[4:50] used to at least till November after
[4:52] that.
[4:53] >> Okay. We'd like to welcome you to this
[4:55] Tilla City Planning Commission meeting
[4:56] here this Wednesday, March 11th, 2026 at
[4:59] the hour of 7 p.m. here in City Council
[5:01] Chambers. Uh first item on our agenda
[5:03] tonight is the Pledge of Allegiance. If
[5:05] you all please rise.
[5:09] I pledge algiance to the flag of the
[5:11] United States of America and to the
[5:14] republic for which it stands. One nation
[5:17] under God, indivisible, with liberty and
[5:20] justice for all.
[5:29] » Next item on our agenda is our roll
[5:31] call. Commissioner Hammer
[5:32] >> here.
[5:32] >> Commissioner Sloan here. Commissioner
[5:34] Proctor here.
[5:34] >> Commissioner Cordova here.
[5:35] >> Commissioner Jensen here. Commissioner
[5:37] Anderson
[5:37] >> here.
[5:38] >> Commissioner Faircloth
[5:39] >> here.
[5:39] >> And we'll please excuse commissioners uh
[5:43] Frank Lynford
[5:47] brain farted my please excuse councilman
[5:50] Hansen and Councilman Gosset sitting in
[5:52] for them. Welcome back Councilman
[5:54] McCall. Please recognize we got Chief
[5:56] Day here with us tonight. Miss Young, uh
[5:59] Miss England, Miss Mr. Agard, and Mr.
[6:01] Johnson joining us tonight. Uh number
[6:03] three on our agenda tonight is a
[6:05] recommendation on a proposed text
[6:06] amendment to Twilla City Code 7-9-2.
[6:09] This is a recreational vehicles and
[6:11] recreational vehicle parks regarding the
[6:13] accommodation of recreational vehicles
[6:15] and parking lots of nonprofit 501c3
[6:17] organizations whose purpose is to assist
[6:20] persons who are unhoused. This one has
[6:22] been tabled from February 25th, 2026
[6:24] planning commission minutes.
[6:26] >> Mr. Yeah.
[6:28] >> So, I don't have a whole lot to say
[6:29] before turning it over to Chief Day for
[6:31] his his comments, but just to remind the
[6:33] planning commission that this is the
[6:34] third meeting where we've discussed
[6:36] this. At the last meeting, you you
[6:38] tabled the meeting pending additional
[6:40] information. Uh Chief Day did make some
[6:43] edits to the the proposed ordinance and
[6:45] those edits were included in your in
[6:47] your packet. Uh the city attorney also
[6:50] made some edits and his were included in
[6:52] the packet as well with his edits being
[6:54] highlighted in blue. Uh at this point in
[6:57] time, we're we're ready for a
[6:59] recommendation one way or the other to
[7:01] get this moving on to city council. And
[7:04] hopefully these edits will address some
[7:06] of the concerns and questions the
[7:07] planning commission had. And I'll turn
[7:09] it over to Chief Dave if he has anything
[7:10] he'd like to add to that.
[7:12] >> Thank you.
[7:15] commissioners. Uh there's a
[7:17] lot of colors in these changes and uh I
[7:21] like to point out the two weeks. this is
[7:23] up for two two weeks is it and uh
[7:28] Commissioner Lynford called me and we
[7:30] talked about it and he he has a great
[7:33] proposal of uh us adding a report
[7:35] whenever there's a RV um staying
[7:40] at the facility so we can monitor two
[7:44] weeks. We don't have to uh
[7:47] um
[7:49] drive by and hope we can get the two
[7:51] weeks. They just notify us. And I've
[7:53] talked to the staff there and they're
[7:54] more than willing to do that. They're
[7:56] more than willing to move it to the
[7:59] back. I did drive back there. There is a parking lot to the north. That is the
[8:05] housing authority. The housing authority
[8:07] would let them have RVs there that's
[8:10] more out of the way. In good conscious,
[8:13] I can't recommend that. I didn't add
[8:15] that because I just I don't want them in
[8:17] the back. I want them up front where we
[8:19] can see them. My experience with those
[8:22] camping in RVs or in tents is stuff
[8:26] starts collecting when you're not seen.
[8:27] There's no cameras back there either. If
[8:30] an incident happens, the cameras in
[8:32] front will capture it.
[8:35] And uh so that there was no changes made
[8:38] to that. Our city attorney added
[8:42] >> if we monitor these if we have a report
[8:44] too with the RVs, we can monitor the 6
[8:48] months. they can't do it again for 6
[8:50] months.
[8:52] Um, that's that's a good way to monitor
[8:55] that. And I don't see why we would why
[8:58] would we would keep doing that? We'd be
[9:00] on them pretty hard if they came back.
[9:02] Why why are we doing this again? Cuz
[9:06] most of these people want to move on.
[9:08] The ones living in the RVs from my
[9:11] experience if but they could have some
[9:14] reason. and there's only two
[9:16] recreational vehicles at any given time.
[9:20] So, if there's any questions you guys
[9:22] have past that, I think that's most of
[9:24] the changes we had from last meeting.
[9:28] >> I didn't even think about that
[9:29] perspective. Out of sight, out of mind.
[9:31] Kind of make you a little nervous,
[9:32] right? And you guys going to be able to
[9:33] see it.
[9:34] >> Didn't hit me until I was driving back
[9:35] there and looking in the back and
[9:38] >> Yeah. hit me there.
[9:40] >> Perfect. Well, good. Let's bring this
[9:42] back to the commission for questions or
[9:43] comments for Chief Day.
[9:47] >> So, I do want to just clarify um we're
[9:49] looking at two spaces and not three.
[9:52] >> Correct.
[9:52] >> Okay.
[9:57] » Yes, Commissioner SL.
[9:59] >> Um I don't know if this is a question
[10:00] for you or for Mr. Johnson, but since
[10:02] it's in red, I'm gonna ask you. Um when
[10:05] last we met, the 501c3 reference had
[10:08] been taken out, and I see it is back. Is
[10:10] that on purpose or did I remember our
[10:14] last meeting wrong? I think we we kind
[10:16] of liked not having it there because it
[10:18] narrowed it even further.
[10:22] >> I don't see that addition in the latest
[10:25] one I have.
