>> welcome, chief samson?
[3:26]
>> thank you, I'm trying to
[3:30]
get the slide up here.
[3:32]
I'm going to stop before I
[3:32]
get
[3:34]
too crazy.
[3:39]
>> good evening, mayor eddie,
[3:42]
matt samson, your fire chief,
[3:43]
first we're incredibly
[3:44]
excited
[3:46]
for next friday the 4th, it's
[3:49]
a really big day for nt only
[3:50]
our department but for our
[3:54]
city to christen the city's
[3:55]
brand new fire boat, it will
[3:59]
take place on friday the 4th
[4:00]
at oyster point, a little
[4:01]
history of the water rescue
[4:03]
program ask a water show and
[4:05]
ip viet the public on the
[4:05]
boat
[4:06]
for tours if they'd like to
[4:07]
come.
[4:09]
We hope to see everyone there.
[4:11]
Second, in support of our
[4:12]
public outreach to help
[4:13]
inform
[4:13]
our community about the
[4:14]
impact
[4:17]
tos the state's most recent
[4:18]
fire hazard severity zone
[4:18]
maps
[4:19]
released at the end of
[4:21]
FEBRUARY websinger ear
[4:21]
hosting
[4:23]
our town hall 65 at the terra
[4:26]
bay neighborhood up on APRIL
[4:29]
7, that will go from 6:30 to
[4:30]
8:30 and we're here to answer
[4:33]
questions regarding the fire
[4:34]
hazard severity zone mps but
[4:36]
also anything wild fire
[4:37]
related, any comments or
[4:38]
comments or anything the
[4:41]
public would like to know how
[4:42]
they can make their home
[4:42]
safer
[4:44]
from wild fire and is the
[4:44]
town
[4:46]
hall is open to anyone in the
[4:50]
city, we hope to see everyone
[4:50]
there.
[4:51]
>> I have a question.
[4:52]
>> please.
[4:56]
>> if I could, so I know that
[4:59]
these fire hazard severity
[5:02]
maps, are they through fema
[5:03]
?Frnlts they're produced by
[5:05]
cal fire and they're released
[5:07]
by mandate under state
[5:08]
ordinance to incorporate all
[5:09]
the etire state of
[5:10]
california.
[5:12]
>> where you fall on that
[5:14]
map,
[5:15]
does that determine maybe an
[5:16]
impact to your home insurance?
[5:18]
>> that is a current concern
[5:20]
right now, we've been assured
[5:23]
that these maps do not impact
[5:24]
insurance rate and is we'll
[5:26]
spend a a quite a bit of time
[5:28]
why we agree with that
[5:29]
perspective during the town
[5:30]
hall.
[5:31]
>> okay, thank you, chief.
[5:35]
>> thank you.
[5:38]
>> we'll go on without the
[5:41]
slide, but I'm very excited
[5:42]
also as the third
[5:42]
announcement
[5:44]
tonight, I would like to
[5:45]
announce officially and
[5:47]
introduce our new dputy fire
[5:50]
chief, devon flannery, he's
[5:54]
been with the city for 23
[5:56]
years, and started in the
[5:56]
fire
[6:01]
service as an explorer and
[6:04]
spent quite a bit of time in
[6:06]
the pacific palisades area.
[6:07]
With our department, chief
[6:11]
flannery has served as
[6:12]
paramedic firefighter, ba tan
[6:20]
I -- battalion fire chief.
[6:22]
Chief flannery has invested
[6:22]
in
[6:24]
his own education, he was
[6:24]
able
[6:26]
to obtain his undergarage
[6:27]
walt
[6:29]
degree from san francisco
[6:30]
state, a doctoral degree f
[6:31]
the university of southern
[6:32]
california in education so,
[6:33]
he
[6:34]
brings a unique skill set and
[6:37]
a lot of capabilities to our
[6:37]
department.
[6:39]
We're going to leverage him
[6:39]
to
[6:41]
make sure we can advance the
[6:43]
department to the future, s
[6:44]
I'm excited and I would like
[6:46]
to bring him up for a few
[6:46]
words.
[6:51]
>> con -- congratulations,
[6:54]
let's bring him up, please.
[6:56]
[Applause].
[6:57]
>> good evening, council, i
[6:59]
want to thank the fire chief
[7:00]
for believes in me, it's been
[7:02]
a a pleasure to serve the
[7:02]
city
[7:03]
the last 230 23
[7:03]
years, I
[7:04]
look
[7:06]
forward to the next
[7:07]
opportunity in my new role
[7:08]
and
[7:09]
using my skill set to further
[7:10]
the mission of the fire
[7:11]
department, I want to thank
[7:11]
everybody.
[7:18]
>> thank you, con fwrafp --
[7:19]
congratulations again.
[7:22]
>> thank you.
[7:23]
[Applause].
[7:25]
>> alright, now I would like
[7:28]
to do a special I guess
[7:29]
announcement, recognition and
[7:30]
for that, I would like to
[7:31]
turn
[7:33]
it over to our city manager,
[7:34]
sharon ranals.
[7:36]
>> good evening, I'm sharon
[7:37]
ranals, city manager, she is
[7:38]
not expecting this but I
[7:38]
would
[7:41]
like to call up christina
[7:48]
fernandez if I could.
[7:50]
Hi, chris taoep na.
[7:50]
>> hi.
[7:51]
Er
[7:53]
>> so, tonight is
[7:53]
christina's
[7:55]
last city council meeting as
[7:55]
a
[7:57]
city employee, we hope to see
[8:01]
her at future council
[8:01]
meetings
[8:03]
because she is still a a
[8:03]
resident, christina has
[8:04]
accepted a position as the
[8:05]
assistant city manager with
[8:06]
the city of brisbane which is
[8:07]
a promotional opportunity for
[8:08]
her so we're happy for
[8:10]
christina but we are very sad
[8:12]
to see her go.
[8:13]
christina has been in the
[8:14]
city
[8:15]
manager's office for six
[8:15]
years
[8:16]
and during that time, she's
[8:19]
worked on a number of
[8:19]
projects
[8:21]
including many grant
[8:22]
applications, many grant
[8:23]
reports, legislative niche
[8:23]
yat
[8:26]
I fevers such as minimum
[8:26]
wage,
[8:28]
styrofoam reach codes and
[8:30]
could back koe which we'll
[8:32]
hear about and emergency
[8:32]
response.
[8:34]
She has also been our
[8:35]
sustainability officer and
[8:36]
has
[8:37]
served as staff liaison with
[8:37]
a
[8:40]
null of outside agencies such
[8:42]
as wet sxa, the harbor
[8:44]
district, one of christina's
[8:45]
major projects has been to
[8:48]
establish a a community
[8:49]
district which is progress
[8:51]
thanks to her effort and is
[8:51]
we
[8:52]
hope it will be successful.
[8:53]
I think there's a special
[8:54]
bond
[8:56]
among the staff who served
[8:58]
during covid and christina
[8:58]
was
[9:00]
really instrumental in
[9:02]
organizing -- I'm getting
[9:04]
choked up -- covid was a
[9:08]
trying time, she was
[9:10]
instrumental in organizing
[9:10]
vaccination clinic, food
[9:11]
distributions, maintaining
[9:11]
the
[9:12]
continuity of operations as
[9:14]
well as staff morale and we
[9:16]
owe her a lot of appreciation.
[9:18]
So w that, I have this little
[9:20]
token of appreciation which
[9:21]
christina, I want dwrou hang
[9:24]
this in your office in
[9:26]
brisbane, just a reminder of
[9:29]
all your friends in south san
[9:34]
francisco.
[9:36]
>> oh my gosh, thank you.
[9:39]
>> nice picture of city hall.
[9:43]
>> thank you so much.
[9:44]
[Applause].
[9:47]
And I'm putting you on the
[9:48]
spot, I don't know if you
[9:49]
want
[9:50]
to say a few words.
[9:51]
>> first of all, thank you so
[9:52]
much to sharon and to
[9:52]
everyone
[9:55]
and to all of you for your
[9:56]
leadership.
[9:57]
You know, when I was brought
[10:00]
on board, I wasn't quite sure
[10:01]
what to expect.
[10:03]
Initially I was to serve as a
[10:04]
commissioner for the city and
[10:07]
then I got recruited to come
[10:10]
work for the city and for
[10:10]
that
[10:11]
I'm forever grateful.
[10:12]
I have a vested interest in
[10:14]
seeing the city succeed and
[10:15]
I'm very, very proud of the
[10:18]
work that the staff has done,
[10:19]
the staff goes above and
[10:21]
beyond every day for the
[10:22]
community and I just feel so
[10:24]
grateful to have been a small
[10:27]
part of it, just a big thanks
[10:28]
to sharon for her leadership
[10:31]
and to all of you for your
[10:31]
leadership and just thank you
[10:35]
so much.
[10:37]
[Applause].
[10:39]
>> any comments from my
[10:40]
colleagues on the dais?
[10:41]
>> MR. Mayor?
[10:43]
>> yes.
[10:46]
>> as christina staining a
[10:46]
picture, christina, I wanted
[10:48]
to say thank you for all your
[10:49]
amazing work, you're
[10:50]
absolutely right, you first
[10:51]
--
[10:53]
we first met you as someone
[10:54]
applying as a commissioner I
[10:55]
think to the planning
[10:57]
commission I think it was.
[10:58]
>> general plan.
[11:00]
>> general plan, that' right.
[11:03]
We were so amazed by you that
[11:04]
we wanted to hire you.
[11:07]
I just wanted to say thank
[11:09]
you, this city really owes a
[11:11]
great debt to you for all the
[11:12]
great work you've done and
[11:12]
the
[11:14]
fact that you are -- ask
[11:14]
still
[11:17]
are a south city resident
[11:17]
gave
[11:19]
a unique perspective in terms
[11:20]
of issues happening in south
[11:21]
san francisco.
[11:23]
I know you're not too far
[11:23]
away
[11:26]
as you go up north --
[11:27]
>> a town over.
[11:28]
>> but we know you're only a
[11:29]
a
[11:31]
phone call away if we need
[11:31]
anything.
[11:32]
>> absolutely.
[11:33]
>> thank you very much.
[11:35]
>> thank you, councilmember.
[11:36]
Anyone else?
[11:37]
>> christina, of course, when
[11:39]
I ws mayor, you have been a
[11:41]
tremendous help and I really
[11:41]
do appreciate all that you
[11:44]
have done for us and for the
[11:46]
city, and as a woman, I am
[11:47]
very supportive of you
[11:49]
climbing up the career
[11:49]
ladder,
[11:52]
more power to you and I'll be
[11:53]
here to support you all the
[11:53]
time.
[11:54]
Thank you, cristina.
[11:57]
>> thank you.
[11:59]
>> I will say you are a
[12:01]
resident of the best district
[12:02]
in south san francisco and
[12:03]
now
[12:04]
that -- I know it was
[12:06]
mentioned earlier, now that
[12:07]
you're no longer employed by
[12:08]
the city, maybe you could
[12:09]
join
[12:10]
a commission and continue to
[12:12]
just be around and contribute
[12:14]
b so many of your talents and
[12:16]
you have many talents that
[12:18]
pansies so many different
[12:22]
topic areas as we noticed the
[12:24]
city manager said you've done
[12:25]
lots of diverse work tere
[12:26]
and
[12:29]
your work on sustainability
[12:31]
which the city with reach
[12:37]
codes, with the poorly l --
[12:40]
polystyrene ban, I hope to
[12:42]
susie you come back in the
[12:42]
future.
[12:45]
>> sharon hosted a lunch at
[12:47]
city hall and we got the
[12:48]
express ourselves and I said
[12:51]
how nice it was for south san
[12:53]
francisco to have an
[12:55]
operative, I had a dream of
[12:56]
annexation but you don't have
[12:57]
to foat that yet.
[13:00]
You can't be any closer than
[13:01]
brisbane, good luck to you.
[13:03]
>> thank you.
[13:04]
>> equally grateful for your
[13:05]
time, for your dedication but
[13:07]
most importantly for your
[13:09]
passion as it was said as a
[13:10]
resident, you certainly care
[13:13]
about the city and it was
[13:15]
highlighted and underscored
[13:15]
in
[13:16]
every presentation and every
[13:19]
staff report that you
[13:19]
provided
[13:19]
and shared.
[13:21]
Thank you for representing,
[13:23]
for being a true resident
[13:24]
like
[13:26]
many in this hall and around
[13:27]
our community that really
[13:27]
care
[13:28]
about south san francisco, so
[13:30]
con grafp lacing, GOD's speed
[13:30]
to you.
[13:32]
If I could ask city manager
[13:33]
and council to join me down
[13:35]
here fr a picture wth
[13:37]
christina, please.
[14:21]
(Taking photograph).
[14:22]
>> thank you very much.
[14:24]
Now we're moving o to the
[14:25]
next agenda item.
[14:27]
>> thank you, mayor, moving
[14:28]
on
[14:31]
to proclamations,
[14:31]
proclamation
[14:33]
recognizing APRIL as fair
[14:34]
housing months.
[14:34]
>> I've asked councilmember
[14:36]
mark nagales to present this
[14:36]
proclamation.
[14:40]
>> this is an honor for me to
[14:42]
recognize the month of APRIL
[14:43]
as fair housing month.
[14:47]
I had the distinct honor to
[14:50]
work with project sentinel
[14:51]
where we helped numerous
[14:51]
south
[14:54]
san francisco residents with
[14:55]
tenant/landlord issues ask
[14:56]
fair housing issues.
[14:59]
You know, you would be
[15:00]
surprised at the fact of the
[15:03]
number of residents who will
[15:05]
get denied for rental units
[15:05]
or
[15:08]
for housing based upon their
[15:11]
gender or their age or the
[15:15]
fact they had children and it
[15:17]
was organization like project
[15:19]
sentinel who went above and
[15:22]
beyond to make sure all our
[15:23]
residents had accessible to
[15:24]
fair housing so I'm honored
[15:25]
to
[15:26]
recognize APRIL as fair
[15:28]
housing month and to read a
[15:30]
proclamation where it says
[15:32]
whereas housing is a basic
[15:34]
right of all people and where
[15:36]
this year we celebrate the
[15:37]
57th anniversary of the
[15:39]
federal fair housing act of
[15:41]
1968 which states that
[15:42]
discrimination t sale and
[15:45]
rental of housing is illegal
[15:48]
and based on race, national
[15:49]
origin, whereas the fair
[15:51]
housing amendment act extend
[15:56]
fair housing rights on
[15:57]
familial status to people
[15:58]
with
[16:00]
children, and whereas
[16:02]
california statutes protect
[16:04]
its citizens on the basis of
[16:05]
age, sexual orientation,
[16:07]
gender identity and source of
[16:09]
income and california
[16:10]
celebrates the 66th
[16:11]
anniversary of the fair
[16:12]
employment and housing act
[16:12]
and
[16:14]
whereas the city of south san
[16:15]
francisco supports fair
[16:17]
housing efforts to eliminate
[16:18]
discrimination in housing and
[16:19]
recognizes the benefits of
[16:22]
project sentinel to educate
[16:23]
home seekers, apartment
[16:23]
owners
[16:25]
on federal and state housing
[16:27]
laws and investigate
[16:28]
complaints of illegal housing
[16:29]
discrimination in south san
[16:31]
francisco, whereas the
[16:32]
heightened public awareness,
[16:33]
the city of south san
[16:35]
francisco wishes to focus
[16:37]
public attention of APRIL as
[16:38]
fair housing mother, now
[16:40]
therefore be it resolved the
[16:42]
city council of the city of
[16:45]
south san francisco does
[16:47]
recognize APRIL as fair
[16:48]
housing month and encouraging
[16:49]
all residents and community
[16:49]
organizations to celebrate
[16:50]
the
[16:53]
value of harm nows and diverse
[16:54]
[Inaudible] With neighbor and
[16:56]
is this is signed by the
[16:57]
entire city council and I'm
[17:00]
going to ask jacob to accept
[17:04]
this proclamation, jacob?
[17:21]
>> welcome.
[17:24]
>> so, my name's jacob, I'm a
[17:26]
fair housing coordinator at
[17:26]
project sentinel, I first
[17:27]
want
[17:29]
to thank the city council for
[17:33]
your continued support of
[17:34]
project sentinel.
[17:36]
You know, it's been a
[17:38]
difficult couple of weeks for
[17:45]
fair housing.
[17:48]
The public was caught around
[17:50]
60-70%, our projects were
[17:50]
just
[17:52]
cut from the federal
[17:54]
government and, you know, our
[17:57]
funding has really taken --
[17:59]
we've had to take some
[17:59]
drastic
[18:04]
measures with our funding.
[18:06]
Cities like south city
[18:07]
provide
[18:08]
a lot for us and it
[18:09]
solidifies
[18:10]
the relationship that we have
[18:14]
with the cities that we work
[18:14]
with.
[18:16]
So, yeah, again, I want to
[18:18]
thank this council for your
[18:19]
continued support and I look
[18:21]
forward to this year and many
[18:22]
more to come.
[18:29]
>> thank you very much.
[18:29]
[Applause].
[18:30]
>> thank you.
[18:33]
>> thank you again.
[18:34]
Next agenda item, please.
[18:35]
>> thank you, moving on the
[18:37]
item 2 is a presentation on
[18:38]
the san mateo county
[18:39]
accessory
[18:42]
dwelling unit adu resource
[18:43]
center.
[18:44]
>> good evening, mayor, vice
[18:46]
MAY yo, councilmembers, billy
[18:47]
gross with the planning
[18:48]
commission and I have the
[18:50]
pleasure of presenting the
[18:51]
next speaker.
[18:53]
As you all know, the adu
[18:55]
resource center of san mateo
[19:00]
county opened in 2024.
[19:02]
It's intended as a one stop
[19:03]
shop for adu resources.
[19:04]
We thought it would be the
[19:06]
director had offered to come
[19:08]
and speak so we thought it
[19:09]
would be good as we were
[19:10]
going
[19:12]
to be in front of you talk
[19:16]
about the general plan and
[19:17]
housing project, so I would
[19:25]
like to introduce anna
[19:26]
alekseyeva, she'll go through
[19:27]
the program.
[19:28]
>> thank you for giving me an
[19:30]
opportunity to present the
[19:30]
adu
[19:31]
resource center.
[19:32]
I want to give you a sense of
[19:35]
what the center is all about
[19:37]
sdp&services it provides to
[19:38]
home owners in member
[19:39]
justices
[19:39]
teases including south city.
[19:40]
Before I do that, I wanted to
[19:42]
set the stage a little bit
[19:44]
about adu's in the state and
[19:45]
more locally which you will
[19:48]
probably be familiar with.
[19:50]
Adu's are really popular
[19:52]
housing typology, ever since
[19:55]
the state started
[19:56]
liberalizing
[19:57]
adu statute across
[19:57]
california,
[20:00]
the number of adu's that are
[20:02]
built every single year has
[20:04]
grown something like 15
[20:07]
thousand percent, so hugely,
[20:10]
hugely popular housing type.
[20:11]
Most recent data suggesters
[20:14]
that one in five new units in
[20:15]
california housing units is
[20:15]
an
[20:17]
adu, if you look at lower
[20:19]
income or very low income,
[20:20]
housing units, that
[20:21]
percentage
[20:23]
is high e more than one third
[20:24]
of housing units are adu's,
[20:25]
so
[20:26]
of course it's not the only
[20:28]
housing type but it is an
[20:29]
important one across the
[20:30]
state
[20:31]
and more locally in sn mateo
[20:33]
and in south city.
[20:35]
And I think billy aluded to
[20:37]
the housing element and
[20:38]
progress the city has made
[20:40]
around the most recent rhna
[20:42]
cycle but south city has a
[20:44]
goal of producing almost 400
[20:47]
adu's in the current 8 year
[20:48]
rhna cycle of which the
[20:50]
majority are projected to be
[20:52]
at the low icome or very low
[20:53]
income levels.
[20:56]
So we like adu's for a lot of
[20:56]
reasons.
[20:58]
One, because it's a housing
[21:03]
type and more housing is GOD
[21:05]
but they're also a housing
[21:07]
type, they allow for
[21:08]
multigenerational living,
[21:09]
they
[21:12]
have a wealth building tool,
[21:14]
they are smaller so they have
[21:14]
environmental and
[21:15]
sustainability benefit and is
[21:17]
we know older adults like
[21:18]
them
[21:20]
because they allow them to
[21:20]
age
[21:21]
in place without having to
[21:22]
leave their community.
[21:24]
Is wah is adu resource
[21:24]
center,
[21:27]
it was launched in SEPTEMBER
[21:31]
of 2024, so we just had our
[21:33]
six month birthday, not --
[21:34]
still baby hood when it comes
[21:36]
to being an organization, but
[21:37]
wanted to share some of the
[21:40]
services we have live already.
[21:41]
Working with jurisdictions
[21:42]
and
[21:43]
with home owners.
[21:45]
It is a non-profit
[21:46]
organization, the funding
[21:48]
primarily comes from local
[21:49]
jurisdictions like south city
[21:50]
f city.
[21:52]
The goal is t drive housing
[21:53]
production by being a one
[21:54]
stop
[21:56]
shop to help get adu's built.
[21:59]
We do that through two
[22:00]
different mechanisms, one is
[22:02]
working with jurisdictions to
[22:04]
meet their adu policy goals
[22:06]
and the second is working
[22:07]
with
[22:08]
home owners directly
[22:09]
providing
[22:10]
resources and direct
[22:10]
technical
[22:11]
assistance so I wanted to
[22:11]
give
[22:13]
you a flavor of each of these
[22:16]
areas so you know what's
[22:19]
offered to residents and sto
[22:20]
-- to staff, the center
[22:22]
provides a raping of support
[22:24]
around housing element
[22:25]
implementation related to adu
[22:27]
policy goals, it elapses
[22:28]
jurisdictions stay in
[22:30]
compliance with hcd
[22:31]
expectations and understand
[22:33]
what the latest adu statutes,
[22:36]
rules and standards are.
[22:37]
And helps jurisdictions stay
[22:40]
up to date about the latest
[22:42]
adu best practices and what's
[22:44]
going on at the state level.
[22:47]
As you all probably know very
[22:49]
well, state housing law
[22:51]
changes rapidly, every sickle
[22:53]
year, that is the same for
[22:53]
adu
[22:54]
laws, so every single year,
[22:56]
there's a slate of new adu
[22:57]
bills that are passed and go
[22:59]
into effect and it can be
[22:59]
hard
[23:01]
to keep up with any o them.
[23:02]
And so one of the roles of
[23:03]
the
[23:05]
center is to make sure that
[23:07]
staff understand what the
[23:08]
latest rules and statutes
[23:09]
are,
[23:11]
going to go through a lecture
[23:11]
of the adu standards because
[23:14]
that would be an a hour
[23:15]
lecture, as you can see on
[23:15]
the
[23:17]
right hand side of the slide,
[23:19]
I noted a few laws that went
[23:21]
into effect this year, all of
[23:23]
them in some way, shape or
[23:24]
form encouraging adu's are
[23:26]
making it easier to build
[23:27]
adu's.
[23:28]
One law I want to call to
[23:28]
your
[23:30]
attention in particular is
[23:32]
legalization of unpermitted
[23:34]
units, so the state as of
[23:37]
JANUARY of this year has made
[23:39]
it easier the legalize
[23:44]
unpermitted adu's, we no in
[23:47]
some place, the ratio is one
[23:48]
to three depending on the
[23:49]
jurisdiction, this has a
[23:51]
potential to have pretty
[23:52]
substantial long term effects
[23:54]
down the road in terms of
[23:55]
bringing unpermitted units on
[23:56]
to the market.
[23:57]
Something else that the
[23:57]
center
[24:04]
is working on is it's working
[24:07]
on affordable adu program,
[24:08]
these programs have been
[24:08]
tried
[24:09]
in different place ins
[24:10]
california and adrsz
[24:11]
f cross
[24:11]
the knotty
[24:12]
f ri.
[24:15]
What they do is provide some
[24:16]
financial incentive for home
[24:18]
own teaser build an adu and
[24:19]
those home owners are
[24:19]
required
[24:22]
to rent their adu's at
[24:24]
affordable rates so it's
[24:25]
below
[24:26]
market rate housing program
[24:28]
that subsidizes home owners
[24:28]
directly.
[24:29]
There's interesting pilots
[24:31]
that have been tried in
[24:32]
different places that we're
[24:34]
exploring and the goal is to
[24:36]
have a program model that any
[24:37]
jurisdiction in the county
[24:37]
can
[24:39]
participate in with the goal
[24:40]
of launching next year, so
[24:43]
very excited about that and
[24:44]
innovating in that space.
[24:46]
And in terms of the services
[24:48]
to hope own oers, you can
[24:48]
find
[24:53]
a lot of information on the
[24:54]
website, smadu.Org, this is
[24:55]
just some of the resources we
[24:59]
have op the website, a very
[25:00]
comprehensive guide book
[25:01]
around the different stages
[25:02]
of
[25:04]
building an adu specific to
[25:06]
with local information, we
[25:09]
have local rules for every
[25:10]
jurisdiction including south
[25:12]
city, we have stories of
[25:13]
residents who have built
[25:14]
adu's
[25:16]
in different use case, we
[25:16]
have
[25:18]
a proprietary tol that
[25:18]
allows
[25:21]
people to put in some details
[25:22]
about a prospective project
[25:25]
and get an estimate of the
[25:26]
projected project cost and is
[25:28]
the return on investment
[25:28]
which
[25:30]
they can expect which is
[25:30]
based
[25:32]
on hyperlocal construction
[25:32]
data.
[25:35]
and w also do and
[25:36]
increasingly are rolling ot
[25:38]
service that is are direct
[25:39]
technical assistance to home
[25:40]
owners which we're excited
[25:42]
about, so starting next
[25:43]
month,
[25:44]
residents o member
[25:45]
jurisdictions, including
[25:46]
residents of city are going
[25:48]
the have ak says to a free
[25:49]
feasibility consult s
[25:49]
frs
[25:51]
where they can talk with an
[25:53]
adu expert for an hour, get a
[25:55]
sense of what is possible on
[25:56]
their property talk through
[25:59]
their goals and get a free
[26:01]
customized report on
[26:01]
recommendations.
[26:03]
We have a homeowner help line
[26:06]
which is like a hotline when
[26:07]
they're in the process of
[26:11]
building an adu if they have
[26:13]
an issue, we have a range of
[26:16]
educational content and
[26:16]
resources.
[26:17]
We've launched a webinar
[26:19]
series wth a few successful
[26:21]
webinars that a couple of
[26:22]
hundred people have attended
[26:23]
already.
[26:24]
Next week we're hosting
[26:26]
another webinar about adu
[26:28]
financing, so really want to
[26:29]
delve into different topics
[26:30]
we
[26:32]
know are of interest to home
[26:33]
owners.
[26:34]
And finally this is just a
[26:37]
list of the center's member
[26:38]
jurisdictions, we're thankful
[26:41]
for everyone who
[26:41]
participates,
[26:43]
san mateo is unique in the
[26:44]
collaboration that is across
[26:45]
jurisdiction asks the
[26:47]
existence of the center is
[26:47]
one
[26:49]
example of that
[26:49]
collaboration,
[26:51]
so thankful to south city as
[26:53]
well as all the other member
[26:54]
jurisdictions for supporting
[26:56]
the role of the center and
[26:59]
with that, I will open it up
[27:00]
to questions if there are any.
[27:04]
>> thank you very much.
[27:06]
Any questions or comments?
[27:09]
>> I think it's perfect that
[27:11]
you are presenting since we
[27:12]
just gave a certificate to
[27:14]
fair housing as well.
[27:17]
And adu is a major part of
[27:18]
affordable housing.
[27:25]
It's been a while that I did
[27:26]
an adu presentation, there's
[27:27]
one of your slides that
[27:27]
talked
[27:28]
about the primary owner
[27:29]
couldn't reside in the adu.
[27:31]
>> yes.
[27:32]
>> so, yeah, I want to
[27:33]
clarify
[27:35]
to make sure I got it right.
[27:39]
So, if a homeowner builds an
[27:41]
adu, that junior adu or full
[27:46]
adu cannot be their primary
[27:48]
residencey for that
[27:48]
particular
[27:49]
homeowner?
[27:49]
>> no, it can be, if you're
[27:50]
referencing no owner
[27:50]
occupancy.
[27:51]
Thafrjts's where I was
[27:52]
confused on the rule.
[27:54]
>> no, yeah, sorry, that's --
[27:57]
it's kind of phrased
[27:59]
awkwardly, what that means is
[28:01]
that a jurisdiction can't
[28:03]
prevent owner occupancy, so
[28:04]
--
[28:05]
or can't enforce owner
[28:06]
occupancy, you don't have to
[28:08]
be an owner occupant to build
[28:11]
an adu, that's what it means.
[28:13]
>> for a a lot o folks who
[28:15]
are aging out in terms of
[28:16]
home
[28:18]
ownership or they want to
[28:19]
reduce their size, a junior
[28:22]
adu or an adu is a perfect
[28:24]
play for folks to transition
[28:25]
to and potentially rent out
[28:26]
their home.
[28:28]
>> absolutely, and there's a
[28:28]
-
[28:31]
new state law that's
[28:32]
referenced here, canonization
[28:36]
that is an optional law that
[28:38]
allows jurisdiction tos enact
[28:40]
an ordinance to sell the adu
[28:41]
separately.
[28:43]
>> that's a new law now?
[28:48]
>> yes, san jose enacted,
[28:50]
it's the first jurisdiction
[28:51]
statewide that enacted it and
[28:52]
san francisco is apparently
[28:53]
in
[28:53]
discussions.
[28:54]
It's an interesting
[28:56]
opportunity to caoe kate
[28:56]
f
[28:58]
yait a stock of starter homes
[29:00]
from adu's.
[29:02]
>> so, they have to enact
[29:02]
that
[29:03]
law for that to happen?
[29:06]
>> t yes, it's an opt-in law.
[29:08]
I'm looking at sky now.
[29:09]
You're going to jump in
[29:13]
>>?
[29:15]
Nell selander, your questions
[29:18]
are preserving one rving --
[29:19]
preempting one of the
[29:21]
council's extra strategic
[29:23]
goals is more diversity in
[29:25]
housing stock and more
[29:26]
particularly home ownership,
[29:28]
this is one of the task items
[29:29]
you might see in a future
[29:30]
report on those strategic
[29:33]
goals is do we want to
[29:35]
consider this locally as a
[29:36]
pretty easy pathway into home
[29:37]
ownership.
[29:40]
>> great, thank you, nell.
[29:42]
>> it's exciting and san jose
[29:44]
just enacted this in the last
[29:46]
one and a half year sos it's
[29:48]
excite tog se -- a lot of
[29:49]
jurisdictions twaont see what
[29:52]
happen ins san jose, but in
[29:53]
seattle, in portland where
[29:57]
this exists, I mean, it's a
[29:59]
massive part of new home
[29:59]
starters.
[30:01]
>> great, thank you for the
[30:01]
information.
[30:04]
Great, any other questions,
[30:05]
comments?
[30:06]
Community, this is a great
[30:07]
resource, please take
[30:08]
advantage.
[30:10]
We are a member city, so
[30:11]
please utilize the resources.
[30:12]
Thank you again fr the
[30:13]
presentation for coming
[30:13]
tonight.
[30:15]
>> thank you very much.
[30:17]
>> next agenda item, please.
[30:17]
Er
[30:20]
>> moving on to council
[30:20]
comments/requests.
[30:22]
>> great.
[30:22]
Would who
[30:23]
would like to
[30:23]
-
[30:25]
start
[30:28]
sharing?
[30:30]
>> you're look at me so I
[30:31]
will
[30:31]
go first.
[30:32]
Thank you, MR. Mayor.
[30:38]
A lot of great events that I
[30:40]
attended, the holly event, it
[30:42]
was such a great event to
[30:43]
celebrate our diversity.
[30:46]
It was a avery colorful
[30:47]
event, there's great pictures
[30:49]
of myself and councilmember
[30:51]
nicolas with bright paint on
[30:52]
our face, so I look forward
[30:53]
to
[30:55]
as that event grows every
[30:57]
year, so I'm looking forward
[30:57]
to it.
[30:59]
And I think councilmember
[31:00]
nicolas and I are hoping by
[31:03]
next year we're throwing
[31:03]
paint
[31:04]
-- yeah, so staff might be
[31:09]
freaking out as I say that.
[31:10]
I went to a wonderful event
[31:14]
with the mayor and
[31:18]
councilmember coleman, we
[31:21]
attended the naac99th gala
[31:22]
celebration where there were
[31:24]
leaders across the region
[31:25]
that
[31:27]
celebrate the san mateo
[31:27]
county
[31:29]
chapter and our very own
[31:32]
superintendent of schools,
[31:33]
shantera moore was
[31:34]
recognized,
[31:35]
it was great to see her and
[31:36]
all of the accomplishments
[31:37]
she
[31:38]
was able to put together.
[31:40]
I had a great meeting with
[31:41]
the
[31:41]
westborough water district.
[31:43]
I know staff was there, I'm
[31:45]
