[0:59]
hearings, John. Pacomb, pre - app. And we have sufficient
[1:05]
notice council. We do. David, would you like to read
[1:08]
to the record, please? Please take notice that in accordance
[1:10]
with local law number 14 of 2022, a public hearing
[1:14]
will be held. The Southampton Town Planning Board on Thursday,
[1:17]
August 27, 2026 at 6 p. m. at town hall
[1:21]
116 Hampton Road Southampton and via video conferencing to consider
[1:25]
the pre - application for the subdivision McConnell John. The
[1:29]
application proposes a three - lot subdivision on a vacant
[1:32]
2. 2326 acre property, 97, 254 square feet situated in
[1:39]
the R20 zoning district located 18 Vail Avenue, Eastquag County
[1:44]
Tax Map number 900 - 315 - 3 - 24.
[1:54]
You have to use the podium. Father Modium, yeah. I
[2:04]
have a few handouts. Thank you. Thank you for seeing
[2:12]
me. I have, as read a 92, 000 square foot
[2:16]
lot. 2. 25 acres. Can you give us your name
[2:19]
for the record? Sure. John Piccone. 30, we suck avenue,
[2:24]
East Coag, New York. That's all you have. Oh, okay.
[2:30]
Okay. We proposed divided them into three lots of about
[2:38]
32, 000 square foot average a piece. It's our 20
[2:41]
zoning. Two flags, 15 foot wide and told for the
[2:49]
rear, the second and third lot in the rear. The
[2:52]
front lot fronts on the street. I'm told that due
[2:58]
to 15 foot flags on the planning board would decide
[3:00]
what they want for the entrance. And I handed out
[3:03]
some pictures a little out. So you get a good
[3:04]
idea what it is. There's also pictures of the lot
[3:07]
itself. It's current condition going back into it. It was
[3:12]
a farm. Known as Carter Farm, nursery actually. And things
[3:19]
have changed. The family has passed on. Even though a
[3:22]
lot of Carters around here, the low carters in this
[3:25]
land anymore. So if you have any questions, more than
[3:29]
happy answer. To beautifully treed environment here. Yeah, it was
[3:33]
a nursery, and that's old nursery stock, actually. No, I
[3:36]
mean around you. Yes, on the left - hand side,
[3:40]
remnants of the old nursery, which are, I think there
[3:43]
were taxes ones are way overgrown plant that every 30
[3:46]
inches or every three feet apart. This is not native,
[3:49]
though. Left there. That's 22 veil. You know the square
[3:51]
footage of loter, excuse me, where footage of lot one?
[3:55]
I believe it's 28, 000. I've got to look it
[3:57]
up here. 27, 996. It's typically we like to keep
[4:06]
the rear lots of naflags larger. I mean, I don't
[4:10]
know whether you can meet the one and a half
[4:12]
times. They probably can't. I believe they all meet it.
[4:15]
But well, let me rephrase that. The two rear lots
[4:17]
meeted for sure. Uh, the front lot, the way that
[4:19]
the property shaped, it made sense to do it that
[4:23]
way, because I have a diagram here. So I can
[4:26]
show you, which majority of the lots are 80 foot
[4:28]
wide in that area. There are some 100 foot wide
[4:31]
ones. There actually is one down the street that has
[4:35]
five 15 foot flags. And one driveway going down about
[4:39]
16 feet wide, which has six slots attached to it.
[4:55]
So where is the flag going to be? The north
[4:58]
side, it looks like. Here in the front. On veil.
[5:02]
The north side. That's the driveway. I see.
[5:12]
Here. So is there anyone here who wishes to speak
[5:16]
to this application. Peter, is there anyone on Zoom. No
[5:21]
one. Any more questions from Boar? Motion to close with
[5:29]
the 10 - day written comment period by Dennis, second
[5:31]
bye. Most extensions, seven in favor. Thank you. Thank you.
[5:38]
Thank you. Do you want to take these back? Okay.
[5:40]
The second application is HB Hotel Owners, formerly Drake in.
[5:46]
And what do we have noticed, Christine? Okay, great. Kate,
[5:50]
do you want to refresh that into the record? Yes.
[5:53]
Please take notice that in accordance with local law number
[5:55]
14 of 2022, a public hearing will be held by
[5:58]
the Southampton Town Planning Board on Thursday, August 27, 2026
[6:03]
at 6 p. m. at Town Hall 116, Hampton Road,
[6:07]
Southampton, and via video conferencing to consider the site plan
[6:11]
pre - submission application HB Hotel owner LLC, formerly Drake
[6:16]
N. The existing. Sorry, the site plan application is for,
[6:24]
to convert portions of the existing lobby slash office building
[6:27]
into a continental breakfast bar, an evening bar service to
[6:31]
serve on - site guests through enlargement of the existing
[6:35]
kitchen facilities, as well as to upgrade the existing sanitary
[6:39]
system to a new innovative alternative on - site wastewater
[6:42]
treatment system, consisting of a grease trap, septic tank, and
[6:47]
three leaching galleys. With room for 50 percent future expansion
[6:51]
in accordance with Suffolk County Health Department requirements located at
[6:57]
16 penny lane in the Hamlet of Hampton Bays. Suffolk
[7:01]
County tax map number 900 - 323 - 2 -
[7:06]
15 in a resort waterfront business zoning district. Good evening.
