public hearing. I just like to briefly go over the procedures for that
[4:26]
following staff's presentation and any questions that the commission may have of staff.
[4:32]
The applicant will then be given an opportunity to speak. That will be followed by
[4:38]
members of the audience who wish to address the commission. Each speaker will be given up
[4:46]
to 3 uninterrupted time to provide their comments. And there's a countdown timer that
[4:51]
you'll see. Please note that the commission does not respond directly.

2 comments from the public, however, we may raise questions of staff that are that are
[5:05]
directly related to the comments that you make. And that would be after the
[5:12]
hearing is closed to before we proceed commissioner night and has a statement that he
[5:16]
would like to make the city. Thanks sure. Out of an abundance of caution and

percent to advice from counsel. I'll be recusing myself from this item to to a common law

conflict of interest and leave the room until the matter is completed.

Thank you, Commissioner night. Okay. This is item 9.1 Boulder's project, Mr. A
[5:52]
community development director. Could you please introduce this item thinks share members of
[6:02]
the public. The item will be presented by a penny, a manager, Ryan Fowler. I
[6:09]
but maybe this is probably one of them has projects that are actually going to be percent
[6:13]
into the Pentagon, which may be second to last. Some rain will be doing the presentation.
[6:20]
Good evening, chair and commission members of the public. This is a boulders to
[6:26]
residential project includes 3 and entitlement cases that the general
[6:31]
plan amendment peel and 24 Dash 0, 2, 5, 3, a change of zone killing. 24 Dash, 0, 2, 5, 2,
[6:37]
and a plot plan peel. And 24 Dash 0, 2, 5, 1, The project site is located
[6:44]
north of Newport Road and west of Marietta Road along its southerly boundary is Spirit
[6:52]
Park. And the project site is located northeast of the terminus. The cul-de-sac there
[6:58]
of Normandy Road east of the railroad and it's adjacent to the boulders. One project, this
[7:06]
boulders to project is the same applicant and owner has that Boulder is one project and we
[7:10]
will talk about a little bit of background on on that in future site. Here. So the general plan
[7:19]
amendment, I it is to go from 5 to 8 join units per acre Residential land use
[7:24]
designation to a 20 to 24 a droll units per acre residential land use
[7:29]
designation. Just important note on this. Back in December of 2021, there was a different
[7:38]
zoning. The 5 to 8. It was economic development corridor, new part Road that designation
[7:43]
would have allowed for a mix of uses, including commercial and residential. It would have
[7:51]
allowed for up to a residential density of 24 dwelling units per acre. In addition to
[7:57]
commercial uses. So this is kind of going back to that sort of density
[8:06]
the zoning designation is now currently the low medium density residential. That's to
[8:10]
align with the 5 to 8. Do you per acre and they are proposing a high-density HDR
[8:18]
classification. Again, the zoning for the site was the economic development corridor,
[8:21]
Newport Road that would have allowed for the 24 dwelling units per acre back in 2021.
[8:28]
Before it was changed. So little bit of a background. These are images of the
[8:32]
boulders. One project here. You're looking at the from the intersection of Brea Normandy
[8:39]
to the Northeast at the medical building there at the on the top image and then behind it
[8:46]
in the background are the residential units. But there's also a podium parking
[8:52]
facilities see on the upper image and then in the lower image you see of the day care
[8:57]
center that's there now as well as the boundary between the boulders, one existing site and
[9:03]
the proposed Boulder's to site. So as far as the timeline that was November
[9:10]
2021. That the planning commission approved this boulders, one project and then
[9:16]
in December 2022, they came back, made some modifications, some tweaks, and it was proved
[9:21]
by planning Commission for those modifications. Then the next year in 2023, they begin
[9:28]
construction. And in 2025, is when the boulders one started receiving some of their
[9:30]
certificates of occupancy to open up and start business. It included the boulders
[9:42]
included 3 medical, a 3 story medical office building which you see there, it had 234 units
[9:48]
of apartments and that is very similar to what we have before us tonight. And boulders to
[9:55]
there was a 9 three-story residential buildings, a day care and the putting parking,
[9:59]
as I mentioned. So as I mentioned, there was this ATC zoning and land use
[10:04]
designation on the site prior to 2021, you see it there. This is an image showing the
[10:12]
land use prior to that to 2021 change. So it says a whole swath. The project site
[10:18]
outlined in red as well as the boulders one project, which is immediately to the West and the
[10:22]
champion Self storage site. All is the ATC. Really? I think the reason why that was
[10:29]
originally ATC as because in Newport, Rhode was essentially Normandy road
[10:33]
that they were mapped to connect and then at some point, the Newport Road was directed
