p.m. and I call this meeting to order.

This is an eight member board appointed
by the city of South Fton's mayor and
[7:35]
city council to hold public hearings to
make recommendations on resoning, use
[7:39]
permits, concurrent variance
applications, comp uh comp land use
[7:43]
plans, maps, and amendments to the
zoning resolution. The applicants or
[7:46]
proponents of each case will be allowed
a total of 10 minutes to present their
[7:50]
case. Since the burden of proof is upon
the applicants to convince the board
[7:53]
that the application should be approved,
they may choose to reserve some of their
[7:56]
time for a rebuttal. Following the
proponent's presentation, any
[8:00]
individuals in opposition will have a
total of 10 minutes to present their
[8:03]
position. If multiple people will speak
in opposition, you should organize
[8:06]
yourselves as to allow everyone to speak
in the 10-minute time frame. Opposition
[8:10]
is not permitted rebuttal time. If you
wish to address the commission on the
[8:14]
case, you must fill out a comment card
and indicate whether you are a proponent
[8:18]
or an opponent of a case. If you are not
sure whether you are not uh if you are
[8:22]
not sure whether you are whether you are
not whether you are a proponent or an
[8:27]
opponent, you must fill out an opponent
comment card. The commission will take
[8:31]
two votes on each application. The first
vote is on the findings of fact as
[8:35]
presented by staff. The second vote is
for approval, denial, or deferral of the
[8:38]
application. It is the second vote that
determines the board's recommendation to
[8:42]
city council. These same matters will be
heard by city council at a public
[8:46]
hearing. Um there are a couple of
council meetings coming up. So we'll
[8:50]
just address those as they come up for
each case and then they will be voted on
[8:54]
at that actual council meeting. Please
refrain from any verbal outbursts during
[8:58]
the public hearing and please only
address the commission during the
[9:00]
designated public comment time. We will

an email from the applicant stating that
they wish to withdraw this case.

Therefore, we uh recommend that uh you
all vote for a deferral and then it will
[12:10]
be voted on for withdrawal at the city
council meeting on November 12th.

Highway. Staff is recommending approval.

And just uh some clarification, this is
a parcel that contains two zoning
[14:36]
districts uh M2 and C2. Um I don't
believe we have a but in your st in the
[14:43]
staff request it should be a zoning map
that shows the two ca the two zonings on
[14:46]
the one parcel. Um we believe that
we have a policy that whichever zoning
[14:54]
takes up the majority of the parcel is
what that zoning is. So we consider this
[14:58]
a M2 zoning and that gas stations aren't
allowed in M2 zoning. So that's why they
[15:02]
need a special use permit to operate and
to expand.

there, but um it they do complain about

owner to kind of upgrade everything.
So, we have an ADA um sink that we're
[16:36]
adding and bringing everything up to
code. Um it it's pretty straightforward.

that up so everybody can move through

the aisle cuz that's kind of a life
safety issue in the event of a fire. I
[19:29]
don't need anybody tripping to get out
of the space. So, um, you had where the
[19:35]
aisles are, where the merchandise is,
you had game machines. And to me, that's
[19:39]
a code violation.
>> So, I kind of separated the two and and
[19:44]
added a game room for the gamers.
So, for to move their already existing
[19:49]
machines into one central location.
Is the owner open to maybe some other um
[19:57]
enhancements? Maybe something that is
beneficial to

more of a and and and I know I don't

want to sound judgmental, but more of a
um
[20:12]
options that are not just games.
And and when I say games, because these
[20:20]
are the the the the slot machines,