[7:12]
Daphne Vaughn, Surfside Environmental Planning, for Happy Acres Drive Shirley,
[7:18]
New York. Excuse me. So a lot of what I
[7:21]
was going to say was just said. The properties on
[7:24]
the west side of Penny Lane. It has a bulkhead
[7:27]
front - on penny pond. The bulkhead is functional. Uh,
[7:31]
we are in an RWB zoning district. There are multiple
[7:35]
buildings on this property, all functioning as a motel. Uh,
[7:38]
there's a total of 18 units plus, uh, lobby and
[7:43]
office area that are located in the landward most building
[7:48]
closest to the street. Uh, there's also an in -
[7:53]
ground swimming pool with associated patio decking around it that
[7:58]
this board recently issued an administrative approval for us to
[8:02]
refurbish. We actually submitted the building permit for that this
[8:05]
afternoon. Um, so as stated, we are proposing to utilize
[8:13]
the current lobby area for a continental breakfast and bar
[8:17]
service for the hotel guests. Uh, in order to facilitate
[8:22]
this, the street side building, uh, on the property needs
[8:25]
to have some minor interior renovations. Mainly the interior, um,
[8:33]
of the kitchen will have, uh, removal of the cooking
[8:36]
facilities and installation of new dedicated, um, septic system for
[8:43]
these things. Uh, we're going to be putting in a
[8:47]
three compartment sink, a separate mop sink and a commercial
[8:52]
dishwasher. These are all required by the health department and
[8:55]
have already been approved by the Department of Health. Again,
[8:59]
there is a new sanitary system dedicated just for this
[9:03]
purpose. Um, they will only be used for, uh, the
[9:10]
on - site guests. It can accommodate up to 12
[9:14]
people in the seating area. We've gotten a conditional approval.
[9:23]
From the state liquor authority for liquor license. I think
[9:27]
they need something from the town to authorize the use
[9:31]
of the space for the continental breakfast and bar. The
[9:39]
food service is really all going to be pre -
[9:42]
packaged. Food. Uh, for breakfast, uh, with limited drinks and
[9:47]
the snacks as well for the evening, uh, bar service.
[9:51]
So as I said, we've already gotten health department for
[9:54]
the sanitary system and for the food usage, for the
[9:58]
commercial, uh, continental breakfast. I did submit a picture of
[10:04]
the sunroom where the seating area will be located. It's,
[10:10]
there's really no changes to the exterior of the building.
[10:13]
This is all interior swapping of spaces. Teresa mason had
[10:17]
asked me for a floor plan, which we submitted showing
[10:24]
the facilities in the back and then the, you know,
[10:27]
your typical continental breakfast, uh, countertops for the seating area.
[10:35]
Um, that's really, really the gist of the project. Can
[10:40]
you say, can you, um, expand, uh, explaining about the
[10:46]
bar, why you are putting a bar in? Well, it's
[10:49]
just for the hotel guests so that they can kind
[10:53]
of mingle together and maybe have a glass of wine,
[10:56]
you know, something beer wine. I don't think there's any
[10:59]
crazy part of their continental breakfast. I mean, I apologize.
[11:04]
Irish heritage. Sometimes maybe that's necessary. No, so it would
[11:10]
be morning for breakfast for the morning. And then in
[11:13]
the evening, you know, to have like kind of meet
[11:15]
and greet kind of things. Was there an intention to
[11:17]
have a restaurant there when we first heard about this?
[11:21]
No, no. No more food. So what kind of snacks
[11:23]
are you going to have? Just prepackage? Uh, yeah. He's
[11:25]
got a menu here. He's got nuts and olives, some
[11:29]
chips, a soup that's going to all be bought ready
[11:32]
- made salads, you know, some sandwiches, things that are
[11:36]
just easily... They're going to take out the stove. So
[11:40]
they won't really be able to actually cook on site.
[11:43]
It's just a matter of having these separate sinks and
[11:47]
dishwasher for commercial facilities. And I don't even know that
[11:52]
he's using plates. I believe it's all going to be
[11:54]
like, you know, throw away plastic. So why does he
[11:59]
need the dishwasher, do you think? Oh no, it's a
[12:01]
health department probably. Yeah, you're probably right for glassware. Where's
[12:07]
the septic system going to go? The new septic system?
[12:10]
Just right between... So it's the landward most building. There's
[12:14]
going to be, actually, the surveys right here. So this
[12:20]
is the building where we'll be taking place and there's
[12:24]
going to be a septic here. I don't think this
[12:25]
is the right map. This, I think, is the one
[12:28]
that goes for the pool. But we've submitted multiple things.
[12:32]
The septic is furthest away from the water. Yes, it's
[12:35]
way all the way up here. And we already have
[12:38]
a health department approval for that. And what's in the
[12:41]
building now. Right now it's basically a lobby. There's a
[12:45]
small office and the couple of units in that building.
[12:48]
So the units would be unchanged. It's just the hangout
[12:51]
area for the check - in. So they're just utilizing
[12:54]
it for people to sit and eat something quick. And
[12:59]
go on with their day. Will it be open to
[13:02]
the public other than the hotel guests? No, not at
[13:04]
all. Just strictly for the guests. And the health department
[13:08]
has also made that stipulation that it's for on -
[13:11]
premise guests. Only no public. So there wouldn't be any
[13:15]
need for additional parking or it's whoever's there staying at
[13:20]
the motel would have access to these services. It's
[13:29]
unusual that we have breakfast and then a bar. So
[13:34]
that's what we're asking questions about it. I think part
[13:38]
of it is to try to get people to actually
[13:42]
communicate with each other in a vacation setting. You know,
[13:46]
I don't know. I think that's the gist of it.
