Mhm.
[11:34]
» Mhm.
[17:47]
» Thank you, Blair, for that prayer.
[17:50]
We'll begin this evening with public
[17:51]
comments. If you've got a public uh
[17:53]
comment, we'd ask you to come up to the
[17:54]
microphone and state your name and the
[17:56]
city in which you reside. I'll allow you
[17:58]
3 minutes to speak, and please direct
[18:00]
the entire
[18:02]
council, and please be respectful. If
[18:04]
you have a comment on either of the
[18:06]
public hearing
[18:08]
that uh we've got tonight, we would ask
[18:10]
that you make your comments during those
[18:12]
public hearings.
[18:17]
» Paul Sturm, South Weber City.
[18:19]
The comment I have tonight has to do
[18:22]
with
[18:23]
and it's sort of the formatting of the
[18:26]
packet itself.
[18:27]
The headers
[18:29]
have been eliminated on every one of the
[18:32]
action items. And when you're
[18:35]
previewing the actual packet itself,
[18:37]
it's a whole lot easier to see that
[18:39]
you've changed topics
[18:41]
if you had that header in place.
[18:43]
And that's on pages 14, 15,
[18:46]
85, 99, and 107 in the packet tonight.
[18:51]
It just makes it a whole lot easier to keep it straight when you're paging
[18:55]
through it, and all of a sudden you see
[18:57]
the header, and you know you've got a
[18:59]
different topic.
[19:00]
>> Right.
[19:01]
>> Thank you.
[19:04]
Paul.
[19:06]
Anyone else?
[19:10]
Okay, next item is to approve April
[19:13]
26th, 2026 minutes.
[19:16]
Are there any adjustments or changes or
[19:20]
discussion to the meeting minutes of
[19:23]
April the 28th? If not, we'll look for a
[19:25]
motion to approve that.
[19:28]
>> May I make a motion to approve the April
[19:30]
28th, 2026 minutes?
[19:32]
>> Second.
[19:34]
>> All in favor, say I.
[19:35]
>> I.
[19:37]
» Okay, next item, public hearing. We're
[19:40]
going to look for a motion to open
[19:42]
public hearing for executive municipal
[19:44]
officers' salary increases.
[19:47]
>> I'll move.
[19:48]
>> Second.
[19:50]
>> Motion is seconded by Councilman
[19:51]
Halverson.
[19:53]
All in favor, say I.
[19:54]
>> I.
[19:56]
» Okay, public hearing is open. Anyone
[19:59]
have any comments they would like to
[20:00]
make?
[20:02]
>> Mayor, prior to any comments, can I
[20:03]
>> Oh, this is where you wanted to
[20:05]
>> Can I say something?
[20:06]
>> Yeah.
[20:06]
one of the numbers on here, um the
[20:09]
public works assistant director shows us
[20:10]
3.4%.
[20:12]
Um that actually needs to be 6.8%.
[20:16]
So, that's a difference than what than
[20:18]
what the packet shows. And the reason
[20:21]
for that is similar to the public works
[20:23]
director position, the conversation has
[20:26]
been to
[20:27]
adjust the status of those positions to
[20:31]
the FLSA exempt status. They are not
[20:34]
currently, they are hourly. And the
[20:36]
methodology um
[20:38]
needed to be the same in both of those
[20:41]
numbers, but but they were not. The 3.4%
[20:44]
did not include that adjustment um
[20:48]
to be FLSA exempt. And so, that's why
[20:50]
that needs to be 6.8 instead of 3.4.
[20:54]
>> Can I ask a clarifying question?
[20:55]
>> You bet.
[20:56]
>> Is the [clears throat]
[20:57]
6.8 already included in the budget and
[20:59]
it's just a typo on this or
[21:02]
was that also requiring an adjust
[21:04]
adjustment on the budget itself?
[21:05]
>> There will be a slight adjustment, um
[21:08]
but it's not a major adjustment, no.
[21:10]
>> Okay. Thank you.
[21:11]
>> Yeah.
[21:13]
>> Okay, thank you, Dave.
[21:16]
Anyone else? Seeing no other ones, I
[21:18]
look for a motion to close the public
[21:20]
hearing.
[21:20]
>> So moved.
[21:22]
>> Second.
[21:24]
>> All in favor, say I.
[21:25]
>> I.
[21:27]
>> You get the second from Joel.
[21:30]
Okay, next item public hearing for
[21:31]
fiscal year 2017 tentative budget with
[21:34]
proposed property tax increase. Look for
[21:37]
a motion to open this public hearing.
[21:39]
>> So moved.
[21:41]
>> Second.
[21:43]
>> All in favor, say I.
[21:44]
>> I.
[21:46]
>> Okay, public hearing is open. Any other
[21:50]
comments?
[21:52]
Seeing none, we'll
[21:54]
ask for a motion to close the public
[21:56]
hearing.
