>> We are live.
[0:09]
» All right. I'd like to call this police
and fire committee meeting together. Mr.
[0:12]
Burnside
>> here.
[0:14]
» Miss Pinglet here
>> and Mr. Bass is here.
[0:17]
» So, Mr. Bernsteag
asked me last week to bring this uh
[0:23]
committee together cuz he wants to go
over uh the ordinance that we are trying
[0:29]
to pass that was going to be in the
second reading. The one that requires a
[0:33]
uniform police officer to direct traffic
when any construction or work
[0:36]
necessities
or blocking or closing of certain
[0:40]
streets here within. I know we talked
about this that we have to revisit it
[0:43]
and we have to go over a little bit a
couple glitches here, but Mr. Burnside
[0:48]
being on the committee says he wants to
uh express some opinions and obviously
[0:53]
we could go over it now.
>> Sure.
[0:55]
» So I'm going to give the floor to you.
>> Thank you. Um first of all I don't like
[0:59]
the word mandatory in there for
everything.
[1:01]
» I agree.
>> Um I think these jobs go out to bid
[1:06]
which the price of a police officer on
is going to increase the cost of the job
[1:11]
for everybody. Um anyway, if they go out
for bid and I think the safety service
[1:17]
director should be the one to decide
whether or not we need police officers
[1:21]
on that job.
>> So that would take the mandatory out
[1:26]
leave it up to him.
>> I I couldn't agree more about the cost.
[1:29]
I think that's something it's our duty
to try to moderate as much as we can,
[1:33]
especially when you really think about
it that we're going to have a lot of
[1:35]
city projects that this is going to add
to, right? And when we blanket a whole
[1:40]
street like let's say Sexton, there's a
lot of places on Sexton that aren't
[1:43]
going to require hardly anything.
There's a lot of places on Sexton that
[1:47]
are going to require traffic control.
There's some that might require an
[1:50]
officer, too. If we identify all of
those streets that they identified, plus
[1:56]
some other ones that I kind of talked to
the mayor about that are an issue, I
[2:01]
think we can go as far as adding any
intersection. If you're working in an
[2:05]
intersection, you at least need to
consult the safety service director
[2:09]
first. And if you are in an
>> inter all the all the paving jobs, they
[2:13]
got to get basically permits
>> permits. But however,
[2:18]
I I was thinking about this in the the
terms of all of these streets, the other
[2:23]
safety concerns that we have addressed,
right? Intersection. Let's say you're
[2:27]
doing a patch on the road that's more
than 300 square feet. It's a certain
[2:32]
distance on any road. You should
probably consult with the safety service
[2:35]
director and see how he wants you to
proceed.
[2:38]
» It's not that different. When I go to
Loville, I get in touch with Joanne,
[2:43]
that is basically their safety service
director anytime I cut their road and
[2:48]
see how do you want me to proceed? How
would you like traffic control? And
[2:51]
here's what here's my plan. I was going
to shut down the northbound lane and let
[2:56]
the southbound lane flow free. Detour
around. and she'll either say that's
[3:00]
great or you're going to need something.
Uh when I deal with the county, it's the
[3:05]
same way. You know, if we're on a main
road,
[3:07]
» so you provide your own
>> correct, but it's you're going to ask
[3:10]
them, what are you going to require for
this job? Are you going to require AWP
[3:15]
to come out? Are you going to require an
officer to come out? Um so,
[3:19]
» so we don't need an officer if AWP's
there. Well, I I think the safety
[3:24]
service director, there's certain times
that might say that he would have to be
[3:28]
there as well.
>> Well, I I think that we should change
[3:31]
that to putting all of this on the
safety service director. We're just kind
[3:36]
of deeming
>> what streets and what situations.
[3:41]
Correct. If we if we can set parameters
for what situations we think you must go
[3:46]
to the safety service director for prior
to doing this, I think we've done our
[3:51]
job best we can. Cuz in all of those
scenarios, it's almost it's almost case
[3:56]
specific. Right.
>> Absolutely. So, like I said, on a street
[3:59]
like Sexton, if we're going to say every
time Sexton's cut it, you have to have
[4:03]
an officer out there or every time
there's construction, you have to have
[4:06]
an officer or you have to provide this,
you're shortsighted because there's
[4:11]
cases that we needed, there's cases that
we don't. However, if we do our job by
[4:14]
saying, "You have to go to the safety
service director anytime you're working
[4:17]
on this street and ask him
>> what's your requirements?"
[4:21]
» Correct. then we've covered ourselves
the best we can and we've given it an
[4:25]
opportunity to
basically put the least amount of cost
[4:31]
on the the construction company or on
the entity doing the work.
[4:35]
» Hopefully, it's far enough in advance
where the police officer who does it is
[4:40]
notified in time.
>> Sure. And Anthony, I'm sorry, as the
[4:43]
safety service director, he would be
able to make all of those specific. If I
[4:47]
if this is going to be a big job and
you're going to be there 10 hours, it's
[4:50]
different than if you're going to be
there one, let's let Anthony make that
[4:53]
distinction and let's also put it if
it's going to be in a a heavy area on
[4:57]
sex or heavy area the things that you do
for opera.
[5:00]
» Yes.
>> How long does it take you to do that?
[5:02]
» Sometimes a whole day.
>> So I don't think I an officer for one
[5:07]
day job.
>> Sometimes an hour. But I would say in
[5:11]
all of these case specific times, if we
just put it to Anthony to say anytime
[5:16]
you're working on these roads, anytime
you're in an intersection, set some
[5:20]
parameters. Anytime the road cut or the
construction on the road is x amount of
[5:25]
space, you're required to call Anthony
and he can make the decision of do I
[5:31]
want an officer, do I want AWP, do I
want both? I agree.
[5:35]
» Or you know what, you're only going to
be there for two hours on this street.
