[6:50] March meeting
[6:53] yes sir in addition I'd like to have an addition under old business if we could
[6:57] call it item 10 a uh Miss Martin I believe received the
[7:02] documentation from the dot concerning the speed limit change on Athens Road
[7:07] right here by the school and I believe we we need to discuss and vote on that
[7:14] 10A additional discussion item all right anything else
[7:20] Mr Mayor I want to add a couple of different items yes sir
[7:24] this can go at the end the end of our agenda but that would be to discuss an
[7:29] increase in our plan review fee say that again that would be to discuss excuse me
[7:36] a discussion to review and discuss a possible increase in our plan review fee
[7:43] for new subdivisions okay and by extension of this also the inspection
[7:48] fees for new subdivisions for our water system
[7:52] Japan
[7:56] and then the second one would be a discussion regarding the protection of
[8:00] our water meter vaults near driveways
[8:05] can we include in the same discussion I would rather you didn't okay I'm going
[8:09] to make this 18a and 18 B
[8:16] is the Vault discussion
[8:27] so anything else
[8:30] I'll make a motion that we approve and adopt the agenda with those changes oh
[8:33] second any discussion
[8:37] Mr Rigsby aye Mr blandreth
[8:42] Mr Foy hand Overlook you sir you're good Mr Jones all right and I'm also I
[8:52] I make a motion that we adopt the minutes from May 5th 2022 it's a special
[8:57] call Budget Workshop a second-hand motion
[9:02] any discussion
[9:05] Mr Rigsby aye Mr Floyd
[9:08] aye Mr Landreth aye Mr Jones aye and I am also I I move that we adopt the
[9:14] minutes from the October the 13th 2022
[9:20] meeting a second
[9:25] I think we need to clarify that's the closed session minutes yeah okay yeah
[9:29] it's good we accept that commitment no that's the that's the uh that's October
[9:35] 13th meeting that wasn't a closed session
[9:38] closed session is January 12th the mayor that both of them are closest
[9:42] I got you I'm sorry yeah I'm sorry all right
[9:47] any discussion Mr Rigsby
[9:52] uh aye Mr Floyd aye Mr Landreth aye Mr Jones
[9:57] aye and I am also I Public Safety report Stokesdale Fire
[10:02] Department fire chief Mr Todd you have another set of closed sessions for
[10:06] January 12th Miss Martin are you sure we didn't vote
[10:11] on news at the last council meeting we had it but we didn't vote on them we had
[10:15] them but we didn't vote on that that's correct we didn't vote okay okay forgive
[10:20] me then Todd if you don't mind just hold on just
[10:23] a second we'll bring this other one up I make a motion that we adopt the closed
[10:27] session minutes for January the 12th 2023.
[10:30] second is there any discussion
[10:34] Mr Rigsby uh Mr Foy
[10:40] aye Mr Landreth aye Mr Jones aye and I'm also I
[10:46] Chief you got the floor good evening Council and citizens uh
[10:51] so quick report for the Stokesdale fire department and our activities in January
[10:56] uh we ran a total of 74 calls of those 47 were medical related seven fire
[11:02] related and 20 that fell in the uh the other categories
[11:08] so we're maintaining a an average monthly we just continue to
[11:15] uh to stay busy unfortunately um our safety tip for the month is
[11:21] something that we really jump on one time a year and that's around daylight
[11:25] savings time and that's our smoke detectors everybody check your batteries
[11:28] change your batteries and stuff like that tonight I just wanted to hit on
[11:31] something that sometimes we Overlook with those and that is
[11:36] um checking them even more often but more so than that if you have a child or
[11:41] young one in your house if you have someone elderly or if your parents are
[11:44] out on their own and they happen to be elderly periodically test that thing so
[11:49] they know what the sound is because in this day and age we have phones going
[11:53] off we have all kind of electronic issues that make different sounds
[11:57] different noises and just make them aware if they hear that what it what it
[12:03] is um you know all you have to be around is
[12:06] a group and you'll hear all kind of tones on phones and stuff like that and
[12:09] somebody you know could very easily get confused but we want everybody to know
[12:15] if you hear that in the middle of the night when you're already tired and
[12:18] sleepy and you wake up to something like that going on and you know what it is
[12:21] and we really stress with the young and with the elderly to make sure that that
[12:28] they know what's going on and check those batteries more than one time a
[12:31] year that's it thank you everybody good
[12:34] evening thank you sir uh we have a deputy with us this evening
[12:38] for the Sheriff's Department
[12:43] good evening Corporal Swearingen the sheriff's office
[12:46] um for the month of January we ran 216 calls for service in the town of
[12:50] Stokesdale resulting in 13 formal case reports a couple of highlights for us is
[12:55] we are still actively investigating the January 10th shooting at the 7 900 block
[13:00] of Leicester Road detectives are still actively investing in that and on
[13:05] January 19th we responded to an aggravated domestic assault in the 8 000
[13:10] block of Oak Creek Drive in which the offender was arrested on-site without
[13:15] any incident um a couple other things just reminding
[13:20] everybody again to make sure you don't leave anything locked up in your cars
[13:24] overnight or leave your doors unlocked because your neighbors to the south of
[13:27] Oak Ridge have recently had a few string of car break-ins and usually the
[13:32] group if it's a group they'll move from one
[13:34] town to the next so just a friendly reminder please don't keep any valuables
[13:38] in your car if you come out and enjoy the park leave your valuables at the
[13:41] house don't leave them in the car because we've had instances where people
[13:45] are seeing backpacks or computer bags or anything and they'll
[13:48] just smash the window and take them off the of course aren't unlocked so just
[13:52] please keep your valuables hidden safe thank you thank you Deputy appreciate it
[13:58] cool administrative reports our clerk Dale Martin
[14:05] we've had um kind of sounds funny only one meter
[14:09] installed this month but that's going to change very soon we had 10 applications
[14:14] for transfers of service 10 work orders were processed
[14:19] 46 811 calls were serviced 735 water bills were mailed out and 35 meters are
[14:27] on hold for for the builders as you are aware we had a recent water break on
[14:34] Highway 68 we'd just like to thank Gene Yates Gene Robertson and Yates
[14:39] construction for their timely response on that
[14:42] this past month Miss Thacker and Mr Wagner both attended an American Rescue
[14:49] plan best practices management webinar on January 25th
[14:55] um we had vandalism in the park we received the mirror replacement today so
[15:00] we'll be getting that installed staff has assisted
[15:05] um various agencies as well as staff in the town park Committee in
[15:11] putting together the rfps for the playground Amphitheater basketball
[15:16] courts and pickleball courts and the rfqs for Engineering Services for the
[15:21] water line extension projects coming up staff has worked with various agencies
[15:27] on the huge amount of paperwork that is
[15:32] associated with each of these grants that will be ongoing for a while through
[15:36] both the state budget office as well as Guilford County we have the 50 000
[15:41] Capital Improvement equipment Grant and the 1.1 Municipal Water System
[15:46] Improvement Grant staff has also
[15:50] completed necessary paperwork for the health insurance for our full-time
[15:54] employees we had our recent renewal that takes effect February 1st
[16:00] staff has worked on several developments and while we only had one meter
[16:05] installed this time probably next month would be very different just wanted to
[16:09] bring to your attention the number of subdivisions that's ongoing right now we
[16:15] have North Ridge we've just finalized phase six
[16:19] Treeline Trails is finishing up phase two but they have three and four that
[16:24] will be working on the new subdivision out on Highway 158 they have named it
[16:31] Nathaniel Ridge we have received plans for that so we'll
[16:36] be starting reviews of that and Oak Level Church Road also submitted new
[16:42] plans this week we'll be working on that one and then of course blacksmith is
[16:48] still in phase one
[16:53] every year we have to renew our application to the North Carolina
[16:58] Wildlife office for the we are considered a dear Urban archery town and
[17:05] every year that's renewed we just recently submitted that
[17:10] um the upcoming elections this year we host we are an election site a Precinct
[17:16] site here I just executed the documents with the Guilford County Board of
[17:20] Elections this week to use the town hall for that for the all the elections
[17:26] necessary for this year we have responded to public records requests for
[17:32] the Happy Hill Road subdivision Mr Wagner has will be attending his first
[17:37] clerk certification class next week so keep in mind he will not be here it will
[17:43] just be pressed enough so be kind
[17:49] um every year we are required to submit a survey to the league in regards to the
[17:55] town benefits I just recently completed that and then every year we are also
[18:01] required to submit to the state on our water system to reports the consumer
[18:09] confidence report that's due June 1st and that's a lengthy process and priest
[18:14] has already started working with Rural Water on that and then we have the 2022
[18:20] water supply report that's also required and that is due April 1st I believe so
[18:26] we'll be working on that as well um and that's just a small list of what
[18:31] we've done this month let me add I also attended an emergency
[18:35] services meeting put on by the county I did that this uh this past week I
[18:41] believe it was
[18:45] our planning board Justin
[18:53] please step up to the podium if you don't mind
[19:01] so you don't have to forgive me I was not told I had to speak about
[19:04] administrative reports on the planning board so uh uh speaking off the cuff
[19:10] we are uh let's see if you would identify yourself please I'm Justin
[19:15] Snyder I am the staff to the Stokesdale planning board I am the senior planner
[19:21] for Guilford County and so we do all the administration and
[19:29] um the reviews for anything that's related to Stokesdale so any site plans
[19:35] any subdivisions Platz related to Stokesdale we do all the reviews on
[19:39] those so um we've had uh inquiries but not a lot
[19:46] of development activity at this point aside
[19:50] from we do have the rezoning public hearing tonight
[19:53] as Dale mentioned we are working still on the blacksmith amenities Center
[19:59] finalizing those plans as well as the blacksmith subdivision plans
[20:04] and then uh not too not too much else uh has
[20:09] really come through we get daily inquiries uh about potential development
[20:14] potential activities uh but as as of right now we haven't gotten any formal
[20:18] submittals so we'll keep everybody in the loop as we get it thank you Jeff
[20:23] appreciate it thank you
[20:28] events committee do we have anything no no nothing for events committee property
[20:32] committee yeah we probably should have put this on
[20:35] an item um
[20:38] further down but we need to either work on or replace a refrigerator yes
[20:45] um it's it's in here yeah well I know but really I should have put it
[20:49] somewhere else but um
[20:52] I need to get authorized to uh so we don't have to wait till next month if we
[20:56] can't if the repair is going to be too much I'll replace this refrigerator
[21:02] as a property committee obtained any quotes for a new refrigerator they're
[21:07] out yeah we need 7.99 for just a standard refrigerator Fighter ice
[21:11] monitor but depends on what council wants to do you
[21:15] want to just we have an ice machine you know
[21:19] okay that's just a standard over and under nothing fancy but you know we've
[21:22] got a fairly nice refrigerator if we can repair it reasonable but if it's going
[21:26] to be four or five hundred dollars probably can you buy refrigerator
[21:29] without an ice maker today yeah yeah Jimmy do you have a number and I'll just
[21:33] make a motion to give you the spending authority of that figure
[21:36] well I'd say uh okay the numbers oh go ahead
[21:42] I have spoken to Mr Landers about this kind of familiar with the problem is why
[21:46] I'd like to make a motion here I'd like to make a motion authorize the property
[21:49] committee to purchase a new refrigerator up and expend up to nine hundred dollars
[21:55] that doesn't mean you got to spend it all guys but 900 and then I would like
[22:01] to prioritize here that the property committee seek to repair the one we have
[22:05] at a cost not to exceed uh 450
[22:13] my thought process is some of the newer refrigerators seem to be
[22:17] uh cheaply built thinner coals components
[22:22] don't look as durable so I'm not sure if we shouldn't at least make an effort to
[22:26] try to fix what we already have I looked at it myself and it seems like a fairly
[22:31] well made refrigerator I did check and it's not clogged with dust I pulled it
[22:35] out and checked that myself so that'll be my motion I'll say thank you
[22:40] yeah any discussion
[22:44] Mr Rigsby
[22:47] aye Mr Foy aye Mr Landreth aye Mr Jones aye and I am also I and the second thing
[22:54] you know we've got a a small leak in the men's restroom plumber came out uh
[23:01] they've ordered a gasket now when they go in I want to fix this
[23:05] thing I don't want to come back to council I have to wait a month so um
[23:11] I don't think it'll be a lot but uh we need to do we need to authorize
[23:16] something or just I'm just going to fix it
[23:19] well the the spending limit for the property committee is fairly low I asked
[23:24] I was going to talk about that tonight too uh well what's what's your
[23:29] preference you want to make a motion here
[23:31] um no I'm going to save that for for when
[23:36] we do the um we've got the um separation of Duties okay I'll make a motion I'll
[23:42] make a motion to authorize the repair of the the leak in the men's bathroom at a
[23:48] cost not to exceed 400.
[23:52] I'll second it any discussion
[23:56] Mr Rigsby aye Mr Floyd
[23:59] aye Mr Landreth aye Mr Jones hi and I am also I
[24:04] uh I might add Jimmy if you need are you going to try to do this yourself no oh
[24:09] okay I was going to say if you're going to try to do it yourself I'll be late to
[24:12] supervise no okay it'll turn into two thousand if I do it
[24:17] okay I got you
[24:20] uh Town Improvement Town Park Improvement committee Mr Stevenson
[24:28] good evening I'm T Stevenson the chairperson for the park Improvement
[24:32] committee uh just a real quick update um and we miss Martin has already spoken
[24:37] to the rfps that have been released but wanted to make sure that you folks knew
[24:41] that the park Improvement committee meets every week on an ongoing basis
[24:46] keeping our finger on the pulse of of everything that's going on
[24:50] as I said the rfps the request for proposals have been released we do
[24:56] expect they were released separately for each each project the playground
[25:02] equipment and installation proposal was released and we expect
[25:06] those to actually be returned tomorrow by lunchtime the cob opening is
[25:13] scheduled for January the 23rd at which time the committee will review those
[25:17] proposals and have further discussion and perhaps a recommendation the
[25:23] construction of the amphitheater the sealed bid for that is due February the
[25:29] 28th and we are anticipating that we will open those on March the 2nd the
[25:36] basketball and pickleball court seal bids are due by March the first and
[25:41] again we anticipate looking at those in the seal bid process on March the 2nd
[25:47] that's certainly when those are received we'll have a lot more to talk about and
[25:54] we'll be able to give you more information at the next town council
[25:57] meeting on March the 9th clarification by we will be opening the bids actually
[26:04] staff Robbie and Miss Martin welcome the Town Park committee would be present and
[26:08] that would occur during a meeting but I just wanted to be clear that staff would
[26:12] do it thanks T right it's always a great report any other questions also tell you
[26:16] you mentioned that you meet weekly yes what day of the week do you meet on
[26:20] Thursday afternoon at 5 15 in this room and these are open meetings anyone that
[26:25] would like to attend is certainly more than welcome
[26:29] there's no admission and there's no food yet thank you sir thanks Mr Mayor if I
[26:37] may make it yes sir yes sir in regards to the parking Improvement committee I'm
[26:43] probably in a maybe perhaps the next meeting I want to
[26:48] make a motion and see if I can get Council support to create a budget for
[26:53] each one of these projects that would break down the cost from you know site
[26:57] work all the way to Atlanta all the way to landscape and at the end
[27:02] and set aside a 20 contingency for each project
[27:07] and let's try to get some numbers down on a sheet of paper for each project so
[27:12] that we're we've got at least a general concept of what we're spending on each
[27:17] one uh the you know up into this point everything's been preliminary but I
[27:22] think we need to get some sort of uh budget sheet put together for each one
[27:26] of these projects
[27:30] I'll be happy to see that forward if you'd like to make a motion I'll vote
[27:33] for it as well well my hesitation is that I don't have
[27:37] a template for this I don't want to well the the template would be different on
[27:42] each project the amphitheater would be the most uh
[27:45] it is inclusive of site work environmental work uh construction
[27:50] materials and so on and so forth whereas you know playground equipment is it's
[27:55] not very complex well what I'd like to do is see the uh Park Improvement
[28:01] committee come up with a template for this and submit it to the council for
[28:04] approval then would make it easy on me once we get the beds we'll
[28:10] pretty much have that that's what we're doing well
[28:13] I mean that's what we're doing again my concert the numbers will be there I
[28:18] understand my concept is to put a financial fence around each one of these
[28:22] projects so that we we have the cost at least contained in this fence or in this
[28:27] box or in this uh you know this worksheet so that uh
[28:32] everybody's looking at the same sheet of paper I mean that's canceled citizens
[28:37] committee that's what we're doing we're trying to
[28:40] get something to put in that box well the request for uh proposals and
[28:44] qualifications all those things are great but I don't think they'll include
[28:49] total cost and the whoever respondents of these is not going to give you a 20
[28:54] contingency for one thing but there will be things that it won't include perhaps
[28:59] Landscaping uh audio wiring you know those types of
[29:03] things I don't know if we'll get every every Last Detail included uh when we
[29:08] get to get these back in the way of a response but but we can control what we
[29:13] do on our ends as far as having uh some sort of budget worksheet for each one of
[29:18] these projects at all that's exactly what
[29:22] we're going to do but we've got to have some numbers to do that and I mean we
[29:27] haven't even voted on as far as Council hadn't even voted to do the projects yet
[29:31] I'm just in the process of the planning to see if we want to do it I understand
[29:35] that's why I'm not making a motion but I feel like
[29:39] the citizens out there deserve our deity of care with spending their money
[29:44] and that's why I bring it up well that's that's what we're doing so I don't want
[29:47] you to make it sound like that's not what we're doing because we are we're
[29:50] well aware that that the citizens money is being spent and we're going to do
[29:55] everything we can to you know get the best bang for the buck
[29:59] um so I mean what you're saying is is good
[30:03] we do need to do that but we've got we got the numbers coming so
[30:06] we can't do anything do we do it anyway perfect
[30:10] duly noted
[30:14] Financial reports Miss Thacker
[30:26] yeah I think that's good good evening good evening can everybody
[30:32] hear me okay okay good all right we'll start with the general fund
[30:38] um in the arpa funds the American Rescue plan act we have 723 965 dollars

[34:18] um 193
[34:21] 264.20 okay thank you you're welcome
[34:28] any further questions we'll open it up for uh citizens
[34:33] comments
[34:37] you'll have to help me out here these cards that I have I'm not sure exactly
[34:40] what
[34:45] just public hearing I know that I said that earlier yeah
[34:49] this is not the public hearing this is the uh this is just citizen comments if
[34:53] you'd like to talk about the shirt I have on or whatever you know
[34:58] uh thank you does it does it really okay well good
[35:05] anyone open meeting all right very good moving
[35:10] right along this goes to the public hearing this
[35:13] public hearing is a rezoning case number two two one two p l b d 0 0 3 1
[35:21] 757 Happy Hill Road Kernersville North Carolina property is located on the west
[35:26] side of Happy Hill Road Sr 2032 approximately 1740 feet north of Monty
[35:34] Drive intersection Guilford County tax parcel one six four nine six one this is
[35:41] a request to rezone the subject property which contains 10.15 acres and is
[35:47] located within the town limits of Stokesdale despite its commercial
[35:51] address from A.G agricultural to rs40
[35:56] single-family residents the applicants upon any major development of the
[36:01] property intend to connect to Stokesdale water
[36:05] system I believe we have Mr Clayton
[36:11] Snyder yes
[36:16] Justin needs to speak go ahead sir
[36:22] thank you Mr Mayor and Council once again Justin Snyder I am the planner for
[36:28] Guilford County this represents the town of stokesdale's interests
[36:33] so um as the the mayor introduced so eloquently we have a rezoning case here
[36:38] at 7577 Happy Hill Road the request is from agricultural to rs40 which is
[36:44] single family residential with 40 000 square foot lot sizes
[36:48] the
[36:52] so um just just a general note that the the reason that they have to come for
[36:57] this rezoning is if they develop this property into any sort of major
[37:00] subdivision which under stokesdale's ordinance is when there's a connection
[37:04] to a public utility a newly dedicated public road or if there's more than four
[37:10] Lots then they they must rezone to an RS District to be able to do a major
[37:16] subdivision so the request tonight is not for subdivision that is handled
[37:22] through the technical Review Committee of Guilford County which then refers it
[37:26] to the planning board for final approval so that is an administrative process
[37:30] this is a legislative hearing on whether this property is worthy of the rs40
[37:36] designation and whether that request is consistent with the future land use
[37:41] plans and what the plans for Stokes Tales so currently this area is
[37:46] primarily rural residential there is agricultural low density single-family
[37:50] residential uses in this area uh there is one single family dwelling
[37:55] on this property uh the surrounding land uses as I mentioned single family
[37:59] residential and agricultural uh to the West it's undeveloped as of right now uh
[38:04] and it's mostly forested land and it is adjacent to the Oak Ridge
[38:09] extraterritorial zoning jurisdiction there are no designated historic
[38:14] landmarks on are adjacent to the subject property and no cemeteries have been
[38:17] shown on this property the Fire Protection District for this
[38:21] would be Stokesdale hits approximately 3.6 miles from the
[38:25] nearest fire station the intent is to connect to Stokesdale
[38:30] water if there's any major development of this property
[38:33] and they would use private septic systems
[38:36] the existing conditions on Happy Hill Road Happy Hill Road is a residential
[38:40] street if there are proposed improvements it
[38:43] would be subject to the North Carolina Department of transportation's driveway
[38:47] permit requirements because it is a North Carolina DOT road
[38:51] a traffic study could be required based upon the overall size of any sort of
[38:58] large subdivision and this property according to North
[39:02] Carolina Department of Transportation does not appear to be impacted by the
[39:05] proposed u.s-158 Improvement project that's listed in the step project number
[39:13] r-2577b and they have noted that the average daily traffic is estimated at
[39:18] below 500 or 500. 500 cars a day for Happy Hill Road
[39:24] there is no projected traffic generation at this time because we this is not a
[39:28] subdivision proposal it's just a resulting proposal
[39:31] and so uh School impacts uh they are projected upon a development of this
[39:37] property at a 40 000 square foot density to be relatively minor with anywhere
[39:42] between uh one to five extra students per School
[39:47] uh environmental assessment on this property the Topography is gentle and
[39:51] steeply sloping there is no regulated flood plain on this property however
[39:55] there are uh there's floodplain and wetlands to the Western portion of this
[40:01] property that lies within Oak Ridge and also within Forsyth County
[40:05] uh the land use plan this is uh part of the Stokesdale land use plan and that
[40:11] plan recommendation is residential and uh the requested action uh by the
[40:17] applicant would be consistent with the recommendation of the Stokesdale future
[40:20] land use plan and thus the action if approved would not require a future land
[40:25] use plan Amendment and staff is recommending approval
[40:28] because the proposed rezoning action is consistent with the recommendation of
[40:32] the future land use plan and it is reasonable and in the public interest
[40:35] because it is excuse me because it is adjacent to residential uses in the area
[40:40] and would provide low-density housing opportunities for citizens in an area
[40:44] that's served by Stokesdale Municipal Water or able to be served by Stokes to
[40:48] a municipal water and I welcome any questions that you
[40:53] might have
[40:55] any questions by the council we want to do we're going to do that now
[40:59] I thought y'all said something get the questions are we going to are we going
[41:04] to wait or I know I would suggest we wait myself
[41:08] okay correct okay well I'll be going to do
[41:12] anything I have some
[41:16] the public meeting is open
[41:21] lay on some grounds ground rules we want to hear those that
[41:25] are going to speak for this reason exactly exactly
[41:31] the proponents and opponents will be limited to uh 30 minutes each
[41:42] no
[41:46] Miss total
[41:50] proponents shall be heard first and shall be provided a total of 30 minutes
[41:55] notwithstanding the number of persons Desiring to be heard opponents shall be
[41:59] heard after the proponents shall be provided a total of 30 minutes to be
[42:03] heard notwithstanding the number of persons Desiring to be heard each side
[42:08] will be allowed three minutes in rebuttal
[42:12] Mr Wagner will be keeping the time and will
[42:17] announce when time has expired
[42:23] speakers in favor
[42:30] yes if you would step to the podium identify yourself
[42:37] all right
[42:44] good evening mayor good evening members of the council my
[42:49] name is Greg Garrett and I'm with RS Parker homes our address is P.O box 5967
[42:55] Highpoint 27262
[43:00] thank you for hearing my request tonight I will do my best to explain why I'm up
[43:06] here tonight um
[43:09] some of you may have been on recognized several of you but in in 2021
[43:15] um my company had acquired 126 Acres um mostly well is to the west of the
[43:23] subject site and in doing that we had a access
[43:28] um onto Happy Hill through Duke Energy property and it was a it was an easement
[43:35] and so we rezoned that and that was going to be access into my development
[43:39] that's mostly on the lake since 2021 and and the details of
[43:45] engineering it became very evident that there were other ways to um to access
[43:53] the 126 acres and um actually through the rezoning process
[43:58] for the 126 Acres I met the the current property owner of this the subject site
[44:03] tonight and she had expressed interest in selling at some point and so we've
[44:09] actually gotten together I'm under contract of course it's contingent upon
[44:13] the rezoning of it the property Zone Agricultural and we're asking to be
[44:18] zoned to rs40 which I understand is your least intense single family zoning
[44:26] District in Stokesdale and even though this is just a general zoning I can tell
[44:32] you because we've already done the detailed designing we're talking about
[44:36] keeping the existing house on the property and adding six more houses to
[44:41] to our development so the development that was approved by you guys with the
[44:47] access and then Oak Ridge and the Lion's Share of the 126 acres is actually in
[44:52] Forsyth County that development in 2021 equaled 94 homes and so tonight this new
[45:02] access will allow us to go up to 101 101 Lots
[45:07] again the 94 is already approved I've got access it's just not the the most
[45:13] desirable access so I'd like to use this one instead of the Duke Energy the good
[45:19] news for the town of Stokesdale and this is that we now have an entrance road
[45:25] that will have homes on the entrance road that will be in your um pound
[45:30] limits so those seven houses will be in the the town limits of Stokesdale
[45:36] um I um I'm I'm sure some of you remember
[45:41] this 2021 rezoning it was back and forth with Duke Energy on whether we needed an
[45:48] easement or whether it needed to be fee simple we ultimately have ended up
[45:52] getting the fee simple and that was zoned rs40 for this subdivision so
[45:56] there's nothing you know that that can be done tonight that's going to stop our
[46:00] ultimate subdivision we're just hoping to improve it with the better access
[46:05] and so that's the reason for the the request tonight we do plan to extend
[46:10] public water to the property it's about 2 700 feet from
[46:16] um Highway 158 it's sending stokesdale's water line down Happy Hill Road and then
[46:22] of course into the development the subdivision
[46:26] um I um I I'm joined here by my civil
[46:30] engineer as well as the current property owner
[46:34] um we're here to answer questions should you have any
[46:38] um I hope that you agree with your planning department and the planning
[46:41] staff um that this is a consistent rezoning
[46:46] request with your your future land use plans and you agree with them and vote
[46:51] in favor for it tonight
[46:55] thank you thank you thank you we'll have some questions after
[46:59] everybody speaks but I would like to make a clarification if you could go
[47:04] back up to the eye the microphone did I understand you correctly when you
[47:09] said that this board has rezoned the Duke Energy property just just a 60-foot
[47:14] right-of-way into the 126 Acres so Mr Wagner this is a good time to
[47:20] throw up that slide
[47:26] yeah that perfect yep and if you would be so kind as to put
[47:32] your cursor over the um the the right-of-way that currently goes into
[47:37] the property um not not this proposed one but you um
[47:42] at the top of your screen there you can see it kind of meanders on in
[47:47] is there a way for you to do we have a pointer
[47:53] yeah well that you zoomed in on it yeah so in 2021
[47:58] um the the Stokesdale Council rezoned that 60-foot right-of-way to
[48:04] rs40 to facilitate this development
[48:10] we rezoned it Mr let me speak to this if I may please do
[48:16] I was the planning board chair when that was heard
[48:20] you made an application for rezoning and then you subsequently withdrew your
[48:25] application um it was on our agenda I made the most
[48:30] necessary motion when you withdrew your application so we could get it off our
[48:34] agenda I'm I've been here almost six years I'm not aware of you having
[48:40] rezoned that property sir so if if there's you've got some evidence of this
[48:44] or can point us where I'm mistaken here I'd appreciate it I I
[48:50] was sitting there yeah I was on the council too and I don't recall rezoning
[48:54] I do recall at the advice of our former attorney that this did not need to be
[48:59] resigned because one the property owner wasn't asking for the rezoning and it
[49:04] didn't need to be resigned because the access road was already there Duke
[49:08] Energy granted the late family I believe access to this in 2008.
