[0:27] Good evening. I'd like to call to order the Mayer.
[0:30] Can we please have an order please? I'd like to
[0:32] call to order the May 1st, 2025 meeting of the city of
[0:35] Nashua planning board.
[0:37] Madam secretary, can we have a roll call please? Yes.
[0:40] Mr. Chair, mayor Donis.
[0:43] Mike Peterson.
[0:45] Bob Bollinger here, Adam barley here.
[0:49] Maggie Harper here, Dan Hudson here.
[0:52] Scott LeClair.
[0:54] Air Larry Hirsch here. Cameron green here. Alderman Klee.
[1:00] All right. We have a forum.
[1:02] Next item on the agenda approval of minutes from our
[1:05] April 3rd, 2025 meeting.
[1:08] Has any member of the board had a chance to
[1:09] review those minutes and is willing to make a, a
[1:12] motion regarding their acceptance or approval.
[1:16] Mr. Green. I'd like to make a motion.
[1:18] To accept the minutes as.
[1:20] All right. We have a motion by Mr. Green. Is
[1:23] there a second, second by Mr. Hirsch, any further discussion?
[1:27] All those in favor.
[1:29] Aye. Aye. Recusals.
[1:32] Recusals. Alright. Motion passes.
[1:35] Passes next item on the agenda.
[1:37] Communications lean on staff for this one. Is there anything
[1:40] that came in since we received our packets?
[1:43] Packets we did receive, I believe one letter in opposition
[1:48] to the Roby park disc golf course that has been
[1:50] forwarded to you.
[1:52] Alright, very good.
[1:55] Thank you, Sam. Next item on the agenda report of
[1:58] chair, committee and liaison. Ms. Harper, you have anything for
[2:02] us tonight? Yes, Mr. Chair, I attended the historical historical
[2:08] district commission meeting early, earlier this week on Monday, there
[2:11] were two cases.
[2:12] One for 13 Manchester street and one for 43 dash
[2:16] 45 orange street.
[2:18] To perform repairs to the buildings and both cases were
[2:22] approved by the commission.
[2:23] Very good. Thank you. The only other thing I'll add,
[2:27] there were a couple presentations.
[2:29] About two weeks ago. I think one was on a
[2:31] Thursday. One was on a Saturday for the redevelopment of
[2:33] the Elm street, middle school property.
[2:35] Very informative. The sessions were recorded. If you're at all
[2:39] interested.
[2:40] Please check 'em out, but very, very good, very thorough
[2:43] presentations.
[2:45] From both potential proponents. So.
[2:50] I think with that, we'll just keep moving along in
[2:53] the agenda. But before I do.
[2:56] Would like to read the planning board procedure.
[3:00] The procedure of the meeting is as follows after the
[3:03] legal notice of each conditional special use permit.
[3:06] Site plan or subdivision plan is read by the chair.
[3:09] The board will determine if that application is complete and
[3:12] ready for the board to take jurisdiction. The public hearing
[3:15] will begin at which time the applicant or representative will
[3:17] be given time to present an overview and description of
[3:20] their project.
[3:21] The applicant shall speak to whether or not they agree
[3:23] with recommended staff stipulations, the board will then have an
[3:26] opportunity to ask questions of the applicant or staff.
[3:30] The chair will then ask for testimony from the audience.
[3:33] First anyone wishing to speak in opposition or with concern
[3:36] to the plan may speak.
[3:38] Please come forward to the microphone.
[3:40] State your name and address for the record. This would
[3:42] be the time to ask questions that you may have
[3:44] regarding the plan.
[3:46] Next have a public testimony will come from anyone wishing
[3:49] to speak in favor of the plan.
[3:51] The applicant will then be allowed a rebuttal period at
[3:53] which time they shall speak to any issues or concerned
[3:55] raised by the prior public testimony.
[3:58] After this is completed, the public hearing will end and
[4:01] the board will resume the public meeting at which time
[4:04] the board will deliberate and vote on the application before
[4:07] us.
[4:08] The board asked that both sides keep their remarks to
[4:10] the subject at hand and not repeat what has already
[4:12] been said.
[4:14] Above all the board wants to be fair to everyone
[4:16] and make the best possible decision based on the testimony
[4:19] presented and all applicable approval criteria established in the Nashua
[4:23] revised ordinances.
[4:24] Ordinances. Thank you for your interest and courteous attention. I
[4:28] would ask that you'd please turn off your cell phones
[4:30] or at least put them on silent mode.
[4:32] A couple of other administrative notes. I do want to
[4:34] point out.
[4:36] The board at its discretion.
[4:38] Can cut off public testimony.
[4:40] At 10 o'clock depending how the rest of the applications
[4:44] on the agenda unfold this evening, there is always the
[4:46] possibility that some items on the agenda may not be
[4:48] heard in their entirety this evening.
[4:51] Secondly, when it does come to the public testimony.
[4:56] We're gonna try to keep that.
[4:58] Organized and on point and really not duplicate matters, which
[5:00] have already been stated if individuals have written letters or
[5:03] emails, either in support or against a particular application.
[5:08] They're already part of the record, the board has received
[5:11] them, read them. They're part of the official record already.
[5:13] You do not need to reread a letter, which you
[5:16] have already written.
[5:18] With that being said,
[5:19] I would like to start moving on to our caseload.
[5:24] Under old's business site plan.
[5:28] This case was continued to May 15th is any, if anyone
[5:31] is here for the east Otterson case,
[5:34] that will not be heard tonight. That has been tabled
[5:37] to the May 15th hearing.
[5:40] Next item on the agenda.
[5:42] Under new business, conditional use permit.
[5:46] There's actually an associated case with this.
[5:50] Under new business subdivision plan properties located at 15.
[5:55] New street, it would be case number a 25 dash
[5:58] 0 43 for the conditional use permit.
[6:02] And case number 8 25 dash 0 0 4 2 for the subdivision plan.
[6:07] Mr. Chair, just sorry, just to.
[6:09] Point of part. Just a quick question. Oh, you are
[6:11] correct. Where we, yeah, we're gonna hear the, I am
[6:13] mistaken. We were gonna skip ahead in the agenda.
[6:16] Apologize for that. We were actually gonna start off this
[6:19] evening with other business.
[6:22] Item number two referral from the board of alderman regarding
[6:26] R dash 25 dash one 40.
[6:29] Relative to tax needed property auction.
[6:34] Is anyone from did anyone from staff care to make
[6:38] a brief statement on that?
[6:40] Certainly thank you, Mr. Chair.
[6:42] So before you as a referral from the board of
[6:44] alderman regarding a number of properties that have been taken
[6:47] by the city due to nonpayment of back taxes.
[6:51] Taxes. This is a standard procedure that is enshrined in
[6:54] the NROs of the city of Nashua and at, in
[6:58] accordance with all applicable state statute and Nashua ordinances notice
[7:02] and procedure has, has occurred.
[7:05] The city now owns these properties and would like to
[7:08] proceed to auctioning these properties.
[7:11] State statute and pursuit, or rather city procedure requires that
[7:14] the planning board make a recommendation on this list of
[7:17] properties to proceed to auction the committee on infrastructure would
[7:20] then hold the public hearing regarding this list of property
[7:23] in that slated full.
[7:26] May 7th.
[7:29] All right. Thank you, Sam.
[7:33] Any questions from staff.
[7:35] Mr. Barley, please. Just a quick question, Sam, just to
[7:37] confirm.
[7:38] As to the sort of status as the, of the
[7:40] properties as you described it in terms of.
[7:43] The notice and process that's already taken place.
[7:45] That's the same for all the properties on this list.
[7:47] Is that correct? Correct. Thank you.
[7:51] Thank you, Adam, other questions from the board.
[7:57] See none.
[7:59] Is any member of the board willing to re recommendation?
[8:03] This would be
[8:06] favorable either favorable or unfavorable recommendation regarding.
[8:11] Regarding R 25 dash one 40 S Mr. Barley.
[8:15] Yes. Thank you, Mr. Chair, as to.
[8:18] Ordinance R dash 25.
[8:20] Dash one 40. I would make a motion that we
[8:24] provide a favorable recommendation.
[8:27] Thank you, Mr. Barley, is there a second?
[8:31] Second by Mr. Hirsch.
[8:33] Any further discussion.
[8:35] All those in favor. Aye. Aye.
[8:38] Motion passes unanimously.
[8:41] Alright, thank you.
[8:43] All right, moving back to our other caseload.
[8:49] Again, we have an item under new business condition you
[8:52] permit is 25 dash 43. Copy located at 15 new
[8:57] street.
[8:59] Same property. There's also under new business subdivision plan at
[9:03] 15 new street case 8 25 dash 0 42.
[9:08] At the board's pleasure. We could hear both of these
[9:11] at the same time.
[9:12] Would any member of the board be willing to make
[9:14] a, make a recommendation?
[9:17] Regarding the board accepting jurisdiction.
[9:19] Over new business subdivision plan and conditional use permit permit.
[9:27] Mr. Barley.
[9:28] Mr chairman as to case.
[9:31] A 25 dash 0 43.
[9:34] Conditional use permit and a 25 dash 0 42 subdivision plan.
[9:39] I would make a motion.
[9:41] That both applications are complete and ready for the board
[9:44] to accept jurisdiction and that we hear the cases together.
[9:47] Okay, thank you. Motion by Mr. Barley. Is there a
[9:49] second, second by Mr. Green.
[9:52] Any further discussion.
[9:54] All those in favor. Aye. Aye. Aye. All right.
[9:59] We have jurisdiction. Go right ahead. Just introduce yourself for
[10:02] the record, please.
[10:04] Good evening, Mr. Chairman members of the board for the
[10:06] record. My name is Ethan Beales. I'm a project manager.
[10:10] At Haner Swanson doing business at three Congress street here
[10:12] in national New Hampshire here tonight representing Bob McIntosh at Ram
[10:16] development.
[10:17] Also with me tonight is the project attorney attorney. Andy
[10:20] Pearlman has just read, read into the record. We're seeking
[10:23] two actions by the planning board tonight.
[10:25] A subdivision approval and a conditional use permit.
[10:29] With the chair's permission, I'd present the facts of both
[10:31] of the cases together, and then we'd be happy to
[10:33] answer any questions at the board may have.
[10:36] The existing site is located at 15 new street and
[10:38] is known to the city of Nashua assessor's office as
[10:41] map 28, lot 15.
[10:44] Scott, if you don't mind bringing up the subdivision plan
[10:45] instead of the, the master site plan for now.
[10:49] It is known to the city of Nashua assessor's office
[10:51] as map 28. Lot 15 is located in the RB.
[10:54] B urban residence, zoning district.
[10:57] Site measure 0.69 acres in size.
[11:00] And this abutted by single family dwellings to the south
[11:02] and Southwest two family dwellings to the Southeast.
[11:05] A large building owned and operated by the nonprofit Southern
[11:08] New Hampshire services to the Northeast.
[11:10] And the Marshall street apartments, a high density multi-family residential
[11:13] development.
[11:15] To the Northwest, the subject site is currently developed and
[11:18] contains an existing single family home.
[11:20] A pool, a detached garage in two sheds.
[11:24] Sheds topography on the site is generally mild with a
[11:26] large, low point in the grasped backyard.
[11:29] Access to the site is provided via two driveway. Curb
[11:31] cuts out onto new street.
[11:33] And the existing dwelling is serviced by city sewer water
[11:36] by Uck waterworks gas.
[11:38] And overhead electric and telecommunication lines.
[11:41] It is proposed to subdivide the existing lot into two
[11:43] lots. The existing house and pool will remain on lot
[11:46] 15 and will retain the 15 new street address.
[11:50] One subdivided this lot will measure approximately 0.261 acres in
[11:53] size.
[11:55] And the newly created lot 21 will measure 0.429 acres
[11:58] in size and will be addressed as 19 new street.
[12:02] The existing detached garage shed and driveway on the new
[12:05] lot, 21 will be demolished to make room for a
[12:08] new development.
[12:09] After subdivision, both of the lots will be legal, RB,
[12:12] conforming lots.
[12:13] Lots. We are seeking one waiver from the subdivision subdivision
[12:16] regulation, and that was detailed in a letter to the
[12:18] board. Briefly summarize that request and ask that the letter
[12:21] be incorporated into the record by reference.
[12:24] The waiver is of 1 90, 2 82 , which requires existing conditions be
[12:28] provided within a thousand feet of the subdivision.
[12:31] The justification being the surveying within a thousand feet of
[12:34] the project is not really practical. It doesn't add valuable
[12:37] information to the plan. It will be cost prohibitive for
[12:39] a project of this size.
[12:41] Scott, if you don't mind now, switching back to the
[12:43] master site plan.
[12:45] Well, a site plan was submitted. A three unit building
[12:47] is allowed in the RV zone by conditional use permit
[12:50] and a formal site plan action is not required here
[12:52] tonight. It is proposed to construct a new three unit
[12:55] multi-family residential building on the new lot 21, along with
[12:58] the so site improvements.
[13:01] The building will be a three story townhouse style building.
[13:05] Elevations were submitted in your packet, but it is similar
[13:07] to several of the townhouse developments that are currently being
[13:10] constructed in the city.
[13:12] The first floor will consist of a garage building entrance
[13:15] and utility and storage space.
[13:17] The second floor will contain a kitchen and a living
[13:19] room.
[13:20] In the third floor will, will contain three bedrooms.
[13:24] Bedrooms a deck will be constructed off the back of
[13:25] each unit connecting to the second floor kitchen.
[13:28] And each unit will have approximately a 24 foot by
[13:30] 32 foot footprint.
[13:33] The building will be fully sprinkled.
[13:35] Access to the site will be provided via a new
[13:37] driveway off of new street.
[13:40] Other site improvements as part of this project include landscaping
[13:42] site lighting.
[13:43] Utility services and store and a stormwater management practice.
[13:47] Once constructed the new building will be serviced by public
[13:49] sewer water by pen, truck, waterworks, gas and underground electric
[13:52] and telecommunication utilities.
[13:55] A traffic memorandum was prepared by Steve Perna, professional engineer.
[13:59] It concluded that the proposed development will generate approximately one
[14:02] vehicle trip in the am peak hour.
[14:05] And two vehicle trips in the PM peak hour.
[14:08] Given the minimal edition, additional amount of trips generated by
[14:11] this proposed development. An additional traffic study was not warranted.
[14:15] In the board's packet tonight was a letter detailing. The
[14:18] nine criteria required for conditional use permit.
[14:21] Well, I'm happy to go through each criteria individually, outta
[14:24] respect for the agenda tonight, perhaps I can just summarize
[14:26] and hit some of those high level points.
[14:30] The use is permitted in the RV zone in the
[14:32] building will conform to all applicable setbacks.
[14:35] Setbacks, the project exists in a transitionary area of the
[14:37] city. Abutting. The project is a mix of single family,
[14:40] two family, a commercial use, and a high density residential
[14:43] use.
[14:44] As such a three unit building is compatible with the
[14:46] neighborhood.
[14:48] A letter was also submitted to the board from a
[14:50] licensed real estate salesperson.
[14:52] Who reviewed the proposed development and wrote an opinion that
[14:54] the three units will not impact the neighboring property values.
[14:57] As mentioned earlier, a traffic report concluded that the proposed
[15:00] project will have a measurable, but minimal impact to the
[15:02] surrounding roadways.
[15:04] Roadways. And finally, adequate utilities exist in the vicinity of
[15:07] the proposed project.
[15:09] We are seeking also one waiver for the C U
[15:11] P as I did earlier. I'll briefly summarize that request
[15:14] and ask that that letter also be incorporated into the
[15:16] record by reference.
[15:18] And the waiver is of 1 90, 1 98, which requires a maximum.
[15:22] Number of six parking spaces on the site, or 1.9
[15:25] space.
[15:27] Per unit times three units for a multi-family development.
[15:30] The plan proposes a total of nine parking spaces.
[15:33] One garage and one driveway space per unit, plus an
[15:36] additional three. We we'll call 'em visitor parking spaces.
[15:40] In our opinion for a development, this size nine parking
[15:42] spaces is appropriate to help accommodate any visitors.
[15:46] Visitors to the site and prevent any on-street parking.
[15:49] In summary, we believe our subdivision planning and conditional use
[15:51] permit, conform to the city Nashua land use code.
[15:55] We've reviewed the staff report and are in agreement with
[15:57] staff's recommended conditions of approval. And at this point, I'd
[16:00] be happy to answer any questions that the board may
[16:02] have.
[16:03] Thank you.
[16:06] Questions from the board.
[16:13] Seeing none at this time. Thank you.
[16:16] I would love like to open this up to the
[16:17] public. Is there anyone here this evening that would like
[16:20] to speak in opposition or concern?
[16:23] With this application.
[16:28] Okay. Seeing none. Is there anyone in the audience that
[16:31] would like to speak in favor of this application?
[16:35] What if we just have a question.
[16:38] Of what was just said.
[16:40] I, I would say I would classify that opposition or
[16:43] concern, but it's okay. You're more than welcome to take
[16:46] the podium if you'd like and ask.
[16:49] You would've to come up just for the record. So
[16:51] it's recorded and you can direct, you could direct your
[16:55] question to the board, but it would be incumbent upon
[16:57] the applicant to actually respond.
[17:00] My name is Melissa. And my address is 10 new
[17:03] street. Just had a question pertaining to.
[17:07] The
[17:08] amount of vehicles that would be traveling up and down
[17:11] the street. I thought I heard one in the morning,
[17:13] two in the evening.
[17:15] We just wondered how that came about.
[17:18] I don't know if I heard that correctly or not.
[17:22] The applicant can certainly respond to the traffic documentation that
[17:26] was provided. So he'll be given that opportunity. So he
[17:29] will, he will address that. Okay. And then I, I
[17:32] guess, did you have any other questions or, or comments.
[17:35] Comments on the testimony.
[17:37] I think that's it for now. It was it. Okay.
[17:39] All right.
[17:40] So, I guess we're, we're still in the, in the
[17:43] public.
[17:44] Hearing. So is there anyone else in the audience that
[17:46] would like to speak on this application?
[17:51] Okay. You see none.
[17:53] Mr Beals, would you like to come up and address
[17:55] the comment related to traffic?
[17:57] Thank you.
[18:00] Sure. As I had mentioned earlier, a traffic memorandum was
[18:03] prepared by professional engineer. Steve Perna, as the board knows
[18:07] traffic is typically measured in am peak hours and PM
[18:10] peak hours.
[18:12] The numbers I had stated earlier in my presentation reflect
[18:15] the values.
[18:16] Of the additional traffic generated by the proposed development.
[18:20] In the peak hour in the peak hour is the
[18:22] hour essentially that the roadway is the busiest. The nearby
[18:26] roadway network is the busiest in during the morning. And
[18:29] during the afternoon, the numbers stated earlier, don't reflect the
[18:32] total volume of traffic.
[18:35] Coming from the site throughout the day.
[18:37] But rather traffic is typically measured in the am and
[18:40] PM peak hours.
[18:43] Thank you for the clarification.
[18:54] We kindly request that we silence.
[18:56] Any, any devices that we have, please? Thank you.
[18:59] Other questions from the board at this time.
[19:07] Mr chair. Yes.
[19:08] More of a common, I guess. So.
[19:11] This Street's a dead end street. So just in terms
[19:14] of maintenance for snow and that sort of thing, I,
[19:16] I imagine it must be challenging for the public works.
[19:20] Vehicles, you know, they gotta push snow somewhere and they
[19:23] gotta be able to turn around at the end of
[19:26] the street. So I just.
[19:28] I know we're not undertaking a full site plan review
[19:30] tonight.
[19:32] But I would just seek to address that later, I
[19:36] guess, with the.
[19:37] A driveway permit stage or something like that with the,
[19:39] with the applicant. So I just wanna note it as
[19:41] a potential cur concern that needs to be addressed at
[19:45] some point in the future.
[19:47] Do you did Mr. Hudson, do you think that's worthy
[19:50] of potentially adding as a condition applicant to work with?
[19:54] Staff regarding I would, yeah. With public works.
[19:58] Yeah, I would, I would welcome a condition like that
[20:00] just to, I, I haven't.
[20:03] Haven't I haven't dreamed up an answer. I don't know
[20:05] what currently occurs. If people turn around the driveways, they
[20:07] turn around the driveways now, or, or how it works.
[20:09] Exactly. But I do see that as an issue on
[20:12] this dead end with no cold sack or turnaround, which
[20:15] I'm I'm is no, not probably you unique in the
[20:17] city, but.
[20:19] Definitely makes things difficult for.
[20:21] For public works operations.
[20:24] Do do you happen to know how they're handling it
[20:26] now as an existing public way or.
[20:29] I do not. No, I do not.
[20:32] It, it seems like there's there's opportunity for, for discussion.
[20:34] So, so maybe no way to no way to do
[20:37] anything with it. I don't know. I just.
[20:40] You know, may, maybe it's a simple as permission to
[20:42] be able to turn around in the driveway. That's gonna
[20:44] be created.
[20:45] I don't know the answer to that, but I, I
[20:47] would wish welcome a further discussion.
[20:49] So I won't, we won't.
[20:52] Won't hold 'em hostage, so to speak, you know, on
[20:54] whatever the end result is, but I would appreciate an
[20:56] opportunity to have that.
[20:58] Direct discussion later with the applicant.
[21:00] Thank you, Mr. Deals. I would imagine you're open to
[21:04] having a discussion with happy to have the public parts.
[21:06] Okay. Thank you. Very good. Thank you.
[21:08] All right. Thank you, Mr. Hudson. Thank you. Other questions
[21:11] from the board at this time.
[21:16] All right. Scene. None.
[21:18] I'm gonna close the public hearing.
[21:22] Go into our, our deliberation.
[21:28] This one, this one seems.
[21:30] I need to use the term, but kind of straightforward
[21:33] other than the, the snow.
[21:36] Removal potential, but it seems like there's, there's at least
[21:39] a conversation to be had on that.
[21:41] So I wouldn't certainly want to see something like that.
[21:45] You know, halt this, but obviously I'd love to, to
[21:47] hear back from the board and see if there's any
[21:49] other issues or concerns that you may have.
[21:55] I just have a question for staff once, please.
[21:59] Just in terms of the.
[22:02] Decorder of, of taking a motions.
[22:05] Motions. I just want to clarify, are you envisioning that
[22:09] we would.
[22:10] Take up the, the one waiver for the subdivision and
[22:14] then the subdivision approval.
[22:16] Then the one waiver related to the conditional use permit
[22:19] and the conditional use permit approval. Is that what you
[22:21] had in mind or I just wasn't sure if we
[22:24] should take those waiver requests separately, given that the.
[22:27] The two were sort of depended on one another.
[22:31] So the, I believe the conditional use is the first
[22:35] item at hand. That'd be a waiver to the conditional
[22:37] use criteria.
[22:39] And then a determination on conditional use approval.
[22:44] And then subsequently the subdivision waiver and the subdivision approval.
[22:48] Good question. Okay. So it's the.
[22:50] The subdivision approval has be granted first, not the conditional
[22:53] use permit. Got it. Conditional use first. I'm sorry. Con
[22:56] conditional use subdivision first subdivision subdivision. First subdivision first. Okay.
[23:01] We're all learning. Okay. Thank you. Thank you.
[23:07] All right.
[23:11] All right now that we have our, our, our PS
[23:13] and QS in order.
[23:15] Is Eddie would any member of the board be willing
[23:17] to.
[23:18] Make a recommendation or make a motion.
[23:22] Regarding the, the C
[23:24] U P application the subdivisions. Oh, the subdivision chief. Now
[23:27] I screwed it up too. All right. Pardon me? The
[23:30] subdivision Mr. Chair.
[23:33] So I would first make a motion as to the
[23:36] one waiver request.
[23:38] Relating to the subdivision plan. So.
[23:40] Specifically that is a wave of request from section.
[23:42] One 90 dash 2 82 with respect to showing existing conditions
[23:48] within a thousand feet.
[23:50] And that motion would be to.
[23:52] Grant that waiver of request based on a finding that
[23:56] strict conformity would pose an unnecessary hardship.
[24:00] And that the specific circumstances of the, the application.
[24:04] Indicate that granting the waiver will still allow for carrying
[24:07] out the spirit and intent of the regulation.
[24:09] Alright, thank you. Motion by Mr. Varley with respect to
[24:13] granting the waiver for the subdivision plan.
[24:16] Is there a second.
[24:18] Second by Mr. Hirsch.
[24:20] Any further discussion.
[24:23] All those in favor.
[24:25] Aye. Aye. Aye. Motion passes.
[24:28] Passes. Would you like to continue? Yes.
[24:32] And just a quick question for Mr. Hudson, does it
[24:34] matter from your perspective that additional.
[24:37] Condition relating to the snow plowing.
[24:40] Do you view that more appropriately as a condition to
[24:42] the subdivision plan or the conditional use permit?
[24:45] I was, I was trying to say that in my
[24:47] own head too. I think maybe the subdivision cuz regardless
[24:49] of what use was.