[5:38]
set up some cones and some traffic signs
and I'll be okay with that. Yeah,
[5:42]
» then he can actually go up and inspect
it
[5:44]
» 100%. And he you if you told Anthony the
exact address you're working at, he
[5:48]
would know the portion of the road and
know basically what you need what you're
[5:53]
doing. So that's going to make it case
specific.
[5:57]
» What do you think?
>> No, this is all sounding really good.
[6:00]
» That that's kind of the way I figure it.
And it's not that far out of realm from
[6:04]
other places that we do it. So, if we
set the streets that we we want anytime
[6:09]
you before you work here,
>> intersections, large patches, uh large
[6:15]
road work of any kind, and I think to be
honest with you, on the streets that
[6:19]
we've selected, we should expand it cuz
it just says roadway. Okay? Now, a lot
[6:24]
of times, I'll be honest, if I'm working
in the right of way, the road right
[6:28]
ofway, you know, curb, devil strip,
sidewalk, my equipment is on the road.
[6:35]
So if I'm on Poland Avenue, whether I'm
working in the road or working on the
[6:39]
rightway, I'm obstructing traffic.
>> Sure. So in we should add that instance
[6:44]
to here on those streets. And again, let
Anthony make the decision. He's going to
[6:48]
know you can get away with just the cop.
You're going to need a a zone setup, a
[6:53]
safety zone setup, and you're going to
need a flagging crew.
[6:55]
» Do you do that?
>> You check with these guys with before
[6:58]
you do your
>> I checked with Bob. No, I No, that's all
[7:02]
on us. I checked with Bob when Bob was
here every time. Um I have checked with
[7:08]
» the
>> and it works fine.
[7:10]
» Street supervisor. Yeah.
>> Um and I think that most of the
[7:13]
companies who are doing that grade or
that level of work,
[7:17]
» they know how traffic control should go.
This is just another step of saying we
[7:22]
want our safety service director to make
sure that it's safe in in each of these
[7:26]
situations. Now, I've I've always
contacted them. I mean, maybe we didn't
[7:30]
if we were on a street that seen two
cars and we were going to be there half
[7:34]
a day, but I think if we set this into
ordinance, I think this is fine. And I
[7:39]
think we if we're sending it to Anthony
and sending it to the safety service
[7:43]
director, we can broaden, like I said,
working in the Devil strip.
[7:48]
» We can broaden the number of streets
because ultimately it's going to be
[7:52]
Anthony that makes that decision. We're
just basically giving the ammunition
[7:56]
there for him to make that decision. I
agree. I think that's a good route to
[8:00]
go.
>> Y
[8:06]
» this way it's not we're not blanketing
things that you know, hey, I use Sexton
[8:10]
as the example cuz there's parts that
are fine and there's parts that are bad,
[8:13]
right? Um so if we blanket that whole
street, you're going to add cost in some
[8:18]
areas that didn't need anything. But by
putting it to Anthony, let him make that
[8:23]
decision, he can gauge where you're at.
I think there were too many different
[8:28]
situational things that came about after
this. Whether it was is this happening
[8:33]
in the middle of the night? Is this
happening during school? Is it on Elm
[8:37]
Street when it's the summertime in
school? How much cost is it going to add
[8:41]
to certain projects? Is it going to
char?
[8:47]
» Yes. But there's too many variables if
you're trying to blanket it. But if we
[8:52]
can just and I'm sorry to Anthony that
we are again putting this on his
[8:56]
shoulders but this he can handle it.
That's his job and I think he'll do fine
[9:01]
at it. I really do. His knowledge of
working with the street department for
[9:05]
that time. He's going to He knows the
streets.
[9:07]
» He knows what's going to be needed.
>> He knows the people.
[9:10]
» He does. I I think that's fine. I really
I think this is the smartest way to go
[9:14]
about it.
>> I think so, too,
[9:16]
» John.
>> So, we got to come up with a different
[9:18]
piece of legislation.
>> Yes. Yes.
[9:22]
» making making him the main guy who makes
the decision around what we have to do.
[9:26]
» And if you want to go over it, Rick,
where you know the parameters that I I
[9:30]
see as a problem or I see should be
lumped into that, we can do that.
[9:35]
» Do do you have like certain places and
and and ideas where you think we should
[9:40]
be more focused on?
>> Yeah. Oh, yeah. I mean, centers the
[9:43]
streets. Well, the streets that they
named, there's a couple extras that I
[9:48]
mean that there's a couple extras.
There's a couple extra streets. I'm sure
[9:51]
if you can't do that, you're getting
about
[9:55]
this. Yes. So, she could No problem.
>> This is going to be amended already just
[9:59]
street wise.
>> Yeah.
[10:00]
» Yeah.
>> And I think we need to get a final
[10:03]
product.
>> I do too.
[10:04]
» So, in the future, other administrators
say, "Well, we don't have to do anything
[10:07]
to this,"
>> right?
[10:08]
» You know.
>> Yeah. Well, and I agree. And the more we
[10:12]
lump in there, probably the better off
you are because again, it's just going
[10:16]
to Anthony to make the decision. We're
saying before you do any of this work,
[10:20]
you have to get in touch with Anthony
and see what he requires.
[10:24]
» Anything that's questionable, we should
put on here.
[10:27]
» Are you putting down streets?
>> Yes. Yeah.
[10:30]
» Oh, you are going to put
>> There's some in there.
[10:31]
» There's some in there now on on on B.
There's the streets, but there's I knew
[10:35]
there was there would be a few extra
ones that Dallas Street.
[10:38]
» So, we're just going to add streets. So,
you're still going to put streets on,
[10:40]
correct? Make it the whole city.
>> So, for me, we're going to add streets.
[10:44]
We're going to have the streets that
they have plus some questionable ones
[10:47]
that could have kind of went on or off.
We might as well put them on.
[10:51]
» Then I I would say you add square
footage based.
[10:54]
» Yeah. See, Anthony is going to need to
know that,
[10:57]
» you know, because how long it's going to
be and
[11:00]
» Mhm.
>> just so he knows what to delegate.
