[13:13] to city government in a tangential way so I found an article published
[13:20] today uh in Europe at the radio Prague website in the Czech
[13:25] Republic and it's about how a beaver colony
[13:29] successfully completed a public works project so I'm going to read the article
[13:36] verba him I can't improve on this a beaver colony in the birdie region has
[13:42] gained overnight Fame by building several dams in the birdie protected
[13:46] landscape area creating a natural Wetland exactly where it was needed it
[13:52] saved the local authorities $1.3 million and has the public cracking jokes about
[13:57] public administration and tape they could have not have chosen
[14:01] their location better erecting the dams on a bypass Gully that was built by
[14:07] soldiers in the former military base years ago to drain the area the
[14:11] revitalization project drafted by environmentalists was supposed to remedy
[14:16] this Mr fizer head of the birdie protected landscape area Administration
[14:22] says nature took its course and the Beavers created the necessary botot
[14:27] conditions practically overnight quote the military Forest management and the
[14:32] vava River Basin were negotiating with each other to set up the project and
[14:37] address issues regarding ownership of the land the Beavers beat them to it
[14:42] saving us $1.3 million they built the dams without any project documentation
[14:48] and for free zoologist Zuri vilek said the local
[14:54] Administration was no competition for the beaver Colony quote beavers are able
[14:59] able to build a dam in one night two nights at most while people have to get
[15:03] building permits get the building project approved and find the money for
[15:07] it environmentalists who inspected the work said the wet land and pools the
[15:12] Beavers created will offer good conditions for the rare Stone crayfish
[15:17] frogs and other species that thrive on Wetlands said yav oberm head of the
[15:23] central Bohemian Office of the Czech nature and Landscape Protection Agency
[15:28] quote beavers always know best the places where they build dams are always
[15:33] chosen right better than we design it on paper so I don't know what to take from
[15:39] that except that as a public entity that sometimes has to contract out maybe we
[15:44] should increase the scope of our bids and maybe uh see if some colonies of
[15:48] beavers are available sometime Mr Mayor I yield the floor back

[16:01] next item on the agenda which is um the approval of the meeting agenda uh we
[16:07] have um there's two items we have requests to to modify um so I'm going to
[16:15] turn to City attorney garoian for uh the the first item and then I'll bring up
[16:20] the second uh mayor thank you in light of The reigns that are going to begin on
[16:27] Wednesday and continue on I believe through Friday uh the city manager has
[16:32] requested that we place an item for discussion on the agenda on an emergency
[16:36] basis in order to do so we'll need a vote of the entire Council to approve
[16:41] plac that on the agenda and I believe staff does have a presentation if the
[16:45] city council chooses to place it on the agenda that's the first one and and that
[16:49] would be in the discussion section is that correct or would it be in the it it
[16:55] it would be a discussion item correct mayor great okay and and the second one
[16:59] would be uh rearranging the discussion items um obviously this is going to be
[17:06] your the council's prerogative uh but placing consideration of ordinance 1478
[17:12] before sign placement would be the request and then perhaps if you wanted
[17:17] to have the uh discussion item for this emergency uh consideration of of The
[17:24] reigns you can place that first have consideration of the ordinance 1478
[17:28] second and then sign placement third would be an option okay i' like to amend
[17:33] the agenda to reflect the city attorney's proposal I'll second that
[17:38] great all in favor I I any opposed great the uh agenda has been adopted
[17:46] unanimously next we have back up back to you uh City attorney G goian for a
[17:51] report out from closed session thank you mayor the city council met in closed
[17:56] session on January 28th to discuss initiation of litigation no reportable
[18:02] action was taken the city council again met today uh under that same agenda item
[18:08] initiation of litigation again no reportable action was taken great thank
[18:12] you all right uh next item on the agenda is the approval for reading resolutions
[18:17] and ordinances by title only so moved do I have a second second all in favor I
[18:26] all right then um we've got the meeting minutes um if I can turn it to the city
[18:33] clerk um to um to walk us through that that item
[18:39] we've got I think two items on that yes sir thank you Mr Mayor the agenda
[18:45] currently lists three sets of uh meeting minutes however the January 9th minutes
[18:50] were previously approved as amended and so um those do not require a second
[18:57] approval the um city council has asked to consider the approval of the January
[19:03] 21st special meeting minutes and the approval of the January 28 2025 city
[19:08] council regular meeting minutes the city clerk's office did receive a request
[19:14] from uh mayor Parkhurst suggesting non-substantive amendments uh
[19:19] specifically to the January 21st meeting minutes page three we were asked to
[19:24] change to uh from mayor crebs to Mayor Parkhurst on page 20 uh council member
[19:30] low requested uh an item on motorized bikes and scooters and safety
[19:35] regulations and then to the January 28th meeting minutes it was suggested that we
[19:40] uh make an amendment to the minutes to reflect that council member crebs
[19:45] um the pronouns be changed on uh on that sentence in the second
[19:51] paragraph cler um one one more on um on the January 21st my my apologies um not
[19:59] just the motorized bikes and scooters but also the community risk reduction
[20:02] officer those were both uh mayor Pro Temp
[20:06] low and um I believe I'm I'm noted there thank you any other edits to the
[20:14] minutes then I'll entertain a motion for approval I move to approve as amended
[20:20] second all in favor all all right Madam cler do we need separate or
[20:26] can we put this together it it can be done as one one hole great all right uh

[20:38] um on February 3rd I attended the meeting of the ad hoc Library project
[20:44] committee here at City Hall the meeting was well attended we did miss a meeting
[20:50] in January because of the fires and we got some good and some bad news I'll
[20:55] share the bad news first as you can imagine the fire is tapped into a
[20:59] significant amount of staff time in January and that kind of set us back in
[21:04] terms of time and then an in congruency was found between the architectural
[21:08] survey and the Civil survey so that took several weeks for that a redesign to
[21:14] take place so they became congruent and can be used and in total those
[21:19] developments put us back about a month the good news is that we are in the
[21:24] clear now we're proceeding with uh the remaining
[21:29] avation the also the original time estimates were very well padded so the
[21:34] target date for completion will still be January 31st 2026 the project manager is
[21:42] is very confident that that will take place um and we are particularly uh
[21:48] happy to hear that they've gotten over all the major hurdles all the unexpected
[21:52] things are pretty much taken care of so they think work is going to proceed much
[21:57] quicker over the next few months in the springtime I'd like I think it was
[22:01] referred to as open field running for the next few months so that's that's a
[22:05] good way to encapsulate this the project manage uh project management firm has
[22:12] given us a new project manager verx has uh a new person in named Sandra burga
[22:18] she attended that meeting and it's diving right in and we'll be working
[22:22] closely with our director of Public Works and other people associated with
[22:26] the project uh last Friday the 7th I attended the
[22:31] transportation subcommittee meeting with my subcommittee meeting colleague mayor
[22:36] parkur very exciting news after a long long laborious process the subcommittee
[22:42] has completed its original charge and we will be bringing back a proposal for a
[22:46] new shuttle service and a new dial ride service for the city at our next city
[22:52] council meeting on February 25th so stay tuned it's going to be very interesting
[22:56] and exciting I think Mr May thank you so much uh council member Garcia why don't
[23:02] we kick it to you next thank you uh there was a meeting of the senior
[23:07] community Commission on February 6th last
[23:10] Thursday um see chair Croc is an attendance uh it was a typical meeting
[23:16] except for we had a presentation by uh City attorney gear goian and Senior
[23:21] planner um wolf regarding the sier Vista Apartments U there's been some concern
[23:27] um it it is a senior living facility for the most part uh uh low and very low
[23:32] income uh I think 45 of the 46 units are designated for that um but uh attorney
[23:39] gagosian gave a very good overview of the history of um all of the
[23:46] the different agreements and amendments and
[23:48] ownership and um that was really part one they tried to keep their meetings to
[23:52] one hour um so we will see a part two I I'm assuming on March 6th um at the next
[23:58] meeting which will be talking about um the different Ami levels for very low
[24:03] and low income and the the the rent uh the amount of rent that can be charged
[24:09] for each of these units because that's that's one of the large concerns the the
[24:12] rent and the um the maintenance and that was brought to the commission and um the
[24:19] commission actually got a very quick response from staff so I was very
[24:22] pleased with that and that's all I have to report great mayor P um on February
[24:29] 5th I went to different homes with the S Madre fire Association the firefighters
[24:34] and um was able to really partake in something kind of nice to be able to go
[24:40] and see the families and the people whose homes were damaged um and not
[24:44] necessarily lost because you're not able to walk to a home and help somebody out
[24:47] when they're they're not there but um they took part in a a pretty good
[24:52] program and neat program that California fire Foundation put together and they
[24:56] call them the safe cards their uh supplies Aid to victims of emergency
[25:02] cards that they handed out to every um person in sir modre who had a damaged or
[25:07] lost home and then um only place in town also covered a dinner card for about
[25:12] $100 each person so it's really neat to go and see those people and you know we
[25:16] have a really amazing town where a lot of the people are like well is there
[25:19] anyone else who could use it more than me and they you know and they and the
[25:22] people that that really need it they're still willing to give um and we're
[25:25] seeing that all across a lot of our our our residents who lost are are out there
[25:30] actually giving back and not and not receiving help um and then on February
[25:36] 6th I went to the special meeting of La County's selection committee where we
[25:40] select our uh District Library um Commissioners and also our Metro
[25:45] Commissioners um and so uh that was a new experience uh for me and we also got
[25:50] to see all the different council members and Mayors from all of the cities in in
[25:55] in Los Angeles County um and then on February 7th
[26:00] um city manager Roso and I really got to attend one of the most unique and I
[26:06] don't know if this has ever been done special meetings um ever is um our brand
[26:10] new Senator state senator uh Sasha Renee Perez as well as our um Senate leader
[26:17] Mike Maguire held a round table and we thought we were going just to hear all
[26:21] the needs that all of our cities have experienced during this um disaster and
[26:26] instead it was almost every single senator from all over the whole state so
[26:31] I was sitting next to the senator for um uh a more southern region and we got to
[26:37] speak with the senator for uh Santa Barbara that dealt with the mudslide in
[26:43] um in mono so it was a really great experience one of the things that we
[26:48] really brought up of course was our mud flow U mitigation what are we going to
[26:51] do and what can we do um and we got put in some so we got put into uh contact
[26:57] with the um people that worked with the other mud flows uh in the Santa Barbara
[27:03] County um what are small businesses able to do besides just grants um army cor of
[27:08] engineer removal debris and insurance companies and all this information will
[27:11] come to you um we'll be able to feed it out to you particularly in a later time
[27:15] in uh a town hall meeting um and uh also with seniors we're seeing our seniors
[27:20] really have a lot of deficits right now because they've been impacted they had
[27:23] to evacuate so their um comprehension is lower they're not good with tech
[27:28] technology so how are they able to fill out all of this paperwork and get it in
[27:31] at the dates so there's um funding available as well as positions available
[27:35] that to go out to community and help seniors um school funding what are we
[27:40] going to do with all the students that we've lost as well as uh the change in
[27:43] your property assessments what's going to happen if you have to rebuild so it
[27:46] was a really exciting time to really collaborate with with
[27:53] everybody thank you very much and thank you for representing the city uh at the
[27:58] LA uh County selection committee and the uh special meeting um so uh my report uh
[28:05] January 29th I attended the opening of the sarer middle school and got to see
[28:11] um the first day there and what they were doing to help uh support all of the
[28:16] students that you know the first day back and and all of the uh wraparound
[28:21] services that they've got for them uh on January 31st I attended uh a uh assembly
[28:27] round round table for our Assembly District uh with assembly member uh
[28:32] herian and a number of other cities attended and we got uh you know it was a
[28:36] really a listening session uh that uh what all the cities needed and what what
[28:42] feed you know what do they want from from the assembly district uh city
[28:46] manager Roso also attended that with me uh and it was a it was a good
[28:50] conversation and and we got some some good information out of that which along
[28:54] with the information from the uh Senate meeting I think we we'll pull together
[28:58] and get out to the community um on February 6th the clean
[29:02] power Alliance had its board meeting uh two things to come out of that one of
[29:07] the items is is that um there was a recent uh CPU California Public
[29:12] Utilities commission's ruling that went against the uh interest of us as as
[29:18] members of the clean power Alliance from a financial perspective um that was
[29:23] unfortunate it was even more unfortunate um that they put it on consent and
[29:27] didn't even have it is a discussion item and um the report back that we got was
[29:32] the way they uh treated our Representatives including um our um the
[29:37] county represented County Supervisors was not not what you would expect of an
[29:42] organization that buys the most renewable energy in the country um on
[29:47] the more positive side uh we approved a geothermal project um out of uh Utah I
[29:55] believe is it'll give us U 247 renewable energy and that'll be coming online I
[29:59] think in 2027 uh and then uh I was also a
[30:04] president of the transportation committee and nothing additional to
[30:07] report there council member go always does such a fabulous job reporting out
[30:10] from that uh City announcements so I have uh three announcements here uh the
[30:17] first one is that the uh that the seniors are going to be continuing to to
[30:24] host the the senior lunch and food program Monday through Thursday at the
[30:27] heart Park Center starting at 11:30 a.m. and if uh and this is is uh sponsored in
[30:35] in cooperation with the YWCA and if you want more information you can call
[30:41] 626 355
[30:46] 5278 and then also uh with the senior committee is there accepting nominations
[30:52] for their older American of the year the nomination forms are available at the
[30:56] senior har Park House uh and we encourage you to pick up one
[31:00] and help us celebrate the incredible contributions of our older adults in the
[31:04] community and I a I imagine that there's a public comment coming up that will uh
[31:09] tell us more about that um then on Thursday February 13th so two days from
[31:16] now uh the Chamber of Commerce is going to have a ribbon cutting uh for die
[31:22] pretty over at the uh Kensington from 5: to 7:00 p.m. uh and and there's a also a
[31:29] mixer associated with that and that is all we have for City uh city council
[31:37] reports and and public announcements so now we'll move on to the participation
[31:41] code uh so we're going to open it up for items not on the agenda and as a part of
[31:47] that we have the uh participation code which is on back of all of the the cards
[31:51] that are there uh and for the the first couple of meetings of the year we
[31:56] typically read this so uh our public participation code of
[32:00] conduct says your participation is welcomed and invited at all City Council
[32:04] meetings the council requests that participants refrain from making
[32:08] personal slanderous profane or disruptive remarks a person who
[32:12] continues to disrupt disrupt the orderly conduct of the meeting after being
[32:16] warned by the mayor or design to Cease the disrup disruption may be precluded
[32:21] from further participation in the meeting no signs posters or other large
[32:26] objects shall be brought into Council chamber MERS or other meeting place if
[32:30] doing so would disrupt disturb or otherwise impede the orderly course of
[32:34] the meeting um if you do want to make a
[32:38] public comment we do ask you to fill out when the yellow cards and bring it down
[32:41] to the clerk Madame clerk do we have any public comments for items not on the
[32:45] agenda yes sir thank you Mr Mayor the city uh clerk's office received three
[32:50] emails that were forwarded to the city council and they uh first was from
[32:55] George Eaton on Highland uh the second was from Katrina hits tough on Orange
[33:02] Drive and the third was from Katherine Addie and um those emails were forwarded
[33:07] to the city council and will be entered into record we do have uh four comment
[33:12] cards for items not on the agenda the first of the four is from Pat Croc
[33:29] good evening mayor Parkhurst and City Council Members I'm Patricia croc from
[33:34] your senior community commission and first of all belated happy New Year's
[33:39] and uh thank you to all the First Responders who help save our town I just
[33:45] wanted to bring you up to date on what happening at the park house this month
[33:50] and other little things that we're developing for the rest of the year uh
[33:54] as the mayor so noted the lunch program is in full swing Monday through Thursday
[33:58] at 11:30 and to help enhance that program and maybe bring in a few more
[34:04] seniors uh on occasion we do little what we call Little lectures on things that
[34:10] are pertinent to the seniors we had one recently on how to hang up on phone
[34:15] scammers and how to slam the door in front of door
[34:19] scammers uh hearing health center clinic and then last week there was a lung
[34:25] screening clinic for those Vic victims of well everybody the eaten fire Canyon
[34:31] smoke and if you qualified you were given a free air filter and so I
[34:37] qualified so my husband's getting that for Valentine's and and I'm keeping his
[34:42] box the SE so and screening air filters and also we had a lecture on the
[34:49] importance of enzymes in your nutrition and these little mini lectures are just
[34:53] maybe a half an hour and they're just fun and informative Fe February 27th
[34:58] we've got a senior tour booked to go to the Reagan Library to tour at the Dead
[35:03] Sea Scrolls this coming Thursday the Valentine social 3:00 at the park house
[35:09] lots of food lots of fun raffle prizes and just a good time for
[35:15] everyone nominations for the older American are out through the city and
[35:21] that event will be held in May there'll be more information on that as we move
[35:26] along March we're running a tour of the uh Academy of Motion Picture museum for
[35:32] the seniors uh Bingo's coming up on February
[35:36] 20th at the Hart Park house and we discussed at our last meeting uh for the
[35:42] month of March having an income tax professional there at least one day a
[35:46] week to help seniors prepare their income taxes any of this information is