[24:51] Done on that lot. We'd want to have that same
[24:53] discussion maybe. Right. Even if it was a single, single
[24:56] family.
[24:57] Lot. So, so I think it's more appropriate for the
[24:59] subdivision, but I yield to staff if that's not appropriate.
[25:02] Okay. Makes sense to me. I would agree. Okay. Thank
[25:05] you.
[25:06] All right. With that clarification, I would then.
[25:10] Make a motion to
[25:14] grant
[25:15] final subdivision approval with respect to.
[25:19] Sorry, I'm just case number here.
[25:22] Case a 25.
[25:24] Dash 0 42.
[25:29] With a finding that the application does meet the requirements
[25:32] outlined in subdivision NRL, section one 90 dash 1 38 G.
[25:37] With
[25:40] subsequent conditions as falls.
[25:42] Follows a through E is written in the staff report.
[25:46] And then a new, newly added.
[25:48] Subsequent condition indicating that the applicant shall work with staff
[25:53] from the department of public works.
[25:55] To develop a plan for snow removal on the site.
[26:01] Thank you motion by Mr. Barley. Is there a second?
[26:05] Second by Mr. Hirsch.
[26:07] Any further discussion.
[26:10] All those in favor.
[26:12] Aye motion passes.
[26:14] Passes, I guess.
[26:17] Next would be
[26:20] yeah. No. So the waiver motion on the waiver? Yeah,
[26:23] for the C U P. Okay.
[26:27] Okay. So
[26:30] I would next make a motion.
[26:34] To approve the waiver request with respect to the conditional
[26:37] use permit.
[26:39] Specifically
[26:42] a request from, for a waiver from.
[26:47] Section 1 98 dash one 90 to allow nine parking spaces
[26:52] where otherwise a max move six would be permitted.
[26:55] And again with the finding that strick and formative impose
[26:58] an unnecessary hardship.
[27:00] And that the specific circumstances or conditions.
[27:03] Of the site indicate that granting the waiver will allow
[27:07] for properly carrying out the spirit and intent of the
[27:09] regulations.
[27:12] Thank you.
[27:14] Motion by Mr. Varley. Is there a second?
[27:16] Second by Mr. Green.
[27:19] Further discussion.
[27:22] Actually just had one from staff that the, the.
[27:26] Land use matrix table.
[27:28] Is in section 1 98, 1 90, but is the waiver actually being
[27:31] sought from one 90?
[27:33] 2 71. I
[27:35] the waiver is to.
[27:38] One 90 dash 2 82, I'm sorry, one 90 dash 2 7 1
[27:43] I two.
[27:44] In that language reads.
[27:47] Reads, I can just find it.
[27:54] That language reads, individual parking loading spaces.
[27:59] To be noted, required and provided.
[28:01] Provided. And so since they were providing.
[28:04] More than what's allowed. We referenced the.
[28:08] Other section of the code specific to parking matrix.
[28:12] Okay. No, and, and I appreciate that, but, but I
[28:15] just, as a matter of citation,
[28:17] in the motion. It, it is is the waiver from
[28:20] section one 90 dash 2 71 or do so that would
[28:23] be okay.
[28:24] Understood. Thank you.
[28:28] Mr. Barlow, would you mind restating that motion? Just.
[28:32] Sure. I, I, I think I, I can just clarify
[28:35] that.
[28:36] The, the waiver itself is from one 90 dash, 2 71.
[28:40] I.
[28:42] In terms of establishing the.
[28:44] The maximum parking standard. Okay.
[28:48] Excellent. Thank you very much. You're welcome.
[28:51] Mr. Green, would you move on this? No, sir. All right.
[28:53] Seconded by Mr. Green. All right. Further discussion.
[28:57] All those in favor.
[28:59] Aye. Aye. Aye. Aye. Motion passes.
[29:02] Passes. Thank you. Thank you.
[29:05] All right. All right. And then.
[29:08] Take the, the left to prove the piece. Yes. Yes.
[29:11] Yep.
[29:13] So final motion on this, this set of, of applications.
[29:21] So as to
[29:23] case number a 25 dash 0 43.
[29:29] Conditional use permit.
[29:31] I would make a motion to approve that application.
[29:35] Finding that it meets the requirements outlined in section one
[29:38] 90 dash 1 33.
[29:41] And with
[29:43] subsequent conditions as listed a through I in the staff
[29:48] report.
[29:50] Thank you. Motion by Mr. Barley.
[29:53] Grant conditional use permit approval. Is there a second, second
[29:55] by Mr. Green?
[29:57] Any further discussion.
[29:59] All those in favor. Aye. Aye. Motion passes.
[30:03] Passes. All right. Moving along.
[30:13] On your new business subdivision plan.
[30:17] Property is located 3 38, 3 40. Can you go Amherst street in
[30:21] 16 airport road?
[30:24] Mr chairman, I'm gonna, but prior to reading it. Okay,
[30:27] thank you, Larry. For the record, Mr. Hirsch is recusing
[30:30] himself when.
[30:31] The next two cases.
[30:36] There's an associated site plan.
[30:39] With same property.
[30:42] Subdivision plan is case a 25 dash 0 46.
[30:47] And the site plan is case number 8 25.
[30:51] Dash 0 0 4, 4.
[30:55] At the board's discretion.
[30:58] We could potentially take both of these at the same
[31:00] time.
[31:02] And if any member of the board is willing to
[31:05] make a motion.
[31:07] Regarding completeness and acceptance over those two cases.
[31:11] Feel free to go for it.
[31:16] Ms. Harper, Mr. Chair, please. Yes. In regards to new business
[31:20] subdivision plans case a 25 dash 0 46.
[31:26] And
[31:28] new business site plans case a 25 dash 0 0 4 4.
[31:34] I'd like to make a motion to take Juris addiction.
[31:37] Alright, thank you. Motion by Ms. Harper. Is there a
[31:41] second?
[31:42] Second by Mr. Barley.
[31:44] Garland any further discussion.
[31:46] All those in favor. Aye. Aye. All right, Mr. Trough,
[31:50] let's go right ahead.
[31:58] Good evening, Mr. Chairman members of the board.
[32:01] My name is Jim Petros. I'm a professional engineer with
[32:04] Haner Swanson.
[32:05] Three Congress street, Nashua, New Hampshire tonight representing the law of
[32:09] family companies.
[32:11] Brian law is the president. Brian joins us this evening.
[32:15] It's just read into the record. We have two cases.
[32:18] With the chair's permission. I'll talk about the lot land
[32:21] relocation plan first.
[32:23] And then move into the site plan.
[32:26] We're here tonight, discussing properties at 3 38.
[32:29] 3 43 50 Emer street and 16 airport road.
[32:34] Three of the four properties have frontage on Amherst street
[32:38] and over the GB general business zone.
[32:41] The other lot.
[32:43] Is long airport road is.
[32:45] In the park industrial zone.
[32:47] Currently these buildings, each lot houses, a building.
[32:52] Lot 98 includes the former.
[32:54] Global building that will be the subject.
[32:57] Of our redevelopment application this evening.
[33:00] Next to it. Lot 97 is the former lead lanes
[33:03] building.
[33:04] About 4 79 is the recently.
[33:07] Constructed retail restaurant development.
[33:10] And as I mentioned, the airport road parcel as well.
[33:14] These are very visible sites. I'm sure everybody has been
[33:16] by them to see them. They're fully developed.
[33:19] Fairly flat sites fully.
[33:21] Utilized, we do have coal rain Brook behind two of
[33:25] the three, two of the four lots.
[33:28] Lots that flows in an Easter redirection.
[33:30] The lot line relocation plan is up on the screen
[33:33] right now. And it's a simple plan that looks to
[33:36] just move lot lines slightly.
[33:39] Between these buildings to ensure conformance with side yard setbacks.
[33:46] Setbacks, not only for this particular.
[33:49] Action on lot 98, but also for a future site
[33:53] plan that will be coming forward.
[33:56] On lot 97 later this summer.
[34:00] These lot line changes will make each of the four
[34:02] lots conforming of course.
[34:05] Law Realty company, law family company will own these lots.
[34:10] Lots and as part of a staff comment,
[34:13] they've asked to put a, a document on record.
[34:16] Essentially saying that if they were to sell one of
[34:17] the parcels.
[34:19] Parcels that the cross access and parking and utility easements
[34:22] would be.
[34:23] Perfected. And we were fine with that.
[34:26] There are no impacts with the lot line plan to
[34:29] any public street. We have requested one waiver. Mr. Chairman,
[34:33] famous section 1 92 81.
[34:36] Survey within Jason parcels within a thousand feet. And similar
[34:40] to the case before you.
[34:42] We seek that relief.
[34:45] With regard to the site plan.
[34:48] The site plan that we've submitted focuses on the newly
[34:51] created lot 98, the former global building.
[34:55] And there are two purposes.
[34:57] Purposes for why we're here this evening.
[35:00] First it's being proposed to change the use.
[35:04] From a 12,500 square foot. One story building from indoor.
[35:08] Recreation to a medical services building.
[35:12] Which is an allowed use.
[35:14] In the GP zone. And then the second is to
[35:17] show minor site improvements to complement this new use.
[35:21] The medical services will go into the building. This is
[35:24] not a tear down. This is not a new construction.
[35:26] This is a redevelopment of that building.
[35:29] The medical use is intended to be a free-standing emergency
[35:32] room.
[35:34] It will provide the same type care as a hospital
[35:36] emergency room.
[35:38] And this use is slightly different than.
[35:41] Urgent care facilities that you might be familiar with.
[35:45] They contain advanced equipment and they contain a higher level
[35:48] of care.
[35:50] Urgent care. You may have a cold or a flu
[35:53] or an ankle sprain. You would go there.
[35:56] This type use is servicing.
[35:59] Cardiac arrest stroke, broken bones or trauma.
[36:03] It is a 24 7 facility.
[36:06] Over the course of the day, they would have 30
[36:09] staff members.
[36:10] And on a typical day, they see approximately 30 patients.
[36:15] Patients, the average length to visit is between 90 and
[36:18] 120 minutes.
[36:20] And there's no overnight stay at this facility.
[36:23] So that's the ch the change of use piece of
[36:26] this.
[36:27] Second piece of the site, improvements that go along with
[36:30] it and you can make it those out on the
[36:31] site plan.
[36:33] We're maintaining our right turn in, right. Turn out. Curb.
[36:36] Cut on Amber street.
[36:38] We are planning for future driveway connections to the west.
[36:43] Through the little lane site.
[36:45] And through the recently constructed law retail site.
[36:50] To create that interconnectivity between these three Amer street, lots.
[36:54] Lots. And what that does is allow.
[36:58] Patients or visitors or staff.
[37:01] Looking to head west on Amer street because Amer Street's
[37:03] a divided way.
[37:05] To work through the law sites to am airport road,
[37:07] take a right, get to Amherst street at the signal.
[37:10] In head west.
[37:13] The parking lot will be reconstructed 31 spaces are required
[37:17] by code or proposing 46.
[37:20] Behind the building is a covered ambulance.
[37:23] Access to the building. There's also a dumpster and a
[37:26] generator PA pad in the back of the site as
[37:28] well.
[37:30] Utilities will remain. There'll be new signage, new lighting, new
[37:35] landscaping.
[37:36] With regard to stormwater currently.
[37:39] This site, just chief James, right into Cole, rain Brook
[37:41] in the back.
[37:43] In redevelopment sites, we're looking to improve.
[37:46] The condition, we do have more open space than the
[37:49] current condition, so that will help quantity wise.
[37:52] Quantity-wise quality-wise we didn't have a lot of options. We've
[37:55] got high ground water out there. We've got some suitable
[37:57] soils.
[37:59] Soils we're proposing a mechanical device.
[38:02] That will seek to remove a lot of the particular
[38:04] that comes off of parking lots, such as this.
[38:09] Traffic Mr. Chairman, your favorite subject.
[38:11] Is a traffic report was submitted.
[38:14] As part of our application.
[38:17] They're very low numbers, 27 trips in the am. Peak
[38:20] 30 trips in the PM. Peak.
[38:22] PMP about 450 trips trips overall.
[38:26] And they're replacing again, a rec indoor recreational.
[38:30] Facility. So a full store.
[38:32] Traffic study was not warranted.
[38:35] Building elevations Connor. If you could call up, there's a
[38:37] couple graphics on the buildings.
[38:40] Buildings really just an enhancement of the building that exists
[38:43] out there right now. New doors, new windows.
[38:46] New canopies.
[38:48] Screening of the HVAC units on top of the building.
[38:53] We're
[38:54] it's it's viewed as a, a pretty good improvement architecturally.
[39:00] Over what's there today. The site plan contains two waiver
[39:03] items.
[39:05] The first is survey 1 92 79.
[39:10] Survey within a thousand feet that you're familiar with.
[39:13] The second is certain architectural standards, dimensional standards, building materials.
[39:19] Materials as an example, Mr. Chairman, the, the code requires
[39:22] a customer of entrance off of public street.
[39:25] The entrance to the building is inward it's facing towards
[39:28] the lead lane site. We're looking to maintain that. So
[39:31] we have an architectural waiver letter as well.
[39:35] With permission. This evening work is expected to start this
[39:38] fall of 2025 with an opening in 2026.
[39:43] We believe our applications conform to the national land use
[39:46] code.
[39:48] The conditions of approval as outlined in the staff report
[39:51] are acceptable to our client.
[39:53] And we respectfully seek your approval this evening.
[39:57] And I'm happy to answer questions.
[39:59] Questions. Thank you.
[40:03] Questions from the board.
[40:05] Mr barley, please. Thank you, Mr. Chairman.
[40:08] Just I'm curious, given the nature of the use.
[40:13] Where it's gonna be a healthcare facility.
[40:15] Do is there.
[40:18] Is the proposed
[40:20] tenant already in the process of seeking licensure for the
[40:24] facility? Yes, sir.
[40:25] In is there, I'm assuming you've got some process by
[40:28] which the.
[40:30] The development is conditioned upon them receiving that approval or
[40:33] how, how are you anticipating that would work. Yes. Yes.
[40:35] Yes.
[40:36] Thank you.
[40:38] There's certain state for everybody else. There's certain state approvals
[40:41] associated with a facility such as this they're going through
[40:44] that process now.
[40:47] Other questions from the board.
[40:50] I just have one question. You had mentioned that.
[40:55] That predominantly there, the cases that would be coming and
[40:58] could be like, you know, heart attack or what have
[41:00] you. So.
[41:01] At the, this facility, they would be doing the initial
[41:04] treatment. Yes. And then moving them to the hospital. Yes.
[41:06] At that point. Okay. Yeah. Thank you.
[41:11] Thank you.
[41:12] Other questions from the board at this time.
[41:19] Okay. Scene none. Thank you. Thank you. We'll open this
[41:22] up to the public. Is there anyone in the audience
[41:24] that would like to speak in opposition or with concern
[41:27] to this application?
[41:32] Is there anyone in the audience I would like to
[41:33] speak in favor of this application.
[41:38] Seeing none. I'll toss it back to the board. One
[41:40] more time.
[41:42] Any further questions from the board.
[41:46] All right.
[41:47] At this time I will close the public hearing. We'll
[41:50] go into our deliberation.
[41:56] My general thoughts.
[41:58] Thoughts will be on the waivers at least.
[42:02] We do see the thousand foot come up a lot.
[42:05] The architectural.
[42:07] I'm a little less concerned with, if.
[42:10] If, if it helps them sort of salvage.
[42:12] You know, kind of the core of the building there.
[42:16] I wouldn't want to force him to swing the door
[42:17] and.
[42:19] If it's front facing to Amherst street, that's not necessarily.
[42:22] Appealing for folks that
[42:25] may seek care there. So.
[42:28] My, my, my, my short 2 cents for now. But obviously
[42:33] I'd love to hear from the board, if you have
[42:34] any other thoughts or, or comments on this.
[42:42] Seeing none.
[42:48] The fun stuff. So
[42:51] I think similar to
[42:55] the last case.
[42:57] We would want to take up the lot line.
[43:00] Adjustment first. So that would be case a 25.
[43:05] Dash 0 46.
[43:09] And firstly, we would need to address.
[43:13] The waiver related to, to.
[43:16] The thousand foot property line. Excon.
[43:20] Is any member of the board willing to make a
[43:22] motion?
[43:23] Regarding the waiver request.
[43:26] On the subdivision plan.
[43:31] Mr. Riley.
[43:32] Yes, Mr. Chairman, I would make a motion to.
[43:36] Grant the waiver request with respect to the lot line.
[43:41] Application a 25 dash 0 46.
[43:46] That
[43:47] request being for a waiver from one 90 dash 2 82,
[43:51] BK nine.
[43:52] Relating to showing existing conditions within a thousand feet.
[43:56] And that motion to approve would be with a finding
[43:59] that strict conformity would pose an unnecessary hardship.
[44:04] And that the specific circumstances or conditions of the site.
[44:08] Indicate that the granting of the waiver will.
[44:11] Allow for properly carrying out the spirit intent to the
[44:13] regulations.
[44:15] Thank you motion by Mr. Barley. Is there a second?
[44:19] Second by Mr. Green.
[44:21] Any further discussion.
[44:23] All those in favor. Aye. Aye. Motion passes.
[44:27] Passes. Would you like to continue Mr. Barley? Sure.
[44:31] So I now like to make a motion to grant
[44:34] final approval.
[44:35] As to case a 25 dash 0 46. Again, the lot
[44:40] line.
[44:41] Adjustment and
[44:44] that would be a fine with a finding that the
[44:45] plan does meet the, the criteria outlined in subdivision, NL
[44:49] section 19 dash one 30 ag.
[44:52] G sub subject to the following.
[44:55] Subsequent conditions that are listed in the.
[44:58] Staff report a through E.
[45:00] Thank you. Motion. Aye. Mr. Barley, is there a second?
[45:04] Second by Mr. Green.
[45:06] Any further discussion.
[45:08] All those in favor.
[45:10] Aye. Aye. Motion passes.
[45:13] Passes. So next would be taking up the site plan
[45:17] application case 8 25 dash 0 44.
[45:23] And we would need to.
[45:26] Address.
[45:28] Two waiver request first.
[45:30] Any member of the board willing to.
[45:32] Make a motion regarding the waiver request.
[45:36] For case 8 25 dash 0 4 4.
[45:42] Mr barley, please. I might as well. keep going
[45:45] along here.
[45:47] Yes. Thank you, Mr. Chair.
[45:49] I would make a motion as to 8 25.
[45:52] 0 0 4, 4.
[45:55] With respect to the two requested waivers to.
[46:00] Make a motion to approve.
[46:02] Both. And those are specifically.
[46:06] A waiver request from section one 90 dash 2 79, EE.
[46:10] Again, relating to showing existing conditions on adjacent parcels.
[46:15] Parcels and second
[46:18] from section one 90 dash 1 72.
[46:21] To waive certain architectural standards for non-residential buildings.
[46:24] Buildings, including requirement to have customer entrances on all sides.
[46:30] And as to both of those.
[46:33] Waiver requests, the motion we've made with the finding that
[46:36] strick conformity would pose a unnecessary hardship.
[46:39] And that the specific circumstances or conditions of the site.
[46:42] Indicate that granting the waivers.
[46:44] Waivers will still allow for properly carrying out the spirit
[46:46] and intent of the regulations.
[46:49] Alright, thank you, Mr. Barley.
[46:52] Motion by Mr. Barley, is there a second?
[46:55] Second by Mr. Hudson.
[46:57] Any further discussion.
[47:00] All those in favor.
[47:02] Aye motion passes.
[47:04] Passes. Do you want, I'll close it out. Mr. Chair.
[47:07] Okay. Sure. Yeah.
[47:09] Again, as to new business, a 25 dash 0 44.
[47:15] Site plan. I would like to make a motion.
[47:20] To grant final approval.
[47:26] And that final approval would be.
[47:29] With the subsequent conditions.
[47:32] Listed a through M in the staff report.
[47:36] Mr actually should second it before we discuss it or,
[47:40] oh, it was just gonna say motion by Mr. Barley.
[47:43] Yeah, I think you should second it, oh, I'll second
[47:45] it. And second, second. Can I speak to my second?
[47:47] I'll second by Mr. Hudson. Any further discussion? Yes. Mr.
[47:50] Hudson, please. Yes, please. Mr. Chair.
[47:54] Condition E can be struck because the traffic related.
[47:58] Comment that Wayne husband had was, was incorporated in item
[48:01] B.
[48:02] Okay. Condition D so that, that, that E can go
[48:05] away and reembered accordingly.
[48:08] Okay. I, Mr. Chair, I will.
[48:10] Amend my motion with that clarification.
[48:14] Still being an approval.
[48:16] With subsequent conditions, but
[48:18] removing original condition.
[48:21] E and re lettering accordingly.
[48:25] I'll re second that motion, Mr. Chair. All right. Motion
[48:27] by Mr. Varley. Second by Mr. Hudson.
[48:30] Any further discussion.
[48:33] All those in favor.
[48:35] Aye motion.
[48:37] Motion passes. Thank you very much.
[48:45] Moving along.
[48:50] Just so folks, if anyone was here for 55, a
[48:53] middle unstable road,
[48:55] that case has been postponed will not be heard this
[48:58] evening.
[49:00] Next case under new business case number a 25 dash
[49:05] 0 31.
[49:08] Property is located at 46 and eight domain avenue.
[49:12] Has any member of the board reviewed that application is
[49:15] willing to make a motion regarding completeness and board acceptance
[49:18] of projects.
[49:20] Projects Mr. Chair, Ms. Harper, please. I'd like to make
[49:24] a motion to take jurisdiction of case new business site
[49:28] plans case a 25 dash 0 0 3 31. Alright, thank you, Ms.
[49:32] Harper in there a second.
[49:36] Second by Mr. Hirsch.
[49:39] Any further discussion.
[49:41] All those in favor.
[49:43] Aye. Aye. And also just note for the record, Mr.
[49:46] Hirsch has rejoined us for, for this case.
[49:52] The floor is your, is us introduce yourself and tell
[49:54] us a little bit about what's going on over on
[49:57] domain. Good evening, everyone. My name is Dan Borowski I'm
[50:00] with Fieldstone land consultants. I'm here tonight on behalf of
[50:04] Gina Mac property Cing site plan approval.
[50:08] Or an amended site plan approval for four, six, and
[50:11] eight domain development.
[50:14] This plan, this site plan was approved in 2022.
[50:18] And we're seeking a small.
[50:20] Amendment here. The changes are really a decreased.
[50:25] Front setback on the Western units.
[50:31] G through
[50:33] G through M I'm sorry, small font and, and it,
[50:36] and it decreased rear setback for the.
[50:40] It's the units in the PI mu district.
[50:43] U district on the Western of the lot.
[50:45] The front impact would be reduced from 30 feet to
[50:48] about 18 feet. And the rear setback would be reduced
[50:51] from.
[50:52] 20 feet to about 10 feet.
[50:55] We had originally submitted a, a variance for this request,
[50:58] but then staff directed us that sense we're requesting this.
[51:03] In the P I M U district at this board
[51:05] is really the proper avenue to, to seek this relief.
[51:09] Because you have the ability to vary the dimensional requirements
[51:12] for this district.
[51:15] So along with this change, we've, you know, this change.
[51:19] Team about with about 4,000 extra square feet of impervious
[51:22] area. So we've extended the.
[51:31] The trench in the rear of the property for stormwater
[51:34] drainage.
[51:35] Accordingly. And we've submitted a stormwater letter to that effect.
[51:41] We've also added some plantings for the front and rear
[51:44] of the lot as well.
[51:48] And in addition to those changes, we've also removed the
[51:50] decks off the front of the lots to.
[51:53] Kind of decrease the impact that we're having on the
[51:56] setback.
[51:57] But overall, we think that this would make for a
[51:59] much more uniform.
[52:01] Looking building and a much more marginable site.
[52:04] So I'd be happy to answer any questions.
[52:06] Questions. Just a couple of quick ones, if I may.
[52:10] So the number, number of units that were originally proposed
[52:13] is not James. Exactly the same. We are originally proposed
[52:16] units.
[52:22] So
[52:24] this was the approved site plan from 2022. And you
[52:27] can see that there are much smaller units.
[52:29] On the Western side of the lot.
[52:33] So the, the main complaint that the development across the
[52:37] street has gotten is that the living rooms are pretty
[52:39] small. So.
[52:41] We'd like to just mirror or use the same exact
[52:43] building footprint on the east side of the lot as
[52:45] the west side of the lot.
[52:47] Okay, thank you for that clarification. And I, I guess
[52:50] my, my one follow up would be despite the increase
[52:54] in impervious, it doesn't look like you're seeking any waivers.
[52:56] So.
[52:57] Dimensionally. This is still all within. Yep.
[53:00] Within the ordinance. It, it is. We still meet the
[53:03] impervious for each zone.
[53:05] And storm water, the increase the storm water was handled
[53:09] with just a, a slight increase in the.
[53:12] Proposed measures that were already proposed.
[53:15] Okay, thank you.
[53:17] Questions from other members of the board.