[13:50]
To connect people. Barr will certainly help. And coffee in
[13:54]
the morning. Yeah, exactly. I'm with you, Florian. And I'm
[14:00]
sorry, and I should remember this. How many rooms are
[14:02]
there at the 18 units? There's 18 units. And the
[14:06]
population is mainly tourists or? Yeah. Families, tourists, couples, you
[14:13]
know, that kind of a thing. Transit use. This day
[14:15]
is what two weeks. So what's the, uh, I really
[14:19]
don't know offhand, but it's a motel. So it's not
[14:22]
like long - term. Might be just weekend guests kind
[14:29]
of thing, you know, weekly. Typical. Okay. So is there
[14:34]
anyone here who wants to speak to the application. Is
[14:38]
there anyone on Zoom, Peter. No one. Are there any
[14:42]
more questions on the planning board? No. Okay. Um, so
[14:47]
let's close with a, this is a regular site planet
[14:52]
comment period. Motion. Motion by, is that Kate? Yep. Yep.
[14:57]
Second byestly. Leslie, all in favor. Aye. Post abstention, seven
[15:02]
in favor. Thank you. Thank you. Moving on to item
[15:09]
number three. Sim Realty lot 25, 11 fox hollow. I
[15:14]
don't have any. No notice on it. Okay. No notice.
[15:19]
That means we can't open. Uh, then we'll jump to
[15:25]
number four, Lee Concord. And, um, I'm going to read
[15:31]
it. Yes. Please. We have notice. We have noted. Sorry.
[15:36]
Please take notice that in accordance with local law number
[15:39]
14 of 2022, a public hearing will be held by
[15:43]
the Southampton town planning board on Thursday, August 27th, 2026
[15:47]
at 6 p. m. at Town Hall 116, Hampton Road,
[15:52]
Southampton and via video conferencing to consider the site plan
[15:55]
application entitled One Lee Concord. This site plan slash special
[16:01]
exception application proposes to convert the use of five out
[16:05]
of six units of the south structure references building A
[16:09]
on the previously approved site plan entitled National Development Corporation
[16:13]
with an overall footprint of 15, 048 square feet from
[16:18]
general and special trade contractor to a pedel sports club
[16:22]
consisting of three pedel quarts. Pro shop office warmup space
[16:27]
to locker rooms, two water closets and 746 square feet
[16:32]
mezzanine viewing area on a parcel measuring 2. 788 acres
[16:38]
in the LI40 zoning district. And within the New York
[16:42]
state archaeological sensitive areas located at one leak on court
[16:46]
tuck a hoe suffolk county tax map number 900 -
[16:50]
158 - 2 - 8. 14.
[17:00]
Had a concern. Well, the concern should be the notice.
[17:04]
I can't pull after this. Uh, okay. Okay. Carl
[17:13]
Benicasa, 860 Montalk. Howie watermelon, New York for the applicant
[17:17]
with me also as John Woodsman, who will be conducting
[17:20]
the build out of the internal renovations we're discussing. Today.
[17:24]
And Ryan Frankel, who's a member of the applicant LLC,
[17:28]
and will be running and operating the facility once up
[17:32]
and running. As mentioned, what we're dealing with today is
[17:36]
an entirely internal renovation and site plan application. The development
[17:43]
will not change any exterior elements. Of this structure. As
[17:50]
mentioned, the southern building, which is the, uh, that you're
[17:55]
looking at there consists of six units. And five of
[17:59]
them will be used for the purposes mentioned. Previously by
[18:04]
Leslie. The internally there will be three pedel courts. And
[18:12]
a, uh, there was a mention of a mezzanine area,
[18:14]
which was part of our discussion previously. That is being
[18:17]
removed from the application. So there will not be a
[18:20]
mezzanine area. I know there had been some express concern
[18:23]
about congregating perhaps more demand on occupancy. So while we
[18:28]
do not believe that would have had much of an
[18:31]
impact we are removing the mezzanine area. Uh, as we
[18:35]
proceed with this application. The major concern when we first
[18:40]
spoke was parking. And I have prepared, as we mentioned,
[18:46]
there is no set parking governance in the code with
[18:49]
respect to this use. It's a very, um, specified use.
[18:54]
So when we spoke originally, we had estimated that each
[19:00]
court would have about an hour use per game or
[19:05]
match whatever you want to call it. And the maximum
[19:08]
usage would be, uh, four people per court. I think
[19:12]
Ryan will explain briefly that we were certainly underestimating the
[19:15]
amount of time that people use that. And actually, uh,
[19:19]
many games are two hours long. So that is actually
[19:23]
working in favor of your concerns. There'll be less demand
[19:26]
on parking. There'll be less, um, in and out of
[19:29]
the facility, which would have less impact on traffic. The
[19:33]
occupancy ratings demonstrate that the calculated occupancy, again, this is
[19:37]
subject to review and approval by the fire marshal, but
[19:41]
it's estimated to be 143. 66. Now under the code,
[19:47]
you have to do, you have to provide, um, as
[19:50]
one space for every three of occupancy, which would require
[19:55]
48 spaces. Now, as you may recall, there are 48
[19:59]
spaces devoted to this building. But eight of them have
[20:02]
to be associated with that six unit. So cannot be
[20:07]
used for this. So the occupancy load put us at
[20:11]
eight space deficit. However, given the, uh, approval authority of
[20:16]
this board and its ability to act within, you know,
[20:21]
the practical reality of how this is actually going to
[20:23]
work. I would just note that Pidell courts, the square
[20:27]
footage of the pedal courts is about 6, 534 square
[20:31]
feet and only 12 people at most can use that.