[10:41]
down to the south and then there's topography there that could have prevented any sort
[10:46]
of street frontage on the south side of the project site. So seeing that there was no
[10:52]
street frontage in really make sense to have the requirement of the EDC, which would have
[10:57]
required a mix of uses with commercial and residential. That's when that was the site
[11:03]
was changed to a more residential only designation and it was put in this category
[11:10]
in between the 24 and the existing residential to the to the north and to the east.
[11:15]
Now we have like us. We have a slightly different scenario and that we have a built
[11:21]
project immediately adjacent to the site, which wasn't the case back in 2021. We have the
[11:28]
boulders, one project as well. As you know, we have numbers and this this site would help
[11:33]
in terms of meeting the city's moderate and above moderate unit requirements for Reno,
[11:39]
which is a state requirement for housing units, location. It is not just important note.
[11:47]
This is not low or very low income, but it is meeting more than moderate and above
[11:52]
moderate. So now for boulders to switching gears to the project
[11:57]
before you tonight, its 240 unit multifamily. So similar to the
[12:03]
unit count of Boulders. One, it's on 10.1 for acres. You see it in the blue, a transparent
[12:11]
coloring, the five-four story, buildings. They were intentionally shifted down and
[12:17]
away from the residents to the north and to the to the east. So that way they were give a
[12:25]
much larger setback. You can see in the image on the left hand side. It's great out, but
[12:28]
you can see the outline of the existing boulders, one project and you can see that the the
[12:35]
boulders to blue buildings are set back almost double what the boulders. One buildings are set
[12:40]
back from the residents to to the north. Then along the perimeter on the north and to
[12:47]
the east, you'll see those yellow tripe Lexus. Those are 2 story.
[12:54]
So they will mimic car or kind of a line with the the residential to story buildings,
[13:00]
homes to the north and to the East. There's also a wrecked
[13:06]
building. That's 5,025 square feet that's shown in the green. And then there's a much smaller
[13:13]
maintenance building up in the northwest portion of the site was 795 square feet.
[13:20]
In terms of access. The me the primary access will be right in right
[13:27]
out off of Newport Road. And there is another access that is a
[13:33]
full driveway off of Bray a road. You see it's shown it goes through the boulders one
[13:39]
site and then connects to Boulder's too. She wanted to emphasize in this presentation
[13:45]
that there is no access through or on Harts Berg. That was an
[13:49]
intentional originally when the project came in because that road was stabbed out to
[13:56]
connect. It was really the originally shown in the site plan to connect, but then Spurs
[14:01]
staff's recommendation that is now closed off. There's a plan or it can't be connected and
[14:05]
instead we're connecting to Newport, with a write-in right out.
[14:10]
There are some improvements for traffic that the applicant is conditions to provide.
[14:16]
So one is a new traffic signal at Berea and Normandy. Just that the northwest corner of
[14:21]
Speer park there. They will also be required to install a northbound left turn
[14:29]
lane pocket at that intersection or just want to note, too, that
[14:35]
they have an alternative scenario and their conditions where they can provide as an
[14:39]
alternative, a roundabout which would keep traffic flowing at that intersection in terms of
[14:47]
parking. They're required per our code to provide 374 spaces and they're providing a surplus
[14:55]
of 4 above that number to 3.78 And in terms of their landscaping and screening.
[15:04]
So they're going to provide 1.7 acres or 16% of the site will be landscaped throughout
[15:10]
the site there upsizing the trees to be 36 inch. And 45 48 inch box trees. So kind of
[15:19]
starting off with a larger specimens. So that way has more of a media impact and then
[15:24]
along the northern and eastern perimeters of the site, they will be putting in evergreen
[15:31]
trees and show Brisbane box trees currently, which are rapid growing, have a high of
[15:34]
about 30 to 50 feet, depending on the environment. And those will be of size to be
[15:41]
the 36 inch box right off the bat. So that way they scream or immediately.
[15:47]
There is a landscape setback of the 20 feet on both the north and the east. And then in
[15:53]
addition, you have on the north side of 40 foot Channel Flood Control Channel that further
[15:56]
separates them from the residents to the North. Catch a quick question. Can go back
[16:04]
to that on the eastern boundary between this specific family residences. And that reflects
[16:07]
is we got the road trees, but is there going to be a cinder block wall, a wall? There is an
[16:12]
existing law existing will help. Also 6 foot 6. And they will be providing
[16:21]
recreational amenities can spread throughout the the project site in the northwest
[16:27]
corner as the the is the sites can slopes up. There is a clubhouse with gentleman's pool
[16:36]
