Yes. if as we
[56:23] get more EMS personnel on staff trained up depending on where they live as quick
[56:30] as they can get to the station and get in the rig and get another person so we
[56:33] have two licenses to roll we're going to go I it depends on where they are but
[56:39] that's our intent is to be there as quick as we can we will continue with HT
[56:43] Lake first when one there's you know there's
[56:47] no ego there whoever's there the fastest is going to take care of you and then
[56:52] we're going assist each other.
[56:56] » Any other questions for Chief Fay?
[57:01] Just want to reply that me and Steve talked about that a long time ago when
[57:07] personnel get higher about keeping staff at the safe medical.
[57:17] » I think the long range plan that we have explored is eventually getting to a
[57:22] millillage and trying to go 247, but we're nowhere near that now. that it's a
[57:28] possibility, but it takes people to, you know, having people here that can
[57:31] respond and we're working on it the best we can. If you know of anybody, please
[57:35] send them our way. >> You That really was my question. 24
[57:40] hours, but that's not within the current funding that we have.
[57:45] » We have a millage coming up next year and then the following year for
[57:49] equipment and uh to get a millillage and prepare it and try and go 24/7 is a
[57:56] major undertaking. It's not in the foreseeable radar, but
[58:01] it will be by next year. We'll be certainly talking about it. We got to
[58:05] get the current millig >> and we are set up for basic life
[58:08] support. So if you're having a heart attack, we want Hot Colton Lake to still
[58:11] come. Or if it's an advanced life support issue, we want them coming
[58:16] because they have the equipment, the paramedics on board, [cough] like
[58:20] they're going to give advanced care. They can push drugs. They can do a lot
[58:23] of things that we can't at our level, our lensure.
[58:27] » So when we call 911, then we get you guys. Is that right?
[58:32] » You get central dispatch >> and they auto tone both us and
[58:37] ambulance. We'll just get whoever gets there fast first. Is that correct?
[58:41] » We we both roll. >> And it's been that way for a couple
[58:44] years. >> Yeah.
[58:47] » People I because I hear frequently we don't have coverage. We do have
[58:50] coverage. That's what we have. >> But you're going 247 would be an
[58:57] ultimate goal. Yes. >> Garish has supported us. Denton
[59:00] supported us. We you know the dispatch knows who's who's where what the
[59:05] emergency is. They're going to dispatch to the best of their ability to get the
[59:08] pursuit, you know, here the past. >> Y
[59:12] » I had to call 911. >> Yep.
[59:17] » 15 minutes. Great job. >> Thank you.
[59:21] » We do have Thanks.
[59:26] » It's good to hear. >> Okay. point of
[59:33] that
[59:38] account
[59:43] you would also send somebody
[59:50] unless it's for example has a life support. Yes.
[1:00:00] » And Chief Williams here if she's if their ambulance is tied up. I think they
[1:00:06] have a second person that would
[1:00:19] take his phone out.
[1:00:34] If something happens,
[1:00:55] I apologize. Yeah. Terminology a little real quick question or not
[1:01:02] comment number one uh on the short stretch of military road that is in
[1:01:08] common. >> That's funny.
[1:01:09] » Continue emergency response to the wrong road. I myself was involved in one. A
[1:01:15] gentleman that was having a heart attack was involved in one. The ambulance went
[1:01:18] to the wrong location. >> Mhm. and we had uh in my case it was
[1:01:23] just what was the perceived so that's a comment second comment is along the same
[1:01:30] line so I'm going to make it right here uh at one time I was running a meeting
[1:01:35] here to this and I had a gentleman having a perceived heart attack and the
[1:01:39] first thing they asked me do you have an AED available there is no AD available
[1:01:46] in this facility that I know of >> it's over in the office
[1:01:50] » in the in other side or >> it's in the other side by the office.
[1:01:54] Assuming that we might see somebody drop in the parking lot.
[1:01:56] » The problem is you weren't here. Those doors were locked.
[1:02:01] » No, I'm saying Well, okay. Good point. >> What organization were you here with
[1:02:07] with a meeting? >> I was here with the CCO.
[1:02:10] » Oh, okay. No, that's a real good point. >> We'll have to fix that somehow some way.
[1:02:15] » Thank you. As far as the address, >> well, it could as easily probably be in
[1:02:19] this hallway. Um, there's nothing saying it has to be
[1:02:23] on the other side of that wall. >> Just a comment. Thank you, Super.
[1:02:26] » No, I appreciate that. >> That makes sense.
[1:02:33] [cough]
[1:02:36] » Okay. Anything else? And then we're going to move on. If not,
[1:02:40] [clears throat] >> thank you, Chief.
[1:02:42] » Thanks, Dave. >> Uh, next is Our
[1:02:47] section Bruce.
[1:02:58] » Okay. At the cemetery, we sold two lots. I had two burials. Um, one was a full
[1:03:04] burial, one was a cremation, and we had three headstone placed. Um, want to let
[1:03:11] everybody know the water's been on now for three weeks. uh finally and uh we're
[1:03:16] in the process I'm in the process of uh painting the chapel and the garage and
[1:03:20] the uh water this week.
[1:03:27] » You must have volunteered. [clears throat]
[1:03:30] » No, because I like doing it. >> I don't know anybody
[1:03:34] » and I care about that. >> I don't know anybody that wants to
[1:03:36] paint. Okay. >> I really care about that cemetery. I
[1:03:40] talk to those people all the time. You do a heck of a job there. I will
[1:03:44] give you that. >> Do they talk back?
[1:03:47] » Sometime sometimes the little headstone pops up.
[1:03:51] [laughter]
[1:03:54] » Okay. Any questions in regards to the sex under the cemetery?
[1:04:05] » Oh, thank you. I appreciate that. >> Actually, I seen it around there today.
[1:04:11] So,
[1:04:15] I've never seen so bad.
[1:04:19] » He does a great job. There's no question.
[1:04:23] » Goes hand in hand with he cares. >> I'll just add a little something to it.
[1:04:28] Every time you have a function over there, anytime, whatever it is, or
[1:04:33] you're dealing with a few people, I get the call. I don't know why the clerk's
[1:04:37] office is the clearing house, but it is. >> That's cuz I serve beers. Oh,
[1:04:43] well, give us a time. [laughter] So, that new water line is a tap. Oh,
[1:04:49] » you buried a keg out there. What'd you do?
[1:04:51] » There's no hope. >> Okay. Well, thank you, sir. Uh, stay in
[1:04:57] the seat and we're going to Let me line this up. Okay. Now, we're on to the
[1:05:02] ordinance officer. >> Yeah. The cemetery was the happy note.
[1:05:05] Okay. Okay. So, I had I had nine nine
[1:05:10] complaints, three complaints about leaf blowing in
[1:05:15] the street. And as you know, as we talked about at the work session, we're
[1:05:19] trying to implement a a ordinance make it illegal to blow leaves in the
[1:05:24] streets on other people's property and across the lake road into
[1:05:30] um the state land. So, we hoping to have that in place by
[1:05:35] October 15. Sorry to push you guys, but yes.
[1:05:41] » Okay. I'm sure we can steal one that fast from another township
[1:05:46] has. There's only one that has one. Maybe you can go to death. I think
[1:05:50] there's
[1:05:53] Okay. I had a complaint of fall in the motel for junk and I got with the health
[1:05:59] department on that one and as it turns out she had cleaned it up pretty well.
[1:06:03] So that's pretty much closed. There's other issues going on over there that
[1:06:07] has nothing to do with us. I also had a complaint about water
[1:06:12] diversion on Insbrook where the person is
[1:06:16] um has a pipe and it's going on the
[1:06:19] person's property. We don't get involved in that. That also is a property
[1:06:24] dispute. Had I had one about go fast rental that's closed. I went and talked
[1:06:29] to them. That's complete. And two unchunked, one on Penry and one
[1:06:35] on Minihaha. Um they started cleaning up on Minihaha
[1:06:40] and I just sent the letter to the person at Penry
[1:06:44] and then also some follow on Minihaha. Um, I had I had the health department
[1:06:49] involved in that and also environmental control. And I have to admit this this
[1:06:54] person is really doing everything can operate. So,
[1:07:00] okay.
[1:07:03] Now, I'm staff. Okay. I put this out
[1:07:10] and and I was late kind of late putting it out. So, I don't know if everyone got
[1:07:13] it because I wanted to talk very briefly about it.
[1:07:17] And I want you to know that I haven't been sitting on any hands. I've been
[1:07:21] working with the with the um sheriff's department with Ben Low and I've also
[1:07:26] been working with the um county commission.
[1:07:30] Um I've been working on some things. We're down there. But I just wanted to
[1:07:36] very briefly touch on whatever this means
[1:07:41] so that we're all on the same page and understand each other because there is
[1:07:44] some confusion.
[1:07:48] So the Jacobs ruling is actually a court order. Okay.
[1:07:55] It addresses the area of roads that beat the shoreline. No person has a right. No
[1:07:59] person has the right to prevent another person
[1:08:02] from using the public access. Everybody and anybody can use it.
[1:08:09] You can you can't swim there. I mean you can't picnic there. You can't sit there.
[1:08:15] It's all about obstruction. You cannot obstruct. You can you can launch a kayak
[1:08:20] or you can uh run in the water. That's about all you can do. But if someone's
[1:08:25] there and I and I talked to Ben Low who's the under who's the under sheriff
[1:08:30] and I asked him this question, can you force somebody off the road? He said
[1:08:34] absolutely not because it's not a law and that's a civil matter.
[1:08:40] And that's what he told me and you're welcome to call him and confirm what I
[1:08:43] just said.
[1:08:47] So that being said, there is a law and it's a 2000 public
[1:08:53] there's a 2012 public act 56 Michigan law
[1:08:59] and that's very strict and that is a misdemeanor.
[1:09:04] So basically all you can do and that mostly concerns docs. Oh and I might add
[1:09:09] something I forgot to add. All doc permits are done through the clerk.
[1:09:15] Not me. Um,
[1:09:19] anybody, you cannot deny anyone can go in any dock. Any boat can come off the
[1:09:23] lake, go up to the dock, drop somebody off or pick somebody off and go off to a
[1:09:27] merry way. Nobody can deny them than that. Not even an association. Nobody.
[1:09:32] They're a public.
[1:09:39] So what you cannot do or what you cannot do more or dock a boat between midnight
[1:09:45] and sunrise install or use a boat hoist or void anchorage device on the public
[1:09:49] road or obstruct another person's access to or from the lake. Install or maintain
[1:09:55] an unauthorized dock and public road in use the public road in or dock in a
[1:09:59] manner that violates restrictions and establishments.
[1:10:04] So, what I'm going to say because there were incidents over there, if there's
[1:10:08] people partying on the dock, call the police. Really, they they will they can
[1:10:12] be fined heavily for that. Please call the police. Don't try to take it upon
[1:10:16] yourself. Call the police. If it's a if it's a road in issue, you can call me.
[1:10:23] If it's one person that's sunbathing, you can call me. But if this it's a big
[1:10:28] party, call the police, please.
[1:10:36] Okay, the last thing that I want to address and stamina said is the parking.
[1:10:41] So, we're going to pretend like that's the water near the lake front runners.
[1:10:46] This is the road. Anyone who's allowed to park and I and I and I drove around
[1:10:52] with the road commission and we talked about this. If anyone is allowed to park
[1:10:57] all along that road, they're all public access, but they cannot obstruct. They
[1:11:03] cannot block a driveway. They have to be 30 ft from the stop sign. Um the road,
[1:11:09] the road that comes here, that's called Bruce Street. Um they can park all along
[1:11:14] that. The road that comes off from the lake, they can park all along that, but
[1:11:17] you cannot obstruct a uh emergency emergency vehicle must be able to go
[1:11:23] through. So, and that's on both sides.
[1:11:28] There's no there's no signs that say there's no parking. It's it's a it's a
[1:11:32] public road. Um, but again, and I actually answered a call where a guy
[1:11:38] literally was parked right up in the stop sign right up to the uh road end
[1:11:43] and I made a move. And that's something I will do. I'll be very strict about
[1:11:47] that. So, and that's the end of my report.
[1:11:54] Well, thank you, sir. I do not want to turn this into a
[1:11:59] freeforall. >> Oh, can I add one more thing?