[11:03]
» Yes. And again, when we put this on
there, when I say, "Hey, if a road if
[11:07]
you're cutting the road open or you're
working in a stretch of road that's
[11:10]
longer than 300 square feet, let's just
make that anywhere in the city." I'm not
[11:14]
saying you have to get a flag. I'm not
saying any of that. I'm saying you have
[11:17]
to call Anthony if you're going to do
that and see, let him tell you what you
[11:21]
need.
>> And then whatever we pass at the end,
[11:23]
Anony's going to take care of getting
that to the companies that work in
[11:26]
shrers that we know. So they're aware,
get it to the tree companies, anybody
[11:30]
that we normally see doing business in
the city. So, us companies are there for
[11:35]
a few hours.
>> 100%. But let Anthony make that
[11:37]
decision. You know, if you're only there
for a few hours, but you're on Poland
[11:41]
Avenue by the manor,
>> it doesn't matter. You You need
[11:44]
something there. You know,
>> grant I I've I've been around so many
[11:48]
barriers, especially this past year.
>> Yes.
[11:50]
» I've never had a problem.
>> No.
[11:52]
» No. But I also think the influx of
construction that we've had in the last
[11:56]
few years, kind of exposed
>> all at one time.
[11:59]
» Yeah. Captain Hos was right. We we do
need something. I mean, we've had quite
[12:03]
a bit and it it has exposed the fact
that we could use something like that.
[12:07]
» Didn't this all come about of argument
or somebody was cuz I never heard
[12:12]
anything about that.
>> Well, there was a few accidents from
[12:14]
what he said. There was three accidents.
>> There was uh almost a fight down here.
[12:19]
» That's that's the biggie.
>> So, I mean, again, I think we're doing
[12:22]
the most responsible thing by delegating
all this and putting it to Anthony to
[12:27]
make that decision.
>> I witnessed the argument up here.
[12:30]
pulling out in front of my building. A
he was aw rather was guy was direct. He
[12:37]
was cussing at cars and swearing. What
the hell?
[12:40]
» See, now he he should have been
reported.
[12:42]
» Yeah. I've never I've never had that in.
>> I've seen it when they were had
[12:47]
» right.
>> I mean, he was
[12:48]
» because a lot of these big companies use
that company.
[12:52]
» Yeah. No, they're the company.
>> This guy won't. He could be just a bad
[12:56]
employee.
>> Maybe. I mean, we've never had an
[12:58]
experience like that. But what I would
say is you're going to get uh not an
[13:02]
even keel, but h you know, a portion of
the time you're going to call on some of
[13:05]
these streets and they're going to say
just put out uh cones and road signs and
[13:10]
you're fine. Correct.
>> A big portion you might need an officer
[13:14]
at minimum. An officer is cheaper than
AWP
[13:18]
» or you're going to need a whole zone set
up in AWP. I mean, there's there's it
[13:23]
could go a couple different routes.
Anthony will have to make that decision.
[13:26]
And we should let Anthony have a chance
to look at it and see what he might want
[13:30]
to add to it.
>> Yes.
[13:32]
» So, I think we need to do that.
>> I mean, I'll add what I kind of what I
[13:36]
think what we talked about here today.
>> Bring that to Anthony. See what he
[13:39]
thinks cuz he's going to be the one.
He's the one enforcing it, too.
[13:43]
» So, I I'll put down what I think. Mayor,
you look at it. Anthony can go over it.
[13:48]
He can add what he feels to it if
there's other areas or situations he
[13:52]
thinks should be in here that aren't
>> And that's the way it is. and and
[13:55]
that'll be fine. I mean, he is the
director of public safety here. I mean,
[14:00]
he should have that say.
>> And there's I see nothing wrong with
[14:02]
that.
>> I I agree.
[14:04]
» As many questions as there are different
situations, um something that he's been
[14:09]
stressing lately, he actually met with a
couple companies already to keep
[14:12]
consistency when it comes to how
everybody's going to be doing something.
[14:16]
So, I know these are
>> situational, but he's been
[14:19]
» talking with us and talking with these
other companies that it's going to be a
[14:23]
consistent thing. It's not going to be
this way for this one or this way for
[14:26]
this. It's going to be consistent across
the board
[14:29]
» and I'm sure fair to each company.
However, a lot of these are going to be
[14:34]
like we discussed different situations
based on where you're located. Yes.
[14:39]
Correct. All of those pictures thatffect
we have to give him uh the freedom to be
[14:45]
able to say
>> you need it here. You don't need it
[14:48]
here. And it has nothing to do with who
you are. It has to do with where this is
[14:52]
located, the time that you're going to
be working, all of those things.
[14:55]
Speaking of location,
>> like state routes now, are we going to
[14:59]
be Yeah,
>> we're still going to enforce it
[15:03]
» and we will have officers or whatnot and
it's not going to be like on county or
[15:08]
it's not going to be all
>> but that that would go be his decision
[15:11]
and it would go to bid with that includ.
[15:17]
Yeah, we still we still require we
should put that in there, too.
[15:21]
» Yeah. Yeah. I mean, even
>> that that doesn't take a car off the
[15:25]
road, does it?
>> We have a car that's available to sit
[15:28]
down.
>> We have a car that would be available,
[15:29]
but then the company would also pays $10
an hour for the use of the car.
[15:33]
» Okay.
>> So, like we had that the gas
[15:37]
» Yeah.
>> We made quite a bit of money from just
[15:40]
the car alone. So, it's a separate
invoice that we build a company.
[15:44]
» I think that's smart. And I think
honestly I think you'll probably see an
[15:49]
even keel of not needing anything on
streets where we would have required
[15:53]
something.
>> Yeah.
[15:54]
» Or just requiring a a police officer.
>> Yes. I think that's by far the smartest
[16:00]
way you guys could do it.
>> I'm okay with that.
[16:04]
» And then you you're talking u something
about pay rate or or something dollar
[16:09]
amount. Was it a minimum of four hours
or
[16:12]
» Well, that's all that's all goes through
the FOP. That has nothing to do with any
[16:16]
of us. That's all their union. So, they
have a set price
[16:19]
» for reduced
>> like not running.