going plug them for our
[31:46]
westborough residents, make
[31:48]
sure you pay your water bill
[31:48]
on time.
[31:50]
They have a lot of great
[31:51]
resources and I look forward
[31:52]
to continuing the part naer
[31:55]
ship with the water district
[31:56]
and if heresies any
[31:58]
information they want to
[31:59]
provide in terms of our
[32:01]
constituents, I know that the
[32:02]
mayor would be willing to
[32:05]
provide that information on
[32:05]
to
[32:07]
his newsletter.
[32:09]
And then last week I had a
[32:11]
town hall with about 50
[32:14]
residents and we had a lot of
[32:16]
great questions from the
[32:18]
audience specifically about
[32:20]
traffic, about public safety
[32:23]
and we had the police chief,
[32:25]
the fire chief, public works
[32:26]
and we had a great
[32:27]
presentation about what's
[32:29]
coming in terms of our new
[32:32]
child care center up in
[32:33]
westborough and a lot of
[32:34]
great
[32:36]
feedback from residents, I
[32:38]
know we're following up for w
[32:39]
a lot of residents in term
[32:40]
ofs
[32:40]
their questions, I've been
[32:43]
doing it for the lst 7 years
[32:44]
now, to see all those
[32:46]
residents come out and ask
[32:47]
questions and engaging
[32:48]
witching staff because I know
[32:49]
this is how w can continue
[32:49]
to
[32:51]
engage with our residents and
[32:54]
a lot of things we're able to
[32:58]
accomplish in terms of stop
[33:00]
signs and curbs came from
[33:01]
these town halls, people were
[33:02]
interested how do I get a
[33:02]
stop
[33:03]
sign in my neighborhood and
[33:06]
there's a process for that.
[33:07]
With that, MR. Mayor, that's
[33:08]
all I have, thank you.
[33:10]
>> thank you, councilmember.
[33:13]
Anyone else?
[33:15]
Go ahead, MR. Vice mayor.
[33:17]
>> thank you, mayor flores,
[33:19]
the nice thing about being
[33:24]
vice mayor to a mayor who is
[33:26]
actively involved and a
[33:27]
demanding career is he can't
[33:28]
attend everything so
[33:28]
sometimes
[33:30]
he sends the vice mayor, so
[33:32]
about a week ago on the 19th,
[33:37]
I was out at biomed, the
[33:39]
campus's gateway on oyster
[33:41]
point boulevard for a ribbon
[33:44]
cutting for a new food
[33:44]
vendor,
[33:45]
proper food, and proper food
[33:48]
is moving fast f you go the
[33:52]
san francisco, they're on
[33:53]
every mayor employment
[33:53]
center,
[33:54]
so they have quite a
[33:55]
following
[33:58]
already, so we did a ribbon
[34:00]
cutting and then a tour of
[34:02]
biomed who still remains vry
[34:04]
bullish on what has happened
[34:05]
and will continue to hppen
[34:05]
in
[34:06]
south san francisco.
[34:09]
The next day I found myself
[34:12]
and again the mayor was at
[34:13]
the
[34:14]
skyline college PRESIDENT's
[34:15]
breakfast and that's 7:30 the
[34:17]
morning, as many of you know,
[34:20]
I'm a little older than the
[34:22]
average colleague up here and
[34:27]
I don't do 7:30 willingly
[34:27]
very
[34:28]
often, he convinced he I
[34:31]
needed to be tere, it was my
[34:34]
first time building 12 at
[34:36]
skyline college, it looks out
[34:38]
into the pacific ocean and
[34:40]
it's inspirational, it's an
[34:41]
amazing venue for an event,
[34:45]
they had well over 240 people
[34:48]
there and they had a dj, mc,
[34:52]
and the music was gj quality,
[34:54]
the early hour and the dj
[34:56]
music, I found a table way in
[34:57]
the corner and it worked okay
[34:59]
for me.
[35:02]
The previous saturday on
[35:02]
MARCH
[35:03]
15, I spent a lot hof time
[35:09]
with the mayor lately, he put
[35:10]
together cafecito, this was a
[35:16]
second one, this was on the
[35:22]
star bucks on mclellan drive,
[35:23]
I met new people in the
[35:25]
district and to see them get
[35:27]
involved and care about their
[35:28]
community and one of them is
[35:30]
in the audience tonight,
[35:32]
hello, anne trres, thank you
[35:33]
for joining us.
[35:34]
That's always great to see.
[35:35]
She's been a a resident of
[35:37]
south san francisco since the
[35:39]
70's and to see hr
[35:40]
willingness to get involved
[35:43]
and play a role is truly
[35:44]
remarkable, so it was all
[35:45]
worthwhile.
[35:46]
>> great.
[35:49]
>> and then we found
[35:50]
ourselves
[35:53]
out of south san francisco at
[35:56]
the japan town center for a
[35:56]
special exhibit for our
[35:57]
sister
[35:58]
city in japan is kish shi
[35:59]
watt
[36:00]
ta, the cultural district up
[36:01]
there was doing a rbbon
[36:03]
cutting for a special x
[36:03]
I
[36:04]
exhibit for the three sister
[36:06]
city that is are here in san
[36:06]
-
[36:07]
mateo county.
[36:08]
We were joined by the former
[36:11]
MAY yr of daly city, they
[36:11]
just
[36:13]
initiated just last year or
[36:16]
this year a new sister city
[36:17]
that we'll be visiting
[36:17]
shortly.
[36:19]
This is a a great segway,
[36:19]
I've
[36:20]
mentioned we are looking for
[36:22]
people that might want to
[36:24]
travel to japan with the
[36:25]
sister city's committee, we
[36:26]
are not quite maxed out of
[36:27]
the
[36:28]
trip, there still might be a
[36:29]
a
[36:31]
couple of openings but I
[36:32]
understand that COUNCILWOMAN
[36:33]
Nicolas and her husband might
[36:35]
be joining us so there's even
[36:36]
less space.
[36:40]
Anyway, on SEPTEMBER 12th, we
[36:41]
fly to japan and we don't
[36:43]
return until the 27th but
[36:44]
we're going there to be part
[36:47]
of the sister city
[36:48]
international committee which
[36:51]
is being hosted in diernl not
[36:53]
going to get the name right,
[36:55]
in the small city daly city
[36:57]
is
[36:58]
twined with, we'll spend some
[37:02]
time in osaka, there's an
[37:03]
international expo that goes
[37:05]
for a number of months, we'll
[37:07]
be in osaka for a little bit
[37:09]
and find our way to tokyo
[37:11]
where we'll all be
[37:11]
overwhelmed
[37:12]
by the energy there and fly
[37:14]
home, so there are still
[37:15]
opportunities if you're
[37:15]
interested.
[37:19]
We can send you the itinerary
[37:21]
and the particulars.
[37:24]
And then I guess -- oh, and
[37:27]
I'm looking forward -- very
[37:29]
much looking forward to
[37:29]
monday
[37:32]
MARCH 31, I have rceive add
[37:33]
guarantee from city hall from
[37:34]
the city manager's office
[37:35]
that
[37:39]
on that day, we will begin
[37:39]
removing the derelict vehicle
[37:43]
that is are in the oyster
[37:49]
cove, vao that -- vehicles
[37:50]
that have completely sunk.
[37:52]
Do you know what time we're
[37:52]
starting?
[37:53]
>> I don't know, we will find
[37:53]
out.
[37:55]
>> we're going to start with
[37:56]
ten of the worst vehicles,
[37:58]
pulling them out of the water
[37:59]
and destroying them on-site
[38:01]
and I'm going to cheer every
[38:01]
one of those.
[38:02]
Er
[38:02]
>> just one bit of
[38:03]
information that I haven't
[38:04]
shared with council yet, I
[38:06]
believe three of the vehicles
[38:08]
that we -- or the boats that
[38:11]
we were going to hve
[38:12]
removed,
[38:14]
once they were posted, they
[38:16]
left of their own accord,
[38:16]
each
[38:18]
removal is very costly, so
[38:21]
that was good news to us.
[38:26]
>> monday MARCH 31 out near
[38:26]
the ac mare yo
[38:27]
t hotel, we're
[38:28]
going to get started on that
[38:30]
day and there will be more to
[38:31]
come, thank you, MR. Mayor.
[38:40]
>> tank you, well said.
[38:47]
>> so, I was also able to
[38:50]
attend the naacp gala and I
[38:52]
want to also congratulate the
[38:54]
honorees, also last week I
[38:56]
attended the orange park
[38:58]
memorial pool beam topping
[39:01]
where we signed the last I
[39:02]
guess team that will b used
[39:04]
for the structure of the pool
[39:05]
and they are building that
[39:07]
pool quickly and I can't be
[39:19]
more excited and I guess
[39:21]
weather permissible, I hope
[39:21]
it
[39:22]
will be done soon.
[39:24]
I want to thank everyone for
[39:26]
making that possible.
[39:27]
That is all I have for
[39:28]
tonight.
[39:28]
>> COUNCILWOMAN?
[39:34]
>> and for that kish wad da
[39:36]
trip, we are paying our own
[39:37]
way websinger are making sure.
[39:40]
So, as a testament for us
[39:41]
being an inclusive community,
[39:44]
I did enjoy the holy
[39:46]
celebration and shout-out to
[39:55]
ver con ka ortiz, devon
[39:57]
stenhouse for the celebration.
[40:00]
We don't know that we're
[40:01]
going
[40:03]
to be having a bigger
[40:05]
celebration next year, and
[40:10]
then also I attended on MARCH
[40:13]
20 the third sister
[40:14]
leadership
[40:15]
conference, all of those who
[40:17]
don't know about the sister
[40:18]
and sister leadership
[40:19]
conference, it's something
[40:22]
that's been going on in santa
[40:23]
clara county for the last 30
[40:25]
years, I brought it to san
[40:26]
mateo county three years ago,
[40:28]
the first two years were held
[40:30]
here in the south san
[40:34]
francisco and that's for
[40:34]
asian
[40:36]
american native hawaiian,
[40:38]
pacific islander girls who
[40:38]
are
[40:40]
from sixth grade to high
[40:44]
school and there's a lot of
[40:45]
women empowerment sessions
[40:47]
that we go through making
[40:48]
sure
[40:49]
that they're comfortable and
[40:51]
this year's theme is
[40:52]
embracing
[40:54]
the journey, so they heard
[40:55]
about people who are
[40:57]
successful now and how they
[40:58]
had gone through difficulties
[41:01]
in life and we are -- we keep
[41:03]
on telling them they're more
[41:05]
than enough, so we had the
[41:05]
big
[41:06]
group from -- and I'm so
[41:07]
happy
[41:09]
to have a big group from
[41:13]
westborough middle school in
[41:15]
alta loma, el camino and
[41:16]
south
[41:17]
city high school, so it was a
[41:19]
a wonderful event for all the
[41:20]
young ladies, and I also
[41:21]
would
[41:22]
like to request that we
[41:24]
adjourn the meeting in memory
[41:27]
of one of the persons I met
[41:29]
when we were just beginning
[41:31]
our life here in south san
[41:35]
francisco, he was the founder
[41:38]
of [Inaudible] Dance company,
[41:39]
a filipino dance cmpany
[41:40]
where
[41:43]
my children started dancing,
[41:44]
filipino folk dancing and
[41:46]
having the love for art and
[41:46]
is
[41:52]
music, his name is bonafo sta
[41:56]
balera junior and MS.
[41:57]
Maurice
[41:58]
copia and MAY their memories
[41:59]
serve as a blessing.
[42:00]
>> I appreciate that, the
[42:01]
good
[42:02]
thing about being mayor is
[42:03]
all
[42:05]
of you share the places we've
[42:06]
already been so I say check,
[42:09]
check, check, thank you to
[42:09]
the
[42:09]
va
[42:10]
is mayor for subbing in.
[42:12]
A lot of folks don't realize
[42:14]
that being mayor and being
[42:16]
councilmember, it naoets a
[42:19]
full
[42:19]
time job, many of us have a
[42:20]
full time job like many of
[42:20]
you
[42:21]
working 8-5 five day as week
[42:22]
so I appreciate that very
[42:22]
much
[42:23]
to be able to cover, I'm
[42:24]
grateful to the resident and
[42:26]
is the community members that
[42:28]
stopped by for our cafecito
[42:30]
with the myor x the vice
[42:33]
mayor, it's not just district
[42:34]
1 residents, there were just
[42:36]
like the last cafecito we
[42:37]
had,
[42:38]
residents from all over south
[42:40]
san francisco and this is
[42:42]
really what it is, it's
[42:43]
bringing different
[42:44]
neighborhoods together, it's
[42:45]
a
[42:46]
a little national night out
[42:46]
on
[42:47]
a saturday morning with
[42:48]
coffee
[42:50]
so it's great to see some
[42:52]
parents stop by on their way
[42:53]
to baseball practice or other
[42:55]
endeavors on a saturday
[42:56]
morning, but building
[42:56]
xhaoent,
[42:58]
it's really what it's about.
[42:59]
There's still many
[42:59]
individuals
[43:00]
that say, you live right
[43:02]
there, I liver right there,
[43:04]
you work right there, I'm a
[43:05]
history buff as the vice
[43:06]
mayor
[43:09]
knows and hearing about the
[43:11]
old macy's warehouses before
[43:13]
the costco years here in
[43:13]
south
[43:14]
city is a great time so I
[43:15]
appreciate that and we do it
[43:16]
in different ways.
[43:18]
We engage with our community
[43:19]
in different ways.
[43:22]
I was also happy to join
[43:23]
councilmember nagales at his
[43:24]
community meeting as well
[43:25]
websinger ear out there and
[43:26]
connecting and sharing the
[43:27]
information so I appreciate
[43:30]
all of you, everyone is
[43:30]
welcome, stay tuned because
[43:31]
we
[43:32]
have many more coming during
[43:34]
the course of this year.
[43:36]
Indeed I attended some of the
[43:37]
ve lents that were already
[43:37]
shared.
[43:39]
I do want to point a little
[43:40]
bit of some of the work I'm
[43:43]
doing here with the support
[43:46]
of our city staff and city
[43:47]
manager.
[43:49]
We hosted and met our new
[43:52]
assembly member and the state
[43:52]
legislature, catherine
[43:54]
stephanie who represents
[43:55]
assembly dstrict 19, we
[43:57]
hosted her last week at south
[44:00]
city at our city hall and
[44:01]
discussed many important
[44:03]
policy issues, many assembly
[44:04]
bills but also things that
[44:04]
are
[44:06]
really important to south san
[44:08]
francisco and this is a great
[44:10]
opportunity to really say
[44:10]
this
[44:12]
has been something that has
[44:14]
ben filets our community and
[44:16]
we need additional support on
[44:18]
this, she was extremely open,
[44:20]
extremely welcoming and
[44:21]
extremely willing to work,
[44:21]
her
[44:22]
and her team, I want to
[44:24]
acknowledge and recognize we
[44:25]
have a strong -- another
[44:28]
representative in the state
[44:28]
legislature.
[44:29]
We're very lucky here in
[44:30]
south
[44:31]
san francisco, we have two
[44:33]
state senators covering, we
[44:35]
have two assembly members, we
[44:37]
have two also members of the
[44:38]
san mateo county board of
[44:40]
supervisors, we have two san
[44:42]
mateo county board of
[44:44]
education trustees, so we're
[44:45]
-- we're well represented and
[44:50]
again it's about advocacy,
[44:52]
it's about ensuring that our
[44:54]
policy priorities that we
[44:54]
will
[44:56]
discuss later are well spoken
[44:59]
for as well.
[45:00]
I did want to talk about
[45:02]
upcoming and you'll start
[45:05]
seeing some of the promotions
[45:07]
websinger are on APRIL 5 and
[45:08]
I
[45:09]
believe the 19th, we're
[45:10]
moving
[45:12]
forward with south san
[45:13]
francisco neighborhood
[45:13]
cleanup.
[45:15]
In particular, kick it off in
[45:18]
some of the areas most
[45:19]
affected, downtown, old town
[45:21]
where we see a lot of illegal
[45:21]
dumping.
[45:27]
We kicked tis off last year,
[45:28]
it was extremely successful.
[45:28]
Thank tos the support of our
[45:29]
staff, we couldn't do it,
[45:30]
also
[45:30]
our volunteer, people that
[45:32]
came out early on saturday
[45:32]
and
[45:34]
we held it it on sunday, this
[45:36]
year is both on saturdays,
[45:40]
this is part of an initiative
[45:42]
I'm so thrilled about, clean
[45:44]
ssf, part of that we envision
[45:46]
providing you with some
[45:48]
shovels, sme picks and some
[45:50]
garbage bag and is lending
[45:50]
you
[45:53]
some gloves and come out and
[45:55]
build community, cleaning up
[45:56]
our neighborhoods, you'll see
[45:57]
that on social media, you'll
[45:59]
see that in my newsletter
[46:01]
coming up so I want to
[46:02]
welcome
[46:04]
all residents, even visitors
[46:06]
of south san francisco to
[46:08]
partake and join me and staff
[46:13]
and let's clean up south san
[46:13]
francisco.
[46:15]
With that in mind, I'm excite
[46:16]
ted share with our city
[46:18]
manager that south san
[46:20]
francisco should be pursuing
[46:21]
the [Inaudible] Designation,
[46:23]
that is the clean california
[46:23]
designation.
[46:24]
I would like the share that,
[46:27]
this is a special initiative
[46:30]
designation put on by the
[46:31]
governor's office and managed
[46:33]
by cal trans and it really
[46:35]
honors communities that are
[46:37]
dedicated to doing something
[46:38]
about it, not just saying,
[46:40]
well, we got to blame so and
[46:42]
so or that agency has to come
[46:44]
up and step up for us, so it
[46:47]
really brings a sense of
[46:48]
community, it's improving the
[46:50]
health, it's improving our e
[46:51]
economy and it's really aso
[46:58]
as part of this designation,
[46:58]
it's allowing south city to
[47:00]
apply for money torx apply
[47:00]
for
[47:01]
grants that potentially could
[47:04]
support us in continuing to
[47:07]
clean up south city and all
[47:08]
locations in every area that
[47:13]
you can imagine, so, the
[47:13]
first
[47:15]
hundred designated
[47:16]
communities
[47:16]
will continue to receive this
[47:17]
resource.
[47:18]
There are already cities,
[47:19]
bakersfield, fresno, irvine,
[47:21]
la, can dewing that are part
[47:22]
of this initiative and I want
[47:23]
to se our city be
[47:23]
represented
[47:24]
as well.
[47:26]
Now just turning a little
[47:28]
different lens, I did want to
[47:30]
ask our city manager if we
[47:31]
could look into two items
[47:32]
that
[47:34]
I've been monitoring as I'm
[47:36]
driving around connecting
[47:36]
with
[47:37]
neighborhoods and different
[47:39]
shopping centers, there are
[47:40]
certain donation insets in
[47:41]
various parking lotuses and
[47:43]
shopping centers, one in
[47:46]
particular is the parking lot
[47:48]
right behind five guys
[47:48]
burgers
[47:49]
in westborough square, as I
[47:55]
was there this weekend, it
[47:58]
wasn't a nice sited to look
[48:00]
at, I would like to see if we
[48:02]
could work with the donation
[48:04]
vendor, how often they clean
[48:06]
up and that sort of thing.
[48:07]
The oher thing I started
[48:10]
noticing is on weekends, many
[48:13]
amazon trucks are parking for
[48:15]
more than whatever it is,
[48:18]
saturdays and sundays, taking
[48:19]
up perhaps a parking lot that
[48:21]
could be for residents so I
[48:23]
want to look at are there
[48:26]
amazon parking lots that are
[48:27]
designated, in particular in
[48:28]
district 5, I'm seeing in
[48:29]
many
[48:31]
of our surface city parking
[48:34]
lotuses, there's a lot of
[48:35]
amazon distribution delivery
[48:36]
trucks on there, so I would
[48:37]
like to follow up and discuss
[48:39]
a little bit on that.
[48:41]
>> we're happy to do that.
[48:43]
>> thank you.
[48:48]
Lastly I want to adjourn in
[48:52]
the memory of jose flores.
[48:54]
He passed away suddenly this
[48:54]
mo
[48:57]
bt, I met jose at my
[48:59]
swearing in this past
[49:03]
DECEMBER, he's the father of
[49:04]
douglas cotoad1 resident and
[49:05]
a
[49:07]
graduate of our citizens
[49:09]
academy, I would like to
[49:09]
honor
[49:11]
and my his manly continue to
[49:12]
be a blessing for all tloez
[49:16]
and equally with the names
[49:17]
that COUNCILWOMAN Flor
[49:17]
nicolas
[49:19]
shared, our condolences to
[49:20]
those families and loved ones.
[49:23]
Thank you, that's all I had.
[49:24]
Next agenda item, please.
[49:25]
>> thank you, mayor, we will
[49:26]
now move on to public comment
[49:29]
and is we will begin with
[49:38]
cynthia markopoulos.
[49:40]
>> good evening, at the
[49:42]
JANUARY 9, 1985 city council
[49:46]
meeting, the clerk's minutes
[49:47]
documented mayor hafy's
[49:49]
comments about the surplus
[49:51]
magnolia building stating "to
[49:52]
provide housing was important
[49:55]
but should not overshadow the
[49:56]
senior center and I should
[49:57]
be
[49:58]
revitalized for seniors and
[50:00]
use of the community".
[50:02]
The most recent e-mail to
[50:05]
attendees of magnolia teglia
[50:08]
center is they will be
[50:13]
relocated to the bola center
[50:14]
for months, and mingling
[50:14]
adult
[50:16]
widths daycare center where
[50:18]
mayor edie said it was a
[50:21]
concern having adults with
[50:23]
young kids.
[50:25]
I agree with you, mayor
[50:25]
eddie,
[50:26]
that history is important
[50:28]
learning about macy's
[50:30]
warehouse, etc., the
[50:32]
historical society and
[50:33]
library
[50:34]
have limited if no
[50:35]
information
[50:38]
on the msb even though they
[50:40]
had orange library grand
[50:43]
avenue's information as well.
[50:44]
As we witnessed over decades
[50:46]
in history, it is to wipe out
[50:48]
any mem ray or eliminate any
[50:50]
significance of something but
[50:52]
we have researched the past
[50:54]
thorough clerk's minutes over
[50:57]
the past six decades
[50:58]
documenting the importance of
[51:00]
the msb and we will not let
[51:03]
you forget it especially when
[51:04]
30% of our population is 55
[51:07]
years and older and that the
[51:09]
msb had 188 thousand visitors
[51:11]
annually and was the most
[51:11]
used
[51:14]
facility as noted in jim
[51:15]
steel's staff report.
[51:18]
I copied each of you in an
[51:21]
e-mail to marie patea, not
[51:21]
one
[51:21]
replay
[51:23]
f mri for you, I put
[51:25]
in a public records request
[51:27]
dated MARCH 14 and I received
[51:29]
an extension on MARCH 24
[51:30]
specifically addressing the
[51:32]
special city council meeting
[51:33]
of APRIL 29.
[51:35]
Let hope in fairness it is
[51:37]
complied with in ample time
[51:39]
before the 29th meeting
[51:40]
concerning the msb.
[51:43]
Thank you.
[51:45]
>> thank you, MADAM City
[51:46]
manager, can you confirm the
[51:47]
date, time and location for
[51:49]
the upcoming meeting, please.
[51:52]
>> for the msb study session?
[51:53]
>> yes.
[51:55]
>> it's wednesday APRIL 29
[51:57]
here at the library parks and
[51:58]
recreation council chambers
[51:59]
at
[51:59]
6:30.
[52:02]
>> thank you.
[52:04]
>> thank you, mayor, if I MAY
[52:05]
add for that specific
[52:06]
meeting,
[52:09]
we intend to have the agenda
[52:11]
published by friday APRIL 25.
[52:12]
>> thank you.
[52:29]
Moving on the sam ch icuti.
[52:33]
>> mayor flores, board
[52:33]
member,
[52:34]
south san francisco city
[52:36]
council, my name is sam, I'm
[52:38]
glad that the city council
[52:38]
has
[52:40]
finally decided to have a
[52:41]
special meeting for the msb
[52:43]
next month on the 29th.
[52:44]
After all, it's only been two
[52:48]
and a half years.
[52:50]
I suppose that the city
[52:51]
council imagined that the
[52:52]
coalition of citizens against
[52:53]
tearing down the msb would
[52:57]
have dissipated by now.
[52:59]
That in and of itself is
[53:00]
short
[53:01]
sighted by this council.
[53:04]
As you have heard in past
[53:06]
meetings, more than 30% of
[53:09]
south san francisco residents
[53:10]
are retired, will be retired
[53:13]
or are close to retirement in
[53:15]
a very short period of time.
[53:20]
I recently saw a youtube
[53:20]
video
[53:22]
of the city council meeting
[53:23]
of
[53:23]
last AUGUST.
[53:24]
In this video, the city
[53:27]
planner of south san
[53:27]
francisco
[53:29]
tony said almost all
[53:29]
available
[53:31]
parcels of land owned by
[53:31]
south
[53:33]
san francisco have been or
[53:34]
are
[53:35]
being developed.
[53:37]
What exactly is the city
[53:38]
council's outlook for south
[53:39]
san francisco?
[53:40]
Do they see south san
[53:45]
francisco as a mini me to san
[53:46]
francisco?
[53:47]
Additional apartments are not
[53:48]
the answer to those that have
[53:50]
been residents of south san
[53:51]
francisco for decades.
[53:53]
Community center where w can
[53:56]
can gather is a necessity for
[53:58]
an aging populous.
[53:59]
The magnolia center is
[54:01]
certainly not the answer, it
[54:03]
can barely accommodate the
[54:04]
people going there now.
[54:07]
What will happen when more
[54:08]
people become seniors?
[54:10]
Is this council's answer to
[54:11]
go
[54:13]
to the senior center in san
[54:14]
bruno?
[54:16]
Save the msb as a community
[54:18]
center for us, thank you.
[54:21]
>> thank you.
[54:37]
Next up.
[54:39]
>> a correction to the
[54:39]
meeting
[54:43]
is tuesday APRIL 29th, thank
[54:43]
you.
[54:45]
>> my apologies.
[54:47]
>> now we're moving on to
[54:50]
tony
[54:58]
allen.
[55:01]
>> good evening, my name is
[55:08]
tony alan, I live near loss
[55:10]
aritos, I wanted to just say
[55:13]
thank you for your newsletter
[55:16]
that comes out, mayor eddie,
[55:19]
and I host english language
[55:21]
students and I have students
[55:23]
often that are spanish
[55:24]
speaking or speak another
[55:26]
language and I just really
[55:27]
appreciate that your
[55:29]
newsletter gave a whole lot
[55:30]
of
[55:31]
good information about how
[55:33]
inclusive and diverse and how
[55:37]
south san francisco really
[55:39]
values our diversity and our
[55:41]
inclusiveness and that you
[55:43]
gave great resources and so
[55:44]
please, I hope we continue to
[55:46]
do that.
[55:47]
I obviously came at the right
[55:52]
time, I'm also an adu person
[55:54]
and so I'm proud of south san
[55:55]
francisco and I just wanted
[55:56]
to
[55:56]
mention that.
[55:57]
Thank you.
[56:01]
>> thank you.
[56:18]
>> fianola?
[56:21]
>> good evening,
[56:22]
councilmembers, and everyone
[56:28]
in the auditorium and
[56:29]
watching.
[56:31]
In 1977, the city exercised
[56:31]
an
[56:34]
option to purchase the value
[56:39]
giant, also known as the
[56:42]
municipal services building.
[56:45]
1977.
[56:47]
You exercised the option and
[56:54]
you purchased the building.
[56:59]
That was quite a while ago.
[57:04]
Now, in part, you needed
[57:05]
extra
[57:06]
space, documents, proof, one
[57:08]
of the things you needed
[57:08]
extra
[57:10]
space for was a senior
[57:11]
center,
[57:13]
so you dedicated space at the
[57:19]
msb for a senior center.
[57:20]
Where MR. Rozzi is that
[57:22]
documented in the
[57:23]
environmental impact report
[57:28]
with respect to with drawing
[57:28]
a
[57:30]
senior center, a dedicated
[57:32]
senior center from tens of
[57:41]
thousands of peopl
[57:42]
in this city, where is that
[57:43]
environmental impact report,
[57:43]
it's supposed to
[57:45]
document significant impacts,
[57:48]
not documented.
[57:50]
In addition, you put a
[57:54]
proposition on the ballot to
[57:57]
reimburse you for the payment
[58:01]
of 1.39 million dollars for
[58:04]
that property.
[58:08]
You assessed 5 cents per
[58:11]
hundred dollars, per hundred
[58:16]
dollars, 5 cents, for 20
[58:16]
years
[58:19]
on taxable property in this
[58:20]
city.
[58:23]
We paid for that building
[58:24]
over
[58:26]
there, property owners did.
[58:30]
Where's the money?
[58:33]
I asked for an accounting of
[58:34]
where that money is.
[58:34]
How much money did you
[58:35]
collect?
[58:38]
You know, roughly speaking,
[58:44]
let's say 44 thousand dollars
[58:46]
was paid by a property over
[58:50]
the 20 years, that's 350
[58:52]
properties to cover that
[58:53]
price, okay.
[58:56]
Where is the money?
[58:57]
I've requested that money --
[58:59]
the accounting of that money
[59:03]
from the city, mo response of
[59:04]
records, I wonder why.
[59:06]
The msb has been a cash cow
[59:09]
for you as you know including
[59:10]
the fire department which
[59:12]
turned out to be political
[59:16]
suicide, didn't it, MR.
[59:16]
Addiego.
[59:17]
Where's the money?
[59:18]
Thank you.
[59:23]
>> thank you.
[59:33]
>> judy?
[59:34]
>> my name's judy, I have
[59:35]
been
[59:38]
a a resident of south city
[59:39]
since 1963, this is my home,
[59:39]
I
[59:41]
love it and I hate some of
[59:41]
the
[59:42]
changes I'm seeing.
[59:45]
I would hate to see the msb
[59:48]
building gone because we need
[59:52]
it for groups.
[59:53]
AUGUST 24, 2019, I was
[59:55]
diagnosed with advanced
[59:55]
breast
[59:56]
cancer.
[59:58]
What I found is that there is
[1:00:00]
no breast cancer support
[1:00:02]
group
[1:00:03]
anywhere near, the closest
[1:00:03]
one
[1:00:04]
was san francisco which I
[1:00:06]
don't care to g to at night.
[1:00:10]
The other one was palo alto,
[1:00:11]
that building would be
[1:00:11]
perfect
[1:00:13]
for a breast cancer support
[1:00:13]
group.
[1:00:16]
One in every four women get
[1:00:18]
breast cancer during their
[1:00:19]
lifetime and you need the
[1:00:19]
support.
[1:00:21]
I am currently in remission
[1:00:24]
but I'm not cancer free.
[1:00:25]
So, -- ask it was tough
[1:00:27]
because like I said, 2019,
[1:00:27]
the
[1:00:30]
end of it, I was diagnosed,
[1:00:32]
I'm -- I'll keep my time,
[1:00:33]
eddie, don't worry.
[1:00:34]
>> she hadn't started.
[1:00:35]
Er
[1:00:37]
>> that's okay, I'm aware,
[1:00:39]
anyway, when I started, it
[1:00:39]
was
[1:00:42]
beginning of covid, going for
[1:00:44]
cancer treatment, they're
[1:00:46]
phenomenal at ucsf, during
[1:00:48]
that time it was scary and
[1:00:49]
not
[1:00:50]
having a support system,
[1:00:52]
you're in your home, you're
[1:00:56]
isolating, it was very
[1:00:58]
depressing and to be in your
[1:01:01]
home alone fr years because
[1:01:08]
you're immune -- immune know
[1:01:09]
fomented was horrible ad I
[1:01:11]
would like the start one in
[1:01:12]
that building as soon as we
[1:01:14]
decide not to demolish it,
[1:01:15]
thank you.
[1:01:16]
>> just for your information,
[1:01:18]
so just for your iformation
[1:01:20]
for breast cancer support
[1:01:22]
group, contact bay area
[1:01:22]
cancer
[1:01:24]
connections and this is in
[1:01:24]
san
[1:01:27]
mateo county.
[1:01:29]
>> thank you, mayor, that
[1:01:30]
concludes anyone registered
[1:01:30]
to
[1:01:31]
speak.
[1:01:32]
Do we have anyone else in the
[1:01:33]
audience that did not
[1:01:34]
register?
[1:01:37]
Go ahead.
[1:01:39]
F you don't mind coming up to
[1:01:40]
the mic., please, thank you.
[1:01:41]
Just so everyone at home can
[1:01:42]
hear you.
[1:01:45]
>> I was wondering, I heard
[1:01:48]
archer aviation is going to
[1:01:49]
be
[1:01:50]
flying this year, is that
[1:01:50]
true
[1:01:55]
in south city?
[1:01:57]
>> sorry, we can't respond to
[1:01:58]
public comment.
[1:02:00]
>> that's basically -- it was
[1:02:02]
more of a question than a
[1:02:02]
statement.
[1:02:03]
That's it.
[1:02:05]
That was basically it.
[1:02:06]
>> MADAM City manager, if you