[21:58]
» So moved.
[22:00]
>> Second.
[22:01]
>> All in favor, say I.
[22:02]
>> I.
[22:08]
» Next item, resolution 26-17,
[22:11]
uh North End Dispatch Agreement.
[22:16]
Any discussion on this resolution?
[22:20]
From the council?
[22:24]
Okay, this
[22:25]
>> Lisa, could we jump to that side, that
[22:27]
portion?
[22:32]
Eric, the rates and everything looked
[22:34]
fairly similar, weren't they?
[22:41]
» Our cost went up by just over $10,000,
[22:45]
um and that's as how they've calculated
[22:47]
bringing all the other agencies that
[22:49]
aren't currently part of Layton Dispatch
[22:51]
on board. Once they were able to
[22:52]
calculate all all of those numbers,
[22:55]
I think we're seeing about a $12,000
[22:57]
increase over the prior year.
[23:03]
» Yeah.
[23:15]
» Okay, we'll look for a motion on this
[23:17]
then.
[23:19]
>> Mayor, move to approve resolution 26-17
[23:22]
as written.
[23:23]
>> Okay, we have a motion.
[23:24]
>> Second.
[23:25]
>> We have a second by Councilman
[23:26]
Halverson.
[23:27]
Do a roll call vote starting with
[23:29]
Councilman Windsor.
[23:30]
>> I.
[23:33]
>> Okay, motion carries.
[23:35]
I forgot to excuse Councilwoman Petty.
[23:38]
She's
[23:39]
uh out of town and asked to be excused,
[23:41]
so.
[23:44]
Next item.
[23:46]
Uh
[23:47]
resolution 26-18 emergency medical
[23:50]
service director contract with Summer
[23:52]
Grace LLC.
[23:55]
Any discussion on this resolution?
[24:04]
He's been doing this for quite some time
[24:06]
for us.
[24:07]
>> I I agree with the background memo. It's
[24:09]
been It's been a good job and a and a
[24:12]
very, very reasonable price.
[24:15]
>> I agree.
[24:16]
>> Totally.
[24:17]
>> Okay, we'll look for a motion on this.
[24:19]
>> Mayor, move to approve resolution 26-18
[24:22]
emergency medical services director
[24:24]
contract with Summer Grace LLC.
[24:27]
>> Second.
[24:28]
>> We have a motion Councilman Halverson.
[24:30]
Do a roll call vote starting with
[24:32]
Councilman Halverson.
[24:33]
>> I.
[24:38]
» Okay, motion carries. Thanks.
[24:41]
Next, uh
[24:42]
we need to move into a board
[24:44]
uh meetings. We'll ask uh to suspend a
[24:47]
motion to suspend uh council. I move
[24:50]
convict
[24:51]
>> Yeah, we got the got the insurance. Is
[24:54]
that not on your
[24:56]
>> No, I've had that one.
[24:57]
>> There you go. That 2619 is all right.
[25:00]
>> a minute. Is that
[25:01]
>> Yeah, that's the bond revenue.
[25:03]
>> Mhm.
[25:05]
It's not on my
[25:06]
Okay. Excuse me.
[25:08]
We won't go into board meeting just yet.
[25:12]
Uh resolution
[25:14]
26
[25:15]
-19 authorizing
[25:18]
the issuance of a lease
[25:21]
revenue bond
[25:23]
by the local building authority of the
[25:25]
city.
[25:29]
Can we Do we want to do that now, Dave?
[25:31]
Do we want to do the board before we do
[25:33]
that?
[25:33]
>> I'll city first.
[25:35]
>> City first?
[25:36]
>> Yeah.
[25:37]
>> Okay.
[25:40]
Any discussion on that?
[25:46]
Not, then we'll look for a
[25:47]
>> Does everybody
[25:49]
understand what all that is?
[25:52]
>> I thought I did.
[25:52]
>> Yeah.
[25:53]
>> So, where we're I mean, just we we would
[25:55]
narrow down to two in the last
[25:58]
finance meeting.
[25:59]
>> Yep.
[25:59]
>> And uh that's what we were going back
[26:01]
with, and that's why Zion is here. But,
[26:03]
it is a good savings.
[26:06]
>> Yep.
[26:07]
>> Okay.
[26:08]
>> You can keep
[26:09]
>> We'll look for a motion.
[26:10]
>> Yeah. You got another one?
[26:12]
>> Here, approve make a motion to approve
[26:14]
resolution 26-19 authorizing the
[26:16]
issuance of lease revenue bonds by the
[26:19]
local building authority of the city.
[26:21]
>> Second.
[26:22]
>> Okay, we have a motion that's seconded
[26:24]
by Councilman Iverson. We'll do roll
[26:26]
call with Councilman Windsor.
[26:27]
>> Aye.
