[3:52] you know the city ma have been working hard over the last couple years to U
[3:58] gain and and require additional water rights and working on getting a third
[4:02] well and uh due to the growth our city has experienced and forecasting over the
[4:07] coming years it's becoming a point where we need to become a little more
[4:10] aggressive in pursuing additional water rights and water
[4:14] infrastructure um we were approached by Burns and McDonald to assist us with
[4:19] these efforts the burns and McDonald McDonald team consists of
[4:23] hydrogeologists Engineers and experts in the
[4:26] regulatory in regulatory operations uh collectively as a team they've got over
[4:30] 60 years of experience working for municipalities and the regulatory
[4:36] agencies that make the decisions um regarding water rights and water supply
[4:42] infrastructure they've got years of experience working with many cities to
[4:46] assist in their water supply efforts including the city of wiah city of Hutch
[4:50] city of Valley Center mcferson and many others uh the city manager and I have
[4:56] met with Brian and Danel over several different occasions and we've got over
[5:00] some of the some of their approach to helping us with our water rights um Nick
[5:06] and I have been pleased with those conversations I'll let um Brian and
[5:10] Daniel kind of go over those with you a little bit but um they'll be able to
[5:14] help us a little bit with our existing water rights as well as um help us find
[5:19] additional water well sites and apply for water rights applications and
[5:23] they've got lots of experience working directly for those regulatory agencies
[5:28] that make those decisions um the Bruns McDonald team um in my and
[5:33] Nick's opinion would Prov would provide the city may as a topnotch and highly
[5:37] experienced group of Consultants that would put us in the best possible
[5:40] position to uh acquire more water rights and put our water system in a a much
[5:45] better spot um with that I'll let uh Brian Meyer uh kind of go over a little
[5:51] bit of their expertise some of their qualifications and share with you all um
[5:55] their approach and what they're going to do to help
[5:58] us thanks Nick I really appreciate it um Daniel you want to go ahead and share

[6:15] perfect yeah hey wanted to express our appreciation for the opportunity to be
[6:20] here tonight and and talk a little bit about Burns Mack our experience and in
[6:24] our approach um Nick did a really good job of describing a lot about Burns and
[6:30] Mac um but I wanted to go into it just a little bit deeper and and then open it
[6:36] up for questions certainly um you know one introductions I'm Brian Meyer with
[6:42] Burns Mack been doing water supply planning for um going on 40 years now um
[6:48] all predominantly in Kansas and in in Oklahoma spent the last 25 years with um
[6:55] Burns Mack um my role on this project is kind of twofold
[7:00] it's not only is the water supply planner but it's also to make sure that
[7:04] the project stays on track meets your goals your expectations whether it's in
[7:08] regard to budget schedule project needs at all times so be in close
[7:14] communication with with Nick to make sure that it is staying on track with
[7:18] that Dan would you like to introduce yourself hey thanks and I I would
[7:22] normally have my camera on but I am recovering from the flu so I didn't
[7:26] figure I wanted to share that that visual image with everybody but um um
[7:30] thanks for letting us join this evening I um I've spent about 15 years in the
[7:34] industry and I've dedicated my career to serving municipalities just like the
[7:38] city of ma and and and helping folks um get to that next phase in their in their
[7:43] water supply um portfolio and and that's range from traditional you know develop
[7:47] a single well and you know serving small communities to to well fields that you
[7:51] know are over 15 20 30 you know 100 million gallons a day so um that range
[7:56] of experience is has been right here in Kansas mostly but across the United
[8:00] States and then again it's a privilege to serve um water is one of those those
[8:04] critical aspects that uh is going to help you guys continue to grow so um my
[8:08] role in the project is going to be on the technical lead side of of
[8:11] hydrogeology that's uh that's my main focus but uh also on the project
[8:15] management side making sure we're headed down paths that are going to be
[8:18] successful in anything that we pursue uh for additional water rights um and then
[8:22] uh also on the technical side for welld designed and things like
[8:26] that excellent thank thank you Daniel couple other folks that on our team that
[8:31] I wanted to mention that aren't with us here today uh Dave Barfield um is with
[8:36] Burns Mack he's the former chief engineer for the Division of Water
[8:39] Resources um once he retired he came over to work part-time with Burns Mack
[8:43] and he is a um a real asset to the team when it comes to managing water ride
[8:49] issues and and dealing with challenging situations so he's a great resource to
[8:54] have we also have Matt Gallagher Matt's more on the infrastructure side as we
