» Good afternoon. Uh and thank you. We
[0:30]
have one agenda item this afternoon. Um
[0:33]
and it is a use permit application. Mr.
[0:36]
Bill Landfair is going to provide the uh
[0:40]
staff report for that uh item. And then
[0:43]
we're going to follow that with an uh
[0:47]
brief review of our agenda items for our
[0:49]
board of zoning appeals meeting um
[0:54]
uh for March 25th. And then we're going
[0:56]
to provide a project update for our
[0:58]
comprehensive planning projects for the
[1:00]
department. Mr. Landfair, principal
[1:02]
planner.

planning commissioners.
[1:06]
» Good afternoon.
[1:07]
» Bill Lanfair, principal planner with the
[1:09]
city of Portsouth planning department.
[1:12]
The application before you today is a
[1:15]
request for a use permit for the
[1:17]
development of three townhouse units on
[1:19]
approximately. 61 acres located at 531
[1:24]
Edward Street in the multifamily urban
[1:26]
residential zoning district.
[1:29]
The subject property is located adjacent
[1:32]
to the Southside Gardens and Portide
[1:34]
Manor multifamily neighborhoods and is
[1:37]
also near the Port Center commercial
[1:39]
park.
[1:41]
The property is vacant, measuring
[1:43]
approximately 75 ft in length and 121 ft
[1:47]
in depth for a total of 9,075
[1:50]
square ft or.21 acres. It's located
[1:54]
within the AE8 special flood hazard area
[1:58]
and the resource management area of the
[2:00]
Chesapeake Bay preservation area.
[2:03]
The surrounding neighborhood is
[2:05]
characterized by a mix of residential,
[2:08]
commercial, industrial, and
[2:09]
institutional land uses all within two
[2:12]
blocks of the subject property.
[2:16]
To the north and west, there are
[2:17]
multifamily developments containing town
[2:20]
houses, condominiums, and apartments
[2:22]
zoned multifamily urban residential.
[2:26]
To the east and south are detached
[2:28]
single family residences also zone
[2:30]
multifamily urban residential.
[2:34]
Additionally, two family and three to
[2:37]
four family dwellings can be found
[2:39]
within about one block of the subject
[2:41]
property.
[2:44]
The applicant is proposing to subdivide
[2:46]
the property into three townhouse lots.
[2:49]
Two will be end units 3,449
[2:53]
square ft in size and one will be an
[2:56]
interior lot 2,178
[2:59]
square ft in size. Each townhouse will
[3:02]
measure 18 ft in width and 30 ft in
[3:05]
depth providing 1556 square ft of living
[3:09]
area. Each dwelling will have a driveway
[3:11]
accommodating two off- streetet vehicle
[3:13]
parking spaces which satisfies the
[3:16]
requirement for the use.
[3:19]
Each unit will also include a covered
[3:21]
front porch and a seconds story rear
[3:23]
balcony. The submitted elevations and
[3:26]
conceptual plans are incorporated into
[3:29]
the conditions of approval for the use
[3:31]
permit to ensure substantial conformity
[3:34]
with the recommended design standards.
[3:37]
Staff is recommending approval of the
[3:39]
applicant's request with the recommended
[3:41]
conditions. The proposed residential use
[3:44]
will be consistent with the overall
[3:46]
intent and policies of the city's build
[3:48]
one portsmith comprehensive plan and the
[3:52]
citywide strategic housing plan
[3:54]
particularly relating to improved
[3:56]
housing quality and the provision of
[3:59]
mixed income housing. The development
[4:01]
will be appropriate at this location. It
[4:04]
provides compatible infill that improves
[4:07]
the appearance of the property and has
[4:09]
an architectural design that will
[4:11]
complement the surrounding area. The
[4:13]
planning department has not received any
[4:15]
public comments. This concludes my
[4:18]
presentation and I'll now stand by for
[4:20]