for the record, we received

and you should all receive in

[1:02:25]
>> great, thank you, that has
[1:02:25]
been received.
[1:02:28]
>> thank you, moving on to

Item 6 is a report regarding

san francisco in order to
[1:03:43]
prioritize housing applicants
[1:03:45]
who live and/or work in the
[1:03:46]
city.
[1:03:48]
Item 8a is the ordinance.
[1:03:50]
>> thank you, are there any
[1:03:52]
members who wuld like to
[1:03:52]
pull
[1:03:53]
any agenda items?
[1:03:55]
>> item 6 and 7.
[1:03:56]
>> 6 and 7.
[1:03:57]
Anyone else?
[1:03:59]
Okay.
[1:04:01]
I'm okay with doing those
[1:04:01]
right now.
[1:04:04]
So we'll start with item 6.
[1:04:09]
>> let me promote our staff
[1:04:11]
here.
[1:04:13]
She's online, are you going
[1:04:14]
to
[1:04:18]
talk, I'm going promote her.
[1:04:22]
>> who are we talking to?
[1:04:24]
>> she's coming, adrianna.
[1:04:25]
Here she is.
[1:04:28]
>> is she here?
[1:04:28]
Okay.
[1:04:32]
So, this item has to do with
[1:04:35]
roughly an one acre piece of
[1:04:35]
property that's out a the
[1:04:36]
marina with wr
[1:04:36]
the harbor
[1:04:38]
master is and it's habitually
[1:04:41]
under water when we have king
[1:04:43]
tides to an amazing degree.
[1:04:44]
We've identified some money
[1:04:48]
but I just need to understand
[1:04:49]
we were aarded a grant and
[1:04:50]
we
[1:04:51]
have to match the grant with
[1:04:53]
like amount of dollars but
[1:04:55]
that grant has expired, so
[1:04:56]
can
[1:04:57]
you explain to me the
[1:04:59]
mechanism that is going to
[1:05:03]
ensure that we have
[1:05:03]
participation.
[1:05:04]
>> yes, of course.
[1:05:07]
So, we've had this fnding
[1:05:08]
agreement ongoing.
[1:05:11]
It's kind of a logistical
[1:05:13]
funding agreement adjustment.
[1:05:16]
We applied for an extension
[1:05:18]
and the ta denied that and
[1:05:22]
said they wanted to create a
[1:05:23]
new funding agreement.
[1:05:25]
All of our invoices will
[1:05:25]
still
[1:05:27]
be paid between the gap of
[1:05:27]
the
[1:05:29]
old funding agreement and the
[1:05:31]
new one.
[1:05:32]
Yeah, did that answer your
[1:05:33]
question, councilmember?
[1:05:35]
>> so, the invoices that
[1:05:36]
we've
[1:05:37]
incurred to date are going to
[1:05:39]
be covered by the ta grant?
[1:05:40]
>> correct.
[1:05:41]
>> and then moving ahead once
[1:05:44]
we have the design for how
[1:05:47]
we're going to improve that
[1:05:52]
air -- area so it's not
[1:05:53]
overtaught with water, the
[1:05:55]
water would eventually
[1:05:57]
penetrate the landfill and be
[1:05:58]
an environmental disaster, so
[1:06:00]
where do we expect to find
[1:06:02]
funds potentially for the
[1:06:04]
actual construction?
[1:06:06]
>> excellent question.
[1:06:07]
Currently we have a
[1:06:08]
consultant
[1:06:10]
looking into feasible gants
[1:06:12]
to cover this construction.
[1:06:14]
We are at the beginning
[1:06:15]
phases
[1:06:17]
of grant research and I can
[1:06:19]
certainly update you as we
[1:06:20]
look into our options.
[1:06:22]
>> okay.
[1:06:23]
Thank you, that's all I have.
[1:06:26]
>> thank you.
[1:06:30]
Item number 7?
[1:06:31]
>> who's going to help me
[1:06:33]
with
[1:06:35]
that?
[1:06:37]
So, MR. Wilson.
[1:06:41]
So, is tere a list of
[1:06:42]
projects that we've already
[1:06:44]
determined are going to be
[1:06:47]
part of this ramp and path
[1:06:50]
million dollar project?
[1:06:51]
>> good evening, honorable
[1:06:53]
members tof council, johnny
[1:06:55]
wilson, your associate
[1:07:01]
engineer with the engineering
[1:07:01]
department.
[1:07:03]
So, your question is with
[1:07:05]
regard to the scope of the
[1:07:07]
project, yeah.
[1:07:12]
Approximately 80 curb ramps
[1:07:13]
distributed roughly equally
[1:07:15]
among the five districts.
[1:07:16]
>> that was the next
[1:07:17]
question,
[1:07:17]
that's great, so that list
[1:07:18]
can
[1:07:18]
be shared?
[1:07:20]
>> yeah.
[1:07:21]
Just putting together a
[1:07:23]
website for it, I've got a
[1:07:23]
map
[1:07:24]
that's ready.
[1:07:28]
As soon as this project is
[1:07:29]
created, I'll create that
[1:07:30]
website and share that map,
[1:07:33]
it's teed up and ready to go
[1:07:36]
and we're also constructing
[1:07:36]
an
[1:07:38]
accessible path to cypress
[1:07:38]
and
[1:07:39]
pine park, that's the other
[1:07:40]
component.
[1:07:42]
>> for downtown?
[1:07:43]
That's great, I just needed
[1:07:44]
to
[1:07:45]
know there was something we
[1:07:46]
could see where the money
[1:07:49]
might be allocated, so thank
[1:07:49]
you.
[1:07:52]
>> aisle be happy to share
[1:07:55]
with you, tomorrow I'll be
[1:07:56]
working on the website.
[1:07:58]
>> thank you, having no other
[1:07:59]
items being pulled, could I
[1:08:01]
have a a motion to approve
[1:08:01]
the
[1:08:02]
consent agenda?
[1:08:02]
>> so moved.
[1:08:03]
>> I'll scond.
[1:08:04]
>> first and second, can can
[1:08:07]
have a roll call, please.
[1:08:08]
>> councilmember coleman?
[1:08:09]
>> yes.
[1:08:10]
>> vice mayor addiego?
[1:08:12]
>> yes.
[1:08:12]
>> coupes member nicolas?
[1:08:17]
>> aye.
[1:08:18]
>> cuncilmember nagales?
[1:08:18]
>> yes.
[1:08:19]
>> and mayor flores?
[1:08:19]
>> yes, motion passes.
[1:08:20]
>> moving on to
[1:08:20]
administrative
[1:08:22]
business, item 9 is a report
[1:08:23]
regarding the 2024 general
[1:08:25]
plan and housing element
[1:08:40]
annual progress reports.
[1:08:42]
>> good evening,
[1:08:42]
councilmembers, billy gross
[1:08:47]
with the planning division.
[1:08:49]
Myself and stephanie will be
[1:08:51]
here for our yearly annual
[1:08:52]
progress reports on the
[1:08:55]
general plan and housing
[1:08:56]
element.
[1:08:58]
So I'll go through just a few
[1:08:59]
slides that talk about
[1:08:59]
actions
[1:09:01]
that happened in 2024 for the
[1:09:03]
general plan and then
[1:09:04]
stephanie will go through the
[1:09:08]
housing element for the 2024
[1:09:09]
progress.
[1:09:10]
As you'll recall, the current
[1:09:13]
general pan was adopted in
[1:09:14]
2022 and continues to be
[1:09:16]
consistent with all state
[1:09:17]
requirements.
[1:09:18]
There were no amendment ts
[1:09:20]
the general plan has were
[1:09:23]
adopted in 2024.
[1:09:24]
This chart shows when each of
[1:09:26]
the required elements was
[1:09:26]
last
[1:09:27]
updated, all of these
[1:09:31]
occurring in e ver 2022 or
[1:09:33]
2023 when we adopted the
[1:09:38]
lindenville specific plan.
[1:09:40]
Attachments 1 and 2 to your
[1:09:41]
staff report are the detailed
[1:09:44]
general plan implementation
[1:09:44]
tables showing the current
[1:09:48]
status of each of the 764
[1:09:49]
policy ins actions within the
[1:09:50]
general plan.
[1:09:52]
Items that you see that are
[1:09:54]
highlighted in yellow
[1:09:54]
indicate
[1:09:56]
an updated entry from last
[1:09:57]
year.
[1:09:58]
The majority of the these are
[1:10:00]
descriptions of progress in
[1:10:02]
2024 in the notes column but
[1:10:03]
there are others that MAY
[1:10:06]
indicate a change in status
[1:10:09]
or
[1:10:10]
timeframe.
[1:10:11]
This chart which is also
[1:10:14]
included in the staff report
[1:10:15]
indicates implementation
[1:10:17]
status by element.
[1:10:18]
Overall, items cnsidered
[1:10:21]
either complete or ongoing
[1:10:24]
have increased from 51 to 55
[1:10:24]
percent.
[1:10:26]
Items considered under way
[1:10:28]
have increased from 16 to 19
[1:10:31]
percent and items with no
[1:10:33]
action have decreased from
[1:10:33]
33%
[1:10:34]
to 26 percent s we are
[1:10:36]
continuing to make progress
[1:10:37]
in
[1:10:41]
all of these actions and
[1:10:41]
policies.
[1:10:43]
And for the general plan
[1:10:44]
progress report, the last
[1:10:45]
thing I wanted to highlight
[1:10:47]
was the data dashboard.
[1:10:48]
This is intended to assist in
[1:10:49]
trag tr
[1:10:50]
tracking
[1:10:51]
implementation progress on
[1:10:52]
performance measure that is
[1:10:54]
were identified in the
[1:10:54]
general
[1:10:55]
plan.
[1:10:55]
The dashboard has been
[1:10:56]
updated
[1:10:58]
with the most recent data
[1:10:58]
that
[1:11:00]
is currently accessible if
[1:11:01]
available.
[1:11:03]
We have also worked with our
[1:11:05]
website consultant team to
[1:11:06]
provide documentation on how
[1:11:07]
the data for each performance
[1:11:09]
measure is obtained and that
[1:11:10]
documentation is now
[1:11:11]
available
[1:11:13]
on the dashboard which can be
[1:11:16]
found on the general plan
[1:11:20]
website shape ssf.Net under
[1:11:21]
measuring progress, with that
[1:11:23]
I'm going the hand it over to
[1:11:24]
stephanie to talk to you
[1:11:24]
about
[1:11:25]
the housing elements progress
[1:11:33]
and I'm happy to answer any
[1:11:34]
questions you haver after
[1:11:34]
that.
[1:11:35]
>> thank you, billy.
[1:11:37]
>> good evening, thank you,
[1:11:38]
billy.
[1:11:40]
Stephanie skangos with the
[1:11:43]
planning division.
[1:11:44]
As billy mentioned, I will be
[1:11:46]
going over the housing
[1:11:47]
element
[1:11:48]
annual progress report.
[1:11:50]
Just to offer a quick little
[1:11:52]
recap, what is the husing
[1:11:53]
element?
[1:11:54]
The housing element is one of
[1:11:55]
the 7 state mandated elements
[1:11:58]
of the general plan.
[1:11:59]
Although unlike the other
[1:12:01]
elements of a general plan,
[1:12:04]
the housing element must be
[1:12:04]
updated by deadlines set by
[1:12:06]
the state.
[1:12:09]
The t city adopted a new
[1:12:12]
housing element in JANUARY of
[1:12:12]
2023 and the department of
[1:12:13]
housing and community
[1:12:15]
development or hcd certified
[1:12:16]
our housing element in
[1:12:18]
NOVEMBER 2023.
[1:12:20]
And this new housing element
[1:12:21]
covers a planning cycle
[1:12:26]
running from JANUARY 31, 2023
[1:12:28]
through JANUARY 31, 2031, so
[1:12:30]
an 8 year period.
[1:12:32]
And again the housing element
[1:12:34]
is essentially the blueprint
[1:12:35]
for future housing
[1:12:36]
development
[1:12:38]
within the city ad it
[1:12:39]
includes goals, policies and
[1:12:41]
programs that will direct
[1:12:45]
residential decision-making.
[1:12:48]
The housing element -- sorry.
[1:12:49]
The housing element process
[1:12:52]
begins with the state setting
[1:12:53]
a regions regional housing
[1:12:55]
needs allocation or rhna
[1:12:56]
which
[1:12:57]
is the estimated number of
[1:12:59]
housing units that will be
[1:13:01]
needed over the 8 year
[1:13:04]
planning cycle to assist with
[1:13:05]
regional growth and trends.
[1:13:10]
The 8 year cycle for rhna
[1:13:10]
does
[1:13:13]
differ slightly by about 6
[1:13:15]
months t rhna cycle run from
[1:13:18]
JUNE 30, 2022 through
[1:13:18]
DECEMBER
[1:13:19]
15, 2030.
[1:13:21]
It's important to note with
[1:13:22]
rhna that these units don't
[1:13:25]
need to be constructed during
[1:13:27]
the time period, but the city
[1:13:29]
is required to ensure that it
[1:13:31]
is possible to build these
[1:13:33]
units trough appropriate
[1:13:34]
zoning.
[1:13:35]
New units are counted towards
[1:13:38]
rhna at the time of building
[1:13:39]
permit issuance and this
[1:13:42]
applies for all new
[1:13:44]
residential unit tpes,
[1:13:44]
single
[1:13:47]
family dwellings, accessory
[1:13:48]
dwelling units, duplexes,
[1:13:52]
duplexes and our larger
[1:13:54]
multifamily buildings.
[1:13:58]
The current rhna cycle sixth,
[1:14:01]
we were -- sorry, we were
[1:14:04]
tasked with our
[1:14:05]
responsibility
[1:14:10]
of 3956 units over the 8 year
[1:14:12]
period.
[1:14:14]
The rhna allocation is
[1:14:15]
further
[1:14:18]
divided into income levels.
[1:14:20]
There are four category, very
[1:14:22]
low, low, mod wrath rat and
[1:14:23]
above moderate.
[1:14:24]
These income categories are
[1:14:27]
based on the area median
[1:14:29]
income that is set by hcd for
[1:14:33]
each county.
[1:14:36]
The 2024ami for san mateo
[1:14:39]
county is 186 thousand 600
[1:14:40]
dollars.
[1:14:44]
Very low category is
[1:14:48]
30-50%ami, low is between
[1:14:52]
50-80%ami, moderate falls
[1:14:54]
between 80-120%ami and above
[1:14:56]
moderate is more tan 100%
[1:14:59]
ami, so you can see the
[1:15:02]
allotment for the total rhna
[1:15:04]
numbers of 3956, the majority
[1:15:07]
of which are uder the above
[1:15:14]
moderate category.
[1:15:15]
For 2024, the city is
[1:15:16]
reporting building permit
[1:15:20]
issuance for a total of 62
[1:15:20]
new
[1:15:21]
residential units.
[1:15:24]
This includes 6 sing m family
[1:15:26]
homes, 6 small multifamily
[1:15:29]
units which are units located
[1:15:32]
within 2-4 unit structures,
[1:15:33]
and 50adu's.
[1:15:36]
Again, new units that receive
[1:15:37]
building permit issuance
[1:15:40]
during the reported year are
[1:15:42]
what is counted towards the
[1:15:44]
current rhna allocation.
[1:15:47]
In addition to the new units
[1:15:50]
issued, a tet of 255 new
[1:15:51]
residential units were
[1:15:52]
finagled or received a
[1:15:55]
certificate of occupancy in
[1:15:59]
the 2024 reporting year.
[1:16:01]
The city also approved
[1:16:02]
planning entitlements for
[1:16:02]
five
[1:16:03]
new residential units during
[1:16:04]
the reporting year.
[1:16:08]
And the detailers for the
[1:16:11]
building permit issuance and
[1:16:12]
entitlements approved and
[1:16:15]
certificate of compliance
[1:16:16]
completion are found in
[1:16:18]
attachment 3 and 4 of the
[1:16:25]
staff report under table a-2.
[1:16:26]
So, this is the second year
[1:16:27]
of
[1:16:32]
the rhna cycle 6 eighty year
[1:16:33]
reporting cycle,
[1:16:33]
cumulatively,
[1:16:34]
the city is dewed building
[1:16:37]
perms for a total of 4.5% of
[1:16:38]
the expected housing units so
[1:16:41]
that's a total of 177 units
[1:16:46]
out of the 3956 units that
[1:16:50]
were allocated through rhna.
[1:16:53]
This is broken down into the
[1:16:55]
four income categories.
[1:16:57]
The city for above moderate
[1:16:59]
housing category, the city
[1:17:01]
issued building permits for
[1:17:01]
36
[1:17:04]
units or 1.9% of the rhna
[1:17:05]
allocation.
[1:17:06]
Moderate housing category,
[1:17:06]
the
[1:17:08]
city's issued building
[1:17:08]
permits
[1:17:11]
for 46 units or 6.4% of the
[1:17:12]
allocation.
[1:17:13]
For the low housing category,
[1:17:15]
the city has issued a
[1:17:16]
building
[1:17:20]
permit for 68 units or 13.5%
[1:17:22]
of the rhna allocation, the
[1:17:24]
very low housing category t
[1:17:25]
city has issued a building
[1:17:28]
permit for 27 units or 3.1%
[1:17:28]
of
[1:17:33]
the rhna allocation.
[1:17:35]
Thsz for the 2023 reporting
[1:17:38]
year ad then the 2024
[1:17:42]
reporting year, cumulatively.
[1:17:43]
In addition to reporting
[1:17:45]
housing production to date
[1:17:49]
during the reporting year, we
[1:17:51]
also provide information on
[1:17:53]
our program implementation
[1:17:54]
status, as mentioned, a large
[1:17:56]
component of the city's
[1:17:59]
housing element are goals,
[1:18:01]
policies and products that
[1:18:01]
direct decision making, most
[1:18:03]
of these programs are
[1:18:05]
implemented and monitored on
[1:18:06]
an ongoing basis, however
[1:18:07]
some
[1:18:08]
programs have deliverable
[1:18:09]
dates throughout the housing
[1:18:14]
element cycle.
[1:18:16]
For the 2024 reporting year,
[1:18:20]
programs were completed.
[1:18:20]
These were all completed
[1:18:22]
through the adoption of a
[1:18:24]
zoning text amendment that
[1:18:24]
the
[1:18:26]
council approved and adopted
[1:18:28]
last JUNE.
[1:18:30]
The zoning text amendment
[1:18:31]
included amended definitions
[1:18:34]
of certain uses such as
[1:18:35]
emergency shelter, addition
[1:18:36]
of
[1:18:38]
some new use classifications
[1:18:39]
including low barrier
[1:18:41]
navigation center and
[1:18:42]
permanent supportive housing
[1:18:46]
as well as updates to the
[1:18:47]
development uses allowed
[1:18:48]
within different zoning
[1:18:53]
districts per state mandate.
[1:18:55]
And that concludes staff's
[1:18:56]
presentation.
[1:18:57]
Both myself and billy are
[1:18:58]
available for any questions.
[1:18:59]
>> thank you, stephanie,
[1:19:00]
thank
[1:19:01]
you, billy.
[1:19:03]
I'll take questions from my
[1:19:04]
colleagues.
[1:19:06]
I have
[1:19:08]
>> I have a lot of questions
[1:19:09]
so I should probably go first
[1:19:11]
which is not a surprise to my
[1:19:12]
colleagues.
[1:19:16]
I'm going the help set up the
[1:19:19]
questions, so I think we have
[1:19:21]
to kind of paint the picture
[1:19:23]
here in terms of help
[1:19:25]
explaining the rhna process.
[1:19:27]
So, if we do a good faith
[1:19:29]
effort in trying to reach our
[1:19:32]
rhna goals and we don't hit
[1:19:35]
those numbers, what are the
[1:19:37]
ramifications of us not doing
[1:19:38]
that?
[1:19:40]
>> great question.
[1:19:43]
So, technically there is no
[1:19:45]
penalty for not meeting the
[1:19:48]
rhna numbers but there are
[1:19:51]
certain provisions sb35 that
[1:19:52]
MAY take effect.
[1:19:54]
If a certain percentage of
[1:19:54]
our
[1:19:58]
rhna allocation is not met,
[1:20:00]
midway through the reporting
[1:20:02]
or the rhna cycle.
[1:20:04]
And those would include --
[1:20:04]
and
[1:20:07]
I MAY call up tony rozzi for
[1:20:07]
help here.
[1:20:11]
But I believe they include
[1:20:15]
changing the process of
[1:20:17]
residential development
[1:20:17]
review
[1:20:19]
from discretionary to
[1:20:21]
ministerial if a certain
[1:20:23]
amount of affordable units
[1:20:23]
are
[1:20:25]
included in the overall
[1:20:26]
proposed residential
[1:20:27]
development.
[1:20:28]
>> so, in other words, if we
[1:20:30]
don't hit our numbers, a
[1:20:32]
developer can come in and
[1:20:34]
pretty much submit a project
[1:20:37]
and we would have to approve
[1:20:38]
it administrative, tony, do
[1:20:40]
you want to -- I really want
[1:20:43]
to be able to -- we
[1:20:43]
understand
[1:20:44]
these terms but I want to
[1:20:45]
make
[1:20:47]
sure the audience understands
[1:20:48]
this.
[1:20:50]
>> yeah.
[1:20:52]
Tony rozzi, deputy director
[1:20:52]
in
[1:20:53]
ecd.
[1:20:55]
I'm going to pull up this
[1:20:56]
slide because ithink it's
[1:20:57]
probably the best way to talk
[1:20:59]
through this.
[1:21:02]
And sb35 is not new, it
[1:21:03]
applied to us in the last
[1:21:04]
cycle.
[1:21:06]
At the end of year four,
[1:21:07]
midway through the rhna
[1:21:08]
cycle,
[1:21:10]
that 8 year period, they want
[1:21:13]
to know that you're on track
[1:21:13]
--
[1:21:14]
>> hang on, she can't hear
[1:21:17]
you.
[1:21:25]
>> sb35 applies and really
[1:21:26]
holds cities accountable for
[1:21:29]
how they're doing as far as
[1:21:31]
progress on their rhna cycle.
[1:21:34]
After year 4, w report back,
[1:21:37]
you know, have you met 50% of
[1:21:39]
your expected above moderate
[1:21:39]
units.
[1:21:41]
So, in this case, we have a
[1:21:44]
lot of above moderate units
[1:21:46]
assigned, almost over 1800,
[1:21:47]
so
[1:21:51]
we would want to see at least
[1:21:54]
900 units permitted by the
[1:21:56]
fifth year in our rhna cycle.
[1:21:57]
Separately, they want to know
[1:21:58]
how are you doing with your
[1:22:00]
low and very low units, so
[1:22:02]
that will be our very low and
[1:22:04]
our low, that's almost 1400
[1:22:07]
units so half of that would
[1:22:08]
be
[1:22:09]
700 units half way through
[1:22:09]
the
[1:22:11]
rhna cycle.
[1:22:13]
If you are on track and
[1:22:13]
you've
[1:22:16]
met both of those numbers,
[1:22:19]
sb35 doesn't apply.
[1:22:21]
It is not out of the question
[1:22:23]
that we might have a stronger
[1:22:25]
next cuple of years but it
[1:22:28]
really depends on the market,
[1:22:30]
tariffs, interest rates, all
[1:22:32]
of those things affect
[1:22:32]
whether
[1:22:33]
a developer pulls a permit or
[1:22:35]
not but that culd be a
[1:22:37]
trigger for sb35, like
[1:22:38]
stephanie said, allows a
[1:22:42]
project to be proposed that
[1:22:44]
has no discretionary review,
[1:22:46]
no ceqa, they do have to use
[1:22:47]
prevailing wage and they do
[1:22:49]
have to provide affordable
[1:22:54]
units, so it's not a free --
[1:22:56]
freebie for a developer but
[1:22:57]
it
[1:22:58]
limits a developer's
[1:22:59]
discretionary review.
[1:23:00]
Does that make sense?
[1:23:02]
>> yeah, that makes sense to
[1:23:03]
me.
[1:23:05]
So, let me dig a little
[1:23:05]
deeper
[1:23:06]
here.
[1:23:15]
So, when you say city report
[1:23:16]
building permits, you say
[1:23:17]
city
[1:23:17]
reported building permit and
[1:23:21]
is then you say planning
[1:23:23]
entitlements and I don't
[1:23:24]
think
[1:23:28]
the audience understands that
[1:23:28]
here.
[1:23:30]
For 62 residential units,
[1:23:31]
those are the numbers that
[1:23:31]
are
[1:23:33]
counted towards our rhna
[1:23:33]
numbers.
[1:23:35]
But when you say planning
[1:23:37]
entitlements, those numbers
[1:23:39]
are different.
[1:23:41]
Can yu briefly explain the
[1:23:42]
difference between those two.
[1:23:46]
>> yeah, I can and they can
[1:23:46]
--
[1:23:49]
in the life cycle o a
[1:23:50]
project, entitlements are
[1:23:51]
your
[1:23:52]
first stage, you go through
[1:23:53]
the planning commission,
