Chairman and members of the board. Uh my
[4:42]
name is Kevin Delaney and I'm the u vice
president of site acquisition and
[4:47]
development for Industrial Tower and
Wireless. And um we just again want to
[4:53]
thank you for the opportunity to present
this application tonight. Uh we have a a
[4:58]
PowerPoint presentation that we'd like
to go through. Um we're going to be
[5:03]
discussing the proposed uh facility. Um
the wireless coverage need for this area
[5:10]
and h how we're seeking to address it
and the site selection process and the
[5:15]
proposed design. So, what we're seeking
tonight for is a site plan review uh to
[5:22]
construct a 190 foot lattice
telecommunications facility and it's
[5:26]
intended to improve wireless coverage
along Route 41 and the surrounding
[5:31]
areas. So, as shown on this map, our
proposal is located on the east side of
[5:36]
Route 41, which is also known as 1486
Pond Road. Uh the property is identified
[5:44]
on the town assessor's map as map Hold
on, Kevin. We have the audience having a
[5:48]
hard time hearing. Let me see if we can
get the owl going.

» Great. So, we're seeking a site plan
review to construct a 190 ft lattice
[10:55]
tower uh intended to improve wireless
coverage along Route 141 and the
[11:00]
surrounding area. So, as shown on this
map, our proposal is located on the east
[11:04]
side of Route 41, which is also known as
1486 Pond Road. The property is
[11:10]
identified on town assessor's map as map
10 and lot 13 and the property is a 5.4
[11:16]
acre lot and it's within the limited
commercial district. Uh this is a
[11:20]
picture of the property itself using
Google Earth. Um so we're going to have
[11:26]
a proposed driveway which is
approximately 260 ft in length. I'm not
[11:32]
sure if you can see my uh my mouse
pointer or not. Uh, but this is the
[11:37]
proposed driveway to the site. It'll be
260 feet in length and it'll be 12 feet
[11:44]
in width and it's going to be all within
a 25 foot wide access and utility
[11:51]
easement.
Now, with the exception of one utility
[11:55]
pole located at the entrance, um, all
the utilities are proposed to be
[12:00]
underground from that point all the way
to the tower site. Um we have um minimal
[12:07]
changes to the grade of the property are
being proposed and when it comes to
[12:11]
traffic flow to the site uh once it's
constructed and operational it's likely
[12:16]
going to see about two to maybe three
visits per month. It will really have no
[12:20]
impact in the area as it's an unmanned
facility doesn't require any kind of
[12:25]
sewer or water um or anything like that.
Uh now near the road uh there will be an
[12:31]
access gate that will prevent um
unauthorized uh vehicles from entering
[12:36]
the property.
Now our lease area as you can see here
[12:40]
in this zoomedin image is a 100 ftx 100
ft area and that's a total of 10,000
[12:47]
square ft. Now our actual compound that
we're proposing to construct within that
[12:53]
lease area is an 80 foot by 80 foot uh
fenced in compound. Now, the fence
[12:59]
proposed is an 8-ft high chain link
fence and it will have a 14 foot wide
[13:04]
access gatement gate at the entrance. Uh
there's also going to be a hammerhead
[13:09]
turnaround
>> at the uh entrance to the site of the
[13:12]
compound.
>> Um now within the compound itself,
[13:16]
there's going to be 6 in of 3/4 in crush
stone and the tower will be located in
[13:22]
the center of the compound. That's the
triangle you see in the center. And then
[13:26]
the equipment shelters will be located
surrounding the tower itself which is
[13:31]
these boxes that you see here. Um
typically these these communication
[13:36]
shelters are u they used to be 12x20
actual like concrete um shelters but
[13:43]
most often now they're all outside
outdoor cabinets that are used. Um again
[13:49]
the the tower proposed is a 190 foot
lattice style tower like the one that
[13:54]
you see in the image here. And this is a
perfect example. This is one of our
[13:58]
sites that we've um constructed already.
And as you can see the lease area that's
[14:04]
cleared is this 100tx 100 ft square
area. And then the compound within that
[14:09]
is the 80 foot by 80 foot fenced in
area. Again with the tower itself, the
[14:14]
lattice style tower in the center of the
compound with the equipment shelters.
[14:18]
surrounding it.
Uh this is an example of what it looks
[14:23]
like at the the ground level of one of
our facilities.
[14:28]