[36:22] Palmer uh good evening um my name is Steve Palmer I live at 55 North Hermosa
[36:28] Avenue across uh the cader elementary school
[36:32] field uh you'll have to pardon me for trying to read this very quickly as I
[36:36] have 20 plus years excuse me of dealing with this situation and trying to
[36:41] distill it down to three minutes I'm here tonight to express my concerns
[36:45] about the increased use of the elementary school field by the various
[36:48] SE mad baseball teams and the impact it's having on our neighborhood my wife
[36:52] and I purchased our home in 1977 we've seen the field evolve over
[36:56] the past 48 years from a mostly dirt field with weeds to a multi-use baseball
[37:02] field over the past 20 years we've met with City officials and baseball
[37:05] representatives to come up with solutions that enable teams to play in
[37:09] the field while lessening the negative impact on our neighborhood unfortunately
[37:13] we've only seen an increase in traffic congestion parking problems and an
[37:17] increase in noise levels throughout the years currently the cad Little League
[37:22] Baseball site list seven Baseball Fields as open as of this morning Heasley Sader
[37:28] ele Elementary School s Sader Middle School leeski field in Arcadia draer
[37:33] field Blair high school and uh Bonita in March of 2023 we met with a sir Madre
[37:41] girls baseball rep he told us the uh field at the middle school was not being
[37:47] used excuse me because needed a major upgrade for proper drainage I went over
[37:52] to the Middle School field last March after a heavy rain it appeared to me
[37:56] that there was only minor r off which could easily be repaired by one or two
[37:59] people within a short period of time the rep rep also told me the upgrade would
[38:04] be of no cost to the school or the school district he also said that um the
[38:10] school and School District seemed only vaguely interested in pursuing the
[38:14] upgrade as mentioned earlier this field is cons listed as open on the uh SI
[38:19] Moder L League Baseball site last February I met with Deputy city manager
[38:23] Laura agular to express our concern she said the baseball league needed $100,000
[38:28] for the upgrade at the middle school but the league needed $100,000 first to
[38:33] upgrade the lights at Heasley fielded I asked if some of the impact could be
[38:37] mitigated by disseminating some of disseminating some of the games to the
[38:41] other fields not having games on Sunday and that the coaches not play music
[38:46] during the games as the noise of the teams and parents was already more than
[38:50] sufficient unfortunately none of these items seem to be addressed I should
[38:54] mention that the baseball league issued a memo asking people not to park on
[38:58] Hermosa well I appreciate the gesture it had little effect and even if it did it
[39:03] would only push the problem um to another neighborhood the leak also said
[39:07] the uh school parking lot on the other side of the school would be open I've
[39:11] checked several times during games and the gates were locked and even if the
[39:16] people did park there the primary problem to me of the noise issue would
[39:20] still exist okay let's see at one of our
[39:24] meeting uh meetings years back a person oop okay well let's see in summary I
[39:29] just want to make it clear we are not against games at the elementary school
[39:33] we hope to see some games there directed to the other Open Fields no games on
[39:37] Sundays and no music during the games it would be great to see the city and
[39:41] baseball Community have some awareness and consideration of the impact of the
[39:46] games are having uh on our neighborhood thank you great thank you very much Mr
[39:53] Palmer and Mr Mayor I'm I'm I'm going to flub this last name because I I'm having
[39:58] trouble reading it but the first name is Brenda and the last name is

[40:15] you hello it's my first time here um so I live at 229 North Hermosa directly on
[40:22] the corner right across from the S MRE M field um I'm just
[40:27] uh kind of highlighting what Steve said all those concerns and my house is like
[40:33] directly impacted on the weekends the noise the um trash has been better but
[40:41] the music playing the noise the traffic I have three cars I I'm able to park one
[40:47] in the uh garage and I have two other cars my me and my son and my partner um
[40:53] so during the week um when I come home from work and my son comes home from
[41:00] college we it's very hard for us to park in our area I either have to park a
[41:06] couple streets over until they're uh until they leave cleared out or
[41:14] um I don't have anywhere to park um also the field was it seems like
[41:21] our community we're not even allowed to use the field um and there's a sign outs
[41:27] side um that I wanted to read real quick that's that said the community should be
[41:32] able to use it when the the um uh youth isn't there and when the school is not
[41:38] there but it's always locked and us I used to walk that field run that field
[41:44] and now we can't even use it the community can't even use the field on
[41:47] the times that nobody else is there because it's always locked so um anyway
[41:52] that's kind of been a big issue but uh especially the parking and uh the
[41:58] traffic I would just hopefully try to find some kind of uh
[42:04] help with you know what we can do as a community we can't even use the field
[42:09] anymore our parking is impacted and the noise just and want the families coming
[42:15] in the baseball family and softball families to just kind of respect our our
[42:19] the the noise level too and not playing any music I I came out one Saturday
[42:24] morning at 9:00 in the morning because they were playing music and it's
[42:28] Saturday morning 9:00 so I went out there and told them to please stop and
[42:33] they did and just want want to keep up on that and stuff but anyway these are
[42:38] my concerns and it's hard because it impacts my um um as a resident here I
[42:46] feel like I have a lot of issues with the field and the baseball and the
[42:49] softball I mean I understand you know having to do it but I'm wondering if
[42:53] they could use the other fields like Steve had mentioned and stuff
[42:57] and just the families be respectful of our neighborhood and the people who live
[43:01] there and that type of thing anyway thank you can I can I ask please quick
[43:07] question ma'am um what your this this increased
[43:12] activity and noise we're hearing about was this just started this season was
[43:16] this place last year years and it's gotten worse the
[43:21] last yeah since the since the pandemic so it hasn't really gone up this year
[43:25] any more than last well um no it has it has we had a little break with the fires

[44:39] of some of the events that are still happening for one book one city um this
[44:43] Saturday we have felting uh if you don't know what
[44:47] felting is I didn't either so so we'll all learn together but um we're having
[44:52] craft it which is something we haven't had at the library since we've moved to
[44:55] our temporary so you can come and learn how to felt and go home with something
[44:59] really neat or perhaps a new hobby and uh we also have a um one book one city
[45:07] play this world the world's strongest librarian that is going to be
[45:13] 7M on Monday the 24th at the playhouse we also have our second Sip
[45:21] and shush which which is our silent book club we had our first one at RT Rogers
[45:28] this past Saturday it went really well um big um thank you to RT Rogers for
[45:33] letting our little group meet there and read quietly which was nice so that's
[45:40] essentially what a silent book club is and we will be doing that Wednesday the
[45:44] 26th at 7:00 p.m. at RT Rogers and to everyone who submitted their wonderful
[45:51] pieces about uh how libraries have impacted their life we are working on
[45:55] publishing that book and we are going to have a book signing and reading on
[46:00] Friday February 28th so hope you all can attend that and uh we also have our one
[46:08] book one city third Thursday book club so if you would like to discuss the book
[46:12] uh this book club meets on zoom and that is going to be Thursday the 15th I
[46:19] believe in my head um at 11:00 a.m. we do have some programs that are not one
[46:25] book one city uh that that we hope uh more people will attend we have tomorrow
[46:29] is our caregiver Workshop so you can uh come to the library we have love
[46:35] buug which is a really fun way to interact with your child it's for ages 0
[46:40] to 36 and that is tomorrow Wednesday at the library at 10:00 a.m. and then on
[46:47] Thursday we have our sensory play which is for our um our wonderful children
[46:53] ages 0 to 11 that would prefer to play in a quiet controlled space and we have
[46:59] exploratory toy toys available and we are working on February 22nd we will
[47:05] have an interior design with TSK Architects we'll have a little town hall
[47:09] here in the city council chamber excuse me city council chambers and uh we will
[47:15] be live streaming that and recording it as well so those are all the programs I
[47:20] believe I have thank you so much just a a clarification there are two of the
[47:26] program that was 0 to 36 was that months or years months okay and then and then
[47:32] then and then the Z caregivers and it's 0 to 11 is it years there we go okay

[47:57] proam councel staff uh Glenn lambden 444 St event uh I'd like to bring your
[48:02] attention to our Municipal Code chapter 120
[48:07] 20. 070 it's titled duty of a budding land owners to cultivate trees on public
[48:14] property I find this um section of the code problematic in two ways uh what it
[48:21] says and what it doesn't say um basically what it says is that
[48:27] property owners are required private property owners are required to maintain
[48:32] publicly owned trees on publicly owned property this is done by taking their
[48:38] Financial Resources uh labor and some
[48:44] materials for the benefit of the public without just
[48:49] compensation my question really becomes how is this not a fifth amendment taking
[48:54] and I've asked the question as some council members I've asked the question
[48:57] to staff and I received the same answer I don't know so if this is in fact where
[49:03] where we are requiring and taking from a private individual for the benefit of
[49:09] the public how is this not a fifth amendment taking I you know I think it's
[49:13] something that needs to be looked into what this doesn't
[49:17] do allow those residents that are encumbered with this special privileges
[49:23] doesn't give them special privileges to add things to the public Parkway as a
[49:28] matter of fact the code expressly prohibits putting anything that's an
[49:33] obstruction that could be on uh a public safety hazard elsewhere in the code it
[49:40] prohibits the placement of certain items on this where I'm having a problem with
[49:45] this is I've addressed this with staff and staff has told me that because of
[49:51] the encumbrance it's only fair that the homeowners should be allowed to put
[49:57] things on there that they want problem is when staff determines that they're
[50:01] going to create policy that circumvents the legislative Authority that we have
[50:06] granted to you our elected leaders it is never staff's position to create policy
[50:13] or to ignore the policy that this Council or previous councils have put
[50:17] into effect um so I would like with this in mind this is going to dovetail into a
[50:23] few of the other items that uh is that's on the agenda tonight and I'll speak to
[50:27] those so I thank you thank you Mr
[50:35] lamon um Mr Mayor James Carlson is the next
[50:46] speaker thank you very much I didn't make the agenda so I'm here for public
[50:50] comment and I will give myself three minutes um just want to give you a quick
[50:54] update on mud preparations and then I'll introduce our our our Chiefs uh sir M
[50:59] public works department has been working on preparations of mud and debris since
[51:03] the beginning before the E eaten fire was even out we've Co coordinated the
[51:08] debris removal from high priority basins including the sadre dam and that was a
[51:13] job that took 2,500 truckloads to get that that debris Basin ready for the
[51:19] upcoming storms we've installed what I refer to
[51:23] as best management practices those are being MPS those can be structural they
[51:28] can be also activity uh examples include K rails or sandbag walls it's also
[51:34] includes inspections and maintenance of of storm drains and a number of other
[51:40] structures throughout the town in an effort to meet anticipated demands for
[51:45] debris and mud management staff has met with the county and daily TK for Force
[51:51] task force meetings since the beginning we have also acquired the services of
[51:56] the p Public Works director with 37 years of institutional knowledge through
[52:01] willan Services decisions regarding where to
[52:05] locate bmps have evolved throughout the process Public Works crews are familiar
[52:10] with the areas of concern as well as locations that are intuitively needed to
[52:16] be addressed this week uh staff is actually
[52:20] also referred to the Watershed Emergency Response Team it's called a w report
[52:25] that was published by the state and and put out on February 4th and then this
[52:30] week the city is in re has received the County's phase one two and three mud
[52:35] flow prediction maps that provides us with additional Hydra hydrologic and
[52:41] Engineering recommendations the most common feedback
[52:45] that we are getting in the public works department is is um for a k to protect
[52:50] an individual's property we take all requests and analyze the effectiveness
[52:56] of each area that K rails have been located we want our community to know
[53:01] that staff will not Place K rails on private property and we will not Place K
[53:06] rails in the street if it would prevent access to areas for mud REM removal or
[53:11] the police and fire calls we understand also the need to be nimble this week
[53:17] will most likely provide us with the first instance of mud and debris flows
[53:23] and we will analyze what we've been um what we've been planning for with our
[53:28] with our institutional knowledge and our our engineers and our hydrologists and
[53:33] see how that compares with what we're seeing in real time so we will keep
[53:37] moving um we don't have the set plan I would like to introduce Chief bentos and
[53:43] chief Bartlett and they have an important announcement for you and look
[53:47] I just made it
[54:00] good evening uh mayor mayor protemp and city council U I'll provide you a little
[54:05] bit of an update to the upcoming uh storm as we prepare for the incoming
[54:10] storm expected from this Wednesday through Friday with Thursday posing the
[54:16] greatest risk I want to emphasize the importance of vigilance and Readiness
[54:20] our priority is and always will be the preservation of Life followed by
[54:25] property we have been proactive in addressing
[54:28] this Potential Threat several meetings have been held at the EOC that's the
[54:34] emergency Operation Center to ensure our preparedness and we have coordinated
[54:40] with area D for additional support in the event evacuations become necessary
[54:47] our police fire and City teams I mean Public
[54:51] Works um City Hall um Etc are fully engaged and are ready we will continue
[54:59] to monitor conditions closely and keep the community of breast I urge all
[55:04] residents to stay informed through the official City Communications Genesis
[55:09] nixel City and social media platforms and please have a plan in place and be
[55:15] ready to evacuate if conditions warrant if an evacuation order is issued please
[55:22] do not hesitate follow the direction to evacuate
[55:27] together as a community we'll face these challenges with resilience and
[55:30] preparedness thank you and uh this concludes um any questions or
[55:37] anything let's go ahead and and get uh fire chief up here and then uh I'll take
[55:43] a moment to see if there any questions thank you Mr Mayor uh mayor
[55:47] protm and City Council Members basically what i' I'd like to add to uh Chief
[55:52] bont's um talking points are yes we're we've been working very diligently D
[55:59] diligently very hard excuse me as a as a city to help mitigate any potential
[56:05] efforts um what I would like to bring to everybody's attention and hopefully we
[56:09] become very familiar with the uh Genesis protect app we used it during the fire
[56:15] um it is also a tool that is fluid and is able to be changed so what I'd like
[56:22] everybody to understand is the zones that we were working with
[56:27] prior were fire zones um each incident is going to have its own Dynamics to it
[56:35] now we have adjusted some of the zones they are basic the base zones will
[56:39] remain the same but we may have uh basically split some of the zones into
[56:44] an A B and potentially even a c these are going to be the mud and debris
[56:50] debris flow zones um which we have used the uh
[56:57] modeling that uh analyst car Carlson has spoke to to
[57:03] come up with these so um once again we're going to ask folks to get onto
[57:08] this app it's going to be a good point for you to know right now we put it all
[57:13] into an advisory in these blue sections here and uh when the time comes we can
[57:19] be changing those to an evacuation warning or an evacuation order and
[57:24] though you'll see the the zone will actually change colors but you'll be
[57:27] able to I don't know James you could pick just that 2B there and click on
[57:32] that U it is basically if you look at the left it tells you it's in an
[57:36] advisory and it gives you the reason those reasons right now uh we taken the
[57:41] Liberty to go ahead and put those into a phase two reason so they do um they do
[57:47] follow La County's mud debris flow um Phase 2 criteria or basically their
[57:54] definition so it's a helpful tool for our residents to kind of take a look
[57:58] at and mostly we really want to let folks know we have been planning and we
[58:03] have been prepping for this and we have identified some areas are concerned and
[58:07] we want to make that known to our citizens so they can prepare uh and as
[58:12] Chief baranto said again once the uh and if but uh any
[58:18] evacuation orders come where asking that you do please leave a
[58:22] residence um it's this is going to be a very different Dynamic than the fire we
[58:27] had a lot of residents did not uh heed the order for the fire
[58:32] evacuations um but this is going to be different uh what I want people to know
[58:36] at least from the fire side is if we have active mud and debris flow we are
[58:43] not responding in that area for an emergency especially if you are under an
[58:47] evacuation order you should not be there we are not going to put public safety
[58:52] personnel into Jeopardy in an active mud and debris FL
[58:56] um we will get there if we if we have the opportunity but under an evacuation
[59:00] order and again I can't stress enough when it's active we're not going to put
[59:04] First Responders in Jeopardy so please adhere to it it's a it's a different
[59:08] Beast than a fire can I ask a question yes is there
[59:13] anything else you have for your presentation no sir that was it okay on
[59:15] that note though I have a question yes please so should anybody even if they
[59:19] didn't evacuate let's say it didn't evacuate but we have active mud flow
[59:22] should anybody try to mitigate an active mud flow no it it and then the fact is
[59:28] and here's my suggestion if we have active and you still at home then
[59:32] shelter in place do not try to leave stay in your home um and hopefully uh
[59:38] stay in a safe Loca location in within your home but do not try to leave during
[59:42] active L debris flow we've all seen um news reels on this and it it's it could
[59:48] be very devastating and um very hazardous to
[59:53] life um so yeah we don't we don't uh uh once see the order will be
[59:59] given prior to any active flow as much as we can we're going to we're going to
[1:00:04] anticipate we're we're we're watching we're listening and we're U we're ready
[1:00:09] to give it the evacuation order prior to hopefully any any potential so um with
[1:00:18] as much notice as we get we'll give the public great counc member go so you're
[1:00:22] saying if you get caught shelter in place
[1:00:26] right correct but when you say it's a different Beast somebody's sitting in
[1:00:30] their house when you have a mud flow above you can you paint a picture of
[1:00:34] some of the potential problems that with that for them sitting in their house
[1:00:39] sitting in your house it depending on your location it could take out your
[1:00:42] whole house um and we won't be able to dig that out for quite a while depending
[1:00:48] on the severity of it I mean it's all speculation at this point we haven't
[1:00:52] seen it our city has never gone through an experience like this where our whole
[1:00:56] front country basically from you know Mitchel Linda to San Anita has never all
[1:01:01] burned at once at least in the histories that any of us are aware of um and so
[1:01:06] therefore we don't truly know what to expect other than historically what have
[1:01:11] we seen on previous fires but that's only been portions of our town so um
[1:01:17] we're we're just at we're asking people to expect for the plan for the worst but
[1:01:21] let's hope for the best U and again uh if we do the evacuation order please get
[1:01:26] out thank you k m Garcia thank you Mr Mayor uh thank you Chief and and I
[1:01:32] opened up my U Genesis protect app and I see as I so I'm I'm Zone 14 and I've
[1:01:38] known that since you've put this in front of us like 18 months ago um and as
[1:01:42] I zoom in I see it split in between uh A and B so I want to I would just want
[1:01:47] residents to know that you kind of have to zoom in on your app to see if you're
[1:01:51] a or b if there is a split um but my question is um one of my children goes
[1:01:58] to Mir high school and I D drive through aladen every morning and I would get
[1:02:01] alerts through not Genesis through smart 911 that I'm entering different zones
[1:02:06] that have different warnings will those warnings push through smart 11 911 as
[1:02:11] well and I know we have our nixel which are really well connected with Genesis
[1:02:15] correct um smart irland one thank you for for bringing that up that is
[1:02:19] something that we've been trying to implement for quite a while now it's
[1:02:22] gaining traction but it is not completely there as
[1:02:26] as an all-encompassing uh notification tool it because the reason I say that is
[1:02:31] an opt-in uh platform so if you sign up for it you will get those notices and
[1:02:36] and the the beauty of it is no matter where you're at in the State uh you
[1:02:40] could be visiting relatives in the northern California area if they if they
[1:02:43] have this active you're going to get notified for an area you're in no matter
[1:02:47] what it's just it's all GPS tracking type of stuff and and it and it will
[1:02:52] activate and that's what I've noticed as I drive you are now entering
[1:02:56] a Zone that's under evacuation warning and it would it will it will alert me to
[1:02:59] that yeah and the same the same kind of applies for the Genesis protect um you
[1:03:04] can type in your address it'll tell you what zone you're in or even if you if
[1:03:09] you move to another zone for instance if everybody opened up this app right now
[1:03:12] we'll all be in uh in in the same zone different than where you're where you
[1:03:17] may where you may live but you can also save one of the zones as your favorite
[1:03:22] so even if you're not home you can which is the great part about it with we have
[1:03:26] to repopulate after evacuations you can just go on this app and see what the
[1:03:29] status is without having to call the City without having to you know get in
[1:03:33] line behind everybody else to find out what's going on and I know the well four
[1:03:37] of us you the five of us are usually here are our utmost concerned is Public
[1:03:42] Safety um that being said I know we've had we've had some residents asking
[1:03:47] questions about am 16:30 is that still not really active not something to rely
[1:03:53] on at this point in time I think it's important for our residents to know know
[1:03:56] exactly where they should look and what they should rely upon uh may have to
[1:04:01] pass that off to to maybe city manager but my understanding yes it's not
[1:04:04] completely reliable yet because we do have some some old equipment old
[1:04:08] technology yeah where we cannot get those parts to repair it and make it uh
[1:04:13] fully functional at this point um and so what it is is we've heard loud and clear
[1:04:17] that we try to you know the community wants us commun communicate as best as
[1:04:21] possible we're finding all the tools we can not nothing's going to get replaced
[1:04:25] placed or throwing out they're all tools in the toolbox they're all applicable
[1:04:29] some might be more appropriate at a certain time uh but the Genesis protect
[1:04:34] the smart 911 app uh and and nixel they're all going to be utilized um if
[1:04:40] we have to we can use them all in concurrency thank you Chief welcome
[1:04:45] mayor may I add um some of the steps that uh we've taken is uh on the website
[1:04:50] in the next 24 hours when you go on the website this map will pop up um also on
[1:04:55] the website uh you can click on um the nixel tab and every nixel alert will is
[1:05:01] there for for our residents what I really want to stress is that right now
[1:05:06] the zones that are listed in that that light blue are
[1:05:10] advisory and I want to stress to our residents that those will likely change
[1:05:14] to a warning in the next 24 hours and there's a high probability that we'll
[1:05:19] have evacuation orders um so um we want residents to be prepared gather their
[1:05:25] documents the pets any medications um and make arrangements uh if you're in
[1:05:30] those areas for potential evacuation and relocation um until this event uh the
[1:05:35] storm event passes for mudslides do we also operate under the Ready set go
[1:05:41] correct and so where are we right now so right now we are I'll turn it over to
[1:05:46] yeah just a great question mayor thank you for uh for serving that one up um we
[1:05:51] do basically still operate under Ready set go the same we would under under
[1:05:55] Fire condition um so I want residents to be advised we
[1:06:00] do have an ordinance for um basically yellow and red flags as well um if you
[1:06:06] see those we'll have those basically strategically um at like Mary's Market
[1:06:11] at the search and rescue um station at the fire station will'll be putting out
[1:06:16] flags that correspond with either a yellow flag which would be basically an
[1:06:21] evacuation warning for the set portion and and then the red flags which mean a
[1:06:28] uh go or an evacuation um order and so those will go out if we get to any red
[1:06:35] flags where they are mud and debris flow or whether they're fire weather red
[1:06:38] flags still will mean that we will implement the uh red flag parking
[1:06:43] restrictions within the appropriate areas as well um and that's the other
[1:06:47] thing that we definitely want to make folks uh be aware of when I say this was
[1:06:52] is a different Beast um once we we ISS those um even if your cars are parked in
[1:06:58] your your garage or your parking spot that you may have for instance in the
[1:07:03] canyon um if we have heavy mud debris flows you're you're not getting out
[1:07:09] period so just take that into consideration even if you have a parking
[1:07:13] spot maybe moving your vehicle out uh to a safer area so if you do have to uh you
[1:07:19] know evacuate or even your second car or what have you you have access to it it's
[1:07:24] just again a a suggestion when we implement the uh red flag parking
[1:07:28] restrictions can we suspend parking citations are we still suspending
[1:07:33] parking citations currently that will go in conjunction
[1:07:38] with the with the red flag parking restriction again that will be an
[1:07:41] advance of of anything so we do evacuation orders or the well I meant if
[1:07:47] you're parking your car further some away from your house you're not going to
[1:07:50] get a ticket obviously we're not going to ticket I hear I apologize to that
[1:07:54] thank you leave that up to my the police chief
[1:07:57] told me to thank you for the question but uh mayor protm yes absolutely we
[1:08:02] could we'll put that on our social media that we will exempt all parking
[1:08:06] restrictions for overnight parking um till next week
[1:08:10] Monday and and uh if we go into the go portion we'll have the the police cars
[1:08:17] going up and using their loudspeakers to announce like they did during the
[1:08:20] fire thank you for the question that's that's correct it's either going to be
[1:08:24] PA systems door knocks it just depends on the circumstance and obviously the uh
[1:08:30] um the terrain of of of the neighborhood and if residents want to
[1:08:35] get sandbags where can they get them at this
[1:08:41] point currently the city is providing sandbags at the entrance to the public
[1:08:47] yards or Public Works yards and um there you you have to present ID proof of
[1:08:53] residence to be there and I think we're doing a limit still or no 25 25 um and
[1:08:59] then James you might be able to talk to this I'm not sure if we still have some
[1:09:02] at Victory Park available as well but yeah Victory Park is is still a
[1:09:07] location it's the same thing they're they're a county entity so sarrians are
[1:09:11] they're qualified to go to Victory Park for the same um situation 25 unfilled
[1:09:17] bags with an ID uh Public Works has also um
[1:09:21] strategically uh staged a few pallets of filled sandbags in some of the highest
[1:09:27] priority areas I'm not going to tell you where that is because everybody will
[1:09:31] come and get them but the people that see them in front of their house those
[1:09:34] are for you and and do we have any estimates on
[1:09:39] the number of bags that we've handed out the number of K rails in whatever units
[1:09:44] make sense that we've we've done in in preparation for
[1:09:47] this um yeah you know director yanz has pretty good idea on that great thank you
[1:09:53] director yanz Mr Mayor and members of city council uh
[1:09:57] we put out approximately about 52k rails uh the north part of town we have
[1:10:03] distributed over 550 um
[1:10:07] unfilled um bags we have placed approximately over 1,000 filled sandbags
[1:10:13] at key uh areas throughout the north part of
[1:10:17] town great thank you so much just a just a followup question regarding parking
[1:10:23] and it might be in De brief flow so maybe public works is is important so
[1:10:27] sometimes with debris flow our roads are used as diversion channels instead of
[1:10:31] we're not going to try to block tons tons and tons of of debris so our roads
[1:10:37] are actually sometimes used so if you leave your car on the road and you're
[1:10:42] under evacuation warning that car can actually
[1:10:44] become uh a potential Hazard to other people if it gets carried down the road
[1:10:49] is that is that also true that is an excellent question sir yes the goal here
[1:10:53] is to flow the mud like of better ter we want to help the
[1:10:57] mud along the street um should a car be left there the mud flow the pressure the
[1:11:03] amount of volume that that will be coming down the street there will'll
[1:11:06] physically pick up the car and then probably Lodge it somewhere then we have
[1:11:10] an issue it'll be it a car Dam okay so not not not only danger to property or
[1:11:17] life uh from that one moving car but it could actually create other issues it
[1:11:22] could create an issue it it could Lodge itself between with between two other
[1:11:26] cars uh a tree Etc then now we have a problem where we're building up pressure
[1:11:31] building up pressure leading to a more serious problem sir thank you for that
[1:11:34] you're welcome mayor I have one more uh point that I'd like to invite Senior
[1:11:39] Management Ellis Carlson back to talk about Athens um pickup
[1:11:45] service yeah I was in discussion with Athens today if if you don't know uh
[1:11:50] Athens Services the the upper and lower Canyon areas on Wednesdays and Thursdays
[1:11:56] and it's not a straight delineated line either it's a little bit all over the
[1:12:00] place um they will be picking up trash tomorrow on Wednesday they will not be
[1:12:05] picking up trash on Thursday um we just do not want trash cans in the road
[1:12:11] whatsoever we don't want the Athens drivers um putting them themselves in an
[1:12:16] unsafe position or getting in the way of some other things we might be trying to
[1:12:20] do so no Athens collection in the canyon on Thursday

