[5:33] vacating a possible future rideway. I'm just

[5:41] consideration to vacate a proposed future right ofway located approximately

[5:45] 2847 North Parkland Boulevard within the Simon subdivision. This will be a

[5:52] public hearing. Uh we'll go ahead and ask Tammy to present to assist for this

[5:56] evening. Okay, this one um this is a

[6:02] a dedicated future proposed right ofway that uh was

[6:11] deemed unnecessary based on it was originally put on the plat for a future

[6:17] rail crossing which is not going to be utilized. There won't be a rail crossing

[6:24] there. And so, um, we're vacating that and it's part of a a a an agreement with

[6:31] the property owner where they made some concessions on some property

[6:38] up a street to the south. I think it's 31. Can't remember the street number,

[6:44] but um the south of their property that uh they gave us some space there for the

[6:52] to do the corner and chamfer. and um 2775 2775

[7:01] to um and then we would vacate that proposed future right away. Um that is

[7:09] not going to be necessary. So we're just proceeding with that. Um DRC has

[7:15] reviewed it with our engineer and um there aren't any any questions there.

[7:23] We haven't had any comments from the public. So our recommendation is to go

[7:28] ahead and vacate that. >> Is this a city generated or is this by

[7:34] the >> It's city initiated.

[7:40] » Then I can't be mad because you're representing the city. I can't be mad

[7:54] we originally, if you remember right, we were going to have a couple different

[7:58] rail crossings over the years in the general plan. This is cleaning up some

[8:01] of that. Um, if you remember right, a few months ago that we switched land

[8:07] down there by the old charter school so we can have a a crossing uh because this

[8:13] is not going to give us this many crossings along area because of park

[8:17] trains there. So, >> and if you look at the future road map

[8:20] here, um where the easement is is up here on this the south end of the lot

[8:29] there. Um that originally was on the future road map and now it's it's been

[8:35] changed because it's not necessary. So, the road is shown down here instead.

[8:49] I have a question. Okay. Question. >> What's the purpose of relinquishing that

[8:55] or vacating that? >> It's just not necessary for the

[8:59] development. And it's and it's um because there will not be a rail

[9:04] crossing there. That was the only reason we had it there from my understanding.

[9:08] And since we won't have a rail crossing there, there's no need for having the

[9:13] road there. this road or this is the planned road to continue north this way.

[9:20] But um as far as the east west road, >> there is a need for it now.

[9:30] » Is there any possibility that the Union Pacific might relent a little bit

[9:34] particularly with the development going along the freeway there? We're going to

[9:37] have a lot of traffic that we haven't anticipated up till now.

[9:42] doubtful I would say um just from the

[9:48] the planning that we have done in DRC in order to get the rail crossing further

[9:54] north um above the charter school.

[10:00] If we were to get that, they would require us to close several other

[10:04] crossings along the way. of for them to any anticipation of them allowing a

[10:11] crossing there besides there's development there now too. So

[10:16] » and if you watch uh if you watch it when it goes across you'll have your trains

[10:21] that are parking you along that whole stretch there. And so these really are

[10:28] just farmer crossings. And that something we've always been up against

[10:31] is them not allowing, you know, eventually those will probably

[10:35] be closed as farmer crossings because they're not going to allow people to use

[10:38] it just as a straight shot run across.

[10:44] » Okay. And to answer your question, I think then that allows the developer

[10:48] without the large

[10:53] was being left there. John question

[11:01] the middle the one down at the at the on the south end there that's probably