Now, uh your regulations require a fall
zone of 105% of the tower height, which
[14:34]
is something that that we make. Um so
that would be 199 12 ft. And that's what
[14:40]
this circle here represents
>> um within the property. So we meet that
[14:45]
um fall zone radius that's required by
your town.
[14:52]
Now the this is a a vertical profile of
what the the tower will look like. Um
[14:57]
again it's 190 ft lattice style tower.
The antennas will be towards the top of
[15:02]
the tower. Um this tower does not
require any kind of lighting uh from the
[15:07]
FAA. Um we've as part of our package
we've submitted an FAA determination of
[15:12]
no hazard. Um and that that
determination basically says that no
[15:17]
lighting uh will be required for this
tower.
[15:22]
And this next image is just examples of
lattice towers that um our company owns
[15:27]
and and constructed uh various sites um
in in New Hampshire just to get an idea
[15:33]
of exactly what they look like.
Um so next we're going to discuss the
[15:37]
the propagation studies that are
associated with this site. Um it's
[15:42]
important to note that tower sites are
not something that are selected by
[15:45]
random. Rather tower sites are selected
based on ident identifying a need for
[15:50]
coverage and then finding a suitable
site that meets wellestablished
[15:54]
telecommunication sighting criteria. So
we don't pick a site that's just simply
[15:59]
convenient. We have to first by begin
and identifying where uh service is
[16:04]
being lost and then we use sophisticated
computer software and modeling to help
[16:08]
us identify exactly where the coverage
gap is and where a suitable location um
[16:14]
will be located to fill that coverage
gap. So after we identify a gap a search
[16:20]
for a site is is begins and that's where
uh Jonathan um works hard to to find a
[16:26]
suitable site. So things that he looks
for while he's looking for a site
[16:30]
include uh constructability. Is the
site, you know, in an area that's
[16:34]
constructible? Um is it available? Is
there a land owner who's willing to to
[16:39]
sell or lease the property? Uh does it
meet zoning requirements? Um are there
[16:43]
any wetlands in the area that we have to
be aware of and avoid? And we need to
[16:48]
make sure that the site is uh available
for collocation capacity. So, this
[16:53]
facility that we've proposed here is
proposed to eliminate a 3.7 mile deficit
[17:00]
of wireless coverage along Route 41. And
so, I know you know your your town much
[17:05]
better than I do, but of course, uh, m
the green line here identifies the town
[17:10]
line. And of course, this is Mount
Vernon here in this area. We have
[17:14]
Reedfield, uh, to the south and FET to
the west. And these red lines here um
[17:21]
indicate state roads. So the red line
that I'm pointing to now is route 41.
[17:26]
And then we have route 17 that goes
through Reedfield in Fyet. So the blue
[17:33]
boxes that you see here are the existing
towers today that are in Mount Vernon or
[17:40]
surrounding Mount Vernon by other towns.
So, we have an existing site to the
[17:44]
north of our proposed tower and then we
have an existing site in Fyet to the
[17:49]
west and an existing site in Reedfield
um to the south. And the coverage gap
[17:55]
that we're looking to fill in is this
area here. Um the yellow signal [snorts]
[18:02]
or the yellow color represents
inbuilding uh signal strength and the
[18:08]
light blue or the cyan color represents
invehicle uh coverage. So if you're
[18:14]
driving along Route 41 and you're you're
within the yellow or the the cyan color,
[18:20]
you're able to make a call. If you're in
the white area, uh anywhere in the white
[18:25]
area, you'll either drop the call um or
it'll be unreliable service where you
[18:29]
won't be able to make a data connection
or your your your service will go in and
[18:33]
out and you won't be able to uh to hold
a call reliably. So, this is the
[18:38]
coverage gap that I I mentioned earlier.

gap? The colors. Sure. the levels I did
a little research and it seems like
[18:53]
these are for quote a good signal where
fair most likely would work. Is there a

reason that you didn't pick like four
different levels of colors to show where
[19:06]
people probably already get coverage? I
live in the area that supposedly doesn't
[19:09]
have coverage on this map and I get
great coverage. So
[19:14]
I think it would help describe why you
selected the what is it 84 and 87 dB.