[53:20] Mr. Hudson, please.
[53:22] Thank you, Mr. Chair, you may have mentioned it, but
[53:24] you are. You're removing all the decks too. Is that
[53:26] true? Yeah, we've removed them. Okay. Correct.
[53:29] And I would just know that this latest plan, I
[53:32] think, engineering received on Monday. So we haven't had a
[53:35] chance to fully re review it.
[53:38] We received the one plan.
[53:40] Not a full set. So, you know, the, the, the,
[53:44] the notation about.
[53:46] We've extended the
[53:48] you know, stone trench and this, that, and the other
[53:50] thing, we just, there's some final details that we need
[53:52] to work through. We didn't, we did not in issue
[53:55] a letter and there was a condition in the report.
[53:57] I would just.
[53:58] Ask that would be provided.
[54:01] An opportunity to further consult with, with the applicant.
[54:05] Just to confirm that everything's been addressed. I.
[54:08] Seems to make sense. It doesn't seem like a whole
[54:10] lot of additional impervious. So it sounds, I.
[54:13] Concur that probably they adequately addressed it, but we just
[54:15] wanna see those details before we sign off. So I,
[54:18] I appreciate that. And Mr. Hudson, do you think that
[54:20] should be yeah. Explicitly as a condition? Yeah. Condition C
[54:25] referencing an anticipating E email from one hus and we
[54:28] have an issued one. So.
[54:31] I just revise that to be something like, you know,
[54:35] final plans to be
[54:37] addressed. I mean, previous comments to be addressed as satisfaction,
[54:42] I guess.
[54:43] All so potentially see, see, I think there was an
[54:44] outstanding comment from the previous, right.
[54:47] Approval, which hasn't been fully dressed made. Oh, actually they're
[54:49] changing things. So anyway, we gotta address.
[54:52] We need to go through and dot the dot the
[54:54] I cross Ts. So some condition to that effect, we,
[54:56] we could wordsmith condition, see a little bit, I think,
[54:59] in a way that would satisfy public works. Yeah. Appreciate
[55:02] that. Thank you.
[55:04] Excellent. Other questions from the board Ms. Harper, please. Yes.
[55:08] Thank you, Mr chair, just curious. Are there any other
[55:10] major changes to the exterior of the building besides.
[55:14] It's removing the decks that we should be aware of.
[55:15] Nope. Just making the, the smaller unions larger and removing
[55:19] the decks. And we added some landscaping in front of
[55:22] the buildings.
[55:24] Buildings. So that would be different than the previous plan,
[55:25] correct? We, and so where the decks were, we had.
[55:28] Okay.
[55:30] Revised and added some more shrubs to, to increase the
[55:32] screening.
[55:33] Understood. Thank you. I guess, as a follow up to
[55:36] that, when a full plan set is completed, we'll revise,
[55:39] architectural. Be part of that.
[55:41] Place or yes, they, they can be because we've already
[55:45] submitted the architecturals I believe for the.
[55:48] Eastern half and we're proposing the same, you know, same
[55:50] building.
[55:51] Yeah, I would just kindly request the next submittal to
[55:55] the city is and complete plan set, full, full plan
[55:58] set. Yes, sir. Helpful for everybody. So.
[56:02] Other questions from the board.
[56:07] All right. Seeing none at this time. Thank you for
[56:10] your testimony. I'm gonna open it up to the public.
[56:13] Is there anyone in the audience that would like to
[56:15] speak in opposition or with concern to this application?
[56:19] Seeing none.
[56:21] Is there anyone that would like to speak in favor
[56:23] of this application?
[56:28] Go back to the board. One more time.
[56:32] All right.
[56:34] At this point, I am gonna close the public hearing.
[56:36] We'll go into our deliberation.
[56:41] I, I think overall to me, this seems like.
[56:45] Barely minor changes that that said I don't want to
[56:48] deny.
[56:50] Dan and his staff.
[56:52] A full lighted, the apple. So I, I think Dan,
[56:54] thank you for pointing that haven't had a chance yet
[56:57] to review a full plan. So.
[57:00] But just based on the prior history with, with this
[57:03] application, I, I would hope that.
[57:06] There's there's nothing too severe that they can't be worked
[57:08] through, but obviously I'd like to hear from other members
[57:11] of the board.
[57:13] If you have any additional thoughts on this one?
[57:16] Mr barley, please. No specific thoughts. Just a question for
[57:19] staff. Mm-hmm .
[57:21] In, in terms of the.
[57:24] Dimensional modification.
[57:26] I just wanna clarify that this is.
[57:29] The standard here is not.
[57:31] The waiver standard, but it's just.
[57:34] We're determining that the
[57:36] the modification is consistent with the site suitability standards. Is
[57:39] that right?
[57:40] Yeah, the site suitability, you're going into two different setbacks
[57:43] and you're enlarging the building a bit. So that will
[57:46] fit under that category. Right. Thank you.
[57:50] Thank you.
[57:52] Other questions or comments?
[57:54] Comments scene none.
[58:01] Would any member of the board, I guess.
[58:05] I guess we're looking for two separate motions here. One
[58:09] would be to grant the first would be to grant
[58:11] the dimensional modifications approval.
[58:15] And member of the board.
[58:16] Feel comfortable making a motion.
[58:19] Regarding the dimensional modification approval.
[58:24] Mr. Barley. Yes. Mr. Chair.
[58:27] So as to new business, a 25 dash 31 site
[58:31] plan amendment.
[58:33] I would first make a motion to.
[58:35] Grant the requested dimensional modification.
[58:39] In particular in reliance on the.
[58:43] Applicant's site plan suitability report dated April 25th, 2025.
[58:49] And finding that granting this modification will be consistent with
[58:54] the.
[58:55] Site suitability standards under section one 90 dash 23 F.
[58:59] Thank you. Motion by Mr. Varley. Is there a second?
[59:03] Second by Mr. Hirsch.
[59:06] Any further discussion.
[59:08] All those in favor.
[59:10] Aye. Aye. Motion passes.
[59:13] Mr. Barley. I hate to do it to you, but
[59:15] would you, would you care to continue? Yeah, I'm on
[59:17] roll here. All right. Yeah. So as to do business,
[59:20] a 25 dash 0 3 0 0 3 1 site plan amendment.
[59:25] I would like to make a motion now to grant.
[59:29] Final approval for
[59:31] the amendment
[59:34] and that.
[59:36] Motion was with the finding that the application does meet
[59:38] the requirements outlined in section one 90 dash 1 46 D.
[59:43] Subject to several subsequent conditions.
[59:46] And I would like to.
[59:48] Reference
[59:50] conditions a through F in the staff report, but with
[59:53] the following modification to.
[59:56] Condition letter C
[59:58] so removing the, the current.
[1:00:01] Condition and replacing it with.
[1:00:05] all outstanding comments from.
[1:00:10] The city engineering department to be addressed to the satisfaction.
[1:00:14] Of the division of public works.
[1:00:18] And that will again, replace the existing language for item
[1:00:23] Okay, thank you. Motion by Mr. Barley. Is there a
[1:00:25] second?
[1:00:26] Second by Mr. Hudson. Any further discussion, Mr. Hudson, please.
[1:00:31] Yes, Mr. Chair, I would just.
[1:00:33] Suggest, maybe we modify that revised condition to be that
[1:00:36] they submit a complete set of revised plans.
[1:00:41] Plans and that any subsequent.
[1:00:43] Comments.
[1:00:45] By engineering, the address to the satisfaction of division of
[1:00:48] public works.
[1:00:49] So essentially the same thing, but just denoting the fact
[1:00:52] that they needed to submit a complete sentence plans, which
[1:00:55] will be helpful for us to be able to provide
[1:00:57] that review.
[1:00:59] Absolutely. So I will go ahead. Amend my motion.
[1:01:03] Consistent with what was already made.
[1:01:07] But with a slight modification to my newly added.
[1:01:11] Condition C to indicate that the, the applicant.
[1:01:15] Shall first submit a complete plan set.
[1:01:18] And then any comments resulting from the submission of that
[1:01:20] plan set.
[1:01:22] By the engineering department.
[1:01:24] Shall be addressed by the applicant to the satisfaction of
[1:01:26] the division of public works.
[1:01:29] Mr. Barley, you guys are by modified his motion.
[1:01:32] Is there a second, second by Mr. Hudson.
[1:01:34] Any further discussion.
[1:01:37] All those in favor. Aye. Aye. Aye.
[1:01:40] Motion passes. Thank you very much.
[1:01:43] Accused. Understood. Thank you.
[1:01:49] I'll just mention that. Certainly.
[1:01:52] All right, moving along before we, we take our next
[1:01:57] case.
[1:01:58] Under new business site plan. Mr. Barley is gonna recuse.
[1:02:01] Yes. Thank you, Mr chair. Thank you.
[1:02:04] Next item on the agenda case number a 25 dash
[1:02:09] zero.
[1:02:10] Six six.
[1:02:13] It's got a very long description. Sam, you just want
[1:02:16] to call it the Mohawk site. All right. The Mohawk
[1:02:20] site.
[1:02:22] Any member of the board I re reviewed this application
[1:02:25] and is willing to make a motion regarding completeness acceptance.
[1:02:30] Mr. Green. Go right ahead, please. Thank you, Mr. Chair, a
[1:02:32] new business.
[1:02:33] Project a 25.
[1:02:36] Six six.
[1:02:39] Has the, I have to learn that it is complete
[1:02:42] and we are ready to take jurisdiction open in public.
[1:02:45] All right. Thank you. Motion by Mr. Green. Is there
[1:02:47] a second?
[1:02:48] Second by Mr. Hirsch, any further discussion.
[1:02:52] All those in favor.
[1:02:54] Aye. Aye. Aye. All right.
[1:02:57] Motion passes.
[1:02:59] Mr whisky, go, go right ahead. The floor is yours.
[1:03:03] Yours. There we go.
[1:03:10] Good evening, Mr. Chair and Madam members of the board.
[1:03:13] My name is Brad Westgate. I'm a lawyer of the
[1:03:16] wine men, 4 0 2 Amer street in Nashua representing Blaylock holdings,
[1:03:21] LLC, which is the apple applicant for approvals on the
[1:03:24] Mohawk Tanner read of development.
[1:03:27] Tom Zaja who's the project engineer with Andrew Swanson apologizes for
[1:03:32] not being here tonight, but he's happily represented by Jim
[1:03:36] Polis, retrograde regret to note his scene.
[1:03:43] What's before you tonight is actually a relatively simple request.
[1:03:46] Mr. Chair.
[1:03:48] The board in this board on June 20th, 2024. Granted for approvals
[1:03:55] for the Mohawk trainer redevelopment, three subdivision approvals in one
[1:03:59] site plan approval.
[1:04:01] What we're here seeking tonight as Mr. Z Zaja outlined
[1:04:04] in his letter that appended our application.
[1:04:07] Is an extension for 36 months of the 12 month.
[1:04:11] Approval timeframe that's set forth in section 1 46 E one
[1:04:16] of the land use code.
[1:04:18] That section states that if a site plan is approved,
[1:04:22] a building permit needs to be issued within 12 months
[1:04:24] of that site plan approval. Otherwise the site plan approvals
[1:04:27] void.
[1:04:29] It's interesting. These subdivision regulations don't have a similar 12
[1:04:32] month requirement.
[1:04:35] But section 1 91 46 E of the lane use code also
[1:04:39] provides that the planning board may extend.
[1:04:42] And pro pro approve a longer period. One margin by
[1:04:45] economic.
[1:04:46] Conditions development, phasing and other unique circumstances.
[1:04:50] And simply put, we would respectfully request that the Mohawk
[1:04:53] tannery redevelopment falls within that provision, given these other unique
[1:04:56] circumstances at which would enable the planning board to extend
[1:05:00] that 12 month timeframe.
[1:05:02] Just a few more brief thoughts about it. If I
[1:05:04] may, Mr. Chair.
[1:05:06] The, there are a number of unique circumstances, frankly, a
[1:05:09] multitude of them involved in this project. Obviously the site's
[1:05:12] quite challenging.
[1:05:14] And redevelopment is fully dependent on remediation of the environmental
[1:05:17] conditions.
[1:05:19] The EPA and D E S.
[1:05:23] Have before at a, and have been involved with Mohawk
[1:05:26] and its consultants, a substantial analysis of the remediation plan.
[1:05:31] This is gone on offer a significant at period of
[1:05:33] time. It involves literally week meetings be between bla law,
[1:05:37] that consultants, EPA and D S and D's own.
[1:05:41] Consultant that those approvals with EPA and DS are pending.
[1:05:46] They're literally looking at a 2,400 page.
[1:05:48] Package of a remediation plan with narrative plans.
[1:05:53] Plans backup data and the like,
[1:05:55] also the board of alderman, of course, has taken a
[1:05:56] number of steps that.
[1:05:59] Pertaining to this project and we're working with city staff
[1:06:02] to finalize some additional.
[1:06:04] Board of alderman matters for consideration.
[1:06:07] Adding to these unique circumstances.
[1:06:10] We're hopeful that the remediation work can actually begin in
[1:06:13] earnest this summer, but it'll probably take a solid two
[1:06:16] years.
[1:06:17] Both to do the work and then enable EPA and
[1:06:19] D S to inspect review and.
[1:06:21] Sign off on the work. So that takes us 24
[1:06:24] months. If you will, out of this 36 month.
[1:06:28] Requested extension, but if all those timeframes hold then within
[1:06:31] that last 12 months,
[1:06:33] which takes us all the way to June of 2028,
[1:06:36] the building permit issuance could be realistic as we noted
[1:06:39] in Mr. Zaja, Mr. Zack's letter. So we would respectfully
[1:06:44] request that that timeframe required under 1 9, 1 40 60 be extended 30.
[1:06:51] Six months. So it runs to June.
[1:06:53] 20 2020, excuse me, 2028, as we've outlined in our
[1:06:57] request.
[1:06:59] Happy to answer any questions, Mr. Chair.
[1:07:02] Thank you.
[1:07:04] Actually, I may just put one to staff really quickly
[1:07:06] just for, for clarification.
[1:07:08] Are we, are we modifying the original approval from last
[1:07:12] year? Or is this technically an extension? Does it matter?
[1:07:15] Is that sort of a move point?
[1:07:18] It, it is in a way, a moot point because
[1:07:20] the effect is the same. Essentially you were, are not
[1:07:22] granting an extension to the approval. Rather you are modifying
[1:07:25] the 12 month approval window. That is typical by attacking
[1:07:29] on another 36 months to that making a it a
[1:07:31] 48 months approval window.
[1:07:33] So this is Le legally there's.
[1:07:36] There's no difference as the outcome would be the same.
[1:07:38] The, the approach is slightly different. And I would say
[1:07:40] that the way that the code is written.
[1:07:43] Grants this unique approach.
[1:07:46] And given the unique circumstances associated with the site, this
[1:07:49] seems to fit better just from a point of law
[1:07:51] within the city's ordinance. Okay.
[1:07:54] I, I appreciate that.
[1:07:57] So, thank you.
[1:07:59] That's all. I had questions from the board.
[1:08:04] All right. None at this time.
[1:08:07] I will, I will put this out to the public.
[1:08:10] Are there any members in public here to speak in
[1:08:12] opposition or with concern for this application?
[1:08:17] Seeing none.
[1:08:19] Are there any members of the public here this evening
[1:08:21] that wish to speak in favor of this application?
[1:08:25] Alright, seeing none, toss it back to the board. One
[1:08:29] more time.
[1:08:32] I think we're good. Attorney Westgate. Thank you.
[1:08:35] This point I'll, I'll close the public hearing.
[1:08:39] We'll go into our deliberation.
[1:08:43] I, I, I think there's some level of appreciation here,
[1:08:46] just, just for the amount of moving parts with, with
[1:08:48] that site, you know, for, for obvious reasons, I think
[1:08:52] we wouldn't want to make a habit of this, but
[1:08:53] if there's one time where.
[1:08:55] I think the longer time period should, should be considered.
[1:08:59] It should be for something like this when you've got
[1:09:01] other federal agencies involved. And I'm not sure what else
[1:09:04] is going on with the land swaps and the easements
[1:09:06] and things like that. I imagine there's, there's a lot
[1:09:07] of details that you're typical application. Wouldn't not have.
[1:09:12] But I, I would say I'd love to hear your
[1:09:13] thoughts. If, if you have anything else to add on
[1:09:17] that.
[1:09:20] Ms. Harper. I, I would just agree with you, Mr. Chair.
[1:09:23] I do think that in this case, this is an
[1:09:25] appropriate amount of time, just because of all the work
[1:09:28] that does need to be completed.
[1:09:30] On the site. Thank you, Ms. Harper.
[1:09:34] Other comments from the board at this time.
[1:09:40] Let's see none.
[1:09:43] Would any member of the board be willing?
[1:09:46] To make a motion.
[1:09:49] Regarding approval of this application, Mr. Green. Yeah. I would
[1:09:53] like to make a motion.
[1:09:55] For new business project, a 25 dash zero six, I'm
[1:09:59] sorry. 0 66.
[1:10:01] Six granting final approval for the modification of the 12
[1:10:05] month time period.
[1:10:06] As defined in one 90 dash.
[1:10:09] 46 E one to be extended by 36 months to
[1:10:12] a 48 month period.
[1:10:14] Allowing for allowing to receive the building permit without need
[1:10:17] to apply further.
[1:10:19] Further approval extensions.
[1:10:22] Before 2028.
[1:10:26] All sub conditions placed on the original final approval.
[1:10:30] Granted in 2024 R to be incorporated in this new
[1:10:33] final approval as conditions.
[1:10:36] Thank you motion by Mr. Green. Is there a second?
[1:10:40] Second by Mr. Hudson, any further discussion.
[1:10:44] All those in favor.
[1:10:46] Aye motion passes.
[1:10:49] Passes. Thank you.
[1:10:53] All right.
[1:10:55] Next item on the agenda.
[1:10:58] Case 8 25.
[1:11:01] 34.
[1:11:03] Property located at Elkbrook road.
[1:11:08] As any member of the board had an opportunity.
[1:11:11] To review this application.
[1:11:13] And is willing to make a motion regarding its completeness.
[1:11:17] Sorry, Mr. Chair, did you want to note the I'm
[1:11:20] back and Mr. Hudson is.
[1:11:22] Certainly. Thank thank you Mr. Barley.
[1:11:28] Pull it up here.
[1:11:34] I'm sorry about that.
[1:11:36] Has any member of the board?
[1:11:38] Been able to review this application.
[1:11:40] And is willing to make a motion regarding completeness and
[1:11:44] the board taking jurisdiction over the application.
[1:11:50] Mr chair.
[1:11:52] I'd like to make a motion to take jurisdiction of
[1:11:55] new business site plans, case a 25 dash 0 34.
[1:12:00] All right, motion by Ms. Harper. Is there a second?
[1:12:04] Second by Mr. Hirsch.
[1:12:06] Any further discussion.
[1:12:10] All those in favor.
[1:12:12] Aye. Aye. Aye. Aye.
[1:12:15] is there any Proman the, the floor is here.
[1:12:21] We finally request again, just for, for the board in
[1:12:25] the hearing room, Mr. Coleman has every opportunity to present,
[1:12:29] and if he has other experts on his team that
[1:12:31] wish to present.
[1:12:34] Everyone's gonna get a chance. So Mr. Foreman, attorney Coleman
[1:12:38] Flores yours, please proceed.
[1:12:40] Mr. Chairman members of the board. Good evening. My name
[1:12:42] is Andy Pearlman.
[1:12:43] Attorney with Prunier and Pearlman here at Nashua.
[1:12:46] I am here tonight.
[1:12:49] Presenting on behalf of the city with respect to the
[1:12:51] Nashua rotary west.
[1:12:53] Disc golf course. We believe that we, we have a
[1:12:56] very good project to bring up a good amenity to
[1:12:58] the city that doesn't exist in the city today.
[1:13:02] We have a number of folks who will be addressing
[1:13:05] the board.
[1:13:07] Matt LeBlanc from public works is going to speak tonight
[1:13:13] with words from.
[1:13:17] Director photo who couldn't be here tonight. Who's not feeling
[1:13:19] a hundred percent.
[1:13:21] Mr. Metropolis, hangar Swanson, who seems to corner the market
[1:13:25] on the board tonight.
[1:13:27] Brendan Quigley is here. Brendan Quigley is our.
[1:13:30] Wetland soil scientist, our, our wetlands expert from Gove environmental.
[1:13:34] He's here to answer any questions. If the board should
[1:13:37] have any wetlands related question, however, the wetland matters have
[1:13:39] been addressed.
[1:13:41] With the zoning board.
[1:13:43] Dan Hudson is here as well. I think you folks
[1:13:46] may know Dan Hudson.
[1:13:48] Dan, if there are any questions with respect to the
[1:13:50] traffic report that VHB prepared.
[1:13:53] Dan can speak to those. I know we have a
[1:13:55] number of other folks here tonight. We have some friends
[1:13:57] from rotary, west Helen HARO, Janet Valk who wanna speak,
[1:14:01] and we have other supporters as well. And Mr. Chairman,
[1:14:04] if you indulge me, I do want to come back
[1:14:06] as speak as a witness.
[1:14:08] Because I, I came on the city's team in January, 2024.
[1:14:14] And I, I had played one round of disc golf
[1:14:16] with my family some years ago, but I've since learned
[1:14:19] a lot about disc golf, how it works.
[1:14:23] And I, and I do want to come back and,
[1:14:24] and speak to the impressions that I've received. Just.
[1:14:28] Learning and walking this golf courses.
[1:14:31] If you're not familiar with disc golf, it's it's.
[1:14:34] It's similar to regular golf.
[1:14:36] Except displayed with disks. We some call them Frisbees, but
[1:14:40] they're discs.
[1:14:42] Discs players have a number of any up to 20,
[1:14:46] some odd discs in their backpack or a cart that
[1:14:48] they leg ground on, on, on the disc golf course.
[1:14:52] And the disks are the different disks they're weighted. They're
[1:14:55] shaped differently for driving.
[1:14:57] Chip shots putting like very similar to golf.
[1:15:02] And similar to golf. I'm terrible at both of these
[1:15:04] sports.
[1:15:07] Mr chairman. We know that there's opposition, there has been
[1:15:10] opposition a along the way from through con Kong through
[1:15:14] the zoning board.
[1:15:15] But we believe we have a good plan that meets
[1:15:18] code we can, and again, we can bring.
[1:15:21] A project.
[1:15:24] That a lot of people in the city want to
[1:15:26] see.
[1:15:27] You know, brought forth in, opened up as soon as
[1:15:30] possible. So with that introductory remark, Mr. Chairman, if I
[1:15:33] could have Mala blank from public works, address the board
[1:15:36] for a moment, certainly. And I'll come back. Thank you.
[1:15:38] Thank you very much.
[1:15:48] Good evening. My name is Mount blank and I serve
[1:15:50] as the operations manager for the division of public works.
[1:15:54] I'm gonna read a statement from the director of public
[1:15:56] works, who has been very passionate about this project.
[1:16:00] But could not be with us tonight due to some
[1:16:02] illness.
[1:16:04] Thank you for the opportunity to present our application.
[1:16:08] Of the many projects that I have led during my
[1:16:10] tenure with the city disc golf has by far been
[1:16:13] the greatest.
[1:16:14] Potential to enrich the lives of all our residents.
[1:16:18] Residents it is free. It can be played at any
[1:16:21] age range and allows our residents to experience the beauty
[1:16:24] of the wooded area in Robi park.
[1:16:27] This project started with a petition of over 600.
[1:16:30] Nashua residents asking the city to build this disc golf
[1:16:33] course.
[1:16:34] When these discussions begin back in 2020.
[1:16:38] I had never even heard of disc golf.
[1:16:40] But came to realize the popularity of this sport with
[1:16:42] over 71 disc golf courses right here in New Hampshire.
[1:16:47] This golf courses are building harmony.
[1:16:50] With the surroundings and designate to protect the natural resources.
[1:16:54] Resources, this course was designed by two world champion disc
[1:16:57] golfers.
[1:16:59] An expert course designers, Avery Jenkins and Simon lizard.
[1:17:03] Mayor donas the board of public works and zoning board
[1:17:06] unanimously supported this project.
[1:17:10] I would like to thank.
[1:17:12] Conservation commission chair, Sherry Dotsie for helping to move this
[1:17:16] project forward in the natural west rotary for donating $30,000.
[1:17:21] To help build this park in a country that is
[1:17:24] currently so divided. It has been truly heartwarming to see
[1:17:27] such a diverse.
[1:17:29] In persistent group of disc golfers unite for the common
[1:17:32] goal of building a golf.
[1:17:35] Park where all residents are welcome.
[1:17:38] Our team is here to answer your questions and work
[1:17:42] with you to bring natural west rotary disc golf park
[1:17:45] to Nashua.
[1:17:46] National and next I'd like to introduce James PATAR Polis.
[1:17:51] Polis. Thank you. Thank you.
[1:17:58] Thank you, Matt.
[1:18:00] For the record.