and spa and in spread throughout the rest of the site. There is a tot lot, 2
[16:42]
different court yards with picnic tables and shade structures and grilling
[16:47]
equipment. And then in the northern portion of the site, there is a pickleball court
[16:52]
and dog Park. There is an open space requirement in the proposed
[17:01]
zoning designation of HDR that requires 20% open space there providing 21 through a mixture
[17:08]
of private open space com and open space, recreational area and passive.
[17:15]
The architecture for the site of the blooms was designed to blend but be distinct from the
[17:22]
Boulder's one project. So they're using the modern style architecture. Again, they're
[17:29]
using in the larger buildings, the horizontal lap siding metal awnings really means brick
[17:36]
stone veneer and then there's us recessing the windows, 2 inches to give it a more a
[17:42]
higher and look. For the 2 story along the north and the
[17:49]
east perimeter. They're going to be providing a little bit more warmth in and to more of a
[17:53]
residential feel, but still tying in some of those modern elements and utilizing garage
[17:59]
windows. Brick veneer board and batten lap siding, concrete flat tile, roofing and the
[18:04]
accidents and would pot shelves. One of the ACC's aspects of the
[18:09]
projects going to mention was that that access on Newport Road. So it does need to go
[18:17]
through a spirit park. So it will impact 0.1 0 acres of Spirit Park and shift it all
[18:24]
the way to the east side of the project site to can shorten the length that it has to
[18:29]
connects to Newport Road and also to avoid the active fields and courts that are in Spirit
[18:37]
Park right here where this new part road, the extension or connection occurs. It's a
[18:42]
natural passive turf area. And then and sáááá areas to offset the impacts of this loss
[18:50]
of Spirit Park. They're proposing to upgrade the parks to install some dog park
[19:00]
fenced areas with the infrastructure for that as well. Benches and and fountains
[19:05]
with that. Last week we did take the projects to the parks, Rec's
[19:10]
and Trails Commission that was on September. 3rd. To discuss, they're quick to
[19:16]
calculation, essentially for the public. The part that is the fee that can up that goes
[19:24]
to park acquisition. And at that meeting we received feedback from Prt. See, we will
[19:33]
need to go back after this project 2, because that was continued. That discussion
[19:38]
to solidify and finalize the Queen bee calculation discussion. That is pretty
[19:45]
standard. all projects after they're entitled go to the Rtc to iron out the details of
[19:52]
credits and how much she could be the responsible for. And the reason
[19:57]
why this one was brought before the planning Commission occurred was because of COVID,
[20:03]
the unique aspect of having Newport, Rhode go through the the Spirit Park.
[20:11]
Initial study for Sequin for California Environmental Quality Act to initial study, a
[20:14]
mitigated negative declaration was prepared, determined that the project will not have a
[20:19]
significant effect on the environment. And the public comment period
[20:25]
ran from July 29th to August 18th. We did receive comments from the from
[20:33]
the Department of Toxic Control, Substance or talks. It substances control.
[20:38]
And those comments were satisfied. Nothing further was required from them. And then we
[20:47]
did receive a couple 2 different correspondents. We email. You have all the
[20:52]
correspondence from the residence and then we did just receive one today that was
[20:56]
forwarded to you in part of your package. So this time staff is
[21:02]
recommending to adopt a resolution. I'm recommending adoption of a
[21:11]
mitigated negative declaration, incorporated and staff are in
[21:13]
the initial study in the conclusion that Boulder's to project look at approximately
[21:20]
600 feet east of railroad northeast of the eastern terminus of nor any road will
[21:22]
not have a significant effect on the environment. And to adopt a resolution
[21:28]
recommending City council approved the general Plan Amendment zone change the plot
[21:35]
plan for both the boulders to project. Just to make a quick note on that first bullet
[21:37]
should be recommending adoption. And then also you have for
[21:45]
exhibits in your blue folder. 3 of those are essentially enlargements are a print outs
[21:52]
for of Bell, make it a little bit more readable review of the exhibits that were in the
[22:00]
exhibit packet. You'll note that and on the on the one exhibit we struck out
[22:05]
language that said that only part. The part of the project site was in a very high fire
[22:10]
zone. Just want to make that correction for the record that it is the entire site that is
[22:15]
within that high fire zone. And then in addition, there is an exhibit showing the the
[22:24]
odd. There were some minor discrepancies between the version that is in your packet
[22:27]
and what they're currently processing with our fire fire department. So we provided that
[22:37]
as well. And then also, exhibit showing the the deployment areas and the the ladder
[22:45]
deployment from the fire trucks. So this concludes staff presentation were here to
[22:50]