[1:12:39] presentations um and so our first presentation is to the CR moderate
[1:12:43] search and rescue um so if we could get the search and rescue team to come up
[1:12:48] here um and I'm going to come up to the podium up there
[1:13:06] I follow right where you said g to
[1:13:14] go so before I start and give the the uh certificate of Rec recognition I'd like
[1:13:19] to call up uh Bob Spears the head of our EOC and to have him start kick us off
[1:13:26] and then I'll read the the pronouncement so for those of you that
[1:13:31] remember on January 7th we were supposed to have a wind event and we looked at it
[1:13:35] as it was going to be like uh 2011 when we had the big winds come through town
[1:13:39] and we were doing really really well with that up until about 618 when the
[1:13:45] fire broke out in Eaton Canyon and suddenly uhoh we were in a position we
[1:13:51] open with the eocc was open senior staff was there we were managing the emergency
[1:13:55] very well uh but then when the uh fire took off all of our fire department was
[1:14:01] gone they're they're committed all our Police Department is gone because
[1:14:04] they're committed the county was evacuating parts of our city and we were
[1:14:08] getting phone calls that we had people with disabilities who would like to
[1:14:12] comply with the evacuation order but they could not because their caretaker
[1:14:16] had left and I'm looking around the room and for those of you that don't know the
[1:14:23] city of Si M has a rather flat or chart so uh there weren't a lot of extra
[1:14:27] people and we didn't want to send a dump truck up with a public works guy so the
[1:14:32] search and rescue people we have been we've been working with them in in in
[1:14:35] our EOC really really well and they've been uh incredibly supportive and they
[1:14:41] said we can do this so boom up they go they go out and rescue these people they
[1:14:46] took them down to to Pasadena to the convention center where the where they
[1:14:50] had the uh the the big shelter did did a great job came back and said you know
[1:14:58] what else can we do oh by the way we have the we have the ability to map the
[1:15:02] entire fire area for you on kelpo and come back and bring you the maps and I'm
[1:15:06] looking like well that's something that takes days and weeks and and usually a
[1:15:10] county person boom they're gone again and they come back you know like 12
[1:15:14] hours later here's the map here's the stuff we had to go out and buy the
[1:15:17] software so we could read what they were doing so these people should arrive on
[1:15:21] white horses because they have literally contributed phenomenal expertise and
[1:15:27] time and skills to the citizens of sier M and have done a great job in doing
[1:15:31] that so I am very very grateful that they are even in town they are they have
[1:15:37] an excellent attitude they're wonderful and they're a volunteer organization
[1:15:41] which is near and dear to my heart so thank you all very much before you
[1:15:48] go is there one more that they did after the fire as a part of the repopulation
[1:15:53] plan they doing something with with with checking out the homes and all that they
[1:15:58] helped do that they when they prented provided us with caltopo maps we're
[1:16:03] looking at where all the houses are that were burned we we had information about
[1:16:08] what was going on in our city before the county and everyone else and we were
[1:16:12] able to give them to to the planning department here's your map here's
[1:16:15] everything that's going on it was it was phenomenal they went around the those
[1:16:19] buildings not only did they take pictures of the of the destroyed
[1:16:23] buildings but the the areas around around them so and they were all linked
[1:16:26] to the map we I mean we we couldn't asked for a a a more professional and
[1:16:32] indepth service and they did it for free out of their own Goodwill
[1:16:38] so so that couldn't be a better way to to kick this off so here we've got a
[1:16:42] certificate of recognition uh for the search and rescue I'm going to go ahead
[1:16:46] and read it so uh it says whereas the city the whereas the Sierra MRE search
[1:16:53] and rescue team has long been a Pillar of Strength dedication and bravery
[1:16:58] providing volunteer life-saving assistance to those in need throughout
[1:17:02] our community and Beyond whereas during the devasta devastating eaten fire which
[1:17:08] threatened homes livelihoods and the natural beauty of sier Madre smsr
[1:17:14] responded with unwavering commitment working tirelessly alongside other First
[1:17:19] Responders to ensure the safety of our residents and protect our city whereas
[1:17:24] the selfish efforts of the team including providing evacuation
[1:17:28] assistance search and rescue operations mapping the disaster and critical
[1:17:32] support for emergency Personnel played a vital role in mitigating the impact of
[1:17:36] fire on our community whereas despite the destruction caused by the fire the
[1:17:42] courage professionalism and expertise of smsr provided hope and reass reassurance
[1:17:48] to those affected exemplifying the highest ideals of service and
[1:17:53] sacrifice whereas the city of s Madre recognizes and honors the extraordinary
[1:17:58] contributions of the S Madre search and rescue team whose actions during the

[1:23:34] what city council was doing in an area and I still AR happy on an election but
[1:23:40] what I what what I learned from it was the city staff is just incredible to
[1:23:46] think that a a a city could have such dedicated hardworking thinking about the
[1:23:52] city first we um you know when we uh when we coach kids in baseball you know
[1:23:57] we always say play for the team first and uh I'll tell you the Sierra mandre
[1:24:01] has a staff that plays for the city first and very very fortunate so it was
[1:24:07] really um a rewarding experience and uh I appreciate the opportunity I think I
[1:24:12] worked with probably three city um three city managers at least three Finance
[1:24:17] directors but through through all of that none of it none of it changed just
[1:24:22] very very um enamored and um just kind of in awe in
[1:24:27] their dedication um bugged me a lot to get stuff done I had a few other things
[1:24:31] going on but um through it all I appreciate the opportunity and and thank
[1:24:35] you yeah thank
[1:24:50] you so Mike before Sue Spears put her name in I I I was gonna that's Chris low
[1:24:56] I was gonna add your name anyways to the next ballot but Sue Spears took care of

[1:26:45] the Professional Services agreement with willand engineering Mr Mayor this

[1:27:10] question was um is this extension because we are behind it all or is this

[1:27:25] uh in the original when this project uh began uh know two and a half years ago
[1:27:29] give or take uh the original uh Grant agreement was for January of
[1:27:35] 2025 and then we were very fortunate to receive the extension into next year uh
[1:27:41] that is the reason at the same time after discussing uh the project itself
[1:27:46] with TSK they are very much committed they uh are staying on board to see the
[1:27:52] part the project through which is the norm for for a project of this
[1:27:56] magnitude my second question is is the
[1:28:01] 91751 is that an amount added to this to this contract we previously had and also
[1:28:07] where is that funding coming from no ma'am that's this is the original agreed
[1:28:12] uh dollar amount from the original contract agreement and this uh funding
[1:28:17] is coming through the uh awarded Grant by by the state of California thank you
[1:28:22] you're welcome all right any other questions on item C
[1:28:28] item D all right I have some questions on
[1:28:32] item D2 okay that would be for the willan
[1:28:37] engineering for Fire Marshall fire plan review and fire code official and fire
[1:28:46] inspection um so just to clarify the increase from 135,000 to 300,000 is
[1:28:52] spanned over a 4year span and when is that contractual date
[1:28:56] ending I will refer that to uh thank you the planning
[1:29:02] manager I think it's director Lynn now is that right you're not tell
[1:29:09] anybody and congratulations thank you mayor and mayor protm um so the contract
[1:29:16] will remain the same um duration the four-year expand from um
[1:29:22] 20203 to 2027 okay great thank you and this might be back for one of you and I
[1:29:28] I'm sure you won't have the ability to add this now but one thing I'm curious
[1:29:32] about is looking at the amount um that we're paying to wian and how much would
[1:29:37] it uh cost us to be able to have our own fire marshall in sier Madre instead of
[1:29:42] Contracting it out to
[1:29:46] willan Great questions that I do not have exact numbers for at this point um
[1:29:51] we are we are assessing that currently and uh and we'll be able to look at it
[1:29:56] but I would like to make uh notice that the contractor services that we have for
[1:30:02] our Fire Marshall through willan uh is currently for the you know
[1:30:08] plan checking doing field inspections such as sprinkler inspections and things
[1:30:13] like that um as long as well as as helping with you know code adoption and
[1:30:18] and the like the uh proposed um Public Safety or excuse me um
[1:30:25] Community risk reduction officer would be a lot more encompassing to include
[1:30:30] all of those functions as well as be involved in education to our community
[1:30:36] uh be AAS on uh not only to uh some of our Civic clubs but um in education and
[1:30:45] but um the fire safe Council that we're looking to start up fireway Community
[1:30:48] would be a liaison between them would help partner with them as well and so
[1:30:53] it's a a very encompassing job we would even have them looking at doing again
[1:30:58] Community risk reduction so we uh most of our calls are ems we can work with
[1:31:03] our EMS coordinator on the number one thing which happens to be probably
[1:31:07] gravity in this town we have a lot of Falls um can we help educate some of our
[1:31:11] senior community on stuff like that so it's it it it is almost apples apples
[1:31:17] but it might be a Macintosh to you know Granny Smith type it's I absolutely
[1:31:22] agree that so pricing will be a little bit different but we are assessing um
[1:31:26] what what we would look at for that job description and what what we would
[1:31:30] actually offer somebody thank you any other questions on consent item
[1:31:36] D all right uh now I'd like to open this up uh for uh public comment Madam clerk
[1:31:43] do we have any um cards for public comment for this item uh not for the
[1:31:48] consent calendar Mr Mayor all right seeing no one come forward on it um we
[1:31:54] do we have any discussion Mr Mayor yes uh I just I know this is um a city
[1:32:00] treasurers report um from TR City Treasurer Sue Spears but there's some
[1:32:05] remnants of Michael mar Mario in here that I just I just want to highlight and
[1:32:09] thank him for while he's
[1:32:14] still so it would there was a time uh very
[1:32:19] recently in the uh let's say 2 three years ago when the Leif funds the local
[1:32:23] agency investment fund was earning less than a percent um and so we have a lot
[1:32:29] of reserves instead of just putting them in a bank account um why not invest them
[1:32:33] and earn some uh investment income some interest um then there was a it's
[1:32:39] followed by a time when the US Treasury government securities especially on the
[1:32:46] shorter term to maturity six months a year two years um were were yielding 4%
[1:32:55] sometimes close to 5% and it's my understanding from talking with staff
[1:32:58] that it was Treasurer Mario that said hey these are risk-free we can ladder
[1:33:03] these bonds and if we hold them maturity we're guaranteed this return rather than
[1:33:08] just having it in Lay funds it doesn't need to be that liquid um yeah we're
[1:33:12] going to get ten of a percent on the stuff where we need liquid but on this
[1:33:16] other stuff that we may not need first six months or two years let's earn four
[1:33:21] or 5% on that and so just given that it we earned an investment income we can't
[1:33:27] we can't rely on it but we earned hundreds of thousands of dollars if not
[1:33:31] a million dollars or more due to that decision so I just want to thank uh City
[1:33:36] Treasurer Mario for being Nimble and um thinking little bit outside the box of
[1:33:42] what we normally did in changing our investment strategy to make us some
[1:33:47] money while he could so that's that's my comment on that so thank you City
[1:33:52] Treasurer thank you so much I really appreciate you bringing that up I was
[1:33:55] going to make a mention uh of his service there and you did it far better
[1:33:59] than I could so thank you so much um any other discussion on the the consent
[1:34:05] items great uh so then I will look for a motion to approve the consent items move