[49:14] uh I okay excuse me I mean it's it's been a
[49:19] couple years but uh uh regardless it's been a couple years for me too yeah so
[49:25] regardless I I do want to take access at a different location which is the
[49:31] subject property tonight sure sure no but you're saying that's rezoned now
[49:37] and that even if you don't get this that you can go that way and still do the
[49:42] project at the lake is that correct that's that is my understanding yes
[49:46] all right I just don't remember I remember being pulled we had us back
[49:49] when we were doing the uh Meetings online yeah and uh y'all kept having a
[49:54] problem with the who was saying it was on who I mean you knew who owned it but
[49:58] who was going to authorize y'all to go through there and it kept getting pulled
[50:01] and back and forth and back never actually came to us and um they said
[50:07] some kind of state law or something Chapman I don't even know that this is
[50:10] true because it was just that you didn't catch come before so that we did no
[50:15] rezoning right whatsoever so yeah like I said it's you know what you're saying is
[50:21] it's it's irrelevant to you but it's relevant to us that's right it
[50:26] absolutely is um what you're saying is whether this
[50:30] project that you're asking for this zoning goes through or not you have your
[50:36] that that project's going to happen that that's not going to stop it
[50:40] that is what my attorneys have told me yes uh you know yeah
[50:46] okay okay all right I just just want to make sure because we had I looked at
[50:50] that several times the planning board meeting online you know where you said
[50:54] that and uh I mean I was there so yeah there was a lot of yeah it was a big
[51:00] confusion um ultimately I was told we got I know I
[51:03] know I forget a lot of stuff but I don't think I'd forget that just to be clear
[51:07] you're talking about the development in Forsyth County would proceed
[51:11] no no we didn't hear anything do anything Forsyth County no but but he's
[51:16] saying but the development here wouldn't proceed without the resulting tonight
[51:19] yeah that's what I'm asking I mean in other words whether this property
[51:25] rezones or not he has access in I just want the citizens to understand if that
[51:30] if that's the case I don't know what to be the case and I'm not saying that's
[51:33] the case but if if that is the case it you know it doesn't matter you're still
[51:38] going to get you're going to get uh what is it I forget what the number was
[51:42] but you're going to have seven less homes up near 100 homes that's
[51:46] regardless yes of this rezone yes sir okay I just want to clarify that yeah as
[51:51] a result of all of that I mean we actually
[51:55] um have fee simple title of that 60-foot access coming in
[51:59] it was originally Duke Energy's it was just an easement granted and then we
[52:04] ultimately purchased it
[52:08] we've got deeper in the woods and I wanted to get that quick it didn't
[52:12] convey with the purchase of all that land in Forsyth County because of all
[52:16] the back and forth about what we needed we ended up needing to have title to it
[52:22] um in order to have it rezoned again I'm just going off of this memory you know
[52:26] so but what I can tell you for sure is you go on GIS and click on it and you'll
[52:30] see ours Parker homes we we own it okay cool
[52:36] anything else like I say I
[52:41] I've got a handful of questions and we're going to hold it too everyone's
[52:44] had a chance to speak uh thank you Gary yes
[52:54] speaker is in opposition so it may want to require any more in in
[52:58] support oh I'm sorry but then getting confused here are there any others in
[53:04] support of the uh
[53:07] rezoning
[53:12] opponents
[53:21] you don't use your card do you have the cards they're waiting for you to call
[53:26] them I'm just I'll let them I don't know who's who
[53:30] Shania Shanae
[53:36] let me get my notes up here
[53:44] if you would please identify yourself my name is Shanae Carroll
[53:49] um I live at um 7581 Happy Hill Road my husband and I
[53:54] we are adjacent to the property of um 7577 Happy Hill Road
[54:01] um I think one of our main concerns is
[54:04] the traffic safety concerns um but there will be a lot of traffic
[54:12] I know this is just the rezoning um that we're discussing the rizzonia
[54:16] tonight but eventually you know if it is approved there will be a development
[54:20] there and there will be a lot more traffic and we live at the top of the
[54:24] hill adjacent to the property and at that top
[54:28] of the hill you can't see cars coming up so
[54:32] even if it was approved we would um
[54:38] highly recommend that there be some type of traffic analysis especially coming
[54:42] from um Warner Road to like if you're coming
[54:46] from Warner Road down Happy Hill Road some type of traffic analysis because
[54:50] you can't see coming down over the hill when you're turning in
[54:54] um another thing is the way our property is adjacent to
[54:59] um 7577 we have concerns of encroachment I mean there are it's
[55:05] I don't feel like the land the the space between our land and then
[55:10] the land on the other side of 7577 is enough land for
[55:15] uh a um a road or to safely put a road in there so those are are our concerns
[55:24] and we just thank you for allowing us to be here and I'm sure we have several
[55:30] um neighbors that will probably speak to it um but yeah we do have a lot of
[55:35] concerns thank you thank you thank you thank you very much
[55:38] uh Daryl Watkins well yo will you take the microphone to
[55:44] him yeah please Robbie
[55:52] I feel like I probably shout out I don't know if y'all could hear me but
[55:57] I live at 75 75 Happy Hill Road and I've been there I've been here in Stokesdale
[56:03] all my life Daryl if you would identify yourself my name is Daryl Watkins I live
[56:08] at 7575 Happy Hill Road uh I'm probably the one that's going to be along with
[56:13] Mrs Carroll one of the most adversely affected people
[56:17] if this goes through um that little bottleneck that they're
[56:23] talking about running through there
[56:26] directly runs parallel with my driveway and that will hook you in the road is
[56:32] going to end up being probably
[56:35] 35 40 feet from my back drive my driveway entrance my garage
[56:42] entrance it's um it's pretty
[56:46] obvious if y'all would come and look and just see
[56:50] what kind of predicament this is going to cause just for my life
[56:56] um not not for the people around me not to
[57:01] mention the traffic that's going to come through that come through that come
[57:05] through there it's it's just not uh I don't think there's enough
[57:09] laying there to do it I think there's going to be encroachment on both sides
[57:13] because even if you have a 50 foot right away what about the utilities and
[57:18] everything that's going to Encompass in those right-of-ways you know you've got
[57:23] to have utility for power you've got to have a water line and the way I
[57:28] understand that water line is going to be great big
[57:30] so eight inch water line coming through there how much does it take to run an
[57:35] eight inch water line 20 25 feet is that going to be another 25 feet and
[57:42] I went today just out of pure curiosity for myself I measured from the center
[57:46] line of the road to the ditch to the center of the ditch that's 25
[57:51] feet so that's already 50 feet for both sides
[57:55] not to mention what the water line is going to be if it's another 25 feet this
[58:02] power line going to be another 25 feet so I'm really I'm really
[58:06] I'm really I guess I'm coming to you guys asking you to
[58:10] just think about what you're doing and please come and look
[58:14] I think this thing needs to be a little more time for you guys to see what
[58:18] they're trying to push on us I mean this is something that we can't reverse once
[58:23] it's done and I guess something else I want to
[58:27] talk to you all about um I don't know if y'all have ever been
[58:31] and seen houses built on Happy Hill Road uh every house on Happy Hill Road
[58:39] have some kind of rock formation that ends up needing blasting
[58:44] and I know the Shiloh up there when they built it just recently they rocked my
[58:50] house um so this company coming in
[58:54] not knowing what adverse conditions that they're going to encompass
[58:59] they're going to jeopardize our homes with this you know if they mess up our
[59:05] foundations on our homes who's going to repair them are they going to be
[59:09] responsible for that and I wish if y'all did let them do it
[59:13] you would make them responsible if they do come in there and blast rock out and
[59:18] bust up our foundations because it's going to happen
[59:22] it's going to happen those rock walls those uh cinder block walls in those
[59:28] basements they aren't going to take but so much
[59:31] they aren't going to take but so much these aren't fireworks they're Dynamite
[59:36] they're explosives that they have to use get that rock out
[59:41] God told me when uh we built my house he said y'all better off
[59:47] just to build a rock quarry here instead of build a house
[59:52] so I guess my thing is all the things that's going to happen to us
[59:57] and to my family and to my friends and all my kin folk around me
[1:00:04] who's going to be responsible for that will this developer be responsible is he
[1:00:09] going to stand up and say hey I'll take care of that if I bust your wall you
[1:00:14] know I'll fix it you know but then they've compromised the Integrity of our
[1:00:19] homes even the value of our homes once they
[1:00:23] tear it up who's going to fix it are they going to fix it and anybody that's
[1:00:29] lived here knows that Happy Hill Road has been
[1:00:34] forever and a day almost a rock quarry and now they're coming in here wanting
[1:00:40] to build these homes without any kind of I don't know geological would that the
[1:00:44] right word won't say studies or anything you know right across the holidays Tim
[1:00:50] and Corey is a closed up rock quarry that ran for years
[1:00:55] and now we're coming in getting ready to develop
[1:00:58] on the top of another one it just don't make sense to me
[1:01:02] and did they even study why the lake stops right there
[1:01:07] where it stops and the lights still had all that land that they even study that
[1:01:12] they didn't question why they still had all that land
[1:01:16] no they didn't I guarantee they didn't but if they did
[1:01:20] check it out in 1974 when they built that Lake why did they stop it there
[1:01:26] that's a good question they'll find that one
[1:01:30] and thank y'all for listening to me and I probably rammed along
[1:01:42] forward the mayor Mr Winfrey
[1:01:46] I feel like I need to say something here
[1:01:50] set a 30 minute limit for those that want to speak in favor of this we have a
[1:01:56] pretty good crowd here and there are people that want to speak in opposition
[1:02:01] that I know Mr Watkins and him and you know
[1:02:06] I've heard every word he said but my concern here is that this time this 30
[1:02:11] minutes is not being evenly allocated amongst those that want to speak against
[1:02:16] this uh our normal practice in the past here
[1:02:21] with these things is to allow somewhere between 10 and 20 minutes for for each
[1:02:27] speaker that's what we've done with planning
[1:02:31] board and and it's tough because this board wants to hear everybody out at the
[1:02:36] same time you know we do have to get finished with the meeting that got other
[1:02:39] agenda items so Mr Winfrey is there some allowance
[1:02:44] that we can make here to divide up this time a little bit more proportionally
[1:02:48] because uh I feel like somebody at the tail end of this that really wants to
[1:02:53] speak to us is not going to get that chance
[1:02:55] well the first question I have is is the clock's still running because we need to
[1:02:58] stop it while we're discussing this procedural matter and maybe yes three or
[1:03:02] four minutes back to it yeah yeah it's still running
[1:03:07] the world can do whatever it wishes uh you know my experience is if you
[1:03:12] if you had someone who was a spokesman for the group in opposition
[1:03:17] if you limit everybody to a certain amount of time then you've got you you
[1:03:21] truncate their discussion so um the board can make whatever rules it
[1:03:26] wants to make with regard to how long each person speaks if you want but
[1:03:32] um typically I've seen just time allocated
[1:03:37] in case there's a spoken and I understand the concept with crowds and
[1:03:42] to limit and and have the uh you know perhaps somebody speak for multiple
[1:03:46] people uh it's just we and rare circumstances in the past the town of
[1:03:52] Stokes stealth's done that but most of the time we've tried to work and make
[1:03:56] sure that we have a little bit of time for everybody that wants to
[1:04:01] that wants to speak and I'm I'm objecting to this uh because I'm
[1:04:06] uncomfortable well that's my job what really wants to adopt with regard
[1:04:11] to time limit I'd like to hear from everybody who wants to speak absolutely
[1:04:15] and you know the only thing I could say folks that do want to speak if if you
[1:04:18] let's say something Mr Watkins has hit on something one thing to speed things
[1:04:22] up would be to say I agree Mr Watkins on that issue instead of going into detail
[1:04:26] about it but I'd like to hear from everybody if you come here and you want
[1:04:28] to talk I want to hear you I agree you know three minutes or whatever I mean if
[1:04:33] you get it out in three I mean if it's something that you really got to go I
[1:04:36] want to hear you man this is important to everybody
[1:04:39] all right Mr Mr Winfrey would it be okay to
[1:04:43] to just uh have the have the chair agree that we're going to allow everybody
[1:04:48] wants to speak on this 10 minutes
[1:04:52] I I'm I'll sit here all night if I need to but the boy can adopt whatever rule
[1:04:56] it wants okay I mean I'm willing to make that
[1:04:59] motion if you think emotion is necessary Mr Wagner well I think excuse me
[1:05:04] I just got you mixed up with young Mr Wagner you should be flattered Mr
[1:05:09] Winfrey yes uh um
[1:05:12] given that the materials announced a rule
[1:05:15] for for how this is to be done if the board was to change that rule I think
[1:05:20] emotionally in order to change the rule to adopt whatever ruling okay of course
[1:05:24] if the proponents want to speak some more too you know I would want to hear
[1:05:28] from them I want to hear from everybody anybody that wants to say something who
[1:05:31] got the rebuttal or whatever I mean this is a big deal I'll make I'll make this
[1:05:36] motion that anybody wants to speak Pro or uh against this rezoning case will be
[1:05:42] allowed at least 10 minutes and and we would ask that you not be redundant and
[1:05:47] repeat what the just the previous speaker
[1:05:50] touched on if if you do this board that courtesy but we want to hear from
[1:05:55] everybody and that'd be my motion yeah in lieu of a time so no time limit for
[1:05:59] opponents who are opposition just 10 minutes per person
[1:06:04] looks like Joe Biden said I have a motion do I have a second
[1:06:10] any discussion Mr Rigsby
[1:06:14] aye Mr Floyd aye Mr Landry aye Mr Jones hi and I am also I
[1:06:20] uh let me back up here just a minute Mr Clayton did you want to speak in favor
[1:06:26] um well I'm the engineer and I can I could answer some of these questions
[1:06:30] that have been brought up okay I have I have the card here for you uh
[1:06:34] as a proponent and I overlooked it would you would you care to stand up to speak
[1:06:38] to anything to this point
[1:06:47] if if you would I'll need you to step to the podium identify yourself please sir
[1:07:01] uh my name's Norris Clayton with Hugh Crete Associates Engineers 1306 West
[1:07:06] Wendover Avenue in Greensboro engineer for the project
[1:07:11] uh the comment came up about putting an eight inch water line eight inch water
[1:07:17] line all water lines within the city of Stokesdale or put in the right away of
[1:07:22] the street you get an encroaching permit from dot to put it in
[1:07:26] it's usually in the shoulder of the street about four or five feet off the
[1:07:29] edge of pavement so that would be within the right way
[1:07:33] the the bottleneck area they're talking about
[1:07:36] is we've done surveys 57 feet from property line to the corner there so
[1:07:43] right away would be 50 feet wide we could we could get in through there
[1:07:48] so does a couple quick answers for that if anybody got any other questions I'll
[1:07:52] be glad we'll have questions once once everyone's had a chance to speak do we
[1:07:56] have any other proponents for this uh rezoning do we have any
[1:08:01] other opponents for this rezoning
[1:08:07] it's hard sir I've got them I've done them got them all
[1:08:10] got them all you've called everybody called them all yes sir would you like
[1:08:13] to speak are you are you in opposition
[1:08:18] okay if you would step to the podium and identify yourself
[1:08:27] thank you my name is Duane Dalton 8300 Zebedee Lang Stokesdale and I'm in
[1:08:33] opposition uh anyway I didn't turn my name in for a
[1:08:38] card but and I'm speaking in a different way
[1:08:42] but I'm in opposition of this rezoning and I'm speaking on behalf of Wildlife
[1:08:49] town at Stokesdale is just being sucked in in the animals is most of us can't go
[1:08:55] out of our backyard front yard nowhere Wildlife don't have nowhere to go
[1:09:03] I know it's good for people to have homes I want everybody to have a home
[1:09:07] but it's more laying outside the Stokesdale than everybody coming to
[1:09:12] Stokesdale and I mean where are the animals going
[1:09:16] I ain't just talking about Happy Hill Road I'm talking about every other place
[1:09:20] in Stokesdale we don't think about that when we uh
[1:09:24] rezone and laying and taking it out of Agriculture putting in residential
[1:09:29] and the Animals can't speak and that's what that's why I'm here
[1:09:36] we need more land no man no more land is being made but we
[1:09:41] need the land we do have for wildlife
[1:09:45] Wildlife because I mean what are we going to do
[1:09:49] I mean you shouldn't have to go to the zoo to see a deer
[1:09:54] you should not go to the zoo to see a raccoon
[1:09:59] a skunk but that's what's gonna happen
[1:10:02] if we keep on building and building and building
[1:10:06] Stokesdale Oak Ridge Summerfield Greensboro Winston-Salem
[1:10:11] the wildlife is going they gonna go somewhere
[1:10:16] and I would like to see a few I'm in Stokesdale all over they get on my
[1:10:19] nerves
[1:10:22] as well as some people
[1:10:25] I was still I just think we should consider
[1:10:30] not developing every inch of land to put houses on not I just that's what I want
[1:10:36] to say okay thank you sir okay thank you very much
[1:10:41] yes sir opposition or proponent
[1:10:46] if you would identify yourself please sir
[1:10:52] some Gerard Carter I live at 7569 Happy Hill Road and just looking at this the
[1:10:59] plan and listening to the developer if they have a right-of-way already
[1:11:05] why do they need to disrupt lives to put another one in just because it's
[1:11:11] probably going to be a little easier for them a little cheaper for him
[1:11:14] like a lot of people said that that spot where they're coming in at it's a blind
[1:11:18] spot when you're coming if you're going south
[1:11:21] on Happy here Road you don't see that until you're almost
[1:11:25] on it you won't see that that driveway until you're on it
[1:11:29] okay that's that's one issue the second issue is they're saying seven homes
[1:11:34] they're not telling you that that acts that's going to access the entire
[1:11:39] development so we're not talking about just seven
[1:11:42] homes now we're talking about 101 homes this is what we're talking about now
[1:11:48] majority in Forsyth County but you don't think they're going to come through
[1:11:51] there because it's easier to get out to 158
[1:11:54] or go to Stokesdale so we're not just talking about seven
[1:11:57] homes as they're trying to make believe we're talking about a 101 homes
[1:12:02] yeah it may be another access home Forsyth County but believe me a majority
[1:12:07] of they're going to come through there and you guys you really need to go look
[1:12:11] at it before you decide because that is a blind spot going south on Happy Hill
[1:12:17] Road once you hit the top of that hill then you see that access
[1:12:22] there's going to be some accidents there sooner or later there will be because of
[1:12:28] the amount of traffic is being added they've already added the development up
[1:12:32] the street at uh what do you call the Silo that's 60 some homes I think going
[1:12:39] in there and then there you're going to put in
[1:12:41] Access for another 100 homes on Happy Hill Road
[1:12:47] you guys realize what that's going to do it's not seven even though they're 77
[1:12:52] it's not seven they're going to have to access that whole development through
[1:12:55] there that's 101 homes
[1:12:59] well there's another unhappy you wrote to this property that they're building
[1:13:04] Mr Mayor yeah yeah but it's not in that spot gentlemen Gentlemen please I'm just
[1:13:11] saying it's not in that spot that's a very dangerous spot
[1:13:15] so that's that's that's what I have to say about it it's very dangerous if you
[1:13:19] ride and you see it I don't know what the other one is I don't know how
[1:13:22] dangerous that is but that one will be a very dangerous intersection
[1:13:27] that's it Julie noted thank you sir thank you Mr Carter
[1:13:32] does anyone else want to speak in opposition or
[1:13:35] a proponent
[1:13:41] guys come on like I won't uh we won't bite and I made that motion to give
[1:13:46] y'all time to talk now the room's full and I I just want to be sure y'all
[1:13:49] understand if you have something to say now would be the time
[1:13:56] if you would please step up to the podium
[1:14:04] foreign ER
[1:14:08] 75-44 Happy Hill Road
[1:14:12] this road this development will access Happy Hill Road the other end of that
[1:14:16] other development the 170 some homes comes off Van Hoy road but it hits the
[1:14:23] other end of Happy Hill Road it comes out on Happy Hill Road
[1:14:28] so all the traffic's going to be on Happy Hill Road
[1:14:32] who's going to put a left turn lane and a traffic light at Happy Hill Road in
[1:14:37] 158. he's going to pay for that
[1:14:41] you're going to need it you already got 500 homes 500 cars that
[1:14:47] you say with a study has on Happy Hill Road
[1:14:50] every day you're going to add 100 homes 101 homes
[1:14:55] you're going to add at least 200 if not 300 cars
[1:15:00] more
[1:15:04] bottom line without any improvements
[1:15:12] so all the traffic from both sides of this development are going to be on
[1:15:16] Happy Hill Road no matter how they want to spin it
[1:15:21] and I don't think you're up to that
[1:15:27] and to pull out at Happy Hill Road now on 158 is tough
[1:15:33] just because of the traffic almost any time of day
[1:15:39] to come in and out of there so
[1:15:43] you know is the town going to put the light put a light in down there then or
[1:15:47] or make the state do it or somebody's going to fund that
[1:15:51] it's going to be the developer I have to pay that bill