[1:23:55]
perhaps city council and you
[1:23:56]
get entitled for the ability
[1:23:59]
to now build those units and
[1:24:01]
you've met your ceqa
[1:24:02]
obligations, you've met our
[1:24:04]
design standards and we have
[1:24:06]
very streamlined process for
[1:24:10]
these projects.
[1:24:11]
That's entitlement, now you
[1:24:13]
take those pretty
[1:24:13]
architectural drawings and
[1:24:14]
you
[1:24:15]
turn them into construction
[1:24:17]
drawings and that could take
[1:24:21]
as quick as 3-6 months, 18
[1:24:22]
months, you have up to three
[1:24:24]
years from your entitlement
[1:24:24]
to
[1:24:26]
get submitted for a building
[1:24:26]
permit.
[1:24:28]
Then you submit for a
[1:24:28]
building
[1:24:29]
permit, you go back and forth
[1:24:31]
with our plan check review,
[1:24:32]
with fire review, with
[1:24:34]
planning review.
[1:24:37]
When we issue that building
[1:24:39]
permit n that whatever year
[1:24:42]
that is which might be three
[1:24:44]
years after they're entitled,
[1:24:46]
we finally get credit in rhna.
[1:24:47]
Now the state wants us to
[1:24:49]
report, how did you do on
[1:24:51]
entitlements, do we we no if
[1:24:53]
you have stuff on the
[1:24:55]
pipeline, how are you doing
[1:24:56]
with issuing permits and now
[1:24:58]
can you tell us if you have
[1:25:00]
finagled those projects, are
[1:25:01]
they now down and people
[1:25:04]
living in them so that's the
[1:25:04]
reporting.
[1:25:06]
>> thank you for that
[1:25:06]
overview.
[1:25:08]
Here's what I'm looking at
[1:25:10]
these numbers, and tony, I
[1:25:12]
appreciate like the midway
[1:25:13]
report.
[1:25:13]
I don't know if yes
[1:25:14]
f wez
[1:25:14]
ear
[1:25:16]
going the hit that based on
[1:25:17]
what you're seeing right now.
[1:25:19]
That is the concern I'm
[1:25:19]
having.
[1:25:21]
And so did you want to jump
[1:25:22]
in?
[1:25:25]
>> I share your concern.
[1:25:26]
I will say tere are some
[1:25:28]
project that is are in
[1:25:29]
building permit review ready
[1:25:32]
to be issued that would tick
[1:25:35]
off our low and very low
[1:25:37]
inclusionary and very many
[1:25:39]
above moderate but it doesn't
[1:25:40]
feel super promising.
[1:25:44]
>> I'm looking behind me as
[1:25:45]
the puc projects that would
[1:25:47]
ramp up our numbers, right.
[1:25:47]
>> right.
[1:25:48]
Er
[1:25:51]
>> so, let me dig deeper,
[1:25:51]
when
[1:25:53]
I was looking at the
[1:25:54]
spreadsheet here, there were
[1:25:56]
some akronbacker ron anymore
[1:25:58]
which is lu, which means land
[1:26:02]
use, and it says 3.9 in terms
[1:26:05]
of the spreadsheet, that felt
[1:26:06]
with crating affordable and
[1:26:07]
workforce housing, I went
[1:26:09]
through all the data points
[1:26:10]
here.
[1:26:12]
They were talking about
[1:26:14]
working with the --
[1:26:15]
potentially working with the
[1:26:17]
school district about
[1:26:18]
building
[1:26:19]
affordable housing sites and
[1:26:20]
know the school district's
[1:26:21]
been looking at this and I
[1:26:25]
know we do have the city
[1:26:26]
council's sdaol district
[1:26:28]
liaison committee and I know
[1:26:30]
it's o one of the priorities
[1:26:31]
in turnover the school
[1:26:33]
district but they do have
[1:26:36]
sites in terms of fox ridge
[1:26:37]
and sarah vista that
[1:26:39]
potentially could be housing
[1:26:41]
sites, so I'm looking at my
[1:26:43]
colleagues who serve on tat
[1:26:44]
subcommittee to really see
[1:26:46]
what the school district's
[1:26:47]
plan on that is and I know
[1:26:49]
again one of the things they
[1:26:51]
mentioned and they have to
[1:26:52]
look at it but honestly
[1:26:53]
they've been saying they
[1:26:54]
support some sort of
[1:26:56]
development there but they're
[1:26:58]
dragging their feet.
[1:27:00]
And if we're going to build
[1:27:01]
affordable housing and
[1:27:02]
workforce housing, I want to
[1:27:03]
see a partnership with the
[1:27:04]
school district so I'm
[1:27:05]
looking
[1:27:06]
at my colleagues over there
[1:27:06]
in
[1:27:07]
termser of moving that
[1:27:08]
forward
[1:27:10]
and I think jefferson high
[1:27:11]
school district is a perfect
[1:27:13]
example of how you build
[1:27:13]
those
[1:27:16]
unit, it's such a successful
[1:27:17]
model that other school
[1:27:18]
districts ares following that
[1:27:20]
model, it's a nationally
[1:27:21]
recognized program in terms
[1:27:22]
of
[1:27:23]
what they're doing so I want
[1:27:24]
to lesh from them in terms of
[1:27:26]
what we can do forward.
[1:27:27]
Okay.
[1:27:29]
There was another one here,
[1:27:30]
it
[1:27:33]
says land use 2.1 which is
[1:27:35]
prioritized development near
[1:27:35]
transit.
[1:27:37]
And we during our housing
[1:27:39]
element cnversation, we did
[1:27:40]
talk about development aong
[1:27:42]
the el camino corridor
[1:27:42]
because
[1:27:44]
we have seen the development
[1:27:46]
on the caltrain corridor, but
[1:27:48]
this is kind of the next kind
[1:27:49]
of section where we have to
[1:27:50]
look at in terms of
[1:27:52]
development because when you
[1:27:54]
build along transit, you get
[1:27:56]
people who start using
[1:27:56]
transit
[1:27:58]
and I know other cities are
[1:28:00]
looking along the el camino
[1:28:02]
corridor in termer of
[1:28:03]
development so as we mover
[1:28:05]
forward in terms of
[1:28:06]
development, these are going
[1:28:07]
to be the sections we're
[1:28:07]
going
[1:28:09]
to be seeing and you can see
[1:28:11]
it now in terms of where
[1:28:15]
across from the san bruno
[1:28:15]
bart
[1:28:16]
station, tere's already
[1:28:19]
development and the century
[1:28:21]
plaza, that's going to be
[1:28:23]
housing, that's along the
[1:28:23]
bart
[1:28:25]
corridor along the samtrans
[1:28:26]
core dhao,'s something we're
[1:28:27]
going to be looking at in
[1:28:28]
terms of development.
[1:28:31]
And there was another thing
[1:28:33]
that says crt which I don't
[1:28:36]
know what crt stood fr.
[1:28:38]
>> creation.
[1:28:41]
>> okay, it said 3.1, review
[1:28:42]
of cmmercial and housing
[1:28:44]
linkage fees.
[1:28:46]
So, that was supposed to be
[1:28:47]
helping us in terms of
[1:28:49]
building development but for
[1:28:50]
me, the pipeline is starting
[1:28:52]
to slow down and there was a
[1:28:53]
initial conversation at or
[1:28:54]
housing subcommittee the see
[1:28:55]
what with
[1:28:56]
f we can do in
[1:28:57]
terms of speeding up the
[1:28:59]
process and I know waun one
[1:28:59]
of
[1:29:02]
the things, we did hire a
[1:29:03]
strategic economic consultant
[1:29:06]
to look at that in terms of
[1:29:06]
housing and commercial
[1:29:07]
linkage
[1:29:07]
fees.
[1:29:10]
I look forward to have that
[1:29:11]
conversation in terms of what
[1:29:14]
we want to d with that
[1:29:15]
particular fee.
[1:29:19]
So, with that, aisle leave
[1:29:20]
that in terms of the
[1:29:20]
questions.
[1:29:22]
>> thank you, councilmember,
[1:29:22]
any other questions?
[1:29:24]
>> I do have a question.
[1:29:25]
>> go ahead.
[1:29:25]
Er
[1:29:26]
>> so, how many housing
[1:29:26]
units
[1:29:28]
are in the pipeline and by
[1:29:31]
that, I mean entitled but not
[1:29:32]
yet permitted do, we have a
[1:29:37]
number that's the total?
[1:29:43]
>> so, for the 2024 reporting
[1:29:45]
year, five units were
[1:29:45]
approved
[1:29:48]
in the planning process have
[1:29:49]
received approved
[1:29:49]
entitlements.
[1:29:51]
We do have approved projects
[1:29:54]
from the previous years
[1:29:59]
including 7 south linden, 410
[1:30:01]
noor, 1477 huntington, all of
[1:30:07]
those have not pulled a
[1:30:08]
building permit yet, a couple
[1:30:10]
of them are on track to
[1:30:12]
possibly get their building
[1:30:13]
permits issued this next year
[1:30:15]
or during this year so we
[1:30:17]
would include them in the
[1:30:17]
2025
[1:30:18]
reporting and that's when we
[1:30:20]
would get the credit towards
[1:30:21]
rhna.
[1:30:24]
>> what's the number of those
[1:30:27]
units?
[1:30:28]
>> roughly 1500 units.
[1:30:30]
>> thank you.
[1:30:33]
And then I know the rate
[1:30:35]
limiting factor is mostly the
[1:30:36]
financing markets, so to the
[1:30:38]
best of your ability, if you
[1:30:39]
can characterize where we are
[1:30:41]
many the market right now, do
[1:30:44]
you see it improving, not
[1:30:47]
improving?
[1:30:49]
>> nell selander, economic
[1:30:50]
and
[1:30:50]
community development
[1:30:52]
director, what we're hearing
[1:30:56]
right now from some of the
[1:30:57]
larger developmental
[1:30:58]
directors
[1:30:59]
who are pulling their
[1:31:00]
building
[1:31:02]
permit and is sites now but
[1:31:04]
not yet pulled a building
[1:31:05]
permit for vertical
[1:31:07]
construction, it's not
[1:31:10]
interest rates, it's the
[1:31:14]
expected tariff wars and in
[1:31:16]
particular wood from canada,
[1:31:18]
so we even hve a project
[1:31:19]
that's not about to pull a
[1:31:21]
building permit but is doipg
[1:31:23]
lot of cost estimating and
[1:31:26]
that was contemplated as two
[1:31:28]
floors of concrete, so two
[1:31:30]
podium floors with four to
[1:31:31]
five stories of wood frame
[1:31:33]
construction above it and
[1:31:33]
they're now considering
[1:31:37]
pricing the whole building in
[1:31:38]
concrete because -- which
[1:31:41]
would be unheard of, three or
[1:31:42]
four or five years ago,
[1:31:46]
because of the volatility in
[1:31:48]
the timber markets because so
[1:31:50]
much of it comes from canada
[1:31:52]
and also because of fire
[1:31:54]
insurance and fire risk,
[1:31:56]
concrete buildings are less
[1:31:57]
risky in a a fire.
[1:32:00]
So, we MAY end up with
[1:32:00]
totally
[1:32:01]
different types of buildings
[1:32:04]
getting built in this sort of
[1:32:06]
economic cycle with the way
[1:32:08]
tariffs are and fire risk.
[1:32:10]
>> thank you, that's vry
[1:32:12]
interesting information.
[1:32:13]
>> thank you.
[1:32:15]
Any other questions?
[1:32:18]
>> there's one bright spot in
[1:32:20]
this, this table a, the
[1:32:22]
housing development
[1:32:23]
application submitted,
[1:32:23]
there's
[1:32:24]
four different projects and
[1:32:26]
what I noticed was that in a
[1:32:30]
couple of them are mid size,
[1:32:33]
one is 64 units, one is 70,
[1:32:36]
and those are all to be owner
[1:32:38]
occupied, is that correct?
[1:32:40]
So that would be 500
[1:32:40]
railroad,
[1:32:41]
the gateway project?
[1:32:44]
>> yes, the railroad
[1:32:46]
townhomes, and there's
[1:32:47]
another
[1:32:50]
project, 170, 180 south
[1:32:54]
spruce, approximately 64, 65
[1:32:54]
row houses.
[1:32:55]
>> I understand that's
[1:32:57]
happening in the south bay
[1:32:59]
where some developers are
[1:33:00]
looking at previously
[1:33:02]
approved
[1:33:03]
entitlements for multifamily
[1:33:04]
with greater height but it
[1:33:08]
looks like there might be
[1:33:08]
some
[1:33:10]
financial advantages maybe to
[1:33:11]
townhouses and it would be
[1:33:13]
wonderful if we had something
[1:33:14]
available for sale where
[1:33:17]
people could come into south
[1:33:17]
san francisco, iv
[1:33:20]
ets, --
[1:33:21]
invest, have a stake in the
[1:33:22]
action and stay here for a a
[1:33:23]
period of time.
[1:33:25]
One of the great
[1:33:26]
disappointments I had with
[1:33:27]
the
[1:33:28]
housing rental market, when I
[1:33:29]
hear the turn over rate can
[1:33:30]
be
[1:33:32]
as high as 30% annually, so
[1:33:33]
you have people that come and
[1:33:34]
visit us for a couple of
[1:33:35]
years
[1:33:36]
and then they go some place
[1:33:37]
else.
[1:33:38]
That's not a healthy
[1:33:38]
situation
[1:33:40]
for a community, so if this
[1:33:41]
becomes a trend, I think
[1:33:43]
there's some potential really
[1:33:45]
great news here where we have
[1:33:48]
properties for sale.
[1:33:49]
>> great.
[1:33:52]
So, this is why rhna's
[1:33:53]
important, so every city has
[1:33:56]
to do rhna, is that right?
[1:33:57]
Someone?
[1:33:59]
>> yeah, every jurisdiction
[1:33:59]
in
[1:34:02]
the state of california is
[1:34:03]
allotted a reap na
[1:34:03]
number.
[1:34:05]
>> and then what happens if
[1:34:05]
we
[1:34:10]
don't abide by the 3956 units?
[1:34:14]
>> again, as tony mentioned,
[1:34:17]
there is no penalty per se,
[1:34:19]
part of the rhna process is
[1:34:22]
making sure that a
[1:34:24]
jurisdiction's zoning ad
[1:34:25]
development standards can
[1:34:27]
allow for the construction of
[1:34:28]
that number.
[1:34:30]
>> let rerephrase that,
[1:34:31]
legally, what happens when
[1:34:35]
we're not there, what is our
[1:34:37]
state attorney general --
[1:34:38]
what
[1:34:39]
has he traditional has been
[1:34:42]
known to have done to some
[1:34:42]
cities?
[1:34:46]
>> I'll defer to tony on that.
[1:34:49]
>> I will say that in cases
[1:34:50]
of
[1:34:51]
jurisdictions that are sort
[1:34:52]
of
[1:34:53]
blatantly bad actor, they
[1:34:53]
have
[1:34:55]
gotten letters from the state
[1:34:56]
attorney letting them know
[1:34:59]
that they are at risk of
[1:35:01]
losing funding for roads,
[1:35:02]
funding for things that are
[1:35:04]
not housing related that a
[1:35:04]
lot
[1:35:08]
of cities rely on.
[1:35:10]
We have not always met our
[1:35:12]
income levels in rhna but we
[1:35:14]
have often met the lump
[1:35:15]
number
[1:35:16]
and we did in the last cycle.
[1:35:20]
It's just very, very hard to
[1:35:23]
get and fund the level of
[1:35:24]
affordable, very low and low
[1:35:26]
income unit that is are
[1:35:28]
projected on most cities and
[1:35:30]
that's where sb35 sort of
[1:35:31]
creates a carrot for
[1:35:33]
developers and frankly a
[1:35:35]
carrot for cities to be a
[1:35:36]
good
[1:35:37]
actor and streamline.
[1:35:38]
>> great.
[1:35:39]
And as mayor and I know that
[1:35:42]
my colleagues share this as
[1:35:44]
well, this is important.
[1:35:46]
This iss what we get elected
[1:35:46]
do.
[1:35:47]
When I hear individuals say
[1:35:49]
you all are hiding behind
[1:35:50]
your
[1:35:53]
rhna numbers or using that as
[1:35:54]
a justification to build,
[1:35:54]
this
[1:35:57]
is happening all across
[1:35:58]
california and in cities that
[1:36:00]
perhaps don't even have space
[1:36:01]
to build, right.
[1:36:02]
They still have a a rhna
[1:36:04]
number to meet and areap na
[1:36:05]
allocation.
[1:36:09]
Tony, can you describe what
[1:36:11]
the builders' remedy is?
[1:36:15]
>> the builders' remedy is a
[1:36:16]
trigger lw that goes into
[1:36:21]
effect if you do not have a
[1:36:23]
compliant and certified
[1:36:24]
housing element, so, you can
[1:36:25]
adopt a housing element but
[1:36:26]
it
[1:36:30]
can be grossly failed to meet
[1:36:32]
the standards that hcd is
[1:36:33]
looking at.
[1:36:35]
Hcd has to certify your
[1:36:36]
housing element, until they
[1:36:36]
do
[1:36:38]
and once the housing element
[1:36:40]
cycle has started and this is
[1:36:42]
affected a lot of
[1:36:43]
jurisdictions including us,
[1:36:44]
there's a window where
[1:36:45]
someone
[1:36:48]
can come in on essentially
[1:36:49]
any
[1:36:49]
parcel anywhere.
[1:36:50]
Er
[1:36:51]
>> any neighborhood.
[1:36:53]
>> and propose whatever they
[1:36:55]
want with streamlining and a
[1:36:56]
lot of clearance.
[1:36:59]
It doesn't happen often but
[1:36:59]
it
[1:37:00]
is certainly -- there are
[1:37:03]
examples in berkeley, santa
[1:37:04]
monica, southern california
[1:37:05]
where these projects have
[1:37:05]
been
[1:37:05]
pro
[1:37:06]
ep proposed and once you
[1:37:08]
propose it, you then have a
[1:37:10]
right to that project in
[1:37:11]
perpetuity.
[1:37:13]
That cn be frightening for a
[1:37:13]
community.
[1:37:15]
>> great.
[1:37:18]
This has been as a result of
[1:37:18]
additional housing, right, a
[1:37:20]
lot of folks say we're in a
[1:37:22]
housing crisis.
[1:37:23]
rhna is supposed to address
[1:37:25]
this but I also wanted to
[1:37:26]
point out that rhna is not
[1:37:28]
just building or approving
[1:37:30]
projects to build but the
[1:37:31]
other implementations of the
[1:37:33]
program such as you all
[1:37:35]
highlighted, the displacement
[1:37:36]
protections, the services,
[1:37:36]
the
[1:37:38]
energy efficiency, these are
[1:37:40]
also meant to preserve as
[1:37:41]
well
[1:37:42]
as sustain and promote
[1:37:44]
additional housing, so when
[1:37:44]
we
[1:37:45]
talk about -- I don't like
[1:37:46]
how
[1:37:47]
south san francisco is
[1:37:48]
changing, we don't really
[1:37:49]
have
[1:37:50]
a choice, folks, we need to
[1:37:51]
address housing.
[1:37:52]
Housing I important, we
[1:37:53]
could
[1:37:56]
certainly make it so that
[1:37:57]
there is affordablability in
[1:37:59]
south san francisco but these
[1:38:01]
are new implementations that
[1:38:02]
are like I said not just in
[1:38:05]
south san francisco but
[1:38:10]
anywhere you go I the state.
[1:38:11]
With that, do you have
[1:38:13]
something else?
[1:38:13]
>>.
[1:38:14]
F MR. Mayor, iped to
[1:38:16]
remind the audience, we just
[1:38:17]
recently passed an ordinance
[1:38:18]
that codified that if you
[1:38:19]
live
[1:38:20]
and work in south san
[1:38:22]
francisco that you would have
[1:38:23]
preferences, so I want to
[1:38:25]
remind folks, and also that
[1:38:27]
3800 number in terms of
[1:38:29]
residents, number of units,
[1:38:31]
they did an audit on that and
[1:38:33]
we apparently -- everyone
[1:38:35]
according to what their audit
[1:38:36]
said was understood counted,
[1:38:37]
so our numbers could have
[1:38:38]
been
[1:38:40]
a lot higher than that than
[1:38:42]
what we have and I serve on
[1:38:44]
abag which is the association
[1:38:45]
of bay aea governments and
[1:38:46]
we
[1:38:48]
are talking about the
[1:38:48]
numbers,
[1:38:51]
the rhna numbers, so I will
[1:38:53]
have a big part in terms of
[1:38:53]
what those numbers are going
[1:38:56]
to be for the region and so
[1:38:58]
the more we can do now t
[1:39:00]
better it is for us in terms
[1:39:01]
of what our rhna numbers ae
[1:39:03]
going to be for the next
[1:39:03]
cycle.
[1:39:07]
>> great, thank you,
[1:39:09]
councilmember, for that
[1:39:09]
addition.
[1:39:10]
This is a report only so no
[1:39:11]
action taken but do we have
[1:39:11]
public comments?
[1:39:13]
>> we have oe public
[1:39:15]
comment,
[1:39:22]
fianola?
[1:39:25]
>> good evening again,
[1:39:27]
councilmembers.
[1:39:31]
The regional housing needs
[1:39:33]
assessment numbers mean
[1:39:34]
nothing.
[1:39:36]
You should all know that.
[1:39:38]
It is surprising you don't
[1:39:43]
know this.
[1:39:47]
Who are you building equity
[1:39:47]
for?
[1:39:50]
All the tax credits from the
[1:39:56]
state.
[1:39:58]
For "affordable" housing
[1:39:59]
units
[1:40:03]
that after sometime the deed
[1:40:05]
restrictions go away.
[1:40:06]
They're no longer affordable.
[1:40:08]
Then who owns them.
[1:40:10]
Who are you building equity
[1:40:11]
for?
[1:40:13]
You are not building equity
[1:40:15]
for regular foils.
[1:40:18]
You
[1:40:19]
-- folks.
[1:40:20]
You're strapping everybody to
[1:40:22]
be debt slaves because you
[1:40:23]
are
[1:40:23]
borrowing on the strength of
[1:40:27]
us, the taxpayers, and we are
[1:40:29]
paying those tax credits, yu
[1:40:32]
do not need to build regional
[1:40:33]
housing assessment numbers
[1:40:33]
but
[1:40:35]
yes, we need house, housing
[1:40:36]
for sale that people can buy
[1:40:38]
and build equity in for
[1:40:39]
th
[1:40:39]
els
[1:40:41]
and is their fmly tos pass on
[1:40:42]
into the future.
[1:40:44]
Who are you building equity
[1:40:46]
for?
[1:40:47]
Yourselves.
[1:40:48]
Because those are the people
[1:40:50]
that come storming in here
[1:40:54]
when it's time for elections,
[1:40:55]
it's very interesting.
[1:40:57]
So, you'll get the votes.
[1:40:58]
But what about the people
[1:41:00]
you're supposed to represent
[1:41:02]
that vote in this
[1:41:02]
constituency.
[1:41:04]
You don't care about them.
[1:41:06]
You only care about using a
[1:41:07]
word that doesn't mean
[1:41:10]
anything because the word
[1:41:12]
affordable, everybody needs
[1:41:12]
to
[1:41:14]
know one unit of affordable
[1:41:18]
housing costs at least -- oh,
[1:41:21]
not including the recent
[1:41:21]
surge
[1:41:24]
in prices, 20% more to build
[1:41:27]
an affordable housing unit,
[1:41:29]
then.It does, a regular
[1:41:30]
house.
[1:41:32]
20% more than.
[1:41:35]
It is far -- it is much, much
[1:41:36]
more money to build
[1:41:37]
affordable
[1:41:38]
housing units.
[1:41:41]
The word affordable is the
[1:41:41]
big
[1:41:42]
cash cow that you're all
[1:41:44]
relying on that people do not
[1:41:48]
realize, it is unaffordable,
[1:41:49]
completely unaffordable to be
[1:41:51]
strapping the taxpayers with
[1:41:54]
the cost of building these
[1:41:58]
units when you should be
[1:42:00]
building for families and
[1:42:01]
people that they can build
[1:42:02]
equity in to pass on to their
[1:42:03]
families into the future.
[1:42:05]
It is shameful, it is
[1:42:06]
disgraceful that each of you
[1:42:08]
sit there and ride a wave
[1:42:08]
just
[1:42:10]
because of a word, words have
[1:42:11]
meaning.
[1:42:13]
Why don't you tell the people
[1:42:16]
what it means.

