Alex, would you like to get a phone and
just
[0:04]
» It's working now.
It's working now.
[0:09]
» All right, let's go. 65.
[0:14]
Moving on to 6.5.
Discussion [clears throat] and possible
[0:17]
direction to staff on policy approve
improvements. This item is on the agenda
[0:22]
at the request of a council member. is
meant to be a recurring topic on the
[0:25]
agenda and this purpose is so that
council may address changes that uh may
[0:28]
be needed to internal policies and uh
processes during this time of limited
[0:33]
staff.
>> I I ask that this stay on the agenda but
[0:35]
I don't have anything for this meeting
for 64
[0:39]
» to put back on for September.
>> Correct.
[0:42]
» Unless anybody else does.
>> Okay.
[0:48]
» Moving on to 6.6 or I guess nobody else
has any. Okay. Moving on to 66
[0:54]
discussion and possible direction uh to
staff on capital improvements
[0:58]
[clears throat] items on the agenda at
the request of council member. This is
[1:01]
meant to be a recurring topic on the
agenda and it purpose so that council
[1:03]
may address critical repairs and
construction needs in the town during
[1:06]
this time of limited staff.
>> I have a question on this topic and
[1:11]
would again would like to hear
everybody's thought on it. Um, now that
[1:16]
Parker Road is complete and the mediums
are now still are now open,
[1:21]
uh, what's anybody's thought on um,
doing uh, treelining the median like
[1:29]
they did like especially like in Saxi
area down 78 um, around Saxi going down
[1:36]
78 toward George Bush. Um, any thoughts
on that? Just in general, no real
[1:43]
actions, just thoughts. I don't know if
we can legally do that.
[1:46]
» I think we can.
[1:51]
» I mean, I know they they restrict
mailboxes because of
[1:54]
» Yeah.
>> of traffic hazard.
[1:57]
» Yeah.
>> They did a
[1:58]
» had a tree. Is it worse than a mailbox?
>> They did a nice improvement plan in
[2:01]
Murphy when we had lived there years
ago. They also had grass there and they
[2:05]
had been wanting to improve it a long
time. It actually looks a lot nicer
[2:08]
along that Betsy Road area. They have
all the trees now. It used to be all
[2:11]
just grass for very long, but they put
the budget to improve that. I think it
[2:15]
looks nice.
>> They also put water and irrigation into
[2:18]
that, which we'd have to consider.
>> It's probably I don't know how much they
[2:21]
spent. I'm sure they spent some They add
irrigation. It's going to add
[2:24]
considerable
>> cost. We can I mean, we can figure out
[2:26]
how big the project needs to be, but
it's an interesting idea.
[2:29]
» Absolutely. Certainly be beautiful. I
don't my my only thought on that is I
[2:34]
think we had to wait for a year a year
year or so to stabilize that that median
[2:38]
because
>> No, I I
[2:39]
» the soil they put in there is garbage.
>> Yeah.
[2:41]
» Yeah. Just waiting for it to sink after
a good couple of rains. But
[2:45]
» but that my thought literally is going
down 78 to George Bush a few times in
[2:51]
the last couple of weeks and when I was
seeing the the trees I thought we've got
[2:56]
Parker Road is really nice.
>> Absolutely. Um now, however, if we'd
[3:01]
lined it with trees such as going
through sexy,
[3:05]
then it would
be it would be very nice.
[3:11]
I just wanted to get anybody's thought
on that, what their what y'all's
[3:14]
thoughts were on it.
>> I think it's worth pursuing in about a
[3:16]
year or year or two just just because
letting that foundation, that soil
[3:21]
stabilize and figure out what's going to
happen with that sod they put in. This
[3:25]
was also on the agenda as a recurring
item for you to be able to bring up any
[3:29]
kind of needs that you see or RBL tells
you about that we need to.
[3:36]
» So, we already have RBL going on some of
the stuff from last meeting, right?
[3:39]
» So, I could use this as a as a as a gate
a segue to to speak to. There is a road
[3:44]
that will be coming across u will be
going undergoing repair. um some things
[3:51]
that AVL has addressed that uh are
higher priority than others.
[3:57]
Um so you will see those
before or next month.
[4:03]
» Okay.
>> So we've made progress on the stuff we
[4:06]
approved.
>> We have seen progress on um check sign
[4:10]
but we are definitely wheels are in
motion. Yes.
[4:14]
» But to Mr. to John's point, you know,
this is a good opportunity for outside
[4:18]
of that or anything that you wanted to
bring out. I didn't mean to step on
[4:20]
that.
>> Yeah, I'll definitely keep that in mind
[4:22]
and if anything comes to mind, I'll drop
it down for next month.
[4:25]
» Just real quick though on the medians, I
do want you all to keep in mind it be I
[4:29]
would love to have something nice there,
too. Don't get me wrong, but that is
[4:32]
where Tex dot is planning on extending
Parker Road to six lanes. So, there is
[4:37]
potential that anything we do could get
undone.
[4:39]
» That's right.
>> Yeah. But the discussion around that
[4:41]
with with Tex was well there's a number
of things it's the traffic flow. It
[4:46]
depends on if WY is going to allow
something to happen through their main
[4:49]
street
>> which the likelihood of that is far
[4:52]
beyond remote.
>> Um so six lanes going down two lanes one
[4:57]
in each direction is bizarrely insane to
even contemplate. So I
[5:03]
» but you got to keep in mind there's not
going to be a bypass around Y lane. Yes.
[5:07]
May still be six lanes getting to that
point. Yeah. Parker going off to the
[5:12]
park going to the right. Yeah.
>> Um but even at that um the entire medium
[5:18]
doesn't have to be populated from edge
to edge. You can still do the trees down
[5:21]
the middle of it. So that if they widen
it because that's the
[5:25]
» the other little part of this
engineering aspect is it's two lanes
[5:30]
right now, but it's really two and a
half lanes. Um, so all they would take
[5:35]
is approximately somewhere between uh 6
and 10 ft of the median away. So it
[5:42]
would still be a rather large median
still left. So
[5:45]
» some trees would be great.
>> But that I mean that that additional
[5:48]
land in each direction has to it depends
on a lot of things. Plus it's state cost
[5:53]
and they have to have some kind of a
compelling reason to spend the tens of
[5:57]
millions hundreds of millions to do it.
and I just don't think they get the
[6:01]
benefit out of it. Honest to God,
>> it's it's a ways down the road, but it's
[6:05]
a good point. Both are good points.
>> It is a ways down the road. Also,
[6:08]
bringing me to that topic, now that
Tucker Road is done, we do need to
[6:12]
re-evaluate our irrigation system here
at Town Hall. They did have to cut some
[6:16]
of the lines to expand the road. So,
there it's mostly the outer portions
[6:21]
towards the roads that may not be
getting coverage
[6:23]
» and they didn't fix it.
>> I don't know what was agreed upon. They
[6:27]
should have
>> when that was originally started, but
[6:31]
it's definitely something we need to
look into, figure out if we need
[6:34]
additional zones, coverages anywhere.
And then also, I know there's been
[6:38]
discussion about potentially putting
some kind of barrier to keep cars from
[6:42]
coming off.