[1:34:18] our first public hearing and so I'd like to call up Ems Captain uh busos to
[1:34:24] present the schedule adjustments for the sier Madre fire
[1:34:31] department good evening mayor mayor protm City Council Members thank you
[1:34:35] foring Captain pastillo could thank you you read my mind I forget I'm short wait
[1:34:41] it's also it's for the people at home we want to make sure that they can hear
[1:34:44] thank you U thank you for allowing me the time to speak with you today um I'm
[1:34:48] here on behalf of the fire department to request a few fee adjustments to the
[1:34:52] city's fee schedule
[1:34:55] so uh we're looking for three additions um our epcr fee A dispatch fee and a
[1:35:01] first responder fee um and then some adjustments to our current paramedic
[1:35:06] subscription program so I will begin with our epcr
[1:35:11] fee um we were on paper until 2018 when everybody converted to this digital
[1:35:16] format um so what you're seeing on the left side of the screen um is our actual
[1:35:21] epcr electronic patient care report um and it kind of serves two purposes uh
[1:35:26] it's going to document all of the data that we collect on a call so incident
[1:35:30] times the resources that were there um any treatments that we gave um any type
[1:35:36] of intervention um and um any medical data um for the patient um the other
[1:35:41] side of that it is it allows us for seamless transfer um between uh agencies
[1:35:48] so in times of automatic Aid um everything that one report has started
[1:35:52] can be transferred to another uh Department it also allows for the
[1:35:56] transfer of that data to be um moved to the hospital when we do transport our
[1:36:00] patients and additionally um the department of health services um is able
[1:36:05] to um see that data for their qaqi purposes so it just ensures continuity
[1:36:10] of care um between all the agencies um So currently uh we are using
[1:36:17] digital EMS um this is the provider for um nearly everybody in the county um
[1:36:22] they do charge us for .95 per e epcr completed and we
[1:36:28] completed epcr for any patient assessment whether it's transported or
[1:36:33] not um so the city currently subsidizes these costs for this epr epcr use um so
[1:36:40] below there you'll see the rate comparison for the agencies in LA county
[1:36:44] that are currently charging this fee and their Associated fees on the
[1:36:50] right um so this is um a slide just as an example of what the recovery cost
[1:36:56] could look like um had that fee been implemented the last um four years um so
[1:37:02] you'll see the year in reference the call volume for that year um and had the
[1:37:06] fee been applied that would be the recovery that we got um we're seeing
[1:37:10] about a 10% increase in EMS calls every year so taking that into account for
[1:37:14] 2025 we're likely to reach uh 1,77 calls um which would equate to about 5,300 um
[1:37:21] in Revenue um and just uh side note um I did not
[1:37:26] include 2021 in this um in the increase fees um in fees because uh we had a
[1:37:33] significantly low call volume due to covid um so this is um our epcr fee um
[1:37:40] we're looking to just place the cost of service for $495 um into the fee
[1:37:46] schedule uh if you have any questions on this one if not I'll move on to our
[1:37:49] dispatch fee so I had a quick question so uh on
[1:37:55] the previous slide um so are these the fees that the
[1:38:01] cities are getting charged because we're getting a
[1:38:04] $4.95 fee so so so why are the the fees different on here is are Kia getting a
[1:38:10] much better deal with them um and is Downey like what are they what are they
[1:38:14] including in their fee because it's quite a bit more thank you for that
[1:38:17] question everybody's getting charged $4.95 um so you will see some
[1:38:21] departments charging for profit on there um and then others that maybe just have
[1:38:25] not updated their fees on their fee schedule so I'm going to turn to City
[1:38:30] attorney I thought you couldn't charge for profit on
[1:38:34] these yeah I know I don't they they're they're probably incorporating other
[1:38:38] costs in there okay yeah I don't know what those other costs would be but um I
[1:38:44] I I don't think they could I don't think they could turn a profit on this one got
[1:38:48] it okay just for clarification and uh definitely not speaking for any of our
[1:38:53] neighboring agencies but it could have been some sort of assessment on uh staff
[1:38:58] time that they increase those fees uh I don't know if we would technically use
[1:39:03] the term of for-profit but I'm sure it was assessment again on staff time and
[1:39:08] and they adjusted as they saw accordingly just as we recently have
[1:39:12] done Citywide through our our fee schedule go thank you
[1:39:17] okay okay moving on um this is going to be our dispatch fee so we're currently
[1:39:22] dispatched through Doo Communications um they've been
[1:39:25] dispatching our fire and EMS calls um since 1999 they're going to Service 13
[1:39:30] fire fire departments in LA county um that's going to be all of our
[1:39:33] surrounding agencies um so anytime somebody in s MRE calls 911 that that
[1:39:38] phone call is going to go to our PD Dispatch um if they deem that a fire
[1:39:41] related call it will go to Verdugo um who will collect the data um from the
[1:39:45] caller and uh dispatch the appropriate resources they are currently charging
[1:39:52] $848 per dispatch really quick is that on on top of another contractual price
[1:39:58] that we pay no so it's 8418 per call um and so the fees that I've seen that
[1:40:04] we've paid out have matched that I don't know outside of that if there's another
[1:40:08] no I mean do we pay for their services and then this is also what they charge
[1:40:13] per call from what I it okay great questions um actually this this is what
[1:40:20] we will see they base that off of uh the previous year's call volume they will uh
[1:40:27] get together their their board or their guiding um entity and they will assess
[1:40:34] new fees that is the current fee for this year it hasn't changed from last
[1:40:38] year however they they will revise the uh agreements that we all have with them
[1:40:44] and that just basically comes out to what the average call is so to answer
[1:40:50] your question the fees that we pay them that's Incorporated in there
[1:40:54] uh so for instance if we ran 1,500 calls last year it' be multiplied times to
[1:40:59] 8418 and that would be the the fee we pay them so it's it's basically just a
[1:41:04] pass through uh fee that we're we're looking to uh to try and Implement does
[1:41:10] it matter if it comes to where you which entity is responding or where the Call's
[1:41:14] coming from so let's say you're responding to Arcadia we don't get that
[1:41:19] charg necessarily because even if we respond to that call we would as far as
[1:41:24] the dispatch fee uh for instance the EMS calls we would get we would get that fee
[1:41:30] as well as the epcr fees if we respond to another another city we will again
[1:41:36] that's it's more of a pass through uh charge and anything else we're just
[1:41:40] trying to recoup what we're being in charge for the service thank
[1:41:48] you okay so this is the rate comparison for Ellie County for the Departments
[1:41:52] that are currently charging a dispatch fee as
[1:41:57] well um and again we're just um asking for that cost of service at
[1:42:02] 8418 to be added Kevin B BOS in in both the staff
[1:42:08] report and your presentation the dollar amount is 8414 I know it's only 4 cents
[1:42:12] but um I just noticed that there was a little discrepancy there so are we we're
[1:42:17] going to ask for 80 8418 yes yeah um so same slide with um all the same rules
[1:42:23] applied um this would be just an example of what that would look like had the fee
[1:42:27] been in place um the last four years um we're seeing approximately 8%
[1:42:32] increase in calls um year-over-year so 25 would likely reach
[1:42:36] 1,666 calls um equating to about a little over
[1:42:41] 140,000 so a question on that so does that mean that there are some calls that
[1:42:47] we have that don't use epcr that's correct uh if we do not do an assess on
[1:42:53] the patient we will not you um get do an epcr but this is for a dispatch fee um
[1:42:59] so we are getting the dispatch fee on a recall that makes perfect sense
[1:43:05] yeah okay um last fee would be the first responder fee so um as you may know in
[1:43:12] 2024 we converted our paramedic um assessment engine to a medic engine um
[1:43:18] so now we provide the city with two full ALS units uh 247
[1:43:23] um so basically that engine looks exactly like the ra without the
[1:43:27] capability to transport so in order to do this uh we
[1:43:31] had a representative from Laie County Department of Health Services come out
[1:43:34] they did an audit of our engine and deemed it uh the rig fit for service um
[1:43:38] there are only a handful if at most um of medic engines um in LA
[1:43:44] county um so it's a little bit big big deal for us um and uh doing that
[1:43:51] transition it did increas some costs for us um and those costs are going to be uh
[1:43:57] initial costs and uh for the to uh the IND indicator emblems to recognize the
[1:44:04] engine as a paramedic engine um some addition of um equipment that are U
[1:44:10] multi- or not single use like backboards um air splints um things like that and
[1:44:15] then also those reoccurring costs that are going to happen on all our calls um
[1:44:19] that will Encompass Medical Supplies medications IVs vages things like that
[1:44:24] um so we'll be looking at those costs continually
[1:44:28] continuously um and so just to give you an example um if engine 41 was to
[1:44:33] respond outside of the city say to Arcadia for an ankle fracture um the
[1:44:39] engine currently would respond um they would start their
[1:44:42] epcr um they would treat that patient um give medication start an IV splinting um
[1:44:50] and then uh once the ra arcad is arrived Arcadia would take over that patient
[1:44:55] continue care to the hospital and and um they would be um have the billing rights
[1:45:01] to that call so we would not see any recoup cost for that um and to the other
[1:45:08] side of that same thing happens if it's within our city and our engine responds
[1:45:11] and we have an outside agency coming in to transport billing rights are with
[1:45:15] that transporting agency so we would see um no recoup on those costs
[1:45:20] either um so we are looking to Implement a fee of
[1:45:25] $189 um and this is going to be charged only when the engine responds alone
[1:45:30] without our ra so if it was with an outside agency's ra it would be charged
[1:45:35] um the 189 was a previous rate that we had um in the fee schedule that was
[1:45:40] removed in 2020 um when we increased some of the assessment fees for ra 41 um
[1:45:45] but now being that is a medic engine we would like to reimplement that fee um
[1:45:50] and these are the three agencies that are currently um charging a first
[1:45:53] responder fee as
[1:45:59] well um and again just an example um of what uh recoup cost would look like um
[1:46:05] for the previous years uh really no Trend in Engel engine only calls so I
[1:46:11] just took the average of uh 2022 through 2024 um and that gave us
[1:46:19] 42477 can I ask you a question when when we charge people this is this covered by
[1:46:25] their insurance is this that extra amount that's not covered by their
[1:46:28] insurance it is these are all going to be pass through fees so likely not
[1:46:33] covered through Insurance depending on the insurance as
[1:46:40] well um so just to tie everything together um all of those fees um added
[1:46:46] together uh you're looking at that that middle column for cost recovery
[1:46:49] historically s modre collects about 79% um for through Billing Services um so
[1:46:56] that uh 79% is applied and you'll see the the uh outcome on the right so um
[1:47:03] based off of those 2025 assessments with that 79% collection fee um rate applied
[1:47:09] we're looking at nearly 150,000 um in cost recovery that added
[1:47:14] to our the 600 that 600,000 that we currently colnect collect through
[1:47:19] medical AIDS we're looking for cost recovery close to 3/4 of a million
[1:47:23] that's insurance and everything put together
[1:47:27] yes um and so we're looking to implement Implement these fees um beginning March
[1:47:32] 1st
[1:47:37] 2025 okay and lastly is our paramedic subscription
[1:47:42] program um so our current program um is uh not utilized as much as we would like
[1:47:49] it to be um a cost of an ambulance especially ALS ambulance is at minimum
[1:47:54] $3,200 and that's without any additional fees depending on the call and the
[1:47:58] treatment um and so that's typically not completely covered by insurance so
[1:48:03] that's going to result in outof Pocket fees uh for the
[1:48:06] residents um so members of the program are assured that those costs are covered
[1:48:11] by the city um and they will not see any out-of pocket expense So currently we
[1:48:16] have about 553 subscribers that's about a 5% usage rate so it's fairly low um so
[1:48:22] we've created some various plans in order to help bring down costs for
[1:48:26] residents and encourage
[1:48:29] usage and these are the plans we'd like to implement um the single plan would
[1:48:34] still remain at $89 and that is for the year um the couple plan for a two-
[1:48:40] member household it's going to just be a 20% reduction so $142 for two people or
[1:48:45] 71 a person a family plan for a thre member household um so it's going to be
[1:48:51] $158 or $56 a person each additional member 18 and we would cap that at five
[1:48:56] people a business plan so 10 employees would be $100 and any additional 10 10
[1:49:01] employees would be another $100 and a loow income plan for an
[1:49:05] entire household um for qualifying residents would be 45 for the entire
[1:49:13] household are there other cities that have subscription programs and is our
[1:49:18] enrollment rate similar our prices similar can tell us a little about kind
[1:49:22] of as you did a benchmark on this the there
[1:49:25] are many agencies that do have a subscription program um they kind of
[1:49:30] vary from 45 um to the highest I've seen was uh 180 um so we're kind of in the
[1:49:36] middle um but uh not too many offer the business and family plans I've only seen
[1:49:41] about two other departments that do that other questions I have a few go for
[1:49:47] it one to all right thank you so um I think you kind of answered it within
[1:49:52] your Pres presentation but um so these fees extra fees won't only be aren't
[1:49:58] only assessed when there's Transportation so if there's a call and
[1:50:02] there's a a PCR put together and um goes through dispatch somebody be charged
[1:50:08] roughly $90 and they're not transported so the epcr Fe is
[1:50:13] $4.95 um so that would be a charge um the um the dispatch fee 8418 um that
[1:50:23] would be a a charge as well um and then the assessment fee definitely because we
[1:50:28] do even though we don't transport patients we do treat patients um and
[1:50:32] sometimes we treat them and leave them at home um so we're still utilizing
[1:50:36] those supplies okay and so I'm just like scen running scenarios through my mind
[1:50:40] uh let's say kid gets hurt at the park there no parents around you come and I'm
[1:50:45] assuming you can provide service to a kid gets hurt and then how do you kind
[1:50:49] of follow up on that so everything is documented it in our epcr and that goes
[1:50:54] to our billing company um it's outside billing company Whitman and so they will
[1:50:58] handle the charges for us but let's say little Garcia's at the park and mommy
[1:51:03] and daddy Garcia after at work um and how do you how do you follow up when you
[1:51:10] you know it's like an eight-year-old child and you don't have their
[1:51:13] information or is that not do we kind of let those kind of slide or um we we
[1:51:17] gather all the information we can so it's um we we can put in that patient's
[1:51:22] information and then based off address and other personal information we can
[1:51:26] get those bills out okay okay thank you um and then I guess that was one and two
[1:51:31] um the other question is so since we're thankfully in automatic Aid let's say
[1:51:38] you are a member of the subscription program but um the city of Arcadia
[1:51:42] transports you do they honor our subscription program and do we honor
[1:51:47] theirs and how how does that work is there reciprocity there yes the city
[1:51:50] will honor any transports made in s audre from an outside agency and outside
[1:51:56] agencies honor our program as well that I'm not sure
[1:52:03] about for example Arcadia and does honor ours and and the reciprocity is there
[1:52:09] for for us as well for them um Pasadena would be the same so those are pretty
[1:52:14] much the two occasionally we will have somebody from San Marino or Hamra uh but
[1:52:21] would if we have subscription members then we will work with that agency to to
[1:52:26] see if we can have them right basically have a right off for it so but uh I most
[1:52:32] of ours are going to be Arcadia and we do we do have that partnership with them
[1:52:37] thank you think that's all I have wonderful staff report by the way I
[1:52:40] don't know if you put it together um very easy to read very comprehensive
[1:52:43] thank you thank you C member c um I I just wanted to get some commentary from
[1:52:49] staff on U the overall budgetary impact of this seems like we're at raising fees
[1:52:56] by about 149,000 in a calendar year budgetary
[1:53:00] year um and I'm I'm not seeing that we're
[1:53:06] getting anything for that other than we're just reimbursing ourselves for
[1:53:10] things that we're already spending money on right so that's going to that's a net
[1:53:14] plus of $149,000 how are we going to actually
[1:53:18] use that those funds is that going to be addressing other issues we have in
[1:53:23] the fire department I hope that will have to go as part of our
[1:53:28] budget um cycle and uh and taken up with our finance director and city manager
[1:53:35] um it it it's basically it is definitely there should we have the need uh to
[1:53:41] increase the budget or basically our budget is subsidizing all these costs as
[1:53:46] it is so at best my uh expectation would be that it would just recoup that cost
[1:53:53] um now should we have a need for additional funding within the department
[1:53:58] uh it is another resource that can be looked at to help offset those costs but
[1:54:02] again that's going to be part of our our budget cycle on budget talks uh every
[1:54:06] fiscal year but it does go on the general fund right if I may add the
[1:54:10] funds do go into the general fund uh during our our budget process we
[1:54:14] determine what the needs and priorities are of the organization um and during
[1:54:20] those times we'll be looking at each department incl ining the fire
[1:54:22] department uh to see if additional resources are needed um currently we're
[1:54:27] running a projected deficit so this is going to help Shore up that deficit but
[1:54:31] will also be U used in consideration for uh for the needs of the general fund
[1:54:37] okay thank
[1:54:40] you I had one last question and I've asked staff this way back when I just
[1:54:44] well way back it's only two years ago when I started um on Council is when the
[1:54:49] original subscription plan was written I believe it was 20 8 maybe prior council
[1:54:54] members will might remember this and I believe maybe also other prior
[1:54:59] firefighters who are here might remember this um it was written in that if you
[1:55:04] are a retired Cadre firefighter you were waved the fee for the subscription fee
[1:55:12] and the premise was because you volunteered your time full-time up to up
[1:55:16] to 15 years or more that this subscription fee would be waved now
[1:55:21] we've never found the report we've had lots of obviously we weren't
[1:55:25] digital back then um and I was really hoping that maybe we could include that
[1:55:29] in this um and I I don't know if that's are we allowed to do we're allowed to
[1:55:34] we're not allowed to add fees without but we can wave fees
[1:55:41] correct um so so that that's correct generally if if you're going to impose a
[1:55:46] fee there has to be some kind of study or some some kind of information to to
[1:55:50] support that fee so we can justify that work adjust a recovering costs and we're
[1:55:54] not returning a profit um you can exclude groups from a
[1:56:00] fe but there has to be uh a rational basis for it uh that's based on
[1:56:08] uh some some kind of some public rationale so it can't be because we like
[1:56:14] these individuals no yes right it it has to be because they provided some service
[1:56:18] to just for example provided some service to the city is the city's
[1:56:21] benefit because they will contribute volunteer hours in the
[1:56:25] future so it's it's possible I just thought that you know
[1:56:30] and it was written into the pre the original documentation if you find it
[1:56:34] says that it is waved for S Madre fire department retirees and that's 15 years
[1:56:38] or more not people who resigned earlier than that so I would like that to be
[1:56:43] added because the people that served before n 2019 and it served for 15 years
[1:56:48] or more served for up to 40 hours a week for free for the the
[1:56:54] city does that do we need to make any changes to the we're still in questions
[1:57:01] here right yeah but I'm kind of wondering if that we can do that so my
[1:57:05] question is can we do
[1:57:08] that yeah it I I think it's it's probably possible
[1:57:15] but my my because I feel like I need to study this uh it'd be my recommendation
[1:57:20] to move forward with as written and then and then and then amended at some future
[1:57:25] date right uh to the extent you you said you've you've searched for this document
[1:57:30] and search well I've asked staff to search and I search and I couldn't find
[1:57:33] it but that was before we really digitized um all of our agendas and I'd
[1:57:39] have to go through all the reports and I was trying to go through all of 2008 and
[1:57:43] all of 2007's trying to figure out when we started the subscription plan versus
[1:57:47] when we started Paramedic Services right because if we're using that document as
[1:57:51] a justification and we can't find it it it it's troubling me okay especially if
[1:57:58] we haven't done a thorough search yet and I don't know that we have okay great
[1:58:04] all right any other questions great then uh thank you very
[1:58:09] much I'd now like to open this up for um public
[1:58:15] comment do we have any public comment cards on this item U Mr Mayor we have no
[1:58:20] submissions for testimony on the public public hearing great then I'll go ahead