[26:31]
>> Okay, motion carries. Appreciate that.
[26:34]
Okay, now we'll
[26:37]
look to a motion to suspend council and
[26:40]
move into
[26:41]
to our board meetings.
[26:43]
>> I'll make a motion to suspend our
[26:44]
council meeting to move into the RDA and
[26:46]
LBA board meetings.
[26:48]
>> Second.
[26:50]
>> Okay, we have a motion that's seconded
[26:51]
by Councilman Davis.
[26:54]
All in favor say I.
[26:59]
Okay, we're now in our board meeting.
[27:02]
The development agency board meeting.
[27:04]
We'll begin with
[27:06]
the one item here.
[27:08]
Uh public hearing for RDA
[27:11]
fiscal year 2027 tentative budget.
[27:16]
For a motion to open the public hearing.
[27:20]
>> So moved.
[27:23]
» Have a second?
[27:24]
>> Second.
[27:26]
>> Motion and a second. All in favor say I.
[27:28]
>> I.
[27:30]
>> Okay, board meeting public hearing is
[27:33]
now open. Anyone have any comments
[27:36]
they'd like to make?
[27:38]
Seeing none, we'll ask for a motion to
[27:41]
close the public hearing.
[27:44]
>> So moved.
[27:45]
>> Second.
[27:47]
>> All in favor say I.
[27:48]
>> I.
[27:52]
» Okay, we'll adjourn from RDA and we'll
[27:55]
convene to our building authority
[27:58]
board meeting.
[28:00]
Look for a motion to do this, so.
[28:02]
>> So moved.
[28:03]
>> Second.
[28:05]
>> All in favor say I.
[28:06]
>> I.
[28:10]
» Okay, local board authority board
[28:12]
meeting.
[28:14]
Have an item to have a public hearing.
[28:16]
We'll look for a motion to open public
[28:18]
hearing for LBA fiscal year 20
[28:21]
27 tentative budget.
[28:24]
>> So moved.
[28:26]
>> Second.
[28:27]
>> All in favor say I.
[28:28]
>> I.
[28:30]
>> Okay, this public hearing is open.
[28:34]
Anyone like to make any comments?
[28:36]
>> We got plenty of opportunity.
[28:40]
» [laughter]
[28:42]
» Seeing none, we'll ask for a motion to
[28:45]
close this public hearing.
[28:46]
>> Motion to close.
[28:47]
>> Second.
[28:48]
>> All in favor say I.
[28:49]
>> I.
[28:52]
» Next item on the agenda is LBA
[28:54]
resolution 26-02 authorizing the
[28:57]
insurance of
[28:58]
the issuance of
[29:00]
lease revenue bond by the authority.
[29:04]
Any discussion on this?
[29:11]
» Chairman, I'll make a motion to approve
[29:12]
LBA resolution 2602 authorizing the
[29:15]
issuance of lease revenue bonds by the
[29:17]
authority.
[29:19]
>> Seconded.
[29:20]
by Councilman Davis.
[29:23]
Do a roll call call vote starting with
[29:26]
board member Halverson.
[29:28]
>> I.
[29:36]
» Okay, thank you. Motion approves. I look
[29:40]
for a motion to adjourn and reconvene
[29:43]
back to city council.
[29:45]
>> So moved.
[29:46]
>> Seconded.
[29:47]
>> All in favor say I.
[29:49]
>> I.
[29:52]
» We are back.
[29:54]
We're not I guess we're not getting all
[29:56]
that for
[30:00]
» [laughter]
[30:02]
>> Thank you very much. We appreciate your
[30:03]
work on this. It's going to save us some money. It's going to be
[30:08]
great.
[30:14]
Okay.
[30:19]
Councilman Davis.
[30:20]
>> And I second it.
[30:24]
One Michelle.
[30:25]
>> New business. Dave, if you got any new
[30:27]
business you'd like to bring up?
[30:30]
>> I have a couple things to report but no
[30:32]
new business.
[30:33]
>> Okay.
[30:34]
Give us your report.
[30:36]
>> Uh we have finalized the date for the
[30:40]
public works open house for the public.
[30:42]
We will begin publishing that tomorrow
[30:44]
morning. We are doing an open house from
[30:48]
4:00 p.m. to 6:00 p.m. on Wednesday,
[30:50]
June 3rd. So, a week from tomorrow.
[30:54]
And
[30:55]
it will be a self-guided tour, but we'll
[30:57]
have staff members there to assist and
[31:00]
answer questions and and talk about the
[31:02]
project for people that
[31:04]
want to ask questions or whatnot, but
[31:07]
it should be a a pretty exciting time
[31:09]
and opportunity for the public who's
[31:11]
wanted to go through the building and
[31:12]
see it to to see it.
[31:14]
>> So, you know, that'll be good.