>> Yeah. So, so the barrier will come will
[6:44]
come down once, you know, things are all
open up. Uh we and then we can probably
[6:50]
go out for bid for that. Definitely. So,
the council should consider something
[6:54]
like that. I was going to I was going to
ask if there was any kind of a a thought
[6:58]
or a contemplation of a of a barrier in
the curve. Um
[7:05]
we I'm certainly open to it. I just
don't want it to be looking like we
[7:09]
walled off the town hall. If there's
some, you know, columns or whatnot that
[7:13]
are to protect cars from coming through
while it still looks open to the public,
[7:17]
that would be great.
>> [clears throat]
[7:18]
» Yeah, I think I think there's I think
there's absolutely
[7:22]
um maintaining the ways you could do it
and um
[7:27]
that that we could make it certainly
>> pleasant to look at and not to be like,
[7:33]
you know, we're walling it off or any
shape, form of fashion,
[7:36]
» freeway,
>> right?
[7:39]
» Exactly.
>> Mr. Mayor, are you still meeting with
[7:41]
the
>> the Well, we'll uh I am got an email
[7:46]
out, so we'll definitely I'll be able to
touch on the sprinkler system as soon as
[7:50]
» um but I I think the that shouldn't have
to have come through council. That one
[7:54]
can just be
[7:58]
[clears throat]
>> anybody anything else
[8:00]
» on this one. Was this the one where we
also uh could talk about I think were we
[8:04]
going to connect with WY about the
easement? Is that a discussion at one
[8:09]
point? Yes. So, I've uh I do I have had
my initial or preliminary discussion
[8:16]
with Mayor W.
>> Okay.
[8:20]
» Can you give us an update next time?
>> Yes.
[8:23]
» Okay. Thank you.
>> This time I was like I don't have enough
[8:28]
information to be able to give you an
update.
[8:31]
» When is your I'm sorry. When is your
>> When is the uh your text meeting on
[8:35]
Tuesdays? It is on Tuesdays.
>> No, Wednesdays.
[8:40]
» Wednesday.
>> Every Wednesday.
[8:43]
» Yes.
>> So, we'll have you'll have one this
[8:46]
week.
>> Um,
[8:50]
can you um run it by them? I know that
they say that they sweep and I know that
[8:55]
they say that they they run the sweeper
down.
[9:00]
They need to run the sweeper down like
five or six times and slowly, not just
[9:05]
let me just zoom by and say we've swept.
Um
[9:09]
Tracy, I've talked to Tracy about it
before with text dot, you know.
[9:13]
» Mhm. and he knows and they'll they'll
swing by with the sweeper. But there is
[9:20]
there's nails, there's metal, there's um
when the when the when the brush um when
[9:27]
the uh when the road brush goes through,
it slings off 8 in metal because they're
[9:33]
brushed. The the brush that's on the uh
road brush is metal brushes and it
[9:39]
slings off these eight 10-in long metal
pieces everywhere.
[9:45]
And I know two people that have gotten
already have flats.
[9:50]
So
I was asked. So I'm asking
[9:56]
» noted. I will uh bring that up in my
concerns.
[10:01]
» They're almost through. So you know what
I mean. It's just like hit the curbs,
[10:05]
drive along the curbs. You know, you
don't have to have to do it two or three
[10:09]
times. even pull into people's
driveways, you know, pick it up, back
[10:13]
back out, get, you know, you're almost
through, guys. Now, make it look nice
[10:20]
or at least start it off nice so we have
it a nice starting place, sir.
[10:30]
Moving on to uh 6.7
direct discussion and possible direction
[10:37]
to staff regarding the town secretary
position. Items on the agenda request
[10:41]
for council members meant to be a
recurring topic on the agenda and its
[10:44]
purpose is so that council may address
staffing needs in the town during this
[10:47]
time of limited staff. You
>> you were going to go through resumeumés.
[10:52]
Yes. Report back to council
uh some potential interviews. Yes. So,
[10:58]
down to the last three. So, out of the
first 100 applicants, we're down to the
[11:03]
last three applicants. So, I will be
engaging town staff at that time to uh
[11:11]
for
additional resources because I need
[11:15]
additional resources.
>> Okay.
[11:19]
There's only 24 hours in the day.
>> Any issues that you see in your role in
[11:23]
your role? just so I could use like two
more of myself.
[11:32]
» The hours are there.
>> Anything else for 67?
[11:37]
» Anybody else? No. All righty. We're
going to move along down to 6.8.
[11:40]
Discussing possible action regarding the
drainage and grading study for DFW
[11:44]
connection points as required by the SUP
approved on 512 2025.
[11:52]
So this evening, council will consider
for approval a grading and drainage plan
[11:56]
submitted by Spires Engineering for DFW
Connection Point Church as required by
[12:00]
the SUV approved on May 12th, 2025. The
study must be approved prior to the
[12:05]
issuance of the building permits based
on the recommendations of the town
[12:08]
engineer. As a reminder, the SP requires
the church break ground on the project
[12:12]
by December 2026.
>> So says, "We have no adverse comments
[12:17]
and recommend approval. Is there any
reason why we should approve this?
[12:23]
» It's open for discussion.
>> Our engineers suggest we're moving it.
[12:28]
» Mr. Larry?
>> No.
[12:31]
» I don't have any concerns. Pearson.
>> No,
[12:35]
the only the only thing I did notice in
this was the um I guess it's a traffic
[12:41]
study that is the study doesn't show St.
Paul alignment, St. Paul road alignment
[12:46]
where it is now. Traffic section 69 68
>> like appendix. Oh, am I wrong?
[12:52]
» We're on 68. We're drainage and grading.
[12:57]
» I move to approve the grading and
drainage plan submitted for DFW
[13:00]
connection point church by Spire's
engineering based on the recommendation
[13:04]
from the county engineer.
>> I second.
[13:06]
» All in favor?
>> I.
[13:08]
» All right. So, on to the I thought we
were talking about Sorry about that. The
[13:12]
uh Can we let the mayor read it? Thank
you.
[13:17]
» Discussion and possible action regarding
6.9 the discussion possible action
[13:21]
regarding the traffic impact analysis
for DFW connection point church as
[13:24]
required by the SP.
>> All right. Before we make motions, I'd
[13:27]
like to talk about the traffic alignment
on section C appendix C for the trips
[13:32]
does not show the alignment for St. Paul
Road the way it is today. So shown
[13:36]
things doing U-turns 50% which I don't
think are going to be there because the
[13:41]
alignment for St. road that's not there
cuz one of those exits I believe is
[13:44]
going to be aligned directly with St.
Paul road I think right
[13:48]
» yes
>> yeah that is correct so the can I please
[13:53]
» um so this uh this study and our textile
permit is approved for all the driveways
[13:58]
proposed uh so they took no comment to
this so we do have um one of our main
[14:06]
driveways is aligned with St. call road
with the light.
[14:08]
» Is there going to be a light in your on
your side?
[14:12]
» On our side? No.
>> So,
[14:15]
there's not going to be a light. That's
a huge problem.
[14:17]
» So, so somebody's going left.
>> There's a right turn only.
[14:20]
» Yeah. They restricted us to only go
right. We have a sign right turn right.
[14:25]
» For both for both.
>> No. Uh, correct. For both.
[14:28]
» For both.
>> One of them is a full median opening.
[14:30]
» So, even though your road lines up to
St. Paul Road, you can't turn left
[14:34]
coming out of your property.