» Yeah. Yeah. They they represent
inbuilding coverage. So the yellow
[19:23]
represents that inbuilding signal. So
although you you may be able to make um
[19:28]
your your phone call outside of you know
outside of your home. The yellow rep
[19:34]
actually represents strong signal
strength that will penetrate um a
[19:38]
building or a home to give you the the
coverage you need. Um the blue
[19:42]
represents invehicle coverage. Um and
anything less than that um is weaker
[19:48]
coverage. If you're not in a vehicle,
you know, the coverage may get a little
[19:52]
better than that. Um but I, you know,
I've tested the these maps and I've
[19:56]
driven this area and um I found it very
reliable along Route I'm not sure where
[20:01]
you live um but along Route 41 I found
it very accurate.

Yeah, I live on to and the north end of
Tory northeast side and in my house I
[20:12]
still get signal strength.

fairly accurate. And this is, you know,

that's used to identify coverage gaps.

existing coverage today and then um with
our proposed site, this is the how we
[22:23]
would fill in the coverage gap. So, you
can see the the white area in the area
[22:29]
where this poor signal strength is
completely filled in now with with
[22:32]
reliable service.
Um and so I was asked um by by the
[22:38]
chairman to run various heights. Um so
you could see the the variation level um
[22:44]
at these different heights. So we this
is our proposed height at 190 ft and
[22:49]
then this is what it looks like at 150
ft. And you can see some of the outlying
[22:53]
areas start to develop more of a
coverage gap where we lose, you know, in
[22:57]
the handoff potential. And then as we go
down in height to 130 and then 110, you
[23:04]
see where you'll still lose coverage
along Route 141 and you won't have that
[23:09]
seamless coverage.
Um and then uh next was the um
[23:15]
photographic simulations, the photo sims
that we did. We um had conducted a uh
[23:20]
balloon test on July 7th. Um, we had a
third-party company um called Virtual
[23:27]
Sight Solutions and we flew a balloon
again on July 7th from 8:00 a.m. to
[23:32]
12:00 p.m. Uh, now the balloon was 3 and
1/2 ft in diameter and it was bright red
[23:39]
and they went out 2 miles to capture
locations where the balloon was visible
[23:42]
from and then simulated a tower at that
location if the balloon was visible from
[23:47]
there. So, these pictures are taken from
public areas. at no point did they um
[23:53]
access any private property if they
didn't have permission. So this balloon
[23:57]
test was also advertised in the local
newspaper. And so the colors that you
[24:01]
see on your map here um the green
represents where it is visible from and
[24:07]
the red indicates that it is not visible
from that location. So it's it's um it's
[24:13]
42 locations. So, I'll I'll go through
them, but just so you understand, um,
[24:18]
the order that I'm going to show these
pictures is based on the distance from
[24:22]
the proposed site. So, um, it may seem
like we're jumping around from, you
[24:27]
know, different roads and areas, but
it's based on the distance from the
[24:31]
proposed site. So, that's why it's it is
the way it is. So, our first location is
[24:37]
um 413 feet just north of the site on
Route 41. And that is um you can see the
[24:45]
balloon located right here. And this is
a picture taken from Route 41 of what
[24:50]
how it would be visible from that
location.
[24:53]
Uh picture two is taken uh from Pine
Grove Road. Um and the top of the tower
[25:01]
is visible. You can see the balloon
right here and the top of the tower is
[25:06]
visible through the trees uh there.