[1:18:02] I'm chip metropolis, professional engineer with Hainer Swanson, Inc.
[1:18:06] And can everybody hear me back there? Is it okay?
[1:18:09] Okay. Thank you.
[1:18:11] So our company was initially hired.
[1:18:13] Hired to locate survey wet flags on this subject site.
[1:18:18] And since then we've been brought into.
[1:18:20] To act as an engineering consultant.
[1:18:23] To provide peer review of the plans, the application.
[1:18:28] And to assist with the project permitting.
[1:18:30] What I'd like to do tonight, Mr. Chairman.
[1:18:36] is give you a quick outline of the presentation. I'm
[1:18:40] gonna give you a brief overview of Robie park.
[1:18:43] I'm going to review the project's recent history.
[1:18:47] I'm gonna give you a very quick crash course on
[1:18:49] disc golf.
[1:18:51] And then I'm gonna talk about the details of the
[1:18:53] site plan.
[1:18:55] There's quite a bit of information here.
[1:18:58] I'll do my best to be both informative.
[1:19:01] In expeditious.
[1:19:03] When complete we, as a team will be available to
[1:19:06] answer questions from the board.
[1:19:08] And from the public
[1:19:11] Roby park itself was purchased and developed in the early
[1:19:14] 1980s and sits at the corner.
[1:19:17] Of spit brick road in east, Constable road in south
[1:19:20] Nashua.
[1:19:22] It's a uniquely shaped lot. You can see it in
[1:19:23] the yellow outline there that measures 50 about 57 acres.
[1:19:28] Located in the R 18 residential zoning district.
[1:19:32] A butters to Robi park to the north of spit
[1:19:35] Brook road, but then a across spit Brook. We have
[1:19:37] the Huntington, we have world academy.
[1:19:40] We have the church and we have a fire station.
[1:19:43] To the east is Oak hill.
[1:19:47] OQ in bay Ridge two multi-family residential developments.
[1:19:51] To the south is undevelopable and in single family, lots
[1:19:55] that, that reside on Southgate road. I believe.
[1:19:59] And then to the west is east SSTable road with
[1:20:02] sky meadow.
[1:20:03] On the other side.
[1:20:05] Rob park is an active public park. It is not.
[1:20:10] Conservation land like a number of other properties.
[1:20:13] In Nashua.
[1:20:16] For the record, there is no legal deed restriction for
[1:20:19] conservation.
[1:20:21] Upon this property.
[1:20:23] Now here in Nashua Robie park, as well as other
[1:20:25] parks have hours of operation that are seven they're open
[1:20:28] 7:00 AM.
[1:20:30] To 10:00 PM currently aerobic park.
[1:20:34] The park contains.
[1:20:36] Contains two softball fields, a children's play lot.
[1:20:40] A sliding hill during winter.
[1:20:42] Skating rink during winter.
[1:20:44] Walking trails and two parking lots.
[1:20:48] Lots. There's an upper parking lot at the corner up
[1:20:50] on east uncivil road.
[1:20:52] It contains about 26 parking spaces.
[1:20:54] And then the main lot that you see a long
[1:20:56] strip Burke road.
[1:20:58] Measures about 55 parking spaces.
[1:21:01] Please note that in addition to these two lots.
[1:21:05] Lots there is public street parking.
[1:21:08] Along a small section of east instable road. We know
[1:21:10] east Huntsville road is a very serpentine road. We know
[1:21:13] it's got guardrail, it's got some challenging curves.
[1:21:16] Curves, but up near that east instable road parking lot.
[1:21:19] There is parking provided probably in the five to six
[1:21:23] parking spaces.
[1:21:25] There's also parking on spit Brook road.
[1:21:28] Just east of the entrance, into the main parking lot.
[1:21:33] As can be seen on the aerial, the property contains
[1:21:36] a combination of trees and open cover, open land.
[1:21:40] The open land is predominantly in, in the north, the
[1:21:43] play fields, the rec areas, the parking lots.
[1:21:46] Lots that makes up about eight acres of the 57
[1:21:49] acres.
[1:21:50] The rest of it in the central part and in
[1:21:52] the Southern part.
[1:21:54] Of Robie park is currently wooded.
[1:21:57] It. And I would say it's mature for us with
[1:21:59] a combination of pine trees.
[1:22:01] In hardwoods.
[1:22:03] Next plan, please. Connor.
[1:22:06] The property has some varying topographic conditions. It's fairly flat
[1:22:10] in the playfield areas.
[1:22:12] Areas, but we've got slumping land on the sides.
[1:22:15] Which kind of creates a low valley in the middle.
[1:22:17] If you've walked the trail errands trails through the property,
[1:22:20] you walk through the low ends and you see kind
[1:22:22] of the, the uplands on the, off to the side.
[1:22:26] Over all. There's approximately a hundred foot grade change from
[1:22:28] the low part of the site to the high part
[1:22:30] of the site. So the site does contain some nice
[1:22:32] topography.
[1:22:36] It also contains, as I mentioned, walking trails, stonewalls.
[1:22:40] Stonewalls in rock out, croppings in the back.
[1:22:44] Wetlands have been flagged in accordance with local state and
[1:22:47] federal jurisdiction.
[1:22:49] Brendan Quigley joins us tonight. He is probably the most
[1:22:51] well respected, certified wetland scientists in the state of New Hampshire.
[1:22:56] And he's been involved in the project.
[1:22:59] The main wetland.
[1:23:01] Complex is a red maple swamp. That's really located in
[1:23:05] the center part of the site.
[1:23:07] It's fairly broad up near the back end of the
[1:23:09] softball fields.
[1:23:11] And then it narrows down into a water course that
[1:23:13] flows south.
[1:23:15] And then it broadens out again in the subtly part
[1:23:17] of this property.
[1:23:18] There's also two wetland channels, one from east Huntsville road
[1:23:22] and one from about the midpoint of Oak hill.
[1:23:25] Condominiums that that flow downhill.
[1:23:28] Into this water course.
[1:23:31] Lastly, there's three small wetland complexes in the extreme Southeast
[1:23:35] corner of the property. And of course, you know, here
[1:23:37] in Nashua,
[1:23:38] these wetlands carry with it. A 40 foot 40 foot
[1:23:41] buffer.
[1:23:43] So that's Robie park.
[1:23:45] Recent history of the project is outlined by Mr. Mr.
[1:23:48] Proman briefly.
[1:23:50] There's been a number of public meetings.
[1:23:52] Meetings on this project, but none before this board.
[1:23:56] Except for tonight.
[1:23:58] So a quick recap as mentioned it started with a
[1:24:01] grassroots movement, asking the city to build a golf course
[1:24:04] on its public lands.
[1:24:06] Lands D P w evaluated sites and determined. Rob park
[1:24:09] was the best candidate.
[1:24:11] Since then Nashua's put together a team to design and
[1:24:14] permit this project.
[1:24:17] Now because of the wetlands that I just described on
[1:24:20] the property.
[1:24:21] There were wetland impacts, wetland buffer impacts.
[1:24:25] As a result of the project.
[1:24:27] So the process started with the conservation commission.
[1:24:30] After several lengthy meetings in sight walks, the process produced
[1:24:34] the 22 vote.
[1:24:36] For input to the zoning board of adjustment.
[1:24:40] The application then went to the zoning board.
[1:24:43] Where they received a unanimous.
[1:24:45] Five zero vote. And I want to get the words
[1:24:47] right here.
[1:24:49] To work in a critical wetland buffer.
[1:24:52] To remove trees, brush.
[1:24:55] Install nine wooden pedestrian bridges.
[1:24:58] Bridges T pads, disc chain baskets, directional signage, wetland markers.
[1:25:03] Markers and trash barrels for a proposed 18 hole disc
[1:25:05] golf course. That's what they permitted.
[1:25:08] As a special exception, which is an allowed right.
[1:25:12] Meeting certain conditions.
[1:25:14] This vote by the ZBA addresses the environmental impact of
[1:25:18] this project.
[1:25:21] The next step in the process is here tonight before
[1:25:23] you with a site requesting site plan approval.
[1:25:27] I mentioned, I'll give you a quick crash course in
[1:25:29] disc golf, cuz I've personally never played.
[1:25:32] But I did brush up on the sport and this
[1:25:34] is what I've learned. It's a fast growing sport throughout
[1:25:37] the country.
[1:25:39] Family friendly outdoor activity.
[1:25:41] Played as Andy said very much like regular golf.
[1:25:45] The standard disc golf course is 18 holes.
[1:25:49] Players start out each row from a small team area.
[1:25:52] Ting area six by 12 kind of gravel tee box.
[1:25:55] And they play by throwing a disc.
[1:25:58] Into a chain basket.
[1:26:00] You add up the number of throws you have at
[1:26:02] the end and that that's your score.
[1:26:06] Groups of players range from one to four.
[1:26:09] Typically it takes about two hours.
[1:26:12] To play the 18 holes.
[1:26:14] Okay. In disc golf and the players are guided through
[1:26:18] the course with directional.
[1:26:20] Signs for each hole.
[1:26:22] With regard to the holes.
[1:26:24] They're laid out for varying skill levels.
[1:26:27] With safety in mind.
[1:26:29] Minimal work to the land in much like regular golf,
[1:26:33] a combination of trees.
[1:26:35] Topography in wetlands.
[1:26:38] Wetlands really provide for an interesting course.
[1:26:42] Thank you, Connor. I just included some.
[1:26:45] Basic pictures. I'll quickly go through those. I mentioned that
[1:26:48] this golf target or the basket, you can see the
[1:26:51] chain link basket. Apparently that's the target.
[1:26:55] You'll see just below it disc golf signage, that would
[1:26:58] be out through the course, identifying the hole in the
[1:27:01] routing so that people know where they were going.
[1:27:05] The backpack and he alluded to.
[1:27:07] They also have something called a retriever.
[1:27:11] Traver where if you throw it up in a tree
[1:27:12] or if it goes into a wet area,
[1:27:15] rather than going into those areas much like a golf
[1:27:18] ball retriever, you can extend this device.
[1:27:21] And grab your disc.
[1:27:24] Next slide, please.
[1:27:26] A couple more signs.
[1:27:28] Signs. If you find somebody's disc, apparently in this industry,
[1:27:31] it's unlike golf, or if you find a ball, you
[1:27:33] put it in your pocket, but if you find disc.
[1:27:36] They ask you to put it. They ask you to
[1:27:38] put it back. So there's a lost and found bin.
[1:27:41] As well, so thank you, Connor. If you can move
[1:27:43] to the next one.
[1:27:45] So now I'm gonna discuss the site plan, Mr. Chairman.
[1:27:49] The project team has made an application to this Nashville
[1:27:52] city planning board for a site plan approval of an
[1:27:55] 18 hole disc golf course.
[1:27:57] On a portion of Robi park.
[1:27:59] City outdoor recreation isn't allowed use in the R 18
[1:28:03] zone.
[1:28:04] Some elements of the project.
[1:28:08] The project proposes to use the existing, upper parking lot.
[1:28:12] Along east instable road.
[1:28:14] As the main parking for this.
[1:28:18] Activity, there'll be a small sign erected indicating that this
[1:28:21] is.
[1:28:22] Roby park disc golf course.
[1:28:25] The site plan does show the routing of the various
[1:28:27] holes.
[1:28:29] As Andy Proman said, the course has been designed by
[1:28:31] Avery Johnson and Simon. Zat both professional disc golfers that
[1:28:35] have designed dozens of courses in the country.
[1:28:39] The plan shows the approximate length.
[1:28:41] In direction of each hole.
[1:28:44] The starting point is up by that parking lot.
[1:28:46] In the way the course is routed, it works in
[1:28:49] a southerly.
[1:28:50] Direction to start.
[1:28:53] The layout eventually swings to the Southwest and it, there
[1:28:56] are crossings.
[1:28:58] Crossings of that center wetland area I described earlier.
[1:29:02] And then the layout eventually.
[1:29:04] Returns back to its point of origin of near the
[1:29:06] parking lot.
[1:29:10] It should be noted that the course was laid out.
[1:29:13] With the intent of keeping and maintaining.
[1:29:15] The current walking trails.
[1:29:17] Trails through the property.
[1:29:20] Walkers will have rights of way.
[1:29:22] Okay. There are a number of disc golf courses in
[1:29:25] this country.
[1:29:26] Very similar situation in public parks with walking trails.
[1:29:31] Trails, they can coexist.
[1:29:34] Much like ski boarders, or snowboarders and skiers. Okay.
[1:29:39] They can coexist safety is a concern. Absolutely. We're gonna
[1:29:42] hear that tonight from the public. And I'll talk a
[1:29:44] little bit about that.
[1:29:51] How does the course get built? It'll get built.
[1:29:54] By D P w
[1:29:56] in console with the course designer.
[1:30:00] The hole will be state. The center line of the
[1:30:02] hole will be state erosion control measures.
[1:30:05] Measures will be installed.
[1:30:08] The course designer will identify.
[1:30:10] Trees to be cut or trees in vegetation. Be selectively.
[1:30:14] Limbed.
[1:30:16] Minimal tree clearing is the goal.
[1:30:18] However trees need to be cut so that the disc
[1:30:20] golf.
[1:30:21] Hole is safe and playable.
[1:30:24] A number of failed trees will be chipped up and
[1:30:26] pushed into the woods.
[1:30:28] A number of fell. Trees will also be cut up
[1:30:30] and used as stringers.
[1:30:32] For the bridge crossings that I'll talk about in just
[1:30:34] a minute.
[1:30:36] If there is
[1:30:38] any trees to be cut in the wetland or wetland
[1:30:40] buffer area, which is allowed.
[1:30:43] The stumps will not be removed in those areas.
[1:30:46] Areas the plan uses the natural terrain. There'll be no
[1:30:49] earth moving. No big grading.
[1:30:52] Unlike a regular golf course.
[1:30:54] The ground cover in chance is to keep the forest
[1:30:57] floor.
[1:30:58] Not owed lawns, not irrigated lawns.
[1:31:01] Lawns, the construction is fairly simple.
[1:31:04] A T PADD area six by 12.
[1:31:07] A concrete post.
[1:31:09] Were the dispatcher.
[1:31:14] And the goal has been to minimize impacts through the
[1:31:17] weapons.
[1:31:18] Wetlands. I told you, there's a number of crossings.
[1:31:21] Pricings of the wetlands. What was permitted by the zoning
[1:31:23] board of adjustment was nine total crossings.
[1:31:27] Crossings six of which are new three of which are
[1:31:29] already existing crossings as part of the trail network.
[1:31:33] The focus
[1:31:34] in the intent of the design is to get the
[1:31:36] disc golfers to use those bridges.
[1:31:39] Bridges and not be walking haphazardly through wetland areas, and
[1:31:42] they're gonna do that.
[1:31:44] Through the combination of signage.
[1:31:47] Of wetland markers.
[1:31:49] Markers of clearly defining the areas where we want you
[1:31:52] to keep out of.
[1:31:54] And the goal would be to channelize players.
[1:31:57] To these crossings.
[1:32:00] The bridges themselves are much like a, a, a, a
[1:32:03] wooded trail you might find in mine falls park, or
[1:32:06] Beaverbrook.
[1:32:07] The fell trees will be used as a base and
[1:32:10] that wood planks nailed on top six feet wide.
[1:32:13] Very minimal width.
[1:32:17] Wetlands are defined as out of bounds on this golf
[1:32:20] course, this disc golf course.
[1:32:22] Okay. A couple things that D P w.
[1:32:25] Is going to be doing as they manage this operation.
[1:32:28] They're responsible for the maintenance of the disc golf course.
[1:32:32] Not a private party, but city of Nashua.
[1:32:35] RO park is for the public to enjoy. There are
[1:32:37] no tee times.
[1:32:39] There's a no litter policy.
[1:32:42] Carry in, carry out. And you saw the sign in
[1:32:44] one of the photos that reflected that.
[1:32:47] Dogs on a leash are welcome into park as they
[1:32:50] are today.
[1:32:52] Disc golfers will be repeatedly told, stay out of the
[1:32:54] wetland areas with signage.
[1:32:57] As with all parks, no alcohol tobacco, or smoking on
[1:33:00] the premises.
[1:33:01] Premises in the course will be free to play.
[1:33:04] The city of Nashua, D P w will implement the
[1:33:07] following.
[1:33:08] They'll conduct a course monitoring visit every year to this
[1:33:11] golf course.
[1:33:12] And see if there's any areas that are seeing.
[1:33:16] Erosion where they will see any areas that.
[1:33:20] Could be improved for safety.
[1:33:23] Reestablish
[1:33:25] the bridges and markers and other things that may have
[1:33:27] come down during the year.
[1:33:29] Supplemental planting. As I mentioned a minute ago.
[1:33:33] Shall we all native species.
[1:33:35] Installed in a consultation with the licensed wetland scientist.
[1:33:41] Invasive species management.
[1:33:43] And construction of best management practice shall follow the guidelines
[1:33:46] as identified by the certified wetland scientist.
[1:33:49] The D P w by controlling.
[1:33:52] Disc golf can ensure that a tournament.
[1:33:56] In the future would not be held the same weekend
[1:33:57] as the softball tournament.
[1:33:59] I'm gonna start parking in a minute.
[1:34:02] But, you know, we want to make sure we don't
[1:34:04] coincide tournament weekends so that there's.
[1:34:07] There's an exacerbated problem.
[1:34:10] And for those interested, a portajohn will be located near
[1:34:13] the upper parking lot, along with.
[1:34:15] Regular scheduled service.
[1:34:18] The city hopes and the goal, it would be to
[1:34:21] construct the course in 2025 with an opening in 2026.
[1:34:27] I'm wrapping up soon, Mr. Chair, our action. Our, our
[1:34:31] application also included a traffic and parking study prepared by
[1:34:35] VHB.
[1:34:36] VHP now, as you know, traffic and parking are two
[1:34:39] different things.
[1:34:42] Traffic with regard to traffic, they counted.
[1:34:45] Trips at other
[1:34:48] disc golf facilities here in New Hampshire to come up with
[1:34:50] their baseline of anticipated trips.
[1:34:52] Trips. They're talking about a normal weekday of 110 trips.
[1:34:57] Trips total 20:00 AM peak 24:00 PM. Peak.
[1:35:01] Those are considered minimal traffic.
[1:35:04] Increases along such a collector route such as Pitt Brook
[1:35:07] road.
[1:35:09] Now, with regard to parking.
[1:35:11] The parking study that was submitted, indicates that the disc
[1:35:13] golf is expected to use between 23.
[1:35:17] And 46 parking spaces during typical.
[1:35:20] Conditions. It's the project's project team's opinion that there is
[1:35:24] ample parking during normal play conditions.
[1:35:27] However we understand Ruby. Park's a popular spot. It's a
[1:35:31] popular destination.
[1:35:33] D P w intends to closely monitor parking during the
[1:35:36] first year of disc golf.
[1:35:38] If, if successful
[1:35:40] it's determined if it is determined that additional parking is
[1:35:43] needed.
[1:35:44] The city will address the issue.
[1:35:47] I can tell you Mr. Chairman, that we've.
[1:35:50] The design teams looked at two areas of expansion.
[1:35:53] The upper parking lot. I told you contains 26 spaces
[1:35:57] could be expanded to 60 spaces, an increase of 34.
[1:36:02] That would not be an easy project. There's quite a
[1:36:03] bit of topography up there.
[1:36:06] That would be a challenging design, but.
[1:36:09] There is the land to do it.
[1:36:11] And if it's needed, that would be one area to
[1:36:14] grow parking.
[1:36:15] And then the second is along the main body of
[1:36:17] parking.
[1:36:19] Along spit brick road.
[1:36:21] There's a small area.
[1:36:23] East of the current parking lot that parking could be
[1:36:26] expanded.
[1:36:28] Without impacting the wet under the wetland buffer.
[1:36:31] We had anticipate or estimate that to contain.
[1:36:35] 20 new spaces. So the site has the ability in
[1:36:37] those two locations to add parking.
[1:36:42] Why aren't we building those right out of the box?
[1:36:44] Well,
[1:36:45] they're expensive.
[1:36:48] And we don't want to overbuild parking.
[1:36:50] We wanna look at it for that first year monitor.
[1:36:53] See what that right number is.
[1:36:55] And then proceed. And of course, any type of.
[1:36:58] Parking improvement would require us to come back to this
[1:37:01] board for approval.
[1:37:03] Okay. The application also included.
[1:37:07] Included three waiver requests.
[1:37:09] The first under 1 90, 1 60 posting of a bond.
[1:37:13] Makes no sense that the city would have to post
[1:37:15] a bond for their.
[1:37:17] Construction of the disk golf course.
[1:37:20] Second waiver 1 92 79 is a, a survey.
[1:37:25] Requirement they're seeking waiver of that. And then under 1 90, 2 79,
[1:37:31] EE, the survey.
[1:37:33] Of all parcels within a thousand feet.
[1:37:36] The submitted letter by D P w states, the reasons
[1:37:39] and justifications.
[1:37:42] In summary.
[1:37:44] We believe the project is being designed.
[1:37:47] In a, in a responsible way in accordance.
[1:37:50] With the Nashua master plan.
[1:37:53] And more importantly, in accordance with your national land use
[1:37:56] code section 1 91 40 60 D.
[1:38:01] As you know, there's 19 criteria for approving a plan.
[1:38:05] It is our testimony this evening that we comply to
[1:38:08] those 19 criteria.
[1:38:11] The addition of a disc golf course at Robie park
[1:38:13] truly provides an exciting programming opportunity for the city.
[1:38:18] Staff has done a good job in their review. They've
[1:38:21] identified a number of conditions.
[1:38:23] That are of approval.
[1:38:25] That are acceptable to the D P w.
[1:38:29] And with that, Mr. Chairman, I've gotten through my notes.
[1:38:34] I'd be happy to answer questions. If you do ask
[1:38:36] me a question that, that I don't feel I'm qualified
[1:38:38] or capable of answering.
[1:38:41] I'm gonna call up some teammates and, and ask them
[1:38:43] to, to answer questions. So thank you for your time.
[1:38:47] Jim. Thank you. Just before we.
[1:38:49] Open it up to the board. Was there anyone else
[1:38:51] on the project team that was, that was.
[1:38:55] Programmed to speak tonight or, or just on Q and
[1:38:59] a. That was it. Okay. All right.
[1:39:02] Questions from the board at this time.
[1:39:06] Mr. Go ahead, please. Thank you, Mr. Chair.
[1:39:08] And Jimmy did a good job of preempting, a bunch
[1:39:11] of my questions to your presentation. So I appreciate that.
[1:39:15] The, the one thing that I wanted to follow up
[1:39:17] on at the moment was just.
[1:39:20] To understand a little bit more.
[1:39:23] You, you noted the issue about, or I should say
[1:39:26] the, the sort of.
[1:39:27] The design where the, the holes are gonna run.
[1:39:31] Sort of parallel with the existing trail.
[1:39:34] In a number of places.
[1:39:37] With the, the expectation that those two uses can coexist.
[1:39:41] And so I gather that there's not a proposal, for
[1:39:44] example, to reroute the trail.
[1:39:47] That it's gonna run through the course of the.
[1:39:50] Of the disc golf course. So.
[1:39:52] Can you just speak to that a little bit more
[1:39:54] in terms of.
[1:39:56] How the sort of
[1:39:58] pedestrians on the trail.
[1:40:00] Have the right of way, just practically on the ground
[1:40:02] with sure. That looks like sure.
[1:40:05] So that plays into the safety piece that we're all
[1:40:08] concerned about.
[1:40:11] The
[1:40:13] the layout of the golf course.
[1:40:17] Has tried to
[1:40:19] first and foremost.
[1:40:21] Have the, the existing trail crossings in the wetland locations.
[1:40:26] Locations matched. Okay. As best we can.
[1:40:30] I believe that there are also.
[1:40:33] Areas where
[1:40:35] the existing trail runs parallel to one of the frizz
[1:40:38] disc golf holes.
[1:40:40] The, the, the rules will be clear that they have
[1:40:43] the right of way.
[1:40:44] And presumably the, the users of the trail will, will
[1:40:47] move forward to a safe position before.
[1:40:50] The disc is thrown during construction. We, we, we discussed
[1:40:55] that if we find.
[1:40:57] That there's areas that are potentially blind spots.
[1:41:01] That we would want to remedy that during construction, we
[1:41:05] would wanna make sure.
[1:41:07] That
[1:41:10] that
[1:41:12] visibility was improved so that.
[1:41:15] The disc thrower can see that there's people actively walking
[1:41:18] in that location. And then lastly, we, we, we, we
[1:41:22] totally realize that there's a likelihood during construction, that some
[1:41:25] of those trails.
[1:41:27] Trails could be relocated. I noticed in the drawings that.
[1:41:32] Some of the trails could very easily be.
[1:41:36] Slightly modified. So they be.
[1:41:38] They actually go behind a, a, a, a team area.
[1:41:42] Or away from a basket area and, okay. So that,
[1:41:46] that is potentially available as an option as you're actually
[1:41:49] absolutely.