[1:15:57] if if you're going to go through with this
[1:16:01] and on the wildlife side you have plans of uh
[1:16:07] developments all over the place you're approving ground for future developments
[1:16:13] when you take away the agricultural that acreage that you approve for
[1:16:19] developments do you put that acreage somewhere else
[1:16:23] into agricultural or Open Spaces when you're doing away with the Open
[1:16:28] Spaces and agricultural or or you don't care about that
[1:16:34] foreign for the Open Spaces
[1:16:39] that's all I got thank you thank you appreciate it
[1:16:42] is there anyone else like to speak yes sir please step up identify yourself
[1:16:49] well I got a quick question is this please step up to the podium identify
[1:16:53] yourself if if you don't use the microphone it won't pick up on our
[1:16:57] YouTube channel and the recorders that the clerks use it was just not not just
[1:17:02] us it's our electronic gear okay is is this just strictly for please
[1:17:08] identify yourself my name is curry Reese I live on Van Hoy Road 8756 my land
[1:17:13] joins the property they're going to develop
[1:17:16] my question is is is this meeting just to rezone the the entrances on Happy
[1:17:24] Hill Road or does this include bent Ridge Forest too
[1:17:30] to answer Mr Reese's question this meeting is to rezone 10 acres of
[1:17:36] property on Happy Hill Road just Happy Hill the other development that's
[1:17:40] probably adjacent to your property that may or may not be in Forsyth County that
[1:17:44] has to the best of my knowledge been approved by Forsyth County
[1:17:49] okay that's that's what I was just wondering okay thank you
[1:17:54] thank you is there anyone else would like to speak
[1:17:59] got time for rebuttal three minutes each Mr Garrett
[1:18:07] once again if you would identify yourself
[1:18:10] Greg Garrett with ours Parker homes so I'm a father and a husband and I've
[1:18:17] learned to own it when I'm wrong I uh I did go look through all of my
[1:18:22] records and I found an email from Oliver bass and Tom Medlin which Mr Wagner has
[1:18:29] and it basically said that we didn't have to rezone that 60 years so you guys
[1:18:36] are absolutely correct it was never rezoned because it was determined that
[1:18:40] it didn't need to be rezoned for Access if there wasn't going to be any houses
[1:18:45] off of it um so
[1:18:48] I think we've cleared the air on that um
[1:18:52] one of the reasons why we don't like that access as much is because there's a
[1:18:58] lot more topography a lot more environmentally sensitive areas so we're
[1:19:02] going to talk about the environment and Wildlife that is the least desirable
[1:19:07] location to bring an Access Road in and and Mr Clayton can can testify to
[1:19:14] that as he's tried he's done all the engineering for it and it's it's not
[1:19:19] it's just not very environmentally friendly but it can be done
[1:19:23] it can be done but it's it's gonna cost more so I don't want to do it I mean um
[1:19:28] as far as the access issue is concerned I mean that is
[1:19:33] ncdot's jurisdiction they will come out and make sure it's a safe condition
[1:19:38] before they'll allow us to run that road I mean we have to go to them and apply
[1:19:43] for a driveway permit so that will be something that will be worked out later
[1:19:49] um as far as the rock goes
[1:19:53] um I'm unfortunately familiar with having to blast Rock and
[1:19:58] um therefore when I buy property I always do lots of geotechnical work up
[1:20:04] front before buying property because you just don't want to have to move rock
[1:20:09] around and blast however if you do incur so and we did not find there's lots of
[1:20:15] surface Boulders but down underneath it is actually good dirt and it's
[1:20:20] consistent with what the soil scientists found most of this land perks it's real
[1:20:24] Rock Rocky you won't per property but should we encounter Rock we actually
[1:20:30] have to hire a seismatologist and and do pre-pre and and post surveys to make
[1:20:39] sure that property nearby properties are not impacted by our blasting efforts and
[1:20:44] if they are then then we we or the blasting company typically has to make
[1:20:49] it right and that's why they carry very high insurance
[1:20:55] I believe I believe and of course Mr Clayton
[1:20:59] addressed how there's enough room for us to construct a road should ncdot permit
[1:21:04] that driveway access happy dancing your other questions you
[1:21:08] might have but there's the email from Oliver Bass
[1:21:12] saying that the rezoning wasn't needed and so at that point we withdrew it so
[1:21:16] you guys are absolutely correct thank you Mr Garrett you mentioned I do
[1:21:22] have a question you mentioned that other environmental concerns on the Duke
[1:21:26] Energy property and that it's also more expensive so it's not ideal if just a
[1:21:31] hypothetical if it was less expensive would you still not want to do it
[1:21:35] because the environmental issues no so another reason is
[1:21:40] um I mean it's uh you you don't like as a
[1:21:44] developer you don't like constructing a road without getting houses on it and
[1:21:48] all I have there is a 60-foot right-of-way to construct a road but we
[1:21:52] can't what they call Enterprise all of that cost just like when you guys run a
[1:21:57] water line you want to make sure you got some Taps on it right and so same same
[1:22:01] principle
[1:22:04] okay [Music]
[1:22:09] anyone else want to rebut anything that's been said
[1:22:20] foreign
[1:22:27] hello I'm Margaret King I live at 7582 Happy Hill Road as far as what he just
[1:22:33] said any of us that has built a house on Happy Hill knows Hill Road knows that we
[1:22:39] have all ran into rock every last one of us have so I don't
[1:22:46] know who's doing his survey he might need to get a refund but I know
[1:22:52] for a fact and I did want to say that and I do want to agree with just about
[1:22:57] what everybody else has said and I just wanted to make sure as you said just
[1:23:02] make sure that you say you're Greek I'm agreeing besides what he said about the
[1:23:07] Rock thank you
[1:23:10] anyone else
[1:23:19] my name is Adam Miler I'm at 75 87 Happy Hill Road I've got 22 acres to join the
[1:23:25] property proposed property development and we've got 22 Acres I had to dig over
[1:23:30] 18 different holes to get my property to perk every single one had Rock so
[1:23:36] just a adjacent to the property they're trying to do we had so much Rock there
[1:23:40] it wasn't even funny so we're just trying to get a six bedroom home in out
[1:23:43] there and we had to dig 18 different holes just to get a perk test on 22
[1:23:47] Acres so that's 22 acres for one home explain to me please
[1:23:53] yes Garrett Mr Garrett
[1:23:58] wait a minute here are we going to allow a third round of
[1:24:03] rebuttal I'm with Mr Landreth I think everyone should have a chance to speak
[1:24:07] okay well just as long as the uh those that are opposed get equal time I'm okay
[1:24:12] with it but we're gonna have the Wingstop nobody as you said we're going
[1:24:15] to be here until until everyone's had a chance okay I'm good come home I'm what
[1:24:20] they call a Hands-On developer I'm sorry Mr Garrett again go ahead I'm what they
[1:24:25] call a Hands-On developer um I actually was out there the entire
[1:24:30] time these Rock studies were done because I've actually gotten bad
[1:24:34] geotechnical information before I've been doing this my whole working career
[1:24:39] um Decades of developing land over the Triad and so much so that I I actually
[1:24:46] bring in track hoes and they dig deep down into the ground because to me
[1:24:51] that's the best way to know and so we spent I think better four or five days
[1:24:56] out there digging digging test pits making sure that we didn't have Rock
[1:25:02] issues could I be wrong I mean you know it's only as good as where you dig but
[1:25:06] we we strategically chose where we would have to do some deeper Excavating and
[1:25:13] and that's how we determine where we dug so I mean it's our risk you know but I I
[1:25:19] did everything I could to vet it now where are you talking about digging
[1:25:23] holes are you 10 acres we're talking about
[1:25:26] tonight are you talking about the party I'm talking about the 126 Acres yeah
[1:25:29] because you hadn't dug any holes over here beside these folks houses not yet
[1:25:33] no okay
[1:25:39] what I've got some questions all right
[1:25:42] Council questions has everybody spoken has everyone spoken that wanted to speak
[1:25:50] questions from Council yeah I've got some too Mr Floyd
[1:25:55] you got Jimmy Mr Landreth uh okay I guess uh Mr Snyder
[1:26:01] would you would you go up
[1:26:05] Justin Snyder Guilford County okay um
[1:26:10] now we know that we have proved that they
[1:26:14] could hook onto water a year or so ago
[1:26:19] there's no condition
[1:26:23] in this zoning about hooking the water correct this is a straight rezoning
[1:26:27] which is not conditioned it's possible I'm not saying it's going to happen or
[1:26:31] nobody you know because things change companies change I guess you're an
[1:26:35] employer you own the company
[1:26:39] things change is it possible that they could not hook up to the water that's
[1:26:43] rs-40 so it's not in our requirements right there there is a let me find the
[1:26:48] provision here now
[1:26:52] it's 5 13.
[1:26:56] so there there is a provision to connect um
[1:27:02] that says that connection of each lot to Public Water and Sewer utilities shall
[1:27:06] be required if the proposed minor subdivisions within 300 feet
[1:27:11] in each lot in a proposed major subdivisions within a thousand feet to
[1:27:15] the nearest adequate lines in a public system so this would exceed that
[1:27:20] thousand feet requirement so the way I read that they would not be required
[1:27:25] okay to connect your information is wrong on minor subdivisions I believe we
[1:27:30] didn't we discontinue the minor subdivision he's just reading okay this
[1:27:35] one I have my ordinance book okay all right well evidently you're very likely
[1:27:39] correct make you a note of that when you check on it I will note this um so
[1:27:44] that's possible that um if they wouldn't have to there's nothing
[1:27:49] saying they have to hook up to the water there's no there's no water line there
[1:27:52] to hook up to anyway
[1:27:57] yeah it looks like there was a proposed text Amendment
[1:28:00] um and we were trying to figure this out if
[1:28:02] this uh passed I think this one did it did yeah this one passed so
[1:28:07] um it says major subdivisions connection of each lot to a public water system
[1:28:11] shall be required if the proposed major subdivision meets
[1:28:15] the criteria in the schedule below table 5-13.6-1 which of course I don't have a
[1:28:21] copy of uh distance shall be measured from the property boundary nearest the
[1:28:26] water system line and then the proposed change was to add
[1:28:30] the verbiage to the above that any proposed major subdivisions as defined
[1:28:34] in section 2-1 which I discussed in my uh entry comments in the RS 30
[1:28:40] residential single-family District shall be required to connect to the water
[1:28:43] system regardless of any of the criteria in the table so this is rs40 this is RS
[1:28:48] 40. that's correct so the bottom line is they're technically not required to they
[1:28:53] just if they decided not to you wouldn't have to do a water line
[1:28:57] they wouldn't have to hook up that is how I read that sir yes so there's
[1:29:00] nothing in Stone Those requirements apply to rs40 if they are within range
[1:29:06] in a major subdivision yeah yeah do you know that specific distance at the
[1:29:12] moment is it aren't in our paperwork I know I think they said 2700 feet from
[1:29:16] 158 to get to this was the nearest I think I saw it
[1:29:21] somewhere I don't have it here it seemed to me like a Sperling I was up there at
[1:29:24] 10 minutes to seven this morning and and um it did I thought I measured for you
[1:29:30] know uh longer than that I don't know so are you familiar with the water lines
[1:29:37] not at all because in the uh I'll bring we'll bring Mr Garrett back up and uh
[1:29:43] and clarify some of that thank you
[1:29:47] Mr Floyd well I I think a question from Mr Garrett uh
[1:29:55] I'm just going to start at the beginning I've got some questions and some
[1:30:01] illustration the best way I know that I answer questions is to reference a
[1:30:05] document and I've asked I've put together
[1:30:09] PowerPoint
[1:30:12] and I said so these were the we had five very similar documents to this in our
[1:30:18] packet and earlier this little narrow swath of land came up as being a concern
[1:30:23] I'm concerned that one in the planning board meeting you said that was 70 feet
[1:30:28] and I guess you're making the correction tonight that that's 57 feet
[1:30:32] I it's it's 57 feet it's how much sir it's 57 feet it's been interested since
[1:30:39] the last meeting to clarify what if may I asked what you told the Stokesdale
[1:30:43] planning board you know me in memory I mean I I there
[1:30:49] may have been 70 thrown out but I was there yeah it was 70.
[1:30:53] but but that's okay you're correcting the error then right there was an error
[1:30:59] made in the planning board meeting when you said 70. right it's 57 it's been
[1:31:04] surveyed since since the planning board meeting okay okay
[1:31:11] all right so he here's this is from a document that
[1:31:15] was not in our packet but it's the from the for a proof site plan from Forsyth
[1:31:19] County for this road and would have highlighted in pink what
[1:31:25] concerns me is that is the 25 foot utility is evening on each side of the
[1:31:29] road and oddly enough if you if you add 25
[1:31:32] and 25 and then a 20-foot Road you get right at 70 feet
[1:31:40] but if you zoom in and we have a two adjacent Property
[1:31:44] Owners speak tonight if you zoom in the outside of the utility easement does
[1:31:51] encroach well it's implied that it'll encroach to the property to the South
[1:31:57] into the property to the north uh
[1:32:03] do you agree I mean I'd have to bring my civil engineer you're you're using the
[1:32:08] details yep excellent Norse
[1:32:24] Norris Clayton you create Associates engineers
[1:32:28] uh yeah I mean there's 57 feet there if you add a an easement outside of that
[1:32:36] uh it would be greater than 57 feet we'd have to ask for an okay with the uh Duke
[1:32:42] power to put it within 57 feet
[1:32:48] but what were to rezone the request is to rezone the property
[1:32:53] with with a document that shows it going into the adjacent Property Owners both
[1:32:58] of them's property
[1:33:01] did you have you had a discussion with both Property Owners to say hey guys
[1:33:05] look this no I don't think they're agreeing
[1:33:11] to give up any easements or anything look
[1:33:17] he's in the transitive logic property you know
[1:33:21] if a private developer takes land that eventually the private
[1:33:26] developer is going to turn over to the government and the DOT
[1:33:29] isn't that kind of like the government taking land from a property owner
[1:33:35] yeah you could I mean you couldn't do that without permission and that but
[1:33:40] what we we would do would we have 57 feet in that property we would we would
[1:33:46] go to Duke Power and work within that amount
[1:33:51] if they couldn't do it then we'd have to back off and do something else
[1:33:57] all right
[1:34:01] so just to clarify that um it's still an unknown that that would
[1:34:05] even that Duke power even give you that um approval
[1:34:10] because that's going to put you right on the road bed right in in the in the
[1:34:14] bedding of the road the rock the you know the fall off
[1:34:18] right and and here I mean we're here for the rezone of the
[1:34:24] property what's the best use of the property
[1:34:27] it's right now it's agricultural it's got one house on it
[1:34:31] all right you have to go rs40 if you put more than one house on on the lot on
[1:34:36] this property so we're going asking for that
[1:34:41] uh you know
[1:34:44] the owner of the property here is a is a citizen of Stokesdale too and they've
[1:34:48] got a right to try to sell their property
[1:34:51] I mean and either way
[1:34:54] it is rs40 a good Zoning for the property is what we're really asking
[1:35:00] here tonight
[1:35:06] if there's not enough room for a road
[1:35:10] we can put a road in well easement yes the easement that's required by the
[1:35:15] ordinance and all that right and then like I say this is the first stage of
[1:35:20] of development we'd have to come back do the subdivision plan gets approvals from
[1:35:25] Duke power get approved from D.O.T to put in the entrance get a driveway what
[1:35:30] about the two individuals The Neighbors that if this passes tonight and they
[1:35:35] leave this meeting thinking that the government just approved a plan when
[1:35:39] they had a document that shows this going through their property
[1:35:46] well we could not go through their property if that becomes an issue we
[1:35:50] can't do that yes
[1:35:57] again if you would identify yourself would you mind heading in the microphone
[1:36:10] how do you go out today and measured across again again if you would identify
[1:36:16] yourself sir I'm Daryl Watkins I'm 75 75 Happy Hill Road I'm the one on the right
[1:36:23] hand side of the bottleneck I guess you call it the uh south side but I went out
[1:36:29] today and measured across there 70 feet if that thing encroaches on me 70 feet
[1:36:34] it's going to take my driveway that's all I got to say
[1:36:43] okay well
[1:36:48] I'm ready to make a motion
[1:36:53] good question before
[1:36:56] you feel like questions we would have to close the public hearing if if you have
[1:37:01] a motion uh but well okay I've got some more questions Yeah well yeah
[1:37:07] started good really all right well I'll uh I'm good I mean if you wanna
[1:37:13] if you want to do a different procedure that's fine with me I just um
[1:37:17] go ahead you know I've got concerns you know I went down this morning it uh I
[1:37:22] was there about 10 minutes till seven I'll tell you
[1:37:25] I've rode bicycles on that road back when it's a dirt road and high tech Road
[1:37:29] it's sometime about 50 years ago I've been here all my life
[1:37:34] and um things have changed
[1:37:38] uh it's a terrible place right there um
[1:37:45] I know we're here for zoning hearing but um
[1:37:48] these issues are reporting that road I know d-o-t um
[1:37:54] will would be looking at the road but I guess maybe this is Justin
[1:38:01] um Mr Snyder you uh this may be hard for you to
[1:38:06] answer or what at one time there was a road that went
[1:38:12] all the way through you know uh over to the West on Happy Hill that would go
[1:38:15] down through that project and I guess it would come out on Van hole from what
[1:38:18] I've seen and that's like I say that's Forsyth County
[1:38:22] um and I know now I think they've split
[1:38:25] that where part of that development goes out there and then this part would would
[1:38:30] come out here yeah it's uh like Birch Tree Lane or something like that to the
[1:38:35] southern part through the Oak Ridge etj right some of the Lots from what
[1:38:41] I've seen of course this hasn't been formally submitted to Guilford County so
[1:38:45] I'm just you know talking subjectively about what
[1:38:49] I've seen uh appear to go off of that entrance whereas other Lots will come
[1:38:55] off of this entrance if they develop the property as from what I've seen if this
[1:38:59] was done that road if if they decided to because they had a cut through I think
[1:39:03] maybe they're going to cut it off or whatever but that can be changed all
[1:39:07] these things can be changed depending on engineering their engineer would have to
[1:39:11] determine you know ultimate Road layout and and how it best works for them and
[1:39:15] and what works to meet stokesdale's ordinance and Dot's requirements
[1:39:20] um I I think um
[1:39:23] you know the the bigger questions would have to be answered by the technical
[1:39:28] Review Committee as part of any review I think the main question tonight is do
[1:39:32] you feel comfortable with this as an rs-40 zoning or would you feel it more
[1:39:37] appropriate to remain as Agricultural and I know there's these these alternate
[1:39:41] questions they're all great questions a lot of these questions
[1:39:46] can't be answered right now without going through full engineering technical
[1:39:51] review letting Watershed look at it letting dot look at it let planning look
[1:39:55] at it because we'll look at all the easements we'll look at where the
[1:40:00] utilities are we'll look at you know whether these Lots will perk all of
[1:40:07] that's handled through that process and I just can't give you any definitive
[1:40:10] answers on What ultimately it's going to look like until we've done a full review
[1:40:14] that's not the point I'm trying to get to this is tough on me I've never I had
[1:40:18] never voted no one will rezone I hope it don't scare anybody but but I haven't
[1:40:23] I've always waited out everything out heavy I mean really heavy I lose a lot
[1:40:28] of sleeping that's my wife she knows it um
[1:40:32] my concern like I said none of that is in stone so if if we did that that's a
[1:40:39] possibility of that road could go and actually could possibly service all
[1:40:42] those houses I know they say what they're going to do but at one time
[1:40:46] and we're going to go on on the other side I mean those things change and I do
[1:40:50] understand that I understand that yeah and you're absolutely but but that could
[1:40:55] happen is that that is a correct assumption
[1:40:58] um anything can be engineered I I think that's the the takeaway anything but
[1:41:02] once we do that then it's once we do that then it's out of our hands correct
[1:41:08] really at that point that meets that ordinance it has to be approved what
[1:41:12] we're doing then we're going to put a hundred and some if
[1:41:15] that if that scenario came we would be putting 100 and some houses possibly
[1:41:20] coming out on that hill right there right because if it was just I'll tell
[1:41:25] you something I wouldn't even have it I would I wouldn't I know that people
[1:41:29] wouldn't like it but if it was just seven houses on a little trailer land
[1:41:32] rs40 it'd almost be a no-brainer for me but but that's just not the case I mean
[1:41:38] I know maybe we're not supposed to look at this and look at that but but you
[1:41:42] know you got to you got to look at the big picture or at least think about it
[1:41:46] so I'm weighing the big picture and that's that was my question yes sir and
[1:41:50] uh let's see
[1:41:55] okay that's
[1:41:59] yeah I'll go ahead I might have some more I got all kinds of questions out
[1:42:03] here but I may have answered some of them so anybody else got anything please
[1:42:07] proceed I've got some questions about I know it's not rs40 zoning but I don't
[1:42:14] know when we'd have an opportunity to get together as a council and we don't
[1:42:18] have a town manager we're a mayor council formal government so I've got
[1:42:21] some questions about the water and uh Mr Clayton or Mr Garrett
[1:42:27] you can answer that
[1:42:31] if I'm looking at the site plan it looks like a town water main would go
[1:42:36] right through the middle of lot 33.
