Right.
[0:16]
» It's 6 o'clock. We'll call the meeting
to order and we'll ask uh we'll start
[0:21]
with the roll call starting on my right.
>> Mitch Klein, planning and zoning.
[0:25]
» Mark Shiner, planning and zoning. Jeff
Anderson, San Diego Township.
[0:29]
» Laya Spencer, Levonia Township.
>> Dalton Kaiderling or Rock Township.
[0:33]
» Francine Larson, Blue Hill Township.
>> Steve Deals, Palmer Township.
[0:37]
» Terrence Vandre, Clear Lake Township.
Bruce Abel, Beg Lake Township.
[0:42]
» Krie Watkins, Haven Township.
>> Greg Felber, Sherburn County Board.
[0:46]
» Lyn Watashic, Planning and Zoning.
>> What's your planning and zoning?
[0:50]
» Thank you all. Uh we got to make sure
that uh all of all the members have
[0:56]
their mic on and when they're speaking
to lean into the mic uh so we can hear
[1:03]
it hear it clearly. This meeting is is
recorded both audio and visual and the
[1:09]
planning commission is a recommending
body. The items heard tonight at the
[1:13]
planning commission public hearing will
be heard by the county board commission
[1:17]
board of commissioners on 4 August 2026
at 900 a.m.
[1:24]
I'll ask now if there's any has every
everyone had a chance to review the
[1:29]
minutes and if there are any changes
please say so.
[1:33]
» Move to approve.
>> Second.
[1:36]
» All in favor? Hi.
>> Hi.
[1:37]
» Hi.
>> Uh, any changes tonight's agenda?
[1:41]
» Mr. Chair, if I could just uh check one
item. So, one of our applicants did
[1:46]
request to have their item tabled.
>> Yes, sir.
[1:49]
» And we do have some people in the
audience. I'm just curious if anyone is
[1:52]
here for the Warick reszone.
>> Um, so, okay, we have two people here.
[1:58]
Um, just in the interest, so we do have
to hold the public hearing for that
[2:01]
item. Would it be beneficial to present
that item and move the agenda around?
[2:06]
Move that to number one so those folks
can get out of here. Um because we're
[2:09]
not going to actually make action on
that except for um tableling it.
[2:13]
» Okay, understood. So we start with
agenda item number three.
[2:16]
» Yes. If that if the chair wouldn't mind
that might just help the flow of the
[2:20]
meeting
>> and hold a public hearing.
[2:22]
» Yep. So staff will give a quick report
on it and then we'll kind of get the
[2:24]
explanation
>> and then upon completion of the public
[2:26]
hearing we'll table it.
>> Then we'll look for a motion to table.
[2:29]
» Okay. As for a motion to table,
understood.
[2:33]
Uh, agenda item number three
will be held first. Uh, Heidi Warkey
[2:41]
request to reszone from general rural to
Shorland residential
[2:46]
P.
>> Oh, I keep doing that.
[2:53]
Well,
>> we keep reminding you. So, [laughter]
[2:57]
okay.
Um,
[3:01]
are there there's no changes to the
agenda, I assume, other than this one.
[3:05]
So,
>> correct.
[3:06]
» A motion to approve the agenda.
>> So moved.
[3:09]
» Second.
>> All in favor?
[3:12]
» Okay, now we can go. [clears throat]
>> Okay, here we go. Now we're rolling.
[3:17]
uh request to reszone from general rural
to Shorland residential P35-000015-3110
[3:27]
and
uh P35-0000408-0205
[3:35]
part of government lot 2 section 15 town
34 range 27 ORO 10.3 acres in a general
[3:45]
rural area district
Mr. Glind.