[1:12:02] » Anybody that wants any information, our ordinance 62 pertains to act, that's on
[1:12:07] our web page. Anyone that wants any information about
[1:12:11] the Jacobs ruling, they can go and Google it and they and they can do it.
[1:12:15] Anyone who wants information about the law, public act 56, it was easy to
[1:12:22] obtain. I just Google and print it and it's very informative. It really lays
[1:12:27] out the rule, especially 56. That's a serious serious law.
[1:12:34] » Okay. Thanks. So, as the ordinance officer, he's informing you of how he's
[1:12:38] going to handle the situation to the best of his knowledge right now. I would
[1:12:44] really like to stay away from arguments in regards to disputes with what he just
[1:12:49] said. I don't know that we're going to be able
[1:12:52] to get away with that. I can tell you that I've been in almost constant
[1:12:58] attorney. I have been in contact with Garish
[1:13:01] Township, Brian Hill there.
[1:13:07] In the end, there's going to be a better understanding for everybody,
[1:13:13] but it's not now today. So, let's try and keep that in mind. If
[1:13:19] we have questions for Bruce, that's fine. But disputing what he's saying
[1:13:24] right now, we're not really done doing the research. I have emails coming back
[1:13:30] from a couple of people yet, and I share them with him, and we go with that. I
[1:13:36] just want you to know that if I get a complaint, the the unfortunate thing is
[1:13:39] at Samuel said, whatever happens on Saturday and Sunday, sometimes I don't
[1:13:43] get the complaint till Monday or Tuesday. So there's nothing that I can
[1:13:47] do after the fact. In fact, there's been many instances there's nothing. Some
[1:13:52] people have my cell phone and they text me. It once I get the complaint, I give
[1:13:56] them my cell phone number so that we can stay in constant contact. I want you to
[1:14:01] know that. >> Okay,
[1:14:03] » that's good. appreciate that. >> I have a question if someone if an
[1:14:07] audience member wants to go first. That's more than
[1:14:10] » So, is there any general questions that we can avoid trying to nail down details
[1:14:14] that we're not really prepared to nail down today?
[1:14:21] [snorts] Sure. We can start over here in the front row. How's that sound?
[1:14:27] The people on cinema set they put a dock in
[1:14:33] that dock has to be like in the middle line up with the middle of their
[1:14:38] property. Correct. >> Correct.
[1:14:42] » Yeah. Here we here we go again. >> I can tell you that I read it just can't
[1:14:47] be on the neighbor's property.
[1:14:52] » Once again we this has been going on how many years? since the late 1940s.
[1:14:57] » We're not going to resolve it tonight. We got to be nice to each other cuz
[1:15:03] answers will be coming, but they're not here right now.
[1:15:08] » How about we'll go down this way and come back around. So, Phil,
[1:15:12] » yes. Must all complaints about ordinance potential ordinance violations be
[1:15:17] submitted. for me
[1:15:22] for me to act I mean for me to fully act it has to go on that little blue sheet
[1:15:27] that's in the office sometimes you know I might get a call and I'll go always go
[1:15:32] and check out and then I'll tell that person they need to file a formal
[1:15:36] complaint >> burning complaint
[1:15:39] a real time complaint somebody burning you get to the point or two later if
[1:15:46] I'll give you an example Greg actually called me about somebody
[1:15:50] burning. You talk about burning leaves, right?
[1:15:53] » Like Greg called me about somebody burning leaves and I ran over them.
[1:15:57] » Okay, that's kind of different than >> What about the guy burning leaves down
[1:16:01] past the store? We talked about this many times. The smoke down there goes
[1:16:07] leaves us as an advertising technique. You know where I'm talking about.
[1:16:14] » I know. Yeah, I know where >> Yeah, I know. Exactly. I don't think
[1:16:17] that Bernie leaves though. I think that they're burning.
[1:16:22] » Yeah, they're they're burning it in a ring.
[1:16:25] » They're burning in ring. >> They're burning in a ring, which is no
[1:16:27] different than somebody having a campfire.
[1:16:29] » Well, it's not a campfire. This is in business.
[1:16:32] » Okay, Phil, I'm going to ask you to do a formal complaint with them and we'll
[1:16:36] look at it again. I looked last year. >> We can't sit here all night talking
[1:16:40] about this. >> I brought this up.
[1:16:43] » No, I went and looked and they were burning wood inside a ring. I said,
[1:16:46] "Come in and make a formal complaint and I will act on it." And you never did.
[1:16:50] » I was told that I had to put writing when Paul was doing your job.
[1:16:53] » Yes. And this board has approved when we hired him that he will deal with
[1:16:58] complaints that are put in writing. >> And I even gave you my cell number.
[1:17:02] » Okay. Well, I like to do a real time report. So, you come in tomorrow. I'll
[1:17:07] give you tomorrow. >> If he decides he wants to deal with it,
[1:17:10] that's his call as the ordinance officer.
[1:17:14] Very good. Okay.
[1:17:18] » How you doing, Dan?
[1:17:30] » Right. There are and that's very because there are no parking signs down there. I
[1:17:34] wasn't I don't want to mislead you. I wasn't referring to that at all. Where
[1:17:38] there's no parking signs, you cannot park there. In fact, I'll take it even
[1:17:41] further. Where the park is, we have an ordinance. You can't pull all those
[1:17:45] four-wheelers up right up to that beach. We have an ordinance.
[1:17:54] [clears throat] >> Okay.
[1:17:57] Okay. Fire back.
[1:18:05] » Um, do you have any idea? And I appreciate you guys are moving forward.
[1:18:12] Have any idea may need some more clarification how many more meetings
[1:18:16] down the road who you're working with clarification specifically in
[1:18:23] talking about
[1:18:27] » we can talk about bismar because that's under investigation
[1:18:31] » yeah that's that was number one we don't we don't know
[1:18:34] » any% it will be educational um I did want to
[1:18:39] publicly thank Bruce and I'll see you all um exceeded my expectations.
[1:18:48] Bruce, you got
[1:18:56] » I I can envision that um a special meeting might have to take
[1:19:02] place subject to deal with all the questions. Um I like I said, Brian Hill
[1:19:09] was gone. The uh chief was on vacation. And I'm glad he showed up tonight. I
[1:19:13] forgot his name. But there's some pieces of this puzzle that need to come
[1:19:18] together for us and then we can start to think about where we're
[1:19:23] going with it.
[1:19:27] Okay, switching over to here. Go ahead, sir.
[1:19:32] » All the many all the marina on set. Now, we got the address to you for the
[1:19:38] sheriff's department. You want it in one lump. You want every address for a
[1:19:42] complaint for every house because there are people that have multiple vaults.
[1:19:47] They're not registered for them. >> Votes are supposed to be registered to
[1:19:50] the owner of the house. >> Yes. Yep.
[1:19:53] » That is true. That is true. >> And I know who they are.
[1:20:00] » There's a difference. There's I mean I I can drive down Samuel set and it's not
[1:20:07] it's not the docks that are the public docks. It's a lot of things going on
[1:20:12] down there. There's blockies. There's I mean
[1:20:15] » I agree. >> There's all kinds of
[1:20:19] you know I mean I'll rule on this end but it's got to be
[1:20:23] » Well, it's got it's got to go. I mean don't I'm not biased one way or another.
[1:20:27] I mean, if you're if you're not doing the rolls, I'm going to act on it.
[1:20:33] » I I would add also, this is one of the reasons we're asking for written
[1:20:37] complaints. When I was temporary ordinance officer, I don't know how many
[1:20:42] times people would tell me something. Your your best bet is to do a formal
[1:20:49] complaint with him. >> Pictures
[1:20:54] are good. Are very good.
[1:21:02] Okay. Nobody can hear you talking. So >> that's a good point. So whoever files
[1:21:06] the complaint, >> nobody will ever know who filed that
[1:21:09] complaint with me. >> I will keep that totally to myself.
[1:21:12] » Okay, that's >> that the second part of that,
[1:21:16] » excuse me. The second part of that is if you go to court, your name comes up.
[1:21:22] » He won't write you off. >> He We don't have to say anything. No, I
[1:21:26] mean it because people you have to understand you can file a complaint and
[1:21:30] you remain you remain anonymous to that person, but if they if you end up in
[1:21:35] civil court, they have a right to know who's complaining about
[1:21:37] » I I'll never divol whoever made [clears throat] that complaint ever. And
[1:21:41] I get, believe me, I get asked every single time. So, [snorts]
[1:21:45] » all right, swinging to this side. Oh, let's go to the far corner. How's that?
[1:21:49] » Same job. >> I want to clarify something. Is that
[1:21:52] mean when my daughters come up to visit me, they cannot go down and sunbathe on
[1:21:57] the dock? >> I'm not going to answer that question
[1:22:00] today. >> It's pretty sad. We're all here to enjoy
[1:22:05] the lake. >> And that's what I don't want to try and
[1:22:09] get into today is the disagreements about whether we believe
[1:22:12] » I think all that is in all that is in Prop 56. I think if you read Prop 56,
[1:22:18] that'll pretty much lay it out what you can do on that dock and what you cannot
[1:22:22] do on that dock. And he's right. We're not going to answer specifically what
[1:22:25] you can do on that dock because you have the ability to gather that information
[1:22:29] for yourself. >> All right, swinging around this way.
[1:22:34] » Anybody in the back? >> Okay, how about you?
[1:22:38] » I want to also
[1:22:45] kindful. >> Thank you.
[1:22:49] » I do have a comment though about um you're stating anybody can park on
[1:22:57] anywhere. >> Well, you cannot not anywhere. Okay. I'm
[1:23:00] going to do a visual. >> No, I know. 30 time.
[1:23:03] » You can park along the road. Okay. >> Right.
[1:23:07] » You can't park this way and the other person park this way because then you're
[1:23:10] obstructed. Well, my concern is an obstruction for emergency vehicles,
[1:23:15] » right? And that's exactly what >> all up and down. That's what I said.
[1:23:20] There has to be >> trailer can't get by.
[1:23:23] » Yeah. Somebody I mean they call me because if it doesn't look like there's
[1:23:28] going to be an emergency vehicle to get through there, then I will make the
[1:23:32] move. >> And and again,
[1:23:34] » it isn't so much the cars. Okay. >> We all know what it is.
[1:23:38] » So, it's the four wheels. this. >> Okay, I don't know that we all know, but
[1:23:42] I'm going to say this again. >> If you feel threatened or you have
[1:23:47] serious trespass issues, call the police. Okay, now their definition is,
[1:23:54] excuse me, just a second. Their definition is, can the vehicle get
[1:23:58] through? That's not the same as are they parked half on the road or not. This is
[1:24:04] another one of them things. cuz we're not going to get to a definitive answer
[1:24:07] today, but the law, the state law is you cannot block traffic. It doesn't say you
[1:24:12] can't park on a road. >> I I will tell you this, working with the
[1:24:16] sheriff's department, as I've done. I know that they're going to be patrolling
[1:24:19] down there more often. [snorts]
[1:24:22] » Okay, that was that was a point that I made and asked them to do.
[1:24:26] » Okay. >> Okay. Coming around.
[1:24:29] Sure. >> This is not about
[1:24:35] I'm just curious because that meeting that there might be discussion about the
[1:24:41] property owner concern late concern with charging of any business that were going
[1:24:48] on public was closed that case and I'm wondering
[1:24:57] share any details about can you share any details about how that
[1:25:02] was closed if you can't. >> No, I can't. No, I absolutely can't. So,
[1:25:06] I went and I know Jeremy. I do know the owner there. I called him. He wasn't
[1:25:11] even aware of it. What was going on, what they were doing. They was they were
[1:25:15] » taking a shortcut instead of going to lunch, but he wasn't aware of the he
[1:25:18] wasn't. And I talked to I talked to the people that were there and they assured
[1:25:24] me that they would move. They wouldn't do it anymore. And I know Jeremy called
[1:25:29] them and from what I from I haven't had a complaint since.
[1:25:33] » So those were his employees that were doing that.
[1:25:35] » It was his employees. It was his employees that were doing it. That's
[1:25:39] correct. >> So the owner doesn't have to open up
[1:25:41] competition now. >> I was just curious.
[1:25:45] » Yeah, I know. >> You have to be in that position,
[1:25:47] » right? But I'm just telling you that's how that's how it was closed.
[1:25:50] » Okay. >> Okay.
[1:25:51] » Great. Good.
