[10:06] for having us mayor and City uh members

[10:08] of the council it's good to be here and

[10:10] thank you to the BFW and for the town of

[10:13] Pinetop Lakeside for always doing this

[10:14] annually and recognizing uh the men and

[10:17] women that serve as First Responders

[10:19] throughout the community as we were

[10:21] coming here tonight I was thinking about

[10:22] all the different deputies and police

[10:24] officers and firefighters we've honored

[10:26] over the years coming here and it's

[10:27] remarkable there truly is

[10:29] a huge amount of of true heroes that serve us each and every day and uh

[10:37] couldn't be happier to be here and to

[10:38] celebrate them today so two or three

[10:41] years ago we started uh as the Sheriff's

[10:43] Office coming to City Council meetings

[10:45] to give a brief presentation of an

[10:47] update of kind of some of the um joint

[10:50] operations or um task forces that we

[10:54] work together with the cities we know

[10:56] that Public Safety is one of the more

[10:58] expensive expensive items on each of

[11:00] your budgets it's one of your more uh

[11:02] critical items that I know the public SP

[11:05] special attention to to include roads as

[11:08] one of them as well but Public Safety is

[11:10] something that's always on the Forefront

[11:11] of each of our minds and it it does come

[11:14] at a high cost and we as Public Safety

[11:17] officials and leaders always come to uh

[11:20] Boards of Supervisors City councils

[11:22] asking for more and more and more and

[11:23] sometimes you have to have a little

[11:25] justification as to why we need that

[11:27] expensive equipment or what we're doing

[11:29] and I know that the sheriff's off office

[11:31] operates in and around and throughout

[11:34] each of our communities within this

[11:35] County and so I feel an obligation and a

[11:37] duty to report back to you as well means

[11:40] that we're operating within your city

[11:42] and we're also operating on the

[11:44] especially in Pint toop Lakeside where

[11:46] it's so checkerboard but we're also

[11:48] working with your Police Department each

[11:49] and every day trying to find ways not to

[11:52] duplicate services but to try to uh

[11:54] share resources and I see one of the big

[11:57] successes of that has been the the

[11:59] regional communication that is something

[12:01] that dates back 10 years ago that we

[12:03] tried to get accomplished and you saw

[12:05] sholo really worked there and we're kind

[12:08] of on the northern part but in part of

[12:11] our presentation I wanted to share

[12:13] tonight is how we've made a lot of

[12:15] stride in the last two years um so last

[12:19] year I came here and we talked about our

[12:21] SRT team or our joint team how we're

[12:24] working together on that we talked about

[12:25] Communications we talked about criminal

[12:27] investigations we talked about mcap

[12:29] which we're going to give an update here

[12:31] tonight and we talked about uh kind of

[12:33] joint operations with traffic

[12:35] enforcement those are kind of five areas

[12:36] that we work with your Chief um trying

[12:42] to do these things in in in

[12:44] collaboration as as a uh as law

[12:47] enforcement this year kind of some of

[12:49] our Focus that I wanted to report on

[12:52] some some uh successes where we've made

[12:56] some Headway um

[12:59] we we have looked for ways to fund a lot

[13:03] of these operations through the state or

[13:05] through different federal grants I know

[13:09] that in my opening remarks we talk about

[13:12] the cost the burden that this brings and

[13:14] you guys have so many different uh

[13:16] priorities that you're trying to weigh

[13:18] and sometimes you're not able to to to fund these at the levels that we want