[31:15]
>> Relating to people knowing
[31:18]
» Uh we're planning on sending out an
[31:20]
email, sending out through social media.
[31:22]
We'll put it on the digital sign and
[31:25]
try to publish that the ways that we
[31:27]
normally do. If there are other ways
[31:28]
that you would like us to or not to do whatever you'd like.
[31:35]
Um public notices, we could do it as a
[31:37]
public notice.
[31:39]
Yeah.
[31:42]
We don't typically do events as a public
[31:44]
notice like that, but
[31:47]
we could potentially do that.
[31:49]
>> Can we do that?
[31:51]
>> Um
[31:51]
>> It's not a public body.
[31:54]
It's not a public hearing.
[31:56]
>> Yeah, so the the notice website's
[31:58]
reserved for
[32:00]
meetings of public bodies and there's
[32:02]
not no public bodies meeting or acting.
[32:04]
So, I think it's probably best just
[32:06]
through social media channels and the
[32:08]
city's website.
[32:10]
>> Okay.
[32:12]
Thanks for that clarification.
[32:14]
>> Appreciate that. One quick note, do you
[32:16]
think that they could get rid of the
[32:17]
weeds at the front of the building
[32:18]
before the open house?
[32:20]
>> We'll do what we can.
[32:24]
» Have we Have we had a meeting with
[32:25]
Valley Design at all?
[32:27]
>> No.
[32:28]
I haven't.
[32:29]
>> We have not.
[32:30]
>> There's been a No, there's been a couple
[32:32]
of exchanges on on some items that need
[32:34]
attention, but not a true meeting, no.
[32:42]
The other thing that I wanted to uh
[32:44]
report on is just a shout-out to the
[32:46]
fire department. Uh there have been
[32:49]
necessary response for multiple fires
[32:51]
over the last few weeks, and and they
[32:54]
have proved themselves again and again,
[32:55]
and just really want to recognize that
[32:58]
um
[32:59]
they they just keep proving themselves
[33:01]
to the city that they're really good at
[33:02]
what they do in protecting us, and um
[33:04]
these fires have started for different
[33:06]
reasons, but most of them have included
[33:08]
an intentional, you know, ignition, and
[33:11]
uh and so we need to talk about that
[33:13]
maybe on a broader scale, but they've
[33:15]
responded uh quickly and and limited
[33:17]
damage in uh in really significant ways.
[33:20]
Um could have been a lot worse, so
[33:21]
shout-out to them.
[33:24]
>> Okay. Anything else, Dave?
[33:26]
>> Not for me.
[33:28]
>> Okay, Council. Do you have any
[33:31]
items
[33:32]
to committee reports, anyone have?
[33:35]
Wayne Adamson, you
[33:36]
>> Uh we could probably give an update to
[33:37]
the progress uh
[33:39]
with the train clubs that uh we've
[33:41]
reached out to them.
[33:43]
Uh actually, they reached out to us with
[33:44]
some questions about uh
[33:47]
um moving forward in some of the
[33:48]
insurance items, which we responded to
[33:49]
within 24 hours.
[33:51]
We then uh reminded them that the
[33:54]
insurance items were separate apart from
[33:57]
the 60 days in which to negotiate a
[33:59]
contract. They're now 30 days in. We've
[34:01]
still not had them reach out to us to
[34:03]
set a date to begin negotiations. Um
[34:07]
staff has been asked to maybe write a
[34:09]
letter to them reminding them that uh
[34:12]
they have until June 30th to uh have a
[34:15]
negotiated agreement to be brought
[34:16]
before the council before the council
[34:18]
considers terminating their current
[34:19]
agreement.
[34:20]
Um so, we stand ready to begin
[34:23]
negotiations, but the Boles on Air Court
[34:25]
uh we have not received sir from them.
[34:31]
» Thanks for staying on top that.
[34:33]
>> We all admire him.
[34:36]
>> Has he stepped down? What's his What's
[34:38]
his name? Did you guys think that?
[34:40]
>> Parker.
[34:40]
>> Yeah, he did step down.
[34:43]
>> Okay.
[34:45]
Mr. Chairman.
[34:46]
>> Yeah, we had a safety committee today.
[34:48]
It was uh
[34:50]
a lot of fun. We had some good
[34:51]
interaction in there.
[34:53]
Um
[34:54]
but uh uh Dave kind of stole a little
[34:57]
bit of thunder calling out uh the recent
[34:59]
fires
[35:01]
uh there but that's all right. I'll
[35:04]
forgive you this time. No, I'm just
[35:05]
kidding.
[35:06]
You can totally find it.