[1:58:29] discussion thoughts comments yeah I'd like that we now have
[1:58:34] a family plan um that's going to help quite a few people want to get involved
[1:58:40] in this and um and use this service so I that's something that's encouraging I
[1:58:46] trying to wrap my head around I probably should ask the question um why I'm sure
[1:58:50] there was a study of business aren't as frequent but why can why do businesses
[1:58:54] get $100 and up to 10 people and families are more expensive and for
[1:58:58] three people but um I proa it's probably because businesses don't their employees
[1:59:05] aren't as frequently having medical medical issues um as a family would
[1:59:11] right so think I'm answer my question but I like I like that we have a more of
[1:59:15] a menu now um which opens it opens it up for more people taking advantage of the
[1:59:20] subscription program i al always love that we're um we're recruit recouping
[1:59:25] some of our our hard costs um we're not charging extra for the service we're
[1:59:31] just trying to recruit pass through costs that we're being charged ourselves
[1:59:34] so I think I like the way it's formatted great other discussion
[1:59:41] comments i' be I'd feel better about this if I knew that we could do better
[1:59:47] than 5% you know participation in the subscription plan I think when people
[1:59:53] when work gets out we might see an uptick by a few percentage points but
[1:59:57] this is a very substantial cost increase for people who find that their insurance
[2:00:02] is not covering them you it's almost 300 bucks and for some people that's that's
[2:00:07] a that's a GameChanger so you know I I get the fact that we need budget help
[2:00:13] there's no question about it so I'm going to support it for that
[2:00:16] reason but um gosh I do agree with you council member Garcia that the family
[2:00:23] plan is very enticing so I'm hoping that maybe if we Market this we can
[2:00:29] get 15% 20% something like that people who might reasonably you know have a
[2:00:36] probability of needing something like this so that maybe they get caught and
[2:00:40] protected it's you know going over these costs the total cost for transports gosh
[2:00:46] four grand right yeah in our household my decision is do I just cover me and
[2:00:52] the kids don't need it my wife doesn't need it she's younger than me you know
[2:00:55] so you make those but when there's a family plan to your point I think we
[2:00:59] we'll get a higher subscription hopefully get a higher subscription uh
[2:01:03] rate sorry coun uh no it's okay or mayor Pro um I was gonna
[2:01:07] inquire when you go to pay for this do you have to come to City Hall and pay
[2:01:12] for it or is there an online ability to sign up and pay because that would seem
[2:01:16] to me to really increase subscription when you don't have to come to City Hall
[2:01:21] write a check which I don't have just L boom and credit card yeah just online
[2:01:25] and auto payment for every year is also very Auto renewal which I don't think
[2:01:29] there is please um we are working on on future um
[2:01:35] I think with the new asella program we will be able to work with the planning
[2:01:39] department to help Implement uh some of our fees within that the paramedical
[2:01:44] subscription program being one of them uh currently it is a check that will
[2:01:49] come in and we process that at the counter
[2:01:52] and it is uh I I I do believe for more signups if
[2:01:58] we get this automated it would be a lot better um and council member Garcia's I
[2:02:03] definitely a recurring charge that maybe you can opt out of if you if you choose
[2:02:08] to uh would just make it easier for for folks to never have to worry about it uh
[2:02:12] you're you're covered until you you opt out but we are looking at that um and
[2:02:18] and we finally have the the platforms and the tools I think to be able to
[2:02:21] implement that I think maybe the problem with um if we have fee increases in the
[2:02:25] future we would need to notify everybody that's part of a re reoccurring charge
[2:02:30] that there's a fee increase that might be a little bit problematic um but I I
[2:02:35] really it's I don't for my water bill I love that I don't have
[2:02:40] to pay it every I it just gets paid right the business license I don't have
[2:02:45] that so I but it's now online right yeah so but still um I I would prefer it was
[2:02:50] just autopay so I could just pay that one one of if I may as well one of the
[2:02:53] other uh options that we're looking at as well is um hopefully we will be
[2:02:58] upgrading the city's website and we'll be able to get it on there as well where
[2:03:01] you can just go through the city's website and sign up uh enter enter some
[2:03:05] uh form of payment uh and through that as well so again we're looking at all
[2:03:10] options to make this easier uh for our residents and while we've got you here
[2:03:16] just to to clarify we've gone through three different fees that are on here so
[2:03:20] we've got the EPC CR fee we've got the first responder fee we've got one uh one
[2:03:26] other fee in here so if you sign up for the subscription plan all of those fees
[2:03:30] are covered plus the the transportation is that correct or are the other fees uh
[2:03:35] would they still be there there's going to be some variables
[2:03:40] to that uh for instance if we transport you you and you're part and you are part
[2:03:45] of the paramedic subscription program whatever the insurance we will still do
[2:03:49] our third- party billing and insurance will pay what they pay uh but all other
[2:03:53] private uh payment will be waved um now again it it depends on your
[2:04:00] your your provider your insurance provider and what they're going to cover
[2:04:02] we all have different policies and plans so it that's why I say there there's
[2:04:06] some variables to that however we will not be going after anybody for
[2:04:11] additional private payment if you're signed up for this nor do we anyways uh
[2:04:16] but the insurance covers pretty much all of it so so the the these epcr fees and
[2:04:22] all those they would be waved if they ended up being a a fee afterwards after
[2:04:26] transport if they were part of the subscription plan correct so so for
[2:04:30] example if it's a $4,000 uh transport fee including
[2:04:34] Services um and your insurance company covered 2,000 of it you're part of the
[2:04:39] paramedic subscription program um you're not going to be charged the $2,000 out
[2:04:43] of pocket hopefully for your $89 for even a single person you're you're
[2:04:48] covered yeah okay
[2:04:52] okay any any further discussion all right well then I will

[2:05:23] remember correctly is ordinance 1487 is that right the the city manager
[2:05:28] or were we going to do the um the new item that I've since it's not written in

[2:05:39] of the new item and the new item being um a dis a dis continuing a discussion
[2:05:46] of the Proclamation of the local emergency in light of uh the Imp pending
[2:05:52] rain all right and you were we we we did that one first right right all right and
[2:05:57] so uh city manager Ros so will you be giving the local emergency so so mayor
[2:06:05] on um on January 9th we had a special meeting uh to declare a fire
[2:06:12] emergency uh and we are now concentrating our efforts on a debris
[2:06:18] and mud flow emergency uh so we'd like to amend uh the the decision that was
[2:06:25] made on January 9th to include mud flow and debris um much of what we uh were
[2:06:30] going to discuss in the presentation was covered by staff um in in public comment
[2:06:35] uh however Senior Management analyst Carlson uh is available to give an
[2:06:40] update again if needed um if not we can we can move to to questions or and and
[2:06:46] just one short update um the city council proclaim the local emergency
[2:06:53] regarding the fire under government code section 8630 that same code section
[2:06:57] requires the council to revisit their Proclamation every 60 days at a
[2:07:02] minimum uh and at some point they have to end that local emergency the city
[2:07:07] managers requesting that we continue the proclamation of local emergency and the
[2:07:11] benefit of doing so is it provides the city manager with the authority as
[2:07:15] Emergency Services director which we're going to talk about again on the agenda
[2:07:19] later on um to adopt executive orders as necessary so if we continue this uh
[2:07:28] local emergency and you make findings that the impending rain might lead to
[2:07:34] debris flows that can lead to an emergency in the
[2:07:37] city uh then the city manager will have the authority to adopt any kinds of
[2:07:42] executive orders that are essentially just regulations that can be imposed uh
[2:07:47] at his Direction without having to come to council to get approval first
[2:07:52] examples would be uh parking restrictions or evacuation orders or
[2:07:57] those these things may run counter to the ordinances on the books but he can
[2:08:01] do so as Emergency Services director during the emergency period got it is
[2:08:07] there anything else with the presentation for that item I I don't
[2:08:11] believe so I believe we covered everything during okay during our our
[2:08:15] public comment then what I'd like to do is just move into to council questions
[2:08:20] so I imagine there's some question questions anybody have any questions are
[2:08:24] we initiating our emergency um EOC our EOC is going to open tomorrow at
[2:08:30] 6:00 am at level two level two and I guess never mind I'll ask the question
[2:08:36] when we get down to that other item about emergency director or director of
[2:08:40] emergencies uh I had a question so if we're if we are um um including mud and
[2:08:48] debris flow it doesn't reset the 60-day clock right so 60 day clock is still
[2:08:52] tied to to January to January 9th or January 7th it would it would it would
[2:08:57] extend it um I think what I'll do because we agendize this on an emergency
[2:09:01] basis that if this if the city council decides to extend this local emergency
[2:09:07] and include uh in light of the impending rainstorm then I'm going to come before
[2:09:13] the city council at the next meeting and place this on consent with the added
[2:09:17] language so you'll see a revised local emergency declaration and you'll just
[2:09:22] adopt that one on consent with the language that you approve today so this
[2:09:26] would take us then through um April 11th so that that takes us a good portion
[2:09:34] through the end of the rainy season because rainy season city manager Ros so
[2:09:39] is it April 30th is that typically the typically yes yeah and the city council
[2:09:45] can always end the local emergency at any time right right but we'd have to do
[2:09:49] it by by by the end of uh of April correct okay 60
[2:09:55] days so as I as I recall during that emergency meeting we did we did discuss
[2:10:01] um the the whole event as being Wind Fire and we were preemptively thinking
[2:10:10] about de debris flow and I I know I asked the question do this Proclamation
[2:10:15] I think it was probably for FEMA purposes of the time but does this
[2:10:17] Proclamation Encompass the debris flow as well so do we even need to change
[2:10:22] language or I I still think we're okay with it as written this is kind of about
[2:10:26] suspender approach because the the resolution itself doesn't reference the
[2:10:31] brief flow someone would have to go back uh transcribe the meeting and reference
[2:10:37] the specific portion where there's a discussion of debris flow I think it's
[2:10:40] probably a safer approach to include actual language regarding debris flow in
[2:10:44] the resolution itself that's going to be adopted by Council okay thank you does
[2:10:48] this change the incident overall to include not just the fire but as well as
[2:10:54] the if we say we have some mud debris flow or some type of action that we do
[2:11:00] have or any emergencies we do have related to the rain does that attach it
[2:11:04] as one incident then because we're under the same emergency local emergency order
[2:11:10] uh so the answer is yes for purposes of our local emergency but that's not
[2:11:15] necessarily the case for purposes of FEMA reimbursement for example these are
[2:11:18] two separate Concepts okay thank you thank you
[2:11:22] other questions all right then I'd like to
[2:11:26] open this up for public comment do we have any comment cards on this
[2:11:30] item uh not on this instrument I wouldn't imagine since it was an

[2:12:15] including uh potential debris flows okay and I think that referen
[2:12:21] should be sufficient and I will come back to the city C if if you approve it

[2:12:28] will have a revised resolution that the city council can can vote on at that
[2:12:33] time I move that we continue the proclamation of local
[2:12:37] emergency uh caused by the eaten fire and any subsequent potential debris flow

[2:12:51] on to ordinance 1478 uh city manager director of
[2:12:55] emergency services and um then we have mayor if i' if I may I'd like to
[2:13:01] introduce uh Deputy City attorney Julia homeria to present great welcome thank
[2:13:10] you uh so this ordinance would be designating the city manager as the
[2:13:15] Director of Emergency Services which previously the city of Sierra Madre had
[2:13:21] an emergency services and disaster commission which was formerly codified
[2:13:26] in Municipal Code chapter 2.32 under which the city manager was
[2:13:31] designated as the Director of Emergency Services however in 2020 an ordinance
[2:13:37] was adopted to reduce the number of Commissioners for active commissions and
[2:13:43] to remove remove code references to inactive commissions that ordinance
[2:13:48] dissolved the emergency services in disaster commission and inadvertently
[2:13:53] repealed the designation of the city manager as the Director of Emergency
[2:14:00] Services the government code requires that for a local emergency to be
[2:14:04] proclaimed either the city council must meet at an emergency special or regular
[2:14:10] meeting to proclaim the emergency or Council May authorize a staff member to
[2:14:15] proclaim a local emergency and then must ratify that within 7 days
[2:14:21] the eaten fire demonstrated why city council uh should designate the city
[2:14:25] manager as director of emergency services and reinstate his authority to
[2:14:30] proclaim a local emergency this would allow for a more timely response to such
[2:14:35] an emergency as it does not require city council to meet for a proclamation and
[2:14:41] thus mobilizes resource for Aid and relief in the city's time of
[2:14:46] need this ordinance does not undermine the authority of council since the
[2:14:51] council will still need to ratify the proclamation um within 7
[2:14:56] days and um this is common practice within many cities including our
[2:15:01] neighboring cities of Pasadena Arcadia and San Marino whose Municipal codes all
[2:15:07] designate the city manager as director of Emergency
[2:15:11] Services lastly this ordinance also makes um an administrative amendment to
[2:15:16] clarify that the city manager has the authority to appoint and remove move the
[2:15:21] city clerk now that the city clerk is no longer an elective
[2:15:27] office great is that the end of your report yeah any questions great
[2:15:31] questions I have one please uh so in section three um so uh
[2:15:38] 2.8.1 140 um subsection B designation of alternate uh it states the the director
[2:15:44] of Emergency Services shall designate the order of succession to that office
[2:15:49] to take effect in the event the direct is unavailable to attend meetings and
[2:15:52] otherwise perform his or her duties during an emergency such orders of
[2:15:56] succession shall be approved by the city council so I'm just trying to
[2:16:01] contemplate how do we have that alternate designated already without
[2:16:07] coming to the council to then approve that so in case the city manager does
[2:16:11] become incapacitated during an emergency do I I would I would prefer to
[2:16:16] have that um order of of secession already in place rather than than having

[2:16:46] you'd like and designate in this ordinance who that who the successor to
[2:16:50] the city manager would be you can or you can strike this language and have the
[2:16:55] city manager determine for himself who his successor is going to be or you can
[2:16:59] leave it as is and adopt a resolution at sometime in the future so you don't have
[2:17:03] to mess with the ordinance and you adopt a resolution identifying the chain of
[2:17:10] succession and I'll wait till discussion to talk about that a little bit yeah

[2:17:22] you said and and it says in the report that um it also makes the administrative
[2:17:26] amendment to clarify that the city manager has the authority to appoint and

[2:17:44] change it takes out the city clerk at in item C of uh 28.70

[2:18:32] um my concern is you know if we put like the language has to be careful because
[2:18:38] you know sometimes we might have a deputy city city manager sometimes we
[2:18:42] might not sometimes we might have an assistant city manager sometimes we
[2:18:46] might not so maybe it's to attorney geagan's recommendation that the that
[2:18:51] the city the city manager appoints that individual might be The Prudent way but
[2:18:56] um I think we just need to be careful about organizationally who we who we
[2:19:01] designate as the successor if we're going to be the one designating the
[2:19:04] successor as per item be here I I would tend to agree with you
[2:19:09] that when as you were talking about that as you as you teed it up that was where
[2:19:13] my mind was going was rather than having that that a detailed succession plan or
[2:19:17] even a you know even one position things change um I I would we we have
[2:19:25] um our city managers demonstrated that that um he is very capable of making the
[2:19:32] decisions empowering people within it um we've seen that with at least the the
[2:19:36] last city manager as well I think it's incumbent upon us to make sure that the
[2:19:40] city manager that that that we have or the council has in the future has that
[2:19:44] same set of of skills and abilities so I I I think empowering the team is is uh
[2:19:50] the way I would lean on this I agree since our job is to
[2:19:55] basically assure that we have a city manager that is um effective at what our
[2:20:03] people want and what our needs and obviously our city managers displayed
[2:20:06] this and he knows his team best whereas we don't since we're not in charge of
[2:20:11] his staff yeah so I agree that leaving it to him is is under his purview sure
[2:20:18] with you it shouldn't be actually should not be NE necessarily our position
[2:20:22] because we're not we're not in charge of Staff we're not interacting agreed so do
[2:20:27] we need to make a change to the resolution at all yes this mayor mayor
[2:20:31] so this language and uh the deputy City attorney can correct me I believe this
[2:20:35] language was in the original version that was struck correct so so this is a
[2:20:41] this is a carryover from the prior language so we reincluded it and if the
[2:20:45] city council wants to authorize the city manager to choose his own successor then
[2:20:50] then I think you just strike the last sentence of us of paragraph B of section
[2:20:59] 2.08 one40 and i' I'd like to have a a
[2:21:04] greater understanding of the alternate you know let's let's
[2:21:07] say city manager is with the fire chief at instant command and something happens
[2:21:14] in the city that needs to be decided upon
[2:21:17] immediately um does that does that individual have the power at that point
[2:21:22] in time or is it does the city manager have to be incapacitated or out of town
[2:21:26] or something else for that to occur so I I I can give you a couple of
[2:21:33] examples one of the one of the benefits that we have in s Moder and I can't
[2:21:37] speak for any other city but we do run tabletop exercises um and we have
[2:21:43] scenarios um and we do have backups and so in my case um assistant city manager
[2:21:49] Hernandez would step in um and then we look at the type of
[2:21:52] emergency um if it's a fire related emergency and and the fire chief is
[2:21:57] available he may be the most appropriate person to step in if it's a police
[2:22:01] emergency um then uh police chief bentos may be the most appropriate person to
[2:22:06] step in uh but I think it's through that process of understanding the emergencies
[2:22:10] and having uh those tabletop exercises to to have the back fill for uh when and
[2:22:15] if I need to step out um there are occasions where I need to step out to uh
[2:22:20] deal with uh our legislative body and and I have to leave somebody in command
[2:22:24] um typically assistant city manager um Hernandez will step in if it's a 24-hour
[2:22:29] emergency where we trade off and he serves at one time and I serve at a
[2:22:32] different time those are some of the situations um and examples yeah because
[2:22:35] to me like item five represent the city and all dealings with public or private
[2:22:39] agencies or matters pertaining to emergencies like if you are not
[2:22:42] available and it's it's imminent that something needs to be decided upon right
[2:22:47] then I I feel comfortable for our citizens that somebody's there that can
[2:22:51] make that decision that doesn't have to be something that we're
[2:22:54] designating okay
[2:22:57] good so um if we were then to strike that last sentence uh of
[2:23:06] uh what is it item uh B thank you yes of Item B uh uh
[2:23:14] section three section three uh 140 so so we can do that now and adopt
[2:23:22] the ordinance is that correct uh correct you can would we need to
[2:23:29] add at the city manager discretion or some kind of the director of Emergency
[2:23:34] Services shall designate the order of succession to that office to take effect
[2:23:37] in the event the director is unavailable to attend meetings and otherwise perform
[2:23:41] his or her duties during an emergency okay and then we strike such
[2:23:45] orders of sucession shall be approved by the city