[13:23] MCAT is one of those that is a it's a

[13:27] multi- agency Joint Task force it is

[13:29] proactive work and sometimes a lot of

[13:32] our Chiefs and and the sheriff's office

[13:34] we need to have deputies and officers

[13:36] doing our calls for service our first

[13:39] responder work and these these uh kind

[13:43] of these proactive task forces sometimes

[13:45] are the ones that that get staffed last

[13:48] and one of the things is we would like

[13:50] to join those task forces if there was

[13:52] funding or if there's vehicles or if

[13:53] there's things that that make it um

[13:56] appealing for us financially to join

[13:58] that that um this last year we as the

[14:03] Arizona sheriff's Association lobbied at

[14:05] the state legislature through the

[14:07] governor's office to take the Bard what

[14:10] governor Ducey started was a border

[14:11] Strike Force well with the change in

[14:13] leadership that that was kind of going

[14:15] to go away and we kind of said hey don't

[14:18] throw out the baby with the bath water

[14:20] right and so Governor Hobbs had

[14:22] reallocated those funds through the

[14:24] legislative uh process it was

[14:26] appropriation that was where all the

[14:28] counties were able

[14:29] to um essentially apply for that and so

[14:33] we did a $1 million kind of Grant

[14:35] application to receive those funds which

[14:38] would now be sent to the county to work

[14:41] and to fund mcap we used to do a lot of

[14:44] these fundings through burn Jag and

[14:46] through asset forfeiture those things

[14:48] have really changed and you're relying

[14:50] on the federal government now we're

[14:52] relying on the state and this not

[14:54] relying on the state but we're asking

[14:55] the state to help fund it with the

[14:57] opioid crisis with the f all crisis with

[14:59] the poorest border and we're seeing a

[15:00] lot of these things that have an effect

[15:02] on us you're seeing a lot of great work

[15:05] that MCAT has been doing over the years

[15:07] with their productivity and their

[15:09] production what we've been able to

[15:10] manage here locally we were able to ask

[15:13] for $1 million Grant we we expect to to

[15:16] receive that in full which those funds

[15:19] were going to be pushed each of our

[15:21] municipalities as an opportunity where

[15:23] they can put someone on the task force

[15:25] up to 75% funded and so that's a

[15:28] exciting opportunity that is essentially

[15:32] two to three times more than what we've

[15:34] done in the past and that's something

[15:36] that we as are looking to um be United

[15:40] within the county that there's there's a

[15:42] great opportunity that's going to bring

[15:43] additional services to your community um

[15:46] the next thing on our Communications

[15:48] with Pinetop Lakeside Joint Forces with

[15:50] sholo we have been working with sholo to

[15:54] make sure that we're not going in

[15:56] different directions I'm not an expert

[15:58] when it comes comes to VHF UHF LTE and

[16:00] all these things but I'm learning it as

[16:02] I'm going and we have people that speak

[16:05] those languages and we got together with

[16:08] your Chief and the City of scholo Chief

[16:10] to say if you guys move this direction

[16:12] we're going to move that direction vice

[16:14] versa that way our two centers Don't Go

[16:17] in different directions and that way

[16:19] that you as community members and

[16:21] councils don't see any um variances

[16:24] between how these operate and that when

[16:27] someone calls 91 one I don't think they

[16:29] care if it goes to Holbrook or if it

[16:31] goes to sholo or how it gets there they

[16:33] just need resources sent quickly right

[16:37] and so that's what our Focus has been in

[16:41] November the Navajo last year the Navajo

[16:44] County Sheriff's Office so part of that

[16:47] conversation I'll just step back just

[16:49] one part of that conversation was not

[16:51] only do we have these centers but we

[16:52] need to really up our infrastructure

[16:56] sites we're operating on four tower

[16:58] sites in our entire County we felt we

[17:00] need to be looking at other models of

[17:02] other counties we need to be around 15

[17:03] or 16 18 20 sites Towers repeaters uh we

[17:07] needed better uh Portables better mobils

[17:10] in our vehicles Navajo County Sheriff's

[17:13] Office applied for a Dema Grant through

[17:15] it's it's federal funds that were sent

[17:18] uh or no they're from the state that

[17:19] were sent to DEA that law enforcement

[17:21] was able to apply for we applied the

[17:23] Sheriff's Office on behalf of all uh law

[17:26] enforcement we received a $7 million

[17:28] Grant and with that Grant we have P

[17:31] we're purchasing radios for every police

[17:33] officer in this County and we're

[17:36] purchasing radio sites and and all that

[17:39] so that we are taking uh the steps

[17:42] forward with the city of sholo to ensure

[17:45] that everybody's Communication in

[17:47] everybody's vehicle fire and police and

[17:49] Sheriff's is all talking on the same

[17:52] language and uh that that is in the

[17:55] works now the grant has been awarded and

[17:57] it's this $5 million or it's a 5year $7

[18:00] million

[18:01] Grant and2 or3 million of those was

[18:04] carved out for this for uh radio

[18:08] infrastructure um next thing three or

[18:11] four years ago we talked about a gel

[18:14] District uh being implemented within

[18:16] Navajo County that has been about 5

[18:20] years that has been very

[18:24] um what' you say it's put good

[18:29] foundation and good structure to the

[18:31] future of jail operations within this

[18:33] County with that we in the last couple

[18:36] years have gone outside of just looking

[18:38] at detention costs medical costs and

[18:41] feeding inmates and just doing those

[18:43] routine mandatory obligations that we

[18:45] have we're now looking at programs that

[18:48] we're starting within the Jael to do

[18:51] actual Rehabilitation or what we're

[18:53] calling re-entry when we say re-entry

[18:55] when people leave the facility and

[18:57] re-enter Society

[18:59] these are my neighbors these are your

[19:00] neighbors they are being held

[19:02] accountable and they're being booked in

[19:03] for for crimes that they've committed

[19:05] but while they're there we're finding

[19:06] that a vast majority of these around 50%

[19:10] it's a substance mental mental illness

[19:13] or substance abuse type thing the other

[19:15] half are serious crimes that they'll

[19:17] probably end up spending DLC time but on

[19:19] those ones that are shortterm going to

[19:21] be re-entered we're looking to start two

[19:23] where we are starting two programs one

[19:26] for the this re-entry where they working

[19:29] with the prosecutor's office where they

[19:31] are going to be given um kind of

[19:34] diversion for for treatment and where

[19:38] their accountability is not dismissed

[19:41] but it's in condition with receiving

[19:44] treatment and then we're going to also

[19:46] have in inhouse or in custody uh

[19:50] substance abuse treatment that way when

[19:52] your cities and the cities within here

[19:54] book them in within ril you're going to

[19:56] get back hopefully a better better

[19:58] citizen that's going to come back and um

[20:02] with successes of not having as many

[20:04] addicted to these drugs and hopefully

[20:06] become a property owner taxpayer and

[20:09] start contributing to society so that is

[20:11] something that we're really excited

[20:13] about because of that jail district and

[20:15] that we now have that stability in there

[20:17] we now are applying for these grants

[20:19] we're seeing great strides in what we

[20:21] are uh in our jail

[20:24] operations um touched on the regional

[20:27] dispat and how that's moving along

[20:29] coming in the same direction CI criminal

[20:32] investigations you guys have had one of

[20:34] the best or not the best one of the

[20:38] most prolific um Cold Case Sol solved

[20:43] cases uh in recent history in this

[20:45] County it was remarkable work that your Police Department did you you

[20:50] should be extremely proud of that case

[20:52] that they

[20:53] did um criminal investigations is one of

[20:56] the most critical aspects I look at each

[20:59] of our our um our departments that is

[21:03] where we're handling some of the more

[21:04] serious crimes we're looking at

[21:06] 30-year-old homicides like like we that

[21:09] was dealing with here we're looking at

[21:10] crimes against children we're looking at

[21:13] um large dollar frauds we're looking at

[21:15] um suicides and all and essentially all

[21:19] death investigations that we we need to

[21:22] make sure we do it right and we don't

[21:24] make any type of mistakes um and that's

[21:27] where we as as a county have really

[21:29] worked together we have what we call the

[21:31] Navajo County homicide Task Force if we

[21:33] have a critical incident we rely on each

[21:35] of the communities or each of the cities

[21:37] to to come together to support one

[21:39] another but it gets burdensome on a lot

[21:41] of these smaller departments where

[21:43] they're like I don't have the overtime

[21:44] funds to send them there I don't have

[21:45] the training for these types of things

[21:47] and then vice versa when someone has to

[21:49] come to our community and send ler

[21:52] detective for a day or two it it's one

[21:54] of those things it's it's hard to wait

[21:56] but we always do what's what's best for

[21:57] the

[21:58] community so we had an appropriation

[22:01] that now we've just received it for the

[22:03] second year in a row we're receiving

[22:05] $120,000 each uh budget Year from the

[22:07] state to go to these region there was

[22:10] five Regional task force identified and

[22:12] Navajo County was one of them because we

[22:14] applied through it through the Sheriff's

[22:15] Office that way when we ask for your

[22:18] detectives to go to these type of

[22:20] trainings or to to work with us that we

[22:21] can help with not only the cost of the

[22:24] overtime but with the training and the

[22:26] supplies and so those are ways that

[22:29] we're looking for Solutions we're

[22:30] finding these funds in these three

[22:32] different areas that are really

[22:34] hopefully going to to make a difference

[22:37] in our in our Public Safety and our

[22:39] criminal justice going forward so with

[22:41] that I just want to give quick update on

[22:43] those five things and then we had um

[22:45] kind of our MCAT update we always do we

[22:48] try to talk about specifically of the

[22:51] type of crimes that we were working in

[22:53] and around the Pint toop Lakeside area

[22:55] and some of those statistical data is

[22:59] okay he was going to give this part of

[23:01] it but he's running late so I think you

[23:03] just may hold him in uh hold him in

[23:05] contemp for something right but I'll go

[23:07] ahead and do

[23:08] it um did it go where do I point it at

[23:13] this just try to point it at this

[23:15] computer there you go yeah okay so these

[23:18] are their 2022 annual uh statistics for

[23:22] um

[23:24] nav as you can see methamphetamine

[23:27] heroin and uh cocaine was one of the

[23:30] more surprising things but these are in either in pounds or grams of of what