» Picture three is taken from uh Potter
Lane and this is uh 0.18 miles away and
[25:17]
at that point it is not visible at all.
Uh picture four is taken off of Pond
[25:24]
Road um on Debbie's Road uh in front of

And we see the top is visible um from
from this area on Debby's uh road.
[25:39]
Uh picture five is taken um at the end
of Pine Grove Road. Uh it's 21 miles
[25:46]
away and it's not visible from that
location.

Uh photograph six is taken from Breezy
Acres and the ball bloom was not visible
[25:57]
from that that area.
Uh, picture seven, which you can see
[26:02]
here, was taken uh, further south on
Pawn Road and the balloon was not
[26:06]
visible from this area. It's 32 miles
away from the proposed site.

Uh, picture 8 is taken uh, north of the
site um, on Route 41 at the intersection
[26:18]
of Five Seasons Road and it is um, uh,
it is uh, slightly visible through the
[26:26]
trees here. If you can see that it was
just barely visible through the top. Uh
[26:32]
picture nine was taken further east on
Five Seasons Road. Now this is about 045
[26:37]
miles away and it's not visible from
that location. Uh picture 10 was taken
[26:44]
on um further south on Route 41 near the
town line and this is just a little over
[26:50]
half a mile away and it wasn't visible
from that location. Picture 11 was taken
[26:56]
east, further east on Five Season Road
and the balloon was not visible from
[27:01]
that area.
Picture 12 was taken on Pond Road north
[27:06]
of the site and the balloon was was not
visible from this area. Uh, picture 13
[27:12]
was taken at the intersection of Pond
Road and Davies Lane in Reedfield and it
[27:16]
was visible from this area as you can
see um going back and forth. The balloon
[27:22]
is right here. And that's what it looks
like with the tower simulated into the
[27:27]
picture.
Uh, picture 14 was taken on Desert Pond
[27:32]
Road uh, a little over a mile away and
not visible from that location. Uh,
[27:37]
picture 15 was taken uh, off of a
Chimney Road and that was u, excuse me,
[27:43]
further south on um, Route 41 and it was
uh, visible from that location. And you
[27:49]
see by the trees over here, you can just
see it, the balloon. And that's what the
[27:53]
tower looks like in this area right
here.

Uh, picture 16 is about 1.18 miles away,
taken from Weston Road, and it was not
[28:03]
visible from that location. Picture 17
was taken from Desert Pond Road, 1.27
[28:10]
miles away, and it wasn't visible from
that location. Picture 18 was taken
[28:15]
further north on Route 41 and not
visible from that location.
[28:20]
Picture 19 was taken from Weston Road,
1.43 miles away, and it was not visible
[28:26]
from that location. Uh, picture 20 was
taken from Chase Road and it wasn't
[28:32]
visible from that location. Uh, picture
21 was taken from Lake Road and it was
[28:38]
not visible from that location either.
Uh, picture 22 was taken from Desert
[28:44]
Pond Road and this is a mile and a half
away and it is visible through the um
[28:49]
the the trees here because it's a wide
air open area and you can see the tower
[28:54]
if I go back and forth a simulation of
the tower. Um, the top of the tower is
[28:58]
visible from this area and that's 1.51
miles away. And then picture 23 was
[29:04]
taken from Pond Road, not visible from
that location. Uh 24, another location
[29:09]
on Echo Lake Road, 1.62 miles away, not
visible from that location. Uh picture
[29:16]
25 was taken uh further south on Route
41, and it's not visible from that
[29:22]
location. Uh picture 26 was taken on
Echol Lake Road as well, 1.69 miles
[29:30]
away, and it's not visible from that
location. Uh, picture 27 was taken on
[29:35]
Chase Road and it wasn't visible from
that location. Picture 28 was taken from
[29:43]
41, 1.7 miles away, and it wasn't
visible from that area of town or that
[29:48]
location.
Uh, picture 29 was taken from Reedfield
[29:53]
on Main Street, 1.73 miles away, and it
was visible from that location because
[29:58]
it's a wide open area with the
cornfields there. And you can see the
[30:02]
photo simulation of the tower.
Uh, picture 30 was um taken from um
[30:10]
further down on Main Street in Reedfield
and in that area it was not visible.