[10:26] >> Um the one I've got, we actually have
[10:28] two of the same page here. The one that
[10:30] has blue and the one that doesn't have
[10:31] blue. Um
[10:34] so it would be
[10:36] 7.9.1 is the page. Uh, it is 7.9.2-7.
[10:46] Yeah, -7.
[10:50] » I'm wondering if uh that was the
[10:52] original one. When I did the packet, I
[10:54] included the original
[10:56] >> plus two the two amended versions. So,
[10:59] you may be seeing the original version
[11:01] that has the 501c3.
[11:03] The other two versions do not have it in
[11:05] there.
[11:06] >> And that's correct.
[11:06] >> If that's confusing, I apologize. It's it's not now, but I was consume
[11:11] confused as to why we had the same page
[11:13] on there twice because it is on there
[11:14] twice, but one of them or three times, I
[11:16] should say. One of them does have the
[11:17] 51c3. So, as long as as long as that's
[11:20] not the official one, then I have less
[11:22] of a concern with it.
[11:23] >> I did I did see that one earlier, too,
[11:25] but it was specified, but even better,
[11:26] it doesn't matter. So,
[11:27] >> thank you.
[11:28] >> It's been taken out. Perfect.
[11:30] >> I think the one that between after
[11:33] attorney
[11:35] Mr. Johnson looked at it and added his
[11:37] thing into with what Chief Day got. I
[11:39] think we've finally got it.
[11:41] >> Yeah. I appreciate all the work you guys
[11:43] did and Oh, and if it fits in with what
[11:46] you guys want out of the thing, I think
[11:49] that I'm good with that, I think.
[11:50] >> And it surprised me that the staff
[11:53] there,
[11:54] they they recommended shorter time frame
[11:57] they for that. And I did see some calls
[12:01] they had made to us when people were
[12:03] living in cars in the front there and
[12:05] they were having us remove them. So, we
[12:07] seem to be on the same page.
[12:10] >> And that was a concern that I had um
[12:13] knowing that this is an emergency
[12:14] shelter and not a transitional shelter
[12:17] time frame of what we would be looking
[12:19] at. So
[12:22] >> do
[12:24] >> going back to the screening because I
[12:25] don't see where that's covered here. And
[12:27] if we're not going to have them in the
[12:29] back and we want them up front, do the
[12:31] neighbors across the street want to be
[12:32] looking at that across up front? So is
[12:37] that still an issue or or not? I think
[12:40] it is. Um, and then Commissioner Hammer
[12:44] brought up that a question regarding
[12:48] license and insured insurance on these
[12:51] RVs. Is are we not going to enforce that
[12:54] as well?
[12:56] >> No, we're not going to enforce licensing
[12:59] and registration on private property. We
[13:03] did just change code. Well, we will
[13:05] enforce that on uh on public
[13:09] rideaways and school property and city
[13:12] property, but private we don't enforce
[13:14] that. It's a it's a very good question.
[13:16] Um when they do get going,
[13:19] are they uninsured? Are they
[13:21] unregistered? That's something to deal
[13:23] with when they leave.
[13:25] But, uh if they're repairing it, I don't
[13:29] we don't have a means to site them for
[13:31] that. So, I didn't want to enforce it.
[13:33] Screening may still be a problem, but I
[13:37] don't want them screened. If we're going
[13:39] to go forward with this, I prefer them
[13:42] not hidden, not screened. And if that stops the recommendation, I'm I'm
[13:48] good with that, too.
[13:51] >> I feel like we've cut it I've cut it
[13:53] down to two weeks. I think screening is
[13:55] probably a little bit less important in
[13:58] my mind because a couple weeks is not
[14:01] too long.
[14:02] >> Yeah. And then
[14:05] back to rodents, because if if they have
[14:07] pets, they're going to have food dishes
[14:09] out.
[14:11] Um, is that not going to be covered here
[14:14] or we're going to be okay with the
[14:16] accumulation of rodents or or the
[14:20] attraction of I should say?
[14:21] >> I think it I think we can enforce that
[14:24] with uh with code if they let garbage or
[14:28] refuge, you know. Um Okay.
[14:31] Yeah, I've seen rodents in vehicles that
[14:33] are kept there for some time, but I'm
[14:35] hoping the two weeks would limit that
[14:37] also.
[14:38] >> Okay,
[14:41] » great question. It's great discussion.
[14:43] >> I don't see that you've asked for a new
[14:45] recorder anywhere.
[14:46] >> Yeah.
[14:50] » I put that in my budget request. He's
[14:52] waiting for that next week.
[14:55] >> I left with my head down.
[15:01] Perfect. Any other further questions,
[15:03] comments from the commission?
[15:08] » All right.
[15:09] >> You ready for a motion, sir?
[15:10] >> I think we're ready. We'll entertain a
[15:12] motion on this item.
[15:12] >> Chief, I appreciate all your work on
[15:14] this. I know it's certainly not a labor
[15:17] of love, but it's a labor of love for
[15:18] your community and so thank you for
[15:20] that. And also, thanks the housing
[15:23] authority and thanks for switch for for
[15:25] being so cooperative, too. So that said,
[15:28] I would move that we forward positive
[15:29] recommendation to the city council for
[15:31] recreational vehicles location and use
[15:33] amendment. The request by Tula City for
[15:35] the purpose of amending Tula City code
[15:36] 7-9-2
[15:38] recreational vehicles and recreational
[15:40] vehicle parks to limit the use of
[15:42] recreational vehicles for temporary
[15:44] housing associate only. I'm taking that
[15:46] part out for temporary housing.
[15:50] >> We got a positive recommendation from
[15:52] Commissioner Sloan. Do I have a second?
[15:53] >> I'll second that.
[15:54] >> I got two,
[15:54] >> Mr. Chairman. I want to make sure that
[15:56] it's clear. My motion does not include
[15:57] the last line of the the motion
[16:00] requiring nonprofit 510 C3
[16:02] organizations. Perfect. Positive
[16:05] recommendation from Commissioner Sloan removing the 5013C3
[16:09] aspect of it. Are you still okay with
[16:11] that? Second, Commissioner Cordova?
[16:13] >> Yes, I am.
[16:13] >> Okay. Thank you. Uh any other discussion
[16:16] before we take this to a vote?
[16:17] >> Actually, are we going to require them
[16:19] to submit a report to
[16:23] >> to the police?
[16:26] Okay, we want to include that in
[16:27] thatation or
[16:29] >> give me some verbage or make a friendly
[16:30] amendment to the motion.