[23:35] we sees you can see that fentanyl at 2.1

[23:40] million pills is the drug of choice

[23:43] throughout America in Arizona and in

[23:46] Navajo County it is it is overtaken what we're seeing being traffic what

[23:52] we're seeing on the streets um it has

[23:54] the highest level potency you've seen

[23:56] all the reports it's still

[23:58] I think it was two years ago it Arizona does a uh threat assessment

[24:04] on on the drug trafficing and and what heida um sees as as the biggest

[24:10] threats to our communities and it was

[24:13] methamphetamine held the top drug for at

[24:17] least a decade it was two years ago that

[24:18] fentanyl overcame that and it and it's

[24:21] done it with quite the force and it's

[24:22] something that we're we're certainly

[24:24] concerned about and we're continued

[24:26] because the numbers just keep Rising um everything else kind of seemed

[24:30] to have plateaued but uh cocaine had

[24:33] made a rise in the last year uh we

[24:37] conducted 68 search warrants throughout

[24:39] this is mcap which is the regional task

[24:41] force that everybody uh participates

[24:43] with and we they conducted 68 search

[24:45] warrants countywide uh during that last

[24:49] year um that was in 22 here in 23 you

[24:53] can see that the fentanyl pills went

[24:55] down by a million um lot of those lot of

[24:59] those seizures are coming on the

[25:01] interstate and

[25:04] um we we would

[25:06] attribute throughout Arizona the numbers

[25:09] were still higher but our local seizures

[25:11] just went down it's not that we're

[25:13] seeing less coming through the state we

[25:15] just uh interdicted Less on on the

[25:17] interstate and part of that would be

[25:20] that our deputies and our DET Texas

[25:22] working in this TR task force were uh

[25:25] instead of doing a lot of interdiction

[25:27] work we're doing a lot of those search

[25:28] warrants working uh working what we call

[25:31] drug trafficking organizations and

[25:32] trying to to intercept those and

[25:35] dismantle those um some of the

[25:38] comparisons have kind of kind of the

[25:40] trends stayed consistent throughout the

[25:42] years but certainly methamphetamine or

[25:46] Methamphetamine and Fentanyl is is uh

[25:49] the two highest uh

[25:52] producers um M catar compared from 2022

[25:56] to 2023 we we had

[25:58] 24 uh3 this year and or last year and

[26:02] then 20 228 the year before so you

[26:05] seeing our our arrests with this task

[26:07] force have gone

[26:09] up uh here's our agency assist broken

[26:12] down uh between each agency and as you

[26:15] can see in the pie chart uh they're

[26:17] assisting every agency uh in to include

[26:20] Apache County um as they've become truly

[26:24] one of the uh hardest hitting fastest re

[26:27] acting groups within the the White

[26:30] Mountains we're really proud of the work

[26:32] that they've done and that that each of

[26:34] these agencies rely or not rely on them

[26:37] but they depend on them and they really

[26:38] use utilize their

[26:41] services

[26:44] um why are you familiar with this this

[26:53] one

[26:56] yeah so back in April we uh had some

[27:00] information that received from some of

[27:01] our local agency

[27:03] officers

[27:05] with different subjects coming in and

[27:07] have a hotel room in the sholo area

[27:10] within that we started looking into it

[27:12] with our detectives with the assistance

[27:14] of like DPS Arizona gang task force as

[27:18] well through this mult multiple traffic

[27:30] it uh we made the 19 arrest five search

[27:33] warrants were actually served one of

[27:35] them was actually served by Phoenix Drug

[27:37] Enforcement Bureau with us on a Target

[27:40] down in the valley that all tied into

[27:41] this

[27:42] area this is also part of a couple

[27:45] people that we have actually arrested

[27:47] two to three times not just only our

[27:50] task force but shd Pine Top Lakeside

[27:52] police officers so it's one of one of

[27:54] them and we've actually just got a

[27:55] sentence in both two of the suspects

[27:58] Reed 5 years prison time out of it so

[28:00] that's been really

[28:03] good thank

[28:10] couple those yeah remember these so we

[28:14] have one detective that's actually a

[28:16] full-time Task Force officer assigned to

[28:18] Homeland Security out of Flag Staff um

[28:20] they received a lot of multiple tips

[28:22] regarding sex offenses throughout the

[28:25] state um our officers that's assigned to

[28:28] that he actually this tip came in

[28:31] and received information of a bunch of

[28:34] sexually explicit material involving a

[28:37] CH child um he called me directly we

[28:40] started working it with Homeland

[28:41] Security same day that we had the tip we

[28:44] had suspect in custody did three search

[28:47] warrants on the house two houses one on

[28:50] a vehicle was able to get the suspect in

[28:53] custody who was working at a local

[28:55] business um speaking with County

[28:58] attorneys I mean there're so far at up

[29:00] 11 counts of the exploitation uh sexual

[29:04] exploitation of a minor photographs um

[29:07] there is still information going on

[29:08] Investigation to further into this which

[29:11] could lead to more charges so basically

[29:13] our mkat team is not only just looking

[29:15] at our dope stuff if it's a major crime

[29:19] we get information on we kind of run

[29:21] with it also in August uh wisell police

[29:25] department called us and said hey we've

[29:27] got a bunch of string of burglaries in

[29:28] there air where one of them is actually

[29:30] a robbery guy walks into a Circle K just

[29:33] walks in there with a knife starts just

[29:35] loading alcohol cigarettes and walks out

[29:37] with about $4,000 worth of product um we

[29:41] was able to identify who the guy was

[29:43] which was also one of our targets we are

[29:44] looking at for some drug sales So within

[29:47] 24 hours we did a search warrant on the

[29:49] residence and recovered probably 50 to

[29:52] 60% of the property and located uh

[29:56] stolen firearm along with some some

[29:59] drugs out of it so it was a really good

[30:01] partnership with all all the agencies on

[30:03] any of these cases because part with

[30:05] just our little task force there's

[30:07] usually three s or three detectives one

[30:09] Sergeant working most of it we can't do

[30:12] it without the help of our local agency

[30:14] even the patrol officers just because of

[30:16] Manpower and the time it's been really

[30:19] beneficial thank

[30:26] you yeah this one we speaking of Jael

[30:29] operations we had an overdose you know

[30:31] fentanyl is is smuggled into everywhere

[30:34] we had a we had an individual who was

[30:37] remanded in court and was sent or was

[30:39] sent you know uh to jail and he had

[30:42] smuggled in couple pills in his shoes

[30:45] that was missed during the search he had

[30:48] transferred one to his uh cmate who

[30:52] started overdose that's why these

[30:54] deputies are recognized for their life-

[30:56] saving measures they performed CPR

[30:58] revive them but MCAT was called in to do

[31:01] an investigation to find out who he was

[31:03] who brought him in and where they did

[31:05] that with that information they were

[31:06] able to go back to the residents

[31:08] intercept a lot of gun stolen guns uh

[31:11] fent andol that was still in the home

[31:13] that led to several arrests from that so

[31:16] uh even though we took one tragic

[31:18] scenario that occurred in the jail these uh this great team was able to uh

