[1:53] ification. Well, there is no reference.  Good evening everyone. Go ahead and call
[1:59] the regular planning and zoning commission  meeting for December 3rd, 2025 to order.
[2:07] Roll call. Kathy Bulan
[2:13] here. Capetta here. D Bernardo here. Hassan  here. Memory here. Wilsack here. Control is
[2:23] not here. We have a quorum. We have a quorum.  First item on the agenda is the approval of the
[2:34] minutes for the planning and zoning commission  meeting on October 1st, 2025. Are there any
[2:41] uh changes or corrections that are needed?  There's one correction that Kathy is going
[2:46] to add regarding my comment about the 50%  masonry being inappropriate for the village.
[2:58] And uh I'd like to entertain a motion to  modify the minutes as uh requested. Second.
[3:10] Roll call, please. Okay.
[3:15] Usually we don't do a roll call for that,  but we can do voice vote. That's fine.
[3:20] Okay. Voice. All in favor say I. I. I. I.  No opposed. All right. If they'll uh Kathy,
[3:30] if you'll amend the minutes and uh just make the  comment that was asked for. And then we we and
[3:36] then we would need a motion to approve the minutes  from the October 1st, 2025 planning and zoning
[3:42] commission meeting as modified. Sounds like a good  plan. Let's make uh anybody want to make a motion
[3:50] to I'll make the motion to approve the minutes  as modifi with modifications for that meeting.
[3:57] Second the motion. All in favor? I I any opposed?  Hearing none. Uh the minutes the motion carries.
[4:11] We have no unfinished business. Um so we have one  new business item. It's item 5A and that's for
[4:19] 3118 White Oak Lane, the Plat of Consolidation.  Rama, can you give us an overview? Good evening.
[4:28] The owner of the property at 3118 White Oak Lane,  it is requesting for the approval of a final plat
[4:36] consolidate two existing uh lots into one.  And the owner is here to answer any questions.
[4:47] If I could ask as a petitioner if you'll  just speak into the microphone and state
[4:51] your name and address. Hello, my name is Tim  Kim. I'm the owner of 3118 in White Oak Lane.
[5:01] Thank you. Go ahead.
[5:06] No, I think it's a pretty straightforward  request. The uh house is on lot one.
[5:11] We would like to consolidate the two  lots and build a pool on lot two.
[5:25] Is there currently um actually I see no member  from the public so there's probably no open it up
[5:31] to the commissioners. Any questions? Mr. Kim, do  do you live in the house? I do. Okay. Thank you.
[5:43] This really does seem straightforward. It's, you  know, he lives on one, he's going to consolidate
[5:48] it with his back lot. It's going to eliminate  a flag lot, which we're always more than
[5:52] willing to get rid of. Nobody's, nobody's  complaining. And when I looked at the map,
[5:58] nobody could complain. There's just there's  nothing that would be upsetting about this.
[6:02] The pool is going to back up to 31st Street. So  this this seems, you know, appropriate to me.
[6:14] Staff, were there any calls  or comments from the None?
[6:21] Any other commissioners have  anything to say? You know,
[6:26] I I do have one more thing. There was something  in the packet in the staff recommendation.
[6:34] It said somewhere it said something like it  appears to comply. Does that mean I just I
[6:47] didn't like that sentence. It just made me feel  like maybe yes, maybe no. Is there anything in
[6:52] here? I'm trying to find where it was. Is  there anything in here? It's on page six.
[6:58] Yeah. The proposal appears to comply with the  subdivision and zoning ordinance regulations.
[7:03] Is there anything in here that  appears not to comply? No. Okay.
[7:10] That was the only thing that  really caught my attention.
[7:16] Were there any comments from the  subdivision itself? Did they have any
[7:21] uh comment about it? Um, not that I can recall.
[7:30] If if anybody wants to make a motion and second  it. I'll make a motion to I don't like reading
[7:35] this thing, but I will make a motion to  approve the consolidation plat. I'll sec
[7:43] second the motion. Do we want to add according  to the final engineering review and approval and
[7:50] uh recording of the document by  village ar please? what Ken said.
[7:57] Eat Roco. D Bernardo. Nimry, yes. Capetta,  yes. Bulan, yes. Hassan, yes. Wilsack,
[8:06] yes. The motion carries. Uh would you advise  the U petitioner of what the next step is?