[8:58] know if we Iden identify a location uh that's suitable um for production from
[9:04] from a water quality water right standpoint the connections to the system
[9:08] and how that site's developed are are critical so Matt's on our team to help
[9:12] with that aspect of it uh just just a little bit of overall philosophy and it
[9:16] and it kind of says it here is that our typical water supply planning process is
[9:21] to optimize what you have to make sure that it's being used as efficiently and
[9:26] as effectively as possible and often those initial U measures are non-
[9:33] capital projects anything that we can do administratively to modify the water
[9:36] rights we'll talk about that a little more detail and then we move on to
[9:41] things that would be um adding additional Supply that have a
[9:46] infrastructure addition or cost to them so um the easy the low hanging fruit
[9:50] first to provide the highest value to the community
[9:54] so next slide Daniel
[10:02] as as Nick mentioned earlier um Burns Max is 125 year old company we've been
[10:06] in witto area for 30 years but decades working for communities around the state
[10:12] of Kansas and it really it really does cover pretty much the full geography of
[10:17] the state and um there's active projects in a lot of these communities right now
[10:22] so this is kind of an ongoing process we develop in Partnership that um continues
[10:27] over time when we get the opportunity unities serve a
[10:30] community um the the column on the right the the agencies that that Nick
[10:35] referenced earlier as well that's because of the work that we've done over
[10:39] the years we've developed those relationships and those have been
[10:43] critical in making sure that we can move a project from conception to
[10:48] implementation effectively and understanding what the um pitfalls might
[10:53] be as we move through that is there a permitting issue is there a is there a
[10:58] water qual issues or want a quantity issue making sure that we have a good
[11:03] dialogue with all of the um permitting agencies and the planning agencies um
[11:09] we've got the Kansas water office on there and as you know we'll talk a
[11:13] little bit more about this in a minute too um they've taken a more significant
[11:18] stance in recent in recent um in the recent year the last 12 to 14 months in
[11:24] water supply planning and providing funding for projects so they are a big
[11:29] player in this as well as as is the Bureau of Reclamation so next slide
[11:36] Daniel just one of the things with with those Decades of experience and and the
[11:41] benefit I think it brings to Mae is that you know each and every project is
[11:45] unique so you got to take a little bit different approach take a different um
[11:50] perspective on what success is and how to get there um just wanted to throw up
[11:54] a few examples of projects that are ongoing now or have been completed in
[11:58] the in the recent recent pass hay that's that's a similar wellfield um in Edwards
[12:04] County um and about a 65 mile pipeline that will go to Hayes and um be their
[12:11] future water supply to to support their Community uh Dodge City take a little
[12:16] little different approach and um with the depletions that we're all seeing in
[12:21] the ogalala out in Western Kansas they they saw the writing on the table that
[12:25] they really needed look hard at Wastewater reuse so that is the actual
[12:30] implementation process for using Wastewater to recharge the aquifer in
[12:34] the vicinity of some of their Municipal Wells and still meet all of the water
[12:39] quality standards um of kdhe um Ark City that was a new water
[12:44] treatment plant um that would is now in operation and it was designed to be
[12:51] compatible with their changing water suppli as they started to see their
[12:55] chlorides increase they needed to change the the treatment technology they were
[12:59] using so um M first that's one that just got completed late last year um once
[13:06] again a wellfield um to provide uh water supply for a declining aquifer in their
[13:12] area as well um in a more sustainable area so they developed a well field
[13:17] about um 20 miles south of mcferson and um we built the pipeline and a treatment
[13:24] plant to manage the water quality that was going to come from that wellfield
[13:28] that um in mcferson so all different types of projects all took a little bit
[13:33] different approach um and all of them took a lot of planning to go in to make
[13:39] sure that it was the right project for the community um and then then you do
[13:43] the project right so right project first and make sure we execute it
[13:48] correctly next slide Daniel thank you um just wanted to talk
[13:53] about something that's really come to the Forefront in the last oh
[13:59] 24 months I mean and it's because of the escalation we've seen all of the supply
[14:04] chain challenges um projects sometimes take
[14:08] longer to get done we start focusing on funding um at the beginning of the
[14:12] project once we understand what the needs are what the goals are and what
[14:16] the nature of the project is we start to think about what what funding sources
