All right. Good evening everyone. We'll
[0:06]
call the Ovette City Council meeting on
[0:08]
August 25th, 2026 to order. Please, can
[0:11]
we please have roll call?
[0:13]
>> Mayor Lewis
[0:14]
>> here.
[0:14]
>> Chairman Prom Pashan Helman
[0:16]
>> here.
[0:16]
>> Council member Clark
[0:18]
>> here.
[0:18]
>> Council member Solomonov
[0:19]
>> here.
[0:20]
>> Council member Durgel
[0:21]
>> here.
[0:22]
>> All righty. Uh, are there any
[0:24]
communications to share at this time?
[0:26]
>> I have no written communications. All
[0:28]
right, we'll move on to item number
[0:30]
three, city manager report, please.
[0:32]
>> Good evening.
[0:35]
Let me
[0:40]
share my screen.
[0:48]
» We were late, so sorry.
[0:53]
>> All right. Um, good evening everyone.
[0:57]
Um, so, um, I have a number of upcoming
[0:59]
events. We are winding up summer and,
[1:03]
uh, fall is always super busy for us.
[1:06]
So, we encourage everybody to come out
[1:08]
to Paris Baguette, um, August 31st,
[1:12]
which is next Monday between 8 and 10:00
[1:15]
a.m. in the morning to meet with one of
[1:18]
our, uh, police officers. So, coffee
[1:20]
with a cop uh, will be during that time.
[1:23]
There will be coffee and some limited
[1:25]
free pastries. So, if you have not had a
[1:27]
chance to uh try a pastry at Paris
[1:31]
Baguette, this would be a great
[1:32]
opportunity to do that, as well as uh
[1:35]
come talk to one of Olivet's finests.
[1:40]
Uh and September 15th is Night Out. So,
[1:44]
this is an opportunity for you and your
[1:46]
neighbors to gather to have a block
[1:49]
party and then if you sign up uh some
[1:52]
oliveette city officials, including the
[1:56]
uh police officers, the fire department,
[1:58]
you might get the fire truck or the
[2:00]
ambulance uh to come and to stop by and
[2:02]
to say hello um meet and greet with uh
[2:05]
our oliveette community. So, um we would
[2:08]
encourage all of the neighbors to go
[2:10]
ahead and sign up. If you have
[2:12]
questions, uh, please reach out to
[2:14]
Lieutenant Selzer in the police
[2:16]
department.
[2:20]
And every year we do the Battle of the
[2:23]
Badges, which is a competition between
[2:26]
the fire department and the police
[2:27]
department. Uh, it is essentially a
[2:30]
blood drive for the American Red Cross.
[2:33]
And both our fire department and our
[2:36]
police department have compelling
[2:38]
stories, personal stories about
[2:41]
grandchildren uh and their need for
[2:44]
blood, hence the blood drive. And so
[2:46]
individuals who come and donate blood
[2:49]
are given an opportunity to cast a vote
[2:52]
for either the police department or the
[2:54]
fire department. Um and at the you know
[2:57]
at the end of the drive the winning
[3:00]
department receives some gift from the
[3:04]
losing department. Um the fire
[3:07]
department has more years that they have
[3:09]
won uh than the police department. So
[3:12]
come out donate for a good cause to the
[3:14]
American cross and then choose which
[3:17]
public safety group is your favorite.
[3:22]
Trivia night is being hosted at Five
[3:25]
Oaks on September 18th. There are nine
[3:28]
tables left, so bring your friends uh
[3:31]
for a table of eight. The theme this
[3:33]
year is 90s and 2000s sitcoms, so there
[3:36]
should be something for everyone. Um
[3:40]
register for your table and we hope to
[3:42]
see you there. I think there's at least
[3:44]
one staff table. Um and I think a couple
[3:48]
other folks have gotten um tables for
[3:50]
the trivia night.
[3:53]
The great Olivet cleanout is happening
[3:55]
again. It is at Five Oaks on Warson.
[3:58]
This is a change from um Stacy Park. So
[4:01]
in years past it's been at Stacy Park.
[4:03]
This year it is at Five Oaks on Warson.
[4:05]
It's on the lower parking lot. So this
[4:08]
is an opportunity for residents to
[4:11]
either have documents shredded if you
[4:14]
have some of those in your office or
[4:16]
your home office. This is not for um a
[4:19]
business cleanout, but if you do have a
[4:21]
home office and you have documents that
[4:23]
you would like shredded or if you have
[4:25]
any um e-waste, so almost anything with
[4:28]
a cord, uh they will take and uh recycle
[4:31]
those for you.
[4:32]
>> Do you know if it's still a drive-thru?
[4:34]
>> Yes, as far as I know, it is still a
[4:35]
drive-thru. And so there is a very
[4:37]
specific route for you to uh to come
[4:40]
through. They will take the items um out
[4:42]
of your vehicle. It's very easy. you
[4:45]
should be um in and out in not much time
[4:47]
at all. So, and we did receive the
[4:49]
grant. So, we've signed off on that and
[4:51]
we did receive the grant for this.
[4:56]
» The fall and winter activity guide is
[4:58]
out. These are all of the recreational
[5:01]
programs that the city is offering
[5:03]
through the fall and the winter. We have
[5:05]
some hard copies out in the lobby if you
[5:07]
would like. Uh it's also on the city's
[5:09]
website and should be hitting should
[5:12]
actually be in homes already. So, we
[5:14]
would encourage you to check those out.
[5:15]
We have activities for all ages.
[5:19]
And then I just always encourage
[5:21]
everyone to sign up for weekly, which is
[5:23]
our weekly e newswsletter.
[5:27]
And then just some general city updates.
[5:31]
Um, our new finance director, Julia
[5:34]
Gwyn, starts tomorrow. So, we probably
[5:38]
uh in September, we will bringing be
[5:39]
bringing her to council to to introduce
[5:41]
her. Uh we are recruiting for another
[5:45]
police officer. Uh two weeks ago I told
[5:48]
you that we had made conditional officer
[5:51]
offers to two individuals. Uh one of
[5:54]
them accepted. They are in the
[5:55]
pre-employment screening phase. Um the
[5:58]
other candidate decided that uh he was
[6:00]
going to remain at his uh his place of
[6:02]
employment. Um and then the follow-up
[6:05]
from the Hicks Carter Hicks the
[6:07]
employment engagement committee is
[6:09]
meeting this week. They're going to
[6:10]
start working on um employee recognition
[6:14]
and then um I have asked Hicks Carter
[6:17]
Hicks to craft a proposal to help the
[6:20]
city with an internal communications
[6:22]
plan. uh one of the uh comments and
[6:26]
areas of deficiency on the survey was
[6:29]
communication and that's a pretty broad
[6:31]
um topic and so I do think working with
[6:34]
them to create and improve some of our
[6:37]
internal communications is a good start
[6:39]
to making headway on that uh survey
[6:42]
result. Are they going to talk to
[6:44]
employees to understand kind of like
[6:46]
what I I know they have the survey
[6:48]
results, but to understand like where
[6:49]
they saw gaps in communication. Will
[6:51]
they have those conversations before
[6:52]
they craft?
[6:53]
>> They're going to craft me a proposal to
[6:55]
do it. So like we'll get a scope of
[6:56]
work.
[6:57]
>> Oh, proposal to even reach out and talk
[6:58]
to people. Gotcha.
[6:59]
>> Correct. Not build a plan and then say
[7:01]
Okay. Correct. Gotcha.
[7:05]
» Uh and then here are your upcoming
[7:07]
meeting dates. And so with that, I can
[7:09]
answer any council questions.
[7:14]
No. All right. Thank you very much.
[7:18]
>> All right. We are going to move on to
[7:20]
staff reports, please, then.
[7:21]
>> All right. Uh, starting with fire
[7:23]
department. So, we often talk about the
[7:24]
fire department and their um
[7:27]
firefighting training and their um calls
[7:31]
for fire. But I thought this month we
[7:33]
might just kind of highlight the fact
[7:35]
that they do run an ambulance and that
[7:39]
takes a a good amount of their time.
[7:41]
They actually run quite a few medical
[7:43]
calls. So just
[7:46]
uh looking at this chart, this is on
[7:48]
average about five calls a day that
[7:51]
they're running. Um, as you can see,
[7:53]
they spend a lot of time in the city of
[7:55]
Alvette, but we are also contracted for
[7:58]
um, fire service, fire and EMS service
[8:01]
for the pocket of uninccorporated that's
[8:04]
just north of us on Dealman. So, we
[8:07]
respond there. St. Louis County
[8:09]
contracts with us, pays us to provide
[8:11]
that service to them. And then we do get
[8:13]
called out of town um often to um Creve
[8:17]
Corps or U City um or certain things on
[8:21]
the highway we might get called out for both police and or for EMS and fire
[8:28]
parks and wreck. Uh we just finished
[8:31]
earlier this month uh municipals. So,
[8:34]
municipals is this uh part of this photo
[8:37]
right here is h offered every other year
[8:41]
and it is a camp that highlights the
[8:45]
city departments. So, the police
[8:47]
department had a day and brought out the
[8:51]
mounted patrol from St. Charles County,
[8:54]
brought out some therapy dogs, brought
[8:57]
out some um other fun police things. The
[9:02]
fire department had a day had an half a
[9:05]
day and they got to go down the slide
[9:06]
and the fire department because we have
[9:08]
a slide and not a pole and they got to
[9:11]
do some other fun uh firefighter things.
[9:14]
This particular picture we had an
[9:16]
opportunity to partner with Emerson who
[9:18]
is a business here in the city of
[9:20]
Alvette and they came and did uh science
[9:24]
things with uh with the kids. So they
[9:26]
did the egg drop project um learning
[9:29]
about gravity and um force distribution
[9:32]
and things like that. And so the kids
[9:33]
had a good time. And then the other
[9:35]
thing with uh the parks department, this
[9:38]
happens to be the segment uh one of the
[9:40]
new segments of the Centennial Greenway.
[9:43]
So now that that greenway has been in
[9:45]
for more than one year, maintenance
[9:47]
falls to the city. And so this is our um
[9:50]
horiculturalist
[9:52]
and our park staff who are clearing um
[9:55]
clearing the fence lines uh along along
[9:58]
that particular section of the trail
[10:03]
planning department. So these are fiscal
[10:05]
year to date. So from June of 25 through
[10:09]
July uh no I'm sorry July of 25 through
[10:12]
June of this year. So, as you can see,
[10:15]
um they were pretty consistent. Uh lots
[10:19]
of people got their roof replaced um in
[10:22]
this particular fiscal year, most likely
[10:24]
from uh the storm that came through in
[10:27]
um in this in May of last year. Um and
[10:31]
we see a lot of um tenant finishes. So,
[10:34]
this could be like reinvestment by
[10:37]
businesses or new businesses coming in
[10:39]
or updates to businesses. Uh so this is
[10:42]
a good sign and what has um been keeping
[10:45]
one aspect of what has been keeping um
[10:48]
Carlos and his staff very busy over the
[10:51]
course of the year.
[10:54]
The police department uh officer Bagsby,
[10:58]
this is Officer Bagsby here. He went to
[11:00]
Aphina Healthc Care's event um talking
[11:04]
about gun safety in particular uh
[11:06]
gunlocks. The Alvette Police Department
[11:09]
donated 50 gunlocks for this particular
[11:11]
event. So, this is just a reminder that
[11:14]
our police department has gunlocks
[11:17]
available to anyone in the community who
[11:19]
is interested. There's no cost. Uh, and
[11:22]
they are available Monday through
[11:23]
Friday, normal business hours. Just go
[11:26]
see the records clerk um here at city
[11:28]
center uh if that's something that you
[11:30]
are interested.
[11:34]
And then public works. Um, if you have
[11:37]
driven at Price, North Price and Olive,
[11:41]
you have seen a lot of work there. Uh,
[11:43]
this happens to be the contractor. They
[11:46]
did some paving overnight. They did a
[11:49]
really um a really nice job on that
[11:52]
work. The work here at the 9201 Olive
[11:56]
site where um the CBDraton building was,
[12:02]
there has been a delay. It is not a
[12:04]
delay related to the city.
[12:07]
It is a delay because a a pipe wasn't
[12:10]
where wasn't as deep as we thought it
[12:12]
was.
[12:14]
That required some changes to storm
[12:16]
water drains that MDOT took a long time
[12:18]
trying to figure out what they wanted.
[12:20]
Um but work is moving forward. In fact,
[12:23]
Spire was on site today moving the gas
[12:25]
line that needed to be moved in order to
[12:27]
accommodate um the storm drain. So,
[12:29]
we're a little bit behind on where we
[12:32]
thought we would be to close out this
[12:33]
project. Um, but it is related to
[12:37]
situations beyond our control. And then
[12:39]
we do have some good news. So, as you
[12:42]
might recall, we um put in for a grant
[12:45]
for
[12:46]
um reconstruction of North Price between
[12:50]
Delmare and Old Bonum um an STPS grant.
[12:54]
And while we have not received the grant
[12:56]
yet, we are on the recommended list. So,
[13:01]
um, East Swiss Gateway meets later this
[13:04]
week to review that recommended list and
[13:06]
hopefully approve that list and
[13:08]
hopefully we will be approved so that we
[13:12]
can um move forward
[13:15]
with reconstruction of that section of
[13:17]
North Price. It is a multi-year project.
[13:20]
So there will be design time and
[13:22]
right-of-way acquisition time and then
[13:24]
construction time. So it's looking
[13:26]
probably a 3 to four year long u process
[13:31]
and that is all I have unless you have
[13:33]
any additional questions for me.
[13:36]
>> Questions? Pencil? No, it's very
[13:39]
thorough. Thank you very much.
[13:40]
>> Thank you.
[13:41]
>> All right, we will move on to monthly
[13:44]
financial reports, please.
[14:04]
All right, I am filling in for our
[14:06]
interim finance director who um she had
[14:10]
a previously scheduled event this
[14:13]
evening. So um you are seeing the report
[14:17]
for the second month of the year. Um
[14:22]
as you can see we are we are on track.
[14:25]
Um general revenue started the year
[14:28]
above expectations by about $37,000.
[14:33]
General fund expenditures are also above
[14:35]
expectations. Um this is normal. We have
[14:38]
a variety of um like all of our
[14:41]
insuranceances are due. So workers comp,
[14:44]
liability, property, all of that is due
[14:47]
um at the very beginning of the year. So
[14:50]
um that's not unexpected.
[14:53]
Um it does result in an unfavorable
[14:55]
variance. But again, we are um this is
[14:58]
the July financial report. So at this
[15:00]
point, we were one month into uh into
[15:03]
the into the into the year.
[15:06]
Um it is not unusual for property taxes
[15:09]
to be slow. Again, we get those in um
[15:12]
December and January.
[15:15]
And um parks and wreck revenues started
[15:19]
the year mixed um and they do um they
[15:22]
exceeded budget projections due to high
[15:24]
soccer enrollments. So soccer is very popular. And then the chart of our
[15:29]
month, this is our monthly uh 1% sales
[15:33]
tax, which we took out a bunch of the
[15:35]
noise. If you might remember past
[15:37]
graphs, there were a lot of lines there.
[15:40]
So this is just the last two years. So
[15:43]
fiscal 25, fiscal 26 and then where we
[15:46]
are um for 27. So we are of course
[15:50]
higher than 25 and a little bit below um
[15:53]
of 26.
[15:55]
So if you have any questions, I'm happy
[15:56]
to answer those for you.
[15:58]
>> We anticipate a drop off or I don't
[15:59]
remember what the drop off. Yeah,
[16:02]
>> we don't anticipate the drop off, but I
[16:05]
will say sales tax tends to be cyclical.
[16:09]
So, anything that we uh receive in
[16:12]
September is actually from people buying
[16:15]
things in July because it's always a
[16:17]
two-month lag.
[16:18]
>> Um, so
[16:20]
we could it could also be um July is a
[16:27]
is half the year and a quarter of the
[16:29]
year. And so there are certain entities
[16:32]
that only report sales tax half of the
[16:34]
year, half of the way through the year
[16:36]
and a quarter of the way through the
[16:37]
year. So that um drop off could have
[16:40]
been somebody missed the cut off. Um so
[16:44]
there are a variety of of factors that
[16:47]
could um account for that.
[16:50]
>> But it bounced back up bounced back up.
[16:52]
>> Correct. Yeah.
[16:53]
>> Correct. particularly if it's um they
[16:56]
just miss the cut off because then you
[16:58]
get to you know you get it the next
[17:00]
month. So
[17:04]
» that's all I have unless you have
[17:05]
anything else.
[17:05]
>> No. Any questions?
[17:07]
>> No.
[17:07]
>> Okay.
[17:08]
>> All right. Thank you. All right. We're
[17:10]
going to move on to city council liaison
[17:12]
reports for each council member to give
[17:14]
an update of kind of activities they've
[17:15]
been up to. Uh council member Clark,
[17:18]
>> I have no reports at this time. Council
[17:21]
member Jurgal.
[17:22]
>> Uh we had a parks meeting. Um most of
[17:25]
the meeting was the installation of two
[17:27]
new commissioners. So uh was kind of
[17:30]
orient or orienting them to the process.
[17:34]
And it was great going through it again
[17:35]
because u uh they went over all of you
[17:38]
know of city government and uh I know I
[17:42]
was given the training beforehand but
[17:44]
when you hear it the second time it
[17:45]
sinks in a little bit more. So that's
[17:48]
always good. Um, one other thing that's
[17:50]
coming up with uh the parks is going to
[17:52]
be the review of the Indian Meadows uh
[17:55]
pavilions. So, that that's on their
[17:57]
agenda and uh should be moving along.
[18:01]
>> Great. Uh, Council Member Sono.
[18:05]
>> Uh, no report for me this evening. I do
[18:06]
have an EDC meeting next Monday.
[18:10]
>> It's on.
[18:11]
>> It's
[18:14]
Oh, the light is hitting my mistake.