Picture 31 was taken um at Echo Lake
1.74 miles away and it was visible from
[30:24]
that location. You can see the tower uh

taken from uh route it's F FR17-1
which is off of Main Street 1.75 miles

away and it's open but it was uh not
visible from that location.

Uh picture 33 off of Main Street in
Reedfield was 1.75 miles away and it was

not visible from that location. Uh,
picture 34 was taken on N road 1.78
[30:57]
miles away and it was not visible from
that location. Uh, picture 35 was taken

for another area on Main Street 1.78
miles away and it is visible from this
[31:09]
location as you can see in the photo
simulation here. Uh, picture 36 was

taken off of Echol Lake Road 1.78 miles
away and not visible from that location.

Uh, picture 37 was taken off of, uh,
Chimney Road, 1.79 miles away, and it

was visible from that location. As you

can see, once you get that to that
distance, it's hard to make out what it
[31:43]
is, but you can see that there's a tower
there. Uh, picture 39 off Point Drive um
[31:50]
was not visible from that location. Uh,
picture 40 was taken off of Church Road
[31:57]
and it was uh not visible from that
location either. Um, then picture 41 was
[32:02]
taken from another point of off of Echo
Lake Road or Echo Road and it was not
[32:07]
visible from there.
Uh, picture 42 was taken off of Main
[32:13]
Street at another location just a little
over two miles away and it was not
[32:16]
visible from from that location. So, the
reason why we we go through these maps
[32:21]
is just to give you a general idea of
visibility. Um, we would like to make
[32:26]
these sites completely invisible. Um,
fortunately it's not possible. But if
[32:31]
you look at the just the the green and

Um you know just uh briefly about
Industrial Tower and Wireless. We've
[32:47]
been in the business for uh 50 years.
Um, we take pride in our work and we
[32:52]
have our own crews who do everything
from the electrical and utility work at
[32:56]
the sites um to the foundation and
excavation and concrete work um to um
[33:04]
actually erecting the tower themselves
and and putting the antennas on the
[33:08]
tower. That's that's all done internally
with our crews. Um, and we also do
[33:13]
special projects like uh this is nothing
like we're proposing here, but this is
[33:17]
just an example of a site that we own in
West Bridgewater, Massachusetts, where
[33:22]
we had to put a um an antenna on top of
the tower. This is a broadcast tower, so
[33:27]
we needed to use a helicopter to be able
to install this this antenna up there.
[33:31]
We also take pride in how our sites work
look. Um, we have our own landscaping
[33:36]
and maintenance crews who come around
and and and make sure that they're they
[33:40]
look good. They cut the lawn when the
lawn needs to be cut and they make sure
[33:43]
that everything's maintained um the way
that that it should be. So, all this to
[33:48]
say that we just we take pride in in in
our sites and how they look and um you
[33:53]
know, we're a local company whereas
we're out of New England. Again, we're
[33:58]
our our main headquarters is based in
Massachusetts, and we have uh another uh
[34:02]
office and and warehouse and crew that
that works out of a a comp our New
[34:07]
Hampshire branch as well that would
likely uh service this site. So, we
[34:13]
appreciate the opportunity to um you
know, present this to you and be happy
[34:17]
to answer any questions you might have
either myself or or Jonathan. We have

that leads to that area and it's heavily

which it was, but whatever road runs
along here. And honestly, I couldn't see
[35:14]
anything. There was a public beach area
that I stopped at where it wasn't
[35:17]
visible from.

there that, you know, I I obviously I
couldn't, you know, get in front of
[35:24]
those houses to see the the wateride to
see what the visibility was. Um, but I I
[35:30]
I I'll take your word for it, but I
couldn't personally see it when I um

when I drove that road.