[14:20] might be out there and and of course we' got a lot of the traditional sources the
[14:25] srf um loan funds but we also look for Grant funds and
[14:31] we've been fairly successful over the last couple of years these are just some
[14:35] of the examples um mcferson BPU project came in it right right out of covid um
[14:43] and saw some tremendous escalation so we were able to go and get some emerging
[14:47] contaminant funding and um some CDs funding um is in the works right now to
[14:53] bring them about $6 million which hopefully will get um their take some
[14:58] stress off their budget couple of other success stories and the
[15:02] reason I wanted to point those out is because each one's different Garden City
[15:07] really went down the road of CDs or congressionally directed spending um and
[15:11] it was compatible with their project Dodge City um went with Bureau of recre
[15:17] funding and that allowed them to access Bill Kansas or the infrastructure Hub as
[15:22] well so um two different types of funding two different types of projects
[15:27] but we keep the keep the uh the everything on the table until we know if
[15:32] there's something available and if it'll fit and then we do what we can to go
[15:35] after it so that's that's a commitment we
[15:38] make next slide Daniel so this this is really kind of
[15:43] the project approach and and Nick did a good job of of describing it as well and
[15:48] it goes back to that that traditional philosophy that we apply to water supply
[15:53] planning projects you know and that's looking at the water rights of your
[15:56] existing Wells first um and one of the things that we are planning to do is is
[16:01] make a change so that each well serves as a standby for the other well so that
[16:07] if one well goes down you can produce the water rights um in total from both
[16:11] Wells from a single point um little more redundancy reliability in that and
[16:17] that's that's a relatively easy change the other significant thing with the
[16:22] existing Wells to optimize is is to look to see if there is um a additional water
[16:29] supply available at one point in time there was because I think applications
[16:34] were actually filed a number of years ago um for a number of reasons those
[16:39] were never seen through to completion um so we would take a look at that again
[16:44] make sure there's yield available and If there is apply for additional water
[16:47] rights at the existing points of diversion um so technically that would
[16:53] require no improvements to those Wells we just take a look at the productivity
[16:57] to make sure that they can visit Bally produce the water rights that would be
[17:01] obtained for those Wells the um the next step is the
[17:05] addition of of a new well or well sites um and once again there we take that
[17:11] conservative approach and I think the initial screening has already been been
[17:15] done and been positive in that it looks like it's in a reasonable place um from
[17:20] a water quality and quantity perspective and could be permitted um now the proof
[17:26] comes in going out and actually collecting the field data um where you
[17:30] would do the test drilling collect formation samples do the water quality
[17:34] um collection water sample collection and then do the pump testing what is the
[17:39] well going to yield um and then make and then that becomes a decision Point are
[17:44] all of those factors um in line with with what you need that well to produce
[17:49] and what water quality expectations you have for your for your utility in your
[17:54] community so and then at that point if everything's a go then it moves into um
[18:00] design and construction of that particular site at the point where you
[18:05] build the confidence to know you're going in the right
[18:07] direction um in in this scope we also um factored in some of the U flexibility
[18:15] because there are opportunities as water rights um are identified and or water
[18:22] right owners come forward are interested in in some sort of um partnership that
[18:28] we can evaluate those and make sure we understand is there something that's
[18:33] viable is there something that's valuable for the community so those so
[18:36] that level of effort is kind of on as assigned basis as they would be
[18:42] identified uh and we' be asked to evaluate them then we we would be able
[18:46] to go forward with that so that's what um that final task is and then I guess I
[18:53] would just sum that up with I mean that's the commitment going through that
[18:57] process is to get you to a place where you do have that long-term sustainable
[19:01] water supply that's going to meet the community growth and future needs so
[19:07] with that um Daniel and I would be glad to take any questions um about um our
[19:13] experience or our
[19:17] approach just uh really quick in the event that this meeting runs out in two
[19:23] minutes um I think uh Tristan has extended the time but I saw a timer that
[19:27] said there was five minutes minutes left so um look at that that I don't know
[19:32] whether that's fixed or not so um just in case that happens we'll send out