[1:25:55] » Okay. Okay. His head's big enough as it is now after tonight. Jeez.
[1:26:02] » Okay, we're going to move on. Thank you. >> I'm not done.
[1:26:06] » Okay. >> No. No. Bruce. Yes. Bruce, have a seat,
[1:26:08] please. I'm not done. >> I'm not done.
[1:26:15] » Just a quick question. I want some clarification. I'll probably open up a
[1:26:18] can of worms tonight, but here we are. Um, so I did a bunch of research with
[1:26:22] legal scholars that I know and I've talked to the Roscom County Road
[1:26:25] Commission numerous times and I want to know if you personally know this to be
[1:26:31] true based on bomb vers bomb family trust versus Babel 2010 that the Supreme
[1:26:37] Court for the state of Michigan ruled that riperian rights riparian rights for
[1:26:43] homes in this case we'll say in Samoset that are on this side of the road do not
[1:26:48] lose that right or privilege. the riparian rights just because a
[1:26:53] public road cuts through, but they do not own the easement and they do not and
[1:26:59] the own the sandy shore up to the wat's edge.
[1:27:03] » I did not want to get into that, Tim, but you did.
[1:27:05] » No, I miss asking you. Have you heard this?
[1:27:07] » That's another >> That's another fight for another day.
[1:27:11] That's >> that's a great answer.
[1:27:16] » Yeah. And I asked I asked my friends that work for the state. So, all right.
[1:27:20] So, we'll just leave it at that. >> It's another fight for another day.
[1:27:23] » There you go. >> Okay. Thank you, Bruce.
[1:27:28] » Uh, Parks and Wreck is on here. I'll briefly mention that we had our first
[1:27:32] meeting with some new members. Didn't uh do a whole lot right off the
[1:27:37] bat. There's a couple of things coming up and announcements that I'll get to
[1:27:42] by midnight.
[1:27:46] » So, that would conclude Comments from the board or the
[1:27:52] department heads.
[1:27:58] [snorts]
[1:28:20] Thank you folks.
[1:28:25] Okay, we'll move on for a while here. See if we can get some of it done. Maybe
[1:28:28] we're going to have to take a break. Uh, next on the agenda is approval of
[1:28:34] the consent agenda. And for today's meeting, the consent agenda
[1:28:39] includes a check register from 71726 to 82026
[1:28:46] and the invoice register from 71826 to 82026
[1:28:52] as printed and delivered to me today and is on the table there.
[1:29:00] I will make a motion to approve the consent agenda as just stated.
[1:29:06] » Do we have a second? >> Second. [clears throat]
[1:29:12] » Okay. A second by Hops. Any discussion from the board on it?
[1:29:17] » Yes. Um I don't know. I don't have the list
[1:29:21] of consent agenda listed in the agenda, but that's just a formality. So, at our
[1:29:25] work session, Supervisor Bertran um made reference to a foyer research foyer
[1:29:31] request researched by our then zoning admin um and that he should get paid for
[1:29:37] that. And I'm wondering is this ACU code on here for 15616 as we discussed is the
[1:29:43] one you referenced? >> I believe it would be. Yes.
[1:29:46] » All right. That is a violation of state law. I checked again since the work
[1:29:51] session. All for your requests, monies must come into the township for the
[1:29:56] operational function only of that department. That comes from Lumis Law
[1:30:01] Firm, not to line someone's pockets. If we choose to give some money for someone
[1:30:06] doing research, it has to be pre-approved by the board. And it was
[1:30:10] not. Supervisor Bertran nor Treasurer Hops nor Clerk Per not that I'm saying
[1:30:15] they did have the unilateral authority under state statute to cut a check with
[1:30:19] your township money and it was never approved by this board. So I would like
[1:30:23] at this point in time I'd like to move that we remove the consent agenda that
[1:30:28] the invoice register out of it put it into the agenda as I'm allowed to do by
[1:30:33] law and we discuss it further. I'll just have you know though there's
[1:30:39] been no check uh that I know of cut. I haven't seen
[1:30:44] one. >> Well, it's right here for 15616 and it
[1:30:47] says it's paid. >> I have not seen
[1:30:50] » Oh, I'm not saying it was you. I'm just saying you three are in the office, but
[1:30:52] I was just referencing what I was told by my legal people. I know that no one
[1:30:56] in the office has the legal authority. >> I agree. So I don't know how we have a
[1:31:01] check here as referenced at the work session dated 83 of 2026 for $156.16
[1:31:08] amount due is zero status paid journalized yes which means it's already
[1:31:12] been cashed >> and paid.
[1:31:14] » No can't it can't have been cashed. >> It says paid amount due zero.
[1:31:19] » Yeah it's have >> it's not pending. It's not open.
[1:31:23] » Courtney hasn't done any checks yet. Correct.
[1:31:26] » Well he got the check somehow. You're talking about for Robert?
[1:31:30] » Yeah, >> we got that a while ago with the bands
[1:31:33] two weeks ago >> before we brought it up. I
[1:31:37] » I think so. And I think it was a at a request
[1:31:40] » of the supervisor. >> We brought it up before I brought it up
[1:31:44] before and offered it as a solution to pay him and and Mr. Monae disputed it
[1:31:49] then if he got paid. I'm willing to live with the consequences myself personally
[1:31:55] if that shouldn't have been done and whatever the fine might be to me I it's
[1:32:00] » it's the whole township we are a board you do not have unilateral authority to
[1:32:04] step on our toes and put us under the bus
[1:32:07] » without board approval we all have an equal
[1:32:09] » if you would like if you would like to try and pull it now I wasn't aware that
[1:32:14] he actually got it I know that's what we had discussed about
[1:32:17] » how'd he get it without a signature from the authorization from the proper
[1:32:20] person.
[1:32:24] » Look at me. >> You can't You don't cut checks.
[1:32:27] » No, but if I if it happened and it was because of something I did, then I am
[1:32:31] the responsible person. And that's if I screwed up in your eyes, if I screwed up
[1:32:37] in the eyes of the law, I'm fine. That is what happened.
[1:32:43] And now we're either moving forward or we talk about it some more.
[1:32:49] And here we are again that there was retroactive pay without board authority.
[1:32:53] And this time, Supervisor Bertran took it upon himself to unilaterally use your
[1:32:58] tax dollars which was supposed to be an operational function those foyer
[1:33:02] requests instead of put giving it to the township, put it in someone's pocket.
[1:33:07] » That is correct.
[1:33:12] The the issue was whether or not he got paid before for this stuff, which we
[1:33:16] actually we still need to resolve. >> He never has.
[1:33:21] » Clerk P was going to look and see if he could find any checks that were ever
[1:33:25] cashed by. >> I've never found any.
[1:33:27] » Okay. >> Before that,
[1:33:30] » I I'll own it. I don't have a problem owning it. So, I'd like to remind this
[1:33:34] board that under state law, if you approve the consent agenda, that means
[1:33:39] you are unanimously, well, you're under individual votes, obviously, approving
[1:33:44] that payment, and that can come back to haunt us. I just want you to know that's
[1:33:48] what the law says. That's the way statute works. Once the consent agenda
[1:33:52] is done, you cannot backtrack. >> So, here we are.
[1:33:58] » Here we are at 8:30. I can run a motion to pass it as it is
[1:34:05] and if that fails can run a motion to remove it. If it
[1:34:09] turns out that I'm the culpable party that the fact that he got this money, I
[1:34:14] will own up to it and do whatever it takes to make things right. But we're
[1:34:17] not going to sit here tonight and keep going about it because that's pointless.
[1:34:22] » And it was >> Is there any other comments at the
[1:34:25] session that you didn't have the right to do that and you did it anyway?
[1:34:28] » That was your statement. Yes. All right.
[1:34:32] » So, for the board, is there any more board comments? And we'll run it. If it
[1:34:37] doesn't pass, it doesn't pass and we can pull it. All I'm saying is if I screwed
[1:34:41] it up, it's me. So, let's keep moving. >> Um,
[1:34:48] any other board comments then on the motion to approve it as it was written
[1:34:52] and delivered to us today?
[1:34:57] » Okay. So we had the second.
[1:35:03] So on the approval of the consent agenda for check register 717 to 820, invoice
[1:35:09] register 718 to 820. Um
[1:35:16] with the money involved, we better have a roll call, please. Clerk Burn.
[1:35:21] » Okay. Clerk Burn. Yes.
[1:35:27] Trustee Monet, >> no.
[1:35:30] » Trustee Demer, >> yes.
[1:35:33] » Treasure Hops, >> no.
[1:35:36] » Supervisor Bertrren, >> yes.
[1:35:41] [snorts] >> Okay, so that carries as is 3 to two and
[1:35:46] for the clarity of the clarity sake. >> Why do you get the vote?
[1:35:51] » Wow.
[1:35:55] because I have a vote in this matter. >> No, you don't. This is a public
[1:35:59] interest. >> I hear what you're saying.
[1:36:01] » You hear what I'm saying, but you don't listen.
[1:36:04] » Philip, you have every right to come after me. All I'm saying is I do not
[1:36:09] believe that everybody sitting here was responsible as much as I was. If there's
[1:36:14] heat to come from this, bring it to me. >> Tell us what you're going to do in the
[1:36:18] future. People really want to know >> if he has determined Let's not break
[1:36:23] into a conversation that's mutually, you know, exclusive of the other people one
[1:36:28] at a time. What I'm going to try and do in the future now that he has confirmed
[1:36:32] that this person did not get checks before
[1:36:36] would be that we will then have to determine how we handle foyer requests.
[1:36:40] If we are paying the person who is doing the research, that's a board decision.
[1:36:44] If the money needs to be repaid, I have no problem repaying it myself.
[1:36:52] It stops with me, right? >> Have a nice evening. Thank you for
[1:36:56] coming. I'll be at the state tomorrow.
[1:37:00] » Yep.
[1:37:03] » I'd like Okay. >> I'd like to say one thing. Uh I've
[1:37:07] worked as a court baiff for the last 10 years. I spent a lot of time in court.
[1:37:13] And there'll be a law that says this and this attorney will say the law means
[1:37:19] that and this attorney will mean this law means another thing and they argue
[1:37:24] over the same law. They all have different opinions and it takes a judge
[1:37:28] to make a decision. Uh just because somebody quotes a law and says this is
[1:37:35] what it means isn't necessarily true. It could be true but it may not be true.
[1:37:41] And I, like I said, I've spent hours and hours and hours in court and I've heard
[1:37:47] all kinds of attorneys say the law means this and all kinds of attorneys say the
[1:37:51] law means that and it takes a judge to make a decision. And that's just my
[1:37:56] statement. >> Okay, we're going to try and keep moving
[1:38:00] on here. The next thing on the agenda is the approval of the past board meeting
[1:38:04] minutes drafts from 7826 and 7:1526.
[1:38:10] Uh, these were handed out to the board members last week, so we got them now.
[1:38:14] You had a chance to look at them. I'll make a motion that we approve those
[1:38:18] minutes as reviewed. >> Do we have a second?
[1:38:21] » Second. >> Okay, a second by Hops.
[1:38:26] Uh, any further discussion from the board members?
[1:38:32] Uh, hearing none. All those in favor of approving those board minute meeting
[1:38:39] drafts uh signify by saying I
[1:38:44] » I oppose the same. Okay, that motion carries four to zero.
[1:38:52] Uh Mr. Monet already made some comments but we are actually it's not on the
[1:38:57] agenda but we are two board comments. Um
[1:39:03] the only comment I have at this point is the um
[1:39:07] parks and the involvement in the grant applications that we have which is for
[1:39:11] some huge sums of money is probably being done right now and be done before
[1:39:17] September where we will get an initial merit scoring ranking.
[1:39:23] Um, we've talked about this before because it's also hooked into making
[1:39:26] sure that we take care of our parks in case there's any spot inspections.
[1:39:31] I'm going to get more involved in that as the time goes on. Um, until I see
[1:39:37] that ranking score, I'm going to act like we need to do everything we can to
[1:39:41] make sure that we don't have a spot inspection that somehow screws us out of
[1:39:46] the two grants that we wrote to improve both parks.
[1:39:50] Other than that, I don't have a comment. Anybody
[1:39:54] else has got one? Go ahead.
[1:39:59] Okay. Hearing none, we're on to approving the meeting agenda
[1:40:06] with possible modifications or additions.