[35:08]
Um but yeah, I I agree with what he
[35:10]
said. Um
[35:11]
you know, we our responses those are are
[35:14]
quick. It always reminds me of the
[35:17]
maybe some of the naysayers in the city
[35:18]
are like, "Well, why do we need a fire
[35:20]
a full-time fire team all the time?" And
[35:23]
it's like, "Well, it doesn't matter
[35:24]
until it does or until your house is the
[35:26]
one that's on fire and
[35:28]
there's a 15-minute delay instead of a
[35:29]
2-minute delay and now your house is
[35:31]
burned down to the ground and you're sad. So
[35:35]
um
[35:37]
that's what goes through my head my
[35:38]
mind. Am I Am I the only one that thinks
[35:40]
that way?
[35:40]
>> No, I agree. I just like that and you're sad.
[35:43]
>> [laughter]
[35:45]
» So
[35:47]
uh so thank you Derek and and thank you
[35:49]
to your entire team for being as
[35:51]
vigilant as you guys are. We appreciate
[35:52]
it.
[35:54]
Um oh my gosh, my mind just went blank.
[35:56]
Give me a second.
[35:57]
Um we also did bring up the requested
[36:01]
conversation around e-bikes and golf
[36:03]
carts. So I'll just kind of
[36:06]
um give you kind of a high-level review
[36:09]
and then I'll let Wayne and the mayor
[36:10]
and David keep me honest if I'm if I go
[36:12]
off track here but
[36:14]
Um all right, so a couple things to
[36:16]
break down here. When it comes to
[36:18]
e-bikes, e-scooters, uh according to
[36:20]
state law, those are considered
[36:21]
bicycles. There's no way around that. So
[36:24]
basically all rules with and it seems
[36:28]
like there's some additional rules that
[36:30]
come with e-bikes like if they are
[36:31]
modified etc. That came up.
[36:34]
Um so long as they're following the
[36:36]
standard bicycle rules of the road then
[36:38]
they're 100% allowed and that goes for
[36:41]
all like
[36:42]
one-wheeled, two-wheeled
[36:45]
bikes, e-bikes, whatever you want to
[36:47]
call them. Is that the gist of it? Is
[36:48]
that correct?
[36:49]
Okay.
[36:50]
I'm getting the nod from Jamie. So um
[36:53]
So I know there were some concerns there
[36:55]
but there's not really anything we can
[36:56]
do on that one unless the state decides
[36:58]
to throw down some some new regulations
[37:01]
in regards to that. So that's that's
[37:03]
where we stand on the e-bike uh
[37:05]
conversation. In regards to
[37:07]
four-wheelers and ATVs, uh
[37:09]
we don't have really any flexibility
[37:11]
there or very little flexibility to
[37:13]
where it's not really flexible.
[37:16]
So the standard uh rules of the road are
[37:19]
you have to be 16 and your vehicle needs
[37:20]
to be street worthy otherwise it
[37:22]
shouldn't happen and expect to get a
[37:24]
ticket from the sheriff's office um when
[37:26]
they pull you over.
[37:27]
>> License.
[37:29]
>> And they have to be licensed, yes.
[37:31]
Um and then the big one that was that
[37:34]
one of the one I think is the big one is
[37:36]
the golf cart discussion. So this one is
[37:38]
interesting. So we have a lot of
[37:39]
flexibility in what we want to do with
[37:41]
golf carts in the city.
[37:43]
Um but the general consensus uh from the
[37:46]
committee was that um to make sure that
[37:49]
we don't uh go too far with the
[37:52]
approvals and the allowance of the use
[37:55]
of golf carts.
[37:57]
That if we start to put restrictions on
[37:59]
what we think would make the most sense
[38:00]
from a safety perspective that the
[38:01]
restrictions would be so much that you
[38:03]
couldn't really use golf carts outside
[38:05]
of your own little pocket of the
[38:07]
neighborhood.
[38:08]
Um
[38:09]
However,
[38:10]
um if if there's enough um
[38:14]
If there's enough desire to start
[38:17]
carving out little pockets on where they
[38:19]
can be allowed and and what and how old
[38:22]
we want people to be to be able to drive
[38:24]
them, etc.
[38:26]
Then we could draft something
[38:29]
together to see if anybody would even want to go down that route,
[38:33]
but before we had staff even go down
[38:35]
that route, I was
[38:37]
or we were curious and it's too bad
[38:38]
Angie's in here cuz I'm sure she'd have
[38:40]
a very strong opinion on this one, but
[38:43]
uh we were just curious if we wanted to
[38:45]
even go there or do we just stick with
[38:49]
state code and and leave it at those
[38:51]
restrictions or if if anybody felt
[38:54]
>> What one is the state code?
[38:55]
>> Yeah, that's what I was going to ask
[38:56]
you. Yeah, so state code is basically
[38:59]
um
[39:01]
Yeah, basically you can.
[39:02]
>> Basically no golf carts.
[39:03]
>> Yeah, yeah no golf carts.
[39:06]
So
[39:08]
um the option would be to follow or
[39:10]
mimic something like what St. George
[39:12]
Vineyard was another example that I I
[39:14]
didn't quite like Vineyards. I think St.