[18:15]
It's my first day. All right. uh
[18:17]
chairman promis
[18:20]
I attended the PCDC meeting on August
[18:22]
20th and at that meeting an outdoor uh
[18:26]
metal canopy was approved for the brass
[18:30]
tap to help extend the seasons for them
[18:33]
um and extend some seating outside
[18:36]
during the wintertime months. So, that
[18:38]
was approved. Um, and that the roof of
[18:41]
that structure will stay throughout the
[18:44]
year, but then there's a wall kind of
[18:46]
enclosure that's temporary for the uh
[18:50]
months of November through Feb fe
[18:52]
November through February.
[18:55]
Um, we also discussed continued
[18:57]
discussing a text amendment for coin
[19:00]
operated laundromats.
[19:03]
Um and a new single family home was
[19:06]
approved for 1123 Hilltop
[19:10]
and uh also had discussion on a text
[19:12]
amendment to allow for other warehousing
[19:15]
and storage that would be specifically
[19:18]
for car condominiums.
[19:21]
So, these are uh spaces that would be um
[19:27]
condominiums that would be sold to
[19:29]
individuals uh who would likely store
[19:32]
their luxury cars, potentially
[19:35]
um RVs and boats. Um but they would be
[19:39]
individual condominiums. So, kind of a
[19:43]
new thing um coming before the
[19:47]
commission and and so it's um at the
[19:49]
discussion stage at this point. Um and
[19:53]
that's all. Thank you.
[19:54]
>> Great. Uh a couple of things. I had the
[19:57]
privilege of speaking uh chamber of
[20:00]
commerce uh for the state of the city
[20:01]
and it's an opportunity where I get to
[20:03]
go and give a state of the city of how
[20:05]
we're doing from an economic and
[20:07]
residential and development and just how
[20:09]
we're overall you know what is all of
[20:11]
that and get to brag on all of that
[20:13]
which was very exciting and a big thank
[20:15]
you to staff Kiana and uh others for
[20:18]
helping you know draft things put
[20:20]
together a great slideshow and it was
[20:22]
you know really wellreceived and get and
[20:23]
get to meet some people there so that
[20:24]
was really nice and then today I
[20:26]
attended the Olivet housing authority uh
[20:28]
where they had a few procedural items
[20:30]
reviewing the financial audit reports
[20:32]
approving other things talking about
[20:33]
next steps on everything around some of
[20:35]
the policies we're moving forward on the
[20:37]
housing. So that that is progressing as
[20:39]
well. Um and then um yeah those were
[20:44]
things that I got to attend. So uh we'll
[20:47]
move on to item seven items from council
[20:49]
members. So, a chance for us just if
[20:51]
we've been hearing things that you want
[20:53]
to bring up for a future topic, we won't
[20:54]
go deep into them now. And uh just a
[20:57]
open forum.
[21:00]
>> Nope.
[21:01]
>> Nothing for me.
[21:01]
>> All right. No,
[21:04]
>> nothing for me.
[21:05]
either. The only things
[21:07]
I'll mention um since not everyone
[21:09]
probably was able to attend previous
[21:10]
meetings we've had and since I see a lot
[21:12]
of uh speakers here which is going to be
[21:13]
great is we did at a previous work
[21:16]
session a few weeks ago discuss the
[21:17]
Indian Meadows Pavilion and as uh
[21:19]
council member Joel mentioned that's
[21:21]
going to come before parks and wreck
[21:22]
where they're going to we asked to go
[21:24]
back to their ask for their assessment
[21:26]
and then it'll come back to the council
[21:27]
at that point um and we'd given the
[21:30]
direction to look at what it would take
[21:31]
to remove and what their thoughts were
[21:33]
and then uh we'll get their feedback on
[21:35]
that. uh previous meeting we'd obviously
[21:37]
discussed block cameras with the uh
[21:39]
chief of police and so that will be on a
[21:41]
future agenda so just calling that out
[21:43]
as well as the NIT policy will be on a
[21:45]
future uh agenda in the future as well
[21:48]
uh and then obvious
[21:52]
uh I imagine people here to speak as
[21:54]
well and so appreciated that we had
[21:56]
committed ID committed back that we're
[21:58]
going to meet with our legal team to
[21:59]
understand what options all of it has
[22:00]
because it is a unique situation and
[22:02]
then uh happy to meet with the concerned
[22:04]
citizens themselves and any council are
[22:06]
welcome to join me to want to hear
[22:07]
everyone's you know concerns in person
[22:09]
and understand everything and then after
[22:11]
that we'll take whatever the appropriate
[22:14]
actions that we can and don't know what
[22:16]
those are right now can't promise
[22:17]
anything but you know want to hear from
[22:19]
everyone and then we'll we'll see what
[22:20]
comes of that so all right uh we're
[22:23]
going to move on to hearing from
[22:25]
citizens so this is a portion of the
[22:26]
agenda where anyone present in person or
[22:28]
virtually may address the city council
[22:30]
regarding any topic including those
[22:32]
later in the agenda each speaker is
[22:34]
allowed up three minutes to address the
[22:35]
mayor and city council. Hearing from
[22:38]
citizens is designed for councils to
[22:39]
receive feedback rather than for a
[22:41]
direct dialogue. We will take speakers
[22:43]
in person first followed by any online.
[22:45]
If you are in person, please complete a
[22:47]
speaker card and give it to the clerk.
[22:48]
If you've already given your card to the
[22:49]
clerk, we will take you in the order
[22:52]
submitted on your card. If you are
[22:54]
online, wish to speak, please use the
[22:55]
raise your hand feature and you will be
[22:57]
added as a speaker. For all speakers, we
[22:59]
ask that you state your name and address
[23:01]
for the record prior to leaving the
[23:03]
remarks and that you keep the three
[23:05]
minutes and just so for the equity for
[23:08]
everyone. So, uh, first are Nancy and
[23:10]
Bob Martin, please.
[23:17]
And if you don't mind turning on the
[23:18]
mic, please.
[23:21]
>> Yep.
[23:23]
Perfect.
[23:24]
>> Um, good evening. My name is Bob Martin.
[23:28]
Nancy Martin
[23:29]
>> and we live at 39 Brford. Um, last week
[23:33]
we sent all you guys an email regarding
[23:35]
uh AZZ and a Missouri uh state statute.
[23:40]
Uh, this is concerning AZ galvanizing.
[23:42]
Um, thank you Mr. Mayor for responding.
[23:45]
>> Yes.
[23:46]
>> Um, following are excer ex excuse me
[23:48]
excerpts from the Missouri state chapter
[23:50]
220 nuisance. nuisances. A nuisance is
[23:54]
any act done or committed or suffered to
[23:56]
be done, committed by any person or any
[23:59]
substance or thing kept, maintained,
[24:01]
placed or found in any public or private
[24:03]
property that is injurous to the public
[24:05]
health, safety or welfare. are to permit
[24:08]
premises to become unsightly,
[24:09]
unsanitary, or obnoxious or obl to the
[24:14]
vicini to the vicinity or offensive to
[24:16]
the senses of users of the public way
[24:19]
abudding the premises that depreciates
[24:21]
the enjoyment and the use of the
[24:23]
property in the immediate vicinity to
[24:26]
such an extent that it is harmful to the
[24:28]
community in which the property is
[24:30]
situated or such a condition exists. AZZ
[24:34]
Galvanizing fits every one of these
[24:35]
definitions of a nuisance. It's zoned
[24:38]
light industrial, but it's expanded
[24:39]
several times over the years. It's not
[24:42]
light industrial anymore. We are asking
[24:44]
Alvette to protect its citizens from
[24:46]
this nuisance and use statute title 7
[24:50]
cities, towns, and villages chapter 71.7
[24:54]
I'm sorry 71.780
[24:56]
nuisances expensive suppression how paid
[25:00]
the noise and toxic emissions are
[25:03]
unbearable and hazardous to our
[25:05]
neighbors health and quality of life and
[25:09]
ours. Uh, we are sleeping in our bedroom
[25:12]
that faces away from ACZ because we
[25:14]
can't sleep in our master bedroom
[25:16]
anymore from the noise. We can't enjoy
[25:18]
our beautiful yard. We've lived in
[25:20]
Olivet for 32 years. It's home. Um,
[25:23]
>> please help us.
[25:26]
Um, they're getting worse and worse.
[25:30]
And we're up on Brford High where the
[25:33]
noise really hits us, but our neighbors
[25:35]
in Indian Meadows are just getting
[25:37]
creamed. They're getting gassed. It's
[25:39]
terrible. But thank you very much for
[25:41]
coming. Really appreciate it.
[25:42]
>> Thank you.
[25:46]
» All right. Uh moving on. Uh Jenny
[25:49]
Littleton.
[26:00]
Hi, my name is Jenny Littleton. I live
[26:02]
at 9639 Haron Drive. I just want to ask
[26:06]
my city council if they would please
[26:07]
support and help all of the residents
[26:10]
deal with this do's a galvanizing.
[26:13]
It's to the point where my son who's
[26:16]
seven, he's beginning to have temper
[26:18]
tantrums because he has a trampoline, a
[26:22]
basketball hoop, a soccer net that now
[26:25]
he can't play because when he begins to
[26:28]
play, I have to make him come in. And so
[26:31]
now he's getting upset, stumping yelling
[26:35]
in the house. What's the purpose of me
[26:37]
having this if I can't play? When are
[26:39]
they going to move that company? He's
[26:40]
seven years old. This is the point where
[26:45]
he doesn't have temper tantrums. Now
[26:48]
he's having them because he's not
[26:49]
getting to play outside. And this was
[26:52]
for the summer. So, I had to make fun
[26:55]
activities in my basement. So, I mean,
[26:58]
now the children, it's to the point
[27:00]
where I'm asking the kids and my
[27:02]
subdivision, you you guys got to go home
[27:04]
now. You can't play here. Can we come
[27:05]
back when the smoke is gone? Yes, you
[27:07]
can come back. So, now the kids, it's
[27:10]
just getting to be too much. And then
[27:12]
also, I'm I know you brought up about
[27:14]
you're going to bring it up with the
[27:15]
parks and you guys are going to redisuss
[27:17]
about the pavilion. Please move that
[27:20]
pavilion. There's so much going on that
[27:22]
my son is seven. He said, "There's
[27:24]
always something going on over here at
[27:27]
this pavilion. Problems every day. He's
[27:31]
seven. There was a time he didn't know
[27:32]
anything about that. Now he's seven."
[27:35]
And he's saying these things. And one of
[27:37]
the neighbors, she couldn't be here
[27:38]
today. She did ask me, "Until you guys
[27:40]
decide about how you're going to move
[27:43]
it, would you please at least move the
[27:45]
tables underneath the pavilion while you
[27:47]
guys are trying to figure out how you're
[27:49]
going to move that pavilion?" So until
[27:52]
you have a due date when you're going to
[27:54]
move it, could you please at least move
[27:55]
the tables? Cuz a lot of that buffoonery
[27:58]
that happens in the morning, afternoon,
[28:00]
and night, they won't have anywhere to
[28:02]
sit and lay and do all of that extra
[28:05]
activity that's unwanted and that we
[28:07]
don't need. So I just wanted to ask you
[28:10]
guys, would you please bless our
[28:11]
community to help all the residents
[28:13]
dealing with a galvanizing and the
[28:15]
nuisance unwanted pavilion, please?
[28:18]
Thank you so much. Thank you very much
[28:20]
for coming.
[28:23]
All right.
[28:26]
Uh Willamina Shackleford, please.
[28:34]
» Good evening.
[28:35]
>> Willamina Shackle for 9656 here on
[28:38]
first. I'm in agreement with Nancy and
[28:40]
Bob. It is horrible and re lately it's
[28:44]
just roars so loud. 3:00 am, four
[28:48]
o'clock. It wakes you up and then you
[28:49]
can't go back to sleep. They'll turn it
[28:51]
off or turn it down maybe about 7:30, I
[28:54]
guess, when they figure people or
[28:55]
whatever's going on. But it's just been
[28:57]
ridiculous. Just ridiculous. And we
[28:59]
haven't really said a lot because, you
[29:02]
know, that there were attorneys working
[29:03]
on it. So, you know, we want to continue
[29:05]
that. But we need the help of the city.
[29:07]
So, I hope that that uh state statute
[29:09]
will help. I got a couple other things
[29:11]
real quick. Um, one is our park and I
[29:16]
know when they redid the the uh the
[29:19]
trail, but they didn't do anything to
[29:21]
the park. Is that on Olivet? It's kind
[29:23]
of bumpy. You know, it's the asphalt,
[29:25]
the black that's in the actual park in
[29:28]
Indian Meadows. So, it's kind of crumbly
[29:30]
in some areas. So, the other concern is
[29:33]
we have two spaces in uh the new park
[29:37]
area that when it we get heavy rain,
[29:39]
it's full of water. So the kids go out
[29:41]
there and play. Then they muddy muddy up
[29:43]
everything which is by the water park.
[29:46]
And then the other area is by the
[29:48]
playground area around one of the trees
[29:50]
is set real low so if we can get that
[29:52]
build back up so that the water won't
[29:54]
set there. Um the other one is the
[29:57]
trees. We have a lot of dead trees. I
[29:59]
know they've cut some down but when we
[30:01]
get any kind of a rain or wind, I should
[30:03]
say wind, there's branches all over the
[30:06]
park. And I realize it's more than one
[30:08]
park. So sometimes it take them a while.
[30:10]
But then the kids are playing and you
[30:11]
got these big branches that are laying
[30:13]
all over the park trail. Uh, one more
[30:15]
thing. How chickens.
[30:19]
We got the chicken coupoops gone from
[30:21]
the side of the house, but there is a
[30:22]
pin. So, I've asked over and over about
[30:25]
an ordinance to be written so that I
[30:27]
don't care about the chickens, but they
[30:28]
need to be fenced in in the back of the
[30:30]
house and not in the very front.
[30:34]
This these chicken coops were on the
[30:36]
front on the side of the home. and I've
[30:37]
complained for a couple of years. And so
[30:40]
it's my understanding that all of that
[30:42]
has been washed aside. I don't know if
[30:44]
anybody knows if that is true, but I'm
[30:46]
going to I'm going to research it that
[30:48]
that's over. The governor was is the one
[30:50]
that uh approved that, but it's my
[30:54]
understanding that they've been fighting
[30:55]
it. So, I don't know. But if not, can we
[30:59]
get an ordinance where they are are
[31:00]
fenced in in the back? And then I think
[31:04]
that's it. Um Oh. We have another area
[31:08]
in our subdivision and I've complained
[31:09]
about it several times. We need some
[31:11]
help uh with uh enforcement of uh
[31:16]
property upkeep. So, we got a lot of
[31:18]
issues with that, but I understand we
[31:20]
only have one part-time person
[31:23]
and for this city, we could probably use
[31:25]
one or two to just do property upkeep
[31:29]
for the for uh all of the the entire uh
[31:34]
et
[31:38]
Bruce is here. Brand view on the corner
[31:40]
of Grand View and La Hoya. There are
[31:44]
huge papa trees that have grown out into
[31:47]
the street. I've asked you can't even
[31:49]
see the street sign. The the trees were
[31:51]
trimmed back right at the sign, but of
[31:53]
course they grow back. I'm asking that
[31:55]
something be done about those trees
[31:57]
because it's really a hindrance. If you
[31:59]
are coming up to the stop sign and
[32:01]
somebody's coming from the other
[32:02]
direction, these trees are huge and they
[32:04]
are actually in the street.
[32:07]
You familiar with that? you know, been
[32:09]
over there in
[32:10]
>> Asia. It's still there. It's just worse.
[32:13]
So, we have several areas where the
[32:15]
trees are actually growing into the
[32:17]
street, ground up, not just hanging
[32:19]
over. So, they actually block traffic.
[32:23]
>> That's it.
[32:23]
>> Thank you very much.
[32:24]
>> Appreciate it.
[32:27]
>> All right. Uh Stephanie Chop.
[32:37]
Hi. Uh, Stephanie Todd, 7 Heather Hill
[32:40]
Lane. So, I'm here to support the
[32:43]
residents um near Indian Meadows and
[32:46]
their complaints about AZZ as an Olivet
[32:49]
resident, but also I'm representing the
[32:51]
Sierra Club and Dark Sky, Missouri who
[32:54]
have who the they have also gotten
[32:57]
involved in these issues. There are
[32:59]
really three issues. Light trespass,
[33:03]
potential air pollution, and noise. The
[33:06]
light trespass that is occurring should
[33:08]
be easy to take care of because St.
[33:10]
Louis County already has an ordinance
[33:13]
against it. So, it'd be really good if
[33:16]
someone from Alvette notified the county
[33:20]
that light trespass from AZ shining into
[33:24]
residents houses, shining off the
[33:26]
property into residents houses and ask
[33:30]
az to shield their lights.
[33:33]
No, air pollution and noise are more
[33:35]
difficult. However, Olivet can do
[33:38]
something about it. The residents have
[33:40]
been complaining about AZ for at least
[33:42]
two years. But they didn't give up. They
[33:45]
found a regulation that cities can
[33:48]
enforce ordinances up to a half mile
[33:51]
outside their boundaries. Alvette needs
[33:54]
to step up and support its citizens. The
[33:57]
county does not have the necessary
[33:59]
equipment to determine if ACC is
[34:02]
emitting pollutants
[34:04]
and to
[34:06]
and and to identify the pollutants.
[34:09]
However, the outside groups that that
[34:13]
they're working with um they're trying
[34:16]
to um install air monitors and analyze
[34:20]
air samples and noise monitors. So, I
[34:23]
encourage you to work with them to get
[34:26]
data to back up their claims.
[34:30]
Um, noise is a harder problem, but put
[34:33]
yourself in these resident shoes. How
[34:35]
would you like to hear a loud bang
[34:38]
several times in the middle of the
[34:40]
night?
[34:41]
I'm asking you to find a way to stop the
[34:43]
loud noise at night and determine if az
[34:46]
is polluting the air and if they are to
[34:48]
try to stop them. These problems should
[34:51]
not be ignored and all of it can and
[34:53]
should do something about them.
[34:55]
>> Thank you very much. Appreciate your
[34:57]
time.
[34:59]
>> Right. Is there anyone else in the
[35:01]
audience who wanted to speak?
[35:11]
» Good evening.
[35:12]
>> Evening.