[1:42:40] that's that is a um the water main would would go
[1:42:46] cross-country at that point so just just to bring everybody up to
[1:42:52] speed um this has been a quagmire in terms of
[1:42:56] jurisdictions this is um
[1:43:00] um it's confusing to me um but Forsyth County has already
[1:43:05] approved the project as two separate projects so that what
[1:43:11] would come out on Happy Hill with this subject site
[1:43:16] um would
[1:43:18] would only be 36 homes with what was originally approved was
[1:43:24] all 94 Lots having access on Happy Hill through that right that 60-foot
[1:43:30] right-of-way and we were connecting over to Bent Ridge Forest and so technically
[1:43:36] in that scenario all 94 homes should they choose to go that way would come
[1:43:42] out onto Happy Hill including the bent Ridge Forest folks
[1:43:47] now that has been segregated and um
[1:43:52] Mr Wagner if you could throw up that plan the the plan that he has
[1:43:58] um is actually the proof Forsyth County um
[1:44:02] special use map so this is you know what we're bound to
[1:44:07] do and it shows a water line as you've already pointed out but it also shows
[1:44:13] that we're no longer connecting the east side of the property to the west side
[1:44:20] with a road with a road well is is that lot 33 are they going to
[1:44:26] build a house there on the on the side of the easement yes
[1:44:31] so they'll have a water main going through their backyard on the side yard
[1:44:35] yes yep and we're going to be responsible for it
[1:44:40] uh yeah so here is the approved plan if you could so this is the the basically
[1:44:47] the western side of the project and you can see they're no longer connected
[1:44:52] um and then the Eastern side actually shows this property subject
[1:44:59] property as an alternative access
[1:45:04] um and to the Duke Energy 60-foot right-of-way but up there if you could
[1:45:09] pull that Eastern one up you can see that you've got in the top
[1:45:13] right hand corner that is the approve County Commissioner seal and so you know
[1:45:21] I know everyone's concerned that I could change up but I'm telling this this is
[1:45:27] what we're now you know obligated to do but
[1:45:32] could you change back to the not change back to the other one but keep the inner
[1:45:36] the road and I mean I have there is there is zero
[1:45:43] zero uh enticement for us to do that we we had Environmental
[1:45:50] yep
[1:45:53] I mean you know it's a lake and and there's a lot of you know tributaries
[1:45:57] feeding into it and so we had by segregating the the two sides
[1:46:05] um we were able to eliminate three stream Crossings
[1:46:13] I don't know much about the water line installation how is that stream at the
[1:46:17] bottom of a gully I'm trying to think in my head how our water line would yeah
[1:46:22] I'll have to bring Mr Clayton up for that
[1:46:37] yeah if you can bring up that playing again I can think I can show you
[1:46:42] yeah the this one uh well go to the first one
[1:46:47] first where's coming off
[1:46:51] yeah you can zoom in down for that easement's
[1:46:55] leaving that uh the entrance Road there
[1:47:00] yeah that bottom left yeah yeah
[1:47:07] okay
[1:47:10] yeah there's where the easement to the water line would go it'd go down
[1:47:16] by those two lots down at the bottom is a stream it would we would bore under
[1:47:22] the stream and come up on the other side and then go if you put it go to the
[1:47:28] other plan it comes out on the other side
[1:47:31] zoom in right in that where that curves at
[1:47:36] um yeah zoom in a little closer on that
[1:47:39] curve till on the top right top right now let's stop that yeah
[1:47:46] that easement comes in between those two lots into that road across that stream
[1:47:53] okay
[1:47:58] and that gives us the service to those back lots to get water out there I think
[1:48:04] there's 65 Lots on that side 36 slots on the other side okay quick question
[1:48:12] that's the county line yes sir Mr Clayton yes who who are you talking
[1:48:18] with are you talking with anybody with a town of Stokesdale with the water lines
[1:48:21] I know you're doing the engineering for it uh I heard there was some high level
[1:48:25] conversations going on and I don't know anything about them and you know it's I
[1:48:30] mean the original back in 21 we did we got to that point and who was you
[1:48:35] talking to then I was on Council man I mean all of a sudden it got put up and
[1:48:38] we said it was a great deal we're going to get a water line we thought the folks
[1:48:41] in Happy Hill because for years they said that you know they wanted water and
[1:48:45] I guess it was late because now the houses tore down that they needed it
[1:48:48] with their shallow Wells and and they dug deep whales and they don't need the
[1:48:52] water line yeah we may have done a test service instead of what we thought we
[1:48:57] were doing and uh so we did vote on that because we've always extended water
[1:49:02] lines in Stokesdale with the developers in 95 of the cases uh there's been a
[1:49:07] couple of things and I just you know like I said I hadn't found anybody
[1:49:11] that's been talking to anybody and um yeah there again this is the first
[1:49:16] step in the process and yes we I mean we're counting on since we did it in 21
[1:49:22] we we would still continue that yeah because we have to take it we had to
[1:49:27] eventually take that thing over and we're responsible when you're running
[1:49:29] all up and down their Hills and Hollows and they start breaking it's just a
[1:49:32] little yeah it's expensive um
[1:49:35] so you just you're really not talking to
[1:49:39] anybody in Stokesdale right now about that you're just in a planning phase
[1:49:42] that's what you're saying and I know that don't really have anything else
[1:49:45] originally we've taught we talked to the mayor at the time
[1:49:49] and the Town Clerk and back in 21 okay yeah you're talking about now bringing
[1:49:54] the water line up to the property
[1:49:58] that you're Rob that we're trying to rezone tonight or
[1:50:02] you're trying to rezone you're not talking about going across that 60 foot
[1:50:07] right away going down that way are you down you'd have the 64 right away
[1:50:13] yourself but wasn't rezone we went about that water line down that
[1:50:19] easement at this point now at this point right
[1:50:22] no there's no need to I mean we've come down through the access of this property
[1:50:27] we're talking about you would come up to I don't know that's three thousand feet
[1:50:30] or so how many 700 feet actually how many about 3 700 yeah I think it's
[1:50:35] pretty good ways uh so that you would go up to that property and go down that
[1:50:39] right away with a water line yes okay
[1:50:45] all right and there's no there's no condition on this
[1:50:49] in Winston-Salem this is not really it are y'all conditioned does they have to
[1:50:55] have the water for the Winston-Salem Winston-Salem has part of their
[1:50:58] conditions their plan is we're getting water through Stokesdale right and so
[1:51:02] that was part of the in the planning board meeting y'all held up a document
[1:51:06] that that was like the condition was in that documentation you have that like
[1:51:09] document that shows that condition I don't know
[1:51:13] thanks God or not um
[1:51:20] yeah I mean at the planning board the last week we actually said we we again
[1:51:26] publicly said we was going to put the water line in
[1:51:29] you know uh Mr Winfrey I have a question here
[1:51:33] based on past experience but if we close a public hearing portion of
[1:51:39] this process won't this Council still be allowed to ask questions of those
[1:51:44] gathered here whether they be you or the applicant or any citizen
[1:51:51] I still ask questions after public hearings closed yeah yeah
[1:51:56] what I'm interested in doing is getting emotion on the floor for Council to
[1:52:01] discuss right now we don't have one I guess first thing would be to close
[1:52:05] the public hearing if that's what the board wishes to do what
[1:52:12] this public hearing is closed no there needs to be a motion I'll make a motion
[1:52:16] we close the public hearing they'll say there is no motion I have the authority
[1:52:21] am I correct Miss Miss Martin you know I have the authority this this
[1:52:26] public hearing has closed what guess what
[1:52:31] you got it you got it taken my instructions from my clerk hey she knows
[1:52:36] her stuff so let's go we'll go to jail together
[1:52:39] it's fine I'm not going with you okay Tim Mike
[1:52:45] probably needs to Mr Jones Okay I want to make a motion that motion would be to
[1:52:49] deny the applicant for the rezoning case number 22 Dash
[1:52:57] 12-plb -00031
[1:53:04] I'm going to second the motion discussion
[1:53:11] I'm going to say I'm I'm a property rights guy I do believe anybody that
[1:53:15] owns their own property ought to have a lot to to say ought to have complete say
[1:53:19] about it and I say that as a homeowners association president
[1:53:24] and if anybody is unfortunate enough to live in a homeowner's association they
[1:53:29] know that you can't do what you want to do with your own property
[1:53:33] but again I do live in one and I'm the president of it but I do believe that
[1:53:39] that a property owner should be able to do whatever they want to do with their
[1:53:43] property
[1:53:47] that's my discussion is there any other discussion
[1:53:51] yes sir Mr Mayor I've got several points that I'm going to make here this is
[1:53:56] going to take a while [Music]
[1:54:00] um I'll try to be as brief as possible
[1:54:05] observe this a previous Council
[1:54:09] uh rezone the property off a cold water Road and this was the first time that
[1:54:16] town at Stokesdale water had been extended back over into Forsyth County
[1:54:21] we buy our water from Forsyth County I observe that Mayor John Flynn at the
[1:54:27] time provided a letter to Forsyth County promising water to that particular
[1:54:32] developer at that time he had no voter Council
[1:54:36] to sign such a letter councils subsequently made a vote
[1:54:43] I don't know how long it was after that letter was signed but subsequently the
[1:54:47] council voted to provide water on cold water
[1:54:50] I bring this up because of some technical points that the way our water
[1:54:55] system operates the way our administrative process operates uh
[1:55:00] the Cold Water Project there was no plan review so no Stokes still no engineer
[1:55:07] looking at the plan on behalf of the town of Stokesdale reviewed that plan
[1:55:11] and then there were no inspections done on that cold water Road water main
[1:55:15] extension over in Forsyth County
[1:55:19] that gets us to the Happy Hill there was a subsequent vote by
[1:55:25] previous Council regarding an agreeing to provide allow RJ R.S Parker Holmes to
[1:55:32] connect to their the town of Stokesdale water system
[1:55:35] where I have I have several different issues pertaining to this uh like my
[1:55:41] good friend Mr Landers pointed out if it was just a rezoning case about seven
[1:55:45] Lots off of Happy Hill Road I I you know it would be a lot more simple as the
[1:55:51] applicants pointed out there are multiple jurisdictions involved here and
[1:55:55] that is unfortunate but that doesn't mean that I'm an automatic yes vote on
[1:56:00] anything going across the county line the
[1:56:06] town of Stokesdale currently has a cap of 300 000 gallons per day to buy water
[1:56:10] from Forsyth County we're negotiating to raise that cap and and I think that will
[1:56:15] be done relatively soon but I as a council member at the moment have to
[1:56:19] consider that this still capped at 300 000 gallons a day
[1:56:22] there's uh the usage that's going back over into Forsyth County I don't know
[1:56:27] what that will when it's completely built out here's what's proposed I don't
[1:56:31] know what that usage will be and I'm concerned about that
[1:56:35] uh just like Mr Lander if I grew up in this area I've been up and down Happy
[1:56:40] Hill Road countless times not sure if I can brag about having to rode my bicycle
[1:56:45] up and down there but I've been up and down that road on tractors I have picked
[1:56:49] up a rock on farms off of Happy Hill Road I have that merit badge
[1:56:53] I'm well aware of the rock over there God made that corner of the Town a
[1:56:59] little rougher than he did at rest of Stokesdale and the applicant can't help
[1:57:02] that and those that are opposed to this rezoning King help that that's just a
[1:57:06] fact it is Rocky over there especially along
[1:57:10] the ridges pyramid Quarry rock quarries right
[1:57:14] around the road excuse me right around the corner on Pyramid Quarry Road I I am
[1:57:20] concerned that we would have a difficult time getting uh
[1:57:24] town of Stokesdale water lines installed there
[1:57:27] I don't like the idea of cross-country water lines without interfacing with the
[1:57:33] town of Stokesdale engineer we have no memo of understanding or
[1:57:39] interlocal agreement with Forsyth County Oak Ridge or anybody else here involved
[1:57:45] regarding the administration of our water system in Forsyth County into this
[1:57:51] development and that concerns me we would need to be able to collect the
[1:57:57] a plan review fee and an inspection fee and then we need to provide those
[1:58:03] services for this development and until the town of Stokesdale is satisfied
[1:58:09] I wouldn't want to see the plot recorded and any Lots sold over in Forsyth County
[1:58:14] right now we don't even have so much as one contact in Forsyth County that we're
[1:58:18] discussing these procedural issues with
[1:58:23] um again if it was about just seven Lots I
[1:58:27] you know I couldn't really see much of a problem with that I I don't like that
[1:58:31] little bottleneck I see going into this property 57 foot is not much
[1:58:37] uh just like my friend Mr Landreth I generally vote for rezonans I I hope I
[1:58:44] think property rights are a fundamental Freedom that we have in this country and
[1:58:49] uh I would I'm always very careful how I consider
[1:58:54] voting on a rezoning case as a planning board member and a council member and in
[1:58:59] this case I have done a lot of pondering I've I've I have examined this several
[1:59:04] different times over a period of time talk to various people
[1:59:08] uh at the end of the day I'm elected to use my judgment
[1:59:13] and uh Common Sense can't be defined
[1:59:17] but this project from everything I can see
[1:59:22] goes against my Common Sense goes against my judgment
[1:59:28] I'm not voting for it that's why I made the motion
[1:59:33] okay um
[1:59:35] I do want to say safety was brought up a couple times tonight and uh the folks
[1:59:42] encouraged us to come out and see the the property I I have done that and I
[1:59:48] can't I couldn't imagine that number of cars on what is now a
[1:59:53] driveway as as you're coming from 158
[1:59:58] yeah coming from 158 down Happy Hill you kind of go over over a little hump so if
[2:00:03] you're sitting here in the new subdivision trying to to pull out you
[2:00:07] know one minute you look to the left you see nothing and then my goodness
[2:00:12] it can change just like that and if you've got that many people coming out
[2:00:17] of that it's uh it's just not a great spot for a subdivision I also believe in
[2:00:22] property rights uh and then and I'll certainly stand with the two adjacent
[2:00:28] neighbors that uh that where there's a utility easement on the uh public
[2:00:33] document going into their property I just don't know how I could know that
[2:00:37] and vote for that uh you know I've got some concerns about
[2:00:42] the water I've I differ from Tim a little bit I my concerns are there's I
[2:00:48] there's no binding document and please don't be
[2:00:54] insulted uh I know you have said that and and but I think Jimmy made the point
[2:00:59] what if the company is is sold or whatever there's no binding document
[2:01:03] between uh the township and the developer
[2:01:06] uh in this situation that would have y'all do water there was no condition in
[2:01:11] the zoning request uh and and that's a really big deal uh given us you know the
[2:01:16] the geographical challenges in that area I do want to uh Tim mention the other
[2:01:21] subdivision that uh the town sells water to cold water uh when we were vetting
[2:01:27] out that process in December of 2020 uh the the gentleman who developed that
[2:01:32] property I mean point point blank told us that
[2:01:36] Aqua who does community Wells was a cheaper option than running Town water
[2:01:41] lines into his development but he thought the town Municipal Water would
[2:01:46] be more of an assurance of water supply and I don't dispute that but but if you
[2:01:51] know we're getting you know if we're in a situation where you know costs may be
[2:01:55] cut and we know from a developer that has said Aqua is a cheaper option and
[2:02:01] there's I get real concerned about tapping into
[2:02:04] that the water table in that area but but my biggest concerns are are going to
[2:02:09] be with the two property owners and the utilities and showing on their side
[2:02:13] you know with respect to to the petitioners I'm I'm not going to vote
[2:02:17] for this either
[2:02:20] I'd like to Echo what Mr Floyd said as far as the two Property Owners on each
[2:02:26] side in the easements for the utilities I mean we can talk about how wide the
[2:02:30] road would be but we don't know until we lay the road out there and we lay the
[2:02:33] utilities and how much you're going to have to be off that road you know that
[2:02:37] road bed to have your utility and and I I just cannot imagine that you're not
[2:02:42] going to be on top of both of those properties and especially the one on the
[2:02:45] left driveway right there um
[2:02:47] the uh my other concern is more of a going back to the spirit of the use of
[2:02:52] the land is I sit here and just look and I take out the um subdivision behind you
[2:02:57] know what's already been approved and I just look at that lot you know it just
[2:03:00] does not to me does not fit the the land out there so you've got you know you've
[2:03:05] got a long house here a long house here and right here in the middle you're
[2:03:09] gonna have a bunch of little houses right here kind of in your backyard you
[2:03:13] know and if you look at it from a from an aerial view which is I which I am you
[2:03:18] know so like I said you're looking at you know a lot lot and all of a sudden
[2:03:22] this lot's gonna have you know all this stuff only it just to
[2:03:26] me it doesn't doesn't um it's not consistent with what's out
[2:03:31] there and and I know we can't control what's what's going to be behind you
[2:03:35] because that's out of our jurisdiction but what we can control is
[2:03:39] um what's in our jurisdiction so that's that would be my comments
[2:03:45] is there any other discussion Mr Mayor one one thing I should say and kind of
[2:03:49] echo what Mr Snyder said earlier um this is a straight up resounding so
[2:03:54] the question uh and you've been presented several
[2:03:57] plans that show six or seven Lots on this ten acres but uh under if you
[2:04:04] approve this resulting if they reconfigured it they could put as many
[2:04:08] Lots as they could forty thousand foot Lots as they could as they wished
[2:04:14] and the the proposed plan in front of you is not binding on the developer they
[2:04:20] will be allowed to configure that any way they want to
[2:04:23] so just to be clear it's not a conditional use something
[2:04:30] um I'll tell you this is this is a this is
[2:04:33] tough all reasons are tough I mean I'm going to tell you this
[2:04:36] we've said on some it's this that's tough I mean you know nobody wants
[2:04:40] anybody to build their room I don't blame them you know I wish we had to
[2:04:43] build half hours we got here now um this is a
[2:04:48] this is a um just a different circumstance though
[2:04:52] um you know agricultural land
[2:04:57] um people want to get rid of it they want
[2:05:00] to sell it you know what are you going to do with
[2:05:04] I mean is it you know we're sitting here in houses on property that was built on
[2:05:08] agricultural land and then you know want other people to
[2:05:12] leave our land alone that's one thing so that's what would
[2:05:16] make it easy for me to vote for this if all the other variables
[2:05:21] now yeah it only has one place to come in on
[2:05:26] that property and uh you know like I say I sit up in
[2:05:30] the liquidate hill today and um
[2:05:34] once we rezone these if we did it's out of our hands you know
[2:05:39] we got to rely on what D.O.T does uh I know they're they're experts but
[2:05:45] um it's out of our hands the uh
[2:05:49] how many houses are you know that end up coming through that road is out of our
[2:05:54] hands completely out of our hands um
[2:06:01] it's just it's a tough one to me I mean you know and I know I mean I know these
[2:06:06] folks and and um you know that part could be easy
[2:06:11] you know people do have property rights um
[2:06:16] this may just be a different scenario so by the time it gets to me I'll make my
[2:06:19] decision
[2:06:23] yes sir one other thing I should say if the
[2:06:27] across which decision the board makes if the if the board approves this resulting
[2:06:32] it should make findings that this application is consistent with the
[2:06:37] environs and the uses uh and the of the neighborhood if the board chooses to
[2:06:44] uh denied they need to make findings that this requested use is not
[2:06:49] consistent with the environments and the uses nearby
[2:06:57] so are you saying that there's things that we can't take in consideration
[2:07:01] I'm just saying you need to um the law says you have to base your
[2:07:06] decision on your is this particular requested use is
[2:07:12] it consistent or inconsistent with with other adjacent land uses and and is
[2:07:20] it going to impact the quality of life of others in the neighborhood and make
[2:07:24] findings that are support a decision to decline it or approve it
[2:07:30] Mr Winfrey do you feel that I need to add a consistency statement to my motion
[2:07:35] is that what you're I think that would recommend that yes
[2:07:39] man what folks need to understand from what I've seen tonight and what I've
[2:07:43] heard I don't know anything for a fact because
[2:07:46] I'm not I don't have anything to fly candy but whether we
[2:07:49] do this or not the the part at the lake and over to Van
[2:07:55] Horn roads you want to be none because I mean from what they said and I don't
[2:07:59] know about the uh the right-of-way the 60
[2:08:03] foot right away I mean like I say it never actually came before our accounts
[2:08:06] so you know
[2:08:10] this this won't this won't stop we don't have anything to do with that so you
[2:08:14] know either way this goes don't you know
[2:08:18] don't think that we're foreign
[2:08:24] Property Owners everybody it's a tough decision
[2:08:31] is there any further discussion
[2:08:36] we have a motion and a second yes do we need a consistency statement um