[20:35]
So I think that the occupancy calculations based on square
[20:38]
footage don't appropriately apply here. And I would think the
[20:42]
fire marshal will, uh, will reiterate that in determining their
[20:46]
calculations. So essentially 6, 500 square feet of commercial space.
[20:51]
But at most you're going to have 12 people in
[20:53]
that space. During the, during their matches. So what we
[20:58]
had proposed, uh, and in consultation with our engineer was
[21:03]
that we would have, we would allot for 12 spaces
[21:07]
for anyone on the court. 12 spaces for anyone that
[21:11]
was just finished their match and leaving the court. 12
[21:15]
spaces for people coming that would be next in line
[21:18]
to play on the game to play a match. And
[21:21]
then four spaces for staff, one full time staff operating
[21:27]
staff and then three instructors is the estimate. So when
[21:31]
you factor the actual use that the actual specifics of
[21:36]
the use, uh, we think that parking is more than
[21:41]
accommodated by this. I would also note that the total
[21:47]
development has 96 spaces and that, uh, those spaces are
[21:52]
rarely used up. Given the current uses. So if there
[21:57]
were spillover and spillover is always possible. Our parking calculations
[22:01]
are based on an estimations and they're based on best
[22:04]
guesses. But even for a standard parking calculation at a
[22:07]
restaurant, you could have everyone coming in their own car
[22:10]
and that would far exceed what's provided. So in the
[22:13]
event unlikely event of a spillover, there is most likely
[22:19]
very adequate spillover parking that could be utilized in the
[22:22]
rest of the development. I think that those were the
[22:26]
primary concerns. Ryan, if you want to come up and
[22:30]
just sort of talk about how these facilities work, what
[22:33]
kind of demands they place on parking and traffic. I
[22:36]
know that you're not necessarily well acquainted with these facilities
[22:40]
because there are not that many. So I think this
[22:42]
could be very helpful for you. Good evening. Members of
[22:50]
the board. Thank you for taking the time to review
[22:53]
our application. Really appreciate that. Um, just a quick intro
[22:57]
to who I am. I am one of the applicants.
[23:01]
Um, and I am also the operating partner of the
[23:02]
business that is leasing the five units in one leak
[23:06]
on court. Um, just a really quick background of myself,
[23:09]
um, I've lived in the Hamptons area for almost 15
[23:12]
years now, um, I was serving it predominantly as a
[23:16]
tennis professional. Um, and more recently as a paddle professional.
[23:20]
So I do a little bit of tennis and also
[23:21]
paddle. Um, so I'm just giving you that background just
[23:24]
so you know that I have a bit of experience
[23:26]
with, uh, with the sports themselves. And as a consumer
[23:29]
and also an instructor, I've been in many different paddle
[23:35]
clubs. And I know how they run and how they
[23:37]
operate. Um, so just, just, um, so that's, uh, that's
[23:42]
there on the table. Um, so yeah, as Carl mentioned,
[23:45]
uh, with predominantly going to be a private club, um,
[23:49]
and also I do want to just stress that, um,
[23:52]
with these paddle clubs, it's not a set time that
[23:56]
everyone comes at the same time. They're naturally very staggered.
[23:59]
Um, so some will may come, let's say at 8
[24:02]
a. m. and then another match could be at 8.
[24:04]
30 a. m. So in terms of traffic coming in
[24:07]
and out, it's not going to be concentrated with 7
[24:09]
a. m. 80 m, 9 a. m. or the courts
[24:11]
are full at the same time. Um, so that will
[24:15]
help with traffic flow in general. Um, also Kyle did
[24:19]
mention about there being three groups with the time that
[24:23]
we're expecting, which is two hours per session. Um, we're
[24:27]
actually only really going to have one group waiting and
[24:31]
one group playing. We're not even going to, that group
[24:33]
that finished would have gone long before that next group,
[24:36]
uh, would have come to play. So realistically, it's only
[24:38]
going to be 24 cars maximum. Um, and then the
[24:41]
minimum, assuming we've completely busy, uh, clearly full, which I'm
[24:45]
actually also going to touch on a second, um, that
[24:48]
would, it could be anywhere between three to 24 cars
[24:51]
to, yeah, cause the four people per court, yeah. So
[24:55]
it could be as little as three cars on our
[24:57]
busiest time, but it could be absolute maximum. It could
[24:59]
be up to 24 cars. Um, but that is worst
[25:02]
case scenario. But like I said with the staggering start
[25:05]
times and predominantly, uh, what we're expecting usage wise, I
[25:09]
also, I'm not sure if, um, uh, the, uh, the
[25:13]
operating summary was shared, but we submitted it a few
[25:16]
weeks ago. Just one thing I want to, I want
[25:19]
to stress also is that where our business model is
[25:22]
more in favor of our members, um, so we want
[25:26]
to make sure that our members have caught availability when
[25:29]
they want. So we're not trying our business, business model
[25:32]
isn't to try and fill the courts relatively low. So
[25:39]
the members can have courts when they want. So we're
[25:42]
anticipating somewhere between 30 to 35 percent court utilization on
[25:46]
average. We understand that there will be busier times and
[25:49]
there'll be less busier times. Um, but so yeah, out
[25:53]
of essentially three court bookings, we're only expecting one to
[25:56]
be filled on average. So we're not, we're not trying
[25:59]
to keep this place fully packed at all times. We're
[26:02]
really trying to benefit our membership with this. Um, so
[26:07]
I'm just making sure I haven't forgotten anything. Also, I
[26:12]
know that there was a question about, uh, tournaments, et
[26:15]
cetera, in the last meeting. Um, I just want to
[26:18]
make sure that, um, that if we do have any
[26:21]
tournaments, and I know this as a consumer of playing
[26:23]
some tournaments myself is that, um, there is, they're scheduled
[26:27]
start times. So when I play, I played in the
[26:29]
US Open paddle, which was the first one, um, ever
[26:33]
a couple of years ago. They give you schedule start
[26:35]
time. So if the 10 a. m. start time for
[26:37]
a tournament, then you show up maybe 20, 30 minutes
[26:40]
before. And at least you know whereabouts when you'll be
[26:43]
playing. People aren't going to be hanging around. Maybe they'll
[26:45]
go into town to do whatever they want to do.