[16:22]
» But I also think that
>> they have a different rate for um events
[16:27]
and they have a different rate for
traffic. So, they set their standard.
[16:31]
They have all that.
>> So, that's non-negotiable.
[16:34]
» Has nothing. That's also that I mean I I
would say in a lot of instances the
[16:38]
police are lower as far as costwise than
AWP. AWP is coming out with signs,
[16:44]
flags, multiple people, uh setting up a
zone, setting up liability. So in a lot
[16:49]
of these instances, I think it is going
to go to the police officers versus AWP
[16:54]
cuz they're not that busy,
>> which will benefit us more.
[16:57]
» Yes, I really do. I think I think out of
all of it, you might see 50% needs a
[17:02]
police officer, 30% needs AWP, 20% needs
nothing. It gives our guys work.
[17:08]
» Yes. So I I think it's all the way
around. I think it's good. I think by it
[17:11]
going to Anthony, it's still by
>> different instances, it's going to help
[17:18]
um the cost
>> because then again on areas that we
[17:22]
really don't need anything, Anthony can
deem that.
[17:25]
» Yeah.
versus us being required to put somebody
[17:28]
here because it was through legislation
when it really doesn't need anything.
[17:32]
» Got it. Well, she put it the mayor put
it in, you know, different rates for
[17:37]
events.
>> I think it'll be perfect.
[17:40]
» We'll have to come up with a new uh
ordinance and obviously now you'll take
[17:43]
a look at it, make sure everything's
right.
[17:46]
» Yeah. And with the amount of traffic
going on, I mean, like I said, I I'll
[17:49]
I'll write down what I thought here
today. I'll give it to Rick and get with
[17:53]
the mayor and the SSD
>> streets that we think
[17:56]
» the rest of the streets all of those
things and um maybe even bring it out in
[18:02]
committee next week if we have something
or uh in caucus if we have something by
[18:06]
then and and pass it after cuz there is
construction quite a bit going on coming
[18:10]
up.
>> Yes. So
[18:12]
» I'm good with that. Okay.
>> You have anything else?
[18:16]
» I'm good. Thank you.
>> All right. Um
[18:22]
motion to adjurnn.
>> Motion to adjurnn.
[18:24]
» Second.
>> Second.
[18:25]
» Motion.
Committee can call this finance and
[18:28]
legislation meeting to order. Mr.
Burnside here.
[18:31]
» Mr. Balac is absent. Mr. Bigley is here.
>> Like to excuse Mr. Carcelli who is not
[18:36]
here. And I'd like to excuse Mr. Balac
who is not here this evening.
[18:44]
Now, all I have here in front of me is
one piece
[18:48]
um that we still need to work on. This
is the uniform police officer.
[18:53]
» Yes.
>> So, let's we we've already discussed
[18:55]
that under police and fire.
[19:00]
Uh anybody have anything else for this
committee, mayor? Yes, I have um just
[19:05]
for you guys to look over that I gave to
you guys last week about the Poland
[19:10]
Village ordinance um to see if you guys
had any comments or any things that
[19:17]
is this something that you guys would
want to look at. Um, I know Anthony went
[19:22]
over this and there's a couple things
that he off the bat didn't like with the
[19:26]
$25 fine and things like there was there
was a couple different um instances on
[19:33]
here. This is obviously just an example.
We would tailor it to what
[19:37]
» sure
>> we would like to see. Um, but I think
[19:41]
just requiring helmets alone for
>> I would say under 16 because even over
[19:48]
16
>> valid I would say 16 is probably a fair
[19:52]
age. We're trusting you to drive.
>> But we have to talk about the
[19:56]
enforcement of this, what the penalty
is, how we're going to do like there.
[20:00]
This has to be kind of a large
discussion
[20:03]
» um because of what you guys all think
for this. They've been doing classes.
[20:07]
Youngsttown Brody just came up. Chief
Rody just came up um today. Youngtown is
[20:12]
holding a class, an informational class
for electric bikes and scooters. So, we
[20:19]
were talking about maybe doing
something. I know we met with Rick um a
[20:23]
couple weeks ago about rolling something
out in the beginning of the year. It's
[20:26]
kind of late now. Um
>> would the golf course fall in line with
[20:30]
this ordinance as well?
>> No, that would be complete. That would
[20:34]
be separate. Okay. Um that would be a
completely separate ordinance. But
[20:39]
that's
kind of roll out. I don't want to say
[20:42]
like a safety day, but in this early
early spring when we have the traffic
[20:47]
garden up um and do something at Mothy
whether he's going to find out who's
[20:52]
doing this informational session and
maybe they can come to us. Um I know the
[20:57]
gentleman from Wheel Bike uh down in
Youngstown, he owns the company where
[21:02]
it's the bike share where you can go to
the different and we talked about maybe
[21:05]
putting a a location here in Shrethers.
Um, it's just in the beginning
[21:10]
» like the kayak place downtown that rents
the kayaks.
[21:14]
» No, this would be a a a um at a loss for
words. I can't think of what I'm trying
[21:19]
to say. It would be a station where the
bikes are and you would go scan.
[21:24]
» Oh. Oh. Oh.
>> I can't think of the
[21:26]
» I can't think of the word I'm trying to
say, but you would take the bikes and
[21:29]
you can return them in Youngstown. You
can return them. So there's a path so
[21:33]
they could ride the electric bikes on
cuz uh State Street is a
[21:38]
» in turn the people that would come to us
would fill our racks.
[21:41]
» Yes.
>> Yeah, that's a good idea.
[21:43]
» So you can leave it all around. They
they have them everywhere else.
[21:45]
» Yeah. I mean there's not like an
employee that has to be there or
[21:48]
anything, right? You're just scanning
your car and it unlocks.