So the applicant will need to have some access for 4 to that area for maintenance, including

[23:53]
between Pechanga in the the applicant. So you say the applicant. Does it

mean the H.O.A. once it's built around that H.O.A. is responsible for maintaining
[24:05]
that entire area or just certain fuel like so many feet in.

Just a point of clarification. Did the the project is safe or rental a product? Therefore,
[24:20]
I'm sure there's going to be a choice if they don't. That probably happened or that
[24:22]
company management company and they should be the property owner correctly on. But they
[24:28]
will legally be responsible for maintenance worker at a pay.
[24:36]
And just to confirm. Part one of the conditions of approval as that.

The project to install a traffic signal at Normandy in Berea right? Is that correct?
[24:47]
Yes. Okay. Or they have an option of the roundabout roundabout and me
[24:55]
if they do the roundabout. There will be no dig at extension of the left turn
[25:00]
pocket. That's correct me. But the way it is, that's correct. Okay. And is it one
[25:03]
of those two-lane roundabouts or a single lane roundabout? That's something that's going
[25:07]
to be decided in final engineering. He's going to be will says
[25:14]
Signalized and going to be a very bitter option. 10 traffic signals for for that location.

part of it was to make it a continuation of the boulders. One project there was serious

thought about how to better buffer, the boulders to projects how we can do better

than even boulders. One. So shifting all the density more to the southwest away from
[26:01]
the residence. But putting the residential buildings that are the same
[26:05]
height. This is the 2 story along the boundaries. In addition, the the higher
[26:12]
designation does help to us with reaching our moderate numbers for arena. Moderate
[26:19]
income numbers. Thank you. And with regard to the access road.

Because it's in a high severity. Fire zone.

Another access is required whether or not it's. At a low density medium
[26:41]
density. Things like that, right? That's so the access of Newport
[26:48]
Road would be required, whether it's this project or another project on this project site.

It's really just a necessity of developing this project site. And my question.

[27:14]
not a part of the 20% open space. Correct? No, that's that's not part of that.

start with. With fire. So when I reviewed the agenda report in the agenda packet.

The materials in the packet indicated that this site was partially yes, please, Madam
[27:46]
Fire Marshal was partially in a very high fire hazard severity zone and that the rest of it,
[27:51]
the say the westerly two-thirds ish. Was in a moderate fire hazard
[27:58]
severity zone. And I don't believe that's correct. And I think we established that that
[28:02]
was looking at that is state responsibility, area maps, not LRA maps and the LRA maps, the
[28:08]
local responsibility area. Does indicate that this is in the very high fire hazard
[28:13]
severity zone in its entirety. Is that correct? Madam Chairman Chair? That's correct. Thank
[28:21]
you. And so I that they gave me concern because that changes the
[28:26]
requirements for help projects going to ground. And part of that has to do with
[28:33]
0 zone. Landscaping requirements and where you can't have any sort
[28:38]
of combustible materials in the euro zone. And I didn't know on this handout that there is
[28:45]
strikeout language. Houston was too correct. Yes. I do know their language but
[28:53]

That one that one. So here's my concern. There are different requirements and well, I see

approved fire protection report gives them up into a building permit release too. and a
[35:14]
final. When he pulled a building permit. You still have to come
[35:17]
compliant with what the code is today. So if the pulled it in 2 years are they pulled it
[35:25]
in 6 months? It is what today's requirement is, which is all the zones to
[35:32]
0, 1, 2, 3 feel modification requirement and all the requirements that are put forth
[35:34]
in the California will be code and so they would have to come compliant. The should they
[35:39]
choose to put today. Should they choose it to pull in 2 years? Those requirements
[35:46]
when change and what we've seen today. Nothing drastic is changing.

Protection regulations. So again, at the time of building permit, it would have to meet
[38:32]
all those requirements section excuse me, condition to a 7, 5 protection plan. Fire
[38:35]
protection plan for this project must be submitted and approved prior to any
[38:40]
landscaping being approved. Please ensure that all information on the landscape
[38:44]
plan, some middle matches what is proposed and approved in the spp. I defer to the middle
[38:48]
for the fire protection plan must be made to them in a few office of the fire marshal
[38:51]
prior to a building plants, the middle again, notwithstanding the the excuse
[39:00]
me, the exhibits. Wet weather. It says there is no escaping for 5 fever, 10
[39:07]
feet if in 2 years the state says that our local area needs to have 20 feet as you're
[39:12]
escaping. That's what will be required at the time. The building permit. It's being

you. Is there is there a line of sight study at that point? They do it by pulling that

right. Turn lane back obviously helps the line of sight unless of a larger vehicles coming

into that right turn lane, then they can determine whether or not they have a clear

explaining what projects are in process where they are in the process. They're also part of

meetings. We there, director of facilities where we have to do in all of the projects and let

in and building new parks as well. So in regards to this specific project
[55:26]
this is unique because it's probably one of the few projects that actually has and
[55:33]
the impact on existing park or it actually taken away open space.