[19:37] another invite to everybody on this list
[19:47] apologize yeah I I don't have any questions I think it's a good deal
[19:51] personally there are there's obviously some significant cost with this but
[19:56] securing I think the securing the future of our water rights is pretty
[20:00] critical um I think Nick kind of Hit the hammer on the head um we want to have
[20:05] somebody that's going to guide us through a process to guarantee our
[20:09] future of our water rights you you as a council
[20:13] identified um you know securing those water rights is a critical need um at at
[20:19] our recent Retreat and so um I think uh in my mind just based upon conversations
[20:26] we've had with Burns and McDonald I I think their approach gives us the most
[20:31] certainty going forward and um uh we uh I would say uh we there there's a little
[20:38] bit of work to a little bit of work to do on our contract with Burns and
[20:42] McDonald but um uh if if you were to approve it today it would be subject to
[20:48] Legal review uh with the city attorney uh but and when you talk about the scope
[20:53] of their work and some of the deliverables I think they meet
[20:56] everything that we need to do uh going forward as a as a city
[21:05] organization
[21:10] okay does anybody else have any other questions Madam president I would

[21:27] to City attorney's approval and authorize the mayor to

[22:31] don't know if you want to chime in uh Mitch as
[22:34] well you the um so as we look at uh our moving forward as a community when we
[22:43] work with developers particularly residential developers um there are um a
[22:49] number of things that requirements that we have during the development process
[22:53] and um something that's not unusual that I don't think U a has done near as much
[23:00] as other communities is to come up with a
[23:05] development agreement when we pass um when we work to approve um uh
[23:15] petitions and uh those those de the development agreement and what a lot of
[23:19] communities use that for is it's a guide guidance tool to explain the
[23:24] expectations that we have of our develop ERS in our process and um it's it's not
[23:32] uncommon we did it when MC in mcferson where I was at and there's a number of
[23:36] communities around us that do the same thing um what we have before you if
[23:41] you're able to click on that link would be a a draft of a template that we'd
[23:47] like to utilize um that kind of lays out some of our expectations and I don't
[23:52] know uh Mitch are you on the line did you want to kind of just hit on some of
[23:56] the high points of uh of that sure Nick can you hear me
[24:01] okay yes okay uh public improvements is and assur go with it uh one of the
[24:09] things we wanted to make sure that that was key in this is like
[24:14] uh you know efforts for a rose control residential areas make sure the
[24:19] compliance they confirm with the compliance on that um a concrete wash
[24:25] out area that meets Nick veering was key in
[24:29] this he said you know make sure that it meets Environmental Protection Agency
[24:32] guidelines and then we uh that we have that in place to
[24:39] where they can wash out their trucks and uh in in a timely manner and all that
[24:44] and not make a huge mess um then you know responsibility for
[24:49] infrastructure damage um Nick Ving also brought to our
[24:54] attention that the uh damage that's being caused on site by
[24:59] ERS um and and the lack of attention to detail in that area so we wanted to
[25:04] cover that and then permitting and things things of that
[25:09] nature I think that covers it for the most
[25:13] part we did work with uh with with u the City attorney on this Pro point that was
[25:20] brought up to me by one of the council members I think is a really good point I
[25:23] just we just didn't get have time to get it into places we also have a payment
[25:28] structure and an set of expectations that we have um I think this is this is
[25:35] I'm not asking we're not necessarily asking for your approval we wanted you
[25:39] to show the process that we're going forward today um if if in theory a going
[25:45] forward with a developers agreement is something that that um you guys are in
[25:51] favor of we still got a lot of work to doing this and we also want to talk
[25:56] about our current processes when when it comes to um securing um securing uh
[26:04] commitments from a financial standpoint currently we require letters of credit
[26:09] and we only dismiss those letters of credit once they've reached a certain
[26:13] level of I think 35% is what they are 35% uh tax credits
[26:20] that apply and um once that once the development's reached 35% completion
[26:26] we'll dismiss those um dismiss those but they have to have
[26:30] constructed and actually have permits uh actually certificates of
[26:35] occupancy on 35% of the structures before we'll dismiss those so I think
[26:40] we'd incorporate some of that language into there actually when we started to
[26:44] go back and look we couldn't find some of the policies that apply to that so
[26:48] that part will have to be something we incorporate but I think it's important