[26:48]
And then they'll come and play, et cetera. So it's
[26:50]
not like everyone's going to be hanging out at the
[26:51]
space at all times during a tournament, for example. As
[26:55]
of right now, we're not planning on any, but I
[26:57]
know that was a question that came up. So I
[26:58]
did want to just address that as well. Um, and
[27:03]
I think that's pretty much where we're at. We want
[27:07]
to, we're really, we're going to allow non - members,
[27:10]
but on a much more restrictive, um, kind of booking
[27:14]
process. So, so again, we really want to make sure
[27:17]
our membership is satisfied. And also if we get to
[27:21]
a stage where we feel like our membership isn't satisfied,
[27:23]
then we will cut up non - members and we'll
[27:25]
just make sure that the membership get the court time
[27:28]
that they want. And we'll also potentially cap membership numbers
[27:32]
at a certain point if we feel like we're getting
[27:34]
to a stage where people are not getting the courts.
[27:36]
They want. And three courts is not a lot. Um,
[27:38]
and with 12 people, it could get to a stage
[27:41]
where we'll have to cap it, hopefully, in practice for
[27:44]
ourselves. Um, and as of, that's all I have written
[27:49]
down. So I'm happy to answer any questions on the
[27:51]
operating side as well. Will you be operating year round?
[27:55]
Yes. We're planning on operating year on months. Yes. Are
[27:58]
you planning any on - site amenities like a snack
[28:00]
barb? Yeah. So the pro shop where there'll be rackets
[28:04]
for sale and maybe some items of clothing. But it's,
[28:07]
it's a very small pro shop. I don't see anyone
[28:10]
being in there longer than 10 or 15 minutes at
[28:12]
any time. Will there be any restaurant or no restaurant?
[28:19]
We're not planning on making any food on site or
[28:21]
anything along those. The letter does say that the refreshment
[28:24]
area. Yes. Yeah. So that essentially means like a fridge
[28:28]
for drinks, but like non - alcoholic drinks, it would
[28:32]
just be like Gatorades, waters, et cetera. How many members
[28:36]
you anticipating? That's a great question. Um, so the thing
[28:39]
is with these membership clubs and working at a couple
[28:42]
of membership clubs myself, it really depends on how active
[28:44]
the membership is. If it's, we could, let's say we
[28:49]
get 150 members and they're all very active. We might
[28:52]
have the cap it at that. But if we also
[28:54]
have a, let's say we have 200 members and 100
[28:55]
members and not that actor, maybe they play once a
[28:57]
week as opposed to three or four times a week,
[29:01]
then that could affect the number that we get to.
[29:03]
We don't have a specific number, but I guess we're
[29:06]
going to kind of figure it out as we go.
[29:08]
Cause again, keeping the membership happier is on number one
[29:10]
priority. With this. And we have a staff person who's
[29:14]
coordinating all of that. Yes, exactly. I'll actually, I'm actually
[29:16]
planning on being on site full time myself. Um, so
[29:20]
it'll be locally owned and also locally run as well.
[29:25]
There's three other instructors. So yeah, those instructions will only
[29:28]
be there if we need them. They're not going to
[29:30]
be there full time. And truthfully that. So that again,
[29:33]
it comes down to that park and calculation a little
[29:35]
bit where we say 28 is maximum. Truthfully, if we
[29:38]
need our instructors, which we get us up to those
[29:40]
four numbers, it would be less people on site because
[29:43]
they'll be taking private lessons and potentially. So it could
[29:46]
only be one member with one coaching staff. So, so
[29:50]
in practice, it would actually be a little bit less
[29:52]
than 28 because we don't, we only really need one
[29:56]
person on site at any time if there's no private
[29:59]
lessons or anything along those lines. And if you have
[30:01]
a tournament that you don't know yet whether you will.
[30:05]
Is there an area for spectators? So we did remove
[30:07]
that mezzanine for now because we wanted to, we just
[30:10]
wanted to make sure that it wasn't going to be
[30:11]
too much congregation, especially at the beginning. We don't want
[30:14]
to, we don't want to feel like we're overchiving this
[30:16]
space. And I know there was concerns with traffic and
[30:19]
parking. So we wanted to make sure we address that.
[30:21]
Um, technically, could you watch from outside the court? Yes.
[30:25]
But it's not truthfully recommended because it's, it's pretty close
[30:29]
to the area of play. So we, so there's not
[30:32]
room for many spectators to be honest with you. And
[30:35]
can you talk a little bit about the balance? It's
[30:38]
described as a membership, uh, club, but you mentioned that
[30:42]
there might be some open times. Can you talk a
[30:45]
little bit more about the non - member you said?