[2:08:42] an amendment to his motion well I think Mr Winfrey is telling us that this
[2:08:48] motion has to be modified with a consistency statement of some sort uh
[2:08:54] which which is tough our planning board looked at this just as seven lots and uh
[2:09:00] they may have been told they had 70 foot at that bottleneck I can't ascertain
[2:09:05] that and I haven't reviewed that particular the electronic recordings for
[2:09:09] that particular meeting that may have impacted their decision somewhat
[2:09:13] uh they have looked at it just from the
[2:09:17] perspective of the the seven Lots it's my contention we're supposed to look at
[2:09:22] whether or not a particular development is is consistent with a given area and
[2:09:27] it's my contention that this area because of the topography from the from
[2:09:32] the roads to the Rock to the to the the layout to the to the bottleneck that I'm
[2:09:39] looking at that as as inconsistent with with good planning
[2:09:44] uh and that that is my that's my consistency statement that I realize
[2:09:51] staff has recommended approval of this but I just don't know if they're taking
[2:09:56] into consideration all these factors uh again like Mr Lander if I'm very
[2:10:02] familiar with Happy Hill Road been up down at I had lived there but I've been
[2:10:06] down at all my life at one time or the other frequently and uh have have worked
[2:10:10] on farms over there so it's not I don't have to go look I'm already familiar
[2:10:16] with that area really and uh I think that that is that is my issue
[2:10:21] this this area does not lend itself of being consistent with the previous
[2:10:25] developments we've approved is that sufficient Mr Winfrey I think that's
[2:10:29] right so you if you're amending your motion to incorporate that and then that
[2:10:32] need a new second for that and then you'll be in business I'll keep my
[2:10:37] second on the table
[2:10:41] any further discussion Mr Rigsby
[2:10:46] just to clarify your your motion is to deny my motion is to deny Mr Rigby I'm I
[2:10:53] Mr Foley I'm I Mr Landreth
[2:10:58] I'm gonna Mr Jones hi I'll make it unanimous
[2:11:04] the rezoning has been denied I I still would I still would like to
[2:11:10] talk more about the they're still going to be able to do the
[2:11:13] subdivision and that's that that that's fine they just need to be in a different
[2:11:17] spot but this uh internal Road connection
[2:11:22] uh I you know it doesn't make sense to me
[2:11:26] that there's just there's now there's one subdivision is now going to be two
[2:11:31] subdivisions and there was an original plan with one and if you look at
[2:11:36] if you look at the uh conditions from the approval of this
[2:11:41] from Forsyth County the written conditions
[2:11:44] it does have at other requirements in there that says should Stokesdale or
[2:11:49] Guilford County declined to remove the internal connection between Lakeside
[2:11:52] Manor Drive and Benton Ridge Forest Drive has proposed a public Street
[2:11:56] connection will be required between bent Ridge Forest Drive and the Guilford
[2:12:00] County Line as shown in the previous site plan
[2:12:03] which you know the previous site plan was just
[2:12:07] one road and and I would like for Stokesdale to have a voice you know in
[2:12:12] that feature because you know one it's our water line and I showed you
[2:12:16] my concerns with with traversing right to the middle of of a lot
[2:12:22] and all that so I mean you know with that I'm gonna make a motion the town
[2:12:26] clerk Miss Dale Martin draft a resolution and obtain mayor Crawford's
[2:12:30] signature in reference to the Forsyth County approved site plan F 1623 stating
[2:12:36] that the town of stokesdale's governing board respectfully respectfully objects
[2:12:40] to Forsyth County's decision to remove the internal Road connection between
[2:12:44] Lakeside Manor Drive and bent Ridge Forest Drive that was originally
[2:12:48] approved in rezoning case f-1597. into occlude and to include verbiage
[2:12:54] that the resolution stating that we request to add back an internal Road
[2:12:58] connection aligns with the requirement in the written conditions of zoning case
[2:13:02] f-1623 pursuant to North Carolina General statute 160 d703 and that the
[2:13:09] developer has signed off to agree to these conditions and this is where he is
[2:13:14] signed off to do that and that removing the internal connection resulted in
[2:13:18] Stokesdale municipal water lines going through three lots backyards and removes
[2:13:23] the Practical connectivity desired in new subdivisions
[2:13:31] I'll suck at the motion right that's it that's I just I don't
[2:13:36] understand why there's one larger side going to Van Hoy and one
[2:13:40] smaller side going to Happy Hill is there a new discussion
[2:13:46] Mr Rigsby aye Mr Floyd aye Mr Landreth
[2:13:50] y'all stop me on the discussion so
[2:13:55] can we go back to discussion yeah sure please sir
[2:14:02] foreign you're wanting to
[2:14:08] you're wanting them to reconsider putting the uh the uh the road through
[2:14:12] the development the the long road that runs almost kind of
[2:14:17] parallel to the lake at one time it was one road that connected to almost van
[2:14:23] Hoy through bent Ridge Forest and then down Lakeside in front of the
[2:14:29] Duke Energy property your concerns about the water line yeah it is
[2:14:35] going through yards and my concern is about that
[2:14:40] there's almost 70 homes going through bent Ridge Forest Drive that that with
[2:14:46] one access point that seems it seems excessive to me it certainly that's not
[2:14:52] what it seems excessive to me given our our
[2:14:55] limit is 50 on an entrance well Oak ridge's limits 52 and it's in their
[2:15:00] extra territorial jurisdiction and and actually their their ordinance
[2:15:05] reads better than ours their ordinance says no single entrance to a residential
[2:15:08] subdivision Shall Serve more than 50 Lots
[2:15:11] uh the single interest is defined as the point where the local Street network of
[2:15:15] a major subdivision or multiple subdivisions intersects the road Network
[2:15:19] outside the major subdivision or multiple subdivision so what it's doing
[2:15:23] is taking into account bent bridge forest as well now I'd be concerned
[2:15:27] about the water line but
[2:15:30] I don't know you know the uh
[2:15:36] trying to tell Forsyth County what to do well well I mean that's going to be put
[2:15:41] and if we do that we're going to be putting
[2:15:44] I mean I know exactly where you're coming from on a water line because I'm
[2:15:47] not for running water lines out through fields
[2:15:51] but now you're going to put on 60 or 70 how whatever the number is
[2:15:57] coming back over to Happy Hill Road which they may come out and go that way
[2:16:01] anyway but um
[2:16:04] it's gonna put all it would put them too I could put them all
[2:16:08] I don't know if this is a place to see it or not but I'm for all stop on this
[2:16:11] until the town of Stokesdale has a proper administrative procedures in
[2:16:15] place to deal with having our water system extended over into Forsyth County
[2:16:21] where I'm at I I don't have an issue with the water
[2:16:25] system into Forsyth County it's more of how the lines well water mains are well
[2:16:30] Mr Mr Floyd why would we treat our water system any differently in Forsyth County
[2:16:34] than we do any other subdivision in in Stokesdale
[2:16:38] we have a process in place where we charge a fee we have our engineer review
[2:16:43] the plan if we approve that plan then when the this water infrastructure is
[2:16:50] installed we have it inspected by our engineer or technical people correct and
[2:16:55] uh this is a you know a very serious issue because once we take it over the
[2:17:00] town of Stokesdale the town of Stokesdale citizens have to pay for the
[2:17:03] maintenance on that from now to the end of time that's correct and so uh we we
[2:17:09] we are not ready to do this in my judgment again we have no communication
[2:17:15] with Forsyth County over these details
[2:17:22] yeah I mean that's a good point I can't dispute
[2:17:24] you know one of these details you can say why don't we get some of these loose
[2:17:29] ends tied up and then I mean I see where you I see where you're coming from I
[2:17:32] don't think no
[2:17:36] this this motion I mean I I think the Forsyth County planning board
[2:17:42] because they added this requirement in there they must have been thinking
[2:17:45] something that Stokesdale would be concerned about removing this
[2:17:49] connectivity within the neighborhood whether it was traffic concerns or water
[2:17:54] line concerns I don't know my vote is not going down on this unless we have
[2:17:59] some reasonable control over this installation just like we do every other
[2:18:04] installation of the subdivision if our water if I if we're going to be
[2:18:09] responsible for that for all that plumbing and Forsyth County this is nuts
[2:18:13] unless we get on top of this and have a plan in
[2:18:18] place
[2:18:21] I don't see any other way we can do it okay what are your thoughts about my
[2:18:26] motion I'm perfectly okay with your emotion it
[2:18:31] is a motion for to address one particular aspect of this
[2:18:37] total problem two particular aspects well you've got to access issue
[2:18:43] yeah I I
[2:18:48] there may be those that argue that I just as a council member in this case I
[2:18:52] just have to look at it as seven Lots off a Happy Hill Road but since it's got
[2:18:57] all this through traffic got our our water mains involved over into Forsyth
[2:19:01] County the uh you know who knows how exactly how many
[2:19:05] houses will be built there you know there could be changes that could come
[2:19:08] up here as it's been pointed out that we we have we will have no input over
[2:19:13] they're not going to come back to us and say hey what do you think about this
[2:19:16] and so we just need to be consistent about what we're doing and and we
[2:19:21] currently review plans we currently do inspections we're
[2:19:26] we run a water system uh we we have to address that too because we are our
[2:19:31] management for our water system has this come to us yet
[2:19:35] I mean the part where the planning board Forsyth County what they're asking no
[2:19:41] this is just to come to us yet has it it won't
[2:19:47] come to us it won't come to us it you know there's
[2:19:54] documents out there and if if we weren't aware of this document you know it just
[2:19:58] nobody would have ever known is my guess I don't think we would have been
[2:20:02] nobody from Forsyth County gave us a heads up like hey guys look this is
[2:20:06] happening uh just a heads up your your municipality your town was called you
[2:20:12] know in one of the requirements of a rezoning here because this does affect
[2:20:15] you we didn't get any kind of warning like that
[2:20:19] or a heads up and but it is out there why would they put it in there I mean I
[2:20:24] don't know I don't quite understand why I don't know I wasn't there but I'm sure
[2:20:28] the discussion was had that night you know of maybe why why because they
[2:20:34] got had one an original plan approved and then a year and a half later they
[2:20:40] had another plan approved and I'm sure there was reasons to to doing another
[2:20:44] plan right uh but I I the second plan I I don't think it's
[2:20:52] I mean my concerns about the water system my concerns about the
[2:20:55] connectivity uh and the traffic on Van Hoy Road really
[2:21:00] you know I'm okay with looking at selling water over into Forsyth County
[2:21:04] provided that we cover all our bases we we look out after the town of Stokesdale
[2:21:09] and the town of stokesdale's water system and and I think I'm not just out
[2:21:13] and outright saying no we should never sell water outside of our jurisdiction
[2:21:16] but it obviously is a different thing from selling water in Stokesdale
[2:21:22] I think what we've already said that we do that but uh
[2:21:28] is to do with the water system I think we've got to write I don't know that
[2:21:31] we've got a right to uh
[2:21:36] step in on you know what they do with the roads
[2:21:41] I mean this is a requirement from Forsyth County that was signed off and
[2:21:47] agreed to by by the company right I I disagree I think we have every right to
[2:21:53] to look at how that water mains installed whether it goes down the side
[2:21:56] of a road a sidewalk or cross country across the creek uh that that needs to
[2:22:01] come to us for unless Forsyth county is going to
[2:22:04] agree to maintain it if they're going to agree to maintain it then you know I'm
[2:22:08] good well
[2:22:11] I have no problem selling them water you brought up some good technical details
[2:22:15] that need to be addressed and probably should have been addressed a year and a
[2:22:18] half ago so I don't I don't dispute that but
[2:22:22] you know we got blindsided on that deal to start
[2:22:25] with so yeah yeah anyway you know
[2:22:31] I'm afraid I have to admit I turn make wrong turns sometimes and find myself
[2:22:35] going down the wrong road and just have to stop and turn around and I think we
[2:22:38] need to stop them be sure we are on the right track with
[2:22:42] with these details
[2:22:46] I don't dispute that at all
[2:22:50] restage motion we'll vote we've restated I can
[2:22:55] I'm glad I wrote it down I make a motion that town clerk Miss Del Martin draft a
[2:23:00] resolution and obtained mayor Crawford's signature in reference to the Forsyth
[2:23:04] County approved site plan F 1623 stating that the town of stokesdale's governing
[2:23:09] board respect respectfully objects to Forsyth County's decision to remove the
[2:23:14] internal Road connection between Lakeside Manor Drive and bent Ridge
[2:23:18] Forest Drive that was originally approved in the original rezoning case
[2:23:23] f-1597. and to include verbiage in the
[2:23:27] resolution stating that the request to add back an internal Road connection
[2:23:31] aligns with the requirement and the written conditions of zoning case
[2:23:36] f-1623 pursuant to North Carolina General statute 160d 703 and that the
[2:23:43] developer has signed signed off to agree to these conditions and that removing
[2:23:48] the internal connection resulted in Stokesdale municipal water lines going
[2:23:51] through three lots backyards and removes the Practical connectivity desired in
[2:23:56] new subdivisions and I second
[2:24:07] Jim has voted I Derek's voted I Jimmy
[2:24:20] the only the only thing I kind of disagree with on that is the
[2:24:25] making it really connect all the way through there for all those houses
[2:24:30] so therefore where I'm going to vote no the water park's right and that that may
[2:24:35] be too I may be off base but I'm gonna vote no
[2:24:39] Mr Jones I'm all right I'm also I
[2:24:44] did all right can we take a break yeah
[2:24:49] we're gonna take a break 10 minute recess 10 minute recess
[2:25:01] why does it feel like it's best
[2:25:23] so January February okay very good times in September it's
[2:25:28] I've got the whole month so far yeah yeah both of those born in January and
[2:25:33] I'm in September too so oh really yes both your dogs yes
[2:25:44] thank you for your help get you a young man
[2:25:51] 27 and 25.
[2:25:56] um they're allegedly they're adults
[2:26:06] I definitely am physically but um
[2:26:10] but yeah yeah it's probably got several things we need to talk about when I get
[2:26:15] a chance appreciate you coming out you know some
[2:26:18] people just think it would be off the office unfortunately because it's
[2:26:24] been such a good time
[2:26:40] you live
[2:26:44] a little bit
[2:26:47] yeah that's the
[2:26:52] difference
[2:27:16] either so there's a that's a good idea
[2:27:24] sir thank you for coming out
[2:27:32] from the farm
[2:27:41] Forest Farm economical spill something
[2:27:47] the national
[2:27:50] animal
[2:27:53] every jurisdiction is a little bit different our our ordinance is 50. why
[2:27:59] it's not 45 versus 55. well now
[2:28:11] in Nashville
[2:28:14] Tennessee
[2:28:17] you've been in a room but you've hurt me I don't like what I'm seeing here it's
[2:28:23] just this multi-jurisdiction here
[2:28:41] Forsyth County Oklahoma
[2:29:02] wasn't on the board paid that vote cold water
[2:29:09] and I would have raised
[2:29:16] and so instead of us
[2:29:20] and I don't think I was at all those meetings but doing the best I know how
[2:29:26] appreciate it
[2:29:40] good morning
[2:30:01] okay
[2:30:08] really yeah
[2:30:46] okay
[2:31:18] foreign
[2:31:55] our 13 years
[2:32:21] foreign
[2:33:02] all right
[2:33:23] foreign
[2:34:04] because it's a lot
[2:34:30] thanks for coming
[2:34:33] please please feel free
[2:34:50] Mr Mayor do I have all these you have all that I had
[2:34:56] you know are they all going to leave now it looks like except for the diehards
[2:35:03] did Mark just shut up oh he's been here
[2:35:41] we're almost done almost done well number nine of 20.
[2:35:57] we're almost to the old business and then we just got a new businesses
[2:36:06] oh we're running the heat on one side of the building there's a thermostat
[2:36:13] yeah we got to pay this bill
[2:36:22] told Tim I'd open up a butcher shop I believe we believe we could butcher
[2:36:27] some homes we used to keep it turned off in this room between meetings
[2:36:32] and that was back though we had a little more control over the budget I finally
[2:36:37] had to give that up because of all that cleaning
[2:36:41] well these women have power surges okay
[2:36:48] to come over here and turn it on the day before the meeting oh that's even better
[2:36:52] take a whole day to cool it down no but I had to run pretty hard
[2:36:59] there's two years
[2:37:05] I got a guy that believed that he does uh these lights work for me so I'm going
[2:37:10] to call him he's got to come outside he's got to come out and go out to the
[2:37:13] lake for me
[2:37:16] well he's well he's by here just stop in and I'll text you remind me I'll text
[2:37:22] you a picture of the name plate already refrigerator I already did you already
[2:37:25] got it I already did it you got it right cheer
[2:37:28] I got to go to the lake get the one off of the one at the lake I just I don't
[2:37:33] know about the new stuff man it's getting all thin but it's a GE it all it
[2:37:37] ought to be repairable and the way Dale's describing it the upper half is
[2:37:42] not cooling and the lower half is freezing
[2:37:52] what do we do we set a 450 limit on it I think that's what I said yeah don't tell
[2:37:58] him that no no no no I'm just going to ask him
[2:38:02] be sure
[2:38:05] I'll jump over there [Music]
[2:38:10] actually the house he's in there was no discussion about my daughter buying it
[2:38:14] but okay or I don't know what the rights would have been I guess he would have to
[2:38:18] refuse it or whatever but I know we talked a little bit about it
[2:38:22] but Jim I've got a guy that I use for my Appliance work he's really good I got to
[2:38:27] send him out to the lake for the park model we got out there
[2:38:32] I've got a picture of the plate I'm gonna ask him if he'll just stop by here
[2:38:35] and give us an idea yeah I mean I I mean my honest opinion is I mean if he
[2:38:41] can look at it and say yes this and we can do it for this but I just
[2:38:46] I think's 13 years old or so that's made in China too so Technologies
[2:38:54] technology well if you come by and take a look at it
[2:38:58] he's got to come this way anyway
[2:39:05] are you already shopping for one no I'm not sure I'll bring anything I was going
[2:39:09] to let the staff look at it use the credit card if they can have it
[2:39:12] delivered and everyone hauled off he needs us getting involved in that stuff
[2:39:16] it's five refrigerator let's move along with it okay let me have my guy look at
[2:39:20] it first I don't think we should Nick on diamond I mean let's not get it we don't
[2:39:25] need anything elaborative but you know we don't need to get a short white one
[2:39:29] that doesn't have a let's get an ice maker if we need an ice maker because we
[2:39:33] don't know because oh here's my dilemma is that's ice makers on refrigerators
[2:39:38] are not that expensive but that ice maker in there yeah is yeah that thing
[2:39:43] goes out when you decide not to replace it you still got an ice mate right the
[2:39:47] chair I just don't cheat oh yeah
[2:39:53] foreign
[2:39:57] we are back in session
[2:40:01] old business adoption of internal controls and separation of Duty's policy
[2:40:06] this has continued from January 12th
[2:40:13] since I wasn't at the 12th meeting I'll let somebody take the lead
[2:40:18] I believe this is yours Mr Jones it's always money
[2:40:23] Miss Martin
[2:40:26] we have had quite a bit of back and forth about this document
[2:40:32] correct if if this Council votes on this document would you be willing to provide
[2:40:37] me with certified copies of it as soon as I can get it done tomorrow absolutely
[2:40:43] that's why it's on the agenda to clear up any confusion as to what you all have
[2:40:48] have approved and you have personally gone through it word by word period by
[2:40:54] period And yes Soraya made those typo Corrections and
[2:40:59] the best of my grammatical uh expertise I have gone through it multiple times in
[2:41:06] so far as substance there's been no change that's correct that's your that's
[2:41:11] your responsibility you mostly removed the strikethroughs that were in there
[2:41:16] okay well that's it I'll make a motion that we
[2:41:21] approve a revised internal controls and separation of
[2:41:26] Duties policy originally adopted July 24 2014 this
[2:41:32] document will be marked revised February this the 9th 2023
[2:41:40] so it'll be effective after we vote Tim can I make a friendly amendment that
[2:41:44] there was a revision on August 13th of 2020
[2:41:51] I would like that in the motion I I submit that the original policy must
[2:41:56] have been approved on the in 2014 but but I vividly remember making a revision
[2:42:02] in August of 2020. August 13 2020 yes sir
[2:42:10] okay let me back up um
[2:42:14] I'm making a motion to it to approve the internal controls and separation of
[2:42:18] Duties policy that
[2:42:22] is currently marked adopted July 24 2014 beneath that it's marked adopted
[2:42:28] February the 9th 2023 and then
[2:42:33] somewhere on this document we want to take into account that revisions were
[2:42:38] made on August the 13th 2020 is that where you're asking for Mr Ford the
[2:42:43] clerk it's currently in the bottom in the footnotes 8 30. okay it certainly is
[2:42:48] it's already here thank you Miss Martin is yes sir and that and I would like to
[2:42:54] still second that motion so we're good to go we are let's vote is there any
[2:42:58] discussion hold on Jimmy had something I think
[2:43:14] tell us we need to um
[2:43:17] we need to raise up on on the property committee
[2:43:23] we come across things where we have to have somebody come out
[2:43:28] and and take a look and uh
[2:43:32] we need to raise up this uh this 250.