So the app pic and we've had discussions with you have to kind of sets you see on the
[55:46]
proposal they try to upgrade the existing parking, create more amenities. They are
[55:52]
willing to continue to have conversations but staff with community service
[55:59]
as well and eventually meet Parks Commission as well and make sure
[56:05]
that to the not only comply with the Queen Bee requirement, but also I either upgrade or or
[56:13]
or provide some type of public benefit, but it's going to ups of set
[56:20]

would actually attached to harbor. And that's what we thought we were going to
[59:08]
originally do. And then the most, the Street, which is parallel a canal, would come
[59:13]
down through. Bull is one boulders to and then turn and connect to would have a loop.
[59:16]
That's what we thought we were going to have. We purchase boulders, one at
[59:23]
that time. Bull is one in boulders to which the brine. Clearly he thought it was part
[59:31]
of the EDC Newport Road and then we had to have a was to add 24 units per acre. We have
[59:38]
had had to have a commercial and a business, a portion of the project. So that's why we
[59:45]
put the medical center building in there, which is a three-story medical center.
[59:50]
And we also build a daycare center, which is the 9,000 Square foot,
[59:56]
a day care to enhance the project. We felt both the medical center and the daycare
[59:59]
but help enhance the community. During that construction phase of boulders.
[1:00:09]
The boulders to the developer told us that there was going to he was working with the city to
[1:00:12]
turn. It turned into single family housing had a density of the 8, which with ADA, he could
[1:00:23]
make it 160 units. And then he talked to us until said he could not make a pencil and
[1:00:26]
that was going to go to the market again at that time we met with the city and we asked
[1:00:32]
if we if we could go back to do 24 and that was the verb each at the time was that with
[1:00:38]
Reena, which is the new State procedure to increase residency units in a city that they felt
[1:00:46]
that was possible. And we want to head and purchased. The goal is to think, you know, we're
[1:00:53]
going to put 240 units just like we did in Boulder's one because of pencils for us.
[1:01:02]
And then in 2025, we were told by the city that he harbored a entry into the project would
[1:01:09]
not be allowed for 2 reasons. One day received complaints from the neighbors, concerns

from the neighbors of higher traffic. But the real reason are a strong reason was the

fire marshal did not want to have access with fire equipment coming down through a

that they felt that we be allowed to go through Spirit Park and what they call the

new Port Road cut through. So we thought that was the pretty logical idea. And that
[1:01:56]
allowed the staff to access is one access from Berea Road North and the other coming
[1:02:04]
in from new port. So that meant that we we felt we had a green light to continue to develop
[1:02:08]
the property and that approximately a month ago, we were told that on Spirit Park
[1:02:14]
in lieu of having to cut through that. If we would put a dog to
[1:02:19]
dog parks, a large dog park and a small dog park and some improvements to the year.
[1:02:24]
And we agreed to that. And that has been finalized. But you can see the yellow. There's 2
[1:02:29]
circles there and that yellow areas of the dog parks, a small dog park and then a large dog
[1:02:36]
park for the size. The dogs also canopies there for shade. Seeding tricking found trick in
[1:02:41]
town for the dogs and also for for the folks. If you look, we also a one-time
[1:02:47]
one of the dog parks was going to be on the. West side of the cut through. But the thing they
[1:02:56]
want the project to be in the most passive areas, which we put them both on the on the
[1:03:02]
east side. If you can see the Spirit Park, which is phenomenal park. But just to
[1:03:07]
the basketball courts, tennis courts, the play areas, the rec area, the shaded area, the
[1:03:13]
barbecue areas and the parking lot. The mayor is all to the to the West and that the past most
[1:03:18]
passive area is where the cut through is. And that's what we have today.
[1:03:27]
I don't think it would behoove us to go through the our Power Point
[1:03:31]
presentation because it was so well covered by by staff. I just want to give a little
[1:03:39]
history of the access because the access was Spence been a challenge and we've we've we
[1:03:44]

project. We're in permitting with that. We have a contract over permitting that.

So basically the 3rd floor in the first floor full and the second floor. We have been 23,
[1:04:56]
people that are entertaining it and we have not signed contracts that any of those 3
[1:05:01]
want to miss the dentist want. And then the other one is AM. Rehabilitation center.
[1:05:10]
Okay. And they do that. By the way, then you react to the population. The day care of
[1:05:16]
that will hold 120 right has a 80 80 plus students. So they're profitable now and they're
[1:05:20]
running. I think it's a very high caliber daycare. I'm very, very happy. But the folks that
[1:05:25]
have that and then we're right now at 199 occupants in the 234. So we're about 80 89 just
[1:05:36]
about not quite 90%. We get between for 5 to 6 people week that move in. So we're
[1:05:42]
expecting some time late this year that before it fully occupied and are you
[1:05:47]
obviously is can the city will make the final decision? But are you leaning towards a
[1:05:52]
traffic signal or a roundabout way around about would keep better flow. We've talked to.
[1:05:58]