[1:41:51] So my response is kind of a combination of, of
[1:41:54] all those things. It's it's signage, it's awareness.
[1:41:57] It's during construction, trying to minimize.
[1:42:01] The, the blind areas as best as possible. Okay.
[1:42:04] Thank you.
[1:42:07] Other questions from the board Ms. Harper, please.
[1:42:10] Yes. When you were talking about the bridges going, you
[1:42:13] know, the new bridges that could be constructed over the
[1:42:17] wetland areas.
[1:42:19] Areas is that essentially gonna be walking between holes?
[1:42:22] Is that, that, that area won't necessarily be part of
[1:42:26] a hole.
[1:42:27] It, it could be, yes. Some of the holes do
[1:42:29] cross the wetland.
[1:42:30] Complex. And so
[1:42:34] the way it's been presented in the drawings is those
[1:42:37] as I, I tried to talk a little bit about
[1:42:39] that. Those crossings.
[1:42:41] Crossings are either, I think there's three or possibly four
[1:42:45] that already exist that are being maintained.
[1:42:48] As trails would be within a hole.
[1:42:51] The, the goal is to try to get people channelized.
[1:42:54] Through, you know, 18 inch high staking or maybe some
[1:42:56] low roping.
[1:42:57] To keep people to walk through there, but they could
[1:42:59] be.
[1:43:00] Within a playing hole. Yes. And not necessarily in between
[1:43:03] a, a teeing area and a, in a basket area.
[1:43:07] I guess what I I think about is my own
[1:43:10] golfing skills and Frisbee skills, and it flying into the
[1:43:15] wetlands beyond.
[1:43:17] I guess the roped areas. Yeah.
[1:43:19] I mean, is there anything to help?
[1:43:22] Yeah, help prevent that to some degree.
[1:43:26] I'm not a disc golf course designer, so I I'm
[1:43:28] sure there's science to it. And I'm sure there's metrics
[1:43:30] to it.
[1:43:32] And I do believe it's been taken into consideration, but
[1:43:35] I'm not gonna stand here and tell you somebody's not
[1:43:37] gonna throw something into a wetland, cuz they likely are.
[1:43:40] Yeah. That point did come up during the conservation hearing,
[1:43:45] you can walk in a wetland.
[1:43:48] That's allowed.
[1:43:51] Thankfully
[1:43:53] through the main body of the course we're, we're, we're
[1:43:55] working through kind of the narrowest part of the wetland,
[1:43:57] which I think is, is, is, is helpful.
[1:44:01] And then I spoke to and showed you. It's why
[1:44:03] I brought the picture of those retrievers to hopefully get
[1:44:06] people to.
[1:44:07] Use those to get the disks out, but.
[1:44:10] Again, the goal will be to minimize and it's gotta
[1:44:12] be with signage and possibly enforcement. You know, that you've
[1:44:16] gotta stay out of those areas, but.
[1:44:19] I, I, I do think.
[1:44:21] There will be discs thrown into wetlands. Yeah.
[1:44:24] I think so, too.
[1:44:27] I had one more question, please continue. And then just
[1:44:30] as far as.
[1:44:32] You know, monitoring parking going forward.
[1:44:35] I mean, what does the parking look like now?
[1:44:38] Before the disc golf is even open.
[1:44:42] Yeah. I'm I know there's wonderful weather days where people
[1:44:45] are actively using the park and softball is busy.
[1:44:49] You know, we do have the non coincidental sports with
[1:44:51] the winter sports. So they typically wouldn't. Wouldn't coincide.
[1:44:56] We know Ruby park is a popular destination.
[1:45:00] We think
[1:45:01] that everyday play.
[1:45:05] There'll be enough, there'll be enough parking for, and that's
[1:45:07] why we wanna look at it and see it. And
[1:45:09] they're gonna keep track of it and do parking counts
[1:45:11] and, and then say, you know what? We don't want
[1:45:14] a crisis. The DPW does not want to create a
[1:45:16] problem at RO park. It's one of the gems in
[1:45:18] the, the city. There's no doubt about it. It, so
[1:45:21] if they find they need park, thank.
[1:45:23] Thankfully we've got land to, to build the parking, but
[1:45:25] they don't want to come out of the box over
[1:45:27] building parking either.
[1:45:30] So, yeah, sure. Peak days and.
[1:45:33] You know, attorney Pearlman had an interesting.
[1:45:36] Dynamic. He said to me that in preparing for this
[1:45:39] evening,
[1:45:40] he said one of the benefits here is that the
[1:45:42] city's the owner.
[1:45:44] And they can really do something about it and watch
[1:45:46] this.
[1:45:47] We know there's a very successful gas station on DW
[1:45:50] highway, south BJ's gas. It's extremely popular.
[1:45:54] And if you've ever been by there, it can get
[1:45:56] really, really, really, really, really busy.
[1:45:59] And yet there's little or no recourse. The city has
[1:46:02] when people back out into the streets, but here.
[1:46:06] By the city owning it. They, they can correct their
[1:46:09] problems much readily.
[1:46:11] Thank you. Thank you.
[1:46:14] Mr. Green, please. I'm not very familiar with this park. Is
[1:46:17] there a reason it's open from six a to 10
[1:46:19] P instead of dust to Dawn? Or is that already
[1:46:23] the Park's operating hours?
[1:46:25] Yeah, I believe park hours in the city are fixed
[1:46:28] at 7:00 AM to 10:00 PM.
[1:46:30] Okay, thank you. The site plan did have 6:00 AM to
[1:46:34] did it 10:00 PM. Yeah.
[1:46:41] Questions, other questions from the board at this time.
[1:46:48] For attorney Pearlman.
[1:46:50] Or public works either.
[1:46:53] No. All right.
[1:46:55] Scene none at this time.
[1:46:57] Okay, Jim. Thank you. Yes. Thank you.
[1:47:03] What I would like to do as you've seen the
[1:47:05] prior cases.
[1:47:06] You would like to open this up to the public?
[1:47:08] Could I.
[1:47:09] We usually do folks with opposition or concern.
[1:47:13] Can I get a quick show of hands just to
[1:47:14] gauge how many folks are here tonight to speak on
[1:47:16] this application in opposition or with concern?
[1:47:20] Okay. What I
[1:47:23] am going to do just out of.
[1:47:27] Due diligence.
[1:47:28] I do just want to reiterate everybody that wants to
[1:47:30] speak is gonna get a chance to speak.
[1:47:33] What I would kindly request is to not duplicate things
[1:47:36] which have already been stated. You're certainly more than welcome
[1:47:39] to.
[1:47:40] Have you turn at the microphone, say you're opposed to
[1:47:42] the project for all the reasons previously stated.
[1:47:46] Stated. The other thing I would mention is that there's
[1:47:49] no need to read verbatim a letter, which is already
[1:47:51] part of the record.
[1:47:53] Like to try to limit this to about a half
[1:47:55] an hour or so.
[1:47:57] So the longer, the longer that you go, you're just
[1:48:00] potentially taking away from your neighbor.
[1:48:03] Obviously, as I mentioned earlier, the board has the right
[1:48:06] to.
[1:48:08] Stop hearing public testimony at 10 o'clock.
[1:48:12] There is still other board business this evening beyond this
[1:48:15] case.
[1:48:16] That being said, I would kindly invite you.
[1:48:19] You can form a line, however you wish to do.
[1:48:21] So if you're able to stand.
[1:48:23] But please just come up to the, to the podium,
[1:48:25] introduce yourself for the record, please.
[1:48:27] Thank you, Mr. Chairman members of the planning board, John Sullivan,
[1:48:30] 30 Holbrook drive, Nashua New Hampshire. And I also rise tonight.
[1:48:35] As ward nine alderman, which Rob park sits within.
[1:48:40] To speak concerns from residents that I've heard from.
[1:48:45] And I also speak to appeal to your spirit of
[1:48:48] compromise because I do have a solution.
[1:48:52] To this, and I believe.
[1:48:54] Could work for all parties involved, but first the disc
[1:48:57] golf saga, as far as I know it.
[1:49:00] Started in the summer of 2021.
[1:49:04] When a group of disc golf enthusiasts approached the board
[1:49:07] of public works in August.
[1:49:09] At that midday meeting in the middle of the summer.
[1:49:12] This group made their pitch to use the city land
[1:49:15] for disc golf course. The following month, it was approved.
[1:49:20] All but one of the D P w.
[1:49:22] Directors voted to move forward with it.
[1:49:24] One director asked a table. It until residents surrounding the
[1:49:28] park were notified.
[1:49:30] And allow them to speak to the public.
[1:49:32] To the change in use for this city owned public
[1:49:35] park.
[1:49:36] Unfortunately, none of that happened.
[1:49:39] Before this project was approved.
[1:49:41] In early spring, 2022.
[1:49:45] I was then ward, alderman. And that's when I got
[1:49:47] involved in this project.
[1:49:49] When I was called down to the site to find
[1:49:52] that trees were being cut and brush taken away for
[1:49:55] the course.
[1:49:57] Since then the project has been stalled.
[1:50:00] And there've been many meetings, both small and large in
[1:50:03] this room and in the conservation commission and, and other
[1:50:06] meetings that you've mentioned.
[1:50:08] As a city representative of this ward, a majority of
[1:50:11] the residents that I've heard from.
[1:50:14] Are against this.
[1:50:16] I've personally met and heard from residents on Southgate drive.
[1:50:20] Oak hill and Bayview condominiums. All of those are direct.
[1:50:25] Abutters.
[1:50:27] Butters to this portion of Rob park that will be
[1:50:28] used.
[1:50:30] My concerns as the ward alderman center on traffic.
[1:50:34] Parking and keeping as much green space as possible.
[1:50:37] Available to Nashua residents.
[1:50:40] Residence in reading the traffic assessment from February, 2025.
[1:50:44] Normal operations at the disc Gulf.
[1:50:47] Course was determined.
[1:50:49] That parking and traffic would be ample.
[1:50:52] It was noted that during special events, traffic and parking
[1:50:55] may be impacted. That's where I'm concerned.
[1:50:58] Knowing this area as I do it is these events.
[1:51:02] Events that concern me most.
[1:51:04] Now what I would
[1:51:06] put forth on the public record.
[1:51:09] Instead of an all or nothing.
[1:51:12] Allow disc golf to design a nine hole course.
[1:51:15] A compromise.
[1:51:17] A good compromise is one where both sides leave the
[1:51:21] table feeling they didn't get everything they wanted.
[1:51:24] But finish the negotiation, satisfied and agreement was made.
[1:51:29] Nine holes.
[1:51:31] Allows enjoyment for the disc golfers and non disc golfers
[1:51:34] who use this public.
[1:51:36] City land. It should be fair to all concerned.
[1:51:40] In this solution addresses just that.
[1:51:43] I appreciate your time and I wish you luck in
[1:51:45] your decision tonight. Thank you.
[1:51:48] Thank you.
[1:51:52] Hello. Good evening. My name's Michael gotk.
[1:51:56] Guardian. Oh yeah. I'm sorry. Feel free to adjust that.
[1:52:03] Hi, my name is Michael Gian. I'm a resident of
[1:52:05] 2 87 Eastville road, south Nashua.
[1:52:08] Thank you for your time as you may. And right
[1:52:11] now know, I've submitted a letter expressing my concerns about
[1:52:14] the proposed disc golf.
[1:52:16] Development at rugby park, highlighting the safety and equitable access
[1:52:19] issues for south Nashua hikers and bikers.
[1:52:22] The letter questions, the parks benefits relative to its ecological
[1:52:25] and recreational costs.
[1:52:27] And suggests an alternative site closer to downtown.
[1:52:30] This alternative would improve access for Nashua's underserved communities.
[1:52:35] And aligned with the city's investment in the downtown area.
[1:52:37] Tonight. I'd like to supplement my letter with a request
[1:52:40] to revise and reposition the signage for the proposed golf
[1:52:43] course at Rob disc golf course at Rob park.
[1:52:46] I asked that the science be placed at the Trailhead
[1:52:49] locations rather than the park entrances entrances, which many trail
[1:52:52] users do not pass.
[1:52:54] And include a clear description of the course's use and
[1:52:57] its impact to the trail users.
[1:52:59] This ensures that all park patrons.
[1:53:01] Patrons are informed about the proposed changes.
[1:53:04] Changes. I have a few comments from tonight that came
[1:53:06] up from tonight.
[1:53:10] One of the leading
[1:53:11] benefits that was pointed out by the attorney who spoke
[1:53:14] first on behalf of the discal was it was benefit
[1:53:16] as an amenity to the city.
[1:53:21] However, no data is available relative to Nashua's benefit from
[1:53:24] a use or commercial sets.
[1:53:26] 600 signatures does not support either.
[1:53:30] I want to know a little bit more about what
[1:53:32] led to the selection of this site by the D
[1:53:34] P w.
[1:53:35] I've seen no evidence of this review or site alternatives
[1:53:37] aside from the already existing and currently under you underutilized
[1:53:42] disc golf course at Greeley park.
[1:53:46] DPW stated that the landed RO park is underutilized.
[1:53:52] But what method in reporting does the D P w
[1:53:54] have to support that finding.
[1:53:57] Annually port-a-potties burn.
[1:54:00] Dumpsters are spilled over and littering occurs at Roe park.
[1:54:04] When vandalism ultimately occurs at the diff disc golf course
[1:54:07] who will pay for it for its repair.
[1:54:10] Additionally enforcement of the course's care and adherence to the
[1:54:14] park rules is admittedly.
[1:54:16] Potentially necessary for the disc golf course.
[1:54:19] Who will do that and who will pay for that?
[1:54:23] Not all holes dis I don't know, with all respect.
[1:54:26] I don't know if they're called the holes.
[1:54:28] But with each hole on the course.
[1:54:32] While some are parallel.
[1:54:34] Some do cross over the trail head.
[1:54:36] And
[1:54:39] regardless of parallel, non.
[1:54:41] Intercepting courses where trails and Hills align, what happens with
[1:54:45] inaccurate throws?
[1:54:47] Throws or in terms of.
[1:54:51] Blind spots.
[1:54:53] How topographical blind spots be accommodated.
[1:54:57] So, you know, I think that these type of.
[1:55:01] Questions need answers before a decision can be made by
[1:55:03] the public.
[1:55:05] So, you know, in summary,
[1:55:07] I'm really in favor of disc golfers, getting a great.
[1:55:11] Facility that's worthy of use.
[1:55:13] And that's awesome. I, I, I don't want to be
[1:55:16] negative about that.
[1:55:18] But I love the trails, the trail system, as it
[1:55:21] is. I'm a user amongst many others.
[1:55:24] And I think there's a tremendous vagueness about this plan
[1:55:26] at current.
[1:55:28] And it prevents the public from weighing in on this
[1:55:30] project in a.
[1:55:32] Meaningful manner.
[1:55:34] Those are my comments. Thank you for your time.
[1:55:36] Thank
[1:55:41] good evening. Hi, good evening. My name is Denise Oli.
[1:55:44] I'm a director butter.
[1:55:46] To Oak hill at six Midhurst. I also sent you
[1:55:49] a letter. I don't know if I heard incorrectly in
[1:55:51] the beginning. I think you said there was only one
[1:55:53] letter of opposition received.
[1:55:56] No, there was, we received a package. Okay. It was
[1:55:58] one document, but it were, there were a series of
[1:56:00] oh, perfect letter letters. Yes. Okay. My, sorry, I got
[1:56:03] that wrong. So a couple of concerns I have, I'll
[1:56:06] try not to duplicate, duplicate what, you know, I said
[1:56:09] in the letter.
[1:56:11] With the bridges, they have to go through N H
[1:56:14] D E S for approval. I don't see anything on
[1:56:16] there saying that there was an application done.
[1:56:19] I talked to Peter at N HDS today.
[1:56:22] And he said those bridges have to go through the
[1:56:24] state for approval.
[1:56:25] The other issue is they're gonna use epoxy on it
[1:56:27] and know that it's recommended by the.
[1:56:30] Manufacturer that epoxy should be applied offsite if possible. And
[1:56:33] if not, they have to be very careful that it
[1:56:36] doesn't drip into the wetlands. Cuz we're gonna have some
[1:56:38] serious ecological problems as a result.
[1:56:42] So that's an issue. And then.
[1:56:44] If it's not drying, you got dog walkers walking through,
[1:56:46] and while the animals are gonna get epoxy all over
[1:56:48] them, which would be that, that is a hazardous material.
[1:56:52] I'm concerned about the aesthetics.
[1:56:55] Aesthetics from, you know, from where we live directly abutting
[1:56:57] the cause we are gonna have markers and ropes and
[1:57:00] signs and baskets at six in the morning.
[1:57:04] I, I don't think that even passes the city of
[1:57:06] Nashua's noise ordinance.
[1:57:10] With the parking
[1:57:11] if they choose to park down by the ad, parking
[1:57:14] down by the lower lot, that's a problem.
[1:57:16] Nobody could tell me if that was a Vernal pool
[1:57:19] at all. Vernal pool has a lot of ecological significance.
[1:57:23] Right now, N H D E S is calling that
[1:57:25] emergent wetland. That's a 40 foot buffer. So if you
[1:57:28] have cars parking in there and asphalt and all of
[1:57:31] that.
[1:57:32] In addition to the trash that I have had to
[1:57:34] pick out of you.
[1:57:35] With sticks and stuff. That's, that's another huge problem. So
[1:57:39] that can't be used for parking. I don't think that's
[1:57:41] gonna pass anybody's.
[1:57:43] Anybody's you know, review we're gonna have, so we're gonna
[1:57:46] cut down trees when all of the wildlife are raising
[1:57:49] their babies, is that what's gonna happen. We have Bobcat,
[1:57:52] we have Fox families, Bobcat, families. We have coyote families.
[1:57:56] All living in those rock croppings mm-hmm and those
[1:57:59] are going to be used for what? I don't know.
[1:58:02] I hope that somebody gives some thought to the wildlife
[1:58:05] that lived there.
[1:58:06] Because it's not feeding them, especially at this time of
[1:58:09] year, they'll be gone soon enough from wearing their babies.
[1:58:12] Trash barrels in the woods, not a good idea. Talk
[1:58:15] to any fish and game person.
[1:58:18] Not a good idea. You're gonna have bears getting in
[1:58:20] there, getting habituated there's bear back there.
[1:58:23] So, I guess, guess who has to suffer when the
[1:58:25] bears habituated, they're gonna come up to our dumpsters, looking
[1:58:28] for food.
[1:58:29] And we're gonna have
[1:58:32] you know, all kinds of rodents and stuff. And you
[1:58:34] know, if you drive up the apex predators, the rodents
[1:58:37] are gonna come onto our property. That's a problem.
[1:58:40] Lights. This is another thing. So at 10 o'clock in
[1:58:43] the say they're playing at nine o'clock or at seven
[1:58:45] o'clock it's dock out. They got headlamps to find the
[1:58:48] discs, the baskets. I mean,
[1:58:51] how are they gonna know if there's a Diaz standing
[1:58:53] near that tree? How are they gonna know if there's
[1:58:55] an owl on that ranch?
[1:58:57] They're not gonna know any of these things. They're headlights.
[1:58:59] Aren't gonna show the headlights. Aren't gonna show if there's
[1:59:01] a bunch of kids sitting there partying in the woods,
[1:59:03] although they'll probably hear the kids partying. So these are
[1:59:06] things you know, that have really, I don't think enough
[1:59:08] thoughts go into it. Also the, I don't see in
[1:59:11] the packet, a current now natural heritage bureau.
[1:59:16] Certificate it expired on 9 20, 23 for this project. I don't
[1:59:20] see that anybody else has put that up there.
[1:59:22] Lastly, I gave you guys a in the letter.
[1:59:26] Hopefully you got it.
[1:59:28] I show that it, that it is conservation land. And
[1:59:31] when I went to the register of deeds, he agreed
[1:59:33] with me. So.
[1:59:35] Somebody's gonna fix some records. If you're all not saying
[1:59:37] that that's conservation land, that's a big problem.
[1:59:40] Because it is listed.
[1:59:42] On the current maps, G I S I checked with
[1:59:44] kata Faulk to make sure I was using the right
[1:59:46] system. And that's listed as conservation land. There's a small,
[1:59:49] like one acre plot. And then there's a 57 acre
[1:59:52] plot listed as conservation land. Somebody should, should look at
[1:59:55] the that and make sure because if that is conservation
[1:59:58] land, it does not allow.
[2:00:01] But active.
[2:00:03] Only passive.
[2:00:05] Activities disc golf is considered an active activity.
[2:00:11] Zoning was told that it wasn't supposed to be any
[2:00:13] impervious services. Now we have signs that are impervious services.
[2:00:18] Services. I mean,
[2:00:21] I agree with the nine holes. If, if you know,
[2:00:23] I agree with the compromise, I don't like it, but
[2:00:25] I would agree to it.
[2:00:27] Before we start doing a bunch of appeals and stuff
[2:00:29] and crossing everybody a lot of money.
[2:00:32] Point six, six.
[2:00:34] Hundred people were interested in this that's only 0.6 0.6%
[2:00:39] of national citizens.
[2:00:41] That are supposedly interested.
[2:00:43] I had a petition. I had 700 people.
[2:00:46] They had 600 and we've spent way more than the,
[2:00:50] we were allowed a 30 K grant, $30,000 grant from
[2:00:53] the rotary club.
[2:00:55] We've already spent 45,000 total.
[2:00:59] 15 of that, I believe came from the grant.
[2:01:01] So I don't think they should be granted any hardships.
[2:01:04] Everything should be plotted. And the site plan should all
[2:01:07] be done.
[2:01:10] And the professional disc office. I'm not trying to insult
[2:01:13] anybody, but they do not have degrees in forestry. They
[2:01:16] do not have degrees in wetland. They're PR their goal
[2:01:19] is to make it a challenging game without worrying about
[2:01:21] the other stuff. And there's no certification.
[2:01:24] And lastly
[2:01:27] so as far as safety goes, you know, you can
[2:01:30] have all the rules in place and things are gonna
[2:01:31] go wrong.
[2:01:33] Couple years ago, something got hit in the face with
[2:01:35] a puck because the guy's playing hockey. Wouldn't get off
[2:01:37] for regular skate time.
[2:01:39] I myself was driving down spit Brook road.
[2:01:42] And a pot came flying by and almost hit the
[2:01:44] car.
[2:01:45] Which I wouldn't really care if it hit the car,
[2:01:46] but if it went through my windshield and hit me
[2:01:49] in the head, that would be a problem.
[2:01:51] So you can say that it's going to be safe.
[2:01:54] But I have my doubts and I don't think that
[2:01:56] anybody here in this room is going to be unsafe.
[2:02:00] But there's gonna be a bunch of people playing it.
[2:02:02] That won't be safe.
[2:02:04] Thank you for your time. Thank you.
[2:02:09] Hi, good evening. Good evening. My name is Judy Taylor and
[2:02:13] I live at 11 1 11 Hawthorne village road. Excuse me, in
[2:02:17] sky meadow. And I'm a opposed to the.
[2:02:22] Project.
[2:02:24] For many reasons, but I'll just talk on traffic right
[2:02:27] now.
[2:02:28] It's very difficult right now with nothing else going on
[2:02:31] just in everyday traffic.
[2:02:34] To get out of sky meadow. We have to wait
[2:02:36] sometimes 25 cars.
[2:02:38] Before we can get out. So.
[2:02:44] The application says there's no effect upon the surrounding traffic
[2:02:48] congestion of pedestrian safety.
[2:02:51] Normal traffic is expected in and out of the parking
[2:02:53] lots on spit Brook road, east, Constable road.
[2:02:56] Well, I think
[2:02:59] the traffic UN spit brick road on a summer weekend.
[2:03:03] Is impossible to get through.
[2:03:07] They park on either side of spit Brook road and
[2:03:09] east instable road.
[2:03:11] And it's like a maze to go through this and
[2:03:13] you have to go really slowly because kids run in
[2:03:16] and out.
[2:03:17] In fact there was an accident.
[2:03:20] Back in November when a child ran out on the
[2:03:24] road from Roby park.
[2:03:26] And his father ran after him.
[2:03:29] And both of them were hit by a vehicle.
[2:03:31] The child, fortunately was had only minor injuries.
[2:03:35] But the father had very serious bodily injuries.
[2:03:41] you know, that's just one example of what could happen
[2:03:44] with all of this.
[2:03:46] Traffic.
[2:03:50] So let's see.
[2:03:57] So Avery Jenkins, the designer of the golf course stated
[2:04:01] at the June 25th meeting.
[2:04:04] Of the zoning board that this course will be a
[2:04:06] huge draw throughout the Northeast.
[2:04:09] He also stated that he expected a couple hundred rounds
[2:04:12] per month to a couple thousand rounds per month.
[2:04:16] Now, with all that.
[2:04:19] Amount of players coming.
[2:04:21] That's certainly going to increase the traffic.
[2:04:24] Around Romi park and then he's expects two tournaments a
[2:04:28] year, which I think will draw a huge crowd.
[2:04:32] Spectators, maybe even vendors.