[31:23] further that and uh bring uh several

[31:25] others that were contributing this to

[31:29] Justice um with that those are just a

[31:32] couple of the snapshots of of of the

[31:34] operations that we're doing here in

[31:36] Navajo County but of course uh open up

[31:38] to any questions if you have any if not

[33:28] the reason for the change in that um

[33:30] date is in 2022 a bill was signed that

[33:36] changed the the percentage of ballots

[33:39] that could be challenged for a recount

[33:42] from 0.1 to5 so with the increase they

[33:44] say it could take longer there's going

[33:46] to be it could possibly cause more

[33:49] recounts so in order to give them enough

[33:52] time to get the ballots counted so that

[33:55] they do count in the election they had

[33:56] to ch change it by a week this could be

[33:58] a permanent thing is what they're saying

[34:00] it's not just for the primary election

[34:02] this year it could be for the ones

[34:04] oncoming um this doesn't affect the

[34:06] general election but um there was a

[34:10] possibility that if that didn't get

[34:12] changed none of Arizona's votes would

[34:14] have counted at all so they moved that

[34:17] to July 30th um for those candidates

[34:21] that picked up petitions and had

[34:23] signatures before the change which it

[34:25] was effective on the 9th I think I said

[34:27] that but um if the petition said that

[34:30] they were signing for an August 6th

[34:32] election they're letting us go ahead and

[34:34] take those petitions because it was

[34:37] changed after that was signed by

[34:39] legislator after and then um as of the

[34:42] 9th every petition needs to state that

[34:44] the election is July 30th and they'll

[34:46] all be accepted um we have three four

[34:50] year seats um and one twoyear seat on

[34:54] this election um council member Craig

[40:06] the visual impact of a wireless

[40:08] communication facility and ancillary

[40:09] structures Evergreen plant material of a

[40:12] minimum height of 5 ft shall be planted

[40:14] adjacent to the exteria of any wall or a

[40:16] fence at least every 10 ft from Center

[40:18] to Center the community development

[40:19] director or the Planning and Zoning

[40:21] commission or in this case the board of

[40:22] adjustment May W or reduce these

[40:24] Landscaping requirements if it is deemed

[40:26] unnecessary or impracticable to provide

[40:28] necessary screen for 17106 030 f4c

[40:33] simulated branches must taper toward the

[40:35] top of the tower to give the appearance

[40:37] of a natural conically shaped evergreen

[40:39] tree the submitted Tower elevation does

[40:41] not demonstrate conformance to this

[40:42] requirement as it does not taper to give

[40:44] the appearance of a natural conically

[40:46] shaped evergreen tree but instead is a

[40:48] cylindrical shape some other things to

[40:51] consider um include General requirements

[40:54] outlined in 17106 030 F which requires

[40:57] wireless communication facilities to be

[40:59] cited and constructed preserve the

[41:01] pre-existing character surrounding

[41:02] buildings of vegetation while this site

[41:04] is neutral is immediately adjacent to

[41:06] the RV part most jurisdictions require a

[41:09] minimum of one to one setback in the

[41:11] event of catastrophic failure of a tower

[41:13] until recently we only required a fall

[41:16] zone letter the fall zone letter stated

[41:18] multiple times that it cannot guarantee

[41:20] the tower would fall within the 20ft

[41:21] fall zone radius which states which

[41:24] statements such as it will like

[41:26] do and so uh and a best attempt to meet

[41:29] the requirements given that current

[41:32] codes do not address failure mechanics

[41:34] is impossible to predict the behavior of

[41:36] a failing structure the fall zone

[41:38] require the applicant to submit

[41:40] additional information to provide

[41:41] further justification if they believe it

[41:43] is necessary or appropriate any existing

[41:46] Tower could accommodate the tower um

[41:48] excuse me an existing Tower could

[41:50] accommodate the tower within 6 t0 of a

[41:52] mile if the proposal progresses with

[41:54] approval there will be likely there is a

[41:56] likelihood that there could be three

[41:58] towers within this area including the

[41:59] existing and the proposed from Tower

[42:01] from Pine Top fire P 17

[42:04] 10608 D coordination with federal law a

[42:08] conditional use permit may be granted

[42:09] despite non-compliance with the

[42:11] provisions of this section whenever

[42:12] denial of a conditional use permit would

[42:14] unreasonably discriminate among

[42:16] providers of a functionally equivalent

[42:17] personal wireless service or prohibit or

[42:20] have the effect of prohibiting provision

[42:21] of personal Wireless services within the

[42:24] meaning of 47 United States code section

[42:27] 332

[42:29] c7b I in evaluating an application for a

[42:32] conditional use permit no consideration

[42:34] shall be given to the environmental

[42:36] effects of radio frequency emissions to

[42:38] the extent that such emissions follow

[42:40] the regulations of the Federal

[42:41] Communications commissions as provided

[42:43] in 47 United States code section 332 C7

[42:48] B4 for an annalysis have provided for

[42:51] the board of adjustment the following

[42:52] the applicant vertical Bridge request to

[42:54] have a conditional use permit issued for

[42:56] a cell tower on August 24th 2023 the

[42:59] Planning and Zoning commission

[43:00] unanimously six to nothing denied the

[43:03] issuance of the conditional use permit

[43:04] the reasons for the denial are as

[43:06] follows the applicant failed to provide

[43:08] engineering report sealed by a licensed

[43:10] structural engineer for

[43:14] 17167 1cd the applicant failed to show

[43:18] all preferred sites where the tower

[43:19] could be cited P 17106

[43:22] 7b1 the applicant failed to provide

[43:25] written explanation of why they did not

[43:26] select a preferred site including their

[43:28] best efforts made to secure each of the

[43:30] preferred sites why such efforts were

[43:32] unsuccessful and why each of the

[43:34] preferred sites is not technically or

[43:35] legally feasible for 17106 70b do3 the

[43:40] applicant proposed Tech lights on the

[43:41] tower for installing new apperances

[43:43] however no artificial lighting of

[43:45] wireless communication facilities is

[43:46] permitted unless such artificial

[43:48] lighting is required by the FAA or the

[43:51] FCC or another state or federal agency

[43:53] of competent jurisdiction or NE or

[43:55] necessary for security such lighting

[43:57] shall comply with the lighting

[43:58] regulations found in section 17141 100

[44:02] the applicant failed to locate the

[44:04] wireless communication facility away

[44:05] from residential neighborhoods whenever

[44:07] feasible per 17106 do10

[44:10] B while the applicant proposes to

[44:13] camouflage the site the camouflage must

[44:14] taper toward the top and the tower shall

[44:16] be painted to emulate a natural tree

[44:19] trunk per

[44:20] 17163 F4 CND D and finally uh under the

[44:25] effective or orance

[44:27] 24468 the tower would require 225 ft

[44:31] setback per

[44:33] 17164 two for my recommendations I

[44:36] provide the following staff recommends

[44:38] denying the cup for the following

[44:40] reasons proposed Tower's height is 180

[44:43] ft a maximum height of 75 ft is

[44:45] allowable and in no case greater than 95

[44:47] ft in the site designated as

[44:49] neutral applicant must submit evidence

[44:51] of meeting the requirements established

[44:53] was within 17106 70 B3 regarding contact

[44:57] with all other Tower providers and

[44:59] Property Owners within preferred sites

[45:01] the applicant failed to submit a fall

[45:03] zone letter that exemplifies confidence

[45:05] that the tower would not harm residents

[45:07] in the RV Park in the event of a

[45:09] catastrophic failure the applicant

[45:11] failed to locate the side away from the

[45:13] residential neighborhood for 17106 10B

[45:16] the applicant should have considered the

[45:17] requirements outlined in 17106 30f

[45:20] requiring Wireless communication

[45:22] facilities to be cited and constructed

[45:24] to preserve the pre-existing character

[45:25] of the surrounding buildings and

[45:26] vegetation while this is a neutral uh

[45:29] site it is immediately adjacent to an RV

[45:31] park a landscaping plan conforming with

[45:34] 17130 F4 still needs to be submitted

[45:37] Tech lighting does not me meet the

[45:39] requirements established within 17141

[45:41] 100 and 17106 030 D the effective

[45:45] setbacks cannot be met at the site per

[45:47] 17106

[45:49] 42 if the board of adjustment chooses to

[45:51] uphold denial the motion must contain

[45:53] the reasons for the denial which shall

[45:55] be supported by substantial evidence in

[45:57] the written

[46:52] whenever there thank you um so today

[46:55] we're we going to be going over the new

[46:57] proposed Wireless facility on behalf of

[46:59] vertical Bridge the site name is usaz

[47:02] 5121 this is cup

[47:06] 133 so the proposed Wireless facility

[47:09] will be located on parcel

[47:11] 41143

[47:13] 008a um and as mentioned by staff it's

[47:17] on a parcel Zone

[47:19] C1 it will be designed as a monopine to

[47:21] blend in with the surrounding pine trees

[47:23] in the area and will be located within a

[47:26] 43x 37 ft enclosure surrounded by an 8T

[47:30] High chain link fence compound the

[47:32] overall height of the tower will be 180

[47:35] ft which will allow for collocation and

[47:37] may include multiple antennas as shown

[47:40] on a later slide with the elevations and

[47:42] we did design the Tower with a 20ft fall

[47:45] radius to contain debris on

[47:47] site so here is just a an aerial view of

[47:51] the overall site plan as you can see

[47:54] that square that's on the screen there

[47:56] that just shows where the tower is in

[47:58] proximity to the parcel

[48:01] lines here is an enlarged site plan this

[48:05] shows the 10x15 concrete pad for

[48:07] Associated ground equipment the 4x9

[48:09] concrete pad for the Emergency backup

[48:11] generator and um it we would like to

[48:14] note for the record that emergency

[48:16] backup generators will cycle once per

[48:17] week for a total of 15 minutes and omit

[48:21] a noise of around 70 to 90 DB which is

[48:24] about the equivalent of a car are

[48:25] passing

[48:27] by so on the screen here you can see the

[48:30] elevations of the tower um the initial

[48:34] anchor tenant would be installed at that

[48:36] top there you can see that um and that

[48:39] is just the rad is basically the center

[48:42] of antennas where it will be installed

[48:45] on the tower let me go ahead and pull

[48:47] those up here so T-Mobile is the initial

[48:50] inchor tenant uh they will be installed

[48:52] at a rout of 171 ft the second Co cator

[48:56] would be installed at a rout of 159 ft

[48:59] and the third collator would be

[49:01] installed at a rout of 147

[49:04] ft there's additional views of the

[49:06] elevation of the

[49:09] Tower so stealth designs um per the Pine

[49:12] Top code it encourages stealth designs

[49:16] to blend in with the surrounding area um

[49:18] as such vertical Bridge decided that a

[49:21] monopine would best suit this area a

[49:24] monopine is is a tower that's designed

[49:26] to look like a pine tree um this photo

[49:29] on the right is not a photo from this

[49:31] specific area but from a different Tower

[49:33] as you can see in the back um the

[49:35] monopine kind of Blends in with the

[49:37] surrounding pine trees

[49:42] um uh so the fall zone uh the Pinetop

[49:45] Lakeside town code under chap chapter

[49:49] 17106 stated that the applicant must

[49:53] provide a certified letter from a

[49:55] structural engineer showing that the

[49:57] structural fa failure characteristics of

[49:59] the wireless communication facility and

[50:01] demonstration that site and setbacks are

[50:03] adequate to contain debris on site um at

[50:06] the time of submitt this was the code it

[50:10] is vertical Bridges position that as

[50:13] such since it was submitted under this

[50:15] code and because the application was

[50:17] active that the old code applies to our

[50:21] site um we did provide a 20 foot fall

[50:24] zone letter to the jurisdiction um and

[50:27] on the next SL this is just a photo of

[50:30] that fall

[50:32] letter so to review preferred sites

[50:35] neutral sites and disfavored sites I

[50:37] won't go through all of the details but

[50:39] preferred sites would include the fire

[50:41] station uh across the street and then

[50:44] neutral sites is any site Zone C1 PUD or

[50:47] r

[50:48] l disfavored sites would be residential

[50:54] neighborhoods so

[50:56] I'll go ahead and Skip just to this one

[50:58] but as you can see on the zoning map

[51:00] here the star the green star on the

[51:02] slide indicates where our proposed site

[51:05] is located it's located on a parcel Zone

[51:08] C1 which is listed as a neutral site um

[51:10] our low is also listed as a neutral site

[51:14] per the code and that RV park is just

[51:17] North of our site there located on R so

[51:21] it's that's just an aerial view

[51:24] there