[1:43:45]
present to you the launch
[1:43:47]
local vacant retail
[1:43:47]
activation
[1:43:48]
pilot program, a creative
[1:43:51]
niche yat I ever designed to
[1:43:56]
revitalize vacant store front
[1:43:56]
ins south san francisco while
[1:43:57]
supporting emerging local
[1:43:58]
businesses.
[1:43:58]
Note the powerpoint published
[1:44:00]
in the agenda packet is not
[1:44:01]
the most updated version.
[1:44:03]
This presentation includes a
[1:44:04]
few minor enhancements and
[1:44:06]
printed copies of the updated
[1:44:07]
slides are available in the
[1:44:11]
back room.
[1:44:11]
Tonight staff recommends it
[1:44:12]
is
[1:44:14]
city council adopt a
[1:44:15]
resolution approving both the
[1:44:17]
program guideline and is the
[1:44:18]
request for interest or rfi
[1:44:20]
for the launch local program.
[1:44:22]
This approval will allow us
[1:44:22]
to
[1:44:23]
mover forward with
[1:44:26]
implementation and tenant
[1:44:28]
outreach.
[1:44:29]
this program was first
[1:44:31]
introduced as a study session
[1:44:33]
at the FEBRUARY 12 council
[1:44:34]
meeting.
[1:44:35]
It responds directly to the
[1:44:37]
economic and visual
[1:44:38]
challenges
[1:44:39]
created by persistent vacant
[1:44:41]
store fronts in our
[1:44:41]
commercial
[1:44:42]
corridors.
[1:44:44]
Launch local supports first
[1:44:46]
time brick and mortar
[1:44:48]
businesses through leases and
[1:44:49]
a tenant allowance up to 10
[1:44:51]
thousand dollars and targeted
[1:44:51]
outreach.
[1:44:53]
The intent is to lower
[1:44:55]
barriers to entry and pilot
[1:44:56]
retail concept that is have
[1:45:01]
long term potential.
[1:45:02]
Council provided thoughtful
[1:45:03]
and clear direction in
[1:45:05]
FEBRUARY which shaped the
[1:45:06]
final program before you
[1:45:07]
tonight.
[1:45:08]
You voiced support for
[1:45:09]
activation goals and
[1:45:11]
emphasized the importance of
[1:45:12]
prioritizing south san
[1:45:13]
francisco residents.
[1:45:15]
There was particular interest
[1:45:17]
in reactivating the former
[1:45:18]
barbershop space and concern
[1:45:20]
was raised about limiting
[1:45:21]
participation to a one year
[1:45:23]
lease term.
[1:45:24]
You also encouraged us to
[1:45:26]
create a model that private
[1:45:27]
property owners could adopt.
[1:45:29]
That input is reflected in
[1:45:33]
tonight's proposal.
[1:45:35]
I would also like to raise a
[1:45:37]
related item for council
[1:45:38]
discussion tonight.
[1:45:40]
Since the FEBRUARY 12 study
[1:45:42]
session, the city has
[1:45:42]
received
[1:45:43]
multiple inquiry from
[1:45:44]
existing
[1:45:46]
businesses, both local and
[1:45:47]
from neighboring cities,
[1:45:48]
interested in leasing the
[1:45:50]
grand avenue spaces at market
[1:45:51]
rate rent outside of the
[1:45:54]
launch local program.
[1:45:55]
One formal lease proposal has
[1:45:57]
already been submit and had
[1:45:57]
we
[1:45:59]
anticipate receiving another
[1:45:59]
soon.
[1:46:01]
Notably one of the interested
[1:46:03]
parties is an existing south
[1:46:04]
san francisco business
[1:46:04]
looking
[1:46:06]
to open a second location and
[1:46:08]
lease both of the city owned
[1:46:09]
storefronts on grand avenue
[1:46:11]
include lg the former
[1:46:13]
barbershop space.
[1:46:15]
Given this interest, staff is
[1:46:16]
requesting council's
[1:46:16]
direction
[1:46:18]
on whether to continue
[1:46:19]
reserving these spaces for
[1:46:21]
launch local or to consider
[1:46:23]
market rate lease proposals
[1:46:24]
separately?
[1:46:26]
Your input will help
[1:46:26]
determine
[1:46:29]
how we -- your input wll
[1:46:29]
help
[1:46:30]
determine how we proceed with
[1:46:32]
these spaces while we
[1:46:33]
continue
[1:46:36]
rolling out the broader
[1:46:36]
program.
[1:46:37]
The name launch local was
[1:46:40]
selected through a survey of
[1:46:41]
key stakeholders including
[1:46:42]
city staff, elected officials
[1:46:44]
and staff pr the renaissance
[1:46:46]
entrepreneurship center at
[1:46:46]
the
[1:46:48]
economic advancement center.
[1:46:49]
It reflects both the
[1:46:50]
program's
[1:46:51]
focus on local
[1:46:52]
entrepreneurship x the
[1:46:54]
opportunity for participants
[1:46:55]
to launch their first
[1:46:57]
physical
[1:46:57]
location.
[1:46:59]
It's memorable, energetic and
[1:47:01]
rooted in place.
[1:47:02]
Branding icluding a logo is
[1:47:07]
currently in development.
[1:47:09]
The program has four key
[1:47:12]
object tiers, first activate
[1:47:13]
underutilized retail spaces
[1:47:14]
in
[1:47:16]
south san francisco, 2,
[1:47:19]
support emerging for profit
[1:47:22]
businesses, particularly those
[1:47:23]
without a prior brick and
[1:47:23]
mortar presence, 3, encourage
[1:47:25]
unique and experiential
[1:47:26]
retail
[1:47:29]
or service concepts, and 4,
[1:47:30]
prioritize local
[1:47:31]
entrepreneurs
[1:47:34]
especially gaduates of the
[1:47:35]
renaissance entrepreneurship
[1:47:36]
center programs at the
[1:47:40]
economic advancement center.
[1:47:41]
Under this pilot, the city
[1:47:43]
will lease out ipsbacker its
[1:47:44]
own vacant retail spaces on
[1:47:47]
grand avenue and el camino
[1:47:50]
real at a discounted rate at
[1:47:57]
$1 per square foot.
[1:47:58]
The standard lease term is
[1:47:59]
one
[1:48:00]
year with performance based
[1:48:05]
options for renewal.

[1:48:15]
through procure now.
[1:48:16]
We'll promote the opportunity

broadly through the city's
[1:48:21]
channels, the chamber of
[1:48:22]
commerce and the eac.
[1:48:23]
Materials will be available
[1:48:23]
in
[1:48:24]
english and spanish with
[1:48:25]
other
[1:48:30]
translations upon request.
[1:48:32]
eligible applicants must be
[1:48:33]
for profit businesses seeking
[1:48:35]
their first south san
[1:48:37]
francisco location, offering
[1:48:39]
retail or experiential s
[1:48:41]
frs
[1:48:41]
concept.
[1:48:42]
Demonstrating readiness and
[1:48:45]
capacity to operate including
[1:48:46]
financial sustainability,
[1:48:48]
priority will be given to
[1:48:49]
renaissance program graduates
[1:48:52]
aligning with their goal to
[1:48:55]
uplift local entrepreneurs.
[1:48:57]
The lease will be 12 months
[1:48:57]

[1:49:00]
duration with monthly sales

[1:49:04]
responsible for property
[1:49:06]

[1:49:07]
utilities
[1:49:09]
and tenant improvement costs
[1:49:11]
are reimbursed as a rent
[1:49:11]
credit, performance and
[1:49:13]

monthly and successful
[1:49:15]
tenants
[1:49:19]

[1:49:39]
Proposals will be reviewed o

the
[1:49:48]
business concept, operational

community impact.
[1:49:56]