[16:35] » How often of how often a submission are
[16:37] we talking about? Every time somebody
[16:38] checks in
[16:39] >> anytime there's a new
[16:41] >> I would include that with my motion.
[16:42] >> Okay. And also to include on that motion
[16:45] that they must file the report with the
[16:47] is it with you guys yourselves and
[16:49] that'll be switch point filing the
[16:50] report.
[16:51] >> Yes.
[16:51] >> Okay.
[16:52] >> Yeah. And we could put the my most
[16:55] important item is getting the VIN of the
[16:57] RV into our system so we can show that
[17:00] it's been there for the six months
[17:02] besides the two weeks and uh they're
[17:04] willing to give that information to us.
[17:07] >> Perfect. And you're okay.
[17:08] >> So, are you good with that back there in
[17:10] charge of the minutes?
[17:11] >> Okay.
[17:13] We've confused you enough.
[17:15] >> She's dealt with me long enough. She
[17:17] should be used to it by now.
[17:19] >> You guys have refined this. So, I want
[17:20] to thank you for uh making this a lot
[17:23] better than when I first started with
[17:25] it. So, I appreciate I appreciate all of
[17:27] it.
[17:27] >> Perfect. We all work together on this.
[17:29] >> Commissioner Cordova, you're you're good
[17:31] with that second still.
[17:32] >> Still good with that.
[17:33] >> Perfect. Okay, we'll take this item to a
[17:35] vote. Commissioner Hammer,
[17:36] >> I.
[17:37] >> Commissioner Sloan,
[17:37] >> hi.
[17:38] >> Commissioner Proctor,
[17:38] >> I.
[17:39] >> Commissioner Cordova,
[17:40] >> I.
[17:40] >> Commissioner Jensen,
[17:41] >> hi.
[17:41] >> Commissioner Anderson,
[17:42] >> hi.
[17:42] >> I am Chairman Hamilton. I also vote I.
[17:44] That one passes seven to zero. Good job
[17:47] on that one. Nice work, guys. Uh this
[17:49] moves us on to number four on our agenda
[17:51] tonight. This is a public hearing and a
[17:53] decision. This is a conditional use
[17:55] permit request by Suzanne Jameson
[17:57] representing Borite Enterprise to
[17:58] authorize the use of automobile sales
[18:01] and rental to occur at the property
[18:03] located at 397 North Main Street in the
[18:05] GC General Commercial Zoning District on
[18:08] 26 acres. Miss Angling.
[18:11] >> Yes, this is um on the southwest corner
[18:14] of Main Street and 400 North. Um it is
[18:19] the byite enterprise um that is planning
[18:23] on having the second location there.
[18:26] Their first location is um located right
[18:29] by city hall um where they've been for
[18:32] about 5 years now.
[18:34] Um this existing commercial property
[18:39] um it has been used for various
[18:41] commercial activities. The last one is
[18:44] an autoglass repair for repair sales and
[18:47] it's been vacant since then. Um
[18:52] the property is considered a legal
[18:55] non-conforming
[18:56] um property because it doesn't meet
[18:59] things such as setbacks, parking,
[19:02] landscaping drive approach, that type of
[19:05] thing. But Tila City code 73 allows it
[19:09] to continue to exist and operate as
[19:11] legal non-conforming. Um, as long as
[19:15] there aren't any changes to the
[19:17] structure or site. Um, the conditions of
[19:21] there are going to be a few conditions
[19:23] of approval and I'll go over those. The
[19:25] first would be sight lighting because
[19:28] there are even though it's surrounded by
[19:31] a general commercial zone, there are um
[19:34] residential neighbors right beside it.
[19:38] And so we want to just verify and make
[19:41] sure that any of the lighting stays on
[19:44] the property and does not shine on any
[19:48] of the neighboring residential
[19:49] properties. Um so that is one condition
[19:53] of approval that we as staff are
[19:55] recommending. The next one would be that
[20:00] um we make sure
[20:02] that anything like car detailing or car
[20:06] washing or you know um any kind of auto
[20:10] repair would be something that is
[20:13] ancillary like just you know changing
[20:16] out light bulbs or just maybe an
[20:18] interior detail vacuuming out the
[20:21] vehicles that type of thing. um
[20:25] unless they get, you know, the the
[20:28] proper requirements for um water rights
[20:32] and that type of thing um for the
[20:34] increases in water use. Um so another
[20:38] condition of approval would be the
[20:40] property is not going to be considered
[20:43] for an auto repair shop or car wash at
[20:45] this time and that's not what we're
[20:47] approving. and in the future they would
[20:49] need to get all of those requirements
[20:52] met if they do add that to to the um
[20:57] use. Um and then
[20:59] the the third condition of approval that
[21:02] we'd like to recommend is that uh they
[21:06] keep the one accessible um wheelchair
[21:09] accessible stall that is existing on the
[21:12] site. So, it's just right off of Main
[21:15] Street and that they have a league step
[21:19] at the very minimum um three uh off or
[21:24] off streetet parking spaces for the
[21:27] customers that come there that are in a
[21:30] convenient area on the property.
[21:34] So, just here's another view side image
[21:38] of it. There's the bay doors where they
[21:41] would probably do some of the um auto
[21:44] detailing and and that type of thing. Um
[21:48] again, here's another view. Uh and so
[21:54] just um to go over the conditions of
[21:56] approval. All new site lighting
[21:58] installed on the building shall be
[22:00] cabinetry are be designed to direct the
[22:03] light down and onto the site. The
[22:06] vehicle bays shall not be covered uh
[22:08] converted to vehicle wash bays without
[22:10] full approvals from the Tilla city and
[22:13] dedication of additional rider rights to
[22:17] satisfy the requirements of a car wash.
[22:20] And the applicant shall provide and
[22:22] maintain three designated customer
[22:24] parking stalls, including one accessible
[22:27] parking stall on the east side of the
[22:29] building in close proximity to the main
[22:32] building entrance.
[22:35] So,
[22:37] >> we'll bring this back to the commission
[22:38] for questions or comments for staff.
[22:46] » We got a public hearing. We'll let you
[22:48] guys up here in a minute.
[22:52] » Commissioner Hammer's thinking.
[22:53] >> I'm okay.
[22:54] >> We'll give you a minute.