[2:04:35] Families coming to watch.
[2:04:38] The tournament.
[2:04:39] So a round of golf. Now this is just my
[2:04:42] estimation. I don't know how true it is.
[2:04:45] Consists of four players at each hole.
[2:04:47] Regularly. If the course is full, that means four players.
[2:04:51] Times 18 holes could equal 72 players.
[2:04:55] So that could be 72 cars because mostly.
[2:04:58] People don't carpool anymore.
[2:05:01] So with the 20
[2:05:03] six parking spaces up.
[2:05:05] On the upper lot.
[2:05:08] That already would be overcrowded.
[2:05:10] And
[2:05:13] so let's see.
[2:05:15] And then so using his prediction of 200 rounds a
[2:05:20] month.
[2:05:21] If we guesstimate 72 players on the core course multiplied
[2:05:25] by 200 rounds.
[2:05:27] Rounds that could equal a possible 14,400 players at Robie
[2:05:31] park.
[2:05:32] In a month, even if all 18 holes aren't being
[2:05:36] used at one time, they're still will be an unusually
[2:05:39] large increase in traffic around the park.
[2:05:42] A month now, worst case scenario where he says it
[2:05:45] could be a possibility of 2000 rounds per month.
[2:05:49] That would just double
[2:05:52] the 200
[2:05:54] and it would put a giant burden of extra cars
[2:05:56] and traffic on spit Brook road and east instable road.
[2:06:01] All of this extra traffic and increased usage of the
[2:06:04] park with the disc golf players.
[2:06:06] Driving from Massachusetts, Rhode Island, Vermont, Connecticut, and Maine.
[2:06:10] Will certainly greatly change the character of our neighborhood.
[2:06:14] Thank you. Thank you.
[2:06:21] I agree. Hi.
[2:06:23] Sharon Lockwood. I live at 3 98 Eastville road.
[2:06:27] A lot of what I wanted to say we've touched
[2:06:29] on. So I will just share with you some of
[2:06:31] my own personal experience.
[2:06:34] As far as parking and safety.
[2:06:36] There were two occasions last winter after snowstorms, when there
[2:06:40] were families at the top of the sliding hill.
[2:06:44] And there were 15 cars because I counted them.
[2:06:47] Underneath the no parking signs.
[2:06:50] Signs. So, and the, the children were walking back and
[2:06:53] forth as if it was a parking lot, not a
[2:06:55] road.
[2:06:56] So that's dangerous.
[2:06:59] If somebody in my neighborhood had needed a firetruck or
[2:07:01] an ambulance, it would not have been able to get
[2:07:03] through.
[2:07:04] So the parking is a huge issue and the park,
[2:07:08] no parking signs are ignored.
[2:07:10] Ignored trash cans. Don't work.
[2:07:14] I walk that road every day.
[2:07:17] And
[2:07:19] the trash goes from the top of the sliding hill.
[2:07:24] Across the street from that. And then all the way
[2:07:25] down to the houses on the mass border.
[2:07:29] I called the city about that.
[2:07:31] As well as a, a no parking or not a
[2:07:33] no parking.
[2:07:38] A sign that's supposed to.
[2:07:40] Keep people going at a reasonable rate.
[2:07:43] And it's leaning into the woods and you can't see
[2:07:45] it. And it's.
[2:07:47] It's still all there.
[2:07:50] The other thing I wanted to mention is.
[2:07:53] The union leader had a front page.
[2:07:56] Story.
[2:07:59] October 31st.
[2:08:03] And
[2:08:06] it stated that
[2:08:09] the national alderman.
[2:08:12] Okayed up to 45 million in bonds to do.
[2:08:18] Structure infrastructure.
[2:08:20] Projects and these were considered essential.
[2:08:25] So if we're borrowing money to do things that are
[2:08:28] essential.
[2:08:29] Why are we talking about something that's not essential?
[2:08:32] Should this not go on a ballot for all of
[2:08:35] Nashua to vote.
[2:08:37] Thank you.
[2:08:38] Thank you.
[2:08:43] Hi, good evening.
[2:08:46] Good evening.
[2:08:47] My name is Chris. Tina McKinley.
[2:08:50] Six Southgate drive.
[2:08:52] And
[2:08:54] I'm going to call attention to.
[2:08:57] An article that was
[2:08:59] this year, January 22nd.
[2:09:02] And the title was safety.
[2:09:05] Concerns prompt Nashua officials to separate hockey players.
[2:09:09] From recreational skaters.
[2:09:12] Hockey players are now banned from.
[2:09:15] Robie park. Exactly. Four reasons that have already been noted.
[2:09:19] Because multi-use
[2:09:22] of that.
[2:09:24] Space has not worked out well.
[2:09:27] And has resulted in injuries.
[2:09:29] Both to a child and an adult.
[2:09:33] That is something that over the last three and a
[2:09:36] half years attending many of these meetings.
[2:09:39] Meetings. I've done a lot of research and starting on
[2:09:41] west coast and heading our direction. There are many parks
[2:09:45] that have discovered that trying to use multi-use.
[2:09:51] Ideas has resulted in not only injuries, but lawsuits.
[2:09:56] Lawsuits my first connection to.
[2:09:59] The whole issue.
[2:10:01] Was actually before disc golf was ever even discussed.
[2:10:05] And our neighborhood was looking.
[2:10:08] For help from the city.
[2:10:11] Regarding trash and traffic.
[2:10:15] And parking, which was already mentioned during sledding season.
[2:10:19] And the safety hazard that, that has created for our
[2:10:22] neighborhood for.
[2:10:24] Ambulance and whatever, and this is.
[2:10:28] A petition that was signed by everyone in our neighborhood.
[2:10:31] And this was dated November.
[2:10:34] 21.
[2:10:38] All due respect to the comments that were made before
[2:10:41] that this is city prop property.
[2:10:44] And so therefore they can correct.
[2:10:47] Mistakes. This was November 21.
[2:10:51] Trash is no different.
[2:10:53] Parking you have heard already.
[2:10:55] Is still happening right underneath the signs that are alderman.
[2:10:59] So nicely managed to finally put no parking signs on.
[2:11:04] Hasn't changed anything.
[2:11:06] And if I look to.
[2:11:09] Most things in my life. I look at, you know,
[2:11:12] watch what someone does, not what someone.
[2:11:14] Says, and what I have seen from the department of
[2:11:18] public works.
[2:11:19] Unfortunately, it's the same.
[2:11:22] Same experience.
[2:11:26] Since I moved here 20.
[2:11:28] Nine 30 years ago.
[2:11:31] Our neighborhood does our own pickup of trash as a
[2:11:34] consequence.
[2:11:35] We go out with our chainsaws to cut down dead
[2:11:39] limbs, that land in the road.
[2:11:42] There is nothing that's done, even from the ease of
[2:11:45] a bucket truck.
[2:11:47] Where you could take care of the, the trees that
[2:11:50] need trimming that you could get rid of vines.
[2:11:54] So when I'm listening to, we're going to manage.
[2:11:56] Invasive species that's not done even on the road side.
[2:12:01] So I don't see how that's going to happen.
[2:12:04] Throughout the park.
[2:12:09] This, this decision to get rid of.
[2:12:14] Hockey.
[2:12:16] On the same rink as skaters.
[2:12:18] And the problem was following rules.
[2:12:22] And yet we're listening to people talk about how all
[2:12:24] the rules will be followed.
[2:12:28] By dis golfers.
[2:12:31] Why would we think that.
[2:12:34] There are rules about trash for sweaters.
[2:12:37] Letters there was a $250.
[2:12:41] Fine.
[2:12:42] Sign. It didn't make any difference.
[2:12:46] The trash is everywhere.
[2:12:48] So, I don't know why we're thinking that dis golfers
[2:12:50] are some amazing people that don't do any of this.
[2:12:57] It's been called to our attention.
[2:13:00] That there are already.
[2:13:02] 70 disc golf courses.
[2:13:04] In New Hampshire, 33 of which apparently have 18 holes.
[2:13:10] How many strictly
[2:13:13] walking trails are there.
[2:13:16] Not for bikers.
[2:13:18] Not for disc golfers.
[2:13:20] Where do people go in New Hampshire and specifically in Nashua?
[2:13:26] Where they're not going to be.
[2:13:29] Amongst anyone who's competing. They're not going to be flown
[2:13:33] by a biker where they can be.
[2:13:36] Contemplative. I don't think there are many places.
[2:13:40] What percentage of the population in Nashua?
[2:13:44] Participate in team sports.
[2:13:47] It's a question. I think we ought to be asking.
[2:13:51] And why must
[2:13:52] productive use of land.
[2:13:55] Focus on competition.
[2:13:57] I don't know why that is.
[2:13:59] But I think it's worth asking the question.
[2:14:02] There's been a great deal written about health benefits.
[2:14:06] Benefits, particularly during the COVID years.
[2:14:08] Of why people need
[2:14:11] space away from screens.
[2:14:13] Screens quiet space.
[2:14:15] Contemplate space, creative space.
[2:14:19] This is that kind of space.
[2:14:21] And we're about to take it away.
[2:14:26] There's been a lot said about the parking.
[2:14:30] And how much the
[2:14:33] designer this Avery Jenkins. Who's a championship disc golfer.
[2:14:38] His focus is on creating tourism.
[2:14:41] I believe mayor Donius focused is on.
[2:14:44] Expanding making this a destination.
[2:14:47] Space for tourism.
[2:14:49] I don't believe that the rotary club, when they originally.
[2:14:53] Donated $30,000.
[2:14:56] That they anticipated all of this.
[2:15:00] They, I think genuinely thought this was going to be
[2:15:02] for families.
[2:15:04] How many
[2:15:06] families get to do pickup games at the baseball field.
[2:15:11] If you don't belong to a team, you don't get
[2:15:13] to play.
[2:15:15] I think that the focus.
[2:15:17] On tournaments and international competition and making this a destination
[2:15:22] location.
[2:15:23] Speaks for itself. This is not going to end up
[2:15:26] for families.
[2:15:34] The national disc golf association in their own documentation.
[2:15:40] State that there needs to be a 300 to 450
[2:15:44] foot.
[2:15:48] Guideline away from
[2:15:51] other borders.
[2:15:53] Borders at least eight holes on this course do not
[2:15:56] meet that. Meet the disc golf Association's own directives.
[2:16:01] Directives. And when they talk about, you know,
[2:16:04] get the, the kind of coexisting with walkers.
[2:16:08] Walkers, what person wants to be walking by?
[2:16:12] When these discs can
[2:16:15] be thrown 175 to 250.
[2:16:19] Feet by a novice.
[2:16:21] 250 to 350 feet.
[2:16:25] By someone intermediate.
[2:16:28] And a tournament player, 300 to 450 feet.
[2:16:32] And that can be 50 to 70 miles an hour.
[2:16:36] Is that really going to work with walkers?
[2:16:40] Walkers. And are they these, these sort of remarkable dis
[2:16:43] players who are gonna follow all the rules?
[2:16:46] And it's in a forest, so they're gonna have to
[2:16:48] see around trees.
[2:16:50] Do you really think that this isn't an accident waiting
[2:16:54] to happen?
[2:16:55] I personally think it is.
[2:16:58] I think there's a reason also why every time we
[2:17:01] come.
[2:17:02] The the, the
[2:17:05] the plans look different.
[2:17:07] And this amendment.
[2:17:09] I find it interesting that a waiver.
[2:17:12] Has been requested.
[2:17:14] Against having to post a bond or an escrow agreement.
[2:17:18] I suspect that's because they've already spent taxpayer dollars.
[2:17:23] They've already spent.
[2:17:25] And if they had used all of what the rotary
[2:17:27] club.
[2:17:29] Had provided that was supposed to cover the whole thing.
[2:17:32] We would already be in the hole. And I think
[2:17:35] the city doesn't want us to know how much is
[2:17:37] this really going to cost?
[2:17:39] And how much will maintenance over time cost.
[2:17:42] And, and they're talking about, you know, hand clipping, how
[2:17:47] many people are you going to need to be going
[2:17:49] in to hand clip all through this?
[2:17:52] Course the conservation committee.
[2:17:57] Required. And I had an opportunity to listen to a,
[2:18:00] a, an opportunity to listen to them. Talk with private.
[2:18:04] Owners who wanted to cut? I think it was a
[2:18:08] total, there were three owners.
[2:18:10] A total of seven trees.
[2:18:12] Is, and they were required to keep them 14 feet
[2:18:16] tall.
[2:18:17] Jagged at the top.
[2:18:20] In addition had to be taken care of by an
[2:18:22] arborist.
[2:18:24] They had to
[2:18:27] for the right to do that, manage invasive species. My
[2:18:31] question is why is city land?
[2:18:34] Not subject to those same.
[2:18:37] Requirements. And finally, I'd like to say that the statistics
[2:18:41] re.
[2:18:43] Regarding support or dissent.
[2:18:45] I looked after the June meeting.
[2:18:48] At all of the letters that came in, as well
[2:18:51] as the notes regarding speakers.
[2:18:55] Speakers one half.
[2:18:57] Of all speakers were not from Nashua.
[2:19:02] Two thirds.
[2:19:03] Thirds of the letters that came in.
[2:19:06] Were not from Nashua.
[2:19:08] In contrast all, but one.
[2:19:11] Of the speakers who opposed.
[2:19:15] The disc golf course were from Nashua.
[2:19:19] I think that's an interesting thing to pay attention to.
[2:19:22] Thank you. Thank you.
[2:19:28] Is there anyone else that would like to speak in
[2:19:30] opposition concern this evening?
[2:19:37] Thank you. Is there anyone in the audience that would
[2:19:40] like to speak in favor of this application?
[2:19:48] Just just
[2:19:52] just actually, you know what, I, I apologize in advance.
[2:19:54] Could we actually just take a quick break with the
[2:19:57] board? I'd like to call a quick recess if I
[2:19:59] can. So.
[2:20:01] We're going we're in recess at nine 20. Is that
[2:20:04] your.
[2:20:08] Five about five, five.
[2:25:21] Folks folks, folks that need we're back in we're back
[2:25:24] in session.
[2:25:25] So I'd like to ask a order, please.
[2:25:30] Apologies for the interruption, but.
[2:25:34] This is the line of folks that's wishing to speak
[2:25:36] in favor of the project.
[2:25:39] I, I would make the same request that I made
[2:25:41] of the others. Just you try to keep your comments
[2:25:44] concise and not repeat. What's already been stated, but.
[2:25:49] Other than that, just please introduce yourself for the record.
[2:25:52] Hi, Karen bill 95 Parnell place here in Nashua. I
[2:25:55] am a Nashua native.
[2:25:57] And the nice thing about.
[2:25:59] The parks in Nashua.
[2:26:02] Is that they are available for all residents. And I've
[2:26:05] always strongly felt that Robie park was never an option
[2:26:09] for me.
[2:26:10] As a resident, because I didn't have a small children
[2:26:14] who, you know, sled or played ball or any of
[2:26:17] that stuff.
[2:26:18] And I would think that the people who actually spoken
[2:26:20] in opposition earlier.
[2:26:22] Would be thrilled with a disc golf.
[2:26:24] Situation coming because
[2:26:27] what so many of them have spoken about is the
[2:26:29] horrible traffic, the horrible trash, the horrible, you know,
[2:26:33] so many horrible things, all that's going on now.
[2:26:36] When I first walked the park to see it.
[2:26:40] I could not believe that there was.
[2:26:43] Boards in what was wetland area?
[2:26:46] That had been there and there was trash.
[2:26:49] And I was kind of appalled and I would probably
[2:26:52] get lost just walking in there because it's a very
[2:26:55] large area.
[2:26:57] So then I started playing disc golf.
[2:27:01] And I was, I was blown away.
[2:27:04] By the people that played.
[2:27:07] That they
[2:27:09] we're so.
[2:27:11] Caring of the environment. You don't move a rock. You
[2:27:13] don't move a stick to throw the disc. There was
[2:27:16] no.
[2:27:17] Wild disks flying all over the place. They're not hitting
[2:27:21] anybody in the head.
[2:27:24] They're not going.
[2:27:25] 500 feet. Oh God. If I could only throw my
[2:27:29] desk 500 feet, I'd be winning, winning things.
[2:27:32] There's a disproportionate amount of attention being paid to this
[2:27:37] versus.
[2:27:38] Other Nashua parks, the hours will be the same. If
[2:27:41] there was a typo, there was a typo. It's not
[2:27:44] six in the morning. It's seven.
[2:27:48] And
[2:27:49] things like our wetland specialist, Brendan, who is.
[2:27:52] So revered in this state.
[2:27:55] For people to think that he has not done.
[2:27:57] Beyond his homework is crazy.
[2:28:00] Everything people have been, Bendo bending over backwards and we've
[2:28:04] gone.
[2:28:05] Well above wetland's concerns. Okay.
[2:28:08] I wanna stay local. I don't wanna have to drive
[2:28:10] 30 to 45 minutes to go play disc golf. I'm
[2:28:13] a new player.
[2:28:15] I wanna be the expert on this.
[2:28:17] Course, let me tell you. It's only a couple miles
[2:28:19] from my house.
[2:28:20] And I am. I just can't even wait because it's
[2:28:25] gonna be such an improvement. There's not gonna be any
[2:28:27] dripping epoxy. It's kind of like sometimes I hear some
[2:28:31] of these things and I think, is it me? Is
[2:28:34] it just, is it, am I being delusional or, or,
[2:28:38] you know, come on.
[2:28:39] If, if every
[2:28:42] unsafe place in this city.
[2:28:44] Which is not gonna be a disc golf course.
[2:28:47] Were closed down. Well, we might as well start with
[2:28:49] the H the highway, since there's so many accidents.
[2:28:53] Accidents. Thank you. I appreciate your time and listening and.
[2:28:58] Let's get it going so we can improve Robie park.
[2:29:00] Thank you.
[2:29:03] Step right up.
[2:29:05] Good evening. Good evening, Dr. Richard smart, 1 59 Surles road,
[2:29:09] lifelong Nashua resident.
[2:29:11] Resident. I am the, the holder of the petition with
[2:29:14] the 600 signatures. We originally presented a hundred signatures to
[2:29:18] the mayor.
[2:29:19] To get this project rolling.
[2:29:21] There's a lot of misinformation that's been presented tonight. There's
[2:29:25] a lot of outright lies that have been presented here
[2:29:28] tonight.
[2:29:30] Including one by an elected city official.
[2:29:33] I, I wish my alderman had stuck around to hear
[2:29:35] my comments. He does not represent just.
[2:29:38] The four or five folks that live on Southgate and
[2:29:41] in that general,
[2:29:42] he represents the entirety of ward nine.
[2:29:45] Okay on that petition.
[2:29:48] Accounted before I came here tonight, 118.
[2:29:51] Of the 625 signatures are from ward nine.
[2:29:55] Who are you serving? Who are you listening to?
[2:29:59] There's got to be open.
[2:30:01] Honest discourse.
[2:30:03] When this happens.
[2:30:05] A couple other points I want to make and I,
[2:30:07] I will keep this brief.
[2:30:09] Why do we want 18 holes in nine holes?
[2:30:12] Because that's what the application's for.
[2:30:14] All right. We didn't come here tonight to compromise. We
[2:30:17] came here tonight.
[2:30:19] To receive
[2:30:21] permission to move forward with this project.
[2:30:24] This is not new. This didn't come out of nowhere.
[2:30:28] It hasn't been done under the, the guise of night.
[2:30:31] There have been almost 20 public meetings at this point.
[2:30:36] It's a constant
[2:30:38] attack of city officials.
[2:30:40] Talking about D P w like they're not in the
[2:30:43] room.
[2:30:44] These folks work for the city. They work hard. They
[2:30:47] make sure that we're all safe.
[2:30:50] In regards to safety.
[2:30:52] People are trying to scare you tonight.
[2:30:54] And tell you that people are going to be injured
[2:30:56] or maimed.
[2:30:57] There has been one.
[2:31:00] One incident in the state of New Hampshire.
[2:31:03] Since I have become very active.
[2:31:06] In so 2015 to now in the last 10 years,
[2:31:08] there's been one incident.
[2:31:10] That has required someone to be, to receive medical care.
[2:31:15] One, the other stories they're talking about.
[2:31:18] Are these gigantic
[2:31:21] gigantic mixed use parks. Think about Greeley park on steroids
[2:31:25] in the middle of California.
[2:31:27] All right. This is a mixed use park. They have
[2:31:30] realized that this isn't the best design. It isn't the
[2:31:32] best way to do it. Most of those parks have
[2:31:34] been redesigned.
[2:31:36] By experts. All right.
[2:31:38] The comments that have been made about Avery Jenkins and
[2:31:40] Simon. Zat not being.
[2:31:43] Up to the task at hand.
[2:31:46] Would be like saying that Jack Nicholas is not up
[2:31:48] to the task at hand for designing a golf course.
[2:31:52] Folks don't know who these people are.
[2:31:55] Avery Jenkins just led team USA.
[2:31:58] To another president's cuff.
[2:32:01] That just happened. This is not something.
[2:32:04] That is small. This is something that is.
[2:32:08] A global sport. It is the second fastest growing sport
[2:32:11] right now.
[2:32:12] Teetering back and forth with pickleball.
[2:32:15] All right. Pickleball was put in Nashua.
[2:32:18] Very quickly. It, it was taken care of.
[2:32:22] It's far more expensive.
[2:32:24] The last thing I want to talk about is the
[2:32:26] expenses part of it.
[2:32:28] The money that was originally.
[2:32:31] Slated for this project.
[2:32:34] Has unfortunately been spent on other things.
[2:32:36] Other things that would not have been done.
[2:32:39] Without the misinformation and lies that the opposition continues to
[2:32:43] tell.
[2:32:44] Thank you for your time. Thank you.
[2:32:47] Hi, good evening. Good evening. Chair members of the board.
[2:32:51] Steve Adii six Pell avenue.
[2:32:54] I would like to speak, of course.
[2:32:56] In favor of the course being proposed at Robi park.
[2:33:00] And I would like to address some of the concerns
[2:33:01] that were approached.
[2:33:03] By the opposition tonight, an example. And during the wetlands
[2:33:07] to retrieve a disc, I understand that's a big concern
[2:33:09] and we wanna protect the wetlands as best as we
[2:33:11] can.
[2:33:12] Most disc golfers who are aware.
[2:33:16] Will have a retriever on them at all times, or.
[2:33:19] If they're advised by signage to not enter the wetlands.
[2:33:23] We could discuss in the future, possibly having D P
[2:33:25] Go through as part of their assignment in.
[2:33:29] Inspecting the course pick out disks in an approved manner
[2:33:32] from there to minimize impact.
[2:33:35] I would also like to talk about signage. A lot
[2:33:38] of people brought up concerns about obstructed views.
[2:33:41] Views and similar safety concerns.
[2:33:44] Concerns. If it is such a concern.
[2:33:46] Which most signs on the course.
[2:33:48] Will address out of bounds markings, including not limited to
[2:33:52] wetlands.
[2:33:54] Wetlands and various other impediments on the course, they can
[2:33:56] also be.
[2:33:58] Built up to address.
[2:34:00] Potential blind spots.
[2:34:03] Regarding the use of other trail systems and studies.
[2:34:06] There was one gentleman who brought up a case that
[2:34:09] this was the only place that was looked at. That
[2:34:11] is not the case.
[2:34:13] I know that at minimum.
[2:34:15] Mind falls, UDI farm.
[2:34:18] And Greeley park were looked at as possible sites for
[2:34:21] this.
[2:34:22] It was determined that this would be the best suited
[2:34:24] site for a course of the nature to be installed.
[2:34:29] I'll go ahead and conclude here by saying that as
[2:34:31] ambassadors for the sport, us disc golfers.
[2:34:34] Try to get everybody who is there to treat the
[2:34:37] course.
[2:34:38] The nature around it and other users, including those who
[2:34:41] are not playing the sport with respect.
[2:34:44] And this is one of the things that I have
[2:34:45] taken away from it in my eight years playing.
[2:34:48] Is, it's a great way to embrace the trail systems.
[2:34:51] And nature in the city, much like as a youth,
[2:34:54] I would play baseball at lions park or sun or
[2:34:57] sunset Heights.
[2:34:59] Heights or as a teenager and young adult, I would
[2:35:02] mountain bike. The trails of mine falls and the Dickey
[2:35:04] farm.
[2:35:05] With respect to other patrons at the park. I thank
[2:35:07] you for your time.
[2:35:09] And I would, again, like to support this and hope
[2:35:12] that it moves forward. Expeditiously. Thank you.
[2:35:15] Thank you.
[2:35:18] Hi, good evening.
[2:35:19] Hi, Uhhuh. Thank you for your time. My name is
[2:35:21] Brian Mojay. I've been one maple street in Draco.
[2:35:25] I am one of those people that someone earlier had
[2:35:28] spoken, oh, you know, people in favor.
[2:35:31] This very few from Nashua or New Hampshire alone.
[2:35:34] Well, I grew up here my whole life. I'm only
[2:35:37] a new to Massachusetts.