[2:24:15] takes us to our um next discussion item sign placement in public Parkways uh
[2:24:23] Parkways and I believe that we have assistant planner hang to come and
[2:24:27] present that is that correct that is correct
[2:24:38] mayor thank you mayor Parkers um good evening mayor and members of the city
[2:24:43] council tonight we have for discussion sign placement and public Parkways
[2:24:49] currently in our municipal code in title 10 a Parkway is defined to mean that
[2:24:54] portion of a street other than a traveled roadway this is also commonly
[2:24:59] known as the portion between a sidewalk and the public rideway often with a form
[2:25:04] of landscaping the code currently does not
[2:25:08] contain a specific rule regarding sign placements in
[2:25:12] Parkways however it does prohibit all signs on public property or rideway
[2:25:18] except for garage and yard sale signs since a public or since a Parkway is
[2:25:24] public property staff interprets the prohibition to apply to signs placed in
[2:25:29] Parkways as well previously in the last December
[2:25:35] December meeting mayor proem loo direct the staff to include the discussion of
[2:25:39] signs in a Parkway it is recognized that the
[2:25:43] restrictions of signs um sign placement in Parkways May create challenges during
[2:25:49] election seasons when individuals seek to display signs
[2:25:53] to support candidates or ballot measures or even signs to support local sport
[2:25:59] leagues or clubs however the relevant provisions of the city's sign ordinance
[2:26:05] have not been amended since 2003 and staff recommends the city council to
[2:26:10] discuss and provide Direction with the consideration that an amendment would
[2:26:14] either one prohibit the placement of signs on public property without a
[2:26:19] Content based exception or two permit signs in Parkways subject to content
[2:26:25] neutral regulations such as size color location um duration and
[2:26:33] Etc and factors to consider when drafting an amendment would include
[2:26:38] enhanced Community engagement um some enforcement
[2:26:44] challenges that may include sign placements in pedestrian
[2:26:48] Pathways um utility or hydrant access traffic visibility and unauthorized
[2:26:54] signage and lastly a balanced approach to Public Safety this may include the
[2:26:59] proposed amendments that include clear guidelines for the
[2:27:03] number um for the number location and duration of signs um to ensure Public
[2:27:10] Safety and minimize potential hazards and to also note that the allowance of
[2:27:16] signs in a public public ride of way may introduce an added risk and liability
[2:27:22] for the city's risk management thank you thank you for that
[2:27:28] presentation questions um I appreciate the
[2:27:33] introduction from public around um ordinance
[2:27:38] 1220 uh 12207 duty of abuting land owners to
[2:27:44] cultivate trees and public property which I I would would like in the report
[2:27:48] because that was the validation for for why I brought this forward and I know
[2:27:53] you guys have a print out by the way of this ordinance um because the validation
[2:27:59] was that if it is it's public land but Property Owners I'm sorry residents are
[2:28:07] given the duty to maintain the grass the trees weeds Vines
[2:28:13] debris and the water for IT Supplies the gardening for it and all such we we're
[2:28:19] we're designating to maintain that my question is one you know why I guess why
[2:28:25] was that ever designated is that normal for all cities is it just us my second
[2:28:30] question would be what about homes that don't have a sidewalk how do we know
[2:28:33] what is property of public land versus like how do we know their their their
[2:28:37] offset like where is the public land versus the personal residence property
[2:28:43] line before you answer I just I have a process question so are our agenda item
[2:28:51] is on sign placement in public Parkways and I understand the overlap of this is
[2:28:56] there anything like is this because this is a discussion item
[2:29:01] and we're coming it back are we okay with noticing on all of this is that do
[2:29:05] we need to do we need to agendize this separately or or can is this something
[2:29:09] we can is this a a rabbit Trail we can go down yeah I I I think for discussion
[2:29:14] purposes it's it's fine because there's no ordinance before the city council for
[2:29:18] consideration if the city council IL directs us to we can consider an
[2:29:23] ordinance Amendment for the for that cited ordinance section as well got it
[2:29:27] okay I apologize that Rabbit Trail is is not the right way to is this a another
[2:29:32] another facet of this so please go ahead and uh answer so I guess question number
[2:29:38] one would be is it normal to require residents to maintain the are we calling
[2:29:45] it I think I I've heard two definitions are we calling it the um Parkway Parkway
[2:29:51] or the there was another term used earlier RightWay
[2:29:55] rideway is there a difference between a rideway and a I guess there's three
[2:29:58] questions there is there a difference between a side
[2:30:01] uh the two different terms thank you mayor protim for the question um so a
[2:30:07] Parkway is considered part of the public rideway if um that answers your question
[2:30:14] there then what's a ride of way
[2:30:18] um so right away would be considered public property um and if Public Works
[2:30:26] has a definition for
[2:30:30] that uh thank you mayor protim L thank you um I get this question a lot what's
[2:30:36] a Parkway um especially if there's not a sidewalk um the ride of way is
[2:30:42] everything everything between the private property lines it could include
[2:30:47] a sidewalk could include a v veg itated Parkway it includes a street and then
[2:30:53] going over you got your curb again maybe another sidewalk maybe not right of way
[2:30:59] is everything in between the private property lines very common to call from
[2:31:05] the private property line to the curb a Parkway okay that's definitely whether
[2:31:12] it has a sidewalk or not yeah and then the only way for somebody to know how
[2:31:17] far is what the size of their Parkway is is to call the public works department
[2:31:22] we have a map and we have it all um we have to look it up for them it's it's a
[2:31:27] wide variety so I guess the problem I guess
[2:31:30] I'm asking is do we do we
[2:31:36] have why do we have the requirement of residents is that normal to have
[2:31:43] residents having to maintain the rideway or the
[2:31:50] Parkway this this section of the code was included with an update to the tree
[2:31:54] preservation and protection uh part of the municipal code in
[2:31:59] 2014 um I actually was around at that time so I think the the impetus and the
[2:32:05] purpose was to have adjacent Property Owners take care of their trees a little
[2:32:10] bit more than maybe some of the other details that are outlined in this
[2:32:13] section that's my best correct recollection as to you know why this was
[2:32:19] inserted it was part of a tree ordinance can I can I follow up on yeah I would I
[2:32:24] remember that discussion M and part of the discussion was that private property
[2:32:29] owners planted the trees in the Parkway and the they they can and and so
[2:32:34] there was a debate about well who's can you even trim a tree if I planted it in
[2:32:38] the parkway yeah then you know then there was that's I remember what that's
[2:32:43] what we're talking about that that still exists to B we really didn't resolve it
[2:32:47] yeah and you know we think we you know we have an inventory with our with our
[2:32:52] contractor on trees that the city plants and then trees that are there that
[2:32:58] nobody knows who planted right so I I agree I think that was a component of
[2:33:02] the discussion in 2014 so I I see there's two lines of
[2:33:08] questioning here and I I what I'd like to propose for us is is since we've
[2:33:12] started down the line of of trees let's start with trees ask questions about
[2:33:17] that and then then I'd like to pause and then and then do signs because I think
[2:33:20] there's some different questions on on each if not just trees but maintenance
[2:33:24] of the whole you got maintenance maintenance of of the Parkway and then
[2:33:30] signs on it right yeah I I think because that's the whole validation of why I
[2:33:33] introduced this but I but I I do think I do think yeah I do think maintaining
[2:33:37] trees is not within uh the the description we have in the agenda it is
[2:33:44] it is Parkways I think I think discussion of Parkways is okay but as
[2:33:47] soon as we get into tree maintenance and can just say Parkway maintenance then
[2:33:51] because that's what I was asking right because my questions are going to
[2:33:56] go straight down to trees yeah yeah I think we should stay away from tree
[2:33:59] maintenance because it's just not part of the agenda descrip so when I when I
[2:34:04] agendized this it was specifically because I said if you are requiring a
[2:34:08] property owner or the resident to maintain the S the side the other side
[2:34:12] of the sidewalk or whatever the property line is for the right away then I should
[2:34:16] be able to put what sign I want to on there I mean Within
[2:34:20] within whatever code we designed so that's why I brought up the discussion
[2:34:23] item but that code isn't in the report so that's why I said I asked for it
[2:34:27] before this and I'm hoping and I'm glad we have it but the public doesn't have
[2:34:31] it you can still argue for it it doesn't have to be in the report you can argue
[2:34:34] for it so that was agree with you yeah so so let's try to stay with with it
[2:34:38] with with questions there's a there's a clear need for for for discussion here
[2:34:43] and so so are there other questions on on the the the uh on the maintenance of
[2:34:51] public Parkways I think it's should I ask that again do most cities do this
[2:34:55] are we the only
[2:34:58] one I do believe most cities do have the property owner maintain their um Parkway
[2:35:06] area in front of their home that they are adjacent
[2:35:13] okay questions yeah so regarding sign placement um there there was a and I
[2:35:19] know this is a kind of a oneoff but there was a business
[2:35:25] owner who also was leas had the enhanced sidewalk program are therefore leasing
[2:35:30] some of the property of the city and they wanted to place a sign in the bow
[2:35:36] out that's adjacent to the area they're leasing um would that then be something
[2:35:42] under their control or is that still a public right of way because it was a
[2:35:47] public property that's being subleased by a
[2:35:51] business and I know it's very oneoff but the business owner asked
[2:35:59] me about that no it's actually a really good question um and we haven't been
[2:36:03] confronted with that as far as I know but when we do uh do one of those bow
[2:36:07] out leases for one of the I think four businesses we asked for a site plan at
[2:36:13] that point that's when we could look and see maybe if there's a sign proposed um
[2:36:18] part of what we're looking for in the site plan is Ada this was a temporary
[2:36:23] sign not a permanent sign so this would be a political sign let's um again we
[2:36:28] haven't been asked that we would look for Ada first of all and then actually
[2:36:33] the uh planning and Community preservation department does have some
[2:36:36] parameters on what the sign's content can
[2:36:40] be um but um if it wasn't a leased space
[2:36:46] it's as simple as an encroachment permit as long as Ada and everything else is
[2:36:51] fine if it's a lease space that's a new question for me that so that would
[2:36:55] include like the signs that stores put up like I'm inside we have a special
[2:37:00] today yeah okay I have a question yes please so um okay so getting back to
[2:37:06] this issue that's in the agenda um do are we aware of any documented instance
[2:37:13] where somebody uh got into some kind of an a
[2:37:16] car accident or perhaps tripped on a sidewalk walk be uh which was
[2:37:21] precipitated by the existence of a political sign in a
[2:37:25] Parkway has it been a documented public safety hazard now to my knowledge okay
[2:37:31] thank you other questions would this also and
[2:37:35] I as in my questions would this also have to include the signage in the park
[2:37:39] that we put up to to help build community with the
[2:37:43] walking like the library signs then would those not be actually allowed I
[2:37:48] know Caitlyn is discussing this with me and I don't know where it ended up so
[2:37:52] I'll let Caitlyn take that and and also we we designed it for the new park but
[2:37:57] The Meadows thank you for the question so
[2:38:01] the code currently prohibits signs that are in the public RightWay or public
[2:38:07] property yeah so that is so so so technically the
[2:38:13] library signs in the in Memorial Park are not allowed according to our
[2:38:19] ordinance only only if those signs were placed by private individuals government
[2:38:25] so if the government places signs on its own property that's totally fine that's
[2:38:28] government speech on its own property okay as long as okay yeah doesn't
[2:38:33] violate any other like political signs they wouldn't be able to do because that
[2:38:37] violates their other corre wait wait wait wait wait wait you're so back up so
[2:38:42] that's government speech on government property
[2:38:47] okay I thought we had had freedom of speech for everybody on government
[2:38:51] property doesn't anyone have a right to make a public statement on public
[2:38:55] property not statement you can yeah that's what's that's what a sign is it's
[2:38:58] an expression of free speech free political speech the city can prohibit
[2:39:03] signage on let's say a park for reasons that are you just have to have a
[2:39:08] rational basis for it so for example if a park is supposed to be used for
[2:39:13] recreation you don't want to have signs in that green space because people can't
[2:39:17] recreate so so long as you can TI it to some rational basis then you can justify
[2:39:21] that prohibition well I I I get that so
[2:39:24] you're saying that we're treating a sign put right in the middle of Memorial Park
[2:39:29] the same as a sign in a Parkway where the sign in the parkway presumably
[2:39:34] hasn't got a real it's not really impeding with the sign in the Memorial
[2:39:38] Park is obviously a problem right so we're treating these as if they're the
[2:39:43] same right yeah and and I'll add the the sign in the park way is more problematic
[2:39:51] for a reason that was addressed in the staff report which is it's creating a
[2:39:56] Content based difference between what can be placed and what can't be placed
[2:40:01] so we have currently the ordinance that says you can place yard signs but you
[2:40:05] can't place political signs uh this ordinance was adopted in
[2:40:11] 2003 the law has evolved since then um when this has come up we've told staff
[2:40:17] uh not to enforce this strictly because uh it's it's probably legally suspect uh
[2:40:22] given the evolution in the law you can't have content-based restrictions on
[2:40:29] speech you could have it but you could have uh restrictions based on other
[2:40:36] things like size or on non-content based non-content based that apply across the
[2:40:42] board got it and and so we also don't that would we haven't included things
[2:40:49] like little league and thank you to our firefighters like that's not in our
[2:40:53] language to be able to include those in public space either correct right and I
[2:40:59] just want to be clear you're talking about private individuals placing these
[2:41:03] things yes so like the little advertisements to sign up for AYSO at
[2:41:07] the park are actually not supposed to be there yeah and and just to draw another
[2:41:11] distinction again to to council member gos this point when the city places it
[2:41:15] signs on its own property it's acting as a private property owner the city is a
[2:41:20] private property owner and it can exercise the same rights that private
[2:41:23] property owners have to place to do whatever it wants with his private
[2:41:25] property including the placing assigns and prohibiting others from placing
[2:41:28] signs on that public property unless that property is a designated public
[2:41:35] forum then there's a different issue and the First Amendment law is a little
[2:41:39] complex on this point I can get into that if you
[2:41:42] like so when there isn't an actual sidewalk in
[2:41:50] Parkway what is then the parkway like a house that doesn't have a um sidewalk
[2:41:58] what's the where is the parkway
[2:42:03] then it is a it's a predetermined um foot or or half a foot
[2:42:10] from the face of the curb in towards the private property and there's an
[2:42:15] invisible line how how how long did you say half a foot no it's different
[2:42:19] everywhere it could it's it's broken down to um uh a a full foot or a half a
[2:42:26] foot it's not broken down by an inch oh okay yeah so it could be 5 and A2 feet
[2:42:30] in from the face of the curb it could be8 feet in from the face of the curb
[2:42:34] and it's really is an invisible line so it it it's based it's based on the title
[2:42:38] of the property then yes okay and so when when when the parcels were created
[2:42:43] in that area it's based on on how that that
[2:42:47] that part of land was parceled out yes track maps and then um you can you can
[2:42:54] get a survey to get it down to the quarter of an inch or whatever you need
[2:42:59] um but we do have the maps that tell you how many feet or feet point5 it is got
[2:43:04] it so conceivably we could have built a road almost all the way to the property
[2:43:09] line and then there's no quote unquote Parkway or public ride
[2:43:15] or extra public rideway beyond the curb there's really no Parkways in the canyon
[2:43:19] areas for example so he can never put a sidewalk there
[2:43:23] right interesting interesting thank you so so so wait hold
[2:43:29] on that that so that's a real that's a really good question so then then um for
[2:43:34] signs in the
[2:43:38] canyon how does how do how does our current ordinance deal with signs in the
[2:43:43] canyon so if you want to put a sign in the canyon and you don't have a a
[2:43:46] Parkway what ordinance how does the ordinance
[2:43:51] apply in that case because then then it's on the building right or it's on
[2:43:56] private property it's on private that's on private
[2:44:00] property okay thank you other