[21:50]
» They have them everywhere. We just our
downtown right now is not safe bike
[21:55]
friendly yet. Um but we're obviously
getting there. But this is something
[21:59]
we've talked maybe even rolling out some
kind of informational or educational
[22:03]
session when we do the golf courts and
carts and everything at Mothy and make
[22:07]
it kind of like a safety day there
>> that would talk about the electric
[22:11]
scooters, the electric bikes, what we
require in the city. Um, and I know
[22:16]
Chief Roddy wanted to do some kind of
our own registration for the golf carts
[22:22]
because right now you you have to have a
license on the golf cart and most of
[22:26]
those stipulations
you should have a license right now. You
[22:30]
should have a license on your golf cart.
So, I know we've been pulling people
[22:34]
over and educating them and letting them
know um because a lot of them aren't
[22:38]
aware of what's needed. So, we kind of
have to do some type of educational
[22:47]
» um
I know years ago
[22:51]
cuz my brother had one of them urban
expresses or whatever. John, this might
[22:55]
you might want to have to answer this
too. Is there a certain mile per hour
[23:00]
that these electric bicycles or
scooters, you know, if they go that that
[23:06]
fast? Um, is it necessary for them to
have a motorcycle license? Cuz I know my
[23:13]
brother had to have a motorcycle license
years ago.
[23:16]
» It's based I think it's based off the
size of the of the of the motor of the
[23:19]
bike.
>> Is that what it is?
[23:21]
» Yeah.
>> Okay.
[23:22]
» Um, but I I don't I don't know what it
is.
[23:26]
» Right. cuz like I said years ago when he
had one he had to get his motorcycle
[23:30]
license.
>> We could see what the Ohio Revis code
[23:33]
says about
>> Yeah. Maybe if we could look at the Ohio
[23:35]
Revis code on that
>> look into it let you know
[23:37]
» because if if that's the case with some
of these bikes and if they're going 25
[23:42]
miles an hour
>> is about they go about 25 miles an hour.
[23:45]
I see some moving some go fast. Yeah.
>> Then they should be on the street.
[23:51]
» Exactly. And that's what I see too. So
or at least
[23:54]
» and there's no chat
>> by the curb on the street,
[23:57]
» right?
>> That's just my question there. Maybe
[24:01]
» break the bike and
>> so it goes faster
[24:03]
» if if it is necessary for these people
if it is under the Ohio revised code for
[24:07]
them to have
>> all right
[24:08]
» a motorcycle license.
>> I appreciate it.
[24:10]
» You know what I mean? Cuz I mean it's
obvious as it says here whereas the
[24:14]
legislature state of Ohio is enacted
legislation to regulate e scooters,
[24:18]
electric bicycles, mopeds and other
assist. They're putting mopeds in here,
[24:22]
too, which is a motorized vehicle.
>> That's closer to a motorcycle, though, I
[24:26]
think.
>> Yeah.
[24:27]
» Well,
>> yeah, I guess.
[24:29]
» So, same situation. They want to put it
in the same,
[24:32]
» you know, uh,
>> there's just so many different things.
[24:35]
Like there's scooters that look like
mopeds, but they're scooters with a
[24:38]
seat.
>> I know.
[24:40]
» There it's
>> But that that's something that
[24:43]
» see what OC has. That's all.
>> Go from there.
[24:45]
» I mean, that's just something I was
thinking about as I was reading this and
[24:49]
something you could look at for me. I
appreciate it.
[24:51]
» You got it.
>> Thanks, man.
[24:52]
» Anything for you?
>> Thank you.
[24:55]
» Anything else on here you guys you want
us to look at, amend, change, alter
[25:00]
questions, comments?
>> You got anything good, Mike?
[25:03]
» What we're going to we're going to sit
and go over with the chief with Anthony
[25:09]
and then probably present something to
John and see what
[25:13]
» we don't need to have him register them,
do we?
[25:16]
» Well, what Chief Rody wants to do Oh,
not the scooters. No, the golf carts.
[25:20]
Yes.
>> Oh, yeah.
[25:21]
» Golf carts. But not the scooters.
>> I don't Unless
[25:26]
» I don't know.
>> I don't know.
[25:28]
» Unless something code says something
about
[25:31]
» if they have a motorized bike that goes
25 miles an hour.
[25:35]
» Yeah.
>> I mean, that's really I mean, you think
[25:38]
about it that that's that's a liability
on the road.
[25:40]
» Yeah.
>> For safety and everything else. I mean,
[25:43]
» but should they be riding on the road
under 16 without a driver's license?
[25:46]
» That's the thing, too. No. And how
many's going to do that?
[25:49]
» Can you imagine being on a bike and
hitting the plum crossing the road 25
[25:56]
» or hitting a bottle this big,
>> right? And you don't know where those
[26:00]
are. You know, us on the road driving
do.
[26:02]
» I think honestly with this one,
>> OC is probably going to give us more
[26:06]
information than
>> we're even talking about right now
[26:09]
because I'm sure they've seen it a
million times. Yeah.
[26:12]
» And it's going to open up a lot of
questions. I just thought when I was I
[26:15]
was watching Abby um from Poland
Village, she goes on FaceTime every time
[26:20]
she's on a meeting and I was watching
specifically about this and I just
[26:24]
thought the helmets
>> I agree.
[26:27]
» Sure. The helmets I liked that and that
it has to be buckled. It can't just
[26:31]
» cuz I I I've almost hit a few kids.
>> Okay.
[26:38]
» Okay. What we What else we got? Um I
have um Jennifer Johnson from Aqua would
[26:45]
like to attend a an executive session to
go over some things um next week and
[26:50]
she's asking that she if she can bring
um another coworker um his name is Ivan.
[26:57]
So I wanted to get permission before I
tell her not to
[27:01]
» I don't have an issue. I mean more
Listen, it's it
[27:04]
» more information the better
>> the better. Exactly. And it's kind of
[27:07]
our job to hear out any information.
Absolutely.
[27:09]
» It's going to come our way.
>> Okay.
[27:11]
» All right. No issue to me.