[3:49]
» Thank you, Mr. Chair. [clears throat]
So, this was just a request from Miss
[3:53]
Warren Key to reszone the portion on the
screen from general rural to Shorland
[4:00]
residential. Well, the request was
simply to to the fact in the future if
[4:05]
they she wanted to subdivide any pieces
of the property, it could go down to
[4:10]
40,000 square feet from the minimum of
two and a half acres in the general
[4:15]
rural. There are no immediate plans to
subdivide it any further, but it does
[4:20]
give that flexibility. Again, the
applicant did request to table it. Did
[4:24]
sign the 60-day waiver extending this to
a date of October 30th. So, we would
[4:29]
have to take action by October 30th,
which means it would have to come back
[4:33]
to the planning commission for sure in
September. But with that um
[4:42]
» township
I township they their comments are just
[4:46]
meeting any requirements of the planning
and zoning and Adam Hodgej Minnesota DNR
[4:51]
area forest supervisor. There are no
objections to this proposal. Minnesota
[4:55]
DNR division of forestry appreciates you
including us in this process. Uh with
[5:00]
that I can answer any questions.
There
[5:03]
» any questions for staff from the board?
[5:10]
If not, u we just go straight to the
public hearing. Yep.
[5:16]
We will open the public hearing. Is
there anyone here to speak on this
[5:20]
issue?
[5:24]
If you have any questions that you can
throw out a question, we can respond to
[5:28]
those also. So, if you're just curious
about what it what they're looking at
[5:31]
doing, we're happy to respond to that
also.
[5:33]
» So, this will be brought up again in
September.
[5:35]
October looks like
>> uh well for sure by September
[5:39]
» at the September meeting
>> we don't know for sure the extension was
[5:43]
till October 30th so they would have to
come at least to the planning commission
[5:48]
this meeting in September to be in the
county board meeting October for it to
[5:53]
take action
[5:56]
» Mr. Chair uh further information would
there be a public hearing at the future?
[6:02]
» That's a good idea.
>> No, there will not be a public hearing.
[6:04]
So, if you do have concerns about what
the proposal is to change the zoning of
[6:08]
the property, um, now would be your time
to express those concerns
[6:13]
[clears throat]
>> or ask questions.
[6:15]
» Mr. Chair, another option is they could
give us their names and addresses and we
[6:20]
could ensure that if this gets put back
on the agenda that we send them,
[6:24]
whoever's at this meeting specifically,
a notice so they know if it does come
[6:28]
back so that they're aware of it and
could return if they wanted to hear more
[6:32]
about it.
Yes, ma'am. Could we get your name and
[6:36]
address? Please step up to the podium so
he could be notified.
[6:41]
» I can just write it down for you, right?
>> Yeah, she can just write it down and
[6:44]
Carrie can take it and we'll make sure
that we have it recorded and send out
[6:48]
notices to him if need be.
>> I see.
[6:51]
» If that's okay.
>> Sounds good to me.
[6:55]
» And the request to table was done today,
so last minute.
[7:02]
» Okay. Is there anyone here to speak?
Anyone else here to speak on this issue?
[7:09]
Is there anyone here to speak on this
issue?
[7:15]
» Move to close the public hearing.
>> Second.
[7:21]
» Been moved and seconded to close a
public hearing. All in favor? I.
[7:26]
» At this time, we'll entertain a motion
to table the issue until
[7:33]
the September meeting I'm assuming or
>> do we want to do date certain the y
[7:39]
» October 30th
>> just by October whatever that
[7:42]
» yeah an action will have to be taken by
October 30th of 2026
[7:46]
» by the county board
>> by the county board of commissioners so
[7:50]
» move to table the issue until the
September meeting
[7:55]
» second
>> it's been moved and seconded to table
[7:58]
the issue until uh the September meeting
all Those in favor say I.
[8:03]
» I.
>> Opposed.
[8:06]
Motion carried.
[8:09]
That knocks off agenda item number
three.
[8:13]
Uh, agenda item number one.
Busen.
[8:19]
I'm going to kill this
elus.
[8:26]
» Uh, property owner Irvin and Rayan
Danielowski. Request interim use permit
[8:33]
for business selling vehicles, boats,
and farm implements. Oriental Auto LLC.
[8:40]
Property address 18005
198th Avenue Northwest Big Lake. PID 10-
[8:50]
00120-
3420.
[8:55]
uh legal description at part of the
southwest southeast quarter the
[8:59]
southwest quarter section 20 town 33
range 27 big lake. Uh Mr. Schneider.