[35:12]
>> My name is Denise Williams. I live at
[35:15]
9600 Hiron Drive.
[35:19]
I just have to say I live ac across the
[35:22]
street from the park
[35:24]
where
[35:27]
all this noise
[35:29]
have been going on for quite a while.
[35:34]
And
[35:36]
hearing this noise all day
[35:40]
and throughout your time of rest
[35:46]
is depreciating
[35:48]
your livelihood.
[35:51]
I'm 70 and I'm not getting any rest.
[35:54]
I've retired to come home and enjoy the
[35:57]
kids, enjoy my bed where I've been
[36:00]
missing it for all this time. And then
[36:02]
you come home and you're hearing all of
[36:06]
this unnecessary
[36:08]
noise that's not supposed to be a part
[36:11]
of your life in Eloette.
[36:15]
I used to call Alvette when I moved here
[36:18]
sleepy hollow.
[36:20]
Very quiet, very surreal.
[36:26]
That has been stolen.
[36:29]
And
[36:31]
days and days and days have passed by
[36:35]
and all of you all are sleeping
[36:38]
comfortably while we're up in the I walk
[36:42]
the trail three times a day. You hear
[36:44]
it? It's supposed to be surreal on the
[36:48]
um path. It's supposed to be something
[36:50]
great that you all have done for the
[36:54]
community.
[36:58]
I don't think so.
[37:01]
Cuz you're walking, you're smelling that
[37:03]
stuff big
[37:06]
just so much smoke it covers the whole
[37:10]
park. The stench comes in your windows.
[37:15]
You smell it at night.
[37:18]
Not including the noise, but the smoke,
[37:21]
the stench.
[37:25]
So
[37:26]
imagine, close your eyes and imagine
[37:29]
that's how your days are going. Every
[37:32]
day you got to deal with this every day.
[37:37]
Your kids are inhaling this
[37:41]
poison.
[37:43]
We're at 70. They're cutting years off
[37:46]
our lives smelling it. I'm sure cuz it's
[37:48]
chemicals that we're absorbing into our
[37:52]
bodies. the kids are absorbing over at
[37:55]
the park that is so nice to have in the
[37:58]
neighborhood, but it's being blown
[38:00]
straight to hell.
[38:02]
Their lives are being cut short.
[38:06]
And
[38:07]
you guys are
[38:11]
when y'all sleep at night, just think
[38:14]
your glory oliveette
[38:17]
is causing suffering
[38:20]
for a lot of of your community and we're
[38:25]
just asking you to really take this to
[38:28]
heart and understand what we're dealing
[38:30]
with.
[38:32]
Thank you.
[38:32]
>> Thank you very much for coming.
[38:34]
Appreciate it.
[38:37]
All right. Anyone else in the audience
[38:39]
wish to speak?
[38:42]
Is there anyone online? Please raise
[38:44]
your hand.
[38:50]
All right. Thank you for everyone for
[38:52]
your comments. Sincerely appreciate it.
[38:55]
All right. We are going to move on now
[38:56]
to item nine. Bill 3066. Could we please
[39:00]
have the title be read? Bill 3066, an
[39:03]
ordinance authorizing a special permit
[39:04]
usage for O3BP Associates LLC, owners of
[39:08]
the property grounds, addressed as 9600
[39:10]
and 9606 Olive Boulevard, to permit
[39:13]
Rick's Ace Hardware to operate an
[39:15]
outdoor display and storage area on the
[39:18]
east parking lot portion associated with
[39:19]
their tenant space addressed as 9612
[39:22]
Olive Boulevard. Second reading.
[39:24]
>> Thank you.
[39:29]
Good evening, mayor, members of the
[39:31]
council. My name is Carlos Trejo. I'm
[39:32]
the director of planning and community
[39:34]
development, and I'm requesting a second
[39:36]
reading call for action for uh this
[39:39]
bill. We had our public hearing on
[39:40]
August 11th. Be glad to answer any
[39:42]
questions, and we do have a
[39:43]
representative in attendance if
[39:44]
necessary.
[39:46]
>> The only question I had is I think there
[39:48]
was a an ask to look at and I think
[39:50]
council man had asked about it like in
[39:52]
terms of the location, could it be
[39:53]
wedged into the corner in the back or
[39:55]
anything like that? Was that feasible?
[39:57]
Um, in terms of the drawing, if I'm
[39:59]
remembering correctly,
[40:01]
>> that was related if like parking was an
[40:03]
issue.
[40:04]
>> Yeah.
[40:04]
>> If that and and that may be something
[40:06]
that needs to be looked at if it becomes
[40:09]
an issue or not.
[40:10]
>> That's fine.
[40:10]
>> Um, and but I I think that's what we
[40:14]
were talking about.
[40:14]
>> That is correct. Okay.
[40:15]
>> That's my understanding.
[40:16]
>> Yeah. And I guess my question is a
[40:18]
procedural question related um just with
[40:21]
us being a fairly new council. Should
[40:23]
there be an issue that becomes apparent
[40:26]
with parking um or traffic movement with
[40:31]
the location safety um what what is the
[40:35]
process for if if we approve the special
[40:38]
permit as it is tonight but realize that
[40:40]
it is not functioning in in the way that
[40:44]
we intended it to.
[40:46]
>> We'll engage with the uh first engage
[40:48]
with the applicant or the petitioner
[40:49]
that operates a special use permit. see
[40:52]
what we can try to mitigate what is out
[40:54]
there, get a better understanding, uh
[40:56]
then ultimately report back to the
[40:58]
council. The council does have the right
[40:59]
to revoke a permit uh if it finds that
[41:03]
there is some val validation to the
[41:04]
concerns that are expressed
[41:08]
» question. How do we define parking
[41:10]
issues? Like what do we consider that to
[41:12]
be?
[41:12]
>> That's a very good question. I mean that site I would assume uh that there
[41:17]
will be some type of reported incident
[41:18]
on Olive or so. But if somebody just
[41:21]
can't find a parking space on a specific
[41:23]
date uh you know they can bring that
[41:25]
information we can try to log it and
[41:26]
record it. But you know it would have to
[41:28]
be something that that's known uh in
[41:32]
there and then the the process that we
[41:33]
had today of the people speaking before
[41:35]
the council noting concerns or issues
[41:37]
gets it on the record. I imagine that
[41:39]
makes
[41:39]
>> well and I imagine if the city got
[41:41]
notified we that could be brought
[41:43]
forward to us but I think about
[41:44]
hypothetically a certain parking lot you
[41:46]
know south of us at the end of 170 I
[41:48]
hear people complain about you know all
[41:49]
the time it's like you if we hear about
[41:51]
citizens something we can bring up too
[41:52]
hopefully it's not an issue and
[41:55]
>> ultimately that it is I mean we will
[41:57]
report back to the council the council
[41:59]
has you know if there's a consensus that
[42:01]
it is an issue I would assume the
[42:03]
council holds the authority to revoke
[42:06]
the permit or push
[42:07]
>> modify
[42:08]
solution.
[42:10]
>> And we talked about Dobs only using the
[42:12]
first row of parking, right?
[42:16]
>> That is a private agreement, I believe,
[42:17]
that they have with the property owner
[42:19]
that they're supposed to be using only
[42:20]
that.
[42:21]
>> Okay. That's not a city enforcable.
[42:23]
>> It wasn't anything that we we put in
[42:24]
into our our contingencies or so because
[42:27]
that's more again that's open parking
[42:30]
for this.
[42:31]
>> Okay.
[42:32]
>> Is the parking lot itself owned by one
[42:35]
parcel or another? It's the best the
[42:38]
best of my understanding it's all owned
[42:39]
by uh or the O3BP Associates which
[42:44]
operates as Biano Properties. They have
[42:47]
the the ownership of all the grounds and
[42:48]
then dos leases from them in there. I
[42:51]
know there are like three different
[42:53]
parcels identified by county but it's
[42:55]
one large site.
[42:57]
>> Okay.
[43:00]
>> All right.
[43:00]
>> And then this is uh fairly random and I
[43:04]
do apologize. I did not send this
[43:06]
question to you ahead of time. Has there
[43:07]
been any consideration with the little
[43:10]
driveway, not driveway, but
[43:13]
uh right ofway area in the front of that
[43:16]
building where you have a curb cut on
[43:18]
one side, a curve cut on the other side.
[43:20]
Has there been any consideration to
[43:22]
closing that driveway? This obviously is
[43:27]
bigger than this particular special use
[43:30]
permit, but through
[43:32]
>> it's it's one of those it's a long-term
[43:34]
discussion. We put together the council
[43:36]
had authorized the uh us to do the
[43:39]
olivet uh boulevard uh conceptual master
[43:43]
plan and it identified uh you know areas
[43:46]
and that that's one of the sides.
[43:47]
Unfortunately with the curvature of the
[43:49]
road is one problem. The intersections
[43:52]
of the opposite streets on the north
[43:54]
side is another problem. and then none
[43:56]
of the aprons align. Um, easy solution
[44:00]
is to place a median. That resolve all
[44:01]
the problems, but I'm sure you'll hear a
[44:03]
lot about that uh in there. Uh, but over
[44:06]
time working with those property owners,
[44:08]
we made them familiar with with the
[44:10]
concept. Uh, ultimately, you know, and
[44:12]
we've had discussions about, you know,
[44:15]
kind of nudging them to think think
[44:17]
ahead of reassessing the whole parking
[44:20]
layout on the the shopping center. It's
[44:22]
a it's tough. It's something I got, you
[44:24]
know, we're, you know, 1963 that was a
[44:27]
determination of how that layout was was
[44:29]
put in place and whether they looked at
[44:31]
the the external factors and what was
[44:33]
across the street. I can't tell you
[44:35]
that. But, uh, it it, you know, I guess
[44:40]
we've made them aware. They know that
[44:41]
there are issues. They're looking at
[44:43]
some formal way that maybe
[44:46]
uh over time that we can kind of like
[44:48]
reshift or consolidate that but it get
[44:51]
becomes expensive and that becomes the
[44:53]
key question. Is it all on their dime or
[44:55]
is it something that we collaborate with
[44:57]
them and partner with uh in that
[44:59]
process? If you go back to the catalyst
[45:01]
tragedy uh another uh you know uh report
[45:04]
that the council funded uh and there why
[45:06]
it didn't go the full extent uh to old
[45:09]
bonum road you know it talked about
[45:11]
creating some type of uh traffic uh uh improvement district or or
[45:17]
transportation improvement district to
[45:18]
look at means of getting that you know
[45:22]
re well it needs to be reassessed in
[45:24]
terms of where are the best points of
[45:27]
entry uh in there and and internal
[45:30]
circulations are going to be also need
[45:32]
to be looked at and of course the
[45:33]
streetscape enhancements. So I hope that
[45:36]
kind of addresses it. I mean it is as
[45:38]
long as I my response to you
[45:40]
>> probably another night for
[45:44]
>> but I think it can be done within within
[45:46]
you know you know the the plan's
[45:48]
horizon.
[45:50]
>> All right, any other questions?
[45:53]
>> I'll entertain a motion. I'll make a
[45:55]
motion to approve bill 3066, an
[45:58]
ordinance authorizing a special permit
[46:00]
use for the O3 BP Associates LLC, owners
[46:05]
of the property grounds addressed at
[46:07]
9600 and 9606 Alla Boulevard to permit
[46:11]
Rick's Ace Hardware to operate an
[46:13]
outdoor display and storage area on the
[46:16]
east parking lot portion associated with
[46:18]
their tenant space addressed as 9612
[46:22]
Olive Boulevard.
[46:23]
>> Second. All right. Motion made by
[46:25]
Council Member Jagos, second by Council
[46:27]
Member Clark. Can we please pull to
[46:29]
council?
[46:30]
>> Council member Juel.
[46:31]
>> Yes.
[46:31]
>> Council member Solomonov.
[46:32]
>> Yes.
[46:33]
>> Council member Clark.
[46:34]
>> Yes.
[46:34]
>> Chairman Prom Pashan Helman.
[46:36]
>> Yes.
[46:36]
>> Mayor Lewis.
[46:37]
>> Yes.
[46:38]
>> The motion is passed. Bill 3066 becomes
[46:40]
ordinance 2836.
[46:43]
>> Thank you. We'll move on to I think it's
[46:45]
the Carlos show tonight, right? Move on
[46:47]
to item 10. Bill 3067. Will you please
[46:49]
have the title be read? Bill 3067, an
[46:52]
ordinance authorizing a special permit
[46:53]
usage for PPM Bower LLC, owners of the
[46:57]
property grounds, addressed as 10401
[47:00]
Bower Boulevard, to permit advanced
[47:02]
driver assistance systems to operate an
[47:04]
indoor automotive repair facility within
[47:06]
the tenants space addressed as 10401
[47:09]
Bower Boulevard, Sweet B. Second
[47:11]
reading.
[47:13]
>> Mayor, again, this was uh read at at our
[47:16]
previous meeting on August 11th along
[47:18]
with a public hearing. be glad to answer
[47:19]
any specific questions. We do have a
[47:21]
representative, Mr. Corbin, and I
[47:22]
believe one of the operators uh in
[47:24]
attendance.
[47:27]
>> I didn't have any questions. I think we
[47:28]
covered it last time as far as I'm
[47:30]
concerned. Does anyone have any
[47:31]
questions?
[47:34]
Not to discredit. I think the work was
[47:35]
great last time, so we got our answer.
[47:37]
So, it's a very interesting new property
[47:39]
to have. No. All right. Then, if anyone
[47:43]
doesn't have any questions, um I'll
[47:45]
entertain a motion. I'd like to make a
[47:48]
motion to approve bill 3067, an
[47:50]
ordinance authorizing a special permit
[47:52]
use for PPM Bower LLC, owners of the
[47:55]
property grounds addressed at 10401
[47:57]
Bower Boulevard, to permit advanced
[48:00]
driver assistance systems to operate an
[48:02]
indoor automotive repair facility within
[48:04]
the tennis space addressed at 1041 Bower
[48:08]
Boulevard, Sweet B.
[48:11]
>> Second.
[48:12]
>> All right. U motion's been made and a
[48:14]
second. Can we please pull the council?
[48:16]
member Dragal,
[48:17]
>> yes.
[48:17]
>> Council member Solammanov,
[48:19]
>> yes.
[48:19]

[48:26]
ordinance 2837.
[48:28]
>> All right, moving on to item 11, please.
[48:30]
Bill 3068. Can we please
[48:33]
>> have the title read?
[48:34]
>> Bill 3068, an ordinance reaffirming and
[48:37]
adopting chapter 115, article 3, section

115.080 080 to 115.120

[48:55]

that we need to do this.
[48:59]
>> That's correct.
[48:59]
>> All right. I did not have any questions.
[49:01]
Did anyone on the council?
[49:03]
>> I had none.
[49:04]
>> All right. Then I will entertain a

an ordinance reaffirming and adopting

[49:35]
>> Second.
[49:35]

>> Mayor Lewis,
[49:45]
>> yes.
[49:46]
>> Motion is passed. Bill 3068 becomes
[49:48]
ordinance 2838.
[49:51]
>> Right. We'll move on to item 12. Bill
[49:54]
3069. Can we please have the title be
[49:56]
read?
[49:57]
>> Bill 3069, an ordinance granting an
[49:59]
easement to Spire for the installation
[50:01]
of an underground gas man at 9201 Olive.
[50:03]
Second reading.
[50:05]
Good evening, mayor and council members.
[50:07]
Um, great news today. This buyer was on
[50:10]
site to finally begin relocating that
[50:12]
2-in high-pressure man. Um, any
[50:15]
questions about our discussion from a
[50:17]
couple weeks ago or thoughts since then
[50:19]
about the wonderful world underneath our
[50:21]
pavement [laughter]
[50:24]
>> when you put it that way.
[50:26]
>> Okay.
[50:26]
>> Got a lot of questions. Yeah,
[50:28]
>> I do not. I mean, nothing new to add
[50:31]
from the
[50:31]
>> Okay, so very good.
[50:32]
>> Yeah. Nothing yet.
[50:34]
>> Anyone? All right, then. I'll entertain
[50:38]
a motion,
[50:40]
I guess. Do we have a motion on this
[50:41]
directly or We do have a motion, right?
[50:44]
>> Yeah.
[50:46]
>> So, do do we need just reward it to
[50:48]
approve this?
[50:48]
>> Yeah. Um, you should just word it as a
[50:51]
motion to approve bill number 3069, etc.
[50:55]
I would like to make a motion
[50:56]
>> for bill 3069, an ordinance, an
[50:59]
ordinance granting an easement to spire
[51:02]
for the installation of an underground
[51:03]
gas m.
[51:04]
>> I second that.
[51:05]
>> All right. Motion made and seconded. Can
[51:07]
we please pull the council?
[51:10]
>> Council member Duel.
[51:11]
>> Yes.
[51:11]
>> Council member Solomonov.
[51:12]
>> Yes.
[51:13]
>> Council member Clark.
[51:14]
>> Yes.
[51:14]
>> Chairman Prom Pashan Halman.
[51:16]
>> Yes.
[51:16]
>> Mayor Lewis.
[51:17]
>> Yes.
[51:17]
>> Motion is passed. Bill 3069 becomes
[51:19]
ordinance 2839.
[51:21]
>> Thank you very much.
[51:22]
>> Thank you. Good luck.
[51:25]
All right, move on to item 13. Bill
[51:27]
3070. If we could please have the title
[51:29]
be read.
[51:34]
Bill 3070, an ordinance authorizing a
[51:36]
special permit use for AC Richardson
[51:38]
LLC, owners of the property grounds,
[51:40]
addressed as 1215 Dealman Industrial
[51:42]
Court, to permit SSM Health Health
[51:45]
Cardinal Glennon Pediatric Therapy, to
[51:47]
operate a 4566qt
[51:50]
medical clinic within the tenant space
[51:52]
addressed as 9375 DM Industrial Drive.
[51:54]
First reading and public hearing.
[51:56]
>> All right. As part of this public
[51:57]
hearing, I'm going to go ahead and open
[51:58]
up the public hearing for this bill. And
[52:01]
good evening, Max.
[52:02]
>> Yeah, welcome back.