[2:43:38] uh to where it could uh if the scenario comes up
[2:43:43] that we've got something that can be repaired that you know might be a little
[2:43:48] bit more money um that's in the that's in the
[2:43:51] separation of duties Jimmy I would I would say that on page five of the
[2:43:55] policy if you've looked a little more than
[2:43:58] halfway down the page IT addresses emergency repairs and
[2:44:02] purchases well I know it does emergencies but some of these things are
[2:44:07] not really emergencies I mean you could you could wait a month but you're going
[2:44:10] to have somebody come out um
[2:44:14] I'm not talking about buying TVs and things like that I'm talking about the
[2:44:19] repair that needs to be made that you get into the process of doing instead of
[2:44:25] so you can get it finished you know you're gonna get it repaired an example
[2:44:29] would probably be the refrigerator that we just discussed earlier in the policy
[2:44:34] it said examples for emergency repairs include Plumbing work electric work HVAC
[2:44:38] work etc if one of these items is not operable and in need of immediate repair
[2:44:43] Tim set the limit on that at four I know the emergency repairs off
[2:45:00] all right all right well I mean
[2:45:05] that's fine I mean okay I mean you know we'll come up with some of this stuff
[2:45:09] maybe on uh I like the plumbing repair I mean uh yeah and the septic I mean all
[2:45:14] that could have been done with you know part of the policy without you know
[2:45:19] yeah you know that you call it a well emergency that's fine we'll leave it
[2:45:25] like it is and if we have any if we have any issue
[2:45:28] then we can go back to it
[2:45:32] okay you don't want to raise it
[2:45:37] we have a motion do we have a second no I didn't have a motion oh you're talking
[2:45:42] about Tim had a motion yeah go ahead go ahead sorry
[2:45:45] do we have a second
[2:45:49] Mr 42nd did it okay any further discussion
[2:45:55] Jim uh Derek hi Jimmy hi
[2:46:00] Tim hi and I'm also I
[2:46:05] discussion of town of Stokesdale I.T contract continued
[2:46:10] from January 12th yes sir something that's yours that's
[2:46:14] mine that's fine yeah so in your package you have
[2:46:18] um three quotes two of them are from a company called geek it
[2:46:22] one one at the top is highlighted it says managed it better and no one says
[2:46:27] good um
[2:46:29] and then there should be one from TCS as well that just came in
[2:46:34] um so I'm almost give you the short on this
[2:46:37] the biggest concern coming out of the last meeting was from staff that they
[2:46:42] didn't feel like they could um pick the phone up and call call TCS if they had
[2:46:47] an issue for that incurring you know a 125 an hour bill
[2:46:53] you need something Mr Jones before I go into the first no I'm just actively
[2:46:57] listening okay I thought you needed so I just want to stop make sure you get
[2:47:00] caught up there no no so the mayor keeps leaning forward and then so I have to
[2:47:04] lean forward so that was the um you know um I don't
[2:47:08] think there's any um
[2:47:11] there's not many any issues with the backup and all the virus and all that
[2:47:14] stuff um that TCS has been providing the biggest concern was the staff couldn't
[2:47:19] kick pick the phone up if a printer went offline or something you know day to day
[2:47:23] that happens and it was in costing the town 125 at a time they picked the phone
[2:47:27] up so um what I did was after the last meeting I had a company this company
[2:47:33] called it geek box I.T reach out to me based on the um Northwest Observer so
[2:47:39] somebody's reading it Patty yeah one one person I got one person
[2:47:44] down for you okay I've done that and I told the guy I hadn't read that
[2:47:49] personally so so I can't comment on that but uh so uh
[2:47:56] um so he he provided us a quote now I gave him the same you know same issues
[2:48:00] that we wanted to look toward more of a managed
[2:48:04] um support system for one fee per month so in short your two i t your two geek
[2:48:10] box I.T quotes one's for good and once for better the better is 667.19
[2:48:17] but and that includes the three main staff members that are here every day
[2:48:23] they're they're machines if something goes wrong they can they can pick the
[2:48:27] phone up and call and and have support without incurring any additional cost
[2:48:33] um I um the other quote for geekbox it is a little cheaper it's 427 but that
[2:48:40] kind of gives us the same thing what we had before so it'll be like 75 an hour
[2:48:45] every time we called um
[2:48:48] So based on the the staff's recommendation I kind of compared the um
[2:48:54] geekbox the better quote which is the the 667 to the TCS quote which is
[2:49:00] 677.84 so monetarily there's not a lot of difference in the two
[2:49:05] um both of them provide a backup solution
[2:49:09] um storage offside in the cloud and and just like geekbox it TTS provided us a
[2:49:17] package that will be um that will and I'll read it it says
[2:49:21] full managed per full-time employee for three employees fully managed support
[2:49:27] so that's remote only that means if they if they have to come out both and this
[2:49:32] goes for both companies if they have to come out then they're going to charge us
[2:49:35] you know the normal fees but if they can handle it off-site remotely then there
[2:49:40] will not be any any additional cost to the town okay um
[2:49:45] so I think I think based on you know everything that we we've talked
[2:49:50] about I think the best option would be to go with one of these two packages
[2:49:55] um I'll leave that up to council as far as the which uh the security and
[2:50:00] maintenance and stuff is better that's probably not for me to say because I
[2:50:04] can't get into that the weeds of the eyes but um so I you know I think both
[2:50:08] of them are probably sufficient enough to provide us security and back up
[2:50:14] um and both of them are going to be providing us some support for our three
[2:50:17] employees without an additional cost so it's just
[2:50:22] um at this point we just need to make a decision which if we want to stick with
[2:50:25] TCS which is already in place or do we want to go to a new company
[2:50:31] um all together and like I said Same Same services to
[2:50:36] the difference in the cost is about 11 a month
[2:50:40] difference um are you are you proposing the 667
[2:50:46] quote I'm not proposing I'm just putting it out there for discussion if anybody
[2:50:49] has an opinion um that's our two options
[2:50:53] um you know we can stay where we're at which which means basically No
[2:50:59] Interruption in service at all and we continue moving forward or we can go to
[2:51:04] dig deep box which that means TCS is going to have to pull all their stuff
[2:51:08] off switch over to another server and so it's going to be a little bit of a
[2:51:11] transitional period um I'm not personally I'm not sure that
[2:51:15] that's worth 11 a month for me to have to go through all that trouble in town
[2:51:19] staff time but I'll open it to y'all is Staff
[2:51:23] unhappy currently with the service we're getting
[2:51:27] oh I'm sorry that's okay no no we're satisfied with TCS the issue
[2:51:32] that we run into with TCS is with our current contract anytime we call them
[2:51:37] with issues it's an added cost uh the good thing about the the new contract
[2:51:41] that Mr Rigsby has proposed is that it's unlimited uh Service as long as they
[2:51:46] don't have to come out here now I've in my time here I don't know that they've
[2:51:51] ever came particularly I don't know that they've ever done a town hall visit in
[2:51:55] my time being here most of the the problems can be fixed over the telephone
[2:51:59] honestly they remote in they fix it that way and it's done in no time if they
[2:52:05] hurry up and fix it how much money have we spent with the
[2:52:09] phone call last year does anybody have a clue
[2:52:13] can you tell us
[2:52:19] well Jimmy what was your last part I couldn't hear you how much money have we
[2:52:23] spent with phone calls with TCS okay you know I mean is it too it's not
[2:52:28] insignificant I'd say a couple hundred dollars more a month on top of
[2:52:33] 470-ish so okay so we're so this is a big difference in my opinion this is a
[2:52:38] good deal well let me and let me say this uh the proposal to TCS provided us
[2:52:44] last month without the support was still going to be around 670 or so because
[2:52:50] they're going to a new security platform which is more secure what we've been
[2:52:55] paying in the past was 426.53 a month that's going up regardless uh on what
[2:53:02] just through negotiating with TCS they're willing to to keep the contract
[2:53:07] they're willing to provide the the fully managed support as well within pretty
[2:53:12] much within the same cost so um it satisfies what the town I think
[2:53:17] the town needs and you know one call is 125 dollars uh two
[2:53:22] calls is 250 or two hours 250. I know we've had that situation with with the
[2:53:27] Facebook uh the Facebook page issue so it could happen
[2:53:31] um but I think more than anything it gives
[2:53:34] the town staff a piece of mind that they're not sitting there sweating
[2:53:38] having a call and knowing they're going to incur a cost and when you have a and
[2:53:42] we have a fixed a fixed cost going forward that we're not having to budget
[2:53:47] you know an overage four if something does break we know what we're going to
[2:53:50] be paying and we don't have to worry about having that fluctuation each month
[2:53:54] because of you know somebody's called somebody's call because they
[2:53:59] you know something the machine didn't need to be needed to be rebooted or
[2:54:02] something like that a lot of times it's very simple stuff
[2:54:06] that that they have many remote interfix and within 15 or 20 minutes but we still
[2:54:10] incur about 125 dollars for this cost so if you've seen it yet
[2:54:16] you're still looking yes I would just like to make cancel the where
[2:54:21] um I did remind let you guys know that there would have to be a budget
[2:54:24] amendment for this and I unfortunately did not see
[2:54:29] these until this morning so therefore I was not sure what the price was going to
[2:54:33] be because I knew the last meeting you guys had said you were going to reach
[2:54:37] out to a couple of more people or what have you
[2:54:39] um I would also like to let you know too I have also received an invoice
[2:54:44] um number 86696 from TCS and it's for monitoring for March
[2:54:50] so um I noticed on the terms on here that
[2:54:54] this contract would begin March 1st 2023 at the sixth
[2:55:00] um 77-84. um I would much rather
[2:55:05] have that revised if possible for 4 123 because I had the invoice for March for
[2:55:10] 426.53 already so
[2:55:14] to me that you know I think that would be silly to
[2:55:19] sign a contract for March one when we had the invoice for March already at 4
[2:55:23] 26. I'm just that's a good deal that's a good point save us come on well the only
[2:55:27] the only issue with what you've got for for March is it doesn't provide that
[2:55:31] support it doesn't provide the support level
[2:55:35] you know the the that that we're talking about that's going back to the same
[2:55:40] problem that's just don't call them yeah yeah month of March okay so that's a
[2:55:44] that's a fine fine piece of example of leadership and I just wanted to let you
[2:55:49] guys because I noticed that on there it does say March 1st but they have already
[2:55:53] invoiced us for March I would contend we couldn't enter into a contract into the
[2:55:58] budget is amended correct and we need to do that in the March meeting so I think
[2:56:02] in April 1 start date is is reasonable for those two reasons and let me let me
[2:56:07] just say I take full responsibility I did not email these costs to Kim until
[2:56:11] this morning or late last night because I did not get the two contracts until
[2:56:15] the last couple days um you know both of them said we'll get
[2:56:18] you one by you know thank you for doing this I know it's a lot of work if you
[2:56:23] were doing this to yourself you didn't have to ask anybody what would you do
[2:56:28] you know um I don't think we any of us have any
[2:56:32] issues like I said with tcs's service obviously it was cost and I don't blame
[2:56:37] them for that it's their business you know that's their agreement hey we come
[2:56:40] out at 725 an hour we agreed to that so I don't have any issues there I just
[2:56:45] think we you know we and now we've renegotiated a little bit better deal
[2:56:48] for us to where we won't have to incur this 125 an hour cost
[2:56:53] um I personally would rather for the cost difference in the two plans
[2:56:58] the two companies I would rather stay with what we have because we don't have
[2:57:02] to worry about having to disrupt our service having had
[2:57:06] all our data switched over to another server or stuff like that you know I
[2:57:09] mean that's going to be a that is going to take some man hour time for somebody
[2:57:13] to come in here and switch their service over so we don't have any any issues I
[2:57:18] would just assume stay with TCS and and you know upgrade to the more secure the
[2:57:23] more security platform in the um the service that our our staff can
[2:57:28] use if they need to well Mr Rigsby
[2:57:33] I'll pick on you since you presented Jason this is nothing against geek box
[2:57:39] I.T because I don't know these folks but uh
[2:57:43] how how did they provide you with references do
[2:57:48] they do work for any other governmental entities
[2:57:51] I'm sitting here not knowing much I'm a Layman when it comes to a computer for
[2:57:55] for sure and and I'm just wondering how I as a
[2:58:00] council member are we as a council go through the process of evaluating
[2:58:05] their competence and their integrity and you know
[2:58:09] do we require them to have any specific kind of insurance to protect us
[2:58:14] uh protect the towns you know computer system we spend a lot of money
[2:58:20] on these computers between buying Hardware software and the I.T
[2:58:25] maintenance it's sometimes it makes me wonder if we should just go back to
[2:58:28] paper
[2:58:31] um so to answer your question I I had two lengthy conversations with people
[2:58:36] from geekbox I honestly cannot remember they they told me who you know several
[2:58:41] companies they provide services for their local company
[2:58:45] they are uh um that's all they're they're local
[2:58:49] they're I mean they're not they're not a one guy operating out of his house
[2:58:53] they're they're legitimate I.T company that uh some of their you know some of
[2:58:57] their um some of their um employees are have
[2:59:02] gone from TCS so they're the same level of of service providers I I was
[2:59:07] wondering if they had at least two or three service people in case somebody
[2:59:10] had the flu they do I believe I believe he told me six but don't quote me on
[2:59:14] that I looked at their website and um okay so did I ask those specific
[2:59:18] questions I can't say that I did or didn't but um I definitely looked at
[2:59:22] their website to make sure there were not a a one-man operation and they
[2:59:27] assured me they had enough support in place to you know to support us because
[2:59:32] they support a lot larger clients than us the only one I've ever been involved
[2:59:37] in really hiring here for I.T support was Tech Authority out of Reidsville
[2:59:42] and I felt comfortable doing that at the time because I knew two different
[2:59:45] companies I knew people that worked there the owners that that Tech
[2:59:50] Authority was performing work for and so just somehow we have to figure
[2:59:55] out some way to vet these folks whether it be asking for references or or
[3:00:01] certifications I don't know the answer to this I I'm not uh
[3:00:07] really up to speed on computer systems or computer period
[3:00:12] enough to know what questions I should be asking Miss Martin Mr Jones we have
[3:00:17] been with them for how long three years I believe it's a little at least three
[3:00:22] years um and yeah with current tcx yeah other
[3:00:27] than just the issues of calling recently say last six months
[3:00:33] I think they've served us well yes well it just uh you would want us to be
[3:00:38] careful what we do in regards to our computer system it would really impact
[3:00:43] the staff negatively if we we had things go Haywire absolutely and from my
[3:00:49] perspective if we switch which we can do but it would be significant downtime for
[3:00:55] the staff while that's done but Miss Martin if you had to make the decision
[3:01:01] yourself solely yourself which what would you do
[3:01:05] I'm I'm satisfied enough with TCS I agree with Mr Rigsby that I would stay
[3:01:10] with him on geek box has not given us a super super deal over and above what TCS
[3:01:18] could provide so I don't have a problem with staying with TCS at all
[3:01:23] all right thank you I'm going to make a motion now that the town enter into a
[3:01:28] contract with TCS that matches a document that we have in our packet
[3:01:31] dated two eight the quote number is t c s q 4744
[3:01:39] the monthly amount is going to be 653 dollars with the sales tax of 24.84
[3:01:45] cents for a total cash outlay of 677.84 a month and that this contract
[3:01:52] become effective April the 1st 2023 there
[3:01:59] I'll second that motion excuse me for uh for a let's see for a one year period
[3:02:06] okay I
[3:02:10] just a point of reference let me let me flip back through here
[3:02:13] I don't know that um
[3:02:18] I think generally they do a two-year period I think it's one of the terms
[3:02:21] that's in here okay so I I would have to be something we had to go back and
[3:02:25] negotiate and I don't know it's kind of like the lawn care business you know if
[3:02:28] they you get a better deal if we you know we
[3:02:32] put a little bit more longer contract with them I don't think two years is
[3:02:35] absurd you know out of the norm well but um Tim and Mike what do you guys
[3:02:41] think are y'all comfortable with two years I kind of hate the idea of
[3:02:46] signing contracts that go into the past the next election just because I've had
[3:02:51] that done to me before and it just that's why you feel good I don't think
[3:02:56] we can avoid that though I mean unless we sign a month by month contract
[3:02:59] because the next election's coming up in seven wait a minute how long we signed a
[3:03:03] contract forth on a year they want no no I mean the standard contract we've
[3:03:06] signed in the past is two years and that's what the term they've got in the
[3:03:10] contract is what I'm saying let's go back to them and tell them we don't want
[3:03:13] to do it yeah I I don't like I don't like doing
[3:03:16] that either I mean you know they'll probably get it back anyway but you know
[3:03:21] there could be three guys sitting up here that are different that want to do
[3:03:25] something I know how we were uh how we had to keep some people that
[3:03:29] we didn't want to keep um the point is we're not having to to
[3:03:33] change anything just by extending the contract they're just taking the
[3:03:37] existing contract and just they want another two-year commitment from us so
[3:03:42] well they shouldn't they should have a problem doing a one-year commitment
[3:03:45] because they're already here well hopefully make a motion to give them a
[3:03:48] one year and if they they accept it we'll be good to go and if they don't
[3:03:52] we'll have to revisit this uh let me propose a friendly Amendment
[3:03:56] if I may that that the terms of the contract be one year rather than their
[3:04:01] requested too and tell them the tell them why I mean I
[3:04:05] mean they've got somebody's got to respect
[3:04:09] it was one well the paper says to come to think of
[3:04:12] it forgive me forgive me I'll wake up in a little bit all right we'll see where
[3:04:17] you agree we don't even know it I know
[3:04:23] okay so it's a one-year proposal one-year motion effective four one
[3:04:28] effective four one Jim you have seconded it
[3:04:33] yes Ms Martin I guess you're going to have to contact them just to tell them
[3:04:37] you know what what we want and give them the reason yeah explain explain why the
[3:04:42] reason is you know we've got election coming up less than a year
[3:04:46] well and we're trying to do the right thing yeah
[3:04:50] and you said April 1st yeah
[3:04:58] any more discussion Mr Rigsby is been the one that's done the negotiations so
[3:05:04] you want okay Mr Rigsby will you will you renegotiate this for us I will
[3:05:09] reach out to him and um and and
[3:05:13] report back uh I guess if if they so uh so I guess what
[3:05:19] we're going to do is we're going to prove it under our conditions tonight
[3:05:23] and if they say no we can't do that and then we'll just have to come back to the
[3:05:27] table in March yes I just can't I couldn't
[3:05:31] understand them you know they realize that we're doing it because we're not
[3:05:35] wanting the hamster no I'm I I just can't speak for them by now I know you
[3:05:38] know they got two years in here for re I don't know if that's just their policy
[3:05:41] their business operation I I don't know it's probably because it's printed on
[3:05:44] the contract it reminds me of that Spectrum contract we thought would never
[3:05:48] end yeah I think if we were a new client for them they may be more hesitant one
[3:05:53] year I agree yeah you know I mean if they don't if they don't
[3:05:57] respect that we feel that way then I don't even know if I want to keep them
[3:06:00] anyway so you know
[3:06:03] Ms Martin you think we've had we've been with them for three years
[3:06:07] I've been here almost too and you were with them do you have any idea what the
[3:06:11] original contract stated
[3:06:17] I think we're I think we'll be fine I think we're you know how did we get to
[3:06:21] three years if we had signed a two-year contract
[3:06:25] oh I got you all right yeah yeah all right Bill don't worry about it is there
[3:06:30] any further discussion Mr Rigsby
[3:06:34] aye Mr Floyd aye Mr Landry aye Mr Jones aye and I am also I
[3:06:40] uh speed limits I believe that's you Mr Floyd
[3:06:44] I'll make the motion uh that the town uh approve with an ordinance to regulate
[3:06:49] the speed limit on Athens Drive within the town of Stokesdale this is strictly
[3:06:54] between the school and Angel Purdue Road I'd
[3:06:58] like to second that but I'd like to make an amendment that should be Athens Road
[3:07:03] not Athens Drive
[3:07:07] yeah it says drive but it's dot paperwork Says Athens drop I don't know
[3:07:12] what's correct I assume their paperwork is correct but I can actually put the
[3:07:18] ordinate well as I could put both on there with one in
[3:07:22] parentheses the state road numbers on there it is that's true it should be
[3:07:26] sufficient whatever y'all want to do we can we can
[3:07:31] do it but it's it's Athens Road um
[3:07:36] if you want to if you just want to put on there to make a note to dot to
[3:07:41] um could I confirm with them which we'll
[3:07:45] just confirm with it and and then and Miss Martin has the authority to do
[3:07:50] whatever to change that if it should be changed I mean if they've slipped up and
[3:07:54] changed it and I just don't know about that's fine
[3:07:57] uh that is Athens Road it's listed that way so
[3:08:02] um maybe they've got a
[3:08:06] I think we should be as accurate as we can any further discussion who second
[3:08:11] did that Jim Jimmy with with the with the
[3:08:15] amendment that uh Miss Martin has the authority to change that to Athens Road
[3:08:19] if need be
[3:08:23] better right there you accept that oh yeah any further
[3:08:28] discussion Jim
[3:08:32] aye Derek hi Jimmy hi Tim hi and I am I
[3:08:38] uh new business discussion on vendor to maintain soccer
[3:08:42] fields at Town Park that sounds like a gym or Jimmy idea
[3:08:46] do we we don't have we have a contract we
[3:08:49] I don't think it's in the packet
[3:08:59] uh we we had them under contract Jimmy um don't quote me on this but if I had
[3:09:05] to guess it was a one-year contract but I don't
[3:09:09] remember I know we've we redid it but it must seems like it was over a year ago
[3:09:13] to me yeah the contracts run out that's and that's what it was
[3:09:18] um contract
[3:09:21] um until December 31st 2022. yeah run out in December so I mean we've we've
[3:09:27] we've been painted do we have a copy of the contract they wanted us to make us
[3:09:32] we don't so they're they're still have they billed us yeah
[3:09:42] yeah but that wasn't yeah okay but so we're
[3:09:45] under a new contract now so we need to uh we need to uh
[3:09:50] get a copy of it it was okay
[3:09:56] all we had was that proposal
[3:10:06] because we can't we can't write them we can't write a check till we we have a
[3:10:10] contract correct I mean she can't you can't do this
[3:10:14] okay so I guess it will be okay with you I mean we can be okay till next uh
[3:10:20] our next meeting I would recommend we ask for one based on
[3:10:24] if y'all want to go for a proposal or you want me to ask Hunter for another is
[3:10:29] everybody happy very much so good I I honestly disagree
[3:10:36] um um I don't know that at this point in a
[3:10:39] staging point I have a I have an alternative but um
[3:10:44] my two issues with with them was one a couple times last year they mowed and
[3:10:49] they left dead grass all over the soccer fields at least two occasions and I've
[3:10:52] got pictures of it to a point where um a parent had to come out with a
[3:10:58] blower and blow it off the soccer field for them to use it um and then also the
[3:11:03] repair that they did to the um uh where they had to dig the hole for the water
[3:11:07] repair I I just it's my opinion and and some
[3:11:12] other professional opinions that that could have been done a little bit better
[3:11:16] and um um so
