discussion on Oh, I guess we have to

have the public hearing first.

We'll start our public hearing for um
[3:57]
item number one, action regarding
[3:59]
restricting bulk fuel storage in
[4:00]
residential zones.
[4:03]

I'm happy just to um go through an
[4:12]
amendment. You probably recognize the um the item we talked about um
[4:20]
prohibiting the storage of um fuel 150
[4:24]
gallons or more residential districts.
[4:26]
So, this is one of those it's been um
[4:28]
you know, it went through the planning
[4:30]
commission under recommendation of
[4:32]
approval and then um you know, in
[4:35]
speaking kind of with the the the
[4:36]
leadership being the city manager um the
[4:39]
assistant city manager and the city
[4:41]
attorney um they felt like we needed to
[4:43]
make um a few more changes. How it was
[4:45]
written before, it was more of kind of a
[4:48]
standard where it was restricted under
[4:50]
the table, no more than 150 gallons.
[4:52]
what the um city uh attorney um and uh
[4:56]
and Jason really felt that it should be
[4:58]
turned more into a use and so we created
[5:00]
a bulk fuel storage use and so that's
[5:04]
what was put in uh in the table and
[5:06]
actually today so u as far as that goes
[5:09]
there's a definition it's pretty simple
[5:11]
that that we provided if you look at the
[5:13]
amendments and then under um each of the
[5:16]
tables for the residential districts
[5:18]
it's a use bulk fuel storage and then
[5:20]
it's a non-permitted use or a prohib I'm
[5:23]
sorry a non yeah a non-permitted use or
[5:26]
prohibited use. Um so in talking with um with with with the city manager um he
[5:34]
felt that um we needed to go a little
[5:37]
bit further because there are some
[5:39]
properties that are zoned residential
[5:41]
but are actually historically used
[5:43]
agriculturally. And he said how it's
[5:45]
written right now um potentially it
[5:47]
could impact those operations. And so
[5:51]
even though like we feel like how the
[5:52]
code's written, it it it won't disrupt
[5:55]
that agricultural use, but he wanted to
[5:58]
ensure that it was crystal clear in the
[6:00]
code. And so today, I've been kind of
[6:02]
going back and forth, city manager and
[6:04]
our city attorney. Um and so I have a
[6:06]
few amendments. Um, so if you do
[6:09]
recommend a positive um
[6:13]
recommendation to the the city council,
[6:16]
we'd like it to be with the
[6:19]
consideration of some some new language.
[6:21]
And so this is the staff report that you
[6:24]
received. Um, and the blue is what was
[6:29]
in the staff report. The red is what was
[6:31]
added working with the attorney and the
[6:33]
city manager today. Um, so we have a a
[6:37]
few spaces where where it was provided
[6:39]
and so the
[6:43]
yeah the definition I can pull we pull
[6:45]
up the definition. So we do uh because
[6:47]
first let me pull up the definition for
[6:50]
bulk fuel storage.

[7:14]
was the or the the definition that was
[7:16]
provided in your packet. So it's bulk
[7:18]
fuel storage of gasoline used fuel,

kerosene or other liquid fuel in one or
[7:23]

[7:25]
combined capacity greater than 150
[7:27]
gallons on a single parcel. Bulk fuel
[7:29]
storage does not include fuel contained
[7:31]
within the factoryinstalled tank of an
[7:34]
operable motor vehicle or or equipment.
[7:36]
And so it's um essentially if you have
[7:40]
um storage of fuel, it's going to cap it
[7:42]
on 150 gallons. It's the same um ba
[7:47]
basic impact that that it had in the
[7:49]
last code. It just clarifies it and it
[7:52]
makes it as as a use. So that's the
[7:54]
definition.