[22:55] >> Yeah. Thanks.
[22:56] >> Anybody else?
[22:58] >> Perfect. We'll give you guys a minute.
[23:00] We'll come back to you. All right. This
[23:01] item does require a public hearing. Uh
[23:03] we will go ahead and open the public
[23:05] hearing now. If you go ahead and
[23:06] approach the podium, write your name for
[23:08] the record, state your name for the
[23:09] record.
[23:18] Uh my name is Lorine Mascarangius. I
[23:21] live um directly west of the building.
[23:24] Um so my question I have a couple of
[23:28] questions actually. Um, with the
[23:31] lighting, I understand they're supposed
[23:33] to be I read the thing and it's supposed
[23:35] to be facing to the property and then
[23:38] they're they can have some surrounding
[23:40] perimeter also facing towards the
[23:42] building.
[23:44] Um, will those be on timers because I
[23:48] have four bedrooms on that side of my
[23:50] house.
[23:52] So, that lighting is going to directly
[23:54] be affecting the bedrooms. Um, so I'm
[23:59] wondering if there are going to be
[24:00] timers on those lighting and how how how
[24:03] bright is that lighting going to be. Um,
[24:07] also
[24:09] the area around I've had issues with um
[24:13] the grassy areas. I don't know if
[24:15] they're going to continue to have that
[24:17] grass area. Um, is it going to be
[24:20] maintained as grass or is it going to be
[24:23] continued as weeds? I've had to always
[24:25] call the um the zoning commission to get
[24:29] them to not these guys but to get that
[24:32] cleaned up especially for the 4th of
[24:34] July because those weeds get tall that
[24:37] they just let it's dead. It's just dead.
[24:40] And then I I'm always concerned about
[24:42] the fireworks and everything because
[24:43] people light off fireworks aerials and
[24:45] everything. So that's my other concern
[24:48] is that area that grassy area there if
[24:53] that's going to be maintained as grass
[24:56] or will they be taking the grass out
[25:01] and it will be part of their cleaning
[25:03] area for their vehicles or
[25:07] um I think that's I think that was just
[25:09] my two main concerns about the thing.
[25:12] >> Okay. Thank you, Miss Mascar.
[25:14] >> Thank you.
[25:17] Miss Masanus, will you sign the roster
[25:19] room up here?
[25:23] » Thank you. I appreciate that.
[25:33] » May I approach?
[25:34] >> Absolutely. Come on up.
[25:36] >> My name is Wanita Talis. I live at 391
[25:39] North Main. So, right behind it. Um,
[25:42] since we have since our parking is so
[25:46] close next to the building and there's a
[25:50] bus stop right in front of it, that is
[25:52] my only worry about access with other
[25:55] people going in and coming out and
[25:57] parking right there. So, we don't have
[25:59] any accidents on hitting another vehicle
[26:02] or hitting a pedestrian. Um, those are
[26:06] my only worries. It just they've already
[26:08] asked me if they can use my parking and
[26:11] I my driveway and I told them no because
[26:17] you know anyway that's that's all I have
[26:20] to say. That's my worries about what
[26:23] could and or can happen. That's all.
[26:26] >> Thank you Miss
[26:53] Uh, my name is Kip Mner
[26:56] and I own the two uh houses just
[26:59] uh north
[27:01] on on 400. And I'm worried about all the
[27:04] parking.
[27:06] If there's no place to park in their
[27:08] lots,
[27:10] they're going to park on the streets
[27:11] front of our house. There's not enough
[27:13] room to even drive down there. We can't
[27:15] get out of our driveways.
[27:18] So, that's my biggest concern.
[27:23] Um,
[27:27] we went through this several years ago
[27:30] with uh Tetanaglass
[27:33] and they were limited to the number of
[27:35] cars they could put on the lot
[27:38] back in the day that they were there,
[27:41] which they,
[27:44] you know, they did do that. They allowed
[27:46] him 10 cars, I think, on the whole lot
[27:48] or eight cars. I can't remember. But
[27:53] I'm worried about the traffic. That's
[27:55] what I'm worried about. Can't even get
[27:56] out of our driveways
[27:58] certain hours of the day.
[28:01] So,
[28:04] I guess that's about it. I don't know.
[28:06] >> Thank you, Mr. Mayor.
[28:09] >> What do you people feel about it?
[28:11] >> You'll hear here in a minute.
[28:12] >> You guys are the planners, huh? Mhm.
[28:15] Well, we're not the planners. We're just
[28:16] the planning commission.
[28:17] >> Oh, yeah. The planner sitting behind
[28:19] you.
[28:49] Uh, hi. My name's Cameron Shemake. I
[28:51] live in the same house as Wanita Talis.
[28:54] Um, my only concerns would be the
[28:56] parking and the lighting. Um, the reason
[28:58] for the parking is because my
[28:59] grandfather's elderly and we and he has
[29:02] um therapists coming to the house on a daily basis to come help give him
[29:05] care and help him do his physical
[29:07] therapy and stuff. So, we need to have
[29:09] at least one space open, and we already
[29:11] have three cars there. And my next big
[29:14] concern is that
[29:16] um my grandpa's bedroom would face
[29:18] towards where they're going to have the
[29:20] main lighting. And so, we want to make
[29:22] sure that lighting isn't going into our
[29:24] rooms cuz that way we won't put cuz that
[29:25] way we can sleep. Other than that,
[29:27] that's all I'm really concerned about.
[29:30] >> What was your last name?
[29:31] >> Sheck.
[29:32] >> Thank you, Mr. Sheam.
[29:56] My name is Karen Mner and I live the
[29:58] same place as Kip and we have the two
[30:00] houses on the north side of 400 North.
[30:03] Um, I'd like to know about the hours of
[30:06] operation. Um, the days they're going to
[30:09] be open, how late, how early,
[30:13] um,
[30:14] and basically how many cars are they
[30:16] going to be allowed because if they're
[30:18] selling cars and there's not enough
[30:20] parking, they're going to be parking
[30:21] them on the street, which allows us not
[30:24] to be able to get out of our house. So,
[30:26] those are the couple questions I have.
[30:29] >> Thank you, Miss Miner.
[30:51] Okay, seeing no one else approach, I'll
[30:53] go ahead and close the public hearing.