[2:35:39] I can tell, I consider this my home and I
[2:35:41] would love to see something like this happen.
[2:35:43] Happened. I believe it'd be very beneficial.
[2:35:46] To families, to businesses.
[2:35:48] And as far as what the mayor was saying, oh,
[2:35:50] why can't it be a nine hole course?
[2:35:52] Well, a nine hole holes, whole course won't bring in.
[2:35:56] The majority of
[2:35:58] tournaments commerce.
[2:36:01] Shops, everything else. As far as the parking goes, I
[2:36:04] believe there are many large hotels.
[2:36:07] Hotels down in the south end. Those will have business.
[2:36:10] People will be flying in the pros. They're gonna be
[2:36:13] spending a couple days. They're gonna dine out. They're gonna
[2:36:16] eat. They're gonna sleep. They're gonna live in Nashua and
[2:36:18] they're gonna be able to experience what I experienced growing
[2:36:21] up. Thank you. Thank you.
[2:36:27] Hi, good evening. Good evening. My name is Janet vouch.
[2:36:29] I live at 41 Roy street in Nashua.
[2:36:33] It's been my home for the last 39 years. And
[2:36:35] I'm very proud to call the city, my home.
[2:36:38] I am a member of the rotary club.
[2:36:41] That is, has provided $30,000.
[2:36:44] And before every meeting, we start with our four-way test.
[2:36:48] Is it the truth? Is it fair to all concerned?
[2:36:50] Will it build Goodwill and better friendships? Will it be
[2:36:53] beneficial to all concerned?
[2:36:55] These are the words again, that we start each of
[2:36:57] our meetings with and we live by those.
[2:37:00] Boards the truth is that this course would be a
[2:37:03] wonderful addition to the city.
[2:37:05] It is fair since it will be available for all
[2:37:07] to enjoy.
[2:37:08] This is not just something for.
[2:37:11] Older people that are on a golf course.
[2:37:15] Small children. Families could have a great opportunity to be
[2:37:19] outside.
[2:37:20] And convene with nature and have a great time.
[2:37:24] Many residents are looking forward to be able to play
[2:37:26] on this course. The last two statements are absolutely true.
[2:37:30] Families and friends can play for free.
[2:37:33] So it is fair to all concerned. It knows no
[2:37:36] monetary.
[2:37:37] Monetary barriers whatsoever.
[2:37:40] And have an opportunity to be outdoors and benefit from
[2:37:43] this wonderful addition to our community.
[2:37:45] As a member of rotary and a Nashua resident, I
[2:37:48] would like to request that you approve the disc golf
[2:37:50] course at Robie park. Thank you for your consideration.
[2:37:54] Thank you.
[2:37:57] Good evening. Hello.
[2:37:59] Brian Chamberlain eight L a L a.
[2:38:02] LA I'm in favor, obviously, and agree with everyone who's
[2:38:04] spoken in front of me. There's one thing that I'd
[2:38:06] like to point out is the numbers that were brought
[2:38:08] up over the amount of people that will be on
[2:38:09] the course at a time.
[2:38:11] I'm not showing up with 72 of my friends at
[2:38:13] 10:00 AM to play around. I'm showing up at four.
[2:38:16] So that's four people on the course for two hours.
[2:38:19] And then maybe four behind me for two hours.
[2:38:21] Not 14,000 in a day.
[2:38:23] That was as big excessive on numbers. So that's all.
[2:38:25] Thank you. Thank you.
[2:38:30] Hi, good evening.
[2:38:32] Good evening. Thank you for your service to our city.
[2:38:35] My name is Helen hon.
[2:38:37] Monroe. I'm a member of the rotary club of Nashua
[2:38:39] west. I live at 46, Raymond.
[2:38:41] Street here in Nashua. And I'm also a business owner
[2:38:43] here in Nashua, raised my family here in Nashua.
[2:38:48] One of the things that attracted the rotary club of
[2:38:50] Nashua west to this project.
[2:38:53] Was that it would
[2:38:55] be an opportunity for people to have.
[2:38:59] Healthy opportunities.
[2:39:01] Low cost opportunities to exercise and be out in nature.
[2:39:05] There's so little cost involved in becoming.
[2:39:09] A disc, a disc golf player.
[2:39:12] It there's the outlay is so inexpensive that families of
[2:39:17] all means would have an opportunity.
[2:39:21] To use this. Well, I live in the north end.
[2:39:24] I think that being
[2:39:27] having the opportunity to use our park.
[2:39:30] System throughout the city in allowing people of all ages.
[2:39:33] And that's something pretty, very important to rotary that it's
[2:39:37] an entire community operator opportunity.
[2:39:40] I wanna be very clear. The rotary club of Nashua
[2:39:43] west is fully supportive eyes wide open, nothing has been
[2:39:47] pulled.
[2:39:49] No wool has been pulled over our eyes. And importantly,
[2:39:52] there has been.
[2:39:54] Due process and an opportunity.
[2:39:56] For everyone in this community to be heard, if they
[2:39:59] would like to.
[2:40:01] I am fully supportive personally with rotary club of Nashville
[2:40:04] west.
[2:40:05] Chose this project to celebrate our 50th year of service
[2:40:09] to this community.
[2:40:11] It was an anniversary of sorts, if you will. And.
[2:40:15] We wanted to take the opportunity to join with the
[2:40:18] city to provide.
[2:40:20] Yet another opportunity.
[2:40:22] For people in our community to have safe.
[2:40:25] Healthy opportunities to be
[2:40:28] out in the out in nature.
[2:40:30] They can certainly operate together.
[2:40:34] Everyone understands that the, that the park will continue to
[2:40:37] operate in the way it always has.
[2:40:40] But that this amenity would be really important.
[2:40:43] To people of all ages in our city.
[2:40:46] They help personally that you will.
[2:40:49] Approve this application for the full 18 holes. And I
[2:40:52] know the rotary club of Nashville west would ask for
[2:40:55] that too. Thank you.
[2:40:56] Thank you.
[2:41:00] Good evening. Good evening, Alex McClain 47 William street.
[2:41:07] Also
[2:41:08] employee of the city. I work for the parks department.
[2:41:12] It's
[2:41:14] it's crazy that
[2:41:16] you have individuals out there on a weekly, daily basis
[2:41:19] and setting up their own baskets inside of Greeley park
[2:41:22] and throwing Frisbees.
[2:41:24] And at whatever rate they throw them. And.
[2:41:28] The individuals around them are not up in arms, but
[2:41:30] yet.
[2:41:31] You attempt to do something like this, and we have
[2:41:33] everybody up in arms.
[2:41:36] I just wanna
[2:41:37] talk, you know, my kids have been out on a
[2:41:39] disc golf course since they were.
[2:41:43] Babies walking with a stroller.
[2:41:45] They're 11 to 12. Now I'm majority of these individuals
[2:41:49] here have never seen me without my kids on a
[2:41:51] disc golf course.
[2:41:53] A lot of them, even the very first municipal disc
[2:41:56] golf course that was approved in the state of New Hampshire.
[2:41:59] It's over at Dover. That is one of the most
[2:42:01] heavily used disc golf courses.
[2:42:03] And it is also the most heavily used walking disc
[2:42:06] golf course.
[2:42:08] That they don't have any issues.
[2:42:11] Issues and they haven't had any issues.
[2:42:14] You know, and
[2:42:16] issues over conservation land that I can cite many of
[2:42:20] different disc golf courses that are all on conservation land.
[2:42:24] This is not anything that's out of the norm.
[2:42:28] thank you. Thank you.
[2:42:35] Mr. Chairman members again, Andy Pearlman, the per Pearlman.
[2:42:39] Attorneys here in Nashua.
[2:42:42] You recall at the outset? I said, I want to
[2:42:44] speak for a moment as a witness, so I I'm
[2:42:46] gonna speak for a moment as a witness. If, if
[2:42:48] please the board, then I do want to have some
[2:42:50] rebuttal time for the comments that were made.
[2:42:53] And the reason I wanted to speak as a witness,
[2:42:54] because since I got involved with this project, since January, 2024,
[2:43:00] I've actually used it to get out and spend some
[2:43:02] time outside. My wife and I have walked.
[2:43:05] Four courses.
[2:43:07] Four full disc golf courses, two in Manchester, the hollows
[2:43:11] courses, north and south.
[2:43:13] One course in
[2:43:16] Franklin mass and one course in nearby and begins with
[2:43:20] M I forget the town, but we worked out there's
[2:43:23] four courses.
[2:43:24] While they were being used.
[2:43:26] While they were someone busier than others.
[2:43:29] But we, we walk the courses.
[2:43:31] And just to just, just.
[2:43:34] Get a sense of the operation.
[2:43:38] But we weren't playing, we weren't playing disc golf. We
[2:43:41] were just walking and we would tell people I'm walking,
[2:43:43] cuz I'm involved in this project. I just wanted to
[2:43:45] feel it out and say no. So people were about
[2:43:47] to tee off and we would say, do you mind
[2:43:50] if we walk ahead and this said, well, let us
[2:43:51] tee off. You guys can walk and then we're gonna
[2:43:53] throw again. Start we'll call you out and stop.
[2:43:56] And pull, you know, move to the side of the
[2:43:58] fairway and then watch for our disks. And then you
[2:44:01] can keep walking.
[2:44:03] Not once. Do we have any concern for our safety?
[2:44:06] It, it was so friendly. It was so.
[2:44:08] Welcome, please enjoy the walk in the woods.
[2:44:12] It, it was fantastic. And not once did we ever
[2:44:15] think that there's gonna be a Frisbee that's gonna hit
[2:44:16] the back of our head, right? Because they saw the
[2:44:19] players saw that the, we were, there were walkers on
[2:44:22] the course and they respected us and they let us
[2:44:24] do our thing. And I, I expected the same here.
[2:44:29] All of the courses that we walked are all the
[2:44:31] same as what we're proposing Robie park though. It's all
[2:44:34] town.
[2:44:35] Our city owned land.
[2:44:37] They all have wetlands on. 'em just, it's hard. You
[2:44:39] can't avoid, you know, 30, some odd acres and not
[2:44:42] have some wetlands on 'em. They all have bridges. They
[2:44:44] all have signs. They have some ropes of guiding the
[2:44:46] players.
[2:44:47] Through all the same, but what I wanted to tell
[2:44:50] you as a witness is what we, what we took
[2:44:52] away.
[2:44:53] From our, our walks and we actually, my, my wife
[2:44:56] remind know that we played round of disc golf some
[2:44:58] years ago in Pennsylvania.
[2:45:00] What we took away from it was, was two things.
[2:45:02] Family and friends and respect. I said that this is
[2:45:05] only board. I'm gonna say it in here tonight, family
[2:45:07] and friends.
[2:45:10] We just saw
[2:45:11] groups of friend 20 rolls. We saw three generations playing
[2:45:16] together.
[2:45:17] We we saw dogs being walked. It, it was, it
[2:45:19] was just a friendliest thing.
[2:45:21] And then the respect part of it. I, we, I,
[2:45:24] since I've been involved with this thing, I've, I've come
[2:45:25] to.
[2:45:26] I'm really taken by the disc golf community because all
[2:45:29] these courses.
[2:45:31] Are immaculate. There's no traction. There's no beer bottles. There's
[2:45:33] no trash.
[2:45:35] They're all carrying carry out. These are immaculate courses and
[2:45:38] it's because of the disc golf community. They, they don't,
[2:45:40] they don't put up with any bologna.
[2:45:43] And we were just so taken by the, by the
[2:45:47] discipline.
[2:45:49] And just, just the camaraderie.
[2:45:51] If you talk to folks who run these org disc
[2:45:54] golf organizations, they will have a cleanup day. There's a
[2:45:57] couple in the back of the room, Norma and bill
[2:45:59] Bruce. They operate programs up in Manchester and they will
[2:46:02] say.
[2:46:03] We call out, you know, every spring and fall we
[2:46:05] will have a cleanup day. No, no play.
[2:46:08] On the chorus war, we're gonna get a hundred people
[2:46:09] walk the course and pick everything up, right. Pick up,
[2:46:12] you know, this that may be lost or whatnot.
[2:46:15] Just the community is, is so impressive.
[2:46:18] And, you know, I don't know the stories about trash
[2:46:20] Roby park. I don't want to live down there, but
[2:46:22] my experience.
[2:46:24] From what I witnessed it's that is not true from
[2:46:27] what, from what I saw.
[2:46:29] And, you know, the zoning board met one of the
[2:46:31] zoning board members.
[2:46:34] Neely he's he said, you know, I actually went up
[2:46:37] to, I walked the halls course up in Manchester and
[2:46:41] well, he said just what attorney Pearlman said it was,
[2:46:43] it was a immaculate it's clean. It was respected. I
[2:46:46] so.
[2:46:47] That's my story as a witness. This is the disc
[2:46:50] golf community you heard tonight.
[2:46:52] You know, they're, they're an impressive group. So that's my.
[2:46:57] Take as a witness Mr. Chairman, and I would like
[2:47:00] an opportunity to rebut some comments.
[2:47:03] Comments if that's, if that's okay. Yeah, you may.
[2:47:06] Possibly. I just want to take the temperature of the
[2:47:07] board here.
[2:47:09] Obviously, there was quite a bit of testimony tonight for
[2:47:12] approaching 10 o'clock.
[2:47:16] What's what's the mood of the board perspective, hearing a
[2:47:19] rebuttal.
[2:47:21] I guess the, the, the follow up to that would
[2:47:23] be.
[2:47:25] If we hear the rebuttal.
[2:47:27] Are we then interested in deliberating knowing there's still some
[2:47:30] other business items on the agenda.
[2:47:35] I want to force anybody into anything, but any general
[2:47:39] thoughts on.
[2:47:40] How we may wish to proceed from here.
[2:47:44] Can we to define the time could we give a
[2:47:47] time limit limit to the it's? It's very hard to
[2:47:50] do. I think yeah. Use the complex as a complex
[2:47:53] issue we may to discuss. Let's true. Yeah. Our meeting,
[2:47:58] I, I would say suggest we.
[2:48:01] That we, we at least hear the rebuttal.
[2:48:03] And we could always, you know,
[2:48:07] reassess after that. Okay. Determine whether we think that we
[2:48:11] need.
[2:48:12] You know, another meeting to deliberate.
[2:48:15] Or not. Yeah, we're, we're not trying to pigeonhole.
[2:48:18] The, the applicant or draw things out unnecessarily, but there
[2:48:21] was obviously, there was a lot of commentary.
[2:48:24] We want to give you.
[2:48:26] As much opportunity to respond to those comments as, as
[2:48:29] possible. But.
[2:48:30] If, if, if we're talking another hour potentially at a
[2:48:33] rebuttal, I'm just making up a number, hypothetically, and then
[2:48:36] we go into our deliberation. I think we're.
[2:48:39] This is why we kind of establish that, that unofficial
[2:48:41] cutoff. But.
[2:48:44] I think it seems like it's the pleasure of the
[2:48:45] board. We'd like to give you an opportunity this evening.
[2:48:48] To rebut, whether rebuttal is one person each correct.
[2:48:54] No, it's you it's it's solely it's the applicant's. Oh,
[2:48:58] this is, this is your, your, yeah.
[2:49:01] Three minutes. Okay. I promise.
[2:49:04] I want, I won't, you know, I won't hold you
[2:49:06] to that, but no, it's okay. We, we appreciate it.
[2:49:10] Thank you.
[2:49:14] Just just, and just some comments and it's not just
[2:49:16] to call some things out. There was not, there was
[2:49:19] nothing particularly technical from the.
[2:49:22] Those in opposition with concern.
[2:49:24] So just wanna call out some, some comments.
[2:49:26] Comments Mr. Barley, your initial questions about trail conflict. I,
[2:49:32] I, you know, I, I tried to explain that and
[2:49:34] my comments as a witness.
[2:49:36] We the nine hole question came up at the zoning
[2:49:39] board.
[2:49:41] The nine hole.
[2:49:43] Proposal was rejected because we think the course would fail
[2:49:46] in, in and of itself. People want to play 18
[2:49:48] holes, people don't, people who want to come here and
[2:49:50] play nine holes in a half an hour and, and
[2:49:52] take off it's. It's not what's.
[2:49:54] What's being proposed. It's not.
[2:49:56] A a, a positive experience for dis golfers.
[2:50:00] Mr guardian, if I'm saying that name correctly, and I
[2:50:03] apologize if I'm not, he raised a question of location.
[2:50:07] And there's a gentleman speaking in favor, who was exactly
[2:50:10] right. We met with director Foto yesterday.
[2:50:13] Grilly park, mines falls, Yi were all looked at and
[2:50:18] all ruled off for different reasons.
[2:50:20] Reasons I primarily, because the topography.
[2:50:23] Of Robie park is what this golf players like to.
[2:50:27] Play on. They like to challenge.
[2:50:29] The other course, the other areas were too flat, too
[2:50:31] boring.
[2:50:32] It wouldn't bring, bring PA players back. They, the Roby
[2:50:35] park was the best option.
[2:50:37] That the city considered and they did consider a number
[2:50:39] of options.
[2:50:41] Ms. Mooni had a couple comments.
[2:50:44] Comments. She is correct. D E S has to sign
[2:50:46] off on the crossings, but be because the crossings are
[2:50:49] so minor.
[2:50:50] The approvals are done by notice there's no formal hearing
[2:50:54] or anything. The Dan Hudson will simply send out.
[2:50:58] Notice that the project complies with D S requirements and
[2:51:03] that's about it.
[2:51:04] There's no trash bails being proposed on the courts or
[2:51:07] in the courts. It's just gonna be it's Carrie in,
[2:51:09] carry out.
[2:51:10] They'll probably be a trash barrel by the parking lot,
[2:51:12] along the porta potty.
[2:51:14] This is not conservation land. I, when I first got
[2:51:17] into this, I did title on Robie park. There is
[2:51:19] no easements.
[2:51:21] Easements there. And I, I, I represent as council before
[2:51:24] you that there's no.
[2:51:26] Restrictions or easements. There's a sewer easement in aerobic park,
[2:51:29] but that's about it.
[2:51:30] Is not conservation land.
[2:51:35] There was talk about tournaments.
[2:51:37] Tournaments and tournaments, but they don't expect many tournaments. There'll
[2:51:40] be a handful of tournaments. Over the years. Tournaments are
[2:51:42] run by professionals. Tournaments will be told if you're gonna
[2:51:45] have a big crowd that you have to manage your
[2:51:47] crowd. You have to find some offsite, parking and shuttle
[2:51:49] to the site.
[2:51:51] I would, I watched a tournament up in Manchester and
[2:51:54] it was a, it was a popular tournament. It was
[2:51:56] a new England tournament. And.
[2:52:00] The way the Bruces actually ran it. They have timed.
[2:52:03] Timed tee times and players are told not to show
[2:52:06] up until like 15 minutes before your tee time. And
[2:52:09] it, it scatters the crowd over the day. It really
[2:52:11] works. So tournaments will be a benefit cuz it'll draw
[2:52:14] people to Nashua, but they can be vantage professionally managed.
[2:52:18] Well.
[2:52:19] And finally, I just, there was one comment at the
[2:52:22] end, Ms. McKinley.
[2:52:25] She said, quote
[2:52:28] if you don't belong to a team, you don't get
[2:52:29] to play.
[2:52:31] And this is not, this is gonna end up not.
[2:52:33] Not end up for families. This is a quote.
[2:52:36] That couldn't be more wrong.
[2:52:38] You know, I it's a shame.
[2:52:40] These, these meetings are run late into the night because.
[2:52:44] The zoning board had a lot of kids come out
[2:52:46] and a lot of coaches come out and say, this
[2:52:48] is great. A lot of teachers say this is great
[2:52:50] for my students. This is something that cost, I don't
[2:52:53] know, you know, 10, 20 bucks to buy a disc.
[2:52:55] Kids can get out there.
[2:52:57] The, the cost to just as, as, as, as HARO
[2:53:00] said, the cost of getting into this sport is next
[2:53:03] to nothing compared to all or other options.
[2:53:06] I have a granddaughter and I'm intentionally not buying her
[2:53:08] hockey equipment.
[2:53:10] Right, because I don't want to go down that road.
[2:53:12] I maybe I'll buy her a disk, but this is
[2:53:16] designed for families. Yes, they'll be tournaments. Yes. There'll be
[2:53:18] pros coming to this thing, but this is such a
[2:53:21] family friendly, free.
[2:53:23] Meant for the city. So we are looking for.
[2:53:26] Your approval tonight. So thank you very much.
[2:53:28] Okay, thank you.
[2:53:33] So put it back to the board.
[2:53:37] For
[2:53:38] before we close the.
[2:53:40] Public hearing any further questions.
[2:53:43] Questions of staff or applicant scheme.
[2:53:51] All right.
[2:53:52] Well seeing none.
[2:53:57] We're gonna close the public hearing now, regardless.
[2:54:02] I guess again, I'll, I'll put out.
[2:54:04] Similar question.
[2:54:06] Pleasure the board in terms of deliberating.
[2:54:09] This tonight.
[2:54:14] What's your capacity for, for moving on.
[2:54:18] I'm okay to keep going, but you guys are good.
[2:54:19] Yeah. Okay. To Maggie.
[2:54:22] Doesn't have to be damn this way. Okay. Okay. All
[2:54:25] right.
[2:54:26] So, all right.
[2:54:31] Obviously, we heard a lot of information.
[2:54:35] This evening.
[2:54:36] Both both pro and con.
[2:54:40] But I, I guess this is one I I'd really
[2:54:42] like to hear from, from.
[2:54:44] Our board members first.
[2:54:47] General thoughts or impressions?
[2:54:51] Please Mr. Green. Yep. Well, I personally play a lot
[2:54:54] of outdoor sports, not disco in particular, but volleyball and.
[2:54:59] Softball friends. Most of the people that tend to play
[2:55:02] end up playing art.
[2:55:04] Malicious in their tent, they're there to play the game.
[2:55:07] Get out.
[2:55:09] So, you know, I, I probably echo many of the.
[2:55:12] The thoughts of some of the.
[2:55:16] People who were for the proposal.
[2:55:19] And just looking at, you know, generally our master planning
[2:55:22] and some of the other objectives of the city. I
[2:55:24] think this does bring in as a.
[2:55:27] Place to for, for most people.
[2:55:29] Almost everybody. So
[2:55:32] I, I tend to think that it fits the, the
[2:55:35] use of the space in the park and, you know,
[2:55:37] similar.
[2:55:38] Sites that I've seen throughout this college with pedestrians moving
[2:55:41] throughout those types of courses and, and work we've put
[2:55:45] them in as well. And there hasn't been any issues
[2:55:48] with even getting close hitting cars, even though they're very
[2:55:50] close to parking lots. So.
[2:55:54] You know, aesthetically
[2:55:56] it's very similar as well. There's park.
[2:55:59] And conservation, it's not a.
[2:56:02] Intensive sport or intensive sport. Like you're not clear cutting,
[2:56:05] and you're not clear cutting everything. You're not.
[2:56:09] Creating any additional
[2:56:11] spaces that
[2:56:13] not spaces. You're not doing additional civil work to really
[2:56:17] destroy the what's existing there. So.
[2:56:20] I think this is relatively low impact for, for the
[2:56:23] area that that's being proposed for.
[2:56:26] Thank you, Mr. Green.
[2:56:30] Others. Mr. Barley, please. Yeah. Mr. Chair, I've just, I
[2:56:33] would echo some of the comments from Mr. Green. I
[2:56:34] mean, I, I appreciate that this is not.
[2:56:38] A zero impact use, right? They're they're some trees are
[2:56:41] gonna be cut.
[2:56:42] You know, we've heard about, you know, additional bridges being
[2:56:45] added.
[2:56:47] But I would say of, of the sort of.
[2:56:50] Uses you could envision here. This is a relatively low
[2:56:52] impact use.
[2:56:54] And I think we've heard a bunch of testimony that.
[2:56:58] Supports, you know, this use.
[2:57:01] Being able to coexist.
[2:57:04] With the other existing uses, you know, in terms of
[2:57:06] people walking on the trails.
[2:57:08] Trails. And I would just suggest that that's.
[2:57:10] That's pretty similar to a lot of the other, other
[2:57:12] public spaces in Nashua. You know, if you go to.
[2:57:15] Mind falls park, for example, you know, several people mentioned
[2:57:18] that.
[2:57:19] There's lots of different uses happening there.
[2:57:22] At the same time you've got, you know, multiple uses
[2:57:25] on the, on the trails, whether it's people.
[2:57:27] Running walking, biking. You've got soccer fields there.
[2:57:30] You know, you've got a number of different activities and,
[2:57:33] you know, my sense, having spent quite a bit of
[2:57:35] time there is that, you know, that those uses seem
[2:57:37] to be able to successfully.
[2:57:39] Coexist. And I think the same thing could be said
[2:57:41] for Greeley park.
[2:57:44] So I think
[2:57:45] you know, there's a, a degree which.
[2:57:49] I think we we've, we've got a good plan from
[2:57:52] the city. We've heard a lot of testimony that suggests.