[30:47]
Of course. Yes. So I think it's more of a,
[30:51]
it's like I said, predominantly membership, but we also want
[30:54]
to expose people to the sport that might not have
[30:56]
played it as the board may notice. It's a relatively
[30:59]
new sport. I don't even know how to pronounce it
[31:02]
if it's padel or paddle. Yeah. So you're asking the
[31:04]
right person for that actually. So a purist would always
[31:08]
call it paddle. It's always pronounced paddle. That's the purist
[31:11]
name. But what happened is that the sport that's in
[31:15]
a lot of country clubs, especially in the northeast, it's
[31:18]
called platform tennis that can also be called paddle tennis.
[31:21]
And that's where that was confusion. So some people just
[31:23]
started calling it pedel. Um, and actually has a bit
[31:26]
more of a nice ring to it. So I actually
[31:28]
like Pidel, but a purist of the sport would argue
[31:31]
with you how it's pronounced truthfully. Well, thank you for
[31:35]
that. That's not possible. Sorry. Very important to our deliberations,
[31:40]
but also the non - member piece. Let me touch
[31:42]
that. That was how you envision bringing people in marketing
[31:45]
it, you know? Yeah. So as I said, we're going
[31:49]
to push memberships as much as possible. Um, but again,
[31:52]
we want to get our membership up. So if the
[31:54]
people, for example, that are local that are in the
[31:55]
area that haven't played or want to check it out,
[31:58]
we want to give them the opportunity to come and
[31:59]
enjoy it, especially in, in the off season. I feel
[32:02]
like it's a good opportunity for some indoor activity from
[32:07]
other people that I speak to. That's something that can
[32:09]
be a little bit of a lack of that, uh,
[32:11]
in the area. Um, so we're going to do that
[32:14]
at the beginning just to kind of get some good
[32:16]
exposure for the, for the sport. And then the goal
[32:19]
is to just convert everyone into members. And there will
[32:23]
be a limit on how many non - members can
[32:25]
play. During certain time, especially if it's busy. They wouldn't
[32:27]
be allowed to just come whenever they want. So we're
[32:30]
going to try the non - members is more of
[32:31]
like a starting tool to have available to build up
[32:35]
our membership base. And also just to touch on that
[32:38]
also paddle is a four person sport in general. You
[32:43]
can play one versus one cross court. But in general,
[32:46]
it's four people. So it's actually kind of difficult to
[32:49]
find four people that are always the same level that
[32:51]
they're going to have a good time. So having a
[32:53]
one on two non - members joining in games can
[32:55]
just help with the membership being happier with it as
[32:58]
well. Um, but so yeah, that's. Will you have any
[33:05]
showering facilities? No, no plans on showering facilities. Just a
[33:08]
bathroom. One bath. So we're going to have one men's
[33:11]
ADA compliant bathroom. One women's bought and is currently five
[33:14]
and we're actually eliminating three of the bathrooms. So it'd
[33:19]
be nice. I'll septic do you have an eye. What
[33:23]
type of subject. I think was it. Check actually? I
[33:29]
know the load is sufficient. I can check the actual.
[33:32]
I'll provide written comment. Okay. And Carl, what's in the
[33:35]
sixth space? What's in the storage. Store it. But not
[33:39]
your storage. Not our storage, separate storage. Okay. It's a
[33:49]
regular septic system. Mr. Woodsman was aware. This facility was
[33:55]
built before the IA systems were actually usable. Um, so
[34:00]
this went with a conventional septic system. Uh, the ethyl
[34:03]
went load from the paddle club is going to be
[34:07]
substantially less than the, uh, workman and the constant use
[34:10]
of the buildings right now. It's going to be taking
[34:13]
a tremendous amount of load off of the septic system.
[34:21]
Is there anyone here who wants to speak to the
[34:23]
application. If you'd like to, yeah, absolutely. Please. Hello. I'm
[34:34]
Laura Milinshaw and I'm a local resident here. My husband,
[34:38]
my kids and I, we live on five Cameron Way.
[34:40]
We've known Ryan for many years. And he's taught my
[34:44]
kids how to play tennis. And now we're very into
[34:46]
Pidel. And I think this Pidell club, whenever we heard
[34:51]
started speaking about it, we thought it would be fantastic
[34:53]
idea because we love the fact that it's indoors. And
[34:56]
this would really be additive to the town and provide
[35:00]
activity for our kids, for us, for many members of
[35:05]
the community as well. And the off season when it's
[35:08]
raining last weekend, it would have been a perfect activity
[35:12]
when it was a washout. And, um, I think it's
[35:14]
a fantastic idea. So, uh, just here to voice my
[35:18]
support for the project. Great. Thank you. Sure. Is there
[35:22]
anyone else. Is there anyone on Zoom, Peter. No one.
[35:28]
Are there any more questions from aboard. Um, I would
[35:33]
just note, uh, that I was the closest residential area,
[35:39]
as you can see to the west is the driving
[35:42]
range to the south. There's an open space and the
[35:45]
train tracks to the east is more industrial. Directly to
[35:49]
the north as the second building, but just to the
[35:52]
north, there's that housing community. And the president of that
[35:56]
housing community reached out to me with questions about this.