>> I'll get with Megan.
[27:14]
» Thanks for asking though.
>> Um
[27:19]
the only other thing I had is um Brandon
from Sixth Street is back in town and he
[27:25]
wants what exactly is there a specific
[27:31]
rock or a specific amount that council
wants him to put down? Because before he
[27:38]
goes and buys anything, I don't want to
make him spend the money.
[27:42]
» At the one man, at the one council
meeting, we council said he wanted
[27:47]
number 57. Council wanted number 57
stone put down.
[27:51]
» I mean, so the thing is the cheapest.
>> Well, it's not that it's the cheapest.
[27:55]
Grindings would be cheaper, but 57 is
going to be the cleanest and it's going
[27:59]
to give you the best drainage. So when
water gets in there, it's if you get a
[28:03]
smaller stone, it's tighter and if you
get a lot of water, it'll rush it and
[28:07]
flood it down the street or flood it
into the grass. 57 drains really well.
[28:11]
So if he uses 57 limestone,
>> it that's going to give him the best
[28:15]
overall product.
>> I'm not sure though he should do
[28:18]
anything.
>> That's my next question. What
[28:23]
» what are we doing with that? Well, it it
came up that there was a question
[28:26]
presented to me as to whether he's
allowed to use that for parking for his
[28:31]
employees. Um, that lot sits in a
residential area. My in my opinion,
[28:41]
if the landscaping business that he
operates is not permitted in that
[28:46]
residential district, nor is him using
that lot for parking of his employees.
[28:53]
He doesn't live there. It's not his
house. There's no house there. Um
[28:58]
» yeah, but the law doesn't state anything
that there has to be a house or not.
[29:02]
That doesn't really there's no
distinction.
[29:04]
» There's no difference between because it
it it came up uh it came up last week as
[29:09]
far as commercial vehicles parking in
parking in you know bringing their their
[29:14]
their cars home and parking in
residential with with res at their
[29:18]
houses,
>> right? Um and
[29:23]
um again I I I agree with you to but I'm
just trying to say that you know if he
[29:28]
he lived there he had a house there you
know I
[29:33]
» because it's not a commercial vehicle.
>> Again I didn't I didn't see anything
[29:37]
that prohibited
you from or anything any instance where
[29:44]
there had to be a house you had to live
there. I didn't see any of that in the
[29:48]
law. So, I just don't know how we're
making an interpretation on that. How
[29:53]
you got to that interpretation?
>> Well, I I told you he it's basically in
[29:56]
my in my it's he it's an accessory use
of his business. It's an extension of of
[30:02]
his business. Um it's not like he's
parking there when he goes home um at
[30:09]
night. He's park, he's using it for
employee parking, but for the
[30:13]
landscaping business being there, there
wouldn't be the need for his employees
[30:17]
to park there. So, it's if you can't all
you're trying to do is you're trying to
[30:24]
say, well, I can't park anywhere around
my com my commercial lot, so I'm going
[30:29]
to park in the residential district. But
it's all just an an extension of his of
[30:34]
his business operations.
>> Yeah. So, but there's no problem if he
[30:38]
takes uh said commercial business
vehicles home and parks them there.
[30:44]
» No, let him take them to his house and
park them there.
[30:46]
» I agree with that.
>> I agree with that. But
[30:49]
» what's going to happen is where it's not
a big deal, but they're going to go back
[30:51]
on the street, which we have
>> on the street,
[30:54]
» which we have nothing.
>> And that's the that was the initial
[30:56]
complaint.
>> The initial complaint was
[30:58]
» they were parking on the street.
>> We made them move them from the street.
[31:02]
That's a good point.
>> He moved him from the street and put him
[31:04]
here, which we deemed accept acceptable.
>> Now we're going to tell them this isn't
[31:10]
good enough. You have to put them back
on the street. We're going to be right
[31:12]
back where we started. And every bit of
this was for nothing.
[31:15]
» How many cars parked there when I went
by?
[31:18]
» I saw three.
>> I would say five or six.
[31:21]
» I real six and then there was a truck
with the name on the side.
[31:25]
» Yeah. So, here's we were talking about
we've been going round with all this. Um
[31:30]
would council I I can ask for a zoning
commission meeting and we can have the
[31:37]
public hearing and they can bring it to
a zoning the zoning commission and then
[31:41]
zoning commission can make the
recommendation to council.
[31:44]
» I agree. Council if there's a variance
that council wants to do for that then
[31:50]
» the zoning commission can write the
recommendation to the council. council
[31:53]
can decide what to do whether or not to
put a variance on or not and go from
[31:59]
there.
>> I would say the smartest way with a
[32:01]
variance
put those stipulations specifically on
[32:05]
that property and you could tell him
this is exactly what we want there.
[32:09]
» But I I do want to say something else.
Last week it kind of came to us that we
[32:15]
what we have in our ordinances as a
commercial vehicle
[32:20]
um
>> different
[32:22]
» differs from what OC excuse me the BMV
what all of those places have as a
[32:28]
commercial vehicle
>> if it comes to it in the future I think
[32:33]
we should revamp what we deem a
commercial vehicle or
[32:38]
if you look at it we only deem a
commercial vehicle something that's over
[32:42]
a one- ton dual rear wheel with a
non-factory truck bed. That's what we
[32:46]
wanted. We wanted to deem that it has to
be at least that to be considered a
[32:51]
commercial vehicle.
>> But the others are talking even cars.
[32:54]
» Correct. So, what I think we should do
if it continues in the future, we leave
[32:58]
the same stipulations. Just take the
word commercial out of it. Correct.
[33:01]
» Cuz we don't care if it's commercial in
the sense that you drive a I'm just
[33:05]
saying for instance a Lawn Ranger car.
There's no just switch commercial
[33:10]
prohibited there. Prohibited vehicle.
Correct. That's where the confusion is
[33:14]
coming.
>> And I I agree. So, but we have but again
[33:18]
we there's there would be nothing that
would require us to pass any
[33:22]
restrictions on the ability to park any
type of vehicle in a residential area.