[51:29] back um okay so I will go ahead and let

[51:31] the RF engineer who is here speak to the

[51:33] significant Gap in service um but the

[51:37] site is uh the only preferred option

[51:40] would be the fire station that was

[51:41] approximately 500 ft away I know we had

[51:44] at our last hearing requested an

[51:46] extension to look into the fire

[51:47] department but ultimately um it did not

[51:50] work for T-Mobile which is is why we're

[51:52] back here

[51:54] today

[51:59] and then this is just an aerial view of

[52:00] the proposed

[52:03] site uh the 5year facilities plan it was

[52:07] stated that that was not included with

[52:09] our application and we just would like

[52:11] to state that we did include that um

[52:13] which had a site inventory and the

[52:16] technologies that would be included on

[52:18] the tower um and then we did have a note

[52:22] that stated that there were no existing

[52:24] Tower T-Mobile Towers or vertical Bridge

[52:26] Wireless facilities within the

[52:29] jurisdiction that that's just a photo of

[52:32] the 5year facilities

[52:37] plan and then the Pinetop Lakeside code

[52:39] does encourage collocation we did

[52:42] explore the option of collocating on

[52:44] nearby structures um and he'll go ahead

[52:47] and deep dive into that a little further

[52:49] but we did determine that this area had

[52:52] the highest need for improved coverage

[52:53] in the area and the additional height of

[52:55] the tower beyond the prescribed limit in

[52:58] the code was necessary to achieve the

[53:01] coverage objective that the initial

[53:02] inchor tenant was looking to achieve um

[53:25] the Wireless Communications industry um

[53:27] can you bring up the RF

[53:29] justification

[53:39] deck that's the alternate side analysis

[53:42] try the other

[53:52] ma'am okay once again um talking about

[53:55] the RF design analysis for the T-Mobile

[53:58] site for vertical Bridge so I'm an

[54:00] independent Consulting RF engineer I do

[54:02] not work for T-Mobile I represent

[54:04] vertical bridge and consult with the

[54:06] T-Mobile

[54:11] Engineers okay so two reasons why

[54:13] carriers design sites as your Sheriff

[54:15] stood up in front of you a little while

[54:17] ago and said that their four sites need

[54:18] to be about 20 it's infrastructure but

[54:22] the need is there so just like the

[54:25] sheriff's department wants to expand the

[54:26] radio network for First Responders the

[54:29] carriers want to expand their networks

[54:30] to provide service for their customers

[54:32] two types of things that create a need

[54:34] for a site one is coverage and that is

[54:37] the ability for a transceiver on a sell

[54:39] site to talk to the transceiver in the

[54:41] phone and have a connection and be able

[54:43] to follow through that connection

[54:45] without a drop call or without a loss of

[54:47] signal that's coverage capacity is the

[54:50] ability to process the traffic for the

[54:53] wireless phones now when I started this

[54:55] business 34 years ago all you could do

[54:56] on a phone was talk now we do a lot more

[54:59] with them we stream videos we do web

[55:01] searches there's apps like crazy on

[55:03] these things that cost capacity that

[55:06] cost throughput capacity and throughput

[55:08] or capacity can be explained um use an

[55:12] analogy of a water hose so if you have a

[55:14] water hose in your front yard you're out

[55:15] work in front yard one day you're the

[55:18] only person drinking from the water hose

[55:19] you're getting 100% of the capacity all

[55:21] the bandwidth is available to you if

[55:23] your neighbor walks up and says hey I

[55:25] want to grab water off the water hose

[55:27] too now the capacity is

[55:29] 50% you add two more neighbors drops to

[55:33] 25% four more neighbors it drops to 12

[55:36] half% down down down so the more users

[55:38] the less water or capacity per user

[55:41] there is these sites can work three to

[55:44] 400 users at a time because these phones

[55:46] while you may not be active on the phone

[55:48] it's active talking to servers and

[55:50] networks because of all the apps you're

[55:52] running on your phone so that's the

[55:54] capacity the

[56:00] impact all right so the objective new

[56:02] site is provide bandwidth for customers

[56:03] in the area provide coverage for

[56:05] T-Mobile users in this area because

[56:07] there's no T-Mobile coverage at this

[56:09] time so this site would provide coverage

[56:10] along 260 in the feder roads in the area

[56:12] where we have a significant Gap in

[56:14] service or no service 96% of Americans

[56:17] own a cell phone 57% of American homes

[56:20] rely exclusively on cell phones and 84%

[56:23] or more of 911 emergency calls are made

[56:25] from cell

[56:32] phones uh site 175t monopine with 5ft

[56:36] apperances all that's all the technical

[56:38] data latitude longitude ground elevation

[56:40] and the antenna center line for

[56:41] T-Mobile's

[56:43] 171 why here lack of coverage in Pine

[56:46] Top lack of services in surrounding R

[56:48] suburban and rural areas there's a

[56:50] significant Gap in service IE T-Mobile

[56:52] has no service in the area uh there's a

[56:55] been a significant amount of increased

[56:56] Network use for all the networks across

[56:58] rural Arizona just because of Co and a

[57:00] lot of people working from home and

[57:02] that's really put Demand on a lot of

[57:04] these networks and as you guys probably

[57:06] are proving new homes being built and

[57:08] all sorts of fun stuff it's it's

[57:10] expanding in the rural areas here's

[57:12] Zumer proposed

[57:14] site uh there's the nearest neighbor

[57:16] T-Mobile sites they're 53.5 miles away

[57:19] and 63.7 miles away so uh T-Mobile's

[57:23] working to expand that but this is one

[57:25] of the the key sites for that this is

[57:28] T-Mobile cell mapper this is coverage

[57:30] that's provided by drive test units or

[57:33] uh vans that drive around and they take

[57:34] readings across the United States and

[57:36] they they have a bunch of antennas on

[57:38] the top of Van bunch of phones and

[57:39] they'll go take readings and report this

[57:41] back to servers this is showing that

[57:44] there is nothing for T-Mobile in the

[57:46] area basically not even enough to to

[57:49] cause a receiver to go into full

[57:51] quieting this is open signal this is uh

[57:54] um so if you ever load an app on your

[57:56] phone like Facebook or something you're

[57:57] giving all these permissions for

[57:59] Facebook to load this stuff on your

[58:00] phone you're going to load a thin client

[58:03] and that's open signals Thin Client what

[58:04] that Thin Client does is it sends to

[58:07] open signal servers hey the telephone

[58:11] connected to the network that did some

[58:12] business and the coverage was good or

[58:14] the coverage was bad and we can see from

[58:17] this that it's significantly

[58:21] Laing this is uh

[58:26] reference signal receive power this is a

[58:28] way that we show coverage in a digital

[58:31] Network or a Broadband Network so green

[58:34] means to a 95% probability that there's

[58:37] going to be service inside a building so

[58:40] you've got all the walls you've got all

[58:41] the things that that can pass through uh

[58:44] and and slow down the the signal and not

[58:46] allowed entry so green when it runs a

[58:49] propagation modeling it's showing that

[58:51] you you're going to have to a 95%

[58:53] probability coverage indoors if you see

[58:55] yellow that's in vehicle and if you see

[58:58] red that's open field you're out the

[59:00] golf course you're out in your front

[59:01] porch you're you're you're not not

[59:04] inside or not in a vehicle this is for

[59:07] low band and to make note 85% of

[59:10] T-Mobile Spectrum as allocated by the

[59:12] Federal Communications Commission is

[59:14] midband so this is low band uh so there

[59:18] it it provides a greater service the the

[59:20] RF the radio energy propagates

[59:23] farther we go to the midband we see A

[59:25] Change midband Is significantly smaller

[59:28] so 85% of the spectrum this is what the

[59:31] coverage it's going to provide where 15%

[59:34] of the

[59:36] spectrum I put a blue circle in to give

[59:38] kind of a reference of what the low band

[59:42] versus the midband is doing okay that's

[59:44] the last of that one the next thing that

[59:47] I was requested to do was an alternate

[59:48] side

[59:53] analysis

[1:00:07] that's

[1:00:13] it okay so uh I was requested to review

[1:00:16] other sites within the area at the

[1:00:17] heights that were available on those

[1:00:19] sites uh compared to the proposed by

[1:00:21] T-Mobile vertical Bridge so the local

[1:00:24] Juris required this two towers exist

[1:00:26] within 1.25 miles the proposed primary

[1:00:29] coverage objective is Highway 260

[1:00:31] towards pentop Lakeside and south and

[1:00:33] east of the proposed towards the country

[1:00:34] club the following propagation is for

[1:00:37] low band as well as midband just like we

[1:00:39] did before so here's the area so there's

[1:00:42] the distance from the proposed to the

[1:00:44] other SES one other site's 8 Miles Away

[1:00:47] the other one is 1.23 miles

[1:00:50] away so alternate site one owned by

[1:00:53] White Mountain Communications 50ft self

[1:00:55] support Tower highest height available

[1:00:57] was 110 ft so it's not you're not be

[1:01:00] able to put the antennas at the top

[1:01:01] Tower because somebody's already there

[1:01:03] ground elevation

[1:01:05] 6,961 ft alternate site to owned by

[1:01:09] navapache Electric Company 196t self

[1:01:12] support Tower highest height available

[1:01:14] is 130 ft that's at 7178

[1:01:19] amsl uh the jurisdiction also requests

[1:01:21] the proposed intentas be lower to 71 fet

[1:01:23] above ground ground level and compare to

[1:01:25] the

[1:01:26] proposed so this is the first low this

[1:01:29] is low band so if we look at the blue

[1:01:31] circle this is what the proposed site's

[1:01:33] going to be able to provide within 171

[1:01:36] ft in tenis Center Line for low

[1:01:38] band this is 10t on the site to the West

[1:01:43] so we can see a slight difference in

[1:01:45] what's what's being covered on the

[1:01:48] frequencies and then we get alternate

[1:01:50] two that's low band on for that site so

[1:01:53] we can see that it's going to be you

[1:01:55] know coverage in the Southeast but not

[1:01:58] coverage towards the center or the West

[1:02:01] within the when the primary coverage

[1:02:07] objective all right uh then we looked at

[1:02:10] proposed 71 ft so we lowered the antenna

[1:02:13] height from 171 down to 71 and that

[1:02:16] shows the difference in propagation

[1:02:17] analysis if you remember on the 171

[1:02:20] significantly more green and yellow

[1:02:21] within the blue circle so a significant

[1:02:25] drop in what the site would do at 71

[1:02:29] ft this is midband so 171 we saw that

[1:02:33] it's it's midband it's not going to

[1:02:36] propagate into the buildings quite as

[1:02:38] well uh just because the wavelength

[1:02:40] that's working out here's the RC RP

[1:02:43] coverage for the 110t

[1:02:46] alternate there's the RC RP coverage for

[1:02:49] the alternate number

[1:02:51] two and there's the rsrp coverage for 71

[1:02:58] ft so alternate sites do not provide the

[1:03:01] same level of service as the proposed

[1:03:03] Heights available in the alternates are

[1:03:04] not as high as the proposed uh

[1:03:07] alternates impact the coverage of low

[1:03:08] Band frequencies and significantly

[1:03:10] impact coverage of high band or midband

[1:03:12] frequencies and you get into 3,800 to

[1:03:14] 4200 megahertz and it it really makes an

[1:03:16] impact and then the reduction in height

[1:03:18] to 71 significantly reduces what the

[1:03:20] site can do so recommended uh please

[1:03:24] approve the proposed site at the hype in

[1:03:26] order for team

[1:03:27] M area I stand for questions thank you

[1:03:33] questions councelor snitzer uh yeah the

[1:03:36] backend um I don't begin to understand

[1:03:39] all the technical stuff but back in uh

[1:03:41] in

[1:03:42] October uh I made a request and they

[1:03:45] said they would comply and it's not here

[1:03:50] U my request was uh everything that was

[1:03:52] presented showed

[1:03:54] what happens if you have one Tower and

[1:03:58] my request was that if we have the

[1:04:01] existing towers and we use both of those

[1:04:05] towers and mount uh their equipment on

[1:04:07] both of those Towers what would the

[1:04:09] coverage look like then uh the coverage

[1:04:13] would be a probably 80% of what the

[1:04:17] proposed site would do the 80% of what

[1:04:20] the one single tall tower yes sir okay

[1:04:22] so they could basically get it at least

[1:04:24] 80% there uh if they added a third short

[1:04:28] Tower if they built the Tower in the

[1:04:30] middle uh and it was a short Tower which

[1:04:34] is whatever is permitted I forget 79 80

[1:04:37] whatever it is feet but if you had those

[1:04:39] three towers what would the coverage

[1:04:41] look like any idea coverage would be

[1:04:43] comparable but once again team Hubble's

[1:04:45] trying to do it with one one asset

[1:04:47] versus three asset well it's yeah it's much uh from a financial standpoint