[36:00]
And, uh, we had a nice conversation. His only concern
[36:02]
was, is there going to be any exterior alterations when
[36:06]
I told them there were not, he said there were,
[36:08]
he had no concerns. Well, that's good. Okay. No more
[36:14]
questions. Entertain a motion to close with a 10 day
[36:17]
written comment period by Kate, second by David, all in
[36:20]
favor. Aye. Opposed abstentions, seven in favor. Thank you very
[36:24]
much. Thanks. Section favor. Six and favor, sorry. Yes. One
[36:28]
absent. And motion to adjourn. Yeah. Peter, is that attorney
[36:35]
still on Zoom. Yes. Bringing one now. Okay. This is
[36:44]
where sim reality lot 25.
[37:01]
I may have to read it. Oh no, you weren't
[37:03]
reading it. No, no. Hi. Good evening. Can you see
[37:06]
and hear me? Yes. I'm Will Shapiro. I'm the attorney
[37:14]
for the applicant on this matter. I believe my client
[37:16]
is also, um, attending by a Zoom. I don't know
[37:19]
if we can get him on right now. Um, Mr.
[37:24]
Shapiro, we don't have jurisdictions open the hearing or anything.
[37:27]
I have none of the required paperwork that was filed.
[37:31]
We shouldn't get filed. The, the affidavits you mean? Correct.
[37:35]
I emailed those in earlier today and I just sent
[37:37]
them again, um, to the secretary of the board. I
[37:41]
need the physical actual, it's okay to do that in
[37:44]
advance, but they didn't get them until now because they
[37:46]
were in planning board all day. And I don't have,
[37:48]
I need the actual documents. To open the hearing. Hard
[37:52]
copy. We can't be hurt tonight. I mean, the notices
[38:01]
were sent out. Um, I mean, my assistant was out
[38:06]
today. I would have had her dropped them off if
[38:07]
I knew that the hard copies were needed. Well, you
[38:10]
need to file originals, right? When you take testimony and
[38:13]
stuff, I can bring the originals tomorrow. Um, I understand
[38:17]
that's maybe. Procedurally backwards, but if you could just make
[38:19]
an exception, um, that would be appreciated. But if your
[38:22]
hands are tied, I also understand that schedule. Whatever the
[38:26]
board wants to do. Yeah. We can get you on
[38:30]
the next hearing public hearing. He needs time to, if
[38:36]
that gives him time to post and. Are you saying
[38:41]
that you complied with everything? Absolutely. I personally went to
[38:45]
the property and hung the posters up in my client
[38:48]
who's on the, um, who's on the Zoom. He was
[38:52]
at the house today. My assistant, Jilly and Lewis, she
[38:55]
mailed out the, um, notices to all the adjoining landowners.
[38:59]
She signed the affidavit. I have it right. And then
[39:03]
it was up 10 days prior to today. Yeah. Hosting.
[39:08]
This is the affidavit for my assistant. And I emailed
[39:11]
this. So I don't know if you could read it.
[39:13]
I mean, I'm just trying to show you on that
[39:15]
Mr. Shapiro. You really have more at risk than we
[39:17]
do in terms of something somebody is contesting this. We're
[39:21]
here. You're going to have your application that would be
[39:24]
a jeopardy. So he is an attorney. So, um, I'm
[39:28]
going to assume he's telling the truth. And we, it's
[39:33]
up to the board. It's really still at your discretion.
[39:35]
You can open this tonight. Leave it open. Um, till
[39:39]
the next hearing date and, you know, if you want
[39:42]
to, um, it's up to you. I'm sorry. There's a
[39:49]
new. I'm a neighbor. I lived at 32 fox hollow.
[39:52]
We absolutely had the notice posted 10 days ago because
[39:55]
I sent a picture to a family member trying to
[39:57]
figure out what it was. Yeah. No, I appreciate that.
[39:59]
I just for legal purposes. I need to take the
[40:02]
attorneys. I'll take his word for it until he'll show
[40:04]
me this. If you can bring them here and keep
[40:07]
my open photograph of the notes, if you could, um,
[40:11]
make sure we get this stuff the originals tomorrow, if
[40:14]
the board chooses to open this tonight. If we open
[40:17]
it, do we have to keep it open? I would
[40:19]
keep it open to the next hearing. I would. So
[40:22]
until we have that document, right, and we can show
[40:24]
it. And then if anybody shows up that night, we'll
[40:26]
hear them. If not, we'll close it. And go on
[40:29]
our way. So, um, let's read this into the record.
[40:37]
You want to read it, Denice? Sure. It's number one.
[40:41]
Okay. Number three. Number three. Number three. Please take notice
[40:45]
of the chords with local law 14 2022 Republicarian will
[40:48]
be held by the South Am town. Planning port on
[40:50]
Thursday, August 27, 2026. At 6 p. m. town hall
[40:54]
116 Hampton Road, Southampton via video conferencing to consider covenant
[40:57]
amendment application entitled SIM Realty Associate Slot 25. The subject
[41:04]
property, Leavened Fox Hollow Drive, he's quag tax map number
[41:06]
900 288 to 16 known as lots 25 of simrealty
[41:14]
is approximately 1. 89 acres situate in the CR80 zoning
[41:18]
district with the act for protection overlay district is shown
[41:20]
on the survey prepared by Salis land serving date February
[41:24]
3rd, 2021. And last survives July 3rd, 2025 and is
[41:30]
requesting to allow for additional clearing. Okay. Thank you. Uh,
[41:38]
first off, I want to thank the board for hearing
[41:40]
us tonight. I seriously appreciate you guys being flexible on
[41:43]
that and taking my word for. That means a lot
[41:45]
to me personally and as an attorney. So thank you
[41:47]
for that. It's an initial matter. Can you get us
[41:49]
your name for the record? I'm sorry. Yes. I'm Will
[41:51]
Shapiro. My address is 135 Main Street, West Hampton Beach.