[1:50:03]
due on APRIL 30.
[1:50:05]
Through the month of APRIL,
[1:50:06]
we'll be available to answer
[1:50:07]
questions and we plan to
[1:50:08]
announce the selected
[1:50:12]
businesses at the end of MAY.
[1:50:14]
There is no impact to the
[1:50:15]
general fund.
[1:50:18]
The program uses city owned
[1:50:20]
currently vacant space and is
[1:50:22]
recoups rent through tenant
[1:50:23]
spaces, the tenant payment
[1:50:25]
allowance is striated as rent
[1:50:28]
payment, the triple lease
[1:50:30]
structure ensures the city is
[1:50:32]
not absorbing additional
[1:50:32]
costs.
[1:50:33]
Launch local is an
[1:50:34]
opportunity
[1:50:36]
to support local
[1:50:37]
entrepreneurship, enhance the
[1:50:39]
vitality of our retail
[1:50:41]
corridors, create a model
[1:50:41]
that
[1:50:43]
privateer owners can
[1:50:43]
replicate.
[1:50:44]
Pending council approval
[1:50:46]
tonight, we will launch the
[1:50:49]
rfi on APRIL 1 and we gin
[1:50:51]
tenant outreach immediately.
[1:50:53]
As a reminder, we're also
[1:50:56]
seeking council's guidance on
[1:50:59]
how to present with the grand
[1:51:01]
avenue spaces outside the
[1:51:01]
launch local program, thank
[1:51:02]
you for your time and
[1:51:03]
attention and I'm happy to
[1:51:05]
answer any questions or
[1:51:06]
discuss next steps.
[1:51:07]
>> thank you, katie, greet
[1:51:10]
work on this, great
[1:51:11]
presentation, lots to unpack,
[1:51:13]
I'm sure my colleagues have
[1:51:16]
questions, so let's go with
[1:51:18]
councilman nicolas?
[1:51:21]
>> so, katie, on the market
[1:51:23]
rate, you said we will have
[1:51:28]
two, right?
[1:51:31]
And one is already an
[1:51:33]
established south city
[1:51:34]
business.
[1:51:36]
Pearly I think, you know,
[1:51:37]
since it's market rate and I
[1:51:38]
understand we would like to
[1:51:42]
preserve the historical look
[1:51:44]
of the barbershop, but from
[1:51:45]
my
[1:51:47]
point of view, a bird in hand
[1:51:51]
is worth two in the bush, but
[1:51:59]
I think there are still other
[1:51:59]
city city properties that we
[1:52:00]
can proceed with being the
[1:52:02]
pilot project fr the launch
[1:52:07]
local, is that correct?
[1:52:08]
>> it will just be the one on
[1:52:09]
el camino, correct, yeah.
[1:52:11]
>> are there others aside
[1:52:11]
from
[1:52:11]
these two?
[1:52:13]
>> those are the only
[1:52:15]
vacancies, yeah.
[1:52:17]
>> and then we will encourage
[1:52:20]
also the other ones that are
[1:52:22]
-- if we find out or if we
[1:52:23]
can
[1:52:28]
prove this is -- this is a
[1:52:31]
viable option for property
[1:52:32]
owners, have we talked to
[1:52:32]
some
[1:52:33]
of them and see what their
[1:52:34]
interests are?
[1:52:36]
>> we haven't talked to any
[1:52:38]
yet but that was our
[1:52:39]
intention
[1:52:42]
if this pilot program deems
[1:52:43]
successful and there was
[1:52:44]
interest from council to
[1:52:47]
expand it, we wuld look into
[1:52:48]
private property owners.
[1:52:50]
>> but I'm very supportive of
[1:52:52]
what you have outlined for
[1:52:52]
the
[1:52:53]
launch local.
[1:52:53]
>> thank you.
[1:52:55]
>> great, thank you.
[1:52:58]
Anyone ese?
[1:52:59]
>> I also am supportive of
[1:53:00]
the
[1:53:01]
program and we wanted to test
[1:53:03]
drive it with all the
[1:53:04]
properties w have available
[1:53:06]
but in the meantime, katie
[1:53:07]
was
[1:53:09]
kind enough to show the
[1:53:10]
property to a family that
[1:53:11]
I've
[1:53:12]
known for a dozen years who
[1:53:15]
are currently in business and
[1:53:16]
as the COUNCILWOMAN
[1:53:16]
Mentioned,
[1:53:18]
you know, a bird in the hand,
[1:53:20]
so it really speaks to the
[1:53:21]
viability of our downtown
[1:53:22]
that
[1:53:26]
somebody wants it right away
[1:53:28]
and you MAY or MAY not come
[1:53:29]
to
[1:53:30]
agreement on all the terms,
[1:53:34]
but the el camino is a whole
[1:53:34]
different challenge so it
[1:53:35]
will
[1:53:39]
be interesting to see who's
[1:53:40]
interested.
[1:53:44]
As far as the tenant
[1:53:45]
participation, it is -- a
[1:53:46]
dollar a square foot is a
[1:53:48]
great deal but all those
[1:53:48]
other
[1:53:50]
things add up rapidly too, so
[1:53:52]
it's quite a commitment for
[1:53:54]
someone coming out of a home
[1:53:56]
business or just a concept,
[1:53:56]
so
[1:53:57]
anyway, but generally I like
[1:54:00]
the idea and you were
[1:54:01]
wonderful in kpix.
[1:54:05]
>> thank you.
[1:54:06]
>> councilmember?
[1:54:08]
>> thanks, MR. Mayor, I agree
[1:54:09]
with my colleagues, I think
[1:54:12]
this is potentially a great
[1:54:14]
pilot program.
[1:54:16]
I think I kind of share the
[1:54:18]
concerns in terms of like el
[1:54:20]
camino real versus grand
[1:54:20]
avenue.
[1:54:23]
You know, one of the things I
[1:54:24]
was thinking about, you know,
[1:54:27]
if we place this business on
[1:54:29]
grand avenue, they do well,
[1:54:30]
eventually they have to
[1:54:31]
rotate
[1:54:34]
out or we could maybe extend
[1:54:36]
the lease as well, is that
[1:54:37]
another option?
[1:54:40]
The idea is to rotate to have
[1:54:44]
a -- not a rediscovering
[1:54:48]
involver -- revolving door,
[1:54:49]
but a pop up business, you
[1:54:51]
would help the tenant either
[1:54:53]
locate somewhere else, I
[1:54:53]
that
[1:54:54]
correct, or --
[1:54:55]
>> yes, we could do that.
[1:54:58]
>> okay, but at that point,
[1:54:59]
they're paying potentially
[1:55:00]
full market value?
[1:55:01]
>> correct.
[1:55:03]
>> and that potentially
[1:55:04]
could
[1:55:05]
be a problem as well because
[1:55:07]
they were paying a pretty
[1:55:08]
good
[1:55:10]
rate and hopefully they were
[1:55:11]
start in terms of saving
[1:55:11]
their
[1:55:13]
money and doing the right
[1:55:15]
business model so they're
[1:55:16]
reminded, hey, this is only
[1:55:18]
temporary, you're going to be
[1:55:19]
here, we want to establish
[1:55:22]
your business and then
[1:55:24]
potentially rotate out into
[1:55:25]
another location, so I think
[1:55:27]
that's going to be on you and
[1:55:29]
staff to say, okay, you could
[1:55:31]
have a good business model in
[1:55:32]
the sense, you have to get
[1:55:34]
ready for the full market,
[1:55:34]
you
[1:55:36]
know, so I kind of want -- a
[1:55:39]
long way of singing on what
[1:55:42]
are you asking them to help
[1:55:43]
them relocate, I know it's
[1:55:45]
early but I want you to be
[1:55:47]
thinking about that.
[1:55:49]
>> yeah, we haven't gotten
[1:55:51]
that far in that planning
[1:55:52]
process, but that's part of
[1:55:55]
the reason why we want to
[1:55:56]
prioritize renaissance
[1:55:56]
graduates because they've
[1:55:58]
gone
[1:56:02]
through an extensive business
[1:56:03]
class and, you know, city
[1:56:04]
staff will be available to
[1:56:06]
help them and renaissance
[1:56:09]
staff will be available to
[1:56:10]
help them, so, they learn
[1:56:12]
these skills of like if
[1:56:13]
they're even capable to be
[1:56:16]
running a brick and mortar
[1:56:17]
business ad hopefully
[1:56:20]
scavenging aving -- saving
[1:56:21]
some money e even if they
[1:56:23]
can't hit that market rate
[1:56:27]
rent, maybe it if it's 75%
[1:56:28]
market rate, so that's all
[1:56:29]
things we'll have to play out
[1:56:34]
when we see those numbers.
[1:56:35]
>> I look forward to it.
[1:56:38]
There is kind of the
[1:56:38]
interesting conversation of
[1:56:40]
talking to other landlords to
[1:56:41]
see if they're interested in
[1:56:44]
doing this kind of model.
[1:56:46]
Someone said they want a
[1:56:49]
permitted kind of tenant,
[1:56:49]
than
[1:56:51]
a temporary tenant but I'm
[1:56:53]
supportive of the concept.
[1:56:55]
>> thank you.
[1:56:57]
>> I think this I a great
[1:56:59]
idea and I wanted to thank
[1:57:01]
staff for having the
[1:57:01]
visionary
[1:57:03]
in them to present this to us
[1:57:05]
and to really activate these
[1:57:07]
vacant spaces so I'm ready to
[1:57:08]
mover forward with the pilot
[1:57:10]
program and I can't wait to
[1:57:11]
see which businesses move in.
[1:57:12]
>> thank you.
[1:57:13]
>> thank you, this is
[1:57:14]
exciting, this is the right
[1:57:15]
direction that we need to
[1:57:16]
head
[1:57:19]
not only for downtown but for
[1:57:20]
our entire city being a
[1:57:22]
creative out of the box
[1:57:23]
thinking, I really appreciate
[1:57:24]
the name too and looking
[1:57:26]
forward to the logo.
[1:57:27]
In the guidelines when you
[1:57:29]
determine who can apply, you
[1:57:30]
said for profit businesses
[1:57:32]
seeking first south city
[1:57:33]
location but you're also
[1:57:34]
mentioning this local one
[1:57:36]
would have a second south
[1:57:36]
city
[1:57:38]
location, so is that just a
[1:57:39]
caveat for that particular
[1:57:40]
case?
[1:57:42]
>> so, that's what we mean,
[1:57:44]
like, that's what we wanted
[1:57:44]
to
[1:57:46]
get some guidance on is do we
[1:57:48]
want to make an exception to
[1:57:49]
this program, do we really
[1:57:51]
want to reserve these spaces
[1:57:54]
for launch local or would we
[1:57:55]
like to have something that's
[1:57:58]
possibly a bit more secure
[1:57:59]
that's an established
[1:58:00]
business, can afford the
[1:58:04]
market rate rent and work on
[1:58:05]
lease negotiation terms with
[1:58:07]
them and then maybe we find a
[1:58:09]
different way, like w just
[1:58:12]
focus on el camino, do we
[1:58:14]
start maybe having talks with
[1:58:15]
private property owners?
[1:58:17]
>> because it doesn't really
[1:58:20]
fit into your name if it's
[1:58:20]
launch local, right.
[1:58:21]
>> correct.
[1:58:21]
Er
[1:58:22]
>> you have to rename it.
[1:58:23]
>> yes.
[1:58:24]
Er
[1:58:26]
>> I'm supportive like my
[1:58:29]
colleagues have said, I'm
[1:58:30]
open
[1:58:34]
to el camino, grand avenue we
[1:58:35]
could prioritize for our
[1:58:35]
local
[1:58:38]
businesses here that would
[1:58:39]
like to expand, right, or
[1:58:39]
have
[1:58:40]
a second location.
[1:58:46]
I think it fits with the nay
[1:58:47]
ture and khur and the fabric
[1:58:50]
of downtown and represented
[1:58:54]
in that sector of businesses.
[1:58:59]
I can't speak enough, their
[1:59:00]
program fully vets them and
[1:59:02]
fully prepares them, not only
[1:59:03]
in city permitting but in
[1:59:05]
marketing and being able to
[1:59:07]
launch and being able to
[1:59:09]
network and really sell and
[1:59:11]
equips them with the tools,
[1:59:12]
the important tools they need
[1:59:14]
to be a successful business
[1:59:15]
owner so that's the key for
[1:59:18]
me, being able to already
[1:59:21]
connect individuals that are
[1:59:22]
ready, are in the right
[1:59:24]
mindset and the space to move
[1:59:26]
forward and I think the lease
[1:59:28]
structure and the program
[1:59:30]
guidelines are extremely well
[1:59:31]
thought out, so I'm very
[1:59:33]
supportive of this, thank you.
[1:59:34]
Good job again, I appreciate
[1:59:34]
this.
[1:59:36]
>> I have one more question.
[1:59:37]
I was a little bit confused
[1:59:38]
by
[1:59:40]
some of the questions and the
[1:59:41]
answers to MR. Nagales.
[1:59:44]
So, if we have somebody go in
[1:59:50]
for that 12 months initially,
[1:59:51]
they're not automatically out
[1:59:52]
in month 13, are they?
[1:59:54]
>> no.
[1:59:56]
>> a very lng time ago, I
[1:59:56]
was
[1:59:59]
if business, the first yar
[1:59:59]
is
[2:00:01]
a xwlaoet blur, you can
[2:00:02]
barely
[2:00:06]
get your bearings the first
[2:00:07]
year, we want somebody to be
[2:00:11]
able to grow their roots in a
[2:00:12]
business.
[2:00:14]
>> yes.
[2:00:15]
>> nell selander here, I
[2:00:17]
wanted to add one thing, the
[2:00:19]
year check-in is a great
[2:00:20]
opportunity for us to make
[2:00:21]
sure they're oerating the
[2:00:23]
business they intended to, so
[2:00:26]
one of the big object tiers
[2:00:26]
of
[2:00:31]
the program is activation and
[2:00:36]
being more vibrant and what
[2:00:39]
can often happen with a
[2:00:40]
business that's struggling is
[2:00:41]
their hours get reduced and
[2:00:41]
reduced and maybe they start
[2:00:42]
using the space for a
[2:00:43]
different it is back office
[2:00:46]
for this or it's, you know,
[2:00:49]
it's nt what was intended by
[2:00:51]
the program, so the year
[2:00:53]
check-in and the monthly
[2:00:53]
sales
[2:00:55]
reports are really important
[2:00:56]
so that we're getting what
[2:00:56]
the
[2:00:58]
program is intended to
[2:00:59]
provide
[2:01:02]
which is active service or
[2:01:04]
retail and that year check-in
[2:01:05]
will be more about the
[2:01:07]
performance of the business
[2:01:11]
and can they afford market
[2:01:12]
rate today, but we want to
[2:01:14]
make sure we have that check
[2:01:15]
so we don't end up with
[2:01:17]
another space that's
[2:01:17]
underutilized.
[2:01:19]
>> I think it's interesting
[2:01:19]
to
[2:01:21]
see so much o the
[2:01:22]
construction, the commercial
[2:01:24]
development of the ground
[2:01:25]
floor has not been a roaring
[2:01:27]
success n the city of san
[2:01:32]
mateo, there's a doper called
[2:01:34]
essex na has a project on dep
[2:01:35]
ware avenue near 92, they
[2:01:36]
announced they're goipg the
[2:01:38]
leave their office space in
[2:01:39]
downtown san mateo and take
[2:01:40]
over the commercial space on
[2:01:42]
the ground floor to ativate
[2:01:46]
the other part of the retail
[2:01:47]
space, besides the 500 tenant
[2:01:49]
that is are in the building,
[2:01:51]
they're going to have a
[2:01:51]
couple
[2:01:52]
of 100 employees working in
[2:01:53]
the offices there.
[2:01:55]
Are we able to do the same
[2:01:55]
thing?
[2:01:57]
I know in the past, we had
[2:01:58]
some restrictions on what
[2:02:00]
could go in the ground floor
[2:02:02]
but are we ale to do
[2:02:04]
something similar where it
[2:02:05]
could b maybe an intense
[2:02:07]
office use to generate
[2:02:12]
activity on the street?
[2:02:13]
>> billy with planning
[2:02:15]
division, we have taken a
[2:02:15]
way,
[2:02:18]
any requirement for even
[2:02:20]
commercial space, it's more
[2:02:22]
about design, does it have an
[2:02:25]
active front, does it have
[2:02:26]
windows, it could be office
[2:02:27]
space, we don't require there
[2:02:31]
to be a certain percentage of
[2:02:32]
commercial space, it's all
[2:02:33]
design related.
[2:02:34]
>> before we were looking for
[2:02:36]
the retail experience and
[2:02:36]
that
[2:02:39]
has evaporated.
[2:02:40]
>> it could be a senior
[2:02:42]
center, it could be a
[2:02:43]
community center.
[2:02:45]
It could be a lot of things
[2:02:45]
happening, especially I
[2:02:48]
downtown and anywhere else.
[2:02:48]
Alright.
[2:02:50]
If I don't have any o
[2:02:51]
ir
[2:02:51]
other
[2:02:52]
comments or questions --
[2:02:54]
>> I just want to clarify
[2:02:54]
from
[2:02:57]
my understanding, is
[2:02:57]
council's
[2:02:59]
direction that the preference
[2:03:00]
-- are we hearing a
[2:03:01]
preference
[2:03:02]
for an established business
[2:03:03]
to
[2:03:04]
rent this retail space at
[2:03:06]
market rate or are you saying
[2:03:11]
we should give preference to
[2:03:12]
the launch local folks?
[2:03:14]
I'm trying to understand what
[2:03:15]
your preference is.
[2:03:18]
We would -- the el camino one
[2:03:20]
is vacant, that could be a
[2:03:21]
launch local, and in the
[2:03:23]
future, other city owned
[2:03:23]
properties could become
[2:03:25]
vacant, once we have the
[2:03:26]
guidelines and the framework
[2:03:30]
and we have one pilot in el
[2:03:31]
camino, I'm trying to get
[2:03:33]
whether we should pursue this
[2:03:33]
other opportunity for
[2:03:34]
somebody
[2:03:36]
that wants tos rent it at
[2:03:37]
market rate or hold those
[2:03:38]
spaces for launch local.
[2:03:40]
I want to be clear with that.
[2:03:42]
>> aisle reiterate, you can't
[2:03:43]
imagine smebody walking by
[2:03:45]
and somebody wants to do
[2:03:46]
market rate right now.
[2:03:48]
>> that's how I feel, and in
[2:03:53]
terms of making sure that the
[2:03:55]
historical effects, maybe the
[2:03:56]
historical society will be
[2:04:00]
pressed and we'll focus on
[2:04:00]
the
[2:04:02]
366 el camino, perhaps what
[2:04:03]
we
[2:04:05]
can do is perhaps the
[2:04:06]
renaissance graduates will be
[2:04:08]
-- because the place there,
[2:04:14]
there's a lab and a florist,
[2:04:16]
maybe something that will be
[2:04:17]
complementing to those
[2:04:18]
establishments that are
[2:04:19]
already in there.
[2:04:22]
i went to milty lab one day
[2:04:24]
and there's long line and a
[2:04:25]
long waiting list so I think
[2:04:27]
the business is tieing and
[2:04:29]
florist, it looks like
[2:04:29]
they're
[2:04:31]
doing business, so I think
[2:04:32]
from the renaissance
[2:04:35]
graduates, we can have a hand
[2:04:36]
in picking out all of those
[2:04:38]
that we will be doing the
[2:04:40]
launch local projects so that
[2:04:42]
we will be assured they will
[2:04:44]
be thriving.
[2:04:51]
>> got it, thank you so much.
[2:04:53]
>> that's not just one, it is
[2:04:54]
a huge space, hopefully that
[2:04:56]
is one of the tenants there,
[2:04:57]
hopefully we get that taken
[2:05:00]
care of too, right.
[2:05:02]
>> great, you have direction.
[2:05:03]
I think this is also
[2:05:04]
important
[2:05:08]
to note that it's good the
[2:05:08]
one
[2:05:09]
year check-in, provide data
[2:05:10]
for us, right.
[2:05:10]
That way request
[2:05:11]
f we can
[2:05:12]
make an informed decision.
[2:05:14]
I think after all this I a
[2:05:15]
pilot program so we're able
[2:05:16]
to
[2:05:17]
kind of finesse and tweak a
[2:05:19]
few things but for right now,
[2:05:21]
this is what we're -- I'm
[2:05:23]
hearing consensus from my
[2:05:24]
colleagues here.
[2:05:25]
Good?
[2:05:25]
Okay.
[2:05:27]
>> you need a motion?
[2:05:28]
>> let me check on public
[2:05:29]
comments first.
[2:05:30]
>> no pblic comments but we
[2:05:31]
do need a motion.
[2:05:35]
>> we do need a motion now.
[2:05:37]
>> I will make the motion, is
[2:05:37]
there a second?
[2:05:38]
>> I second.
[2:05:40]
>> thank you, piser and
[2:05:42]
second, roll call.
[2:05:43]
>> vice mayor yeasting goe?
[2:05:44]
>> yes.
[2:05:45]
>> councilmember coleman?
[2:05:45]
>> yes.
[2:05:46]
Er maifrjt yor flores?
[2:05:48]
Inger yes.
[2:05:49]
>> councilmember nagales?
[2:05:51]
>> aye.
[2:05:51]
>> councilmember nicolas?
[2:05:52]
>> aye.
[2:05:58]
>> moving on to item 11 is a
[2:06:00]
record regarding a resolution
[2:06:02]
approving an increase to the
[2:06:03]
south san francisco toe
[2:06:06]
services rates to the maximum
[2:06:07]
allowable toeing rate that is
[2:06:09]
are comparable to other
[2:06:09]
police
[2:06:10]
agencies in northern san
[2:06:12]
mateo
[2:06:12]
county.
[2:06:14]
And 11a is the resolution.
[2:06:16]
>> tla's why you all are here
[2:06:16]
today.
[2:06:19]
>> thank you, good evening,
[2:06:20]
councilmembers, my name is
[2:06:22]
adam plank, one of the
[2:06:23]
captains with the police
[2:06:24]
department.
[2:06:25]
Tonight my presentation
[2:06:27]
involves an overview of the
[2:06:29]
city's rotational tow
[2:06:31]
program
[2:06:33]
and a request to update those
[2:06:36]
fees ask the industry
[2:06:37]
standard
[2:06:38]
for city ins san mateo county.
[2:06:41]
The police department have
[2:07:00]
vehicles removed from the
[2:07:01]
[Inaudible] Insurance
[2:07:02]
requirements, alcohol and
[2:07:02]
drug
[2:07:04]
testing loosing kaix of where
[2:07:06]
those storage lots are,
[2:07:08]
response times, safeguarding
[2:07:09]
vehicles and following the
[2:07:10]
maximum rates that tow
[2:07:12]
companies can charge for
[2:07:13]
police generated tows are
[2:07:13]
some
[2:07:15]
of those regulations.
[2:07:19]
Those regulations ensure that
[2:07:21]
tow companies provide safe
[2:07:21]
quality service to our
[2:07:22]
community and their vehicles
[2:07:23]
are accessible and within
[2:07:24]
secured storage facilities if
[2:07:27]
south san francisco.
[2:07:28]
A police generated tow
[2:07:28]
request
[2:07:33]
can happen for a variety of
[2:07:33]
reasons.
[2:07:35]
And those could include a
[2:07:36]
vehicle that's blocking a
[2:07:39]
roadway and cannot be safely
[2:07:41]
moved, certain violations of
[2:07:43]
the vehicle code like
[2:07:43]
blocking
[2:07:44]
someone's driveway and we're
[2:07:46]
unable to get a hold of that
[2:07:47]
owner, parking in a a posted
[2:07:48]
construction zone, a marked
[2:07:50]
tow away zone and we can't
[2:07:50]
get
[2:07:53]
a hold of those owners and
[2:07:55]
also when certain cases when
[2:07:57]
driver's arrested, the
[2:07:57]
vehicle
[2:07:58]
can't safely remain parked at
[2:07:59]
the scene.
[2:08:03]
We do make attempts to locate
[2:08:05]
the owner and have the
[2:08:06]
vehicle
[2:08:08]
moved prior to it being towed
[2:08:10]
in the crcumstances where we
[2:08:12]
have that ability to make
[2:08:14]
that
[2:08:15]
decision.
[2:08:16]
Our mximum allowable tow
[2:08:18]
rates have been unchanged
[2:08:20]
since 2016 resulting in our
[2:08:22]
rates being the lowest of the
[2:08:23]
8 jurisdictions in northern
[2:08:25]
san mateo county.
[2:08:29]
Tow companies like other
[2:08:31]
businesses have expressed
[2:08:34]
experiences with increased
[2:08:35]
operational costs like rent,
[2:08:37]
equipment, fuel, insurance
[2:08:37]
and
[2:08:40]
labor costs, per our
[2:08:41]
municipal
[2:08:43]
code, those police maximum
[2:08:47]
allowable tow fees can be
[2:08:49]
adjusted after a review from
[2:08:50]
the police department and
[2:08:51]
after speaking to a
[2:08:51]
designated
[2:08:54]
representative of those tow
[2:08:54]
companies.
[2:08:55]
And conducting a survey of
[2:08:58]
what the other rotational tow
[2:09:00]
companies in northern san
[2:09:03]
mateo county cities charge.
[2:09:05]
The current fee in south san
[2:09:08]
francisco for a basic tow fee
[2:09:09]
is $225.
[2:09:10]
After meeting with the
[2:09:11]
representative of the tow
[2:09:14]
companies, we conducted a
[2:09:19]
survey, as you can se on the
[2:09:20]
chart, san francisco fees are
[2:09:23]
the lowest of those 8 cities
[2:09:27]
in northern san mateo county.
[2:09:29]
The srvey that we conducted
[2:09:31]
taking south san francisco
[2:09:32]
out
[2:09:35]
showed an average of $323 per
[2:09:36]
tow as being the average
[2:09:37]
levering south san francisco
[2:09:40]
in as one of the 8 -- the
[2:09:44]
average would be $311 per tow.
[2:09:45]
The tow companies in addition
[2:09:46]
to the survey, the tow
[2:09:48]
companies have proposed we
[2:09:49]
increase the basic tow
[2:09:50]
service
[2:09:52]
fee to $325 so they remain
[2:09:54]
comparable to other
[2:09:55]
jurisdictions in northern san
[2:09:56]
mateo cunty.
[2:10:00]
On our next slide, you will
[2:10:03]
see what those proposed rates
[2:10:06]
would be and the additional
[2:10:07]
services that are involved in
[2:10:09]
towing vehicles.
[2:10:11]
It's important to note that
[2:10:12]
most vehicles only require a
[2:10:15]
basic tow and a basic storage
[2:10:16]
fee.
[2:10:16]
On some occassions,
[2:10:17]
specialized equipment lke a
[2:10:21]
flat bed a dolly, or a more
[2:10:22]
heavy duty medium sized heavy
[2:10:24]
duty or super duty truck are
[2:10:27]
needed to safely remover a
[2:10:29]
vehicle, a bus, a larger
[2:10:31]
vehicle from the safe --
[2:10:35]
safely from the road.
[2:10:38]
On our next slide, if the
[2:10:40]
proposed fees were accepted
[2:10:42]
and approved, this would show
[2:10:44]
where south san francisco
[2:10:47]
would be with those adjusted
[2:10:48]
rates, it's not at the very
[2:10:49]
top, it's in the middle,
[2:10:53]
comparable with the other
[2:10:55]
agencies.
[2:10:57]
In speaking with a couple
[2:10:58]
other agencies in northern
[2:10:59]
san
[2:11:00]
mateo county, I learned that
[2:11:01]
there are other cities on
[2:11:02]
this
[2:11:05]
list that are looking to also
[2:11:06]
evaluate and adjust their
[2:11:09]
rates to keep them current
[2:11:11]
with the industry standard.
[2:11:14]
As noted in the staff report,
[2:11:15]
but worth mentioning tonight,
[2:11:17]
all all of the proposed fees
[2:11:18]
we're talking about do not
[2:11:19]
get
[2:11:20]
paid to the city, these are
[2:11:22]
paid to the tow truck
[2:11:24]
companies and for their
[2:11:26]
services in towing these
[2:11:28]
vehicles dependent upon the
[2:11:29]
circumstances.
[2:11:31]
So, in conclusion, the
[2:11:33]
rotational tow program
[2:11:34]
establishes a standard level
[2:11:36]
of service that tow companies
[2:11:38]
must provide, it's regulated,
[2:11:40]
when performing their police
[2:11:42]
generated tows, the maximum
[2:11:44]
allowable tow fees have been
[2:11:46]
unchanged since 2016 and
[2:11:47]
currently don't accurately
[2:11:49]
reflect the industry standard
[2:11:51]
for northern san mateo county.
[2:11:52]
It's recommended that city
[2:11:54]
council review and adopt the
[2:11:55]
proposed rate adjustments for
[2:11:57]
the maximum allowable fees
[2:11:59]
associated with police
[2:11:59]
generated tow services.
[2:12:02]
Thank you, that concludes my
[2:12:03]
presentation, I'm available
[2:12:05]
for questions and with me
[2:12:05]
here
[2:12:07]
tonight are a representative
[2:12:07]
from each of the tow
[2:12:08]
companies
[2:12:10]
if you have an operational
[2:12:11]
question or something
[2:12:11]
specific
[2:12:12]
that I wouldn't be able to
[2:12:14]
answer for you.
[2:12:16]
>> thank you, captain plank,
[2:12:17]
appreciate the presentation.
[2:12:21]
Any questions?
[2:12:22]
Councilmember nagales?
[2:12:24]
>> thank you.
[2:12:26]
I appreciate kind of just
[2:12:27]
understanding what the actual
[2:12:28]
increase is ging to be
[2:12:29]
paying
[2:12:32]
for because I wasn't quite
[2:12:34]
sure, like, I was looking at
[2:12:35]
it like, okay, aren't we
[2:12:36]
getting a better deal by
[2:12:40]
paying less I terms of the
[2:12:42]
rate but you answered the
[2:12:43]
question for me.
[2:12:44]
So, when someone goes in, I
[2:12:46]
want to understand the fees
[2:12:47]
here, so what you're asking
[2:12:49]
for the basic tow fees is
[2:12:52]
going to be 325 now, the
[2:12:54]
person would come in and pay
[2:12:54]
for that.
[2:12:56]
There was something about an
[2:12:57]
administrative fee on the
[2:12:59]
bottom of the attachment b,
[2:13:00]
there was an administrative
[2:13:01]
fee?
[2:13:02]
>> yes, on the bottom of the
[2:13:03]
tow form?
[2:13:04]
>> yes.
[2:13:08]
>> yes, that is a south city
[2:13:09]
of south san francisco fee
[2:13:11]
that's in our master fee
[2:13:14]
schedule for the processing
[2:13:15]
of
[2:13:16]
paperwork, the mailing of
[2:13:18]
notices when a vehicle gets
[2:13:22]
towed to the registered
[2:13:23]
owner, that's the
[2:13:25]
administrative costs that are
[2:13:27]
paid to the police department
[2:13:28]
when there's a police
[2:13:31]
generated tow.
[2:13:33]
>> so I want to get that
[2:13:34]
process correct, when
[2:13:36]
someone's car gets towed, not
[2:13:39]
only are they paying
[2:13:40]
potentially a $325 towing
[2:13:41]
fee,
[2:13:43]
but now they're paying this
[2:13:43]
administrative fee as well?
[2:13:44]
>> yes, that's correct.
[2:13:47]
And that's a vehicle release
[2:13:47]
fee.
[2:13:49]
>> which is $160 now.
[2:13:49]
Er
[2:13:52]
>> yes, it is.
[2:13:54]
>> okay, has there been a
[2:13:54]
time
[2:13:56]
when an individual has come
[2:13:56]
to
[2:13:58]
the towing company and sy I
[2:14:00]
can't pay for these fees,
[2:14:00]
it's
[2:14:01]
too high.
[2:14:02]
Is there like a payment plan
[2:14:05]
that a person can do in terms
[2:14:06]
of trying to release the
[2:14:09]
vehicle?
[2:14:10]
>> in speaking to at least
[2:14:10]
one
[2:14:13]
of the companies, they did
[2:14:15]
express an option case by
[2:14:15]
case
[2:14:16]
based on the circumstances
[2:14:19]
where a payment plan might be
[2:14:23]
an option but it's also
[2:14:25]
somewhat o a risky option if
[2:14:27]
the vhicle is being released
[2:14:28]
and there's an agreement that
[2:14:30]
doesn't get fulfilled.
[2:14:34]
>> now, the person's already
[2:14:34]
being penalized already, and
[2:14:36]
for those who are potentially
[2:14:37]
low income and having a
[2:14:39]
difficult time paying for
[2:14:40]
these fees, a lot of the
[2:14:41]
folks
[2:14:42]
rely on their vehicle to get
[2:14:45]
to work or to get to point a
[2:14:48]
to point b, so I'm just
[2:14:49]
trying
[2:14:50]
to understand what the
[2:14:50]
process
[2:14:52]
is in terms of if someone is
[2:14:53]
having a difficult time
[2:14:54]
paying
[2:14:54]
for it.
[2:14:56]
If the person can't pay for
[2:14:58]
it, the car is going to be in
[2:15:00]
storage and now they can't
[2:15:03]
travel, you know or I guess
[2:15:04]
they have to take public
[2:15:05]
transportation in this case z.
[2:15:09]
>> from speak toing the tow
[2:15:11]
companies, the tow fee and
[2:15:11]
any
[2:15:13]
associated storage fees
[2:15:16]
usually isn't the hurdle that
[2:15:18]
needs to get over in order to
[2:15:21]
get the car out.
[2:15:24]
Oftentimes, there is
[2:15:24]
associated expired
[2:15:26]
registration fee that is are
[2:15:28]
owed to dmv that ae required
[2:15:30]
to be paid in current prior
[2:15:31]
to
[2:15:32]
getting thing vehicle
[2:15:32]
released
[2:15:34]
and back to them.
[2:15:39]
Also if there are other
[2:15:40]
circumstances, a driver's
[2:15:41]
license if the registered
[2:15:43]
owner has a a dmv issue that
[2:15:45]
needs to be corrected, there
[2:15:46]
might be something that needs
[2:15:49]
to be handled at dmv prior to
[2:15:51]
going to the tow to address
[2:15:52]
the basic fee and storage.
[2:15:55]