[52:02]
>> Thank you. Uh my name is Carlos Tjo. I'm
[52:04]
the director of planning and community
[52:06]
development for the city of Alvette. And
[52:07]
tonight I'm here to present bill 3070,
[52:10]
which is a special permit use request
[52:12]
for uh medical offices and clinics at
[52:14]
9375 Dilman Industrial Drive. The next
[52:17]
slide will kind of show the location.
[52:19]
It's at the corner of Dilman Industrial
[52:21]
Drive and Dilman Industrial Court, which
[52:23]
is on the lower left hand corner of of
[52:25]
the parcel. It's a corner parcel uh in
[52:28]
there. It's about 3 and 12 acres. The
[52:30]
building itself which you see the Lshape
[52:32]
and the white roof there is roughly
[52:34]
31,596
[52:37]
ft. It's a multi-tenant office
[52:38]
warehouse. You might be familiar with
[52:40]
the uh the the artery is located in
[52:43]
there along with uh the USGS uh is
[52:46]
located in that facility. Uh the
[52:48]
proposed uses of medical office and
[52:49]
clinics and since this is light
[52:51]
industrial uh medical offices and
[52:53]
clinics are identified in the permitted
[52:55]
uses but only as a special permit and
[52:58]
that is why SSM health cardinal linen is
[53:00]
here before you. It's zone L light
[53:02]
industrial district and it is authorized
[53:05]
uh as a uh special permit use in the LI
[53:08]
district. Uh the next slide
[53:11]
uh kind of talks about the special
[53:12]
permit procedure where we try to uh
[53:16]
facilitate and then further our vision
[53:17]
and goals with the comprehensive plan
[53:19]
which we hope is reflective of our
[53:21]
ordinances in the CO district but allows
[53:23]
us to look at the potential impact the district itself the comp plan sites
[53:28]
uh sustainability the surrounding
[53:30]
impacts and then the council rights to
[53:33]
buffer uh required from additional
[53:36]
improvements and imposed some open space
[53:38]
requirements. ments and to uh consider
[53:41]
uh some limitations like in hours and things of that nature. It goes to
[53:45]
our planning and community design
[53:46]
commission for review and a
[53:49]
recommendation and then a council holds
[53:50]
the public hearing and then considers
[53:52]
actions via an ordinance. On the next
[53:55]
slide, just a couple of things regarding
[53:57]
special permit uses. There are some
[53:58]
general conditions that are outlined
[54:00]
with our ordinance. Those are that is it
[54:02]
listed in the district? Does it further
[54:03]
the comprehensive plan? Uh is it the
[54:06]
location the parcel suitable for the
[54:08]
environment surroundings? Is it
[54:09]
complementaryary to the surroundings in
[54:11]
the neighborhood and the improvements?
[54:13]
Uh did they demonstrate mitigation to
[54:15]
any potential spillover effects? And
[54:17]
then of course it gives the city the
[54:18]
authority to grant buffering designate
[54:20]
areas for uh open space limit set
[54:23]
limitations on operations implementation
[54:25]
schedules meaning like over time they
[54:27]
need to do this and consider adequacy of
[54:30]
public services. The next slide we'll
[54:32]
get into the nuts and bolts. This is a
[54:34]
street view of the building facility.
[54:36]
They'll be taking that front corner that
[54:37]
you see there. It's approximately I I
[54:40]
believe it's a little over 4,500 square
[54:42]
f feet. We'll get to that specifically
[54:44]
uh in a second. Uh Dilman Industrial
[54:47]
Drive is on the right hand side. Dilman
[54:50]
Industrial Court is on the left hand
[54:51]
side. Dilman Industrial Court is just a
[54:53]
short street uh that leads directly to a
[54:55]
building that's in the background there.
[54:57]
The next slide,
[54:59]
this is the the uh just the tenant
[55:02]
improvement plans that they're proposing
[55:03]
uh that kind of exist in the existing
[55:05]
site ground. It is a 4500 ft² building I
[55:08]
believe. Um they are when you look at it
[55:11]
in comparison to the overall building
[55:13]
which is about 3200 feet, 3200 32,000
[55:17]
ft². Uh they're a little bit of around
[55:19]
an eighth of the whole building uh in
[55:21]
there. And you can see the corner area
[55:22]
that they'll be taking up their space.
[55:24]
It's kind of proportion to the the size
[55:26]
on on the uh on the plan. The next slide
[55:32]
will identify what are they doing. It's
[55:34]
a 4,566
[55:35]
square foot outpatient physical therapy
[55:37]
clinic, pediatric therapy clinic. Uh the
[55:40]
clinic provides multiddisciplinary
[55:42]
therapy for physical therapy,
[55:44]
occupational therapy, and speech therapy
[55:46]
at their site. Uh they currently operate
[55:48]
in Creve Corore and they're relocating
[55:50]
to etc which is great. Uh the next slide
[55:53]
uh kind of goes over the commission did
[55:55]
review it and they motioned to recommend
[55:58]
to the council that the uh council
[55:59]
consider and approve authorization of
[56:01]
the special permit. They use of course
[56:03]
the comprehensive plan, our community
[56:04]
goals in their review. Uh we look at the
[56:07]
principles for economic development and
[56:09]
our comprehensive update goals which is
[56:10]
environmental sustainability investment,
[56:13]
crime prevention, native plantings and
[56:15]
strategic redevelopment. And you can see
[56:17]
the check boxes as we go through in
[56:19]
there to complete those boxes. Of
[56:21]
course, they are asking uh for some
[56:23]
additional landscaping along the Dealman
[56:25]
Industrial Drive uh component, which is
[56:27]
the west side uh when you enter from the
[56:28]
stop sign area uh to replace exterior
[56:31]
wallpack lights with those compatible
[56:33]
with chapter 428, meaning that they're
[56:34]
cut off facing down uh and there. And
[56:36]
then to limit the hours of operation
[56:38]
from 7:30 a.m. to 6:30 p.m. That's done
[56:40]
in collaboration with the petitioner.
[56:42]
And the concern was because it's a
[56:44]
pediatric facility just to make sure
[56:46]
that uh they're not interrupting or um
[56:49]
throughout the evening or when we have
[56:51]
industrial traffic.
[56:53]
On the next slide, mayor, if I can enter
[56:54]
a couple of items just for the record.
[56:56]
Uh, our 2024 comprehensive plan update,
[56:58]
including the 5-year economic
[57:00]
development plan, the Alvette municipal
[57:02]
code and zoning map, uh, the staff
[57:04]
presentation and memorandum that was
[57:06]
presented to the planning and community
[57:07]
design commission dated July 23rd, 2026,
[57:10]
including the petition and supporting
[57:12]
plans and documents. Our public hearing
[57:14]
notice, this is a public hearing. We
[57:16]
were required to post this 15 days prior
[57:18]
uh to tonight and that was posted in the county in St. Louis County on August
[57:24]
10th, 2026. And you have a list of the
[57:26]
properties that were notified. Uh we did
[57:28]
300 ft which is above and beyond the 185
[57:31]
called by code. Uh and then this
[57:33]
presentation before the city council.
[57:36]
So mayor, I'd be glad to answer any
[57:37]
specific questions and then we do have
[57:39]
representatives here I'd like to
[57:40]
introduce.
[57:41]
>> What's what was their current
[57:42]
previously? what was who occupied? Uh it
[57:46]
was an engineering firm I believe was
[57:48]
the last uh firm that was there
[57:50]
>> and it they're going to be if you don't
[57:52]
mind going back to the uh overlay of the
[57:54]
office they're going to be doing
[57:55]
outpatient
[57:56]
um I guess so patients come in and are
[58:00]
seen there or is the expectation but
[58:03]
because these are these cubes I guess
[58:05]
I'm just wondering where where that
[58:06]
occurs
[58:06]
>> kind of like shows the internal layout I
[58:08]
think there's going to be some changes
[58:09]
and modifications I think that's what it
[58:11]
looks like right now uh in there so they
[58:13]
haven't applied but but yes they do
[58:15]
one-on-one therapies with uh individual
[58:17]
clients, pediatrics, of course. Uh in
[58:20]
there, probably a question that can
[58:21]
better address than I could on the
[58:23]
description.
[58:24]
>> Um before we bring them up, other
[58:25]
questions people have or
[58:27]
>> I had the same question.
[58:28]
>> Yeah, I don't have it.
[58:30]
>> I had a question on the hours. So,
[58:32]
pediatric means all the way through 18,
[58:34]
right? So, is the city limiting the
[58:37]
hours or is that something that SSM is
[58:39]
choosing?
[58:40]
>> We talked with SSM about what hours and
[58:42]
in there and that was within that range.
[58:44]
which I think they they close at 5:30.
[58:46]
Something we can check with them again.
[58:48]
>> Okay. Okay.
[58:50]
>> And then I was just curious, I don't see
[58:51]
a landscape plan here yet, but um want
[58:54]
to be clear about the area that this
[58:57]
business would be working,
[59:00]
>> like what part of the parcel they would
[59:02]
be working on to improve the landscaping
[59:05]
and hopefully get some trees out there
[59:07]
and native plants, something other than
[59:09]
just the turf. Um, and then also curious
[59:13]
if there's going to be any signage on
[59:16]
that corner there or that little kind of
[59:20]
>> Mhm.
[59:21]
>> park that pokes out on the corner.
[59:24]
>> Um, if there's any kind of signage that
[59:26]
they're
[59:27]
>> We can go one slide back. Uh, Miss Yak,
[59:30]
uh, on the right hand side, you'll see
[59:32]
Deman Industrial Drive. That's where
[59:34]
we're asking for some additional
[59:35]
landscaping to be placed in there with
[59:37]
50% of that being native. The one thing
[59:39]
along this corner both going north
[59:42]
[snorts] you know where I'm when you're
[59:44]
looking at that right road you are going
[59:48]
north to south uh on the left you're
[59:50]
going east to west uh on both portions
[59:54]
of the road and you can see some of the the fiber indication there's fiber
[59:57]
and underground utilities all running
[59:59]
through uh through there where I have
[1:00:02]
the most excess of rightway believe it
[1:00:04]
or not is going to be on the western
[1:00:06]
side this used to be an easement and
[1:00:08]
that's where I believe maybe that's why
[1:00:10]
there was no sidewalk or landscaping uh
[1:00:12]
in place. When the city took over the
[1:00:13]
roads, we took over just a significant
[1:00:16]
portion. A lot of times the parking
[1:00:18]
would have been further back, we would
[1:00:19]
have more area for landscaping and and
[1:00:22]
things of that nature. So, we're looking
[1:00:23]
here on the right hand side as you can
[1:00:25]
go uh north to south that they do some
[1:00:28]
uh some additional landscaping uh in
[1:00:30]
their trees to be careful. probably
[1:00:33]
preference would be more ornamental, but
[1:00:35]
nothing that's going to be deeprooted
[1:00:36]
because they're going to there's
[1:00:38]
continue a matter of fact uh there was
[1:00:40]
markings uh this morning again that
[1:00:42]
somebody's running some type of fiber
[1:00:44]
optics or things uh of that nature. So,
[1:00:46]
it continuously gets torn out, but we'd
[1:00:49]
like to get them more towards uh on the
[1:00:52]
western or the eastern part of that hump
[1:00:54]
as you see in the the grading uh in
[1:00:57]
there to kind of hide some of the
[1:00:58]
parking
[1:01:00]
in there. We didn't look at the north as
[1:01:02]
they're kind of more facing towards
[1:01:04]
Olive uh in there. But again, I know I
[1:01:06]
have a lot of uh
[1:01:09]
utility stuff that runs uh underneath
[1:01:11]
and the sidewalk kind of extends more
[1:01:13]
along that area uh in there, but it
[1:01:15]
could be discussion we can have with the
[1:01:17]
property owner. In terms of signage, no
[1:01:19]
signage has been proposed.
[1:01:20]
Traditionally, the signage has been uh
[1:01:22]
on the wall in there. I anticipate that
[1:01:25]
they will continue to do so. I know
[1:01:27]
ImageNet, which is also located on that
[1:01:29]
building at the far uh left end uh which
[1:01:33]
would be the eastern end of the building
[1:01:35]
does have a monument sign at that back
[1:01:36]
corner. So if they do another one, they
[1:01:39]
have to place it uh towards the other
[1:01:42]
apron uh in there. So I don't anticipate
[1:01:44]
anything towards the front.
[1:01:46]
>> Okay. And my questions are twofold. One,
[1:01:50]
obviously to increase our environmental
[1:01:52]
sustainability and to have plantings
[1:01:54]
along that um area as much as possible
[1:01:58]
that not only are good for the
[1:02:00]
environment but can also provide shade
[1:02:02]
um and reduce the heat on that um
[1:02:05]
asphalt parking lot. Um, and then the
[1:02:09]
other piece with Oh, and safety as well
[1:02:12]
because you're going to have kids in
[1:02:14]
that parking lot and obviously it's
[1:02:15]
worst case scenario thinking that
[1:02:17]
somebody's jump going to jump the curb
[1:02:18]
and go over, you know, that's obviously
[1:02:20]
worst case scenario, but any buffer
[1:02:22]
>> uh that we can put in there is a good
[1:02:24]
one. Um, and the same concern with
[1:02:26]
safety for signage. Um just so that when
[1:02:29]
we've got parents who are looking for
[1:02:31]
the facility that it's clear and we
[1:02:33]
don't have kind of that driving around
[1:02:36]
trying to find it because it is you know
[1:02:38]
somewhat tucked down um
[1:02:42]
back behind there just so that it's it's
[1:02:44]
clearly clearly seen and visible um for
[1:02:47]
your visitors for your patients and
[1:02:49]
their families.
[1:02:50]
>> It's something we can look at and
[1:02:52]
discuss with it. And again, I just want
[1:02:53]
to be clear in terms of the the two on
[1:02:57]
the first comp component of that, the
[1:02:58]
sustainability aspect as we're looking
[1:03:01]
at some of the the plantings and the
[1:03:03]
native species, the concern would be on
[1:03:05]
the trees being too too big in there
[1:03:07]
because of the
[1:03:09]
>> uh because of the utilities that run on
[1:03:12]
that north side. Now, right here where
[1:03:14]
the bench is set, there is more depth
[1:03:16]
and I think it's the parking stall
[1:03:17]
length and we can talk with them if
[1:03:19]
that's an area that they could do more
[1:03:20]
of the shade aspect of it as opposed to
[1:03:23]
the decorative part component of it.
[1:03:25]
>> Yeah. And even if it was native bushes
[1:03:26]
or something that it would help and put
[1:03:29]
that barrier
[1:03:30]
>> is the you know the white and orange
[1:03:32]
pole that you can see in the front of
[1:03:35]
the picture but then also on that right
[1:03:37]
side there is that the marking for the
[1:03:39]
fiber optic cable
[1:03:40]
>> one of the companies
[1:03:42]
>> I would assume it doesn't represent all
[1:03:44]
of the companies and then you can see
[1:03:45]
the little square in there represents
[1:03:47]
somebody's vault
[1:03:49]
>> to get in in that space. So is the idea
[1:03:52]
being though that the general location
[1:03:54]
of those lines is approximately on the
[1:03:57]
right side approximately the same as
[1:04:00]
what we can see in the in the foreground
[1:04:02]
of the image
[1:04:03]
>> at least for the ones that are marked.
[1:04:04]
Yes.
[1:04:04]
>> Okay.
[1:04:06]
>> Yeah. And unfortunately they're usually
[1:04:08]
about 2 feet below below grade which is
[1:04:11]
not much when you kind of think about
[1:04:12]
it.
[1:04:15]
Okay.
[1:04:15]
>> Why don't we bring the petitioner?
[1:04:19]
you ask questions.
[1:04:28]
» How are you?
[1:04:29]
>> Good. Hello.
[1:04:30]
>> My name is Lara Masters. I'm a regional
[1:04:32]
director for um SSM Health Cardinal
[1:04:34]
Glenn and Pediatric Therapy. Thank you
[1:04:36]
for letting us be here today.
[1:04:39]
>> Happy to answer any questions.
[1:04:41]
>> And I'm Ann Hug. I'm the vice president
[1:04:43]
of operations for the company.
[1:04:45]
>> Um yeah, I think the question we had is
[1:04:46]
just the layout. it patients will be
[1:04:49]
seen in there and
[1:04:50]
>> is it is it just kind of open like your
[1:04:52]
counseling so it is cubes or is it
[1:04:54]
actually like private facility or how
[1:04:56]
what what kind of things you know are
[1:04:58]
happening usually
[1:04:58]
>> there'll be an open space like a gym for
[1:05:01]
more like physical therapy but we we'll
[1:05:04]
probably have I mean I would say seven
[1:05:07]
or eight individual treatment rooms that
[1:05:09]
are more where speech therapists would
[1:05:11]
work with individual patient
[1:05:14]
>> so this is not necessarily what the
[1:05:15]
layout
[1:05:15]
>> this is this is what it looks like now
[1:05:17]
we to do something different with it.
[1:05:20]
Um, so where there'd be, you know,
[1:05:22]
individual treatment rooms, again,
[1:05:24]
they're not big, but they're
[1:05:25]
>> Yeah,
[1:05:27]
and there Yep.
[1:05:28]
>> The treatment rooms will be around the
[1:05:30]
perimeter and the gym space would be in
[1:05:31]
the middle.
[1:05:32]
>> Okay. For actual PT itself and things
[1:05:34]
like that.
[1:05:35]
>> Yep.
[1:05:35]
>> Okay.
[1:05:36]
>> Will it be possible to have uh the
[1:05:39]
drawing of how how you envision this?
[1:05:41]
it. I think it's just very helpful for
[1:05:43]
us to actually have the drawing in front
[1:05:45]
of us as opposed to each of our brains
[1:05:48]
kind of thinking what it might look
[1:05:50]
like.
[1:05:50]
>> I have I have we have a clinic that's
[1:05:53]
very similar in size in Ronnie's Plaza
[1:05:56]
and I have that drawing that I can share
[1:05:58]
with you that we will use that that kind
[1:06:02]
of design for this space. So I can I
[1:06:05]
would be would love to share that with
[1:06:06]
you. bring that for the second reading
[1:06:07]
or for Carla M the Trey House has
[1:06:09]
probably forward it to us
[1:06:11]
>> and this is eventually going to go to
[1:06:13]
planning and zoning once if this is
[1:06:16]
approved and then they'll have the full
[1:06:19]
sets of drawings and landscape plans and
[1:06:22]
things like that. Is that correct?