not long enough. So that's why I'm here too. We've had lots of issues. It's been nothing

short of a nightmare since Boulder Boulders, one has started and unfortunately, we
[1:15:37]
weren't able to provide comments at that time. We were in communications with the
[1:15:43]
project, you know, PR person went up to the site phone number work constantly
[1:15:49]
in communication because of the dust. And unfortunately, since the boulders, one project
[1:15:57]
has started, our backyard area has not been habitable. In addition to having replaced
[1:16:04]
having to replace our AC unit, we our pool. Unfortunately, I know first what problem but has
[1:16:11]
been on some level. in addition to that project and just all of the movement around
[1:16:16]
there has been even though we were sure there are water tankers there that are just
[1:16:21]
making sure that the ground continues to stay wet. That did not happen. There's not a day
[1:16:29]
that goes by that the dust is accumulating outside in our backyard and within our home.
[1:16:33]
So that's an issue. Second, another issue is the parking on the and exiting door
[1:16:41]
about court making a left onto Berea. There's so many parked cars there is. It's completely
[1:16:50]
packed and there's and I'm not sure what what you have, what the if there has to be a

sidewalk painted red. But unfortunately, everybody is packed right there and it's

hard to see. And especially during the boulders, one construction, a lot of the

I miss. But at the Times that I do have to leave a little bit later, the traffic to go right

mitigated. But then on and also the driveway on Hershberger Road. But then going into

boulders to I don't know where these residents are currently parking or where they're going

to park because it's going to get worse. And it's probably going to continue on to do

about quarter and affect all of those residents. Residents there and I have to drive on to
[1:17:57]
talk about court entre to exit onto Newport Road. So the traffic is just going crease.

I hope that the communication between the developer and the residents continues to it

continues to improve because there was a big lack of communication. And there was a

For 2 reasons. First of all. If you go West Harbor area on Normandy.

That goes to an area with hundreds of Audi Murphy homes. The only other street that
[1:19:01]
those people can get out to Newport on. Is gets road. That's the only 2 ways those
[1:19:10]
hundreds of homes can get to Newport. The traffic coming down or
[1:19:16]
Monday at rush hour. And then the evening. Backs up almost to Salt Creek.
[1:19:27]
That rat scares me. The traffic on Newport wanting to turn right on to Berea.
[1:19:35]
Backs up on the new port at times for that intersection of Berea and Norman Tree.
[1:19:40]
The impact of that intersection. Literally with this project
[1:19:46]
be doubled. The density is too high. I don't know anywhere else in
[1:19:53]
Menefee where they have such a density of of of homes and cars. The 2 ladies before May's
[1:20:00]
spoke about the parking on Berea that narrows bread down very significantly because the
[1:20:05]
cars are thick on both sides. The second reason I'm opposed to this project.

Is that access across the park. They talked limiting of the park area. The number they gave
[1:20:25]
didn't include that. The celebration lane that came up with your questions. That's
[1:20:30]
going to cut into the park even more. The 2 dog parks. They're going
[1:20:37]
to be too small to be useful. There's a nice dog park over on Marietta.

If the city wants to do another dog park. The park over on Bradley.

It's got a lot of area that can be used because it's inundated with gopher holes.

a walk. She has to be walked. She is high energy dog and I can't do it anymore. So my

husband has to do it because she needs to go to 3 to 4 miles every night. And I want to be

more. It's too hot to do it during the day. It's small kids. And I won't let them ride

their bikes around the block anymore because the traffic now is too high and Orville.

So if we add more cars because we're adding more residents and it's only going to get
[1:22:13]
worse because they do cut through from Marietta to go through Doraville. I'm a
[1:22:21]
resident on gifts for and so I'm street removed. But I still I can't let them go
[1:22:26]
up any further because there's a car. Every time. So I took notes for the dog park as well.
[1:22:36]
The place where you put it, there's no parking for that. So you'd have to go. Crossover
[1:22:43]
somewhere. So that doesn't make sense. Also have the infrastructure that you guys
[1:22:47]
are proposing. I mean, the grocery store is. Crazy. Can't go past 4 o'clock
[1:22:52]
because now you have there's a dunce from the new construction. You're speaking
[1:23:00]
about. You have the construction that's going on everywhere. And then you now
[1:23:02]
have these residents and now you want to add 300 more residents because you have to
[1:23:08]
think it's not just the departments that one person per apartment. It's going to
[1:23:13]
be couples. It's going to be roommate. It's going to be, however, many other people.
[1:23:19]
So it's not one person you're adding. It's not a single unit that you're adding. You're
[1:23:25]
adding. 600 more people. Because whos just to people sometimes stop. Not the way