» The next agenda items um will be
[4:43]
presented by Mr. Travon Boon, our zone
[4:46]
administrator, and he's going to review
[4:48]
the uh board of zoning appeals agenda
[4:50]
items that will be considered on March
[4:52]
25th.
[4:54]
» Um good afternoon, commissioners. I say
[4:56]
that I am Son, zoning administrator for
[4:58]
the city of Portsouth. Um there are five
[5:00]
cases to be heard before the board of
[5:02]
voting appeals on March the 25th um at
[5:04]
our BCA meeting. Um those items include
[5:07]
1404 Center Avenue. Um they are
[5:10]
requesting a special exception to
[5:12]
authorize the reduction of the minimum
[5:14]
minimum required side yard setback from
[5:16]
7 ft to 3 ft and that's in order to
[5:19]
construct a detached single family
[5:20]
dwelling on a narrow lot. Um the next
[5:24]
item that we have is 316 High Street and
[5:28]
also 330 County Street. Um both are
[5:31]
requesting a special exception to
[5:33]
authorize a residential ground floor
[5:36]
conversion in accordance with section
[5:38]
40.2-535
[5:41]
subsection B subsection 2.
[5:44]
The next item that we have is 822
[5:46]
Garfield Street. They are requesting a
[5:49]
variance in or in accord in in
[5:51]
accordance excuse me with zoning
[5:52]
ordinance section 40.2534
[5:55]
subsection B subsection 6 to allow for a
[5:58]
deviation from the provisions of the
[6:01]
city code chapter 14.1 and the flood
[6:04]
protection area. And the last item that
[6:06]
we have is 1204 airline boulevard and
[6:09]
they're also requesting a variance to
[6:11]
reduce the side yard setbacks
[6:13]
requirements from 20 ft to 14 ft. and
[6:16]
they are all the items that we have by
[6:18]
our March the 25th meeting for the board
[6:20]
of zoning appeals.
[6:22]
» Commissioners, the um code of Virginia
[6:25]
requires that um we share with the
[6:28]
planning commission those agenda items
[6:29]
for our board of zoning appeals meeting
[6:31]
in the event that you have comments that
[6:34]
you would like for us to uh share with
[6:36]
board members or appear uh before the
[6:39]
board during their deliberations.

[6:51]
projects if I may share that with
[6:53]

Members of the commission, I um what you
[7:41]
uh traditionally see from um our agenda
[7:45]
items monthtomonth, you'll see resoning
[7:47]
applications, you'll see use permit
[7:49]
applications. Occasionally um over the
[7:52]
the 24 months that I have been on board,
[7:55]
you've seen a couple of zoning ordinance
[7:57]
text amendments, but I thought as we
[7:59]
were deliberating amongst our team
[8:01]
members uh about project assignments and
[8:04]
priorities of projects that it would be
[8:06]
beneficial to share with the
[8:07]
commissioners the comprehensive planning
[8:09]
projects or the long-term planning
[8:11]
projects that we're working on and then
[8:13]
to give you some status information
[8:15]
about those projects. I also think that
[8:17]
it's um
[8:21]
prudent to share this information with
[8:23]
you because we often get requests. I
[8:25]
received a request this morning from a
[8:26]
citizen that made an appointment to
[8:28]
speak to me about things that they think
[8:30]
we ought to be involved in and put on
[8:32]
our list of priorities. Um and so uh the
[8:36]
first item is the historic uh district
[8:39]
design guidelines review. Mr. Bill
[8:42]
Landfair uh coordinates and supports
[8:44]
both our uh uh historic preservation
[8:47]
commiss commission and our uh DDC our
[8:51]
our downtown design um commission. And
[8:55]
what we have found um is that the design
[9:00]
guidelines for both districts really
[9:03]
don't take advantage of some of the new
[9:06]
opportunities for materials um that are
[9:10]
more costly. uh and more effective um in
[9:14]
terms of um uh energy efficiency and
[9:17]
other efficiencies. Um and because
[9:20]
they're not in the guidelines, they are
[9:22]
not ready opportunities for property
[9:24]
owners to use. So take for example slate
[9:27]
roofing. They're composite materials
[9:30]
that emulate that so that from the
[9:33]
untrained eye, they're
[9:35]
indistinguishable, especially if you're
[9:37]
looking at it from the ground level. and
[9:39]
our design guidelines don't um currently
[9:42]
permit that. Additionally, for window
[9:44]
treatments, composite window treatments
[9:47]
that resemble wood material um that
[9:50]
would be appropriate. Our design
[9:52]
guidelines in many instances don't
[9:53]
permit. And so um for at least a year uh
[9:58]
I have u been party to discussions about
[10:01]
when are we going to update the historic
[10:04]
uh preservation district uh design
[10:06]
guidelines and we are undertaking that
[10:09]
effort as we speak and so we want you to
[10:11]
be aware of that. In addition to um the
[10:15]
materials, we want to review the
[10:18]
administrative
[10:20]
um
[10:22]
allowances that would permit uh staff to
[10:25]
review and approve
[10:28]
uh work within our historic districts
[10:30]
and issue a certificate of occupancy
[10:33]
without having to go through board
[10:35]
review. And the reason why that's
[10:37]
important is in in most instances it
[10:41]
time is money. And if we can get a
[10:43]
project to construction four weeks
[10:46]
faster or eight weeks faster, we are um
[10:51]
uh improving the outcome from the
[10:54]
developer or the property owner just by
[10:57]
the nature of uh saving time and saving
[10:59]
money.