[26:52] to incorporate those aspects of it as well so this is a just to understand
[26:57] this is a working document it's something that will change over time it
[27:01] may not be the exact for every developer but um some of the things that are in
[27:06] here I think should be consistently uh done across the board for
[27:11] developers I just uh today was probably as much about
[27:16] uh Mo giving staff some direction to move continue to move forward with this
[27:21] process um I I really think it it's there's a lot of things that are
[27:26] mentioned here that are help that are mentioned in other aspects whether it's
[27:31] the erosion control requirements for the city that are in different documents and
[27:36] it makes reference to those but it gets it all into one document that I think
[27:40] the developer can see are there any questions that anybody
[27:47] has um I have a comment I definitely think this is the way we need to be
[27:51] moving I think that um with all the developments we have already in progress
[27:58] and as much as we've been growing and building I think some of this stuff is
[28:02] kind of been all over the board and each time we're presented with a new uh
[28:07] Builder coming in we have to reinvent the wheel almost and this would make a
[28:11] basis Baseline for us to start with to be able to just say this is this is
[28:16] where we start this is what we have to work with these are what our
[28:19] expectations are and I think um I think it's definitely
[28:25] necessary we' tried to identify some of the common issues that we frequently
[28:29] deal with and that's one of the reasons that I think it's you know this may be
[28:33] something that does change over time as we identify new new trends that we're
[28:37] seeing from Builders or developers um but I think uh this gives you at least a
[28:42] snapshot of what we're looking
[28:48] at any other
[28:56] thoughts so far so good yeah okay we'll just uh uh we'll
[29:04] continue with issuing these so you'll see one of these likely the next time
[29:09] that you get um next time we have a brand new
[29:13] development that doesn't have any petitions already issued is where you'll
[29:17] probably see this um so a lot of the a lot of the developments that are already
[29:21] in place um we probably will not incorporate this so it'll just be new
[29:26] developments going forward
[29:30] if there's no other questions I'd entertain a motion to recommend staff to
[29:35] move forward with drafting the
[29:40] template I guess my my question is are we is the motion to move forward with
[29:46] drafting a template or to move forward with the template that was presented to
[29:51] us I think it'd be move forward with the template that's presented and make any
[29:57] improvements as as staff sees
[30:01] fit so I'd be on board with that but I do think it's important to get some of
[30:08] the payment stuff in there as I had emailed to you Nick so I don't know if
[30:13] it needs a final Council approval after that or not but um I think that's an
[30:20] important piece of it I I think uh the first one you see will have some of that
[30:24] language in there um uh so these will be approved whenever you see a development
[30:31] so um what what we'll likely do is we'll put out some of that information that we
[30:35] plan to incorporate into there we just don't have it in a policy form at this
[30:39] point U and we're able to find that current Administration was able to find
[30:44] so um we we will get some language out there that you're able to
[30:49] see and um and the first time you see one of these develop development
[30:54] agreements that happen at the time of development uh hopefully you'll see it
[30:57] in there
[31:00] and and Tom's read through all this stuff right so we're all good with that
[31:03] too with him uh yes that's
[31:08] correct okay yeah I want to make sure that we got our tees are crossed and our
[31:12] eyes are dotted on all this here because you know we're gonna get some um some
[31:16] Kickback we've uh we've met met on it probably three or four times internally
[31:21] as a staff and we've added to it every single
[31:25] time okay so uh not to be difficult but if uh if an agreement every time an
[31:32] agreement comes up with a developer if that's going to be put in front of
[31:35] council is there really any reason to take action
[31:39] here uh I I'm okay if you don't ultimately take action but I just want
[31:44] to make sure we're headed in the right direction and that everybody's in
[31:47] agreement that this is something we should be looking to do with all of our
[31:50] residential developers I I would maybe it's more
[31:54] consensus I would Echo Jennifer's comments that yes absolutely think we're
[31:58] moving in the right direction Nick I think Nick I think one
[32:03] other point to make that's relevant is I don't know if we noted it in here or not
[32:07] but we also talked about having that uh pre-development meeting with the
[32:11] developers that's something that's not happening right now as well that would
[32:14] go over all this in person with the with the
[32:18] developer I think that's important as