>> thank you for answering
[2:15:56]
that, I wonder if this is a a
[2:15:57]
hindrance in trying to
[2:15:58]
release
[2:16:00]
the vehicle, but it sound
[2:16:00]
like
[2:16:02]
that's not the main issue.
[2:16:04]
Are they located in south san
[2:16:05]
francisco, these three
[2:16:07]
companies?
[2:16:11]
>> bob junior's is located on
[2:16:13]
south linden, action tow has
[2:16:16]
an office on north canal --
[2:16:19]
south canal and courtesy tow,
[2:16:22]
I'm drawing a blank.
[2:16:23]
On montgomery avenue jst
[2:16:23]
into
[2:16:24]
san bruno.
[2:16:27]
>> that means the fast
[2:16:28]
service
[2:16:29]
service when we need tem.
[2:16:30]
>> which is one of the
[2:16:31]
requirements, either within
[2:16:32]
south san francisco or a
[2:16:33]
certain distance from our
[2:16:34]
city
[2:16:36]
limit that is allows anyone
[2:16:38]
who's having their car towed
[2:16:39]
from our police department
[2:16:42]
doesn't have to travel
[2:16:44]
multiple cities away or be
[2:16:45]
inconvenienced in order to
[2:16:46]
access their car.
[2:16:48]
>> okay, thank you, I'm fine
[2:16:48]
with this now.
[2:16:49]
Thank you.
[2:16:50]
>> thank you.
[2:16:53]
Other questions?
[2:16:54]
Go ahead, COUNCILWOMAN.
[2:16:56]
>> captain plank, if a a car
[2:16:59]
is towed not because of te
[2:17:01]
owner's fault, say for
[2:17:02]
example
[2:17:03]
it's been car napped and
[2:17:05]
vandalized and it didn't get
[2:17:07]
to an owner until sometime
[2:17:10]
later, how -- are they still
[2:17:11]
liable to pay for all those
[2:17:12]
charges?
[2:17:17]
>> if a vehicle is recovered
[2:17:19]
stolen vehicle, if the
[2:17:19]
registered owner is the
[2:17:20]
victim
[2:17:21]
of a crime and it's towed as
[2:17:24]
result of that crime, our fee
[2:17:27]
at the police department can
[2:17:32]
be wavered by us vered --
[2:17:33]
wavered by us under those
[2:17:33]
circumstances.
[2:17:35]
The other fee that is are
[2:17:36]
assessed by the tow
[2:17:37]
companies,
[2:17:38]
if there's isurance
[2:17:38]
involved,
[2:17:41]
whether it's triple a or some
[2:17:43]
other type of insurance that
[2:17:44]
has coverage on whatever
[2:17:45]
other
[2:17:45]
circumstances happened, I
[2:17:46]
know
[2:17:48]
that that is an option for
[2:17:51]
what was described to me as a
[2:17:51]
reimbursement from those
[2:17:53]
companies, maybe an upfront
[2:17:54]
charge with the insurance
[2:17:56]
reimbursing at a later time,
[2:17:58]
but more specifically I might
[2:17:59]
need to refer to one of the
[2:18:02]
tow companies for how the
[2:18:07]
processing of the transaction
[2:18:08]
would be.
[2:18:10]
>> could we hve them come up
[2:18:12]
and give us the scenario
[2:18:17]
please, if you don't mind.
[2:18:18]
Good evening, welcome.
[2:18:21]
>> my name is brian banks,
[2:18:21]
the
[2:18:24]
opener of action towing.
[2:18:25]
So, probably 95% of the tows
[2:18:27]
that we are doing are
[2:18:27]
normally
[2:18:29]
not the situation you're
[2:18:30]
describing, they're only
[2:18:30]
about
[2:18:32]
5% of the tows we're doing.
[2:18:33]
The majority of the tows
[2:18:33]
we're
[2:18:35]
doing are people that have
[2:18:37]
violated laws, have not paid
[2:18:39]
their registrations, are
[2:18:40]
driving without driver's
[2:18:42]
licenses and in some cases
[2:18:44]
many of the cases the cars
[2:18:46]
we're towing, probably 50% of
[2:18:47]
the cases we're doing in
[2:18:48]
south
[2:18:50]
san francisco is abandoned
[2:18:50]
vehicles.
[2:18:52]
So, it MAY seem like a lot of
[2:18:53]
money to you guys as you're
[2:18:54]
processing this, what you
[2:18:55]
need
[2:18:56]
to understand is that more
[2:18:58]
than 50% of these vehicles,
[2:19:00]
probably more like 65 or 70
[2:19:02]
percent of these vehicles are
[2:19:03]
never being picked up.
[2:19:05]
You guys have done a
[2:19:05]
wonderful
[2:19:06]
job in south san francisco
[2:19:07]
and
[2:19:08]
being here tonight, this is
[2:19:09]
amazing and beautiful and
[2:19:11]
we're doing our part to help
[2:19:13]
keep your streets clean.
[2:19:15]
So, what we're asking for is
[2:19:16]
rate increase because of the
[2:19:18]
fact that our businesses,
[2:19:19]
you've heard it from your
[2:19:21]
planning department and
[2:19:22]
everybody else, things have
[2:19:24]
gone through the roof.
[2:19:26]
Metal for us is at a 7 year
[2:19:28]
low and so that's how we get
[2:19:29]
paid for these vehicle,
[2:19:31]
sometimes we might tow a car
[2:19:32]
where we have a driver goes
[2:19:34]
out and tows it, he's on the
[2:19:35]
job for an hour and a half,
[2:19:38]
two hours, we have to pay a
[2:19:40]
lien sale fee, we have to
[2:19:41]
store this vehicle for
[2:19:41]
upwards
[2:19:44]
of some cases, anywhere will
[2:19:45]
be a quick one will be 30 day
[2:19:47]
and is a long one will be 6
[2:19:49]
months, we're stringing in a
[2:19:50]
building, rents are not
[2:19:50]
cheap,
[2:19:53]
we discussed what it is a
[2:19:55]
square foot, especially for a
[2:19:58]
warehouse so, the expenses
[2:19:58]
are
[2:20:00]
enormous and most of the
[2:20:01]
vehicles are not being picked
[2:20:03]
up websinger eve seen
[2:20:04]
inflation of our equipment
[2:20:04]
has
[2:20:07]
gone up over 30% to buy a new
[2:20:08]
tow truck, our insurance is
[2:20:11]
going up on average just like
[2:20:13]
yours, I'm insurance on your
[2:20:15]
homes 20% a year tha,'s the
[2:20:17]
facts of what's going on, all
[2:20:19]
of these expenses are goipg
[2:20:21]
up, we're not trying to
[2:20:21]
punish
[2:20:23]
-- it looks like a lot of
[2:20:25]
money but we're not trying to
[2:20:26]
punish good people, we have
[2:20:26]
to
[2:20:27]
pay for the s
[2:20:27]
frs we provide
[2:20:29]
for the city and keeping your
[2:20:30]
streets clean s you guys
[2:20:30]
will
[2:20:31]
continue to mover forward and
[2:20:33]
have this beautiful city
[2:20:33]
where
[2:20:35]
people want to develop
[2:20:37]
apartment and is buildings
[2:20:38]
and
[2:20:39]
do business here, so the
[2:20:39]
other
[2:20:42]
answer to your question is
[2:20:44]
those 5%, most of those
[2:20:44]
people
[2:20:45]
do have insurance, like if
[2:20:45]
you
[2:20:47]
were in an accident and the
[2:20:49]
people that hit you did not
[2:20:50]
have insurance, you would
[2:20:50]
lean
[2:20:52]
on your insurance on that, if
[2:20:54]
there's accident and is your
[2:20:56]
car is stolen, the good
[2:20:57]
people
[2:20:58]
seem to pay the fees for the
[2:20:59]
bad people and there's no
[2:21:00]
other way around that but
[2:21:02]
providing they have good
[2:21:03]
insurance and follow the laws
[2:21:05]
that they have, normally the
[2:21:07]
insurance will come ad
[2:21:08]
reimburse them for their
[2:21:10]
expense and is most of the
[2:21:12]
time the insurance picks them
[2:21:14]
up, the people who do pick
[2:21:15]
them up primarily are the
[2:21:19]
people that have dui's,
[2:21:21]
expired reds, driving on a
[2:21:23]
suspended license, not good
[2:21:28]
behavior they're being pun
[2:21:29]
--
[2:21:30]
punished for a reason, this
[2:21:30]
is
[2:21:33]
another part of a punishment,
[2:21:34]
that's why we're asking for
[2:21:36]
more money, for the obvious
[2:21:38]
expenses we have, we've been
[2:21:39]
good partners to the city for
[2:21:41]
a long time, we asked for a
[2:21:42]
long period of time for
[2:21:43]
raises, ask you guys have
[2:21:46]
worked for us but we feel
[2:21:47]
this
[2:21:48]
is necessary, we hope you
[2:21:49]
take
[2:21:50]
this into consideration what
[2:21:51]
we're asking for tonight.
[2:21:55]
>> my name is steven, I'm
[2:21:56]
with
[2:21:57]
bob junior towing, we eer
[2:21:59]
been around a long time here
[2:22:02]
and bryan pretty much said
[2:22:03]
what's happening with our
[2:22:07]
towing companies and there's
[2:22:07]
two different entities when
[2:22:08]
it
[2:22:12]
comes to the towing, we want
[2:22:15]
to take care of the people
[2:22:17]
within south san francisco as
[2:22:18]
well as te people that are
[2:22:20]
coming through the city as
[2:22:23]
well and when we do that, it
[2:22:26]
is not easy for them, what
[2:22:26]
you
[2:22:27]
were saying, how do you pay
[2:22:29]
for it and what do you do
[2:22:29]
when
[2:22:31]
they come to you and all
[2:22:31]
those
[2:22:35]
types of things.
[2:22:36]
It's a tough situation we
[2:22:36]
have
[2:22:37]
to go through and every
[2:22:38]
scenario is different than
[2:22:38]
the
[2:22:41]
other one and we take a look
[2:22:43]
at each and every individual
[2:22:44]
within this city and also
[2:22:46]
outside the city when they
[2:22:47]
come here.
[2:22:49]
And it's a tough decision on
[2:22:51]
our end to make that decision
[2:22:52]
on how we're going to do this
[2:22:53]
with them.
[2:22:56]
We want to do it in a really
[2:22:59]
-- the expenses of this, it's
[2:23:00]
really expensive for them to
[2:23:02]
get the car released, go to
[2:23:03]
the police department and
[2:23:04]
have
[2:23:06]
that done as well, go to the
[2:23:08]
dmv, by the time they come
[2:23:09]
tows, they're pretty upset so
[2:23:11]
we want to make it as
[2:23:12]
pleasant
[2:23:13]
as we can for these folks and
[2:23:15]
make it to where they could e
[2:23:16]
either afford to get their
[2:23:16]
car
[2:23:18]
out, if not, then we have to
[2:23:19]
look at different options and
[2:23:21]
a lot of times the different
[2:23:22]
options that they don't come
[2:23:24]
to get their cars out, so
[2:23:26]
we're stuck with that.
[2:23:27]
We have to process the
[2:23:29]
vehicles like he was saying
[2:23:32]
and it's a low time with the
[2:23:34]
junk industry and all those
[2:23:36]
types of things and it's
[2:23:38]
getting tougher to do
[2:23:38]
business
[2:23:40]
with that.
[2:23:42]
It's pretty much what brian
[2:23:44]
was saying, the cost of the
[2:23:45]
rents and the insurance and
[2:23:46]
stuff like that.
[2:23:47]
>> thank you, I appreciate
[2:23:47]
that.
[2:23:50]
>> thank you.
[2:23:53]
>> good evening, my name is
[2:23:55]
gino with courtesy tow and it
[2:23:57]
pretty much sums it up, what
[2:23:58]
my other two colleagues have
[2:24:01]
said, insurance costs are
[2:24:02]
through the roof, prices of
[2:24:04]
newer trucks ask newer
[2:24:06]
equipment to stay doing
[2:24:09]
business in california, the
[2:24:12]
regulations of the def
[2:24:13]
regulations, retiring old
[2:24:15]
trucks, having to buy new
[2:24:17]
equipment, having to invest
[2:24:17]
in
[2:24:19]
new equipment, driver
[2:24:22]
education, safety programs,
[2:24:25]
workers compensation, it all
[2:24:28]
costs, so we expect cities
[2:24:29]
that we do business with to
[2:24:31]
kind of stay as competitive
[2:24:31]
as
[2:24:32]
possible.
[2:24:38]
It is unfortunate like my
[2:24:39]
colleagues said but the
[2:24:40]
insurance per truck per year
[2:24:44]
is 25 to 30 thousand dollars
[2:24:45]
per truck per year
[2:24:46]
televising's not many
[2:24:47]
companies souring, it's hard
[2:24:49]
to do business in california
[2:24:52]
bottom line and it's
[2:24:52]
unfortunate to say that but
[2:24:53]
we
[2:24:54]
have to stay with what's
[2:24:54]
working.
[2:24:56]
>> thank you.
[2:24:58]
>> any questions to the
[2:24:58]
operators?
[2:25:01]
>> the last time we loked at
[2:25:02]
this was 2016?
[2:25:04]
>> yes, that is correct.
[2:25:06]
>> so, are they willing to
[2:25:07]
not
[2:25:11]
come back for another 9 -- 8
[2:25:12]
years?
[2:25:13]
>> I wuld like to make a
[2:25:14]
suggestion.
[2:25:16]
I don't know if you guys are
[2:25:17]
open to this or not, with
[2:25:18]
most
[2:25:19]
agencies, we renew on an
[2:25:21]
annual basis and one of the
[2:25:22]
things I would suggest if
[2:25:22]
it's
[2:25:23]
possible and it's not too
[2:25:25]
late, we put some sort of
[2:25:25]
cola
[2:25:27]
in this for the district
[2:25:28]
we're
[2:25:29]
in, a cost of living
[2:25:30]
increase,
[2:25:32]
I think that -- if that was
[2:25:33]
the case, there would
[2:25:34]
probably
[2:25:35]
be no reason we would have to
[2:25:36]
come back and see you guys, I
[2:25:40]
think it's fair based on a
[2:25:42]
market value of what's going
[2:25:43]
on and the county we live in.
[2:25:44]
If we could do something like
[2:25:44]
that, I think it will save
[2:25:45]
you
[2:25:48]
guys 20 minutes of your time
[2:25:50]
fiver years from now we come
[2:25:51]
crying, I don't know if
[2:25:51]
that's
[2:25:52]
a possibility.
[2:25:53]
>> any other questions for
[2:25:54]
the
[2:25:55]
operators?
[2:25:55]
>> captain plank?
[2:25:58]
>> so, when we have a problem
[2:26:00]
on the street and we have
[2:26:02]
three operator, we rotate but
[2:26:03]
maybe somebody's not
[2:26:03]
available
[2:26:04]
so you bounce it to somebody
[2:26:06]
else o how does that work?
[2:26:10]
>> exactly, it's rotation
[2:26:10]
one,
[2:26:15]
two, three, you should --
[2:26:16]
>> you should start with
[2:26:17]
courtesy.
[2:26:19]
>> yeah, if we get to action
[2:26:21]
tow and they're unavailable
[2:26:21]
or
[2:26:22]
don't have the equipment
[2:26:23]
available to do it, we'll
[2:26:25]
bounce back to the next one
[2:26:27]
and then put them at the top
[2:26:30]
for the next rotation to keep
[2:26:31]
it balanced.
[2:26:36]
>> okay.
[2:26:38]
I'm interested, captain
[2:26:38]
plank,
[2:26:41]
on the police side of it, if
[2:26:42]
somebody comes home late
[2:26:45]
friday night and they park,
[2:26:47]
maybe they're blocking a
[2:26:48]
driveway maybe b a little
[2:26:49]
bit,
[2:26:50]
what kind of efforts do we
[2:26:52]
make to not make it an
[2:26:53]
automatic tow?
[2:26:56]
>> that's a great question.
[2:26:57]
Our intention and desire is
[2:26:59]
not to tow the vehicle, it
[2:27:02]
takes an officer out of s
[2:27:03]
frs
[2:27:05]
from anywhere from 25-45
[2:27:06]
minutes deal witching the
[2:27:08]
paperwork and hooking it up.
[2:27:11]
We have access to the license
[2:27:13]
plate shows where that car is
[2:27:14]
registered to, we make every
[2:27:14]
attempt --
[2:27:16]
>> woe would knock on a door
[2:27:17]
if we could?
[2:27:19]
>> we would, we would check
[2:27:23]
our database if we hve a
[2:27:25]
recent phone nmber, we wuld
[2:27:27]
try to contact tem in
[2:27:29]
multiple different avenues
[2:27:29]
until we've exhausted
[2:27:32]
everything and then we
[2:27:33]
ultimately would have to tow
[2:27:34]
the car.
[2:27:36]
It has to meet a criteria for
[2:27:38]
blocking that driveway too,
[2:27:39]
so
[2:27:40]
we'll evaluate, if it's
[2:27:42]
partially blocking the
[2:27:43]
driveway but the person can
[2:27:45]
still get out, we're likely
[2:27:48]
not going to tow that vehicle.
[2:27:49]
>> is that a different fine
[2:27:51]
for somebody, is there a fine
[2:27:54]
for that for a motorist that
[2:27:55]
partially blocks a driveway.
[2:27:57]
>> you can receive a ticket
[2:28:00]
for blocking a driveway and
[2:28:03]
that's a citation.
[2:28:05]
The -- if the person, I mean,
[2:28:06]
I just imagine after this
[2:28:07]
meeting, if I were to go home
[2:28:09]
and there was a car blocking
[2:28:11]
my driveway and nobody could
[2:28:13]
get a hold of it, my desire
[2:28:14]
would be for it to be towed
[2:28:17]
because I want to go home and
[2:28:20]
do my evening stuff and go to
[2:28:21]
work tomorrow so that would
[2:28:21]
be
[2:28:23]
my expectation.
[2:28:25]
>> I'm glad we make the front
[2:28:26]
end effort.
[2:28:27]
>> excellent point.
[2:28:29]
Go ahead.
[2:28:32]
>> so, the 225 is the 2016
[2:28:35]
amount and if we follow the
[2:28:38]
average inflation rate of
[2:28:38]
3.26
[2:28:41]
per year, that will be $300,
[2:28:43]
now, to address what you were
[2:28:44]
asking for, that if you can
[2:28:45]
do
[2:28:46]
it every year, I think that
[2:28:49]
will be for the next round,
[2:28:51]
right, and it depends also on
[2:28:53]
how your bandwidth to work
[2:28:55]
with them if that's what they
[2:28:57]
wanted to have an annual
[2:28:58]
inflationary cst.
[2:29:01]
But for now, we're just
[2:29:02]
talking about the suggestion
[2:29:05]
to increase it from 225 to
[2:29:05]
325
[2:29:08]
which is already higher than
[2:29:11]
if you compute for the annual
[2:29:14]
inflationary rate from 2016
[2:29:14]
to
[2:29:17]
2025, it should just be about
[2:29:18]
to $300.
[2:29:20]
>> we're okay with the 325 at
[2:29:21]
the moment.
[2:29:23]
>> that's what we're tlking
[2:29:23]
about.
[2:29:26]
I'm just telling you that
[2:29:27]
it's
[2:29:29]
$25 more than --
[2:29:31]
>> in addition.
[2:29:45]
>> [Inaudible].
[2:29:45]
>> thank you.
[2:29:50]
>> I did do the math, it
[2:29:51]
compounded as 28.8%, comes
[2:29:52]
out
[2:29:53]
to around $300.
[2:29:55]
>> captain plank, it says on
[2:29:56]
attachment a, if you believe
[2:29:58]
you have been unfairly
[2:30:00]
channeled, please contact
[2:30:01]
south city pd traffic
[2:30:03]
division, how many of those
[2:30:04]
have you been contacted in
[2:30:05]
what manner, I want to know
[2:30:07]
about performance and
[2:30:08]
accountability too about this.
[2:30:12]
>> I'm not aware of any
[2:30:12]
formal
[2:30:13]
complaints where someone had
[2:30:19]
called and said I'm being
[2:30:22]
overcharged or the most that
[2:30:25]
we would receive is if
[2:30:25]
someone
[2:30:27]
indicated that maybe there
[2:30:28]
was
[2:30:31]
a minor scratch or blemish on
[2:30:33]
a bumper might claim that
[2:30:35]
wasn't there prior to and
[2:30:35]
they
[2:30:36]
say it was as a result of a
[2:30:40]
tow but there's no price
[2:30:41]
gouging or delaying so
[2:30:42]
there's
[2:30:44]
an extra daily storage fee or
[2:30:45]
pushing it until after hours
[2:30:47]
so then there's an after
[2:30:48]
hours
[2:30:49]
fee added to it, I'm not
[2:30:50]
aware
[2:30:52]
of any of those taking place.
[2:30:53]
>> toy
[2:30:55]
f tows are considered
[2:30:57]
vehicle impounds as part of
[2:30:59]
what you do or how are those
[2:31:00]
classified sm
[2:31:02]
>> so, a vehicle impound
[2:31:02]
would
[2:31:04]
be if someone has a
[2:31:08]
restriction on their driver's
[2:31:09]
license, sspended, has proof
[2:31:11]
of service, is aware they
[2:31:12]
shouldn't be driving and
[2:31:14]
continues to drive, so, and
[2:31:16]
continue tos drive a car
[2:31:21]
that's registered to them.
[2:31:23]
So, that would be a 30 day
[2:31:23]
impound.
[2:31:24]
>> okay.
[2:31:24]
>> another impocketbacker
[2:31:26]
pound would be if someone has
[2:31:28]
multiple prior convictions
[2:31:29]
for
[2:31:30]
driving under the influence
[2:31:31]
and there was restrictions
[2:31:32]
that said they're not allowed
[2:31:34]
to drive or else that would
[2:31:34]
be
[2:31:35]
an impound.
[2:31:37]
The majority of the other
[2:31:38]
tows
[2:31:39]
we do are storage.
[2:31:40]
>> got it.
[2:31:43]
>> it doesn't have a set time
[2:31:45]
period that it needs to be
[2:31:50]
held at the tow yard if the
[2:31:52]
owner responds within 30
[2:31:53]
minutes from it being towed,
[2:31:55]
they can access the car and
[2:31:58]
get it out, the impound would
[2:32:00]
be a specific situation.
[2:32:02]
>> so, that includes dui
[2:32:04]
vehicles that are picked up
[2:32:06]
during ceck points?
[2:32:08]
>> no, it wouldn't.
[2:32:10]
That charge, I'm sorry, that
[2:32:11]
authority to tow that car
[2:32:13]
would be a storage, it would
[2:32:15]
be the driver's arrested and
[2:32:17]
we aren't able to lever it at
[2:32:19]
its current location, we do
[2:32:21]
leave the vehicles at their
[2:32:23]
resting point if they're
[2:32:25]
legally parked, if they're on
[2:32:26]
their street, we don't take
[2:32:27]
them automatically.
[2:32:31]
If it's parked in a tow away
[2:32:33]
zone and if we leave it
[2:32:33]
there,
[2:32:35]
it will be towed later on
[2:32:35]
that
[2:32:37]
night or if it's parked in a
[2:32:42]
road zone or in unsafe area
[2:32:42]
or
[2:32:43]
an area that's prone to have
[2:32:45]
higher vehicle burglaries or
[2:32:47]
crime, our community care
[2:32:48]
taking authority is to remove
[2:32:49]
the vehicle and have it
[2:32:50]
stored
[2:32:51]
safely until the person can
[2:32:52]
get it out.
[2:32:54]
So, not all arrests result in
[2:32:55]
a tow as well.
[2:32:57]
>> understood, thank you for
[2:33:00]
that clarification.
[2:33:01]
>> I don't mean to belabor
[2:33:02]
this, I think there is an
[2:33:05]
argument to be made an an
[2:33:06]
annual adjustment, maybe a
[2:33:07]
cpi
[2:33:09]
and we have something
[2:33:09]
similar,
[2:33:14]
I think every three years we
[2:33:15]
look at our scavenger rates
[2:33:17]
and we adjust to a percentage
[2:33:19]
of the cpi, and if we did
[2:33:21]
that, even though it wasn't
[2:33:24]
reaching the full expense, it
[2:33:27]
would allow us to go a number
[2:33:32]
of years, at in time, the
[2:33:35]
operators can come and ask
[2:33:36]
for
[2:33:36]
an increase if things felt
[2:33:37]
like they did now, so I think
[2:33:38]
we should can consider a
[2:33:39]
little quution the cpi, maybe
[2:33:41]
a percentage of the annual.
[2:33:43]
>> great.
[2:33:44]
>> I'm supportive of that
[2:33:47]
>> I want to hear from
[2:33:48]
everyone.
[2:33:49]
>> I'm fine with that.
[2:33:51]
>> okay.
[2:33:55]
>> do we do 60% on our
[2:33:56]
scavenger utility bill?
[2:33:58]
>> I did just look at tat
[2:33:58]
and
[2:34:00]
I would have to get back to
[2:34:00]
you.
[2:34:01]
That does sound correct.
[2:34:02]
>> okay.
[2:34:03]
>> councilmember?
[2:34:07]
>> so, tonight I was very
[2:34:09]
much prepared to vote no but
[2:34:11]
think based on sergeant
[2:34:12]
plank,
[2:34:13]
I'm a lot more comfortable
[2:34:15]
voting on this item, the
[2:34:16]
reason is I have experienced
[2:34:17]
being tow and had I have
[2:34:21]
others who have experienced
[2:34:22]
being towed in san francisco,
[2:34:23]
in san francisco, they're
[2:34:24]
looking for every reason to
[2:34:27]
tow a vehicle and it's
[2:34:27]
disgusting and predatory,
[2:34:28]
here
[2:34:29]
it looks like we're trying to
[2:34:30]
do everything but tow a
[2:34:34]
vehicle, only in the most
[2:34:35]
extreme circumstances which I
[2:34:37]
appreciate and I believe that
[2:34:39]
having a cpi adjustment
[2:34:41]
annually would make a lot of
[2:34:42]
sense, that way we don't have
[2:34:44]
to bring it back again.
[2:34:47]
>> sure, like brian had said,
[2:34:48]
some cities, I don't know
[2:34:50]
around here, I do know of
[2:34:51]
some
[2:34:52]
cities to do that, it's a
[2:34:53]
much
[2:34:54]
shorter presentation and much
[2:34:55]
more of an update, this is
[2:34:57]
what the new number is and,
[2:34:59]
yeah, I can look into that
[2:34:59]
for
[2:34:59]
sure.
[2:35:00]
>> thank you, captain.
[2:35:03]
do we have any public
[2:35:04]
comments?
[2:35:05]
>> no public comments, mayor.
[2:35:06]
>> thank you.
[2:35:09]
If not, I am looking for a
[2:35:09]
motion.
[2:35:10]
>> so moved.
[2:35:11]
Er
[2:35:12]
>> I'm sorry, mayor, just to
[2:35:13]
clarify waoe, doipg a motion
[2:35:15]
for the resolution with an
[2:35:18]
amendment to the item or --
[2:35:20]
>> everyone agrees to the
[2:35:21]
amendment, right, so yes.
[2:35:24]
>> eel -- I'll look to the
[2:35:24]
motion maker?
[2:35:27]
>> to the amendment?
[2:35:30]
If we really would like to go
[2:35:31]
for the 3.26 average
[2:35:32]
inflation, the amount of
[2:35:33]
money
[2:35:35]
from 2016 to 2025 is $300,
[2:35:36]
but
[2:35:38]
I'll just let it go and next
[2:35:39]
time maybe you will come to
[2:35:40]
us
[2:35:43]
and ask for a different one.
[2:35:45]
>> so you're making the
[2:35:45]
motion
[2:35:47]
just to adopt the proposed
[2:35:50]
fees with no automatic
[2:35:50]
inflationary adjustment?
[2:35:52]
>> and I'll second it but on
[2:35:54]
that question, we can come
[2:35:56]
back at any time and include
[2:35:58]
cpi, a percentage of cpi?
[2:35:59]
>> yes.
[2:36:00]
>> so for tonight we're
[2:36:01]
talking about what staff
[2:36:02]
presented?
[2:36:03]
>> correct.
[2:36:04]
>> okay, clarified, thank
[2:36:05]
you,
[2:36:05]
all.
[2:36:07]
>> perfect, I have a first
[2:36:08]
from councilmember nicolas a
[2:36:09]
second from vice mayor
[2:36:10]
addiego.
[2:36:10]
Er
[2:36:11]
>> roll call.
[2:36:12]
>> MAY xwrorbacker yo
[2:36:12]
r mrez
[2:36:13]
rez?
[2:36:14]
>> yes.
[2:36:15]
>> nicolas?Frjts aye.
[2:36:15]
>> addiego?
[2:36:16]
>> yes.
[2:36:17]
>> coleman?
[2:36:18]
>> yes.
[2:36:18]
>> nagales?
[2:36:19]
>> yes.
[2:36:21]
>> motion passes, thank you,
[2:36:22]
captain plank, thank you,
[2:36:23]
everyone, thank you,
[2:36:24]
gentlemen.
[2:36:26]
>> moving on to item number
[2:36:26]
12
[2:36:28]
is a report regarding an
[2:36:32]
ordinance amending title 6,
[2:36:35]
chapter 6.46 of the south san
[2:36:37]
francisco municipal code to
[2:36:39]
adopt by reference title 4,
[2:36:41]
chapter 4.98 of the san mateo
[2:36:42]
county ordinance code and
[2:36:45]
repealing in its entirety
[2:36:48]
title 6, chapter 6.47, sales
[2:36:50]
of flavored tobacco products,
[2:36:52]
pharmacy sales of tobacco
[2:36:54]
products and sales of
[2:36:56]
electronic smoking devices
[2:36:56]
prohibited.
[2:36:58]
Item 12a is the ordinance.
[2:37:00]
>> so you're really going to
[2:37:02]
kick it off the park here,
[2:37:02]
MS.
[2:37:04]
Fernandez as your last
[2:37:04]
presentation.
[2:37:05]
>> this is my parting gift to
[2:37:08]
all of you.
[2:37:10]
Good evening, councilmembers,
[2:37:11]
christina fernandez, your
[2:37:12]
deputy city manager, I'm here
[2:37:14]
tonight to provide an update
[2:37:17]
and seek your approval for
[2:37:18]
our
[2:37:19]
flavored tobacco regulations
[2:37:20]
such that they cmply with
[2:37:23]
recent changes to state law.
[2:37:26]
With me tonight, I have our
[2:37:29]
team, lieutenant sair wyatt,
[2:37:32]
shawn occur, from the
[2:37:35]
tobacco's county education
[2:37:37]
team, myra daoe yez ramirez
[2:37:41]
and director of public works,
[2:37:42]
bob, so I want to thank them
[2:37:44]
for their efforts during this
[2:37:45]
process.
[2:37:46]
So again we're seking
[2:37:49]
council's approval to amend
[2:37:49]
the tobacco retailer permit
[2:37:51]
and adopt the county's
[2:37:52]
ordinance by reference.
[2:37:55]
I'm also going to update you
[2:37:57]
on our retailer outreach and
[2:37:58]
education efforts and then
[2:38:00]
provide you with next steps
[2:38:01]
on
[2:38:03]
tobacco education and
[2:38:03]
engagement efforts.
[2:38:05]
So, one of the primary
[2:38:05]
reasons
[2:38:07]
for the city's efforts around
[2:38:09]
tobacco is due to the rise of
[2:38:13]
vaping by mouther, there's 15
[2:38:15]
thousand flavors online, 93%
[2:38:17]
of youth who started vaping
[2:38:21]
start witched a flavored
[2:38:22]
product, 96% of high school
[2:38:23]
students who vape use flavor
[2:38:27]
and is 9% of san mateo
[2:38:29]
high-schoolers vape.
[2:38:29]
Vaping requires nicotine salt
[2:38:31]
which is highly concentrated
[2:38:33]
and bad for developing
[2:38:33]
brains,
[2:38:36]
it can cause anxiety and many
[2:38:39]
other detrimental health
[2:38:40]
effects.
[2:38:42]
So just a little background
[2:38:42]
on
[2:38:45]
past actions, back in 2008,
[2:38:48]
the city adopted the county's
[2:38:49]
tobacco retailer permit
[2:38:51]
ordinance by reference and
[2:38:53]
that essentially said that we
[2:38:55]
were requiring all tobacco
[2:38:58]
retailers to maintain a valid
[2:39:00]
tobacco retailer permit and
[2:39:02]
that we would have the
[2:39:03]
county's environmental health
[2:39:05]
division enforce those
[2:39:05]
permits.
[2:39:08]
In 2012, we then passed an
[2:39:10]
ordinance prohibiting new
[2:39:12]
significant tobacco retailers
[2:39:14]
and a significant retailer
[2:39:14]
has
[2:39:17]
20% or more of their floor
[2:39:19]
area space and/or 50% or more
[2:39:21]
of their completed sales
[2:39:23]
transactions including
[2:39:24]
tobacco
[2:39:27]
products or paraphernalia,
[2:39:30]
back in no. 2019 when I came
[2:39:30]
on board, there was an
[2:39:33]
interest on behalf of council
[2:39:36]
to pursue a flavored tobacco
[2:39:37]
banser we pursued that, it
[2:39:40]
bans the sale of flavored
[2:39:42]
tobacco in all businesses
[2:39:43]
except for all adult retail
[2:39:45]
and he iser they only allow
[2:39:45]
21
[2:39:47]
and over on their premises
[2:39:47]
and
[2:39:49]
that was effect tier JANUARY
[2:39:52]
1, 2020.
[2:39:54]
So, there have been some
[2:39:56]
recent changes to state law
[2:39:58]
which would necessitate these
[2:40:01]
updates to our ordinance.
[2:40:04]
In 2022, voters upheld senate
[2:40:07]
bill 793 which prohibited e
[2:40:09]
cigarette and is apes and
[2:40:13]
other tobacco items listed on
[2:40:16]
the screen, methane
[2:40:18]
cigarettes, flavored blunt
[2:40:20]
wraps, loose leaf roll your
[2:40:22]
own tobacco, rolling papers,
[2:40:25]
flavored, and tobacco product
[2:40:27]
flavor enhances, it did
[2:40:28]
exempt
[2:40:29]
flavored premium sig gars
[2:40:30]
with
[2:40:31]
the wolesale price of $12 or
[2:40:34]
more and it also exempted
[2:40:37]
flavored loose leaf, pipe
[2:40:40]
tobacco and flavored sheik ka
[2:40:42]
hookah tobacco which MAY only
[2:40:46]
be sold in adult only
[2:40:49]
retailers.
[2:40:53]
Another couple recent bill,
[2:40:56]
ab3218 and sb1230, ab3218
[2:40:58]
creates an unflavored tobacco
[2:41:01]
list and that list is
[2:41:01]
supposed
[2:41:03]
to be released by the
[2:41:03]
attorney
[2:41:05]
general by the the end of the
[2:41:06]
this year, products not on
[2:41:07]
this list would be considered
[2:41:10]
a flavored product.
[2:41:14]
Sb1230 or the stop act
[2:41:15]
complements 3218 such that it
[2:41:19]
allows the state to seize
[2:41:20]
flavored tobacco products not
[2:41:22]
on that list and it imposes
[2:41:24]
civil penalties on retailers
[2:41:28]
and wholesalers.
[2:41:30]