[33:27]
We have defined in our ordinance the
vehicles that we are attempting
[33:33]
» to keep away
>> to keep away. Correct. We just so
[33:35]
happened to use the term commercial
vehicle to def to to classify what we're
[33:42]
not using the the Ohio revised code.
>> We can keep this exactly the way that we
[33:48]
enforce it right now by just taking
commercial out and and we're in the
[33:52]
right and we're doing the exact same
thing we were doing. We're just we're
[33:56]
doing it in the right.
>> I don't even think you need to do that.
[33:58]
But
>> I would say in the future if if it comes
[34:01]
up again, but I don't I don't think
we've defined the vehicle.
[34:04]
» My thing is I don't this I I say it all
the time. Hardworking town. People work
[34:09]
here. They drive work cars home from all
of the different places. I mean we
[34:13]
there's if you drive around there's a
Shelly and Sands trucks. There's Rudzik.
[34:17]
There's Bova. Uh there's a multitude of
trucks. I don't want them people to not
[34:21]
be able to take a car home. They should
be able to. And I agree that those are
[34:25]
commercial vehicles. This had nothing to
do with those people.
[34:28]
» I I understand. But that this is where
we are now. This is where it it led us
[34:33]
now. You know what I mean?
>> That wasn't your intention.
[34:37]
» But it it also Lori and I agree. But it
it exposed maybe a flaw that we have.
[34:42]
» I don't know.
>> So in the future
[34:44]
» very minor in my eyes to be honest if
it's defined. Yeah. We define what it
[34:49]
is. But what the the thing is when we
have commercial in there, we're going
[34:53]
against the what the OC deems
commercial. We're going against what the
[34:57]
BMV deems commercial.
>> We're using a word. All we're doing is
[35:00]
we're just we're using a we're not
saying that it is commercial vehicles as
[35:05]
defined by the Ohio Revised Code. We're
saying commercial vehicles for purposes
[35:08]
of our ordinances. In particular, this
particular section of our ordinance is
[35:13]
how we're defining them. Again, I I I I
get the confusion. I don't really think
[35:17]
it's that big of a deal. So, leave it
>> if it come if it comes up again and you
[35:21]
want to change the word commercial to
prohibited or commercial to
[35:25]
» not allowed vehic whatever you want to
use that that's a
[35:29]
» just as long as we have our our terms of
what we consider acceptable and not
[35:35]
acceptable.
>> Right.
[35:36]
» Correct.
>> But we don't want that con contingent on
[35:41]
if it's actually commercial or not. We
just want what we prohibit. Yes.
[35:45]
Exactly. I I if Yes.
>> You know, it's come up a couple
[35:51]
different times about lettering on a
truck. These guys, you got to keep in
[35:56]
mind, we got some carpet cleaning people
park their vehicles on. They got
[35:59]
lettering on here. Are they going to be
>> But I think Ohio Revised Code calls that
[36:03]
a commercial
>> commercial vehicle. That that was
[36:05]
brought up last week.
>> That's how we
[36:09]
put the ordinance together. We didn't
want these people that run a commercial
[36:12]
that run a carpet cleaning business.
>> No, I agree.
[36:17]
» Lumped in.
>> Listen, there's
[36:19]
» on a vehicle's 50 to me
>> is not offensive.
[36:24]
» And I promise you that there is some
probably different sections of the Ohio
[36:27]
Revised Code that use commercial
vehicles in different ways and have
[36:31]
different
I'm sure I'm I'm positive. Okay. So I
[36:35]
again I I heard I get where he was I get
where he was confus where Ray was
[36:40]
confused and what he what he was saying
but but he was missing the point though
[36:44]
is that we have it defined in our
ordinance and we're just using that as a
[36:48]
descriptive word for these vehicles
>> and that's fine. I just thought that
[36:52]
that would simplify everything at some
point if it needs simplification by
[36:57]
extracting commercial from it.
>> So John so we should take out commercial
[37:00]
and put prohibitive
>> I I wouldn't touch anything. I mean I
[37:03]
think it's fine as it is. Why pay to
change our ordinance again with that
[37:07]
company? I mean, I don't know how what
they charge us,
[37:10]
» but I I think it's fine as it it is fine
how it is. It's
[37:14]
» But we're still able to enforce it in
the way that we've been enforcing it.
[37:17]
Correct.
>> Absolutely. Okay. Here's I have a
[37:19]
question though because I after talking
with Billy because we had a bunch of
[37:22]
pictures from last week and there were
some violations that were on the yard.
[37:26]
Some of the cars that were on there are
being worked on and that we talked to
[37:30]
Chief Rody was not in violation because
they are actively being worked on. He
[37:35]
wanted me to ask if the because some of
the trailers are small trail they are
[37:42]
smaller than they are
>> if we could change instead of that have
[37:48]
the have the length of the trailer be so
long that is banned because some of
[37:52]
these trailers that they have at their
house
[37:55]
» I don't think it's all trailers correct
it's dual axle
[37:58]
» it's dual axle some of those are small
some of them are little but you go if
[38:04]
you go so long to keep a long trailer on
the road, you got to have dual axles.
[38:09]
That's why we put dual axles in.
>> Well, that and we didn't want to
[38:14]
» uh
have a guy that just has a single axle
[38:19]
trailer that pulls his lawnmower around.
We didn't want him
[38:24]
» saying. So, what So, go ahead.
>> I think Bill and I spoke with him last
[38:27]
night on this too. He wants to he wants
to put something in an order in saying
[38:31]
um nothing longer than 16 foot.
>> 16 foot is fine. I would say that's
[38:36]
» going to have a dual axle.
>> Not all not all of them, but a lot of
[38:39]
them do.
>> But some of the smaller ones for some
[38:42]
reason have the dual axle and
>> you can get a 12footer with a dual axle.
[38:46]
You can still let them have a dual axle.