[1:06:24]
>> No.
[1:06:26]
>> Oh yeah. I want to see it now.
[1:06:28]
>> No, it would be more regarding the use
[1:06:29]
and the the operations of the use. The improvements would be internal uh in
[1:06:34]
there. So that generally that would go
[1:06:36]
back to the commission for for review.
[1:06:38]
Uh there was a code and the the number
[1:06:40]
of exits and the use is going to dictate
[1:06:42]
what how that space
[1:06:44]
>> how people geointer currently is not
[1:06:46]
necessarily our
[1:06:47]
>> in terms of landscaping. Yes, the
[1:06:48]
commissioner was comfortable with it
[1:06:49]
administratively you know that as long
[1:06:51]
as they submit some type of landscaping
[1:06:53]
uh in there and then set the condition
[1:06:56]
of the 50% native.
[1:06:57]
>> Yes.
[1:06:57]
>> Uh in there gives us the guidance of
[1:06:59]
what they're looking for. Okay, I
[1:07:01]
understand.
[1:07:02]
>> And that just be helpful if you send an
[1:07:03]
example just so we can, you know,
[1:07:05]
visualize it. Appreciate it.
[1:07:07]
>> Like before the second, you' like
[1:07:09]
>> forward it to Mr. Trey, he can forward
[1:07:10]
it to us and then we'll have it before
[1:07:11]
the second and just helps us visual.
[1:07:13]
Again, it's your internal not ours. But,
[1:07:15]
uh, just that's where I was struggling.
[1:07:17]
I'm like, I don't understand.
[1:07:18]
>> What is it? You know,
[1:07:20]
>> hey, I'm like, it's your your your
[1:07:22]
business,
[1:07:23]
>> you know.
[1:07:23]
>> Yeah. Thank you. But I do think having
[1:07:25]
that information, you know, I know you have presented this to the PCDC a
[1:07:30]
few months ago. Um, and so like the the
[1:07:33]
understanding that for a landscaping
[1:07:35]
plan has been kind of out there for a
[1:07:37]
little bit. So it would be nice to see
[1:07:39]
some movement towards getting a clearer
[1:07:41]
sense of what that is as well as what
[1:07:44]
your layout internally is before the
[1:07:47]
second reading.
[1:07:48]
>> Okay.
[1:07:48]
>> So that we're really clear on what what
[1:07:50]
we're approving. Um,
[1:07:52]
>> Sure. And I'm I'm thrilled to like my
[1:07:54]
hesitancy is not anything about this
[1:07:56]
business or anything. I'm I think it's a
[1:07:58]
good use. I think it's
[1:08:00]
>> um great uh to have this here and all of
[1:08:03]
it. And I'd like to have a clear sense
[1:08:05]
of what we're approving before we
[1:08:07]
approve it.
[1:08:08]
>> Sure.
[1:08:10]
>> All right. Thank you very much.
[1:08:12]
Appreciate it.
[1:08:13]
>> Happy to be here. Thank you.
[1:08:14]
>> Did you have
[1:08:15]
>> Yeah, I had just one comment. U I'm Drew
[1:08:18]
Clary with Intel. I work with the
[1:08:21]
landlord on this building. I just had a quick comment question on the the
[1:08:27]
conditions of the landscaping. Um, so
[1:08:29]
Carlos mentioned there's some fiber
[1:08:31]
optic optic cables that run on the
[1:08:34]
inside or just on the outside of the
[1:08:36]
sidewalk. Um, there's there's a very
[1:08:39]
similar one just on the other side. You
[1:08:41]
can't see it, but it's right there in
[1:08:43]
front of a manhole. Um, would it be
[1:08:46]
beneficial at all if we did more
[1:08:48]
landscaping right where that park bench
[1:08:50]
is
[1:08:51]
instead of along the the western
[1:08:54]
barrier?
[1:08:56]
My view is more landscaping anywhere is
[1:08:58]
good. Like so as many native or this
[1:09:02]
council is generally I won't speak for
[1:09:03]
everyone but it's generally in favor of
[1:09:04]
native plants and beautifying and just
[1:09:06]
adding sustainability. So um there's
[1:09:08]
many many ways to attack that. So I
[1:09:10]
think um yeah, we have to be sensitive
[1:09:12]
to the cabling and not get in the way of
[1:09:14]
utilities and trees and things like
[1:09:16]
that. So we're not in any way saying,
[1:09:17]
"Oh, no, just put trees everywhere."
[1:09:18]
It's what are the best use of native
[1:09:20]
plants sustainability that are
[1:09:22]
aesthetically looking that are good
[1:09:24]
maintenance, you know, and see and and I
[1:09:27]
think it's just seeing what would look
[1:09:28]
like.
[1:09:28]
>> Yeah. So we and just a couple couple
[1:09:31]
thoughts on what we were planning on
[1:09:32]
doing to this building. So it's it's
[1:09:34]
been under a new owner since about
[1:09:36]
October. Um, the building, I don't know
[1:09:38]
if you've driven by it frequently, but
[1:09:40]
it looks very tired on the outside. So,
[1:09:43]
the signage is all mismatched. Festive
[1:09:45]
is is on that corner. Their signs about
[1:09:47]
this big, literally. Um, and so we're
[1:09:50]
trying to make the signage consistent.
[1:09:52]
We trying to make it prettier, channel
[1:09:54]
cut lettering if available. Um, repaint
[1:09:56]
the exterior of the building. We were
[1:09:58]
welcoming the light improvements. Um, we
[1:10:00]
were planning on doing that anyway. Uh,
[1:10:03]
and so I was trying to get to an
[1:10:06]
understanding of is it more
[1:10:07]
beautifification or is it more safety
[1:10:10]
barrier now that you have a better
[1:10:12]
understanding of their hours of
[1:10:13]
operation or is it a little bit of both?
[1:10:15]
Because I could probably do more
[1:10:17]
landscaping
[1:10:19]
near the park bench, more in front of
[1:10:22]
the building. I guess what I'm getting
[1:10:23]
at is I want to create the barrier. I
[1:10:26]
want it to be pretty. I don't I I would
[1:10:27]
love to not do too much because we're
[1:10:29]
going to make the building look a lot
[1:10:30]
nicer and I would hate for it to be
[1:10:32]
obuscated
[1:10:33]
>> if we have hedges grow too tall. But
[1:10:36]
I'll you know
[1:10:37]
>> that's nice to have not
[1:10:38]
>> at least from my perspective with the
[1:10:40]
landscaping you know it's it's
[1:10:42]
addressing sustainability and aesthetic
[1:10:45]
purposes. Okay.
[1:10:46]
>> Um but with the sustainability piece you
[1:10:48]
know trees provide benefits a multitude
[1:10:51]
of benefits. storm water control,
[1:10:53]
cooling, um biodiversity,
[1:10:57]
uh and aesthetics. Yeah. Um as well. So,
[1:11:00]
and trees give you the biggest bang for
[1:11:03]
your buck over time.
[1:11:04]
>> Mhm.
[1:11:05]
>> Low low maintenance generally too.
[1:11:07]
>> That is and it it is a triple net
[1:11:09]
building and so increasing the
[1:11:10]
maintenance cost does get passed back to
[1:11:12]
the tenants and
[1:11:13]
>> Yeah.
[1:11:14]
>> So, trying to find that happy medium.
[1:11:16]
>> I Yeah. And I I think again this is not
[1:11:18]
a dictative. It's just a anywhere we
[1:11:21]
can, especially when we're approving new
[1:11:22]
things, we're saying let's continue
[1:11:24]
sustainability goals. I'm less concerned
[1:11:25]
about the safety. It's always a nice
[1:11:26]
thing, but at least there is also a
[1:11:28]
ridge up, which is nice. It's a very
[1:11:30]
large area versus just a curb.
[1:11:32]
>> Um, but yeah, I think we just like to
[1:11:34]
see us continuing to grow and get more
[1:11:36]
sustainable. So, but to your point,
[1:11:38]
>> you don't want to block the signage
[1:11:39]
you're going to put up either. It's a
[1:11:40]
balance.
[1:11:41]
>> Yeah. Okay. I think we're on the same
[1:11:42]
page. we'll get you something has a
[1:11:44]
really good sense of I think of
[1:11:46]
>> what we're
[1:11:47]
>> we've had these conversations in
[1:11:48]
multiple forms. So, um I think he's
[1:11:51]
probably well equipped to advise on
[1:11:53]
that.
[1:11:54]
>> He has been you guys have always been
[1:11:55]
very helpful too. So,
[1:11:56]
>> what what color are you going to paint
[1:11:58]
the building?
[1:11:58]
>> That's a good question. Um
[1:12:02]
>> and are you going to paint? It looks
[1:12:03]
like there's masonry.
[1:12:05]
>> No, right now our our thought was just
[1:12:07]
the facade. Um but it's it's a it's
[1:12:11]
barely a thought. Are you are you
[1:12:13]
familiar with what they did with the
[1:12:14]
cone elevator building just a little bit
[1:12:16]
further down?
[1:12:17]
>> No.
[1:12:17]
>> It's probably it's right next to Stone
[1:12:19]
Fabricators and PK Construction, but if
[1:12:22]
you look at the before and after of what
[1:12:23]
they did, they painted it white and blue
[1:12:25]
accents. It looks incredible. So, it's something that would be tasteful
[1:12:30]
and nice and and not obnoxious, but if you go go look at it sometime this
[1:12:36]
week, I mean, it's it's peeling. It's
[1:12:37]
just there's a light that's it just
[1:12:39]
needs to be needs to be redone. So,
[1:12:42]
>> if you can kind of describe what that's
[1:12:44]
going to be, you know, what color, what what you guys decide before the
[1:12:48]
next reading, that would be great, too.
[1:12:50]
>> Yeah, we'll try and um put something
[1:12:52]
together like that along with a
[1:12:53]
landscaping plan.
[1:12:55]
>> I could be wrong. These they're not
[1:12:56]
necessarily tied together, right?
[1:12:58]
Because we're talking you're talking
[1:12:59]
about the entire building versus just
[1:13:00]
this. So, good point.
[1:13:02]
>> Yeah, it wasn't a requirement on the
[1:13:03]
PNC.
[1:13:03]
>> I don't want to stop this or makes
[1:13:05]
sense.
[1:13:05]
>> Let's do both. Yeah,
[1:13:07]
>> I don't I don't want to encumber that or
[1:13:09]
but I just wanted to let you know of our
[1:13:11]
plans anyway.
[1:13:11]
>> Appreciate it. It's good to know. I
[1:13:12]
appreciate the unification. So,
[1:13:14]
>> of course.
[1:13:15]
>> Cool. All right.
[1:13:16]
>> Thank you.
[1:13:17]
Other public comments?
[1:13:20]
>> No. All right. Anyone online?
[1:13:24]
Anything else from the council?
[1:13:26]
>> No.
[1:13:27]
>> All right. We will go ahead and close
[1:13:29]
the public hearing then and then there
[1:13:31]
will be a second reading of this bill on
[1:13:33]
September 8th. Thank you very much for
[1:13:35]
coming. Appreciate it.
[1:13:36]
>> Thank you.
[1:13:38]
>> All right. Moving on to item 14. Bill
[1:13:42]
3071. Ask I'm going to ask for the title
[1:13:44]
to be read.
[1:13:46]
Bill 3071, an ordinance authorizing a
[1:13:49]
special permit use for New Blueprint
[1:13:50]
Partners LLC, owners of the property
[1:13:53]
grounds addressed as 1220 North Price
[1:13:55]
Road to permit AIM field hockey to
[1:13:57]
operate a 6,614
[1:13:59]
square foot enclosed recreational use
[1:14:02]
within the tenants space addressed as
[1:14:03]
1220 North Price Road, Sweet 4. First
[1:14:05]
reading and public hearing.
[1:14:06]
>> All right, I will go ahead and open the
[1:14:08]
public hearing as well and another great
[1:14:10]
presentation.
[1:14:11]
>> Good evening, mayor. And just for the
[1:14:12]
record, my name is Carlos Tjo. I'm the
[1:14:14]
director of planning and community
[1:14:15]
development for the city of Alvette. And
[1:14:17]
tonight here I'm uh to discuss bill 3071
[1:14:20]
which is a special permit request for an
[1:14:23]
enclosed recreational use at 1220 North
[1:14:25]
Price Road uh suite number four uh in
[1:14:28]
that building. That is the same building
[1:14:30]
where we have Padel and Pickle uh on on
[1:14:33]
the northern end and underneath Pedell
[1:14:35]
and Pickle is actually uh u
[1:14:39]
beauty uh auto beauty specialists. I'm
[1:14:42]
sorry I can think of the name. And then
[1:14:43]
right in the middle you have uh uh
[1:14:45]
door.com
[1:14:47]
uh that that's located uh that kind of
[1:14:49]
wraps. And then this is a little corner
[1:14:51]
piece that I'll show you more
[1:14:52]
specifically in a second. So if you go
[1:14:54]
to the next slide, it is an old uh an
[1:14:57]
older building that was built uh I
[1:14:58]
believe in the the 1960s. I didn't put
[1:15:00]
the date uh in there, but it's a 6acre
[1:15:03]
lot with 134,000
[1:15:05]
uh square foot uh was considered of
[1:15:08]
office manufacturing, warehousing, and
[1:15:10]
distilling uh that took place at one
[1:15:12]
time. Now we have uh recreational use
[1:15:14]
with Pedel and Pickle uh storage with
[1:15:17]
auto beauty specialists and then some
[1:15:19]
distribution and offices with locked uh
[1:15:21]
with uh lock.com
[1:15:24]
or door.com uh on the site. the there's
[1:15:28]
one more piece uh of the building that
[1:15:30]
is up for lease uh and it's roughly
[1:15:33]
about 6,700 square ft² and that's where
[1:15:35]
you see the orange door there at the
[1:15:37]
lower right hand corner uh is where
[1:15:39]
they're looking to take a a piece of
[1:15:42]
that. It's very oddly configured because
[1:15:44]
over time as that property was improved
[1:15:47]
they they did it in phases and pieces uh
[1:15:49]
in there and of course it was the old
[1:15:50]
Southern Comfort Distillery uh that was
[1:15:53]
operating on that site. property grounds
[1:15:55]
are zone LI light industrial district
[1:15:58]
and enclosed recreational uses and
[1:16:00]
outdoor recreational uses are permitted
[1:16:02]
uses in the LI district but subject to a
[1:16:05]
special permit meaning they're not
[1:16:06]
industrial but they can be compatible
[1:16:08]
with a lot of the industrial uses that
[1:16:09]
we have there and of course I noted we
[1:16:11]
have Pedel and Pickle on the site uh
[1:16:13]
just to the left of it you had the
[1:16:15]
bridge uh facility um in there and then
[1:16:18]
we used to have the old town in tennis
[1:16:19]
just down the block uh not too far from
[1:16:21]
where SSM was looking at the next slide
[1:16:25]
We have a procedure for special permit
[1:16:27]
requests. It's a recommend review and
[1:16:29]
recommendation by the council by the
[1:16:31]
commission. Uh they forward that to the
[1:16:33]
council which holds a public hearing and
[1:16:35]
then has a action via an ordinance
[1:16:38]
special permit process. We have a
[1:16:39]
procedure that's outlined within our
[1:16:41]
ordinance that looks about looks at the
[1:16:43]
impact to it to limitations. Uh but
[1:16:46]
always, you know, trying to see how we
[1:16:47]
can further our comprehensive plan uh
[1:16:49]
goals and updates. And I'm sorry about
[1:16:51]
the lower left hand that should have
[1:16:53]
been LI district uh in there on that
[1:16:55]
side. The next slide will kind of talk
[1:16:57]
about general conditions of a special
[1:16:58]
permit. So what do we do is that we make
[1:17:01]
sure it's listed in the district that it
[1:17:02]
first to go a comprehensive plan that
[1:17:05]
the location is suitable to the
[1:17:06]
environment and surroundings. Sometimes
[1:17:07]
it could be doing topography some
[1:17:10]
natural features is is the property flat
[1:17:12]
is it hilly or or things of nature. Uh
[1:17:15]
are the improvements complimentary to
[1:17:17]
the neighboring uses? Did they
[1:17:19]
demonstrate that they're mitigating any
[1:17:21]
spillover effects that would adversely
[1:17:23]
impact the addition properties? And then
[1:17:25]
of course the city has the authority to
[1:17:27]
require whether buffering aesthetic
[1:17:29]
enhancements, designate areas for open
[1:17:31]
space, set limitations on operations,
[1:17:33]
implement a schedule and that is you
[1:17:35]
know requiring things to happen over a
[1:17:37]
certain amount of time and consider
[1:17:39]
adequacy of public services such as fire
[1:17:43]
uh medical police type of services. The
[1:17:45]
next slide we'll get into the nuts and
[1:17:46]
bolts. This is a corner of the building.
[1:17:48]
Again, this is 134,000 ft building. It's
[1:17:51]
a big building. Um, they're taking this
[1:17:55]
uh kind of uh front view here where the
[1:17:58]
orange door is, but not the whole thing.
[1:18:00]
It's just the on the left hand side, the first two uh components where you
[1:18:05]
see the vertical uh things right there
[1:18:08]
and then it kind of L-shapes and goes
[1:18:10]
back. So, you actually enter the
[1:18:12]
building uh from from that gap between
[1:18:15]
where the cursor is and to the far left
[1:18:19]
uh in there. There's a little cove
[1:18:20]
that's a little bit further back. Thank
[1:18:22]
you, Miss Yaki. Uh in there where the
[1:18:24]
enter entrance is. And I'll show you a
[1:18:26]
little bit more when we get into the
[1:18:27]
aerial view. The next slide will kind of
[1:18:30]
show how that is set up. And again, uh
[1:18:33]
sorry, I'm using white on the white
[1:18:35]
background. Uh, but you can see this
[1:18:36]
L-shaped layout kind of laid out onto
[1:18:39]
the 134,000 foot building. You can see
[1:18:42]
that cove area in that cove area on the
[1:18:44]
lefth hand side is the layout. There's a
[1:18:47]
66
[1:18:48]
uh 6,60 ft uh of the building footprint
[1:18:52]
for uh the Ames indoor uh field hockey
[1:18:56]
projects facility. Who is your your
[1:18:58]
petitioner? The next slide.
