appeal of this type to come

before the planning commission
[4:02]
since the 2021 zoning Code
[4:02]
amendments signed this review

[4:52]
standards that the development
[4:54]

Under the city's
[5:03]
non-residential design
[5:04]
standards, large commercial
[5:05]
buildings must include among
[5:06]
other elements, horizontal
[5:09]
facade, articulation These are
[5:10]
perpendicular offsets intended
[5:12]
to reduce long, flat exterior
[5:13]
walls and introduce a visual
[5:16]
interest in building design.
[5:17]
The ordinance establishes 3
[5:17]
main requirements when it
[5:18]
comes to horizontally.

Articulation. There's a
[5:22]
maximum distance, a walk and
[5:23]
run before an offset is
[5:25]
required. Each offset must be
[5:26]
at least a certain death based
[5:29]
on the building's height. Off

These requirements are adopted
[5:36]
by the city to help prevent
[5:38]
overly monolithic commercial

structures and to reinforce

applicant shows the codes
[5:49]
required offset depth at the
[5:49]
top and the proposed depth at
[5:53]
the bottom. The building needs

depth is less than required.

But the slide summarizes how

the proposed showroom facade

compares to the articulation

[6:15]
applicant provides offsets at
[6:15]
the appropriate intervals and
[6:16]

that does not comply as the
[6:23]
minimum offset depth. The

ordinance requires an offset
[6:25]
death based on 15% of the

provides a shallower depth.

This appeal solely focuses on
[6:35]
the difference in that death
[6:36]

the appeal to allow an offset
[6:45]
depth of one foot, 6 inches in
[6:46]
place of the required 3 foot,

to me all other articulation
[6:52]
standards and the reduced
[6:53]
still supports the ordinance
[6:54]
is a 10 intend and the
[6:58]
dealerships brand design. In

shallower offset does not
[7:01]
appear to affect the
[7:04]
building's visual character.

The request concerns only

offset death and appears to

Approval of this rezoning
[16:14]
request would legalize the
[16:15]
manufactured homes that have
[16:18]
been recently placed on the
[16:19]
property and allow their
[16:22]
continued permitting. A denial
[16:23]
of the request would require
[16:23]
the removal of the
[16:28]
manufactured homes. The
[16:29]
request would not be
[16:31]
consistent with following
[16:35]
actions of Envision New
[16:36]
Braunfels Action. 1.5, which
[16:38]
is promote economic centers by
[16:41]
ensuring adequate parking for
[16:44]
people visiting businesses,
[16:46]
restaurants and shops action.
[16:47]
1.8 is to concentrate future
[16:49]
investment in industry and
[16:53]
employment centers along the
[16:54]
I-35 corridor and action. 1.1

status. So we had to kind of

backtrack you know, notify the
[24:21]
applicant in writing that the
[24:22]
previous permits that were

issued were issued

incorrectly. And that's how we
[24:28]
are here today.

discuss our plan to replace

manufactured homes. It's under
[26:57]
trees. Texas Hill Country. Our
[26:57]
intent for the parcel is not
[26:58]
to change anything in the
[27:01]
approximate 11 acre parcel,
[27:01]
rather, just replace
[27:02]
manufactured homes that were
[27:04]
previously on the property. At
[27:05]
this time, we have no plans to
[27:06]
add any new development that
[27:08]
was not previously
[27:09]
established. Our goal is just
[27:10]
to restore previous used the
[27:14]
sites. As a real estate
[27:14]
investment trust. We will
[27:15]
maintain ownership of the land
[27:16]
regardless of the individual
[27:18]
homes located on the property.
[27:19]
Our preferred approach is to
[27:21]
enter these homes into our
[27:22]
home rental program that
[27:23]
provides a quality and
[27:25]
affordable living space while
[27:25]
maintaining consistent
[27:27]
ownership and management of
[27:28]
the property are home. Rental
[27:30]
program includes a formal
[27:31]
application and screening
[27:33]
process for prospective
[27:34]
occupants. This allows us to
[27:35]
evaluate applicants ensure
[27:38]
that the homes are occupied by
[27:38]
qualified individuals meters.
[27:42]
That was rental requirements.
[27:43]
We also performed annual
[27:45]
inspections to ensure units
[27:46]
are maintained and all
[27:47]
property standards are met.
[27:48]
Ultimately, our goal is to
[27:49]
responsibly maintain the
[27:50]
property, preserve its
[27:50]
character, replace homes
[27:52]
without introducing a new or
[27:52]
substantial different used to
[27:56]
the parcel. So I guess like
[27:58]
part of the what I would say,
[27:59]
part of the misconception
[28:00]
about this is that we want to
[28:01]
change the entire 11 acre
[28:04]
parcel. We do not. If you look
[28:05]
at the photo that we have,
[28:08]
this is an old photo and its
[28:09]
right off the second street
[28:10]
there. There's like 10 sites
[28:11]
right there to the right of
[28:14]
the Second Street. The mh
[28:15]
homes were there in the past.
[28:16]
We just want to we're put. We