And then
[8:01]
this document,
[8:03]
yeah, this word document, this is the staff report, but then we added in
[8:07]
the red to really ensure and make it
[8:10]
crystal clear that it um will not impact
[8:14]
currently operating agricultural
[8:17]
businesses that are in residential
[8:18]
districts. So the first um is the home
[8:21]
occupation section. So the home
[8:23]
occupation section just under the the
[8:25]
prohibited um uses under that code we
[8:30]
had simply just bulk fuel storage. Now
[8:33]
we provide a little bit more
[8:34]
clarification except so it's bulk fuel
[8:36]
storage except when accessory and
[8:38]
incidental to a lawfully established
[8:40]
agricultural operation conducted on
[8:42]
residentially zoned property. Fuels
[8:44]
stored under this exception shall be
[8:46]
used solely to support the agricultural
[8:48]
operation. It should not be sold or
[8:50]
dispensed for any unrelated purpose. So
[8:54]
just making it clear, we're not going to
[8:57]
have an impact to our agricultural u
[8:59]
businesses. And then under the use
[9:02]
table. So this is um the language that
[9:06]
we'll then put throughout all the
[9:08]
residential uh tables, but we just had
[9:10]
time to put it in this as an example in
[9:13]
the staff report. So if approved, we
[9:16]
would then duplicate this in the rest of
[9:18]
those residential um use tables. So the
[9:21]
first one is the bulk fuel storage. Um
[9:24]
and so accept agricultural bulk fuel
[9:27]
storage as provided below. And so that's
[9:30]
where we have the N. It's a
[9:31]
non-permitted use for residential. But
[9:33]
below that is the carve out for
[9:36]
agricultural uses in residentially zoned
[9:39]
properties. So bulk fuel storage
[9:40]
agricultural um bulk fuel storage that
[9:43]
is accessory and incidental to lawfully
[9:46]
establish agricultural operation
[9:48]
conducted on the property. Fuel stored
[9:50]
under this provision shall be used
[9:52]
solely to operate vehicles, machinery
[9:54]
and equipment used in that agricultural
[9:55]
operation. and it shall not be offered
[9:57]
for sale distribution for use outside of
[10:00]
the agricult agricultural operation. All
[10:04]
storage shall comply with applicable
[10:06]
fire building and environmental
[10:07]
standards. So even an agricultural use,
[10:11]
if there's large amounts of fuel, they
[10:13]
still have to meet building code for for
[10:14]
safety and whatnot. But that's the
[10:16]
provision that would um kind of
[10:18]
safeguard our agricultural uses. So
[10:21]
should have the same impact. just makes
[10:23]
it really crystal clear and uh you know
[10:26]
should meet kind of what our city
[10:28]
manager and our um city city attorney
[10:31]
want in terms of just making sure that
[10:33]
our agriculture uses are safeguarded
[10:35]
while still providing kind of the public
[10:37]
safety feature for our home occupation
[10:39]
so we're not having large amounts of
[10:41]
fuel associated with with just a general
[10:43]
home occupation.

Um and that is is everything from staff.

So the red hopefully that's clear the
[10:50]
red is what was added today. The blue is

specifically written um to target just

those residential, the R8, I think the

R10, the R15, it would impact those. So
[12:24]
the idea is like your tra traditional
[12:26]
single family um you know having large
[12:29]
amounts of of uh storage of fuel like
[12:33]
inside inside the garage that that
[12:35]
that's where it would it would it would
[12:36]
have an impact.

[12:40]
permit that you have to go through if
[12:42]
you wanted [clears throat] so they would
[12:45]
be involved in a situation like that if
[12:46]
it came up.

not everybody, but a lot of people would
[12:52]
subscribe to the fact that they would
[12:54]
are trying to u be self-reliant.

And so to be self-reliant, a lot of
[13:01]
times they will store some things up and
[13:04]
that would may include fuel. Wouldn't it
[13:07]
be better to go through a permitting
[13:10]
process and a process of safety
[13:13]
regulation instead of just outright
[13:16]
banning it?
[13:18]
Um, so it it it really depends on on on
[13:21]
what the process was. So when we went
[13:22]
through um we met with like our public
[13:24]
works and our our fire official and they
[13:28]
felt like the 150 galon would still
[13:30]
provide um folks enough enough storage
[13:33]
if they had four-wheelers and things of
[13:35]
that nature on site for a residential
[13:37]
use. what our concern is and and we we
[13:40]
had um we have received requests for
[13:43]
this in the past, but folks that want to
[13:46]
sell fuel as a home occupation. And so
[13:48]
that that that that is a use that that we have seen and that um has been
[13:53]
requested in the past. And so that that is of of concern because it's kind
[13:57]
of making a potentially like a a a gas
[14:01]
station in in a residential district,
[14:03]
but you know, not not official gas
[14:05]
station, but we we didn't we didn't want
[14:07]
um to to blur lines like we we felt like
[14:10]
that was a good use that we wanted to
[14:13]
take out of the the home occupation
[14:14]
section.

So that's that's
[14:18]

saying you cannot sell fuel out of a
[14:23]
household or a
[14:24]
>> or a domestic dwelling if you want to
[14:27]
put it that way. But to limit people and
[14:31]
take away their choice to be able to
[14:34]
store enough fuel for themselves and
[14:35]
their family in case of an emergency
[14:40]
I think is a negative.