[9:08]
Great. Uh so the town board did
recommend approval of this request but
[9:12]
they did express concern regarding the
parking at the property. um they
[9:17]
basically had concern with kind of the
layout um because there has been a
[9:20]
similar business on this property for
going back to at least well under the
[9:25]
current interuse permits I think 2023.
Um so there's been you know a couple
[9:30]
different businesses at this location.
Um they suggested an alternative parking
[9:35]
arrangement and they did provide a site
plan. Um staff did include that in the
[9:39]
board's packet and virtues with that
alternative parking plan. Um so what
[9:44]
we're dealing with is the applicant is
requesting to sell um used vehicles from
[9:48]
the property. They'll be leasing the
west half of the existing building and
[9:51]
will use property to buy and sell
vehicles. Many of the vehicles purchased
[9:54]
from auction or insurance companies. The
applicant will replace defective parts
[9:58]
and do auto body work from the 2100 foot
building. The applicant is not proposing
[10:03]
to do mechanical work from the property.
If auto mechanical work is needed, the
[10:07]
vehicles are sent out for service. Um
the parking plan does provide space for
[10:10]
22 vehicles. Um the applicants proposing
17 of these for vehicles for sale and
[10:15]
five for customers. Um according to Big
Lake Township over the years parking has
[10:20]
been an issue at the property with cars
being piled up and not really in good
[10:23]
order. The township has re recommended a
revised parking plan that allows for a
[10:29]
cleaner, more organized layout. Staff is
recommending planning commission adopt
[10:33]
the parking plan recommended by the town
board which is attachment board packet
[10:37]
E. Uh hours of operation are Monday
through Friday 5 to uh 10:00 a.m. to
[10:42]
5:00 p p.m. Saturday 11:00 to 5:00 p.m.
total number of employees are three.
[10:47]
They had a septic passing septic
compliance in 2020 and according to Irv
[10:53]
uh the property owner uh auto body and
mechanical repair shop has existed on
[10:57]
the lot since you know was developed 40
years ago. Uh auto sales have operated
[11:01]
from the property for many years. Most
recently, uh, Fly Motors LLC had an
[11:06]
intermuse permit to run a very similar
business. So, in Sherburn County, you
[11:11]
have to have a intermuse permit to
operate an auto dealership. And when you
[11:16]
change ownership or name changes, they
have to conform you. So, we have to get
[11:21]
a new IEP. And through the state of
Minnesota, we have to sign off on a
[11:24]
zoning um authorization form for auto
dealers. So, this is a this is a process
[11:31]
[clears throat] that we've dealt with in
the past on this property. So, I'll jump
[11:35]
to the board packet really quick. So,
you can see the property here. Um, so
[11:39]
they'll be using this western half um
for auto sales for this business.
[11:47]
And so, again, um the repair garage,
it's kind of flipped. So, this would be
[11:52]
the um west side of the property. So,
that's a repair shop and a small office.
[11:58]
Um this was a originally approved
parking plan with this property. Going
[12:02]
back in time, this is what the applicant
acknowledged as a you know acceptable
[12:06]
parking plan. The one that um staff is
looking at is this one right here where
[12:12]
we would be um you know parking cars in
a different orientation. So cars going
[12:16]
east and west versus north and south. Um
[clears throat] the town board felt that
[12:21]
it fit better. they've had some
firsthand experience, you know, with
[12:24]
this property and felt that this was a
good layout for vehicles.
[12:29]
So, with that, I'm happy to answer any
questions the board may have on this
[12:32]
IEP.
>> Any questions for staff?
[12:35]
» Do we have conditions in here that uh
that we normally use when there's a auto
[12:41]
body,
you know, paint disposal and and the
[12:46]
likes. Um, so any liquid or solid waste
must be handled I suppose according to
[12:50]
public accounting and state regulations.
So we do have a condition in there that
[12:54]
addresses that
>> and that'll handle what's what could be
[12:57]
going on.
>> Yep.
[12:59]
» Okay.
>> I have a question regarding the parking
[13:03]
spaces, the new proposed ones. How will
they be marked? I see part of it
[13:06]
asphalt, but the other looks
>> I think that is a good one for the
[13:09]
applicant to respond to. Uh, right now I
don't think they've historically been
[13:13]
marked. Um, it's it's a dirt lot. Um so
but I have seen you know simple
[13:18]
solutions like painting you know markers
you know in the ground have to get
[13:23]
redone obviously periodically but that
might be a reasonable solution too.