[1:40:10] I have a couple and then God help us, maybe we can get through this pretty
[1:40:14] quick on the agenda itself. Number one is the
[1:40:18] interviews for the zoning admin. We already took care of that. So the new
[1:40:23] number one would be the personal handbook.
[1:40:27] I want to add as a number 10
[1:40:32] uh accepting my resignation as one of the two Lion Township representatives on
[1:40:37] the Ross Common District Library Board as number 11. uh that the board approval
[1:40:44] of Sheriad Ziggian as one of the two Lion Township
[1:40:48] representatives on the Ross Common District Library Board.
[1:40:54] That's the only additions I have. So that brings me at least by my count up
[1:40:58] to number 10 and number 11. Are there any other ones from the board members?
[1:41:07] » Okay, hearing none, >> you have the hiring
[1:41:13] Yeah, it's on Well, the hiring actually I had 12 and 13 for both of them. Yeah,
[1:41:19] that would be 12 and 13. Do them individually. Sorry.
[1:41:22] » Or just one. >> Oh, I'm sorry. Which? Okay.
[1:41:26] » So, we'll do that as number 12 would be the hiring.
[1:41:30] » Philip will be next time once she gets that.
[1:41:33] » Okay. Yeah. Thank you. Once you told me you already went through it, I kind of
[1:41:36] went Okay. So, that would be number 12. So,
[1:41:41] we would have 12 in total. Has anybody else on the board got anything they want
[1:41:44] to add?
[1:41:49] Okay. Uh, so as modified, I'll make a motion we
[1:41:55] approve the agenda as modified. Do we have a second?
[1:41:59] » Second. >> Okay. Second by Hops. Any further
[1:42:02] discussion from the board?
[1:42:06] Okay. Hearing none. All in favor of approving the agenda as modified signify
[1:42:12] by saying I. >> I.
[1:42:13] » I. >> All right.
[1:42:14] » Oppose the same. Motion carries four to zero. That brings us to the agenda which
[1:42:22] will be number two. If you're looking at the one that's here, [cough]
[1:42:25] discuss and approve the final version of the personal handbook for employees.
[1:42:30] Uh, everybody had it. Everybody looked at it. We got feedback.
[1:42:35] Uh my deputy ended up making a couple of minor corrections in it and we're good
[1:42:39] to go. Um I will make a motion to approve the
[1:42:45] final employee handbook as reviewed and presented. We have it um changed and
[1:42:51] altered. It's a matter of getting a second and
[1:42:55] moving forward at this point. >> I'm going to second. Does I have a
[1:42:59] question?
[1:43:03] » Uh okay. sang it by Hops. Okay. For this discussion,
[1:43:06] » where's the final draft? >> She, I believe, gave it to you guys,
[1:43:12] emailed it to you guys. >> No.
[1:43:14] » Well, I don't have it. >> I don't have it either. The version, it
[1:43:18] was a combination of what you two had added with the uh bereavement time
[1:43:24] » and the pay payoff. See, >> she discussed it with us. We have a copy
[1:43:29] [clears throat] of >> I know she put it in one. I thought she
[1:43:31] emailed it to you guys. No, no email.
[1:43:36] » Okay, that were the that was the only changes. I took out all of the
[1:43:40] additional italicized >> stuff that I put in there. We're right
[1:43:43] back to the bare bones. >> Um, as was given you guys last week.
[1:43:52] » Any other discussion from the board?
[1:43:58] Okay. Uh hearing none on a motion to approve the final employee handbook as
[1:44:02] reviewed and I'll have to find out why it didn't
[1:44:06] get emailed. Can we have a roll call, please? Clerk
[1:44:09] burn. >> Sure.
[1:44:12] » Trustee Detner. >> No.
[1:44:16] I'd like to see the final draft before I vote for it.
[1:44:19] » That's exactly what >> Yeah, I I agree.
[1:44:22] Treasure H. >> No. Okay. [clears throat]
[1:44:26] » Clerk P. No.
[1:44:30] Supervisor Bertra, >> I'll say yes because I did see it, but
[1:44:34] apparently it didn't make it back to you guys.
[1:44:37] » Okay, so that fails at one, two, three.
[1:44:45] Next is uh discuss and approve. Let me make sure I got that.
[1:44:54] discuss and approve potentially approve the cleaning service contract with ROC
[1:44:59] the core people that come and clean. We have a new contract
[1:45:06] um effect for one year commence August 1.
[1:45:13] I suspect that you gave copies of this um to the board members or
[1:45:20] Mr. apps. >> This not doesn't have my name on it.
[1:45:24] » I didn't I didn't get one. >> I got one here that says I would say we
[1:45:29] just renew it. >> Yeah. But
[1:45:33] » is that was that from you or >> That's That's for me. Yeah.
[1:45:36] » All right. >> But you got to sign it. And it's it's
[1:45:38] the same contract as last year. No increase.
[1:45:40] » Yeah, I know. I got to sign it. I didn't know if anybody
[1:45:43] » Yeah, there's no increase. >> There's no increase. It's one year deal.
[1:45:46] Yep. uh some of the issues on on the type of
[1:45:50] work they were doing. I believe we went over that.
[1:45:54] » Yeah, they were addressed. >> I'm okay with moving it along. I can
[1:45:59] make a motion and if it fails, that's fine.
[1:46:05] So, [snorts] I'll make a motion that we approve the new contract, which is only
[1:46:10] different in that it is the next year starting August 1.
[1:46:14] um with RO O R O C to do the cleaning of
[1:46:20] our office and bathrooms once a week. We have a second on that.
[1:46:26] » Second. [clears throat]
[1:46:28] » Okay. A second from Hops. Any further discussion?
[1:46:32] » Yeah, we the only discussion we had was we had another lady offer to give us a
[1:46:40] price on things. It was drastically higher number one, but we were told that
[1:46:48] uh maybe the treasurer would have a talk with the cleaning crew on a Friday and
[1:46:53] that was done. They said they would improve their service and that's all I
[1:46:57] needed to hear. [snorts] Yeah. Plus, we we need to go back to
[1:47:00] cleaning when we have meetings like this.
[1:47:04] We need to go back to the maintenance crew cleaning this room because some of
[1:47:08] the stuff stays here and that was part of the problem between those two. The
[1:47:12] discussion and that I think we got it solved.
[1:47:14] » Mhm. >> Um any further discussion?
[1:47:20] Okay. Can we have a roll call on that please? Clerk per.
[1:47:25] » Sure. >> Um Supervisor Bertrren.
[1:47:29] » Yes. >> Uh Treasure Hub. Yes,
[1:47:34] » clerk P. Yes, >> Trusty Dler.
[1:47:38] » Yes. >> Okay, that carries at four to zero.
[1:47:43] Next is to discuss and vote on a draft township purchasing policy presented and
[1:47:48] reviewed over the last week. Uh, so I gave this to you guys last
[1:47:53] week. I really got no input on anything changing.
[1:47:59] So, other than the italicized versions of things in there that I pulled out in
[1:48:04] the final version, um you've all had a chance to look at
[1:48:08] it. As I've already explained, it is
[1:48:13] important that we have this in place prior to grant scoring and during grant
[1:48:18] scoring as we we can submit form paperwork to bolster our case.
[1:48:25] uh we have to be on the ball on spending money, care, maintenance, and I think
[1:48:29] it's also good for us that we are holding ourselves accountable
[1:48:33] with how we do business here. That being said, I'll make a motion to
[1:48:38] approve the new township purchasing policy as it was presented last week.
[1:48:46] Do we have a second? Yeah, I'll second. Okay, we have a
[1:48:52] second from Clerk P. Any further discussion from the board?
[1:49:00] Okay. Hearing none, again, could we have a roll call in it because it certainly
[1:49:04] is about handling money. >> Mhm.
[1:49:08] » Treasurer H. >> Yes.
[1:49:10] » Clerk P. No. >> Trustee Detmer.
[1:49:14] » No. >> Supervisor Bertrren.
[1:49:18] » Yes. So, let me back. Okay. Monops. Okay. So, that is stalled at 2:2 at the
[1:49:27] moment.
[1:49:31] Next, I don't know if you guys I put it in
[1:49:35] your packets, but you should have something that says hello MTA on the top
[1:49:38] of it here. >> And there's a bunch of copies over
[1:49:41] there. >> I asked our attorney to give us some
[1:49:44] explanation on um what we could do about possible moratoriums. We've been talking
[1:49:49] about this for about a month. moratorium on data centers. So the the copy that's
[1:49:56] supplied over there on the board has got a picture of our attorney uh Michael Bea
[1:49:59] and Robert Thal. No great surprise, they represent MTA, so they're already all
[1:50:04] over this thing. So he sent me that document explaining and then he sent me
[1:50:09] a blank um
[1:50:14] uh ordinance that we could use to for a temporary moratorium on data centers.
[1:50:18] And what that really means is we're saying we need more time to think about
[1:50:23] this, go over research, do data gathering. It's just saying we're not
[1:50:28] going to we're going to say we're not going to do anything until we get more
[1:50:30] information. Uh so in the end it is a very simple
[1:50:36] ordinance and all it is doing is declaring a
[1:50:40] moratorium and that's uh the backstory on it. I can
[1:50:46] make a motion and see if this passes tonight.
[1:50:50] So for the township of Lion, Ross Common County, it will be ordinance number 68.
[1:50:56] Uh ordinance to enact a temporary moratorum on data centers. It goes on,
[1:51:01] it's only two pages, goes on to explain the purpose of it and it can take effect
[1:51:08] uh upon publication. So if we adopt it, we could send it to the newspaper and
[1:51:13] once they put it in, we're good to go. So, I'm going to make that motion. It
[1:51:19] doesn't have to happen, but it's a pretty simple process. I'll make the
[1:51:23] motion that we approve adopting ordinance number 68, which is
[1:51:28] titled an ordinance to enact a temporary moratorium on data centers.
[1:51:34] Do we have a second for that? >> I second.
[1:51:37] » Okay. So, we have a second by Demer. Any further discussion from the board?
[1:51:46] Um, >> okay. Hearing none.
[1:51:51] No, there is one more thing. My concern in this is I don't think we can stop it
[1:51:55] on state land, but maybe some of you this has crossed your mind. If you go
[1:52:00] west of Higgins Lake into the drainages from Big Creek and Little Creek and you
[1:52:05] go down Morristown Road, there's water all the way down through that state
[1:52:10] lane. If somebody decided to think about putting something out there, we probably
[1:52:15] couldn't stop them. But this is the first step in trying to be able to get
[1:52:19] control of some things. So, [snorts] if there's no further
[1:52:23] discussion from the board, all those in favor of adopting
[1:52:30] a new ordinance number 68 for Lion Township signify by saying I.
[1:52:35] » I oppose the same.
[1:52:40] Okay, that motion carries four to zero. Next is to distribute
[1:52:47] and you should have this too. We talked last week about veterans and I asked our
[1:52:52] attorney uh some questions about it. He affirm he replied in the affirmative
[1:52:58] that we can purchase posters honoring veterans
[1:53:03] uh especially a historical interest of the township. We can do that. That was
[1:53:06] the main question. Can we do that legally? and use the money for it. I
[1:53:11] think it was Mr. Monae had that question. Yes, we can.
[1:53:15] Uh he said he was a little less comfortable
[1:53:19] with donating money to the private organization as far as uh Amvets, but he
[1:53:24] did say we could offer him a deal. We could say we can have our maintenance
[1:53:28] crew come over there for a reduced rate and do something. Um
[1:53:32] » I thought I asked for that to be withdrawn.
[1:53:35] » You did? >> You did. But I'm saying I ended up
[1:53:37] sending him this and he sent back both answers, which is what you got there.
[1:53:41] So, as far as why it's on here, I I wanted to make a motion that we pursue
[1:53:47] prices and more information on purchasing acceptable material to honor
[1:53:52] my township veterans and family members. No set price. Just move forward on this.
[1:53:57] See what we can find and what we can come up with.
[1:54:01] So on that motion to pursue it. Uh do we have a second?
[1:54:07] » No second. >> Okay. A second from Hops. Is there any
[1:54:11] further discussion from the board?
[1:54:16] Hearing none. All those in favor signify by saying I.
[1:54:20] » I. I. >> I. Oppose. The same. That motion carries
[1:54:24] four to zero. Next is to revisit a power plant grant.