So, and I can see where we'd want to do

it safely.

way to put some regulation around it

you know, uh, having moved here from

Missouri, there are a lot of, um, towns
[15:28]
where the outskirts of town, people will
[15:30]
have a, you know, a 1500 gallon propane tank so that they can make it
[15:37]
through the entire year if they need to.
[15:39]
And I would think we'd want to provide
[15:40]
our citizens the same option here to be
[15:43]
able to have something like that if if
[15:45]
they so choose. I'm not saying everybody
[15:48]
wants that, but taking away someone's
[15:51]
freedom of choice is something that I
[15:53]
don't like. Saying, "Hey,
[15:56]
we want you to be safe in our community,
[15:59]
I think that's reasonable, but just
[16:01]
taking the choice away, I I don't agree
[16:04]
with." And maybe I'm looking at it
[16:05]
wrong. if anybody,
[16:07]
you know, I'm just these are all
[16:10]
thoughts that came to my mind as I was
[16:11]
reading through the agenda packet for
[16:13]
tonight. And so, um,
[16:17]
I I don't want my neighbor to improperly
[16:20]
store,
[16:21]
you know, 500 gallons of gasoline right
[16:24]
next to my property, but I don't want to
[16:26]
take his right away to be able to do
[16:28]
that if
[16:30]
he's being safe about it.
[16:33]
So,

it's kind of a catch 22, I guess, is
[16:37]

the the feeling was like 150 gallon is

would get you u would get mo most people

what what what they needed. did. Um, but
[17:31]
going above that, like the the thought
[17:34]
was like then potentially you're you
[17:36]
might be getting into more of a
[17:38]
commercial capacity where someone could,
[17:40]
you know, be be using that for a
[17:42]
business or commercial purpose.

looking at just the the storage or like

now it's more of like an umbrella, it's

like the personal use and it's home

occupations. Um, we could start by just

occupation as opposed to just the the general storage. Um, and so if
[18:07]
that's a route that the planning
[18:09]
commission feels more comfortable with,
[18:10]
we we could we could look at that that
[18:13]
as well. Um,

occupation chapter, right above, it says

that you can't have um chemicals and

good upper limit of what someone would

want to store. Yeah,

would be in addition to um if you feel like that goes too far, you could

make it very specific to just the home

occupation use and just you know fuel

target that. I would think we we would

want to look at that maybe maybe a a
[20:35]
little bit more and and and come come

back to you if if that's if that was the

consensus of the planning commission. So

you have you have a lot of options you
[20:42]
could recommend as proposed tonight. You
[20:45]
could kick it back to staff with the
[20:48]
direction that you you want it to be
[20:50]
more narrowly focused on on home
[20:52]
occupations as opposed to to storage.

Um, if if you do
[20:58]
if if there is a concern, well, I'm
[21:01]
trying to think too, like if someone
[21:02]
does for a storage purpose for their own
[21:05]
personal needs, if they want to store
[21:09]
like 500 gallons of fuel, we probably
[21:12]
would want to talk to the the fire
[21:13]
marshall and see if there's a permit
[21:14]
process or something like that.

really kind of stemmed out of requests

like we we'd be happy to to to look at
[22:46]
what other Utah cities are doing. I
[22:48]
mean, if there's something in Missouri,
[22:49]
too, we could look there, but probably
[22:51]
from a state code perspective, we'd want
[22:53]
to look at uh Utah communities. Um, but
[22:56]
I I would think I from just general, we
[23:00]
have researched a lot of home occupation
[23:02]
ordinances and I that's something I've
[23:04]
personally done a lot throughout my
[23:06]
career. Typically I you don't see fuel
[23:08]
sales out out of home occupations. So I
[23:10]
think we would be pretty in line if we
[23:12]
just restricted that if if the
[23:14]
commission felt comfortable at least
[23:17]
with that approach, you know, making it
[23:19]
very clear home occupations, you can't
[23:21]
sell fuel, you can't have large
[23:23]
quantities of fuel for your your home occupation. I I think that
[23:27]
puts us in a in a pretty good uh spot,
[23:29]
at least kind of going with a starting
[23:30]
point. And then there's the operational
[23:32]
permit. It sounds like if someone wanted
[23:34]
to have bulk fuel storage for um their
[23:38]
per personal use, then they they would
[23:40]
have to go through an operational
[23:41]
permit, probably through the fire
[23:42]
department.
[23:44]
And we I I we could find out more
[23:46]
details of what the operational permit
[23:47]
is, but that that's that that's what my
[23:51]
best guess is is that it would be
[23:52]
through the the fire department.

time. I think you guys did a really good
[23:58]
job of getting to the bottom of that one
[24:01]
and and making that that not a concern
[24:03]
anymore. But I do like this this new
[24:05]
direction of of limiting the commercial

use while also having a permit for
[24:11]
personal storage. I think that's
[24:13]
probably a better approach.