[41:56]
New York 11978. I'm here on behalf of the owners
[41:59]
of 11 Fox Hollow, Mark and Donni Stein. Um, we're
[42:04]
not actually looking to increase existing clearing. We're just looking
[42:08]
to legalize the existing clearing. Um, I don't know if
[42:12]
all the board members were able to review my application
[42:16]
letter. Um, but my clients purchased the property, um, in
[42:19]
2025, um, they have not cleared any additional property. Um,
[42:24]
I provided in my application a bunch of, uh, historical
[42:29]
references of the property, like some aerials and some surveys.
[42:33]
So the property based on the most recent survey from
[42:36]
Scalise land surveying is at 31 percent cleared The subdivision
[42:41]
declaration allows 20 percent overlay district would be 35 percent.
[42:48]
So that's why I requested the 35 percent's mouth, but
[42:54]
I don't think there's any plan to clear an additional
[42:57]
four percent I just went with the 35 percent number
[43:01]
because prior amendments to the clear and restriction granted in
[43:09]
this subdivision that I referenced in my application on lot
[43:12]
10 and I believe 27. So that's kind of where
[43:20]
we are. We're just trying to make sure the property
[43:22]
is legal so that we can proceed with some building
[43:25]
permits and whatnot Uh, the property again is to urderate.
[43:29]
It's currently a 31 percent. The subdivision declarations. That's always
[43:35]
good. No questions from board the purpose of having the
[43:41]
hearing is to give you for the public to be
[43:45]
made aware that your property is not within the current
[43:49]
subdivision clearing restrictions So by keeping the it opened right
[43:56]
give neighbors the opportunity to opine on that. And we
[44:00]
have a neighbor Right and we have and there Yeah
[44:03]
no one is here so Well, we do have someone
[44:06]
Did you want to speak. Do it I'm in favor
[44:10]
of it yet That's the podium Tell us who you
[44:13]
are right.
[44:23]
Give us your name please David Hart. Family trust owns
[44:27]
32 fox hollow. I'm at the exact number I'm at
[44:35]
32 percent cleared. Of them being able to clear. I
[44:40]
live in the area and I've seen my house this
[44:43]
year in the last six months has had Uh, half
[44:47]
a dozen trees fall. The the pine beetle issue is
[44:51]
killing a lot of the trees But I've had actually
[44:55]
two oaks fall. This year one fell into the pool.
[44:59]
Uh, thankfully the way it fell it did not harm
[45:03]
anyone in that storm That happened on I think it
[45:07]
was July 3rd or July 4th that sudden storm that
[45:09]
came up. Uh, it ripped one of the trees in
[45:12]
the yard in half. And so I Want them to
[45:15]
be able to do that because The area the trees
[45:19]
right now There seem to be a lot of problems
[45:21]
Not just with the pines, but with the oaks The
[45:24]
other tree in my yard that fell When they cut
[45:27]
it down I could provide pictures for the board Um,
[45:32]
carpenter ants had literally made it like a cartoon There
[45:37]
was that bad The trunk of the tree was 12
[45:39]
inches and the inside was missing nine inches of wood.
[45:43]
It was crazy. And so. They are I'm surprised it
[45:49]
says that they're at 31 percent cleared I walked the
[45:52]
property this morning. And I would have thought they were
[45:56]
less clear than that But I'd like them to be
[45:58]
able to clear. What they want or keep it cleared.
[46:02]
Because I think I appreciate that the need for protecting
[46:08]
and following the rules for the area I forget what
[46:10]
it is for the aquifer protection. And keeping a certain
[46:16]
amount of coverage on the ground. But there are a
[46:19]
lot of problems with both the oaks and the pines
[46:22]
in there. And I don't know some of my pines
[46:26]
and oaks are falling because there's an invasive vine. That
[46:29]
has grown up And I can't do anything to the
[46:33]
fine because I have to keep that area Uh... covered.
[46:37]
And so I just wanted to make sure I stood
[46:40]
up for a neighbor I've never actually met them. I've
[46:43]
seen them They just did an addition on their home
[46:47]
So I wanted to make sure to come and stand
[46:50]
up. And make the board aware. Great Thank you very
[46:55]
much Mr. Thank you. Anybody on Zoom. Anyone on Zoom.
[47:02]
Peter. Anyone else. Okay we're going to keep this open
[47:06]
until the next Do we have space on the next
[47:10]
Um... Public hearing date. Hopefully they'll just see an open
[47:15]
and a close. Yeah. Unless people show up. But it's
[47:25]
quick. Yeah Okay so we'll reschedule it for What's the
[47:30]

[47:36]

[47:45]

[48:03]

[48:20]

[48:23]
you for hearing us out tonight and just asking if
[48:28]
there's any possible way that We can Dispense with this
[48:34]
tonight as opposed to delaying a whole nother month. Is
[48:39]
there any possible way. We can't take an action tonight.
[48:43]
It's a hearing night. This is a public hearing Uh...
[48:50]
Portion So the planning board doesn't. Take actions on application
[48:57]
So we've rescheduled it for. September 10 And maybe you
[49:02]
could just do it by Zoom then Because it Okay
[49:05]
September 10th. Yeah. And if nobody shows up at that
[49:08]
point The board would more than likely close it and
[49:11]
may or may not have a written common period Okay
[49:13]
great Thank you very very much You're welcome Thank you.
[49:18]
Thank you guys always a pleasure appearing before you have
[49:21]

[49:26]