[1:19:02]
What is being proposed? The operations
[1:19:04]
are it's a 6,600 foot women's indoor
[1:19:06]
field hockey practice facility. In this
[1:19:09]
facility, the operations will include
[1:19:10]
training, one-on-one coaching, office
[1:19:13]
operations, and then video productions
[1:19:15]
that they use for uh uh for promoting
[1:19:17]
purposes for the uh for the individual
[1:19:19]
athletes uh for schools and and things
[1:19:21]
of that nature. Uh next slide. Uh as we
[1:19:25]
go through the PCDC, they went and they
[1:19:27]
reviewed it. Again they have a process
[1:19:29]
to review it in accordance with uh our
[1:19:31]
ordinance in special permit uses and
[1:19:33]
then also our comprehensive plan. Uh
[1:19:35]
when you look at economic development
[1:19:37]
and investment, it also has its own
[1:19:39]
specific goals about environmental
[1:19:41]
sustainability, investment, crime
[1:19:42]
prevention, uh native plantings and
[1:19:45]
strategic redevelopment. So in their
[1:19:47]
review, the commission uh motioned that
[1:19:49]
the council consider authorizing the
[1:19:51]
special permit through this ordinance.
[1:19:53]
However, they also laid out the
[1:19:54]
following conditions. One is to limit
[1:19:56]
the hours of operations from 7:00 a.m.
[1:19:58]
to 8:00 p.m. How do we get there? Again,
[1:20:00]
that was a discussion with the
[1:20:01]
petitioner of what their operating hours
[1:20:03]
would be. Uh, and there uh to replace
[1:20:05]
the exterior wallpack lights with uh
[1:20:07]
those that are cut off and facing down
[1:20:09]
compatible with chapter 428 to do a tree
[1:20:12]
health assessment and replacement plan
[1:20:14]
with 50% of those being native. There
[1:20:16]
was several trees along the perimeter of
[1:20:18]
the the the site as itself. you know,
[1:20:20]
different differentiating it from the
[1:20:22]
petitioner here. Uh, and there and some
[1:20:25]
of them had been cut down and some of
[1:20:26]
them uh seemed like they they were not
[1:20:29]
as healthy. And then to replace some of
[1:20:31]
the deteriorated fencing sections uh
[1:20:33]
that were on the uh south side of the
[1:20:37]
property uh uh in there the next slide,
[1:20:40]
mayor, if I can just enter a couple of
[1:20:42]
items into the record. Uh, one is our
[1:20:44]
2024 comprehensive plan update,
[1:20:46]
including our 5-year economic
[1:20:47]
development plan, the Olivette municipal
[1:20:49]
code and zoning map, the staff
[1:20:51]
presentation and memorandum presented to
[1:20:52]
the planning and community design
[1:20:54]
commission dated July 23rd, 2026,
[1:20:57]
including the petition and supporting
[1:20:58]
plans and documents. The public hearing
[1:21:00]
notice, of course, this is a public
[1:21:02]
hearing. We're required to post this in
[1:21:04]
the county and St. Louis County. It was
[1:21:06]
published on August 10th, 2026. And then
[1:21:08]
you have a list of the properties that
[1:21:09]
were identified or notified uh regarding
[1:21:12]
that twice. Uh they get a postcard
[1:21:14]
before it goes to the commission and
[1:21:16]
then they also get a public hearing
[1:21:18]
notice uh prior to our meeting here at
[1:21:20]
council and then the presentation before
[1:21:22]
council dated August 25th, 2026. I do
[1:21:25]
have representatives here in attendance,
[1:21:27]
but I'd like be glad to answer uh
[1:21:29]
specific questions about the building
[1:21:30]
and the operations.
[1:21:32]
>> I have questions mostly for the
[1:21:33]
petitioner. So before we bring them up,
[1:21:35]
anyone have any questions for Mr. Tjo.
[1:21:38]
>> Yeah. So I uh my daughter actually took
[1:21:39]
lessons at Padel and Pickle. So I got to
[1:21:41]
see the parking lot when they're when
[1:21:43]
it's gets a little bit busier.
[1:21:45]
>> It does it just want to make sure that
[1:21:47]
there are enough spots for all the
[1:21:48]
tenants if this goes through. Especially
[1:21:51]
if you know there's a team or a couple
[1:21:53]
of teams practicing, everyone drives in
[1:21:55]
their own cars.
[1:21:57]
>> End up with an extra with an extra 30
[1:21:59]
cars. [snorts]
[1:22:00]
>> Would that be enough space? And if not,
[1:22:02]
where would the overflow be?
[1:22:04]
>> Well, good question. Uh if you we can go
[1:22:07]
back to the aerial. I think it's about
[1:22:09]
uh three on on this site. Well, one
[1:22:14]
uh on this site. So you can see um
[1:22:17]
there's that center parking uh in in
[1:22:20]
that area primarily used by by lock uh
[1:22:23]
door.com, excuse me. And their pedal and
[1:22:26]
pickle uses part of that and then they
[1:22:28]
uh expanded their have the uh the
[1:22:30]
parking facility there on the lower left
[1:22:33]
corner uh in there. and you see that aisle in there. Uh they've always
[1:22:37]
wanted to expand in that green space,
[1:22:39]
but then that would trigger MSD review
[1:22:41]
and and storm water. So, there's always
[1:22:42]
that caveat that we have available
[1:22:44]
there. But then there's some additional
[1:22:46]
parking on the far right end of the
[1:22:48]
building uh in there. It's kind of
[1:22:50]
separate and independent, but they also
[1:22:52]
operate this. Yes.
[1:22:54]
>> To the f Okay,
[1:22:56]
>> that that area where the cursor is at.
[1:22:58]
>> Would would that be another entrance or
[1:23:00]
would people have to walk around?
[1:23:01]
>> They would have to walk around. They're not in the way the in the
[1:23:06]
original building everything was all
[1:23:07]
within within [snorts] reach. Now that
[1:23:09]
things have been separated, yes, the
[1:23:11]
parking is all kind of uh disassociated
[1:23:13]
with the with the spaces.
[1:23:16]
>> But it's always a good question. I mean,
[1:23:18]
I always hear, you know, that's a lot of
[1:23:20]
parking. You know, do do they really
[1:23:22]
need all that surface area? And you try
[1:23:24]
to balance that. Do they really have
[1:23:25]
enough parking uh in there? You know,
[1:23:28]
from a planning perspective, there are
[1:23:30]
in our code, there are some some
[1:23:32]
minimums. We go by minimums uh in there
[1:23:35]
that they have to have a minimum amount
[1:23:36]
based on the type of activity that takes
[1:23:39]
place. For recreational uses, it's based
[1:23:40]
on square footage. There's a simple
[1:23:42]
calculation that we use to calculate
[1:23:44]
that. For the office, it's based on on a
[1:23:47]
similar weight. Uh but then they're in a
[1:23:50]
match. And then our code allows us to
[1:23:52]
provide some overlap. So if this use
[1:23:54]
needs this much parking, this use need
[1:23:56]
needs this much parking, this use needs
[1:23:57]
this much parking, you can have some
[1:23:59]
overlap that that some may come in at
[1:24:01]
night, some may come in during the day
[1:24:03]
um in there. So it allows for that
[1:24:05]
process in there to help try to balance
[1:24:07]
it uh in there. But again, it's, you
[1:24:11]
know, from a professional view, it's
[1:24:13]
like I think if if people are unhappy with
[1:24:18]
the parking, they're going to go
[1:24:20]
somewhere else to find a better facility
[1:24:21]
that can accommodate them. And it
[1:24:23]
impacts the user in there. We want to
[1:24:24]
keep these uses viable. We want to keep
[1:24:27]
our residents and and and the region
[1:24:29]
coming to our our our location uh in
[1:24:32]
there, but this is a fine balance as
[1:24:34]
opposed to having over parking. We had
[1:24:36]
the conversation when uh Murthy Health
[1:24:38]
Systems was looking at the pharmacy and
[1:24:40]
we were asking can we get rid of parking
[1:24:42]
spaces uh back there and it's tough
[1:24:46]
>> for this area specifically. I just want
[1:24:47]
to make sure people are not parking
[1:24:48]
along the road or something like that.
[1:24:50]
So, but that sounds plenty sufficient if
[1:24:52]
we have that lot in the back.
[1:24:55]
>> But a good question. I mean it's it's
[1:24:57]
one of the things we struggle with and
[1:24:59]
finding that right mix, right balance.
[1:25:00]
Mhm.
[1:25:01]
>> Um, related to parking, I'm interested
[1:25:04]
in kind of hearing your perspective on
[1:25:06]
the traffic flow on this lot. Just
[1:25:08]
recognizing that it has kind of an
[1:25:10]
unusual
[1:25:12]
setup with the two entrances. Um, you
[1:25:15]
know, it's not a cir circle drive, but
[1:25:18]
you know, kind of coming in from both
[1:25:20]
sides. And then the extended part that
[1:25:23]
I'm assuming when this was more serving
[1:25:26]
an industrial purpose um was set up for
[1:25:30]
truck loading and unloading. Um and I
[1:25:34]
guess I'm just I'm curious in this
[1:25:37]
parcel recognizing how the uses have
[1:25:40]
shifted um pretty significantly. Um,
[1:25:44]
other than Door, perhaps Door still uses
[1:25:47]
the larger trucks for uh deliveries and
[1:25:51]
loading and unloading. I'm not sure. I'd
[1:25:53]
be curious to know um if this current
[1:25:56]
traffic configuration
[1:26:00]
is
[1:26:01]
the best um
[1:26:04]
use of that space
[1:26:07]
um and or the safest use recognizing
[1:26:11]
that you know for field hockey you'll
[1:26:13]
have parents driving but you my guess
[1:26:15]
[clears throat] is potentially some of
[1:26:16]
the clients will be uh older
[1:26:20]
kids young adults who are driving
[1:26:22]
themselves and aren't necessarily known
[1:26:24]
for being the best drivers. Um, and
[1:26:28]
trying to trying to make that that
[1:26:31]
particular area work in a way that um
[1:26:36]
it seems a little the setup as it is now
[1:26:39]
is a little odd for the uses that are
[1:26:41]
being
[1:26:42]
>> No, it's a very good question.
[1:26:43]
>> Those buildings
[1:26:45]
>> in there a good question uh just on the
[1:26:49]
timing on on here. So, and and this is why it's a special permit. I
[1:26:55]
mean, we have seen our industrial parks.
[1:26:58]
There's not much industrial going on in
[1:27:00]
those parks uh anymore. Uh we have seen
[1:27:04]
the the the the road and all that. This
[1:27:07]
used to be all private. So, those dock
[1:27:09]
doors all worked uh in there because
[1:27:11]
they were not under our jurisdiction uh
[1:27:14]
and in place. Now, we've taken up those
[1:27:16]
spaces in there. And these buildings
[1:27:18]
still are industrial buildings trying to
[1:27:21]
be retrofitted for uses that that were
[1:27:24]
or you know that that were not designed
[1:27:27]
or or built. And that's why we go
[1:27:29]
through these processes. You know, this
[1:27:31]
is the third time that I've been here
[1:27:33]
just for this building. You know, we did
[1:27:35]
that for Paddle and Pickle. We did it
[1:27:36]
for uh Auto Beauty to expand underneath
[1:27:40]
uh in there and then now we're doing it
[1:27:41]
for the Ames indoor hockey uh in there.
[1:27:45]
You know, I couldn't give you a straight
[1:27:47]
answer of is this, you know,
[1:27:49]
professionally, is this the ideal
[1:27:51]
parking configuration? No. No, it's not.
[1:27:54]
This is what what I have to work with
[1:27:56]
and what how it's put in place. uh
[1:27:58]
things that would I would would be ideal
[1:28:01]
for that parking is to make it more
[1:28:03]
uniform and and uh
[1:28:07]
you know uh polygono or or so but then
[1:28:11]
it triggers things because then you get
[1:28:13]
rid of that green space and then MSD
[1:28:15]
gets involved in all that and then the
[1:28:16]
cost of trying to retrofit these
[1:28:18]
buildings becomes more difficult um uh
[1:28:21]
in there. I think it's something we have
[1:28:24]
to kind of look over time uh in there.
[1:28:28]
We I'm not aware that that there's been
[1:28:30]
any incidents uh in the spaces, but we
[1:28:32]
only have three of the four tenants in there right now. Uh with uh auto
[1:28:37]
beauty, that's solely storage and those
[1:28:39]
are moved from just kind of back and
[1:28:40]
forth uh with them. Pedal and Pickle,
[1:28:44]
you know, I know they have their their operation their times kind
[1:28:48]
of fluctuate over time and it's just
[1:28:50]
going to be kind of looking at how that
[1:28:51]
mixture works between the two. The only
[1:28:53]
constant is Door.com. We know who's
[1:28:56]
there during during the regular hours
[1:28:57]
and then when when they leave uh in
[1:29:00]
there, it could be something that we
[1:29:01]
could look at, you know, how are the
[1:29:02]
hours of operating working with with
[1:29:04]
that over time. uh or you know talk
[1:29:08]
about how do we get more connectivity uh
[1:29:10]
with some of the other spots in there
[1:29:12]
depends on when I go out there you know
[1:29:14]
it's full and you can see uh to the left
[1:29:17]
on on the on the slide you know all that
[1:29:20]
parking right there is bridge uh in
[1:29:24]
there and it was like when we were going
[1:29:26]
through that we didn't anticipate you
[1:29:27]
know that volume um in that place but
[1:29:30]
we've been fortunate that the mix of
[1:29:32]
that building has been you know kind of
[1:29:33]
balances pretty well you don't go there
[1:29:36]
during the bridge time, you're going to
[1:29:37]
get pretty good parking. If it's during
[1:29:38]
bridge time, yeah, you're you're you're
[1:29:40]
kind of moving around trying to find a
[1:29:41]
space in there, but then they have a
[1:29:43]
similar pattern where the parking wraps
[1:29:45]
around the building and then there's a
[1:29:47]
whole another field on the north side uh
[1:29:49]
of it. So, yeah, I think there's enough
[1:29:52]
spots. It certainly does meet our code.
[1:29:54]
Is it configured perfectly? No, it is.
[1:29:58]
It it isn't. But I think we have to see
[1:30:00]
how we, you know, how these buildings
[1:30:02]
kind of transition and how this parking
[1:30:04]
kind of works over time.
[1:30:07]
>> What the current hours for paddle and
[1:30:09]
pickle? Do you happen to know?
[1:30:12]
>> Not off hand. Uh I believe they do have
[1:30:14]
an early start like 6:00 a.m.
[1:30:19]
» And paddle pickles where on here with
[1:30:21]
the curses are
[1:30:22]
>> Okay. So as you look Yeah, right there.
[1:30:25]
>> Okay. Thank you.
[1:30:26]
>> And they do actually use a parking lot.
[1:30:28]
That's where that blue truck, blue roof
[1:30:31]
>> right in that area.
[1:30:32]
>> Yeah. So that ends up being old parking
[1:30:34]
too. Like
[1:30:35]
>> an old old picture then.
[1:30:37]
>> It's I don't know that it's marked right
[1:30:39]
now, but people just park there in a row
[1:30:41]
and it's pretty organized.
[1:30:43]
>> Oh, okay.
[1:30:44]
>> I've seen it many times.
[1:30:46]
>> How crowded is it when you're if you've
[1:30:48]
been there?
[1:30:50]
>> I think I mean from what I've seen, they
[1:30:52]
only take up that wider part of the
[1:30:54]
parking. They don't even end up much on
[1:30:56]
the pavement.
[1:30:58]
So,
[1:30:58]
>> okay.
[1:30:59]
>> So, it sounds like it there should be
[1:31:01]
room.
[1:31:02]
>> Yeah. I mean, if we have that other
[1:31:03]
parking lot on the far right, I mean,
[1:31:05]
that's overflow if needed. Yeah. It's I
[1:31:08]
imagine it's also by hour times things
[1:31:11]
make difference
[1:31:11]
>> because I love this reuse.
[1:31:14]
>> Yeah. It's exciting
[1:31:15]
>> to these types of
[1:31:18]
>> and it draws people. They want to get
[1:31:19]
dinner afterwards. They want to do
[1:31:21]
things like that. It's great
[1:31:22]
>> and it's unique to the community, right?
[1:31:24]
>> It's it's a great
[1:31:27]
bring up the petitioner. So I have just
[1:31:28]
random questions. I'm curious more
[1:31:30]
curiosity questions. So like
[1:31:37]
» evening. Thank you guys so much for your
[1:31:39]
time with this and consideration. I'm
[1:31:40]
Lauren Kornweight, the founder and
[1:31:42]
director of Aimfield Hockey. I've been
[1:31:44]
at this for 20 years and have a vision
[1:31:46]
for for the next step. So
[1:31:49]
>> I'm Chris Paul now and I'm a
[1:31:51]
representative for Lauren and the real
[1:31:52]
estate.
[1:31:53]
>> Great. Um I was curious two things.
[1:31:56]
hours only because again I feel like it
[1:31:58]
might be different thinking about my
[1:31:59]
son's soccer and the private things like
[1:32:00]
they easily do things till 10 o'clock at
[1:32:02]
night and so it's you're comfortable
[1:32:04]
with the hours because it is light
[1:32:05]
industrial so we have a little bit of
[1:32:07]
give so
[1:32:08]
>> I am comfortable with the hours a lot of
[1:32:10]
um the you know during the day is going
[1:32:12]
to be just office use for we just have
[1:32:15]
four of us in there so it's not like a
[1:32:17]
huge you know for parking or whatever um
[1:32:21]
and then I am comfortable with the hours
[1:32:23]
it's going to be a lot of small group
[1:32:24]
and private training and not like loads
[1:32:27]
of teams coming in that space.