[2:44:10] report um one of the things we could talk about is number of signs um have we
[2:44:15] done a survey I think to Mayor Pro Low's point of how many sign you know looking
[2:44:22] at other cities how many signs they permit when they do permit um or do do
[2:44:26] cities even permit signs in Parkways um around us direct ly
[2:44:37] know so um thank you for the question um we did a survey of surrounding cities
[2:44:43] none of the cities um allow signs in public right away or Parkway um the only
[2:44:51] city that um allows science in the parkway would be
[2:44:56] laata in St Gable Valley and and what's their policy then so their policy is to
[2:45:03] they they're limited to two signs and there is a size restriction for
[2:45:09] political signs so so no other city in kind of our our cohort group or within
[2:45:16] our area has an ordinance around signs or do they have or do they have an an
[2:45:21] ordinance that bans signs um their
[2:45:26] ordinance prohibit signs in Parkway okay so there there actually is
[2:45:32] you you're not allowed to put them on so so in Arcadia you couldn't have any
[2:45:37] little league or firefighter or political sign in the parkway that's
[2:45:43] correct similar to sadra CO as well our current Co prohibit all the all signs in
[2:45:48] Parkway EX except for yard signs andar got it but they
[2:45:54] do we've driven through Aradia during so do we that's right right all
[2:46:01] right further questions all right then I would like to
[2:46:06] to move and open this up for public comment Madam clerk do we have any uh PE
[2:46:11] any cards for public comment we have one uh submitted Mr Mayor from Glenn lemon
[2:46:20] honorable mayor mayor proam council and staff um my suggestion unless we want to
[2:46:28] look like the Clutter that is in some of the surrounding communities a little
[2:46:32] south of here prohibit all signed on city property real simple we don't have
[2:46:37] to worry about whether it's a Parkway uh ride of way a park um so just
[2:46:44] prohibit it somebody wants to put a sign put it on your own property
[2:46:49] um but I think there's a larger issue here
[2:46:53] that that I want to address this I believe was was brought
[2:46:57] and thank you Chris for bring bringing this to council this was brought because
[2:47:03] during the November elections I noticed that there was signs City Park bow
[2:47:11] outs ksing court and in the Parkways um and I was curious why the
[2:47:20] codes weren't being enforced so I contacted the code enforcement officer
[2:47:24] he told me that he was directed by his bosses not to enforce it I also noticed
[2:47:30] that four of our five council members were in violation of the law willingly
[2:47:34] in violation of the law this was concerning for me so I took the issue up
[2:47:40] again with the senior manager and and I was told that for the
[2:47:46] the reasons Chris that you had said um if homeowners are going to be mandated
[2:47:53] to maintain it then it's only fair that we ignore codes that previous councils
[2:47:59] adopted through legislative action and allow them to put the signs there this

[2:48:14] to elected people um what you're doing now is the right way to do it if you
[2:48:19] don't like the law you change it but you don't ignore it and staff should never
[2:48:23] direct Personnel to ignore it also um imagine if you guys tonight or in future
[2:48:31] you decide to change the regulations and future councils undermine the authority
[2:48:35] that you have it's not right and so again my suggestion just just um
[2:48:43] prohibit all of it but even more importantly we cannot lose sight
[2:48:47] undermine the leg legislative process that we've adopted we can't do it we
[2:48:52] can't even start a trickle to erode it because that's basically what our system
[2:48:56] is all about so thank you thank you Mr lamon do we have any other public

[2:49:16] tonight's idea is is is guidance so but you know I think this needs to come

[2:49:28] I think was originally intended by by mayor
[2:49:31] protm uh to to include talking about trees and and all those types of things
[2:49:36] and what the what the duty of the homeowner or resident is and what the
[2:49:42] duty of the city is and part of that will be I think the sign issue
[2:49:48] but doesn't mean we can't not we should talk about discuss this but uh I think
[2:49:52] that's kind of a bigger bigger picture I I I would tend to agree I'd like to have
[2:49:57] the holistic thing I I I want I I'm I'm biting my tongue to go down the tree
[2:50:02] route because I've got thoughts there but it is not part of this item but I I
[2:50:07] think that when it comes back I'd like that to be part of of it as well and
[2:50:11] that could include we'll genderize it at the end how about that when you guys
[2:50:16] want to talk about that if we give if we give if we give
[2:50:19] now we guidance now I'll tell you why later I'll agendize it at the end and
[2:50:23] I'll tell you why because otherwise I'm bringing up a whole another agendize
[2:50:25] item right now so we're not going to De no no no no no I'm talking about the
[2:50:30] trees okay any discussion of trees and things
[2:50:35] like that my my premise again for this wasn't just political signs it was for
[2:50:40] little leak signs it's for those amazing my kid is an honor rooll student it's
[2:50:44] for thank you s fire department and first Rescuers and PD and everything
[2:50:48] like that those signs and I am paying to the city money in my
[2:50:56] water bill to maintain that area I'm paying my Gardener to trim the grass and
[2:51:02] I'm not a very like Landscaping person so I don't do this but many people do
[2:51:07] landscape that area and they maintain it and we're charged to do that according
[2:51:11] to our code but I can't put down what I want to as a sign at all unless it's
[2:51:17] yard sailor garage sale and I find that erroneous I don't like the idea that
[2:51:22] you're making me required to take care of this but I can't use it as I as I
[2:51:27] would want within reason I mean obviously I don't want to do some crazy
[2:51:31] crazy scary decoration of something but I think we should put in writing and
[2:51:36] make a code that leaves it to like lonyatta where
[2:51:41] it's not overdone to signs I agree with that type of of of signage as long as it
[2:51:47] doesn't Hinder public uh utilities safety and there was already signage
[2:51:54] language about glowing and things like that and there's parameters in and what
[2:51:59] it can look like can I comment on that please I completely agree with you supp
[2:52:04] support a change that makes I and I think uh Mr laman's point is certainly
[2:52:09] important that these have been obviously flagrant examples of us kind of looking
[2:52:14] the other way when the code says something well there's a reason for that
[2:52:18] it's called custom and I think the custom in this city is going up against
[2:52:23] the rule and I think we need to change the rule to reflect the Customs um I I I
[2:52:27] teach political science and I above everything else believe in free speech
[2:52:32] and I believe in we we can't get enough political speech and I feel like if you
[2:52:36] look at how Parkways are laid out and you put a sign perpendicular to the
[2:52:40] street on a Parkway there's a far higher probability someone will see it and
[2:52:46] that's the whole point of political speech for somebody to see it process it
[2:52:50] uh when you put a sign up on somebody yard sign facing the street it's much
[2:52:55] harder to see in some neighborhoods it's almost impossible to see because of
[2:52:58] trees and overhang so it seems to me we ought to side on the on the on the side
[2:53:03] of more political speech not less I do believe it's an issue having done this I
[2:53:08] do believe it's an issue that when you get close to intersections you could
[2:53:12] very well impede the vision so I would say maybe and I'd have to leave this to
[2:53:17] the expert I'd say at least 150 ft from any intersection I don't
[2:53:21] think I'd put a sign in a Parkway but uh cuz you you know because if you're
[2:53:27] turning left and there's a sign here you can't see maybe not see the lane of
[2:53:30] traffic but I did ask and there is no documented instance where a political
[2:53:35] sign impeded or caused an accident or caused any injury so it seems to me that
[2:53:41] we're we're we'd be safe if we did this one quick thing to add that too in
[2:53:48] equity why would I if I have a sidewalk not be
[2:53:52] able to do this but if I don't have a sidewalk I don't know where the property
[2:53:55] line is so I'm going to I can do this so it it's it's not Equitable for those who
[2:54:00] have sidewalks and not because people who don't have sidewalks you don't know
[2:54:03] where the property line is and I don't think the code enforcer
[2:54:06] most likely will go out and look at the whole parcel map that be a waste of time
[2:54:11] the code enforcer let's get this straight we have
[2:54:15] all kinds of rules on the books The Code Enforcer doesn't look at because he
[2:54:18] doesn't know they're there or doesn't have the time to do so this just add
[2:54:22] these to the list I mean think about all the additions that are being done and
[2:54:26] and and things that are being done in people's homes this week that are not
[2:54:30] being run through the code enforcement not run through our planning department
[2:54:34] so I mean it seems like we got to kind of pick and choose where our priorities
[2:54:38] here if we're looking for code enforcement those agendized items you
[2:54:40] know items yeah I know but I mean it goes to this issue is this such a high
[2:54:45] priority that you know we want our
[2:54:52] so so I I I like where you're go where you went with this council member gos is
[2:54:57] that you know it is norms and culture and it is you know Traditions or history
[2:55:04] or practice and and I mean that's one of the things that's great about the city
[2:55:08] is that you go anywhere and there's all kinds of signs on it and I and I would
[2:55:12] agree with you on on the the any type of of speech that we should be allow we
[2:55:16] should be encouraging it we should be encouraging people to speak out and to
[2:55:19] have you know to to to have that dialogue um so I think that that makes a
[2:55:24] lot of sense I I also think you know that that's why I was asking the
[2:55:29] question about where the parkway starts is that you know trying to decide where
[2:55:34] your property line is it gets gets really difficult I me we're actually
[2:55:38] having we've had some some issues with residents Mo most recently with with
[2:55:43] that so I I I think having some guidance on the the placement the
[2:55:51] number U probably revisiting the the the details on the signs you know like
[2:55:57] Council like mayor PM said is on you um powered or flashing or colors or
[2:56:05] anything like that that that would be distractions I think that that's
[2:56:09] important um but I I I do think you know having signs out um is something that
[2:56:14] that's part of the city and should be supported and encouraged within reason
[2:56:19] within within some sort of scope can I also ask that this part of
[2:56:25] the discussion be reflected in the minutes because I think it's really
[2:56:27] important to look at the future when we are bringing this forward that people
[2:56:31] can read through our minutes and see what why we've made these choices what
[2:56:37] our perspectives were what was a public comment because help guide because in
[2:56:41] the future when I bring up like what was when you said this came up what 2003 was
[2:56:46] the first one and now it's interesting to see like how was that process changed
[2:56:51] why did they change it would it so would it be in the minute or in the staff
[2:56:55] report because I think the staff report would then have what did the actual it
[2:57:00] would reflect the dialogue that was received so the reason I asked that is
[2:57:03] when I looked at the planning commission's Alverno issues as well as
[2:57:07] other issues those minutes told me exactly what the discussion was with the
[2:57:12] people sitting here so I could understand why that code was amended why
[2:57:18] was that code set and approved because of the discussion items like right now
[2:57:23] what was the rationale for the policy correct correct and I think it was
[2:57:27] really important and really helped us as Council when I read through those
[2:57:31] reports from Planning Commission so I think it's really important that we do
[2:57:34] that otherwise people have to go to archived videos and watch a whole video
[2:57:39] I just think it's really important and I've seen you know other councils do
[2:57:42] that where it's when it's this kind of thing like give a blurb of why we're
[2:57:46] what we're discussing why did we make this policy so I I completely agree with
[2:57:50] with with the the intent that you've got where I where I'm wondering is is that
[2:57:55] we're going to have a staff report on that and and that's where it's going to
[2:57:58] have the decision on it so would it be easier to find the results on it if you
[2:58:03] had the the discussion and then the outcome in the staff report because
[2:58:07] that's I want know why I trust those leaders when I'm not here anymore but
[2:58:11] it's in the staff report I want to see I want to go back to those minutes and see
[2:58:14] what our previous Council were thinking just like I want to know what the
[2:58:19] Planning Commission was thinking when they come up with codes and policies
[2:58:22] you're just asking for exp asking expanding minutes like when it comes to
[2:58:26] our discussion items like this is and then they normally are I just want to
[2:58:29] make sure that it's noted what our public comment was what we're
[2:58:34] discussing so that we can understand why did we change
[2:58:37] this what was our rationale okay I think it also makes it very transparent that
[2:58:43] we're not hiding anything this is our transparency time
[2:58:50] okay and we even have technology that does that now for us other
[2:59:00] discussion PL when do you have enough guidance on this or city manager Roso do
[2:59:04] you have enough guidance to take this back um I I I want to
[2:59:08] clarify I have questions okay go ahead so so on the issue of content
[2:59:15] neutrality is the council okay with drop ing any reference that differentiates
[2:59:20] signs based on content yes yes okay and if I'm understanding correctly the
[2:59:26] council wants to permit signs in the public right away but Place restriction
[2:59:32] objective non-content content neutral restrictions on them right quick
[2:59:37] question then about that well for Public Safety purposes primarily is there state
[2:59:42] or LA County restrictions on signage at all even if it's on the person's
[2:59:49] property or not and the example I'm stating is there was a resident in I
[2:59:53] believe North Hollywood that had a race racial symbol in their window and the
[3:00:01] city was able to mandate they remove that and I don't remember why because to
[3:00:05] me it would be free speech even if I don't like it and I want to know if
[3:00:09] there's already language in there that prohibits certain signage due to hateful
[3:00:13] or anything speech I I mean only only speech that's not protected by the First
[3:00:18] Amendment would be something we could move against and we would have to get an
[3:00:21] injunction to do that it's not something we could do through code enforcement
[3:00:24] okay uh and but as far as like LA County I don't know because LA County would
[3:00:30] have La County's ordinances and regulations have no bearing on the city
[3:00:35] of C okay and um this made me think of another one do we need to put any
[3:00:41] provisions in for uh real estate signs or is that covered in a separate thing
[3:00:45] so is that so so business regulation is a a entirely separate topic that would
[3:00:51] be a considered yeah that makes sense okay vulgarities those are already those
[3:00:55] are fine I mean permissible under the First
[3:01:02] Amendment wasn't there a code of decency though that like I can't stand in front
[3:01:05] of my house naked uh even though it might be my
[3:01:08] first amendment right correct that's a there's a separate body of law on on
[3:01:14] public nudity you know if we pass an ordinance like this and and kind of
[3:01:20] liberalize this I I don't think we're we're going to see a
[3:01:25] whole mass amount of signs controversial signs spring up about all kinds I I feel
[3:01:31] like that that's why we live here most of the our our fellow are moderns are
[3:01:37] self disciplined about these kind of public matters we don't have that
[3:01:42] problem and we can go to other cities you can see really horrible examples of
[3:01:46] it but here we've been generally pretty good about this I I wouldn't expect
[3:01:49] changing the actual language uh to allow for things in the
[3:01:54] parkway is going to cause you know Fu signs in the Parkways if you're a
[3:01:58] moderator something like that yeah I it's you your your options are really to
[3:02:03] allow it or disallow it because when you try to regulate along the margins you
[3:02:07] run into very challenging um lawsuits to defend so I mean what we're trying to do
[3:02:13] is is codified what the actual practice is
[3:02:18] C Roso you wanted some clarifications did you get what you needed I I I took
[3:02:22] some notes um and so um today was to provide staff with with Direction uh so
[3:02:28] we can come back um but what I'm what I have is uh who maintains the Parkways
[3:02:33] and why the homeowner's right to use the parkway um and I think City attorney
[3:02:40] just clarified it doesn't matter what type of sign it is um so it so little
[3:02:45] league political signs um um we're just going to look at signs in general um
[3:02:52] we're going to look at if there's any state or County restrictions and if they
[3:02:56] apply to the city um we did the initial conversation was around uh elections so
[3:03:03] I'm going to include time restrictions or or election periods um or if we want
[3:03:08] to just open it up all year uh because little league and and First Responders
[3:03:13] thank you those happen could happen at any time is that okay yes you mean you
[3:03:17] mean keeping the code that we already have that political signage can only be
[3:03:22] up 10 days after no it can't it can't be based on the content of the signs so
[3:03:26] it's going to be it's it might be something like Signs can only be there
[3:03:30] for 30 days all signs after 30 days you'd have to move a sign that that
[3:03:35] would be like a durational limit a a a Content neutral durational limit on
[3:03:39] signage like the parking 3 parking so so then how do you um when when you run for
[3:03:45] office you have to have a bond or a sign Bond or something I can't sign there was
[3:03:51] another it's a bond it's a signed Bond um
[3:03:56] so how does that re reflect this this dialogue is it can
[3:04:02] you may mayor is correct um when a candidate's running for office for an
[3:04:07] elected office the candidates do um pay a $100 refundable Bond and then if the
[3:04:15] uh signs are removed according to the municipal code if the removed within 10
[3:04:18] days uh after the election then the bond is refundable and and the bond is to pay
[3:04:25] the cost of us having to the city having to remove it correct if they are not
[3:04:29] removed within 10 days and City staff needs to remove them then that um bond
[3:04:34] is used for City staff to remove the bond the signs and and so if if some
[3:04:40] kind of durational limit was placed on signs through this ordinance we'd
[3:04:44] probably have to revisit that bonding requirement
[3:04:48] so yeah I mean I'm contemplating if you have a presidential sign if you have a
[3:04:52] state senate sign I mean there's no they don't have to pay a bond and their signs
[3:04:56] were all over the place as well right um do they get stuck with a a bill to clean
[3:05:01] up the city no no no
[3:05:07] that if you have a presidential sign on your private property you can have it
[3:05:13] only a private property we're talking about the parkway but not according to
[3:05:16] the bond because prior those signs could be on any public area so it's inferred
[3:05:21] that it's on your private residence so technically if you had a political
[3:05:25] president sign up you were supposed to remove it you were supposed to get a
[3:05:29] bond and then remove it within 10 days private property is is that what the
[3:05:35] ordinance so so the the bond is it is it based on an ordinance I I think again we
[3:05:41] might be getting off topic because we're we were trying to focus on sign
[3:05:45] placement in the Parkways yeah and I think plac in the in private property
[3:05:51] might be out of the scope did I did I miss anything in
[3:05:55] my the only the issue I might have is is if signs place too close to
[3:06:01] intersections in Parkways I think maintain safety yeah from a safe traffic
[3:06:07] point of view that that we there is the new law on um parking related to to
[3:06:15] implied cross rocks I can't remember the exact
[3:06:18] yeah but but but but but there there's guidance that's that's exactly where I
[3:06:23] was thinking it's a guideline for pedestrians it it may be at least
[3:06:28] something to consider I I don't want to bind staff on it but there someone had
[3:06:33] done some thinking on that and and it' be worth looking at that as as guidance
[3:06:37] sign safety distance from intersections is that and size size
[3:06:44] right that's non size is in there I think to think the the standard
[3:06:49] yeah yeah I think that I think our current size size is in there but size
[3:06:53] is in size is in there but we can revisit it right yeah it wouldn't mess
[3:06:58] with color or anything like that I think it says something that deters driving