the proposal, not not so much the apartment complex because I think the the city needs more
[1:24:59]
affordable housing for a lot. A lot of young families. Singles and couples. But the
[1:25:04]
fact that the proposal to take the park take and put a road through Spirit Park is
[1:25:10]
unprecedented. Her in the city that section of of Spare Park is a passive park. It's it's a
[1:25:19]
very popular place to to walk. There's a beautiful walking path through there on the
[1:25:24]
boulders and the the pine trees. I was just there on Monday with my grandson.
[1:25:32]
And I just we we were unanimous in our in our decision first not to to prove a quid. The
[1:25:36]
assessment for the project at this time because what? And so we kind of hit the ball back to
[1:25:43]
the planning Commission on this project. And as well as we wanted to hear more from the
[1:25:50]
public and and even suggested to some type of public public hearing
[1:26:00]
specifically regarding the the the effect it'll have on on on Spirit part, putting a road
[1:26:04]
through Spirit Park by setting that one acre section of the park concerned for the safety
[1:26:10]
of our residents on the bike trails on The Walking path up on the sidewalk. With that
[1:26:19]
right turn in for from westbound. Only right. Turn out to going westbound.
[1:26:23]
I'm thankful that there was no signal propose there, but to it's just not.
[1:26:32]
It's not a great plan. I'm not opposed to the project itself, but the access to this project
[1:26:36]
has severe restrictions. I know the neighbors don't want to access to harsh. Harsh Berg.

Is it to the streets and there's a limited access to the on the connector to
[1:26:49]
the existing, even with the contractor proposing to give us the dog parks, which frankly

little bridge on the Walking path. It sets at lower grade level.

I now work for the state of California and I work from home. So I live on the record
[1:27:55]
in the apartments directly affect me as far as working from home, I hear constant
[1:28:01]
screaming domestic violence issues and that in turn affects my mental health as well as my
[1:28:09]
and within our property. And we've had occupants come to our door to ask for
[1:28:15]
surveillance. Do the fight in front of our property because birria is already filled.
[1:28:20]
They park on our street corridor full court. So people have parked their they left
[1:28:25]
chest bear. There's increased drug use which is not proper for kids because there's a day
[1:28:35]
care for one. There's a park. There's 2 we would eventually that's less than a mile and
[1:28:39]
half away. So it's like not beneficial. They have also reached out to
[1:28:47]
our other neighbors in regards to camera footage and we should not be going to be put in the
[1:28:49]
position of becoming the security system for new development.
[1:28:55]
If this does get approved, I have also requesting from the city of residential parking
[1:28:59]
permit parking permit program for surrounding homeowners. The additional residents of
[1:29:06]
vehicles from this development recreate will create additional demand for street parking and
[1:29:09]
existing homeowners should not lose access to the parking that we rely on.
[1:29:16]
Another major concern is privacy. We were promised privacy. But in as you
[1:29:20]
mentioned before, they did not. Provide any privacy at all. Therein properly spaced.
[1:29:29]
So. They don't. I don't. They providing coverage to it from the
[1:29:34]
balconies to into our backyards. The leaves dewfall year-round. So.
[1:29:41]
Again, do not provide part privacy. As far as the part. I do feel
[1:29:48]
like that's essential to our children here in Menifee because

there is not much for the children who are already complaining about the e-bikes

are complaining planning about this. Every time I go by that park, the park is full. It's

consistently the parking situation is atrocious. It's starting to overflow onto

Dorval it's not safe for any kids riding bikes up and down the
[1:31:30]
street anymore like it used to be. Where is just regular residential? Very low volume of
[1:31:36]
traffic. Now it's high volume of traffic with everyone coming through and it's only going to
[1:31:39]
get worse with approval of this. This complex. I would propose that you build
[1:31:48]
on spirit part, give more land to the kids, give more land too. The residents give more
[1:31:54]
land to beautiful landscapes instead of just high-rise buildings. That's what I would
[1:31:58]
love to see for my community. If you go over to the sports park, I was at the sports Park
[1:32:03]
Lake Elsinore Sports Park last night. It was completely packed full of kids packed proxies
[1:32:09]
like football practicing soccer. We literally had to park on the street because
[1:32:12]
there's no more parking field in the park like we need more parks and to take away parks
[1:32:17]
and a takeaway, recreational activities for high rises that. Just are going to impact the
[1:32:23]
traffic in our community impact the crime statistics in our community
[1:32:29]
and just take away from what our community needs and take away from Parks and rec.