[1:32:29]
>> Okay,
[1:32:29]
>> that helps. I'm also I guess I'm
[1:32:31]
surprised too like your choice field
[1:32:34]
hockey, but you guys don't ever open it
[1:32:36]
up to anything else like football or
[1:32:38]
other, you know, trainings. You just it
[1:32:40]
only dedicates to field.
[1:32:41]
>> I mean, this is again we've been doing
[1:32:42]
this 20 years and we just focused on
[1:32:44]
field hockey, but
[1:32:45]
>> it's a win. Okay,
[1:32:47]
>> great.
[1:32:48]
>> How many uh players are training at any
[1:32:51]
one time? Oh, thank you.
[1:32:53]
>> We'll we'll be looking at doing small
[1:32:55]
group. Well, some will be literally
[1:32:56]
private one-on-one, but we'll be looking
[1:32:58]
at doing like 8 to 12 kids um training.
[1:33:02]
>> Yeah, that's right.
[1:33:03]
>> So, this is kind of a new concept, so
[1:33:06]
it's a little bit unproved. Lawrence
[1:33:08]
kind of gone out on a limb here because
[1:33:10]
all these indoor practice facility,
[1:33:12]
anyone who uses turf, they're all
[1:33:14]
fighting over each other for Veta in the
[1:33:16]
different turf
[1:33:17]
>> areas. So, Lauren's still going to
[1:33:19]
utilize those spaces. This will be a
[1:33:21]
complimentary facility for her where she
[1:33:24]
can do smaller group training
[1:33:26]
one-on-one. She does a lot of
[1:33:27]
recruitment videos for college and
[1:33:29]
things like that. So, it'll have like a
[1:33:31]
video production room.
[1:33:33]
>> Um, so it's not totally unknown. I think
[1:33:36]
she knows what she's gone through a
[1:33:38]
heavy business plan. So, I think it's
[1:33:40]
going to be a great facility. And
[1:33:43]
honestly, the um the previous meeting we
[1:33:46]
went to, they were like, "We think
[1:33:49]
you're going to outgrow this facility
[1:33:50]
and need to go get a bigger facility."
[1:33:51]
So, it's going to it's a new concept in
[1:33:53]
the indoor space. There's no one else
[1:33:55]
doing it. We're excited about it. We're
[1:33:57]
happy to be in Alvette. This is a great
[1:33:59]
location. The property is well lit and
[1:34:01]
it's a safe neighborhood. At night, the
[1:34:04]
all the other businesses are in the
[1:34:05]
afternoons, they'll be winding down on
[1:34:07]
their business where she'll be picking
[1:34:08]
up from when kids get out of school
[1:34:11]
until the evening hours. So I think it's
[1:34:13]
complimentary and then a lot of the
[1:34:15]
parents when they drop their kids off
[1:34:18]
they can go support the other businesses
[1:34:19]
in the community or go over to pet pedal
[1:34:21]
and pickle and make reservations and so
[1:34:23]
maybe that helps from the parking
[1:34:25]
standoint as well.
[1:34:26]
>> Could I address just your question
[1:34:28]
earlier also um we serve like
[1:34:32]
three-year-olds to 18y olds so 90% of
[1:34:35]
our clients are are parent drivers. Um,
[1:34:39]
we do have some, you know, the 16, 17,
[1:34:41]
18 year olds and I do understand your
[1:34:43]
question with that, but it's that's
[1:34:45]
going to be a small percentage.
[1:34:47]
>> I do imagine you will do quite well
[1:34:49]
because I can imagine a lot of people
[1:34:50]
that's why I asked about other sports
[1:34:51]
because the recruitment as my son's
[1:34:53]
going through that kind of thing right
[1:34:54]
now. It's um a space where you could do
[1:34:57]
that privately and get that and have
[1:34:58]
video. I question do you plan maybe you
[1:35:00]
don't because the size isn't like food.
[1:35:02]
You're not selling food. We're not No,
[1:35:04]
we don't have like a grillin bar or
[1:35:06]
anything like that. think like a veta or
[1:35:08]
something like that. Okay.
[1:35:09]
>> You don't want any part of that.
[1:35:11]
>> I don't want to venture into that.
[1:35:12]
>> I understand. I just wanted to check.
[1:35:14]
So,
[1:35:16]
>> all right.
[1:35:17]
>> Yeah. I think it's a very exciting use.
[1:35:19]
I love to see the building repurposed um
[1:35:22]
and and especially providing something
[1:35:25]
that's unique um and sounds like a
[1:35:28]
really great market to address. Um,
[1:35:32]
and yeah, my my concerns really are more
[1:35:35]
about the building and the kind of weird
[1:35:38]
driving situation that exists. I don't
[1:35:40]
have any concerns about the business
[1:35:42]
other than the potential that you will
[1:35:44]
be more successful and uh outgrow this
[1:35:48]
space too quickly.
[1:35:50]
So, we are in a little bit of a So, when
[1:35:53]
we negotiated this deal on the building,
[1:35:56]
the there was a new buyer coming in for
[1:35:58]
the building, which is the Bluepoint or
[1:36:00]
whatever LLC that's on the agenda for
[1:36:04]
this evening. It is kind of an emergency
[1:36:06]
situation. and Lauren got busy in the
[1:36:08]
spring and we burned some time and then
[1:36:10]
we realized when we went to permits that
[1:36:13]
we figured pedal and pickle and it
[1:36:15]
wasn't talked about with the previous
[1:36:16]
lawn lords on the use that we didn't fit
[1:36:18]
within the light industrial without a
[1:36:20]
special use permit. So now we're in a
[1:36:22]
situation where construction's been
[1:36:24]
delayed. So really what we're trying to
[1:36:26]
achieve is to get this thing off center
[1:36:29]
because it's she's a small business and
[1:36:32]
she's got time burning on at least right
[1:36:33]
now and we're confident we can get
[1:36:35]
through this with you guys and make the
[1:36:37]
compromises needed to make sure everyone
[1:36:39]
in the city is happy with the use. But
[1:36:42]
it's kind of like we need I think what
[1:36:44]
Carlos suggested is that we need to have
[1:36:46]
it as an emergency so we can get a first
[1:36:48]
and second reading. So whatever
[1:36:50]
accommodations
[1:36:51]
Yeah. So we we kind of would like to see
[1:36:56]
if we can move this forward this evening
[1:36:59]
if you guys would be open to that.
[1:37:01]
>> Don't know from policy how that works in
[1:37:03]
terms of because because we have to post
[1:37:05]
agendas
[1:37:06]
>> start the review of the uh the permit
[1:37:08]
plans with them uh and then that's
[1:37:10]
something we can offer
[1:37:12]
>> to move I'm sorry
[1:37:13]
>> to kind of facilitate and start the the
[1:37:15]
permit review the the building permit
[1:37:17]
plans before the council authorizes. So,
[1:37:20]
it's a risk we take, but it's something.
[1:37:22]
>> Yeah. And I think if it sounds like
[1:37:23]
they're willing to work, so I think that
[1:37:25]
makes sense to start early. We can't
[1:37:26]
authorize until the second reading, but
[1:37:28]
I think that gets you forward versus
[1:37:30]
waiting to the second reading then to do
[1:37:32]
that, right? So, it keeps us on track,
[1:37:34]
if that makes sense. So,
[1:37:35]
>> what is the policy? Can we do a first
[1:37:37]
and second reading on one day?
[1:37:39]
>> I don't know how we can do that.
[1:37:41]
>> Technically, you can. Um, it was not
[1:37:43]
advertised on the agenda that you were
[1:37:45]
going to vote on it this evening. So, um
[1:37:48]
that would have been useful, but uh
[1:37:50]
technically you could you need to vote
[1:37:53]
as a council. Someone needs to make a
[1:37:55]
motion to hold the second reading this
[1:37:58]
evening and then you need to vote on
[1:38:00]
that motion and then you would be um you
[1:38:03]
could then vote um on the
[1:38:10]
» vote.
[1:38:11]
Correct.
[1:38:14]
And I guess though, Carlos, does it
[1:38:15]
speed us up that much? Because the
[1:38:16]
plans, how long is it going to take you
[1:38:17]
guys to work through that?
[1:38:19]
>> Takes about right now we're about 15
[1:38:22]
days out for review comments.
[1:38:24]
>> Okay. So, if you start working with them
[1:38:25]
immediately, it's going to be 15 15 days
[1:38:27]
anyway. And so, to me,
[1:38:30]
>> it's going to be two weeks before we
[1:38:31]
vote on this again, right?
[1:38:33]
>> And so, I I don't think it's going to
[1:38:34]
change anything anyway. And I'd rather
[1:38:36]
if we didn't need to um if it was going
[1:38:38]
to dash but so I think starting as soon
[1:38:39]
as we can on just review to help them
[1:38:41]
out would be great if
[1:38:42]
>> it's something we can do without you
[1:38:43]
with or without the
[1:38:45]
>> okay before the only concern is in it
[1:38:47]
was my understanding in the past it it
[1:38:49]
sets a precedent and then they're always
[1:38:51]
asking us the staff you know about
[1:38:53]
>> yeah I think I think it's understood and
[1:38:56]
so we need to be careful on that and not uh so recognizing that there's a
[1:39:01]
need to burn and we really excited about
[1:39:02]
the reuse of the building so you know
[1:39:04]
open to that. But, uh, it's a good call
[1:39:06]
out. Um, signage. Oh, sorry.
[1:39:08]
>> I would be comfortable if we entertained
[1:39:12]
a second rating tonight. Does how does
[1:39:14]
anybody else feel?
[1:39:16]
>> I mean, if it if it's going to expedite helping them
[1:39:22]
move forward faster, I'm okay with it.
[1:39:24]
But if it's not going to make any
[1:39:25]
difference, stick to what we're doing
[1:39:27]
now.
[1:39:27]
>> Yeah, that's generally I mean, I I
[1:39:29]
wouldn't be totally objecting to it
[1:39:31]
except it does set precedent for us,
[1:39:33]
too. Um, and it doesn't sound like it's
[1:39:35]
going to accelerate at this point in the
[1:39:37]
period.
[1:39:37]
>> And I say leave everything the way it
[1:39:38]
is, but it might help Carlos so he
[1:39:41]
doesn't get
[1:39:42]
>> Well, it's one of these where one way or
[1:39:44]
the other we're establishing a tricky
[1:39:46]
precedent.
[1:39:46]
>> Yeah. Um, I I feel more comfortable with
[1:39:50]
Carlos working with the petitioner on
[1:39:53]
the building permit side of things than
[1:39:57]
making a decision in the middle of a
[1:39:59]
council meeting to adjust our processes.
[1:40:02]
Um, that we we were not prepped for
[1:40:05]
ahead of time to do something like that.
[1:40:07]
And I think adjusting something like
[1:40:10]
that in in a council meeting at itself,
[1:40:12]
I I don't feel comfortable with that.
[1:40:17]
Yeah, I kind of need to I guess Carlos
[1:40:18]
the question for you is or Mr. is it any
[1:40:20]
concerns from you moving forward on your
[1:40:22]
side sooner than later?
[1:40:24]
>> No, I mean they started off with permit
[1:40:26]
plans. So I think they're they're they
[1:40:28]
should have the contractor is here uh in
[1:40:31]
>> I don't want to put you guys in a bind
[1:40:32]
either if that's something that you guys
[1:40:34]
can't staff timing or anything like that
[1:40:36]
either. So that would
[1:40:37]
>> correct but I think we can coordinate
[1:40:38]
and get that that okay you know that
[1:40:40]
first round going
[1:40:41]
>> if you guys are good we'll have move
[1:40:42]
forward that way. I think it'll end
[1:40:44]
about the same time either way and I I
[1:40:45]
would agree with Chairman Bam on that.
[1:40:47]
>> So, realistically, when would the second
[1:40:49]
reading be?
[1:40:50]
>> ETH.
[1:40:51]
Okay. Okay. Okay.
[1:40:53]
>> And signage for the building. I don't
[1:40:54]
know if we covered that. I apologize.
[1:40:57]
>> I would say on the signage, Lauren and I
[1:40:59]
have talked about it. It would go if you
[1:41:01]
go forward a couple, you can see the
[1:41:03]
orange door.
[1:41:08]
» Oh, wrong way.
[1:41:10]
We could put a sign there to
[1:41:11]
>> Yeah, you could put a big arrow.
[1:41:14]
>> So I think in Lauren I it as long as it
[1:41:17]
hasn't changed. Her plan was to put AIM
[1:41:19]
above that loading door
[1:41:22]
um on that orange panel right there.
[1:41:24]
>> But the loading door is not you're not
[1:41:26]
using that door as an entrance.
[1:41:28]
>> No.
[1:41:29]
>> Okay.
[1:41:29]
>> And just to so you guys understand, this
[1:41:32]
space only accounts for about 2% of the
[1:41:34]
entire building. And um the the way this
[1:41:38]
space lays out, the entry will be on the
[1:41:41]
other side of that orange door, but
[1:41:42]
directly on the other side of the space.
[1:41:44]
So that'll be the main entry point.
[1:41:45]
You're not going to be entering from the
[1:41:47]
price side. But the way it's laid out
[1:41:49]
and the previous owner, they were
[1:41:52]
basically talking about mothballing that
[1:41:54]
space because it's laid out so
[1:41:55]
inefficiently for really any other use
[1:41:58]
than recreational or special use. So
[1:42:02]
just because it's hard to get into stuff
[1:42:04]
on the right side of this drawing which
[1:42:05]
used to be a rail loaded is really tired
[1:42:08]
space that you know frankly Lauren's
[1:42:11]
spending a lot of money that she's
[1:42:13]
investing into the space herself rather
[1:42:15]
than landlord and the other space that
[1:42:16]
Lord loading dock comes up and it makes
[1:42:19]
a 90 degree turn. So I mean this is
[1:42:21]
really it sat for a long time where they
[1:42:24]
almost said let's just forget about
[1:42:26]
leasing it and move on. So, all reason
[1:42:28]
exciting to reuse it.
[1:42:29]
>> Yeah.
[1:42:30]
>> Wish you the best of luck. So,
[1:42:32]
>> we'll move forward then. Um, any other
[1:42:35]
questions from council?
[1:42:37]
>> Uh, does anyone in the public have
[1:42:39]
questions to ask?
[1:42:40]
>> I just had one quick one.
[1:42:42]
>> Come on up.
[1:42:45]
>> So, I did represent the landlord when we
[1:42:47]
signed this lease. Um,
[1:42:50]
is there is there not have is there not
[1:42:53]
more of a or less of a pre precedent to
[1:42:56]
have a second reading at the council
[1:42:58]
meeting, first reading and second
[1:43:00]
reading, and to do the drawings early?
[1:43:02]
>> Do you guys normally have you never done
[1:43:03]
the second reading?
[1:43:04]
>> It's not that we've never done it. My my
[1:43:06]
concern is that everything we do
[1:43:08]
generally we need to give the notice to
[1:43:09]
the public so they expect what what
[1:43:11]
we're voting on, what we're talking
[1:43:12]
about, which is why we can't bring up
[1:43:13]
random topics and discuss them and just
[1:43:15]
forget at a given time. Um, and so it
[1:43:18]
sets that precedent that we could do
[1:43:20]
something and then people get upset that
[1:43:21]
like you did something without letting
[1:43:22]
us know. I would have come and spoken. I
[1:43:24]
would have objected. I would have
[1:43:25]
brought something up.
[1:43:26]
>> Whereas this, while we usually staff
[1:43:28]
would not usually work with you until
[1:43:30]
it's put forward,
[1:43:32]
>> we recognized this is going to go
[1:43:33]
forward. So staff working with you now,
[1:43:35]
I think puts us in the exact same spot
[1:43:37]
at the end of the day. So
[1:43:38]
>> Gotcha.
[1:43:39]
>> Yeah.
[1:43:39]
When we when we signed the lease,
[1:43:41]
we figured um and I actually remembered
[1:43:43]
it at the end, but when we did the
[1:43:45]
paddle and pickle deal, I thought we had
[1:43:47]
a special use permit athletic for the
[1:43:49]
whole building and it was specific to
[1:43:50]
their use. So,
[1:43:53]
>> I want them to get going as soon as
[1:43:54]
possible.
[1:43:54]
>> Me, too. Trust me. So, I I think this
[1:43:56]
will end up that's why our question of
[1:43:57]
if it's going to be 15 days, if it's
[1:43:59]
going to take that long anyway, we'll
[1:44:00]
approve it in 14 days. Hopefully, it's
[1:44:02]
done. We're at the same spot. If that
[1:44:04]
was not the case, I'd be much more
[1:44:05]
willing to entertain at this point. So,
[1:44:07]
>> well, I appreciate your time. No, thank
[1:44:09]
you. Thank you.
[1:44:10]
>> Thank you. Thank you. Anyone online?
[1:44:12]
>> You know, the only drawback is that I've
[1:44:14]
been frequenting Paris Baguette ever
[1:44:17]
since discovering this place. So,
[1:44:19]
>> yeah. Good with the bad, right? You
[1:44:21]
know, so
[1:44:23]
>> thank you.
[1:44:24]
All right. Anyone online?
[1:44:26]
Questions, comments? All right. I will
[1:44:29]
close the public hearing.
[1:44:31]
All right. And then we'll have it the
[1:44:32]
second reading on the 8th. Thank you
[1:44:34]
very much.
[1:44:34]
>> Thank you.
[1:44:36]
>> Okay. Move on to item 16.
[1:44:39]
Uh, surface transportation we will be
[1:44:41]
blocked. I will have you read it. How
[1:44:44]
about that?
[1:44:46]
>> Or do I?
[1:44:47]
>> Yes, sir.
[1:44:48]
>> Did I miss Oh, I passed bill. I
[1:44:50]
apologize. Just kidding. Item 15, Bill
[1:44:53]
3072. If we can have the title right,
[1:44:55]
please.