[3:07:19] to the next item which is resolution 2506 legislative
[3:07:29] advocacy is that right uh yes mayor I'll be presenting
[3:07:33] this one uh the city council last considered this item at their January
[3:07:38] 28th regular meeting uh at that meeting the city council provided some direction
[3:07:43] uh here is the direction I had recorded to prioritize requests from neighboring
[3:07:48] or Regional public agencies to expand the scope of the resolution to include
[3:07:52] funding applications and other opportunities to increase
[3:07:55] resources and for the city manager to consult with the mayor prior to taking
[3:08:00] any policy position so this the version of the
[3:08:04] resolution in your packet today looks a little different than the prior version
[3:08:08] because it doesn't seek to define the policy priorities that's been taken
[3:08:14] out uh instead what it's doing is it's creating um three elements that need to
[3:08:21] be satisfied in order for the city manager to take a policy position those
[3:08:24] three elements are the following the position um the position is at the
[3:08:31] request of a neighboring public agency or a member organization of which the
[3:08:35] city is a member the position supports an increase
[3:08:39] in or opposes a decrease in resources to the city a neighboring public agency or
[3:08:45] a member organization of which the city is a member
[3:08:48] and the mayor approves the policy position so you can see this one is more
[3:08:52] focused on resources and um is stays away from uh really policy
[3:08:59] considerations it's more focused on I guess policies that Advance resources
[3:09:05] Less on policies that determine legislative decisions not related to
[3:09:11] resources and remind me the the reason for that is if if we were going to talk
[3:09:15] about a legislative policy uh it's not as timely was that that was
[3:09:21] our rationale right and because we some things are timely for our neighbors to
[3:09:26] get support for maybe a grant uh that's that was our concern right so there
[3:09:31] there were the the rational behind this uh uh policy resolution was that we kept
[3:09:39] receiving we I mean City management kept receiving requests to take positions on
[3:09:45] legislation on regulation on
[3:09:48] applications for resources and other items and the city and the city
[3:09:53] management was unable to respond to those requests in time because we
[3:09:59] couldn't agendize it uh or or by agend by agiz that for the next regular city
[3:10:05] council meeting we lost the opportunity to weigh
[3:10:08] in and so initially the idea was that the city manager was going to uh be
[3:10:16] authorized to pursue policy positions on a whole host of
[3:10:20] things including resources and non-resource related issues and this one
[3:10:24] is going to be related specifically to resources for the city um or neighboring
[3:10:30] public agency or member organization so it's a lot narrower in
[3:10:38] scope and that's your presentation right yes

[3:11:13] um one one of the benefits of of our representative government is that we the
[3:11:21] people we get to pick from us five council members to go into the
[3:11:27] bureaucracy that is government and create legislation you
[3:11:32] create policy and you represented us through the legislative Authority that
[3:11:37] we give you through fair and open elections this proposal in a way kind of
[3:11:43] violates that in that it would eliminate the public to be involved in these
[3:11:49] policy decisions um and it would only require
[3:11:55] just the mayor not two other council members to be in agreement now let me
[3:12:00] let me say I I believe every of our five council members are extremely
[3:12:06] trustworthy and capable and qualified to make the decisions but that's not a
[3:12:11] reason to sidestep the legislative process that we put you we trust you to
[3:12:18] go into government and make these decisions on our
[3:12:23] behalf it's again this is just one more little
[3:12:27] thing that erods the very Foundation of this represented government um so I
[3:12:35] would say no if if this is just a matter of convenience and we might not make a
[3:12:40] Time issue then you know what call a special meeting we can do that but it
[3:12:45] takes three elected council members to make something happen in this city and
[3:12:49] and I'd hate to see us start stepping away from that again okay thank you got
[3:12:55] question Mr L thank thank you for that um did you did you watch the meeting
[3:12:59] when we discussed this when first I did not okay no no um so if you do watch
[3:13:03] that you you will see that your concerns were were raised by the council and
[3:13:07] that's why it's coming back to us and and I did speak with one council member
[3:13:10] on this and and I was made aware of that I you know it's just important the
[3:13:15] process is so important and we we can't ever sidestep it in in in all
[3:13:20] applications of government and policy creation and and adhering to policy
[3:13:26] thank you thank you do we have any other other comment
[3:13:31] no sir all right we'll bring it back for discussion thoughts yeah so the the
[3:13:37] title of the resolution didn't really change so I don't think it meets the
[3:13:41] spirit of what we were kind of contemplating originally um and it kind
[3:13:47] of goes back to Mr Len's comments um we as a current Council um we're we
[3:13:55] typically and it's just because of our current Council and probably the two
[3:13:58] before we avoid any large political issues that aren't to a direct benefit
[3:14:05] of our residents and our city um that's just kind of been
[3:14:10] a just a quiet policy that we've we've kind of fell into because all all we're
[3:14:16] focused on is this city and the benefit of this city um so I don't know that
[3:14:24] that the title is really referencing and that was our consensus when we talked
[3:14:27] about this um the first time so I don't think I don't know that we need to
[3:14:31] change the title but the title is a little misleading um are from what I
[3:14:36] recall and I asked the question um the reason we wanted to do this was
[3:14:43] because we have Regional partners that are sometimes asking for funding and
[3:14:48] would like to have a letter to go along with it for their benefit um and we
[3:14:54] can't call a special meeting to do that generally um and if there's a issue
[3:14:59] that that is of regional state or federal legislation regulation that is
[3:15:06] important to us we we you generally have time for that to come to the council for
[3:15:10] us to discuss go through the legislative process have policy and approve it so um
[3:15:15] I'm thinking because of section 2 a 1 2 and 3 it still is in the spirit of our
[3:15:21] discussion but um again I think the title might be a little
[3:15:26] mislead you know based on what you just said there there was something that I
[3:15:30] pulled out of there that that it may be worth making a change and and it's the
[3:15:34] time sensitive nature of it right when you said with with many of the federal
[3:15:39] state and and sometimes even local one items
[3:15:44] um if it's on its its regular path we we've got time but but I think you know
[3:15:49] the Crux of this the core of this is the time sensitivity right I mean the
[3:15:54] perfect example was our neighbors in Arcadia was looking at an alternative
[3:15:57] transportation plan grant funding that would directly benefit us not only from
[3:16:03] from our relationship with them but there could have been you know we we we
[3:16:08] could be supporting bike Lanes on you know on um Orange Grove that would B
[3:16:16] directly benefit our our residents and we missed it because we had to move a
[3:16:19] meeting so to me like that the part of the core of this is that time sensitive
[3:16:23] nature of it that that maybe that's that's something that should be added
[3:16:26] here I'd love to others thoughts on it agreed and the reason we decided to have
[3:16:32] the mayor of Des because we didn't want to wholly because it's not always going
[3:16:35] to be Jose we wish it would be right um but we didn't want to wholly leave that
[3:16:40] that decision up to the city manager uh we wanted to have at least one member of
[3:16:44] this Council um weigh in and whether or not they believe the council would kind
[3:16:49] of agree with it right and I think that was a spirit of I know it's a little off
[3:16:52] topic from your comment but I think that was a spirit of why we wanted the mayor
[3:16:57] we want at least one person design designate if we have three people that's
[3:17:00] a brown act issue right we need to call a meeting so that's that's why we decide
[3:17:04] on the mayor can I comment on this too because that was my original worry is
[3:17:10] that we're not always going to be here Jose is not always going to be here and
[3:17:13] we've seen in the past we've had issues with City managers and city council
[3:17:18] members that have gone to Cahoots and things weren't done on the up and up and
[3:17:23] it held us liable as well as it was just not moral and ethical and so the problem
[3:17:31] I do have is that what if it's not us what if it's not you and you and we've
[3:17:36] implemented this well so is there is there a report
[3:17:40] back on this does it come back it it if if there was something on it did the the
[3:17:47] resolution I don't believe and correct me you guys all read these real closely
[3:17:53] I don't know that there it has to be reported back at the next
[3:17:57] meeting it it there is it says all policy positions adopted by the city
[3:18:01] manager design shall be communicated to the council at the next regularly
[3:18:05] scheduled there we go city council earlier in writing
[3:18:09] great I mean that to me so what if we added two members which which like we do
[3:18:15] for an at hoc committee what if what if it's two members of
[3:18:19] council instead of just the mayor and someone else or what if it's the mayor
[3:18:23] and another council member so so My worry is there's times when a mayor and

[3:18:45] relationship or already built into the way we do things could it just be like
[3:18:49] like we normally do designate the mayor and another council member or two
[3:18:52] council members which would normally default to the mayor but let's say
[3:18:56] you're not available either council member low if if you did it that way
[3:19:00] without any kind of undefined term it would become a standing committee and
[3:19:04] that would also be subject to the brown act got it right right so it would have
[3:19:07] to be designated mayor mayor proam or something or does that matter either way
[3:19:12] it becomes a committee yeah if you're if if we're having the mayor and and the
[3:19:16] mayor protem working together to review all
[3:19:21] resolutions it we're not calling the committee
[3:19:25] but smells like a committee I just don't like it that I trust us 100% but it
[3:19:31] really worries me because I've been here for 50 years
[3:19:35] now even though not I'm all aware since all the whole time but I've seen things
[3:19:39] that you're like huh are you talking about entire
[3:19:43] councils In Cahoots or just and we are this could be so this ordinance can be
[3:19:50] repealed or rescinded by the council that sees somebody sees a a city manager
[3:19:57] and a mayor that are not on the up and up but you'd have to actually see a
[3:20:01] violation at that point it doesn't because it' be reported in the very next
[3:20:07] meeting I see say I'm just hyper sensitive to to transparency because
[3:20:12] I've seen it happen here what if then they present the report that's worded
[3:20:17] like they want it to be said in other words we don't we don't
[3:20:22] know exactly what happens except that we trust our reports are are valid and that
[3:20:27] they're trustworthy and that this is the honest
[3:20:30] truth so if we violate that if they violate someone else violates that
[3:20:36] they're going to report what they want about anything here's what I'm
[3:20:39] struggling with government today is so all all these agencies public
[3:20:45] authorities are are also intertwined with one another this the league of
[3:20:50] cities for is very instructive League of cities actually has
[3:20:54] influence uh and it's dependent upon the city members of the league of cities
[3:20:59] actually working together to speak as one voice in Sacramento and that has
[3:21:05] benefits for the members who participate and there are other organizations like
[3:21:09] Cog where where same things going on and maybe we get a call from Cog and we got
[3:21:14] and we don't have time to have a meeting but we need to so there's a practical
[3:21:18] side to this that maybe I don't know if it's existed back in the golden years
[3:21:21] but I suspect it didn't I I suspect the intergovernmental relationships are are
[3:21:27] more important than than ever before that's why I was open to discussing this
[3:21:32] because I have the same concerns about transparency that you do Chris as a
[3:21:37] student of government I I I certainly don't need to be reminded of how how
[3:21:42] easy it is for corruption to uh weasel its way into a system so I'm really torn
[3:21:47] on this I mean I I I'm I'm really torn right down the middle on this and I'm
[3:21:52] with you both with with the transparency and all those issues but the catalyst is
[3:21:57] a request from a neighboring agency and so I I'm trying to where's the
[3:22:02] corruption there generally um because it's that's the Catalyst only right or a
[3:22:07] member of an organization which the city is a member I guess I guess I me League
[3:22:11] of cities you know city of Arcadia city of
[3:22:14] Monro a South pass so anything else would have to be an
[3:22:18] emergency meeting if anything else that we
[3:22:22] anything outside the perimeters of a position that request of a neighboring
[3:22:26] public agency or a member organization of which city is a member so if that was
[3:22:30] like a special meeting not an emergency meeting sorry thank you sorry special
[3:22:34] meeting thanks because I know we've had we have
[3:22:39] had opportunities that we missed because of this you know if you s if you if we
[3:22:44] if if our city manager and or may may or think that it's a good idea that it
[3:22:49] might have a benefit if a law passes or something policy changes higher than us
[3:22:55] and it does and we've we've played a role in that then it's not just that the
[3:22:59] law passes we've also helped the people that were working with so you know that
[3:23:04] they're they're going to be more inclined to help us in the future as
[3:23:07] well and we're and we're talking about support or nonsupport issues right is
[3:23:11] that right Jean is that how you're reading it yeah yeah not changing
[3:23:15] policies for our city no no no no we're talking about resources that we might be
[3:23:19] able to use like for bears for instance that might be beneficial to other
[3:23:23] agencies as well or maybe they we all vote for bears and maybe they they
[3:23:28] they're happy to or we help them on something in the future that we know
[3:23:32] would be beneficial to them or at least advocate for them in terms of
[3:23:38] resources
[3:23:42] yeah I do like the addition of support rep an increase in or opposes a decrease
[3:23:48] in resources yeah a12 and three I think
[3:23:53] limit this severely um to avoid yeah I we had because we had the discussion
[3:23:58] these were added because of the discussion avoid those corruption type
[3:24:03] issues right and I really appreciate your title change because I think that's
[3:24:07] what I think I was still triggering on was
[3:24:11] like we can change it yeah absolutely and I don't know what we change it to
[3:24:15] but
[3:24:18] it is trigger I was like whoa so so when this when uh this gets past it's a
[3:24:25] resolution then then how does it how does it enter into like the
[3:24:32] overall administrative record so like like how does how do does do future
[3:24:37] Council know what this is like in an ordinance you go you go to the ordinance
[3:24:41] and you can look up the ordinance right how do you know that this other than um
[3:24:46] um the the the the uh knowledge of Staff or council members at some point in the
[3:24:54] future how do people know that this resolution is still around I'll defer to
[3:24:57] the city clerk Mr Mayor resolutions are uh
[3:25:01] typically policy driven and so the uh city council and they and they become
[3:25:07] effective immediately upon the council's approval uh but they can also be amended
[3:25:13] or they can be um cancelled with Council approval as well uh they
[3:25:20] they are not usually part of the um Municipal
[3:25:25] Code unless they're used to amend an existing Municipal Code but um they are
[3:25:31] there is a log of them kept and then and the resolutions are also kept in the
[3:25:35] book the council and City staff through institutional knowledge would have to
[3:25:39] know that the policies exist and incorporate them through regular use so
[3:25:44] so if it's not used they there may right now be a resolution out there that gives
[3:25:50] us guidance or gives us a policy Direction on something that we're not
[3:25:54] following because we don't know about because it just it just in in natural
[3:25:58] turnover of of of staff and counsel and everyone it it may just be collecting
[3:26:06] dust it's possible yeah okay city clerk agular I I know you I know you as city
[3:26:12] clerk are The Keeper of the book of resolutions yes is there also some kind
[3:26:17] of index of resolutions that can be referenced we do
[3:26:21] have a log of the resolutions that are kept but it's it's a log that goes that
[3:26:26] spans over a number of years and so uh the the council if if it's inquiring
[3:26:33] about or or interested in creating a policy or amending a policy we could
[3:26:38] look into the index to see if it already exists or if it's something that could
[3:26:42] just be amended um but to your point there could be potentially some
[3:26:48] resolutions that are that are not being utilized got it I want to Circle back
[3:26:54] I've taken us on a little bit of a detour but to to Mayor pm and council
[3:26:59] member Garcia are there edits you'd like to make to the the title of the
[3:27:04] resolution that would make it less I think triggering was the word I
[3:27:19] well first I guess it's establishing a legislative advocacy policy and
[3:27:24] authorizing the city manager manager to take policy
[3:27:29] positions on local regional state federal legislation so it's the whole
[3:27:33] legislation regulation initiatives or opportunities but it doesn't say
[3:27:36] anything about what the three bless you um take a position on request of
[3:27:43] neighboring has to be and it goes to like see right if the city manager takes
[3:27:48] a PO poos and it's about correspondence stating we support supportive amended
[3:27:54] oppose or oppose unless amended I mean that's really what we're allowing um
[3:27:59] correspondence or a letter of support or non-support and not changing our
[3:28:04] policies not changing our legislation or or state legislation or so the spirit of
[3:28:08] that I think should be so I'm wondering if if we we change it to say um
[3:28:17] something about responding to requests if we could work responding to requests
[3:28:22] or timely I like that timely responding to requests in there because because
[3:28:27] we're not really it's it we are we are having legislative ad advocacy but it
[3:28:34] what we're missing is is that it it's at the request of another body and and I
[3:28:38] think I I think maybe we need to add a sentence saying if if this request
[3:28:46] is needed before the next city council meeting or one of one of those issues
[3:28:51] right so that has to be I think another yeah Catalyst for this to actually be
[3:28:57] used so so are are you saying that under a you would have um it would be four
[3:29:02] criteria instead of three yes
[3:29:08] okay um because otherwise it could be used
[3:29:14] for L lot EAS yeah to be used right so so um C attorney do you have enough
[3:29:23] guidance here to come back with another draft on this I mean I I don't think it

[3:30:01] paragraph a to be uh that if the request comes before the next regularly
[3:30:09] scheduled city council meeting but it's I even I don't know
[3:30:15] because it we're even talking about um sometimes we can't call a um a special
[3:30:21] meeting right and do we even want to call a special meeting for something as
[3:30:26] is right so I don't even know if if we include the special meeting portion or
[3:30:31] just say if it comes be if the decision needs to be or the letter needs to be
[3:30:34] sent prior to the next regularly scheduled council
[3:30:40] meeting and I would just point out that almost it's almost always the case that
[3:30:45] the city council can call a special meeting and address one of these
[3:30:49] concerns um but the issue is the time gap between your regular meetings is
[3:30:55] that a is that a 36- hour noticing uh the regular meetings is is 72h hour
[3:31:00] special meeting is 24 hours 24 hours okay
[3:31:06] so if we were to to to if we were to give you guidance and it comes back on
[3:31:11] consent do we need to to vote on it tonight to give that we agree with
[3:31:14] Direction Okay so it's okay to come back on consent and and the council's
[3:31:19] comfortable with the the edits that are there I mean we'll have a chance to vote
[3:31:23] on it then and but it will be on consent discuss it twice and it gives the public
[3:31:26] another chance to give public comment on it I I like that idea will be able to

[3:32:12] the tree is on city property and we know if it's easy on sa property it's their
[3:32:18] responsibility if it's it's part of the fire codes or making us safer um and if
[3:32:23] it's on private property it's there so what do we do about these areas that are
[3:32:28] we're not sure like do do literally they all going
[3:32:32] to have to call the city and everyone and you're going to have to go out there
[3:32:36] and check the exact area check the parcel maps and decide on that and does
[3:32:43] and does our fire department have that parcel map so when they go to request
[3:32:48] people do brush AB bment they're advising someone to trim their trees and
[3:32:53] it could be our property all right I don't have anything

[3:33:51] line does that mean that if if that tree is in front of my house and it's
[3:33:55] actually you know a tree that could endanger my home like the branches are
[3:34:00] laying on my house does that mean that I'm responsible now for also the fire
[3:34:04] safety and trimming that tree even though it's on public
[3:34:08] land I I'd like to to expand just slightly instead of trimming I'd like to