[8:16] This will be going to the next uh board  meeting on January 13th for approval.
[8:23] Great. Thank you so much. You're welcome.  Thank you. Good luck with the pool. [Applause]
[8:38] Uh Kathy Ramo, is there anything  upcoming for the future meeting?
[8:42] Uh I also wanted to update you regarding  the um the 714 enterprise which uh came
[8:49] to the planning and zoning commission  for the approval of an event space.
[8:52] So it did go to the board and uh it was  not approved. It was not approved. No.
[9:04] Were they uh going to revisit anything or is  it just uh No, they were just concerned about
[9:10] the president that it would set. uh because  it's an office buildings area and it's also
[9:15] in an O1 district. So they were concerned about  that and that's why they did not approve. No.
[9:25] And u we have uh one more uh project that's going  to go to the board for a preliminary board review
[9:32] that's uh on the 1900 spring, the northernmost lot  uh where uh it's being presented for a 13-story
[9:40] apartment building. And that will be on December  9th. Is that the former McDonald's property? Um,
[9:49] no. No. 1900. 1900 spring. It was the um  previously approved as the Butler to be
[9:57] called the Butler. Yes. Butler condominium.  Oh yeah. It was a 22tory condominium building
[10:01] originally. Correct. Correct. So that's  not happening now. That's not happening.
[10:05] But we have another proposal for a 13-story  apartment building for an apartment building,
[10:10] not a condo. Um likely to be converted probably.  Okay. Um but yeah. And do you anticipate that in
[10:19] the January meeting? Um that's in the December  9th. So that's just a preliminary board review
[10:24] and then they will uh refer it to the planning  and zoning commission. Then it'll have to undergo
[10:29] a plan development process. Thank you, Rama.  Any other upcoming issues? Nope. That's all.
[10:39] If nobody else has anything to say, I can we make  a Can I talk about old business for a second? I'm
[10:46] going to reiterate. Sure. Now I have something  to read that will go maybe verbatim into the
[10:53] minutes or close thereof. It is important to  consistently bring poor political agendas to
[11:00] light. The 50% masonry requirement of the  village board insists on being part of the
[11:06] newly adopted zoning ordinance is an overstep  of aesthetic control that has no place in local
[11:13] government. Oakbrook residential neighborhoods  and the community as a whole have always been
[11:18] at the forefront of tasteful development and  architecture. It is unreasonable to dictate
[11:24] a limited architectural style when so many good  American architectural styles exist without the
[11:30] use of masonry. Please remove this atrocious  constraint on creativity from our progressive
[11:37] yet conservative community. Thank you. Is  that better? Anybody else have any comments?
[11:47] I would say one thing. Um, some subdivisions go  far and uh above what the village requires. I
[11:56] mean, in my particular subdivision, they  dictate what kind of garage door you can
[12:01] have. They dictate uh what kind of roof you  can have. It's it's either got to be slate,
[12:06] tile, or cedar shake. So, in that light, I just  want to bring up some of these in some of these
[12:13] subdivisions. It isn't the village, it's the  individual subdivisions, architectural com
[12:17] committee, not what uh Jeff was speaking to,  but I just wanted to mention that that some
[12:21] of these subdivisions even go far and beyond  what the village does, but that's an HOA issue,
[12:28] which is not a government body. I'm speaking about  a government body, and it's inappropriate for a
[12:34] government body to have that much aesthetic  control. It didn't work in Oakbrook Mall.
[12:40] It hasn't worked elsewhere. When Oakbrook Mall  was created, if they had had these constraints,
[12:45] who knows what we would have ended up with. And in  turn, it's one of the best malls in the country.
[12:53] There's a lot of architects and designers  that have spoke out against this requirement,
[12:59] and there's statistics to show that this is a  bad requirement based on architectural styles.
[13:07] You can have some pretty atrocious  looking things that are all masonry.
[13:18] If there are no additional comments, uh, I'd  entertain a motion to adjourn the meeting.
[13:22] So moved. Second the meet. Second motion.  A motion has been made and seconded uh to
[13:28] adjourn the meeting. May I have a voice vote? All  in favor? I. Any oppose? Happy holidays. Day one.