We've talked a lot about the link
[11:03]
district and uh you most recently
[11:06]
considered amendments to the uh
[11:10]
Portsmith zoning ordinance uh regarding
[11:13]
adoption of provisions um of the
[11:15]
ordinance to implement the
[11:17]
recommendations of the innovation plan.
[11:20]
You will recall that we propose that we
[11:23]
do that in two phases. Um that we put
[11:26]
forth those prescriptive recommendations
[11:28]
that are in the plan and we follow that
[11:31]
effort with a stakeholder engagement
[11:34]
process so that we readress some of the
[11:37]
design guidelines that uh are outlined
[11:41]
in the innovation plan to model um some
[11:45]
of the observations that we've made in
[11:48]
other areas. main street downtown areas
[11:51]
that have reinvented themselves. Um that
[11:55]
effort where we are is developing or
[11:57]
identifying stakeholders who would be
[11:59]
involved in that process. Uh we have
[12:02]
intentionally sought to observe the
[12:05]
stakeholder engagement process around
[12:08]
the Crawford Bay um
[12:11]
um uh stakeholder public engagement
[12:15]
efforts that have just includ concluded
[12:18]
and and I'll share with you that um I
[12:21]
actually registered as a participant uh
[12:24]
in the um Porsmith um it was on our the
[12:27]
Porsche website and I just marveled how
[12:32]
that uh the updates for real time for
[12:35]
both of the community engagement efforts
[12:38]
uh were sent to me by text message, by
[12:40]
email uh and by phone. So, it would have
[12:43]
been impossible to forget uh that both
[12:45]
of those activities were occurring and
[12:48]
then what we were being asked to do as
[12:51]
stakeholders
[12:52]
uh in the process in in our
[12:54]
participation. And so we're going to as
[12:57]
closely as possible mimic that process
[13:01]
uh in the development of the link
[13:03]
district design guidelines.
[13:06]
So our short-term rental ordinance, we
[13:10]
don't know if we presented this to the
[13:12]
planning commission or not, but in
[13:13]
September we did present to uh the city
[13:17]
council in a work session uh information
[13:20]
about our short-term rental ordinance
[13:22]
and the provisions of the code of
[13:23]
Virginia. And so just in a quick
[13:26]
summary, um the code permits by right uh
[13:30]
a property owner to use their property
[13:33]
for short-term rentals as long as they
[13:36]
are residing in the property at least
[13:38]
50% of the time. Okay? So that could
[13:41]
mean to, you know, if you take six
[13:43]
months out of the year, say they they're
[13:44]
living in the property six months and
[13:46]
then they're using it as a short-term
[13:48]
rental six months or they're residing at
[13:50]
the in the property at the same time or
[13:54]
portion of the time that it is also um
[13:56]
being leased as a short-term rental. Um
[14:01]
we had committed to um well we have
[14:04]
committed to to have this process
[14:07]
complete by summer 2026.
[14:10]
Um the the
[14:13]
challenge with this one is that the the
[14:16]
stakeholders aren't readily