>> That's correct. That's not, you know,
[14:37]
that's not going to happen.
>> Well, there's there's a there's a median
[14:40]
walking um in the
>> Yeah, they've got a little concrete
[14:43]
thing that's supposed to divert it to
the right triangle.
[14:47]
» Was was that the solution? That was that
is the only solution because the refusal
[14:52]
or because the option was for a light to
go there or the recommendation was
[14:56]
» there was no option for us to get a
light. Uh um if we were to when we
[15:02]
approached them, it would have been 18
months before we could have gotten a
[15:05]
light there.
>> Well, they the driveway was already
[15:07]
existing and they designed uh they
designed the signal and we had um Tracy
[15:13]
Mo and all the main textile people. Uh
this was the proposed solution by them.
[15:19]
Um and Jennifer Forester. Well, yeah.
There's a little concrete uh diversion
[15:26]
that's in the plants that says you can't
go left.
[15:29]
» That's going to be a mess.
[15:33]
» Is that something we bring up with
textile as well? Is that this is this is
[15:37]
really a mess.
>> I I I would
[15:39]
» It wouldn't be that big a deal. Let me
say this if I if I may. If it wasn't
[15:42]
that much of a travel road that St. Paul
Road is a very highly traveled road and
[15:46]
so I can see that being just a mess.
>> Yes, absolutely.
[15:51]
you you can hold off until I can get
further clarification. I I just I heed
[15:58]
with caution because they you know again
December 2026 that's the deadline that
[16:02]
the town imposed on them to break
ground.
[16:06]
» Are y'all pursuing that uh for for some
a future change?
[16:11]
» I mean you're on target say that again.
We're hoping to break ground next month.
[16:16]
» Yeah. Yeah. I'm just wondering in the
future, are you are you pursuing to have
[16:19]
a light on your side where you could go
left?
[16:22]
» Uh right now we haven't thought past
phase one, which I mean keep in mind
[16:26]
we're 100 people church and so for us uh
>> yeah, I'm not I'm not suggesting we like
[16:31]
postpone this or anything. I'm just I'm
just curious.
[16:34]
» So yes, it would be nice, but uh it's
because they did it for the Montasuri
[16:41]
school down here. Why in the world can
they do it for these guys?
[16:44]
» Exactly.
Exactly. It doesn't exist.
[16:48]
» So, you would you would like
to push that. Okay.
[16:55]
» Driveway was there and they designed the
signal for a three-way intersection
[16:59]
and we came back and pointed that out to
them. Actually,
[17:03]
» just make sure the owner of the property
wants to do what we're saying
[17:07]
they would incur, not anybody else.
>> Yeah. But we were we were under the
[17:10]
assumption that they were designing
because the driveway was already there.
[17:14]
Well, the driveway was moved while they
were designing it. And so now textile,
[17:18]
they we we found out they were putting
the poles up and we said, "Hey, where's
[17:21]
our light?" And they kind of said,
"Well, it wasn't in the design." And so
[17:27]
we we basically determined that this
ride out only was they said it was
[17:33]
acceptable to us or we agreed to it
because we just, you know, we want to
[17:37]
move forward with our project. However,
we would love if the town supports that,
[17:41]
we would love
>> Well, yeah. So, no wonder it says so the
[17:43]
50% U-turns is going to be right. You're
going to have a bunch of trouble doing
[17:46]
U-turns.
>> So, I mean right now um our engineer
[17:50]
doesn't have an issue with this and says
uh would endorse approving it. So, um
[17:57]
you know, that's fine, but I think we
ought to as a town and as a property
[18:01]
owner push text dot to make that change
for safety reasons. But I don't want to
[18:07]
penalize the church on not being able to
get their project on because of text. I
[18:11]
don't Yeah, I don't think there I don't
see a reason why the church should be
[18:15]
penalized for their property running
there. There's nothing I wouldn't see
[18:20]
anything in these plans that should
preclude them from beginning and even
[18:24]
where their driveway in existence is
because the the the stop lightss um that
[18:31]
would go on to Parker Road or at St.
Paul Road are they can be secondary.
[18:37]
There is many roads around that are
completely already built and have stop
[18:42]
lights put up after the fact. And so
I don't know if we're saying the same
[18:47]
thing, but
>> yeah. So I mean I'd like to move to
[18:51]
approve the traffic impact analysis
submit for DFW connect church plus
[18:54]
engineering based on recommendations
from engineer.
[18:57]
» Do I have a second motion? I'll second
as long as we do engage with text dot on
[19:03]
this being an issue
>> and then I would suggest that we as a
[19:06]
separate issue address that with text
dot in partnership with the property
[19:11]
owner
pastor just I'll reach out to you. Okay.
[19:18]
» So who was my second because I second
>> okay all in favor?
[19:24]
» Any oppose?
[19:29]
Motion passes.
[19:34]
» Moving on to executive session. Texas
Government Code have [clears throat]
[19:39]
five.
>> You don't have to go to it. That's
[19:41]
that's just
there in case y'all needed it.
[19:45]
» Is there any reason why anybody would
like to go to executive session?
[19:50]
» Okay. I'm going to move on to uh item
number eight. Discussion of about 8.1.
[19:57]
discussion about uh future meeting
agenda items. Anybody have any topics?
[20:02]
Now,
>> the one I sent last month that did get
[20:05]
added.
>> Yes, sir. That one is going to be uh
[20:10]
the 14
[20:17]
sorry adding the item about the
>> newspapers and the ordinance.
[20:22]
» Yes. Yes. The ordinance the ordinance
for for uh uh newspapers for for uh what
[20:30]
would you call it?
>> For the ordinance for to restrict the
[20:32]
newspapers
the one we refer to PNZ.
[20:36]
» Oh, the unsolicited
>> unsolicited material. That's the word I
[20:39]
was looking for.
>> You want that back on the agenda?
[20:41]
» We have to make the motion to send it.
>> Yeah.
[20:45]
» And then
>> I don't think we did. I think David I
[20:47]
can review that meeting but Mr. Overcast
was here and I'm pretty sure he said
[20:50]
that y'all did not have to make a motion
to do that. to do what?
[20:53]
» To send it to PNZ.
>> I can review the recording.
[20:57]
» Okay.
>> I'm pretty sure that's why we did it
[21:00]
that way. He was here.
>> If it's if it doesn't require, we'll
[21:02]
push it on.
>> Amen.
[21:04]
» Okay.
>> Sorry, Mr. Dre.
[21:08]
» Uh yeah. So, we had a um a a a
citizen I think it was last meeting that
[21:16]
uh asked why we just listen to public
comments and don't talk about it. And I
[21:23]
think it would be good as mayor in your
comments if you would let them know that
[21:27]
we are unable to talk about things that
are not agenda items
[21:31]
just as a reminder because they did not
know that and they were
[21:35]
assuming that we're just ignoring their
comments and just not even paying
[21:40]
attention because we wouldn't comment
back or discuss it. So we'll put that
[21:47]
would bring some clarity to public
comments and what we can and can't do as
[21:51]
a council.
[21:55]
I like that.
[22:01]
» Okay. Thought it was already in there.
Okay. Cool.
[22:07]
All righty. Mr. Pearson.
[22:11]
» No.
[22:17]
» All right. What are we doing right now?
>> Um, future items.
[22:19]
» Future items. Any future
>> items? Yeah. Okay.