[39:16]
George would be
[39:17]
a better one to mimic ours off of if we
[39:19]
wanted
[39:20]
>> to start somewhere.
[39:22]
>> Uh but again, the restrictions that they
[39:23]
have is basically not allowed on any
[39:26]
road that's over 25 mph
[39:28]
and which means you're you're not
[39:30]
crossing South Weber Drive, which means
[39:32]
like I said, because of the way our
[39:34]
city's designed,
[39:35]
if we allow them, they're going to be so
[39:37]
boxed in that almost
[39:39]
what's the point of allowing them? So
[39:42]
that we could carve out exceptions.
[39:44]
That's definitely a part of what St.
[39:46]
George does as well. They carved out
[39:47]
certain exceptions like oh go on on this
[39:49]
section of this road, it's allowed, but
[39:51]
nowhere else on that road.
[39:53]
>> Wasn't but wasn't one of the requests
[39:56]
and I could be totally wrong because
[39:58]
obviously a golf cart doesn't go 40 so
[40:00]
not down South Weber Drive unless it's a
[40:02]
modified golf cart.
[40:03]
>> Right.
[40:04]
>> Um
[40:05]
wasn't the request from an individual to
[40:08]
allow them on the sidewalk?
[40:11]
>> Yeah, so we were pretty uniformly
[40:13]
against the sidewalk idea.
[40:14]
>> Nobody Nobody
[40:15]
>> I I agree with that. That's why I was
[40:16]
just curious if that if I remember the
[40:18]
request
[40:19]
>> it into the code if you so wish, but I I
[40:22]
think that would be a horrible option
[40:24]
personally.
[40:25]
>> Otherwise, to me it
[40:27]
I mean
[40:28]
>> [clears throat]
[40:28]
>> Yeah, I don't I don't think they should
[40:29]
be running down South River Drive all
[40:31]
the time.
[40:32]
>> Right.
[40:32]
>> Well
[40:33]
>> That was generally the consensus is that
[40:36]
we didn't want them operating on South
[40:38]
River Drive. Now, the the one call out
[40:41]
was, "Well, what about between 2100 and
[40:44]
89 you have an extra extra wide
[40:48]
shoulder.
[40:50]
And if somebody if if we would be
[40:52]
comfortable with that, I think
[40:54]
I'm kind of 50/50 on that one, but
[40:56]
everybody else was was almost like a
[40:58]
hard pass on that one. So
[41:00]
>> I'm everyone else so
[41:01]
>> Okay, there's only two of us so
[41:04]
>> [laughter]
[41:05]
>> I'm everyone.
[41:10]
» So, I think
[41:11]
>> I'm I'm okay with allowing them anywhere
[41:12]
but under 30 or 25, but that's that's
[41:16]
restricted. I mean, that would be a just
[41:17]
a blanket thing across this
[41:19]
but that's just something people would
[41:21]
have to learn.
[41:22]
>> Yeah.
[41:22]
>> I mean, cuz there's a lot that go
[41:24]
around. I mean, there's
[41:26]
10 or 12 that go around my neighborhood
[41:28]
all the time.
[41:29]
>> Yeah.
[41:29]
>> I mean whether they're adult I mean, a
[41:31]
lot of them are adults driving them.
[41:33]
>> Yeah.
[41:33]
>> So, I mean, that's totally I'll leave
[41:35]
that up to the committee for
[41:36]
recommendation.
[41:37]
>> understand why St. George had them
[41:38]
starting in January. You know, with all
[41:40]
the golf courses down there and uh
[41:43]
the tenured
[41:45]
uh people who live down there um that's
[41:47]
probably their mode of transportation.
[41:49]
Uh it made sense to have some sort of um
[41:51]
additional requirements to what the
[41:52]
state had to allow certain things like
[41:54]
that cuz people own um the golf carts.
[41:57]
As Jeremy was saying here, if if we're
[42:00]
you know, one the age of the driver was
[42:03]
part of the restrictions in the code. Um
[42:05]
16 and above. Um and then the speed
[42:08]
limit. If you putting them on roads that
[42:09]
are above 35 mph
[42:12]
who's who's at risk? You know, you got a
[42:14]
semi, you know, you can't control things
[42:16]
that are going down South Liver Drive.
[42:17]
You get an 18-wheeler or even a big dump
[42:19]
truck coming down there and uh it just
[42:22]
it makes for a very uncomfortable
[42:23]
situation. Uh
[42:25]
and then one of the destinations,
[42:27]
you know, the golf course, where people
[42:28]
want to go, you know, maybe they go to
[42:30]
the elementary school, maybe the rec
[42:31]
center, Maverick, uh see or the other.