[30:54] We'll bring it back to the commission
[30:55] and staff. Um, I don't know how we want
[30:58] to answer some of those questions. Miss
[30:59] England,
[31:01] >> I'm not sure if the applicant is here or
[31:03] not tonight answer questions.
[31:07] Okay.
[31:09] >> Yeah. if you want to uh I I can answer
[31:13] questions if you'd like.
[31:14] >> As many as you can, that'd be great.
[31:16] >> Sure.
[31:19] » So, I know we we've required um down
[31:22] lighting and uh of course keeping it
[31:24] away from the uh the houses, of course.
[31:27] What other things could we require on
[31:28] that?
[31:29] >> So, we could also do like a timer that
[31:33] they're only on during business hours
[31:35] or, you know, like a an hour after dark.
[31:39] so that they aren't on all night. There
[31:42] are other things that we can also do to
[31:45] mitigate the um intrusiveness of the
[31:49] lights, like we could soften it, like uh
[31:52] limiting the Celvin to like 3,000 or
[31:55] something along those lines, so it's
[31:56] more of a warmer light than a cool
[31:58] light. Um and it's not quite as bright.
[32:02] Um, so that would be more like we could
[32:05] say if you could put in lighting that
[32:08] meets more of the dark sky requirements.
[32:12] Um, we could we could add those those
[32:14] type of conditions to the approval.
[32:18] Um, as far as the safety concerns,
[32:22] I can see where they do have those
[32:24] concerns, but those are existing
[32:27] non-conforming
[32:29] with and our ordinance does allow this
[32:33] type of use, the commercial use to
[32:35] continue at this location. even with
[32:37] those non-conforming um situations
[32:41] there.
[32:43] The only thing I could say is require
[32:45] them to add signage maybe um uh to to
[32:50] tell them that they cannot block the
[32:52] neighboring uh driveways or you know
[32:55] something along those lines.
[32:58] Um
[32:59] and then as far as like any of the weeds
[33:02] are concerned,
[33:03] uh that would just be something that we
[33:05] would have to rely on code enforcement
[33:08] still. That's um because that is towards
[33:11] the back. That's not at the front of the
[33:14] building. We can't really like
[33:18] uh require them to to do landscaping and
[33:21] that type of thing there. some.
[33:23] >> But having a tenant there will
[33:25] definitely help the
[33:26] >> I'm sorry.
[33:27] >> Having a tenant there will definitely
[33:28] help the
[33:29] >> Yeah,
[33:29] >> the upkeep of it.
[33:31] >> It would definitely and there would be
[33:33] somebody that
[33:34] >> could um easily fix it if there are any
[33:38] code enforcement requirements or issues.
[33:43] So
[33:46] >> on on your photos, you had a picture uh
[33:49] on 400 North looking in there
[33:52] >> like right here.
[33:53] >> No, from 400 North the last one you're
[33:55] at. I was just wondering if there was a
[33:57] fence but which you can't see from the
[34:00] >> So there are there is some steel fencing
[34:03] but um it is not opaque.
[34:08] you know, there could be a a potential
[34:11] that you can require them to have opaque
[34:14] fencing rather than just the rod iron.
[34:19] >> Okay, that's what I was wondering if it
[34:21] was a view obscuring fence or
[34:26] » So, I did have um a couple of questions
[34:28] and I do appreciate um the question as
[34:32] far as the hours of operation because I
[34:34] was curious about that as well. And then
[34:36] just having an idea as far as foot
[34:39] traffic, do they expect to with this
[34:42] second location, is it going to be um
[34:46] providing the same services as the first
[34:48] location or is it how is that?
[34:52] >> So I know that this is going or is going
[34:55] to serve as a car dealership only. Um,
[35:00] as far as
[35:02] their hours of operation, they did not
[35:05] they didn't um submit anything along
[35:09] those lines as far as I know. Um, what
[35:12] we could do is say, you know, limit it
[35:14] to an hour after dark or, you know,
[35:18] something or, you know, during only
[35:20] normal business hours or, you know, that
[35:23] type of thing. Um,
[35:27] uh, yeah, that one would be a little
[35:29] hard without the applicant here to to
[35:33] really get down to the bottom with.
[35:36] >> Mr. Chair, I'm not sure and and staff
[35:38] can correct me if I'm wrong, that that
[35:41] stuff falls within the purview of what
[35:42] we can do on a conditional use permit.
[35:44] >> There have to be a reason to do
[35:46] >> I was just going to add that I recently
[35:48] bought a car from them and their hours
[35:50] were 8 to 6.
[35:53] So, pretty standard commercial hours
[35:56] >> and they're usually closed on Sundays.
[35:58] I'm I'm guessing from what I've seen,
[36:00] too. I've worked with them a little bit
[36:01] being in downtown. So,
[36:03] >> and they're easy to work with as well.
[36:05] So, they're they're great tenants that
[36:06] I've I've worked with them, but
[36:08] >> great questions.
[36:09] >> And again, just another question in
[36:11] regards to kind of the past. What was
[36:14] the issue? Was what was the lighting
[36:18] situation
[36:19] when there was the other two?
[36:22] >> Yeah, I I was not here for that time
[36:25] period. I don't know if Andre might know
[36:27] or or somebody else
[36:29] >> that was on the commission.
[36:33] >> Is that something that we could ask one
[36:35] of the neighbors?
[36:39] » Yeah, we can ask the neighbors
[36:41] >> commissioners. I would just add if if
[36:43] you look at this picture that's on the
[36:45] screen,
[36:46] >> it is about 3 years old. It was taken
[36:48] from Google Streets, uh the only
[36:50] lighting on the site is the lighting
[36:52] that's on the building. There is no
[36:54] standalone lighting in the in the site
[36:56] itself. So, I would anticipate that the
[36:59] lighting was just strictly limited to
[37:01] the building into the site.
[37:03] >> And I can't remember, and maybe that
[37:04] answers my own question. Uh is that is
[37:08] that lighting directed away from the
[37:10] building or is it straight down?
[37:12] Then maybe the neighbors can help.
[37:15] >> It doesn't look like there's cabinetry
[37:16] on the lighting.
[37:17] >> No,
[37:22] » so the the cabinetry part of the
[37:24] recommendation should cover
[37:26] >> a lot of that stuff.
[37:27] >> Yeah.
[37:28] >> The dark sky requirements type of thing.
[37:29] Yeah. We want the light to
[37:32] >> absolutely onto the lot rather than into
[37:34] the neighbors
[37:36] >> bedroom windows like my neighbors does.