» Yeah, so the foundation will be about 8
feet. We'll do a geotech report that

size and and and confirm that, but

typically they're between you know, six
and 8 ft. And you know, we've built
[37:06]
these close to to homes with with wells
and um there's been been no issues
[37:11]
whatsoever.
And if there was an issue, we would take
[37:15]
care of it.

to provide coverage to this gap. So, it
was a total of 10. Um, and and that's
[38:00]
something that that that Jonathan
McNeel, he he's actually the person who
[38:04]
looked at these sites, and he'd be able
to address those specifically if anybody
[38:07]
has any questions. But we did look at 10
other sites
[38:11]

>> Um, well, so we have to measure the
[38:21]
distance between the difference between
providing coverage to the gap. So, it
[38:25]
needs to be within this this general
area. Um, so the other sites that we
[38:30]
looked at, um, the the land owners were
were not interested in in doing any kind
[38:35]
of of deal, um, or we couldn't agree on
on a location. But I'll let Jonathan, if
[38:40]
you want to speak to that specifically
since you were the person um, doing that
[38:44]
work. Yeah, I mean as Kevin says, you
have to have a worldling less or um and
[38:51]
we try to find locations that have
sufficient area space.
[38:57]
They have to meet the zoning
requirements and there's there's a
[39:02]
couple properties in the limited
commercial area. Um but uh this was the
[39:07]
only property that had a willing less
north.
[39:14]
So the self that you guys would be
paying the owners of that property like
[39:19]
a monthly fee or for as long as there
[39:37]
» well my other big question is how does
this affect my property value if I were
[39:41]
to sell my house someone buying it. I
wouldn't want to purchase a house
[39:45]
looking at a 200 foot cell tower in the
front yard. So, that's going to kill my
[39:50]
property.
[39:53]
» I mean, I think we still need to um deal
with the issue that you're asking for a
[39:58]
variance. Our ordinance says a tower no
greater than 100 ft. Um I still want to
[40:06]
see more data. You went down to 110, but
my research seems to indicate and based
[40:12]
on my testing around my place.
Your map seems to be for quote a good
[40:20]
signal where in most locations a fair
probably would work. They may get lower
[40:25]
data rates.
So I think we need to still review this
[40:30]
further of why we need that tall of a
tower.
[40:38]
Yeah, I mean
you we're not require we're not
[40:41]
requesting a variance at all for this
site. Your your bylaw does allow up to
[40:45]
190 ft. Um I I provided coverage.

It allows it if it you shows that it's a
significant uh I'll have to look at the

verbiage but basically anything less
than 100 ft the ordinance allows you to
[41:03]
do but greater than that you have to
show that um there's a significant
[41:08]
performance degradation by maintaining
that 100 foot or lower height.

» Yeah. the so we're proposing you 190
foot tower that's that that is accurate
[41:21]
and we did show the difference the
variations
[41:24]
» in the the lower heights um it'll come
at a cost unfortunately I mean we can we
[41:29]
build something less than 190 ft yes we
can um but it'll come at a cost of not
[41:35]
having the seamless coverage um you know
along Route 41 and along Route 17 um you
[41:42]
know if we were to reduce the height
down to 170 ft. Um, we could provide
[41:49]
similar coverage, but you need to
remember that there's multiple carriers
[41:53]
that use these sites and they require 10
ft of vertical separation between their
[41:58]
antennas. So, when you um it may work
for the the top mounted
[42:04]
carrier at 170 ft, but you have to
remember that there's also going to be
[42:09]
another carrier who's going to be down
at 140 ft. and that's where it starts at
[42:13]
a degrade for the the various carriers.
So, we're trying to provide
[42:19]
we're trying to provide a solution at a
height that will provide coverage for
[42:23]
all the carriers.
>> There's nothing that can be added to the
[42:28]
power that's on Elmer Elvin's property
on Kent Hill or the power on Blake Hill.