[32:22] well we just want to have a different we want to lay out our expect expectations
[32:27] so we think this is the best way to do it um ultimately and and to go over this
[32:32] whenever we do meet with the developer I think is
[32:38] important I important as we move forward some of these are expectations of their
[32:44] builders that that are out there working in here and so a lot of these uh you
[32:49] know the best person to hold those Builders accountable is going to be the
[32:54] developer in a lot of cases
[33:04] agree so we don't need to have a no as as long as there's no there no no
[33:11] concerns with us moving forward there's not really any action you need to take
[33:14] on
[33:17] this okay I'm I'm good with it okay as long as you do you know what Jeff and
[33:24] Jennifer said so I'm good with that we got to have certain
[33:30] standards okay with that being said um I would go ahead and have us move on to
[33:36] business 7c Evans building project series two 2019 IRB Amendment
[33:45] resolution okay um I'll try to
[33:51] um we were approached by um Evans building and by our bond attorney
[33:58] um Gilmore and Bell uh that Evans building has an interest in selling off
[34:04] a portion of their property and for uh we currently have an IRB standing IRB
[34:11] with Evans building and Evans uh I don't know I'm
[34:17] not exactly sure where where we're at in uh and terms of
[34:22] that IRB but we're several years into that
[34:26] IRB and for that reason um what we need to look to do is to amend the 2019 IRB
[34:35] that we had currently with Evans building to remove that section for
[34:40] which they plan to develop uh it's approximately 1.5 Acres I know uh on
[34:46] this call we do have Hunter Lem monion that is um the realter assisting in this
[34:54] process I don't know if you have anything else to add Hunter but um
[34:59] ultimately this is a this is just a methodology that we do to remove the IRB
[35:04] portion from uh Evans building and it the IRB that's currently in place would
[35:11] just apply to the section that that that Evans building continues to
[35:16] own there's a what basically we're asking for is to pass this resolution to
[35:22] mend those documents and then um any of those supporting documents that we
[35:27] authorized signature of those as well and the May mayor to sign any of those
[35:33] documents you want to chime in Hunter on anything or did I did I represent that
[35:39] correctly I think you represented that well um no that's exactly what we're um
[35:44] trying to accomplish here um a 60,000 square foot piece of property that Evans
[35:49] currently owns or akj Holdings um and ultimately there is a another type of
[35:55] industrial user that has shown interest in coming into that industrial park and
[36:00] yeah I think everything else that you had shared there is
[36:07] accurate once again this does have has had the legal review um uh we've heard
[36:12] from uh not only from our bond Council but our City attorney and it's a very
[36:16] similar step we did when we went to acquire a portion of the property Evans
[36:22] owns for our wellsite except in this case we're not the city's not purchasing
[36:27] ing it's it's someone it's a private uh property owner that's that's
[36:34] acquiring this section of the
[36:40] property any other questions do we know what type of
[36:45] company is acquiring at this at this point I don't
[36:50] think they've disclosed that um okay I just want to make sure it fits
[36:56] kind of what our goal they realize that there are some
[37:00] requirements that come along with the zoning and the industrial park I believe
[37:04] and uh you whatever whatever user it is I think is identified that um I I did
[37:11] have I did feel the call from the owner of Evans building at one point uh to ask
[37:17] about um another user and whether they' had availability of water and sewer for
[37:24] that location so um without um without sharing that information we did
[37:30] talk a little bit about zoning as well
[37:38] so any specials or anything that would be associated with that property would
[37:43] be transferable to the new owner is that yeah in this case I would assume that
[37:48] would be the case um do you want us to address that Hunter is is
[37:54] that new owner that that is correct nope everything you said
[38:00] there um essentially throughout this we would have kind of a respread type of
[38:05] agreement where they would proportionately share what's the current
[38:09] special assessments that are on that property so they would they would take
[38:12] portion in
[38:16] that unlike on the property we took where we weren't accessing into the
[38:21] utilities um um we we moved all of the specials onto that lot and it would be
[38:27] split between this property and and the regular Evans building
[38:33] property that's the other difference between the property we
[38:39] took okay is there any other questions or
[38:44] discussion if not I would entertain a motion uh Madam president I would move
[38:50] to pass the resolution to amend certain documents relating to the series 2019
[38:56] industrial revenue bonds and authorize the mayor to sign documents connected
[39:02] to said