[13:30]
» Any other questions?
>> Is there business currently operating or
[13:34]
because there's cars
>> there is a there is a business that
[13:37]
currently operates. Yeah. An auto
dealership. Yeah. So this is a new lease
[13:42]
coming into the property. So there's
been an existing auto sales and there's
[13:46]
been two different auto sales. So this
is the third version of you know um
[13:51]
separate auto sales being operated from
the property.
[13:53]
» Is that one moving out and this one?
>> Yep. So this one's taking their place.
[14:00]
Any other questions?
This time we'll ask the applicant to
[14:05]
come to the podium. [clears throat]
State your name and address for the
[14:09]
record, please.
[14:16]
Good evening. Uh my name is Hussein
Alcalaf. My address is 3088
[14:24]
31st Court Northeast Blaine uh 55449
[14:32]
for the home address. Sorry. Or like the
business address?
[14:35]
» No, the home address works.
>> Yep.
[14:40]
or um I'm sorry I I messed up your name,
but uh no, not the easy name, you know.
[14:48]
Are there any questions from the board
for the uh
[14:52]
for the applicant?
[14:59]
Um you know, so if I could just, you
know, address, you know, the Francine's
[15:03]
question because she asked it to me and
I I did respond, but I thought maybe you
[15:06]
could help respond. Um, so parking has
been somewhat of a challenge out at the
[15:10]
site.
>> Yes, we changed it. Yes, asked uh with
[15:13]
the last meeting at the
>> township.
[15:15]
» Yes, at the township. So, we change it
and we still work on it because I still
[15:19]
like, you know, not to start with the
business. Exactly. So, uh, we'll move
[15:23]
like we move like the old car, you know,
the one need fixed we put like in the
[15:29]
inside and, uh, I still like waiting for
my license to, uh, to reorganize
[15:35]
everything to move, uh, the car from the
old business and, you know, I will try
[15:41]
my best to follow all the regulation and
all the zoning, you know, recommend.
[15:47]
» Yeah. So maybe parking marking off some
of the spots might be a decent solution
[15:50]
to ensure that
>> yeah I will try yes everything will be
[15:55]
as
[16:02]
» I'm going to ask you are you uh aware
aware of the 12 conditions and are able
[16:07]
to abide by those
>> that 12
[16:10]
» there's 12 conditions with this interim
use permit
[16:15]
» you're aware of them.
>> Yes.
[16:18]
» And are able to live with them. Okay.
[16:23]
I guess if there's no further questions
for the applicant, uh
[16:30]
we'll uh open the public hearing. Is
there anyone here to speak on this
[16:34]
issue?
[16:37]
Is there anyone here to speak on this
issue?
[16:42]
Is there anyone here to speak on this
issue? Move to close the public hearing.
[16:46]
» I'll second.
>> It's been moved and seconded to close
[16:51]
the public hearing. All in favor say I.
>> I.
[16:55]
» Okay. What are the wishes of the board?
>> Mr. Chair, uh sir
[17:00]
» I move that we uh
uh approve this with with
[17:04]
[clears throat] the 12 conditions
listed.
[17:10]
» A second.
>> Been moved and seconded. We'll proceed
[17:13]
with the findings of fact.
>> Perfect. Uh number one, that the
[17:18]
intermuse permit will not be injurious
to the use and enjoyment of the
[17:20]
properties in the media vicinity for
purposes already permitted nor
[17:24]
substantially diminish and impair
property values within the immediate
[17:27]
vicinity.
>> Yes. Proposed use is non injurious and
[17:32]
would not diminish or impair values
within the immediate area. Selling
[17:36]
vehicles is a permitted use with the
required permits.
[17:40]
» Okay. that the establishment of the
interse permit will not impede the
[17:44]
normal and orderly development and
improvement of surrounding vacant
[17:47]
properties for uses predominant in the
area. Yes, the proposed use will be the
[17:53]
selling of used vehicles. It will not
impede the normal and orderly
[17:57]
development. This property has
historically been used for auto sales
[18:01]
and auto body repair.