I don't think is there a correct answer here? I would like to see a more

space for for a communal. You sound like to see more space for children. I would

parking spot with their units on the townhouses, but they have a second car.

the residential product that they are not okay with ICE acting the part that part and

also they were not okay with the dog park. The from what I recall. And

they said that passive. Open space is part of an official to the community
[2:06:21]
because the dog park on the caters to a certain type of resident.

Is there any viable alternative to the Newport Connection? We've talked about the travel

access. So is there any other viable opportunities for this infill project other than that
[2:06:58]

options? You know, that this was actually the staff's recommendation to the applicant
[2:07:10]
because of time we were concerned with the neighborhood to the east. So we want to
[2:07:16]
impact that. So we obviously understood that we're going to be patients with the cultural
[2:07:20]
resources. So this wasn't even proposed by the applicant. And we
[2:07:26]
actually have Brad to forward to the app and say, you know what, let's look at this
[2:07:30]
because this seems to be I love all the scenarios. The least. Harmful to that to
[2:07:42]
the neighborhood right as Maybe a lot of weight on a couple more other issues in terms of
[2:07:47]
your comments about making for ownership project you know. Everything that we process or
[2:07:56]
18, 80% of what we process in Cannes before the planning commission is for ownership,
[2:08:01]
whether it's single-family residential where there is a medium density or even higher
[2:08:06]
density in terms of of condos, right there. He's a need over a makes
[2:08:14]
both types of units. These. Project for one-bedroom apartments, two-bedroom
[2:08:24]
apartment, which we don't have a lot of options in the city. So I'm
[2:08:31]
that makes a challenge in trying to provide the type of product we constantly to get
[2:08:39]
comments from. Residents. Then, you know, they're they're college kids.
[2:08:43]
You know, they can come back because they that they don't have a place to go. You
[2:08:51]
the residential single-family home price in the even though. It's more economical and in the
[2:09:00]
side of of the county and still expensive for a segment of the population. So this helps us
[2:09:07]
meet that need as well. In terms of your statistics for a crime. We've had other
[2:09:17]
multifamily projects because strength in other parts of the city. We haven't seen that
[2:09:22]
increase or at least the house and the chair with that. So I'm not sure if this is
[2:09:27]
unique to this area where there are affecting that as well. So I
[2:09:34]
don't think there's a correlation between multi-family in crime. They
[2:09:39]
may be some but not not to the extent that that we're talking today.
[2:09:47]
So on to pay back money just said the project I'm referring to near me. It is a gated
[2:09:51]
community. So that is something staff with that effect crime levels and behavior on the
[2:10:02]
site. Would you think? Kind of along those lines? I've heard a number of things
[2:10:17]
this evening from neighbors, the comments that most concern me that I've heard
[2:10:25]
really revolved around. For lack of a better phrase. Also criminal activities around
[2:10:32]
the site that that concerns me that concerns me because if if I live adjacent to that,
[2:10:39]
I would not feel at peace at home and that's really important so that that one
[2:10:44]
resonates parking issues, off-site parking issues that spill over
[2:10:49]
out of the project. I think that's another very legitimate concern.

I I want to get to safety in just a second, but I want to see if I could. I'd like to say
[2:11:01]
a couple of things. The access off of Newport doesn't particularly concerned me.
[2:11:05]
I think that there's a way to potentially mitigate the impacts of that. I think what
[2:11:11]
you ask for some additional mitigation is appropriate. I don't know what that is yet,
[2:11:14]
but I think there's a way to do that. That seems to be the least impactful, a remote
[2:11:22]
location and without secondary egress, even the 5 to 8 density. Would not be possible
[2:11:31]
to build on this site. Secondary means of egress that remote like that is absolute.
[2:11:36]
Otherwise you create additional problems for the city that I would particularly. Now.
[2:11:41]
But but that's just we have to have that. I do like the way that could
[2:11:49]
you flip to the ran one of the site plan may be that landscape plan. Whatever most clearly
[2:11:54]
shows the drive aisles. Through the project. I do. I do think there is a but
[2:12:04]
and that's OK about the colored up 1, one that had colored rivals result easier to see
[2:12:09]

me. The circulation through the sate is a little concerning having to zigzag through that.

That last could you use the cursor grand the bottom block of for story buildings,

the one closest to Newport. You, which ones I'm talking about. Yeah, that block.

Could that block seems like that block could be mirrored. So the drive I would come
[2:13:20]
straight down and you have a pedestrian. Corridor through the center
[2:13:27]
of the site leading to the recreation center. To me that works a little better. It
[2:13:31]
doesn't. I don't think you lose any units. It separates making. It said all along, make it a
[2:13:39]
square. No, just mere mean with that. If it looked around this way and friend so the drive
[2:13:45]
out would be on the right side and the pedestrian path would be through the.
[2:13:49]