[1:54:30] Uh this previous motion failed uh at one to three with a board member missing.
[1:54:36] Still missing, but I'll I'll run it. Uh the this was for a grant that we got for
[1:54:42] a camera. I'll change the motion again to just
[1:54:46] pursuit. [clears throat] So they ended up putting uh the old camera, moved the
[1:54:50] old camera to a different location. So, we have an existing pole that has the
[1:54:55] hookup still on it. I asked security, give me a number then just to buy the we
[1:55:01] can use the grant money to buy the camera or defer most of the cost to just
[1:55:05] put a new one up on that pole because all the wiring is already there. They
[1:55:09] have not answered me yet, but I just sent it yesterday day before yesterday.
[1:55:14] Uh, I still am advocating that every time we get PAR, every time we get a
[1:55:19] grant approval from the power plan, if we don't use it, that reduces our
[1:55:23] chances in the future. Uh, based on that and the fact that now
[1:55:28] we do have a pole with power up it or with the connections on it, it's
[1:55:33] probably going to be less money than we were talking before. So, I'm going to
[1:55:36] make a motion that we pursue a new cost estimate to use the grant money
[1:55:41] dedicated for the new camera purchase and install it on the existing Southwest
[1:55:46] Pole at Phoenix, now vacant because uh the camera was moved and it has existing
[1:55:52] wiring already. Do we have a second on that?
[1:55:58] » I'll second so we can get a vote and get this off of the
[1:56:01] » Okay, second by Hops. Any further discussion?
[1:56:07] Okay. Certainly money. Could we have a roll call then for that as stated to use
[1:56:12] the grant money to buy the new camera? >> Let me ask one question before we get to
[1:56:16] that. Um the motion was to pursue an estimate. I'm sorry I didn't say that.
[1:56:23] » That's all we're talking. So there is no money involved yet.
[1:56:26] » No, no money. It's if he gives us a price, we could certainly talk look at
[1:56:30] it, but I haven't got one yet. Well, then I don't think we need a roll call
[1:56:35] vote to you. >> You're right. How about we switch it to
[1:56:41] no further discussion from the board? >> Mhm.
[1:56:45] » Okay. Then all those in favor of pursuing a new estimate to use that
[1:56:49] grant money signify by saying I.
[1:56:53] » I. >> That would be I. That would be me
[1:56:57] and you. All those opposed the same. >> No.
[1:57:00] » No. >> Okay. That one's two to two still. Wow,
[1:57:04] that could be a record. Keeps coming up two to two.
[1:57:11] Uh, revisit the clearing the brush along the
[1:57:14] West Higgins Lake Drive at the cemetery. Mr. Hops and I have talked about this. I
[1:57:19] I wanted to add um in the before we had no second, no motion, no discussion.
[1:57:26] Uh the cemetery is included in the parks and wreck fund which is a millillage
[1:57:32] intended to be used for improvements. Last year we spent over $15,000 chasing
[1:57:38] oak wilt around and it worked great and we got rid of a lot of it and we used
[1:57:42] park and wreck money for that. Uh so the cost of this would be it's $3,000 $3,15.
[1:57:51] Uh Mr. Mr. Hops and I were talking about that we if we remember the fact that we
[1:57:55] have $15,000 we didn't spend. There is money to do this and for the public it's
[1:58:00] to clear a stretch from the cemetery driveway
[1:58:06] alongside where the water pump house is so that you can actually see the back
[1:58:09] half of that cemetery from the road. And of course we know Bruce does a great
[1:58:13] job, but they would take the underbrush out, leave the trees so you can see
[1:58:18] through there. Um,
[1:58:22] so the reason I brought it up again is because that $15,000 we we don't have to
[1:58:28] use this year, is there? There's probably money to do this. No problem.
[1:58:32] Again, it's a millage. We're supposed to spend this money for improvements.
[1:58:37] So, I'll run it by again. Uh, I'll make a motion that we approve the contract
[1:58:41] for the brush clearing at the cemetery for a cost of $3,15
[1:58:46] from Land Works LLC. So, do we have a second on that tonight?
[1:58:54] I will second for discussion. >> Okay. And then further discussion. I
[1:58:58] already told you where I'm at on it. >> And I told you where I'm at. I said, why
[1:59:03] don't we wait till next year? >> I hear you. Uh, any further discussion
[1:59:07] from the board? I'd rather see trees than tombstones.
[1:59:14] Oh, okay. Took me a while to figure out where you're going with that. Uh, any
[1:59:19] other discussion from the board.
[1:59:23] Okay. So, that is money. Uh, if we do a quick roll call here, we can move right
[1:59:29] out of this one. >> Okay. Treasure Hut.
[1:59:32] » No. >> Trusty Demer.
[1:59:35] » No. >> Clerk P. No.
[1:59:39] » Okay. >> Supervisor Bertrren.
[1:59:41] » Yes. So, this is uh now that we actually discussed it,
[1:59:46] » I think it's a great idea to park it till next year.
[1:59:51] Again, uh number eight is revisit health and safety committee. When we talked
[1:59:55] about this before, uh I didn't I ended up calling Paul
[2:00:00] Olsson, our insurance company rep. Uh he said that one of the things
[2:00:05] that it it might be worth considering to have a committee is that you could have
[2:00:10] the committee do an inventory of stuff. Uh and it would be if for no other
[2:00:15] reason than if there was ever any insurance claims on theft or fire. You
[2:00:19] might have a better idea. I I get what he's saying.
[2:00:24] But again, this is one of those ones that either we weren't all here or it
[2:00:28] didn't get a second. So I'm going to run it by again. I'll make a motion that the
[2:00:32] board create a health and safety committee for the purpose of building
[2:00:35] and property walkthrough inspections and input.
[2:00:39] Do we have a second? >> I'll second for sacred discussion.
[2:00:43] » Okay. Further discussion being go to
[2:00:48] buildings, you look around, make sure everything you don't have gas cans in
[2:00:52] the library, stuff like that. Uh but then also the addition inventorying what
[2:00:58] we had is probably not a bad idea. Uh any other
[2:01:02] » I just don't I don't see the reason for it. I I don't understand. We haven't had
[2:01:08] an issue so far. It just seems like uh why we need a health and safety
[2:01:13] committee is is beyond me. >> Understood. Every place I ever worked,
[2:01:19] we had one. That's you know, but we have a difference of opinion.
[2:01:23] » Uh any other comment from the board?
[2:01:28] Okay. Hearing none. Let me back that up. All those in
[2:01:35] favor of a motion to create a health and safety committee for those purposes
[2:01:39] signify by saying I. >> That would be me.
[2:01:44] » And oppose the same. >> No.
[2:01:47] » Okay. So that motion fails at one four. Number nine. Accepting a resignation.
[2:01:54] And I'm going to make a board a motion that the board accept my resignation as
[2:01:57] Lion [clears throat] Township representative from the Ross Common
[2:02:01] District Library Board immediately. We have two slots. I'm in one. Nancy and
[2:02:09] I'm going to screw her name up. Not even going to try. Ny's in the other one. I'm
[2:02:15] going to resign. Uh and I would like you to accept my resignation.
[2:02:21] Um, so on that motion to accept it, do I have a second?
[2:02:29] » Okay. And any further discussion from the board
[2:02:36] hearing? None. And the position itself had money. I never took money, but we
[2:02:43] should do a roll call. >> Okay. Trusty Dmer.
[2:02:48] » Yes. Cliff Per, yes.
[2:02:53] Fisher Hunt, >> yes.
[2:02:56] » Supervisor Bertrren, >> yes. Thank you, gentlemen.
[2:03:01] Uh, so that motion carries four to zero. Number 10 is to approve
[2:03:05] [cough and clears throat] [snorts] an appointment of uh for that
[2:03:09] position. So, I'll make a motion. Sherry Edzigian has graciously
[2:03:15] um offered to fill that position and she is pretty tuned in to the
[2:03:20] library and I think it's a great fit and I couldn't be more happy that you're
[2:03:27] willing to do it actually. >> Well, you're you're a better fit than I
[2:03:31] was there for different reasons. We got that resolved. Okay. So, I'm going to
[2:03:36] make a motion that the board approve the appointment of Sherry Ed Ziggy into the
[2:03:39] open position on the Ross Common District Library Board as the a as a
[2:03:44] line representative effective immediately.
[2:03:49] Do we have a second? >> Second.
[2:03:53] » Okay. Any further discussion? I do have some
[2:03:57] Mr. Monae has some opinions about this. Our attorney has already told us that we
[2:04:02] don't need to submit paperwork. If you want to quit, you can quit. We can
[2:04:06] appoint people. They need to be sworn in. He has a different opinion. And God
[2:04:11] bless America. Uh I'm comfortable with doing this this way.
[2:04:17] Any other discussion from the board?
[2:04:22] Okay. And there is potentially money involved. So if we could do a roll call,
[2:04:26] please. >> Clerk Burn. Yes. Treasure Hunt.
[2:04:30] » Yes. Supervisor Bertrram.
[2:04:35] » Yes. >> And trustees, whatever your name is on
[2:04:39] their death. >> Yes.
[2:04:42] » Okay. Motion carries four to zero. Thank you very much, Sherry. Welcome aboard. I
[2:04:48] know you're going to do a great job and you're going to enjoy those meetings.
[2:04:52] » And remember this, they got a million dollar budget.
[2:04:57] So when they start pinching pennies, you get in there and save. Come
[2:05:01] » on. That means we need to up the rent here.
[2:05:04] » Well, I don't know about that. Anyway, uh number 11. Uh okay, I'm going to
[2:05:09] scratch 11. I had that as Phillip. So, I will call number 11.
[2:05:16] Um as recommended by Fire Chief Fay. I'll make a motion that the board
[2:05:20] approve the hiring of Brianna McGillan. Is that correct?
[2:05:25] As an [clears throat] addition to the Line Township Fire Department,
[2:05:29] » not EMS yet. joining the department.
[2:05:34] » Okay. >> So, as stated, fire to the Lion Township
[2:05:38] Fire Department. >> Do we have a second for that?
[2:05:42] » Second. >> Okay. A second by Demmer. Any further
[2:05:46] discussion from the board? >> Just a quick question. She's at Cam
[2:05:50] Gring currently. >> Yes.
[2:05:53] » What is she?
[2:05:59] » She's a guardsman. Logistics. >> Logistics.
[2:06:02] » She's a
[2:06:07] sergeant. >> Okay.
[2:06:10] Just curious. >> I saw it on her resume.
[2:06:14] [clears throat] >> Well, she
[2:06:18] Okay. >> The application was certainly fine and
[2:06:21] we're certainly looking for people. So, you're doing something right if they're
[2:06:24] coming out of the woodwork and trying to get in. Appreciate that.
[2:06:29] Um,
[2:06:34] there's money. We got to roll call that, too.
[2:06:36] » We got to make a motion first, huh? >> I got a second from Demmer.
[2:06:40] » Oh, you did. The silent man. Okay. >> And then discussion. Well, we kind of
[2:06:44] blew through discussion unless somebody else has got no.
[2:06:52] » Okay. So, treasure hubs.
[2:06:56] » Yes. Trusty Demer.
[2:06:59] » Yes. [snorts] >> Clerk P. Yes.
[2:07:03] And Supervisor Bertram. >> Yes. So that motion carries four to
[2:07:08] zero. And tell her welcome aboard.
[2:07:13] » Okay. Unless I miss something. >> That's it.
[2:07:16] » That's the end of the agenda. So getting into announcements.
[2:07:21] Uh the cancer sucks tournament is going to be in September. There's
[2:07:26] paperwork over there on the desk about it if you'd like to get in involved or
[2:07:31] make donations. Excuse me. Certainly appreciated. It's a
[2:07:35] good cause. Great baseball teams come from all over the state to play that
[2:07:39] weekend and you'll see some great baseball.
[2:07:44] Uh so I just got the paperwork on that.
[2:07:48] You're going to start seeing it on our bulletin boards or getting pushed on
[2:07:51] Facebook. the fish sculpture at Phoenix Park.
[2:07:58] Two things I'm going to say now. I ended up uh doing some emergency spending. The
[2:08:03] maintenance crew uh declined to try and deal with it because of the size of the
[2:08:09] mounting post. I ended up finding uh actually Nick Sergeant was willing to
[2:08:16] uh use a process to put a pole in similar to a light pole, which was the
[2:08:21] only thing that made sense to me and he was the only one willing to do it and we
[2:08:25] got to get this thing up because the kiosks
[2:08:29] with the map of all these water spots in Roscommen County are here.