[37:39] >> Mr. Chairman, one more question.
[37:42] >> It seems like, and this is going back,
[37:44] maybe only Commissioner Hammer might be
[37:45] the only one that remembers this, uh,
[37:47] directly to the east of this across Main
[37:49] Street, um, Bob Johnson's place. When we
[37:54] did that, one of the restrictions we did
[37:55] put in place to maybe solve some of the
[37:57] problems from a parking standpoint is we
[38:00] very, very clearly did not allow off or
[38:03] on street parking uh, in any way, shape,
[38:06] or form. Now, 400 North does not lend
[38:08] itself to that there. certainly on this
[38:09] side of the street, but people are what
[38:12] they are. But if we limit limit that
[38:15] parking to only onsite
[38:18] and
[38:18] >> I think considering there's an
[38:19] intersection right there
[38:21] at all. That's a good idea.
[38:25] » Great.
[38:28] >> Yes, Commissioner. Go ahead. With the
[38:29] size of this lot and we're requiring
[38:31] essentially three parking spots, one
[38:33] being a
[38:35] an accessible spot. How many cars can
[38:38] fit on this lot reasonably?
[38:46] I'm not seeing it being like a really
[38:48] big lot. I'm gonna see. Um,
[38:56] oh gosh, that's that's a really hard one
[38:58] to to say. We But we could also limit
[39:03] the amount of um stalls that that are
[39:08] displaying cars for sale. Yeah. Well,
[39:11] I'm just wondering if this grassy or
[39:13] weedy area ends up being part of the lot
[39:18] and we're showcasing cars there, are we
[39:22] going to leave it weeds or are we going
[39:24] to ask for
[39:26] >> that may kick in the non-conforming
[39:30] section of the ordinance where if they
[39:32] change all of that then they might have
[39:34] to bring the whole lot into compliance.
[39:37] So, I don't know if that's the direction
[39:39] they're going to want to go.
[39:42] >> So,
[39:46] » just a point of clarification.
[39:48] >> Yes.
[39:48] >> Is that okay?
[39:49] >> So, at this point, they could not park
[39:52] on this landscaped part where there's
[39:55] dirt in
[39:56] >> where? Yeah. It would not be allowed for
[39:58] them to use that as additional parking
[40:00] area because it it was not developed for
[40:04] parking and it's not part of the
[40:06] non-conforming rights of the property.
[40:10] >> Thank you.
[40:11] >> Um, one more question.
[40:13] >> Yes, Commissioner.
[40:14] >> So, the driveway approaches are quite
[40:17] large.
[40:18] >> Yes. And so I um do have questions about
[40:22] where all these for sale cars will be
[40:26] parked cuz it's three parking spots and
[40:30] a handicap spot. Is that correct?
[40:32] >> Or was it two and one?
[40:35] >> So it's one of the handicap parking
[40:38] spots and then two additional customer
[40:40] parking spots.
[40:41] >> But then I'm sorry, three more.
[40:43] >> Yeah. Okay. And they had them across the
[40:45] front. But I guess that's not the front.
[40:47] >> But that's So that's a driveway though.
[40:52] >> Okay.
[40:54] >> So they don't have Oh, sorry. I just Do
[40:57] they not have to use the driveway as a
[40:59] driveway? They could put their cars for
[41:01] sale in front of a driveway.
[41:04] >> No, there's a sidewalk that goes across
[41:06] that city right away all along there.
[41:10] >> But can you go back one um photo? Yeah.
[41:13] So, right here. Oh, no. Right there.
[41:15] >> This one.
[41:15] >> Oh, sorry. Just stay where you were.
[41:17] Sorry. It was on Christmas tree, not
[41:20] there.
[41:20] >> So, that's
[41:21] >> that's a driveway over there.
[41:23] >> Well, it's a driveway approach, but you
[41:24] got a city sidewalk that goes all the
[41:26] way across.
[41:27] >> So, I'm just saying could they
[41:29] park cars in front of a driveway? So,
[41:32] like you could park I'm saying like
[41:34] right here.
[41:35] >> Do you understand?
[41:36] >> Yeah. for for um for us to be able to
[41:40] approve it, they would have to be able
[41:41] to get in and out of the driveway safely
[41:45] or the parking lot safely. They wouldn't
[41:47] be able to block it or the sidewalks.
[41:51] They would not be able to be in the
[41:54] public rideway. Um so there would be
[41:58] some some restrictions on that. Um
[42:02] >> Chief Day's new record.
[42:03] >> Yeah. I just don't understand where all
[42:05] the cars will go. Like I'm just kind of
[42:07] confused.
[42:08] >> So just in the middle.
[42:09] >> Yep.
[42:11] >> I I'm I'm not gonna speak for the
[42:13] >> Yeah,
[42:13] >> that's where I would put them if it was
[42:14] me.
[42:15] >> Yeah, I would put them over on the west
[42:18] side on the bigger
[42:20] >> parking area. But then there's
[42:23] >> Okay.
[42:23] >> So yeah, all we're required for parking
[42:25] is what's there, which is all that
[42:27] technic required.
[42:29] >> There's some here, right?
[42:30] >> Okay. All right.
[42:34] Good questions. Good discussion.
[42:40] Any other questions or discussion?
[42:47] I think we've drilled down all of our uh
[42:50] issues that we see and try to mitigate
[42:52] those those problems as much as possible
[42:54] with
[42:55] of course the dark sky requirements. Um
[42:59] they're not allowed to park on a
[43:00] driveway. We've already figured that
[43:01] out. A parking signage would be a good
[43:03] one. No parking signs were where
[43:05] applicable. Anything else we can think
[43:07] of?
[43:08] >> Is that no parking one mean um you can't
[43:12] block resident I mean on the residential
[43:14] parking you have to park on site only?
[43:16] Is that
[43:16] >> I would hope that's common sense not to
[43:18] block it.
[43:18] >> No, I'm going to make it very specific.
[43:20] >> I would make it very specific as well.
[43:22] It's common sense. It's
[43:24] >> not all that common anymore.
[43:25] >> We see it happen all the time. I mean we
[43:26] see it happen in
[43:27] >> Thank you.
[43:28] >> residential areas as well. So
[43:29] >> Mhm.