» We're 3.4 miles away from that site. Did

» I think we still need to get better heat
maps because my research the uh decibel
[44:43]
uh range that you picked is considered a
good signal. Calls work well and data is
[44:48]
fast. 91 to 100 dBm um fair signal calls
work but data may be slow down.
[44:56]
Um I'm actually in the next zone down in
my house and I still get calls through
[45:02]
and data um is much slower. So I think
we need a better map showing maybe four
[45:11]
different colors for these ranges to
really show what the gaps the real
[45:16]
critical gaps are.

strength levels to the um to the maps
and present that.

most sites that we would

We have a copy of the financial ability

to maintain and put it in.
But that would be a requirement in our
[48:43]
if this got approved that would be
condition of approval that they um I

guess create a bond which is a standard
thing for a lot of these projects.

I'm not an expert on it so I don't know
exactly how it works.

as far as noise, the tower itself makes
[49:27]
no noise um at all. Um as far as the um
RF EMF electromagnetic um force that
[49:37]
that we did provide a study um that
basically explains that you know if this
[49:43]
tower were completely loaded with um all
the wireless carriers operating at the
[49:48]
maximum power that they're licensed to
do which is way more than they actually
[49:52]
ever operate at that even if and they're
all full power all at the same time it
[49:58]
would be less less than 11% of what the
uh maximum permissible exposure level
[50:04]
that the FCC allows for. So the FCC
governs this and they allow for a
[50:09]
certain amount of of power and if it
goes beyond that then that's when we
[50:13]
would have to file some uh special
studies. But what we're doing is 11% of
[50:19]
what's allowed. So it's well below the
threshold um that the FCC permits.

I'm sure you guys did like a wildwood
study too, right? I don't have any of
[50:34]
the reports in front of me, so that's
why I'm asking.
[50:40]
No impact on like birds or deer.

» We do environmental infection.

So I think I heard something about
worried about like wildlife. Is that is

>> Yes.

» Okay. So so that is another part of the
process that we have to file with um we
[51:11]
have to comply with NEPA guidelines and
I think the NEPA report was filed with
[51:15]
the town. You should have a copy of it.
But there's basically eight criteria
[51:19]
that that governs that. Um the first one
is if it's in a wilderness or wildlife
[51:24]
area um you know that which we're not um
that could be an issue. Um if we affect
[51:30]
any kind of endangered species in
critical habitat um which we do not um
[51:36]
and we've provided the studies that
explain that. Um we also do not um have
[51:41]
an any effect on historical sites in the
area. Um we're not in in a flood plane
[51:48]
um which is another aspect of it. um we
don't affect any features like wetlands
[51:52]
or surface features and um and we comply
with um the lighting aspect because the
[51:59]
tower will not be lit. So that's the
criteria of the environmental
[52:02]
assessment. But I think what I heard was
the concern about endangered species and
[52:06]
critical habitats and we've provided a
study that that that comments that we do
[52:10]
not our site as proposed will not affect
that.
[52:15]
» And just for the board, this is Kristen
speaking. Um it is tab 11. The summary
[52:21]
of NEPA is in tab 11 of your booklet and
was submitted the full report which is
[52:28]
over 50 pages was submitted um in its
full package with the original uh
[52:36]
» which anyone could go to the town office
and look at that.

name is Susie Herman I live in Mount
Vernon um not near the site but I've

been on the ordinance for you committee
here on Mount Vernon for o over 30 years

Um, and I was involved when we created
[53:16]
the ordinance that applies to cell
towers um, over I think it's around 15
[53:21]
years ago. And I just wanted to bring to
the attention of the board members. And
[53:27]
you probably already know this, but
there seems to be some questions about
[53:33]
the height, the necessity for 190 ft,
the necessity for the tower to begin
[53:38]
with, whether there is a gap or whether
people get good coverage as it is, the
[53:45]
impact on on neighboring properties and
so on. And the ordinance has some tools
[53:52]
for the planning board if you choose to
use them to hire an independent um
[53:59]
engineer and also an independent I think
it's called a landscape architect to
[54:06]
look at visual impact.
you have the ability to do that under
[54:11]
the ordinance and um at the at the
expense of the applicant to do your own
[54:17]
to have your own study of these
questions. It's a tool that we purposely
[54:23]
included in the ordinance. This is this
is very technical and um it seems like
[54:29]
that's something that uh you might want
to consider
[54:33]
um in terms of your evaluation of this
project especially in light of the
[54:39]
comments here. Um so that's that's
basically um what I wanted to say.