>> Perfect. Uh number three, that adequate
[18:06]
utilities, access road, drainage, and
other necessary facilities have been or
[18:09]
are being provided. Yes, there is no
proposal to change uh existing
[18:15]
conditions on the property. No concerns
or issues have been raised related to
[18:20]
drainage.
>> All right. Number four, that adequate
[18:23]
measures have been or will be taken to
provide sufficient off street parking
[18:26]
loading space to serve the proposed use.
>> Yes, the applicant has sufficient
[18:30]
parking space to accommodate the
proposed use. And lastly, that adequate
[18:35]
measures have been or will be taken to
prevent the control offense of odors,
[18:38]
fumes, dust, noise, migration. So now
these will constitute a nuisance and
[18:42]
control lighted signs and other lights
in a manner that no disturbance to
[18:46]
neighboring properties will result.
>> Yes, it will not cause offensive odor,
[18:51]
fumes, dust, noise, and vibration to the
immediate area.
[18:56]
» Thank you.
Thanks.
[18:59]
It's been moved and seconded and
findings of facts recited.
[19:04]
All those in favor say I.
>> I.
[19:08]
» Opposed. Same sign.
>> Motion carried. This will be in front of
[19:13]
the uh uh
county board on August 4th was it?
[19:18]
» Yep.
>> And uh it would behoove you to be
[19:22]
present for that meeting.
Thank you.
[19:28]
Uh, agenda item number two,
the
[19:33]
the applicant was submitted by Mr. David
Jurich, property owners Brandon and
[19:38]
Cassandra Kak. Request residential
preliminary and final simple plat of
[19:45]
Muller Oaks consisting of one lot
[music]
[19:48]
P 40-000011-3301
[19:56]
um south 133 ft of the north half
section 11 town 35 range 29 Palmer 86.58
[20:06]
acres in agricultural
uh Mr. lines.
[20:11]
» Thank you, Mr. Chair. [clears throat]
As you mentioned, applicant is
[20:16]
requesting one lot on this large parcel.
Uh Palmer Township did comment. The
[20:21]
Palmer Township has no issues with the
request as presented. Applicant
[20:24]
indicated he wants to keep the property
as is. The board agrees with this. This
[20:27]
would be the best for this parcel. Uh
Russ Highland County surveyor, he did
[20:33]
say comments have been addressed. Uh but
we would like to address the
[20:37]
encroachments. Uh on this survey, it
just showed some trails coming in from a
[20:41]
south parcel and maybe a trampoline over
a lot line or the encroachments. Uh Dave
[20:49]
Rodell, no issues, not on a county road,
one lot. So it would be a a one lot fee
[20:54]
of,200. Uh I did reach out to Mandot.
[clears throat]
[20:58]
They didn't have any issues. Just when a
new resident is built on this parcel,
[21:02]
they will need to get an access change
in use permit from Mindot. This records
[21:06]
the access being shared between two
single family residences. There is no
[21:10]
cost for the permit. Mailbox structure
will be installed by MDOT if the owner
[21:14]
wants to. Uh does not benefit from a
ditch and property tax, no concerns.
[21:19]
Again, the applicant is proposing to
create a 127.52 acre lot from an 86.58
[21:25]
acre meets and bounds parcel. Uh there
is a communication tower that was
[21:29]
constructed in 2005 that will be 206
feet from the north property line that
[21:33]
will remain on the remnant parcel. It is
meeting the required separation. Uh the
[21:38]
lot line does need to be at least the
length of or the height of the
[21:43]
communication tower and it does meet
that requirement. The wetland delination
[21:46]
was completed and a notice of decision
was approved on May 6. There are no
[21:50]
wetlands on this portion of the
property.
[21:54]
And then there is a parcel in the
southeast that uses this property right
[21:58]
now to access their parcel. So they will
be required to have an ingress egress
[22:03]
easement be recorded at the same time in
the plant. But with that comes a consent
[22:07]
to plant for that property owner. The uh
developer property owners are aware of
[22:12]
that as a requirement. Um other than
that I can answer any questions or the
[22:18]
applicants.