[22:22]
» Okay.
>> All righty. At this time, we're going to
[22:25]
move on to 8.2 regular council meeting.
Do I have a motion for adjournment?
[22:30]
» A motion that we adjourn the regular
meeting.
[22:32]
» I second.
>> All in favor?
[22:34]
» I
[22:40]
time is 8:20.
[22:46]
All right. Thank you.
[22:57]
All righty. Let's see. The time is now
8:20. Going to go ahead and do a roll
[23:04]
call for the board of adjustments
meeting. Mr. Nail
[23:08]
» present.
>> Mr. Dryen here.
[23:11]
» Greg
>> here.
[23:14]
» Mrs. Buley
>> here.
[23:16]
» Mr. Simmons here. All right, we have a
quum.
[23:21]
Would you like to do the pledge of
allegiance again or we're just going to
[23:23]
say recount it all and move on to number
three, the announcements. Town of St.
[23:27]
Paul is currently seeking town secretary
please visit St. Paul text.
[23:33]
» Yeah.
>> Sorry.
[23:38]
» You can put anything in front of you.
[laughter]
[23:41]
Did I just pose the wrong one?
>> Is that
[23:49]
okay?
>> 2.1 consideration and approval of the
[23:52]
minutes from the BOA meeting held on
July 13th, 2026.
[23:55]
» Like how I did that.
>> I'm helping you out there, bro.
[23:58]
» That was a
>> I move to approve the minutes of the
[24:01]
board of adjustments meeting held on
July 13, 2026.
[24:04]
» I second.
>> All in favor? I
[24:07]
» except with the members absent. Robert
Simmons
[24:12]
» he got a quick I says me was I there I
says member's absent I think I was not
[24:18]
there but I didn't say I'm absent
>> no you were there remember I called you
[24:21]
and we had this conversation
>> because I was confused because the way I
[24:25]
had written it down is I written down
you were absent I was like no she was
[24:28]
there
>> oh you remember
[24:32]
» so we're talking about board of
adjustments right I was absent for that
[24:35]
» oh you were not abive session seconded
yes I was not absent for the executive
[24:40]
session but I was absent for the motion
was
[24:44]
» made and second so for the minute I
think he'd add my number my name because
[24:47]
I was present I don't I was
>> okay but I wasn't
[24:52]
» with that condition all in favor
>> I
[24:58]
oppose
[25:01]
a second
>> all right
[25:06]
moving on so so [clears throat] 3.1
there was just one
[25:12]
sign that was still left off.
>> Correct.
[25:14]
» We technically have to have to open the
public hearing.
[25:18]
» Yeah. Got to open it up. Public hearing
regarding varian request for public car
[25:22]
wash that was approved on 511 2026
meeting but an admin error was made in
[25:26]
the number of signs needing an approval.
This hearing is to consider allowing one
[25:30]
additional sign to the property. Wish to
speak.
[25:32]
» I'll make a I'll make a motion that we
uh
[25:35]
» not yet.
>> Hold on. comments.
[25:37]
» Any comments?
>> Okay.
[25:40]
» All right. Public comments. Public
hearing is now closed.
[25:44]
» Go ahead and do a uh
>> Well,
[25:47]
I got a second one. So, there's also the
3.2 is cons conduct a public hearing on
[25:51]
a request for variance submitted by the
town of the Coventry Reserve seeking
[25:55]
relief.
>> Article 3.05004
[25:59]
for permanent signs which states
temporary signs are allowable for 120
[26:02]
days per year. Only one sign per
building is allowed to be mounted
[26:06]
permanently.
>> Public comments.
[26:13]
I'm Daryl Blakey. I represent puppetry.
Um the reason that we're asking for
[26:19]
bearance on that is because with the
road construction stuff, we've not been
[26:24]
able to
this is on the property of two at 2010
[26:29]
which is power to move. It's a sister
organization to Coventry
[26:33]
and they serve the public I mean
community that have spinal injuries and
[26:40]
wheelchairs
and the road is not sufficient into that
[26:46]
property or drive. We intend to rebuild
that. So we really don't have a location
[26:52]
to build the sign the permanent sign at
this time until we get that road
[26:57]
rebuilt. They have school buses. They
serve the WY school district. And then
[27:02]
they have uh people that are in chairs
that come in with adaptive driving
[27:08]
equipment on the cars. So we we've got
to rebuild the road for them to
[27:12]
accommodate them adequately. So that's
really the hold up. Otherwise, we would
[27:16]
already be going for permit for the
permanent sign.
[27:20]
» When do you think it'll be able to do
the driveway? Uh we're working on
[27:23]
funding for it, but uh you know probably
four, five, six months and and we're
[27:30]
going to have to get a permit from text
dot because the entrance to the drive
[27:35]
was was not u we tried to talk to them
about widening that at the time, but
[27:41]
they they wouldn't change that or they
weren't able to do that. But we're going
[27:46]
to need to widen the entrance. only got
a 9 ft wide apron coming into the
[27:52]
property. So, and there's a big drainage
that goes across there and goes under.
[27:57]
So, doing the drive is going to be quite
expensive.
[28:01]
Made the water coming under Parker Road
and coming across there and goes under
[28:06]
that driveway.
So the request is for
[28:13]
it's just for an extension of the
temporary signs
[28:17]
» that and a waving of the fees simply
because it's a nonprofit and they they
[28:24]
don't have
>> I guess we that's 42 I guess we should
[28:28]
discuss at this point.
>> Yeah. Yeah.
[28:29]
» All right. Thank you.
>> Yeah. Sorry. I've got to close the
[28:31]
public hearing before discuss. Okay.
>> Thank you.
[28:37]
this time a motion to close the public
hearing. Seems like we have in the past.
[28:40]
» I just I have to close. Okay. So, at
this time I'm if there's no other
[28:45]
comments I would make, you know, close
the public hearing. We're going to move
[28:49]
on to uh regular agenda 4.1 discussion
possible action regarding correction to
[28:56]
a variance approval for club car wash
from May 11, 2026 meeting from 13 to 14.
[29:02]
Signs needed.
I'll make a motion that we um
[29:09]
allow for the variance for the 13 to 14
signs.
[29:16]
» Okay. Do I just
That's it.
[29:19]
» Yeah. Yeah.
>> This is just administrative. We just
[29:22]
missed that one.
>> Yes.
[29:25]
» Also, thank you.
>> All in favor?
[29:28]
» Yeah, we went over all those songs and
where they were placing them.
[29:31]
» I remember that. I just didn't
understand why we were singing them.
[29:35]
confused
>> 4.2
[29:39]
and here I sorry does anybody else have
something question
[29:44]
discussion possible action regarding a
variance for the for the cover reserve
[29:47]
seeking relief from article 3.05004
05004 permit sign which states temporary
[29:51]
signs are allowable from 110 days per
year. So and only one sign per building
[29:56]
is allowed to be mounted permanently.
This request regarding signs at the
[29:58]
location 2010 Parker Road aka power to
move. They're also seeking relief from
[30:02]
the required application fees that
accompany the sign and variance
[30:05]
applications.
>> This is for a business right
[30:09]
but is the res but is that land a
business or residence?
[30:14]
» Are you talking commercial land?
It's in it's a nonprofit.
[30:20]
» So So
I think believe it is zone type F.