[2:08:34] Um, so I did it'll come out probably in the next consent agenda that uh that
[2:08:40] would be under $1,500 for him to come out and put that poll in and also put
[2:08:45] the attachment on the top that I did that without board approval. And also
[2:08:50] for Martin Schelby when the pole was up there, the huge
[2:08:55] pine tree there, a couple branches needed to be trimmed off the side so
[2:08:58] that we can get a good visual on the fish hanging there within what is going
[2:09:03] to be a photo op at the lake in the background. Uh he came in and did that
[2:09:08] again was willing to do it. Came two days later. Uh I don't know what that
[2:09:13] estimate would be. I don't think it's going to be more than 400 bucks.
[2:09:17] Um those things needed to be done. Uh the community foundation uh the lady was
[2:09:23] here Wednesday, Monday.
[2:09:27] This thing needs to get done and there's one Ross Common Township is still
[2:09:31] screwing around with theirs too. Last but not least, uh another grant from
[2:09:39] Michigan State Clean Lakes Clean Water Demonstrations.
[2:09:44] We did one already at Samoset. There's a new sign at Samoset with a brush hanging
[2:09:48] there and some tools. Uh it will be at uh on 9526
[2:09:54] Saturday 11:00 Phoenix at 12:15. That will be put on by Laura Piaowski,
[2:10:02] one of the parks and recck members and her son. Uh we're doing them on the
[2:10:06] weekend because we get photos with people. That's what the grantees want to
[2:10:11] see. That keeps the money flowing. I do not have any other announcements. I
[2:10:17] don't know if any of you gentlemen do. I'd
[2:10:22] » like to announce that I just stand up because my back hurts from time to time.
[2:10:25] So, don't be alarmed. >> Yeah, every now and then you have to
[2:10:29] remind everybody when I Okay, that brings us to public comment.
[2:10:35] So, we have a lot of people here. We're certainly going to try and do the five
[2:10:39] minutes. Um, you know, >> I guess if you get up first, you're
[2:10:46] first, right? >> Well, I assumed you wanted me moved into
[2:10:49] this position. Thank you, Supervisor, and members of the board. I'm going to
[2:10:53] address two issues with one one problem that you may have, and that has to do
[2:10:59] with Hula. Uh, unfortunately or fortunately, uh,
[2:11:04] » Oh, yeah. >> Oh, I'm sorry.
[2:11:05] » Some of these people don't know who you are.
[2:11:07] » Yeah. I'm Tim Poxton, 11995 Military Road, Ross Common, Michigan. And again,
[2:11:14] thank you uh to the board. Uh fortunately, the last unfortunately the
[2:11:18] last meeting I attended with the ULA, I heard some things that really disturbed
[2:11:22] me. I think I wasn't the only one that was disturbed by some of the things that
[2:11:25] we heard. Number one, they don't believe they report to you at all. They believe
[2:11:30] they're independent. I believe that >> who are we talking about?
[2:11:33] » Huga board. Higgins Lake Utility. Okay. Hugans Lake Utility Authority. I think
[2:11:38] you got an email from me as a matter of fact.
[2:11:40] » Yes, I did. >> And I believe that they do report to you
[2:11:44] any board that's appointed by a a township, city or anything else. And I
[2:11:48] worked in city government for a number of years and we had boards and those
[2:11:52] boards could create problems for us if we didn't oversee them. Matter of fact,
[2:11:56] they were were lawsuits that uh ended up at the city's problem. So, I believe
[2:12:01] Lion Township and Beaver Creek have elected officials have to oversee it and
[2:12:06] that they have to provide you with reports. I saw none no reports tonight
[2:12:11] on the table or given uh orally. Um they believe they're an independent
[2:12:18] uh practically uh able to do anything they want to was
[2:12:23] my impression. I could be wrong about that. Second issue I have with the hula
[2:12:27] board is that they are going to violate state law Michigan uh MCL Michigan
[2:12:32] compile law 141.121
[2:12:37] by spreading quarterly fees on the other users of the system when a uh part of
[2:12:44] that system is one of the users or all a number of users don't pay their
[2:12:49] quarterly fee. I believe that's a violation of state law. They cannot
[2:12:54] spread any of that out. They have to uh uh absorb those losses until the money
[2:13:00] is collected through either um attached to to the tax assessment which all house
[2:13:07] buildings over there have a U tax number and or the sale of that particular
[2:13:14] property uh >> and [snorts] then the new user or the
[2:13:17] old user whatever they agree to will pay back those fees. They should not fall in
[2:13:22] any form one penny on any other owner. And I'm willing to answer any questions
[2:13:27] if supervisor would allow that. If you have any questions.
[2:13:30] » Uh questions. Well, other than if you send me details, this has gone to our
[2:13:35] attorney. >> Yeah.
[2:13:36] » If you send me details, I do know we talked about uh some of this before. We
[2:13:43] are supposed to be getting reports from the two Lion Township representatives,
[2:13:48] but we just now installed two new people. Um, I don't know that I've ever
[2:13:53] asked them if they're supposed to come, but I will. Again, I I'm not asking you
[2:13:59] that they come. I'm asking you that they provide a report to this elected body.
[2:14:03] Okay? >> And uh, also, I should have mentioned
[2:14:06] it. I had it in my notes. I didn't mention it. There may also be an issue
[2:14:10] of the Michigan Constitution violation of the Headley amendment by hiding taxes
[2:14:15] in a uh collected fee. Uh that one I'm not as certain on because I couldn't get
[2:14:20] all the research I needed for all that one. But thank you, Super.
[2:14:23] » If you put it in an email, I can >> I think I think I did send you the email
[2:14:27] with all with those two complaints in it, didn't I?
[2:14:31] » If you did, it got buried in whatever happened in the last week and a half.
[2:14:36] » Yeah. And you got it about a week ago, I believe.
[2:14:38] » Let me look. And if I didn't, I'll uh let me see if I can find it.
[2:14:44] » Okay. Thank you, supervisor and board, for your time.
[2:14:46] » Well, thank you for your comments. Okay. Let's start on this side. If
[2:14:51] somebody Well, let's just see. Has anybody got something they want to say?
[2:14:55] And I'm sorry. You sat down and your head was lower.
[2:15:01] This gentleman is here and I should have got to you a long time ago.
[2:15:05] » Oh, that's okay. >> Well, it's not okay. You were behind. I
[2:15:09] didn't see you. >> So, again, what what is your purpose in
[2:15:13] being here? Because >> Yeah. So, my name is Mo. I'm from a
[2:15:16] small business administration. Uh, thanks so much for the opportunity. The
[2:15:20] president and the governor declared uh the Roscomment to be a disaster area
[2:15:24] because of the storm that happened back in April the 10th through the 21st.
[2:15:31] » The ice storm. >> Yeah, the rainstorm. Yeah.
[2:15:34] » Well, there was a ice storm and then the flooding.
[2:15:36] » Yeah. So, this is specifically for the flooding.
[2:15:39] » Oh, for the flooding. >> Flooding. Yeah. April the 10th through
[2:15:44] the 21st. >> Okay. Because I And what Mr. Trump did.
[2:15:49] Roscom County is not in there for the flooding.
[2:15:52] » Uh, yes, it's actually in there. Roscom, >> you had you had any conversations with
[2:15:57] Vanessa Barner about any of that? >> Yes.
[2:16:00] » Yeah, we've been talking to I actually emailed you and the clerk I think uh two
[2:16:04] weeks ago was at your >> Keep going because that was
[2:16:07] conversations with her. I didn't think we were in on the FEMA money for the
[2:16:11] flooding. >> Yeah, actually that's one of the reason
[2:16:14] I'm here. Actually, FEMA and SBA will be in Hton Lake, Michigan, uh at St. John's
[2:16:20] Lutheran Church this coming weekend, uh Thursday through Monday.
[2:16:26] Uh let me just check the hours real quick.
[2:16:33] I believe it's from uh 8:00 until 6:00 p.m. So, if you guys know anyone that
[2:16:39] been affected by the storm, um they can go to the disaster recovery center. I
[2:16:44] also have a number of brochures here that I can share with you and with the
[2:16:48] town. So, any businesses, nonprofits, homeowners who got affected by the
[2:16:52] storm, they can apply for that resource >> that including municipalities.
[2:16:57] » Correct. Yes. >> Wow. This is completely contrary to what
[2:17:00] was told before. >> Yeah, I think the one that you're
[2:17:03] talking about is is the ice storm. I I don't think that got approved.
[2:17:08] » Well, we we just submitted $14,000 worth of bills on the ice storm to the state
[2:17:13] of Michigan. >> Okay.
[2:17:15] » But the FEMA the money that FEMA that President Trump had cut loose,
[2:17:20] it didn't say Roscom County on the thing. And I asked Vanessa why that was.
[2:17:27] So, I'm not here because of FEMA. That could be maybe I can talk to Vanessa as
[2:17:32] well to explain that further, but I'm representing SBA. Just kind of an FYI.
[2:17:37] » Okay. All right. Yeah, if you got something, I'm looking at it.
[2:17:40] » Yeah. >> But yeah, that's the reason I'm here.
[2:17:43] And if you have any question [laughter]
[2:17:48] I saw you again, I probably would have did something.
[2:17:50] » Thank you so much. >> I appreciate it. Thank you, sir.
[2:17:55] » You're a patient man.
[2:18:01] a few.
[2:18:04] » Yeah. >> Yeah. But I'm not uh you know he's Go
[2:18:08] ahead. Go ahead. If he wants to answer, he certainly can.
[2:18:11] » What's his name again? >> I believe there's a couple who will
[2:18:15] print them up. >> There may be a couple people who have a
[2:18:18] question. If you'd like to entertain answering one now,
[2:18:22] » I don't think he's here yet. If you want to entertain answering a
[2:18:27] couple questions, >> go ahead and sit down.
[2:18:30] » Specifically, if somebody has flooded basement or we had a bunch of
[2:18:36] problems up on the north side where the road got washed out, they would show up
[2:18:42] down at St. John. Is that right? And they could fill out. And do you have any
[2:18:47] idea how much in funds are available for Rock County? Uh there's any specific
[2:18:53] price
[2:18:56] I'll definitely
[2:19:02] » Okay. And as far as I mean what kind they have to prove cost they come in do
[2:19:08] they have to have insurance claims or do they insurance just fail you know
[2:19:14] probably have clean up cost walls whatever
[2:19:19] everything really. Uh so if you have insurance you can't get
[2:19:24] so it has to be uninsured
[2:19:34] and so all that will be discussed at St. John, they will give they will give
[2:19:38] people help here how to figure that out. Is that correct?
[2:19:42] And is there a time on this? [clears throat]
[2:19:45] So that so 31st August 31st
[2:19:57] August 31st of 2026. >> Okay.
[2:20:04] » Great. So we just show up
[2:20:09] » similar to these meetings >> time limit. I mean time update.
[2:20:16] » Uh yes open.
[2:20:25] » Okay. So if you can leave me something uh we can get it up on Facebook for the
[2:20:30] township. >> Okay. I'll uh
[2:20:35] » and we can make copies for it, man. >> Well, if Yeah. I don't know. I have to
[2:20:42] get a hold of Vanessa and figure out where the disconnect was there.
[2:20:50] » Yeah. [snorts] Um Yeah, because we were trying to figure out how Ross Common
[2:20:54] County didn't get included in that. But All right. Well, I appreciate that.
[2:21:00] Thank you very much, sir. Sorry about you having to wait that
[2:21:05] long.
[2:21:11] [laughter]
[2:21:13] » It's like our attorney says, I'm not surprised at anything that happens in
[2:21:16] Lion Township. Uh, anybody else got a com or a comment,
[2:21:21] something they want to say before we go ahead, sir.
[2:21:25] » Oh, this is round two for you. >> Well, that was a question earlier.