[1:04:51] I understand it's easier to have a few

[1:04:54] big tower yes sir but it sounds to me

[1:04:57] like they could get where they want to

[1:04:59] get if they built a small Tower and then

[1:05:03] rented space on the other two towers is

[1:05:05] that right yes sir okay thank you yes

[1:05:07] sir any other questions any other

[1:05:09] questions for

[1:05:14] I would like to invite Jeremiah to come

[1:05:16] back up please go over what you've got

[1:05:19] for

[1:05:21] us so we had a third party RF engineer

[1:05:25] um basically run the numbers on the same

[1:05:28] site and interestingly enough the um RF

[1:05:32] engineer that we selected to do this was

[1:05:34] a had worked for T-Mobile for 20 plus

[1:05:38] years uh and I don't proport to

[1:05:40] understand all of this information

[1:05:42] that's in here either uh councelor

[1:05:43] snitzer but I'll do my best to convey it

[1:05:45] to the uh members of the board um so

[1:05:49] they basically ran the same numbers and

[1:05:52] some of the comments that they made were

[1:05:54] the values provided by the applicant

[1:05:55] were listed as rsrp th though the

[1:05:58] provided values were much higher

[1:06:00] strength than the applicant's typical

[1:06:01] design

[1:06:02] thresholds um and they go and they they

[1:06:06] as the maps that you sh that the the

[1:06:08] applicant showed they have some similar

[1:06:10] but they're slightly different and

[1:06:12] hopefully the board had time to review

[1:06:14] those they're also available in the

[1:06:17] packet for anybody interested at home or

[1:06:19] in the audience you can view them

[1:06:21] digitally um but some of the through the

[1:06:24] general discussion and the concerns that

[1:06:26] they had they said that the proposed

[1:06:29] location provides indoor coverage of the

[1:06:30] areas in Pinetop along Highway 260 from

[1:06:33] Sweetwater Ranch to the west to just

[1:06:34] past Buck Springs road entrance into the

[1:06:36] White Mountain summer homes and pine

[1:06:38] toop Lakes Country Club Pine toop Lakes

[1:06:40] has some indoor service but mostly in

[1:06:41] vehicle coverage along Buck Springs to

[1:06:43] Branding Iron Loop White Mountain

[1:06:44] Country Club is Not serviced well

[1:06:47] coverage is mostly local to the

[1:06:48] businesses along the Highway 260 the

[1:06:50] majority of which are to the west of the

[1:06:52] proposed Tower location tower Tower the

[1:06:55] wiscom tower area that's actually been

[1:06:57] purchased by Tower co uh the

[1:06:59] improvements in coverage to the east and

[1:07:01] south over the wiscom tower results from

[1:07:04] increased ground elevation of 7170 at

[1:07:07] the proposed location vers 6960 at the

[1:07:10] wiscom tower plus the increased rad

[1:07:13] Center of 171 versus

[1:07:15] 117 available at wisecom a total of 165

[1:07:18] ft increase in antenna height however

[1:07:20] the wise the wisecom tower as shown

[1:07:23] later provides better Target coverage

[1:07:25] around the business areas of pint

[1:07:26] toop uh some of the concerns the rsrp

[1:07:30] design points are little on the high

[1:07:32] side the 85 uh dbel mowatt rsrp for

[1:07:36] indoor service is more typical of

[1:07:38] commercial areas rather than rural areas

[1:07:40] in pintop residential indoor services

[1:07:42] for five megahertz carriers at 700 MHz

[1:07:46] is more along the lines of um 100 to 105

[1:07:50] D mows with many models showing to dbm

[1:07:54] and the link budget the covered areas

[1:07:57] have good population densities however

[1:07:58] the areas include very highly attended

[1:08:00] areas during the summer activities uh in

[1:08:03] this area and they're speaking

[1:08:05] specifically of the wiscom tower one

[1:08:07] sector of the proposed site will cover

[1:08:10] the general Pinetop area including

[1:08:11] businesses and residential areas one

[1:08:13] sector of the proposed site covers the

[1:08:15] Pinetop lakes and Pinetop Country Club

[1:08:17] areas one sector of the proposed site

[1:08:19] covers the residential areas of Woodland

[1:08:20] Hills and White Mountain Country Club

[1:08:23] the same services areas are provided by

[1:08:25] multiple sites by all the cellular

[1:08:26] providers in the area and such as

[1:08:29] Verizon at and cellular 1 use the other

[1:08:31] three sites they're functionable a

[1:08:34] single Tower location so hopefully that

[1:08:37] speaks to your question a little bit um

[1:08:39] a single Tower location may not provide

[1:08:41] sufficient capacity for the area and

[1:08:43] additional Tower locations will

[1:08:44] eventually be investigated by the

[1:08:46] applicant tier one carriers Verizon AT&T

[1:08:49] mobile Point their annual Capital spend

[1:08:51] to populated metropolitan areas Ro areas

[1:08:54] are typically the last areas to Beed

[1:08:56] which typically increases the time

[1:08:57] required to fix service problems

[1:08:59] congestion issues and lead to block

[1:09:01] calls and slow data through put speeds

[1:09:03] drop calls due to the areas of impaired

[1:09:05] services and and other concerns um then

[1:09:08] they go on to show some of the maps run with the numbers that they used and

[1:09:13] they're similar but they vary a little

[1:09:15] bit they show um the RSI RSSI approach

[1:09:20] and um using typical design values

[1:09:24] and then uh part of their analysis they

[1:09:26] state that the specifications provided

[1:09:28] by the applicant included only Spectrum

[1:09:30] owners by another entity the SL s

[1:09:34] Spectrum through this spectrum may have

[1:09:36] been so though the Spectrum may have

[1:09:38] been sold or leased to T-Mobile Sal

[1:09:40] Spectrum also owns or owned the B Block

[1:09:42] meaning the prediction should be run for

[1:09:44] 10 mahz LTE carrier rather than 5 MHz

[1:09:47] bandwidth and that concludes the third

[1:09:50] party

[1:09:51] analysis thank you Jeremiah does anybody

[1:09:54] have any questions for

[1:09:55] Jeremiah just more of an observation um

[1:10:00] if I'm looking at these Maps right and I

[1:10:02] don't I don't report to understand them

[1:10:05] but um understanding what was said the

[1:10:08] green area is where we're getting our

[1:10:09] coverage and this is on the low Band

[1:10:11] frequencies and I'm I'm looking at this

[1:10:13] and just comparing in my head where my

[1:10:16] house is versus where this Tower is

[1:10:18] going to go we're talking like a three

[1:10:20] mile stretch of highway and a whole

[1:10:23] bunch of land where nobody lives and a

[1:10:27] huge isore right off the the side of the

[1:10:30] highway in the middle of town for and I

[1:10:32] don't I don't understand the purpose

[1:10:34] there's barely any residential area that

[1:10:36] gets good coverage from this

[1:10:38] site that was kind of my observation as

[1:10:41] well councelor Heiser moving the site

[1:10:44] over there gives more elevation but then

[1:10:46] a big part of the area have the uh

[1:10:50] greatest effect on is basically forest

[1:10:52] service and uh not develop land so it's

[1:10:56] curious as to exactly why this site was

[1:10:58] selected as opposed to somewhere

[1:11:01] else thank you for your observations

[1:11:03] anybody else just I I I think there

[1:11:06] there's an obvious economic benefit to a

[1:11:09] single big tower it it's less costly

[1:11:12] than multiple Towers plus it gives you

[1:11:14] the opportunity down the road to sell

[1:11:17] space like what we're talking about

[1:11:19] lower down on the same Tower to other

[1:11:21] entities so but from the stand point of

[1:11:24] providing service as opposed to

[1:11:27] maximizing profitability you can provide

[1:11:30] roughly equivalent service with multiple

[1:11:33] Towers so if we if we um deny this we

[1:11:38] might be imposing a financial hurdle but

[1:11:41] we're not making it impossible to serve

[1:11:44] people in a certain area and um and then

[1:11:47] you know so I think um I think the

[1:11:51] things that we've asked for generally

[1:11:53] speaking but the thing I asked for in

[1:11:56] particular um they have not been very

[1:11:58] responsive to uh to our request for

[1:12:02] information or to the requirements from

[1:12:03] our codes um and and I don't think we

[1:12:07] are imposing anything more than uh you

[1:12:10] know lowered profitability if we say

[1:12:14] yeah you've got to have a small Tower in

[1:12:16] the middle that meets our requirements

[1:12:17] and use the existing Towers I think that would make a feasible solution for