[30:26]
Well, no, because that would be
churches.
[30:30]
» I'm not entirely sure.
>> I mean, I know the church I know
[30:32]
Coventry is zoned as a church.
>> Do you happen to know what how how your
[30:36]
property is zoned?
>> Actually, the cover is zoned as a
[30:40]
school.
>> Okay.
[30:41]
» But the point being is I understand the
Covent tree makes sense. I'm not sure
[30:44]
about this property. I think this
property is supposed to be a residence.
[30:47]
» Well, that property is a owned by
Coventry. We purchased that property.
[30:54]
» I'm not asking who owns it. I'm saying
that it's not it's not zoned to be a
[30:58]
business.
>> I can provide some clarity if you
[31:02]
» please.
>> So, this is where the map is going to
[31:06]
come in handy. Okay.
>> I'm not going to get into it too much,
[31:10]
but power to move is one of those is it
or isn't it?
[31:13]
» Okay. in the town.
>> Okay.
[31:16]
» And so it has been treated as ETJ for a
number of years. And so that's why there
[31:21]
is a
>> I guess you could call it it's not
[31:24]
really a business like he said it's a
not for profit but it's not being used
[31:27]
as a residence.
>> Is is the Coventry facility the building
[31:30]
itself in the city of St. Paul in the
town of St. Paul or is it in the county?
[31:35]
» The Coventry there's two
>> there's two structures on that property.
[31:40]
One is an 80 an 80 by 40 that's been
turned into a gym for adaptive fitness
[31:47]
for this these uh participants.
>> Mhm.
[31:51]
» The other is was a residential house
that's being used for respit for
[31:56]
Coventry weekends for Coventry uh
participants that go to the Coventry
[32:02]
day.
>> Yeah. Yeah. So, like I've talked about
[32:05]
before, when we sit before you as the
zoning and uh what is it? The view board
[32:11]
of adjust board of adjustments. The
zoning board of adjustments. We're not
[32:15]
sitting as a town council. We're sitting
as a quasi judicious body that's
[32:19]
supposed to be looking into whether or
not we're supposed to allow for this
[32:22]
variance to be granted. And so, the
first thing that we need to do, I think,
[32:25]
as a body is figure out what is this
property zoned as. And it sounds like
[32:30]
it's in limbo
at best. It's really Yeah, it it's
[32:35]
really
um
[32:40]
there's some concerns with where the
property lines are,
[32:43]
» right?
>> But I do want you all to keep in mind
[32:45]
this is for signage, which is something
we can control also in the ETJ,
[32:50]
» right?
>> And and the sign is not lit. Is that
[32:52]
correct? The temporary sign is not lit.
>> Not lit.
[32:54]
» Um and having a sign would be public
safety for people to know what's there
[33:01]
or if that's the driveway.
So, let me tell you what exactly they're
[33:04]
asking for. So, they want to keep their
temporary sign out for a period of
[33:08]
longer than 120 days. So, we would
ideally
[33:11]
» the sign that's there now.
>> The sign that's there now.
[33:14]
» They also want a second building mounted
sign on the power to move building.
[33:19]
There is a currently a sign on the front
and a sign on the side and they would
[33:23]
they are seeking permission to keep that
second sign up.
[33:28]
So, there's those are multiple parts.
are also seeking relief from all of the
[33:32]
application fees associated with said
sign permits and for their variance
[33:38]
application. They did pay the fee for
the application and they are seeking
[33:42]
relief which would require us to
reimburse the fee.
[33:45]
» And as I recall the the sign ordinance
does not allow for variance for
[33:49]
temporary assignment for temporary
assignment dates.
[33:54]
It's it's and it's also not like a
variance for zoning or for adding on a
[33:58]
house. It's not about hard partnership.
It's about making sure we're doing the
[34:02]
what that the ordinance allows for. I
don't believe it even allows for
[34:05]
variance.
[34:12]
» What page?
>> The very last page.
[34:18]
» The very last page.
[34:23]
» So the entire sign ordinance is in here.
>> Yes. So I think I see
[34:28]
regulations
[34:33]
to check the sign.
There we go. Page 307, I think.
[34:41]
» What was that, Mr. Dragon?
>> It's very last page. Very last page.
[34:44]
3.05.
>> I don't see anything in here that says
[34:47]
that it can't be for a temporary sign.
>> Well, I don't think that's the entire
[34:51]
sign ordinance. So, I'm trying to go to
the I believe the sign ordinance
[34:57]
cuz I was one of the authors.
>> I don't think it allows for variance for
[35:01]
this.
>> So, you believe this is the entire sign
[35:05]
ordinance in the back here?
>> Yes, I printed it directly from code,
[35:10]
» but I have reviewed it versus the phys
physical copy of the ordinance and they
[35:14]
are the same.
[35:22]
uh IDC hardship language isn't it
3.05.01A
[35:30]
so we have the authority to grant
variances
[35:33]
from the provisions of article respect
to on premise lines only when said court
[35:37]
has made a specific finding from the
evidence presented that compliance with
[35:40]
provisions of the article result in a
substantial financial hardship super
[35:43]
equity
[35:56]
So this was a couple months ago. We were
going to look at this and I had not
[36:00]
then I do remember there being something
about not allowing for variances on
[36:05]
temporary signs.
>> So it does say a new event show such a
[36:08]
very permitted variance including
committing a sign which is an unlawful
[36:11]
sign under section.
>> The the previous one was a request for a
[36:16]
lit temporary sign.
>> Okay. And that's that was the difference
[36:20]
is that they wanted the big arrow with
all the lights and the flashing.
[36:25]
» That that was the difference. That was
>> although it doesn't
[36:28]
» I think this is a conforming sign a
conforming temporary sign versus what
[36:32]
was requested before was a
non-conforming temporary sign.
[36:35]
» It doesn't say nor permitting a
commercial sign and a residential zone
[36:38]
other than it's permitted by this
article. So there is an aspect of what
[36:41]
is it zoned as
[36:47]
» well? Oh yeah, there's I think there's
question about whether the So here's the
[36:51]
here's the thing. The signs are going to
go in the town of St. Paul,
[36:56]
» right?
>> Proper the buildings themselves
[37:00]
under
>> not in the
[37:02]
» or fall outside of Yeah. Paul.
>> So the building that falls outside of
[37:08]
St. Paul, is that the building that
you're requesting the sign variance for?
[37:12]
» Correct.
>> Okay. If if if the building falls
[37:16]
outside of the town of St. Paul, then
this shouldn't even I don't know if we
[37:21]
should even be
>> No, we can't
[37:24]
even
>> They take away everything else. Greg,
[37:27]
don't take that away, too.
>> I didn't want to give it away. I mean,
[37:29]
that is true.
>> I just wanted to throw it out there. Is
[37:31]
it even our call to restrict and it's
not like it's a power thing. It's just
[37:35]
that again, this is planning. This is
planning for the future, you know, for
[37:39]
situations whether whether or not the
property is in the ATK. We can't control
[37:42]
the signs of it.
>> Okay.
[37:45]
» All right.
>> So, both both the temporary sign and the
[37:48]
permanent building mounted sign both
conform to the ordinances. It's just
[37:53]
getting permission to have because we
only allow one building mounted sign.