[2:57:55] You know, as, as you, as I respect for other
[2:57:57] experiences that these uses can coexist. And again,
[2:58:01] I feel like it's a, a relatively low impact use.
[2:58:04] Given the space in a, in a good way to
[2:58:06] provide.
[2:58:07] People an alternative way.
[2:58:10] To get out and explore, you know, an open space
[2:58:13] and to do so at no cost.
[2:58:17] Thank you, Mr. Barley.
[2:58:20] Anyone else?
[2:58:22] Ms. Har please just quickly OB I do echo a
[2:58:26] lot of the sentiments that you both just just said,
[2:58:30] and I don't play the sport either, but I do
[2:58:32] have some friends that, that do play discal.
[2:58:37] And the one thing that they always say about it
[2:58:39] is that they love it because they're outside of nature.
[2:58:42] Playing playing the game and that that's really the draw.
[2:58:48] And I, I think that sounds wonderful.
[2:58:53] And, and again, I do feel like this is fairly
[2:58:55] low impact, you know, compared to like mowing everything down
[2:58:58] and putting a softball field in or.
[2:59:01] Pickleball court or, I mean, pretty much any other sport
[2:59:06] out there.
[2:59:09] And that, you know, potentially down the road, if you
[2:59:12] know, there was no more disc golfing, the impact as
[2:59:15] far as what type of equipment.
[2:59:17] Or what's been done to the land itself.
[2:59:20] Will be low impacted. You could, you know, you could
[2:59:22] potentially remove it and it would be.
[2:59:24] We would still have ones. So that's.
[2:59:28] That's all I have. Yeah. I, I appreciate those thoughts.
[2:59:33] The, the one thing I did want to comment on
[2:59:35] was.
[2:59:37] Was the parking. I, I.
[2:59:39] Appreciate the fact that the city is.
[2:59:42] At least they they've left themselves some room.
[2:59:46] Should should there need to be improvements?
[2:59:49] I, I wouldn't necessarily be in favor of just adding,
[2:59:51] you know, unused, impervious.
[2:59:54] Just for the sake of potentially adding it. I think
[2:59:56] if, if folks.
[2:59:58] Played sports or had kids that played sports in town,
[3:00:01] you know, that whether it's shady lane or dooby field
[3:00:04] there there's.
[3:00:06] There's there. Isn't a ton of parking.
[3:00:10] Even if even
[3:00:12] community park, you know, whether you had early morning, fall
[3:00:15] soccer or just taking prom pictures. You're, you're basically on
[3:00:19] street parking there. So.
[3:00:22] In any case? I, I, I, I understand the.
[3:00:26] Understand the concern.
[3:00:28] But it seems like the city does potentially have options
[3:00:31] to, to address that should this thing.
[3:00:34] You know, turn into something more than, than what it's
[3:00:38] anticipated to be.
[3:00:44] it's kind of, kind of my thoughts on it.
[3:00:46] Mr. Barley, please. You Mr. Judge, just to, since you
[3:00:49] raised the, the parking issue, I, I, I agree with
[3:00:51] you and I agree with the.
[3:00:53] You know, the city's approach of.
[3:00:55] Not adding the parking first.
[3:00:58] You know, without sort of, you know, seeing what the.
[3:01:02] What the usage is.
[3:01:05] I like the idea of not, you know, again, talking
[3:01:07] about.
[3:01:08] The impact to the land and, and.
[3:01:11] You know, so taking more tree down, trees down, adding
[3:01:14] more impervious surface.
[3:01:16] I, I, I agree with the approach of, let's not,
[3:01:18] let's not do that to start.
[3:01:20] If it's maybe not necessary. And.
[3:01:22] I, I will. I, you know, it's, it's been a
[3:01:24] while since I've spent.
[3:01:26] Much time at Robie park, as my kids are older
[3:01:28] now, but, you know, we used to go there all
[3:01:30] the time and, and I'm, I've experienced the, you know,
[3:01:34] sort of overflow parking situation in the winter for sledding
[3:01:37] and, and, you know, sometimes the other parking lot could
[3:01:39] give busy, but.
[3:01:40] You know, I think Pelger as you've correctly pointed out,
[3:01:42] I mean, that's true of a lot of.
[3:01:45] You know, public spaces, playing fields in Nashua and I,
[3:01:48] you know,
[3:01:50] I, I, I think it's just something that do people
[3:01:52] have to sort of try to manage and.
[3:01:55] And, you know, we do that in lots of other
[3:01:57] places and, and I think, you know,
[3:02:00] in some ways where we park is better situated because
[3:02:03] there are.
[3:02:04] You know, possibilities to expand parking, if that became a
[3:02:07] need. Whereas a lot of the other, you know, places
[3:02:09] you, you mentioned Doobie field.
[3:02:12] There's no opportunity to expand parking there.
[3:02:15] So I, I
[3:02:17] would also support the approach of, of taking the sort
[3:02:20] of wait and see approach on that.
[3:02:21] Yeah, look, Barry. Please. Am I, my concern is, does,
[3:02:24] would it make any sense to go to this compromised
[3:02:26] position? It was suggested of just the nine holes.
[3:02:29] Even the possible expansion, you know, built in or something
[3:02:33] that way. I mean, I don't think the city's being
[3:02:35] benefited by tournaments, for example, especially in that location, if
[3:02:39] that's the reason for the 18 holes.
[3:02:41] I haven't gotten the
[3:02:43] the sense that it nine holes wouldn't work.
[3:02:46] And I kind of wonder if that wouldn't be a
[3:02:47] better way for the board to go.
[3:02:49] So at least my experience, other outdoor facilities, when, when
[3:02:52] you're playing with either, you know, your group of four
[3:02:54] people, I think the, the timeframe like.
[3:02:58] It is maybe within worst worth going somewhere else. If
[3:03:01] you're not.
[3:03:02] Gonna get the full experience like 18 holes.
[3:03:06] I think it's a preference thing typically.
[3:03:11] I'm not sure.
[3:03:13] If there's a concrete yes or no, it'd be used
[3:03:14] more. Right? It's it's very, I'm not saying I'm totally.
[3:03:18] This is an absolute on my I'm just asking. I
[3:03:20] throw, I get the question out to the board, essentially.
[3:03:23] It seems like, you know, the be.
[3:03:25] Obviously that's impact and everything else, a lot of the
[3:03:27] concerns would be mitigated of the objectors. I mean, the
[3:03:31] other thing I would just say just.
[3:03:32] Sorry, Mr. Grant. I mean, the plan we had before
[3:03:36] us is 18 holes. I don't, I don't think that
[3:03:38] we can just unilaterally as a board say, well,
[3:03:41] we're we're gonna approve a nine hole. No, I understand
[3:03:43] that. So I think we.
[3:03:44] We basically be saying
[3:03:47] to the city go back to the drawing board.
[3:03:50] But, you know, I think it sounds like it's the
[3:03:53] case for all of us. None of us.
[3:03:55] Are just golf players and, and I don't.
[3:03:57] Don't you know, purport to sort of know what.
[3:04:00] What the standard should be. Right. And.
[3:04:03] You know, the testimony we've heard, you know, from people
[3:04:05] tonight.
[3:04:07] You're representing the city from, from the public.
[3:04:10] As well as these, these people who design this course
[3:04:12] is that.
[3:04:13] Hey, if you want to have a successful course.
[3:04:15] This is the way you design it with 18 holes.
[3:04:19] And so I don't, I don't, I appreciate what you're
[3:04:21] saying in terms of yeah. You know, if you had.
[3:04:24] If it's half the size it's, you know, in theory,
[3:04:26] half the impact.
[3:04:28] But I, I guess I don't personally feel like I'm,
[3:04:30] I I'm in a position to sort of second, guess
[3:04:32] what the.
[3:04:34] What the approach is in terms of 18 versus nine.
[3:04:38] If Mr. Green, go ahead. I'll give an example that
[3:04:41] I've seen. So like Hollis says a outdoor volleyball court
[3:04:43] that's completed with backing nets and.
[3:04:46] Stops for volleyballs and stuff. And Barack is closer to
[3:04:49] me. I have seen.
[3:04:51] One other group go there and Hollis has a very
[3:04:53] robust community of people.
[3:05:01] You're more likely to get community engagement because you can
[3:05:04] get the full gambit of what you expect from the
[3:05:06] sport.
[3:05:07] Again, that's just anecdotal of what we're looking at, but
[3:05:11] again, I would tend to.
[3:05:13] Agree with some of the logic in 18 hole and
[3:05:15] make more sense for a success of a.
[3:05:18] The course, I, I guess I all to add onto
[3:05:21] to that. I'm, I'm less concerned with how it's.
[3:05:25] It's marketed. Like I, I, I personally wouldn't. Wouldn't.
[3:05:28] Wouldn't it wouldn't affect my day-to-day if they had a
[3:05:30] tournament there or, or, or not. Yeah. But if, if
[3:05:34] again, to Mr. Barley's point, we have the plan that,
[3:05:37] that is before us. I, I would've thought it had
[3:05:39] there been some, some opportunity for compromise.
[3:05:44] This is not the forum in which to do it.
[3:05:46] Just because again, it's not up to us to sort
[3:05:49] of.
[3:05:51] Redesign a site plan.
[3:05:53] So I, I, I, that's not.
[3:05:56] To discredit that idea if it was thought of earlier,
[3:05:58] but this, if this has been in the works for.
[3:06:01] Several years now and has been vet by ZBA.
[3:06:05] Not that we're reliant on their decision. It, it seems
[3:06:07] like there has been some, some foresaw foresight.
[3:06:10] So I, I, I think trying to throw that into
[3:06:12] the 11th hour is not.
[3:06:15] I appreciate the, the comment from the public, but I
[3:06:18] just don't think it's necessarily up for us to adjudicate.
[3:06:21] So, no, I, I understand that part. I just yeah.
[3:06:23] Was asking the question. No, and.
[3:06:26] Yeah. Yeah. I couldn't as, as a non-player I, I
[3:06:29] couldn't tell you necessarily what the .
[3:06:37] Any further, further discussion or, or comments?
[3:06:41] Comments Mr. Green question for staff.
[3:06:48] Is there a permitting process for reserving fields and for
[3:06:51] termly type of use, I'm just not familiar with it.
[3:06:54] This might not be the, the form to task that
[3:06:57] I, I can't speak to D P W's plans to
[3:07:00] operate.
[3:07:02] But it is my understanding and, and I would defer
[3:07:05] to anyone from D P w to speak. If I
[3:07:07] get this wrong, I don't believe that there is any.
[3:07:11] Reservation system planned where it's just free and open use.
[3:07:15] To the public tournaments, maybe a completely different scenario as
[3:07:19] Mr. Poland alluded to.
[3:07:22] I'm seeing some head nos from that's correct. Dan Hudson
[3:07:25] in the back. So that sounds right.
[3:07:29] I, I did have one additional question for, for staff.
[3:07:33] Is, is it commonplace with respect to the bond waiver?
[3:07:36] Mm-hmm is it commonplace for city projects to not.
[3:07:40] Bond themselves or so the, the reason we ask site
[3:07:42] plans to host a bond, typically it's associated with the
[3:07:46] improvements that they plan to execute.
[3:07:49] Largely in the context of anything that's within the right
[3:07:51] of way, essentially, you know, that is the city's domain.
[3:07:54] If, if a private entity is coming and, and disturbing
[3:07:57] the city's domain.
[3:07:59] We want some sort of fiscal sureity to ensure that
[3:08:01] that can be returned to a usable condition.
[3:08:04] Now where the city is essentially beholden unto itself. Well,
[3:08:09] the city is doing a project on city property. The
[3:08:11] city wouldn't post a bond.
[3:08:13] For its own project on its own property. It's.
[3:08:16] It's the money's still within the city. So it wouldn't
[3:08:19] make sense. Mm-hmm , it's not like we're asking to,
[3:08:21] to.
[3:08:23] Issue a bond, which would be an aldermanic action to
[3:08:25] pay for the improvement. That's not what this is.
[3:08:29] Appreciate the clarification, Sam. Thank you.
[3:08:34] Hey barley. And just one other quick question for staff.
[3:08:37] The, the staff report does title this as a site
[3:08:40] plan amendment.
[3:08:42] Yes. Is that just because the, of we are technically
[3:08:45] amending the existing site plan for where we park for
[3:08:48] whatever prior proves of made over time? That's correct. Yep.
[3:08:51] Okay. Thank you.
[3:08:55] Other questions of staff.
[3:08:57] Or other comments, discussion items.
[3:09:04] All right.
[3:09:05] Seeing none.
[3:09:10] Any, any board member is willing to make a motion.
[3:09:13] But we, we do have three waiver requests related to
[3:09:17] this application.
[3:09:20] Obviously we would need to take action.
[3:09:23] On those items first, any member of the board willing
[3:09:27] to.
[3:09:28] Consider a motion.
[3:09:30] Regarding the three waivers applicable to this application.
[3:09:35] Mr barley, please.
[3:09:37] And Mr. Chair as to.
[3:09:40] Case a 25 dash 0 34 site plan amendment.
[3:09:46] For ropey park.
[3:09:47] I would like to first.
[3:09:50] Make a motion with respect to.
[3:09:53] Three waiver requests that have been made.
[3:09:56] By the applicant. The first such waiver request is from
[3:10:00] section one 90 dash one 60.
[3:10:04] To not be required to post a bond or escrow.
[3:10:10] The second wave request is from one 90 dash 2 79
[3:10:15] Regarding submittal requirements to not provide the location of all
[3:10:18] permanent monuments, property lines, or street lines.
[3:10:21] Instead allow for a partial site survey.
[3:10:24] And finally a waiver from section one 90 dash 2 79,
[3:10:28] EE.
[3:10:29] E against middle requirements to not provide survey information for
[3:10:32] all properties within a thousand feet of the subject property.
[3:10:36] And my motion would be to.
[3:10:39] Grant all three of those waivers.
[3:10:42] Waivers and it would be.
[3:10:45] Based on the rationale.
[3:10:48] Rationale provided by the applicant in the waiver request.
[3:10:51] Letters submitted on March 20th, 2025.
[3:10:56] And with findings that strict conformity.
[3:10:59] Would pose an unnecessary hardship.
[3:11:01] And that the specific circumstances or conditions of the land.
[3:11:05] Would indicate that these three waivers can be granted.
[3:11:10] While still properly carrying out the spirit intent of the
[3:11:13] regulations.
[3:11:14] Alright, thank you. Motion by Mr. Barley. Is there a
[3:11:17] second?
[3:11:19] Second by Mr. Green.
[3:11:21] Any further discussion.
[3:11:23] All those in favor. Aye. Motion passes.
[3:11:27] Passes Mr. Riley, would you like to continue?
[3:11:31] Absolutely. So
[3:11:34] again, with respect to case a 25 dash 0 34 site
[3:11:39] plan amendment.
[3:11:40] For Robie park, I would like to then make a
[3:11:44] motion.
[3:11:45] To grant final site plan approval.
[3:11:49] And
[3:11:50] that motion would be with a finding that the site
[3:11:53] plan amendment does meet the approval criteria outlined in section
[3:11:56] one 90 dash 1 46 D.
[3:12:00] And that final approval would include.
[3:12:04] The subsequent conditions.
[3:12:06] Identified in the staff report.
[3:12:08] Letters a through L
[3:12:11] thank you. Motion by Mr. Barley.
[3:12:14] Is there a second. Second by Mr. Green. I do
[3:12:17] have a question though. Oh,
[3:12:19] any further discussion.
[3:12:21] Mr. Green, please. Thank you.
[3:12:24] The time of the
[3:12:26] course is open 6:00 AM to 10:00 PM.
[3:12:30] Would subsequent petition conditions, a.
[3:12:33] Minor drafting corrections be able to.
[3:12:35] To correct that. I just wanna put that on the
[3:12:37] record. I mean, from my perspective, I think, yes, I
[3:12:40] think they uncovered right. Bob. You agree?
[3:12:43] I, I wouldn't, I would agree. And I don't know
[3:12:45] if, if Mr. Hudson.
[3:12:48] Can nod his head on that one, but yeah. Okay.
[3:12:51] But no good point. Thank you. No problem.
[3:12:55] Further discussion.
[3:12:58] Alright, none.
[3:13:00] All those in favor. Aye. Aye. Aye. Motion passes.
[3:13:12] Moving on our agenda.
[3:13:19] Stand back real quick. Stand back real quick. No, not
[3:13:22] really. he's gone.
[3:13:25] Thank you. Yeah. Thank you.
[3:13:35] Let the room clear out.
[3:13:39] Jim. Thank you very much. Quiet.
[3:13:51] I'm sorry, we, we still have other business items today.
[3:13:53] You're welcome to stay if you'd like to listen, but
[3:13:56] we are gonna continue.
[3:14:02] All right. Dan, Dan.
[3:14:04] Hudson city engineer has rejoined us.
[3:14:10] Next time on the agenda review of.
[3:14:13] Tentative agenda projects and regional impact.
[3:14:17] Has any member of the board had an opportunity to.
[3:14:20] Review.
[3:14:23] The future applications and is willing to make a motion
[3:14:26] regarding.
[3:14:28] Regional impair, Mr. Hudson, please. Mr. Chair, I have reviewed
[3:14:32] the tentative agenda. I find.
[3:14:34] No projects of regional significance.
[3:14:37] All right, motion by Mr. Hudson.
[3:14:40] Is there a second.
[3:14:42] Second by Mr. Green, any further discussion.
[3:14:45] All those in favor. Aye. Aye. Motion passes.
[3:14:50] Passes. All right. Last item on the agenda under other
[3:14:53] business.
[3:14:55] For Sam.
[3:14:57] Sam, how much of a deep dive do you
[3:14:59] want to go into inclusionary zoning standards tonight? Because I
[3:15:02] don't want to go into a deep dive. I wanna
[3:15:05] provide a couple of updates. This is we've been working
[3:15:08] on this.
[3:15:09] Throughout this week, I will say.
[3:15:13] You know, we, we took some direction. The last time
[3:15:15] we talked about this in regards to incorporating the formula.
[3:15:19] Into the document in which we have done. We've had
[3:15:22] some.
[3:15:23] Ongoing conversation about the regulation of household size.
[3:15:29] Which has directly correlated to HUD AMI levels. And then
[3:15:35] how that relates to how large of a house someone
[3:15:38] can buy.
[3:15:40] And we've kind of gone back and forth, back and
[3:15:42] forth. And I think we actually we've come full circle,
[3:15:45] you know, having taken issue with how it was originally
[3:15:47] written.
[3:15:49] And now kind of seeing.
[3:15:51] Some of the, the faults in the logic of that
[3:15:53] original issue that we took and kind of coming back
[3:15:55] around to saying,
[3:15:57] you know, you, you do get capped at how big
[3:16:00] of a household you can buy. We did. We wanted
[3:16:02] to pull away from.
[3:16:04] Really caring about how many people were in a given
[3:16:07] household, but because that is so.
[3:16:10] Closely correlated to AMI. We really can't separate those two
[3:16:14] issues.
[3:16:15] Issues the problem being, you know, say you're a single
[3:16:17] person.
[3:16:18] Making 150% of AMI.
[3:16:22] For a one bedroom.
[3:16:25] Well, you might be making 80% AMI for a six
[3:16:28] bedroom. Now, does that make you qualified to go by
[3:16:31] a six bedroom?
[3:16:32] You know, affordable house.
[3:16:34] Probably not. We, we want to avoid that, that.
[3:16:38] Essentially the, the gaming of the system. So with that
[3:16:42] said, I think we still have some.
[3:16:44] Slight amendments to make to the document to kind of
[3:16:47] shore that up. But you have this newer version.
[3:16:51] Before you you've had the opportunity to look at it.
[3:16:55] Happy to take any, any questions as to, you know,
[3:16:58] the document it's current form before you.
[3:17:01] But I think it would be fair to say that
[3:17:03] you can expect a.
[3:17:06] A final document. If you will, final draft at the
[3:17:09] May 15th meeting.
[3:17:13] All right.
[3:17:15] Questions for Sam.
[3:17:22] Righty. Just taking a quick look ahead.
[3:17:29] Sam is east Otterson.
[3:17:31] Still go for the 15th, you think? Or are they
[3:17:34] gonna need a little bit more still to be determined?
[3:17:36] Okay.
[3:17:39] And I guess for, for folks that that may not
[3:17:42] have known.
[3:17:45] Paket
[3:17:46] is officially at a business at this point. So.
[3:17:49] That's actually why the 55, a ible ible case got
[3:17:54] continued tonight.
[3:17:56] I don't know what's going on with their records or
[3:17:58] their representation, but they were sort of a victim of
[3:18:01] the circumstance. So.
[3:18:07] So anyway, made her in pocket is, is no longer
[3:18:09] a business. So.
[3:18:11] Let's see, get around for a long time.
[3:18:16] So I think
[3:18:19] that was, that was all I had.
[3:18:21] I just wanna make two other points. We have a,
[3:18:24] we're working with plan, New Hampshire. They're a group that does
[3:18:28] design charettes and, and other services for municipalities where we
[3:18:31] actually have two events coming up with them in may
[3:18:34] the nine 19th in combination, like I spring work workshop,
[3:18:38] there'll be a panel discussion.
[3:18:40] It's going to be on the third floor of the
[3:18:42] center for the arts.
[3:18:43] We'll have representatives from the real estate community. Dan Scanlan
[3:18:47] is going to be a panelist. We also have someone
[3:18:50] from GZA environmental, so geotechnical, Heather shank, the director of
[3:18:54] the office of planning and development with the state will
[3:18:56] also be speaking. And then Liz Hauer echo economic director
[3:18:59] will be participating in the panels.
[3:19:02] As well, talking about planning and developing in, in uncertain
[3:19:05] times and how public private partnerships are so integral to
[3:19:08] the success of projects now. And, and, and really in
[3:19:11] light of, of current situations.
[3:19:14] We will also then follow on with a walking tour
[3:19:17] of some downtown sites. I really kind of building on
[3:19:20] the discussion of the panel and then finishing at, at
[3:19:24] rambling house for a kind of a social hour. And
[3:19:27] that's on the ninth, 19th on the 30th and the
[3:19:29] 31st will be holding a char.
[3:19:32] Charette for the Millard. There has been a lot going
[3:19:34] on in the mill yard. There's a lot of planning
[3:19:37] that is really needs to happen. And I think.
[3:19:40] Utilizing plan new Hampshire's capabilities.
[3:19:44] The technical abilities in bringing in a, a public process
[3:19:47] with that charette and that visioning for the area is
[3:19:51] really coming at a perfect time. As we're writing regulations
[3:19:54] in the new land use code, you know, we're talking
[3:19:56] about utilizing, you know, BIDA.
[3:19:59] And, you know, redeveloping city property within the mill yard
[3:20:01] and working with some of the people who already have
[3:20:04] projects underway in the mill yard, it's really coming at
[3:20:06] at a great time.
[3:20:07] So just wanted to plug those two events.
[3:20:10] Events and my final item, you may recall.
[3:20:13] Voting to give Mr. Bollinger the authority to sign a
[3:20:17] letter of support for a housing champions designation. We, we
[3:20:20] did receive that designation while back, and, and as a
[3:20:23] reminder that allowed us to apply for some competitive grant
[3:20:26] funds. We sought funding for a.
[3:20:30] Per unit award. So basically you can apply for about
[3:20:34] $10,000 per unit that was marked as affordable at 60%
[3:20:38] AMI, we submitted for the.
[3:20:41] Monahan Manor project. And we were received an award and
[3:20:45] went through the process with the alderman for first and
[3:20:47] second reading last week for a total of $828,000.
[3:20:51] That we will be putting into the housing revolving fund
[3:20:55] for.
[3:20:57] Future projects and, and, you know, housing planning adjacent.
[3:21:00] Exercises so, so great news. And it was a bit
[3:21:03] of a scramble to get all that in. And it
[3:21:04] was, it was worth it.
[3:21:07] Excellent. Thank you, Sam. Appreciate.
[3:21:09] I guess a before, ask for a motion to adjourn.
[3:21:12] I just, I appreciate everybody.
[3:21:15] Kind of pushing through tonight. These ones were, there's gonna
[3:21:18] be a lot, lot of public testimony. I, I know
[3:21:20] those can go a, a number of different ways, but
[3:21:22] I, I think overall folks did.
[3:21:25] I, I think we've seen others that maybe didn't go
[3:21:28] that, that smoothly way much better than I thought I
[3:21:30] would. No, thank you. They're great. Thank you everybody. For,
[3:21:33] for pulling through.
[3:21:35] But that was, that was it. So we willing to
[3:21:38] take a motion to adjourn.
[3:21:40] Adjourn anyone, anyone? Mr. Chair. Ms. Harper, please.
[3:21:46] I thought all the testimony was important by the way.
[3:21:49] But Mr. Chair, I'd like to make a motion to
[3:21:51] adjourn.
[3:21:53] Adjourn. All right. All those in favor.
[3:21:55] Aye. Aye. And we are adjourned at 10 22.