[1:12:23] every body just not the highest

[1:12:28] profitability thank you go ahead and to

[1:12:30] that point part of the point I was

[1:12:33] trying to make was it seems as though

[1:12:34] they're going to have to have multiple

[1:12:36] Towers in the area anyways to meet the

[1:12:38] coverage need if the really the end goal

[1:12:40] is to provide coverage to the community

[1:12:42] because this does not do that right and

[1:12:45] that was one of the observations of our

[1:12:47] third party RF analysis uh RF engineer

[1:12:49] as well that uh this this Tower alone

[1:12:52] wouldn't uh

[1:12:53] provide coverage for the for the area so

[1:12:57] they eventually would seek more

[1:13:00] towers do do we have I know the

[1:13:03] progression the technology progression

[1:13:06] you know 5G and all this has been to uh

[1:13:09] more smaller

[1:13:11] Towers um does that is that only for

[1:13:15] urban areas or something like that

[1:13:17] looking I'm asking you to look down to

[1:13:19] the future I can't even imagine but the

[1:13:21] does the progression of Technology

[1:13:23] indicate that these big tall towers

[1:13:25] won't be required as much in the future

[1:13:28] um I may defer that question to an

[1:13:30] actual RF engineer being a civil

[1:13:31] engineer but I can tell you what I've

[1:13:33] seen um from the standpoint of

[1:13:36] engineering from civil engineering in in

[1:13:38] um Metropolis or greater Phoenix area I

[1:13:41] have uh another civil engineer on my

[1:13:44] commission and he's we had the

[1:13:46] conversation he said what they're doing

[1:13:47] down in the valley for instance is

[1:13:49] putting a bunch of towers on a light so

[1:13:51] you don't it's why when you go down

[1:13:52] there you don't see one every half mile

[1:13:54] of these 180t towers number one they

[1:13:57] don't have the same elevation obstacles

[1:13:58] or trees that we have but they're they

[1:14:01] have the ability to put these on lights

[1:14:02] anywhere and I think that at one point

[1:14:04] in our code the intent was looking

[1:14:06] forward that that was the direction that

[1:14:08] the industry was going and and correct

[1:14:09] me if I'm wrong but it appears that um

[1:14:12] our code was looking towards that

[1:14:14] direction but um I think that the

[1:14:16] service up here um May May preclude that

[1:14:20] number one based on we don't have the

[1:14:22] light capacity that cities do and we

[1:14:24] have all the elevation Deltas but you

[1:14:26] can explain more if you'd like so you're

[1:14:28] referring to small cells they're

[1:14:30] typically sites that are anywhere from

[1:14:33] 20 feet tall to 32 to 35 ft tall

[1:14:37] depending on the depending on the height

[1:14:39] of the light pole or the street uh

[1:14:41] traffic signal light so we see a lot of

[1:14:43] the small cells in areas where there's a

[1:14:45] lot of capacity so for example last

[1:14:48] year's Super Bowl at State Farm Stadium

[1:14:51] um I was hired to design about 50 small

[1:14:54] cells covering in and around that

[1:14:56] stadium so why so many small cells when

[1:14:59] there was already macro coverage that

[1:15:01] was because the amount of users within

[1:15:02] that area were very tight condensed

[1:15:05] packed small areas so you got a site

[1:15:08] that covers maybe two blocks so in a

[1:15:11] area like a college or downtown Phoenix

[1:15:14] or downtown Chandler or larger

[1:15:18] metropolitan areas you're going to see

[1:15:20] small sales and basically their capacity

[1:15:22] fixes so they're all ing mobiles to not

[1:15:24] talk to the macro but switch down to the

[1:15:26] small cell even though the coverage area

[1:15:27] is smaller so it does really good where

[1:15:29] there's slow traffic or a lot of walking

[1:15:31] colleges a lot of college kids love

[1:15:33] these phones so that's where you see

[1:15:35] small cells uh in order to have small

[1:15:38] cells you have to have existing macro

[1:15:40] coverage or large sight coverage to be

[1:15:42] able to do that yeah I wasn't exactly

[1:15:44] thinking of I was more thinking in a in

[1:15:46] a general sense the the years ago um I

[1:15:51] was working on a designing an

[1:15:53] agricultural tractor and all the gauges

[1:15:56] were analog gauges at that time uh but

[1:16:00] my program wasn't going to happen for 5

[1:16:02] years and we could see that five years

[1:16:04] down the road uh digital Technologies

[1:16:08] cost you know the cost curve would come

[1:16:10] down and uh so so the time that I was

[1:16:14] putting this together was prohibitive to

[1:16:16] do what I wanted to do but by the time

[1:16:18] we got there 5 years later it was

[1:16:21] cheaper and better and all that so so

[1:16:23] Mike it's sort of a general question do

[1:16:25] we see technology changing we're um not

[1:16:30] necessarily a little Tower every you

[1:16:32] know couple hundred yards but but uh

[1:16:35] something like uh you know using Towers

[1:16:37] but just not needing not even needing

[1:16:44] physics and how radio frequencies

[1:16:46] propagate um it's kind of like you guys

[1:16:54] everybody sitting in the chairs behind

[1:16:55] me so you have the ability to see

[1:16:57] everything better than what we have we

[1:16:59] have the ability to see you because

[1:17:01] you're elevated higher than what we are

[1:17:03] in the crowd same concept for antennas

[1:17:05] if you take your pair of eyes and you

[1:17:07] say I'm going to turn them into antennas

[1:17:09] all right are they going to work better

[1:17:11] up here near the top of my head where

[1:17:13] God put them or are they going to work

[1:17:15] better at my

[1:17:16] ankles so the laws of phys physics come

[1:17:18] into play with radio frequency

[1:17:19] properties but there's you know there's

[1:17:21] still it's like that that what used to

[1:17:23] be true in radio communications but they

[1:17:26] just found a way to to bring a ground up

[1:17:30] uh so that the basically the signal the

[1:17:33] signal was propagating from a higher

[1:17:36] level and covered more distance I it's

[1:17:38] just I mean I again I don't begin to

[1:17:40] understand the technology but do you see

[1:17:43] any uh any shift toward guys being able

[1:17:48] to solve the problem of getting cover I

[1:17:49] mean whoever does it will make a lot of

[1:17:52] money um you get of getting better

[1:17:56] coverage without having a tall tower

[1:17:58] don't see that once again it comes into

[1:18:00] play with laws of physics and terrain

[1:18:02] and morphologies and clutter data and

[1:18:05] trees and all those wonderful things

[1:18:07] that stop RF it's a physics

[1:18:10] thing any other

[1:18:54] stick out like a a sore thumb next thing

[1:18:57] I saw was a they have a 20ft fall zone

[1:19:01] well if you have 180 ft Tower and it

[1:19:03] falls over and it falls over white mine

[1:19:06] Boulevard what good is a little 20x 20

[1:19:08] fall zone going to do and the thing I

[1:19:11] never saw they talk about T-Mobile

[1:19:14] expanding their their marketing in this

[1:19:16] area did anybody see any any input as to

[1:19:19] what T-Mobile currently has in the

[1:19:22] October fire remember somebody asked who

[1:19:24] had T-Mobile nobody raised their hands

[1:19:27] so here we're supposed to put a tower in the hopes that T-Mobile is going to