So, in 2023, the city receive
[2:41:33]
add a let frer the county
[2:41:35]
saying, listen, thankers for
[2:41:37]
adopting the 2019 flavored
[2:41:39]
tobacco ban because our
[2:41:40]
ordinance was modeled on
[2:41:41]
that,
[2:41:43]
however, we did make
[2:41:43]
exceptionbacker exemptions
[2:41:44]
such that all the other
[2:41:45]
cities
[2:41:48]
throughout the county also
[2:41:49]
made exemptions so there's a
[2:41:50]
patch work of ordinances out
[2:41:51]
there.
[2:41:54]
In order to reduce logistical
[2:41:56]
challenges with enforcing
[2:41:58]
various city ordinances
[2:41:58]
around
[2:42:00]
tobacco, the county said
[2:42:00]
we're
[2:42:03]
going adopt a new tobacco
[2:42:04]
retailer ordinance and have
[2:42:06]
stronger enforcement, have
[2:42:06]
retail restriction and is
[2:42:08]
there will be proximity
[2:42:11]
restrictions for new retail
[2:42:12]
businesses and they really
[2:42:13]
encouraged cities to adopt
[2:42:15]
this so there's a more
[2:42:17]
streamlined approach to
[2:42:17]
enforcement and
[2:42:18]
administration
[2:42:21]
of the retailer program.
[2:42:25]
So, the new county tobacco
[2:42:26]
ordinance requirements, it
[2:42:28]
does clean up some of the
[2:42:30]
language such tat it aligns
[2:42:32]
with sate law, so tobacco
[2:42:34]
prugt is then defined to
[2:42:35]
include synthetic nicotine
[2:42:37]
which in the past it did not
[2:42:39]
and it also expands the
[2:42:40]
definition of electronic
[2:42:42]
smoking device to include
[2:42:45]
non-nicotine products.
[2:42:47]
It also has issues around
[2:42:48]
proximity of where new
[2:42:50]
retailers could be located
[2:42:53]
such that it prohibits new
[2:42:55]
tobacco permit for any
[2:42:56]
location within a thousand
[2:42:58]
feet of the youth populated
[2:43:02]
area that could include
[2:43:05]
schools, public rec centers,
[2:43:07]
libraries, child care
[2:43:08]
facilities, preschools, those
[2:43:10]
are all considered youth
[2:43:11]
populated areas.
[2:43:13]
It also prohibits the issue
[2:43:13]
of
[2:43:16]
new permits with locations
[2:43:22]
within 500 feet within an
[2:43:23]
existing tobacco retailer,
[2:43:24]
posting of retailers unless
[2:43:26]
they have a permit and it
[2:43:27]
updates such that it
[2:43:29]
streamlines with new state
[2:43:31]
laws by increasing the age of
[2:43:35]
21 years to purchase tobacco
[2:43:36]
products.
[2:43:37]
So what does this mean for
[2:43:40]
existing retailers?
[2:43:42]
Upon discussions with county
[2:43:45]
staff, we understand that if
[2:43:47]
retailers meet one of these
[2:43:48]
three requirements, they will
[2:43:49]
be designated as a
[2:43:50]
preexisting
[2:43:53]
business and not subject to
[2:43:54]
new proximity requirements.
[2:43:56]
So, if a retailer previously
[2:43:59]
held a a tobacco permit under
[2:44:01]
the county's environmental
[2:44:02]
health services, if they're
[2:44:03]
register witched the state's
[2:44:05]
department of tax and fee
[2:44:07]
administration as a tobacco
[2:44:09]
retailer or if they hold a
[2:44:10]
south city business license
[2:44:12]
and is listed aa tobacco
[2:44:14]
retailer, then they would be
[2:44:15]
considered a preexisting
[2:44:16]
business and not have to get
[2:44:19]
new permit and be subject to
[2:44:21]
the thousand feet and the 500
[2:44:26]
feet requirements.
[2:44:28]
So, the new county ordinance
[2:44:31]
also mandates fines for any
[2:44:32]
violations, it increases the
[2:44:34]
fines up to $500 for the
[2:44:34]
first
[2:44:36]
violation and up a to
[2:44:38]
thousand for all subsequent
[2:44:39]
violation, it requires permit
[2:44:40]
suspension if a a business is
[2:44:43]
found to have sold to someone
[2:44:45]
under 21 and it requires
[2:44:47]
on-site inspections by the
[2:44:48]
county's environmental health
[2:44:49]
services department at least
[2:44:52]
twice a year.
[2:44:54]
So, some retailer and
[2:44:55]
community engagement, I
[2:44:55]
really
[2:44:58]
want to thank pd for their
[2:44:59]
assistance here.
[2:45:00]
We mailed out business
[2:45:01]
letters
[2:45:03]
to approximately 100
[2:45:04]
businesses who we thought
[2:45:05]
might be affected.
[2:45:09]
We also did three information
[2:45:10]
sessions, two in person and
[2:45:14]
one virtual and we also did
[2:45:15]
an
[2:45:16]
online tobacco retailer
[2:45:18]
survey, we targeted that with
[2:45:19]
the ecd distribution list we
[2:45:22]
have online and we also did
[2:45:23]
some social media posts
[2:45:24]
around
[2:45:25]
the survey encouraging folks
[2:45:27]
to take it.
[2:45:30]
And we also did in person
[2:45:31]
retailer visits such that we
[2:45:33]
visited about half of the
[2:45:34]
retailers that we have on
[2:45:35]
file
[2:45:38]
and we went and we spoke with
[2:45:40]
businesses and informed them
[2:45:43]
of the upcoming changes and
[2:45:44]
let them know how this could
[2:45:46]
potentially affect their
[2:45:47]
business and answered any
[2:45:49]
questions they MAY have,
[2:45:50]
overall most of the
[2:45:50]
businesses
[2:45:54]
said we haven't sold flavored
[2:45:56]
tobacco in four or five years.
[2:45:57]
There were questions around
[2:45:59]
sofm the other products such
[2:46:02]
as like flavored cigars, I
[2:46:03]
guess folks had questions
[2:46:04]
about that.
[2:46:06]
And so, yeah, overall, folks
[2:46:07]
didn't seem to really have
[2:46:09]
questions and they all seemed
[2:46:10]
to indicate they were
[2:46:14]
compliant with existing state
[2:46:14]
law.
[2:46:17]
So, for the next steps, you
[2:46:21]
know, currently chapter 20 of
[2:46:23]
our money code [Inaudible]
[2:46:26]
Chapter 20 is referenced in
[2:46:27]
chapter 6.47 which will be
[2:46:28]
repealed if this is approved
[2:46:30]
tonight, just to ensure
[2:46:32]
consistency the throughout
[2:46:32]
our
[2:46:35]
municipal code, staff will be
[2:46:37]
bringing chapter 4.20 to the
[2:46:38]
planning tuition for their
[2:46:39]
review and back the city
[2:46:40]
council for their review and
[2:46:41]
approval.
[2:46:42]
That being said, separate and
[2:46:44]
apart from that, I this
[2:46:45]
ordinance is approved
[2:46:46]
tonight,
[2:46:47]
we would go for a second
[2:46:49]
reading on APRIL 9 and this
[2:46:50]
would then be effective 30
[2:46:52]
days from that reading so
[2:46:52]
we'd
[2:46:55]
think about MAY 7.
[2:46:57]
And so with that, the team
[2:46:58]
and
[2:46:59]
I are here, happy to answer
[2:47:01]
any questions you MAY have.
[2:47:02]
>> thank you, christina, I
[2:47:06]
appreciate the presentation.
[2:47:09]
Questions?
[2:47:11]
>> I was going to say the
[2:47:12]
presentation was so complete
[2:47:15]
and prfect that I have no
[2:47:16]
questions.
[2:47:17]
Great finish.
[2:47:19]
>> I have just one or two
[2:47:20]
questions, I think it's
[2:47:21]
appropriate the first thing
[2:47:23]
that I passed with your help
[2:47:25]
happens to be the last thing
[2:47:29]
you're presenting here.
[2:47:30]
At the time, we had a
[2:47:33]
discussion back in 219 about
[2:47:35]
the businesses that will be
[2:47:36]
exempt.
[2:47:37]
At the time, there were two,
[2:47:38]
now there's one from my
[2:47:39]
reading o the staff report,
[2:47:40]
correct?
[2:47:40]
>> that's correct.
[2:47:42]
>> they would still be able
[2:47:42]
to
[2:47:47]
operate based upon the -- I
[2:47:49]
guess the criteria,
[2:47:50]
grandfathered in.
[2:47:51]
Thefrjt would still be able
[2:47:51]
to
[2:47:52]
operate but anything that
[2:47:52]
they
[2:47:54]
had that MAY be flavored,
[2:47:58]
there are some businesses
[2:47:58]
that
[2:48:00]
are maybe not compliant with
[2:48:01]
our existing ordinance,
[2:48:01]
right,
[2:48:03]
so it's maybe time to kind of
[2:48:04]
do some education and some
[2:48:06]
outreach just to make sure
[2:48:08]
they're above board with the
[2:48:09]
current ordinance but I will
[2:48:11]
say that that business would
[2:48:13]
not hen be able to sell
[2:48:14]
flavored tobacco, they can
[2:48:17]
stay in business and sell
[2:48:18]
unflavored tobacco but they
[2:48:19]
could not sell flavored
[2:48:20]
tobacco.
[2:48:22]
>> that was kind of the
[2:48:22]
conversation that the
[2:48:23]
previous
[2:48:24]
council had in terms of
[2:48:26]
making
[2:48:27]
sure that we are not damage
[2:48:29]
thing or hurting their
[2:48:30]
business in a sense because
[2:48:33]
that was a big topic amongst
[2:48:33]
us.
[2:48:36]
And so I kind of wanted
[2:48:37]
clarification on there's like
[2:48:39]
signage sometimes I see that
[2:48:42]
sells -- that says flavored
[2:48:42]
tobacco being sold.
[2:48:45]
Is that now being restricted
[2:48:50]
in terms of advertisement?
[2:48:51]
I'm trying to understand how
[2:48:51]
that --
[2:48:52]
>> yeah, so, as I understand
[2:48:54]
the new county ordinance,
[2:48:57]
unless you have a valid
[2:48:58]
tobacco retailer permit, you
[2:49:00]
would not be able to
[2:49:00]
advertise
[2:49:02]
tobacco products.
[2:49:04]
>> so, if you had a valid
[2:49:07]
license to sell flavored
[2:49:09]
tobacco, you are able to have
[2:49:10]
that signage?
[2:49:12]
>> so, flavored tobacco is
[2:49:12]
not
[2:49:15]
going to be allowed to be
[2:49:15]
sold
[2:49:17]
anywhere, so I think that if
[2:49:20]
they wanted to advertise like
[2:49:22]
cigarettes, they could, and
[2:49:24]
honestly if they want to
[2:49:26]
advertise flavored tobacco,
[2:49:27]
they probably could but I
[2:49:29]
don't see if they would if
[2:49:31]
they couldn't sell it but I
[2:49:33]
guess technically they could.
[2:49:34]
I don't know if you have
[2:49:36]
comments on that.
[2:49:38]
>> okay, I see those signage
[2:49:40]
and I always felt like that
[2:49:41]
should be restricted, okay.
[2:49:42]
>> yeah.
[2:49:43]
>> and then could we talk
[2:49:44]
about the county
[2:49:46]
implementation, so now we are
[2:49:49]
going from our own pd in
[2:49:49]
terms
[2:49:50]
of education and enforcement
[2:49:59]
now to the county.
[2:50:00]
>> it's twofold t the city
[2:50:01]
can
[2:50:02]
still enforce, we are looking
[2:50:04]
to to the county to do those
[2:50:06]
site inspections twice a year
[2:50:08]
and to enforce where
[2:50:10]
appropriate but definitely I
[2:50:12]
know pd will definitely have
[2:50:14]
hand in code enforcement and
[2:50:15]
code enforcement will also
[2:50:17]
have a hand in this th
[2:50:17]
and
[2:50:19]
once we adopt this, we're
[2:50:21]
looking at pushing out
[2:50:22]
education first.
[2:50:25]
I know lieutenant sair dotty
[2:50:27]
was successful in obtaining
[2:50:29]
state department of jstice
[2:50:32]
tobacco grant for money to do
[2:50:32]
outreach and education.
[2:50:34]
I don't know, lieutenant, if
[2:50:35]
you want to make a comment
[2:50:36]
here.
[2:50:38]
>> please, come on up.
[2:50:40]
>> good ever wantoning, yes,
[2:50:42]
the department of justice
[2:50:44]
tobacco grant we received,
[2:50:45]
our
[2:50:49]
primary goal is to provide
[2:50:51]
education since the
[2:50:52]
implementation of the grant,
[2:50:53]
we have gone out to the
[2:50:54]
businesses, provided
[2:50:54]
pamphlets
[2:50:57]
and information on our
[2:50:57]
current
[2:50:59]
muni code on tobacco
[2:51:00]
products,
[2:51:02]
checked t see that they were
[2:51:05]
in guidelines with our muni
[2:51:08]
code, so should we adopt the
[2:51:10]
new muni code, we would go
[2:51:10]
out
[2:51:13]
and implement the new muni
[2:51:14]
code, povide eucation, we
[2:51:16]
would not be enforcing it at
[2:51:17]
this time and just ensure
[2:51:18]
that
[2:51:19]
all the businesses understand
[2:51:22]
that the muni code, so our
[2:51:25]
primary action is education
[2:51:26]
before enforcement.
[2:51:27]
>> now I've seen the
[2:51:28]
education
[2:51:30]
process when we implemented
[2:51:30]
this.
[2:51:32]
I started seeing the flavored
[2:51:34]
tobacco getting taken away
[2:51:36]
like for like the wall fronds
[2:51:42]
or the 7th [Hr-e/]-elevens
[2:51:42]
where they were primarily
[2:51:43]
being sold, I was seeing
[2:51:43]
those
[2:51:44]
taken out.
[2:51:46]
The last question is the
[2:51:48]
hookah tobacco, the ordinance
[2:51:50]
says if that's still
[2:51:50]
permitted
[2:51:55]
if a business that's I guess
[2:51:58]
allowed 21 -- 21 or older on
[2:51:59]
the premise, if you're a
[2:52:02]
business that has that, you
[2:52:05]
can still continue as long as
[2:52:07]
an adult -- I don't want to
[2:52:09]
use your terminology in terms
[2:52:10]
of 21 and ogler.
[2:52:11]
>> we're adopt thing county's
[2:52:12]
ordinance which is stricter
[2:52:14]
than the state law such that
[2:52:16]
hookah would not be allowed.
[2:52:17]
>> okay.
[2:52:18]
alright.
[2:52:19]
That's all I have, thank you.
[2:52:23]
>> great, thank you.
[2:52:25]
>> so, I do have a question,
[2:52:27]
well, I I do sup or the the
[2:52:29]
ordinance but my question is
[2:52:31]
flavored tobacco has been
[2:52:33]
banned if for sometime now
[2:52:35]
statewide and yt when I go
[2:52:38]
out, there I see flavored
[2:52:39]
tobacco everywhere.
[2:52:43]
And so my question is, is it
[2:52:45]
an isue of enforcement, how
[2:52:50]
come it's still so pervasive
[2:52:51]
outside?
[2:52:56]
>> yeah, I mean, I don't know
[2:52:59]
I mean I would say that maybe
[2:53:01]
it's enforcement, you know,
[2:53:02]
maybe it's, yeah, wi eel pull
[2:53:07]
it off the shelf and then a a
[2:53:09]
month a a so and put it back
[2:53:10]
up, that kind of thing, but I
[2:53:10]
can't really speak to why
[2:53:12]
it's
[2:53:12]
pervasive.
[2:53:14]
I would assume it is probably
[2:53:15]
just enforcement and just
[2:53:18]
being consistent in
[2:53:19]
enforcement
[2:53:22]
>> and once we provide the
[2:53:24]
education to the retailers,
[2:53:24]
we
[2:53:26]
can also do more town halls
[2:53:27]
and invite retailers to
[2:53:29]
educate them on the new muni
[2:53:31]
code and the laws.
[2:53:33]
We would provide a time for
[2:53:35]
them to understand it, make
[2:53:35]
sure everyone is in
[2:53:36]
accordance
[2:53:41]
with it and then we can do
[2:53:41]
impact inspections similar to
[2:53:43]
what we do with our abc grant
[2:53:45]
where we go out, we make sure
[2:53:46]
they're following all of the
[2:53:48]
laws that they have to do
[2:53:49]
with
[2:53:51]
their license with abc, so we
[2:53:52]
could d inspections at these
[2:53:53]
retailers to make sure
[2:53:54]
they're
[2:53:56]
following the guidelines for
[2:53:57]
the tobacco products, so that
[2:53:59]
is an option we would be able
[2:54:01]
to have with that.
[2:54:02]
>> sure, thank you.
[2:54:04]
>> what's the timeline that
[2:54:07]
you allow tem to -- while
[2:54:07]
the
[2:54:09]
law implements that phase-in,
[2:54:10]
what -- is it varying or do
[2:54:12]
you work with each one, what
[2:54:14]
does it look like?
[2:54:17]
>> obviously we don't want to
[2:54:18]
go --
[2:54:19]
>> tat's exactly what I'm
[2:54:20]
going to.
[2:54:22]
>> education has always been
[2:54:27]
at the forefront of all of
[2:54:27]
our
[2:54:29]
grants, with abc as well, so
[2:54:30]
we -- the easiest way is to
[2:54:33]
kind of explain our abc
[2:54:33]
grant,
[2:54:35]
for instance we do these
[2:54:35]
impact inspections and we
[2:54:36]
will
[2:54:39]
go out to or retailers, our
[2:54:41]
licensees two or three time
[2:54:44]
sos the first time we'll go
[2:54:46]
over, make sure they're
[2:54:48]
following all of the
[2:54:49]
regulations for their
[2:54:50]
license,
[2:54:51]
make sure if they need to
[2:54:53]
update anything websinger ear
[2:54:54]
write things down, give them
[2:54:56]
some pamphlet and is go out
[2:54:57]
maybe a month later, check,
[2:54:59]
hey, did you fix these things
[2:55:00]
we talked about, if they
[2:55:01]
still
[2:55:02]
need to make some
[2:55:03]
corrections,
[2:55:04]
we'll write them town and
[2:55:04]
then
[2:55:06]
come out maybe a couple of
[2:55:07]
months later and then if
[2:55:09]
they're still not doing it,
[2:55:12]
maybe we'll start giving a
[2:55:16]
citation or we'll contact abc
[2:55:17]
to come out and do it that
[2:55:18]
way
[2:55:20]
so we'll give them plenty of
[2:55:22]
opportunities to correct the
[2:55:24]
behavior because they are
[2:55:25]
businesses in our city so we
[2:55:27]
do want to work with them.
[2:55:27]
>> okay.
[2:55:29]
Thank you.
[2:55:31]
Anyone else, questions?
[2:55:34]
I just wanted to know,
[2:55:36]
christina, you sent letters
[2:55:38]
for this community meeting to
[2:55:39]
100 businesses, how many of
[2:55:41]
those were tobacco retailers
[2:55:42]
approximately?
[2:55:44]
>> well, we only have -- so,
[2:55:47]
on the book, we have about 45
[2:55:49]
tobacco retailers so we sent
[2:55:52]
it to the 45 but tlen to
[2:55:54]
anyone else who MAY be sort
[2:55:55]
of
[2:55:55]
associated with it.
[2:55:58]
>> but I wanted to highlight
[2:56:00]
that no tobacco retailers
[2:56:01]
attended any of the three
[2:56:01]
meetings.
[2:56:03]
>> we had cmmunity members
[2:56:05]
come and speak about tobacco
[2:56:08]
and how they weren't fans of
[2:56:10]
tobacco but we did not have
[2:56:11]
any retailers, we had a
[2:56:12]
little
[2:56:13]
more luck with the surveys
[2:56:14]
but
[2:56:15]
the surveys indicate that
[2:56:15]
most
[2:56:18]
folks are compliant with the
[2:56:19]
lasers already.
[2:56:20]
>> alright.
[2:56:22]
Any other questions or
[2:56:22]
comments?
[2:56:24]
If not, do we have public
[2:56:25]
comments?
[2:56:26]
>> we do not, mayor.
[2:56:27]
>> alright.
[2:56:30]
>> before you make -- ask for
[2:56:32]
a motion, just one procedural
[2:56:34]
point, state law is a little
[2:56:36]
bit different when adopting
[2:56:37]
the code of another agency by
[2:56:40]
reference which is what we're
[2:56:41]
doing tonight, you'll still
[2:56:42]
introduce it.
[2:56:43]
When it comes back, the
[2:56:45]
ordinance will not be on
[2:56:46]
consent for the second
[2:56:47]
reading
[2:56:48]
we're required to hold a
[2:56:51]
public hearing, so you'll
[2:56:52]
still -- there will still be
[2:56:53]
two meetings for the
[2:56:54]
adoption,
[2:56:55]
rather than it appearing on
[2:56:56]
consent, it will be a public
[2:56:58]
hearing at the second reading.
[2:56:59]
>> thank you for that
[2:57:00]
clarification.
[2:57:02]
With that, do I have a motion?
[2:57:03]
>> so moved, MR. Mayor.
[2:57:04]
>> I'll second.
[2:57:05]
>> I have a first and a
[2:57:06]
second, can I have a roll
[2:57:07]
call?
[2:57:09]
>> vice mayor addiego,
[2:57:10]
councilmember nagales?
[2:57:12]
>> yes.
[2:57:12]
>> mayor flores?
[2:57:14]
>> yes.
[2:57:15]
>> councilmember nicolas?
[2:57:18]
>> yes.
[2:57:20]
>> councilmember [Inaudible]
[2:57:21]
>> aye.
[2:57:22]
>> thank you, I appreciate
[2:57:22]
everyone staying.
[2:57:23]
Er
[2:57:26]
>> moving on to items from
[2:57:28]
council, committee reports
[2:57:29]
and
[2:57:30]
announcements, item 13 is
[2:57:31]
consider sending letters of
[2:57:33]
support for various
[2:57:35]
legislative items.
[2:57:36]
>> alright.
[2:57:37]
Sharon?
[2:57:39]
>> sure, I would be happy to
[2:57:40]
speak to this.
[2:57:44]
we've provided you with fiver
[2:57:46]
-- five letters of support,
[2:57:50]
there were deadlines we need
[2:57:52]
today meet, a couple of these
[2:57:53]
letters have been spent.
[2:57:53]
Our practice has been to copy
[2:57:56]
council or seek your support,
[2:57:57]
so I've got five of them
[2:57:58]
here,
[2:58:02]
the frst one is regarding
[2:58:05]
congressionally directed
[2:58:09]
spending for samtrans and
[2:58:09]
this
[2:58:11]
is to different legislators,
[2:58:14]
then we have one here for --
[2:58:15]
three different legislators
[2:58:17]
on
[2:58:20]
that one, oneshorline
[2:58:23]
resilience plan support as
[2:58:29]
well as licensing exemption
[2:58:32]
and one for weta, and I would
[2:58:35]
just add, I'm very supportive
[2:58:36]
of doing these letters in
[2:58:37]
that
[2:58:39]
we often ask these agencies
[2:58:39]
to
[2:58:41]
write up support letters when
[2:58:43]
we're submitting a grant so
[2:58:44]
it's reciprocal that we
[2:58:45]
support other agencies when
[2:58:47]
they're seeking funding so we
[2:58:48]
want to mke sure council is
[2:58:50]
aware of these letters and
[2:58:52]
doesn't have any issues with
[2:58:54]
us issuing these?
[2:58:56]
>> any comments on these?
[2:58:58]
>> for these letters?
[2:58:58]
Okay.
[2:59:01]
I did want to note there are
[2:59:03]
other current bills going
[2:59:04]
through committee, initial
[2:59:05]
committee in the state
[2:59:06]
legislature.
[2:59:11]
One of them is assembly bill
[2:59:18]
6530 -- 650 from dianne
[2:59:18]
papin
[2:59:19]
in relation to the housing
[2:59:22]
element, I don't know if if
[2:59:23]
staff is willing to share on
[2:59:25]
that so we can give direction
[2:59:26]
for support.
[2:59:30]
Nell, you're in the back.
[2:59:31]
>> MR. Mayor, are you asking
[2:59:32]
for support for that bill
[2:59:32]
right now?
[2:59:36]
Inger correct, yes.
[2:59:37]
>> christina's probably
[2:59:37]
better
[2:59:41]
suited to answer this.
[2:59:42]
>> I apologize, bring her
[2:59:43]
back.
[2:59:45]
>> it's a spot bill and so we
[2:59:46]
don't have legislate iever
[2:59:50]
language yet to respond to or
[2:59:51]
support.
[2:59:52]
We went in a little bit of a
[2:59:53]
circle here because we could
[2:59:55]
not find the legislation, I
[2:59:57]
guess this is why, when it
[2:59:58]
appears, we can bring it your
[3:00:00]
way.
[3:00:02]
>> yeah, so, to be able to
[3:00:05]
support at the level of
[3:00:07]
providing additional runway,
[3:00:08]
additional space for cities
[3:00:08]
to
[3:00:10]
be able to be compliant and
[3:00:12]
be
[3:00:13]
able to provide compliance
[3:00:15]
with the housing element
[3:00:18]
should they not be able to at
[3:00:19]
that level too.
[3:00:21]
In addition, since it is
[3:00:23]
agendized as a letter of
[3:00:24]
support, colleagues, some of
[3:00:27]
you might be hearing or
[3:00:27]
seeing
[3:00:30]
our second state senator
[3:00:31]
scott
[3:00:35]
wiener is supporting a
[3:00:35]
regional transportation
[3:00:37]
measure that potentially
[3:00:37]
could
[3:00:38]
support and bring in support
[3:00:42]
for san mateo county to
[3:00:44]
support caltrain as well as
[3:00:45]
to
[3:00:47]
support bart.
[3:00:50]
at this level, I wouldn't be
[3:00:53]
able to, sky, bring in
[3:00:53]
support
[3:00:55]
because one of our
[3:00:55]
councilmembers is connected
[3:00:56]
to
[3:00:57]
that, is that correct, if I
[3:00:57]
wanted to --
[3:00:59]
>> he would just rcuse
[3:01:00]
himself.
[3:01:01]
>> okay, well, we're looking
[3:01:03]
for and when I was talking to
[3:01:05]
the city manager, many of
[3:01:07]
these agencies are looking to
[3:01:10]
not be part of this regional
[3:01:11]
transportation measure and
[3:01:12]
only three counties instead
[3:01:13]
of
[3:01:14]
four counties, however, the
[3:01:18]
bill has now been designed
[3:01:18]
for
[3:01:20]
counties or cities to be able
[3:01:22]
to opt in.
[3:01:24]
If san mateo county wants to
[3:01:26]
opt in to b able to
[3:01:26]
participate.
[3:01:28]
I think as a city that
[3:01:29]
heavily
[3:01:31]
is supported by caltrain as
[3:01:33]
well as -- or has the
[3:01:34]
influence of caltrain and
[3:01:34]
bart.
[3:01:36]
This is important for us.
[3:01:38]
This is a measure that
[3:01:40]
potentially would be able to
[3:01:44]
support a path to potentially
[3:01:46]
relieve the debt that
[3:01:47]
caltrain
[3:01:48]
currently has and bart
[3:01:51]
currently has.
[3:01:52]
There's mixed opportunities
[3:01:52]
right now.
[3:01:55]
I think where we stand is I
[3:01:57]
believe samtrans board will
[3:01:57]
be
[3:01:59]
taking a position of I, a
[3:02:01]
position on this ballot
[3:02:04]
measure or potential ballot
[3:02:05]
measure, a senate bill right
[3:02:07]
now next week and I wanted to
[3:02:09]
see if there's interest so
[3:02:11]
that our city manager could
[3:02:13]
express not a position
[3:02:14]
particular but just to say,
[3:02:19]
hey, tink about thens --
[3:02:23]
city ins north county, daly
[3:02:24]
city, south san francisco
[3:02:24]
that
[3:02:25]
we have caltrain and bart, we
[3:02:27]
have to be at the table, we
[3:02:28]
can't completely be excluded
[3:02:30]
aout of a potential funding
[3:02:32]
mechanism that will support
[3:02:34]
contra costa, al la immediate
[3:02:35]
da and san francisco and not
[3:02:38]
be at the table when these
[3:02:39]
discussions are potentially
[3:02:41]
funding support would come
[3:02:42]
through.
[3:02:45]
That is potentially what this
[3:02:45]
regional transportation
[3:02:49]
measure would look like right
[3:02:49]
now.
[3:02:50]
Any questions or any
[3:02:53]
additions
[3:02:54]
from my colleagues, jump in.
[3:02:57]
>> so, I believe we have --
[3:02:58]
there's no language for ab650
[3:03:01]
that we should have a more in
[3:03:02]
depth discussion on ab650
[3:03:05]
because I know that it can go
[3:03:07]
in various directions.
[3:03:09]
For sb63, I think it's
[3:03:11]
important we continue to
[3:03:13]
collaborate with our regional
[3:03:16]
partners for some sort of
[3:03:16]
deal
[3:03:18]
that makes sense for san
[3:03:18]
mateo
[3:03:19]
county but ensures we are
[3:03:20]
getting funding and
[3:03:24]
contributing to the funding
[3:03:26]
that would save caltrain and
[3:03:29]
bart from the fiscal cliff
[3:03:31]
that they are facing because
[3:03:34]
we are potentially going to
[3:03:38]
see massive, massive cuts o
[3:03:43]
the entire system of bart and
[3:03:47]
I think it needs to be known
[3:03:49]
that 43% of transit riders
[3:03:49]
who
[3:03:51]
start in san mateo county end
[3:03:56]
up outside of san mateo
[3:03:56]
county.
[3:03:57]
That is a fakts.
[3:03:58]
We can't just have -- and I
[3:04:00]
know this is a great council
[3:04:04]
and we understand this but
[3:04:05]
with the county as an
[3:04:06]
audience, we have to
[3:04:09]
understand that public
[3:04:09]
transit
[3:04:11]
does not start and stop in
[3:04:11]
san
[3:04:12]
mateo, it is regional.
[3:04:16]
We need to be part of the
[3:04:18]
solution that saves public
[3:04:19]
transit in the region but
[3:04:20]
also
[3:04:21]
ensures that it is the most
[3:04:23]
seamless experience possible.
[3:04:27]
There are some south in the
[3:04:30]
county who believe that only
[3:04:31]
caltrain is worth saving.
[3:04:33]
There are twice as many
[3:04:33]
riders
[3:04:35]
on bart than there are
[3:04:37]
caltrain in san mateo county.
[3:04:39]
And there are many people who
[3:04:41]
take caltrain and then
[3:04:41]
connect
[3:04:43]
to bart to get to their place
[3:04:47]
of work or connect to other
[3:04:49]
areas and so we need to
[3:04:52]
strongly express that we want
[3:04:54]
to continue san mateo
[3:04:55]
county's
[3:04:56]
collaboration in this transit
[3:04:56]
measure.
[3:05:00]
I think right now we are at a
[3:05:01]
cross roads where we could be
[3:05:02]
included or we could not be
[3:05:07]
include -- included and the
[3:05:09]
recent involvement that some
[3:05:11]
of our county's leaders have
[3:05:14]
had with mtc and with bart
[3:05:14]
has
[3:05:15]
been very antagonistic that
[3:05:17]
has led us to where we are
[3:05:19]
today and it's a shame but
[3:05:22]
right now it is a time for
[3:05:22]
leadership and collaboration
[3:05:24]
and we have to work on a deal
[3:05:25]
that makes sense that ensure
[3:05:27]
that is our public transit
[3:05:28]
agencies are well funded for
[3:05:31]
the people of san mateo
[3:05:33]
county.
[3:05:35]
So I would support a more in
[3:05:36]
depth discussion on that as
[3:05:36]
well.
[3:05:37]
Thank you.
[3:05:39]
>> anyone else?
[3:05:43]
>> I couldn't say it any
[3:05:44]
better, councilmember coal
[3:05:45]
hanh and I think that is
[3:05:47]
classic south county versus
[3:05:48]
north county, not an
[3:05:50]
appreciation for what we're
[3:05:51]
all about and what we bring
[3:05:52]
to
[3:05:53]
the table.
[3:05:59]
>> so, I'm not impinging --
[3:06:00]
jumping into this
[3:06:01]
conversation, there was
[3:06:02]
another bill that I was
[3:06:03]
talking about and it has to
[3:06:04]
do
[3:06:07]
with public comment and it
[3:06:08]
would basically require that
[3:06:10]
for every city council
[3:06:10]
meeting
[3:06:13]
that you would have to allow
[3:06:15]
for online participation and
[3:06:17]
for that person to be allowed
[3:06:19]
for public comment.
[3:06:23]
Am I pretty much -- and we
[3:06:24]
experienced wat happened and
[3:06:26]
I had a conversation with
[3:06:29]
nick
[3:06:33]
nicolo, our lobbyist up in
[3:06:34]
sacramento, and he was
[3:06:38]
interested in what happened,
[3:06:41]
requested to the city manager
[3:06:42]
to do a letter on what
[3:06:43]
happened that night, there's
[3:06:45]
an interest in doing this, I
[3:06:47]
would like to see us doing
[3:06:49]
that moving forward, not
[3:06:50]
taking a position about it
[3:06:50]
but
[3:06:51]
explaining to the author,
[3:06:51]
this
[3:06:53]
is what we experienced when
[3:06:54]
we
[3:06:55]
allow for public comment
[3:06:56]
happening on vao
[3:06:57]
m where we
[3:06:58]
really couldn't control it.
[3:07:00]
>> thank you, councilmember,
[3:07:02]
really important point and I
[3:07:03]
appreciate you bringing that
[3:07:04]
up as well.
[3:07:05]
Just to separate, more just
[3:07:08]
tracking and monitoring on
[3:07:10]
ab650, I'm hearing support
[3:07:11]
for
[3:07:12]
the regional transit masure
[3:07:15]
on that and then sending a
[3:07:16]
letter to illustrate what
[3:07:18]
occurred here and how that
[3:07:18]
has
[3:07:20]
affected south san francisco.
[3:07:21]
MADAM City manager, do you
[3:07:22]
have enough direction?
[3:07:23]
>> I do, thank you.
[3:07:26]
>> alright, thank you.
[3:07:27]
Next agenda item, thank you,
[3:07:28]
colleagues.
[3:07:30]