[14:18]
identifiable, you know, because I mean
[14:20]
in general they're property owners. Uh
[14:23]
we think that the um the uh real estate
[14:27]
brokerage industry would would also be
[14:29]
stakeholders uh involved in this
[14:31]
process.
[14:32]
uh property managers. There are all
[14:35]
kinds of uh levels of expertise that we
[14:37]
want to bring to the table in uh vetting
[14:40]
and developing an ordinance uh for
[14:43]
short-term rentals. Uh I noticed over
[14:45]
the weekend um
[14:49]
a community is very different from from
[14:51]
Portmith. Uh but it's the town of
[14:53]
Smithville. There's an article that said
[14:55]
they have very few uh short-term rentals
[14:58]
and their ordinance only requires the
[15:00]
registration um of the uh property as a
[15:04]
short-term rental and uh a business
[15:07]
license. And so uh we are uh also
[15:11]
responsible for benchmarking and and
[15:13]
just finding out you know what what our
[15:15]
neighboring localities are doing and
[15:16]
what's working uh what's not working and
[15:19]
then try to launch our ordinance process
[15:22]
in a way that avoids those uh regulatory
[15:26]
practices that that did not work for our
[15:28]
neighbors.
[15:30]
Uh comprehensive plan update. So we did
[15:34]
an audit of the comprehensive plan that
[15:36]
we presented to the PL our planning
[15:38]
commissioners and council. Uh we have
[15:42]
actually out on EVA which is the state's
[15:45]
uh procurement website uh a request for
[15:48]
proposals where we're seeking consultant
[15:50]
support to help us in the development of
[15:53]
our 2040 comprehensive plan. We
[15:56]
anticipate that that is going to be uh
[15:59]
about a a a 24 to 30month effort. Uh we
[16:04]
are uh well aware of the best practices
[16:07]
uh Commissioner Melvin that you have
[16:08]
asked us to consider uh in the
[16:11]
development of that plan. Along the way,
[16:14]
you will uh as commissioners will
[16:16]
receive periodic reports uh on the
[16:19]
status of our plan development uh as
[16:23]
well as information about our
[16:24]
stakeholder and public engagement um uh
[16:28]
activities so that you can participate
[16:30]
if you'd like. And then the last item um
[16:34]
we should mark that as complete. We did
[16:36]
a overhaul of our Chesapeake Bay
[16:39]
uh preservation district ordinance uh
[16:42]
and uh reaffirmation of the maps
[16:45]
designating our RPA, RMA
[16:48]
um and intensely developed area features
[16:51]
uh on our map. And so just want um
[16:54]
commissioners to be aware, you know, in
[16:56]
tandem as we're processing these uh land
[16:58]
use applications and our site plans and
[17:00]
our subdivisions and supporting our five
[17:02]
boards and commissions, we are also
[17:04]
working on those long-term projects that
[17:07]
really um will change the uh physical um
[17:14]
appearance, the physical uh plant of the
[17:17]
community. Uh and those efforts take
[17:20]
time.
[17:21]
I'm happy to answer. I'm looking at this
[17:23]
is usually y'all are surprised. So, I
[17:26]
have an audience of three today.