[3:11:20] you know not not saying that anything negative on them or anything but I'd be
[3:11:25] open to um looking at some other vendors if
[3:11:28] possible you don't have any options right now though because springtime's
[3:11:32] getting ready to come up pretty quick yeah but um no I don't but I we can
[3:11:37] certainly I had a couple people kind of reach out
[3:11:41] one was the person that blew all the dead grass off hemos Angels Glen
[3:11:45] subdivision now he's our contractor he asked me about it um and I told him I
[3:11:50] said at that point we were still in the contract but if we put bids out you know
[3:11:54] I'd reach out to him um also um
[3:12:00] our current regular mower um
[3:12:05] Excellence you know that would be another option but but unless we decide
[3:12:09] to like rebid it I mean there was no reason to go out and you know try to
[3:12:13] rebid it until we talked about it as Council but I'm just saying I'm not I
[3:12:18] don't know that I'm in lockstep to to just give them another year without at
[3:12:22] least talking about it well Mr Rigsby that turf grass business is a whole
[3:12:27] nother world it's a special real mower it is but everything most landscapers
[3:12:33] don't have the the sprayers and access to the chemicals no certifications and
[3:12:39] what have you but you know if Council wants to look at that fine by me but I I
[3:12:44] would hope that we would bring our concerns to Hunter and let him know
[3:12:48] those those two issues so that he can address them or at least be aware of
[3:12:52] them we we did on the dead grass and correct and you can let we can let the
[3:12:58] staff get there we'll see were they responsive Mr Wagner
[3:13:05] yeah I will um I I know I can think of at least two
[3:13:10] different instances where I was at the park mainly after that repair was made
[3:13:14] you know I would go down there and water in the mornings had a couple residents
[3:13:17] that would come up and and uh make a comment about the dead grass on the
[3:13:21] field and I wanted to know if that was going to be fixed and if I'm not
[3:13:26] mistaken uh Mr Rigsby had actually been down here I think you might have gave
[3:13:30] him a call and they said that sometimes they do that they mow it's early in the
[3:13:34] mornings they wait for it to dry out and then they come and blow it off now
[3:13:37] whether or not they would have came back without him calling I don't know but at
[3:13:40] some point they did come back and blow it off but it wasn't until after Mr
[3:13:45] Rigsby called them and and asked them to do so well this fellow has all the
[3:13:52] necessary specialized equipment to service Athletic Field the turf grass so
[3:13:58] that that would be my concern if you know if you can find a competitor that
[3:14:02] wants to give us a quote that that is in that business and we can verify that I'm
[3:14:07] fine by that you know great let me let me just give you and I don't have
[3:14:11] anybody in mind right this second but that was what I had been told for all
[3:14:16] this time um as well however um
[3:14:22] every I've used Northwest High School as an example of their football field is as
[3:14:27] in good a shape as this right here he is and it's done by an athletic coach with
[3:14:31] a John Deere with an attachment and um so I you know I don't I think I think um
[3:14:39] from equipment standpoint I think anybody could go out and buy the
[3:14:43] equipment they needed to do it now from a spray-in and a chemical standpoint
[3:14:47] most any any certified by this mowing it's going to
[3:14:52] have those those you know those um uh access to those because they're
[3:14:57] already you know using them on if they're a commercial mower they're going
[3:15:01] to have access to chemicals and and spraying license so I don't I don't know
[3:15:04] that that's that big of a hurdle I'm just saying you know if we want to at
[3:15:09] least take a look and see what kind of bid we could you know could get to
[3:15:12] somebody that's comfortable I mean I don't want to certainly don't want to
[3:15:15] reduce our requirement in any way as far as equipment or or licensing or
[3:15:20] insurance or anything like that I just wanna just proposed do we want to look
[3:15:24] at and at least give some other vendors a chance to look at it well
[3:15:28] just speaking for me I would want them to be able to demonstrate to me that
[3:15:33] they are in the business of taking care of turf grass and they've been
[3:15:36] successful at it um
[3:15:38] don't know what's going on with the dead grass but
[3:15:41] certainly if we're having surface service issues then that's what we're
[3:15:45] having I um I agree with you I would just I
[3:15:50] mean I you know I like to continue to like I said the repair that they made
[3:15:55] down there I I consulted with um probably the biggest
[3:16:00] turf grass company in the in the Triad and was very you know adamantly told
[3:16:06] that that was not done properly and and pointed out in many ways why it wasn't
[3:16:10] done properly and uh and like here's the history here's a picture of it
[3:16:15] Mr Jones I thought I don't mess that up um and I'll just give you I mean let me
[3:16:21] approach it is it show you this is this picture when the repair was done or now
[3:16:26] both no no no so there's the the dead grass yeah that we're talking about and
[3:16:32] here's the repair and you can see the lip that was left
[3:16:35] how that should have been done you can see it again it should have been
[3:16:40] tapered the sand it should have been used more sand it should have been
[3:16:42] tapered down to where it was more level and flat
[3:16:46] um and you can see The Ridges that you know the unlevelness of it
[3:16:51] there's a good picture you can see where you know they left the edges and stuff
[3:16:56] so you're going to have some transition period it could could have used more
[3:17:00] sand right there um but then again there's some more of
[3:17:04] the dead grass well you know so that's just concerns please notify them and
[3:17:09] tell you know tell them your concerns maybe they'll come out and
[3:17:12] I do a warranty repair add some sand and blend it in a little better
[3:17:18] in the past we haven't experienced a lot of service issues with Hunter I will say
[3:17:23] that you know and I agree I'm not familiar with any at all just like I
[3:17:28] said the dead grass um and I don't you know I mean you and I
[3:17:32] both know mud grass many times it could have been a lot of reasons it happened
[3:17:36] but I think it happened more than once because it happened the day I saw it and
[3:17:40] I going back on that time period I think we're talking to staff they had had an
[3:17:45] issue the week previous with the same thing and and like I said I've had a
[3:17:49] parent as well come up and say he went out there and blew all the grass off so
[3:17:53] they could play on the fields so and there was another issue and I don't know
[3:17:58] who did I don't want to throw shade but just the movement of some equipment that
[3:18:01] occurred on those fields that damaged some equipment
[3:18:04] that um you know that they tied a mower to it and supposedly pulled it I had to
[3:18:09] complain about that from the citizen as well
[3:18:11] so um but I don't know that they did it or not
[3:18:15] but you know just it happened the the goal got damaged we
[3:18:19] do know that much so you know we've got a lot of people coming out here in the
[3:18:23] evenings too that I think might move some stuff you know I mean well my
[3:18:26] understanding was it was done with a chain oh well it was a chain was tied to
[3:18:30] the goal and it was pulled with a machine and it damaged the goal I've
[3:18:35] seen citizens out on those fields with pickup trucks doing various things it's
[3:18:40] hard to police
[3:18:44] um one of these days about I'll talk about putting the fence around this
[3:18:47] thing I could have an oak Creed people can't drive up on them
[3:18:51] we might should have done that this time when we were and I just didn't think
[3:18:55] about it true that uh we don't have any
[3:18:59] um maybe we should pursue getting the contract and um
[3:19:05] I mean we don't we don't have a uh alternative right now if you want to try
[3:19:08] to find some um I mean we could we're going to do something because it's going
[3:19:12] to be spraying time I'm not sure it says in the contract that uh Miss Martin
[3:19:17] uh when they when they spray is it that's your question in the
[3:19:23] contract doesn't it say uh when they when they spray and all
[3:19:29] I can't remember
[3:19:36] I mean this thing's paid quarterly so we won't be able to if they do anything
[3:19:41] we'll be able to write a check until we you know prove it
[3:19:44] well I mean it actually shouldn't they be spending the movie until
[3:19:49] yeah I was thinking the same thing maybe we need to
[3:19:52] um do we need to just notify him to hold
[3:19:56] off on any Services until we make decisions
[3:20:01] guys I worry about we neglected
[3:20:06] the condition of those fields will get away from us the soccer season's I don't
[3:20:10] know a month away it has been a contentious issue in the past previous
[3:20:14] year also has spent a huge amount of money on those fields so I'd sure hate
[3:20:19] for us to back up it's uh there's gold in that grass
[3:20:25] yes it is that repair was gold uh I think that we got we've got a year we we
[3:20:32] can even though it might not have been 100
[3:20:35] percent uh we may just be too late to uh
[3:20:40] um you know to get somebody in I think he's
[3:20:44] does it say s
[3:20:48] a proposal that was submitted in March of 2 2022 February March they're already
[3:20:54] applying Ron star whatever it is they probably already started doing something
[3:20:58] so they are prepared already to probably start doing maintenance on it I agree it
[3:21:04] wouldn't it wouldn't hurt to look but we waited to this time we probably
[3:21:08] [Music] um
[3:21:10] I mean we had a few incidents um
[3:21:14] when you when you get reelected well I
[3:21:20] um I had some interface and back and forth
[3:21:23] with Mr hunter in my first term and and I always found him to be receptive and
[3:21:29] responsive to any any questions and concerns and I just if we have some
[3:21:34] issues here I just want to make sure that he personally knows about him and
[3:21:38] not you know just I don't know if somebody answering the phone at his
[3:21:42] company I'm just I'm kind of like Derek I just
[3:21:45] don't want to let the soccer fields I mean he's probably already putting it on
[3:21:48] there so we've already incurred some expense
[3:21:51] uh bills quarterly we can't sign a check till
[3:21:55] if a contract if we want to go there we may be able to get some free advice from
[3:22:00] NC State University some of their extension people etc etc if
[3:22:06] Council thinks we we need some expert opinion
[3:22:14] um that's that's up to you um
[3:22:18] I mean if we need to we're not we're not under contract with
[3:22:22] them right now so I I would have to question if they're
[3:22:26] coming out here spraying you know are they if we're not under
[3:22:30] contract are they doing that on their own with the assumption that we're going
[3:22:33] to pay as we were under contract which is a big assumption if it was told we
[3:22:38] hadn't told them nothing I mean it's just I mean I I don't know the man you
[3:22:43] know and I don't have a problem with Mr Grimes he's doing it he's trying to keep
[3:22:46] the fields up and I'll tell you I really appreciate if he's doing it because
[3:22:50] um but we just need to have some Community
[3:22:52] if you know he needs to you know provide us a proposal because I think he went up
[3:22:56] on the price last year if I'm not mistaken he did so we don't need to be
[3:23:00] shocked if he's going to plan on going up on the price again this year and then
[3:23:04] we you know we get halfway through the spray-in season and he gives us a
[3:23:08] proposal for 14 000. do we not have a proposal now
[3:23:12] well let's be sure we ask him for an updated proposal and then we'll go from
[3:23:18] there I don't have to call special call Newton to take care of this because we
[3:23:21] don't want to let this I mean whatever um can we can we get a
[3:23:28] you can now get in contact with him get a proposal
[3:23:31] and let's see where it is and if it's something we can put off the next next
[3:23:35] month but we've got to make sure these soccer fields are taken care of I just
[3:23:38] checked I think I still got his cell number if you I'll give it to you all
[3:23:42] right just as a point of reverence this
[3:23:46] proposal we got last year dated March 2022 was approved by Council April 14th
[3:23:52] and if their schedule is correct they had already done work last time yeah
[3:23:57] yeah contract for a year from from March Lori
[3:24:02] is it for it is it for 12 months from the day we signed it it was
[3:24:13] so it really wasn't a full year okay but the contract is out
[3:24:18] and we haven't received any communication from them say hey we need
[3:24:23] to renew you know do you want us to send a proposal for fourth quarter is the
[3:24:27] only thing I would call City that's a bill yeah yeah that's the only thing
[3:24:32] I've we're seeing that I can recall yeah
[3:24:38] all right well let's just we'll find out what they've been spraying or whatever
[3:24:42] if you want to look at something Jim I I can
[3:24:46] um all right we can call them about my concern without even going out there
[3:24:49] obviously is that repair uh the dead grass which we want to incur that until
[3:24:54] the summer anyway um and
[3:24:56] without looking there was a couple of holes and not holes but a couple large
[3:25:01] exhibits in the middle of the field where they tend to play a lot and I
[3:25:05] don't know that that has been repaired that probably needs to be repaired as
[3:25:09] well and I don't know if that's considered inside the contract or is
[3:25:12] that an additional repair but Derek can probably tell me is there not a couple
[3:25:17] places on the middle of the field out there there are where you know the wear
[3:25:23] and tear is not level anymore I think two years ago we had to have them come
[3:25:27] out and just resand some areas just and I do think that was an additional
[3:25:33] charge but uh yeah okay okay so I'll I'll get with you
[3:25:39] Jimmy and we'll decide who's going to call him and what we're going to happen
[3:25:43] all right I mean you know if you got an alternative look at it like I said I
[3:25:48] just don't want to I just don't want to let the you know realize and all that
[3:25:53] you got to do this stuff at a certain time of year
[3:25:55] that's correct [Music]
[3:25:58] if we have questions let's give him an opportunity to make it right that's all
[3:26:02] I'm saying okay
[3:26:06] any more discussion
[3:26:12] do we have that discussion we currently don't have a contract with them so yeah
[3:26:20] I would I would be interested in just just to throw it out there the
[3:26:25] repairs like like the small ones inside the middle of the inside the playing
[3:26:29] surface that that be worked into the contract so now so it's kept up on a
[3:26:34] regular basis without it getting too far out of hand that we have to
[3:26:38] hating to do it maybe a suggestion and maybe you already do this but is there a
[3:26:43] log of current contracts that we're in and when they expire
[3:26:49] oh I'm sorry
[3:26:53] I haven't had an opportunity to work and Miss Martin that's cool I know you're
[3:26:57] busy but but that's just an opportunity for improvement for the future
[3:27:00] absolutely so we can stay because I feel like I was just yesterday
[3:27:05] when we voted for these guys again time flies you know so uh uh but anyway
[3:27:13] we've beat this one pretty good
[3:27:18] all right any further discussion consideration of a request
[3:27:24] excuse me discussion and approval of dates for Budget workshops physical uh
[3:27:30] physical year 23 24 budget
[3:27:34] yes Kim you got the dates I do um guys I sent you an email January the
[3:27:39] 17th uh proposing these dates for the budget workshops fiscal year 23-24
[3:27:47] um I base these dates on kind of what we scheduled for the budget workshops for
[3:27:51] 22 23. um and I have proposed Thursday March
[3:27:57] the second April the 6th and May 4th
[3:28:02] of 2023 and I was assuming seven o'clock if that's good with you guys or
[3:28:09] um I'm just asking you know seven o'clock or all of these
[3:28:13] Thursdays they are Thursday they're the first Thursdays of each month
[3:28:17] of these months
[3:28:22] good as any for me
[3:28:26] do we need to make a motion on this or just accept it
[3:28:29] I think we need to make a motion I make a motion we adopt this
[3:28:33] recommended dates for the budget Workshop
[3:28:38] if you would reference Miss thacker's email dated January 17th 23 regarding
[3:28:44] this as stated in Miss thacker's email of
[3:28:49] January 17 2023. thank you I'll second
[3:28:54] any discussion Jim
[3:28:58] aye Derek aye Jimmy
[3:29:00] all right and I'm I
[3:29:04] consideration of a uh of a request for proposal art RFP for audit firms for
[3:29:12] physical 2022 to 2023 Financial records
[3:29:19] um I sent you guys an email February 4th
[3:29:25] um regarding this that you guys voted unanimously in the July 14th 22 Town
[3:29:31] council meeting for the finance officer to reach out to four other accounting
[3:29:34] auditing firms to solicit proposals for the next year's Town audit councilman
[3:29:40] Jones requested an amendment to the emotion that Council reviewed the list
[3:29:43] prior to mailing out the request for proposals the amendment was accepted in
[3:29:47] the motion I mean
[3:29:50] yeah it passed excuse me I sent a list out to you guys on July 27th of 2022
[3:29:56] with the six audit auditing firms and you also should have a copy of those
[3:30:02] firm in your packet as well you will also
[3:30:06] find the RFP I wish to send out to the auditing firms the town of Stokesdale
[3:30:10] has used this RFP in the past for auditing proposals
[3:30:14] so um I don't know if you guys have had time to look over this
[3:30:19] I have okay I I do want to remove Ralph's Rouse
[3:30:24] and Gardner from this list they've been for one thing I've already
[3:30:28] been performing our old all it for a number of years it's time to switch as a
[3:30:34] best practice okay done
[3:30:37] done any object if there's any no objection from Council
[3:30:48] is there any further discussion are we
[3:30:54] I already have that on there Mr Jones you had requested um that I had uh send
[3:31:00] one to Gibson and Company they were actually on my list already is that I
[3:31:04] was wondering if they were not already yes they were already on there well
[3:31:08] forgive the redone this it's okay that's it
[3:31:15] they might come in cheaper than theirselves
[3:31:39] we're in a motion as we already made a motion
[3:31:48] it'll be clear here this does not necessarily mean if we were contacted by
[3:31:53] an auditing firm that was not on this list we would allow them to quote this
[3:31:58] work correct correct any anything I received I would
[3:32:02] definitely bring to council
[3:32:09] but if there's anyone else that you guys would like to add you know just
[3:32:13] let me know the information I'll be happy to send out
[3:32:20] these were closest around the area that's why these are the ones I chose
[3:32:25] we've requesting a one-year contract um if you look on oop I did not number
[3:32:31] the pages one it's actually the second page of the RFP
[3:32:36] um it does say that the annual these would be for 22 the 23 24 and 25 fiscal
[3:32:43] year however um it also stated in there
[3:32:48] that the town of Stokesdale reserves the
[3:32:53] right to request proposals at any time following the first year of this
[3:32:56] contract so it's given you the option after a new
[3:33:00] Council will have the option to do that per this RFP yes because they have to
[3:33:05] send those contracts like Mr Rouse would send those each year to us
[3:33:10] for Council to accept and approve
[3:33:15] this is a suggestion for a second year and a third year but correct yes just an
[3:33:21] option yes owners will not telling anybody else a hands it says each year
[3:33:24] after negotiations have taken place an annual contract documenting the terms of
[3:33:29] the audit will be signed
[3:33:33] since one governing board may not obligate future governing boards the
[3:33:38] remaining years of the agreement are subject to annual governing board
[3:33:40] approval good good that's good enough yeah it's in there
[3:33:49] I'll make a motion that we have staff follow through and send the fps to this
[3:33:54] this list
[3:33:59] I'm trying to I guess this list was attached to uh February 4th 2023 email
[3:34:05] Miss Thacker yes you also received it on July 27th okay Jessica
[3:34:13] that's my motion and I second it got it okay any further
[3:34:20] discussion any further discussion
[3:34:24] Jim hi Derek hi Jimmy hi Tim hi and I am I
[3:34:39] consideration of appointment reappointment to the planning board
[3:34:42] two-year term to expire on 1-1 2025. I'll make a motion to reappoint Michael
[3:34:50] threatt for an additional term to 2025
[3:34:57] is there a second now second
[3:35:02] any discussion Jim
[3:35:07] aye Derek aye Jimmy
[3:35:09] aye Tim hi and I am I adoption of a final version of the
[3:35:14] Stokesdale planning board rules and procedures
[3:35:18] is this in our packet yes
[3:35:26] this is simply an attempt to clean the document up the same as with the rules
[3:35:30] and the separation of Duty's policy we found multiple copies with
[3:35:36] strikethroughs just to make it simple for everybody to know what exactly was
[3:35:40] approved by Council we cleaned the document up if you want to make
[3:35:44] Amendments of course you can do that as well but that's what this document is
[3:35:54] yeah I don't want to make any amendments but but I would like I think we
[3:35:58] discussed this some of us when we do get a final documents final
[3:36:03] sign the mayor and everything if you would send it in an email but this is
[3:36:08] the final document done on this date to us and I'd like to minutes to be that
[3:36:13] way and everything that way we don't ever have not that we've had any
[3:36:16] problems you know but that way we have a something to go back to we say well this
[3:36:22] is it and then we can take that piece of paper and if it's ever a question
[3:36:25] probably never will be again but that way it takes that out of a couple
[3:36:29] punches a button and absolutely that would also serve to protect us a
[3:36:36] little bit from a meltdown of the computer system in the town hall here we
[3:36:39] would have at least part of the documents out there in the emails that's
[3:36:44] great
[3:36:50] okay
[3:36:56] well I'll make a motion that we approve the planning board rules and procedures
[3:37:02] as presented by
[3:37:06] staff and um they'd be emailed to us once they're
[3:37:12] finalized and signed off by the mayor to be effective February 9 2025 if you
[3:37:18] would exhibit
[3:37:21] any further discussion Jim
[3:37:26] ah Derek aye Jimmy uh-huh Tim all right and I am I discussion and approval of
[3:37:32] inter local
[3:37:34] agreement Guilford County contract number nine zero zero zero four nine six
[3:37:40] three American Rescue plan Act of 2021 coronavirus state and local fiscal
[3:37:46] recovery funds agreement between Guilford County and the town of
[3:37:50] Stokesdale
[3:37:52] is it go ahead Derek sir yeah sure I I added this to the agenda back in the
[3:37:59] county uh officially approved with a vote of their Board of Commissioners uh
[3:38:05] the interlocal arpa agreements you know between the town of Stokesdale Oak Ridge
[3:38:09] uh and Summerfield and this vote would be to officially enter into the
[3:38:15] interlocal agreement with Guilford County uh with the 3.1 ish million
[3:38:21] dollar uh grant that the county received through the federal government and is
[3:38:27] allocating for the town for water system improvements
[3:38:34] and this is the same document that Mr Winfrey has painstakingly reviewed
[3:38:39] great and there were revisions made
[3:38:44] not only requested by Stokesdale by other towns too we had made some changes
[3:38:48] to and the Commissioners adopted the most important those changes when
[3:38:53] back in January great
[3:38:57] I've read over this document isn't it and I'm no attorney is there any hitches
[3:39:01] that you found in this document that could that would cause us to have to uh
[3:39:06] I don't know so they put apartment buildings in or anything like that or do
[3:39:10] I'm sorry are there any hitches in the in the
[3:39:13] contract strings that could cause us to you know have to uh well we'll have to
[3:39:19] comply when we're spending this money we'll have to comply with the federal
[3:39:22] rules as it relates to Contracting so we'll have to so it's not there are some
[3:39:28] Federal requirements because you're seeing Federal money so
[3:39:32] you have to um
[3:39:34] some other somewhat ridiculous I think but you have to make sure the
[3:39:38] contractors make sure that their drivers use seat belts or everything else in the
[3:39:44] world that a federal contractor has to do but it's not like we'd have to put in
[3:39:47] public housing that's right I know that's what I'm talking about I mean
[3:39:51] there's there's nothing to pay for it there's nothing in here that's going to
[3:39:55] cause us to have to do anything with our Zone and land planting or anything like
[3:39:58] that not you see no I think we're fine so okay
[3:40:06] I don't recall that no I don't believe I saw that in here
[3:40:22] because it is federal I mean that's on the federal level right
[3:40:30] I didn't see anything right yeah I think yeah I don't recall
[3:40:36] that being in here
[3:40:38] I make a motion that we uh adopt the Guilford County contract number nine
[3:40:43] zero zero zero four nine six three American Rescue plan Act of 2021.