put them back, right? It just

took a little bit longer than

sons Silver Star to a point

we've gone through some

changes corporate management

re-branding. So that's what

all the da's un names come

from. But we purchased it in
[29:34]
FEBRUARY 2016 285 sites and 52
[29:35]
vacation rentals. The family
[29:37]
focus property with indoor
[29:38]
outdoor pools, volleyball
[29:39]
courts, extensive events and
[29:41]
activities that we want to,
[29:41]
you know, should provide a
[29:44]
good time for our guests.

We're also committed to local
[29:46]
outreach and giving back. So

we host annual event with Camp

Quality usa can't quality

provides outdoor hospitality

camping for, you know,

families that are impacted by

children with cancer. So we

plan to replace the

manufactured homes are removed

from the property. We did not

order the homes until after we
[30:34]
had that meeting. Right? So we

thought there were no concerns
[30:39]
raised in that meeting we were
[30:40]
ok to order them because we're
[30:43]
replacing right. There was I
[30:44]
think some representatives
[30:46]
from net was at the and the
[30:47]
you in New Braunfels utilities
[30:49]
on the call. It was a team's
[30:54]

ahead and ordered In APRIL.

The homes began to arrive. We

got our first permits and I
[31:26]
think as mentioned, we got 3
[31:27]
permits. One on MAY 28th one
[31:28]
on JUNE 4th and one on JUNE
[31:31]
24th and then on JULY, the
[31:32]
permits revoked while we had
[31:36]
the other 7 in for review.
[31:37]
Right? So we were we were not
[31:38]
doing anything with the other
[31:38]
3 were waiting for the permits
[31:41]
to come in. We also had 4
[31:44]
applications on these already.
[31:45]
So we had to guess that we
[31:46]
were just waiting for the
[31:47]
final construction to be
[31:48]
completed, but we are ready to
[31:48]
move into these homes before
[31:51]
we got the revocation. We 4
[31:52]
locations to are denied to are
[31:56]
approved. So that we feel this
[31:57]
was due to a timing
[31:58]
technicality and not a
[31:58]
substantial violation. We
[32:00]
would have been within one
[32:01]
year, we would have been fine.
[32:02]
We would still had a
[32:02]
non-conforming use for one. We
[32:07]
remove them. This is the site
[32:08]
plan. So this these time that
[32:10]
we have here on the site's up
[32:14]
in the front of the park. You
[32:15]
know, that's the far end of
[32:15]
the park away from the
[32:17]
neighboring community in the
[32:19]
back. It's right off the road.

we love about these homes

compared to our views as we

right? Like we maintain the

standards, we maintain the

curb appeal the guest pulls in

with an rv. It could look 10
[33:05]
times worse than this. In
[33:07]
conclusion like our thought
[33:08]
process here is is really we
[33:08]
just want to replace what we
[33:11]
have these 10. We're not
[33:11]
looking to change our
[33:12]
business. We're not looking to
[33:14]
change the entire parcel. We
[33:15]
just want to be able to
[33:17]
replace the time that we have
[33:18]
and keep you and utilize that
[33:19]
and that we have already put
[33:20]