[42:34]
So, these are where people go. Those
[42:35]
seem to be the areas that people may
[42:37]
want to go to do the candy run or
[42:39]
whatever you want to do, but how do you
[42:41]
going to get there if you list if it's
[42:43]
25 30 [clears throat] miles an hour or
[42:45]
less or 25 miles an hour or less?
[42:46]
There's no route to get there. So, now
[42:48]
it's like, okay, are are you setting
[42:50]
them up to, you know, just jet across
[42:52]
the the Frontage Road or just jet across
[42:54]
South Liver Drive and now
[42:56]
yeah, they're adults or near adults and
[42:58]
they got to make decisions, but
[43:00]
yeah, at what point do you people want
[43:01]
to push that limit? So, the question
[43:03]
became, do we want staff to move forward
[43:04]
and put something together like that
[43:06]
knowing it's going to be,
[43:08]
you know,
[43:09]
blocky? I guess was the was the
[43:11]
terminology that was used. Uh or do we
[43:13]
say, you know, by all that effort, it's really not worth having, so why
[43:17]
spend the time? That was kind of this question we wanted to ask
[43:20]
the council.
[43:21]
>> Yeah.
[43:22]
>> Do you think Do you know what the state
[43:24]
code is for drivers 16 and above?
[43:28]
Or is it absolutely no one?
[43:30]
>> No golf carts on public
[43:31]
>> No golf
[43:31]
>> Yeah.
[43:33]
>> I thought we couldn't supersede state
[43:35]
law.
[43:40]
» You're not. State law establishes a
[43:42]
default rule.
[43:43]
And so, the default is no golf carts,
[43:46]
and then there's space for cities to
[43:48]
allow them.
[43:49]
And it points out the different
[43:53]
elements of the use of a golf cart that
[43:55]
a city can restrict. So, you can
[43:57]
restrict the age of the driver,
[43:59]
the locations where golf carts can be
[44:02]
driven,
[44:03]
the speeds of the locations where they
[44:06]
can be driven and then
[44:08]
um whether they can allow passengers in
[44:11]
the golf cart or not.
[44:14]
>> Well, I would just say that if I I would
[44:16]
prefer
[44:17]
um instead of just letting it go
[44:20]
willy-nilly, that we do have staff
[44:23]
um sit down put together age
[44:26]
um
[44:27]
just thinking through it here, I know I
[44:30]
can make it from all the way over from
[44:33]
Maverick um to
[44:36]
um at least the school and now beyond it
[44:39]
going a little bit further. So, I think
[44:42]
you're right. As long as we're looking
[44:43]
at, okay, is the real question
[44:46]
are we looking for
[44:49]
two or three people that want to be able
[44:50]
to cross the overpass
[44:53]
to get to Maverick
[44:55]
or are we talking about we've got just
[44:58]
so much demand that everybody else wants
[45:00]
to be able to drive their golf carts up
[45:02]
and down the roads constantly?
[45:04]
>> Yeah, that that
[45:05]
I get them on my road and every time
[45:09]
it's underage kids.
[45:11]
Every time they are hanging on to the
[45:14]
sides.
[45:15]
Um they're not driving it responsibly.
[45:17]
They're driving it as if they're having
[45:18]
fun.
[45:19]
Um and if they're going to do that,
[45:23]
that's one thing, but as soon as it
[45:24]
starts endangering other people,
[45:27]
then I think we do have to step in and
[45:29]
say, "Okay, um
[45:31]
if it's going to cause damage to
[45:33]
vehicles that are around there,
[45:34]
um then it shouldn't just be a free pass
[45:36]
for them to go."
[45:38]
But, if we get it to an age of you know,
[45:40]
16, then
[45:41]
yeah, if you can drive a car or you can
[45:43]
drive a a motorcycle or a four-wheeler,
[45:45]
yeah, you should be able to drive a golf
[45:47]
cart any place if that's what you really
[45:49]
want to do. Uh like you said, they don't
[45:51]
really go fast, so
[45:53]
if I'm 16, if I can have a four-wheeler
[45:54]
or a golf cart, I'm definitely going
[45:56]
with a four-wheeler.
[46:00]
Oh, I would, too. All you have to do is
[46:01]
increase the
[46:02]
and that's going to increase the amount
[46:03]
of
[46:04]
>> [laughter]
[46:04]
>> golf carts
[46:05]
>> So, so one one of the things that came
[46:07]
up is I think it was
[46:09]
St. George example is that as soon as
[46:12]
they instituted the rule, they saw a big
[46:15]
influx in golf carts. So, that was
[46:18]
something that was just an interesting
[46:21]
fact. I'm not sure if that would hold
[46:22]
true everywhere. You would As soon as
[46:24]
you announce that golf carts are now
[46:25]
allowed, are you going to see a bunch of
[46:27]
people buying golf carts to where now
[46:29]
it's a
[46:30]
more popular thing to do than it once
[46:32]
was? I don't know.