[43:31] >> Yeah. I think that's a great condition
[43:32] to put in there to mitigate that as
[43:34] well. And then the fencing um in the
[43:38] back
[43:41] » if we wanted to.
[43:42] >> Did you close the public hearing by?
[43:44] Okay.
[43:45] >> Yes. It's all in us now. So,
[43:47] >> it's a lot of pressure. I got people I
[43:49] know out there.
[43:52] » All right. Any other uh findings of fact
[43:54] that we can mitigate?
[43:57] >> Well, Councilman McCall, go ahead.
[43:59] >> Yeah. Could I just add?
[44:01] >> Absolutely.
[44:02] >> Since you guys can um basically put it
[44:05] as a conditional use, what about the the
[44:09] lighting ju just just for the sake of
[44:12] the lighting that's there? Um they may
[44:15] want to change it out because it is a
[44:16] car dealership and most car dealerships
[44:19] they're lit, you know, so you can see
[44:20] the cars. It's part of their business profile.
[44:25] But if I'm not mistaken, you could
[44:26] probably make a conditional that they
[44:29] put lighting next to that fence by that
[44:32] lady's house that's shining away from
[44:34] her house, but onto their property, the dealership's property. That way,
[44:40] they could remove the lights on the side
[44:41] of the building that's shining in her
[44:43] direction. So, all the lights is
[44:46] pointing right at their property and
[44:48] nobody else's. I mean, I'm not saying
[44:51] they're going to do it, but you can
[44:53] suggest that they did
[44:55] >> as a as a show of good faith because
[44:57] sitting here looking at it, I I figured
[44:59] they could probably get about 15 cars in
[45:01] that in that spot.
[45:05] » No.
[45:09] » Six, seven cars.
[45:11] >> Oh, good. Good. My I was looking and I'm
[45:15] getting old, but I can't see.
[45:18] And I think our our first condition on
[45:20] the lighting specifies both of those
[45:21] things already. So we should be okay.
[45:23] >> We want the lighting off the residence.
[45:24] That's for sure. Absolutely. I like it.
[45:27] >> You can't see it, but there's also a
[45:28] dumpster right there.
[45:33] » Okay. I hate to do this to you guys, but
[45:34] we've already had our public hearing and
[45:36] I've I've got a business meeting to run
[45:38] and I've got to do it up here. So, I'd
[45:40] appreciate it if you just let me do
[45:41] that.
[45:42] >> Thank you.
[45:44] >> We understand your concerns though. I
[45:45] promise you. We're we're trying to
[45:46] mitigate them as much as possible.
[45:49] Any other conditions we can think of?
[45:51] This might be a challenging one
[45:54] >> for all of us, but I think we can get
[45:55] through it.
[45:56] >> I'd like to yell at the planning
[45:57] commission that approved this the first
[45:58] time.
[46:01] >> All right. Any other further discussion,
[46:03] questions, comments?
[46:05] >> From the commission.
[46:07] All right. I'll entertain a motion on
[46:09] this one.
[46:19] Mr. Chairman, I'm struggling with this
[46:21] one. I'm going to I'm going to make the
[46:22] motion. Um
[46:27] well, since I've got the mic, I can say
[46:28] what I want. Um but maybe for for the
[46:31] folks in the audience that need to
[46:33] understand kind of the position we're
[46:35] in. Um,
[46:38] conditional use permits
[46:41] are very, very narrowly focused in what
[46:43] we're allowed to deny.
[46:46] Um, we have to be able to uh site some
[46:50] concern that can't be mitigated,
[46:53] and I'm not sure I can do that here. I
[46:56] I've got a solution for all this stuff,
[46:58] unfortunately. Um, so I will go ahead
[47:01] and make the motion that uh we approve
[47:04] the conditional use permit request by
[47:05] Suzanne Jameson to authorize the use of
[47:08] automobile sales and rental to occur at
[47:09] the subject property application number
[47:12] 202612
[47:13] based on the findings subject to the
[47:15] conditions listed in the staff report
[47:17] dated March 5th, 2026. And I want to
[47:19] emphasize condition number one as the
[47:22] staff recommended it. All new site
[47:24] lighting installed on the building shall
[47:26] use cabinetry or be designed to direct
[47:29] the light down and into the site. That
[47:31] all site lighting installed in the site
[47:33] away from the building in the perimeter
[47:35] shall be direct. It should be at the
[47:37] perimeter of the site and directed down
[47:39] and into the site and away from the
[47:41] local residences. That we also had a
[47:43] condition um prohibiting offsite parking
[47:47] that no parking will be allowed on any
[47:49] of the streets surrounding the site. Um,
[47:53] what am I missing? Commissioner
[47:56] that the that the landscaping be can't
[47:58] do much more than just the current city
[48:00] ordinances for landscaping, but
[48:02] emphasizing that those areas need to be
[48:04] kept uh in conformance with city
[48:07] ordinance
[48:09] and that we limit the number of vehicles
[48:12] on the site to 10.
[48:17] I'm sorry, let me amend that. That's not
[48:19] customer cars, that's cars for sale to
[48:21] 10. Thank you.
[48:24] >> We want to add anything about signage.
[48:27] >> I don't know where we could put it that
[48:29] it would work. Um we we can put signs
[48:32] all day long. Uh but once they can get
[48:35] to them and read them, they're already
[48:37] there. So if you I'm perfectly happy to
[48:39] amend that motion if you've got a as you
[48:41] call it a common sense.
[48:44] >> Um if they're parking in the neighbor's
[48:46] rideway, they need to call the police
[48:49] anyway. And that's in violation because
[48:51] we've already said no offsite.
[48:53] >> Yeah. No offsite limited to 10 for sale.
[48:56] I'll second your motion as you stated.
[49:00] >> Not going to try and repeat it.
[49:02] >> No.
[49:05] >> Okay. So, we have a motion to approve
[49:07] with the following conditions added. Of
[49:09] course, a heavy heavy emphasis on the
[49:11] light pointing down and the light
[49:12] pollution uh keeping the light on the
[49:14] property and not towards the neighbors.
[49:16] Uh prohibit off-site parking. uh keep
[49:19] the landscaping maintained as per city
[49:21] code and then limit the cars on the site
[49:24] for sale to 10 vehicles. Did I get it
[49:28] all?
[49:30] >> We did. I'm sorry I wasn't paying enough
[49:31] attention. No off-site parking, right?