[3:40:50] I'll second that motion it's ready for the discussion
[3:40:55] let us rest the mayor to sign it the contract
[3:41:01] s uh
[3:41:14] okay authorized the mayor and Miss Thacker to sign it
[3:41:20] second we want to keep you all out of jail after all well I don't I want to go
[3:41:24] to Atlanta Jim uh Derek uh Jimmy uh
[3:41:30] and I am I consideration of job description of
[3:41:35] part-time administrative assistant position
[3:41:39] I've already signed off on this with Ms Martin I don't know if anyone else has
[3:41:42] had a chance to look at it
[3:41:48] yeah I'm okay with a job description and I think it's good to have a job
[3:41:53] description in place and this is something I think we need to discuss in
[3:41:56] the budget meetings and how we're going to budget if we're even going to move
[3:41:59] forward with this I see the value in doing that
[3:42:04] but all we're voting for tonight is a job description is that correct that is
[3:42:08] correct my one concern and it all that I discussed with Miss Martin was just
[3:42:13] simply to be sure that whoever we hired had the necessary skills and uh
[3:42:18] wondering how we would determine uh their qualifications based on their
[3:42:24] ability for for example the words per minute uh with their typing skills
[3:42:31] and so uh
[3:42:34] I have I would want to make sure that whoever we hire is is you know an
[3:42:40] employee at will and and there's some probationary periods wherein we could uh
[3:42:44] assess their performance and and if it wasn't uh what the town needed that we
[3:42:50] would uh uh be able to uh look for somebody else
[3:42:56] to Mr foy's point we uh uh we haven't even decided yet to uh
[3:43:03] fill this position since we're discussing that
[3:43:08] well I'm just I also agree with Tim maybe uh you know of course resume will
[3:43:12] be able to see you know real life and practical experience uh also some
[3:43:17] reference checks what need to happen
[3:43:24] any further discussion we'll call me on
[3:43:28] discuss with Mr Jones some type of typing test
[3:43:32] if we do a speed test we would have to get something offline that's right but
[3:43:38] what I'm familiar with is creating some scenarios and having someone compose
[3:43:45] some letters create some spreadsheets these are the type things that we would
[3:43:50] need somebody to help us with and so that's easily done and we can we'll be
[3:43:56] glad to do that yeah are you okay with this document is this
[3:44:02] she authored it yes you authored it so you're and I need it filled tomorrow
[3:44:06] yeah I just wanted to make sure that we got somebody that's really going to be
[3:44:11] of some help to you
[3:44:18] all right I'll make a motion we adopt the job description
[3:44:22] I'll second it for the uh Administrative Assistant I was still second
[3:44:28] Mr Rigsby aye Mr Floyd aye Mr Landry aye Mr Jones
[3:44:34] aye I am also I Council comment we got one more um two
[3:44:40] more than Tim added yeah increase the increase plan review and respect
[3:44:46] inspections I can't even read my own writing am I right Tim
[3:44:49] you know I think so Mr Mayor
[3:44:58] we we've talked about this indirectly you know several times this evening
[3:45:03] already
[3:45:05] what we are currently paying to have Hazen and Saudi review plans and conduct
[3:45:12] inspections is significantly more than the amount of in in a way of a fee we
[3:45:18] are collecting from the developer and and I think it would be appropriate
[3:45:23] to to raise these charges and do you know put those costs where they belong
[3:45:28] I don't know exactly what they should be raised to I hope maybe someone on
[3:45:34] Council has got a good idea um
[3:45:38] Miss Thacker Miss Martin do you know what we're currently charging for review
[3:45:42] of plans and they're like 400
[3:45:47] maybe somebody needs to defeat schedule real quick
[3:45:57] so anyhow I think that plan review charge has got to go way up and then I
[3:46:03] want to charge something per lineal foot to conduct the inspections
[3:46:11] it seems like we used to charge a dollar a foot I don't know why that sticks in
[3:46:16] my mind for the inspections
[3:46:32] logically
[3:46:36] did Mr Ford go to get the schedule I'm not sure where he went
[3:46:42] [Music]
[3:46:47] what do you propose when we raise it to well that's a problem I haven't done the
[3:46:51] math backwards to see what we really need to need to charge but I just know
[3:46:57] that what we're currently charging is not even beginning to cover those cost
[3:47:01] outlays for the engineers yes sir yeah well we need to it needs to be the uh
[3:47:07] you know whatever the cost per foot or whatever
[3:47:11] um well it's you know we're we're charging 400 and it's costing thousands
[3:47:16] and thousands for this process
[3:47:22] well I appreciate that
[3:47:30] bear with me I wasn't prepared for that schedule in the absence of other any
[3:47:37] other information I'm going to propose that we charge a dollar a foot for the
[3:47:41] inspection
[3:47:45] did you come back with the answer
[3:47:49] where he went actually
[3:47:56] I think they only have found it I know I've got it in one of these folders
[3:48:00] well I saw your proposal again I don't think Mr before we got to hear you he
[3:48:04] was a little message Mr Foley I want to
[3:48:07] charge a dollar a foot to conduct the inspections or per lineal foot of water
[3:48:12] main that's an easy number to obtain because it's on the the application to
[3:48:18] DEQ plan review so we know we're always going to know how many feet of water
[3:48:23] main are going into a project well it makes sense and you know when
[3:48:27] you look at uh the inspection the cash out late we're
[3:48:31] inspecting on that you know and the new subdivisions were doing I don't know I
[3:48:36] may be completely wrong but it seems like our
[3:48:39] previous charge for that was a dollar a foot Mr Jones well what specifically was
[3:48:44] your question which one plant plan review what's our charge in our schedule
[3:48:48] fees side plan review fees one thousand dollars per case plus plus one hundred
[3:48:54] dollars per 1000 square feet
[3:48:58] now this that's for zoning gross flooring yeah is that what
[3:49:03] that stoning we're talking about our water system plans
[3:49:08] it's either four or five hundred dollars they all agree
[3:49:13] that sound right
[3:49:16] up however we want to do it I mean or do we
[3:49:20] or you just want to be simple and just add a dollar a foot hundred dollars per
[3:49:23] plant we need to do I've caused the water customers
[3:49:27] 500. staff says 500. that's a good point oh that's what what's going on I'm going
[3:49:33] to I'm going to propose we we raised that to 1500 for a major subdivision and
[3:49:38] a dollar a foot linear foot for the inspection fee
[3:49:46] that's your motion yes sir where's your justification for the 50 you say it was
[3:49:50] but because we're bleeding a lot of money no no I'm not I don't want to uh
[3:49:57] I see where the dollar foot's going but I mean what's the you're going from four
[3:50:02] to fifteen hundred five to Fifteen five to fifteen hundred yeah it's a
[3:50:06] considerable amount of of work for the engineer to do the interaction between
[3:50:10] Town staff the developer and the developers Engineers uh there's a
[3:50:16] there's a lot of time expended in communication between those parties that
[3:50:20] we're paying for would it would it not make more sense to
[3:50:26] simply just pass the entire bill over to the
[3:50:30] contractor through through an agreement that says you'll be responsible for all
[3:50:35] fees related to the inspection process and that way we're not shorting
[3:50:39] ourselves or overcharging not a bad idea Mr Rick just do it but you know we have
[3:50:46] to turn it over to Mr Winfrey if we don't get the money if we get the money
[3:50:49] first then we got the money first that's a
[3:50:53] good point I don't want to charge folks I'm going
[3:50:56] to pay their way well you could do a deposit and then
[3:51:00] well due to deposit into their responsible the other issue would be
[3:51:04] with that there'd be make it difficult for you know a developer that's in
[3:51:07] business to determine what their you know their costs are going to be uh if
[3:51:12] if we just say well hey you know we're going to have this service provided and
[3:51:16] you're going to pay the bill and they're going to say well how much you think
[3:51:19] it'll be and we're going to say well we don't know but here's what the last one
[3:51:23] cost you see what I mean
[3:51:26] yeah there's no predictability though those are both good points however
[3:51:34] I don't know what could the engineering firm not tell us
[3:51:37] you know could they not look at and say okay this is going to cost you
[3:51:41] I don't know I mean I kind of think we need to get get some kind of um
[3:51:47] cost basis from the engineering firm to base this
[3:51:50] proposal off of how they base their fee to us and we should base our fee to them
[3:51:55] we're spending uh three four five thousand dollars a pop
[3:52:02] basically right I don't I don't disagree I'm just saying whatever whatever logic
[3:52:07] that the engineering firm charges we need to pass that same logic and down
[3:52:11] and and time is passing here where we're losing money progressively so this won't
[3:52:17] fix it but but I feel like it's a shot in the right direction
[3:52:23] one of the other things uh we're discussing with uh Hazen and Sawyer is
[3:52:28] is using a uh one of their vendors that does technical
[3:52:34] inspections so we would still pay Hazen and Sawyer but
[3:52:38] they would hire a subcontractor basically at a cheaper rate that would
[3:52:42] go out and do the inspection and provide us with a report and what have you so
[3:52:45] we're hoping to to cut down on some cost in that direction hadn't happened yet
[3:52:50] but you know we're hoping to get there
[3:52:56] but I guess my my question is does Hazen and Sawyer have a method to how they
[3:53:01] charge us is it by by the foot by the size of the development by the how they
[3:53:06] come up with us our charge us engineering time by the hour
[3:53:12] so and I have looked for other companies everybody out there in this business is
[3:53:20] very busy they're always happy to talk about new work with us but they'll say
[3:53:25] well you know we can't take anything else for six months eight months a year
[3:53:30] you know that's what I've experienced um
[3:53:35] I mean I called a number yeah I have no issues with Hayes and Sawyer I just
[3:53:40] they've got to have some I don't know just maybe they could
[3:53:44] advise us kind of a round number that they think would be more suitable so so
[3:53:49] we're not still shorting ourselves two thousand dollars every time
[3:53:53] maybe they could say hey you know the minimum is probably going to be around
[3:53:56] 2500. they haven't indicated a willingness to provide a quote for for
[3:54:02] each one of these subdivisions we could ask them I guess but just a round number
[3:54:08] maybe that they think is a ballpark well I I really I really don't know if it's
[3:54:12] our to our advantage to ask them to quote it because they're they're
[3:54:16] basically writing insurance so they're going to make sure they don't lose any
[3:54:19] money yeah that this
[3:54:26] let's go over this for a minute and make sure that
[3:54:32] we understand or I understand and everybody in TV World understands
[3:54:38] they uh they have an engineer that seals this right
[3:54:43] that is correct the developer hires an engineer that provides sealed drawings
[3:54:48] yes does that engineer have any
[3:54:52] responsibility yeah that's that's kind of a legal
[3:54:57] question I think but I think so but we sat Demand right there we seemed to it
[3:55:01] when we have something go wrong it doesn't seem to help that we have those
[3:55:05] sealed drawings well the engineer was worked for the
[3:55:09] person who hired him so so they have the person hired them can can come after
[3:55:14] them we can't is that what you say no we're not we're not having any privity
[3:55:18] with that right okay so they're not working for us
[3:55:28] foreign
[3:55:31] I'm open to suggestion here that's just my motion did I get a second
[3:55:36] I don't think we have a second well restates your motion yes
[3:55:42] Miss Martin would you restate my motion I'm sorry I was just going to ask you
[3:55:45] that I was switching from one doctor to the next 1500 initial fee a dollar a
[3:55:51] foot for the main
[3:55:55] it's a dollar foot for the inspection and fifteen hundred dollars to review
[3:55:59] the plan that we we review plans first ask for any necessary changes go through
[3:56:05] that process and then when the installation happens the town conducts
[3:56:09] an inspection do we have a second
[3:56:14] oh I'll second it
[3:56:19] any further discussion Jim ah Derek hi Jimmy
[3:56:26] hi Tim hi and I am also I
[3:56:31] okay uh what if I excuse me Mr Brewer I didn't add an effective date is it is it
[3:56:38] clear the tests effective immediately Mr wimpy was it stated that way
[3:56:43] yeah we'll make a motion and make it effective of me well I'll make another
[3:56:47] motion that the the two fees that we just discussed the plan and review fee
[3:56:52] of fifteen hundred dollars in system inspection of a dollar per lineal foot
[3:56:56] for water main uh will be effective after this vote immediately does that
[3:57:02] include somebody that's already in the process process yes I want we
[3:57:09] need the money if if they want to make an argument that
[3:57:14] they shouldn't pay it I you know that's a
[3:57:17] they can do that but we need the money well I understand we need the money
[3:57:23] so well but need the money because we are currently spending the money let's
[3:57:29] yeah but we're spending the money if if you want under contract if we're under
[3:57:33] contract with somebody I don't know I mean I know
[3:57:39] um and believe me I want us to get paid and
[3:57:42] and do this right but um what Mr Winfrey when does it
[3:57:48] become a contract well Mr I guess the question is did you mean that for any
[3:57:52] prospective applications that come in but the ones that are already in under
[3:57:56] the old fee schedule a lot of those fee schedules we have some in progress but I
[3:58:02] don't know what stage those are in and I don't know uh
[3:58:08] we haven't approved a a plan for any of that but I assume they
[3:58:13] would have made paid fees when they submitted the submitted the plans for
[3:58:17] review right if we have somebody that's paid already submitted I think the I
[3:58:23] mean that's I think Mr Lambert's point is valid if they've already paid the the
[3:58:27] 500 fee than they have uh escaped our our increase but would that be that
[3:58:34] that's right so I would just make it for a perspective for any new applications
[3:58:38] if they if they have a receipt then they have a receipt they don't have the
[3:58:43] receipt and they've just been talking about it then if they they haven't paid
[3:58:47] under the old regime do they pay in the new regime
[3:58:53] thank you do you need to clarify your motion no Jimmy has made a good point I
[3:58:57] think we're good
[3:59:01] Jim aye Derek aye Jimmy
[3:59:05] aye Tim aye and I'm also I I'm sorry who
[3:59:08] seconded that
[3:59:11] okay Jimmy yeah
[3:59:16] foreign
[3:59:19] he's always promised to Second everything so well yeah that's exactly
[3:59:23] right if only second and I did that's giving credit Mr Landreth I heard him
[3:59:27] yes can't Step Up second I'll do it Eric did the first one but yeah Derek the
[3:59:34] first one but all right well I seconded all right survey says we got a second
[3:59:37] all right
[3:59:44] let me do a couple of announcements the town of Stokesdale town planning board
[3:59:49] was there one more thing oh yeah well The Vault I'm sorry there was I forgot
[3:59:53] that one okay um well
[4:00:00] help me out Tim I can't read my writing again Vault Discovery week water meters
[4:00:05] I added an agenda item to discuss our our water meter Vault protection
[4:00:10] adjacent to driveways now this is related to a recent case
[4:00:16] that we we did some repairs on 68 at an address because uh
[4:00:21] ncdot cut a line and and then I think ensco came along cut a line anyway the
[4:00:27] long and the short of it is the property owner has taken out their old concrete
[4:00:31] driveway pipe and put in a new one the the new Culvert is is longer thus the
[4:00:37] width of the entrance of the driveway is longer thus it's the flare in the edge
[4:00:43] of the driveway is much closer to our meter vault
[4:00:48] I had some conversation with uh both Gene with Yates construction and Aaron
[4:00:54] Babson about this
[4:00:58] we're not sure this is covered specifically in the town specs at the
[4:01:03] moment I do remember there was a handout that came with the
[4:01:07] original installation we're in a citizen came to town hall received a
[4:01:13] diagram a wooden stake with some blue flagging on it and they followed the
[4:01:17] diagram and went out and put the wooden stake up where they wanted their meter
[4:01:21] Vault located and on that diagram it requires a
[4:01:25] certain separation from the driveway since I don't have it in hand I don't
[4:01:30] know what that is Mr Babson has suggested that three foot
[4:01:34] is uh an appropriate distance
[4:01:38] what Mr Yates has suggested it excuse me Mr Roberson Gene has suggested is that
[4:01:44] we send a notice to that property owner asking them to maintain a three foot
[4:01:50] separation between their driveway and our
[4:01:53] meter vault with some kind of stipulation that you
[4:01:58] know should they run over it with a vehicle that would be the the that cost
[4:02:04] you know the town would still fix it but that cost would be on them rather than
[4:02:08] the town uh
[4:02:10] when we have this happen usually when somebody runs over uh
[4:02:16] a vault and a meter on the side of the road it tends to be about 800 to 1200
[4:02:21] dollars for the repair just based on my fuzzy memory and so I'm
[4:02:26] trying to avoid the town having to write those kind of checks
[4:02:34] and so I would like to make a motion that we have the town staff draft the
[4:02:38] necessary letter and send it certified mail
[4:02:43] regarding this issue I'll suck at that motion
[4:02:49] any discussion if somebody
[4:02:53] I guess those are in the right of way but if if somebody runs over
[4:02:58] a vault would would
[4:03:01] um but not the homeowner's insurance
[4:03:04] take care of it and then if it was somebody that ran off the road and you
[4:03:08] knew who it was well conceivably an auto insurance claim could be made if it
[4:03:13] happened during a wreck or something like that and uh if uh if it was
[4:03:18] somebody engaged in employment for the property owner you know like a tree
[4:03:23] service maybe I would think either they could make a claim to that
[4:03:28] company or the claim that their insurance to get it repaired
[4:03:32] but you know point being that our little water Enterprise fund I shouldn't really
[4:03:37] have to have to pay for those kind of Damages I'm not they're not even going
[4:03:41] there I might be going further than what you're talking about going okay
[4:03:45] um if you were you know say you got a tractor in your
[4:03:49] mowing your yard with it you run over it and bust it would the town be
[4:03:53] responsible if it's out in the middle of the yard
[4:03:55] well these boxes are are designed to uh I think they're they're suitable for a
[4:04:02] riding lawn mower to drive over I don't know the definition of tractor could
[4:04:06] start to get heavy there but just normal residential use with with uh
[4:04:12] uh you know mowers and what have you I think they'll hold that up but they
[4:04:16] definitely they're you know definitely they're plastic Lids are just not heavy
[4:04:19] enough to hold up a truck or a car or you know anything
[4:04:24] heavy like that is they're going to break and if and if it's wet it really
[4:04:29] does make a mess
[4:04:32] what would just wanted for clarification would these letters be sent out to every
[4:04:36] new customer or who were the letters go to no this specific one I I okay
[4:04:42] refrain from mentioned in this address at the moment because I don't know what
[4:04:46] the ramifications of that might be but it's just a caution to to this
[4:04:52] particular property owner because they have widened their driveway toward
[4:04:57] the meter box the meter box I have pictures Mr Rigsby
[4:05:02] now I just wanted to just make sure we weren't going to send that out to every
[4:05:05] customer standpoint to be clear we're just
[4:05:08] talking you just want to send one letter just just one letter but but also to
[4:05:12] make counsel and staff aware of this problem and and you know so we can be
[4:05:17] proactive and and hopefully not have to address these things when you know it's
[4:05:22] raining or bad weather and somebody's run over a meter box and we have to call
[4:05:27] Yates or whomever out to repair it and our water Enterprise fund has to pay
[4:05:31] that bill we we should be trying to avoid that scenario
[4:05:37] any further discussion we have a motion and a second Jim
[4:05:42] aye Derek hi Jimmy hi Tim hi and I am also I let me do these announcements and
[4:05:49] we'll go to council comments right after the town uh town of Stokesdale town
[4:05:53] planning board will hold a meeting here in the town hall on February 21st 2023
[4:05:58] at 7 pm that is we just received word that's
[4:06:03] been canceled thank you so much no planning board meeting please disregard
[4:06:08] that first announcement the town of Stokesdale Town Council will
[4:06:13] hold regular meeting March 9th 2023 at 7 pm right here
[4:06:19] be there or be square uh Council comments
[4:06:28] I'm on full gold mine I think we've said enough tonight yep I just want to remind
[4:06:32] citizens that uh the town of Stokesdale and town of Oak Ridge we are still
[4:06:37] without representation on the school board and the school board is in my
[4:06:41] opinion acting illegally by blocking Mr Logan's appointment uh duly right
[4:06:47] appointment so it really concerns me that we remain with that representation
[4:06:51] wow two billion dollars of bond money is being decided on how it's going to be
[4:06:55] allocated because I don't see this ending well for our our schools is there
[4:07:00] anything we can do well I'm hoping some citizens you know
[4:07:06] might be as torqued up about as I am I don't know
[4:07:11] put together a resolution I mean that's about all we can do
[4:07:15] the resolution that we want some representation
[4:07:18] Summerfield need to do the same thing well representative Hurst or his
[4:07:22] proposed legislation to clarify the statute and get that through but we'll
[4:07:28] see if that happens yeah maybe we need to put an attorney on it
[4:07:38] check is oh
[4:07:44] wait that's all for me all right um the only comment I'd like to make is thank
[4:07:49] you all for sitting through this uh if you'd like to leave you're certainly
[4:07:52] welcome to we're going to go into closed session well Mr Mayor
[4:07:56] how come I never get to talk well you didn't speak up well I was waiting my
[4:08:01] turn patiently sorry uh Mr Marty adjourned it go ahead thank you Mr Mayor
[4:08:07] I'd like to Echo Mr foy's comments and concerns about our lack of
[4:08:11] representation with the school board it's just a very unfortunate set of
[4:08:18] circumstances it demonstrates a lack of respect for the minority in Northwest
[4:08:24] Guilford County in terms of numerically and uh
[4:08:29] doesn't speak well of the board when it doesn't want to be sure everybody's
[4:08:33] represented I'd also like to thank our two citizens
[4:08:37] that are still president are meeting a little bit past 11 and uh with that I'll
[4:08:44] I'll pass the devil back to Mr Mayor sorry for the interruption uh uh Public
[4:08:49] Announcement the Stokesdale Christian Church is doing a fundraiser this
[4:08:53] Saturday with uh soup and sandwiches I believe so please
[4:08:59] take part it's from five o'clock to seven o'clock on Saturday
[4:09:02] with that said we're going into closed session do I
[4:09:07] need to make a motion absolutely need to make a motion for closed session in
[4:09:11] accordance with 143 318 11.
[4:09:20] do I need to clarify that just we need to say the permitted purpose and I don't
[4:09:25] even know why we're going in closed session
[4:09:27] I'm trying to client privilege well it won't be long if we if we don't have
[4:09:30] consultation with the attorney for on legal matters okay yes that's right you
[4:09:35] had asked for that I'll second
[4:09:39] uh permitted permitted purposes its policy of the State closed session
[4:09:44] shall be held only when required to permit a public party to act in the
[4:09:48] public interest as permitted in this section the public body May hold a
[4:09:53] closed session and exclude the public only when a closed session is required
[4:09:59] clear enough
[4:10:03] for the permitted purpose of attorney-client privilege Consulting
[4:10:07] with the attorney Consulting with the attorney about a legal matter okay
[4:10:11] clarified I made the motion got a second
[4:10:15] five seconds already you second it already ah Eric aye Jimmy uh Tim hi
[4:10:25] hey