[1:19:31] expand their business so I for me I

[1:19:34] still don't think it's a great idea

[1:20:29] um I don't think that the due diligence

[1:20:31] has been done by this company they had

[1:20:34] 90

[1:20:35] days couldn't F could not uh respond

[1:20:41] back within the 90 days they missed

[1:20:43] their

[1:20:44] deadline and really in my opinion has

[1:20:47] not explored other options we've got uh

[1:20:50] Chief Morgan I was talking to him and

[1:20:52] he's been talked to there there was an

[1:20:54] option of T-Mobile joining with them and

[1:20:58] they had a deadline of today to either

[1:21:01] agree or

[1:21:03] disagree and from what I understand they

[1:21:06] either did not uh get back with them at

[1:21:10] all or um they they uh turned it down so

[1:21:15] it was an option that was right across

[1:21:19] the street that was given to them and

[1:21:22] they're still turning it down they're keep pounding this one

[1:21:26] location and I'm I'm representing the mobile home park and this

[1:21:31] Tower the base of this Tower

[1:21:34] unfortunately for

[1:21:36] me is 38 ft from the corner of my

[1:21:41] personal mobile home and like I was can

[1:21:45] you put your paper down so we can pick

[1:21:47] you up on our thank you okay that red

[1:21:51] you so it's 38t from the base of of of

[1:21:55] where I live and uh i' I've showed you

[1:21:57] guys pictures I I put out uh different

[1:22:00] presentations with pictures a lot of

[1:22:02] different information and for me I'm not

[1:22:06] going to be going out and

[1:22:08] looking out at a tower I'm going to have

[1:22:12] to actually see this Tower I'm going to

[1:22:14] actually have to go outside and look

[1:22:15] straight up at 180t Tower and and the

[1:22:19] fall

[1:22:20] zone is just you yeah

[1:22:25] it's Jeremiah has talked about uh if and and hope and in perfect world

[1:22:32] situations that's just that's just

[1:22:35] BS

[1:22:36] um I've got uh I'm I'm supposed to be

[1:22:47] uh we had over a hundred uh signatures

[1:22:50] of of people before that are are against

[1:22:54] this um this was back when the mobile

[1:22:57] home park was actually open it's it's

[1:23:00] normally the majority of my people are

[1:23:02] only there for six

[1:23:03] months

[1:23:05] uh and so the other six months of which

[1:23:08] we are in right now they're not here and

[1:23:11] not representing uh but we had 100 100

[1:23:14] over a hundred uh residents that signed

[1:23:17] that uh a lot of this

[1:23:19] stuff he's covered we've covered

[1:23:23] Jeremiah's covered talking about the

[1:23:26] uh applicant doesn't provide the entire

[1:23:29] area the proposed

[1:23:31] facility uh justification as to why they

[1:23:35] don't have a preferred site uh of which

[1:23:38] the site on uh 2666 East White Mountain

[1:23:43] Boulevard it does not have enough space

[1:23:48] to do everything that they want if if it

[1:23:51] was the the the land itself with nothing

[1:23:54] else on that land it still wouldn't be

[1:23:57] enough for the tower they had a nice

[1:23:59] little Tower picture up there with the

[1:24:01] uh uh the little gazebo in

[1:24:05] there I did not see any properties that

[1:24:07] were 38 ft from the base of that Tower

[1:24:10] in that little picture picture you

[1:24:13] had

[1:24:15] uh say we've covered a lot of this um

[1:24:19] talked about Chief Morgan just talked to

[1:24:22] him tonight they never got back with

[1:24:23] them on a different

[1:24:26] option uh applicants said that they

[1:24:29] talked with the fishing game fishing

[1:24:31] game had no knowledge whatsoever of them

[1:24:34] contacting them at

[1:24:36] all doesn't qualify for a neutral site

[1:24:40] uh points that have already been made

[1:24:42] that I'm just going to touch on they

[1:24:43] missed the deadline the new setback is

[1:24:47] in effect now even though they they say

[1:24:49] that it wasn't in effect at the time it

[1:24:52] was uh it was denied at the time and

[1:24:57] they were supposed to show why it uh why

[1:24:59] it was supposed to be a good

[1:25:01] idea uh David can you kind of wrap up a

[1:25:04] little bit please okay that's about

[1:25:06] that's it's just not enough room in the

[1:25:07] tower and it's too close the fall zone

[1:25:10] is just it's

[1:25:12] not and so I definitely request that you

[1:25:16] uh turn it down thank you very much for

[1:25:48] T-Mobile but I just don't think that that Tower belongs in our

[1:26:03] our friends are elderly and it's going

[1:26:05] to cause them health problems and I just

[1:26:09] think that you made the right decision

[1:26:11] in October and I hope that you find us

[1:27:19] the FCC rules regarding health and

[1:27:21] Towers just real quick cuz I I mean want

[1:27:24] people understand that we're listening

[1:27:25] to what they say but we're also

[1:27:27] precluded from right and I mentioned

[1:27:29] that uh in my staff report that

[1:27:33] basically U you can't take into

[1:27:35] consideration health effects if it uh um

[1:27:40] Falls within the guidelines provided by

[1:27:43] the federal government um so basically

[1:27:46] that rules out that component as part of

[1:27:49] um the decision making process thank you make a

[1:27:56] motion board member oh councelor

[1:27:59] Phillips board member Phillips I guess I

[1:28:01] appreciate the fact that they uh

[1:28:03] provided the maps and all that and I I

[1:28:05] reviewed all that stuff and uh but me

[1:28:08] I'm a visual guy I actually took a drive

[1:28:11] out there this last week myself in my

[1:28:13] truck and where the proposed Tower uh

[1:28:17] would

[1:28:18] be I understand where you're saying 38

[1:28:21] ft is right on top of the the real close

[1:28:24] to those mobile homes and uh the 20ft

[1:28:27] Falls them seems to be a

[1:28:31] little

[1:28:33] underestimated and I would agree with

[1:28:35] that statement and that's why we brought

[1:28:36] forward after I after this came to my

[1:28:38] attention um having worked at a

[1:28:40] municipality that had at least a one: U recommendation that was what the

[1:28:45] commission um brought forward I

[1:28:48] initially proposed a 2:1 uh ratio the

[1:28:51] commission went with a 1 to one and then

[1:28:53] ultimately the council decided that uh a

[1:28:56] 1 and a quarter would be more signific

[1:28:58] or more uh substantial be able to cover

[1:29:01] things like maintenance and uh safety

[1:29:05] for uh residents around the area and uh

[1:29:08] did have this conversation with the town

[1:29:09] attorney and he's of the opinion that

[1:29:11] this is an effective ordinance and it

[1:29:13] was effective as of uh February 5th

[1:29:15] which was three days after they were

[1:29:17] supposed to be here for their 90-day

[1:29:19] appeal that was granted uh from the

[1:29:22] board in

[1:29:23] November thank you any other comments I

[1:29:26] guess I would ahead I'm a kind of a

[1:29:29] practical guy and we have a reason for

[1:29:33] the height that we have in our

[1:29:35] ordinances and this is way above that um

[1:29:40] I I understand why because the higher

[1:29:43] you get the farther you can transmit you

[1:29:45] know it's but you know technology is

[1:29:47] line of sight so I understand that uh um

[1:29:52] but from a really practical standpoint

[1:29:55] how can you expect a tower to fall

[1:29:57] that's 180 ft tall if it's strong enough

[1:30:00] to stand up it's probably strong enough

[1:30:02] to fall that

[1:30:04] way it's 180 ft you know fall radius to

[1:30:08] me right I I don't I don't see how they

[1:30:11] could do it in 20 ft unless it's a

[1:30:13] collapsible thing so they they in a

[1:30:15] nutshell they design a weak spot into

[1:30:17] the tower so the top 20 ft there's a

[1:30:22] they do a finite element analysis and

[1:30:25] they design it so there's essentially a

[1:30:27] weak spot there and in a perfect world

[1:30:29] the top would just fall off but we don't

[1:30:30] live in a perfect world there's

[1:30:31] potential and even as identified in

[1:30:33] their own fall zone letter for it to

[1:30:35] fall outside exactly that that's my

[1:30:37] point you

[1:30:39] know theoretically it might but probably

[1:30:42] won't fall within that 20 foot if there

[1:30:44] was a catastrophic failure it would fall

[1:30:47] the entire Tower would fall uh and

[1:30:49] probably roll even further than 180 ft

[1:30:52] yeah and I used to live in the little in

[1:30:54] that park by the

[1:30:56] way in the

[1:30:59] summertime yes go ahead councelor for me the main point just as as it has

[1:31:05] been since October is uh the and and you

[1:31:11] know and i' asked for him to bring this

[1:31:13] out they brought it out but only when I

[1:31:15] ask again they didn't volunteer the

[1:31:18] information and that is that they can

[1:31:20] provide uh

[1:31:22] essentially 100% of the same coverage by

[1:31:25] using two of the existing towers and

[1:31:27] renting space on them and building a

[1:31:30] conforming Tower at this location so so

[1:31:33] I don't see a need other than a

[1:31:35] financial need but there's no physical

[1:31:38] need the technolog is in place and uh

[1:31:41] you know a short Tower here and the

[1:31:43] other two towers would meet the needs so

[1:31:46] um you know for you know in addition to

[1:31:49] these other reasons I would say that

[1:31:51] because there's another way to meet the

[1:31:54] need thank you anything else um as did

[1:31:59] board member Phillips I have taken a

[1:32:01] tour of that um mobile home park and I

[1:32:06] know exactly where that Tower would be

[1:32:07] in relation to these folks homes and I

[1:32:09] just think that's way too close I mean

[1:32:11] we we thought about this when we

[1:32:13] implemented the

[1:32:14] 1.25 fall zone 1.25 to one so I think we

[1:32:19] are we are well aware of that and um

[1:32:22] also I want to address the 5G topic that

[1:32:25] came up on the shorter Towers I believe

[1:32:27] when we put that in our code it was an

[1:32:28] FCC regulation that we address that

[1:32:31] somehow in our code and so we were

[1:32:33] proactive in doing that even though that

[1:32:35] technology I don't believe is up here

[1:32:36] yet so that's why you know just for the

[1:32:39] Public's knowledge that's why that is in

[1:32:40] our code so I I too do not believe this

[1:32:44] is a great place for this proposed tower

[1:32:47] now the the technology I mean it's uh

[1:32:51] you know we went went away from from

[1:32:52] microwave as an example we went away

[1:32:54] from microwaves old technology were

[1:32:57] going to go to a new technology and then

[1:32:59] people figured a way to what they call

[1:33:02] multiplexing microwav so you have you

[1:33:05] know instead of it being able to carry

[1:33:07] one communication it can carry multiple

[1:33:09] Communications and all of a sudden

[1:33:11] microwaves have come back into the mix

[1:33:14] especially because there are places that

[1:33:16] suffer from low low uh internet service

[1:33:20] through the normal me so that like the

[1:33:22] hospital has a microwave link now in

[1:33:25] case everything goes wrong they still

[1:33:27] have a way to get in and out um so you

[1:33:30] know the Technologies keep

[1:33:32] changing thank you is there any further

[1:34:05] of meeting the requirements established

[1:34:07] within 17106 070 B3 regarding contact

[1:34:12] with all other Tower providers Property

[1:34:13] Owners within the preferred sites the

[1:34:16] applicant failed to submit a fall zone

[1:34:17] letter that exemplifies confidence that

[1:34:19] the tower would not harm residents at

[1:34:21] the RV Park in the event of catastrophic

[1:34:24] failure the applicant failed to locate

[1:34:26] the site away from residential

[1:34:27] neighborhoods per 17106

[1:34:30] 010b the applicant should have

[1:34:32] considered the requirements outlined in

[1:34:34] 17106 030 F requiring wireless

[1:34:37] communication facilities to be site

[1:34:39] cited and constructed to preserve the

[1:34:42] pre-existing character of the

[1:34:43] surrounding buildings and vegetation

[1:34:45] while the site is neutral it is

[1:34:46] immediately adjacent to an RV park the

[1:34:49] request is deficient as a land scaping

[1:34:51] plan in conformance with

[1:34:54] 17130

[1:34:57] F4F was not submitted Tech lighting does

[1:35:00] not meet the requirements established

[1:35:02] within

[1:35:03] 1704100 and 17106 030 D the proposed

[1:35:08] site does not meet the effective

[1:35:09] setbacks for wireless communication

[1:35:11] facilities established within 17106

[1:35:16] 0402 thank you I'll second that thank