[37:56]
So, they need permission for two and
then they would need and then I don't
[38:00]
know if y'all want to set a timeline for
the temporary sign
[38:03]
» and and the fees, right? So the fees
would they wouldn't have had to have the
[38:07]
additional fees if it wasn't because we
had to
[38:10]
» we delayed them. The fees aren't the big
deal.
[38:12]
» Yeah.
>> Isn't there a monthly fee or something?
[38:15]
» Yes. Temporary signs are $75 a month for
the permit. So requesting that as well.
[38:22]
Yes.
>> Is and is the claim because this is a
[38:25]
hardship due to the fact that text dot
didn't widen their drive approach. So
[38:30]
they're having to wide they're they're
widening the driveway but they're having
[38:34]
to create funding because they're a
nonprofit and this is all sort of
[38:37]
stemming that really
>> before we wouldn't have had this issue
[38:40]
except for the fact that text did a 9
foot driveway as opposed to a commercial
[38:44]
driveway.
>> I think those are two separate things
[38:46]
group this temporary sign request is not
because of anything tech.
[38:49]
» I thought I thought that that was the
reason they were
[38:52]
» they're going to be requesting a
permanent sign when tech stop finishes
[38:55]
but that's a whole other issue. This is
a temporary sign
[38:59]
» that they have currently that they're
wanting to extend. Has nothing to do
[39:02]
with text.
>> Oh, I I I misunderstood. I'm sorry. I I
[39:06]
thought that the temporary sign was only
going to be temporary because they
[39:09]
didn't want to put in a permit because
of the
[39:11]
» when they when they fixed their driveway
issue. He said they're going to request
[39:14]
a permanent sign, which will be a second
sign that that's going to that's going
[39:18]
to come back to us.
>> I'll come back.
[39:20]
» Right now, it's just a temporary sign
that they're wanting to extend.
[39:23]
» But you make sure nothing. you make
motions, right, with those contingencies
[39:28]
that it gets re-reviewed. You can do
that.
[39:30]
» Here's my other question is if you know
where your driveway is and you know what
[39:37]
the widening is going to be for it.
>> What is the preclusion of going ahead
[39:41]
and putting up a permanent sign?
>> I think they're going to work.
[39:44]
» There is a permanent sign.
>> So, the Parker Road is finished. He's
[39:49]
talking about Sir, are you going you're
going to be working on the road that you
[39:52]
have on your property, right? That is
correct. But the road rolls off pretty
[39:57]
steeply on both sides. So it's not like
>> Let me ask you this. Is there any
[40:02]
further construction happening on Parker
Road for you?
[40:05]
» Uh no.
>> Okay. Thank you.
[40:07]
» And there already is a permanent sign.
This is going to be a second permanent
[40:10]
sign which they'll have to get approval
for.
[40:13]
» So it's coming back to us.
>> No.
[40:16]
» No. So that that will I mean I guess it
depends on what the kind of sign they
[40:20]
apply for ultimately. that a sign that's
going to be at the front drive of the
[40:24]
property is going to be like a monument
style sign which they can have in
[40:28]
addition to a building mounted sign.
>> There is sign for Coventry there.
[40:33]
» That's for Coventry. This is for power.
>> Are they going to be one or are they
[40:37]
going to be two separate?
>> Coventry is on.
[40:40]
» It is two. It is two separate propert.
[40:45]
» I'm sorry guys. I know it's confusing.
>> It is. It is. So, yes. So,
[40:49]
» is the sign house there? It's not
>> is this sign is this variance requesting
[40:54]
that sign be a monument sign. So it'll
be one sign with two distinct business
[41:00]
names on it or is are we talking about
two separate signs all together?
[41:05]
» The permanent sign will will be one sign
with one name on it
[41:11]
» just for
power. Sir power move is going to be
[41:15]
operated separate from Coventry.
understand it's owned by it, but you're
[41:18]
going to work those two properties
separately.
[41:20]
» It's actually a per a separate uh
nonprofit, but they lease that building
[41:25]
from Coventry,
>> right? But you're going to operate those
[41:28]
two different uh buildings, if you will,
or two different properties
[41:33]
» kind of separate from each other. Oh,
yeah.
[41:34]
» Yeah. Yes.
>> So, the two the sign that you're talking
[41:36]
about is not going [cough] to be with or
in the same location as the Coventry
[41:42]
sign. It's going to be on the property
that's further to the south.
[41:44]
» To the north.
>> North. Okay. Ah, okay. So, it's that
[41:48]
it's a story.
>> Mhm.
[41:50]
» Okay. So, it's a separate driveway all
together.
[41:52]
» I tried to put in a visual, but I guess
it doesn't.
[41:54]
» So, it's a separate driveway, separate
sign. It's all separate.
[41:57]
» All separate.
>> And it used to be a So, I believe it
[42:00]
used to be a residence, right?
>> Yes.
[42:03]
» Excellent. So, all the signs are for
power to move. So, they want two
[42:06]
building mounted signs, eventually one
permanent monument sign,
[42:11]
» but for now it's a temporary sign.
>> Okay. So the question I believe Mr.
[42:16]
Pearson just asked is is there a reason
we can't put the monument sign up now?
[42:23]
» Are you asking me?
>> Yes, sir.
[42:25]
» The reason?
>> Yeah. Is there a reason we can't put the
[42:27]
monument sign up now? The permanence on
it?
[42:30]
» It's because the drive is not
sufficient. It's going to the drive is
[42:34]
going to have to be widened and the
embankment enough where we can put the
[42:38]
permanent signs.
>> So the embankment work is the issue.
[42:40]
» That's correct.
>> That's what he let in with. I think it
[42:42]
was a little confusing because we we we
must have felt like
[42:45]
» property is mixed up.
>> Oh yeah, the property's mixed up. And I
[42:47]
guess there was some mix up about
>> needing to complete Parker Road. It's
[42:51]
not a completion of Parker Road. It's a
completion of your personal or not
[42:54]
personal your your entity's driveway
into your property.
[43:04]
I would say the second building sign
mounted is not would not be we wouldn't
[43:09]
particularly need that after we get the
monument sign.
[43:12]
» So that's a temporary as well.
>> Yes.
[43:15]
» And and why do you so there's there's
not a road over there. Why do you need a
[43:19]
second sign on the building?
Well, there's two properties that use
[43:25]
that driveway and so it needs to be on
the front of the building so the people
[43:29]
coming in will know where they're
supposed to go.
[43:34]
» And so why does there need to be one on
the other side of the building? If you
[43:37]
have one on the front, why do you need
one on the other side? Well, we had
[43:41]
problems when during the construction of
the of the highway [clears throat] was
[43:46]
people not being able to see or know how
to get in there because there were the
[43:51]
the drive is so narrow that they would
miss it.
[43:56]
So, they put a sign on the north side of
the building to help accommodate
[44:01]
visibility
[44:04]
cuz when I drive by there, I can only
see the part of the building that's
[44:07]
facing the west. Right.
If you're driving on, if I'm thinking of
[44:12]
the right building up in the
>> If you're going if you're going north on
[44:16]
on Parker, when you come up on 2010, you
look, you can see the sign on this north
[44:21]
side of the building.
>> The north side of the building is not
[44:25]
facing Parker.
>> No.