[49:33] >> No offsite parking. So, I was still
[49:35] trying to figure out a place to put your
[49:36] sign.
[49:37] >> I know it's hard to do. Is there a way
[49:39] that we can address just to make sure
[49:41] that um outside of business hours that
[49:45] you know the lighting is going to be on
[49:47] a timer or how
[49:50] >> I don't think we have the ability
[49:52] >> Yeah. I don't know that we have the
[49:52] ability to do
[49:54] >> Yeah.
[49:54] >> to do that within the confines of the
[49:56] conditional use.
[49:57] >> Mhm.
[49:58] >> And again the staff if I'm wrong staff
[50:02] >> save me but
[50:03] >> by directing it down and in it should
[50:05] not be an issue.
[50:06] >> Yeah. Yeah.
[50:10] All right. Yeah.
[50:11] >> And a second from Commissioner Proctor
[50:13] with all of those extra conditions as
[50:15] well.
[50:15] >> Yep. Perfect. Any discussion before we
[50:17] take this to a vote? We know this is a a
[50:20] good one. I like it.
[50:22] >> Makes us think tonight.
[50:27] » Okay, we'll take this to a roll call
[50:29] vote. Commissioner Hammer, how do you
[50:30] vote?
[50:31] >> I.
[50:31] >> Commissioner Sloan.
[50:32] >> Hi.
[50:32] >> Commissioner Proctor.
[50:33] >> I.
[50:34] >> Commissioner Cordova.
[50:34] >> Hi.
[50:35] >> Commissioner Jensen.
[50:36] >> Hi. Commissioner Anderson.
[50:37] >> I I am Chairman Hamilton. I also vote I.
[50:40] That one passes with the added
[50:41] conditions in there. And please, if
[50:43] there is somebody parking in your
[50:44] driveway, that's going to give Chief Day
[50:46] ammo to get his new record. So, call
[50:48] him. We will get them moved. Well, not
[50:51] we, but they will.
[50:53] All right. This moves us on to number
[50:54] five on our agenda tonight is our city
[50:56] council reports. Councilman McCall.
[51:00] >> Uh, good evening again. Um the only
[51:02] thing that we uh went over the last
[51:05] meeting um which you thought yours was a
[51:09] doozy tonight. We had a doozy and that
[51:13] was a proposed amendment to 12 to 12
[51:16] city code 7-4-7
[51:20] parking limitations regarding front yard
[51:23] parking and residential zoning
[51:25] districts.
[51:27] And I won't dwell into that a lot, but
[51:30] um just to let you know, we had a a
[51:32] really really good discussion on that
[51:34] one
[51:36] >> um because it basically boils down to um
[51:41] in a sense dictating what you can and
[51:44] cannot do in your yard
[51:47] in in the the broader sense. Um, and
[51:50] whether or not you can park in the front
[51:52] and how much you can park in the front,
[51:55] whether or not it needs to be paved or
[51:59] rocked and whether you can park in the
[52:01] back and how much of you can park in the
[52:03] back and when you whether or not you can
[52:04] park on the side. Um, it was an
[52:09] interesting conversation. So, you will
[52:12] be seeing that. Um, is it before it
[52:14] comes back to us, Andrew, or after?
[52:16] >> Next meeting.
[52:17] Yeah, you'll be seeing it
[52:20] and I I may come in and stand out in the
[52:23] hallway just to hear you guys since the
[52:25] other two uh council members will be
[52:27] here and I can't legally come in the
[52:29] office in the building or the room. I'll
[52:31] just stand outside the door and
[52:33] >> and listen to you guys discuss that one
[52:35] because Andrew can tell you it was a it
[52:39] was a duty and it is but unfortunately
[52:44] it is something that we have to address
[52:47] uh due to the fact that if you ride
[52:48] around town you'll see what was brought
[52:52] to the council. There's a lot of homes
[52:55] um where there are cars parked in the
[52:59] front and on the side and in the street.
[53:02] I mean, there's and Andrew could share
[53:05] it with you, but he's there's places
[53:07] where you have like eight, nine cars
[53:09] parked not literally on the grass
[53:14] um in in in yards and it's really bad
[53:17] for the neighbors.
[53:20] So, it's a problem and unfortunately
[53:22] that's part of our job is to try to
[53:24] rectify that problem.
[53:26] >> So, you will get your hands on it as
[53:28] well.
[53:29] >> Looking forward to that one. It's been a
[53:30] problem for a while. I know a few
[53:32] properties.
[53:32] >> Yeah.
[53:33] >> And just speaking of this last one, for
[53:35] example, on street parking, Fourth
[53:37] North, there's no room for it, so there
[53:39] shouldn't be happening.
[53:40] >> It's not. It it's it's one of those
[53:42] things where a lot of people are moving
[53:44] back home and um because they can't
[53:46] afford to live on their own and they're
[53:49] bringing their toys and their cars with
[53:50] them and it's no place for them to work.
[53:54] >> Affordable housing. That's what it's
[53:56] boiling down to. Huh.
[54:02] » Perfect. Thank you, Councilman McCall.
[54:04] Any questions for Councilman McCall?
[54:08] >> Thank you, sir. Thank you for coming
[54:09] tonight. We appreciate it. That moves us
[54:11] on to number six on our agenda tonight.
[54:13] It's a review and decision our February
[54:15] 25th, 2026 planning commission meeting
[54:17] and meeting minutes. Are there any
[54:19] additions or corrections to those
[54:21] minutes?
[54:23] >> I move we approve them as presented.
[54:26] >> Got a motion to approve from
[54:27] Commissioner Proctor and a second from
[54:28] Commissioner Anderson. Any discussion
[54:31] before we take it to a vote?
[54:36] » Commissioner Pro Hammer, how do you
[54:37] vote?
[54:38] >> I. Commissioner Sloan. Hi,
[54:40] >> Commissioner Proctor. Hi,
[54:41] >> Commissioner Cordova. Hi,
[54:42] >> Commissioner Jensen. Hi,
[54:43] >> Commissioner Anderson. Hi,
[54:44] >> I am Chairman Hamilton. I also vote I.
[54:46] Those minutes are passed. Moves us on to
[54:49] number seven. I'll entertain a motion.
[54:51] >> Move to approve. I mean,
[54:53] >> they are adjourned. Thank you,
[54:54] Commissioner H.