» Um I think it's just one that is not on
[17:34]
this sheet, but it's up there. The code
[17:37]
enforcement for entertainment venues.

» We took that off. You know why? Cuz we
[17:41]
we we are for the most part done with
[17:44]
that. We have to tweak that ordinance
[17:46]
that was adopted in August 2026.

relative to implementation because we
[17:53]
had some some challenges that I I don't
[17:55]
want to discuss um in public because I'd
[17:58]
be identifying the specific properties.

» Um but with respect to uh enforcement
[18:05]
and um mitigation of of the the two
[18:09]
properties that were a challenge, those
[18:11]
issues were resolved on February 25th.

I definitely like the historic district
[18:21]
design guideline review. Thank you so
[18:25]
much. Um I learned about that the hard
[18:28]
way by actually going through it. Um but
[18:31]
everybody was great, especially Phil and

Miss Rhonda. Um, but I do like that it
[18:36]
was uh even a thought um Sean I think
[18:39]
his name is who is the president of uh
[18:42]
the HPC to like once in a while have a
[18:46]
meeting of the minds for everybody
[18:47]
involved like from
[18:50]
historical to planning commission to
[18:52]
zoning just so that like we make sure
[18:54]
we're all on one page about some of the
[18:56]
changes that come down the pipeline. Um,
[18:59]
I'm excited for the link district and
[19:03]
short-term rental ordinance. That's
[19:05]
going to be um a project. A project and
[19:10]
a challenge, but I know you guys can get
[19:12]
it done. So, I'm excited about
[19:13]
everything that's on the list for the
[19:15]
city.

stakeholder for the link district

ordinance and the uh comprehensive plan.

um considering my feedback for the
[19:39]
comprehensive plan. I know uh doing a
[19:42]
great job here with including smart
[19:43]
goals which are very important. Um but
[19:46]
also including like a capability matrix
[19:48]
for each department will help out
[19:50]
because you'll find yourself in the same
[19:52]
predicament as last year with uh
[19:55]
departments not um doing certain you
[19:58]
know objectives cuz they just might not
[20:00]
have the capability such as you know
[20:02]
funding or the amount of people. So the
[20:04]
capability matrix gives Mr. Carter the
[20:06]
opportunity to see where each department
[20:08]
is at and be able to fund or plan out so
[20:13]
that they can reach that objective. So
[20:15]
just just something to to note there so
[20:18]
that we can
[20:20]
show action with a comprehensive plan.
[20:23]
» Okay. Can you help me with how is the
[20:25]
capability metrics um different than uh
[20:30]
a task an assignment?
[20:32]
» Yeah. So you can um provide you can give
[20:35]
any task right but if the department per
[20:39]
se can't meet that task
[20:42]
then it's just it's just out there it's
[20:44]
not going to be done. So with the
[20:45]
capability matrix matrix it shows you
[20:48]
there's like a a taxonomy out there that
[20:52]
shows you like uh from levels one to
[20:53]
five
[20:55]
um where you can meet at. And like
[20:57]
usually typically when companies do this
[21:00]
they want to be at level three or four.
[21:02]
That means that their pro processes are
[21:03]
in place. They have the right amount of
[21:05]
people that can do the job. They have
[21:07]
the funding so that they can meet that
[21:09]
task. Now, if you're under level three,
[21:12]
if you're at one or two, that means you
[21:14]
don't have the processes in place, you
[21:15]
don't have the funding, you don't have
[21:16]
the people, so you can't meet that
[21:18]
objective. And there's nothing to do
[21:20]
with, you know, the department itself.
[21:22]
It's just that there's some there's a
[21:24]
shortage somewhere. And with the
[21:25]
capability matrix, it gives you the city
[21:28]
manager the um the ability to see like,
[21:32]
okay, I see where my shortfalls are at
[21:35]
now. I can uh strategically
[21:37]
um allocate resources to that department
[21:41]
so that they can meet that objective if
[21:43]
that's your priority. So that's how
[21:46]
capability matrix will will help out
[21:47]
with the task. Because if you just have
[21:49]
a task and smart goals, it's nice to
[21:51]
have on paper,
[21:54]
but you need the people, you need the
[21:55]
funding, you need the processes in order
[21:58]
to actually execute. And that's where I
[22:01]
realized that a lot of, you know,
[22:04]
companies uh go wrong is that they don't
[22:06]
have the means to execute. I know we're
[22:08]
in a resource constraint environment
[22:11]
and this allows you to see on paper
[22:13]
where we're at and then prioritize um
[22:16]
based off of that. Right. So, you know,
[22:19]
we always say like the the hard thing is
[22:22]
not what you're going to do, it's what
[22:24]
you're not going to do. And capability
[22:26]
matrix helps you plan that. So,
[22:29]