[44:27]
» So, how can you see that sign? I mean,
I've driven by many, many times. I've
[44:30]
looked at it being curious what's going
on there because of businesses popping
[44:34]
up without a permit. Um, and I believe
I'm looking at the west side of the
[44:39]
building when I drive by Parker going
north. In fact, I would think I would
[44:42]
have to be looking at the west side of
the building. I don't see how there's
[44:45]
any possibility of seeing the north
side.
[44:46]
» The north side's very visible on the
road.
[44:49]
» Okay.
>> Now,
[44:51]
there's a lot of trees been moved and
stuff there. Just be straight. This is
[44:57]
north, right? That's south. And so,
>> when you're driving south, you can see
[45:01]
it.
>> Okay.
[45:04]
Right.
Yeah. I'm not sure I see why you need to
[45:07]
have two signs on the building, but
Okay. And
[45:11]
» is there
I think for safety uh and as long as
[45:15]
it's conforming, it's because before
we've had to deny non-conforming with
[45:19]
the lighting and stuff on temporary
stuff.
[45:21]
» Are they temporary? So, they are
temporary or which one's not? So, I
[45:24]
guess that's what we really need the
firm clarity is is that second sign
[45:27]
going to come off the building.
>> That's what I just heard as well. I just
[45:31]
heard that second sign is not a
permanent sign. It's also a temporary
[45:36]
sign.
>> And so its temporary status would also
[45:39]
fall in line with the temporary status
of the street signs. So when the
[45:43]
permanent sign at the street goes up,
then the second sign on the building
[45:49]
would be all disengaged. It would come
down along with the temporary sign at
[45:54]
the road.
>> That is for the power to move property.
[45:58]
» That is right. So Coventry, the only
question with that is is leave the
[46:04]
temporary sign in place for an
additional 120 days until a month.
[46:08]
» Has nothing to do with co
It's just power to move. [clears throat]
[46:12]
» It's all all these signs are for power
to move.
[46:15]
» All right. Okay. I apologize. I thought
that one was in play, too.
[46:19]
» No. No.
>> Okay. All right.
[46:21]
» No, that's just the entity that owns
power to move. The owning entity is the
[46:26]
Coventry.
>> Okay.
[46:27]
» For for for traffic and for uh for
stuff. I mean, I would I would support
[46:32]
extending it.
>> Oh, yeah. I'll make the motion
[46:35]
» with no fees.
>> No fees. Wave the fees.
[46:39]
» We didn't talk about the fees, though.
So, it's
[46:43]
» Well, we can put it.
>> So, it's 75 a month.
[46:45]
» We We can make it for six months.
>> So, they've already paid me $75 once and
[46:50]
150 once for the variance application.
So,
[46:54]
That's
>> any more specific clarification if we
[46:57]
can work on that as well.
>> So,
[47:01]
» can I ask if it's Do we typically not I
think someone said nonprofit do we
[47:06]
typically not wave fees or is that like
our standard or is the council's
[47:10]
discretion? I feel like it should be a
standard.
[47:11]
» Yeah, we're not the council. So, that's
part of the problem with this is that we
[47:15]
really I don't I don't know if the board
of adjustment can actually wave fees. I
[47:19]
don't know that we even have that
ability.
[47:21]
Yeah,
>> I think the council does, but we are not
[47:23]
the council.
>> The council would have the governing
[47:25]
authority over over policy change
>> or tempor specific policy.
[47:31]
» So, we could approve the sign, not
approve the fee waiver and uh push that
[47:36]
to council to the to the
>> Okay. Okay. And yeah, in the motion,
[47:42]
just make sure that you iterate that in
the motion.
[47:45]
» All right. And I'll make a motion.
>> Hold on. Sorry. I'm sorry. I mean,
[47:49]
you're saying 5 to 6 months. How
confident are you on that number? 5 to 6
[47:53]
months for this
>> be done.
[47:56]
» The road the the drive reconstruction is
going to be 50 grand. So, we're going to
[48:04]
have to re get the funds together to get
that done.
[48:07]
» Are you going to be great regrading the
area and so regrading and bringing in
[48:12]
dirt? Are you changing? Is that
currently an easement with drainage
[48:17]
through it? Yes.
>> Okay. That's going to change things.
[48:21]
» That's going to change things.
>> Okay. So, these are things that that
[48:26]
I just we're going to have to be fully
transparent. I understand.
[48:34]
So, in in regards to this,
um
[48:40]
I would make a motion that we approve
the adjustment to
[48:46]
two additional temporary signs of 120
days,
[48:52]
both of which
should be scheduled to come down at the
[48:57]
end of 120 days
pending a new sign or the permanent sign
[49:03]
is built.
[49:06]
And secondly, uh that we
u
[49:11]
schedule for the council to uh consider
adjustments to the fees for temporary
[49:20]
signs.
>> And the only thing I I mean this is the
[49:23]
part that I was trying to find is in the
variances. It says we cannot grant
[49:27]
variances for commercial signs and
residential zone. And that's part the
[49:30]
part that's in limbo. We don't know.
Yeah. Can we have it be pending? We
[49:34]
confirm that. That's
>> We will not be able to.
[49:37]
» No, we can't.
>> There's not going to be We're not going
[49:39]
to be able to confirm that.
>> Yeah. That That is That is another
[49:42]
project that is in process that is not
anywhere near uh where we're going to be
[49:46]
able to
make that call yet.
[49:50]
» Yeah. I I
>> we've been going under the premise that
[49:52]
it's not residential.
>> And that's I'm going under the premise
[49:55]
that this is a commercial venture. It's
operating as a nonprofit commercial
[49:59]
business.
So, it's okay for your neighbor to start
[50:03]
a nonprofit put signs up.
>> No, no, I'm not advocating it. It's just
[50:08]
an operating
>> currently an operating
[50:11]
» not putting signs up. We're extending
signs that are already that have already
[50:14]
been approved.
>> It's okay for us to do that. I don't
[50:17]
agree with that. I think if my neighbor
has a 16ft sign that they have put up at
[50:21]
their house, it's a residence, they
shouldn't be allowed to leave it up.
[50:26]
» So, why is it that we can't figure out
the zoning? Why is that? That's a whole
[50:29]
map. No mapping issues.
>> There's mapping discrepancy with the
[50:34]
third with with a third party.
>> How long is that? Is that long tail on
[50:38]
that?
>> We do not have an ETA.
[50:41]
» It's a bigger project,
>> but the council has uh approved
[50:47]
legal counsel
to for an RFQ to engage with a third
[50:52]
party to do to address our maps.
[51:02]
So is that
motion that was motion?
[51:06]
» So So there was a motion made with
>> Yeah, the motion's made. So you know
[51:11]
» the motion that's there is to approve
two temporary signs of 120 days
[51:17]
» to extend
>> to extend
[51:18]
» extend
>> the two temporary signs to 120 days. And
[51:22]
after 120 days, they got to come down
with the new permanent signs being
[51:26]
built.
>> Corrected.
[51:29]
» We start that counting tomorrow.
>> And uh that would commence as of um what
[51:36]
was today's date?
>> 24th.
[51:38]
» Commence as of August 25th.
[51:44]
» I'll second it.
>> All in favor?
[51:51]
I'm having a little hard time.
[51:55]
» Nay,
>> I have a hard time.
[52:00]
» There's not a tie. Once you have two,
that's it. It's done. They have to have
[52:03]
a super majority.