[2:21:28] » Oh, okay. or it was a comment, but um Jim McCarthy 245 Sam
[2:21:35] um I already thanked you guys, so I was going to start out with that. Um
[2:21:40] I thought I had a lot to say, but really there's not a lot to say because I'm not
[2:21:44] here to change anybody's opinion. I don't I don't think I can. Um I'm really
[2:21:49] going to just try to appeal to what I hope is a universal sense of of wrong
[2:21:53] and right. Um, and even to trustee Demer's point of of how the law is
[2:21:58] interpreted in court, that's we'll try to even simpl it down. I mean, like,
[2:22:01] let's just say, for example, I'm speedy. If I'm 1 mile an hour, I'm about 30
[2:22:06] miles an hour. Breaking the law, I'm wrong. We can all argue it what the
[2:22:11] reason was or whatever. The enforcement, that's really discretionary, right?
[2:22:16] We've all been given that break maybe or I did meet somebody earlier this week
[2:22:21] who has never been pulled over. But uh um yeah, exactly right. Um but you know
[2:22:28] 5 miles an hour over the speed limit on the interstate is looked at differently
[2:22:32] enforcement wise than say 5 miles an hour over the speed limit in a school
[2:22:36] zone. I think what I'm going to ask of the
[2:22:42] board really is just to take a look at our ordinance, ordinance 62 closely.
[2:22:49] I'm obviously laser focused on on Bismar and I would ask that we look at the
[2:22:55] procedures from start to finish to include the permitting procedure to see
[2:23:01] if things were done properly.
[2:23:07] accepting minor discretions [snorts]
[2:23:12] to the gentleman's point earlier about his granddaughter sunbathing
[2:23:17] be outstanding if we could just say yeah just like the 5 miles and over on on the
[2:23:23] interstate but when somebody goes 30 miles an hour
[2:23:28] through this through the school zone and does something destroys something
[2:23:34] hits a kid or something like that and I guarantee you Everybody's going to start
[2:23:38] looking at every mile an hour over that.
[2:23:44] I don't care what side of the argument you're on. I think we can all agree that
[2:23:48] what happened on Bismar or at Bismar's dock on the 2nd of July [snorts]
[2:23:55] was a tragedy, an egregious violation of many things.
[2:24:00] I don't think we want to see that happen again. I do appreciate Bruce doing the
[2:24:04] investigating he has. I know that like a long time ago I was
[2:24:10] told if you have a hard time figuring out between wrong and right,
[2:24:15] usually the right thing to do is the harder thing to do.
[2:24:21] Sometimes enforcing those ordinances, abiding by law
[2:24:28] is the hard thing to do. Usually it is. It's a lot easier just to go speeding
[2:24:32] down the road knowing that you're probably not going to get pulled over.
[2:24:40] About 5 years ago now, we purchased our retirement home right here, 245 Samo.
[2:24:49] The 33 years prior to that, I spent all over the world
[2:24:54] defending what I hope or doing, fighting the good fight, I think, and defending
[2:24:58] our way of life. I don't say that to be pretentious or to ask for special
[2:25:03] treatment or anything like that. I say it to let you know that during that
[2:25:07] time, I was able to come back to this home state of Michigan [snorts] and
[2:25:12] actually look down at Higgins Lake from above and see that yes, that is the most
[2:25:17] beautiful lake in this state. And my god, that's a paradise down there, isn't
[2:25:20] it? [snorts]
[2:25:24] What I've seen in the four years, four summers that we've been here
[2:25:32] is that it [snorts] wasn't that paradise of thought. At best, it's it's a Dr.
[2:25:36] Seuss book of nichees putting stars on their bellies and taking them off and
[2:25:40] getting confused on who's who. At worst, it's the West Bank. But
[2:25:45] generationally, we don't even know why we hate each other. We just know that
[2:25:48] the ones before us did. I'm gonna ask that you guys take a
[2:25:53] little close look at what happened on Bismar
[2:25:58] and instead of waiting for one more incident,
[2:26:01] I'm gonna ask you to take a vote just like the ordinance says you can at any
[2:26:04] time on revoking the permit. And then because
[2:26:09] the sad irony of this whole thing is that we actually we I'm talking about me
[2:26:14] and my wife were advocates for the public and for
[2:26:18] the public access there. The first thing we started doing, we showed up as we we
[2:26:22] saw that public access and the erosion and the damage that's going on and the
[2:26:26] cobblestones that were dangerous for anybody to walk down. My wife started
[2:26:30] writing letters. She started out with the HLPOA because we didn't know who
[2:26:33] else and their riparian committee. She tried with the road commission. this
[2:26:37] year, even prior to the structure being built that's there,
[2:26:43] she contacted all the way up the state legislatores, even the attorney general,
[2:26:47] and then she started getting calls from the road commission, like we're going to
[2:26:51] do something. I went out there and tried to help the
[2:26:56] young man that was working on the stairs that Samuel said. I'm the one that said,
[2:27:00] "You might want to put a railing there to try to get this thing into code. you
[2:27:05] might want to get a permit so that people can safely go down here.
[2:27:11] So, I'm [clears throat] going to ask for that, a vote on it, the replication of
[2:27:15] its permit, and then I urge the board to work with
[2:27:21] Eagle, the county, the road commission, and come up with a solution to repair
[2:27:27] that shoreline. Give it a couple of years, whatever the
[2:27:32] profession, the people know, okay, I'm done. But the people know or the
[2:27:36] professionals say we might need it might be three years, I don't know. Restore
[2:27:39] that shoreline, put in a stair access that [snorts] is safe and will not
[2:27:45] create all that erosion. Fix it. Thank you for your time.
[2:27:50] » Thank you for your comments, sir. Anybody else got something they want to
[2:27:54] say tonight? Come on up, Phil.
[2:28:08] Uh, Phil Robinson. I'm a resident uh on West Higgins Lake Drive. Um, not very
[2:28:16] far from Samoset. I created a handout that I put at the
[2:28:20] table and passed some around today. Um, I spent a little bit of time recently
[2:28:25] trying to understand what's going on down there because having walked down
[2:28:30] there many, many times, I've seen changes take place and it's been hard to
[2:28:35] get straight information as to what rights people have and what people are
[2:28:39] not allowed to do because that basically everything on the side of the road on
[2:28:45] Samet that's toward the lake is part of a county easement.
[2:28:49] And that easement uh uh comes with certain um public rights. It also comes
[2:28:55] with certain obligations. It's been a little bit confiscated because uh
[2:29:00] there's been some judgments made in lawsuits in the past years that have
[2:29:04] created certain specific stipulations. Um, I've gotten the impression in recent
[2:29:10] years that some of the um, alterations that have taken place on the easement
[2:29:15] across from the private properties seemed at least in some part designed to
[2:29:19] create the impression that that easement is actually part of their property even
[2:29:23] though there's a road between them and the lake. And we've seen this recently,
[2:29:28] especially when many signs are popping up um saying private property, no
[2:29:34] trespassing, people are doing all kinds of
[2:29:37] improvements, and it's hard to get information about
[2:29:40] what's really going on. So, I decided to talk to a couple people and then I spoke
[2:29:44] with staff at the road commission uh this week and including the the road
[2:29:50] commission manager trying to get an understanding of what they plan to do
[2:29:56] and what obligations uh they have to make sure that the public have access to
[2:30:02] this. If you look through the document, um, I characterized the discussions that
[2:30:07] I had with them and some of them were surprising because not because they're
[2:30:11] unreasonable, but because I didn't understand how that thing operated. And
[2:30:16] as it turns out, that whole belt along there between the lake and the road,
[2:30:21] with the exception of the road ends, which have their own special rules, um,
[2:30:25] those um, areas are actually public access areas. And even the improvements
[2:30:32] that are put there by permit are allowed to be used by the public. So if you got
[2:30:37] there and you you build a sidewalk and you build a patio and you make a really
[2:30:41] beautiful place right there, that doesn't mean that now you own that
[2:30:45] property. In fact, the public is allowed to utilize any of those things that are
[2:30:50] put in place. And that was made very clear to me by um um Roger Saxton, who's
[2:30:56] the manager. Uh, I understand after speaking with the road commission that
[2:31:01] they're upping their game a little bit in terms of how to manage those access
[2:31:06] conflicts on that thing on that piece of property and hopefully they'll do a
[2:31:12] better job. Uh, the day after I spoke I spoke with them yesterday actually and
[2:31:17] today I went down Samet and lo and behold a lot of those private no
[2:31:24] trespassing signs are gone. And uh but there's still others that
[2:31:29] remain and there's other other artifacts that or private property that were
[2:31:34] stashed on that piece of property that have been relocated. Either that or
[2:31:37] somebody left for the weekend or left for the week. So I think you're going to
[2:31:42] see some changes down there because the public has a a right to actually picnic
[2:31:47] on that property. They have a right to park on that property. And I'm just
[2:31:52] repeating to me repeating what I've been told by people who I'm trusting would
[2:31:58] know and would probably wouldn't stick their neck out to say that if they
[2:32:02] didn't have good reason to do so. So if people have any questions about who has
[2:32:07] a right to do what there, I wouldn't hesitate to take those issues directly
[2:32:12] to the road commission and talk to people like the manager and they can
[2:32:17] explain to you uh in the context of other lawsuits that have been involved
[2:32:20] with property conflicts there and also their knowledge about what the general
[2:32:26] policies are about the county's managerial role in easement properties.
[2:32:31] you can come away with a lot better idea.
[2:32:34] Many of the things that have been put in there like these sidewalks and stonework
[2:32:39] and whatnot, even gardens and plantings, um I'm not saying specifically which
[2:32:44] ones, but you know, there've been uh most of them I think have been given
[2:32:49] permits. Uh but there are some that are not
[2:32:53] permitted and uh apparently they're in the process of doing a little bit of
[2:32:57] cleanup. And it's like a lot of administrative things. Sometimes time
[2:33:00] goes by and we lose track of, you know, what the regulations are and there's a
[2:33:05] lazy fair compliance uh program that lets things kind of drift off in a
[2:33:11] different direction. Quite frankly, just walking down there today in the absence
[2:33:14] of those signs and some of that junk on those properties made it a much more
[2:33:18] pleasant walk. Uh rather than uh little and there's still some little tiny
[2:33:24] fences even at the water's edge to discourage the public from from um
[2:33:29] entering that property with the impression that that's actually
[2:33:33] connected to a property across the street and they have no right to be
[2:33:36] there. >> All right, go ahead. Wrap it up if you
[2:33:38] can. Well, I I'll wrap it up like that because uh I think most of everything
[2:33:43] else that I learned is in that document that I passed around. It's a three-page
[2:33:47] document and uh I hope you'll read it and if you have questions uh before we
[2:33:52] get, you know, down the road and graduate into conflicts on that property
[2:33:57] uh access for the public, maybe we can avoid that by educating the public and
[2:34:02] the public can help educate itself about what their rights are as property owners
[2:34:06] and what the public's rights are as well. So, it's it's changing. The the
[2:34:11] acknowledgement of those changes are probably going to become more apparent
[2:34:14] as time goes by here. All right. Thank you, sir.
[2:34:20] Okay. Any other public comments from the crowd this evening?
[2:34:39] It's getting late. Trying to make it short and sweet. My name is Susan
[2:34:44] Lindamoon. I'm at 145 Samoset. Um, when I when Mr. Robinson came in
[2:34:52] today, he handed me this uh brochure pamphlet or whatever his opinions were.
[2:34:59] He made a phone call and someone told him maybe this or maybe that and he
[2:35:05] wrote it down on this paper and he handed it out
[2:35:10] and that's wrong. >> Okay. Don't get so When it gets loud, it
[2:35:15] ends up on the recording. >> I might get louder.
[2:35:17] » Well, as I as long as you stay this far away, it on the recording, it ends up
[2:35:22] screaming. >> When he sits up here and he says the
[2:35:25] Samoset people don't own the property on the
[2:35:29] other side of the road, I believe he's wrong. When I bought when we bought our
[2:35:35] property on Samosant, Remax assured me with paperwork and the legal lawsuits
[2:35:42] that were filed and won, all Samoscent owners own the property on the other
[2:35:48] side of the road. And in fact, on our deeds, it says that we gave the township
[2:35:56] the right away to put a road through our property. And why did they do that?
[2:36:02] because emergency vehicles need to get through
[2:36:05] there. It's my understanding. Years ago, it used to be a twotrack. Now
[2:36:11] it's become a racetrack. Samuel said it's unreal. How do you even walk down
[2:36:17] there beyond me? Let alone the kids driving golf carts. I got see
[2:36:25] three-year-olds sitting in the driver's seat. Come on. I mean, somebody needs to
[2:36:30] start policing. Samo said it's out of control.