» So is that the town's responsibility to
pay for it? No.
[54:51]
» No. or we can it can be at the
applicant's expense. I did very briefly
[54:59]
look at the big notebook at one time and
I thought there was something in there
[55:03]
that said the applicant was willing to
do that. Um I don't know if that's been

discussed. I haven't been involved with
this uh in terms of prior meetings, but
[55:14]
I just wanted to um bring that to your
attention that you do have these tools
[55:20]
to, you know, gather that information to
fully evaluate what's before you.

when the application was finally deemed

anywhere as close to that size, but it's
[57:06]

there would be wind generated noise,

there's there's guys this this will have

those that's what makes the vibration
makes the sound.

benefit. That's section uh 35 C
um I the height and where the ordinance
[1:02:35]
specifically states that um
the planning board may enlarge the
[1:02:41]
maximum height to 190 ft upon showing by
the applicant by substantial evidence
[1:02:45]
that enlargement up to 190 ft is the
only feasible alternative to fill a
[1:02:50]
significant coverage gap within the
meaning of the telecommunications back.
[1:02:55]
» So,
>> yeah, and I understand that it was just
[1:02:57]
mentioned that a variance would be
required for the 190, and I just wanted
[1:03:00]
to make it clear that we're not
requesting a variance. That's all.

» Um, I thought at the initial meeting
that we met on the application, you had
[1:03:09]
two variance requests. You had a
variance request not to send the letters
[1:03:13]
to the Jason tower owners, but you
backed off on that. And wasn't there a
[1:03:18]
second variance request?
>> No, there was some waiverss that we had
[1:03:21]
talked about, but there was no
variances.
[1:03:25]
We we didn't move forward with
submitting any waiverss for this
[1:03:28]
application. We ended up fulfilling all
application requirements.
[1:03:37]
Actually, I take that back. We did ask
for a waiver for the up to 10 miles for
[1:03:44]
the balloon test simulation photos down
to two miles. And that was
[1:03:50]
that was agreed upon because the balloon
becomes
[1:03:55]
almost invisible at that distance.
[1:04:01]
» And I guess the other question I'll ask
it again is Kevin, we had talked at the
[1:04:05]
last meeting about the pictures that I
took. You say that there you had a
[1:04:10]
special camera, but I can tell you the
elevation, the distance away from the uh
[1:04:15]
tower that or the balloon that I took
that picture from. Your outside
[1:04:20]
contractor can't then do the simulation.
>> He can't. It needs to be done with his
[1:04:26]
his he's got a high-tech camera that
gives him a lot of different parameters,
[1:04:30]
and you can't get the same parameters
off like an iPhone picture or or a cell
[1:04:35]
phone or or even a regular camera. Even
if I know the elevation and the distance
[1:04:39]
away,

connecting into their existing
facilities as well to access it. Um a

lot of greenery here obviously with the
driving range and the parking green a
[1:20:06]
little bit of new impervious area um
will be associated with this. We have
[1:20:10]
quantified it total as 5,933
square ft.

of new impervious area. Camp Laurel has
an ongoing site location permit with D.
[1:20:26]
So this they allowed up to 10,000 square
ft of impervious area per calendar year
[1:20:34]
without having to submit a new permit.
We just have to notify D of the
[1:20:39]
operation, provide our drawings to them
and give them a notification. So upon
[1:20:44]
approval from the planning board, we
will be doing that providing that
[1:20:48]
notification to the EP to update their
slogan permit.