[46:33]
>> And it sounds like anecdotal evidence
[46:35]
cuz unless they're writing a lot more
[46:37]
tickets, which they wouldn't be, but
[46:39]
again, going back to almost your point,
[46:41]
if we're going to give them the freedom
[46:44]
to do it, and we set the age,
[46:47]
then why not? If we want to have, you
[46:49]
know, everybody wants to buy a golf
[46:51]
cart, and they're going to follow the safety guidelines and the age
[46:54]
guideline, and making
[46:56]
of course that it's street legal, um why
[46:58]
not? I mean, that's that's the good part
[47:00]
about when you legislate things, and
[47:02]
everyone else wants to do it. As long as
[47:04]
they follow the law, you know,
[47:06]
>> Yeah, I think I think the point is if
[47:08]
we're going to go down the road of
[47:09]
creating our own rules, I think we
[47:11]
should do it in a way that
[47:13]
Well, if every other person in the not
[47:15]
every other person, but if we saw a big
[47:18]
influx in golf in golf carts, does the
[47:20]
rule still make sense or not? I think
[47:22]
so.
[47:22]
But, it sounds like what I'm hearing is
[47:24]
that you guys are generally
[47:26]
interested in seeing what a hypothetical
[47:29]
rule could look like,
[47:31]
and then making a decision based on kind
[47:35]
of what we come back with. Does that
[47:36]
>> Yeah.
[47:36]
>> sound
[47:37]
>> Suggest the age.
[47:38]
>> Uh-huh.
[47:39]
>> That's all. Okay.
[47:41]
The only The only big concern, and
[47:43]
that's why I brought up the cars, is
[47:44]
that with a golf cart, you don't have to
[47:46]
have insurance unless you are made
[47:48]
street legal.
[47:50]
Um so, not only are is it just going
[47:52]
around, there's no requirement for a
[47:54]
golf cart to have
[47:56]
>> I don't I don't believe cities can
[47:58]
require insurance on golf carts. They're
[48:01]
state code designates classes of
[48:03]
vehicles and so you have
[48:05]
off-road vehicles are one class,
[48:07]
bicycles are a class, automobiles are a
[48:09]
class
[48:10]
and they define
[48:12]
golf carts as its own category.
[48:14]
>> Yeah.
[48:15]
>> And so I don't think the restrictions
[48:17]
that you could take up would not get
[48:19]
into
[48:20]
insurance requirements. It would just be
[48:23]
the age of the operator, whether they
[48:25]
can have passengers, at what hours can
[48:28]
they operate the vehicle, and on what
[48:30]
streets or facilities can they operate
[48:33]
the vehicle. That's it. You can You have
[48:36]
a lot of room for policy choices within
[48:38]
those categories, but those are the
[48:39]
things you can regulate.
[48:41]
>> Yeah, so exactly to my point. They don't
[48:44]
have any insurance if they crash into a
[48:45]
car.
[48:47]
So
[48:48]
>> I think the well the liability lies on
[48:49]
the parents at that point, right? And
[48:51]
that's where you have like an umbrella
[48:52]
policy as a parent or or liability
[48:55]
>> policy. Homeowners Those are under
[48:57]
homeowners.
[48:57]
>> Yeah.
[48:59]
>> So
[48:59]
>> All right, Dave, do you have enough to
[49:01]
go off of?
[49:02]
>> Yeah, Jamie and I'll work on a draft and
[49:05]
then the only question I have is does
[49:07]
that come back to the whole council or
[49:09]
does that go back to the committee?
[49:10]
>> committee first for like a first draft,
[49:12]
yeah. I think that makes sense. And then
[49:14]
I think where we start is I think we
[49:16]
just mimic St. George and and make some
[49:17]
adjustments that make sense for our
[49:18]
city.
[49:19]
And then I like the callout that we had
[49:21]
in the committee of
[49:23]
highlighting the roads where would be
[49:25]
allowed based on the rules and then that
[49:27]
can give us a good visual on
[49:30]
I think I remember who whose idea that
[49:31]
was, but that was a good idea.
[49:32]
>> Like
[49:33]
>> Okay. Yeah, I understand what you mean.
[49:35]
So
[49:36]
uh that'd be really good to see. So if
[49:38]
we can include that, I think that'd be
[49:39]
good.
[49:40]
>> Yeah, start with St. George.
[49:45]
» Perfect. That's all I got man.
[49:46]
>> Hey, great. Appreciate it. Joel?
[49:48]
>> Yeah.
[49:48]
>> Done.
[49:50]
>> Larry?
[49:50]
>> Nothing to report.
[49:53]
» Same with that, then we'll
[49:55]
uh look for a motion to adjourn.
[49:57]
>> So moved.
[49:58]
>> Second.
[49:59]
>> All in favor say aye.
[50:00]
>> Aye.