[2:36:35] It's got to stop before someone gets hurt. I got 10-year-old kids doing
[2:36:42] uh circle eights in my driveway. They're going to flip. They're going to get
[2:36:46] hurt. It's almost ridiculous what we see on
[2:36:50] Samo's set. And as far as Mr. Robinson goes to the best of his understanding
[2:36:57] the comments the following comments he put on here the best of his
[2:37:02] understanding they're accurately portrayed in what he
[2:37:07] wrote this this is just someone's opinion he needs to see the legal
[2:37:12] documents that go to the property owners on
[2:37:17] Samoset before he is allowed to pass out at a
[2:37:22] public meeting of this paperwork. That's all I have to say. I I don't know
[2:37:30] why he doesn't like the people on Samoset. We're really nice people. If
[2:37:35] you want to sit on my swing, sir, you're more than welcome. I never kick anybody
[2:37:39] off. You want to go use my dock and get in the water? You're more than welcome.
[2:37:43] Just ask me. >> That's all.
[2:37:46] » All right. Thank you. Let's not go there. Thank you for your comment.
[2:37:51] Appreciate it. Uh, anybody else? Okay. >> Hi, my name is Jaclyn Valente. Am I
[2:37:59] close enough or am I going to be booming out of there?
[2:38:01] » You should be good. It's just on the tape it ends up banging it too hard.
[2:38:05] » Okay. My address is 5604 West Higgins Lake Drive. My parents is 5598 West
[2:38:10] Higgins Lake Drive on Samoset. They have a West Higgins Lake Drive, but they are
[2:38:15] on Samoset. And same with myself. I've been coming up here
[2:38:20] since I was 5 years old on Samoset for 55 years. Okay.
[2:38:28] The way this street is not monitored in any way, shape, or form anymore, it is
[2:38:35] out of control. And I know we're all waiting for something tragic to happen.
[2:38:40] Almost what happened on business, it was very violent. A lot of kids
[2:38:47] watching. Okay. It wasn't for young people to just to have to watch us
[2:38:53] and witness this. Okay. We need something in control. If it's
[2:38:59] this board, if it's somebody to start monitoring what is happening on Samson,
[2:39:05] you've got literally 8-year-olds, 10 year olds driving these side by sides,
[2:39:11] golf carts, whatever it is, minibikes, motorcycles,
[2:39:16] everything. Okay? Are you just waiting for my grandchild to get run over? Is
[2:39:22] that what it's going to take? A tragic situation, somebody getting possibly
[2:39:28] injured or or killed? We are asking for this board's support
[2:39:34] and having this street monitored
[2:39:38] this for 55 years. This is is out of control. Out of control.
[2:39:47] I appreciate your comment. I would reiterate again that anytime you feel
[2:39:51] danger or threatened, call the police. >> We have
[2:39:55] » Okay. I believe that what Bruce was saying and the fact they're probably
[2:39:59] going to increase their presence. >> We are never going to be 24/7 as a
[2:40:05] board. So, at least in the safety issue aspect of this, call the police,
[2:40:09] » the support and what we're asking. I no I I get your comment but if it's
[2:40:15] any like if you think there's a serious threat or trespassing
[2:40:20] don't even a year ago people used to call here
[2:40:24] » no >> we can't do anything you got to call the
[2:40:26] police >> all right I appreciate
[2:40:29] » I mean we write the state we write the federal whatever we'll we'll do whatever
[2:40:35] we can to help this street >> yeah safety I mean
[2:40:43] Okay. Well, I sus I suspect we will be having meetings and more comments can
[2:40:49] come up. >> I appreciate your comments.
[2:40:51] » I think maybe we should invite the road uh representative of the road commission
[2:40:55] to one of our meetings. >> Let them sit here and explain
[2:41:01] » everybody >> and they'll bring their attorney and we
[2:41:03] need to invite ours and it'll be a party that I don't know if it need that. I
[2:41:07] mean, >> well, yeah. I don't I'm not doing
[2:41:10] anything unless our attorney says we could do it.
[2:41:12] » Well, you can invite him here to speak. >> Yeah, that's what that's what I mean.
[2:41:16] This is heading towards, >> you know, he came here once to talk
[2:41:19] about short-term rental. >> Um, yeah, we're I certainly think we
[2:41:26] need to try and do something. I have no idea what that thing is yet and it has
[2:41:31] to be legal. >> I agree.
[2:41:34] » Thank you. >> Appreciate it.
[2:41:44] John Bart of Lion Township. Um, you know, I I really was not going to say
[2:41:49] much, but after hearing the stuff about Samuel said, um, I've heard, you know,
[2:41:54] um, Trusty Demer say, you know, we really we don't need a police source
[2:41:58] here. But I think maybe what you guys might be missing the point is that you
[2:42:04] know we that we feel that you need to be proactive that you we we don't want to
[2:42:11] wait until somebody makes a complaint or has or feels threatened as you said Paul
[2:42:17] I think what we're saying is that we need somebody monitoring that. We need
[2:42:21] somebody there to to sort of nip it in the bud to say look we've got a presence
[2:42:25] there so nobody ever feels threatened. So you don't wait until you're
[2:42:30] threatened. We need to have somebody monitoring that somehow. So, and I know
[2:42:35] it's a difficult issu situation, but I I just want to emphasize the point that,
[2:42:42] you know, to sit there and say wait for wait for a complaint. That's not what
[2:42:46] we're saying. The point is we want somebody there to monitor it probably
[2:42:50] would not have happened to Tim. Whatever happened, I don't know. But that was
[2:42:55] awful. and and you know if there are people doing things there that they
[2:42:59] shouldn't do there's nobody there monitoring it. So please don't wait for
[2:43:03] a complaint. Please be proactive about whatever your plan is.
[2:43:09] » Thank you sir. Okay we are down to Sam Bedian Jr.
[2:43:15] [clears throat]
[2:43:18] Thank you all for your patience. I said this at one of the concerts too. You get
[2:43:22] a bunch of people together with different opinions. [clears throat]
[2:43:24] Higgins like people get they know how to get along with each other, you know, in
[2:43:28] general. >> You're not hearing what they're saying.
[2:43:31] » No, I'm hearing what they're say. What I'm saying is fights aren't breaking
[2:43:34] out. >> They're not.
[2:43:36] » They are. Yeah. >> And not I'm talking about right here.
[2:43:39] » Oh, >> when we when we get together to discuss
[2:43:42] things, there are many townships, you've probably seen the videos, where the
[2:43:47] meetings just go nuts. >> We're if if we can work our way through
[2:43:51] this, I think that'll be it. To me, it's a credit. The people who live around
[2:43:55] here are great people. Anyway, go ahead, Mr. Bedoleian.
[2:44:00] Sam Bedian, Junior, Lion Township. [clears throat]
[2:44:09] I live at 205 Elamar Boulevard, four-way stop, just past the Silver Dollar Bar.
[2:44:15] Ed Nellis was supervisor. We had issues back in the day.
[2:44:21] Ed Ellis and I at the time Fran was sheriff
[2:44:25] went in discussed asked if the patrol cars that passed
[2:44:30] North State Park and go to Old 27
[2:44:35] and take Old 27 to Holton Lake could just detour
[2:44:42] and take Higgins Lake Boulevard through Lion Township
[2:44:46] and he did that and that's going on today. I'm leading to a point. So that
[2:44:52] was accomplished that you have patrol from the sheriff of Ross Common County
[2:44:56] in your township without having a police department that many years ago the
[2:45:01] public wanted you guys to have a police department. That's a whole different
[2:45:04] ballgame. I I don't want to get into that right now. But you have coverage
[2:45:07] now here with the board support. your supervisor
[2:45:13] can sit down with the sheriff and discuss these matters
[2:45:18] and I'll bet you he would have no problem having his
[2:45:25] patrol car detour and go right down Samuel set for exposure and take care of
[2:45:31] those problems. That's the one one way I see that you're going to have coverage
[2:45:35] that you folks need because we the township limited. Obviously, they don't
[2:45:40] have a badge. They don't have a gun. Neither does Bruce. And I'm going to
[2:45:43] defend him and every which way and a lot of things he's trying to do. But that's
[2:45:48] my suggestion. Get a hold of the sheriff and I'll bet you he'll have his patrol
[2:45:51] cars going down that road just like I saw four-wheelers parked at some Samet
[2:45:56] park and there's no parking signs there. He can't do nothing. He doesn't have a
[2:46:01] badge, but somebody can call the sheriff's department. Any one of you can
[2:46:06] call the sheriff's department on that. But he can go in there and talk about
[2:46:10] the fact of getting a patrol car down there. Now, this public notice,
[2:46:16] you're going to have to forgive me. That was in 2005.
[2:46:21] I'm not good at math, but that's 21 years ago.
[2:46:26] So, we that have been here have seen a lot. We're we're gonna try and help you
[2:46:30] folks because of these situations. It's a different generation now. Now you're
[2:46:34] going to have to re really get support from the legal end of it. Public Act 56
[2:46:41] was created by the legislators in 2012, which is a law. Now, I I had a kit here
[2:46:49] and I'm not going to pass it out. I'll wait till maybe next month. It's all
[2:46:52] about Public Act 56, which is a law. If you go on your phone, and I'm I don't
[2:46:57] even have a computer, but I went on my phone and asked for public act 56, state
[2:47:02] of Michigan. It just prints it all out what it is. And I believe me, you'll get
[2:47:06] educated on that. And then you'll get educated on this, but you'll still need
[2:47:10] legal help. I mean, the sheriff's department or even the state police. You
[2:47:14] can call either one of them. They will come down. You have a complaint, you
[2:47:18] call 911, call a complaint. They'll have they'll send a patrol car. That's their
[2:47:22] job. But I'm going to end at that. Thank you.
[2:47:27] » Thank you, Sam. Appreciate it. Anybody else? Any last last comments?
[2:47:36] Okay. I I want to thank you all again. I'm sorry I didn't state that very well,
[2:47:42] John. You're right. There are problems, but I have faith that the majority of
[2:47:46] people here can work together and figure things out.
[2:47:50] » And you're right. I can get a hold of the share. I've been sitting on
[2:47:54] probably shouldn't even Well, I'm not going to say it now.
[2:47:57] » There's a reason I'm kind of waiting before I get a hold of him. Something
[2:48:02] needs to be settled on their end first. Then I'm going to get a hold of them.
[2:48:06] » Wonder if they understand it's been going on long enough. They know what's
[2:48:10] going on, >> right? But there's a there's a
[2:48:12] particular >> get on it before the Labor Day weekend
[2:48:15] so they can start getting patrol to help these folks.
[2:48:18] » There's a particular thing that they need to make a decision on. that's
[2:48:21] probably going to happen this week. And at that point, I have
[2:48:26] » I'm wondering if we couldn't do something with either the state police
[2:48:29] or the sheriff's department and have almost like a a substation in the fire
[2:48:36] department where they could have like a little office there, have
[2:48:40] the car there. They're close by. We've got plenty of room in the fire
[2:48:45] department to have an office there. I mean,
[2:48:49] » we could buy we could buy an old police car, give it to Bruce,
[2:48:55] » but that way you've got at least something someone local. So, if if there
[2:49:00] is an issue, they're not coming from Ross Common or Holton Lake or wherever
[2:49:05] they're at. They're they're here. They're at the fire department. Um, I
[2:49:10] don't know. It's just a thought. I think that a lot of thoughts are going to come
[2:49:14] up and [clears throat]
[2:49:17] and we'll see.
[2:49:21] » Okay. Anyway, as far as the meeting goes, perfect timing. I would entertain
[2:49:27] a motion that we adjourn this meeting. >> I make the motion.
[2:49:31] » Okay. Motion by Demmer. Public comment is closed. So, do we have any do we have
[2:49:36] a second? I'll >> second.
[2:49:38] » Okay. Any discussion from the board? Okay, then the meeting is adjourned at
[2:49:46] 9:48. >> Holy crap.
[2:49:55] » Holy crap. Okay, turn your mics off. >> Hey, turn your mics off. It's all going
[2:50:02] on.
[2:50:17] When there's a sheriff there, but they will follow the kids all the way back to
[2:50:22] their place and then they get a ticket or whatever.
[2:50:27] » And then okay, then you don't see it for a few hours.
[2:50:44] I'm sorry.