>> No,
[38:50]
» no, it would just they just can't be
over a certain length over certain
[38:53]
length. If it's a trailer,
>> nothing over 16 ft long.
[39:01]
» 16 foot I would say that's fine. Nothing
lower than that. No, you you you really
[39:05]
I would say 16T is as fair as it's going
to get. You're actually probably
[39:08]
pushing,
>> you know, and everything else. They
[39:12]
can't be long. So any trailer longer
than 16 ft is
[39:17]
» it's generally though it's it's off the
deck size would be longer than 16 ft.
[39:20]
They don't take the tongue into
consideration. So,
[39:24]
» well, is that something that council
would be
[39:26]
» I I don't have a problem with that. I
would say that's fair.
[39:28]
» I I agree with that, too.
>> You probably shouldn't have anything
[39:30]
longer than 16 ft. I mean,
>> and being on the grass obviously is a
[39:34]
no. But the length
>> if he's talking to some of these people
[39:37]
and they're
>> But we are talking we're talking any
[39:40]
kind of trailers on grass.
>> No, you don't include
[39:42]
» just the deck.
>> Deck. Yeah,
[39:44]
» just the deck.
>> But any any kind of trailers be like
[39:48]
cars. Nothing on grass.
>> Correct. Oh, correct.
[39:52]
» Correct. And that's going to be for
that's only going to be for trailers
[39:56]
that are designed for hauling freight
>> uh equipment, anything like that. We're
[40:02]
not now taking campers into that.
>> Right.
[40:06]
» Right.
>> Yeah. Because campers
[40:08]
» Yeah. And they're going to be longer
than
[40:09]
» campers and boats. Am I correct on that?
>> Mhm. But they're going to be longer than
[40:12]
16t. So I would say
>> but they they're seasonal as well.
[40:15]
» They are. But I would say if we make
that uh designed for hauling freight or
[40:21]
» something like that. That's what it
reads now. Correct.
[40:24]
» I thought we were gonna put something
for campers from like April to November.
[40:27]
I thought we did. Did we do that?
>> Yeah, I thought we did.
[40:30]
» Well, with the team
>> seasonal from like end of April,
[40:35]
» end of October. Yeah.
>> For campers. I think we did
[40:38]
» a single axle, but it's 16 ft long.
>> I don't know if they ever actually put
[40:43]
that in. You start to get
>> Yeah,
[40:45]
» I think we talked about it.
>> I know we did the one Lori did one.
[40:48]
Remember we did the school bus on the
street. There was something
[40:52]
» camper on the street up on the north,
>> but none of them are permitted on the
[40:55]
street anymore. Do you remember correct?
>> No trailers aren't
[40:59]
» campers are
buses are allowed on seasonal.
[41:04]
» I remember seasonal from the end of the
end of April until we ain't been having
[41:09]
any issues with them anyway. No,
>> but somebody was living in that we were
[41:13]
thinking about doing something down at
>> campers or or the boats
[41:17]
» cash flow.
>> I thought we were coming up with boats
[41:20]
too being parked in.
>> I I I could tell you in the last few
[41:22]
years I don't think we've had one issue.
>> No, I don't think so.
[41:25]
» So I would say,
>> but I'm just wondering if we already
[41:28]
have stuff.
>> I don't know if we did or not, but I
[41:30]
remember talking about it.
>> So we're going to So we're going to
[41:33]
amend the commercial portion of that to
16 ft of that.
[41:37]
» Yeah, it's fine with me. We can bring it
for next week so you guys can look it
[41:41]
over before we do anything. That can
that's something that can go through
[41:44]
» and then we're going to leave the
ordinance as is. The only thing we're
[41:48]
going to change is the ch the trailer
part of that
[41:50]
» the deck.
>> So that's fine and design.
[41:53]
» And another thing the um the officer for
the road that portion we we could pass
[42:00]
that under emergency because this
instead of going to three readings this
[42:03]
is a safety issue. We don't want to push
out. We don't want to push it out two
[42:07]
months. That's You know what I mean? So,
let's
[42:11]
» Yeah, but I don't know what's being
changed in anyone.
[42:13]
» Yeah, we'll we'll get it together.
>> I'm going to talk I'll talk go over
[42:17]
everything.
>> But that's why I even said if we can get
[42:20]
it together for um
>> caucus
[42:23]
» caucus next week, bring it out and bring
it out in the meeting. Sooner the
[42:26]
better.
>> You have to call finance legislation and
[42:31]
talk about it.
>> No problem. Anybody else? Anything for
[42:35]
this committee?
>> I don't have anything for the committee,
[42:37]
but I just a couple updates. The splash
pad has been poured. Not opening that
[42:41]
until May. Um,
but the concrete is all done. It's
[42:47]
small, but it's there. If you guys have
a chance to go look, it's right off of
[42:52]
uh Great Field there. And Rich Craig is
in our detective's office now and doing
[42:56]
a heck of a job. He's been applying for
grants and he got he just received a
[43:01]
grant from CSX Railroad for 2500 towards
a drone.
[43:05]
» Oh, that's great.
>> Good.
[43:07]
» Yeah.
>> So, who's back there now?
[43:09]
» So, Rich Craig and Jeremy Kramer.
>> Okay.
[43:12]
» They're they're they're doing very not
that
[43:16]
» they're just
>> Yeah,
[43:17]
» we haven't had a detective. Yeah,
they're doing very well there.
[43:21]
» Good for the both of them.
>> Happy to see them there.
[43:24]
» Mhm.
>> And that's free money. So,
[43:26]
» yeah, we always like free money.
>> Anything else for this committee?
[43:30]
» Um, if anybody's listening, Saturday 8
a.m. Bed build. Anybody wants to come?
[43:37]
It's
>> fun.
[43:38]
» Scarlet will be there.
>> Brad's bringing a bunch of friends.
[43:41]
» I see. Can I bring this?
>> But yes.
[43:46]
» Okay. Motion to adjurnn.
>> Motion to adjurnn.
[43:48]
» Second. A second. Meeting adjourned.