>> Even with the mayor,
[52:06]
» he's not the mayor, but even with super
majority, which would be
[52:10]
» I don't know if I have a vote. So, you
don't have any authority here?
[52:12]
» I don't think I have.
>> You do. You can move. I do.
[52:15]
» Yeah, you do. But it has to once you
have two nays, it's over.
[52:19]
» Okay.
>> Because it's not super.
[52:21]
» Okay. Well, then it will be denied.
>> Motion denied.
[52:24]
» Well, no, it's not denied. You have to
actively deny it.
[52:27]
» Okay.
>> That's one of the things we've learned
[52:29]
with with over the years of doing this
is you have to have an active motion
[52:32]
that has to pass.
>> Okay. Oh, that's correct. Okay. I
[52:36]
understand what you're saying. Okay. So,
that motion did not pass.
[52:40]
» Okay.
>> Do I have any other motions?
[52:44]
I
>> if if we don't do anything
[52:46]
» then it's denied
>> then it's automatically then the then
[52:50]
the current sign permit expires and the
signs come down.
[52:54]
» All right.
[52:58]
» I don't know that we have enough for I
can I'll motion that we deny I can
[53:00]
motion that we deny the variance
request.
[53:03]
» Okay. Do I have a second
[53:07]
to get over?
[53:12]
Okay. Okay.
>> And the reason why is not because of
[53:16]
safety. I think it I agree with the
safety issue having sign. I just don't
[53:20]
know if we can actually prove it. But
the language here is my concern of the
[53:25]
» So
yes, may I suggest a little bit more
[53:31]
research?
>> So at this point it's a mpoint.
[53:35]
» Right. So then
>> it seems like I'm trying to remember
[53:37]
this is why it's nice to have council
here with you. It seems like it seems
[53:40]
like you have to supermajority to be
four. You don't have to have a
[53:43]
supermajority to deny. That's what I
remember. So you can have just a
[53:46]
plurality to deny it, but you have to
have a supermajority to to approve it,
[53:51]
» which four out of six is not super.
>> I forget the percentage that's required.
[53:58]
» 75%
>> 75% of the board has to hear an item to
[54:02]
vote on it, but I don't know if that's
>> it's the same for the approval. And if
[54:06]
and if the board is if any of the
members are absent, they count as a nay.
[54:09]
» Yeah.
>> Yeah. So four out of six won't do it.
[54:14]
» So at this point then
>> so
[54:18]
did we have enough votes to deny? We
didn't we didn't have like a plurality
[54:22]
because it doesn't have to be a super
majority to deny.
[54:24]
» We we didn't have
>> we don't need it.
[54:26]
» But I like the idea of maybe we could
research this a little bit more.
[54:29]
» Yeah, I think we need a little bit more
research on
[54:30]
» table the discussion.
>> You could we can table this and revisit
[54:34]
it. Um and
the zoning be right. So that could be a
[54:40]
motion where you revisit this. You can
give yourself ample time. Um so you know
[54:46]
your next meeting would you could
potentially have your next meeting.
[54:50]
» September 14th. And we could well so we
could make a motion
[54:58]
» to table um this uh
temporary sign issue until
[55:07]
we have u legal counsel
give us suggested u
[55:16]
give us suggested options for the um
[55:23]
the permitting of this property that's
functioning under a commercial
[55:29]
uh exception currently
[55:34]
and I guess part of that motion would be
I would direct the mayor to
[55:39]
to seek the legal counsel.
>> Oh, Kristen, you you're concerned with
[55:43]
some of the language.
>> Yeah. and the variance I'm
[55:46]
» so is that it would this motion
accomplish meeting Kristen and that's
[55:51]
what I I was trying
>> maybe there's something else in the
[55:54]
article that maybe we're not seeing
right now that allows us to do this I
[55:58]
guess my concern is over the language
that says not permitted commercial sign
[56:02]
or residential zone and if it's
residential then I think we're
[56:04]
permitting it
>> I mean do does this give Alex and our
[56:09]
mayor the ability the what they need to
then ask council
[56:13]
» yeah I think legal reviews so that we
can put this on next month's agenda and
[56:19]
address it again.
>> I don't think we need here.
[56:23]
» I mean, there's several questions that
came up, you know, so long as those get
[56:28]
answered, I suppose.
>> All your concerns.
[56:32]
» I've got Okay. So, I've got the motion
to table until legal counsel can be
[56:35]
sought regarding the zoning and the
wording of the restriction that you're
[56:40]
seeing.
>> Yeah. Yeah. I was trying to encompass
[56:44]
» her concern too with the commercial
>> versus residential
[56:49]
» just be able to get that one addressed.
I assure
[56:52]
» I I know but I mean but well I was
hoping David David might give us some
[56:56]
kind of a
>> I mean some kind of opinion
[56:59]
» kind of an opinion saying because this
is this is commercial operation that's
[57:03]
currently
actively operating
[57:07]
» in this zoned area.
>> It's been acting non-residential for
[57:10]
some time.
>> Yes sir. Yeah, I I don't disagree. I'm
[57:13]
just in doing it properly.
>> No, I understand. But but I we're asking
[57:17]
our attorney to make a determination on
something
[57:21]
» to give us
for him. But
[57:24]
» I mean, at least let him give us an
opinion
[57:28]
» that you know that might make everybody
more comfortable with it.
[57:32]
» Is that the only thing we want to ask
him?
[57:35]
» That was the only thing.
Yeah, I mean I I need to I guess the
[57:41]
only other one I don't understand is why
because usually when a property when
[57:46]
they're asking for signs on both sides
of the building or multiple sides of the
[57:49]
building, it's because you have roads on
both sides of the building. We don't
[57:52]
have roads on all the sides of these
buildings. I don't understand why you
[57:56]
need extra signs on, you know, two
different sides of the building.
[57:59]
» That's my legal question.
>> Well, that would be an SP. That's a
[58:03]
right. So, that would require an SUP to
have an additional signage. It's
[58:08]
» okay.
>> But yeah, so you're still in the ZBA.
[58:13]
» Yeah. Okay.
>> So So you would have to So in your
[58:17]
motion, you would because nobody's
accepted your motion, you can your
[58:22]
motion
>> and and with with with Alex kind of
[58:26]
guiding you
>> as a refresher.
[58:29]
» Yeah. Uh
so right, you can table it for September
[58:34]
14th. for September 14th and bring back
with legal counsel addressing all the
[58:40]
council's concerns
>> and that should be
[58:43]
» okay. All right, that's fine. Can we
just amend my motion?
[58:48]
» Yeah, if you want to say it again for
the record.
[58:50]
» Okay. Um then I make u I make a motion
to table the variance from the allowable
[58:57]
time of temporary sign placement um
until
[59:03]
September 14th. at that time. Seek um
uh legal council's recommendations and
[59:12]
or advice on the um suggested wording of
commercial property sign placement at
[59:21]
this current operating facility
and supply council with
[59:29]
uh suggested course of action.
[59:35]
Do I have a second?
>> I'll second.
[59:38]
» All in favor? I
>> oppose.
[59:44]
Motion carries. Make a motion to be
this. We have a second for the motion.
[59:49]
» I'll second [laughter]
[59:53]
I'm going to put Robert down. Who wants
to take a second? I'll take Mr. Simmons
[59:57]
a second. All in favor? I Mr.