>> Could you restate the encroachment? So
[22:22]
you want to zoom in?
So a consent to plant will be required
[22:26]
because that parcel in the southeast
uses an existing driveway right now that
[22:32]
accesses onto this property. Uhhuh.
>> So an ingress egress easement will be
[22:36]
required to be
>> so that
[22:40]
the encroachments are just Russian had
noticed some trails coming in from the
[22:44]
south and then from the survey I'm
gathering a potential trampoline that
[22:48]
would just need to be located off the
property if it's over. So it just needs
[22:53]
to be addressed prior to us signing the
myars.
[22:59]
Are there any questions for staff?
At this time, we'll ask the applicant to
[23:04]
come to the podium. State your name and
address.
[23:17]
» Uh Brandon Kak, 839747th
Street Southeast St. Cloud 5604.
[23:27]
I'm Dean Mohler, 9877
155th Avenue Southeast Becker.
[23:35]
Thank you both. Are there any questions
for the uh for the applicant?
[23:43]
I have one.
Why are the proposed uh
[23:48]
septic systems located so far away from
the proposed house location?
[23:55]
We're not planning on building a house
at this time. So,
[24:00]
we're not we're just trying to split
this property off back to put it in the
[24:05]
My family sold this property a couple
years ago and uh Brandon wanted the
[24:12]
farmland and being such a large family,
it was easier for him to purchase the
[24:16]
whole property and now we're just he's
offered the the woods back to me and I'm
[24:22]
trying to put it back in the family
name. So, that's why we we're not really
[24:26]
planning at this time to build a house
on it. We're just trying to follow all
[24:29]
the requirements of this
simple plat.
[24:34]
» Yeah. Yeah.
>> I'm just gathering because it's the only
[24:38]
place they had the other two soil
borings.
[24:40]
» The only what?
>> The only other two place they had the
[24:43]
other soil borings.
>> So they knew they had septic.
[24:45]
» Oh,
>> I see three soil borings. House and then
[24:48]
two septics. So they set up put them
there.
[24:52]
» Looking to me like a pretty expensive
endeavor.
[24:54]
» Yes, that would be quite the line.
[24:59]
But the elevations aren't very
consistent.
[25:01]
» Yeah, I mean it's favorable soil
throughout. So, uh,
[25:06]
» it's a great question, but I'm assuming
that's just because where they put the
[25:09]
» A lot of piping,
>> lot of schedule 40 on that one.
[25:14]
» You bet. U,
are there any other questions for the
[25:18]
applicant?
[25:23]
Well, at this time, we'll open a public
hearing. Is there anyone anyone here to
[25:27]
speak on this issue?
[25:30]
Is there anyone here to speak on this
issue?
[25:36]
Is there anyone here to speak on this
issue?
[25:38]
» Move to close the public hearing.
>> Second.
[25:41]
» Been moved and seconded to close the
public hearing. All those in favor say
[25:44]
I.
>> I. Opposed.
[25:47]
» Uh
[25:50]
I guess at this time, what other wishes
of the board?
[25:53]
» Mr. Chair.
>> Sir,
[25:56]
» I would like to uh make a motion to
recommend to the county board to approve
[26:00]
the uh uh preliminary and simple plat
for this project.
[26:06]
» Yeah. And then
I forgot to mention the
[26:09]
» with the uh seven conditions.
>> Seven conditions. Again, I should have
[26:14]
asked the applicant that are you aware
of the seven conditions and able to
[26:17]
abide by them?
>> Yes.
[26:20]
» Thank you.
[26:23]
Okay, it's been moved and seconded.
>> I'll second.
[26:27]
» Seconded now. Thank you.
>> All those in favor say I.
[26:34]
» I.
>> I.
[26:37]
» Opposed.
Motion pass.
[26:43]
Thanks for coming in. This issue will be
up in front of the the county board on
[26:47]
August 4th. It behooves you to be here
for that.
[26:55]
That's it.
>> Brandon,
[26:59]
» Mr. Chair, I move that we adjourn.
>> Move and seconded to adjourn. All in
[27:06]
favor say I.
Yeah, right.