[1:44:56]
>> Bill 3072, an ordinance to amend section
[1:44:58]
405.460, 460 condominiums, plats, and
[1:45:02]
additional requirements being part of
[1:45:04]
the subdivision code of the city of
[1:45:05]
Alvette. Chapter 405, subdivision
[1:45:08]
regulations of title 4, land use of the
[1:45:10]
Alvet municipal code to allow for both
[1:45:12]
residential and non-residential
[1:45:13]
condominium plats and additional
[1:45:15]
requirements. First reading and public
[1:45:17]
hearing.
[1:45:18]
>> All right, we'll open the public hearing
[1:45:19]
on bill 3072 and presentation, please.
[1:45:22]
>> Uh, chairman, just for the record, my
[1:45:24]
name is Cardinal Stro. I am the director
[1:45:26]
of planning and community development
[1:45:27]
with the city of Alvette. Uh and this is
[1:45:29]
a tax amendment. So unlike uh having the
[1:45:31]
site plan and illustrations all the
[1:45:33]
pretty pictures uh and there we're
[1:45:35]
looking to amend our subdivision code
[1:45:37]
specifically the section referring to
[1:45:39]
condominiums plats and additional
[1:45:40]
requirements. The next slide will show
[1:45:42]
the the specific section and the changes
[1:45:44]
in that is to remove the references to
[1:45:46]
multif family or anything residential.
[1:45:49]
Uh what this does it gets us more
[1:45:51]
consistent with the condominium act. You
[1:45:53]
see there reference of chapter 448 the
[1:45:55]
revised statutes of Missouri. They kind
[1:45:58]
of say that we we really can't hold a uh
[1:46:00]
a distinction in terms of condominiums
[1:46:02]
whether they're residential or
[1:46:04]
non-residential that they can be applied
[1:46:05]
to buildings a building replace or the
[1:46:08]
sale of the building uh and they're I'm
[1:46:11]
hoping I address that correctly with and
[1:46:14]
there and we're just getting our code
[1:46:16]
more consistent with the state.
[1:46:17]
>> This is what most other cities in
[1:46:19]
>> that is correct.
[1:46:20]
>> Correct. Okay.
[1:46:21]
>> Does that also apply to like industrial
[1:46:23]
or office space as well? Yeah.
[1:46:26]
>> Good. I'm surprised the word condominium
[1:46:27]
doesn't mean living dorms doile, but you
[1:46:30]
learn something new every day.
[1:46:34]
» Is there any uh with the word
[1:46:36]
subdivision in there, does that does
[1:46:39]
that word imply one thing or another?
[1:46:41]
I'm not sure what a you know, a
[1:46:42]
condominium as a building versus a
[1:46:44]
condominium subdivision.
[1:46:48]
>> Condominium is a form of subdivision.
[1:46:49]
And so I think when you go through
[1:46:50]
chapter 405 and go through the the
[1:46:53]
definition sections that's where that term subdivision is refer
[1:46:57]
representing both a process and then a
[1:47:00]
product of that process too. I think
[1:47:02]
that's what where the that you're trying
[1:47:04]
to address
[1:47:05]
>> feels similar the word dwelling but you
[1:47:07]
again I don't care I trust if this is
[1:47:09]
what this
[1:47:09]
>> the code's going towards and it gets us
[1:47:11]
clear of that that makes sense.
[1:47:14]
>> All right questions from the council.
[1:47:17]
Anyone in the public online would like
[1:47:19]
to speak to this?
[1:47:20]
>> I think there are some items that record
[1:47:24]
through our 2024 comprehensive plan
[1:47:27]
update, the municipal code and zoning
[1:47:29]
map uh the staff presentation and
[1:47:31]
memorandum to the plan commission dated
[1:47:33]
July 23rd, 2026. In that presentation
[1:47:36]
and and that is part of your link uh in
[1:47:38]
your staff memo, uh there are references
[1:47:40]
to what other communities had uh in
[1:47:42]
there, what they they were all doing,
[1:47:44]
all of them being consistent. uh this
[1:47:46]
public hearing notice because this is a
[1:47:47]
public hearing and it was posted in the
[1:47:49]
county in St. Louis County on August
[1:47:51]
10th, 2026. And then we did not have a
[1:47:54]
list of addresses, so I'm sorry I didn't
[1:47:56]
take that off uh there and then this
[1:47:58]
presentation before the commission.
[1:48:02]
Any other questions from council?
[1:48:05]
>> All right. Anyone online?
[1:48:08]
>> Yep. We will close the public hearing
[1:48:11]
and the second reading will be on
[1:48:12]
September 8th. Thank you, mayor.
[1:48:15]
>> Thank you.
[1:48:16]
>> All right,
[1:48:18]
moving on to item 16, surface
[1:48:20]
transportation block grant agreement
[1:48:22]
with Missouri Highways and
[1:48:23]
Transportation Commission for the North
[1:48:25]
Price Phase One Grant Project.
[1:48:27]
>> Good evening, Mayor.
[1:48:31]
and council members.
[1:48:32]
Again, Bruce McGregor, public works
[1:48:34]
director. Um back in January uh work
[1:48:38]
session, we discussed our second uh
[1:48:40]
application for a surface transportation
[1:48:43]
suballocated grant for North Price Road
[1:48:47]
section one or phase one old bottom road
[1:48:50]
to uh Delmare. It's a little over 2,100
[1:48:53]
linear feet. We had applied the previous
[1:48:56]
year and and didn't score high enough.
[1:48:58]
So we made some strategic amendments to
[1:49:00]
our application and uh basically
[1:49:03]
offloaded some of the uh engineering
[1:49:06]
work out of the grant as the city
[1:49:08]
responsibility to try to meet a
[1:49:11]
threshold to score more points which is
[1:49:13]
one of the criteria used when the uh
[1:49:16]
committee is reviewing the uh the grant
[1:49:18]
applications. Uh so we found out a
[1:49:21]
little bit earlier by looking at the
[1:49:23]
agendas for the uh commission at East
[1:49:25]
West Gateway that we were on the
[1:49:27]
recommended list and then a couple weeks
[1:49:29]
ago we got a formal notice from uh MDOT
[1:49:33]
from the local projects uh administrator
[1:49:36]
that we were on the list for the uh
[1:49:39]
meeting this week for award approval and
[1:49:42]
that they recommended uh to hit the
[1:49:45]
ground running that we present our uh
[1:49:47]
the agreement to council for a
[1:49:48]
pre-authorization
[1:49:50]
uh to uh to uh execute the agreement
[1:49:54]
should the uh board uh go ahead and do
[1:49:57]
the expected uh you know decision this
[1:50:00]
week. Uh be glad to answer any questions
[1:50:03]
about the project, the timing, um next
[1:50:06]
steps, what we've already completed,
[1:50:08]
anything like that.
[1:50:11]
>> Excited about it.
[1:50:12]
>> Yeah.
[1:50:13]
>> Good snooping.
[1:50:15]
>> Yeah. And just FYI as well, uh, since
[1:50:18]
Amron had been so busy there, we've
[1:50:20]
received notice for them that they've
[1:50:22]
done all of the energizing work on the
[1:50:25]
circuits, uh, they may be coming back
[1:50:27]
into town over the next few months,
[1:50:30]
removing some obsolete cable uh, from
[1:50:33]
the runs, but everything is in service
[1:50:35]
uh, for that uh, load balancing or load
[1:50:38]
relief project uh, for the distribution
[1:50:41]
in University City and Leoo uh, just
[1:50:44]
since it's in that same area that that
[1:50:45]
project is done. Uh there
[1:50:48]
>> so if we were to get final approval for
[1:50:50]
this, I think this is question in
[1:50:52]
everyone's mind. When would this project
[1:50:54]
be realistically done?
[1:50:56]
>> Well, so that's a a very fair question.
[1:50:59]
What we have done uh last year uh we had
[1:51:02]
committed to doing the survey. Uh this
[1:51:05]
year what we had began we began in last
[1:51:07]
budget year which is in the spring was
[1:51:09]
the design work. Uh our intent is to
[1:51:13]
have our what what they call an RE
[1:51:16]
request for environmental review. So
[1:51:18]
that is a uh a submitt that goes to
[1:51:21]
Jefferson City to basically clear any
[1:51:24]
environmental impacts we have and that
[1:51:26]
might be more than just like hazardous
[1:51:28]
materials but like native people or some
[1:51:31]
other social economic uh impacts uh
[1:51:34]
along with uh ecology as well. You know
[1:51:37]
are we displacing any bats? The biggest
[1:51:40]
unknown we have is rightaway
[1:51:42]
acquisition. So, we have a 40-way
[1:51:45]
rightway width. We want to maximize our
[1:51:48]
existing condition of two sidewalks,
[1:51:50]
right? One on either side. Uh we want to
[1:51:53]
have a safe roadway for motorists and
[1:51:56]
for cyclists. And we still want to have
[1:51:59]
that appearance that's, you know, I
[1:52:01]
think feels softer to us, which is a
[1:52:02]
tree lawn. So to accomplish all that and
[1:52:05]
relocate utilities and and other things,
[1:52:08]
we need at minimum a temporary
[1:52:12]
construction easement for grading uh
[1:52:14]
from probably all of the uh property
[1:52:18]
owners along the alignment. Okay. So um
[1:52:22]
once we start through this process and
[1:52:24]
get the rear submitted, we'll be
[1:52:26]
planning public meetings. Um we'll be
[1:52:29]
getting the word out, maybe going
[1:52:31]
doortodoor. Um, every time I walk around
[1:52:33]
with a vest with the engineer and we're
[1:52:35]
looking at conditions, you know,
[1:52:36]
interested parties come out. So many
[1:52:39]
folks are quite excited about it. But,
[1:52:41]
you know, once you start talking about
[1:52:43]
changing, you know, the side of your
[1:52:45]
house, people, you know, can start to
[1:52:47]
question things. So, um, we always hope
[1:52:51]
that we don't get to condemnation. We've
[1:52:53]
done it before. And on the old bottom
[1:52:55]
project, I think we submitted the final
[1:52:58]
court documents 2 or 3 days before our
[1:53:01]
grant expired uh which was uh almost $2
[1:53:04]
million for that project. So um we hope
[1:53:08]
we never get there again uh on there. So
[1:53:11]
that's our biggest announcement. So So
[1:53:13]
the long story short, we would hope to
[1:53:16]
be doing construction for the schedule
[1:53:18]
in 3 years. Um I'm hoping we can be
[1:53:21]
ahead of that. Um, I'm optimistic that
[1:53:24]
our residents will be enthusiastic.
[1:53:26]
We'll have a nice design, um, and we'll
[1:53:29]
be able to start the negotiation sooner
[1:53:31]
in the involvement and, you know, get
[1:53:33]
everybody signed off on. So any type of
[1:53:36]
um federal grant or grant run through
[1:53:38]
MODOT requires the city to do a lot more
[1:53:43]
um work and there are a lot more steps
[1:53:47]
that need to be taken than if we were
[1:53:50]
just doing a regular street project,
[1:53:52]
right? And so that is why it requires a
[1:53:55]
lot more time. Uh realistically, you
[1:53:57]
know, I would tell people three to four
[1:53:59]
years. Give yourself a little uh leeway
[1:54:02]
because it's not just us that has to do
[1:54:04]
the work. Um
[1:54:07]
when we do rideway acquisition, we do
[1:54:10]
all of that and then MDOT has to go
[1:54:12]
through and approve all of that and we
[1:54:14]
can't get started on the next step till
[1:54:15]
we finish right away. And then plans,
[1:54:18]
MDOT has to approve all of that. So
[1:54:20]
there's a lot of kind of us doing a lot
[1:54:22]
of work and then waiting on others and
[1:54:24]
then doing a lot of work and waiting on
[1:54:26]
others. So if you want to give um give
[1:54:29]
your constituents kind of a realistic
[1:54:30]
answer, 3 to four years.
[1:54:32]
>> We have the same concerns of
[1:54:34]
hypothetically a gas line that isn't
[1:54:36]
marked where
[1:54:37]
>> Yeah. And and and one of the challenges
[1:54:39]
is like what we ran into on the cost
[1:54:41]
share project is the area team meets
[1:54:44]
once a week. So and we aren't privy to
[1:54:47]
the meeting. So they meet, they review,
[1:54:49]
they ask a question. Well, then we have
[1:54:51]
a week to respond and then they ask
[1:54:54]
another question and then we have
[1:54:55]
another week to respond. So, you know,
[1:54:58]
it's not like we can make these
[1:54:59]
decisions on the fly. Um, and it so so that's exactly right. And and we have
[1:55:06]
we follow and we do everything by the
[1:55:08]
rules anyway, but we we have extreme
[1:55:11]
oversight on rightway acquisition
[1:55:12]
following what's called the Uniform Act.
[1:55:15]
Okay. It is uh designed to protect the
[1:55:18]
property owner, you know, and make sure
[1:55:20]
that everything is done, everything is
[1:55:22]
properly appraised, every opportunity is
[1:55:25]
given for the the owner to review and
[1:55:28]
sign off on, you know, without being
[1:55:30]
coerced. So, I mean, I always feel good
[1:55:33]
that I know we did the right thing. You
[1:55:34]
know, we always appraise everything. We
[1:55:36]
sometimes we get second opinions. We did
[1:55:38]
that on the cost share project because
[1:55:40]
we wanted to make sure it was such a big
[1:55:42]
acquisition that we were doing the right
[1:55:44]
thing and everything was being fair uh
[1:55:47]
you know for oversight.
[1:55:48]
>> So to answer your question are we going
[1:55:50]
to find something unexpected? Yes.
[1:55:53]
>> And it could be something positive
[1:55:55]
unexpected. It might not be something
[1:55:57]
positive. it. Who knows?
[1:55:59]
>> Um,
[1:56:00]
>> one of the most positive that's ahead.
[1:56:02]
>> Um, I don't know. Could be we need fewer
[1:56:05]
ride ofway than we thought, right? Yeah.
[1:56:08]
Um, there will almost always be
[1:56:10]
something unexpected.
[1:56:11]
>> Yeah.
[1:56:12]
>> All right. Fun times.
[1:56:13]
>> All right. Any other questions? And
[1:56:16]
anyone want to make
[1:56:18]
>> uh make a motion to authorize the city
[1:56:20]
manager to execute an STBG agreement
[1:56:24]
with the Missouri Transportation
[1:56:26]
Commission for the North Price Road
[1:56:29]
phase 1 project contingent upon final
[1:56:32]
award approval.
[1:56:34]
>> Second.
[1:56:34]
>> All right. Motion made second. Can we
[1:56:36]
please pull the council?
[1:56:38]
>> Council member Dragal.
[1:56:40]
>> Yes.
[1:56:40]
>> Council member Solomonov.
[1:56:41]
>> Yes.
[1:56:42]
>> Council member Clark.
[1:56:43]
>> Yes.
[1:56:43]
>> Chairman Prom Pashan Helman.
[1:56:45]
>> Yes. Mayor Lewis.
[1:56:46]
>> Yes.
[1:56:46]
>> Motion has passed.
[1:56:48]
>> Thank you very much.
[1:56:48]
Good luck.
[1:56:50]
>> Excited.
[1:56:51]
>> All right. Item 17, hearing from
[1:56:53]
citizens part two. Does anyone in the
[1:56:56]
audience or online wish to make a
[1:56:58]
comment?
[1:57:02]
» We're looking at one person.
[1:57:03]
>> Yeah, one person. All right, we'll move
[1:57:05]
on to item 18, review and acceptance of
[1:57:07]
minutes. Uh, anyone have any corrections
[1:57:09]
or notes to call out on the minutes?
[1:57:12]
>> All right. If not, I'll take a motion to
[1:57:14]
approve.
[1:57:15]
>> I'd like to make a motion to approve the
[1:57:17]
council minutes from uh August 11th,
[1:57:19]
2026.
[1:57:20]
>> Second.
[1:57:20]
>> All right. Could we please pull the
[1:57:22]
council?
[1:57:24]
>> Council member Juel,
[1:57:25]
>> yes.
[1:57:26]
>> Council member Solomonov,
[1:57:27]
>> yes.
[1:57:27]
>> Council member Clark,
[1:57:28]
>> yes.
[1:57:28]
>> Chairman Prom Halman,
[1:57:30]
>> yes.
[1:57:30]
>> Mayor Lewis,
[1:57:31]
>> yes.
[1:57:31]
>> Motion has passed. All
[1:57:33]
>> right. Thank you. We'll move on to item
[1:57:34]
19, city attorney's report.
[1:57:36]
>> No report this evening.
[1:57:37]
>> All right. But we do have a close
[1:57:39]
session.
[1:57:40]
>> Yep. Okay. All right. Right. Moving on
[1:57:42]
to item 20, close session. So, can I
[1:57:44]
please get a motion to go into close
[1:57:46]
session?
[1:57:46]
>> Like to make a motion go into close
[1:57:48]
session pursuant to the revised statutes
[1:57:51]
of the state of Missouri. Discuss
[1:57:54]
client, excuse me, attorney client
[1:57:56]
privileges, communications pursuant to
[1:57:58]
section 610.021
[1:58:02]
and real for and real estate matters
[1:58:04]
pursuant to section 610.0212.
[1:58:10]
» All right. All right. Do I hear a
[1:58:11]
second?
[1:58:11]
>> Second.
[1:58:12]
>> Please pull the council.
[1:58:15]
>> Council member Lewis. I'm sorry. This is the wrong one. Council member
[1:58:21]
Duel.
[1:58:21]
>> Yes.
[1:58:22]
>> Council member Solomon.
[1:58:23]
>> Yes.
[1:58:23]
>> Council member Clark.
[1:58:24]
>> Yes.
[1:58:25]
>> Chairman Prom Pashan Helman.
[1:58:26]
>> Yes.
[1:58:27]
>> Mayor Lewis.
[1:58:27]
>> Yes. All right. We will now close this
[1:58:30]
regular session and move into executive
[1:58:31]
floor session.
[1:58:36]
» All right. We'll call the we'll close
[1:58:38]
the executive session and call the
[1:58:39]
regular session back to order. Um no
[1:58:41]
major decisions were made uh at this
[1:58:45]
point. Um
[1:58:46]
>> I'll make a motion to adjurnn
[1:58:48]
>> and we will Yeah, we will adjourn at
[1:58:50]
9:45 p.m. Thank you.
